Executive Director Opening Plenary Remarks CLINIC Convening 2023

Good afternoon, dear friends. My name is Anna Gallagher and I have the honor of leading CLINIC as executive director. It is such a pleasure to be here with you all as we officially begin our first in-person Convening since 2019.

Looking out at the sea of faces in front of me, I am filled with gratitude to finally be able to come together to engage with one another, to listen, learn and gather strength for the work ahead in support of our immigrant brothers and sisters.

Even just being in your presence I feel a sense of renewed hope and energy. I am so looking forward to the next few days, and I am certain that you will be reignited to take on the important work ahead.

In a moment I will welcome our wonderful panel of Affiliate experts, but right now I want to take a moment to recognize this moment we’re facing and my hopes for this year’s CLINIC Convening.

You all, of all people, know that immigrant communities are facing truly unprecedented challenges – and I do not use that word, unprecedented, lightly.

With the lifting of Title 42, and the camps of men, women and children along the border desperate to find welcome on the other side; the proposed USCIS fee increases which threaten to put immigration benefits out of reach for many; the newly announced delays for foreign-born religious workers and special immigrant juveniles; and, perhaps above all, our warming planet and the outbreaks of violence which force many more people to migrate around the world – these are extremely challenging times for migrants in our country and around the world.

Several months ago, the New York Times featured an op-ed that has stuck with me, entitled, “The Rich World Has a Shockingly High Tolerance for Cruelty.”

It was about how rich nations are more willing than ever to let migrants languish at their borders in sub-human conditions rather than create safe pathways for migration or address the conditions causing people to flee.

It was about how the promises that nations made after World War II to respect the dignity and rights of those who are fleeing have been eroded and now, on a practical level, forgotten.

When I read this article, in my mind I was transported back to the time I spent in North Africa several years ago, working with migrants as a representative of Jesuit Refugee Services.

I interviewed migrants who had traveled for 18 months or more to try and find safety in these countries bordering Europe. I got to know some of the migrants, who called me “grandma” – a term of endearment, as my hair was grey.

While I was talking to some of them, they showed me their hands, which were scarred with wounds. When I asked them what happened, they said their hands were repeatedly pierced while climbing barbed wire to get through to safety.

Hearing this, my heart broke – as it has many times over the years.

The idea that we are using barbed wire to keep out our fellow human beings is inconceivable, yet true. Our immigrant brothers and sisters stand at our gates, begging for our aid, and we build barbed wire fences that pierce their hands.

Many wealthy nations are founded on a concept of all human beings being equal in dignity, but we do not act like it.

As we gather in Arizona, I know we are all mindful that these kinds of camps that the op-ed author is speaking of are just several hours away on the border. We also know that immigrant communities’ dignity is denied not only in these camps, but all over the country in the various places we’ve come from.

We must be clear, this is not an “other side of the world problem,” it is our problem. It affects all of us, in our integrity as people of faith and conscience, and as a reflection of our society.

And yet today, as I recall that New York Times op-ed, and the sense of frustration and despair I felt while reading it, I feel a surge of hope.

I want you to look around the room. Look at your neighbor to your left and right. YOU are the hope that fills my heart, and YOU are the hope that reignites me in our work.

As we gather here today, I am in a room full of people who DO act like all human beings are equal. Those who spend their precious time – often too much of their time, working long hours – trying to advance the truth that every person is precious, valuable, and deserving of a safe and dignified life.

That’s why being in your presence gives me such hope. I am reminded that the CLINIC network is full of holy people.

That is why our gathering here together, and throughout this week, is so powerful: we are, to borrow the words of Bishop Seitz of El Paso, working to be a “creative counterexample” to the culture of fear and hostility, to be a network that is slowly creating a new culture of solidarity and hospitality.

At CLINIC, we also are bolstered by our faith that we do not do this hard work alone. The spirit of God is inspiring us and pushing us forward, giving us strength and magnifying our efforts, especially when we are overwhelmed by the need in front of us.

Our faith also acts as a mirror for us, forcing us to keep evaluating whether we are truly reflecting the gospel truth of God’s concern for all people.

To maintain this faith, and to maintain the energy to be this creative counterexample, we need one another. Our network is sustained through the support, advice, and solidarity we demonstrate to one another.

Throughout the next few days, we will take the time to step back, to reflect on our work and learn and share new strategies, information, and tips for the very practical day-to-day work of supporting immigrant clients and communities.

We know that this practical work – the forms, the bureaucracy, the nitty-gritty details – changes and saves lives. So how well we can do it matters, which is why we gather to learn and grow.

We also gather to enjoy one another – to laugh, share stories, and reconnect with beloved colleagues and friends.

So I also hope that over the next few days you will have some fun!

Thank you for coming here to CLINIC Convening and for your dedication to this work. I am so honored to be alongside all of you this week, and all days.

Now, I am pleased to introduce our panelists for our opening plenary, Preparing for the Lifting of Title 42: Key Insights from our Network. When we decided on “reunited and reignited” for our theme this year, we knew we wanted to do something different for our opening conversation.

This “Network Fireside Chat” will be an opportunity to highlight the work done by our network throughout the United States. During this conversation, you’ll hear how Affiliates in three distinct geographical regions are rising to meet the needs of our immigrant and refugee brothers and sisters – especially during this increased time of uncertainty.

From the Border region, Joel Enriquez-Cazarez will share about the work of Jewish Family Service of San Diego.

As a transit city, Carolina Rivera will share how Catholic Charities of Dallas assists our immigrant brothers and sisters.

And Yer Vang from Catholic Charities Archdiocese of Dubuque will give an interior city perspective of welcome.

USCIS Agrees to Restore Path to Permanent Residency for TPS Beneficiaries

CARECEN, Mar. 22, 2022

“U.S. Citizenship and Immigration Services (USCIS) agreed to restore a path to permanent residency for many Temporary Protected Status (TPS) beneficiaries blocked by then-acting USCIS Director Ken Cuccinelli—an illegally appointed Trump official. Because of today’s agreement, TPS beneficiaries impacted by this policy will be able to reopen and dismiss their removal orders and apply to adjust their status to become permanent residents—eliminating the threat of deportation if their TPS protections are revoked in the future.

The agreement is the result of a new settlement in CARECEN v. Cuccinelli, a lawsuit filed by Democracy Forwardthe Catholic Legal Immigration Network, Inc. (CLINIC)Montagut & Sobral, PC, and Debevoise & Plimpton, LLP in August 2020. Seven Temporary Protected Status (TPS) beneficiaries and the Central American Resource Center (CARECEN) sued the Trump administration for unlawfully denying tens of thousands of TPS beneficiaries the opportunity to take steps to adjust their immigration status and become permanent residents. In the lawsuit, the seven current TPS holders shared their stories. Now, each one now has the opportunity to obtain permanent residence.

The December 2019 policy change, disguised as a mere clarification, was one of the Trump administration’s many efforts to eliminate TPS protections for tens of thousands of beneficiaries. The groups’ lawsuit alleged the change violated the Administrative Procedure Act and the Immigration and Nationality Act; was motivated by the Trump administration’s racial and anti-immigrant bias; and was unlawfully authorized by Ken Cuccinelli, whose appointment was deemed illegal by a federal court in March 2020 in response to a separate lawsuit brought by Democracy Forward, CLINIC, RAICES, and Debevoise & Plimpton LLP.

“Today’s agreement will allow TPS beneficiaries—many of whom have lived in the U.S. for decades and built deep roots in their communities—to once again seek permanent residency and extinguish the threat of deportation if their TPS protections are revoked,” said Democracy Forward Senior Counsel John Lewis. “The Trump administration’s policy illegally sought to destabilize the lives of tens of thousands with TPS protections. We’re proud to have helped restore protections that ensure our neighbors have a path to pursue permanent residency.”

“This victory will change the lives of those individuals impacted,” stated Abel Nuñez, Executive Director of CARECEN. “As an organization, we are proud of our continued efforts to defend our community as they integrate into their new home in the U.S. CARECEN will work with those TPS members that qualify under the settlement and also keep fighting to ensure that all TPS beneficiaries who have been in the U.S. for over 20 years and have complied with everything that has been asked of them are able to apply for legal permanent residence.”

“As an organization grounded in Catholic social teaching, we celebrate today’s settlement that will prevent family separation and provide pathways to citizenship for thousands of TPS beneficiaries,” said Anna Gallagher, Executive Director of the Catholic Legal Immigration Network, Inc., or CLINIC. “Our faith tradition teaches us that we are to stand for justice and against any barrier to human flourishing. This agreement eliminates the barrier of an unlawful policy created by an illegally-appointed official. We are proud to have stood among those who fought against this policy, and we celebrate alongside our immigrant brothers and sisters whose lives will now be profoundly changed.”

Concepción de Montagut and Germaine Sobral from Montagut & Sobral P.C., who brought forward their client’s cases affected by the policy, said:  “When we saw the negative impact the policy change had on the long-awaited permanent residence applications of our clients, we knew we had to fight the policy. We are proud to have been part of a team that has fought for this change that will now allow not only our six named clients, but also thousands of TPS beneficiaries to reopen and dismiss their deportation cases and proceed with their permanent residence applications so they can remain in the US with their families and turn their dreams into reality.”

Thanks Julie! Just another example of how the NDPA goes around cleaning up the messes created by the Government immigration bureaucracy!

The attack on TPS Adjustment was one of the stupidest moves of the Trump regime. The folks they “targeted” were all long term residents, many employed, paying taxes, and making substantial contributions to our economy, and all met the requirements for lawful permanent residence. 

Rather than following the law and helping these deserving individuals to “get out of limbo,” the Trump regime wasted taxpayer money, violated the law, and attempted to undermine our economy by “targeting” them for race-based discriminatory treatment.

Fortunately, members of the NDPA like Julie and the team she mentions were there to thwart the illegal actions of “Cooch.”

Readings of the Day

In today’s reading, we see Mary travelling to the hill country in haste where she entered the house of Zechariah and greeted her cousin Elizabeth.  After hearing Mary’s voice, the infant in Elizabeth’s womb leaped.   Filled with the Holy Spirit, Elizabeth cried out to Mary in a joyful voice, blessing her, and humbly asking, “…how does this happen to me, that the mother of my Lord should come to me?”  We see a message of gratitude, love and welcome in this short gospel reading.   Elizabeth celebrates a kind story that had wrapped itself around her, as we are reminded by Padraig O Tuama in Daily Prayer with the Corrymeela Community (Day 3).  Elizabeth would soon bear her own long-awaited child.  This beloved child, who would grow up to be John the Baptist, would prepare people’s hearts to receive our Lord Jesus Christ.

This reading compels us to ask how we express our gratitude, love and welcome especially to those most in need as Elizabeth did in receiving her cousin Mary.  How do we open our hearts to receive and practice the love that Jesus taught?   Pope Francis reminds us in Fratelli Tutti that human beings cannot live, develop, and find fulfillment except “In the sincere gift of self to others.”  Nor can they fully know themselves apart from an encounter with other persons. If we are to follow the example of Elizabeth, the preaching of John the Baptist and the teaching of Jesus, we know that such encounters – moments of agape love and welcome – must occur without regard to our differences. In fact, to practice the radical love that Jesus taught and become full humans as Pope Francis teaches, we must choose love over fear, care over comfort and welcome those we encounter in the most vulnerable situations in our communities and at our borders.

A Statement From the ED: CLINIC Condemns Federal Ruling to Resume Migrant Protection Protocols
SILVER SPRING, Maryland — The following is a statement from CLINIC Executive Director Anna Gallagher:

“CLINIC staff and volunteers have accompanied and provided legal counsel to thousands of men, women and children who sought safety at our doors, only to be stranded in Mexico in inhumane conditions through MPP. They desperately waited for protection and admission to one of the richest countries in the world, in increasing danger, by design of the U.S. government.

MPP is a national shame.

Jesus said, ‘whatever you did for one of the least of these brothers and sisters of mine, you did for me.’ Judge Kacsmaryk’s decision is contrary to man’s law and God’s law and must be overturned. We now call on President Biden to act on his faith and once again, end this policy that is so contrary to our values and who we aspire to be.”

CLINIC advocates for humane and just immigration policy. Its network of nonprofit immigration programs — 400 organizations in 48 states and the District of Columbia — is the largest in the nation.

In case you miss the irony, think of this: At the very moment we are pleading with the international community to help extricate us from the humanitarian disaster in Afghanistan, we are illegally and arbitrarily turning away legal asylum applicants at our border, many of them women and children with claims just as compelling as those from Afghani women and girls, and returning them to dangerous areas with NO PROCESS AT ALL!

And, Judge K would like to support his GOP White Nationalist buddies in Texas and Missouri by unlawfully reimplementing “Remain in Mexico” — a much-studied, vigorously and rightfully criticized program deemed a practical, human rights, legal, and humanitarian disaster by every credible human rights organization.

Greetings,

 

Thanks, Dan, for circulating this decision! This is actually a CLINIC BIA Pro Bono Project case represented by Derek Stikeleather of Goodell, DeVries, Leech & Dann, LLP. In this published decision, the Eleventh Circuit held that the BIA failed to give reasoned consideration to a Cuban asylum seeker’s claims that he had a well-founded fear of future persecution. The court noted that the IJ and BIA ignored evidence that the petitioner was persecuted for being a political journalist. Congratulations to Derek Stikeleather and thank you to our BIA Pro Bono Project Attorney Rachel Naggar for guiding and mentoring Derek on this case!

As Judge Martin, concurring and dissenting, cogently explains, the BIA actually got everything wrong in this case.

Mr. Martinez has made the case that he suffered two years of threats and abuse at the hands of the Cuban government because he is a journalist for a dissident magazine (Convivencia) that is critical of the government. Although the immigration officials who heard Mr. Martinez’s account found him to be credible, they gave him no relief. The Board of Immigration Appeals (BIA) said Mr. Martinez must be returned to Cuba because the story he truthfully told did not sufficiently show either that he had been persecuted in the past, or that he had a well-founded fear of being persecuted in Cuba in the future.

Now the majority opinion gives Mr. Martinez relief on one of the grounds rejected by the immigration authorities, but not the other. Maj. Op. at 2. The majority says the BIA failed to give reasoned consideration to Mr. Martinez’s claim that he has a well-founded fear of future persecution. See id. at 16–20. I agree and join in that part of the opinion. However, I would give Mr. Martinez broader relief because I think Martinez’s experiences as he tried to live and work in Cuba show that he suffered past persecution as well. I therefore respectfully dissent.

The dissent highlights the real ongoing problem here: A system with unqualified judges, particularly the BIA’s Appellate Judges, searching for specious reasons to deny compelling, well-documented asylum claims!

EOIR is NOT dispensing expert adjudication that complies with the due process clause of our Constitution! Not by a long shot, as any real expert in immigration and human rights laws would tell you!

Yet, the farce and perversion of justice goes on, day after day, case after case @ EOIR. Only by “Dred Scottification” — viewing asylum applicants and migrants, mostly people of color, as something other than “persons” entitled to fair and respectful treatment under the law, can we explain failures such as this!

So far, Judge Garland has neither recognized the fundamental problems in his courts nor shown any serious interest in providing justice for asylum seekers and other migrants. Heck, the only “refugees” Garland is protecting are Stephen Miller’s “burrowed in cronies” @ EOIR, including the Sessions/Barr “Asylum Denial Society” hiding out in the ranks of “Appellate Judges” at the BIA! Disgusting, but true! 

Garland’s failure to take an interest in due process for migrants has come to the attention of some of the folks @ EOIR who actually believe in due process, fundamental fairness, and human decency. There is a growing sense of outrage and betrayal as they watch neo-Nazis and incompetent, biased restrictionists continue to draw fat salaries and abuse migrants courtesy of “Team Garland,” while asylum seekers continue to suffer and their attorneys are treated like dirt by EOIR! The folks who should have been put in charge of aggressively reforming and rebuilding this disgrace to American justice are still on the outside looking in, while “Clowns 🤡and political hacks (incredibly, holdovers from the “Trump regime”) rule!”

Garland’s  ancestors were fortunate. Today’s refugees and asylees, not so much. But, hey, no need to “pay It forward” once “you’ve got yours” and your life is no longer subject to the institutionalized bias, racism, and grotesque inconsistencies of America’s immigrant “justice” system.

Through the continuing outstanding efforts of folks like Derek, Michelle, CAIR, and the rest of the NDPA, we can eventually grind Garland’s Deadly Clown Courts 🤡to a halt!  No matter how much you “turn up the dial” or expand these dysfunctional and fundamentally unfair courts to railroad folks out, every reversal, remand, and injunction that the NDPA gets will further clog the 1.3 million case pipeline while saving individual lives in the process and setting favorable precedents that can be used to combat the current assault on justice and mistreatment of  people of color and women by DOJ and EOIR.

Additionally, if the pace keeps up, Circuit Courts, even the most conservative ones, like the 5th and 11th Circuits, might tire of serving as a substitute BIA. There won’t be much else on their dockets.

Maybe they will finally take a serious look at the clear unconstitutionality of the system. That will throw a monkey wrench unto Garland’s apparent plans to pretend like institutionalized racism, unprofessionalism, bias, and  gross unfairness aren’t operating under his auspices. Ideally, at some point he will decide that it’s easier to fix the mess than to try to pretend that it’s not happening.

Also, if Garland chooses to go with the same gang of DOJ attorneys who got beaten up in court on a fairly regular basis by the NDPA, the NDPA is likely to continue to feast. That’s particularly true because Garland shows every sign of stubborn determination to keep “the best due process lawyers in America” off his team, and therefore dedicated to opposing his attempt to run the Immigrtion Courts as if “elections don’t matter.”

Sure doesn’t sound like a winning strategy to me. But, hey, what do I know?  I’ve only been practicing law for about the past 50 years.

At any rate, it’s important for the NDPA to adjust from the short-term mindset that things might be better under the Biden Administration and ramp the litigation, public critique/exposure, immigrant assistance, and “resistance to evil” machines into even higher gear.

Vulnerable human lives and the future of our democracy are at stake. The Biden Administration to date has demonstrated neither capacity nor interest in addressing the real, festering problems in American justice in a constructive manner.

That’s highly unfortunate. As little as they wish to recognize it, the Administration’s racial justice efforts will go nowhere as long as Garland continues to operate a “court system”where institutionalized racism, intentional perversion of the law, and degradation of humanity are the operating principles. Certainly enlightened, competent leadership on Immigration Court reform is conspicuously absent!

Sometimes, the only way to get attention from the tone-deaf folks in charge is to break their entire corrupt system by using the tools still available under the law strategically and effectively to end scofflaw behavior and force constructive, long, long, long overdue change.

This insanely nonsensical gibberish put forth by the BIA — and defended by OIL — is an insult to the entire American justice system! Obviously, EOIR and their DOJ “handlers” unethically assume that Article III Circuit Judges will just “take a dive” and defer to illegal and illogical removal orders. Because, after all, it’s only foreign nationals (mostly people of color) whose lives are at stake! Not “real human beings.” That’s exactly what “institutionalized racism” and “Dred Scottification” look like. Nothing worth breaking a sweat about in the “21st Century Jim Crow America!”

The BIA’s anti-asylum bias and massively incompetent adjudication — on life or death matters — continues to be exposed. There likely are many, many other legitimate asylum cases that are wrongfully rejected by the EOIR “denial factory.” That’s one of many reasons why the EOIR/DHS (intentionally) “cooked stats” on the bona fides of asylum seekers arriving at our Southern Border can never be trusted!

Not everyone is fortunate enough to have competent representation and get meaningful review by a Circuit panel not on “autopilot.” This is a corrupt and broken system, the continued existence of which in its current form is a repudiation of our Constitution, the rule of law, and human decency!

The Biden Administration can, and must, put an end to this ongoing national disgrace! “Any reason to deny” is not justice!

Bad conduct, leering ‘jokes’ — immigration judges stay on bench

Chronicle investigation: U.S. Justice Department lacks strong harassment oversight for judges

WASHINGTON — One judge made a joke about genitalia during a court proceeding and was later promoted. Another has been banned for more than seven years from the government building where he worked after management found he harassed female staff, but is still deciding cases.

A third, a supervisor based mostly in San Francisco, commented with colleagues about the attractiveness of female job candidates, an internal investigation concluded. He was demoted and transferred to a courtroom in Sacramento.

The three men, all immigration judges still employed by the Justice Department, work for a court system designed to give immigrants a fair chance to stay in the U.S. Every day, they hear some of the most harrowing stories of trauma in the world, many from women who were victims of gender-based violence and who fear that their lives are at risk if they are deported to their native countries.

These judges’ behavior toward women is not an isolated phenomenon in the immigration courts system. A Chronicle investigation revealed numerous similar instances of harassment or misconduct in the courts, and found a system that allows sexually inappropriate behavior to flourish.

In response to detailed questions before President Biden took office, the Justice Department declined to comment on specific allegations against judges, citing the privacy of personnel matters in some instances and the lack of written complaints in others, but said generally that it follows department procedures on misconduct. The Biden White House did not immediately respond to a request for comment.

Interviews with dozens of attorneys across the country and current and former government officials, as well as internal documents obtained by The Chronicle, show the problems have festered for years. The Justice Department has long lacked a strong system for reporting and responding to sexual harassment and misconduct.

And when such behavior has come to its attention, the department has in some instances simply transferred the offenders elsewhere.

The judges’ behavior appears to violate the department’s conduct policies and raises questions about the immigration courts’ ability to function fairly. Attorneys who have been the victims of harassment say they fear that if they try to hold judges accountable, they risk severe consequences, not only for themselves but for vulnerable clients.

“In the moment, you just know that you have to stay calm,” said Sophia Genovese, who has been an immigration attorney for three years and worked in the field of immigration policy for five. “You know if you do anything to piss him off, that’s going to ruin your reputation in his eyes. In that moment, am I thinking that I might be perpetuating sexism in the system? No, I’m thinking, I just need to get through this.”

She added, “If all you have to do is force a smile so that your client is not deported, the answer is obvious what practitioners are going to do.”

Michelle Mendez of the Catholic Legal Immigration Network, which provides legal representation to immigrants and helps attorneys report allegations of judicial misconduct, said lawyers face tremendous pressure not to call out judges’ bad behavior, even though they know ignoring it means it is likely to continue.

“An immigration judge might retaliate against the advocate by punishing her clients — and these are people fleeing persecution, rape and even death,” Mendez said. “It’s quite literally a Sophie’s choice that should never happen in the American legal system.”

The Trump administration did little to change the pattern, The Chronicle found, and in one case even promoted a judge who many women have said made them feel uncomfortable in open court and behind the scenes for years. Justice Department data shows the administration dismissed more complaints against judges than its predecessor.

It’s a problem that Biden’s administration has inherited. The very structure of the courts creates the conditions that allow bad actors to escape consequences, experts say. But that leaves Biden with a problem, they add: Does he reform the system to be independent of political influence, or does he use his political control over it to clean it up?

What an ongoing national disgrace! The arrogance, audacity, and belief that there will be no accountability for abusing “the other” is both stunning and totally in line with four years of the Trump/Miller/Sessions/Barr/Hamilton/McHenry (surprise, all white males whose collective, genuine immigration and judicial “expertise” would fit in a thimble with room left over) kakistocracy and institutionalized abuses of migrants and their attorneys at EOIR and DOJ.

And many thanks to heroes like Michelle Mendez, Sophia Genovese, and other courageous members of the NDPA, and many “Knightesses” of our Round Table of Former Immigration Judges for having the courage to speak out in so many different and effective ways about the ongoing abuses inflicted by EOIR!

We must keep fighting and publicizing until these abuses end, and justice is restored to this ludicrously abusive, biased, openly misogynistic, anti-asylum, anti-due-process, and intentionally dehumanizing system.

The solution to the “problem” posed in Tal’s last sentence is not rocket science! 

There is nothing wrong with using Executive authority to get rid of the kakistocracy, putting in experts and widely respected “due-process warriors and warrior-queens” as judges and judicial administrators, and giving them independence to reform and reformulate every aspect of this totally broken system and the disgraceful anti-migrant jurisprudence it has spawned. Get rid of the “deadwood” (or worse), put the right folks in charge, and then trust them to solve judicial problems without political interference. That’s how any “real” independent court system works, for Pete’s sake! 

That certainly can and should include a new “merit selection system” for Immigration Judges that values immigration scholarship, human rights expertise, experience representing migrants and asylum seekers in Immigration Court, courage to oppose abuses, diversity, and a demonstrated lifetime commitment to due process and equal justice under our Constitution for all persons in the United States! 

Over time, every judge currently in the system should be required to re-compete for their job under the new merit system. That system must be open, transparent, and involve public input in the selection process. (Unlike the current, largely closed, system designed to favor prosecutors and other government attorneys, and which has produced a remarkably, shockingly non-diverse, non-expert, and non-representative “judiciary,” particularly in light of the communities most involved in, and affected by, the Immigration Court process).

Those incumbent judges who have demonstrated a commitment to guaranteeing fairness and due process for all should have no trouble being retained. But, those who have carried out the departed regime’s “dump on asylum seekers and their lawyers program” should and will be removed and replaced by better-qualified judges. Human lives simply are too important to be at the mercy of bad judges — and, without knowing exactly how many, there are some “bad judges” operating  in the EOIR system!

Remove the Clown Show🤡🦹🏿‍♂️☠️! Put Michelle, Sophia Genovese, and/or other leading members of the NDPA in charge of EOIR & the BIA and let them solve the problems! Empower them to root out the “bad actors” (including members of the “90% Asylum Denial Club” — some disgracefully ensconced at the BIA) in the judiciary, support reform of the process and the law without interfering with judicial independence, then get 100% behind the legislative push for an Independent Article I Immigration Court with expert, due-process-committed, diverse, courageous judges! 

There are hundreds, perhaps thousands, of well-qualified lawyers in the NDPA out there who could solve these pressing problems!

Stay tuned! Courtside will have lots to say about this until somebody in the Biden DOJ takes notice and solves the problem! The Clown Show has got to go!

E.A.’s mother’s recent childbirth is a serious medical event, which coupled with E.A.’s minor age, her difficulty obtaining transportation, and her difficulty navigating the immigration system without assistance, constitute “exceptional circumstances” necessitating rescission of the in absentia removal order. … The BIA’s decision was also contrary to law, and therefore an abuse of discretion. … First, the BIA improperly considered E.A.’s age separately, rather than considering age alongside other factors, when determining that she had not shown that exceptional circumstances justified her failure to appear. Second, the BIA erred when it dismissed without adequate explanation E.A.’s evidence that she is eligible for SIJS. Finally, the BIA improperly stated that E.A. was required to present prima facie evidence that she was eligible for immigration relief as part of her motion to reopen. … For the foregoing reasons, we GRANT the petition for review, VACATE the removal order, and REMAND for further proceedings consistent with this opinion.”

“Salim Al Amiri, an Iraqi citizen, seeks relief from removal on the grounds of asylum, withholding of removal, and protection under the United Nations Convention Against Torture (“CAT”). He premises his requests for such relief on the harm that he fears that he would be subjected to in Iraq at the hands of members of Iraq’s military or civilian insurgents operating in that country. Al Amiri contends that he has reason to fear he would be subjected to that harm on account of his work as a paid contractor for the United States Army during the war in Iraq, as in that role he educated U.S. soldiers about Iraqi customs and practices as they prepared for their deployment. We vacate and remand the ruling of the Board of Immigration Appeals (“BIA”) denying his claims for asylum and withholding of removal, but we deny his petition insofar as it challenges the BIA’s ruling rejecting his CAT claim.”

  • Congrats to all involved!
  • Think how much better this system would function with expert  judges who treated asylum applicants fairly from the “git go,” granted protection wherever possible in accordance with the the Refugee Act of 1980 and the (more “woke”) Supremes’ precedent in Cardoza-Fonseca, provided clear, positive guidance on how valid claims could be documented and granted, and promoted and consistently applied best practices to achieve efficiency with maximum due process.
  • At first glance, although the issue is reopening rather than a continuance, E.A.C.A. undercuts McHenry’s nativist, insanely wasteful, and totally dishonest attempt to “raise the bar” for routine continuances for asylum applicants who need time to properly document and prepare their cases.
  • The “Deny – Deny Program” — deny due process, deny relief — that infects EOIR’s “Star Chambers” (impersonating “courts”) is a huge backlog builder that kills people and screws up Court of Appeals dockets in the process. 
  • Reopening cases that should be reopened, getting to the merits, and getting the many properly grantable asylum cases represented, documented, and prioritized would be a huge step in reducing EOIR’s largely self-created and unnecessary “bogus backlog.” 
  • Ultimately, many of the clearly grantable asylum cases being mishandled and wrongly denied at EOIR, at great waste of time and resources, not to mention unnecessary human trauma, could, with real expert judges at EOIR setting and consistently enforcing the precedents, be granted more efficiently and expeditiously at the Asylum Office and ultimately shifted to a more robust and properly run Refugee Program.
  • In the longer run, once EOIR is redesigned and rebuilt as a proper court with real, independent, expert judges, it might be appropriate to place the Asylum Offices under judicial supervision, given the grotesque abuses and corrupt, perhaps criminal, mismanagement of the Asylum Offices by USCIS toadies carrying out the regime’s racist, White Nationalist, unconstitutional agenda of hate and waste.
  • NOTE TO JUDGE GARLAND👨🏻‍⚖️: Please fix the EOIR mess, Your Honor, before it brings you and the entire US justice system crashing down with it! This is a national emergency, and a damaging national disgrace, NOT a “back burner” issue!

Subject: CLINIC MTR In Absentia Win at the CA6 on behalf of SIJS-Seeking UC (E. A. C. A. v. Jeffrey Rosen)

 

Greetings,

 

Sharing this win, E. A. C. A. v. Jeffrey Rosen, out of the CA6 by my amazing colleague Rachel Naggar who manages our BIA Pro Bono Project. This was an appeal of an IJ (Memphis) denial of an in absentia motion to reopen for a 13-year old unaccompanied child.

 

Interestingly, after oral argument, OIL filed a motion to remand the case (which Rachel opposed) and the CA6 denied that motion. Seems the CA6 really wanted to issue a decision on the merits and we are grateful for the decision. Here are some highlights from the decision:

 

SIJS

·       “Notably, the IJ’s decision does not mention E.A.’s claims that she was eligible for SIJS.”

·       FN 1: “As of the December 2020 Visa Bulletin, visas are available for special immigrants (category EB4) from El Salvador to adjust their status if their priority date is prior to February 2018. If DHS removes E.A. prior to approving her visa, she will be unable to apply for adjustment of status. See 8 U.S.C. § 1101(a)(27)(J).”

 

Totality of the Circumstances

·       “Based on the totality of the circumstances, including E.A. mother’s recent childbirth, E.A.’s young age, E.A.’s mother’s failed attempts to obtain counsel to help change the address of E.A.’s hearing, and E.A.’s inability to travel from New York to Memphis for the hearing, we hold that E.A. established exceptional circumstances.”

·       “Under the totality of the circumstances, E.A.’s young age is an important factor in determining whether exceptional circumstances exist.”

 

Exceptional Circumstances

·       “E.A.’s mother’s recent childbirth is a serious medical condition that supports reopening. The statute defining ‘exceptional circumstances’ that justify reopening an immigration proceeding lists the ‘serious illness of the alien, or serious illness or death of the spouse, child, or parent of the alien’ as an example. 8 U.S.C. § 1229a(e)(1). Childbirth is a serious medical event that necessitates a recovery period.”

·       “Instead of recognizing that childbirth is a serious medical condition, the BIA minimized the seriousness of childbirth and its impact on E.A.’s mother’s ability to bring E.A. to Memphis. […] Recovery from childbirth is exactly the type of circumstance that § 1229a(e)(1) was intended to cover.”

 

Prima Facie Eligibility

·       “Finally, the BIA erred by stating that E.A. was required to prove prima facie eligibility for immigration relief. The BIA’s decision improperly states that E.A. is required to show at this stage prima facie eligibility for relief. The statute governing motions to reopen removal orders entered in absentia provides that the petitioner must ‘demonstrate[] that the failure to appear was because of exceptional circumstances.’ 8 U.S.C. § 1229a(b)(5)(C). In general, we have stated that ‘[a] prima facie showing of eligibility for relief is required in motions to reopen.’ Alizoti, 477 F.3d at 451–52. In the case of a motion to rescind a removal order entered in absentia, however, the BIA has held that ‘an alien is not required to show prejudice in order to rescind an order of deportation” or removal. In re Grijalva-Barrera, 21 I. & N. Dec. 472, 473 n.2 (BIA 1996); see also In re Rivera-Claros, 21 I. & N. Dec. 599, 603 n.1 (BIA 1996). This is consistent with the statute governing motions to rescind removal orders entered in absentia, 8 U.S.C. § 1229a(b)(5)(C), which does not list a showing of prima facie eligibility for relief from removal as a requirement to rescind in absentia removal orders. Rivera-Claros, 21 I. & N. Dec. at 603 n.1; see also Galvez-Vergara v. Gonzales, 484 F.3d 798, 803 n.6 (5th Cir. 2007) (declining ‘to affirm the IJ’s decision on the grounds that [the petitioner] has not shown that he was prejudiced by his counsel’s performance’ because ‘In re Grijalva-Barrera, 21 I. & N. Dec. at 473 n.2, provides that an alien need not demonstrate prejudice for his counsel’s erroneous advice to constitute an ‘exceptional circumstance’ justifying rescission of an in absentia removal order’); Lo v. Ashcroft, 341 F.3d 934, 939 n.6 (9th Cir. 2003) (‘follow[ing] the BIA’s usual practice of not requiring a showing of prejudice’ to rescind an in absentia order of removal). We now join our sister circuits and hold that E.A. is not required to make a prima facie showing of eligibility for relief in order to obtain rescission under 8 U.S.C. § 1229a(b)(5) of the in absentia order of removal.”

Court Grants Class Certification and Amends Preliminary Injunction in USCIS UC Asylum Jurisdiction Litigation

 

On December 21, 2020, the U.S. District Court in Greenbelt, Maryland granted Plaintiffs’ motion for class certification in J.O.P. v. DHS, No. 19:1944, a lawsuit challenging a May 31, 2019 USCIS policy limiting USCIS asylum jurisdiction over applicants previously determined to be “unaccompanied alien children.” The court certified the following class:

 

“All individuals nationwide who prior to the effective date of a lawfully promulgated policy prospectively altering the policy set forth in the 2013 Kim Memorandum (1) were determined to be an Unaccompanied Alien Child (“UAC”); and (2) who filed an asylum application that was pending with the United States Citizenship and Immigration Services (“USCIS”); and (3) on the date they filed their asylum application with USCIS, were 18 years of age or older, or had a parent or legal guardian in the United States who is available to provide care and physical custody; and (4) for whom USCIS has not adjudicated the individual’s asylum application on the merits.”

 

Simultaneously, the court granted in part Plaintiffs’ motion to amend the nationwide preliminary injunction to prevent USCIS’s deference to EOIR jurisdictional determinations and to prevent ICE’s advocacy against USCIS initial jurisdiction. The court denied Plaintiffs’ request to amend the preliminary injunction to prevent USCIS from rejecting jurisdiction based on its expansion of the “affirmative act” exception from the 2013 Kim Memo, instead granting Plaintiffs 21 days to amend their complaint to encompass this claim. As amended, the preliminary injunction has the following components:

  • It enjoins USCIS from relying on the 2019 policy for any purpose. USCIS is barred from “rejecting jurisdiction over any asylum application filed by Plaintiffs and members of the class whose applications would have been accepted” under USCIS’s previous policy, articulated in the 2013 Kim Memo.
  • It enjoins USCIS from deferring to EOIR jurisdictional determinations. USCIS is barred from “deferring to EOIR determinations in assessing jurisdiction over asylum applications filed by Plaintiffs and members of the class.”
  • It orders USCIS to retract adverse decisions already made. USCIS must “retract any adverse decision rendered on or after June 30, 2019 that is based in whole or in part on any of the actions enjoined and restrained” as described above.
  • It enjoins ICE from advocating against USCIS initial jurisdiction. Where a class member’s asylum application is pending before USCIS, ICE is barred (both at the IJ and BIA levels) from seeking denials of continuances or other postponements to await adjudication of the I-589 filed with USCIS, seeking EOIR exercise of jurisdiction over an asylum claim where USCIS has initial jurisdiction under the terms of the 2013 Kim Memo, or otherwise taking the position that USCIS lacks initial jurisdiction over the class member’s asylum application.

Counsel for the Plaintiffs will continue to provide updates to practitioners as this litigation progresses. Finally, at long last, some Article III judges are “calling out” the highly unethical and glaringly unconstitutional “partnership” between ICE enforcement and EOIR to screw asylum seeking kids.

The EOIR White Nationalist agenda 🏴‍☠️ of limiting legitimate continuances and administrative closing to mindlessly, improperly, and inefficiently proceed in Immigration Court on matters that should be resolved through USCIS adjudication is not only thoroughly corrupt, but also totally counterproductive, as uncontrollably mounting EOIR backlogs and increasing Article III Court interventions have shown.

And, the completely unconstitutional and unethical call early on by corrupt former AG Jeff “Gonzo Apocalypto” Sessions 🤮 for “his wholly owned EOIR judges” to join their “ICE enforcement partners” in racist immigrant bashing initiatives should long ago have been a basis for the Article IIIs to declare this entire ungodly mess in the Immigration Courts to be unconstitutional under the 5th and 14th Amendments.

On December 10, 2020, the Ninth Circuit issued an order vacating the decision of the Board of Immigration Appeals in Matter of E-R-A-L-, 27 I&N Dec. 767 (BIA 2020). Albizures-Lopez v. Barr, No. 20-70640, 2020 WL 7406164, 2020 U.S. App. LEXIS 38725 (9th Cir. Dec. 10, 2020). In E- R-A-L-, the asylum applicant was targeted by a drug cartel because his family owned a farm in Guatemala. The Board’s now-vacated published decision rejected his family and landowner-based particular social groups, as well as making errors relating to the nexus analysis for asylum and withholding of removal.

Practitioners should note that the Ninth Circuit specifically vacated E-R-A-L- itself, meaning that the Board’s decision has no effect anywhere in the United States. See Harmon v. Thornburgh, 878 F.2d 484, 495 n.21 (D.C. Cir. 1989) (“When a reviewing court determines that agency regulations are unlawful, the ordinary result is that the rules are vacated—not that their application to the individual petitioners is proscribed.”) Practitioners should argue to Immigration Judges that E-R-A-L- is no longer binding precedent, making it easier to prove the cognizability of landowner-based particular social groups. If an Immigration Judge already denied a landowner case, and the appeal is pending before the Board, practitioners should argue that the case should be remanded in light of E-R-A-L-ʼs vacatur.

This is certainly the right approach. That “in your face Article IIIs” position by the BIA is remarkable. But even more remarkable has been the feckless Article IIIs’ failure to challenge this disrespect for their functions.

You don’t even have to be a lawyer to understand that a vacated and/or reversed decision is no decision at all. Since it no longer represents the correct resolution of an actual dispute, it pertains to no live “case.” It’s simply part of the historical record of that case, having no force and effect. Continuing to treat it as “precedent” is essentially issuing an illegal advisory opinion, untethered to any actual case or controversy.

Sure, I understand the concept of “Circuit splits,” better than most, having dealt with the legal and practical aspects of them for nearly half a century. But, no reversed precedent should be effective anywhere unless and until the BIA revisits the issue in another Circuit with a precedent fully considering the reasons why the “naysaying Circuit” found their original precedent wrong, whether that Circuit’s interpretation should be adopted nationwide, and, if not, cogently explaining why they have chosen to disregard the Circuit’s views. And, it should be the BIA’s actual, independent evaluation, not a result that they are explicitly or implicitly “told” to issue by OIL, the Solicitor General, the Attorney General, the Director, or any other DOJ official.

So, whether E-R-A-L- continues to have precedential effect outside the 9th Circuit probably ultimately depends on if and when the Biden Administration replaces this BIA with better judges and whether we finally get a better qualified Attorney General, committed to due process, human rights, and human decency, willing to let the “new BIA” function independently. 

On the merits, E-R-A-L- was a ham-handed attempt by the BIA to abrogate its seminal Acosta precedent which correctly recognized “land ownership” as a proper “fundamental characteristic” and therefore a recognizable ”particular social group.” As I often have observed, the BIA’s subsequent absurdist, ahistorical approach in E-R-A-L- would come as a surprise to millions of dead kulaks liquidated by Stalin’s purges and countless others subjected to persecution throughout history based on property ownership, one of the most clearly recognized “particular,” “socially visible,” and “fundamental” characteristics in human existence. 

One wouldn’t exactly have to be a “Rhodes Scholar” to recognize the ridiculous, overtly politicized, intentional misinterpretation of asylum law that springs from the pages of the BIA’s atrociously erroneous decision in E-R-A-L-.

But, it’s hardly surprising, given the disrespect for immigration and human rights expertise in judicial selection at all levels of EOIR and the resulting failure to produce anything close to a fair, representative judiciary that is capable of understanding asylum law in context and appreciating the impact of their decisions on the human lives and communities they most affect. There is also a conspicuous absence of deliberation or dissent among today’s politically accommodating, “go along to get along” BIA “judges.”

What’s the purpose of a supposed “deliberative body” that neither transparently deliberates nor gets the correct answers on basic legal questions; a body incapable of protecting the constitutional and statutory rights, not to mention the lives, of individuals seeking justice?

To some, the BIA might (wrongly) be considered “obscure.” But, there is nothing “obscure” about the real human beings whose existence is threatened or eradicated by the BIA’s malfeasance and dereliction of duty!

The EOIR Clown Show 🤡 must go!

New Legal Challenge: CARECEN v. Cuccinelli

Representing the CARECEN and seven people with Temporary Protected Status, CLINIC, Democracy Forward, Montagut & Sobral PC and Debevoise & Plimpton LLP sued the Trump administration to block a policy issued by an unauthorized federal executive, U.S. Citizenship and Immigration Services’ Acting Director Ken Cuccinelli. The lawsuit, filed today in the U.S. District Court for the District of Columbia, seeks to stop the Trump administration from denying access to lawful permanent residency to people with TPS who legally qualify for green cards thanks to their U.S. citizen spouse or child. Cuccinelli’s action, couched as a mere “update” to the agency’s policy manual, eliminates the ability for TPS beneficiaries with prior removal orders to apply to adjust status with USCIS even though they departed the United States and returned with USCIS permission. The suit challenges the policy change as unlawful under the Administrative Procedure Act and the Constitution’s Due Process Clause, and because its author, Ken Cuccinelli, was not legally appointed to direct USCIS.

And, think of the grotesque stupidity, not to mention cruelty and illegality, behind this USCIS “policy.” Those in TPS are part of our community. Many have been here for years, even decades, working, paying taxes, and raising families (including many US citizens). Many are now fully qualified to adjust to “green card” status under existing law, thereby regularizing their status and getting out of “limbo.” 

With LPR status, and eventually US citizenship, they can reach their full potential as humans and as members of our society. That’s a “win-win” that helps us move forward and prosper as a nation.

Yet, “Cooch Cooch” and the rest of the maliciously incompetent kakistocracy at DHS stay up nights thinking of ways to “stiff” our friends and neighbors in the TPS community and to keep them from regularizing their status and achieving their full human and economic potential, not to mention traumatizing US citizen family members. Talk about fraud, waste, and abuse in Government!

Incidentally, current TPS holders would all be entitled to full Immigration Court hearings if the regime attempted to expel them by force after ending TPS. Most have strong claims to relief, from cancellation of removal to asylum and other forms of protection.

Many could apply for adjustment of status in Immigration Court and individually litigate no matter what the USCIS “policy.” With a known backlog of approximately 1.5 million cases and perhaps another 500,000 to 1 million “lost in the docket dysfunction at EOIR,” their Immigration Court dates could easily be a decade, or “2.5 Administrations” from now. So, the Cuccinelli policy is basically a way of inflicting some cruelty and racist harassment on TPS’ers eligible to immigrate, without any realistic chance of “enforced removal.” Wow, talk about using a system already FUBAR’ed, to a major extent by this regime, as an illegal “weapon against humanity!”

Where, or where, have the Article IIIs been in taking a strong, unified stand against racism and stupidity (legal term “unreasonable behavior”) by the Trump immigration regime? Cooch Cooch was determined by a Federal Court to be illegally serving at USCIS! Yet, he contemptuously remains in office inflicting illegal harm and suffering on migrants, chewing up legal resources, and insultingly wasting the time of the Federal Courts.

I sort of understand the feckless performance of the Immigration Courts, wholly owned by “Billy the Bigot.” But, what’s the purpose of an independent Article III Judiciary that performs like it’s the “King’s Court” — unwilling or unable to defend our Constitution, humanity, or even their own prerogatives against the tyranny of a dangerous scofflaw moron like Trump?

What’s their excuse for drawing their salaries? The overall systemic failure of the Article III Judiciary, starting with a tone-deaf, racially insensitive, and often eagerly complicit Supreme’s majority, in the face of Trump’s White Nationalist authoritarianism, demands serious national re-examination of the role, qualities, and character we should expect from our Article III Judiciary, assuming that our nation survives the current legal and moral debacle led by Trump and enabled by judges who failed to do their duties!

However, CLINIC’s BIA Pro Bono Project continues to fight back and perform miracles—defeating Goliath—thanks to BIA Pro Bono Project Manager Rachel Naggar, BIA Pro Bono Project Legal Specialist Brenda Hernandez, and our many dedicated attorney volunteers. Rachel and Brenda shared with me the project’s awe-inspiring stories of success from this summer and the volunteers who made these victories possible. In turn, I share these success stories with you to offer inspiration to keep fighting for your clients while the Trump administration escalates its attacks on immigrant communities.

 

  • The BIA remanded the case of a Haitian asylum seeker on numerous grounds, including that the IJ did not apply the proper framework for assessing firm resettlement, the IJ mixed up the respondent’s political party when assessing his claim for withholding of removal, and the IJ did not meaningfully consider the respondent’s risk of future persecution.   • The BIA overturned the IJ’s adverse credibility finding against an asylum seeker from Burkina Faso. The BIA also found that the IJ erred in concluding there was no nexus between the harm the respondent suffered and his political opinion, including that the prosecution he endured was actually pretext for persecution.   • The BIA granted asylum to a Cuban refugee. Contrary to the IJ, the BIA found that the harm suffered by the respondent did cumulatively rise to the level of past persecution and he did have a well-founded fear of persecution.   • The BIA remanded the case of a Cuban asylum seeker because the IJ failed to consider the evidence of past economic persecution along with the physical harm suffered. The BIA also reminded the IJ that where the persecution is committed by the government, it is presumed that internal relocation is not reasonable, and the burden shifts to DHS to demonstrate that it would be reasonable in this case.   • The BIA reopened the case of a Cuban asylum seeker because he had new evidence of harm and threats against his family that occurred after his final hearing with the immigration judge. Thank you to Astrid Ackerman and Aaron Webman of Kramer, Levin, Naftalis & Frankel!
  • The Ninth Circuit granted the petition for review of a Ghanaian asylum seeker, overturning the IJ’s negative credibility finding and concluding that the Board had failed to adequately consider the country conditions evidence when it denied CAT relief.   • The Third Circuit, in a published decision, granted a Honduran asylum seeker’s petition for review, finding that the IJ and BIA erred in analyzing whether the respondent had suffered past persecution. The Court also found that the IJ failed to conduct the proper analysis regarding the need for evidence in an application for CAT protection. You can read the full decision here.   • The Sixth Circuit, in a published decision, granted a Russian asylum seeker’s petition for review, finding that the IJ and BIA erred in concluding that the respondent was not persecuted on account of his political opinions and that his indictment for peacefully protesting under Russian law was a pretext for persecution.   • DHS withdrew its appeal of a grant of asylum from Mexico to a Cuban national. DHS conceded to the IJ that the respondent was eligible for asylum from Mexico, but not Cuba because of the Third Country Transit Bar. DHS changed its mind and filed an appeal, which was withdrawn after pro bono counsel filed his brief. Thank you to James Montana of The Law Office of James Montana!
  • The BIA dismissed an appeal by the Department of Homeland Security and upheld a Cuban woman’s grant of asylum. The Board found that the IJ was correct in deeming the respondent eligible for asylum and not subject to the Third Country Transit Bar.   • ICE released a Venezuelan asylum seeker from detention to reunite with her spouse, after tremendous advocacy efforts by her pro bono attorney. Thank you to David Gottlieb!
  • The Ninth Circuit remanded the case of a Honduran victim of domestic violence, at the request of the Department of Justice. The Court ordered the BIA to reconsider whether the respondent had demonstrated that the Honduran government acquiesced in her persecution, whether the respondent is part of a viable particular social group, whether it would have been futile for her to report the harm to local authorities, and whether internal relocation would be reasonable.   • A victim of human rights violations by the notorious Eritrean military was granted withholding of removal, after the BIA overturned the IJ’s adverse credibility finding and found that the IJ failed to consider that the country conditions evidence corroborated the respondent’s claim. Thank you to Jonaki Singh and Susan Jacquemot of Kramer, Levin, Naftalis & Frankel!
  • The Ninth Circuit remanded the case of an asylum seeker from Mexico, at the request of the Department of Justice. The Court ordered the BIA to reconsider whether the respondent had been persecuted and sexually assaulted on account of her sexual orientation, and whether the government of Mexico could adequately protect her from future harm.   • The Fourth Circuit granted the petition for review holding that a conviction under VA 18.2-280(A) is not a removable firearms offense, a result that would not have been possible had Mr. Gordon not continued to fight his case for so many years even despite being deported.   • Jose came to the United States in 1985 to live with his father as a permanent resident. He built a life in the United States, becoming a father himself. After a run in with the law, he was placed in removal proceedings and was detained for 19 months. In a 2-1 decision, the Third Circuit found that under the unique circumstances of this case, Jose’s father was deprived of the equal protection of the laws. Jose is a United States citizen, the court declared, and has been since 1985. In the wake of the Supreme Court’s 2016 decision in Sessions v. Morales-Santana, Jose’s case was the first to benefit from this Supreme Court decision. You can read the full decision here. The government petitioned for rehearing, but the full Third Circuit declined to intervene. Ultimately, the government declined to ask the Supreme Court to review the case. For the better part of the last decade, Jose’s life has been filled with uncertainty and stress, but not anymore, which is very important as Jose is expecting his first grandchild. Here’s what our colleague Judge Jeffrey Chase has to say about Michelle and CLINIC:

No surprise, Michelle.  CLINIC is responsible for so much good case law.  And the non-CLINIC successful attorneys probably used CLINIC training or practice advisories.  Congrats to you and all of your outstanding attorneys and support staff, and thanks for all you do!

Even in times of our greatest national darkness and misery, there are plenty of lives that can be saved! Contrary to the “Dred Scottification” — dehumanization of persons in our country — unconscionably pushed by the regime and enabled by many public officials and courts that “should know better,” every person’s life is important!

And, despite the conscious misinterpretation and misapplication of the Fifth Amendment by far too many of those charged with upholding it, every person in the U.S., regardless of race or status, is entitled to due process, fundamental fairness, and to be treated with human dignity.

Think of how much progress we could make if we didn’t have to keep re-litigating all the same issues over and over again, often with differing results! 

What if the “precedents” concentrated on those cases that could be granted, rather than almost exclusively focusing on “roadmaps to denial?” 

What if we promoted and supported great pro bono representation, rather than inhibiting and discouraging it? 

What if meritorious cases were moved to the “head of the line” instead of continuously being “shuffled off to Buffalo” by “Aimless Docket Reshuffling” (“ADR”) thereby languishing in the mindlessly expanding backlog? 

What if Federal Judges at all levels were the “best and the brightest” — selected from among those with demonstrated expertise in immigration, asylum and human rights and impeccable reputations for due process, fundamental fairness, and humanity, rather than being selected for “go along to get along” reputations or allegiance to perverse political ideologies that undermine equal justice for all?

What if our Immigration Court system were administered independently and professionally, rather than as a biased and weaponized tool of DHS enforcement and White Nationalist politicos?

What if our Justice System worked cooperatively with folks like Michelle, Jason, Judge Ashley Tabaddor, and many others with good, creative, practical ideas for institutionalizing “best practices” leading to to “due process with efficiency?”

What if we fairly implemented our refugee, asylum, and protection legal framework to “protect rather than reject?”

What if we consistently treated our fellow beings as humans, rather than as “less than human?”

What if we viewed immigration for what it really is: the foundation of our nation and a continuing source of great strength, pride, and optimism for our country of immigrants, rather than pretending that we live on an island and must “wall off” the rest of the world?

This November, vote like your life and the future of our nation depend on it! Because they do!
