Four toddlers were so severely ill and neglected at a U.S. Border Patrol facility in McAllen, Texas, that lawyers forced the government to hospitalize them last week.

The children, all under age 3 with teenage mothers or guardians, were feverish, coughing, vomiting and had diarrhea, immigration attorneys told HuffPost on Friday. Some of the toddlers and infants were refusing to eat or drink. One 2-year-old’s eyes were rolled back in her head, and she was “completely unresponsive” and limp, according to Toby Gialluca, a Florida-based attorney.

She described seeing terror in the children’s eyes.

“It’s just a cold, fearful look that you should never see in a child of that age,” Gialluca said. “You look at them and you think, ‘What have you seen?’”

Another mother at the same facility had a premature baby, who was “listless” and wrapped in a dirty towel, as HuffPost previously reported.

The lawyers feared that if they had not shown up at the facility, the sick kids would have received zero medical attention and potentially died. The Trump administration has come under fire for its treatment ― and its alleged neglect ― of migrants who have been crossing the southern border in record numbers. The result is overcrowded facilities, slow medical care and in some instances, deaths.

Immigration authorities say they’re overwhelmed; activists say they’re not trying hard enough.

“It’s intentional disregard for the well-being of children,” Gialluca said. “The guards continue to dehumanize these people and treat them worse than we would treat animals.”

U.S. Customs and Border Protection declined to respond to HuffPost’s request for comment.

The Associated Press reported this week that children in border facilities don’t have adequate access to food, water, soap or showers. On Tuesday, a Justice Department attorney argued in court that the government should not have to provide detained children with soap, toothbrushes or beds.

The AP report is based on interviews a group of lawyers conducted with hundreds of children in three Texas-based Border Patrol stations last week as part of the Flores settlement ― an agreement that outlines conditions for detained children. The lawyers say children are also being held in these facilities for longer than the 72-hour limit the settlement specifies, and in some cases up to three weeks.

Lawyers are particularly concerned about the spread of illness inside Border Patrol facilities, which can sometimes turn fatal. Five children have died in Border Patrol custody since December, some of whom were initially diagnosed with a common cold or the flu. The processing center in McAllen, known as Ursula, recently quarantined three dozen migrants who were sick after a 16-year-old died of the flu at the same facility.

Children and their parents told lawyers that in some cases they didn’t have any access to medical treatment in Border Patrol facilities despite being visibly ill. Gialluca spoke with one 16-year-old mother whose toddler had the flu, but was told by a guard the child “wasn’t sick enough to see a doctor.” She said others also reported being denied medical attention despite having critically sick babies.

Medical experts say that because children have less developed immune and respiratory systems, their symptoms can escalate quickly if they aren’t properly treated.

Dr. Julie Linton, the co-chair of the American Academy of Pediatrics, previously told HuffPost that children can’t recover from illnesses in Border Patrol facilities. These centers are described as “hieleras” ― Spanish for iceboxes ― because of their freezing temperatures, and migrants describe sleeping on floors under bright lights that shine 24/7, with nothing but Mylar blankets to keep warm.

Gialluca met one 16-year-old mother whose 8-month-old baby was sick with the flu and forced to sleep outside for four days at the McAllen Border Patrol station. The mother said the guards took the clothing off the baby’s back, leaving her in a diaper, and forced them to sleep on concrete without a blanket.

A sick 2-year-old girl was shivering in a T-shirt and had shallow breathing, according to Mike Fassio, a Seattle-based immigration attorney who visited Ursula.

“I was very, very concerned,” he said, adding lawyers spoke with immigrants in a room outside of the facility. “When she left us, I knew she was going back to a place that was cold, crowded and unsanitary.” Fassio noted that guards referred to the children as “bodies.”

Some children were so exhausted they fell asleep during the interviews, said Clara Long, a senior researcher at Human Rights Watch who spoke with kids at a facility in Clint, Texas. Long met a 3-year-old boy who was dirty with matted hair and was being taken care of by his 11-year-old brother. She said that more than 10 sick children were being quarantined in cells.

While the group of roughly eight lawyers and interpreters at Ursula were supposed to be interviewing children about conditions in the facilities, they also ended up asking guards and government officials to bring kids to the hospital because they were so worried about their state. Gialluca added that she and her colleagues interviewed only a small portion of migrants in the facility, which is the largest processing center in the U.S. and can hold up to 1,000 people. She believes the number of migrants in need of hospitalization is likely much higher.

Government officials have blamed horrific conditions at detention facilities on the fact that Congress has not yet passed an emergency funding package that would include almost $3 billion to help care for unaccompanied migrant children. But Gialluca says border officials shouldn’t need more resources to treat immigrants like human beings.

“Money isn’t keeping guards from allowing people to access toilets,” she said. “Money isn’t causing guards to take clothing and medicine away from children.”

A team of lawyers conducted 60 interviews with migrant children being held in an El Paso, Texas, detention camp and found conditions to be dismal.

Fifteen of those in the holding center had the flu and 10 more are quarantined with illness, according to the lawyers, who first gave the data to the Associated Press. Three infants are being detained alongside their teenage mothers, and many children are under the age of 12.

“A Border Patrol agent came in our room with a 2-year-old boy and asked us, ‘Who wants to take care of this little boy?’ Another girl said she would take care of him, but she lost interest after a few hours and so I started taking care of him yesterday,” one teenaged girl told the lawyers in an interview. The boy was not wearing a diaper and his shirt was covered in mucus, she said.

Law professor Warren Binford, who aided in the interviews, said she witnessed an 8-year-old girl caring for a 4-year-old child who was very dirty, the girl was unable to get the boy to take a shower. She also described the children she interviewed as sleep-deprived, often falling asleep while speaking with her.

“In my 22 years of doing visits with children in detention, I have never heard of this level of inhumanity,” said Holly Cooper, co-director of the University of California, Davis’ Immigration Law Clinic, to the AP.

The lawyers were inspecting the facility as part of the Flores agreement, which resulted from a landmark 1985 case that established that facilities where minor migrants are held must be kept “safe and sanitary.”

A representative of the Trump administration, the Justice Department’s Sarah Fabian, argued Tuesday that safe and sanitary conditions don’t necessarily have to include toothbrushes, soap or towels for children.

TRUMP ADMINISTRATION PLANS MAJOR ICE RAIDS FOR SUNDAY
U.S. immigration authorities plan to raid Miami, Houston, Chicago and Los Angeles and other cities. They intend to arrest up to 2,000 families, three U.S. officials with knowledge of the plans told The Washington Post. The orders reportedly come directly from President Donald Trump.

On Monday, the president tweeted: “Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in.”

Officials told The Washington Post that the Department of Homeland Security agency plans to hold families in hotel rooms until they are deported. Acting DHS Secretary Kevin McAleenan is allegedly targeting families that have completely dropped out of the court process, but has warned that the operation could lead to further cases of families being separated.

Los Angeles Police Department Chief Michel Moore confirmed the raids on Friday, saying that about 140 families in southern California will be targeted in pre-dawn raids early next week. The chief also made clear that the raids are done on a federal level and that the police department will not be involved.

On Thursday, Carla Provost, chief of the United States Border Patrol argued that the Department of Homeland Security was not receiving enough money to properly care for migrants on the southern border, and that was leading to terrible conditions in detention centers. On Wednesday, the Senate Appropriations Committee agreed to $4.6 billion in emergency funds for what the Trump administration has referred to as a “border crisis.”

Texas Congressman Joaquin Castro questioned how the agency could afford mass raids while asking for more money Friday. “The Trump Administration says it needs more money (supplemental bill) for the situation at the border yet they may be starting massive immigration raids next week. So how do you have the money for that if you’re running out of money ICE?” he tweeted.

“These potential raids are a disgusting political ploy to stoke fear and rile up Trump’s base for 2020,” wrote Sandra Cordero, Director of Families Belong Together, an immigration advocacy group, in a statement. “Past raids have left children alone and afraid in empty homes, praying they won’t be left to care for younger siblings by themselves, with no idea if they’ll see their parents again. This is yet another flagrant disregard for the welfare of children on behalf of a cruel administration bent on fomenting fear and creating chaos.”

Come on, Carla, cut the BS and butt covering. The “mix” of arrivals at the Southern Border began to shift to refugee families from the Northern Triangle back in the summer of 2014. So, CBP and DHS have had five years to prepare for this “change” which is actually “old news.” 

More “old news” is the increased flow of asylum seekers with kids which began back before Thanksgiving. Plenty of time for CBP and DHS to bring back retired asylum officers and adjudicators and reassign other adjudicative personnel to the border to insure prompt, orderly, safe, and efficient processing of asylum applicants at ports of entry, thus eliminating the incentive (or necessity) for folks to turn themselves in after crossing the border between ports.

Also, plenty of time to work with NGOs, pro bono groups, states, and communities to insure representation and proper placement of family groups in various locations throughout the country without panic or “dumping.” 

Another bogus claim spread by Trump, Provost, and the rest of the sycophants: that the prevalence of kids among new asylum arrivals is somehow totally a response to the Flores settlement (which actually has been in effect for decades).

Undoubtedly, with the Trump Administration’s active assistance, unscrupulous smugglers and coyotes are encouraging some folks to bring children as the only way to have a shot at fair processing under the tilted U.S. asylum system promoted by Trump. So, the prevalence of children among new arrivals should properly been seen as part of a sad worldwide trend that Trump and his cronies disgustingly have done everything possible to encourage, exploit, and aggravate. It most certainly is not primarily caused by the Flores settlement or by giving soap, toothbrushes, blankets, or medical care to children being abused in the “DHS Gulag” administered in part by disingenuous folks like Provost.

Any honest observer of what’s going on knows that the majority of the asylum applications that passed credible fear probably could have been granted (or given protection under the Convention Against Torture — “CAT”) by the Asylum Office without even going to Immigration Court under the proper generous interpretation of our asylum laws, an honest interpretation of CAT that reflects the true conditions in the Northern Triangle, and a very “doable” change in procedures. 

Only dishonest fools in the Trump Administration (and a few from the Obama Administration) would maintain that gender isn’t a social group subject to widespread persecution in the Northern Triangle, deny that gangs have assumed the role of quasi-governmental entities thus making most of the harm they inflict on resisters “political persecution,” and make the beyond ludicrous claim that the corrupt failed states of the Northern Triangle have either the ability or much real interest in protecting those subject to persecution.

And, Carla, why aren’t you out there today registering a public protest of the waste of time and funds in ICE going after families with ridiculously inappropriate “raids” when every  resource could and should be focused instead on providing humanitarian assistance to asylum seekers arriving at the Southern Border?

This racist-inspired  “Sunday Morning Reign of Terror” directed at U.S. ethnic communities is specifically designed to return helpless families to the very dangerous countries from which they originally fled! Thus, Trump and his phony DHS are intentionally feeding “fresh meat” to gangs and cartels and insuring that the cycle of northward migration, no matter how dangerous, will continue until everyone who needs to leave its either gone or dead (the latter apparently the “solution” favored by Provost, Trump, Morgan, McAleenan, Miller, and others).

Provost, McAleenan, Morgan, and their co-conspirators are all participants in a cynical scheme to intentionally “crash” the asylum system, rather than competently administering it. They are intentionally endangering the lives of children and other vulnerable asylum seekers, many entitled to legal protections, to promote, along with GOP restrictionists, totally bogus, dishonest, and completely unnecessary and unwarranted restrictions of the precious, life-saving right of refugees to seek asylum in the U.S. 

It’s an unbelievably dishonest and cowardly scheme, and a complete breach of both oaths of office and public trust. It might be that those who long ago abandoned American values will lap up this insult to human values and human dignity.

But, there are plenty of us out here who know and understand exactly what you are doing. We will not only resist it, but will be historical witnesses to your cruel, inhuman, and unlawful schemes and gimmicks to “abuse and kill the innocent.” And, we’ll be keeping count.

Kevin McAleenan Falsely Claims That 90% Of Asylum Seekers Abscond — Actual Court Records Show The Truth: “Most courts showed patterns very similar to national appearance rates — with represented families’ appearance rates close to 100 percent, and unrepresented families somewhat lower.”

Here’s what McAleenan told Congress:

Acting Secretary of Homeland Security Kevin McAleenan testified Tuesday that 90 percent of asylum-seekers tracked under a recently instituted program skipped the hearings in which their cases were to be adjudicated.

Testifying before the Senate Judiciary Committee, McAleenan explained that his department is hampered in its efforts to deter illegal immigration by U.S. laws that allow asylum-seekers to remain on U.S. soil under their own recognizance for months or even years while awaiting a hearing that the vast majority of them simply skip.

“Out of those 7,000 cases, 90 received final orders of removal in absentia, 90 percent,” McAleenan told Senator Lindsey Graham (R., S.C.), referring to the results of a recent DHS pilot program that tracks family units applying for asylum.

“90 percent did not show up?” Graham asked.

“Correct. That is a recent sample from families crossing the border,” McAleenan replied.

The latest case-by-case records from the Immigration Courts indicate that as of the end of May 2019 one or more removal hearings had already been held for nearly 47,000 newly arriving families seeking refuge in this country. Of these, almost six out of every seven families released from custody had shown up for their initial court hearing. For those who are represented, more than 99 percent had appeared at every hearing. Thus, court records directly contradict the widely quoted claim that “90 Percent of Recent Asylum Seekers Skipped Their Hearings.”

These findings were based upon a detailed analysis of court hearing records conducted by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University. With rare exception virtually every family attended their court hearings when they had representation. Appearance rates at the initial hearing were 99.9 percent. One reason for these higher rates for represented families is that it is an attorney’s responsibility to keep on top of when and where their client’s hearing is scheduled, and communicate these details to them. Thus, even if the court’s notification system fails, the family still finds out where and when to appear for their hearing.

Under our current system, there is no legal requirement that immigrants actually receive notice, let alone timely notice, of their hearing. Given many problems in court records on attendance that TRAC found, and in the system for notifying families of the place and time of their hearings, these appearance rates were remarkably high. TRAC’s examination of court records also showed that there were nearly ten thousand “phantom” family cases on the court’s books. These were cases entered into the Immigration Court’s database system but with little information apart from a case sequence number. The date of the notice’s filing, charges alleged, and particulars on the family were all blank.

Most courts showed patterns very similar to national appearance rates — with represented families’ appearance rates close to 100 percent, and unrepresented families somewhat lower. Full details by nationality and court are available at:

Obviously, if McAleenan and the Administration were serious about court appearances, rather than spreading lies and creating chaos, they would work with the pro bono bar and NGOs to establish a universal representation program for asylum seekers. That would achieve nearly 100% compliance with hearing notices while promoting the rule of law and Constitutional Due Process. Not to mention that they should be investing in “quality control” in the issuance of the hearing notices, which all too often are erroneously addressed or improperly served. 

Lawyers and improved notice as well as more professional adjudications that actually comply with the generous legal standards for asylum established by Congress and the Supreme Court would be much smarter and better investments than detention, more enforcement officers, bogus in absentia hearings (most based on defective notices), attempting to force asylum seekers to apply or wait in dangerous third countries without functioning asylum systems, and smearing lawful asylum applicants in support of totally unwarranted changes in the law.

Additionally, with lawyers and fair, impartial, and properly trained independent judges, many more of these asylum cases could be granted in short order, thus helping eliminate largely self-created Immigration Court backlogs and unnecessary appeals that burden the system as a result of the Administration’s constant malfeasance (a/k/a “malicious incompetence” resulting in “Aimless Docket Reshuffling”).

In the meantime, McAleenan’s lies, distortions, and misrepresentations under oath should certainly be grounds for a Congressional investigation into why he retains his current position and why DHS is using taxpayer money to falsify data to support a bogus attack on lawful asylum seekers.  

Also interesting, but not surprising, that EOIR has 10,000 “phantom family cases” in its system.

President Trump said in a tweet Monday night that U.S. immigration agents are planning to make mass arrests starting “next week,” an apparent reference to a plan in preparation for months that aims to round up thousands of migrant parents and children in a blitz operation across major U.S. cities.

“Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States,” Trump wrote, referring to U.S. Immigration and Customs Enforcement. “They will be removed as fast as they come in.”

Large-scale ICE enforcement operations are typically kept secret to avoid tipping off targets. In 2018, Trump and other senior officials threatened the mayor of Oakland, Calif., with criminal prosecution for alerting city residents that immigration raids were in the works.

Trump and his senior immigration adviser, Stephen Miller, have been prodding Homeland Security officials to arrest and remove thousands of family members whose deportation orders were expedited by the Justice Department this year as part of a plan known as the “rocket docket.”

In April, acting ICE director Ronald Vitiello and Homeland Security Secretary Kirstjen Nielsen were ousted after they hesitated to go forward with the plan, expressing concerns about its preparation, effectiveness and the risk of public outrage from images of migrant children being taken into custody or separated from their families.

Vitiello was replaced at ICE by former FBI and Border Patrol official Mark Morgan, who had impressed the president with statements on cable television in favor of harsh immigration enforcement measures.In his first two weeks on the job at ICE, Morgan has said publicly that he plans to beef up interior enforcement and go after families with deportation orders, insisting that the rulings must be carried out to uphold the integrity of the country’s legal system.

“Our next challenge is going to be interior enforcement,” Morgan told reporters June 4 in Washington. “We will be going after individuals who have gone through due process and who have received final orders of deportation.

“That will include families,” he said, adding that ICE agents will treat the parents and children they arrest “with compassion and humanity.”

U.S. officials with knowledge of the preparations have said in recent days that the operation was not imminent, and ICE officials said late Monday night that they were not aware that the president planned to divulge their enforcement plans on Twitter.

Executing a large-scale operation of the type under discussion requires hundreds — and perhaps thousands — of U.S. agents and supporting law enforcement personnel, as well as weeks of intelligence gathering and planning to verify addresses and locations of individuals targeted for arrest.

The president’s claim that ICE would be deporting “millions” also was at odds with the reality of the agency’s staffing and budgetary challenges. ICE arrests in the U.S. interior have been declining in recent months because so many agents are busy managing the record surge of migrant families across the southern border with Mexico.

The family arrest plan has been considered even more sensitive than a typical operation because children are involved, and Homeland Security officials retain significant concerns that families will be inadvertently separated by the operation, especially because parents in some households have deportation orders but their children — some of whom are U.S. citizens — might not. Should adults be arrested without their children because they are at school, day care, summer camp or a friend’s house, it is possible parents could be deported while their children are left behind.

Supporters of the plan, including Miller, Morgan and ICE Deputy Director Matthew Albence, have argued forcefully that a dramatic and highly publicized operation of this type will send a message to families that are in defiance of deportation orders and could act as a deterrent.

According to Homeland Security officials, nearly all unauthorized migrants who came to the United States in 2017 in family groups remain present in the country. Some of those families are awaiting adjudication of asylum claims, but administration officials say a growing number are skipping out on court hearings while hoping to live and work in the United States as long as possible.

Publicizing a future law enforcement operation is unheard of at ICE. Trump administration officials blasted Oakland Mayor Libby Schaaf last year for warning immigrants about an impending raid, saying she endangered agents’ safety.

“The Oakland mayor’s decision to publicize her suspicions about ICE operations further increased that risk for my officers and alerted criminal aliens — making clear that this reckless decision was based on her political agenda with the very federal laws that ICE is sworn to uphold,” then-ICE Deputy Director Thomas D. Homan said at the time.

Homan later retired, but last week Trump said Homan would return to public service as his “border czar.” On Fox News, Homan later called that announcement “kind of premature” and said he had not decided whether to accept the job.

Schaaf responded late Monday to the president’s tweet teasing the looming ICE roundups.

“If you continue to threaten, target and terrorize families in my community . . . and if we receive credible information . . . you already know what our values are in Oakland — and we will unapologetically stand up for those values,” she wrote.

The pain, terror, racism, and disregard for human rights is real. But, the ability to summarily remove the “millions” of our fellow humans Trump claims as his objective might be limited by both reality (lack of resources) and the law.

Many of those with so-called “final orders” were tried “in absentia.” Many of those never received legal notice of their hearings. (All reputable studies show that asylum applicants who actually understand the system, have fair access to pro bono lawyers, and receive legally sufficient hearing notices appear at rates close to 100% of the time, even if they lose their cases).

If that is the case, and they can get lawyers, they can file a “motion to reopen” for lack of legal notice and receive a statutory stay of removal while both the Immigration Judge, and if denied, the Board of Immigration Appeals rule on the motion. And, the Immigration Courts are totally screwed up and backlogged due to Trump’s and the DOJ’s “malicious incompetence.” So, good luck with that.

Large numbers of deportees would also further destabilize the already “failed states” of the Northern Triangle thus insuring a continuing outward flow.  Indeed, some of those deported might well “head north” again — only this time they won’t be dumb enough to entrust themselves to the U.S. legal system.

They will just disappear into the interior where their chances of being found again are probably less than their chances of being harmed in the Northern Triangle. No amount of authoritarian militarization of our internal police force is going to locate and remove 10-11 million people, most of them residing quietly and productively in our communities throughout America.

But, Trump has never been about results. (Nor has DHS for that matter). He’s all about White Nationalist hatred, racism, and appealing to a “base” that long ago abandoned the rest of America (the majority of us) and human values.

And let’s not forget the responsibility of Congress and the Article III Courts who for years have mostly overlooked the glaring Constitutional defects and clear incompetence and bias evident in the Immigration Court system as administered by the Department of Justice. It has taken the Article IIIs’ complicity in a legally defective system to produce these so-called “final orders” in the first place. 

Every dead kid, broken family, and new forced gang recruit should be on their collective consciences. And, the primary result of the “New Reign of Terror” will undoubtedly be fear of cooperating with local police in solving crimes, thus making ethnic Americans “perfect victims” who have been abandoned by those who are failing in their legal duties to insure “equal justice for all.”

2020 might be our last chance to save our country and humanity. Don’t blow it! Who knows, the life you save might be your own!

Cages With ‘Kids’ Pop Up Around NYC To Protest Immigrant Detention

The art installations were meant to bring awareness to the horrific conditions children and other migrants face at the southern U.S. border.

Some people in New York City were confronted with an alarming image as they walked down the street on Wednesday morning: a chain-link cage on the sidewalk containing a child-size mannequin wrapped in a foil blanket, with audio playing of migrant children crying.

More than 20 cages were placed around Manhattan and Brooklyn ― from Union Square to the Barclays Center sports arena ― as part of a campaign called #NoKidsInCages by immigration nonprofit RAICES and ad agency Badger & Winters.

It was meant to draw Americans’ attention to the children and other migrants being held in alarming conditions at the U.S.-Mexico border.

Speakers in the cages played the viral recording released by ProPublica last summer of kids wailing for their “mamá” and “papá” after having been separated from them at the border as a result of the Trump administration’s “zero tolerance” immigration policy.

“We want to bring this back to the consciousness of the American people,” RAICES CEO Jonathan Ryan told HuffPost. “One of the many unfortunate consequences of the repeated traumatic stories coming from the border is that, as horrified and angry as people have been, we also become desensitized. It’s important for people … to be confronted with the reality that this is about children, human beings, whose lives are forever affected.”

“This is being done in our name by people who we elected,” he added. “And if we don’t do something to stop this, this will become who we are.”

About two dozen cages were dropped around the city from about 4 a.m. to 5 a.m., Ryan said. By midafternoon most of them had been taken down by police or city employees, with three remaining around 2 p.m., per Ryan. The New York Police Department confirmed to HuffPost that more than half a dozen cages had been removed around Manhattan, but did not respond to questions as to why.

The online campaign associated with the installations recalls the family separations under President Donald Trump’s hard-line zero-tolerance policy, which led to the separation of thousands of children from their parents last year. The policy sparked protests nationwide and was reversed by executive order in late June. But a January report from the Department of Health and Human Services found the administration may have separated thousands more kids from their families than was previously known, and it did not know how many or whether they were reunited.

RAICES also wants people to become aware of other issues migrants face, Ryan said.

He noted undocumented immigrant families are still separated “routinely” at the border, including when migrant kids are split from other guardians like uncles and aunts or older siblings. Separations occur inside the country too, he said, when a child’s undocumented mom or dad is arrested by immigration agents, for instance in a workplace raid.

U.S. Customs and Border Protection apprehended over 109,000 people at the border in April ― more than double the number of migrants detained during that month last year. A majority of the migrants apprehended were either families traveling together or unaccompanied kids.

A Department of Homeland Security watchdog, reporting on Border Patrol facilities in El Paso, Texas, found last month that detained migrants were kept in dirty and extremely crowded conditions, forcing some people to stand on toilets to get some breathing room.

Last week, Trump said he reached an agreement with Mexico that includes “rapidly” returning to Mexico anyone who crosses the border seeking asylum in the U.S. Advocates are concerned about the dangerous conditions in cities such as Tijuana and Ciudad Juárez, where more migrants will now be forced to wait as their claims are processed.

“When the American people hear stories of this problem being fixed by the ‘remain in Mexico’ policy, it hasn’t been fixed, it’s just further from their view,” Ryan said. “The suffering will only increase.”

WASHPOST CALLS OUT TRUMP’S RACIST ATTACKS ON MIGRANTS: “This is Trumpism at its ugliest: turning truth on its head; vilifying the “other”; sowing hatred and fear. It is un-American at its core; it’s also the president’s stock in trade.”

The Post Editorial Board writes:

UNDER THE Trump administration, deportation agents have arrested unauthorized immigrants with no criminal records at more than three times the rate they were arrested during the final two years of the Obama administration. That may be surprising given the White House’s relentless and sweeping characterization of such migrants as dangerous criminals, gang members and, in the president’s own words, “bad hombres.”

Or maybe not so surprising. Multiple studies have shown that immigrants generally commit crimes at a lower rate than native-born Americans. New data — the most comprehensive to date — suggest there is also no correlation between illegal immigrants and higher crime rates. Notwithstanding the president’s inflammatory rhetoric, most undocumented immigrants are law-abiding, which may help explain the growing percentage of those picked up by Immigration and Customs Enforcement agents who have no crime on their records.

The new data come from studies undertaken by the Pew Research Center and the Marshall Project, both nonpartisan outfits. Crunching the numbers, Pew broke down changes in the number of unauthorized immigrants in each of some 180 metropolitan areas in the decade that ended in 2016. Using those figures and places, the Marshall Project compared them with local rates of violent and property crime from the Uniform Crime Reporting program, published by the FBI.

The results showed that crime declined in the large majority of those metro areas, as it has for more than 20 years throughout the United States generally, whether the number of undocumented migrants increased or decreased in a particular place. Anna Flagg, a senior data reporter for the Marshall Project, wrote that “changes in undocumented populations had little or no effect on crime in the various metro areas under survey.” There was some data, albeit inconclusive, suggesting that crime fell even more in places with greater numbers of illegal immigrants.

As is often the case, the facts fly in the face of the Trump administration’s agenda, which is to convince Americans that undocumented migrants are a frightening threat. Nonetheless, the new data dovetail with several previous studies — from the libertarian Cato Institute; from Governing Magazine; and from Criminology, an academic journal — that also show no correlation between unauthorized immigration and crime rates. As The Post’s Fact Checker, Glenn Kessler, wrote this year, “the available research indicates that, when compared to U.S. citizens, illegal immigrants commit fewer crimes.”

By bending the data — or, in this case, ignoring facts to suit their own cynical political narrative — Trump administration officials have engaged in demagoguery and scare tactics, the better to whip up xenophobic hysteria. President Trump himself has made it clear he believes that strategy was critical to his electoral success in 2016; there is every indication he will revive and amplify it in the 2020 cycle.

This is Trumpism at its ugliest: turning truth on its head; vilifying the “other”; sowing hatred and fear. It is un-American at its core; it’s also the president’s stock in trade.

White Nationalism and racism won’t resolve immigration issues. There is a pretty good socio-economic argument that much of Trump’s overblown, expensive, arbitrary, and capricious civil enforcement of immigration laws does more harm than good, removing productive members of our communities and often leaving unnecessary pain and suffering behind. Not too mention tying up public and private resources that could better be spent on things more beneficial to society.

Welcome to the front lines of the battle for our legal system, and ultimately for the future of our constitutional republic. Because, make no mistake, once this Administration, its nativist supporters, and enablers succeed in eradicating the rights and humanity of Central American asylum seekers, all their other enemies” — Hispanics, gays, African Americans, the poor, women, liberals, lawyers, journalists, civil servants, Democrats will be in line for Dred Scottification” — becoming non-personsunder our Constitution. If you dont know what the Insurrection Actis or Operation Wetbackwas, you should tune into todays edition of my blog immigrationcourtside.com and take a look into the future of America under our current leadersdark and disgraceful vision.

Before I introduce the Dream Teamsitting to my right, a bit of asylum history.

In 1987, the Supreme Court established in INS v. Cardoza-Fonseca that a well founded fear of persecution for asylum was to be interpreted generously in favor of asylum applicants. So generously, in fact, that someone with only a 10% chance of persecution qualifies.

Shortly thereafter, the BIA followed suit with Matter of Mogharrabi, holding that asylum should be granted even in cases where persecution was significantly less than probable. To illustrate, the BIA granted asylum to an Iranian who suffered threats at the Iranian Interests Section in Washington, DC. Imagine what would happen to a similar case under todays regime!

In the 1990s, the Legacy INSenacted regulations establishing that those who had suffered past persecutionwould be presumed to have a well-founded fear of future persecution, unless the Government could show materially changed circumstances or a reasonably available internal relocation alternative that would eliminate that well-founded fear. In my experience as a judge, that was a burden that the Government seldom could meet.  

But the regulations went further and said that even where the presumption of a well founded fear had been rebutted, asylum could still be granted because of egregious past persecutionor other serious harm.

In 1996, the BIA decided the landmark case of Matter of Kasinga, recognizing that abuses directed at women by a male dominated society, such as female genital mutilation(FGM), could be a basis for granting asylum based on a particular social group.Some of us, including my good friend and colleague Judge Lory Rosenberg, staked our careers on extending that much-need protection to women who had suffered domestic violence. Although it took an unnecessarily long time, that protection eventually was realized in the 2014 precedent Matter of A-R-C-G-, long after our forced departurefrom the BIA.

And, as might be expected, over the years the asylum grant rate in Immigration Court rose steadily, from a measly 11% in the early 1980s, when EOIR was created, to 56% in 2012, in an apparent long overdue fulfillment of the generous legal promise of Cardoza-Fonseca. Added to those receiving withholding of removal and/or relief under the Convention Against Torture (CAT), approximately two-thirds of asylum applicants were receiving well-deserved, often life-saving legal protection in Immigration Court.

Indeed, by that time, asylum grant rates in some of the more due-process oriented courts with asylum expertise like New York and Arlington exceeded 70%, and could have been models for the future. In other words, after a quarter of a century of struggles, the generous promise of Cardoza-Fonseca was finally on the way to being fulfilled. Similarly, the vision of the Immigration Courts as through teamwork and innovation being the worlds best administrative tribunals guaranteeing fairness and due process for allwas at least coming into focus, even if not a reality in some Immigration Courts that continued to treat asylum applicants with hostility.

And, that doesnt count those offered prosecutorial discretion or PDby the DHS counsel. Sometimes, this was a humanitarian act to save those who were in danger if returned but didnt squarely fit the somewhat convoluted refugeedefinition as interpreted by the BIA. Other times, it appeared to be a strategic move by DHS to head off possible precedents granting asylum in close casesor in emerging circumstances.

In 2014, there was a so-called surgein asylum applicants, mostly scared women, children, and families from the Northern Triangle of Central America seeking protection from worsening conditions involving gangs, cartels, and corrupt governments.There was a well-established record of femicide and other widespread and largely unmitigated gender-based violence directed against women and gays, sometimes by the Northern Triangle governments and their agents, other times by gangs and cartels operating with the knowledge and acquiescence of the governments concerned.

Also, given the breakdown of governmental authority and massive corruption, gangs and cartels assumed quasi-governmental status, controlling territories, negotiating treaties,exacting involuntary taxes,and severely punishing those who publicly opposed their political policies by refusing to join, declining to pay, or attempting to report them to authorities. Indeed, MS-13 eventually became the largest employer in El Salvador. Sometimes, whole family groups, occupational groups, or villages were targeted for their public acts of resistance.

Not surprisingly in this context, the vast majority of those who arrived during the so-called surgepassed credible fearscreening by the DHS and were referred to the Immigration Courts, or in the case of unaccompanied minors,to the Asylum Offices, to pursue their asylum claims.

The practical legal solution to this humanitarian flow was obvious help folks find lawyers to assist in documenting and presenting their cases, screen out the non-meritorious claims and those who had prior gang or criminal associations, and grant the rest asylum. Even those not qualifying for asylum because of the arcane nexusrequirements appeared to fit squarely within the CAT protection based on likelihood of torture with government acquiescence upon return to the Northern Triangle. Some decent BIA precedents, a robust refugee program in the Northern Triangle, along with continued efforts to improve the conditions there would have sealed the deal.In other words, the Obama Administration had all of the legal tools necessary to deal effectively and humanely with the misnamed surgeas what it really was a humanitarian situation and an opportunity for our country to show human rights leadership!

But, then things took a strange and ominous turn. After years of setting records for deportations and removals, and being disingenuously called soft on enforcementby the GOP, the Obama Administration began believing the GOP myths that they were wimps. They panicked! Their collective manhooddepended on showing that they could quickly return refugees to the Northern Triangle to deterothers from coming. Thus began the weaponizationof our Immigration Court system that has continued unabated until today.

They began imprisoning families and children in horrible conditions and establishing so-called courtsin those often for profit prisons in obscure locations where attorneys generally were not readily available. They absurdly claimed that everyone should be held without bond because as a group they were a national security risk.They argued in favor of indefinite detention without bond and making children and toddlers represent themselvesin Immigration Court.

The Attorney General also sent strong messages to EOIR that hurrying folks through the system by prioritizingthem, denying their claims, stuffingtheir appeals, and returning them to the Northern Triangle with a mere veneer of due process was an essential part of the Administrations get toughenforcement program. EOIR was there to send a messageto those who might be considering fleeing for their lives dont come, you wont get in, no matter how strong your claim might be.

They took judges off of their established dockets and sent them to the Southern Border to expeditiously remove folks before they could get legal help. They insisted on jamming unprepared cases of recently arrived juveniles and adults with childrenin front of previously docketed cases, thereby generating total chaos and huge backlogs through what is known as aimless docket reshuffling(ADR).

Hurry up scheduling and ADR also resulted in more in absentiaorders because of carelessly prepared and often inadequate or wrongly addressed noticessent out by overwhelmed DHS and EOIR court staff. Sometimes DHS could remove those with in absentia orders before they got a chance to reopen their cases. Other times, folks didnt even realize a removal order had been entered until they were on their way back.

They empowered judges with unusually high asylum denial rates. By a ratio of nine to one they hired new judges from prosecutorial backgrounds, rather than from the large body of qualified candidates with experience in representing asylum applicants who might actually have been capable of working within the system to fairly and efficiently recognize meritorious cases, promote fair access to pro bono counsel, and insure that doubtful cases or those needing more attention did not get lostin the artificial backlogs being created in an absurdly mismanaged system. In other words, due process took a back seat to expedienceand fulfilling inappropriate Administration enforcement goals.

Asylum grant rates began to drop, even as conditions on the ground for refugees worldwide continued to deteriorate. Predictably, however, detention, denial, inhumane treatment, harsh rhetoric, and unfair removals failed to stop refugees from fleeing the Northern Triangle.

But, just when many of us thought things couldnt get worse, they did. The Trump Administration arrived on the scene. They put lifelong White Nationalist xenophobe nativists Jeff Sessions and Stephen Miller in charge of eradicating the asylum process. Sessions decided that even artificially suppressed asylum grant rates werent providing enough deterrence; asylum seekers were still winning too many cases. So he did away with A-R-C-G- and made it harder for Immigration Judges to control their dockets.

He tried to blame asylum seekers and their largely pro bono attorneys, whom he called dirty lawyers,for having created a population of 11 million undocumented individuals in the U.S. He promoted bogus claims and false narratives about immigrants and crime. Perhaps most disgustingly, he was the mastermindbehind the policy of child separationwhich inflicted lifetime damage upon the most vulnerable and has resulted in some children still not being reunited with their families.

He urged judgesto summarily deny asylum claims of women based on domestic violence or because of fear of persecution by gangs. He blamed the judges for the backlogs he was dramatically increasing with more ADR and told them to meet new quotas for churning out final orders or be fired. He made it clear that denials of asylum, not grants, were to be the new normfor final orders.

His sycophantic successor, Bill Barr, an immigration hard-liner, immediately picked up the thread by eliminating bond for most individuals who had passed credible fear. Under Barr, the EOIR has boldly and publicly abandoned any semblance of due process, fairness, or unbiased decision making in favor of becoming an Administration anti-asylum propaganda factory. Just last week they put out a bogus fact sheetof lies about the asylum process and the dedicated lawyers trying to help asylum seekers. The gist was that the public should believe that almost all asylum seekers from the Northern Triangle are mala fide and that getting them attorneys and explaining their rights are a waste of time and money.

In the meantime, the Administration has refused to promptly process asylum applicants at ports of entry; made those who have passed credible fear wait in Mexicoin dangerous and sometimes life-threatening conditions; unsuccessfully tried to suspend the law allowing those who enter the U.S. between ports of entry to apply for asylum; expanded the New American Gulagwith tent cities and more inhumane prisons dehumanizingly referred to as bedsas if they existed without reference to those humans confined to them;  illegally reprogrammed money that could have gone for additional humanitarian assistance to a stupid and unnecessary wall;and threatened to dumpasylum seekers to punishso-called sanctuary cities.Perhaps most outrageously, in violation of clear statutory mandates, they have replaced trained Asylum Officers in the credible fearprocess with totally unqualified Border Patrol Agents whose job is to make the system adversarialand to insure that fewer individuals pass credible fear.

The Administration says the fact that the credible fearpass rate is much higher than the asylum grant rate is evidence that the system is being gamed.Thats nativist BS! The, reality is just the opposite: that so many of those who pass credible fear are eventually rejected by Immigration Judges shows that something is fundamentally wrong with the Immigration Court system. Under pressure to produce and with too many biased, untrained, and otherwise unqualified judges,many claims that should be granted are being wrongfully denied.

Today, the Immigration Courts have become an openly hostile environment for asylum seekers and their representatives. Sadly, the Article III Courts arent much better, having largely swallowed the whistleon a system that every day blatantly mocks due process, the rule of law, and fair and unbiased treatment of asylum seekers. Many Article IIIs continue to deferto decisions produced not by expert tribunals,but by a fraudulent court system that has replaced due process with expediency and enforcement.

But, all is not lost. Even in this toxic environment, there are pockets of judges at both the administrative and Article III level who still care about their oaths of office and are continuing to grant asylum to battered women and other refugees from the Northern Triangle. Indeed, I have been told that more than 60 gender-based cases from Northern Triangle countries have been  granted by Immigration Judges across the country even after Sessionss blatant attempt to snuff out protection for battered women in Matter of A-B-. Along with dependent family members, that means hundreds of human lives of refugees saved, even in the current age.

Also significantly, by continuing to insist that asylum seekers from the Northern Triangle be treated fairly in accordance with due process and the applicable laws, we are making a record of the current legal and constitutional travesty for future generations. We are building a case for an independent Article I Immigration Court, for resisting nativist calls for further legislative restrictions on the rights of asylum seekers, and for eventually holding the modern day Jim Crowswho have abused the rule of law and human values, at all levels of our system, accountable, before the court of historyif nothing else!

Eventually, we will return to the evolving protection of asylum seekers in the pre-2014 era and eradicate the damage to our fundamental values and the rule of law being done by this Administrations nativist, White Nationalist policies.Thats what the New Due Process Armyis all about.

Here to tell you how to effectively litigate for the New Due Process Army and to save even more lives of deserving refugees from all areas of the world, particularly from the Northern Triangle, are three of the best ever.I know that, because each of them appeared before me during my tenure at the Arlington Immigration Court. They certainly brightened up my day whenever they appeared, and I know they will enlighten you with their legal knowledge, energy, wit, and humanity.

AS TRUMP’S POLICY OF “MALICIOUS INCOMPETENCE” CONTINUES TO UNRAVEL, UNHINGED PREZ CONSIDERS MASSIVE VIOLATIONS OF CONSTITUTION & HUMAN RIGHTS — “OPERATION WETBACK 2019” In The Offing?

A White House spokesman left often the possibility Friday that President Trump would invoke an arcane law that would allow him to deploy the military to remove illegal immigrants, as Trump warned migrants on Twitter that they could be leaving the country soon.

Asked during a television appearance whether Trump is considering using the Insurrection Act, spokesman Hogan Gidley said the president is “going to do everything within his authority to protect the American people” and has “lots of tools at his disposal.”

“We haven’t used them all, and we’re looking at ways to protect the American people,” Gidley said during an appearance on Fox News’s “Fox & Friends.”

His interview took place amid a series of tweets from Trump, including some that suggested new actions to crack down on illegal immigration.

“All people that are illegally coming into the United States now will be removed from our Country at a later date as we build up our removal forces and as the laws are changed,” Trump said in one tweet. “Please do not make yourselves too comfortable, you will be leaving soon!”

In another, Trump said “bad ‘hombres’” were being detained and would be “sent home.”

His tweets followed a Rose Garden speech on Thursday about a new immigration plan that opened him to criticism from conservatives for not pressing a harder line.

The new White House proposal seeks to prioritize the admission to the United States of high-skilled workers over those with family members who are U.S. citizens, but it does not change the net level of green cards allocated each year.

In a sign of sensitivity to criticisms from immigration hard-liners, The Post reported Thursday that Trump’s advisers are looking at measures behind the scenes such as the Insurrection Act, an arcane law that allows the president to employ the military to combat lawlessness or rebellion, to remove illegal immigrants.

The idea of using the law was first reported by the Daily Caller, a conservative news outlet, after Trump finished his speech Thursday afternoon.

Such a plan would involve deployment of the National Guard and cooperation of governors who might not be inclined to go along with Trump’s order.

I toured an immigration detention center. The prison-like atmosphere was mind-numbing.

Immigration detention is supposed to be a temporary stop, not a prison. But what else can one call a place with razor wire covered fences, holding cells, head counts, locked dormitories, solitary confinement, limited recreation, inadequate mental health services and no-contact visits?

While visiting the New Mexico border area as volunteers with Catholic Charities Immigration Legal Services of Southern New Mexico in March, a group of undergraduates, three law students, a campus minister and I toured the Otero County Processing Center. Management & Training Corp. (MTC) runs the facility for the federal Immigration and Customs Enforcement service.

A smiling ICE officer greeted us at the start of our visit, explaining that ICE likes giving tours of Otero to dispel criticisms circulating about immigration detention.

Our first stop was the count room dominated by a large board covered with more than 900 colored tags on hooks — mostly blue and orange — representing the detainee population and designating the level of security and privileges afforded based on jumpsuit color. “Blues” have no known criminal history and simply entered the United States without papers. “Oranges” are divided into two groups — individuals who have a history of very minor crimes such as public intoxication, and those arrested for or convicted of other nonviolent crimes. “Reds” have arrests, convictions or other history involving violent activity.

In the intake area, we found newly arrived men lingering in a large holding cell behind a locked, metal door waiting to be processed. A security officer explained the intake procedure, but it was hard for me to focus on his words because I couldn’t take my eyes off the mountain of duffel bags and backpacks full of their belongings piled next to a shower room. I later learned that same image haunted my students.

We passed through the medical unit where individuals receive basic medical care. Those with more serious conditions, we were told, are sent outside of the facility. Our guides told us that a psychiatrist visits once a month to oversee medication, and one full-time counselor is available for the 900 or more detainees. There is a small room where detainees deemed suicidal are watched.

Our guides also brought us into one of the dorms — locked housing where 50 men sleep on thin mattresses in rows of bunk beds. I was overcome with a sense of time standing still; boredom pervaded the room. Despite MTC’s commitment to “provide an atmosphere that is comfortable, safe, and conducive to making time pass quickly for those who find themselves in our care,” individuals are limited to two hours of recreation a day.

One of the students asked whether English classes are offered. Our guide replied that they are working on it, that such programs have not been instituted because those at Otero only stay for six to eight weeks. But we met detainees who reported being there for six to eight months or more.

The blues and oranges able to secure a job in the facility (only four of the 50 men in the dorm we visited were working at the time) earn at least $1 a day, the ICE-stipulated minimum wage. I couldn’t help but wonder whether the detainees we saw raking the grounds, mopping hallways, doing laundry or preparing food allowed MTC to meet its labor needs without actually paying for them.

A glimpse through a narrow window revealed the Secured Housing Unit — the solitary confinement block — a row of small cells where individuals causing problems are sent. Men who are vulnerable to bullying or abuse (including transgender women) can also request a move here for protection, though they would have to be pretty desperate to do so.

Immigrants need asylum, not imprisonment

Facilities like Otero are not supposed to be prisons. Most ICE detainees have not been convicted of any crime. For many others, they are detained even though a U.S. court had dismissed charges, authorized release while awaiting trial, or convicted and imposed a minimal sentence already served.

None of these men belong in jail.

Yet the realization that we were in a jail only intensified at our last stop — the visiting area. We found a large glass window running the length of a long table, seats placed on either side. Detainees are kept separate from loved ones and communicate by phone.

Immigration detention is supposed to be a temporary stop for individuals seeking a determination of whether they have a legal basis for staying in the United States. Yet many at Otero are eligible to apply for asylum and other forms of humanitarian protection.

Why are U.S. taxpayers paying a private company to provide housing, food and 24/7 security for individuals, the majority of whom pose no security threat and have a right under U.S. law to seek protection?

Why are these men consigned to live in a mind-numbing, prison-like atmosphere that leads many — in Otero and similar facilities around the country — to become so desperate to get out that they abandon valid claims and self-deport?

Unfortunately, my students and I came to the troubling conclusion that this desperation is not just the inevitable result of immigration confinement, but may actually be the goal in the first place.

In the final “Kafkaesque” twist, perhaps Trump’s “maliciously incompetent” immigration policies will simply convince individuals needing refuge that our legal system is as worthless and dishonest as the ones they are leaving behind.

For the right price and degree of risk (and refugees are by nature risk takers) smugglers will be able to eventually get persistent individuals to the interior. There, as I have pointed out, their chances of avoiding forced removal will be much better than their odds of getting asylum in an unfairly biased, increasingly lawless system that uses illegal coercive methods and is stacked against their claims, no matter how valid or compelling.

Right now these folks are NOT a security risk, no matter what lies Trump and the restrictionists spread. A smart, humane, competent, and law-abiding Administration would simply encourage them to arrive at ports of entry, promptly screen them, apply the asylum laws in the generous way that they were intended, integrate those granted (probably the majority, under a fair, generous application of the law, in accordance with Cardoza-Fonseca) into our society, and return those who do not qualify after full due process in a humane and dignified manner.

Why would folks cross the border between ports of entry to turn themselves in to the Border Patrol if they could present themselves at a border port and be treated promptly, humanely, and fairly? That’s what would actually give us a secure border as well as many grateful, productive new residents who will help the U.S. It would also promptly separate out those who clearly can’t qualify for protection before they establish ties to the U.S.

With a smarter, common-sense approach to the Immigration Courts, universal access to counsel, and better, more professional, judges who were actually well-trained in recognizing and granting meritorious asylum cases (and not expected to function as a “Border Patrol junior auxiliary”), asylum cases could be completed in compliance with full Due Process in months, rather than years. The Border Patrol could go back to real law enforcement, which they are largely ignoring right now in a rush to do Trump’s bidding.

Instead, Trump seems determined to create a situation where many will die, smugglers will get richer, but more individuals will get to the interior where they will live, unscreened and perhaps exploited, but alive, as part of a growing “underground” or “immigration black market.” The Border Patrol won’t even be able to count them or “arrest” (arguably an inappropriate term for
“turn ins”) them as they do now to support their bogus claims of  a “law enforcement emergency.” This self-created “emergency” — actually a humanitarian tragedy —has little to do with legitimate law enforcement. How maliciously incompetent can one Administration get?

And, no, “Trump’s Big Beautiful Wall” won’t stop professional smugglers! They are already laughing at his ineptness and anxiously waiting to see how his next nativist-driven dumb policy will improve their business and fill their coffers. The dumbest smuggler is probably smarter than Trump, and much less dangerous to America.

Shootouts, armed raids and last-minute pleas to stop the bloodshed formed the central threads of their stories. MS-13 wanted the neighborhood to sell drugs. The other gangs wanted it to extort and steal. But the members of Casa Blanca had promised never to let their neighborhood fall prey to that again. And they would die for it, if they had to.

Almost no one was trying to stop the coming war — not the police, not the government, not even the young men themselves. The only person working to prevent it was a part-time pastor who had no church of his own and bounced around the neighborhood in a beat-up yellow hatchback, risking his life to calm the warring factions.

“I’m not in favor of any gang,” said the pastor, Daniel Pacheco, rushing to the Casa Blanca members after the shooting. “I’m in favor of life.”

The struggle to protect the neighborhood — roughly four blocks of single-story houses, overgrown lots and a few stores selling chips and soda — encapsulates the inescapable violence that entraps and expels millions of people across Latin America.

Since the turn of this century, more than 2.5 million people have been killed in the homicide crisis gripping Latin America and the Caribbean, according to the Igarapé Institute, a research group that tracks violence worldwide.

The region accounts for just 8 percent of the global population, yet 38 percent of the world’s murders. It has 17 of the 20 deadliest nations on earth.

And in just seven Latin American countries — Brazil, Colombia, Honduras, El Salvador, Guatemala, Mexico and Venezuela — violence has killed more people than the wars in Afghanistan, Iraq, Syria and Yemen combined.

The violence is all the more striking because the civil wars and military dictatorships that once seized Latin America have almost all ended — decades ago, in many cases. Most of the region has trudged, often very successfully, along the prescribed path to democracy. Yet the killings continue at a staggering rate.

They come in many forms: state-sanctioned deaths by overzealous armed forces; the murder of women in domestic disputes, a consequence of pervasive gender inequality; the ceaseless exchange of drugs and guns with the United States.

Underpinning nearly every killing is a climate of impunity that, in some countries, leaves more than 95 percent of homicides unsolved. And the state is a guarantor of the phenomenon — governments hollowed out by corruption are either incapable or unwilling to apply the rule of law, enabling criminal networks to dictate the lives of millions.

For the masses fleeing violence and poverty in Central America, the United States is both a cause and solution — the author of countless woes and a chance to escape them.

Frustrated with the stream of migrants treading north, President Trump has vowed to cut aid to the most violent Central American nations, threatening hundreds of millions of dollars meant to address the roots of the exodus.

But the surviving members of Casa Blanca, who once numbered in the dozens, do not want to flee, like tens of thousands of their countrymen have. They say they have jobs to keep, children to feed, families, neighbors and loved ones to protect.

“There is only one way for this to end,” said Reinaldo. “Either they kill us or we kill them.”

Trump’s complete lack of humanity, empathy, and his constant racist-inspired lies and misrepresentations about refugees and asylum seekers are truly reprehensible.

But, he and his henchmen like Stephen Miller are by no means the entire problem.

Every day in U.S. Immigration Court, DHS attorneys make demonstrably false representations minimizing the truly horrible conditions in the Northern Triangle, particularly for women. Every day, some U.S. Immigration Judges betray their oaths of office by accepting those false representations and using them, along with an unfairly skewed anti-asylum view of the law, to deny asylum cases that should be granted.

And, perhaps worst of all, every day some life-tenured Article III Circuit Judges turn a blind eye to the legal travesty and due process disaster taking place throughout our corrupted Immigration Courts by rubber stamping results that would be totally unacceptable in any other type of litigation and which don’t even pass the “straight face test.” I guess “out of sight is out of mind,” and the wrongfully deported are “out of sight” (or maybe dead, in hiding, or duressed into joining or cooperating with gangs after the U.S. failed to protect them)

But, there are folks our there resisting this malfeasance and dereliction of duty. Among other things, they are memorializing what is happening and making a record of where the “modern day Jim Crows” and their enablers stand and what they have done to their fellow human beings in the name of “expedience” and an “Alfred E. Neuman (“What Me Worry”)” view of the law and our legal system.

Donald Trump is horrible. But, his racism and infliction of lasting damage on our country and on humanity depend on too many judges and other supposedly responsible public officials supporting, acquiescing, enabling, or minimizing his inhumane, dishonest, counterproductive, and often illegal actions.

An appropriate response by an honest, competent Administration with integrity would be:

  • Establish legal precedents recognizing those fleeing politicized gang violence, domestic violence, and violence directed at famnilies as refugees;
  • Establish precedents incorporating the Article III decisions emphasizing the concept of “mixed motive” in determining “nexus” under asylum and withholding of removal laws;
  • Establish precedents granting temporary withholding of removal under the Convention Against Torture (“CAT”) to those who face torture at the hands of the gangs or Northern Triangle governments (or both), but who can’t establish the convoluted “nexus” for asylum, with a rebuttable presumption that the countries of the Northern Triangle will “acquiesce” in the torture;
  • Liberally use Temporary Protected Status (“TPS”) for nationals from Northern Triangle countries which perhaps would make large-scale asylum adjudication less of a priority and allow most cases to be dealt with in due course through the Asylum Offices rather than clogging Immigration Court dockets;
  • Work to insure that applicants for protection have assistance of counsel in developing and presenting their claims (which would also dramatically increase fairness and efficiency).

On Monday evening, President Trump issued a memointended to make life more difficult for those seeking asylum in the United States. The memo calls for regulations that, among other things, require asylum seekers to pay a fee to apply for asylum and their first work permit, and denies work permits to immigrants who entered the United States without inspection, or “illegally.”

Since the creation of our asylum system, after the United States signed the Protocol to the Refugee Convention in 1968 and enacted its own Refugee Act in 1980, there has never been a fee to apply for asylum. Filing for asylum is free for a reason under U.S. law and in the vast majority of other countries: Seeking asylum is a human right.

There are already plenty of obstacles and limits to that right in our existing immigration system. For instance, asylum seekers have to wait to receive permission to legally work in the United States. Congress codified a waiting period for work permits for asylum seekers in 1996. Asylum seekers can apply for a work permit 150 days after they have submitted an application for asylum. The work permit is issued sometime after 180 days.

Introducing a fee to apply for asylum and to apply for the first work permit not only is cruel but also goes against common sense and U.S. economic interests. Asylum seekers typically cannot afford to pay even a nominal fee. Trump’s memo does not specify the fee amount, only that it would “cover the cost of adjudication.” But even the rumored $50 fee would be too high for any of our clients. All individuals present in the United States have a legal right to apply for asylum, and that legal right should not depend on ability to pay. Many asylum seekers flee their countries with nothing more than the clothes on their backs and the cash in their pockets. Other asylum seekers come with their life savings, which are often quickly depleted as they pay for living expenses awaiting adjudication of their asylum claims.

Years ago, one of us worked with one client who was homeless and lived in her car while she waited for her day in court. One of our current clients lives in a public storage locker because he cannot afford to pay rent. We have asylum-seeking clients who go hungry so that their children can eat, or who drink water to “feel full.” Other clients go without medication to treat chronic illnesses such as diabetes and high blood pressure because they lack health insurance and money to pay out of pocket for their medications. Asylum seekers are not a population with an ability to pay extraneous fees.

This new fee would also put asylum seekers further at risk of being exploited, or even physically harmed, abused or trafficked within the United States. Asylum seekers are already vulnerable to such predatory behavior. For example, years ago, one of us worked with a young woman from Niger who fled a forced marriage and female genital mutilation. As an asylum seeker in the United States, she had no way to provide for herself and found herself passed from one abusive situation to another. By the time she filed her asylum application, she had been repeatedly raped, held captive and forced to work in various homes. She was providing free child-care in exchange for lodging but forbidden from leaving the house.

And contrary to some misconceptions among the public (and the Trump administration), asylum seekers are generally ineligible for any form of federal or state aid. Indeed, even after they are granted asylum, they do not receive significant support from the government. Between paying for rent, food and other living expenses, and not being able to work for a significant period of time, how will asylum seekers pay the fee?

Asylum seekers, who have lost everything and been forced to leave their countries and start over in ours, have a tremendous amount to give to our communities if given the chance. Take Constance, for example, one of our West African clients. In 2015, while she was seeking asylum, she commuted two hours by bus each way to a factory to cut fruit during a 12-hour overnight shift. She now works as a French language newscaster for a major news and radio outlet. Another client is a microbiologist who worked waiting tables until he found a job directing a lab at a hospital. As one of our clients said: “I know I’ve lost my country, but I haven’t lost my skills. I can still contribute.” Requiring these individuals to remain idle while jobs go unfilled and immigration court and asylum office backlogs persist could mean years in limbo and is a waste of talent, expertise and the hard work asylum seekers contribute.

They have devoted their professional lives to making America a fairer and better place and helping the most vulnerable among us to have a fair shot at asylum and to contribute their full talents to our society. A terrific “win-win” for us and for asylum seekers. And they both work on “shoestring budgets” — giving much and asking little — just like the refugees they are helping!
What if we had a Government that recognized, honored, and worked with such talented folks to solve problems? Imagine what we could achieve with cooperation and positive efforts, involving real expertise from those who actually know and work with asylum seekers, and who therefore recognize asylum seekers as fellow human beings and great potential assets to our country?

President Trump has made immigration crackdown a central focus of his presidency, and a new Washington Post-ABC News poll shows a growing number of Republicans and Democrats agree that the worsening situation on the border is a “crisis.”

But Trump is offering a solution that relatively few Americans like. In fact, his newly announced decision to make it harder to seek asylum is even less popular than his border wall national emergency, according to the same poll.

The Post-ABC poll shows that 30 percent of Americans favor making it more difficult for those seeking asylum in the United States to obtain it. About as many — 27 percent — favor making it easier, while 34 percent want to leave the process as-is.

Even among Republicans, just 46 percent favor making it more difficult. Among the few groups where a majority support the idea are conservative Republicans (51 percent) and those who approve of Trump (53 percent). Even in the latter group, though, 29 percent say leave the system as-is, and 11 percent want to make it easier to seek asylum.

Late Monday, the White House announced that it was proposing a new fee for asylum seekers. It is also seeking to prevent those who cross the border illegally from obtaining work permits, and it set the ambitious goal of requiring asylum cases to be decided within 180 days.

There has been a huge uptick in the number of asylum seekers in recent months. More than 103,000 immigrants crossed the U.S.-Mexico border last month, and 60 percent of them were Central American families who have requested asylum. The system has become overburdened, and even critics of Trump’s immigration approach acknowledge the situation must be addressed.

But saying there’s a problem and saying this is the solution are two different things. Trump has repeatedly argued that asylum seekers are exploiting weak U.S. immigration and asylum laws and that many of them are criminals and gang members who are told to claim asylum even though they don’t need it. He has called the concept of asylum “a big con job.” Yet, even as the situation at the border is exacerbated by a growing number of asylum seekers, Americans are still clearly uncomfortable with increasing the burdens on them.

Because the poll was conducted before Trump’s announcement, it didn’t test the specific details of his proposal. A fresh debate about the specific proposals could feasibly change the levels of public support. But Trump has been pushing the idea that asylum seekers are exploiting the system for months, and it doesn’t seem to have led to a chorus of support within his base for tightening the rules.

The level of support is even less than the backing for his national emergency to build a border wall. The Post-ABC poll shows just 34 percent of Americans favor that, while 64 percent oppose it. But at least on that proposal, Trump’s base is strongly onboard. Seventy percent of Republicans back the border wall national emergency.

Trump’s overall approval on immigration stands at 39 percent, with 57 percent disapproving, according to The Post-ABC poll.

Bottom line: On asylum, the public essentially is split in thirds among 1) more generous; 2) less generous; and 3) current system. That means that neither radical retractions nor radical expansions of the current system are likely to be achievable at present. That opens the door for the Dems to put together a powerful coalition to strengthen and fairly and efficiently administer the current asylum system.  

It’s not rocket science — more like basic governing competence. Here are the elements:

  • Establish an independent Article I U.S. Immigration Court;
  • Invest in representation of asylum seekers; 
  • Add more Asylum Officers, Immigration Judges, and Port of Entry Inspectors;
  • Provide comprehensive basic and continuing training for all asylum adjudicators from experts in asylum law;
  • Use prosecutorial discretion (“PD”) to reduce Immigration Court backlogs to allow Immigration Judges to concentrate on timely hearings for recently arrived asylum cases;
  • Reduce immigration detention;
  • Hire more anti-smuggling, undercover, and anti-fraud agents for DHS;
  • Invest in improving conditions in “sending” countries in Central America.

It would 1) cost less than the money Trump is now squandering on “designed to fail” enforcement and detention efforts; 2) create a political constituency for funding and future improvements; 3) protect human rights; and 4) give the U.S the substantial benefits of integrating asylees and their talents into our society and economy through the legal system. Those found ineligible could also be removed in a humane and timely manner after receiving due process.

Now is the time for House Dems to hang tough on demanding some real border security for the money — in plain terms, require the money to be spent in exactly the ways described above, not on more of Stephen Miller’s White Nationalist, anti-asylum schemes and gimmicks.  

Additionally, there should be specific prohibitions on: 1) wall and barrier building beyond what Congress has already authorized; 2) any additional spending for detention of non-criminal asylum applicants beyond the time needed to give them credible fear interviews; 3) family detention; 4) “tent cities;’ 5) “Remain in Mexico,” 6) “metering” of asylum applicants at Ports of Entry; 6) charging fees for asylum applications; 7) denial of work authorization for non-frivolous asylum applicants; 8) denial of reasonable bond to asylum applicants unless individually determined to be “threats to the community;” and 9) use of the military except to assist in providing humanitarian aid. There should also be a specific mechanism for accounting and constant Congressional oversight on how the Administration spends the extra funding.

I.

Good afternoon. Thanks so much for inviting me and coming out to listen. Most of all, thank you for what you are doing to save our legal system and preserve our democracy.  For, nothing less is at issue here.

Jeremy talked this morning about the supreme satisfaction of seeing smug, uncooperative, unresponsive, scofflaw bureaucrats hauled into court and forced to follow the law. There isn’t much a bureaucrat, particularly one working in this particular Administration, fears more than the law. 

In my life, the comparable feeling of satisfaction was when a Court of Appeals reversed my wrong-headed colleagues at the BIA on the basis of one of my frequent dissents or having a Court of Appeals reverse the BIA for incorrectly reversing my decision as an Immigration Judge granting relief.

Once upon a time, there was a court system with a vision: Through teamwork and innovation be the world’s best administrative tribunals guaranteeing fairness and due process for all. Two decades later, that vision has become a nightmare. 

Would a system with even the faintest respect for Due Process, the rule of law, and human life open so-called “courts” in places where no legal services are available, using a variety of largely untrained “judges,” themselves operating on moronic and unethical “production quotas,” many appearing by poorly functioning and inadequate televideo? This system is as disgraceful as it is dysfunctional.

Today, the U.S. Immigration Court betrays due process, mocks competent administration, and slaps a false veneer of “justice” on a “deportation railroad” designed to evade our solemn Constitutional responsibilities to guarantee due process and equal protection. It seeks to snuff out every existing legal right of migrants. Indeed, it is designed specifically to demean, dehumanize, and mistreat the very individuals whose rights and lives it is charged with protecting. 

It cruelly betrays everything our country claims to stand for and baldly perverts our international obligations to protect refugees. In plain terms, the Immigration Court has become an intentionally “hostile environment” for migrants and their attorneys.

This hostility particularly targets the most vulnerable among us – asylum applicants, mostly families, women, and children fleeing targeted violence and systematic femicidal actions in failed states; places where gangs, cartels, and corrupt officials have replaced any semblance of honest competent government willing and able to make reasonable efforts to protect its citizenry from persecution and torture. All of these states have long, largely unhappy histories with the United States. In my view and that of many others, their current sad condition is in no small measure intertwined with our failed policies over the years – failed policies that we now are mindlessly “doubling down” upon.

My good friend and colleague Dr. Triche gave you the “scholarly side” of immigration appeals.  Now, I’m going to take you over to the “seamy underside of reality,” where the war for due process and the survival of democracy is being fought out every day. Because we can’t really view the travesty taking place at the BIA as an isolated incident. It’s part of an overall attack on Due Process, fundamental fairness, human decency and particularly asylum seekers, women, and children in  today’s “weaponized”  Immigration Courts.

I’m going to tell you twelve things that you and your colleagues need to do to win the war against the forces of darkness and anti-Constitutional bias who have seized control of our justice system and aim to destroy it.

I, of course, hold harmless Dr. Triche, the Louisiana State Bar, Woody’s law firm, all of you, and anyone else of any importance whatsoever for the views I express this afternoon. They are mine, and mine alone, for which I take full responsibility. No party line, no sugar coating, no bureaucratic BS – just the truth, the whole truth, and nothing but the truth, as I see it based on more than four- and one-half decades in the fray at all levels. In the words of country music superstar Toby Keith, “It’s me baby, with your wake-up call!

II.

First, get everyone represented. That’s why it’s so important that you are all here today. Next time, I hope this meeting will be in the Mercedes-Benz Superdome! 

Today’s “deportation railroad” operates on the assumption that it will be able to ramp up “numbers,” boost “productivity,” and promote bad law and worst practices by shooting unrepresented individuals “like fish in a barrel.” We know that representation increases success – sometimes by as much as 14 times.

Second, remember that there still are “pockets of due process and fundamental fairness” out there – pockets of resistance, if you will. These are Immigration Judges and sometimes ICE Assistant Chief Counsel who are courageous and honest enough to insist on a properly fair and generous interpretation of asylum law, procedural due process, reasoned decisions, and impartial judging. This is in the overall context of a DOJ that encourages and fosters overt anti-asylum bias, prejudgment, unprofessional treatment of lawyers, bullying of respondents, and predetermined results as part of a concerted effort to both discourage representation and “deter” bona fide asylum seekers from applying.

It’s critically important that you provide these “good guy” judges and counsel with the detailed, plausible, and consistent testimony, strong corroborating records, and cogent legal arguments to allow them to do the right thing while being “covered” in the case of likely attacks by “higher ups” for following the law, treating applicants and their representatives with dignity, and often granting asylum. 

Third, if you are relying on “particular social groups” (“PSGs”) state them clearly on the record at the outset to satisfy BIA requirements. The BIA will not allow you to develop new social groups on appeal — even where they might be obvious from the record below.

Fourth, insure that PSGs meet the BIA’s three criteria: 1) immutable or fundamental to identity; 2) particularized; and 3) socially visible.  Where applicable, don’t shy away from inclusive groups that clearly meet the BIA’s criteria like “women in Guatemala” or “gay men in Honduras.” 

For too long, advocates have been “going along” with a “gradualist approach.” That favored limited, highly particularized, social groups designed to ease and appease the Government’s often bogus “floodgates fears” and thereby to win government cooperation in a gradual, positive, and progressive development of the asylum law consistent with Matter of Acosta, the BIA’s seminal precedent on PSGs. 

Jeff Sessions clearly showed in Matter of A-B- why cooperation with the Government in a “captive” court system, without ingrained values or a strong basis of intellectual honesty, is too risky. It’s time to vindicate the full coverage of gender-based persecution under the refugee definition.

Fifth, argue politics where applicable. The BIA and some appellate courts have willfully misconstrued the reality of conditions in the Northern Triangle. Gangs in the Northern Triangle aren’t a bunch of neighborhood delinquents hanging out on the local street corner pestering kids and stealing lunch pails. No, they are powerful armed forces that have infiltrated and compromised governments, in many areas operating as “de facto governments.” 

For Pete’s sake, in El Salvador gangs are reportedly the  largest single employer. They have actually negotiated now-failed “peace accords” with the government. Of course, in those situations, quite contrary to disingenuous statements in BIA precedents, opposition and resistance to gangs is considered to be a “political act” that will be harshly punished. 

Don’t rely just on mealy-mouthed State Department Country Reports that have been compromised by this Administration’s political agenda.  Attack the reliability of State Department Reports with real experts and more reliable resources. Insist that reality be part of the record of proceedings no matter how much individual Immigration Judges or the BIA might want to ignore it. 

Sixth, document the systematic truncations of due process in Immigration Court.  These days, denial of merits hearings; arbitrary limits on testimony, evidence, and arguments to meet inappropriate production quotas; limitations on client access; capricious denials of continuances; frequent disparate treatment when EOIR and DHS shuffle and reprioritize dockets for no good reason; lack of notice; use of idiotic form decisions and woefully inadequate, analysis-free oral decisions as a substitute for reasoned analysis; and increased use of “summary affirmances” rubber stamping clearly defective Immigration Judge decisions are commonplace. It’s “haste makes waste to the Nth degree” imposed by the DOJ politicos. Expose these travesties and abuses! Make the record for review by “real” Article III Courts.

Seventh, limit to its facts Session’s outrageous attempt to turn back asylum law decades in Matter of A-B-. At the end of 30 pages of disingenuous “babble” and erroneous legal analysis, Sessions actually resolves nothing more than to vacate Matter of A-R-C-G-. It’s almost all dicta; vicious and misogynistic dicta, but dicta nevertheless. 

Read Judge Emmet Sullivan’s outstanding opinion in Grace v. Whitaker cataloguing Sessions’s many errors and misrepresentations. The result in the BIA’s A-R-C-G- was clearly correct on the facts presented – so much so that it was uncontested by either party! Yes, some judges follow the erroneous dictum even deny hearings. Object, make your record, appeal, and hold these wrong-headed “jurists” accountable.

It’s frustrating to have to establish A-R-C-G-‘s correctness again and again for no good reason, but it’s what we have to do. It also won’t hurt to point out to the Article III’s how Sessions’s unjustified and biased actions have actually made the hearing system more unnecessarily complicated and inhibited fair, consistent, and efficient processing of asylum grants. 

Eighth, apply for bond notwithstanding Barr’s unconstitutional attempt in Matter of M-S- to eliminate bond for those who have passed the credible fear process. Take the Fifth Amendment constitutional issue to the U.S. District Courts on habeas every time. Let them see firsthand what passes for “due process” and “justice” in today’s Immigration Courts. 

The Ninth Circuit and several U.S. District Courts have already indicated that Government’s implementation of indefinite detention can’t pass constitutional muster under the Fifth Amendment. Keep the defeats coming for the DOJ and maintain the focus of the Article IIIs on how the DOJ’s arrogant and wasteful maladministration of the U.S. Immigration Courts is screwing up the entire U.S. justice system.

Ninth, if you lose below, take your appeals to the BIA and the Circuit Courts of Appeals. There are three good reasons for appealing: 1) in most cases it gives your client an automatic stay of removal pending appeal to the BIA; 2) appealing to the BIA ultimately gives you access to the “real” Article III Courts that still operate more or less independently from the President and his Attorney General; and 3) who knows, even in the “crapshoot world” of today’s BIA, you might win.

After the “Ashcroft Purge of ’03,’’ which incidentally claimed me as one of its casualties, the BIA became, in the words of my friend, gentleman, and scholar Peter Levinson, “a facade of quasi-judicial independence.” But, amazingly, it has gotten even worse since then. The “facade” has now become a “farce” – “judicial dark comedy” if you will. 

And, as I speak, incredibly, Barr is working hard to change the regulations to further “dumb down” the BIA and extinguish any last remaining semblance of a fair and deliberative quasi-judicial process. If he gets his way, which is likely, the BIA will be “packed with more restrictionist judges,” decentralized so it ceases to function as even a ghost of a single deliberative body, and the system will be “gamed” so that any two “hard line” Board “judges,” acting as a “fake panel” will be able to designate anti-asylum, anti-immigrant, and pro-DHS “precedents” without even consulting their colleagues.

Even more outrageously, Barr and his “do-bees” over at the Office of Immigration Litigation (“OIL”) intend to present this disingenuous mockery as the work of an “expert tribunal” deserving so-called “Chevron deference.” Your job is to expose this fraud to the Article IIIs in all of its ugliness and “malicious incompetence.”

Yes, I know, as we heard earlier, many “real” Federal Judges don’t like immigration cases. “Tough noogies” — that’s their job! 

I always tell my law students about the advantages of helping judges and opposing counsel operate within their “comfort zones” so that they can “get to yes” for your client. But, this assumes a system operating professionally and in basic good faith. In the end, it’s not about fulfilling the judge’s or opposing counsel’s career fantasies or self-images. It’s about getting Due Process and justice for your client under law. 

And, if Article III judges don’t start living up to their oaths of office, enforcing fair and impartial asylum adjudication, and upholding Due Process and Equal Protection under our Constitution they will soon have nothing but immigration cases on their dockets. They will, in effect, become full time Immigration Judges whether they like it or not. Your job is not to let them off the hook.

Tenth, challenge the use of Attorney General precedents such as Matter of A-B- or Matter of M-S- on ethical grounds. The U.S. Court of Appeals for the D.C. Circuit, in a recent decision written by Judge Tatel invalidating the rulings of a military judge on ethical grounds said: “This much is clear: whenever and however military judges are assigned, rehired, and reviewed, they must always maintain the appearance of impartiality.”

Like military judges, Immigration Judges and BIA Judges sit on life or death matters. The same is true of the Attorney General when he or she chooses to intervene in an individual case purporting to act in a quasi-judicial capacity.

Yet, Attorney General Barr has very clearly lined himself up with the interests of the President and his partisan policies, as shown by his recent actions in connection with the Mueller report. And, previous Attorney General Jeff Sessions was a constant unapologetic cheerleader for DHS enforcement who publicly touted a White Nationalist restrictionist immigration agenda. In Sessions’s case, that included references to “dirty attorneys” representing asylum seekers, use of lies and demonstrably false narratives attempting to connect migrants with crimes, and urging Immigration Judges adjudicating asylum cases not to be moved by the compelling humanitarian facts of such cases. 

Clearly, Barr and Sessions acted unethically and improperly in engaging in quasi-judicial decision making where they were so closely identified in public with the government party to the litigation. My gosh, in what “justice system” is the “chief prosecutor” allowed to reach in and change results he doesn’t like to favor the prosecution? It’s like something out of Franz Kafka or the Stalinist justice system. 

Their unethical participation should be a basis for invalidating their precedents.  In addition, individuals harmed by that unethical behavior should be entitled to new proceedings before fair and unbiased quasi-judicial officials — in other words, they deserve a decision from a real judge, not a biased DOJ immigration enforcement politico.

Eleventh, make a clear record of how due process is being intentionally undermined, bias institutionalized, and the rule of law mocked in today’s Immigration Courts.  This record can be used before the Article III Courts, Congress, and future Presidents to insure that the system is changed, that an independent Article I U.S. Immigration Court free of Executive overreach and political control is created, and that guaranteeing due process and fundamental fairness to all is restored as that court’s one and only mission. 

Additionally, we are making an historical record of how those in charge and many of their underlings are intentionally abusing our constitutional system of justice or looking the other way and thus enabling such abuses. And, while many Article III judges have stood tall for the rule of law against such abuses, others have enabled those seeking to destroy equal justice in America. They must be confronted with their derelictions of duty. Their intransigence in the face of dire emergency and unrelenting human tragedy and injustice in our immigration system must be recorded for future generations. They must be held accountable.

Twelfth, and finally, we must fight what some have referred to as the “Dred Scottification” of foreign nationals in our legal system. The absolute mess at the BIA and in the Immigration Courts is a result of a policy of “malicious incompetence” along with a concerted effort to make foreign nationals “non-persons” under the Fifth Amendment. 

And, while foreign nationals might be the most visible, they are by no means the only targets of this effort to “de-personize” and effectively “de-humanize” minority groups under the law and in our society. LGBTQ individuals, minority voters, immigrants, Hispanic Americans, African Americans, women, the poor, lawyers, journalists, Muslims, liberals, civil servants, and Democrats are also on the “due process hit list.” 

III.

In conclusion, the failure of Due Process at the BIA is part of a larger assault on Due Process in our justice system. I have told you that to thwart                                                                                                                                                                                                                                                                                                                                                                                                                                                                            it and to restore our precious Constitutional protections we must: 1) get everyone represented; 2) nourish the “pockets of due process;” 3) clearly define social groups; 4) use the BIA’s three-part test for defining PSGs; 5) argue politics;  6) document systematic truncations of due process; 7) limit Matter of A-B-; 8) apply for bonds; 9) take appeals; 10) challenge the  precedents resulting from Sessions’s and Barr’s unethical participation in the quasi-judicial process;  11) make the historical record; and 12)  fight “Dred Scottification.”

The antidote to “malicious incompetence” is “righteous competence.” Folks, the U.S Immigration Court system is on the verge of collapse. And, there is every reason to believe that the misguided “enforce and detain to the max” policies, with resulting “Aimless Docket Reshuffling,” intentionally “jacked up” and uncontrollable court backlogs, and “dumbed down” judicial facades being pursued by this Administration will drive the Immigration Courts over the edge.  

When that happens, a large chunk of the entire American justice system and the due process guarantees that make America great and different from most of the rest of the world will go down with it. As the late Dr. Martin Luther King, Jr., said in his Letter from a Birmingham Jail, “injustice anywhere is a threat to justice everywhere.” 

The Immigration Court’s once-noble due process vision is being mocked and trashed before our very eyes by arrogant folks who think that they can get away with destroying our legal system to further their selfish political interests. 

Now is the time to take a stand for fundamental fairness and equal justice under law! Join the New Due Process Army and fight for a just future for everyone in America! Due process forever! “Malicious incompetence” never!

“DUH” OF THE DAY: Barr Is A Trump Flunky — Leah Litman Reports @ Slate

It took Attorney General William Barr only one week from the release of the Mueller report to bring obstruction of justice charges against two governmental officials for interfering in a federal investigation. But the charges have nothing to do with the special counsel’s investigation into Russian interference in the election or the possible obstruction of that investigation.

Although the obstruction charges DOJ filed are not related to the Mueller report, they underscore just how far the attorney general bent over backward to spin the report in the president’s favor and how partisan the Department of Justice has become. The disparities between the two cases highlight how the Department of Justice, under Barr’s leadership, has become nothing more than a political arm of the Trump administration, particularly in its handling of possible obstruction charges stemming from the Mueller report.

The indictment against Judge Shelley Richmond Joseph, a Massachusetts district court judge, and Officer Wesley MacGregor, a Massachusetts trial court officer, alleges that the officers interfered with an Immigration and Customs Enforcement proceeding by preventing ICE from arresting an individual who was arrested on state charges and attended an arraignment hearing in state court. During the state court proceeding, Joseph asked an ICE officer to wait outside the courtroom while the court conducted the arraignment hearing. Earlier in the day, the judge had requested more information about one of the state charges in the case (a fugitive charge) after the prosecutor said the state would not seek to detain the defendant on the other charge (a drug charge).

After recalling the case, the judge observed that ICE was in the courthouse. The prosecutor then informed the court that the state did not believe the defendant was the fugitive from Pennsylvania for whom there was an arrest warrant and therefore believed that the fugitive charge was an error, which would mean that the defendant would be free to leave. The defense attorney, however, noted that ICE was convinced otherwise and suggested they would likely take the client into custody. The defense attorney then suggested that “the best thing for us to do is to … release him … and hope that he can avoid ICE.”

At that point, the judge noted the other alternative was to recall the proceedings again the next day and asked “ICE is gonna get him?” before directing the clerk to go off the record. The recording was turned off for 52 seconds, and when it resumed, the prosecutor renewed the claim that the defendant was not the person with a Pennsylvania warrant out for his arrest and moved to dismiss the fugitive charge against him. Because the state had already stated it would not seek to detain the defendant on the drug charges, the defendant was released, and the trial court officer escorted him through the back door.

This evidence provided the basis for Barr’s Department of Justice to indict the state judge and state officer for obstruction of justice and conspiracy to obstruct justice. Yet all of the reasons Barr has previously cited for opposing an obstruction investigation against the president suggest the Department of Justice should not have brought obstruction charges against Joseph and MacGregor either.

For example, in June, Barr wrote a memo as a private citizen arguing that obstruction laws should not “reach facially-lawful actions taken by the President in exercising the discretion vested in him by the Constitution.” Yet that is exactly what the obstruction-of-justice charges against Joseph and MacGregor cover. State judges do not persist with criminal charges that the district attorney has dropped, and state law does not require judges to detain individuals on the drug charges that remained. It was therefore “facially legitimate” and within the “discretion” of the judge not to detain the individual based on the drug charge. The judge also has total control of her courtroom and can decide through which doors to instruct people to come and go. And the state judge’s motive shouldn’t matter to the analysis because under Barr’s theory of obstruction, government officials can’t be charged with obstruction “based solely on his subjective state of mind” for “simply exercising his discretion in a facially lawful way.”

Ultimately, the Justice Department’s indictment of Joseph and MacGregor is a reminder about how aggressively the federal government often reads the federal obstruction statute. For example, the indictment confirms that obstruction does not have to be particularly sophisticated or successful in order to constitute a crime—the trial court officer merely let the defendant out the back door, and the defendant was subsequently apprehended and now faces deportation.

It also demonstrates a contrast in the kind of evidence that often suffices to establish an obstruction-of-justice charge. In the case of Joseph and MacGregor, DOJ has some snippets of a courtroom conversation that indicated the judge wanted to do something she did not want publicly recorded and less than a minute without a recording. In the case of President Donald Trump and his associates, special counsel Robert Mueller compiled dozens of witnesses, contemporaneous notes, 10 separate incidents, 182 pages of a report, multiple instances of officials lying to investigators or not being forthcoming with them, and several damning instances of the president lying in an apparent effort to cover his tracks. All of this led Barr to his four-page summary conclusion that Trump had not committed a crime—a conclusion that flew in the face of Mueller’s findings.

The stark difference between the attorney general’s treatment of the obstruction case against Joseph and MacGregor and the obstruction cases at the heart of the Mueller report serves as a pointed reminder that Barr’s response to the obstruction issues raised by the Mueller report was partisan and unprincipled.

STANDING TALL: 2d Cir. Says “No” To Trump Kakistocracy’s Misuse Of Deportation To Violate First Amendment — Ragbir v. Homan

Press Release: Federal Appeals Court Holds that The First Amendment Protects Immigrant Rights Activists from ICE Retaliation

New York, NY —  A federal appeals court has ruled in favor of immigrant-rights activist Ravi Ragbir, concluding that the First Amendment prohibits the government from targeting immigration activists for deportation based on their political speech. “To allow this retaliatory conduct to proceed would broadly chill protected speech, among not only activists subject to final orders of deportation but also those citizens and other residents who would fear retaliation against others,” the decisionstates. It goes on to explain:

Ragbir’s speech implicates the apex of protection under the First Amendment. His advocacy for reform of immigration policies and practices is at the heart of current political debate among American citizens and other residents. Thus, Ragbir’s speech on a matter of “public concern” is at “the heart of . . . First Amendment[] protection,” and “occupies the highest rung of the hierarchy of First Amendment values.’”  Because Ragbir’s speech concerns “political change,” it is also “core political speech” and thus “trenches upon an area in which the importance of First Amendment protections is at its zenith.” Indeed, his “speech critical of the exercise of the State’s power lies at the very center of the First Amendment.”  (citations omitted).

The court of appeals concluded: “Ragbir’s speech implicates the highest protection of the First Amendment,” and “he has adduced plausible — indeed, strong — evidence that officials responsible for the decision to deport him did so based on their disfavor of Ragbir’s speech (and its prominence).”  

The decision further held that a federal statute stripping courts of their power to hear these First Amendment claims is itself unconstitutional. The court of appeals sent the case back to the district court to consider the case in light of its conclusions, directing the district court to stay Mr. Ragbir’s deportation as it considers the next steps in the case.

Mr. Ragbir, Executive Director of the New Sanctuary Coalition, was abruptly detained by Immigration and Customs Enforcement (“ICE”) on January 11, 2018 after years of routine check-ins. ICE’s action came at the heels of its similarly abrupt arrest and detention of Jean Montrevil, a co-founder of New Sanctuary Coalition, that same month. ICE deported Mr. Montrevil and attempted to do the same to Mr. Ragbir before a federal court ordered his release. ICE officials made clear that they resented Mr. Ragbir’s and Mr. Montrevil’s outspoken activism and criticism of U.S. immigration policies.

Even after Mr. Ragbir’s release from detention in January 2018, ICE continued to pursue Mr. Ragbir’s deportation, prompting the New Sanctuary Coalition of New York City, CASA, Detention Watch Network, the National Immigration Project of the National Lawyers Guild, and the New York Immigration Coalition to join Mr. Ragbir in filing suit (Ragbir v. Homan) to challenge the targeting of immigrant rights activists by federal immigration officials. The suit alleged that the specific actions against Mr. Ragbir, along with similar retaliatory actions against activists across the country, were part of a pattern and practice of unlawful targeting in violation of the First Amendment.

The district court denied Mr. Ragbir’s motion for a preliminary injunction and dismissed the claims challenging his deportation under the First Amendment. On appeal, the Second Circuit vacated that decision, concluding that the alleged retaliatory deportation by ICE was sufficiently “outrageous” to violate the First Amendment, and that the Constitution requires judicial review of these claims. The opinion was written by Judge Droney and joined by Judge Leval. A dissent was filed by Judge Walker, who stated that he agreed with much of the majority’s reasoning, but believed ICE’s retaliation against Mr. Ragbir ended with his release from immigration detention.  

“I cannot begin to express my gratitude to all those who have stood with us in this struggle. It humbles me to know that not only will my voice be protected, but that together we can protect the voices of so many people who are living in this country under the threat of deportation,” said Mr. Ragbir. “It was all of our voices together that made this decision possible and we have to continue to speak out against the travesty of our deportation system.”

“Today’s decision stands as a warning to this administration to end its pattern of retaliating against immigrant-rights activists across the country,” said R. Stanton Jones of Arnold & Porter, who argued the case at the Second Circuit. “Mr. Ragbir’s activism, his advocacy, and his protest for immigrant rights stand in America’s greatest civic traditions.  With today’s decision, Mr. Ragbir may continue his important work free from fear of forceful government retaliation.”

“This decision affirms a constitutional principle of critical importance — the First Amendment prohibits our government from silencing its political opponents by deporting them,” said William Perdue of Arnold & Porter. “Immigration officials are not above the Constitution.”

The lawsuit was supported by numerous faith leaders, immigrant rights organizations, elected officials, activists, and others who spoke out on behalf of protecting immigrants’ First Amendment rights (including but not limited to the New York State Council of Churches, Make the Road New York, the Center for Popular Democracy and the Center for Popular Democracy Action, the Institute for Constitutional Advocacy and Protection, and the Knight First Amendment Institute). “Protecting activist voices is about protecting the movement,” said Jessica Rofé of the NYU Immigrant Rights Clinic. “So many have stood up for Ravi because they know what is at stake.”

“Ravi’s crucial advocacy drives to the heart of our nation’s moral imperative to remember that immigrants are humans who deserve to be followed, listened to and protected,” said Pastor Kaji Dousa, co-chair of New Sanctuary Coalition. “For asserting that immigrants have rights and are not disposable, ICE sought to silence Ravi and deport him. We are grateful that the Second Circuit had the wisdom to rule on the side of liberty and to uphold the notion that even Congress can’t take away immigrants’ Constitutional rights. Now Ravi can continue with the very work this country so deeply needs.”

“CASA applauds the Second Circuit’s decision allowing Ravi to move forward with his case.  It is an important vindication of the First Amendment right of all members of our society to make their voices heard, free from fear of retaliation.  Our leaders will not be silenced, as we continue to fight back against the abuses of the current administration’s inhumane immigration policies, and call on Congress to finally reform our broken immigration system so that families can remain together,” said George Escobar, CASA Chief of Programs and Services.

The Court’s finding affirms what we always knew — Immigration and Customs Enforcement (ICE) unlawfully targeted New Sanctuary Coalition’s Ravi Ragbir for deportation as a result of his immigration rights activism,” said Betsy Plum, VP of Policy, New York Immigration Coalition.

“We know that the struggle is not over,” said Alina Das of the NYU Immigrant Rights Clinic. “But we are on our way. We are so deeply grateful for this decision because it will allow us to continue our fight for justice for Ravi and for all those who have been targeted and taken from our community for speaking out.”
