The White House denies that political cowardice caused its foot-dragging. But if true, this wouldn’t be the first time fear of right-wing blowhards distorted Biden’s immigration policies.

In February, Biden announced he was lifting Donald Trump’s draconian restrictions on worldwide refugee admissions. Then, inexplicably, Biden didn’t sign the paperwork to put his change into effect. Refugees who’d already been fully vetted, approved and booked onto flights by the State Department were left stranded.

For months, the White House refused to explain the delay; spokespeople repeated the same content-free bromides about how Biden believes refugees are “the heart and soul of this country.”

Eventually it came out that Biden was dragging his feet because of worries about political optics.

Then as now, his attempt to duck GOP attacks backfired. His delays inspired several negative news cycles about his broken promises. By the time he finally signed the paperwork, the refugee system had been effectively shut down for months, leaving Biden on track to close out the fiscal year with the lowest refugee admissions on record.

Even lower than under Trump alone.

You might wonder how the nativists have responded to Biden’s attempts to cave to their preferences. Unsurprisingly: They’re still not happy!

Amid Biden’s delays over the refugee ceiling, and his decisions to maintain other (possibly unlawful) Trump-era immigration policies, Trumpers continued to attack him. Fast-forward to today, as former Trump officials ludicrously fearmonger that Afghans who assisted U.S. troops are dangerous and claim that efforts to rescue them are an extension of Biden’s “self-destructive open border policies.” Tucker Carlson and fellow Fox News colleagues accuse Biden of encouraging Afghan refugees to “change” or even “invade” America, offering rhetoric reminiscent of the white-supremacist “Great Replacement” conspiracy theory.

Here’s the thing Biden never learned: No matter what he does, these bad-faith demagogues will accuse him of “open borders.” So he might as well pursue the policies he thinks are right and not let decisions be dictated by fear of how Fox News might frame them.

This is especially true of today’s Afghan refugee crisis, since there are many conservatives who do support efforts to keep our promises to wartime allies and welcome them here for resettlement. They include veterans who fought alongside these allies, as well as Republican governors, senators and congressmen.Republican lawmakers voted overwhelmingly to fund more visas for Afghan allies, as Rep. Peter Meijer (R-Mich.) pointed out in an interview.

“If there is one immigration issue that could have rallied conservatives, it is the protection of Afghans who have helped our military,” said Ali Noorani, president and chief executive of the National Immigration Forum, an advocacy organization working with faith, law enforcement and business leaders. “This was a profound misreading of the politics by the [administration]. And, even worse, believing Tucker Carlson represents America.”

Biden calls himself pro-immigrant. His appointees to senior immigration posts have generally been excellent. And unlike his openly xenophobic predecessor, Biden speaks warmly of newcomers and their contributions to this country. But such words are meaningless if he still caves to the bigots when it matters.

As I always say, actions speak louder than words! The essence of Catherine’s article is so true, and bears repeating and remembering by all members of the NDPA:

None have said it better and more clearly! And, it’s true not just of Biden, but of Dems almost across the spectrum. When “push comes to shove” they are too often unwilling to stand up for their own values and implement them in the face of well-orchestrated right wing lies and myths. 

Having a competent implementation plan, staffed and led by progressive experts, is another frequent Dem failure. The GOP has no problem bringing in unqualified ideologues and hacks to carry out their toxic agendas at the “retail level” of Government.

But, the Dems leave the “progressive all-star team” in the dugout! I’ve pointed out many times that no matter how noble your rhetoric, or meritorious your ideas, you’re doomed to failure if you don’t have the courage, expertise, and determination at the “retail levels” of Government (including the legal system, particularly EOIR) to put better Government into effect.

Catherine is right that many of Biden’s upper level immigration appointees are promising. But, the critical levels below them are still infested with Trump holdovers and folks who simply lack the progressive knowledge, courage, and skill set to constructively solve problems and implement long overdue reforms.

I’ve actually lived through it in a number of Administrations where once in office, the Dems basically carried out the GOP immigration agenda, pissed off some of their most loyal supporters, but were still characterized as “open borders” and “weak” by the GOP while actually killing, maiming, and destroying the lives of those they once had pledged to protect! Could there be a worse result?

As usual, Catherine’s analysis is much clearer, more succinct, and more articulate than the gibberish and double-talk that often comes out of politicians on both sides, but particularly the White Nationalist nativist crowd. I’ve suggested before that the Biden Administration or Dems in Congress would do well to hire Catherine as their spokesperson and “press flackie” on immigration. They also would do well to pay attention to her substantive analysis on issues including immigration and the economy.

But, even if they weren’t, we would have a moral obligation to help Afghan refugees after 20 years in their nation, during which many have been placed in life-threatening situations because of their assistance to us or their adherence to our stated ideals and promises.

Many of us have been warning for some time about the catastrophic human and moral consequences of the Biden Administration’s “slow walk” to repair the intentional, legally questionable, and unconscionable dismantling of the once-proud U.S. Refugee Program done by the Trump White Nationalist kakistocracy and its cowardly cronies, enablers, and bureaucratic toadies. (The same is true of our legal asylum system, which deals with refugees in a different context.)  Now, our worst fears are playing out with the world watching and lives in the balance.

In an interview with ABC News, Mr. Biden himself for the first time hinted at flexibility on the deadline, “if there are American citizens left.” That won’t be enough: This country’s moral responsibilities begin, but do not end, with U.S. citizens. On Tuesday, Sen. Ben Cardin (D-Md.) received and forwarded to Secretary of State Antony Blinken an appeal from the National Association of Women Judges on behalf of 250 Afghan women judges, trained by Americans and other Western countries, some of whom sentenced Taliban fighters to prison for murder or other crimes. These criminals have just been released by the Taliban. The judges have thus joined the ranks of the fearful. This country must make time for all of them.

NAWJ is the U.S. Chapter of the International Association of Women Judges, an organization which NAWJ founded, developed and helped grow. NAWJ joins the IAWJ in expressing our grave fears for the basic human rights of women and girls in Afghanistan as the Taliban advance and take control of large parts of the country. In particular, the women judges have disclosed that because they have followed their country’s laws, conducted trials, and administered sentences to the guilty, many of whom are members of the Taliban, they will soon be targeted for assassination. The AWJA judges have served in criminal, anti-corruption and narcotics courts, developed in conjunction with the United States over many years. Through their efforts, they have implemented rule of law and anti-corruption principles which are central to the mission statements of NAWJ and IAWJ.

At a virtual meeting of the AWJA last month, at which a number of NAWJ members were present, the Afghan judges spoke about the dangerous and difficult conditions in which they live and work. Some judges have lost their lives in terrorist attacks and several of the judges present had received death threats. Some have already been forced to flee their posts in the provinces with their families because it was too dangerous to remain. Their fears are not theoretical. In January, two women judges traveling to their jobs at the Supreme Court of Afghanistan, were murdered in the street. Now, the prisons housing convicted terrorists have been opened, and sentenced prisoners are contacting their judges threatening reprisals and revenge.

As a chapter of the IAWJ, an organization comprised of over 6500 women judges from more than 100 countries and territories worldwide, NAWJ wants to draw particular attention to the situation of Afghan women judges, given the special role they have played in upholding the rule of law and human rights for all, and the particular dangers they face as a result. We honor their commitment and their courage. Today, some 250 women serve as judges there.

Today, it is reported that the Afghan government has collapsed. The President of Afghanistan has fled the country. The United States Department of State is currently prioritizing visas for employees of the United States, including interpreters, as the United States reaches its date for final withdrawal from Afghanistan. NAWJ urges the Department of State to include the Afghan women judges and their families, who are in such a desperate and precarious position, in facilitating travel and processing visas in the same manner that special measures are being extended to interpreters, journalists and other personnel who provided essential service to the foreign military forces in Afghanistan.   NAWJ urges our government to consider the fate of the women judges. By serving as judges and helping develop the Afghan judicial branch, women judges have helped establish the rule of law in their country, an essential pillar of a democratic state. Allowing them to be at the mercy of the Taliban and insurgent groups, given what they have sacrificed and contributed working side by side with the United States would be tragic indeed.

Also, many thanks to Senator Ben Cardin (D-MD) for sending this to Secretary of State Anthony Blinken who hasn’t exactly covered  himself in glory or shown much moral or intellectual courage in standing up for the rights and lives of refugees and energizing the bureaucracy to save lives.

Compare this with the conspicuous lack of moral, intellectual, and legal leadership and effective action from the Biden USDOJ on refugee and asylum issues. 

Sadly, as many of us tried, in vain, to tell the incoming Biden Administration, failure to make immediate, bold, progressive, humanitarian, due process reforms at EOIR and to take a strong, courageous stand against the continuing misuse of bogus legal rationales to suspend refugee and asylum processing (and ignore our legal and moral obligations to refugees and other migrants) at the border will likely cripple the US response to arising human rights catastrophes and cost more innocent human lives.

Human rights and immigrant justice are not “back burner” issues! Nor are they “rocket science!” Delay costs lives and undermines democracy and our international leadership.

A Statement From the ED: CLINIC Condemns Federal Ruling to Resume Migrant Protection Protocols
SILVER SPRING, Maryland — The following is a statement from CLINIC Executive Director Anna Gallagher:

“CLINIC staff and volunteers have accompanied and provided legal counsel to thousands of men, women and children who sought safety at our doors, only to be stranded in Mexico in inhumane conditions through MPP. They desperately waited for protection and admission to one of the richest countries in the world, in increasing danger, by design of the U.S. government.

MPP is a national shame.

Jesus said, ‘whatever you did for one of the least of these brothers and sisters of mine, you did for me.’ Judge Kacsmaryk’s decision is contrary to man’s law and God’s law and must be overturned. We now call on President Biden to act on his faith and once again, end this policy that is so contrary to our values and who we aspire to be.”

In case you miss the irony, think of this: At the very moment we are pleading with the international community to help extricate us from the humanitarian disaster in Afghanistan, we are illegally and arbitrarily turning away legal asylum applicants at our border, many of them women and children with claims just as compelling as those from Afghani women and girls, and returning them to dangerous areas with NO PROCESS AT ALL!

And, Judge K would like to support his GOP White Nationalist buddies in Texas and Missouri by unlawfully reimplementing “Remain in Mexico” — a much-studied, vigorously and rightfully criticized program deemed a practical, human rights, legal, and humanitarian disaster by every credible human rights organization.

  • Confirms and amplifies they absurdity and wrongness of US District Judge Kacsmaryk’s recent decision to “restore” the unlawful, cruel, inhumane, and unnecessary MPP (“Let ‘Em Die In Mexico”) https://immigrationcourtside.com/2021/08/14/%e2%98%a0%ef%b8%8f%e2%9a%b0%ef%b8%8falternate-universe-where-human-rights-human-dignity-due-process-dont-matter-trumpist-usdj-shafts-asylum-seekers-of-color-by-reinstating/;
  • As the human rights situations in Afghanistan, Haiti, and the Northern Triangle continue to unravel, the lack of a coherent, operational, legally sound, properly generous refugee and asylum program will continue to haunt the Administration;
  • In particular, the disgraceful failure to establish a strong, consistent, humane, and protection-oriented interpretation of gender-based asylum to protect women, who are disproportionately targeted for persecution, torture, and other violence, will cost lives of the most vulnerable and be a lasting stain on our nation. The need to fix our our refugee and asylum systems immediately was obvious on January 20, 2021. Why, after 7 months it still is nowhere close to being accomplished is less obvious!

The turmoil in Afghanistan and Haiti and the ongoing human rights disasters in Latin America, all reasonably predictable, are going to increase the human and political problems flowing from a failure to take human rights seriously and to bring the practical human rights experts necessary to solve these issues constructively into the Government power structure! In the end, human rights are everyone’s rights! We ignore that at our peril!

Ironically, while protecting women from persecution and improving their lives was used as a justification by Administrations of both parties for our continuing military presence in Afghanistan, now, as the “end game” plays out in real time, it appears to have been largely reduced to a “talking point” (or a “news feature”) without any discernible plan for protecting or saving Afghan female refugees. Sadly politicos and officials from both parties seem more interested in using women’s lives as “cover” for two decades of ultimately futile presence there than with actually saving any lives now. Indeed, if we treat Afghan women refugees with the inhumane indifference we have continued to heap on female refugees seeking legal asylum at our Southern Border, their outlook is beyond grim.

America was founded as a safe haven to persecuted people and a beacon of hope, liberty and freedom to people around the world. Those themes reflect our values, and the welcoming of refugees to our shores is one of our proudest legacies and a fundamental part of who we are as a nation.

As military leaders, we spent nearly four decades defending these values. But today, a core American legacy is at risk, as the Trump administration is reportedly considering issuing severe, unprecedented cuts — potentially even zeroing out — the bipartisan U.S. Refugee Admissions Program, the established legal means of entry for these deserving people.

This week, we joined a group of 27 retired generals and admirals — all of whom have been operational leaders in military conflicts and exhibited courage in defending our values on the battlefield — in writing to President Trump expressing grave concerns about the direction of this vital program.

That’s because for many of us, welcoming refugees is not just a matter of smart policy and a reflection of our national values; it is also personal. Many of us know these refugees: They worked for and with us in our fight against terrorists and insurgents. The tangible and significant improvements we were able to make in the lives of millions as well as efforts to protect our own soldiers, sailors and Marines would not have been possible without the dedicated efforts of thousands of Iraqi and Afghan interpreters, logisticians, engineers and others.

Many of those individuals were targeted because of their assistance to us. They and their families have often been threatened for working with coalition forces, yet they bravely continued in their service at every level from translating conversations at the infantry squad level to contributing to task-force-level diplomatic missions. They may claim different cultures and speak different languages, but they have all put their lives on the line along with our citizens as part of our team.

Many of our partners continue to live in fear, given the continued hazardous situations in various parts of the world. In Iraq alone, more than 100,000 await entry to the United States. We promised our Iraqi partners support and safety when they were shoulder to shoulder with us fighting a despicable enemy. If today we turn these people away, or reduce the numbers who are allowed entry, it will be extremely difficult to ask others to assist us in the future.

Providing safety to people who assist American troops is a core function of our refugee program, but it does not stop there. We are living in a moment of unprecedented global displacement. Of the nearly 26 million refugees across the globe, most are hosted by low- and middle-income countries bordering the unstable areas that people are fleeing. A small proportion of the most vulnerable — less than 5 percent — are selected for resettlement. In addition to humanitarian assistance, resettling refugees is a concrete way that the United States offers support to these countries, while also strengthening regional stability and reducing the risk that people will be forced to return to conflict zones.

We know firsthand that both the humanitarian and strategic consequences of conflicts in Iraq, Syria, the Balkans and East and West Africa would be much worse had neighboring countries closed their borders. We also know that conflicts can restart when refugees are sent home prematurely. Of the 15 largest returns of refugees since 1990, a third have resulted in the resumption of conflict and the slaughter of innocents.

When we slam the door on refugees, we encourage other nations to do the same, contributing to a less compassionate and more dangerous world, one in which our military will increasingly be called to provide stability.

Over the past 40 years, the United States has welcomed about 3 million refugees from around the world who have gone on to contribute to and strengthen this country in immeasurable ways. The average refugee admission level across both Republican and Democratic administrations is 95,000 annually. Yet in the last two years, admissions have plummeted 75 percent.

In the next two weeks, the president will decide how many refugees we will admit in 2020. That decision will determine whether we uphold America’s legacy as a haven for the persecuted, and it will send a powerful message to the world about who we are as a people. We strongly recommend that this lifesaving humanitarian program be restored to historic bipartisan-supported levels.

So much for the Trump Administration’s “solution” of returning refugees and other forced migrants to danger zones in their own countries or to countries that are equally or more dangerous. Killing and abusing forced migrants through improper returns and “deterrents” intended to make them “die in place” is reminiscent of other types of “final solutions” that were disastrous for humanity. Only, this time, the U.S. is the “leader of the pack” downward rather than one of those fighting to save humanity.  

A thoroughly cowardly performance by Trump and his White Nationalist gang.

Also, for the more than four decades I have been involved in immigration and refugee issues, overseas refugee admissions have received overwhelming bipartisan support. What has happened to the GOP which suddenly has “swallowed the whistle” in the face of Trump’s cowardly White Nationalism?

It appears that retired military leaders, like former U.S. Immigration Judges, can make a “full time job” out of speaking out against the stupid, counterproductive, and inhumane policies of the Trump Administration.

A PRESIDENCY WITHOUT INTELLIGENCE IS A THREAT TO OUR NATIONAL SECURITY: By Contrast, Individuals Seeking Asylum Through Our Legal System @ Our Southern Border Are No Such Thing — “None of the [U.S. intelligence] officials said there is a security crisis at the U.S.-Mexico border, where Trump has considered declaring a national emergency so that he can build a wall.”

James Hohmann from the “Daily 202” in today’s WashPost:

— Here are five of the main issues where the intelligence community leaders broke with Trump:

  1. Coats “said that North Korea was ‘unlikely to completely give up its nuclear weapons and production capabilities,’ which the country’s leaders consider ‘critical to the regime’s survival.’ That assessment threw cold water on the White House’s more optimistic view that the United States and North Korea will achieve a lasting peace and that the regime will ultimately give up its nuclear weapons.’”

  2. None of the officials said there is a security crisis at the U.S.-Mexico border, where Trump has considered declaring a national emergency so that he can build a wall.”

  3. Officials also warned that the Islamic State was capable of attacking the United States and painted a picture of a still-formidable organization. Trump has declared the group defeated and has said he wants to withdraw U.S. troops from Syria as a result.”

  4. The officials assessed that the government of Iran was not trying to build a nuclear weapon, despite the Trump administration’s persistent claims that the country has been violating the terms of an international agreement forged during the Obama administration. Officials told lawmakers that Iran was in compliance with the agreement.”

  5. Officials also warned, as they did last year, about Russia’s intention to interfere with the U.S. political system. … Trump continues to equivocate on whether Russia interfered in the 2016 election on his behalf, contradicting the unanimous assessment of all the top intelligence officials currently serving.”

I’ve been saying on “Courtside” for some time that the real existential threat to our national security is Trump. While the Administration has undoubtedly completely screwed up our asylum system at the border and in the U.S. Immigration Courts that has almost nothing to do with “national security.”

It’s simply a matter of common sense: We know (or should know) almost exactly what the number oF arrivals is going to be, particularly when they travel in slow-moving “caravans” that easily can be tracked and anticipated. We certainly could “funnel” almost all of them into the legal screening system for asylum.

Get the Inspectors and Asylum Officers down there to do the screening, and the necessary Immigration Judges, ICE lawyers, and defense counsel to decide cases of those screened in! Take lower priority cases, most involving long-term residents who have been here and likely will continue to be here for years, off the overcrowded Immigration Court dockets!

This would allow processing of the “new influx” in a timely manner, with full due process, and without creating more “Aimless Docket Reshuffling” in the Immigration Courts. It would also avoid the always ineffective, wasteful, and usually illegal “gimmicks” that the Administration has used to “game” the asylum system against applicants. And, certainly in this respect, getting more pro bono lawyers involved would be a much bigger help than more unneeded troops or Border Patrol Agents.  Let the Border Patrol go back to their job of apprehending those border crossers who aren’t turning themselves in at or near the border to apply for asylum. Stop wasting resources and solve the problem!

Meanwhile, we should all be scared by Trump’s disregard of the prudent advice of his “national security and intelligence team.”

There Are More Than 5 Million Syrian Refugees. The Trump Administration Has Admitted 2 of Them.

State Department data shows that many nations’ refugees are still effectively banned.

The United Nations estimates that there are 5.5 million Syrian refugees. In the past three months, the United States has allowed two of them to enter the country—down from about 3,600 in the last three months of the Obama administration.

After kicking off his presidency by temporarily banning refugees, Donald Trump lifted the ban in late October. But at the same time, he increased scrutiny of refugees from 11 countries, requiring that they be admitted only if doing so fulfills “critical foreign policy interests.” Refugee advocates said that the language would effectively ban refugees from a group of mostly Muslim-majority nations. Data from the State Department’s Refugee Processing Center reviewed by Mother Jones confirms their prediction.

The United States has taken in 44 refugees from the targeted countries since Trump issued his executive order, compared to about 12,000 during the same period last year. The countries are Egypt, Iran, Iraq, Libya, Mali, North Korea, Somalia, South Sudan, Sudan, Syria, and Yemen.

The heightened vetting of people from those countries has driven down the total number of Muslim refugees coming to the United States. About 550 Muslim refugees have been admitted to the United States since the executive order. More than 11,000 arrived during the same period last year. The share of admitted refugees who are Muslim has dropped from 48 percent at the end of the Obama administration to 11 percent in recent months.

Under Trump’s October executive order, the Department of Homeland Security (DHS) would conduct a 90-day “in-depth threat assessment of each [targeted] country.” During that period, DHS said in a memo to Trump, it would only take refugees from the 11 countries “whose admission is deemed to be in the national interest and poses no threat to the security or welfare of the United States.”

The 90-day mark passed last week. But Sean Piazza, a spokesman for the International Rescue Committee (IRC), a refugee resettlement agency, says the organization has not received any updates about the status of the temporary review now that the 90-day period has passed. It is unclear if it is still in effect, and DHS did not respond to a request for comment. DHS’ October memo stated that refugee admissions from the targeted countries are likely to “occur at a slower pace” beyond the 90-day deadline.

The Trump administration has tried to undermine support for accepting refugees by casting them as an economic burden. In September, the New York Times reported that White House officials had killed a draft report from the Department of Health and Human Services that found that refugees have increased government revenue by $63 billion over the past decade. The report that was ultimately published had a different calculus, documenting how much it costs to provide services to refugees but not how much they pay in taxes.

Overall, the United States in on track to resettle about 21,000 refugees this year, according to the IRC. That would be fewer than in any year since at least 1980—including 2002, when refugee admissions plummeted in the wake of 9/11. It is also less than half of the annual 45,000-refugee cap that the Trump administration set in September, which was the lowest cap ever. Historically, the United States has been considered a world leader in resettling refugees.

Before Trump assumed the presidency, it already took up to two years for refugees to be vetted and resettled, not including the time people spent fleeing their country for refugee camps. Henrike Dessaules, the communications director at the International Refugee Assistance Project, says the group has had clients who “were ready to travel, that had their medical checks, security checks, and interviews done.” Instead, “they have been completely stalled in the process,” she says.*

In 2016, the Obama administration placed its refugee limit at 85,000 people and used all but five of those slots. This year’s drop comes even though there were about 22.5 million refugees across the world in 2016, more than at any time since the United Nations’ refugee agency was founded in 1950.

Bekaa Valley, Lebanon (CNN) — The rocky, plowed hillside is scattered with clues of what happened that January night. A woman’s scarf. A diaper. Empty cans of tuna fish. A plastic bag of sugar. An empty box of Turkish chocolate biscuits. A single cheap Syrian-made woman’s shoe. Several white, mud-spattered rubber gloves.
It was here, last month, that 17 Syrians froze to death in a night-time snowstorm while trying to cross the mountains into Lebanon.
Three-year-old Sarah is one of the few who survived. She now lies in a bed in the Bekaa Hospital in nearby Zahleh, two intravenous tubes taped to her small right arm. Frostbite left a large dark scab on her forehead. A thick bandage covers her right cheek. Another bandage is wound around her head to cover her frostbitten right ear.
Sarah doesn’t speak. She doesn’t make a sound. Her brown eyes dart around the room — curious, perhaps confused. Her father, Mishaan al Abed, sits by her bed, trying to distract her with his cell phone.

Sarah, 3, suffers from frostbite after smugglers abandoned her and her family as they were crossing into Lebanon.

No one has told Sarah that her mother Manal, her five-year-old sister Hiba, her grandmother, her aunt and two cousins died on the mountain.
“Sometimes she says, ‘I want to eat.’ That’s all,” Abed says. Sarah hasn’t mentioned anything about her ordeal, and he is hesitant to ask her.

An unfortunate reunion

Until now, Sarah hadn’t seen her father for two and a half years. He left Syria for Lebanon and found work as a house painter, leaving his family behind.

ISIS controlled Abu Kamal from the summer of 2014 until last November, when it was retaken by Syrian government forces. Fighting still rages in the countryside around it, where Al Abed’s family lived.
After their house was damaged, Abed’s brother and his family, along with Abed’s wife and two children, fled to Damascus. There they paid $4,000 — a fortune for a poor family — to a Syrian lawyer who they were told had the right connections with the army, intelligence and smugglers.
The plan was for them to be driven to the border in private cars on military-only roads. From there, says Abed, they were to walk with the smugglers for half an hour into Lebanon, where they would be met by other cars.
The plan started to fall apart when snow began to fall. The smugglers abandoned the group. The family lost their way and became separated. In the dark and the cold, most of them died. It’s not clear how Sarah and a few others survived.
The only thing that is clear, says hospital director Dr. Antoine Cortas, is that “it is a miracle Sarah is still alive.”
Hidden by the darkness and the snow was a house just a few hundred steps down the mountain.

Abed was expecting his family to cross over, but became concerned when he didn’t hear from them. “I was told the army had arrested people trying to cross into Lebanon. I thought it must be them. Then the intelligence services sent me a picture. I identified her as my wife.”
He opens the picture on his cell phone. It shows a lifeless woman curled up on the snow amidst thorn bushes, a red woolen cap on her head.

A struggle to cross over, a struggle to remain

More than a million Syrians have taken refuge in Lebanon, straining the resources of a country with a population of around six million. The Lebanese authorities have, to some extent, turned a blind eye to those entering the country illegally. But they have refused to allow relief groups to establish proper refugee camps, unlike Jordan and Turkey, for fear they will become permanent.
What pass for camps — officially called “informal tented settlements” — are ramshackle affairs. Syrians typically pay $100 to a landowner to build drafty, uninsulated breezeblock shelters with flimsy plastic tarpaulins as roofs.
Abu Farhan, a man in his sixties from Hama, in central Syria, lives in one of those shelters in a muddy camp outside the town of Rait, just a few kilometers from the Syrian border. His wife Fatima is ill. She is huddled next to a kerosene stove under a pile of blankets. Between coughing fits, she moans loudly. Farhan has had to borrow more than two million Lebanese pounds — around $1,300 — for her medical treatment.

Denied proper refugee camps, many Syrian refugees live in informal tented settlements.

Illness is just one of the perils here. Vermin, he says, is another. “There’s everything here,” he chuckles bitterly, “even things I’ve never seen before. Rats. Mice. Everything!”
The dilemma that Syrians in Lebanon face is glaringly clear. They’re not welcome here, and it’s difficult to scrape by. According to a recent report by the Norwegian Refugee Council, 71% of Syrian refugees in Lebanon live in poverty.

Point of no return

Some Syrians have returned home, but many, like Abu Musa, a man in his forties who lives in the same settlement as Farhan, insist that returning would be nothing short of suicidal. He comes from Maarat al-Numan, in Idlib province, where Syrian forces, backed by Russian warplanes, are waging an offensive against government opponents.
“Of course, I’d like to go back to Syria!” Musa exclaims, gesturing around his damp, cold hut as if that were reason enough to return home. “But Syria isn’t safe. They’re fighting in my town. My house has been destroyed.”
And thus, Syrians continue to try to make their way to Lebanon, despite the very real risks.

“The people who are walking across the mountains, and taking days to cross the mountains in the middle of winter, are a testament to the fact that Syria is not safe,” said Mike Bruce of the Norwegian Refugee Council.
“Until Syria is safe, until there is a lasting peace, people should not be going back to Syria.”

By 7 p.m., the sun had set and groups of young men had begun to gather inside a small, nameless restaurant on a narrow street in Tapachula, Mexico. Anywhere else in the city, a hub of transit and commerce about ten miles north of the Guatemalan border, there would be no mistaking that you were in Latin America: The open colonial plaza, with its splaying palms and marimba players, men with megaphones announcing Jesus, and women hawking woven trinkets and small bags of cut fruit suggested as much. But inside the restaurant, the atmosphere was markedly different. The patrons hailed not from Mexico or points due south but from other far-flung and unexpected corners of the globe—India, Pakistan, Eritrea, Cameroon, Sierra Leone, Congo. Men, and all of the diners were men, gathered around tables, eating not Mexican or Central American fare but steaming plates of beef curry, yellow lentils, and blistered rounds of chapati. The restaurant’s proprietor, a stern, stocky Bangladeshi man in his thirties named Sadek, circulated among the diners. He stopped at one table of South Asian men and spoke to them in Hindi about how much they owed him for the items he’d collected on their tab. The waitress, patiently taking orders and maneuvering among the crowds of men, was the only Spanish speaker in the room.

Outside, dozens of other such men, travelers from around the world, mingled on the avenue. They reclined against the walls of restaurants and smoked cigarettes on the street-side balconies of cheap hotels. They’d all recently crossed into the country from Guatemala, and most had, until recently, been held in Tapachula’s migrant detention center, Siglo XXI. Just released, they had congregated in this packed migrants’ quarter as they prepared to continue their journeys out of Mexico and into the United States. They had traveled a great distance already: a transatlantic journey by airplane or ship to Brazil; by car, bus, or on foot to Peru, Ecuador, and Colombia; through Panama, Costa Rica, and Nicaragua; on to Honduras, Guatemala, and into Mexico. Again and again, I heard their itinerary repeated in an almost metronomic cadence, each country a link in a daunting, dangerous chain. They’d crossed oceans and continents; slogged through jungles and city slums; braved detention centers and robberies; and they were now, after many months, or even longer, tantalizingly close to their final goal of the United States and refugee status.

They are the extreme outliers of a global migration crisis of enormous scale. Today, more than 65 million people around the world have been forced from their homes—a higher number than ever recorded, as people flee war, political upheaval, extreme poverty, natural disasters, and the impacts of climate change. Since 2014, nearly 2 million migrants have crossed into Europe by sea, typically landing in Italy or Greece. They hail from dozens of countries, but most are from Syria, Afghanistan, Iraq, and Nigeria—countries struggling with war, political repression, climate change, and endemic poverty.

Their passage to supposed safety, which takes them across Libya and the Sinai, as well as the Mediterranean, has become increasingly perilous. According to the United Nations High Commissioner for Refugees, nearly 150,000 people crossed the Mediterranean in 2017. More than 3,000 are believed to have drowned. Stories of detention in Libya, as well as physical and sexual abuse, are commonplace among those who manage to make it to Europe. A recent CNN report depicted a Libyan slave auction, where people were being sold for as little as $400. Even the lucky ones who wash up on Europe’s shores may end up stuck for years in transit camps and detention centers in the south of the continent, in some cases only in the end to be deported. In 2013, in an effort to curb migration and ease the burden of migrants within its borders, the European Union began ramping up deportations. In 2016, nearly 500,000 people were deported from Europe.

While the global drivers of migration have not subsided—devastation in Syria and Afghanistan, political repression in parts of sub-Saharan Africa—200,000 fewer migrants attempted to cross into Europe in 2017 than the year before. In response to the migrant crisis, European countries have sent strong messages that newcomers are no longer welcome; they’ve built fences to stop refugees from crossing their borders and elected far-right politicians with staunchly anti-immigrant messages. Meanwhile, most asylum cases are stalled in overburdened court systems, with slim prospects for any near-term resolution, which leaves many migrants stuck in the wicked limbo of a squalid, under-resourced refugee camp or austere detention facility. Today, European authorities have stiffened their resistance not only to new arrivals, but to the hundreds of thousands of asylum-seekers who arrived years before and remain in an eerie liminal zone: forbidden to live or work freely in Europe and unwilling, or often unable, to go home.

Because of the high risks of crossing and the low odds of being permitted to stay, more and more would-be asylum-seekers are now forgoing Europe, choosing instead to chance the journey through the Americas that brings them to Sadek’s restaurant in Tapachula. Each year, thousands of migrants from the Middle East, Africa, and Asia make their way to South America and then move northward, bound for the United States—and their numbers have been increasing steadily. It’s impossible to know how many migrants from outside the Americas begin the journey and do not make it to the United States, or how many make it to the country and slip through undetected. But the number of “irregular migrants”—they’re called extra-continentales in Tapachula—apprehended on the U.S. side of the border with Mexico has tripled since 2010.

They remain a tiny fraction of the hundreds of thousands of Mexicans and Central Americans crossing into the United States. But it is a hastening trickle that may well become a flood. “These ‘extra-continental’ migrants will probably increase,” said Roeland De Wilde, chief of mission for the International Organization for Migrationin Costa Rica, “given the increased difficulties in entering Europe, relative ease of entry in some South American countries, and smugglers’ increased organization across continents.”

A migrant from Bangladesh, Sadek (in a red shirt) is part restaurateur, part migratory middleman. He can help a traveler with a good meal—or a good travel agent or immigration attorney.

One tragic lesson of the extra-continentales is that no set of governments, however callous, can solve the migration crisis by closing its doors to refugees seeking shelter. All Europe has done is redirect the flow of vulnerable humanity, fostering the development of a global superhighway to move people over this great distance. The doors will not hold, and neither will the fences. You can build a wall, but it will not work. Desperate people find a way.

“WASHINGTON — Late to his own meeting and waving a sheet of numbers, President Trump stormed into the Oval Office one day in June, plainly enraged.

Five months before, Mr. Trump had dispatched federal officers to the nation’s airports to stop travelers from several Muslim countries from entering the United States in a dramatic demonstration of how he would deliver on his campaign promise to fortify the nation’s borders.

But so many foreigners had flooded into the country since January, he vented to his national security team, that it was making a mockery of his pledge. Friends were calling to say he looked like a fool, Mr. Trump said.

According to six officials who attended or were briefed about the meeting, Mr. Trump then began reading aloud from the document, which his domestic policy adviser, Stephen Miller, had given him just before the meeting. The document listed how many immigrants had received visas to enter the United States in 2017.

More than 2,500 were from Afghanistan, a terrorist haven, the president complained.

Haiti had sent 15,000 people. They “all have AIDS,” he grumbled, according to one person who attended the meeting and another person who was briefed about it by a different person who was there.

Forty thousand had come from Nigeria, Mr. Trump added. Once they had seen the United States, they would never “go back to their huts” in Africa, recalled the two officials, who asked for anonymity to discuss a sensitive conversation in the Oval Office.

As the meeting continued, John F. Kelly, then the secretary of homeland security, and Rex W. Tillerson, the secretary of state, tried to interject, explaining that many were short-term travelers making one-time visits. But as the president continued, Mr. Kelly and Mr. Miller turned their ire on Mr. Tillerson, blaming him for the influx of foreigners and prompting the secretary of state to throw up his arms in frustration. If he was so bad at his job, maybe he should stop issuing visas altogether, Mr. Tillerson fired back.

Tempers flared and Mr. Kelly asked that the room be cleared of staff members. But even after the door to the Oval Office was closed, aides could still hear the president berating his most senior advisers.

Sarah Huckabee Sanders, the White House press secretary, denied on Saturday morning that Mr. Trump had made derogatory statements about immigrants during the meeting.

“General Kelly, General McMaster, Secretary Tillerson, Secretary Nielsen and all other senior staff actually in the meeting deny these outrageous claims,” she said, referring to the current White House chief of staff, the national security adviser and the secretaries of state and homeland security. “It’s both sad and telling The New York Times would print the lies of their anonymous ‘sources’ anyway.”

While the White House did not deny the overall description of the meeting, officials strenuously insisted that Mr. Trump never used the words “AIDS” or “huts” to describe people from any country. Several participants in the meeting told Times reporters that they did not recall the president using those words and did not think he had, but the two officials who described the comments found them so noteworthy that they related them to others at the time.

The meeting in June reflects Mr. Trump’s visceral approach to an issue that defined his campaign and has indelibly shaped the first year of his presidency.

How We Reported This Story

The Times conducted over three dozen interviews with current and former administration officials, lawmakers and others close to the process.

Seizing on immigration as the cause of countless social and economic problems, Mr. Trump entered office with an agenda of symbolic but incompletely thought-out goals, the product not of rigorous policy debate but of emotionally charged personal interactions and an instinct for tapping into the nativist views of white working-class Americans.

Like many of his initiatives, his effort to change American immigration policy has been executed through a disorderly and dysfunctional process that sought from the start to defy the bureaucracy charged with enforcing it, according to interviews with three dozen current and former administration officials, lawmakers and others close to the process, many of whom spoke on the condition of anonymity to detail private interactions.

But while Mr. Trump has been repeatedly frustrated by the limits of his power, his efforts to remake decades of immigration policy have gained increasing momentum as the White House became more disciplined and adept at either ignoring or undercutting the entrenched opposition of many parts of the government. The resulting changes have had far-reaching consequences, not only for the immigrants who have sought to make a new home in this country, but also for the United States’ image in the world.

“We have taken a giant steamliner barreling full speed,” Mr. Miller said in a recent interview. “Slowed it, stopped it, begun to turn it around and started sailing in the other direction.”

It is an assessment shared ruefully by Mr. Trump’s harshest critics, who see a darker view of the past year. Frank Sharry, the executive director of America’s Voice, a pro-immigration group, argues that the president’s immigration agenda is motivated by racism.

“He’s basically saying, ‘You people of color coming to America seeking the American dream are a threat to the white people,’” said Mr. Sharry, an outspoken critic of the president. “He’s come into office with an aggressive strategy of trying to reverse the demographic changes underway in America.”

Even as the administration was engaged in a court battle over the travel ban, it began to turn its attention to another way of tightening the border — by limiting the number of refugees admitted each year to the United States. And if there was one “deep state” stronghold of Obama holdovers that Mr. Trump and his allies suspected of undermining them on immigration, it was the State Department, which administers the refugee program.

At the department’s Bureau of Population, Refugees and Migration, there was a sense of foreboding about a president who had once warned that any refugee might be a “Trojan horse” or part of a “terrorist army.”

Mr. Trump had already used the travel ban to cut the number of allowable refugees admitted to the United States in 2017 to 50,000, a fraction of the 110,000 set by Mr. Obama. Now, Mr. Trump would have to decide the level for 2018.

At an April meeting with top officials from the bureau in the West Wing’s Roosevelt Room, Mr. Miller cited statistics from the restrictionist Center for Immigration Studies that indicated that resettling refugees in the United States was far costlier than helping them in their own region.

Mr. Miller was visibly displeased, according to people present, when State Department officials pushed back, citing another study that found refugees to be a net benefit to the economy. He called the contention absurd and said it was exactly the wrong kind of thinking.

But the travel ban had been a lesson for Mr. Trump and his aides on the dangers of dictating a major policy change without involving the people who enforce it. This time, instead of shutting out those officials, they worked to tightly control the process.

In previous years, State Department officials had recommended a refugee level to the president. Now, Mr. Miller told officials the number would be determined by the Department of Homeland Security under a new policy that treated the issue as a security matter, not a diplomatic one.

When he got word that the Office of Refugee Resettlement had drafted a 55-page report showing that refugees were a net positive to the economy, Mr. Miller swiftly intervened, requesting a meeting to discuss it. The study never made it to the White House; it was shelved in favor of a three-page list of all the federal assistance programs that refugees used.

At the United Nations General Assembly in September, Mr. Trump cited the Center for Immigration Studies report, arguing that it was more cost-effective to keep refugees out than to bring them into the United States.

“Uncontrolled migration,” Mr. Trump declared, “is deeply unfair to both the sending and receiving countries.”

As the new year approached, officials began considering a plan to separate parents from their children when families are caught entering the country illegally, a move that immigrant groups called draconian.

At times, though, Mr. Trump has shown an openness to a different approach. In private discussions, he returns periodically to the idea of a “comprehensive immigration” compromise, though aides have warned him against using the phrase because it is seen by his core supporters as code for amnesty. During a fall dinner with Democratic leaders, Mr. Trump explored the possibility of a bargain to legalize Dreamers in exchange for border security.

Mr. Trump even told Republicans recently that he wanted to think bigger, envisioning a deal early next year that would include a wall, protection for Dreamers, work permits for their parents, a shift to merit-based immigration with tougher work site enforcement, and ultimately, legal status for some undocumented immigrants.

The idea would prevent Dreamers from sponsoring the parents who brought them illegally for citizenship, limiting what Mr. Trump refers to as “chain migration.”

“He wants to make a deal,” said Mr. Graham, who spoke with Mr. Trump about the issue last week. “He wants to fix the entire system.”

Yet publicly, Mr. Trump has only employed the absolutist language that defined his campaign and has dominated his presidency.

After an Uzbek immigrant was arrested on suspicion of plowing a truck into a bicycle path in Lower Manhattan in October, killing eight people, the president seized on the episode.

Privately, in the Oval Office, the president expressed disbelief about the visa program that had admitted the suspect, confiding to a group of visiting senators that it was yet another piece of evidence that the United States’ immigration policies were “a joke.”

Even after a year of progress toward a country sealed off from foreign threats, the president still viewed the immigration system as plagued by complacency.

“We’re so politically correct,” he complained to reporters in the cabinet room, “that we’re afraid to do anything.”

“On a Thursday morning in June, near the end of Ramadan, Majed Abdulraheem arrives for work at Union Kitchen. The brightly lit, shared commercial kitchen space in Northeast Washington is filled with chef’s tables, pastry racks and the bustling of a dozen cooks building fledgling businesses. It’s Chef Majed’s second time at work today. Fasting makes the daytime heat of the kitchen too hard to manage, and so he was in the kitchen preparing orders late last night, into the early morning.

Abdulraheem, 29, works at Foodhini, a meal delivery service that employs immigrant chefs in Washington. The start-up was founded by Noobtsaa Philip Vang, a child of refugees from Laos, who discovered, after arriving from Minnesota to Georgetown three years ago to get his MBA, that he was missing the Hmong cuisine he grew up with. “I was really craving some of my mom’s food,” says Vang, “and I was thinking I wanted to find a grandma or auntie that was living in the neighborhood somewhere and just buy some of their food.”

He started mulling his own family’s immigration story: When his mom came to the United States, she had limited English skills, and finding work was difficult. His dad sometimes worked multiple jobs, sleeping in his car between shifts, to make sure the family had enough money to survive. What his mother did have, which might have been marketable if only she’d had the resources, was incredible skill as a chef. “There’s got to be a way to create opportunities for people like my mom,” he thought.

Abdulraheem is one of Foodhini’s first chefs. On its website, he offers a menu of his own design: bamiatan, a dish of crisp mini okra sauteed in garlic and topped with cilantro; mutabbal, an eggplant-tahini dip similar to baba ghanouj; and kebab hindi, meatballs cooked in a spiced tomato stew. Like Vang, his love for food and for family are inextricably intertwined: Many of the items on Abdulraheem’s menu are dishes his mother used to make for him when he was a kid growing up in a small town in southern Syria. Even after attending culinary school in Syria, and after years of working in restaurants, he still considers her, his original teacher, to be the better chef.

“You have to love cooking to be good at it,” Abdulraheem tells me through an interpreter. He is preparing the vegetables for fattoush, a staple salad of lettuce, tomato and crunchy pita chips. He stacks long leaves of romaine lettuce, one on top of the other, slicing them crosswise into small confetti ribbons as he talks, before perfectly dicing tomatoes. He cuts huge lemons in half, just once, and squeezes the juice out of them effortlessly. It’s a simple dish but one he loves to make, because it’s both universal and endlessly customizable. “I’m making fattoush, my wife will make fattoush, you can make fattoush,” he says. “But each time it will come out a little bit different, because it’s a reflection of you.”

When Abdulraheem arrived here in 2016, he became part of a long history of immigrants — often refugees — who reached the United States and began making food. You can find this tradition in Eden Center, the Northern Virginia strip mall packed with pho restaurants and pan-Asian groceries, built up by Vietnamese refugees in the 1980s. You can see it in the popular Ethiopian restaurants on U Street; in the restaurants of Peter Chang, who fled Washington’s Chinese Embassy in 2003 and acquired one of the most loyal followings of any chef in America; or in the Thai and Indian restaurants in large cities and small towns across the country.

What Abdulraheem and other refugee chefs bring when they come to America has implications beyond the kitchen. Cooking the dishes — sharing the foods of their home country — is a way of ensuring “that identity and heritage are not lost just because the homeland is,” says Poopa Dweck, author of the book “Aromas of Aleppo: The Legendary Cuisine of Syrian Jews.” They are “documenting history, in some way, for the next generation.”

It’s this diversity — the richness of so many cuisines and cultures, brought from all over the world — that makes American food so outstanding. At the moment, however, that tradition is under threat. The Trump administration has dedicated a lot of energy to barring Syrian refugees like Abdulraheem from coming into the country, while waging a multifront campaign against undocumented immigrants from Latin America. Continuing on this path would have a profound impact — not just on our food, but on our national identity.

It can be hard to explain to people who view immigration as a threat just what we stand to lose when we turn away from this ideal. Maybe a grand argument about American values isn’t the best place to begin. Maybe it’s best to start smaller, somewhere closer to home — somewhere like the dinner table.

There are things that Majed Abdulraheem doesn’t usually talk about when he’s at work chopping vegetables. But they’re on his mind a lot: How, on his last visit to his parents’ home in 2013, they begged him not to return to his apartment in Damascus but to flee Syria across the border to Jordan instead. How he did as his parents asked. And how he never got to see his father, who became ill during his exile, before he died.

The irony is certainly not lost on me. Refugees overcome great obstacles to contribute to America’s greatness; immigrants (including, yes, those without legal status) help us prosper as a society; guys like Trump and Sessions are corrosive negative influences who contribute little of positive value and do great damage to our country, our society, and our collective future every day they hold power, despite having having been given every chance to make positive contributions.

America’s continued greatness, and perhaps our ultimate survival as a nation, depends on whether we can use the legal system and the ballot box to remove corrosive influences like Trump, Sessions, and their ill-intentioned cronies from office before they can completely destroy our country.

“Since President Donald Trump took office on Jan. 20, his administration has repeatedly implemented policies that pull the welcome mat from under the feet of refugees and immigrants seeking safety in the United States. The latest directive, announced in late October, institutes new vetting measures for refugees from 11 countries, effectively extending the travel ban that recently expired.

These developments are unbefitting America’s history as a safe haven for refugees. Democratic and Republican presidents alike have ensured that the United States supports refugees who seek liberty and reject ideologies opposed to American values.
U.S. leadership is needed now more than ever, when tens of millions across the globe face life-threatening situations. Yet the Trump administration continues to issue anti-immigrant and anti-refugee policies that endanger innocent people fleeing persecution and, inherently, weaken America’s reputation both at home and abroad.
Here is a timeline of the Trump administration’s immigrant policies during its first nine months.
Travel ban
By the numbers
President Trump is pulling back America’s welcome mat at a time of unprecedented global need. This year:

More people have been forced to flee their homes by conflict and crisis than at any time since World War II.

During his first week in office, President Trump instituted a travel ban that suspended the U.S. refugee resettlement program for 120 days and barred Syrian refugees from entry to the U.S. indefinitely. It also indiscriminately excluded any travel from six other countries—Iraq, Iran, Sudan, Libya, Somalia and Yemen—for 90 days.
Opponents of the travel ban challenged the directive in the courts. The Administration drafted a second travel ban as replacement: It allowed travelers who hold green cards entry the U.S.; removed Iraq from the list of restricted countries; and struck down the indefinite ban on Syrian refugees.
Even with this second ban, an eventual Supreme Court ruling required the administration to rewrite its travel guidelines over the summer, stipulating that people who have a “credible claim of bona fide relationship” with a person living in the U.S. can enter the country. The new guidelines, however, raised more questions than answers. For example, “bona fide relationships” didn’t include grandparents or resettlement agencies until advocates further challenged the protocols. Meanwhile, thousands of vulnerable refugees who were not already on flights to the U.S. were left stranded.
“The human toll on families who have patiently waited their turn, done the vetting, given up jobs and prepared to travel is wrong,” said David Miliband, president of the International Rescue Committee (IRC), in a July 13 statement. “After decades of leading with its gold standard resettlement program, this defective policy shifts the goal posts and sees America turn its back on—and break its promise to—the world’s most vulnerable.”
The Supreme Court scheduled hearings on the legality of the travel ban, but the expiration date for the directive rendering the case moot.
End of protections for Central American refugee children
On Aug. 16, the Trump administration ended the automatic parole option for children in the CAM program (formally called the Central American Minors Refugee and Parole program). Since December 2014, the CAM program has helped reunite children fleeing gang violence in Guatemala, Honduras and El Salvador with parents already in the U.S.
Many of these children avoided a perilous journey in order to reunite with parents and relatives—who are lawfully in the U.S.—and begin their new lives with refugee status protected under U.S. and international laws, notes Jennifer Sime, senior vice president of United States Programs at the IRC. “These children are no longer separated from their parents due to conflict and unrest, and are able to attend school and have a childhood free from violence.”
Terminating this lifesaving program, as this administration has done, is brutally tearing families apart—and in many cases, endangering children.
End of the “Dreamers” program

Why the U.S. should accept more refugees
On Sept. 5, Trump ended the Deferred Action for Childhood Arrivals (“DACA”) program, which created a fair and necessary safeguard for hundreds of thousands of young people—commonly known as Dreamers—brought to the U.S. as children.
This decision puts nearly 800,000 young people at risk of deportation from the only country they have ever known. It will have a painful and lasting impact on their lives, the fortunes of their employers, and the wellbeing of their communities.
“The devastating decision to discontinue DACA … unnecessarily tears families apart,” says Hans van de Weerd, vice president of United States Programs at the IRC. “To take away the promised protection of DACA without an alternative, from those who courageously came out of the shadows to apply to the program, bolster our economy and enrich our communities, is simply inhumane.”

Historically low refugee cap
On Sept. 27, the Trump administration announced that it would cap at 45,000 the number of refugees granted admission to the U.S. in Fiscal Year 2018. This number is a historic low—the annual cap on average has exceeded 95,000 since 1980—and comes at a time when more people are uprooted by war and crisis than ever before.
“This administration’s decision to halve the number of refugees admitted to America is a double-blow—to victims of war ready to start a new life, and to America’s reputation as a beacon of hope in the world,” says Miliband. “When America cuts its numbers, the danger is that it sets the stage for other nations to follow suit, a tragic and contagious example of moral failure.”
New vetting procedures

Why the existing vetting process already works
The travel ban officially expired on Oct. 24, but the Trump administration substituted the directive with a round of new vetting procedures for refugees entering the U.S. All refugees will now need to provide addresses, phone numbers, email addresses and other details – over the past decade – for themselves and, potentially, their extended family members.
Further measures essentially allow Trump to extend the ban for 90 days for refugees from 11 countries.
“This will add months, or potentially years, to the most urgent cases, the majority of which are women and children in heinous circumstances,” says Sime. “With a world facing brutal and protracted conflicts like in Syria, or new levels of displacement and unimaginable violence against the Rohingya, this moment is a test of the world’s humanity, moral leadership, and ability to learn from the horrors of the past.”

FORMER DHS SEC MIKE CHERTOFF TELLS HOW CUTTING REFUGEE ADMISSIONS HURTS AMERICA AND ENDANGERS NATIONAL SECURITY!

“President Trump will make another decision this month that will affect thousands of people: How many refugees will the United States admit in fiscal year 2018?

The president already cut refugee admissions by more than half this year, from more than 100,000 down to 50,000. By way of comparison, the highest ceiling under President Ronald Reagan was 140,000. The president has also signaled, through his executive orders and in his budget proposal, that these cuts will carry over to next year. And in fact, some in his administration are trying to convince him to cut even further.

This would be a mistake. Cutting refugee admittances would not only be a moral failure but also damage our national interest abroad and our economy.

Of course, security is an imperative, and the refugee resettlement program is secure. U.S. security and intelligence agencies conduct multiple reviews on every refugee admitted, and only those approved for admission by the Department of Homeland Security are granted refuge in the United States.

 

There is also the humanitarian imperative: We are in the midst of the greatest refugee crisis on record, with more than 22 million people seeking safety from violence, conflict and persecution all over the world. The vast majority of refugees — nearly 90 percent — are hosted by poor and middle-income countries. Only the most vulnerable — those whose safety cannot be assured in their countries of first refuge — are selected for resettlement. For these refugees — widowed women; orphaned children; survivors of rape, torture and brutal religious persecution — refugee resettlement is a lifeline.

But what’s in it for the United States?

Strategic allies located near crises host the largest refugee populations in the world. Jordan, Turkey, Pakistan and Kenya are among the top refugee-hosting states. Their willingness to host millions of refugees contributes greatly to regional stability and security, all in regions where U.S. troops are deployed. As our military works to contain terrorist insurgencies in Afghanistan, Iraq, Syria and the Horn of Africa, forcing refugees to return to unsafe and unstable countries would make countering terrorism more difficult.

 

That’s why in 2016, when the Kenyan government threatened to close the Dadaab refugee camp and forcibly return more than 250,000 Somalis to an unstable Somalia, then-Secretary of State John F. Kerry got on a plane to Kenya. It’s also why the United States should be concerned that more than 700,000 Afghan registered and unregistered refugees have been returned to Afghanistan since 2016 — a threefold increase from 2015 — at a time when growing instability in Afghanistan and terrorist gains are forcing an increase in U.S. troop levels.

If we’re not willing to do our fair share, how can we ask front-line allies to do more?

Maintaining resettlement commitments is also critical to our military, diplomatic and intelligence operations abroad. Tens of thousands of Iraqi and Afghan nationals have put their lives on the line to support intelligence-gathering, operations planning and other essential services. Terrorist groups openly target these individuals because of their cooperation with Americans. Resettlement is instrumental to ensuring their safety — a testament to the U.S. military’s commitment to leave no one behind on the battlefield.

And in a proud American tradition, Republican and Democratic presidents have used refugee admissions to signal support for those who reject ideologies antithetical to U.S. values. In the past few decades, we have raised our admissions ceilings to take in those fleeing communist uprisings, religious persecution and tyranny.

 

Today, the United States must provide unwavering support for Muslims who put their lives at risk to reject terrorist ideologies, many of whom refused to join or be conscripted into terrorist groups, militias and state security forces persecuting their fellow citizens. The Islamic State considers all those who flee its rule as heretics subject to execution. Those who risk their lives — and their children’s lives — to reject terrorism must know, as a matter of our fight against extremism, that the United States supports and welcomes them.

Even in the wake of 9/11, the worst terrorist attack in our country’s history, President George W. Bush deliberately and explicitly maintained a refugee admissions ceiling of 70,000 annually, affirming the United States’ great humanitarian tradition.

Finally, refugees enrich and are deeply supported by our communities. Hundreds of mayors, faith leaders and business leaders have attested to the contributions refugees make. Thousands of Americans donate volunteer hours, in-kind goods and services, and private dollars to support refugees. One study estimates only 39 percent of the costs of resettlement are covered by federal dollars.

 

Despite being among the most vulnerable and destitute when they arrive, refugees thrive. Entrepreneurship among refugees is nearly 50 percent higher than among U.S.-born populations, creating jobs for Americans. More than 57 percent of them are homeowners.

Our values and our national security interests argue for raising our refugee ceiling, not lowering it. The president should seize the mantle of Reagan and fortify U.S. leadership on refugees.”

I’ll admit to not always being a Chertoff fan. In particular, his failure to support internal efforts to institute a strong prosecutorial discretion program at ICE that would have empowered the Chief Counsel to control the Immigration Courts’ growing docket was unfortunate, given his legal and judicial background.

But, I agree with what Chertoff says here. Just compare the power, logic, and moral authority of his statement with the mealy-mouthed, cowardly, morally vapid lies flowing from the mourths of xenophobic, disingenuous, fear mongers like Jeff “Gonzo Apocalypto” Sessions, Stephen Miller, Steve Bannon, Rep. Steve King, and the rest of the White Nationalist crowd!

“In 2016, the last year of President Obama’s administration, the U.S. accepted 85,000 refugees and set a goal of bumping that number up to 110,00 this year. Those plans changed with President Trump’s so-called travel ban, which set the refugee limit at 50,000 for 2016. Now, the administration is considering setting that number even lower for 2018, despite the worst refugee crisis since World War II.

The President has until October 1 to set a refugee ceiling and, the Times reports, there’s a debate raging in the White House about whether the number should be reduced to numbers not seen in decades. Leading the arguments against cutting the totals is Trump senior adviser Stephen Miller, an immigration hawk and ally of Steve Bannon and Attorney General Jeff Sessions. Miller has reportedly produced cutting the number all the way to 15,000. The Department of Homeland Security has proposed its own cut to 40,000.

The Times explains their purported thinking:

 

Two administration officials said those pushing for a lower number are citing the need to strengthen the process of vetting applicants for refugee status to prevent would-be terrorists from entering the country. Two others said another factor is a cold-eyed assessment of the money and resources that would be needed to resettle larger amounts of refugees at a time when federal immigration authorities already face a years long backlog of hundreds of thousands of asylum seekers.
This reasoning doesn’t align with the facts. Refugees are far more likely to be victims of politically motivated attacks than perpetrators. Limiting refugees does not keep America safer because refugees are not dangerous. It’s difficult not to see nativism as the motive behind pretending that they are: fear makes it easier to convince people that suffering people should be excluded from the United States. As for the cost concerns, the GOP’s feigned fiscal prudence should never be taken seriously.

By setting the refugee cap at 50,000 this year, Trump has already pushed the number lower than it’s been in decades. In the 37 years since the Refugee Act of 1980 gave the president a role in setting the cap, it hasn’t slipped lower than the 67,000 President Reagan set in 1987.

Cutting the refugee ceiling would leave tens of thousands of vulnerable people out in the cold, the International Rescue Committee said in a report last month. The humanitarian organization advocates for a ceiling no lower than 75,000 people. “An admissions level of at least 75,000 is a critical signal to the world that the United States remains a safe haven for those fleeing persecution, terror and ideologies antithetical to American democratic values,” the report says. “Anything less would be to turn our backs on the United States’ humanitarian tradition and global leadership.”

Under the last three Administrations, the US has made an absolute muddle out of two ill-advised wars and Middle East policies in general. The idea that guys like Trump, Tillerson, Miller, Bannon, Sessions, and even “the Generals” can come up with a constructive solution borders on the ludicrous. Nope. They going to to fight the 21st Century version of the “100 Years War” with similar results.

If there is a solution out there that will help achieve stability and provide a durable solution to the terrorist threats, it’s more likely going to be coming from one of today’s refugees who have a better idea of what’s actually going on and how we might become part of the solution rather than making the problems worse.

Refugees represent America’s hope. The Sessions-Miller-Bannon cabal represents America’s darkest side — one that threatens to drag us all into the abyss of their dark, distorted, and fundamentally anti-American world view.

THE HUMAN TOLL OF IMMIGRATION DETENTION: Mother Attempts Suicide After 6 Months In Texas “Family Detention Centers!”

“AUSTIN, Texas ― A woman locked at a family immigrant detention center tried to take her own life this month in what legal advocates described as a desperate effort to free her two kids.

Samira Hakimi, an Afghan national, has spent the last six months detained with her two young children despite a federal ruling that dictates they should have been released within three weeks. The case reinforces the longstanding concerns of immigrant rights groups that say asylum-seeking families should not be forced into prolonged detention.

“They told us you will only be a couple of days in there,” Hakimi told HuffPost. “I never thought that I would be detained here for such a long time. That I’m detained here because I’m from Afghanistan and that’s all. But I’m human.”

In Afghanistan, the Hakimi family had established a high school and multi-branch private university that used Western curricula, taught in both English and Dari and offered more than half its scholarships to women, according to lawyers representing Hakimi and her husband.

Since 2013, the Taliban repeatedly threatened the family for its work. To avoid the danger of commuting, the family moved onto the university campus and contracted private security guards that year.

It wasn’t enough for them to feel safe. “We could not go outside,” Hakimi said. “My children could not go to school. We thought they might be kidnapped. This was always in our minds…. They have their lives to live. They should live happy and free from every small thing, going to school and enjoying their lives.”

Last year, they fled Afghanistan with Hakimi’s brother-in-law and his pregnant wife, who were facing similar threats.

In December, the two families crossed into the United States from Mexico through a legal port of entry, where they all asked for asylum. The men were separated and sent to all-male immigrant detention centers, where they remain. Hakimi and her kids, as well as her sister-in-law and her newborn baby, were sent to the South Texas Family Detention Center in the town of Dilley and later transferred to the Karnes County Residential Center outside San Antonio.

Hakimi passed her “credible fear” interview ― the first step toward applying for asylum. It’s common practice for Immigration and Customs Enforcement to free people who pass these interviews so they can pursue their cases in immigration court, but ICE declined to release her and her children. The agency did not respond to a request for comment explaining why it refuses to release them. Hakimi’s sister-in-law is also still at Karnes with her 10-month-old baby.

The Karnes County Residential Center houses mothers who enter the United States with their children. Most of them seek asylum or other forms of humanitarian exemption from deportation.
Hakimi told HuffPost she had suffered from bouts of clinical depression before being detained. Advocates with RAICES, a nonprofit that provides legal services to detained families, say she had attempted suicide in the past and told medical workers at Karnes that her condition had worsened as her case appeared to stall. Neither medicine nor therapy would alleviate the problem, she argued. Her depression stemmed from remaining locked up in the detention center with her children.

As the months dragged on, she lost hope. “Here, no one talks to us,” Hakimi said. “They don’t give us the reason why I’m detained in here. I never thought that I would be detained here for such a long time.”

Her son came to her one day asking her why other families were allowed to leave but not them. “That was really triggering her,” Amy Fisher, RAICES’s policy director, told HuffPost. “She was crying and really depressed. And she went into this thought process, when she was really low, thinking, ‘Well, if I’m no longer here, maybe my children can be free.’” Kids cannot be held without their parents or guardians in family detention.

After she made an effort to take her own life, she woke up in the medical unit of the detention center and was taken to a nearby hospital, where two members of the detention center staff sat with her continuously.

“I told them, ‘I’m just crying for my children, please,’” she said in a recording with one of her legal providers. “I’m not sick. But they gave me medicine. And they told me take this every four hours, but I didn’t take it anymore.”

Don’t think that a few (or even many) attempted suicides or preventable deaths in immigration detention are going to change the Administration’s plans to establish an “American Gulag.” After all, what better “deterrent” than death to put a dent in migration.

No, the only thing that might get in the way is if Democrats start winning elections and wielding some political power in Washington. (Not that Democrats have been particularly enlightened when it comes to immigration detention, either. After all, Dilley, Karnes, Berks County, and other “family residential prisons” were Obama initiatives. But, that’s another story.)

But, as I just pointed out in an earlier blog, Dems appear lost in the political wilderness with no path out.

He or she has a well-founded fear of being targeted for reasons of race, religion, nationality, political opinion or membership in a particular social group.
A refugee can be an adult or a child.

Julie Wong was 10.

“It couldn’t have been longer than a football field from where we were hiding to that ship, but I remember what I saw along the way,” Wong said of the night she left the Vietnamese city Danang in 1975.

“We had to step over dead bodies. Bicycles. Suitcases. People’s lives strewn all around.”

Wong is 52 and lives with her husband in Sammamish. Their sons play football. She works for a pharmaceutical company as an oncology diagnostic consultant.

She cried when she talked about Danang being shelled and the refugee camp near San Diego where she took English classes.

She doesn’t usually talk about those things. Most people never ask, and she doesn’t feel the need to tell. She leads a busy life as a proud American.

But when Wong sees Syrian refugees on the news, running for their lives, she’s reminded of her own story.”
