A federal appeals court decided Wednesday that the Trump administration may not withhold federal funds from California’s immigrant-friendly “sanctuary” cities and counties.

The U.S. 9th Circuit Court of Appeals, in a 2-1 decision, upheld a district judge’s ruling in favor of San Francisco and Santa Clara County, which sued over the administration’s threats to withhold money to jurisdictions that have passed laws limiting local law enforcement cooperation with federal immigration authorities.

The ruling was a blow to the Trump administration’s efforts to punish cities and states that fail to help enforce federal immigration law, a goal President Trump announced shortly after he was sworn in.

The administration did not comment on whether it intended to appeal the decision.

But the 9th Circuit handed Trump one victory. It removed a nationwide injunction against his directive, concluding there was not enough evidence presented in the case so far to support blocking it beyond California.

Devin O’Malley, a spokesman for the U.S. Department of Justice, called the ruling a “a victory for criminal aliens in California, who can continue to commit crimes knowing that the state’s leadership will protect them from federal immigration officers.”

O’Malley also declared that the removal of the nationwide injunction amounted to “another major victory for the rule of law.”

The case stemmed from an executive order issued by Trump shortly after taking office. He directed his administration to withhold federal funds from sanctuary jurisdictions.

The 9th Circuit said Trump exceeded his authority because only Congress can put conditions on federal funds.

“The United States Constitution exclusively grants the power of the purse to Congress, not the President,” wrote Chief 9th Circuit Judge Sidney R. Thomas, a Clinton appointee.

The administration argued that the order was “all bluster and no bite, representing a perfectly legitimate use of the presidential ‘bully pulpit,’ without any real meaning — ‘gesture without motion,’ as T.S. Eliot put it,” Thomas wrote.

But that explanation “strains credulity,” Thomas said.

The ruling quoted Trump expressing his opposition to sanctuary cities in a television interview after issuing his order.

“If we have to defund, we give tremendous amounts of money to California…. California in many ways is out of control,” the court quoted Trump as saying.

The Justice Department later issued a memorandum interpreting Trump’s order as affecting only three law enforcement grants historically conditioned on compliance with immigration law.

But the 9th Circuit said that interpretation was unreasonable and inconsistent with the executive order.

The court left the injunction in place for California because it found there was sufficient evidence that the counties and the state were “particular targets.”

But there was little to no evidence presented on the impact of the executive order outside California, the 9th Circuit said.

“The record as presently developed does not justify a nationwide injunction,” the court said.

Unless the Trump administration appeals, which legal analysts believe is likely, the case will return to the district court, where evidence could be presented to support a nationwide injunction.

Ninth Circuit Judge Ferdinand F. Fernandez, appointed by former President George H.W. Bush, dissented.

He argued the case was not “ripe” for a decision, in part because no action has been taken against the counties.

“While the counties may be convinced that the Executive Order loosed a fearsome chimera upon them, that does not mean that the courts should take up arms to vanquish the imagined beast by slaying the executive order itself,” Fernandez said.

Wednesday’s decision was the latest among several to block Trump from punishing sanctuary jurisdictions.

Last month, a federal judge in Sacramento largely rejected a challenge by the Trump administration of three statewide California sanctuary laws.

In April, a federal judge in Los Angeles sided with the city in a ruling that said the administration could not consider sanctuary policies in parsing out police grants.

Chicago and Philadelphia also won court challenges of the administration’s authority to yank law enforcement grants based on sanctuary policies. The U.S. 7th Circuit Court of Appeals upheld the decision in the Chicago case.

The U.S. 5th Circuit Court of Appeals, though, has allowed a Texas law requiring police chiefs and sheriffs to cooperate with federal immigration officials to go into effect. Texas lawmakers passed the requirement in response to the sanctuary city movement.

The U.S. Supreme Court has not yet weighed in on the sanctuary policies or on the legality of the administration’s effort to end protections from deportation for immigrants who came to the U.S. when they were young.

The high court decided 5 to 4 in June to uphold Trump’s travel ban, which was a revision of an executive order the president issued shortly after taking office.

The order bans foreign visitors and immigrants from several mostly Muslim-majority nations. Lower courts had struck down the ban.

Santa Clara County Counsel James Williams called Wednesday’s decision “great news.”

He said all the courts that have examined lawsuits involving sanctuary polices have concluded that Congress, not the executive branch, controls federal spending.

“This opinion today is a huge reaffirmation of that very core bedrock principle of separation of powers,” Williams said.

Kent Scheidegger, legal director of the Criminal Justice Legal Foundation, described the majority ruling as “deeply dishonest.” The foundation sided with the Trump administration in the case.

Scheidegger noted that Trump’s order asked for compliance “consistent with law,” which limited it to only a few grants, not all federal spending.

“This case is headed for rehearing by a larger 11-judge panel, at least, and probably to the Supreme Court,” he said.

San Francisco City Attorney Dennis Herrera praised the ruling for blocking an unconstitutional “power grab” by Trump.

“San Francisco’s sanctuary policies make our city safer by encouraging anyone who has been a victim or witness to a crime to tell police,” Herrera said. “We are a safer community when people aren’t afraid to call the Fire Department in an emergency.”

Fairly predictable. Just think of the incredible amount of attorney and court resources, and the potential for goodwill and cooperation the Trump Administration has wasted in pursuing its White Nationalist agenda to actually make America less safe!

If the same amount of energy, effort, and resources were put on working with the private bar and the Immigration Judges to 1) get all asylum applicants competently represented, and 2) remove the 75% or so of the cases of individuals who should eventually be legalized or otherwise allowed to stay from already overcrowded Immigration Court dockets, the backlog resulting from “Aimless Docket Reshuffling” by DOJ politicos could largely be eliminated. The system then would be able to adjudicate new cases, particularly those of recently arrived asylum seekers, fairly, within a reasonable period of time, and in conformity with Constitutional Due Process.

Attorney General Jeff Sessions announced Monday that the U.S. Justice Department is launching a “religious liberty task force” — and Twitter erupted.

The new unit will aid the department in fully implementing the religious liberty legal “guidance” issued last year under President Donald Trump’s direction, Sessions said in a speech at the Justice Department’s Religious Liberty Summit in Washington.

The attorney general charged that the freedom to practice religion in America has come “under attack” in the nation’s current “cultural climate.”

A “dangerous movement, undetected by many, but real, is now challenging and eroding our great tradition of religious freedom …. It must be confronted … and defeated,” he added.

“We’ve seen nuns ordered to buy contraceptives. We’ve seen United States senators ask judicial and executive branch nominees about dogma …. We’ve all seen the ordeal faced so bravely by Jack Phillips,” Sessions added, referring to the Colorado baker who won a religious liberty challenge to LGBTQ anti-discrimination law in the U.S. Supreme Court after refusing to bake a wedding cake for a same-sex couple.

Sessions called freedom of religion “indeed our first freedom being the first listed right in the First Amendment” and said that the Trump administration is “actively seeking to accommodate people of faith.”

Sessions touted his department’s prosecution of attacks on religion, among them court actions shielding about 90 plaintiffs from Obama-era requirements that employer health insurance cover contraception, an amicus brief “we were proud to file” on behalf of Phillips, and indictments in an arson attack and threats directed at two mosques.

Twitter exploded, with critics charging that the Religious Liberty Task Force was a front to protect religious zealots attacking LGBTQ rights and an unconstitutional push to marry church and state on the altar of Christianity.

Interestingly, Sessions himself has been charged within the Methodist Church (of which my wife and I are members) with violation of teachings of Christ and the Church’s own rules and values.

He’s a total scofflaw and a fraud, seeking to impose his corrupt, inhumane, intolerant views on the rest of us by abusing his Government position and squandering taxpayer funds on an anti-Constitutional  attempt to establish particular “so-called Christian views” as the law of the land.

If you have children, imagine how you would feel seeing them taken away like that. Hug your kids. Imagine not knowing where they are or whether you’ll ever get to hug them again.

Now imagine the terror and despair those 711 “ineligible” children must feel. It is monstrous to gratuitously inflict such pain. It is, in a word, torture.

In 120 cases, according to the government, a parent “waived” reunification with the child. This claim cannot be taken at face value, however, since immigration advocates cite widespread reports of parents being coerced or fooled into signing documents they did not understand.

Human nature binds parents with their children. It shocks and depresses me to have to write this, but I wonder whether Trump and his minions see these Central Americans — brown-skinned, with indigenous features — as fully human.

In 431 cases involving children between 5 and 17, officials reported, the parents have been deported. Where are they now? How could the government let this happen? If these parents were going to be denied permission to stay in the United States, what was the big hurry to kick them out? Why couldn’t the administration wait until their children could be brought back from wherever they were being kept?

Even more incredibly, in 79 cases, the children’s parents have been released into the United States. In other words, the parents have some legal status — but the government has their children.

And in 94 cases, according to Trump administration officials, the parents cannot be located. What are the odds, do you think, that these men and women will ever be found? Where do parents go to begin the process of tracking down their children? How do you tell a 5-year-old that she may never see her mother and father again?

That’s the reported situation for children 5 and older. The government is also still holding 46 children younger than 5 whom officials cannot or will not give back to their parents. Think of the trauma being inflicted on 2-year-olds — to make a political point.

All of this is happening because Trump has no respect for law or due process and no sense of empathy. He was reportedly upset this spring by a rise in border crossings by asylum-seekers, who by law had to be allowed to stay pending resolution of their claims. He and Sessions seized upon the pretext — for which they have not provided evidence — that children were being “trafficked” into the country for some reason.

“If you’re smuggling a child, then we’re going to prosecute you, and that child will be separated from you, probably, as required by law,” Sessions said in May. “If you don’t want your child separated, then don’t bring them across the border illegally.”

Think, for a moment, of the millions of Irish, Italian, Eastern European and other immigrants who “smuggled” children into the United States — families such as Trump’s own. The only difference is that those earlier immigrants, though sometimes rejected at first, came to be seen as white.

Brown immigrants need not apply. Not if they want to see their kids again.

Judge strikes down law underpinning Sessions’ anti-sanctuary city push

Attorney General Jeff Sessions and the Trump administration were handed another stark defeat in their effort to punish sanctuary cities, with a judge declaring a law the administration had been relying on unconstitutional.

In a terse 58-page opinion, a Reagan-nominated district court judge thoroughly rebuked Sessions’ efforts to penalize sanctuary cities, saying efforts he has taken to impose immigration-related conditions on federal law enforcement grants are unconstitutional. The judge also called the underlying law that the administration has pointed to as justifying its efforts unconstitutional.

The ruling will only apply to the city of Chicago for now — but the judge said he intends for his ruling to apply nationwide.

Judge Harry Leinenweber had also previously temporarily blocked the grant conditions, which the appellate court upheld.

But now Leinenweber has gone even further — making his initial ruling permanent and going beyond it to strike down the underlying law, referred to as Section 1373.

The administration has pointed to the obscure law in all of its sanctuary city lawsuits, the vast majority of which it has lost. The law mandates that local governments share immigration status of individuals with the federal government.

The Justice Department has argued that law should be interpreted broadly to mandate cooperation with federal immigration enforcement. But citing a recent Supreme Court ruling, Leinenweber did the opposite — striking down the law itself as unconstitutional.

The privatization of ICE detention centers has exacerbated the problems the bureau faces and has given considerable fodder to media exposes of abuses.  The DHS Office of Inspector General recently released a scathing report on failures of the private contractors to comply with detention standards. It’s time to restructure the responsibilities to administer detention and removal policies more humanely.

To its credit, ICE also performs critical assignments that include investigating foreign nationals who violate the laws. The main categories of crimes its agents investigate are suspected terrorism, criminal acts, suspected fraudulent activities (i.e., possessing or manufacturing fraudulent immigration documents) and suspected smuggling and trafficking of foreign nationals. ICE investigators are housed in the Homeland Security Investigations (HSI) component and are among those who would dismantle ICE.

If ICE is not at the border performing critical background checks and national security screenings, who does? First, the State Department consular officers screen all foreign nationals requesting a visa, employing biometric technologies along with biographic background checks. In some high-risk consulates abroad, ICE assists in national security screenings. Then, DHS Customs and Border Protection (CBP) inspectors examine all foreign nationals who seek admission to the United States at ports of entry. CBP inspectors and consular officials partner with the National Counterterrorism Center (NCTC) to utilize the Terrorist Identities Datamart Environment on known and suspected terrorists and terrorist groups.

They also check the background of all foreign nationals in biometric and biographic databases such the FBI’s Integrated Automated Fingerprint Identification System. Improvements in intelligence-gathering, along with advances in technologies and inter-agency sharing, have greatly enhanced the rigor of our national security screenings.

The most effective policy for interior immigration enforcement would be one prioritizing “quality of life” enforcement. As I have written elsewhere, it would be aimed at protecting U.S. residents from the deleterious and criminal aspects of immigration. Foremost, it would involve the investigation and removal of foreign nationals who have been convicted of crimes and who are deportable, thus maintaining the important activities of the current ICE investigators.

“Quality of life” enforcement, furthermore, would prioritize investigations of specific work sites for wage, hour and safety violations, sweatshop conditions and trafficking in persons — all illegal activities to which unauthorized workers are vulnerable. “Quality of life” enforcement also would encompass stringent labor market tests (e.g., labor certifications and attestations) to ensure that U.S. workers are not adversely affected by the recruitment of foreign workers, as well as reliable employment verification systems. Many of these functions once were performed by the Department of Labor (DOL), before funding cuts gutted its enforcement duties.

Prioritizing these functions likely would go a long way toward curbing unauthorized migration. Whether DOL or a revamped immigration enforcement be the lead on “quality of life” measures remains a key management question. There is a strong case for re-establishing DOL’s traditional role in protecting U.S. workers and certifying the hiring of foreign workers. Given the critical role that ICE investigators play, it is imperative that they be housed in an agency that provides them with adequate support. These are finer points that can be resolved as the functions are reorganized.

Including a multi-pronged agency or agencies charged with ensuring “quality of life” immigration enforcement measures as part of a package of immigration reforms would only increase the strong public support (roughly two-thirds favor) for comprehensive immigration reform. Good policy. Good politics.

I believe that both Nolan Rappaport and I have previously noted the importance of better wage and hour enforcement in preventing employer abuse of both the legal and extra-legal immigration systems. Sure make lots more sense than “busting” hard-working, productive members of our community who have the bad fortune to be here without documents in an era of irrational enforcement!

There are lots of “smart immigration enforcement” options out there. Although the Obama Administration for the most part screwed up immigration policy, toward the end they actually were coming around to some of the “smart enforcement” initiatives, particularly with DACA at USCIS and more consistent and widespread use of prosecutorial discretion (“PD”) at ICE.

Naturally, the Trump Administration abandoned all of the “smart” initiatives started by the Obama Administration and instead doubled down on every cruel, ineffective, and just plain stupid policy from the past. But, that’s because it’s never been about law enforcement or developing a rational immigration policy. It’s really all about racism and White Nationalism. This Administration, representing a minority of Americans, has absolutely no interest in democracy or governing for the common good.

That’s why it’s critical for the rest of us, who want no part of White Nationalist Nation, to begin the process for “regime change” at the ballot box this Fall! And, in the meantime, join the New Due Process Army and fight the horrible excesses and intentionally ugly policies of the Trumpsters!

(CNN)A federal judge in California on Monday flatly rejected the Justice Department’s attempt to modify a decades-old settlement agreement that limits the length of time and conditions under which US officials may detain immigrant children.

The Justice Department had asked US District Judge Dolly Gee to modify what’s known as the Flores settlement to give the Trump administration maximum flexibility to detain families not only until their criminal proceedings conclude, but also through the end of any asylum proceedings, which could drag on for many months.
In a strongly worded order, Gee added that there was no basis for the change, calling it “procedurally improper and wholly without merit.”
“It is apparent that Defendants’ Application is a cynical attempt, on an ex parte basis, to shift responsibility to the Judiciary for over 20 years of Congressional inaction and ill-considered Executive action that have led to the current stalemate. The parties voluntarily agreed to the terms of the Flores Agreement more than two decades ago. The Court did not force the parties into the agreement nor did it draft the contractual language. Its role is merely to interpret and enforce the clear and unambiguous language to which the parties agreed, applying well-established principles of law.
“Regardless, what is certain is that the children who are the beneficiaries of the Flores Agreement’s protections and who are now in Defendants’ custody are blameless. They are subject to the decisions made by adults over whom they have no control. In implementing the Agreement, their best interests should be paramount,” Gee wrote.
Gee said that “absolutely nothing prevents Defendants from reconsidering their current blanket policy of family detention and reinstating prosecutorial discretion.”

A federal judge on Monday dismissed most of the Trump administration’s lawsuit seeking to knock down a series of California immigration laws, delivering a major blow to the Justice Department’s efforts to crack down on so-called sanctuary states.

U.S. District Judge John Mendez tossed out the part of the lawsuit seeking to invalidate Senate Bill 54, which limits cooperation between local and state law enforcement and federal immigration enforcement. He also dismissed an effort to block another law — Assembly Bill 103 — which allows the California attorney general to review and report on immigrant detention facilities.

Mendez also tossed out part of the lawsuit against Assembly Bill 405, which sought to limit private employers’ cooperation with federal immigration enforcement.

Mendez’s dismissals mean that California will be able to continue limiting its cooperation with federal immigration enforcement.

In dismissing the Justice Department’s case against the two laws, Mendez rejected the Trump administration’s argument that only the federal government has the final say on immigration enforcement and regulation under the U.S. Constitution’s Supremacy Clause.

“[T]he Court does not find any indication in the cited federal statutes that Congress intended for States to have no oversight over detention facilities operating within their borders,” Mendez wrote.

The dismissals came days after Mendez rejected the Trump administration’s request for a preliminary injunction to block the laws while the case played out in court.

The Justice Department first brought the lawsuit against California in March, arguing that the sanctuary laws effectively hindered federal efforts to enforce immigration policies.

But Mendez rejected that argument, writing in his rejection of the Trump administration’s injunction request last week that “refusing to help is not the same as impeding.”

California Attorney General Xavier Becerra, whose office is charged with defending the state against the lawsuit, celebrated the dismissals on Monday, saying that it upheld California’s right to determine how best to protect its residents’ privacy and security.

“Today’s decision is a victory for our State’s ability to safeguard the privacy, safety, and constitutional rights of all of our people,” he said in a statement. “Though the Trump Administration may continue to attack a state like California and its ability to make its own laws, we will continue to protect our constitutional authority to protect our residents and the rule of law.”

A spokesperson for the Justice Department did not immediately respond to The Hill’s request for comment.

Donald Trump has ordered Central American refugees to get off America’s “lawn.”

On Thursday, the president reiterated his desire to deport asylum seekers without providing them access to the American legal system — a proposal that would violate American law, multiple binding international treaties, and the U.S. Constitution.

“Congress must pass smart, fast and reasonable Immigration Laws now,” the president tweeted on July 5, when Congress was not in session. “Law Enforcement at the Border is doing a great job, but the laws they are forced to work with are insane. When people, with or without children, enter our Country, they must be told to leave without our … Country being forced to endure a long and costly trial. Tell the people ‘OUT,’ and they must leave, just as they would if they were standing on your front lawn. Trump’s remarks come as his White House struggles to resolve its (self-engineered) crisis of border-enforcement policy. The administration would like to criminally prosecute all migrants who commit the misdemeanor offense of crossing the U.S. border illegally — including those fleeing violence or persecution in their home countries, who have a right under U.S. law to cross our border and then turn themselves into immigration authorities for the purpose of registering an asylum claim.

But many asylum seekers come to the United States with children in tow — and federal law forbids the government from imprisoning migrant children for longer than 20 days. Thus, the administration adopted its infamous policy of separating migrant families — sending migrant parents to jail, while placing their children in (supposedly) less restrictive forms of confinement, or else with sponsor families. This led to our government willfully traumatizing hundreds of small children; which led to a broad, bipartisan backlash; which led Trump to sign an executive order instructing the federal government to jail migrant families together (in defiance of judicial rulings barring that practice).

There are practical ways of resolving the administration’s family-detention dilemma. Officially, the administration’s insistence on imprisoning asylum seekers is grounded in the belief that migrants who are allowed to await court proceedings outside of federal detention will simply abscond into the interior of the country (a.k.a. “catch and release”). But that worry could be resolved by providing asylum seekers with ankle monitors. The Department of Homeland Security has used such monitors to track a small portion of asylum seekers for two years now; and migrants with ankle bracelets have complied with court appearances 99.6 percent of the time. Outfitting all asylum seekers with ankle monitors — instead of detaining them — would save the federal government millions of dollars, while also resolving the humanitarian problems posed by family detention.

But if the Trump administration finds ankle monitors insufficiently cruel, it could at least throw its support behind expanding the ranks of immigration judges. If the government could rapidly process asylum claims, it would not have to detain families for months on end. Currently, the U.S. has 334 immigration judges; experts believe that hiring an additional 364 such judges would allow the courts to get through the large backlog of pending deportation cases. To that end, Texas senator Ted Cruz has put forward a bill that would bring the total number of immigration judges up to 750.

But Trump has denounced all viable solutions to the White House’s problem. The White House’s aversion to ankle monitors isn’t hard to understand — the administration has signaled that it believes treating migrants cruelly is an effective means of deterring future migrants. By contrast, the president’s loud opposition to hiring more immigration judges is simply baffling.

The United States already deports many undocumented immigrants without allowing them to appear before an immigration judge. In fact, expedited removals — which is to say, removal orders issued to individuals who have been ordered to leave the U.S. previously — account for the vast majority of deportations.

But both U.S. and international law prohibit the expedited removal of asylum seekers. And it’s unlikely that there are 50 votes in the U.S. Senate for repealing that law and breaking the relevant treaties — let alone, the 60 necessary for passage. Meanwhile, Trump’s broader proposal to deny migrants all forms of due process — and to simply eject them from the country like rowdy teens on a front lawn — would require a constitutional amendment to enact.

Given these facts, it’s hard to fathom why the president wouldn’t want to increase the pace of deportations by hiring more immigration judges — a measure that could ostensibly pass Congress if he put his weight behind it, and provided some minor concessions to Democrats.

And yet, this irrational intransigence is of a piece with Trump’s broader approach to immigration policy. The president has repeatedly refused to accept funding for his border wall because it wasn’t paired with steep reductions to legal immigration — which only 38 Senate Republicans support.

I agree with Levitz that Trump already appears to be winning the war on asylum seekers. Racist xenophobic zealot Jeff Sessions runs the Immigration Courts and the BIA. “Go along to get along” Article III courts like the Third Circuit and the Supremes are willing to “swallow their whistles” when it comes to outing overt racism, religious bigotry, and parodies of Due Process in our Immigration Courts. More “captive judges” would be a “cheap and easy” way of speeding up the deportation express while even adding a patina of “fake Due Process” so that the Article IIIs can more easily rubber stamp the results. Chief Justice John Roberts and his “Supreme Gang of Five” have already shown how easy it is to bury the Constitution when it comes to immigration.

And, don’t forget that Sessions is already well on the way to insuring that asylum applicants are removed without fair hearings. He essentially directed Asylum Officers and Immigration Judges to summarily deny all of the most viable claims coming from Hispanic refugees from Central America. Meanwhile, the Article III courts continue to adopt creative ways to ignore the obvious trashing of Due Process going on in the “credible fear” process.

But, even that isn’t enough to keep Trump’s White Nationalist base revved up. By calling outright for the overthrow of our Constitution, he is really casting light on what he, Sessions, and their fellow White Nationalist sycophants already are doing. That might be a mistake. It will further energize the resistance — the many Americans still willing to stand up for the Constitutional rights of everyone in America –  even in the age of Trump.

Interesting, and not just a little discouraging, that so many of those who took an oath to uphold our Constitution aren’t willing to do so, while those outside of our corrupt government and weak-kneed courts are the only ones standing up for our Constitutional protections and individual rights!

A federal judge in Washington on Monday ordered the U.S. government to immediately release or grant hearings to more than 1,000 asylum seekers who have been jailed for months or years without individualized case reviews, dealing a blow to the Trump administration’s crackdown on migrants.

U.S. District Judge James E. Boasberg of Washington said U.S. Immigration and Customs Enforcement ignored its own policy stating that asylum applicants who establish a “credible fear” of persecution in their native country must be granted a court hearing within seven days or released.

He granted a preliminary injunction preventing the government from carrying out blanket detentions of asylum seekers at five large U.S. field offices, including those currently held, pending resolution of the lawsuit.

The American Civil Liberties Union and other groups sued in March after finding detention rates at the offices surged to 96 percent in the first eight months after President Trump took office in 2017, up from less than 10 percent in 2013.

The ACLU says the mass imprisonment of people seeking refuge while awaiting immigration court hearings stems from policies promoted by Trump and Attorney General Jeff Sessions that amount to a deterrent to using the asylum provision. The policy, the ACLU argued, unlawfully denies asylum seekers as a group based on only one of the factors used to assess the danger an individual poses: how long they have been in the United States.

“As the events of recent months make clear, the question of how this nation will treat those who come to our shores seeking refuge generates enormous debate,” Boasberg wrote in a 38-page opinion, an allusion to the administration’s family-separation policy recently implemented and then abandoned amid international condemnation.

“This Opinion does no more than hold the Government accountable to its own policy, which recently has been honored more in the breach than the observance. Having extended the safeguards of the Parole Directive to asylum seekers, ICE must now ensure that such protections are realized,” Boasberg said.

The lawsuit was filed on behalf of nine detained asylum seekers from Haiti, Venezuela and other countries who were initially determined to have credible stories and have been jailed for up to two years awaiting a hearing before an immigration judge, lawyers said. Two have been granted asylum and released since the case was filed in March, said attorneys with the ACLU and the Covington & Burling law firm.

The court action named the Department of Homeland Security and its sub-agency ICE, which detains immigrants, and the Justice Department, which runs the immigration courts where immigrants can seek bond hearings.

As of April 2017, the average wait for a hearing was 670 days, and the immigration court backlog has increased since then. It was 714,067 cases in May 2018.

It isn’t possible to enforce the immigration laws if deportable aliens can’t be put in removal proceedings, and the judges are being pressed to spend less time on cases, which puts due process in jeopardy.

Relatively few asylum applications are granted, and even fewer will be granted in the future.

We need a politically acceptable way to reduce the number of asylum applicants to a manageable level.

I agree with Nolan’s observation that pushing Immigration Judges to schedule more cases and spend less time on them puts due process in jeopardy. I also can see that Sessions intends to reduce asylum grant rates to about 0% by totally distorting the system until it is impossible for virtually anyone actually needing protection to get it.

As I have stated before, the problem isn’t the asylum law. The problem is the way Trump and Sessions have distorted and perverted asylum law and the Constitutional right to Due Process.

Asylum law is designed to protect individuals fleeing from persecution. We haven’t even begun to test the limits of our ability to give refuge. Indeed, at the time of the world’s greatest need, and our own prosperity, we have disgracefully turned our backs on accepting anything approaching a fair share of the world’s desperate refugees. We should be ashamed of ourselves as a nation! Refugees of all types bring great things to our nation and help us prosper. But, even if they didn’t, that wouldn’t lessen our moral and humanitarian obligations to accept our fair and more generous share of the world’s refugees.

And never forget that the backlog and the waiting times have little or nothing to do with fault on the part of asylum applicants. Many of them have also been unfairly screwed by the mess that Congress, the DOJ, DHS, and politicos have made of the Immigration Court system.

The backlog is almost entirely the result of “Aimless Docket Reshuffling” which has been kicked into high gear under Sessions, exceptionally poor choices in docket management and bad prosecutorial decisions by DHS, and years of neglect and understaffing by Congress, as well as stunningly incompetent management of the Immigration Courts by the DOJ under the last three Administrations.

Here’s the truth that Trump and the restrictionists don’t want to deal with:

Contrary to what White Nationalist liars like Trump & Sessions say, our U.S. asylum laws are not the problem. The politicos who misinterpret and misapply the law and then mal-administer the asylum adjudication system are the problem.

The current asylum laws are more than flexible enough to deal efficiently, effectively, and humanely with today’s bogus, self-created “Southern Border Crisis.” It’s actually nothing more than the normal ebb and flow, largely of refugees, from the Northern Triangle.

That has more do with conditions in those countries and seasonal factors than it does with U.S. asylum law. Forced migration is an unfortunate fact of life. Always has been, and probably always will be. That is, unless and until leaders of developed nations devote more time and resources to addressing the causation factors, not just flailing ineffectively and too often inhumanely with the inevitable results.

And the reasonable solutions are readily available under today’s U.S. legal system:

  • Instead of sending more law enforcement officers, prosecutors, and judges to the Southern Border, send more CBP Inspectors and USCIS Asylum Officers to insure that those seeking asylum are processed promptly, courteously, respectfully, and fairly.
  • Take those who turn themselves in to the Border Patrol to the nearest port of entry instead of sending them to criminal court (unless, of course, they are repeat offenders or real criminals).
  • Release those asylum seekers who pass “credible fear” on low bonds or “alternatives to detention” (primarily ankle bracelet monitoring) which have been phenomenally successful in achieving high rates of appearance at Immigration Court hearings. They are also much more humane and cheaper than long-term immigration detention.
  • Work with the pro bono legal community and NGOs to insure that each asylum applicant gets a competent lawyer. Legal representation also has a demonstrated correlation to near-universal rates of appearance at Immigration Court hearings. Lawyers also insure that cases will be well-presented and fairly heard, indispensable ingredients to the efficient delivery of Due Process.
  • Insure that address information is complete and accurate at the time of release from custody. Also, insure that asylum applicants fully understand how the process works and their reporting obligations to the Immigration Courts and to DHS, as well as their obligation to stay in touch with their attorneys.
  • Allow U.S. Immigration Judges in each Immigration Court to work with ICE Counsel, NGOs, and the local legal community to develop scheduling patterns that insure applications for asylum can be filed at the “First Master” and that cases are completed on the first scheduled “Individual Merits Hearing” date.
  • If there is a consensus that these cases merit “priority treatment,” then the ICE prosecutor should agree to remove a “lower priority case” from the current 720,000 case backlog by exercising “prosecutorial discretion.” This will end “Aimless Docket Reshuffling” and insure that the prioritization of new cases does not add to the already insurmountable backlog.
  • Establish a robust “in-country refugee processing program” in the Northern Triangle; fund international efforts to improve conditions in the Northern Triangle; and work cooperatively with the UNHCR and other countries in the Americas to establish and fund protection programs that distribute refugees fleeing the Northern Triangle among a number of countries. That will help reduce the flow of refugees at the source, rather than at our Southern Border. And, more important, it will do so through legal humanitarian actions, not by encouraging law enforcement officials in other countries (like Mexico) to abuse refugees and deny them humane treatment (so that we don’t have to).
  • My proposed system would require no legislative fixes; comply with the U.S Constitution, our statutory laws, and international laws; be consistent with existing court orders and resolve some pending legal challenges; and could be carried out with less additional personnel and expenditure of taxpayer funds than the Administration’s current “cruel, inhuman, and guaranteed to fail” “deterrence only” policy.
  • ADDITIONAL BENEFIT: We could also all sleep better at night, while reducing the “National Stress Level.” (And, for those interested in such things, it also would be more consistent with Matthew 25:44, the rest of Christ’s teachings, and Christian social justice theology).

As Eric Levitz says in New York Magazine, the folks arriving at our border are the ones in crisis, not us! “And those families aren’t bringing crime and lawlessness to our country — if anything, we brought such conditions to theirs.”

That warrants a much more measured, empathetic, humane, respectful, and both legally and morally justifiable approach than we have seen from our Government to date.The mechanisms for achieving that are already in our law. We just need leaders with the wisdom and moral courage to use them.

I also take note of how EOIR under Sessions has disingenuously manipulated the asylum adjudication numbers to support a false narrative that most asylum  claims are meritless.

The only “real ” number is a comparison of asylum grants to denials, not grants to the total number of cases involving asylum applications including the substantial number that were never decided on the merits. The fact that a case is disposed of in some other manner does not mean that the asylum application was meritless; it just means that the case was disposed of in another way.

Here are the “real” numbers from EOIR’s own Statistics Yearbook, before they were dishonestly manipulated under Sessions’s instructions to support his false claims about asylum seekers:

In 2016, the “real” grant rate was 38%. Even under Sessions in the partial FY 2018, the merits grant rate is 35%. That’s by no means negligible — one in three! And, remember folks, this is with asylum law that was already badly skewed against applicants, particularly those from the Northern Triangle with potentially bona fide claims. (But, admittedly, before Sessions recent rewriting of asylum law to improperly deny asylum and  essentially impose death sentences or torture on vulnerable women fleeing from the Northern Triangle.)

And, in my experience, the vast majority of denied asylum seekers had legitimate fears of harm upon return that should have entitled them to some protection; they just didn’t fit our unrealistically and intentionally restrictive interpretations. By no means does denial of an asylum claim mean that the claim was frivolous!

The real question we should be asking is that with the refugee situation in the world getting worse and with continually deteriorating conditions in the Northern Triangle, how do asylum merits grant rates drop from 56% and 53% as recently as FY 2011 & 2012 to 35% in 2018? What those numbers really suggests is large-scale problematic behavior and improper influence within the DOJ and the Immigration Judges who are denying far, far too many of these claims. Some of that includes use of coercive detention in out-of-the-way locations and depriving individuals of a fair opportunity to be represented by counsel, as well as a number of BIA decisions (even before Sessions’s Matter of A-B- atrocity) specifically designed to promote unfairness and more asylum denials.

There is no “southern border crisis,” other than the unnecessary humanitarian crisis that Trump and Sessions created by abusing children. Nor is there a problem with our asylum laws except for the intentional failure of our Government to apply them in a legal, fair, and Constitutional manner. But, there is a White Nationalist, racism problem clearly manifesting itself in our immoral and scofflaw national leadership.

Everyone committed to fairness, Due Process, and maintaining America as a country of humane values should fiercely resist, in every way possible, suggestions by Trump, Sessions, and some in the GOP  to further abuse Due Process and eliminate the already limited rights of the most vulnerable among us! 

We need to say focused on the real threats to our national security and continued existence as a democratic republic: Trump, Sessions, and their cohorts and enablers!

WHITE NATIONALIST ALERT AT JUSTICE: NEO-NAZI SESSIONS REPORTEDLY PROPOSING MASSIVE VIOLATION OF CONSTITUTION, REFUGEE ACT OF 1980, INTERNATIONAL LAW, AND HUMAN RIGHTS STANDARDS WITH RACIALLY TARGETED ABOLITION OF ASYLUM BY REGULATION! – Is Our Republic Teetering On The Brink?

The Department of Justice, under Attorney General Jeff Sessions, is drafting a plan that would totally overhaul asylum policy in the United States.

Under the plan, people would be barred from getting asylum if they came into the US between ports of entry and were prosecuted for illegal entry. It would also add presumptions that would make it extremely difficult for Central Americans to qualify for asylum, and codify — in an even more restrictive form — an opinion written by Sessions in June that attempted to restrict asylum for victims of domestic and gang violence.

Vox has confirmed that the regulation is in the process of being evaluated, and has seen a copy of a draft of the regulation.

When the regulation is ready, it will be published in the Federal Register as a notice of proposed rulemaking, with 90 days for the public to comment before it’s enacted as a final regulation.

The version Vox saw may change before it’s finalized, or even before the proposal is published in the Federal Register. (The Department of Justice declined to comment.)

But as it exists now, the proposal is a sweeping and thorough revamp of asylum — tightening the screws throughout the asylum process.

One source familiar with the asylum process but not authorized to speak on the record described the proposed changes as “the most severe restrictions on asylum since at least 1965” — when the law that created the current legal immigration system was passed — and “possibly even further back.”

The Immigration and Nationality Act gives the attorney general, along with the Department of Homeland Security, discretion over asylum standards — saying that the government “may grant asylum” to an applicant who they determine meets the definition of a refugee. But the proposed regulation would make it nearly impossible for Central Americans, including families, to earn the government’s approval.

It would eliminate the path that thousands of Central Americans, including families, take every month to seek asylum in the US: entering between ports of entry and presenting themselves to Border Patrol agents. It would make it all but impossible for victims of domestic or gang violence to qualify for asylum — going even further than a June decision from Sessions that sought to limit asylum access for those groups. It would create a presumption against Central Americans who travel through Mexico on their way to the US.

Anyone convicted of entering the US illegally would become ineligible for asylum

What happens under current policy: Under the Trump administration’s “zero tolerance” initiative, all migrants who cross between ports of entry and are apprehended by Border Patrol are supposed to be criminally prosecuted for illegal entry.

That arrest can delay a person’s claim of asylum, but it doesn’t derail it. An asylum-seeker may not get their initial screening interview, which determines whether they’ll be allowed to file an asylum application and get a hearing, until after they’ve been prosecuted and convicted. And they definitely won’t get approved for asylum before their criminal conviction.

But the conviction for illegal entry doesn’t affect the asylum claim; as Customs and Border Protection puts it, the two are on “parallel tracks.”

What would happen under the new plan: The proposed regulation would bar anyone from getting asylum if they’d been convicted of illegal entry or illegal reentry. That means people who asked for asylum when they were apprehended at the border, but were prosecuted first, would get denied asylum.

In effect, under this new regulation, combined with the zero-tolerance prosecution initiative, no one would be able to come to the US and get asylum unless they presented themselves at a port of entry. Many asylum-seekers simply don’t have that option. Smugglers often prevent asylum-seekers from using official ports of entry, and many of those who do come to ports of entry are being forced to wait days or weeks, after being told there’s no room to process them right now. And asylum-seekers who come to ports of entry are often required to stay in immigration detention without bond until their case is complete.

The administration would almost certainly get sued over this provision if it ended up included in the finalized regulation. The Department of Justice (DOJ) has the power to bar people from getting asylum (or other forms of relief from deportation) if they’ve committed “particularly serious crimes.” While there’s no definition of seriousness in the law, lawyers and immigration advocates would likely challenge the idea that illegal entry, a misdemeanor, is “particularly serious.”

But even if that provision is struck down or eliminated by the courts, another proposal in the draft regulation could have much the same effect. It would instruct immigration judges to consider how the asylum-seeker got into the US, and treat it as a significant factor in whether or not to grant asylum (since asylum-seekers have to show they deserve “favorable discretion” from the judge). So even if people who crossed between ports of entry weren’t officially banned from getting asylum, they would have a very hard time winning their cases in practice.

If adopted, the regulation, combined with the zero tolerance initiative, would allow the administration to set up assembly-line justice for asylum seekers, including families, entering the US. People who entered between official ports would be held by the Department of Homeland Security, prosecuted for illegal entry, convicted, then have their asylum applications denied and get deported.

While the Trump administration is currently trying to win the power to detain families for more than 20 days, if this regulation were enacted, they might not even need to. They could deny most asylum claims and deport the claimants within that time.

Victims of domestic or gang violence would be all but banned from asylum

What happens under current policy: US law limits asylum to people who are persecuted because of their race, religion, political opinions, nationality, or membership in a particular social group.

The government has been wrestling for decades with that last classification what exactly counts as a “particular social group”? — and with whether someone is “persecuted” if they’re victimized by someone other than the government. These questions are key to the fate of many of the Central Americans (including children and families) who have come to the US to seek asylum in recent years, many of whom are claiming asylum based on domestic violence or gang victimization in their home countries.

In June, with a sweeping ruling overturning a case from the Board of Immigration Appeals, Sessions attempted to narrow the circumstances in which someone fleeing domestic or gang violence could qualify for asylum in the US — saying that, generally, victims of domestic or gang violence wouldn’t be eligible for asylum based on their victimization.

As I reported last week, though, US Citizenship and Immigration Services (USCIS) has been cautious in implementing Sessions’s opinion. Most notably, while Sessions decreed that his ruling overturned any precedent that contradicted it, USCIS only told asylum officers to stop using the one precedent decision Sessions explicitly named as moot.

It looks like the DOJ may be trying to use regulation to accomplish the same goal — with even narrower definitions of “persecuted” and “particular social group.”

What would happen under the plan: The proposed regulation would add several restrictions to what could constitute a particular social group: a family, for example, wouldn’t be a social group unless the family had a visible national presence. Interpersonal violence or crime victimization, similarly, wouldn’t be the basis for social group membership unless they were happening on a national scale. Having been recruited by a gang would be explicitly prohibited as grounds for an asylum claim.

To qualify for asylum, an applicant would have to show that the people who persecuted her were also persecuting others on the same basis. Human-rights lawyers worry this could disqualify many legitimate asylum claims. One lawyer raises the example of a gay man in Russia who suffers a violent homophobic attack: Under the proposal, “this would not be persecution on account of sexual orientation unless you could prove that these attackers had previously persecuted other gay men.”

An asylum-seeker would be required to provide an exact definition of her “particular social group” when she was applying for asylum. And she wouldn’t be allowed to appeal a denial, or reopen a claim, on the basis of any group she hadn’t originally named.

It’s extremely difficult for anyone other than a trained immigration lawyer to know exactly what does and doesn’t count as a particular social group eligible for asylum. Under the proposed regulation, however, an asylum-seeker who didn’t know the precise nature of the basis for her persecution would be assumed to not really be a victim of persecution at all.

This standard wouldn’t just apply to final approvals or denials of asylum. The initial step for an asylee is what’s called a “credible fear” screening, during which an asylum officer decides whether the person has a credible fear of going back to their home country. The proposed rule would tighten standards for those, too.

Immigration lawyers and border advocates were already extremely concerned that Sessions’s May ruling would cause asylum officers to radically hike the standards for passing the screening interview (though the USCIS memo posted by Vox suggests that might not be the case just yet). If this regulation were finalized, however, it seems very possible that many people who are currently given the opportunity to apply for asylum would be turned away before they got the chance.

Central Americans would be penalized for not seeking asylum in Mexico

What happens under current policy: Many asylum seekers are Central Americans who come through Mexico to seek asylum in the US. The US is not allowed to simply turn them back and force them to seek asylum in Mexico instead. (The Trump administration is trying to get Mexico to sign a “safe third country” agreement that would allow them to do this, but Mexico appears unenthusiastic.) But the proposed regulation would make it a lot easier to deny their asylum claims based on not having sought asylum in Mexico first.

What would happen under the plan: Under the proposed rule, the government would generally withhold “favorable discretion” (and, therefore, deny the asylum claim) for anyone who had spent more than two weeks in another country en route to the US without seeking asylum there, or who had traveled through more than one country on the way to the US.

Many Central Americans, especially if they take the train through Mexico or travel on foot, take more than two weeks to travel through Mexico. And asylum-seekers from Honduras and El Salvador cross through Guatemala and Mexico to get to the US — meaning that they would almost certainly not earn the “favorable discretion” required to get their asylum claim approved.

Tightening the screws on the entire asylum process

The proposed regulation is extremely broad, with a lot more provisions — all of which would make it much harder for people to seek and get asylum. Some of the remaining ideas in the proposed draft include:

Limiting appeals for asylum-seekers who fail their screening interviews. Under current law, if an asylum-seeker fails her initial “credible fear” interview with an asylum officer, she can appeal for a judge to review her claim with fresh eyes — ignoring the fact that the asylum officer hadn’t found it a credible claim. Under the proposed regulation, judges would only be able to approve a credible-fear claim on appeal if there was clear evidence that the asylum officer had screwed up.

Rejecting incomplete applications first and letting them get completed later. Instead of returning incomplete asylum applications to the applicant and asking her to complete it, the government would reject the application. The applicant would still have 60 days to complete and resubmit the application before it was officially denied, but it’s not clear how applicants would be told about that — or whether they’d read beyond the word “rejected.”

Allowing judges to put evidence into the record on their own. The proposal would allow immigration judges considering asylum cases to unilaterally insert any information from credible sources into the record (as long as both the prosecutor and defense were informed). This provision would make it much easier for judges to insert information claiming that an asylum-seeker’s home country isn’t as dangerous for him as he claims — since asylum cases often hinge on whether there’s anywhere safe in the home country the asylum-seeker could live instead of the US.

Immigrants could be barred from asylum based on traffic offenses… In addition to the new prohibitions on asylum for immigration-specific crimes, the regulation would ban any applicant who’d been convicted of two or three misdemeanors (depending on what they were) from getting asylum.

This would have the biggest impact on unauthorized immigrants living in the US who get arrested and put in deportation proceedings, but ask for asylum to avert their deportation. (Under asylum law, someone can ask for asylum at any point within their first year of living in the US.)

In immigration policy, traffic offenses like driving without a license often don’t count as misdemeanors because in many states unauthorized immigrants aren’t allowed to get licenses. But the draft regulation makes clear that if driving without a license is a misdemeanor in the jurisdiction in question, it counts toward ineligibility.

…and blue states can’t fix eligibility by expunging immigrants’ records. Some Democratic state officials (most notably Gov. Jerry Brown in California) have started to use the pardon power to clear the criminal records of immigrants facing deportation. This regulation would do an end-run around that strategy.

Convictions that had been expunged or otherwise modified after the fact would still count as convictions if there was any evidence that the criminal record had been altered for immigration purposes. In other words, if Brown tried to expunge a record to make someone eligible for asylum, the fact that that’s why he did it would prevent it from stopping their deportation.

And, I suppose that once the kids have been disposed of by returning them to death in the Northern Triangle, Trump & Sessions will use the cages to keep the rest of us in.

When Magistrate Judge Peter E. Ormsby stepped into the federal courtroom here Tuesday morning, 75 defendants rose to their feet.

Their ankles were shackled, and they wore headsets through which the proceedings would be translated into Spanish. In the hallway, just beyond the door, was a pile of handcuffs that had been removed before they entered the courtroom.

Most of the defendants appeared dressed in the same filthy, sweat-saturated clothes they had been wearing two days before, when they were apprehended crossing the Rio Grande aboard rafts.

In all but 11 of their cases, this criminal misdemeanor was the first time they had ever been found to have violated U.S. law.

Ormsby informed them his was not an immigration court. Many had already signed away their rights to further proceedings and had orders for what is known as “expedited removal.” They had done that before the 17 lawyers of the public defender’s office had met with any of them for the first time, just hours before.

The next two hours would see each one of them plead guilty and be sentenced, most to time already served.

With few exceptions, each case would be dealt with in under 75 seconds.

This was just the morning docket. It is what President Trump’s “zero tolerance” policy looks like here, where busloads of recently detained migrants roll up to the federal courthouse several times a day. Ormsby invited me and a handful of other observers there to sit in the jury box, because there was no room anywhere else.

The president contends that even this assembly-line version of justice is more than what those caught entering the country illegally should get.

“We cannot allow all of these people to invade our Country,” Trump tweeted Sunday. “When somebody comes in, we must immediately, with no Judges or Court Cases, bring them back from where they came. Our system is a mockery to good immigration policy and Law and Order.”

On that latter point, the president is correct — but it is for the reverse of the reasoning he offers. His zero-tolerance policy is putting even more stress on a legal system that already gives migrants far less than their day in court.

The outcome for many might be different if they had fuller access to the legal system, to which they are entitled in theory if not practice, and given an opportunity to make their case to stay in this country.

Trump has mocked proposals for adding to the number of immigration judges, who handle separate proceedings for those who want to remain.

“We have thousands of judges already,” he has claimed. That is incorrect. The number actually stands at fewer than 350 across the country. They are facing a backlog of more than 700,000 cases.

Just as critical as the scarcity of judges is the fact that so few migrants ever have a chance to consult an attorney.

Only about 14 percent of those who are detained have access to counsel, says American Bar Association President Hilarie Bass, who was here from Miami. She added that migrant adults with lawyers win slightly more than half their cases and get to stay in this country, while 9 out of 10 of those without representation lose and are deported.

For unaccompanied children, the disparity in outcomes is even greater. As Bass noted: “How can you ask a 12-year-old to walk into court and make a case for themselves?”

Under Trump’s zero-tolerance policy, more migrants are being prosecuted and deported on the border, rather than being sent to other parts of the country where they can await trial while staying with relatives or others who can take them in. That has compounded the challenge, because it adds to the backlog in this region and makes it more difficult for migrants to find lawyers.

In the current crisis, platoons of lawyers are arriving weekly to volunteer their services, but there are not nearly enough, says Kimi Jackson, director of the South Texas Pro Bono Asylum Representation Project. “What we need most here are Spanish-speaking immigration attorneys, particularly ones who can stay a little longer.” The need will remain for the foreseeable future, long after the journalists and cameras have moved on to the next story.

And even if help comes, it will be too late for most of those who appeared before Ormsby. As he worked his way through their cases, he expressed sympathy for the circumstances of poverty and violence that brought them from dangerous places in Honduras and El Salvador and Mexico to his courtroom. He wished them and their families well and urged them to go through the process of coming to the United States legally.

“Seeing the type of people you appear to be,” the magistrate added, “I hope that you will be successful with that.”

But everyone there knew that was a wish, and one unlikely to come true.

  • Anybody know that asylum applicants who pass credible fear can request bond?
  • Anybody understand the consequences of a conviction?
  • Anybody pressured to plead guilty to get their kids back or get out of detention?
  • Anybody know how the asylum process works and how to apply?
  • Anybody know how important lawyers are for asylum seekers and how to get in touch with local pro bono lawyers?
  • Anybody separated from kids?
  • Anybody know that the Government has been ordered by a more conscientious Federal Judge to reunite families?

We’ll probably never know the answers, because that might have exceeded Judge Ormsby’s 75 second attention span and cut into his productivity stats.

President Donald Trump in recent days has fumed about the immigration courts that handle cases of people seeking entry into the US.

But Trump’s fixation on the courts and the judges who staff them flies in the face of what his attorney general has been trying to do to reshape the courts to align with the President’s vision, including hiring more immigration judges and restricting asylum laws.

The President tweeted that those stopped at the border should be simply told they can’t enter, rather than going through the system.

“When somebody comes in, we must immediately, with no judges or court cases, bring them back from where they came,” Trump tweeted on Saturday.

Press secretary Sarah Sanders told reporters Monday that “virtually all Americans” agree that drawn-out court proceedings don’t make sense for migrants who enter the country illegally. Trump, she said, “would certainly like to see more expedited removal.”

“Just because you don’t see a judge doesn’t mean you aren’t receiving due process,” she said.

The immigration courts decide whether immigrants have a legal right to stay in the US or should be deported — and those cases include people arriving at the border as well people from the interior of the US, who may or may not have had legal status at some point.

But Trump’s suggestion has several problems, including the fact that there are fewer than 350 immigration judges nationwide and the Justice Department has budgeted for only 100 more.

In addition, the suggestion that the immigration courts could be done away with altogether would likely fly in the face of the Constitution and a host of domestic and international laws that bestow rights on everyone in the US and crossing the border, regardless of whether they are citizens.

BALTIMORE, Md. ― Aracely Martinez Yanez, 33, knows she’s one of the lucky ones. A deep scar that carves a line through her scalp, from crown to cheek, is proof of that fortune.

She got lucky when her abusive partner shot her point-blank in the head, and she survived.

She got lucky when she escaped her tiny village in Honduras. Local villagers blamed her for her partner’s death; he killed himself and their two young sons after he shot her.

She got lucky when she wasn’t harmed as she made the treacherous 2,000-mile journey to America.

And she got luckiest of all when she was granted asylum after she got here.

If she were to make her journey to America now, she would likely be turned away. Last week, Attorney General Jeff Sessions ruled that immigration judges generally cannot consider domestic violence as grounds for asylum. Sessions overturned a precedent set during the Obama administration that allowed certain victims to seek asylum here if they were unable to get help in their home countries.

Domestic abuse of the kind experienced by Martinez Yanez is endemic in Central America. In Honduras, few services for victims exist, and perpetrators are almost never held criminally responsible. One woman is killed every 16 hours there, according to Honduras’ Center for Women’s Rights.

For many victims, the United States is their best shot at staying alive.

While the exact numbers are not available, immigration lawyers have estimated that the Trump administration’s decision could invalidate tens of thousands of pending asylum claims from women fleeing domestic violence. Advocates warn it will be used to turn women away at the border, even if they have credible asylum claims.

“This administration is trying to close the door to refugees,” said Archi Pyati, chief of policy at Tahirih Justice Center, a nonprofit organization that works with immigrant women and girls who have survived gender-based violence. They represented Martinez Yanez in her asylum case. Travel bans, increased detention and family separation are all being used as tools to deter individuals from coming here, Pyati said.

Still, that will not stop women from coming. Because there are thousands of women just like Martinez Yanez, and their stories are just as harrowing.

A Violent Start

Martinez Yanez grew up in a tiny village in Honduras with her parents and seven siblings. Her family made a living by selling homemade horchata, a sweet drink made from milky rice, and jugo de marañon, cashew juice. They also sold fresh tortillas out of their house. Her childhood was simple and happy.

But after she turned 15, a man in her village named Sorto became obsessed with her. At her cousin’s wedding, he tried to dance with her. She pushed him off: He was 15 years her senior, and gave her the creeps. A few days later, Martinez Yanez said, he waited outside her house with a gun and kidnapped her. He took her to a mountain and raped her repeatedly.

“I wanted to die,” she told HuffPost through an interpreter at her home in Baltimore on Tuesday. “I felt dirty. He said that I was his woman, and that I would not belong to anyone else.” As she told her story, she rubbed her legs up and down, physically uncomfortable as she recalled the terrible things that had happened to her.

Over the next six years, she said, Sorto went on to rape and beat her whenever he pleased. In the eyes of the village, she was his woman, just like he said. She got pregnant immediately, giving birth to her first son, Juancito, at 16, and her second son, Daniel, at 18. Sorto would come and go from the village, as he had a wife and children in El Salvador. But when he wasn’t there, she said she was watched by his family.

As for help, there were no police in her village, she said. She had seen what happened to other women who traveled to the closest city to report abuse: It made things worse. The police did nothing, and the abuser would inevitably find out.

“I felt like I was worthless, like I had no value,” she said.

A few years after her sons were born, she became friends with a local barber who cut her children’s hair. He was sweet and respectful, nothing like Sorto, she said. They began a secret relationship. Sorto had been gone from the village for a few years, and Martinez Yanez hoped she was free of him. Then she got pregnant. Scared that Sorto would find out, she fled to San Pedro Sula, a city in the north of the country. She didn’t tell anyone where she had gone.

But Sorto found her anyway. He called her on the phone and told her if she did not come back to the village within the next 24 hours, he would kill her family, she said. Martinez Yanez got on the next bus back.

A few days after she returned, she said, Sorto told her that he was taking her and their two boys to the river. He brought a hunting rifle with him. The family walked through the mountainside. Martinez Yanez recalled handing her children some sticks to play with, and crouching on the ground with them. Then she felt the rifle pressing into her head. The rest is a blank.

Sorto shot her in the back of the head, and killed her two sons, before shooting himself. Juancito was 6, Daniel was 4. Somehow, Martinez Yanez, five months pregnant, survived. She was hospitalized for months and had to relearn to walk and talk. She is still deaf in one ear, and has numbness down one side of her body.

When she returned home to the village, she said, people threw rocks at her and called her names. Someone fired a gun into her house. Someone else tried to run her over with a bicycle. The community blamed her for the killings because she had tried to leave Sorto, she explained. His family wanted to avenge his death.

“The whole village was against me,” she said. “Children, adults. I couldn’t go anywhere by myself.”

A few months later she gave birth to a girl, Emely, but she was overwhelmed with stress. On top of grieving the death of her two sons, learning to live with a traumatic brain injury, and caring for her newborn, she was constantly worried about being killed by people in her village.

It was too much. She eventually fled to Tegucigalpa, the capital of Honduras, but Sorto’s family found her there too, she said. In a last-ditch effort to save Martinez Yanez’s life, her family paid over $7,000, an enormous sum for the family, to a coyote, a person who helps smuggle people across the border to the U.S. Emely, who was now 2, had to stay behind. They couldn’t afford to send her, too.

Martinez Yanez made the heartbreaking decision to go alone.

The Journey To Freedom

She left in the middle of the night, traveling with a group of four or five people. They were transported in a van for part of the trip, and then in taxis.

There was very little to eat or drink, she said, and she barely slept. Her stomach was upset and she suffered from debilitating headaches. In Mexico, she almost turned back.

“I missed my parents and my daughter so much,” she said. “But the threats and the conditions that I knew were waiting for me in my village gave me the motivation to continue to the U.S. to be safe.”

It took them two weeks to get to the U.S. border. Then they waited two days before attempting to cross, she said. She was terrified that she would be caught by immigration officials and sent back. She crossed the border illegally in February 2009, and went to her uncle’s house in Houston, Texas, before traveling on to Annapolis, Maryland, where her brother lived.

Women like Aracely are saving their own lives.Kristen Strain, a lawyer who worked on Martinez Yanez’s asylum case.

Martinez Yanez didn’t know that she could apply for asylum as a domestic violence victim until a few years later, when she sought medical care for her head injury in Maryland. There, she was referred to Tahirih Justice Center.

Kristen Strain, an attorney who worked on her case, wrote the legal brief arguing that Martinez Yanez should be granted asylum.

Generally, applicants must show that the persecution they have suffered is on account of one of five grounds: race, religion, national origin, political opinion, or membership in a particular social group. Strain successfully argued that being a female victim of severe gender-based violence in Honduras counted as a particular social group for purposes of obtaining asylum.

“There simply aren’t laws in place that protect women like Aracely,” she said. “They have no recourse. It is accepted in their communities that women can be treated like men’s property.”

She said it took over a year to gather all the evidence for Martinez Yanez’s claim, which included a neurological evaluation, medical documents, news stories from Honduran papers about the shooting, dozens of interviews, and statements from friends and family in Honduras to corroborate her story.

“It is not as if it’s easy,” Strain said. “In addition to having to physically get here, which is harrowing and dangerous, women have to navigate a complex legal system that is difficult to understand, especially when they don’t speak the language. It’s hard for them to even know what their rights are, let alone find an attorney who can advocate for them.”

“Women like Aracely are saving their own lives,” she went on.

Martinez Yanez was granted asylum in 2013. Her daughter, Emely, was allowed to join her in 2014. While they talked on the phone regularly, the mother and daughter had not seen each other for five years.

A New Life

In her Baltimore home, more than 3,000 miles from the tiny village in Honduras where she was raised, Martinez Yanez likes to be surrounded by photos. They remind her of those she had to leave behind.

There’s one of her sister graduating college. Another of her parents beaming happily.

And then, hanging in the entrance to the kitchen, is a photograph of her with her two deceased sons. It is the only picture she owns of them. She brought it with her when she fled Honduras. When she spoke to HuffPost about her sons, she cried. She still doesn’t understand why they were killed.

Since she’s been in the U.S., Martinez Yanez has expanded her family. Emely, who is 11, now has two sisters: Gabriela, 7, and Alyson, 4.

“I’m very fortunate to be able to have my daughters with me,” she said. “I can’t ask for anything better to happen. I am so happy with my life.”

Martinez Yanez still struggles with the repercussions of being shot in the head. She is forgetful and can get confused easily. She said she has to put every appointment she has in her phone with an alarm, otherwise she’ll miss it.

She said she was grateful that she was granted asylum, and heartbroken for other women who may not have the same opportunity she did.

“I just feel so sad that other women in my situation, or even in worse situations than mine will not be allowed in the country anymore,” she said. “Here, I don’t have to hide or run away from anyone.”

 

So, without the interference of the DOJ politicos, here was an actual working system that helped get deserving cases granted and off the docket, conserved judicial resources, saved time, saved lives, and complied completely with Due Process. In other words, a smashing Immigration Court and U.S. system of justice “success story” by any rational measure! 
That has all been disgracefully dismantled by Sessions. Now, following his perversion of the law in Matter of A-B-, He’s encouraging DHS and Immigration Judges to deny such cases without even hearing the testimony (even though every one of these individuals easily should qualify for the lesser relief of protection under the Convention Against Torture). That’s almost certain to result in appeals, prolonged litigation in the Courts of Appeals, and ultimately return of most cases to the Immigration Courts for full hearings and fair consideration.
At some point, not only is A-R-C-G- likely to be reinstated, but it is likely to be expanded to what is really the fundamental basis for these claims — gender as a qualifying “Particular Social Group.” It’s undeniably immutable/fundamental, particularized, socially distinct and clearly the basis for much of the persecution in today’s world!
In the meantime, however, those who don’t have the luxury of great pro bono representation, lack an attentive Circuit Court of Appeals, or who can’t get through the “credible fear interview” as it has now been “rigged for denial” by Sessions will likely be unlawfully returned to their home countries to suffer abuse, torture, and a lifetime of torment or death, along with those cute little kids in the pictures we’re seeing. 
The White Nationalist, neo-Nazi regime of Trump, Sessions, and their enablers will be one of the most horrible and disgusting periods in our history. History will neither forget nor treat kindly those who failed to stand up to the racists and child abusers running and ruining our Government, and destroying many innocent lives in the process.

Abigail Tracy @ Vanity Fair reports on the latest batch of vile untruths flowing from the top of our vile White Nationalist regime as they try to defend their indefensible policy of official child abuse:

Facing mounting outrage in the media over its new “zero-tolerance” policy at the border, the Trump administration is deliberately misleading Americans about the thousands of migrant children it has forcibly separated from their families. The objective, according to people close to Donald Trump, is twofold: “deterrence,” as Chief of Staff John Kelly explained last month, and political extortion. “The thinking in the building is to force people to the table,” a White House official told The Washington Post last week. A second official confirmed that the president is hoping to use the detained children as leverage to force Democrats to cut a deal on immigration: “If they aren’t going to cooperate, we are going to look to utilize the laws as hard as we can.”

The images emerging from these detention centers, where traumatized young children are kept in chain-link pens, have drawn comparisons to some of the worst episodes in American history, including the internment of Japanese Americans during WWII. Instead of ending the controversial policy, however, President Trump has promoted a contradictory and confusing message about family separation. At times, he has blamed Democrats for what he has described as their “law” (it is not a law); at others, he has suggested that family separation is indeed his policy, but that Democrats have forced him to take action by not agreeing to new immigration-reform legislation. In a series of tweets Monday morning, he wrote that it is “the Democrats fault for being weak and ineffective with Boarder [sic] Security and Crime” and called on Congress to “change the laws.” He also indicated that the policy is driven by racial or cultural concerns, describing migrant children as Trojan horses for “the worst criminals on earth” and declaring that the U.S. should not repeat Europe’s “big mistake” of “allowing millions of people in who have so strongly and violently changed their culture.”

Over the weekend and into Monday, a number of Trump officials made similar obfuscations about the policy. In every instance, however, the implication was clear: the problem could go away if Democrats will just play ball. “This is up to the Democrats. They could fix this right now. If you close those loopholes, we could do this humanely,” White House Deputy Press Secretary Hogan Gidley said during an interview with Fox & Friends on Monday, before accusing Democrats of bolstering drug cartels and the “child-smuggling industry.” Senior White House adviser Kellyanne Conway similarly put the onus on Congress to address the crisis at the border during an interview with NBC’s Meet the Press on Sunday. After asserting that “nobody likes this policy,” Conway said, “If the Democrats are serious, and if a lot of Republicans are serious, they’ll come together. They won’t just talk about just this week, just the Dreamers, or just the wall, or just catch and release. It’s all of the above,” she said. Even First Lady Melania Trump appeared to lay responsibility for her husband’s policy at Congress’s feet, issuing a rare policy statement saying that she “hates to see children separated from their families,” but “hopes both sides of the aisle can finally come together.”

Secretary of Homeland Security Kirstjen Nielsen, meanwhile, seems unsure whether her agency’s policy exists. “We do not have a policy of separating families at the border. Period,” she tweeted on Sunday, blaming Democrats, journalists, and advocacy groups of “irresponsible and unproductive” reporting on the border. On Monday, however, Nielsen appeared to reverse herself, defending the separation of migrant families as necessary when prosecuting migrants who cross the border illegally. “There are some who would like us to look the other way,” the Homeland Security secretary said at a speech before the National Sheriffs’ Association in New Orleans. “Past administrations may have done so, but we will not. We do not have the luxury of pretending that all individuals coming to this country as a family unit are, in fact, a family. We have to do our job. We will not apologize for doing our job.” Attorney General Jeff Sessions, who addressed the group after Nielsen, said while he doesn’t enjoy separating children from their parents, the situation could be fixed if only Democrats would accede to building Trump’s border wall and passing new laws to crack down on illegal immigration.

The mixed messaging has become a problem for Republicans seeking to defend the Trump policy, but unsure whether they are supposed to be blaming Democrats, defending “law and order,” or pretending the policy doesn’t exist. “The policy is incredibly complicated and it is one we need to do a better job of communicating,” White House Director of Legislative Affairs Marc Short told The Wall Street Journal. “We’ve not talked about the history of how we got to this point.”

The history of the policy, however, does not support the administration’s narrative. It is true that at the height of the 2014 migrant crisis, when there was a surge in unaccompanied minors crossing the border, the Obama administration placed a large number of families in detention centers. But these families—many of them fleeing violence in Central America—were allowed to remain together while their claims were being processed. Under Trump’s “zero-tolerance” policy, however, all adults caught crossing the border are criminally prosecuted, with no exceptions. As a result, thousands of children have been taken away from their parents and treated as if they had tried to cross the border alone. In some cases, undocumented adults are being deported without their children, who remain detained in federal immigration facilities with no way to contact their parents. Immigration experts worry that some families may be permanently separated.

“If you’re smuggling a child, then we’re going to prosecute you, and that child will be separated from you, probably, as required by law,” Sessions said last month when announcing the new policy. “If you don’t want your child to be separated, then don’t bring them across the border illegally.” White House senior adviser Stephen Miller, a staunch advocate of the policy, told The New York Times last week, “It was a simple decision by the administration to have a zero-tolerance policy for illegal entry, period. The message is that no one is exempt from immigration law.”

Still, the cruel reality of family separation has become difficult for Trump’s allies to defend. On Sunday, Breitbart News criticized the Associated Press for describing the metal enclosures used to intern children as “cages,” suggesting that they were merely “chain-link partitions.” Fox & Friends host Steve Doocy argued the same point Monday morning.

This appears to be a losing battle for the White House. In a rare op-ed in The Washington Post, former First Lady Laura Bush derided separating families as “cruel” and “immoral.” Reverend Franklin Graham, the son of the late Billy Graham and a frequent defender of Trump, similarly slammed the policy as “disgraceful.” And while Republicans on Capitol Hill have remained largely silent on the issue, G.O.P. Senators Jeff Flake and Susan Collins sent a letter to Nielsen and Health and Human Services Secretary Alex Azardemanding more information on whether the Trump administration was separating families seeking asylum at ports of entry, in addition to those crossing the border illegally.

Administration officials have seized on the distinction between the treatment of asylum claimants caught crossing the border versus those presenting themselves at sanctioned ports of entry to depict the former category as criminals. D.H.S. spokesperson Tyler Houlton recently said, “There is no policy to separate those seeking asylum at a port of entry.” But according to multiple reports, undocumented immigrants who appear at these ports are often turned away or detained. “Contrary to what D.H.S. has indicated as proper procedure, we are currently seeing cases where immigrant families seeking asylum are separated after lawfully presenting themselves at a U.S. port of entry,” Senator Flake said in a statement accompanying his letter. In some cases, it appears that immigrants’ claims are simply rejected—a result, perhaps, of the Trump administration’s institutional skepticism toward asylum claims. Sessions has previously criticized the asylum process, asserting in a speech last October that “dirty immigration lawyers” provide applicants with “the magic words needed to trigger the credible fear process.” On Monday, Nielsen declared, “Our system for asylum is broken.”

No, asylum law isn’t broken — except that it has been applied far too narrowly, begrudgingly, and often in the absence of common sense, humanity, principles, and due process leading to unnecessary inconsistencies and backlogs in a system that has not been allowed to fully function in a way that fulfills its humanitarian purposes. Instead of designing the asylum system to efficiently screen out the minority of applicants who don’t really qualify as refugees, and grant some type of protection to the majority, the system is now engaged in manipulating and intentionally misconstruing the law and falsifying or distorting facts to disqualify or deny legitimate refugees fleeing for their lives. The idea being pushed by our White Nationalist regime is to create and support a false narrative that the majority of refugees arriving here and applying for asylum aren’t “really refugees.” But, they are. 

What is broken is the group of  corrupt, dishonest, ignorant, and incompetent political hacks who are administering and intentionally destroying our asylum and refugee systems today. Removing this regime and their enablers from office at the ballot box will a long difficult process. But, until it is accomplished, we will not regain our humanity as a nation and we certainly will not be able to put any fair, workable, legal system of immigration controls that serves our real national interests in place.

Our democratic institutions are dissolving right before our eyes. But, the responsibility for that is clearly and solely upon our Executive and Legislative Branches which are all controlled by the Trump GOP. Don’t let them get away with unloading their responsibility on the rest of us who are resisting tyranny and trying to do the right thing (something that never, ever, occurs to anyone associated with Trump).
