“Who needs a wall?

Less than a year into his presidency, Donald Trump is moving swiftly to reshape the nation’s immigration system in more concrete ways, curtailing illegal crossings at the U.S.-Mexico border and sending a chill throughout Central America.

In a stark reversal from the Obama era, the administration has ramped up round-ups of undocumented immigrants regardless of age or criminal history, expanded detention space and stepped up workplace raids. Officials have also restricted the number of refugees allowed into the country while pushing to speed the deportation cases of hundreds of thousands of immigrants awaiting legal decisions.

Taken together, the policy changes have put the border wall debate on the backburner, advocates on both sides of the issue said.

“Expanded border barriers—whether you call them walls or something else—are not priority,” said Mark Krikorian, executive director of the Center for Immigration Studies, a conservative think tank in Washington, D.C. that supports tighter controls on immigration.

“There’s no question the president has changed the tone of the debate and that caused a huge drop in illegal crossings,” Krikorian told Newsweek.

To be sure, the border wall has been bogged down by political obstacles, including the fact that Congress has not appropriated funds to build it. But the shifting sentiment is striking given how central the border wall was to Trump’s political support in last year’s presidential campaign. Its mere mention was an applause line at rallies and Trump himself said it was key to stemming the flow of illegal immigration.

But since his January inauguration, apprehensions at the U.S.-Mexico border have dipped, according to the most recent data from Customs and Border Protection. Agents apprehended 31,582 undocumented immigrants at the border in January, compared to 22,293 in August, the latest available data. April saw the year’s low, with just 11,125 apprehensions.

Adam Isacson, director for defense oversight at The Washington Office on Latin America, a human rights advocacy organization, said news of the administration’s actions is spreading through Central America and discouraging crossings. At the same time, a climate of fear in the United States is gripping undocumented immigrant communities.

“People are avoiding going outside to get their groceries. They have friends to come and do that for them,” Isacson said. “They’re missing a lot of work when they learn that Immigration and Customs Enforcement is in the area and kids are not going to school as much. There’s real fear there.”

Indeed, the immigration overhaul has come so fast that the ranks of federal immigration judges are pushing back on some elements. At issue are the administration’s plans to impose “numeric perfomance standards” on judges deciding deportation cases.

The White House has said the quotas are necessary to help reduce a backlog of more than 600,000 cases, but judges say the standards will hamstring their ability to decide complex, life-and-death cases.

“[It’s] completely at odds with the kind of independence a judge needs,” Dana Leigh Marks, a spokesperson for the National Association of Immigration Judges and a federal immigration judge for more than 30 years, told Newsweek.”

Nolan Rappaport reminds me that he predicted that cutting off the “home free magnet” in the interior would have a dramatic deterrent effect on illegal migration.

On the other hand, it remains to be seen whether having a system that relies on largely random enforcement to spread a climate of fear and loathing among a community of generally law-abiding, productive migrants, intertwined with citizens and legal residents, who are part of our communities is something that we’ll ultimately be proud of as a nation.

“The Russia investigation may be undercutting Attorney General Jeff Sessions’ credibility, but it has not undermined his efforts to take the U.S. Justice Department back in time.

The time Sessions wants to go back to features an unforgiving system of mass incarceration that disproportionately targets people of color in a legal structure too often stacked against them.

To do this, the attorney general has issued a slew of policy rollbacks — unfortunate for a Justice Department that was only incrementally making progress toward equal justice under President Barack Obama and Attorney General Eric Holder.

In this sense, Sessions’ Justice Department might be the most effective unit of the Trump administration. If Trumpism’s goal is, at least in, part to destroy the progress achieved under the Obama administration, Sessions’ scorecard so far outstrips his GOP colleagues in the Cabinet and former colleagues in the Senate.

In March, for example, the nation’s top law enforcement officer visited St. Louis, next-door to Ferguson, ground zero for the Black Lives Matter movement. Sessions was in St. Louis talking about crime initiatives but also seeming to criticize one of the most useful tools for documenting police brutality: civilian cell phone videos. The choice of venue could not have been a coincidence. By focusing on “targeted police killings,” he deflected attention from the challenges now confronting law enforcement.

In fact, Sessions has had little to say on how the Justice Department might address matters of police brutality, much less on the matter of Black Lives Mattering. Instead, he has mostly showcased President Donald Trump’s belief that strong policing and incarceration are key to maintaining law and civil order.

It is as if Sessions’ Justice Department is operating on a set of alternative facts. Because the statistics are well known: Whites and blacks use and sell drugs at roughly the same rates, and African Americans make up roughly 13 percent of the U.S. population. Yet law enforcement records are remarkably different for each demographic. According to Human Rights Watch: “Black adults are more than two-and-a-half times as likely as white adults to be arrested for drug possession. In 2014, Black adults accounted for just 14 percent of those who used drugs in the previous year but close to a third of those arrested for drug possession.” In many states, a felony conviction also means losing the right to vote.

It is as if Sessions’ Justice Department is operating on a set of alternative facts.

Sessions looks eager to re-open the “war on drugs” — or, more appropriately, the war on poor people who use drugs. No available metric on this decades-long war shows any significant success in limiting access to drugs in the United States or in reducing addiction to controlled substances.

What the “war on drugs” has been good at is: stigmatizing poor people afflicted with the disease of addiction; profiling black and brown folks and arresting them at rates exponentially greater than their white counterparts; and creating revenue streams for the Prison Industrial Complex.

Sessions’ success will be key if Trump wants to make good on his law-and-order promises.

Sadly, it is working. The Justice Department is slowly transforming into an injustice department right before our eyes.

Mass incarceration, its impact on families and communities and the often racially biased ways in which its policies operate is still one of the most pressing human rights issues of our time. It’s a shame that, in the era of Trump, we are unable to effectively address the challenges we face.

“President Trump’s vision of a “big, beautiful” wall along the Mexican border may never be realized, and almost certainly not as a 2,000-mile physical structure spanning sea to sea.

But in a systematic and less visible way, his administration is following a blueprint to reduce the number of foreigners living in the United States those who are undocumented and those here legallyand overhaul the U.S. immigration system for generations to come.

Across agencies and programs, federal officials are wielding executive authority to assemble a bureaucratic wall that could be more effective than any concrete and metal one. While some actions have drawn widespread attention, others have been put in place more quietly.

The administration has moved to slash the number of refugees, accelerate deportations and terminate the provisional residency of more than a million people, among other measures. On Monday, the Department of Homeland Security said nearly 60,000 Haitians allowed to stay in the United States after a devastating 2010 earthquake have until July 2019 to leave or obtain another form of legal status.

Even as they fight court orders seeking to halt parts of Trump’s immigration agenda, Sessions, White House senior adviser Stephen Miller and other key players are finding ways to shrink the immigration system. Miller was an aide to Sessions before both men joined the administration; in less than a year, their immigration policy prescriptions have moved from the realm of think-tank wish lists to White House executive orders.

In October, the White House — in a plan led by Miller — said it had conducted a “bottom-up review of all immigration policies” and found “dangerous loopholes, outdated laws, and easily exploited vulnerabilities in our immigration system — current policies that are harming our country and our communities.”

Trump’s tough talk alone appears to be one of the administration’s best bulwarks: Illegal crossings along the border with Mexico have plunged to their lowest level in 45 years, and U.S. agents are catching a far greater share of those attempting to sneak in. Applications for H-1B skilled visas and new foreign-student enrollment have also declined.

William Frey, a demographer at the Brookings Institution, said that until now U.S. immigration rates have largely spared the country from the challenges facing advanced industrial nations such as Japan and Germany that can’t replace aging workers fast enough. By slashing immigration, Frey said, the country could end up with labor shortages and other workforce issues.

But although some of Trump’s most fervent supporters see curbing immigration as a way to turn back the United States’ rapid racial and ethnic transformation, Frey said it is an unrealistic goal. By 2020, census projections show minorities will account for more than half of the under-18 U.S. population, because of higher birthrates in nonwhite populations. And by 2026, the number of whites is projected to begin declining in absolute numbers, he said, as deaths exceed births.

“You can slow the rate of Latino and Asian immigration, but it won’t make the population whiter,” Frey said. “It will just become less white at a slower pace.”

Trump continues to insist his administration will build a border wall, despite exorbitant cost projections and senior DHS officials saying a 2,000-mile structure is impractical. His supporters say they admire the president for plowing ahead in his overhaul efforts and see a historic, generational shift underway.

“There is more than one way to get to the goal,” Dane said. “Legislative solutions are all great, but clearly the administration has done things behind the scenes. . . . The results have been dramatic.”

It’s no surprise that guys like Jeff “Gonzo Apocalypto” Sessions and his henchman Stephen Miller are leading this racist-inspired, xenophobic “race to the bottom” that if successful would likely tank our economy and cause even more inequality and social unrest as well as inflicting all sorts of unnecessary pain and suffering on long time residents, needed and productive workers, and the most vulnerable individuals seeking protection under U.S. and international laws.  Really, hard to see how guys like this with retrograde ideas that come right from the “Jim Crow era” of American history get into positions of power for which they are so totally unqualified, both by background and temperament. But, then again, look at whom we have elected our President to represent us on the international scene.

The good news for the majority of Americans is that  the “turn back the clock” plan is ultimately likely to fail. We will eventually move forward again as a diverse, productive, “country of immigrants,” and restore humane and humanitarian values to our national and international profile.

GONZO’S WORLD: Gonzo Smugly Mocks The “Rule Of Law” — But Will Mueller Get The Last Laugh?

“Since taking office as Donald Trump’s attorney general, Jeff Sessions hasn’t missed a chance to remind the public that the North Star of his Department of Justice is the rule of law. Eliminating protections for Dreamers and exposing them to deportation; threatening to pull federal funding from sanctuary cities that refuse to do the administration’s bidding on immigration; asserting in court that gay workers aren’t protected by the letter of Title VII of the Civil Rights Act of 1964; siding with a religious baker who declined to make a wedding cake for a same-sex couple wishing to marry — all actions demanded by fidelity to the the rule of law.

Because the rule of law matters to Sessions, he decided to make it the centerpiece of his Friday remarks at the annual national lawyers’ gathering of the Federalist Society, the conservative legal brain trust that helped Trump handpick Neil Gorsuch for the Supreme Court. About the president’s own disdain for the rule of law and so-called judges who rule against him, the group has largely turned a blind eye. Instead, they celebrate the parade of originalist judges he’s sent to the federal bench. For conservative legal thinkers, this covers a multitude of sins. “Attendees this year have an ebullience I haven’t seen before,” Ariane de Vogue, a longtime Supreme Court correspondent, observed on Twitter. The Federalist Society’s chairman, for his part, is already plotting how to turn the judicial map red.

Chalk it up to the electricity in the air, all this winning, that Sessions, after an introduction by Edwin Meese, his predecessor at the Justice Department during the Reagan administration, suddenly decided the rule of law was a joke. “Is Ambassador Kislyak in the room?” Sessions asked of the lawyerly audience, which greeted the question with laughter. “Before I get started here, any Russians? Anybody been to Russia? Got a cousin in Russia or something?” The audience was loving it. Meese was rolling.

Sessions must have thought of the Russia bit on the spot, as it wasn’t in his prepared remarks. There’s a reason he may have found the whole thing hilarious right there and then: He delivered the line at none other than the Mayflower Hotel, the same location where he and Kislyak, the former Russian ambassador, had an encounter during the presidential campaign that went undisclosed during his confirmation hearing. Sessions’s own shifting recollections and denials about his contacts with Russian officials in later Senate testimony are hard to keep up with. For all we know, he may have lied to Congress. Suffice it to say, the extent of those contacts played a significant role in Sessions’s recusal from all things Russia, a move that blindsided Trump and infuriated him. With a loyalist out of the way, it fell to Rod Rosenstein, Sessions’s deputy, to appoint Robert Mueller to lead the criminal and counterintelligence probes into the Kremlin’s disruption of last year’s election. Sessions came this close to resigning over Mueller’s appointment.

None of this is a laughing matter. That Sessions had the presence of mind to crack a joke about it makes a mockery of his self-professed commitment to the rule of law. The rule of law isn’t just rescinding Obama-era rules or steering the federal government toward more conservative outcomes. The rule of law, fragile as it is, is also a set of unwritten norms that stay the same no matter who’s in power — such as the nation’s top law-enforcement officer recognizing that he should not make light of an investigation in which he himself is implicated and may have committed perjury. One in which his own Justice Department has active, ongoing prosecutions of campaign officials that he once worked with. Sessions treating this as a joke undermines keepers of the constitutional order — Congress, the Executive branch, and now the courts — who are taking it very seriously.

“Recusals happen all the time throughout the Department of Justice … just because we follow the rules. That furthers confidence in justice,” Sessions declared near the end of his Federalist Society speech. Now that’s a good one. Desiree Fairooz, the activist who laughed at Jeff Sessions during his confirmation hearing and was prosecuted by his Justice Department over it, would be forgiven if she heard that zinger and laughed again.

Mueller, for his part, has his sights on another uproarious matter: ABC News reported Sunday that the special counsel is looking into the Justice Department’s role in the firing of James Comey. Sessions may have a hard time laughing that one off.”

Sessions, who lives on and for the “wrong side of history and human decency,” should go down as the most lawless Attorney General since John Mitchell. Indeed, I think he has the potential to surpass Mitchell in terms of contempt for the American system, for the majority of Americans, and for the rule of law. Having lived through the “Watergate Era,” that’s saying something!

“In the story of our country, the Trump administration’s dismantling of the DACA program is a national tragedy that will be a source of confusion for generations to come. The program was one of the few compromises that the Obama administration made in attempt to right unjust, inhumane and outdated immigration laws. Our own history tells us that laws are fluid and change over time; they do not dictate morality, but are dictated by morality (or the lack thereof). It wasn’t until the 20th century, for example, that we saw women first granted the right to vote and the abolishment of Jim Crow laws.

The pervasive rhetoric around immigrants who received DACA and their families is predicated on an underlying judgement that their mere presence in this country is a crime. It is not: Being in the U.S. without authorization is a civil offense.

Yet if a crime has been committed, someone must be responsible, right? If you qualify for DACA, it means that you were under a certain age when you came here, so you were too young to have committed a “crime.” You are a “good,” “acceptable,” “assimilated” one. But your parents are not. America will accept you — provisionally — but you must condemn the actions of your family members who brought you here.

“Divide and conquer.”

No wall has yet been built, no border yet drawn, no law yet written that overpowers the love of parents for their children. Let us celebrate and give thanks to the resilience of immigrant families who, despite all possible obstacles, find ways to survive, even thrive. Our laws and various languages may separate them, but united they stand.

One of the most offensive things that Sessions consistently does is to undervalue the contributions of immigrants, both documented and undocumented. This was particularly true in his slandering of “Dreamers.” They are America’s youth; we’re fortunate to have them!

The closely related idea of GOP White Nationalist restrictionists that “chain migration” is bad is equally insulting and totally wrong. Family immigration has contributed as much to America as has so-called “employment-based” immigration. Undocumented migrants have also contributed to our success, particularly our economic success.

Our real problem is with White Nationalists and restrictionists who insist on overly restrictive immigration policies that are unenforceable, expensive, corrosive, and against our national interests.

For so many people who are close to Donald Trump, Russia is the Bermuda Triangle of their memory.

Conversations and meetings seem to pass through this mysterious quadrant of their brains and simply disappear. Even when the wreckage is found on some server or other, they profess ignorance, confusion or innocence. And sometimes all three at once.

On Tuesday the synapses inside the skull of attorney general Jeff Sessions magically reconnected around a March 2016 campaign meeting in which he heard Trump’s point man on Russian policy discuss how the candidate could get together with one Vladimir Putin.

 

This is kind of awkward since Sessions had sworn, like the honorable southern gentleman that he is, that there were no absolutely no such contacts with the Russians, no siree.

Fortunately for the former senator, his amnesia has recovered enough to remember that he pooh-poohed the idea of a Trump-Putin meeting. Somehow he could remember none of the other sordid details of what normal people would call collusion.

“I had no recollection of this meeting until I saw these news reports,” Sessions told the House judiciary committee, before he recalled only the details of the meeting that made him look good.

Sadly this sickness may have started inside the Trump family itself, in which case Sessions is just a hapless victim of some brain-corroding virus. After all, Donald Trump Jr, the president’s son, shows repeated symptoms of Moscow Memory.

It is only five long months since we learned about the slick-haired son’s meeting with a Russian lawyer. Luckily his father was on hand to draft a press statement saying the meeting was no big deal: just a casual chat about Russian adoptions.

But then there were all those leaked emails from Trump Jr himself in which he set up the “adoptions” meeting. “I love it,” he wrote, when offered a Russian government trove of “official documents and information that would incriminate Hillary”.

Once the emails were public, Trump Jr denounced the leaks and claimed he was being wonderfully transparent after all.

This makes the latest leaks – involving WikiLeaks, no less – all the more conclusive in diagnosing this Putin-induced amnesia. It also makes them more exquisitely ironic.

As reported by the Atlantic, in the final stages of last year’s presidential election, our forgetful protagonist was coordinating campaign efforts and tweets with WikiLeaks.”

“Attorney General Jeff Sessions’s defense for apparently misleading Congress about his knowledge of campaign contacts with Russians is that he has a bad memory. No, honestly. The man who now oversees the entire Justice Department might have heard about contacts with Russia, but no alarms went off, nothing was seared into memory and no action was taken. Even if you believe Sessions, his testimony is damning.

It may be that Sessions is struggling to deflect pressure for him to investigate Clinton. However, that would simply be evidence of the president’s total lawlessness and would suggest that Sessions is not being candid when he denies pressure to investigate Clinton. The proper response to outside pressure to use the Justice Department as a political weapon against political opponents should be: Forget it. If that pressure continues, a responsible attorney general would either quit or force the president to fire him (as acting attorney general Sally Yates did when she refused to litigate the travel ban).

Finally, if Sessions’s memory is so poor, one wonders how he can reliably answer questions that the special counsel will no doubt ask about the firing of former FBI director James B. Comey and Russian collusion. An attorney general who remembers nothing might escape implicating the president or others — but it also suggests he should never have been given the job.”

“We are running a terribly unwise experiment: What happens when you replace U.S. presidential leadership with the slapstick antics of a clown?

On Saturday, President Trump issued the following statement: “Why would Kim Jong Un insult me by calling me ‘old,’ when I would NEVER call him ‘short and fat?’ Oh well, I try so hard to be his friend — and maybe someday that will happen!”

There is a natural tendency to become inured to Trump’s gushing stream of nonsense. Resist the urge. Read that statement again. The president of the United States, in the midst of a trip to Asia, taunted the nuclear-armed dictator of North Korea in a manner most sixth-graders would consider juvenile.

There was a time when the world looked to the U.S. president to speak clearly in defense of freedom, democracy, the rule of law and respect for human rights. I refer to the entirety of modern U.S. history before January, when Trump assumed the high office he now dishonors.

His Asia tour has been at times a disaster, at times a farce. What was the most shameful moment? Perhaps when he announced that he has a “great relationship” with Philippine President Rodrigo Duterte, who has encouraged police and vigilantes to fight the trade in illegal drugs by assassinating suspected traffickers without the bother of arrests or trials. At least 7,000 and perhaps as many as 13,000 people have been slain.

The White House claimed that human rights came up “briefly” in a private meeting between the two leaders, but Duterte said it didn’t come up at all. In fact, during a gala dinner, the buffoonish Duterte serenaded Trump with a Philippine ballad that includes the lyric, “You are the love I’ve been waiting for.”

The spectacle was simply appalling. One might argue, however, that Trump’s kowtowing to Russian President Vladimir Putin was even worse.

The U.S. intelligence community has concluded that the Russian government directed a multipronged campaign to meddle in the 2016 election, with the aim of helping Trump win. Putin denies having committed this hostile act, and Trump, for some reason, takes the former KGB officer at his word.”

“He said he didn’t meddle. He said he didn’t meddle. I asked him again. You can only ask so many times,” Trump told reporters aboard Air Force One as he flew from Da Nang to Hanoi in Vietnam. Trump spoke to Putin three times on the sidelines of summit here, where the Russia meddling issue arose. “Every time he sees me, he says, ‘I didn’t do that,’” Trump said. “And I believe, I really believe, that when he tells me that, he means it.” “I think he is very insulted by it,” Trump added.

Could Trump actually believe that the ex-KGB operative is insulted by the accusation he pulled off a masterful plot, at very little cost, to tip the scales in an American presidential election and get the candidate of his choice? Certainly, Trump is not only gullible but also running scared as special counsel Robert S. Mueller III breathes down his neck.

Anyone who sides with their alternative universe (Sebastian Gorka, Vladimir Putin, Bill O’Reilly, Roy Moore) is a hero and a victim of those pro-immigrant, globalist, anti-Christian elites. Anyone who presents cold, hard facts (the mainstream media, scientists, allied governments, Democrats, #NeverTrumpers) that explode their dearly held myths is an enemy of the people.Yes, that’s the mental universe in which Trump and his ilk reside. It renders Trump susceptible — eager, even — to believe our enemies, even — especially! — at the expense of American values, security and interests. He’s putty in the hands of wily autocrats. “Despite the Trump administration’s repeated attempts to frame illegal immigration as a threat to public safety, the poll also found an overwhelming majority believe that people without legal residency help revitalize cities as opposed to increasing crime.

The survey results, poll analysts and policy experts said, reflect ongoing trends in California, where through the decades the public has tended to support immigrants in the country illegally, even when federal or state political leaders have stoked anti-immigrant sentiment to rally their bases.

“We have seen this in California forever,” said Jill Darling, the survey director for the Center for Economic and Social Research at USC. “People, including Republicans, have been more supportive of immigrants and reform, even to the point of supporting a path to citizenship, more so than Republican leadership.”

Most poll participants also expressed positive perceptions of people without legal residency in the country.

Nearly 63% of people surveyed said they believed immigrants without legal status strengthened the economy, as opposed to roughly 38% who said they took away jobs. Sixty-six percent said immigrants in the country illegally helped revitalize cities, and about 34% — including more than 72% of Republicans — believed they increased crime.

Policy experts said the poll results reflect the explosive growth of Latinos, Asians and other minority communities that tend to lean Democratic. California’s families are so diverse, they said, that nearly everyone knows someone who came to the country as an immigrant — legally or illegally.

It also reflects a shift away from the “us-versus-them” rhetoric that damaged the Republican brand in the 1990s, political consultants and immigration policy experts said. During that time, Gov. Pete Wilson was criticized for using footage of people running across the border to dramatize the problem of illegal immigration, and voters passed propositions to bar immigrants in the country illegally from public benefits, outlaw affirmative action programs and teach only English in schools.

That “no longer reflects our reality,” said Mindy Romero, director of the California Civic Engagement Project. “In a state like California, immigrants are us.”

Andrew Medina, state policy manager for Asian Americans Advancing Justice, said he wasn’t surprised by the results of the poll — or by the approval among California residents for the sanctuary state law. A study released in February by the Public Policy Institute of California found that a solid majority of Californians believe the state and local governments should make their own policies and take action to protect the rights of immigrants who are here illegally.

The final language of the sanctuary state law was the result of months of tough negotiations among Gov. Jerry Brown, Senate leader and bill author Kevin de León (D-Los Angeles), and law enforcement officials.

It will largely prohibit state and local law enforcement agencies from holding or sharing information about people with federal immigration agents unless those individuals have been convicted of one or more offenses from a list of 800 crimes outlined in a 2013 state law.

Federal immigration authorities still will be able to work with state corrections officials — a key concession Brown had demanded — and will be able to enter county jails to question immigrants. But the state attorney general’s office will be required to publish guidelines and training recommendations to limit immigration agents’ access to personal information.

“It is positive that these polls show that there is support for immigrant communities, and it is especially positive in this era,” Medina said.

Still, Romero advised caution.

“Discrimination against immigrants is very real and a danger,” she said, pointing to anti-immigrant rhetoric at the national level. “I think we can’t rest on a changing landscape in California and just assume that things will continue to be more receptive and open.”

TRUMP ADMINISTRATION LAUNCHES “STEALTH ATTACK” ON MUSLIM REFUGEES!

“At the end of last month, the Trump administration quietly rolled out new restrictions on certain groups of refugees, ostensibly aimed at “protect[ing] people from terrorist attacks and other public-safety threats.” This latest form of “extreme vetting” reportedly targeted citizens of 11 purportedly high “risk” countries, along with the children and spouses of refugees already in the United States.

These high “risk” refugees would be temporarily barred from entering the country and kept from resettlement, so yet another layer of reviews could be added to the already years-long process. Here is the list of affected countries: Egypt, Iran, Iraq, Libya, Mali, North Korea, Somalia, South Sudan, Sudan, Syria, and Yemen. Nine of these countries are Muslim-majority nations. The list was not made public in the executive order itself. Instead, the State Department released an accompanying memo saying that the refugee freeze would affect 11 unnamed countries for which additional security screening had been previously required for males age 16–50.

The new policy expands the additional scrutiny for people from those 11 nations to include all refugees, and not just males of a certain age, while attempting to hide which 11 countries are affected. It also “temporarily prioritizes” applications of refugees from countries not on the list. The list of countries has never been made public outside of media reports, but was included in a December 2016 State Department memo seen by Slate. The new executive order was the Trump administration’s latest attempt to secretly sanitize and repurpose President Trump’s long-proffered and repeatedly bungled Muslim ban.

To put it more simply: This is another Muslim ban.
In addition to the new vetting and resettlement restrictions for a certain type of refugee, the “follow-to-join” program for close relatives of refugees who are already in the U.S. was paused indefinitely until further review. That means that refugees already lawfully admitted will be prevented from reuniting with their spouses and minor children. Department of Homeland Security data shows that about 2,000 follow-to-join family members came to the U.S. in 2015. Just as a reminder, one of the first plaintiffs in a lawsuit against Trump’s first “travel ban,” Haider Sameer Abdulkhaleq Alshawi, was an Iraqi who had qualified for a Follow to Join Visa. Alshawi’s wife and 7-year-old son, whom he had not seen for three years, were lawful permanent residents living in Houston. He was detained at JFK Airport in transit to the U.S. when the first travel ban was signed in January, before ultimately being allowed to reunite with his family.

Seen together, the new restrictions will not only disproportionately affect Muslim refugees: They will also extend an already cumbersome process that at present features extensive vetting that can average between 18–24 months.”

“The U.S. Justice Department’s request that the Supreme Court consider sanctions against lawyers who advocated for an immigrant teenager at the center of an abortion case has raised questions about the government’s motivation and threatened to jeopardize the reputation of the solicitor’s office before the justices. Former Justice Department attorneys called the government’s action in the Supreme Court “extraordinary” and said they had no memory of a similar Supreme Court petition.”

And remember, you read first in some of my earlier blogs in immigrationcourtside.com about the DOJ’s and SG’s likely loss of years of hard earned respect and credibility by arguing the relatively “law free” politicized “Gonzo” positions forced on them by Sessions and the rest of the White Nationalist Trumpsters. Remember, the pro bono lawyers being smeared by Sessions’s DOJ were fighting to vindicate a migrant teenager‘s clear constitutional rights against an attempt by Government officials to substitute their own personal opinions for the constitutional rules and to misrepresent their true intentions (use delay and obfuscation tondefeat constitutional rights) in doing so. Sounds like it’s Sessions and his group whose law licenses should be re-examined.

The public and to some extent the media might have allowed the “Trump/Sessions Crowd” to “normalize” the presentation of lies, misrepresentations, intentional omissions, distortions, and political screeds as “facts” or “legal arguments.” But, most Article III Courts don’t like being played for fools, particularly by the USDOJ which traditionally has been expected to meet higher standards of integrity, fairness, and responsibility to accurately inform the tribunals before which they appear.

Ironically, although Gonzo tried to tag immigration lawyers fighting to preserve their clients’ statutory and constitutional rights as “dirty,” that tag is much more likely to stick to Gonzo and some of the ethically challenged DOJ lawyers doing his bidding. Not to mention that the DOJ is wasting the time of the Supremes with its basically frivolous request, intended largely as political grandstanding to satisfy Gonzo’s anti-abortion, anti-US Constitution political backers.

“AYATOLLAH ROY” APPARENTLY CAUGHT WITH HIS PANTS DOWN (LITERALLY) AS GOP REMAINS LARGELY IN DENIAL!

“So President Trump, Senate Majority Leader Mitch McConnell (Ky.) and fellow Republicans think Roy Moore, the GOP Senate nominee from Alabama, should quit his Senate run only “if these allegations are true.”

If true? Four women, on the record in The Post, say Moore, when he was in his 30s, tried to date them as teens, and one of the women says he had sexual contact with her when she was 14 and he was 32. Perhaps Republicans expect video and DNA evidence from 1979 magically to emerge, or a confession by Moore? (He denies the allegations.) More likely they are just dodging so that they can stick with Moore and keep the seat Republican — even if it means having an alleged pedophile join their caucus.

By comparison, there was more integrity in the defense of Moore offered by Alabama State Auditor Jim Zeigler, who told the Washington Examiner that, even if true, “there’s just nothing immoral or illegal here.” Indeed there’s biblical precedent for Moore’s alleged behavior.

“Take Joseph and Mary,” Zeigler said. “Mary was a teenager and Joseph was an adult carpenter. They became parents of Jesus.”

 

Jumpin’ Jehoshaphat!

Let us take seriously Zeigler’s justification, which is consistent with Moore’s view that “God’s laws are always superior to man’s laws,” and the Bible stands above the Constitution and other piddling laws of man. It is true that the Bible does not say “thou shalt not strip to thine tighty whities and kiss a 14-year-old and touch her through her bra and underpants.” The Bible also does not specifically prohibit colluding with the Russians, accepting emoluments, money laundering or conspiracy against the United States. So Moore, and for that matter President Trump and his administration, has nothing to worry about.

But if we are to accept the Bible literally as the legal standard (and not, say, age-of-consent laws), we will also have to accept as legal certain other activities in 21st-century America, including:

Sacrificing as a burnt offering your young son (Genesis 22:2) or your daughter, if she comes out of the doors of your house to meet you (Judges 11:30-1, 34-5).

 

Having rebellious children stoned to death by all the men of the city (Deuteronomy 21:18-21).

Purchasing slaves (Leviticus 25:44-46), selling your daughter as a slave (Exodus 21:7-8) and making sure they submit to their masters, even cruel ones (1 Peter 2:18).

Executing pagan priests on their own altars and burning their bones (2 Kings 23:20-25).

Cutting off the hand of a woman if she grabs the penis of a man who is fighting with her husband (Deuteronomy 25:11-12).

There’s no allegation of sexual intercourse, he said, and “Roy Moore fell in love with one of the younger women.” That would be his wife, Kayla, who Zeigler says is 14 years his junior and whom he was dating around that time.

You don’t need a judge and jury, Republicans, to determine that there was something icky going on or that there is something dangerous in having as a senator a man who places God’s law over man’s — and then interprets God’s laws to suit himself.“

KELLY TRIED TO BULLY ACTING DHS DIRECTOR ELAINE DUKE INTO TERMINATING TPS FOR HONDURANS – SHE WOULD HAVE NONE OF IT!

White House chief of staff John Kelly pressured acting Homeland Security Secretary Elaine Duke to terminate protections for tens of thousands of Honduran immigrants currently living in the US, sources tell CNN.

Duke received multiple calls from Kelly pressuring her, in Duke’s perception, to end Temporary Protected Status for Honduran immigrants on Monday’s decision day, leaving Duke “distraught and disappointed” and ready to leave the department, according to a source familiar with Duke’s thinking.

The Trump administration characterized the call as Kelly weighing in through a normal process and said Duke was committed to remaining at her post.

The Washington Post first reported on the call.

TPS is an immigration status allowed by law for certain countries experiencing dire conditions, such as a natural disaster, epidemic or war, and protects individuals from deportation and authorizes them to work in the US.

Monday was the deadline for a decision on the protected status for the roughly 86,000 Hondurans. DHS instead announced that Duke had not found there was enough information to make a formal decision, a move that triggered a six-month extension of the protected status. The administration did terminate protections for Nicaraguans, about 5,300 of which live in the US. Both populations have lived in the US for nearly two decades.

According to the source familiar with Duke’s thinking, Kelly and the administration wanted Homeland Security secretary nominee Kirstjen Nielsen to avoid questions about the issue at her Senate confirmation hearing on Wednesday, and wanted to her confirmed quickly enough that she would be the one to make a decision on temporary protected status for Haitians, which is due at the end of the month and which will likely be ended.

According to the source familiar, Duke had decided over the weekend that she did not have enough information to end the protections for the Hondurans, which is what the department announced late Monday evening.

“I think she’s very distraught and disappointed at Kelly and the whole apparatus,” the source said. “She’s out there alone, you know? It’s like, ‘Why do I keep doing this if you guys are just going to beat me up?'”

The source confirmed that she made reference to resigning during the back-and-forth and is inclined to leave the job.

The source described the back-and-forth as a “forceful, directive conversation.”

“It was a loud conversation, it wasn’t a quiet conversation,” the source said.”

Kelly sinks deeper into “The Swamp” every day with each new revelation of his sleazy conduct and reactionary views. I suspect that Duke’s DHS career will come to an end shortly. And, there is some reason to suspect that her permanent replacement, Kirstjen Nielsen, is being put over at DHS to  be a “yes-woman” for the Trump, Sessions, Kelly, Miller, Bannon (in absentia) White Nationalist crew operating out of the White House and the DOJ. Whether she will live up to their “low expectations,” however, is another matter entirely.
