“BALTIMORE — For months, Veronica Castro had dreaded Tuesday, when she was scheduled to check in with immigration officials.

The undocumented immigrant didn’t know whether she would be detained and deported to Mexico or allowed to return home with her husband, a disabled veteran, and their four children, all U.S. citizens who live in Lothian, Md.

On Tuesday, as she and her husband stood in a crowded office in the George H. Fallon Federal Building here, their fears were allayed in less than 30 minutes.

Immigration officials gave Castro another year before she would have to check in again.

“I’m happy,” she said in Spanish, smiling.
“It’s raining, but it’s a wonderful day,” said her husband, Ricardo Pineda, who served in the Army for six years and reached the rank of sergeant. “We get another year, one more year to be together, and hopefully more.”

Three clergy members had accompanied the family into the immigration office, a tiny room with 11 chairs and a flier on the wall that warned of an MS-13 member wanted for murder in Honduras. As they stood in the elevator heading down, a stranger noticed them and asked if there were religious services in the building.

“God is everywhere,” Pineda told him.

Outside, a crowd had gathered to show the family support. Among them was a pastor who had traveled from Chicago and local immigration rights activists who had formed groups only after President Trump’s inauguration. They held signs to let the family know they weren’t alone. “We love you,” read one. “Safety for all,” read others.

Those in the crowd had prayed together and listened as Castro told them her family’s story. The 38-year-old told them about her husband’s medical needs. Pineda, 47, received a medical discharge from the Army and takes medication for diabetes, depression and pain in a hand he injured during combat training. She told them about her four children, two of whom have disabilities. The couple’s 14-year-old son has cerebral palsy and their 17-year-old was left with brain damage after heart surgery as a toddler. His mother helps him bathe, get dressed and walk to and from the bus each day.”

Kudos to everyone involved here. To Sgt. Pineda and Ms. Castro for having the courage to do the right thing by reporting in accordance with the law and for trusting in “the system.”

To the ICE officials in Baltimore who took the time to understand the facts and had the courage to exercise discretion and do the right thing by allowing Ms. Castro to stay. ICE is taking lots of grief from lots of folks these days (including me), and it’s a good reminder that the overwhelming majority of ICE Officers, including most that I have known over the years, are conscientious professionals doing a very hard job and who, when allowed to do so, often use their discretion to to save individuals that the “law has forgotten.”

And, of course, we shouldn’t forget the couple’s lawyer and the many friends and community supporters who stood with them during this difficult time.

Finally, we only learn about these incidents, both good and bad, from fine reporters like Theresa Vargas who take the time to cover the “human side” of the immigration drama from all angles.

BREAKING: DHS Releases Final Border Enforcement Memos — Get “Fact Sheet” & All The Links You Need Here!

Fact Sheet: Executive Order: Border Security and Immigration Enforcement Improvements | Homeland Sec

Highlights (sorry about the formatting — like a true  “EOIR Vet” I did the best I could under the circumstances):

Actions

Enforcing the law. Under this executive order, with extremely limited exceptions, DHS will not exempt classes or categories of removal aliens from potential enforcement. All of those in violation of the immigration laws may be subject to enforcement proceedings, up to and including removal from the United States. The guidance makes clear, however, that ICE should prioritize several categories of removable aliens who have committed crimes, beginning with those convicted of a criminal offense.

Establishing policies regarding the apprehension and detention of aliens. U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) will release aliens from custody only under limited circumstances, such as when removing them from the country, when an alien obtains an order granting relief by statute, when it is determined that the alien is a U.S. citizen, legal permanent resident, refugee, or asylee, or that the alien holds another protected status, when an arriving alien has been found to have a credible fear of persecution or torture and the alien satisfactorily establishes his identity and that he is not a security or flight risk, or when otherwise required to do so by statute or order by a competent judicial or administrative authority.

Hiring more CBP agents and officers. CBP will immediately begin the process of hiring 5,000 additional Border Patrol agents, as well as 500 Air & Marine agents and officers, while ensuring consistency in training and standards.

Identifying and quantifying sources of aid to Mexico. The President has directed the heads of all executive departments to identify and quantify all sources of direct and indirect federal aid or assistance to the government of Mexico. DHS will identify all sources of aid for each of the last five fiscal years.

Expansion of the 287(g) program in the border region. Section 287(g) of the INA authorizes written agreements with a state or political subdivision to authorize qualified officers or employees to perform the functions of an immigration officer. Empowering state and local law enforcement agencies to assist in the enforcement of federal immigration law is critical to an effective enforcement strategy, and CBP and ICE will work with interested and eligible jurisdictions.

Commissioning a comprehensive study of border security. DHS will conduct a comprehensive study of the security of the southern border (air, land, and maritime) to identify vulnerabilities and provide recommendations to enhance border security. This will include all aspects of the current border security environment, including the availability of federal and state resources to develop and implement an effective border security strategy that will achieve complete operational control of the border.

Constructing and funding a border wall. DHS will immediately identify and allocate all sources of available funding for the planning, design, construction, and maintenance of a wall, including the attendant lighting, technology (including sensors), as well as patrol and access roads, and develop requirements for total ownership cost of this project.

Expanding expedited removal. The DHS Secretary has the authority to apply expedited removal provisions to aliens who have not been admitted or paroled into the United States, who are inadmissible, and who have been continuously physically present in the United States for the two-year period immediately prior to the determination of their inadmissibility, so that such aliens are immediately removed unless the alien is an unaccompanied minor, intends to apply for asylum or has a fear of persecution or torture in their home country, or claims to have lawful immigration status. To date, expedited removal has been exercised only for aliens encountered within 100 air miles of the border and 14 days of entry, and aliens who arrived in the United States by sea other than at a port of entry. The Department will publish in the Federal Register a new Notice Designating Aliens Subject to Expedited Removal Under Section 235(b)(1)(a)(iii) of the Immigration and Nationality Act that expands the category of aliens

subject to expedited removal to the extent the DHS Secretary determines is appropriate, and CBP and ICE are directed to conform the use of expedited removal procedures to the designations made in this notice upon its publication.

Returning aliens to contiguous countries. When aliens apprehended do not pose a risk of a subsequent illegal entry, returning them to the foreign contiguous territory from which they arrived, pending the outcome of removal proceedings, saves DHS detention and adjudication resources for other priority aliens. CBP and ICE personnel shall, to the extent lawful, appropriate and reasonably practicable, return such aliens to such territories pending their hearings.

Enhancing Asylum Referrals and Credible Fear Determinations. U.S. Citizenship and Immigration Services (USCIS) officers will conduct credible fear interviews in a manner that allows the interviewing officer to elicit all relevant information from the alien as is necessary to make a legally sufficient determination. USCIS will also increase the operational capacity of the Fraud Detection and National Security Directorate.

Allocating resources and personnel to the southern border for detention of aliens and adjudication of claims. CBP and ICE will allocate available resources to expand detention capabilities and capacities at or near the border with Mexico to the greatest extent practicable. CBP will focus on short-term detention of 72 hours or less; ICE will focus on all other detention capabilities.

Properly using parole authority. Parole into the United States will be used sparingly and only in cases where, after careful consideration of the circumstances, parole is needed because of demonstrated urgent humanitarian reasons or significant public benefit.

Notwithstanding other more general implementation guidance, and pending further review by the Secretary and further guidance from the Director of ICE, the ICE policy directive with respect to parole for certain arriving aliens found to have a credible fear of persecution or torture shall remain in full force and effect.

Processing and treatment of unaccompanied alien minors encountered at the border. CBP, ICE, and USCIS will establish standardized review procedures to confirm that alien children who are initially determined to be unaccompanied alien children continue to fall within the statutory definition when being considered for the legal protections afforded to such children as they go through the removal process.

Putting into place accountability measures to protect alien children from exploitation and prevent abuses of immigration laws. The smuggling or trafficking of alien children into the United States puts those children at grave risk of violence and sexual exploitation. CBP and ICE will ensure the proper enforcement of our immigration laws against those who facilitate such smuggling or trafficking.

Prioritizing criminal prosecutions for immigration offenses committed at the border. To counter the ongoing threat to the security of the southern border, the directors of the Joint Task Forces- West, -East, and -Investigations, as well as the ICE-led Border Enforcement Security Task Forces (BESTs), are directed to plan and implement enhanced counter- network operations directed at disrupting transnational criminal organizations, focused on those involved in human smuggling.

Public Reporting of Border Apprehensions Data. In order to promote transparency, CBP and ICE will develop a standardized method for public reporting of

statistical data regarding aliens apprehended at or near the border for violating the immigration law.”

Michele Waslin, Immigration Impact: Trump Administration Ditches “Common Sense Priorities” In Adopting a Max Enforcement Program!

“The Trump administration is quickly unraveling the last administration’s efforts to prioritize those for deportation who pose a serious threat over those who don’t. The new administration is ignoring priorities that were put into place by the Obama Administration as a way to manage limited law enforcement resources. The priorities recognized that there is a finite budget available for immigration enforcement, thus making prioritization important. The approach now being pursued by the Trump Administration casts a wide net and will result in an aggressive and unforgiving approach to immigration enforcement moving forward.

The most significant indications of this shift came through the “Enhancing Public Safety in the Interior of the U.S.” executive order, issued January 25, 2017, which prioritizes for deportation those noncitizens who:

Have been convicted of any criminal offense;
Have been charged with any criminal offense;
Have committed acts that constitute a chargeable criminal offense;
Have engaged in fraud or willful misrepresentation in connection with any official matter or application before a government agency;
Have abused any program related to the receipt of public benefits;
Are subject to a final order of removal but have not departed;
Otherwise pose a risk to public safety or national security.
In addition, unauthorized immigrants with no criminal history will likely fit under the third bullet because entering without inspection is a chargeable criminal offense (illegal entry or re-entry). And since the executive order states that many immigrants without immigration status or who overstayed their visas are a risk to public safety and national security, it appears the final bullet is a catch-all category for many others. In other words, the president has “prioritized” everyone, which means in reality he’s prioritized no one, making everyone a target for enforcement. Furthermore, legal immigrants—even green card holders–who are convicted of aggravated felonies or crimes of moral turpitude could also be subject to deportation.

Yet despite the more aggressive approach, it is still unclear from where the resources to identify, arrest, detain, and deport all of these individuals will come. For example, the U.S. is already over-capacity in detention, and immigration courts are seriously backlogged.

In the past, the government has stated that budget realities make it impossible to remove everyone who is in the country without authorization or who is otherwise deportable. This meant the agency had to set priorities and focus on a subset of deportable immigrants.

The Obama administration released a series of memos designed to prioritize those who pose a threat to public safety and national security and other categories of individuals.”

The Obama Administration made a total mess out of the already stressed U.S. Immigration Court dockets by unwisely and unnecessarily “prioritizing” cases of recently arrived unaccompanied children, women, and families fleeing violence and corruption in the Northern Triangle.

Nevertheless, thorough programs such as DACA, stateside processing, closing cases with possible relief pending before USCIS, and frequent wise use of prosecutorial discretion (“PD”) in “clean” cases with difficult legal issues but strong humanitarian factors, the Obama Administration was the first Administration I have seen make progress on developing a system that could eventually have helped “rationalize” Immigration Court dockets. If freed from politicized and unrealistic “priorities” from above, this eventually could have allowed the courts to focus on cases that really needed to be litigated, as is the case with almost all other high-volume court systems.

By contrast, the Trump Administration seems intent on “torquing” the Immigration Court system until it breaks apart. Even the Obama Administration used an overly broad concept of “criminal alien.” They included too many individuals who, while technically removable under the law, were doing useful things in the community and presented no real threat to the safety or security of the U.S.

Certainly the Trump Administration could have focused on those whose removals should be prioritized by “fine tuning” the Obama enforcement priorities. Instead, they have embarked on an expensive and ill-planned “mission impossible” to make everybody a priority (and, hence, nobody a priority) without any regard to the capacity or the best uses of court time and resources within our judicial system.

Additionally, the Trump Administration seems to be going out of its way to “disempower” those who are closest to the problem and are actually in the best position to determine which cases should be prosecuted:  the local Offices of Chief Counsel of the DHS (the “immigration equivalent” of the U.S. Attorney). In Arlington, the Office of Chief Counsel was well-respected by all and had an excellent grasp of how to make the justice system work for all involved. Their main problem, like that of the Immigration Courts, was unrealistic priorities and directives imposed on them by political officials “up the chain.”

Sadly, the Trump Administration seems determined not to build on those things that have been successful in the past and instead to embark on a new “blunderbuss” approach to immigration enforcement that is almost guaranteed to get tied up with both legal challenges and practical impossibilities.

Reuters Exclusive Report — Dreamer Arrested By ICE In Seattle — Mistake Or New Policy?

Daniel Levine and Kristina Cooke of Reuters San Francisco break this exclusive story:

“U.S. authorities have arrested an immigrant from Mexico who was brought to the United States illegally as a child and later given a work permit during the Obama administration in what could be the first detention of its kind under President Donald Trump.

Daniel Ramirez Medina, a 23-year-old with no criminal record, was taken into custody last week at his father’s home in Seattle by U.S. Immigration and Customs Enforcement officers. The officers arrived at the home to arrest the man’s father, though court documents did no make clear the reason the father was taken into custody.

Ramirez, now in custody in Tacoma, Washington, was granted temporary permission to live and work legally in the United States under a program called the Deferred Action for Childhood Arrivals, or DACA, established in 2012 by Democratic President Obama, according to a court filing.”

As far as I know, the Administration has not made a final decision on whether or not to revoke, retain, or modify the Obama Administration’s DACA program. But, given the sloppiness with which this Administration has proceeded on immigration matters, who knows?

Undocumented Residents Are Part Of The Fabric Of Our Nation’s Capital

Theresa Vargas and Steve Hendrix write in today’s Washington Post:

“Monroy is now working toward a master’s degree in international education. She is also the director of education at the Family Place, a service organization that offers literacy classes for adult immigrants, many of whom have no more than a third-grade education. She credits DACA with giving her that freedom to thrive and help others.

“A lot of fear I had before was taken away,” she said.

She hopes Trump will continue to honor the policy, but said if he revokes it, she is less worried about herself than others. Every day she sees women who come from places where gangs have taken their homes and tried to recruit their children. Women who fear not just instability, but losing loved ones, if they are forced to leave the United States. It is why in recent weeks she has attended protests at the White House and in front of the Trump hotel, adding her slight frame to the swelling crowds.

“I’ve told my friends if I have to go down with a fight, it will be a glamorous fight,” she said.”

Arlington Immigration Court “Chatter” — Local Immigration Attorney Says “New Sheriff In Town” — The End of “PD”

From today’s e-mail “chatter:”

“For all those who said ‘he doesn’t mean what he says’ or ‘it will not be that bad’ that is now officially bullshit. As of this afternoon all DHS Office of Chief Counsel prosecutors have been instructed not to exercise prosecutorial discretion in removal cases. The most recent executive order from the White House lists as enforcement priorities for removal those who have been CHARGED with a criminal offense whether that offense is resolved or not. In immigration offices and courts throughout the US ‘there’s a new Sheriff in town’ is driving denials and deprivation of rights. We have closed our doors to refugees and now will embark on an interior campaign against immigrants. And it is day 6.”

Sad, but predictable, based on yesterday’s Interior Enforcement Executive Order.  While it lasted, prosecutorial discretion (“PD”) was one of the best and smartest policies ever applied by immigration prosecutors.

It was a “quadruple winner:”  prosecutors got low priority cases off their overcrowded dockets; overtaxed Immigration Courts could concentrate on more important cases; respondents with equities, good records, who had lived productive lives, and paid taxes got (limited, but potentially life-saving) humanitarian relief that the courts could not offer; and communities, employers, and families in the United States got to retain individuals who were contributing to our country in large and small ways.

But, as I’ve indicated before, sometimes philosophical roadblocks (including bias and prejudice) blind folks to their own self interest. And, I’m NOT talking about the DHS Counsel here;  their hands are tied and clearly nobody asked them before the politicos changed the policies.  They are just the “messengers” for policies that they don’t necessarily endorse.

Why The U.S. Immigration Court In NYC Is Overwhelmed: Listen & Read WNYC/NPR Senior Reporter Beth Fertig’s Report (Quoting Me) Here! Without Reforms, Due Process Is In Peril! Why Not “Give Due Process A Chance?”

“This is why experts say it’s hard to imagine Donald Trump deporting more criminal immigrants than Obama. “I think this administration already takes a fairly broad view of who is a criminal,” said Paul Wickham Schmidt, who was an immigration judge in Arlington, Virginia for 13 years.

Trump has claimed there are two to three million undocumented immigrants with criminal convictions. The government has said that number is actually just below 2 million and includes non-citizens who are in the country legally (like Bilanicz), as well as undocumented immigrants.

The government has put more resources into immigration enforcement. But Schmidt said it hasn’t done enough to help the court system meet the growing demand. There were fewer than 300 immigration judges for the whole country last year, and they were hearing more than 220,000 cases. Schmidt said even 100 additional judges would barely keep up with incoming cases, let alone the backlog.

“If you start doing the half million cases that are pending then you’re going to fall behind on the incoming cases,” he said.

Judges have also complained that the government fast-tracked unaccompanied minors and families from Central America and Mexico who crossed the border in a “surge” a couple of years ago. These recent arrivals got priority over immigrants who had been waiting years for their hearings or trials, leading to bigger backlogs.

The whole [Master Calendar] process took about five minutes for each case, and [Judge Amiena] Khan was scheduling future court appearances as late as August of 2018. This isn’t so bad given, that Schmidt said he was scheduling hearings for 2021 before retiring last summer. But one lawyer in court that morning, Shihao Bao, agreed the system couldn’t possibly handle more cases unless Trump wanted to “take away due process.”

To paraphrase Chief Justice John Robert’s spot-on observation in the immigration case Nken v. Holder, 556 U.S. 418, 421 (2009), providing due process in an individual case takes time: “[S]ometimes a little; sometimes a lot.”  As I have said numerous times on this blog, the “just peddle faster approach” to due process in the U.S. Immigration Courts, unsuccessfully tried by past Administrations, isn’t going to “cut it” for due process.

And, cutting corners is sure to be more expensive to the taxpayers in the long run when Article III U.S. Courts of Appeals inevitably intervene and use their independent authority to stop the “assembly line” approach to justice and force the return of numerous cases to the Immigration Courts for “redos,” sometimes before different Immigration Judges.

I’m relatively certain that some of the Ashcroft-era cases “bounced back” by the Courts of Appeals are still kicking around the Immigration Courts somewhere without any final resolutions.  With the help of the local immigration bar and the ICE Office of Chief Counsel I finished up a fair number of these “oldies” myself during my time at the Arlington Immigration Court.  By the time the cases finally got to my Individual Hearing calendar, most of the individuals involved had qualified for relief from removal or, alternatively, had established lengthy records of good behavior, tax payment, contributions to the community, and U.S. family ties that made them “low priorities” for enforcement and resulted in an offer of “prosecutorial discretion” from the Assistant Chief Counsel.

In the Arlington Immigration Court, the Office of Chief Counsel had a strong sense of justice and practicality and was a huge force in helping to get “low priority” cases off the docket whenever possible consistent with the needs and policies of their DHS client.  But, I know that the Offices of Chief Counsel in other areas did not perform at the same consistently high level.

Rather than having enforcement efforts stymied and having to redo cases time and time again to get them right, why not invest in providing really great fairness and due process at the “retail level” of our justice system:  the United States Immigration Courts?  Getting it right in the Immigration Courts would not only save time and money in the long run by reducing appeals, petitions for review, and actions for injunctions directed to higher courts, but would also produce a due process oriented Immigration Court system we could all be proud of, that would have great credibility,  and that would serve as an inspiring example of “best practices” to other courts and even to immigration systems in other countries.  After all, the “vision” of the U.S. Immigration Courts is supposed to be:  “Through teamwork and innovation be the world’s best tribunals guaranteeing fairness and due process for all.”  Why not “give due process a chance?”

Writing In “The Hill,” BIA and Congressional Staff Vet Nolan Rappaport Says Trump Must Combine Legalization With Interior Enforcement to Succeed

“As of the end of Nov. 2016, the average wait time for a hearing was 678 days. President-elect Trump will have to reduce the population of undocumented immigrants to a manageable level with a very large legalization program before he will be able to address the home free magnet.

Also, so long as immigrants who want to come here illegally think that they will be safe from deportation once they have reached the interior, they will find a way to get past any wall that he builds to protect our border.”

Nolan’s thoughtful article gives a great summary of the prosecutorial discretion (“PD”) programs put into effect by the Obama Administration.  Although Nolan is is OK with the concept of PD, he believes that by formalizing and publicizing the PD program, the Obama Administration has given a “home free” signal to undocumented migrants who reach the interior of our country.  Nolan believes that this acts as both a magnet for undocumented immigration and a barrier to effective immigration reform legislation.

I agree with Nolan that removal of most of those with cases backlogged on the Immigration Court dockets will prove impractical.  I also agree with him that the huge backlogs and lengthy waiting times for hearings have robbed the Immigration Court system of credibilty.  But, with due respect, I tend to doubt that addressing “the home free magnet” is the primary answer to a workable system.

First, I think that human migration is an historic phenomenon driven primarily by forces in sending countries which we do not control.  Addressing the “root causes” of these problems has proved elusive.  Efforts to provide assistance through foreign governments have been largely unsuccessful because of endemic corruption and lack of the necessary infrastructure.  Efforts administered by the State Department and USAID within foreign countries have shown some promise, as described in one of my earlier blogs (12/26/16).  Yet, to date, they appear to be too labor intensive and too limited in the number of individuals who can be reached to have a major effect on migration patterns.

Additionally, I doubt that migration will be controlled without legislative changes and expansion of our legal immigration system to better match supply with demand.  Currently, the demand for immigration by U.S. citizen and lawfully resident families, U.S. employers, and displaced or threatened individuals in foreign countries far exceeds the supply of available visas.  Continued immigration is a reality and, in fact, a necessity for our nation’s prosperity.  Until there is a better balance between supply and demand, individuals will, as Nolan suggests, continue to breach any walls or interdiction systems that we can construct.  And, differing from Nolan, history shows that they also will evade interior enforcement efforts which, in any event, will prove to be costly, ineffective, disruptive, and unacceptable from a civil liberties standpoint.

Yes, I know this isn’t what folks, particularly those “outside the Beltway,” want to hear.  But, the fact that my message might be unpopular in today’s climate doesn’t necessarily mean that I’m wrong.

Immigration is a complicated issue that will require thoughtful, creative, cooperative, and human-oriented solutions.  Merely doubling down on enforcement, whether popular or not, will not give us control over human migration.
