“In a Time of Hate, My Refugee Clients Give Me Hope

As an ordinary citizen, it is not easy to decide the best way to confront a Nazi march. Show up to peacefully protest? That might give additional attention to the other side. Protest violently? Not only could that elevate the Nazis, it might also de-legitimize the resistance to the Nazis (even those who peacefully resist). Ignore them? That might be viewed as condoning their views. Reasonable people can differ about what to do, at least as far as the peaceful responses are concerned.

As a great American philosopher once said, “I hate Nazis.”

But when you are a public figure, especially an elected official, the decision about how to respond is clear: First, ensure safety and free speech. Second, denounce the evils of Nazism and make it plain that Nazis, Klan members, and anyone who might march side-by-side with such people are un-American, illegitimate, and unworthy of a seat at the table of public discourse.

Fortunately, the vast majority of our country’s elected leaders knew what to say in response to the Nazi march last weekend. But unfortunately, there was one important exception–our President, Donald J. Trump. To me, Mr. Trump’s contemptible silence, followed by a reluctant “denunciation” of the Nazis, followed by a denunciation of the “denunciation” is an utter disgrace. It is a green light to Nazis. It is yet another attack on common decency and on our shared national values. It is complicity with Nazism. By the President of the United States. (As an aside, one of my lawyer-friends at the Justice Department told me–perhaps half jokingly–that she wanted to post a sign in her office that reads, “Nazis are bad,” but she feared it might get her into trouble–that is where we are under Mr. Trump.)

Frankly, I am not particularly worried about the Nazis themselves. They certainly can do damage–they murdered a young woman and injured many others. But they do not have the power or support to threaten our democracy. This does not mean we should take them for granted (few would have predicted Hitler’s rise when he was sitting in prison after the Beerhall Putsch), but we should not be unduly fearful either.

On the other hand, I am very worried about our President’s behavior. His governing philosophy (perhaps we can call it, “trickle down histrionics”) is poisoning our public debate, and it weakens us domestically and internationally. Thus far, his incompetence has served as a bulwark against his malevolence, but that can only go on for so long (see, e.g., North Korea). So there is much to be concerned about.

Here, though, I want to talk about hope. Specifically, the hope that I feel from my clients: Asylum seekers, “illegals,” and other immigrants. There are several reasons my clients give me hope.

One reason is that they still believe in the American Dream. Despite all of the nastiness, mendacity, and bigotry coming from the White House, people still want to come to America. They are voting with their feet. Some endure seemingly endless waits, often times separated from their loved ones, in order to obtain legal status here. Others risk their lives to get here. They don’t do this because (as Mr. Trump suggests) they want to harm us. They do it because they want to join us. They want to be part of America. My clients and others like them represent the American ideal far better than those, like our embattled President and his racist friends, who disparage them. When I see my country through my clients’ eyes, it gives me hope.

My clients’ stories also give me hope. Most of my clients are asylum seekers. They have escaped repressive regimes or failing states. Where they come from, the government doesn’t just tweet nasty comments about its opponents, it tortures and murders them. The terrorist groups operating in my clients’ countries regularly harm and kill noncombatants, women, children, and even babies. My clients have stood against this depravity, and many of them continue to fight for democracy, justice, and human rights from our shores. My clients’ perseverance in the face of evil gives me hope.

Finally, I have hope because I see the courage of my clients, who refuse to be cowed by the hateful rhetoric of our Commander-in-Chief. Since the early days of his campaign, Mr. Trump has demonized foreigners and refugees, and after he was sworn in as President, these individuals were the first to come into his cross hairs. If he can defeat people like my clients, he can move on to new targets. But many refugees and asylum seekers have been subject to far worse treatment than Mr. Trump’s bluster, and they are ready to stand firm against his bullying. Their fortitude encourages others to stand with them. And stand with them we will. The fact that vulnerable, traumatized people are on the front lines of this fight, and that they will not surrender, gives me hope.

I have written before about the tangible benefits of our humanitarian immigration system. It demonstrates to the world that our principles–democracy, human rights, freedom, justice–are not empty platitudes. It shows that we support people who work with us and who advance the values we hold dear. When such people know that we have their backs, they will be more willing to work with us going forward. And of course, that system helps bring people to the United States whose talents and energy benefit our entire nation. Add to this list one more benefit that asylees and refugees bring to our nation in this dark time–hope.”

“President Trump’s plan for an aggressive hiring surge of 15,000 Border Patrol and immigration personnel to help keep out undocumented immigrants is unrealistic — and the Department of Homeland Security has not made a case for it, the agency’s watchdog says.

A report released this week by the DHS inspector general concludes that based on its rigorous screening requirement for law enforcement jobs and the relatively high rate of attrition among Border Patrol agents, Homeland Security would have to vet 750,000 applicants to find 5,000 qualified personnel.

In addition, to hire the 10,000 Immigration and Customs Enforcement (ICE) agents the president called for in executive orders he issued in his first days in office, a pool of 500,000 candidates would need to apply, auditors found.

The report calls into question whether DHS officials even need 15,000 new hires to target undocumented immigrants. Agency leaders have done such poor planning for what their workforce should look like, with an understaffed, poorly trained human resources operation, that they cannot justify thousands of new employees, the report says.

“Neither [U.S. Customs and Border Protection] nor [ICE] could provide complete data to support the operational need or deployment strategies for the additional 15,000 agents and officers,” the report by the office of Inspector General John Roth said.

DHS officials told auditors that they are still three to four years from getting a system in place that will be able to tell them how many new personnel they need and where to deploy them.

“Without comprehensive staffing models, operational needs analyses, and deployment strategies, CBP and ICE will not be able to identify clearly the correct number and type of employees required, what positions must be filled, or where to deploy those employees,” the report said.

Trump promised on the campaign trail to vastly beef up enforcement against undocumented immigrants with a new border wall, a surge in agents to help seal off the Southwest border with Mexico and a “deportation force” to arrest people in the country illegally. The 15,000 new front-line employees would come with almost 9,600 more technical and support staff, the report said.”

“Trump’s appearance with the senators came as the White House moved to elevate immigration back to the political forefront after the president suffered a major defeat when the Senate narrowly rejected his push to repeal the Affordable Care Act. The president made a speech last Friday on Long Island in which he pushed Congress to devote more resources to fighting illegal immigration, including transnational gangs.

The event on Wednesday illustrated the president’s efforts to broaden his push to reform border control laws beyond illegal immigration. Trump called the changes to legal immigration necessary to protect American workers, including racial minorities, from rising competition for lower-paid jobs.

“Among those who have been hit hardest in recent years are immigrants and minority workers competing for jobs against brand new arrivals,” Trump said. “It has not been fair to our people, our citizens and our workers.”

But the bill’s prospects are dim in the Senate, where Republicans hold a narrow majority and would have difficulty getting 60 votes to prevent a filibuster. The legislation is expected to face fierce resistance from congressional Democrats and immigrant rights groups and opposition from business leaders and some moderate Republicans in states with large immigrant populations.

Opponents of slashing immigration levels said immigrants help boost the economy and that studies have shown they commit crimes at lower levels than do native-born Americans.

“This is just a fundamental restructuring of our immigration system which has huge implications for the future,” said Kevin Appleby, the senior director of international migration policy for the Center for Migration Studies. “This is part of a broader strategy by this administration to rid the country of low-skilled immigrants they don’t favor in favor of immigrants in their image.”

Other critics said the Raise Act, which maintains the annual cap for employment-based green cards at the current level of 140,000, would not increase skilled immigration and could make it more difficult for employers to hire the workers they need. And they noted that Canada and Australia admit more than twice the number of immigrants to their countries as the United States does currently when judged as a percentage of their overall population levels.

“Just because you have a PhD doesn’t mean you’re necessarily more valuable to the U.S. economy,” said Stuart Anderson, executive director of the National Foundation for American Policy. “The best indication of whether a person is employable is if someone wants to hire them.”

Alex Nowrasteh, an immigration policy analyst at the CATO Institute, wrote in a blog that the bill “would do nothing to boost skilled immigration and it will only increase the proportion of employment-based green cards by cutting other green cards. Saying otherwise is grossly deceptive marketing.”

Groups that favor stricter immigration policies hailed the legislation as a step in the right direction. Roy Beck, president of NumbersUSA, said the Raise Act “will do more than any other action to fulfill President Trump’s promises as a candidate to create an immigration system that puts the interests of American workers first.”

Washington, D.C.—Human Rights First today urged members of the House Judiciary Committee to reject the Asylum Reform and Border Protection Act when it marks up the legislation today. The bill would severely undermine access to protection for genuine refugees.

“The proposed legislation does nothing to enhance the integrity of our asylum system, but instead puts individuals, particularly women and children, at grave risk of return to persecution, trafficking, and death in their home or third countries,” said Human Rights First’s Eleanor Acer. “Instead, this bill is a disgraceful attempt to evade U.S. refugee protection responsibilities and foist them on to other countries. Not only would this effort undermine U.S. global leadership, but it would set a poor example for the countries hosting the vast majority of the world’s refugees. The bill would make it even more difficult for refugees to receive asylum in our already rigorous asylum system and leave vulnerable children, families, and other individuals at risk of severe harm or death.”

The bill seeks to make it harder for those fleeing persecution and torture to file for asylum in the United States, a process already fraught with obstacles. Several groups of particularly vulnerable individuals—including children, women, and LGBTQ asylum seekers—would be disproportionately impacted by certain provisions, which essentially eliminate protection for refugees who have been victims of crimes in their home countries. The bill attempts to eliminate the statutory basis for release on parole, which would leave asylum seekers detained in violation of U.S. treaty obligations, and held in jails and facilities with conditions similar to jails despite the existence of more cost-effective and humane alternative measures that result in compliance and appearance at hearings. The bill also seeks to ban federal government-funded counsel, including for unaccompanied children, some of whom are toddlers or even younger.

Human Rights First, along with 73 other rights and immigration groups, sent a letter to members of the committee today urging them to reject the legislation. Among many changes to law, the Asylum Reform and Border Protection Act of 2017 would:

Raise the expedited removal screening standard to an unduly high level. The bill would require that an asylum seeker—in order to even be allowed to apply for asylum—not only show a “significant possibility of establishing eligibility for asylum” but also prove it is more likely than not that his or her statements are true—the standard for a full adjudication, not a summary screening interview.
Appear to prevent arriving asylum seekers who have passed the credible fear screening process from being paroled from immigration detention, instead leaving them in jails and jail-like facilities for months or longer, even though there are more fiscally-prudent and humane alternatives that have been proven effective.
Deny asylum to large numbers of refugees based on transit or stays in countries where they had no legal status, or no lasting legal status, and to which they cannot be returned in most cases. This provision would seek to deny asylum to many refugees who have passed through Mexico, despite the risks and severe protection deficiencies there. In addition, refugees—who may have languished in a refugee camp for decades without the ability to legally work, access education or secure legal permanency—with valid claims would be left in a state of uncertainty, with no prospects for a durable solution and no secure future for themselves and their children.
Allow asylum applicants and unaccompanied children to be bounced to third countries (such as Mexico) despite the dangers and lack of protection from return to persecution there, and in the absence of any agreement between the United States and the countries in question for the reception of asylum seekers.
Categorically deny asylum and withholding of removal to refugees targeted for criminal harm—including rape and killing—based on their membership in a particular social group in their countries of origin. This extraordinarily broad provision would deny protection to asylum seekers who have been beaten for being gay, who have suffered horrific domestic abuse, or who have been treated as property by virtue of their status as women, to name but a few examples. It would also effectively eliminate asylum eligibility or withholding of removal for asylum seekers who have been victims of or who fear persecution related to gang violence in their home country.
State that the government not bear expense for counsel. The bill also states that in no instance will the federal government bear expense for counsel for anyone in removal or appellate proceedings. Children – including toddlers – the mentally disabled, and other vulnerable people cannot represent themselves in our complex immigration system.
Last week Human Rights First released a new report assessing the dangers facing refugees in Mexico in the wake of proposals from the Trump Administration and Congress to block refugees passing through Mexico from seeking protection in the United States. The analysis, “Dangerous Territory: Mexico Still Not Safe for Refugees” finds that migrants and refugees in Mexico face risks of kidnapping, disappearance, sexual assault, and trafficking, and that Mexican authorities routinely deport individuals to their home countries regardless of whether they fear return to persecution and the country’s human rights obligations.

Human Rights First notes that when Congress—with strong bipartisan support—passed the Refugee Act of 1980, the United States codified its commitment to the 1951 Refugee Convention and its Protocol. Under those treaties, states can’t return refugees to places where their lives or freedom would be threatened or reject potential refugees at the border. The United States is also a party to the Convention Against Torture, which prohibits governments from sending people to places where they would be in danger of being tortured, and to the International Covenant on Civil and Political Rights which prohibits the arbitrary detention of asylum seekers and migrants. Instead of turning away those seeking protection, the United States should be doing more to ensure their protection claims are properly assessed and due process is safeguarded.

“At a time when the world faces the largest refugee crisis in history, this bill sends a dangerous message to other nations, including those who host the overwhelming majority refugees: that the United States intends to shirk its responsibility to those fleeing violence and persecution,” added Acer.

The Asylum Reform and Border Protection Act (H.R. 391) would undermine the individual rights of people fleeing persecution and violence to seek asylum in the United States. The bill would obliterate the current asylum standards and now require asylum seekers to prove their claims to an impossible degree immediately upon their arrival at the border—without access to the documents or witnesses that they would need to do so. The government would then promptly deport without a hearing before an immigration judge those who fail this unattainable requirement, possibly to endure violence or persecution. The authors claim that this radical change is necessary due to an unprecedented surge of asylum applicants. In the 1990s, however, a similar surge of asylum seekers arrived in the United States, and Congress adopted much less severe reforms than those proposed in this bill. Even assuming that the applicants are submitting asylum applications for the sole purpose of gaining entrance to the United States, the bill does nothing to address the underlying cause of the problem: the lack of a legal alternative to migrate. As long as legal immigration remains impossible for lesser- skilled workers and their family members, unauthorized immigration of various kinds will continue to present a challenge. Asylum rule change will result in denials of legitimate claims Current law requires that asylum seekers at the border assert a “credible fear” of persecution.1 Asylum officers determine credibility based on whether there is a “significant possibility” that, if they allow the person to apply, an immigration judge would find that the fear is “well-founded,” a higher standard of proof. The credible fear interview screens out only the claims that obviously have “no possibility, or only a minimal or mere possibility, of success,” as U.S. Citizenship and Immigration Services (USCIS) puts it.2 If the USCIS asylum officer rejects the claim as not credible, the applicant may ask an immigration judge to review the determination the next day but is not granted a full hearing. Customs and Border Protection removes those who fail to assert or fail to articulate a credible fear. H.R. 391 would impose a much higher standard simply to apply for asylum in the United States. In addition to demonstrating that they had significant possibility of successfully proving their claim to an immigration judge, it would require applicants to prove that it is “more probable than

not” that their claims are true—a preponderance of the evidence standard.3 This standard eviscerates the lower bar that Congress established. The committee simply cannot expect that asylum seekers who may have had to sneak out of their country of origin in the dead of night or swim across rivers to escape persecution will have sufficient evidence the moment they arrive in the United States to meet this burden. In 2016, a group of Syrian Christians who traveled thousands of miles across multiple continents and then up through Mexico to get to the United States arrived at the border to apply for asylum.4 Thankfully, they met the credible fear standard and were not deported, which enabled them to hire an attorney to help them lay out their claim, but this new standard could endanger anyone who follows their path. An inability to provide sufficient evidence of their religion, nationality, residence, or fear would result in deportation immediately after presenting themselves at the border. The authors imply that requiring them to prove their statements are true is not the same as requiring them to prove their entire asylum case, but this is a distinction without a difference.5 Asylum applicants must state a “credible fear” of persecution. Those statements would then be subject to the much more stringent standard. Of course the government should demand the truth from all applicants, but this is a question of the standard by which asylum officers should use to weed truth from falsehood. It is virtually impossible that, by words alone, asylum seekers could prove that it is “more probable than not” that their statements are true. The committee should consider this fact: in 2016, immigration judges reversed nearly 30 percent of all denials of credible fear that came to them on appeal.6 This means that even under the current law, asylum officers make errors that would reject people with credible claims of persecution. If Congress requires an even greater burden, many more such errors will occur, but faced with the higher evidentiary requirement, immigration judges will have little choice but to ratify them. Here is another sign that the truth is not enough: asylum applicants with attorneys were half as likely to have their asylum denied by immigration judges in 2016 as those without attorneys. Indeed, 90 percent of all applicants without counsel lose their case, while a majority with counsel win theirs.7 This demonstrates that people need more than just honesty—they also need to understand what evidence is relevant to their case and need help to gather documents, witnesses, and other evidence to support their claim. For these reasons, Congress never intended the credible fear interview as a rigorous adversarial process because it wanted to give people who could credibly articulate a fear of persecution an opportunity to apply. It knew that while some people without legitimate claims would be able to apply, the lower standard of proof would protect vulnerable people from exclusion. As Senator Alan Simpson, the sponsor of the 1996 bill that created the credible fear process, “it is a significantly lesser fear standard than we use for any other provision.”8 Indeed, during the debate over the compromise version of the bill, proponents of the legislation touted that the fact that they had dropped “the more probable than not” language in the original version.9

Asylum surge is not unprecedented People can either apply for asylum “affirmatively” to USCIS on their own or they can apply “defensively” after they come into the custody of the U.S. government somehow, such as at the border or airport, to an immigration judge, which would include the credible fear process. If USCIS denies an “affirmative” applicant who is in the country illegally, the government places them in removal proceedings before an immigration judge where they can present their claim again. Reviewing the data on asylum claims, two facts become clear: total asylum claims peaked in the 1990s, and a substantial majority of claims are affirmative—that is, done voluntarily, not through the credible fear process or through removal proceedings. Although credible fear claims—a process that was first created in 1997—have increased dramatically, the overall number of asylum claims has still not reached the highs of the early 1990s. Unfortunately, the immigration courts have not published the number of cases that they received before 1996, but as Figure 1 shows, the United States has experienced similar surges of asylum seekers to 2016.10

narrative. As Figure 2 highlights, the Obama administration denied an average of about 25 percent of all asylum seekers from 2009 to 2016.11

Despite fluctuations of up to 35 percentage points during this time, there is simply no relationship at all between the rate of approval and the number of claims being made. Factors other than the approval rate must be driving the number of applications. Some of these claims are undoubtedly invalid or even fraudulent, but given that a majority of claims by individuals with representation in immigration court win their asylum claims, it is obvious that the credible fear process has protected many people from deportation to persecution abroad.12 If fraudulent claims are a concern, Congress can best address it in the same way that it has successfully addressed other aspects of illegal immigration from Mexico: through an expansion of legal immigration. During the 1950s and again recently in the 2000s, Congress expanded the availability of low-skilled guest worker visas, which led to a great reduction in the rate of illegal immigration. Figure 3 presents the number of guest workers entering each year and the number of people each border agent apprehended each year—the best available measure of illegal immigration. It shows that the period of high illegal immigration occurred almost exclusively during the period of restrictive immigration.13 Most guest workers today are Mexicans.14 This is largely due to the fact that the current guest worker programs are limited to seasonal temporary jobs and Mexico is closer to the United

States, which makes trips to and from the United States easier. By comparison, most asylum seekers are from Central America. Assuming that a significant portion of these asylum seekers are either reuniting with illegal residents already in the United States or are seeking illegal residence themselves, these seasonal programs are unavailable to them.

Congress should create a temporary work visa program for low-skilled workers in year-round jobs, similar to the H-1B visa for high-skilled workers.15 This would cut down on asylum fraud and illegal immigration without the downsides that this bill presents.

Bier’s report notes that U.S. Immigration Judges overruled approximately 30% of credible fear denials by the DHS Asylum Office. Although I did a modest number of credible/fear reasonable fear reviews, including some in temporary assignments to “detained courts” on the Southern Border, I found the number of erroneous credible/reasonable fear denials to be in the 80% to 90% range, including a number of cases that were “clear grants” under Fourth Circuit case law. The idea that Border Patrol Officer could fairly make these determinations is beyond preposterous!

Chairman Goodlatte and his GOP buddies seek nothing less than the end of a fair asylum adjudication system that fulfills our international mandates. H.R. 391 also makes a mockery of due process. In other words, the Goodlatte GOP crowd seeks to turn the U.S. into a “Third World” imitation of a democracy. These types of legislative tactics are exactly what I saw for 21 years of adjuducating claims from countries where the rule of law had broken down.

Whether immigration/refugee advocates or not, every American Citizen who cares about our Constitution and the rule of law should be fighting measures like this tooth and nail. If Goodlatte & Co. win, we all lose, and America will be well on its way to becoming just another third world facade of a democratic republic.

Rather than the totally bogus restrictionist agenda being pushed by Goodlatte and the GOP, here’s what REALLY should concern us as a nation, taken from one of my recent speeches:

“Our Government is going to remove those who lose their cases to countries where some of them undoubtedly will suffer extortion, rape, torture, forced induction into gangs, and even death. Before we return individuals to such possible fates, it is critical that they have a chance to be fully and fairly heard on their claims for protection and that they fully understand and have explained to them the reasons why our country is unwilling and unable to protect them. Neither of those things is going to happen without effective representation.

We should always keep in mind that contrary to the false impression given by some pundits and immigration “hard liners,” losing an asylum case means neither that the person is committing fraud nor that he or she does not have a legitimate fear of return. In most cases, it merely means that the dangers the person will face upon return do not fall within our somewhat convoluted asylum system. And, as a country, we have chosen not to exercise our discretion to grant temporary shelter to such individuals through Temporary Protected Status, Deferred Enforced Departure, or prosecutorial discretion (“PD”). In other words, we are returning them knowing that the effect might well be life threatening or even fatal in many cases.”

Picking on the already vulnerable, disposed, and endangered is what the Goodlatte/GOP restrictionist program is really about.

UNDER THE RADAR: Trump Administration Implementing “Muslim Ban” Without Fanfare!

“Lost amid the uproar over the Trump administration’s travel restrictions on citizens from Muslim-majority countries and the impending showdown at the Supreme Court are the insidious ways that the government has already begun to impose a Muslim ban.

It’s doing so through deceptively boring means: increasing administrative hurdles and cementing or even expanding the current travel restrictions that are not under review at the court. The collective impact of these changes will be that a permanent Muslim ban is enshrined into American immigration policy.

. . . .

The Twitterverse and cable news pundits are unlikely to be mobilized by policy changes that come about through these types of bureaucratic processes. Most people are not closely following the intricacies of visa vetting and screening.

That’s a shame because there is already evidence that they are working. The number of visas issued to citizens from Muslim-majority countries has decreased by double digits. Among nearly 50 Muslim-majority countries, nonimmigrant visas declined almost 20 percent in April, compared with the monthly average from 2016. Visas issued to people from Iran, Syria, Sudan, Somalia, Libya and Yemen, the six countries on the travel ban list, were down 55 percent. Those figures will continue to get worse if these other provisions are implemented.

Finally, consider an embarrassing incident. An Afghan girls’ robotics team was initially denied entry into the United States to participate in a science competition. It was only after public outcry and an intervention by President Trump that they were granted passage. Situations like that are also likely to have a chilling effect on people from Muslim-majority countries, resulting in further decreases.

A Muslim ban, even when implemented through seemingly mundane bureaucratic processes, simply has no place in our country.

TRUMP ADMINISTRATION’S WAR ON AMERICA — Proposals To Restrict Student Visas & Reduce Legal Immigration Will Hurt Economy, National Standing

These articles from today’s Washington Post highlight three “gonzo” immigration proposals driven by the Trump Administration’s white nationalist agenda.

First, the proposal to require nonimmigrant students in the U.S. to apply for annual extensions of stay would roll back the “duration of status program” for students — arguably the single best and most mutually beneficial efficiency move in the history of INS/USCIS. It would also create chaos in student visa programs that not only keep many colleges and universities financially viable, but also fuel American innovation and technological advances in the STEM fields.

Second, proposals to make visa issuance a law enforcement function within the DHS would lead to chaos in the visa issuing program and probably will result in retaliation by other friendly nations. Visas are part of the foreign commerce of the U.S., not a domestic law enforcement program.

Finally, proposals to reduce legal immigration and further restrict legal opportunities for unskilled workers would deprive the U.S. of workers at a time when the growing economy needs them the most. This short-sighted policy would likely lead to the same type of economic stagnation that has plagued EU countries and Japan over the past several decades.

What does that tell us about the country?

And his attacks on people. Megyn Kelly: “You could see there was blood coming out of her eyes, blood coming out of her wherever.” Jews: “The only kind of people I want counting my money are little short guys that wear yarmulkes every day.” Sen. John McCain (R-Ariz.): “He’s not a war hero . . . I like people that weren’t captured.” My journalist colleague Serge Kovaleski, who has limited mobility in his arms: “Now the poor guy, you ought to see this guy,” Trump said, before contorting his arms in an apparent impersonation.

Trump the candidate showed himself to be an ignorant, undisciplined, ranting bully who exaggerated and lied without shame. A man who wore a tough-guy masculinity but was actually a coward, who picked on women, demeaned minorities and was thoroughly lacking in human decency.

Trump’s character defects were on full display well before the polls opened.

President Trump’s behavior in the White House has been equally as disgusting and beneath the dignity of that high office.

And now our nation’s capital is being wrenched apart by the Trump-Russia scandal and congressional and federal investigations into the Kremlin’s intrusion in the election.

The country can’t claim not to have seen this coming.”

One of the most disturbing aspects of the Trump fiasco is that although he might be “historically unpopular,” his support in the polls has remained steady at around 35% – 40%. That means that at least 1/3 of Americans are willing to accept incompetence, dishonesty, bias, racism, xenophobia, intentional cruelty and divisiveness, nepotism, bullying, anti-intellectualism, scientific ignorance, undermining national security, and misogyny as the “new norms” in America. It essentially means that a substantial number of our fellow Americans have put themselves out of reach of rational political dialogue. That’s going to make America “tough to govern” no matter who wins the next round of elections.

“The U.S. Justice Department on Friday asked the Supreme Court to block a judge’s ruling that prevented President Donald Trump’s travel ban from being applied to grandparents of U.S. citizens and refugees already being processed by resettlement agencies.

In a court filing, the administration asked the justices to overturn Thursday’s decision by a U.S. district judge in Hawaii, which limited the scope of the administration’s temporary ban on refugees and travelers from six Muslim-majority countries.

The latest round in the fight over Trump’s March 6 executive order, which he says is needed for national security reasons, came after the Supreme Court intervened last month to partially revive the two bans, which were blocked by lower courts.

The Supreme Court said then that the ban could take effect, but that people with a “bona fide relationship” to a U.S. person or entity could not be barred.

The administration had narrowly interpreted that language, saying the ban would apply to grandparents and other family members, prompting the state of Hawaii to ask Hawaii-based U.S. District Judge Derrick Watson to expand the definition of who could be admitted. He ruled for the state late on Thursday.

In the court filing, the Justice Department said the judge’s ruling “empties the (Supreme) Court’s decision of meaning, as it encompasses not just “close” family members but virtually all family members.

The conservative-leaning Supreme Court is not currently in session but the justices can handle emergency requests. The administration’s application could be directed either to Justice Anthony Kennedy, who has responsibility for emergency requests from western states, or to the nine justices as a whole. If the court as a whole is asked to weigh in, five votes are needed to grant such a request.

“The truth here is that the government’s interpretation of the Supreme Court’s stay order defies common sense,” said Omar Jadwat, a lawyer with the American Civil Liberties Union involved in challenging the ban. “That’s what the district court correctly found and the attorney general’s misleading attacks on its decision can’t change that fact.”

In his decision, Watson harshly criticized the government’s definition of close family relations as “the antithesis of common sense.”

Watson also ruled that the assurance by a resettlement agency to provide basic services to a newly arrived refugee constitutes an adequate connection to the United States because it is a sufficiently formal and documented agreement that triggers responsibilities and compensation.”

“When President Trump spoke of the need to defend Western civilization in Poland last week, many saw an effort by him and some of his top White House advisers to redefine the mission of American foreign policy away from building relationships and spreading democratic principles, to a more protective stance drawing sharp lines between the United States and those perceived as threats.

One emerging flash point in that struggle is the internal administration debate over which part of the government should be in charge of deciding who gets into the United States.

Ever since the passage of the Immigration and Nationality Act in 1952, that mission has been charged to the State Department. Thousands of diplomats not only stamp passports and issue visas, but also craft policy and make recommendations about who gets to visit, work and seek refuge in the United States. That tradition has now come into question.

A document crafted by senior White House advisers, first reported by CNN, includes proposals to move the State Department’s Bureau of Consular Affairs and Bureau of Population, Refugees and Migration over to the Department of Homeland Security. White House policy adviser Stephen Miller, who helped craft the document, has reportedly been pushing Secretary of State Rex Tillerson to get “tougher” on immigration, vetting and refugee policy at the State Department.

That nativist strain in the White House is represented by Miller, who was the principal author of Trump’s travel ban, which targeted six Muslim-majority countries, as well as of Trump’s speech last week in Poland, which cast the mission of U.S. foreign policy as one based on threats, not relationships.

“The fundamental question of our time is whether the West has the will to survive,” Trump said. “Do we have enough respect for our citizens to protect our borders? Do we have the desire and the courage to preserve our civilization in the face of those who would subvert and destroy it?”

Viewing immigration and refugee programs through that lens alone is the opposite of courage. Only through a humane, non-discriminatory approach, led by diplomats and integrated with the rest of American foreign policy, can the United States achieve long-term stability abroad and security at home.”

Sometimes, all you need to know about a “bureaucratic reorganization” is who is sponsoring it. On its face, combining all immigration related functions in one agency could make sense and has been discussed in various forums for years. But, once we know that racist white nationalist Stephen Miller, a disciple of Steve Bannon and Jeff Sessions, is sponsoring the proposal, it’s obvious that it has nothing to do with efficiency or security and everything to do with advancing a racist, xenophobic, white nationalist agenda. That an out of touch, anti-social, extremist like Miller, who has no known positive accomplishments in his life, should be in the White House and shaping national and international policy should be of concern to every American who believes in the tenants of Western liberal democracy.

TRAVEL BAN UPDATE: Hawaii Federal Judge Rebuffs Plaintiffs’ Attempt To Broaden Travel Ban Exception — Only The Supremes Can Clarify — Grandparents Of Americans Stiffed!

“HONOLULU — A federal judge in Hawaii on Thursday left Trump administration rules in place for a travel ban on citizens from six majority-Muslim countries.

U.S. District Court Judge Derrick Watson denied an emergency motion filed by Hawaii asking him to clarify what the U.S. Supreme Court meant by a “bona fide” relationship in its ruling last month.

The Supreme Court ruled the administration could mostly enforce its travel ban, but said those “with a credible claim of a bona fide relationship with a person or entity in the United States” could enter.

Watson says the relationship question would be better posed to the Supreme Court, not him.

“This court will not upset the Supreme Court’s careful balancing and ‘equitable judgment,’” Watson said in his order.

Hawaii attorney general Doug Chin objected to the administration’s omission of grandparents, aunts and uncles from its list of people meeting the definition of a close relationship.

The Trump administration has said the exemption to the ban would apply to citizens of the six countries with a parent, spouse, child, adult son or daughter, son-in-law, daughter-in-law or sibling already in the U.S.

The U.S. Department of Justice said in an emailed statement that it was pleased with the decision.

“If the plaintiffs elect to proceed, we are confident that the U.S. Supreme Court will again vindicate the President and his constitutional duty to protect the national security of the United States,” the department said.

The Hawaii Attorney General’s Office noted after the ruling that the district court did not address the substance of either party’s arguments and instead focused on the procedural question about which court is the appropriate forum to decide the issue.

“The scope of the travel and refugee bans badly needs to be resolved and not just according to the Trump administration’s interpretation,” Chin said.

Hakim Ouansafi, president of the Muslim Association of Hawaii, said he respects Watson’s ruling but thinks there will be more opportunities to ensure the ban does not exclude grandparents and others close family members.

“We will have people directly affected by this, for sure,” Ouansafi said. “When you exclude that many people, the circle is much wider.”

One problem when an appellate court emasculates the trial judge at a preliminary stage of the case is that the higher court then “owns” the case. But, in this particular situation, the Supremes are out to recess until Fall. So, the Trump Administration appears to have won this round because right now the plaintiffs realistically have no forum for their complaint. We can all sleep better knowing that we are protected from a few grandparents of U.S. citizens!

N. RAPPAPORT IN HUFFPOST: ESTABLISHMENT CLAUSE SHOULDN’T BE AN ISSUE IF SUPREMES EVER REACH MERITS OF TRAVEL BAN CASE!

Nolan writes:

“May not need to state a reason at all.

In Kleindienst v. Mandel, the Court observed that, without exception, it has sustained Congress’ “plenary power to make rules for the admission of aliens.” And, “The power of Congress …. to have its declared policy in that regard enforced exclusively through executive officers, without judicial intervention, is settled by our previous adjudications.” (Page 408 U. S. 766).

Mandel held that when Congress has made a conditional delegation of its plenary power over the exclusion of aliens to the Executive Branch, and the Executive Branch exercises this power “on the basis of a facially legitimate and bona fide reason,” the courts will not look behind the exercise of that discretion.

The next sentence in Mandel indicates that it may not be necessary to state the reason. “What First Amendment or other grounds may be available for attacking [an] exercise of discretion for which no justification whatsoever is advanced is a question we neither address nor decide in this case.” (Page 408 U. S. 769-70).

No basis for finding religious discrimination in the language of the order.

But the travel ban order does state a reason, and the District Court for the District of Hawaii found no basis in the stated reason or elsewhere in the language of the order for suspecting that the real purpose of the ban was religious discrimination:

It is undisputed that the Executive Order does not facially discriminate for or against any particular religion, or for or against religion versus non-religion. There is no express reference, for instance, to any religion nor does the Executive Order — unlike its predecessor — contain any term or phrase that can be reasonably characterized as having a religious origin or connotation (page 30).
Does it matter if other explanations for the travel ban are possible?

The district court nevertheless went on to find that religious discrimination was the real reason for the ban. In other words, the court finds two reasons, the stated one, which does not reflect religious discrimination, and the real reason, which was found in Trump’s calls for a Muslim ban when he was still campaigning.

Other areas of immigration law do require a weighing of conflicting reasons. An alien is not eligible for an immigration benefit on the basis of a sham marriage, which is defined as a marriage that was entered into for the primary purpose of circumventing the immigration laws. But if the primary reason was that the couple was in love and wanted to spend their lives together, the fact that they got married so the alien spouse could stay in America does not make the marriage a sham.

In the present case, however, the Court will not be weighing reasons to determine which one is primary. It will be interpreting an unambiguous statutory provision that does not require the stated reason to be the primary one. It doesn’t even require the president to say why he made the finding. Section 212(f) has no requirements at all. The president just has to proclaim that he has found that that “the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States.”

If opponents of the travel ban find this unacceptable, their only recourse is to lobby Congress to revise section 212(f).

Man, Nolan is prolific, appearing not only in The Hill on an almost weekly basis, but in HuffPost and other publications as well! And, it’s all “original stuff.”  I have a hard time just keeping up with posting his articles!

Nolan might be right, if Trump can keep from shooting off his mouth and undermining his own case, as he has done in the past. But, that’s a big “if!” And to date, I’ve seen nothing to indicate that 1) Trump possesses the quality of self control, or 2) that anyone else can impose it on him. So, I wouldn’t underestimate Trump’s ability to screw this up. Perhaps, Nolan is just hoping that Trump will show some restraint.

“The Supreme Court on Monday agreed to let a limited version of President Trump’s travel ban take effect, so we are republishing an updated version of this story.

President Trump’s executive order temporarily banning travelers from six Muslim-majority nations due to “heightened concerns about terrorism” was quickly frozen by the courts, much like an earlier version of the ban, until the Supreme Court acted on Monday.

The justices said they would let the ban partially take effect and, in the ruling, announced plans to consider the case later this year. The Supreme Court made a key exception, saying the ban could not be “enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States.” But otherwise, the Trump administration is now free to impose a 90-day ban on travelers from six countries that it had said posed certain “national security risks.”

The second travel ban had something big in common with the first version: It would not have kept out of the United States anyone responsible for a deadly terrorist attack since 2001.”

TRUMP ADMINISTRATION’S WAR ON AMERICA’S GREATNESS CONTINUES –TILLERSON DECONSTRUCTS CENTURIES OF AMERICAN DIPLOMACY!

“The deconstruction of the State Department is well underway.

I recently returned to Foggy Bottom for the first time since January 20 to attend the departure of a former colleague and career midlevel official—something that had sadly become routine. In my six years at State as a political appointee, under the Obama administration, I had gone to countless of these events. They usually followed a similar pattern: slightly awkward, but endearing formalities, a sense of melancholy at the loss of a valued teammate. But, in the end, a rather jovial celebration of a colleague’s work. These events usually petered out quickly, since there is work to do. At the State Department, the unspoken mantra is: The mission goes on, and no one is irreplaceable. But this event did not follow that pattern. It felt more like a funeral, not for the departing colleague, but for the dying organization they were leaving behind.

As I made the rounds and spoke with usually buttoned-up career officials, some who I knew well, some who I didn’t, from a cross section of offices covering various regions and functions, no one held back. To a person, I heard that the State Department was in “chaos,” “a disaster,” “terrible,” the leadership “totally incompetent.” This reflected what I had been hearing the past few months from friends still inside the department, but hearing it in rapid fire made my stomach churn. As I walked through the halls once stalked by diplomatic giants like Dean Acheson and James Baker, the deconstruction was literally visible. Furniture from now-closed offices crowded the hallways. Dropping in on one of my old offices, I expected to see a former colleague—a career senior foreign service officer—but was stunned to find out she had been abruptly forced into retirement and had departed the previous week. This office, once bustling, had just one person present, keeping on the lights.

This is how diplomacy dies. Not with a bang, but with a whimper. With empty offices on a midweek afternoon.

When Rex Tillerson was announced as secretary of state, there was a general feeling of excitement and relief in the department. After eight years of high-profile, jet-setting secretaries, the building was genuinely looking forward to having someone experienced in corporate management. Like all large, sprawling organizations, the State Department’s structure is in perpetual need of an organizational rethink. That was what was hoped for, but that is not what is happening. Tillerson is not reorganizing, he’s downsizing.

While the lack of senior political appointees has gotten a lot of attention, less attention has been paid to the hollowing out of the career workforce, who actually run the department day to day. Tillerson has canceled the incoming class of foreign service officers. This as if the Navy told all of its incoming Naval Academy officers they weren’t needed. Senior officers have been unceremoniously pushed out. Many saw the writing on the wall and just retired, and many others are now awaiting buyout offers. He has dismissed State’s equivalent of an officer reserve—retired FSOs, who are often called upon to fill State’s many short-term staffing gaps, have been sent home despite no one to replace them. Office managers are now told three people must depart before they can make one hire. And now Bloomberg reports that Tillerson is blocking all lateral transfers within the department, preventing staffers from moving to another office even if it has an opening. Managers can’t fill openings; employees feel trapped.

Despite all this, career foreign and civil service officers are all still working incredibly hard representing the United States internationally. They’re still doing us proud. But how do you manage multimillion-dollar programs with no people? Who do you send to international meetings and summits? Maybe, my former colleagues are discovering, you just can’t implement that program or show up to that meeting. Tillerson’s actions amount to a geostrategic own-goal, weakening America by preventing America from showing up.

State’s growing policy irrelevance and Tillerson’s total aversion to the experts in his midst is prompting the department’s rising stars to search for the exits. The private sector and the Pentagon are vacuuming them up. This is inflicting long-term damage to the viability of the American diplomacy—and things were already tough. State has been operating under an austerity budget for the past six years since the 2011 Budget Control Act. Therefore, when Tillerson cuts, he is largely cutting into bone, not fat. The next administration won’t simply be able to flip a switch and reverse the damage. It takes years to recruit and develop diplomatic talent. What Vietnam did to hollow out our military, Tillerson is doing to State.”

While Trump and his cronies fabricate security threats from refugees, Muslims, and immigrants (and, I guess we can now add “grandparents” to that list), the greatest threat to our national security is the Trump Administration itself and its toxic mix of arrogance, incompetence, ignorance, and disdain for America and all it has stood for.
