It is not news that the Republican Party has a stagnant governing agenda cobbled together from the long-discredited dogmas and shibboleths of the conservative movement. “The current iteration of the G.O.P. is indifferent to the substance of government,” Steve Benen, a political writer and producer for The Rachel Maddow Show on MSNBC, writes in “The Impostors: How Republicans Quit Governing and Seized American Politics”:

It is disdainful of expertise and analysis. It is hostile toward evidence and arithmetic. It is tethered to few, if any, meaningful policy preferences. It does not know, and does not care, about how competing proposals should be crafted, scrutinized or implemented.

What is news is the extent to which the Republican Party has embraced the trappings of its leader, which is to say, the trappings of a right-wing cable news network: a nonstop parade of conspiracy, demagogy and grievance, in service to a cult of personality, all for the sake of a politics of plunder, theft and extraction.

Pretty good explanation of The Party of Trump (formerly known as “The Party of Lincoln”). 

My question is why the so-called “mainstream media” (excluding Jamelle and a few others) handles with “kid gloves” folks like Nikki Haley, Tim Scott, and Melania, who go on national TV and present knowingly bogus, totally disingenuous, fabricated portraits of Trump as a benign presence in U.S. politics. In a vain, continuing search for “normalization” of overt 21st century Jim Crow nationalist fascism, the “mainstreams” appear ready to credit speaking in complete, largely grammatical, sentences in the English language and not screaming racist tropes or absurdist internet conspiracy theories as all that is necessary to be considered “credible” and a “moderating force” in today’s “Trumpized” GOP!

The disingenuous treatment by the “mainstreams” of dishonest attempts to “soften” Trump’s true “Mini-Mussolini” persona as election-season gimmick is a gross dis-service to the public welfare and the abdication of the duty of courageous independent journalism to provide critical coverage — not just regurgitate RNC propaganda!

Why are “the mainstreams” rolling over for the RNC?

🏴‍☠️☠️🤮⚰️👎KAKISTOCRACY KORNER: SPOTLIGHT ON AMERICA’S MOST DANGEROUS HATE GROUP: THE RNC!

This past weekend, the Republican National Committee caved to white supremacist and other hate groups by adopting a resolution titled Refuting the Legitimacy of the Southern Poverty Law Center to Identify Hate Groups.

The focus of the resolution is that “the SPLC is a radical organization” that harms conservative organizations and voices through our hate group designations.

This attack on our work is an attempt to excuse the Trump administration’s pattern and practice of working with individuals and organizations that malign entire groups of people — immigrants, Muslims and the LGBTQ community — while promoting policies that undermine their very existence. It comes from the same vein as Trump’s claim that there were “very fine people” on both sides of the 2017 Unite the Right rally in Charlottesville.

Simply put, it’s an audacious attempt by Trump and the GOP to paper over the bigotry and racism that has been allowed to infect their policies.

This resolution comes at a moment when Trump will argue at the Republican National Convention that he will combat hate and bigotry, despite welcoming the support of QAnon. It also comes days after the indictment of Stephen Bannon, reminding us that Bannon was once the White House chief strategist and senior counselor and CEO of Trump’s 2016 presidential campaign. And it comes just after our special investigation shined a light on One America News Network’s Jack Posobiec, a reporter at Trump’s favorite network who is aligned with white supremacy and has used his platform to further hate speech and propaganda.

Trump should sever these ties to hate groups and extremists instead of doubling down through this RNC resolution.

The Trump administration has filled its ranks and consulted with alumni and allies from the Federation for American Immigration Reform, an anti-immigrant hate group that has ties to white supremacist groups and eugenicists. They include Julie KirchnerKris KobachJeff Sessions and, most notably, Stephen Miller.

The Trump administration has worked with hate groups like the Family Research Council (FRC) to roll back LGBTQ rights. FRC was designated an anti-LGBTQ hate group for decades of demonizing LGBTQ people and spreading harmful pseudoscience about them. Over the years, the organization has published books, reports and brochures that have linked being LGBTQ to pedophilia, claimed that LGBTQ people are dangerous to children and claimed that LGBTQ people are promiscuous and violent.

Anti-Muslim groups have also been welcomed into the administration, including the Center for Security Policy (CSP)Fred Fleitz, a longtime staffer, was appointed the executive secretary and chief of staff of the National Security Council. For decades, CSP has peddled absurd accusations that shadowy Muslim Brotherhood operatives have infiltrated all levels of government.

These extremists are seeking a license to continue spreading their bigotry and will do anything to undermine those — like the SPLC, which tracks and monitors hate groups — who expose their extremist views and oppose their attacks on communities. With this resolution, Trump and members of the GOP have shown the extent to which they will carry their water.

This past weekend, the RNC also released a resolution titled Resolution to Conserve History and Combat Prejudice – Christopher Columbus. It’s a remarkably transparent statement that hate and bigotry stem from Black Lives Matter protesters. The RNC and Trump did not denounce organizations that promote antisemitism, Islamophobia, neo-Nazis, anti-LGBTQ sentiment or racism. It only criticized the SPLC for challenging those groups.

If there’s one thing you can say about President Trump and his administration, it’s that nothing is regular except the irregular, which has had myriad damaging consequences for the nation. And it’s had particularly adverse consequences for the federal government’s ability to defend itself in court.

The latest example comes in the criminal case against Trump’s first, short-tenured national security adviser, Michael Flynn. He pleaded guilty — not once but twice — to charges that he had lied to FBI agents during an interview about his conversations with senior Russian officials during the presidential transition. Despite Flynn’s admissions of guilt, Attorney General William P. Barr filed a motion asking that the case be dismissed — and supporting Flynn’s effort to have that done without even a hearing before the district judge.

Flynn won before an appeals court panel. But when the full court of appeals heard arguments on Flynn’s petition, the judges couldn’t have seemed more bewildered at the Trump administration’s position. The government argued that the district judge couldn’t inquire into the government’s reasons for seeking dismissal even if he’d seen the prosecutor take a bribe, in open court, in exchange for dismissing the case.

The Trump administration has been saying things like that a lot lately — trying to stretch the law in ways that undermine its remaining credibility. It argued that a sitting president’s accountants and bankers can’t be subpoenaed for his personal records during his term in office by either a state grand jury or, without meeting an impossibly high burden, by Congress. It argued that the president’s close aides can’t be called to testify before a congressional committee investigating presidential misconduct. The least trustworthy administration in decades, if not ever, keeps arguing: “You’ve just got to trust us.”

Lawyers have a phrase for the government’s saying “Trust us.” It’s called the “presumption of regularity.” The presumption of regularity means that courts should presume that government officials acted through a “regular” process: that it carefully vetted its policy and scrupulously examined relevant legal precedents.

 

But, as its name suggests, the presumption of regularity rests on the premise that the government is functioning in a regular way. And the Trump administration is anything but regular. Following the cues of a chief executive who despises what he calls the “deep state,” administration officials have cut corners, displaced career professionals, exiled dissenters and abandoned institutional norms — in short, circumvented the very processes that justify the presumption of regularity in the first place.

 

The chickens have now come home to roost. Whether they say so explicitly or not, courts have been dispensing with the presumption of regularity. The best example: In the litigation over the 2020 Census, the Supreme Court held that Commerce Secretary Wilbur Ross’s decision to add a citizenship question to the census form was arbitrary and capricious. The reason? “Altogether,” Chief Justice John G. Roberts Jr. wrote, “the evidence does not match the explanation the secretary gave for his decision.” That’s just a polite lawyer’s way of saying Ross lied.

Examples of the administration’s disrespect for regularity are legion, and not just confined to litigated matters. Barr has acted as a virtual one-man band of irregularity: He forced the U.S. attorney in Washington, Jessie K. Liu, out of her job, thereby enabling him to countermand former special counsel Robert S. Mueller III’s sentencing recommendation for Roger Stone. And Barr gave a transparently false account of the Mueller report in the week before it was released to the public.

Perhaps the most disturbing thing is that Billy the Bigot actually “runs” a so-called “court system” — the U.S. Immigration Court — that has life or death authority over some of the most vulnerable individuals in our society, indeed in the world! How this stunning violation of both the Fifth Amendment and fundamental human decency (not to mention basic principles of competent management and good governance) continues to grind humanity into a grisly mess 🤮 of human misery ☠️ in plain sight every day is beyond me!

Almost everything in this “spot on” op-ed echoes “Courtside.” I have consistently criticized the irresponsibility and the gross dereliction of Constitutional duty by a Supremes majority that all too often treats Trump’s patently false, racist, xenophobic, and invidious immigration, refugee, and asylum policies as the actions of a “normal Executive” when Trump is nothing of the sort.

Nor does he even claim to be! He ran on overtly racist and hate-driven policies and has promoted racist tropes and lies about immigrants at every turn. Yet, the Supremes often pretend that there is some “legitimate basis” for clearly illegitimate policies and abrogation of important laws without the involvement of Congress and of Constitutional protections without any reasonable, fact-based justification.

If the “chickens have come home to roost” for the corrupt Trump DOJ, so will they eventually come home to roost for Supremes who have disingenuously and intentionally looked the other way and have enabled, or in some cases even encouraged, Trump’s racist and lie-driven dismantling of American democracy and “Dred Scottification” of “the other.” Life tenure protects the jobs of derelict Federal Judges. But, it won’t protect their reputations from the truth of history.

COVID-19 has exploded at migrant detention centers nationwide, infecting detainees and employees alike and seeding the disease aboard deportation flights to countries ill-equipped to respond, especially in Latin America. The facilities, run by U.S. Immigration and Customs Enforcement, are petri dishes of contagion, and the residents — many of whom have no serious criminal record — are sitting ducks in the crosshairs of an inhumane policy.
A federal judge has ordered the release of migrant children at two ICE family detention centers in Texas and one in Pennsylvania, having found them at risk to the virus and to spotty enforcement of safety measures. But across the country, scores more facilities have been hit hard by the pandemic, and ICE has been unable to contain it.

Roughly 1,000 new covid-19 cases have been diagnosed in ICE facilities since early July, bringing the number who have tested positive for the disease since March to roughly 4,000. That’s roughly a fifth of all those who have been tested, though some were infected before ICE took them into custody.
Courts have ordered more than 500 at-risk detainees released, and ICE has released an additional 900 at its own initiative. Those reductions, along with ongoing deportations, have cut the detainee population by 40 percent since March, to roughly 22,000 now. That’s good, but it is clear that the agency’s steps to mitigate the outbreak have been inadequate. It is also clear that testing at the facilities has lagged, proper distancing at some is insufficient, and health care is not equal to the task of containment. At the Farmville Detention Center in Virginia, west of Richmond, nearly two-thirds of 400 detainees have tested positive for the virus in recent weeks.
Moreover, ICE has been complicit in accelerating the pandemic’s reach into Central America, the Caribbean and elsewhere, by deporting tens of thousands of migrants since the spring, including some who were infected. At least a dozen countries assert that deportees arrived with the virus.
Many were not tested before boarding the flights. On one deportation flight to India in May, 22 passengers — about 15 percent of those onboard — tested positive upon arriving in India. In Guatemala, authorities say more than 160 deportees who have arrived since April tested positive for the virus. “We understand the United States wants to deport people,” said Guatemalan President Alejandro Giammattei in May. “What we don’t understand is why they send us all these contaminated flights.”

Advocates and public health officials have urged ICE to accelerate the release of at-risk detainees, who can be fitted with ankle monitors to encourage their appearance at immigration court proceedings. ICE has done some of that; it is critical that it do more.
To continue detaining nonviolent detainees as the virus tightens its grip on ICE facilities is pointless and dangerous — for detainees and for employees, scores of whom have been infected with covid-19. It’s past time for ICE to intensify the fight against covid-19, and reassess a policy that has failed to contain a pandemic behind bars.

Expecting ICE to do the right thing without being ordered to do so by Congress or the Federal Courts is absurd. We’re in the middle of a deadly meltdown of our democratic institutions.

And, led by the Roberts’ Court’s spineless complicity in the face of clear unconstitutionality, illegality, immorality, and inhumanity from the Trump regime, the failure of the Federal Courts to take a strong, unified approach against the “crimes against humanity” committed by the Trump regime on migrants and others is a national disgrace. Something we have to consider as a nation moving forward.

Better judges for a better America! Time to stop appointing “Dred Scottifyers” and non-believers in due process, human rights, and equal justice for all to our life-tenured courts! The damage they have done will take decades to repair. We can’t afford to continue the GOP’s recent tradition of elevating bad judges who won’t stand up for and don’t believe in American democracy.

When our nation is experiencing massive and deadly institutional failure and a failure of legal and moral leadership, we must start looking at the qualifications and values (or in some cases the rather obvious lack thereof) of the folks in those failing institutions! In a democracy, bad leadership doesn’t “drop out of the sky.” It’s a product of bad decisions and apathy among those with the power to select our leaders. That means all of us who can vote or encourage others to vote.

This November, vote like your life and the future of our democracy depend on it! Because they do!

(CNN)Attorney General Bill Barr’s written opening statement to the House Judiciary Committee was replete with mischaracterizations, fallacies and unnerving stereotypes that run afoul of the principle of equal justice — and which, taken together, show how he has transformed the Department of Justice that enforces the law to a department that undermines the rule of law.

These are but a few lines that should evoke a visceral reaction to the views of a man who sits at the helm of the most powerful prosecutorial office in the country.

1. “Ever since I made it clear that I was going to do everything I could to get to the bottom of the grave abuses involved in the bogus ‘Russiagate’ scandal, many of the Democrats on this Committee have attempted to discredit me by conjuring up a narrative that I am simply the President’s factotum who disposes of criminal cases according to his instructions.”

No, Attorney General Barr, you are not being accused of being a factotum, colloquially defined as a handyman. You stand accused of being a henchman who acts not only under the President’s instructions but, perhaps more nefariously, exclusively in the President’s interests. And what conveys this impression is not a deceptive narrative crafted by the Democratic members of the House Judiciary Committee, but rather your own conduct.

Case in point: undermining career prosecutors in what appears to clearly be the interests of President Donald Trump. Not once can I recall an attorney general weighing in on a career prosecutor’s sentencing recommendations for a defendant convicted of multiple felonies by a jury. Yet, this appears to be an increasingly frequent endeavor by this Attorney General on behalf of Trump associates, including, most recently former National Security Adviser Michael Flynn and the President’s long-time friend Roger Stone.

The disturbing trend is underscored by the fact that the one convicted felon who has fallen out of the President’s favor, Trump’s former lawyer Michael Cohen, felt the knife twisted rather than removed when the Justice Department recently, albeit briefly, sent him back to prison under questionable 

And Barr’s misuse of terms continues with the use of the term “Russiagate.” The use of the suffix “gate” insinuates that it is conspiratorial, farcical and worthy of derision. And yet, the Attorney General has confirmed, as recently as today’s colloquy with Louisiana Rep. Cedric Richmond, that Russia did interfere with the past presidential election and will presumably continue to interfere with our upcoming presidential election. Perhaps the nod to conspiracy theorists was inadvertent in light of overwhelming evidence he fails to dispute.

2. “Like his predecessors, President Trump and his National Security Council have appropriately weighed in on law-enforcement decisions that directly implicate national security or foreign policy, because those decisions necessarily involve considerations that transcend typical prosecutorial factors.”

No one doubts the propriety of the President of the United States and members of his National Security Council to get involved in cases that directly implicate the national security of this nation or those matters that directly relate to our foreign policy interests. What is in doubt is whether Barr’s defense of deploying federal agents to US cities is anything more than a pretextual reason to infringe upon the constitutional rights of Americans, namely their First Amendment rights to assemble and to protest their grievances with the government. A bald assertion of a national security interest does not absolve the executive branch from having to provide an appropriate and lawful justification when constitutional rights are implicated. And yet Barr has offered no compelling reason.

3. “I had nothing to prove and had no desire to return to government. … When asked to consider returning, I did so because I revere the Department and believed my independence would allow me to help steer her back to her core mission of applying one standard of justice for everyone and enforcing the law even-handedly, without partisan considerations.”

This is just laughable. He had no desire to return to the government? I have a June 2018 memo that says otherwise. It was entirely unsolicited, offered Barr’s insight on special counsel Robert Mueller’s handling of an investigation into Russia’s interference in our presidential election and read like a solicitation for a job. And lo and behold, he got his wish. Now, Barr has launched an investigation into the origins of what he calls “Russiagate” that seems to track the very outline he presented when he, ahem, had no desire to put skin in the game.

Barr’s suggestion that he was compelled to return to the helm out of a sincere interest to restore the objectivity and credibility of the Department of Justice is belied by his decision-making. His sentencing decisions that seem to show political favor, his failure to justify the use of force against peaceful protestors and his involvement in the removal of Geoffrey Berman, the former Attorney General for the Southern District of New York, comprise just a handful of the many instances where his conduct has undermined — not restored — the credibility of the Justice Department.

It’s a familiar pattern. After “stonewalling” Congressional oversight, Administration Kakistocrat finally shows up and arrogantly spews lies, misrepresentations, and false narratives under oath. Dems spend their time lecturing and pontificating, but don’t create the factual record for a subsequent perjury prosecution. (Ask yourself: What if Laura Coates were doing the questioning?)

GOP toadies in Congress “circle the wagons” and double down on the lies showing their complete contempt for truth, human decency, and good governance.

We already knew Barr was a shady character and that the GOP is unfit for any office in any branch. So, this hearing didn’t really accomplish much.

But it does demonstrate the absolute necessity for the majority of us who want to save our nation to get out the vote to remove Trump and the GOP at every level 🧹 in November. 

This November, vote like your life depends on it! Because it does! Another four years of Trump’s racist malicious incompetence and the GOP kakistocracy could kill us all (including the truth-impervious Trumpsters and GOP toadies willing to seek the end of our democracy)! THE GREAT CLIMATE MIGRATION

Early in 2019, a year before the world shut its borders completely, Jorge A. knew he had to get out of Guatemala. The land was turning against him. For five years, it almost never rained. Then it did rain, and Jorge rushed his last seeds into the ground. The corn sprouted into healthy green stalks, and there was hope — until, without warning, the river flooded. Jorge waded chest-deep into his fields searching in vain for cobs he could still eat. Soon he made a last desperate bet, signing away the tin-roof hut where he lived with his wife and three children against a $1,500 advance in okra seed. But after the flood, the rain stopped again, and everything died. Jorge knew then that if he didn’t get out of Guatemala, his family might die, too.

Even as hundreds of thousands of Guatemalans fled north toward the United States in recent years, in Jorge’s region — a state called Alta Verapaz, where precipitous mountains covered in coffee plantations and dense, dry forest give way to broader gentle valleys — the residents have largely stayed. Now, though, under a relentless confluence of drought, flood, bankruptcy and starvation, they, too, have begun to leave. Almost everyone here experiences some degree of uncertainty about where their next meal will come from. Half the children are chronically hungry, and many are short for their age, with weak bones and bloated bellies. Their families are all facing the same excruciating decision that confronted Jorge.

The odd weather phenomenon that many blame for the suffering here — the drought and sudden storm pattern known as El Niño — is expected to become more frequent as the planet warms. Many semiarid parts of Guatemala will soon be more like a desert. Rainfall is expected to decrease by 60 percent in some parts of the country, and the amount of water replenishing streams and keeping soil moist will drop by as much as 83 percent. Researchers project that by 2070, yields of some staple crops in the state where Jorge lives will decline by nearly a third.

Scientists have learned to project such changes around the world with surprising precision, but — until recently — little has been known about the human consequences of those changes. As their land fails them, hundreds of millions of people from Central America to Sudan to the Mekong Delta will be forced to choose between flight or death. The result will almost certainly be the greatest wave of global migration the world has seen.

In March, Jorge and his 7-year-old son each packed a pair of pants, three T-shirts, underwear and a toothbrush into a single thin black nylon sack with a drawstring. Jorge’s father had pawned his last four goats for $2,000 to help pay for their transit, another loan the family would have to repay at 100 percent interest. The coyote called at 10 p.m. — they would go that night. They had no idea then where they would wind up, or what they would do when they got there.

From decision to departure, it was three days. And then they were gone.

Our modeling and the consensus of academics point to the same bottom line: If societies respond aggressively to climate change and migration and increase their resilience to it, food production will be shored up, poverty reduced and international migration slowed — factors that could help the world remain more stable and more peaceful. If leaders take fewer actions against climate change, or more punitive ones against migrants, food insecurity will deepen, as will poverty. Populations will surge, and cross-border movement will be restricted, leading to greater suffering. Whatever actions governments take next — and when they do it — makes a difference.

The window for action is closing. The world can now expect that with every degree of temperature increase, roughly a billion people will be pushed outside the zone in which humans have lived for thousands of years. For a long time, the climate alarm has been sounded in terms of its economic toll, but now it can increasingly be counted in people harmed. The worst danger, Hinde warned on our walk, is believing that something so frail and ephemeral as a wall can ever be an effective shield against the tide of history. “If we don’t develop a different attitude,” he said, “we’re going to be like people in the lifeboat, beating on those that are trying to climb in.”

President Trump granting clemency to his crony Roger Stone, who served as the go-between for the Trump campaign and WikiLeaks, on practically the eve of Stone’s incarceration for multiple crimes attendant to his coverup on behalf of the president, is grotesquely corrupt but unsurprising. Stone virtually confessed to a quid pro quo, telling Howard Fineman, “He [Trump] knows I was under enormous pressure to turn on him. It would have eased my situation considerably. But I didn’t.” Silence for clemency. A separate system of justice for the president’s henchmen. This is the very definition of corruption.

“By this action, President Trump abused the powers of his office in an apparent effort to reward Roger Stone for his refusal to cooperate with investigators examining the President’s own conduct,” House Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) and Oversight and Reform Committee Chairwoman Carolyn B. Maloney (D-N.Y.) said in a written statement released Friday. “No other president has exercised the clemency power for such a patently personal and self-serving purpose.”

Stone’s clemency should remind all Americans of the necessity of removing Trump at the ballot box and seeking a full accounting of Attorney General William P. Barr’s role in running interference for the president (e.g., spinning the Mueller report, turning a blind eye toward criminality in the Ukraine scandal, intervening to block Stone’s and Michael Flynn’s punishments). It should remind voters that if not for the spinelessness of every Republican senator save Utah’s Mitt Romney, Trump would not have survived impeachment to seek vengeance on witnesses (e.g., Lt. Col. Alexander Vindman), corruptly protect his friends and incompetently manage a pandemic, leading to the unnecessary deaths of tens of thousands. With the pardon of Stone, we can affirm that Maine Republican Sen. Susan Collins’s assertion that he learned his lesson from impeachment was delusional.

However, we will need far more than an electoral shellacking of Republicans to address the damage Trump has done to the Justice Department and the rule of law. Ten simple measures would begin to repair our justice system:

1. A thorough redo of the special counsel/independent counsel law is necessary. The counsel’s final report should be issued to Congress and/or the courts, depriving a potentially corrupt attorney general or president the opportunity to pre-edit or spin it. Additional legislation should clarify that a special counsel is empowered to make specific findings of illegality. The DOJ guidelines preventing prosecution of the president while still in office should be revisited.

2. Congress must reassert the power of the purse. The executive branch must report all holds/impounds on congressionally appropriated funds. “Emergency” powers should be reexamined, tightened and clarified to prevent the sort of unilateral misappropriation of funds we saw regarding the wall.

3. Severe criminal penalties should be exacted for revealing the identity of whistleblowers or threatening and/or punishing federal employees for providing truthful testimony.

4. A new, speedy enforcement mechanism is required for contempt of Congress citations, allowing lawmakers to get a swift and definitive resolution of its conflicts with the executive branch.

5. We need a barrier between the White House and Justice Department to prevent political interference in specific cases, targets of investigation and prosecutorial recommendations. Any such communications must be logged and made available to the inspector general and/or Congress.

WASHINGTON, DC — The American Immigration Lawyers Association (AILA) condemns the Trump administration’s recent ramp-up of efforts to turn the immigration court system into an enforcement tool rather than an independent arbiter for justice. The immigration courts are formally known as the Executive Office for Immigration Review (EOIR) and are overseen by the Department of Justice (DOJ).

AILA President Jennifer Minear, noted, “AILA has long advocated for an independent immigration court, one that ensures judges serve as neutral arbiters of justice. This administration has instead subjected the courts to political influence and exploited the inherent structural flaws of the DOJ-controlled immigration courts, which also prosecutes immigration cases at the federal level. The nail in the coffin of judicial neutrality is the fact that the administration has put the courts in the control of a new Chief Immigration Judge who has no judicial experience but served as ICE’s chief immigration prosecutor. No less concerning is DOJ’s recent choice for Chief Appellate Immigration Judge – an individual who also prosecuted immigration cases and advised the Trump White House on immigration policy. This administration continues to weaponize the immigration courts for the sole purpose of accelerating deportations rather than dispensing neutral justice. Congress must investigate these politically motivated appointments and pass legislation to create an independent, Article I immigration court.”

As a friend and former colleague said recently “I would have thought that the one thing everyone could get behind, regardless of political philosophy, would be a neutral court system.” Sadly, not so in today’s crumbling America.

There are three groups blocking the way:

  • The Trump Administration, where due process only applies to Trump and his corrupt cronies;
  • GOP legislators whose acquittal of Trump against the overwhelming weight of the evidence shows exactly what due process means to them;
  • Five GOP-appointed Justices on the Supremes who don’t believe that due process applies to all persons in the US, notwithstanding the “plain language” of Article 5 of our Constitution — particularly if those persons have the misfortune to be asylum seekers of color.

The end result is “Dred Scottification” — that is, dehumanization or “de-personification” of “the other.” The GOP has made it a centerpiece of their failed attempt to govern, from voter suppression, to looting the Treasury for the benefit of the rich and powerful, to immunity for law enforcement officers who kill minorities, to greenlighting cruel, inhuman,and counterproductive treatment of lawful asylum seekers and immigrants. Not surprisingly, this essentially “Whites Only” view of social justice is ripping our nation apart on many levels.

I find it highly ironic that at the same time we are rightfully removing statutes of Chief Justice Roger Taney, a racist who authored the infamous Dred Scott Decision, Chief Justice Roberts and four of his colleagues continue to “Dred Scottify” asylum seekers and other immigrants, primarily those of color, by denying them the due process, fundamental fairness, fair and impartial judges, and, perhaps most of all, racist-free policies that our Constitution demands! 

Compare the “due process” afforded Trump by the GOP Senate and the pardon of a convicted civil and human rights abuser like “Racist Sheriff Joe” with the ugly and dishonest parody of due process afforded Sister Norma’s lawful asylum seekers whose “crime” was seeking fair treatment, justice, and an acknowledgement of their humanity from a nation that has turned it’s back on those values.

What Sister Norma’s article did not mention is that those who survive in Mexico long enough to get to “court” have their asylum claims denied at a rate of about 99% by an unfair system intentionally skewed and biased against them. Most experts believe that many, probably a majority, of those being denied actually merit protection under a fair and impartial application of our laws. 

But, as pointed out by AILA, that’s not why Billy the Bigot has appointed prosecutors as top “judges” and notorious asylum deniers as “appellate judges.” He intends to perpetuate a highly unfair “deportation railroad” designed by infamous White Nationalist racist Stephen Miller. In other words, our justice system is being weaponized in support of an overtly racist agenda formulated by a racist regime that has made racism the centerpiece of its pitch for remaining in office. Incredible! Yet true!

The Supremes have life tenure. But, the other two branches of our failing Government don’t. And, a better Executive and a better Legislature that believe in our Constitution and equal justice for all is a necessary start on a better Federal Judiciary — one where commitment to due process, fundamental fairness, and equal justice for all is a threshold requirement for future judicial appointments. Time to throw the “non-believers” and their enablers out of office.

Upon hearing Donald Trump declare his candidacy for President, I turned to my wife Cathy and said “The guy is totally without values and redeeming qualities.” While I didn’t get the outcome of the election right, I nailed the Trump kakistocracy. If anything, it’s been much worse than my bleak outlook. 

Who would have thought that our un-President would dance on the graves of 130,000 dead Americans while urging his followers to “drink the Kool-Aid?” Who would have believed that our supposed leader would urge the maximum spread of deadly disease, intentionally overload an already stressed healthcare system, while looking to insure thousands of unnecessary deaths and disabilities by maliciously seeking to ax health insurance for some of America’s most vulnerable? With a “Jim Jones style” false leader like this, who needs enemies?

But, speaking of “enemies,” why not suck up to Putin while turning against long-time allies like the EU, Canada, and Mexico? Why not give the PRC an opening to subsume Hong Kong, while increasing its influence in Africa, Latin America, and the Caribbean as U.S. foreign policy crumbles?

Worldwide pandemic — embrace it. Climate change — deny it. Inevitable increase in worldwide migration driven by the preceding — build walls and prisons. High unemployment — end the Federal supplement. Failing bridges and unsafe highways — who cares. Falling revenues — cut taxes for the rich and services for the poor. Institutional racism — double down and glorify past racists. Voting rights — suppress them. Police brutality — enable it. Free speech —punish it. Environmental degradation — deregulate. Truth — be damned. Human decency — mock it. Justice — only for some. Reports of bounties on American soldiers — look the other way. Hate crimes — encourage them. Trump’s “malicious incompetence,” cruelty, corruption, and downright stupidity is endless and on public display every day.

Now, with no message of hope, healing, improvement, or a better future for all Americans and the world, Trump spews and babbles the only things he actually stands for (other than his own self-aggrandizement): hate and racism. Is this “Know Nothing/KKK Redux” really the message on which the GOP seeks to govern in 21st Century America? Outrageously, the answer clearly is “yes,” even if the Tim Scotts, Clarence Thomases, Herman Cains, and Ben Carsons of the world feign ignorance or believe that their privileged positions will save them, if not their souls.

For the rest of us, the time has come to rise up and throw the imposter out. Joe Biden might not be the “perfect candidate.” Has there ever been such a thing? As humans, we all have our warts and past mistakes. But, unlike Trump, Biden has a message and a plan for healing America, correcting long-standing injustices, and moving forward.

Biden’s July 4 message emphasized the positives that will make a better future for all in America, regardless of race, religion, status, or economic power:

  • Enhancing voting rights and maximizing participation in elections;
  • Safeguarding elections from Putin and other corrupt foreign governments leaders;
  • Reversing inhumane and counterproductive asylum, visa, “baby jails,” and family separation policies; 
  • Reaffirming our identity as a proud nation of immigrants; 
  • Protecting and enhancing judicial independence; 
  • Honoring freedom of the press and independent journalism; 
  • Rooting out institutionalized racism from every part of society where it is now embedded;
  • Leading the world to better times by example, encouragement, and mutual assistance, rather than constantly issuing threats, reacting with childish petulance to every perceived slight, and spewing the ugly, disproven gospel of selfish nationalism, that has nearly destroyed our world in the past, as the vision of the future.

Joe Biden is an accomplished public servant, capable leader, decent human being, and advocate for true American values. He will restore our humanity, reinvigorate our democratic institutions, bring Americans of goodwill together, rebuild our economy, protect our health, care about our environment, address racism and inequality, maximize everyone’s human potential, and reestablish our international political, economic, and moral leadership. 

This is our chance to join together to retake our Government from the forces of darkness and hate and to finally achieve that which our Constitution has demanded for the last century: Equal justice for all. This November, vote like your life, the life of every American, and the future of our world depend on it. Because they do!

Imagine yourself in a foreign land. You don’t speak the language, and you don’t know the rules. You’re arrested for a minor crime. You think you have a plausible defense. But, it could result in capital punishment. You are detained in squalid conditions. You’re hauled before a court. The bond is ludicrously high, set by the prosecutor and judge under rules they make up as they go along. You don’t have a lawyer because you can’t afford one. The “judge” is appointed by the chief prosecutor. The judge herself is a former prosecutor. The prosecutor makes the rules. 

If you win, the prosecutor can appeal to a body stacked in his or her favor. If you lose, you can appeal to a tribunal hand-selected by the chief prosecutor because of their harshness and votes to convict more than 90% of the time. If, against those odds, you still win acquittal, the chief prosecutor can take over the case, rewrite the rules, and change the verdict to guilty. In the meantime, you’ll remain imprisoned in the “Gulag.”

Doesn’t sound like much fun does it? Am I describing something out of a third-world dictatorship or a Kafka novel?  Absolutely not! This system operates right here in our United States of America, right now.

It’s chewing up and spitting out the lives of men, women, and even children who are supposed to receive due process and fundamental fairness and instead get the exact opposite. It’s enabled by Supreme Court Justices, Federal Judges, legislators, and public officials who won’t stand up for the legal and Constitutional rights of migrants and asylum seekers in the face of grotesque Executive abuses.

It’s called the U.S. Immigration Court. It exists in a “Constitution & humanity-free zone.” It’s run by Chief Prosecutor Billy Barr and his subordinates at the U.S. Department of Justice (“DOJ”). It’s not really a “court” at all, by any rational definition. 

No, it’s a national disgrace and an intentional perversion of the constitutional right to due process, fundamental fairness, and human dignity. It’s also an unmitigated management disaster where DOJ-promoted  “Aimless Docket Reshuffling” (“ADR”) has built an astounding 1.4 million case backlog with cases stretching out beyond the next Administration, even after doubling the number of “judges.” More judges means more backlog in this wacko system.

In the words of my friend and fellow panelist, Ira Kurzban, “this is not normal.” Yet complicit public officials, legislators, and life-tenured Federal Judges continue to “normalize” “America’s Star Chambers” and their biased, race-driven nativist attack on our Constitution and our humanity!

It needs to change. But, all three branches of our government currently lack the courage, leadership, and integrity to make “equal justice under law” a reality rather than just a slogan.

The three things I would do right up front are:

First, remove the Immigration Courts from the DOJ and create an independent, Article I U.S. Immigration Court as recommended by ABA President Judy Perry Martinez, the FBA, the NAIJ, AILA and almost all other true experts in the field.

Second, return the Immigration Courts to their previous noble mission of “through teamwork and innovation, be the world’s best tribunals guaranteeing fairness and due process for all.” End the disgraceful, unlawful, unconstitutional use of the Immigration Courts as a tool of DHS Enforcement, a deterrent, and a weaponized enforcer of a nativist, anti-human-rights agenda.

Third, replace the current highly-biased, one-sided judicial hiring system with a merit-based hiring process that properly weighs and credits demonstrated fairness, scholarship in immigration and human rights, experience representing asylum seekers and other migrants, and involves meaningful public input in judicial selections. Since 2000, the current skewed system has favored prosecutors and other “government insiders” by a ratio of more than 9-1, and has totally excluded private sector candidates from appellate judgeships at the Board of Immigration Appeals (“BIA”).

Our Constitution requires “equal justice for all.” To achieve it, we need public officials, legislators, Supreme Court Justices, and other Federal Judges who actually believe in it. That means real change in all three branches of our failing (and worse) Federal Government. Due Process Forever; Corrupt Officials, Feckless Legislators, and Complicit Courts, Never!

President Trump’s planned address to the nation on race, American Urban Radio’s April Ryan reports, is being written by none other than Stephen Miller, a Trump aide and aficionado of white nationalism.

This is bound to raise a fuhrer. What next? Paul Manafort drafting a presidential address on business ethics?
But Miller can stand down. Trump has already given his remarks on race — many times, in fact. Here they are, entirely in Trump’s own words, excerpted:
I have a great relationship with the blacks. I’ve always had a great relationship with the blacks. Oh, look at my African American over here. Look at him.
Nobody has ever done for the black community what President Trump has done. My Admin has done more for the Black Community than any President since Abraham Lincoln. George [Floyd] is looking down right now and saying this is a great thing that is happening for our country. A great day for him.

Diamond and Silk, you’re so, so great. Thank you, Kanye, thank you. Frederick Douglass is an example of somebody who’s done an amazing job and is getting recognized more and more, I notice.
Think of this: Blacks for Trump, Black Voices for Trump, African Americans for Trump. Call it whatever the hell you want. I have a group of African American guys and gals, by the way, that follow me around, and they think I pay them and I don’t.
A well-educated black has a tremendous advantage over a well-educated white in terms of the job market. If I were starting off today, I would love to be a well-educated black, because I believe they do have an actual advantage. Sadly, because President Obama has done such a poor job as president, you won’t see another black president for generations!

To the African American community, I say what the hell do you have to lose? You’re living in poverty. Your schools are no good. You have no jobs. Fifty-eight percent of your youth is unemployed. Last in crime, last in this, last in homeownership, last in the economy, lowest wages. Our inner cities are a disaster. You get shot walking to the store. They have no education, they have no jobs.

Wouldn’t you love to see one of these NFL owners, when somebody disrespects our flag, to say, “Get that son of a bitch off the field right now”?
Why is so much money sent to the Elijah Cummings district when it is considered the worst run and most dangerous anywhere in the United States? No human being would want to live there. A disgusting, rat and rodent infested mess. Congressman John Lewis should spend more time on fixing and helping his district, which is in horrible shape and falling apart (not to mention crime infested).

So interesting to see ‘Progressive’ Democrat Congresswomen, who originally came from countries whose governments are a complete and total catastrophe. Why don’t they go back and help fix the totally broken and crime infested places from which they came?
Why do we need more Haitians? Why are we having people from all these shithole countries come here? We should have more people from places like Norway.

An ‘extremely credible source’ has called my office and told me that @BarackObama’s birth certificate is a fraud. His grandmother in Kenya said, “Oh, no, he was born in Kenya.” A lot of people do not think it was an authentic certificate.
You ever see Maxine Waters? A low-IQ individual. LeBron James was just interviewed by the dumbest man on television, Don Lemon. He made LeBron look smart, which isn’t easy to do.

What has happened to the respect for authority, the fear of retribution by the courts, society and the police? Let our politicians give back our police department’s power to keep us safe. Unshackle them from the constant chant of “police brutality.” BRING BACK THE DEATH PENALTY AND BRING BACK OUR POLICE!
You also had people that were very fine people on both sides. You had people in that group that were there to protest the taking down of, to them, a very, very important statue and the renaming of a park, from Robert E. Lee to another name. Robert E. Lee was a great general. They’re trying to take away our culture. A Great American Heritage.

I know nothing about David Duke. I know nothing about white supremacists. All Republicans must remember what they are witnessing here — a lynching. I am the least racist person that you’ve ever encountered. I don’t have a Racist bone in my body!

So, you think a speech on race written by neo-Nazi racist Stephen Miller is going to bring the nation together and solve the problem of racial injustice? The very idea is so totally absurd that it shows why we won’t have anything approaching racial justice in America until Trump and the GOP are removed from power.

It can’t happen. The regime won’t allow it. And, we have a Supremes’ majority unwilling to stand up for justice in America. Heck, Trump could claim that an end of laws promoting racial justice is necessary because of COVID-19 and the “JR Five” would say “right on.” In case you haven’t noticed, Trump is a total legislative failure; he merely rules by Executive Decree. And the JR Five doesn’t bat an eye as democracy goes down the drain.

Miller, of course, is the architect of Trump’s White Nationalist racist attack program on the asylum system and other parts of our immigration laws and constitutional due process for persons of color. It’s called “Dred Scottification” or “dehumanization of the other.”

George Floyd was a tragic example, but by no means the only one. Ask separated families, caged kids, asylum applicants returned to constant danger and squalid conditions in Mexico, women and children “orbited” back to face torture and death in the Northern Triangle without hearings, Muslim refugees stuck in horrible camps and separated from families forever, non-criminals suffering in inhumane conditions in the “New American Gulag” primarily because of the color of their skin, Latinos too scared to seek the health care they need and are entitled to because of the “public charge” travesty, “Dreamers” left to twist in the wind so that they can be “bargaining chips”for politicos, or Blacks and Latinos intentionally disenfranchised from having their vote count by the GOP, to name just a few.

Of course, Miller’s real targets are all (non-GOP) people of color — Latino asylum seekers and migrants are just “first in line” because higher Federal Courts seem largely unwilling to recognize and stand up for their legal and Constitutional rights as well as their right to be treated with respect and human dignity. But, you can bet they won’t be the last of “the others” targeted by the Trump/Miller/Barr/Wolf/Cotton White Nationalist agenda.

The bigger problem is that the Trump/Miller racial agenda has “admirers in high places:” None other than John Roberts and four of his GOP-appointed colleagues on the Supremes. When lower Federal Courts have quickly and emphatically quashed the various outrageous White Nationalist assaults on our Constitution, laws, and human decency, the “JR Five” has been right there to intervene. There is no obvious pretext, legally disingenuous argument, or xenophobic racist myth that Trump Toady Solicitor General Noel Francisco can utter that wouldn’t find favor with “The Five.”

They even bend the rules so that Francisco and his ethics-free team of White Nationalist apologists won’t have to go through the trauma of defending their bogus, unethical, and morally repugnant positions in lower Federal Courts, like other “peons” in “The Five’s” twisted, distorted, and privileged legal world are forced to do.

In a show of extreme bias, toadyness, and complete tone-deafness, several Justices have even publicly bemoaned the fact that Trump and Francisco have to deal with the indignity of nationwide injunctions against the regime’s assaults on the rule of law. Why not make unrepresented migrants of color and those with pro bono lawyers have to win before all 600 some Federal District Judges to stop the abuse?

Why would folks with such feeble understanding of due process, asylum law, human rights, what really goes on in Immigration Court, what it’s like to be a lawyer defending migrants in a systemically biased, patently unfair system, and the real human lives and futures being ground into mush by the likes of Miller, Sessions, and Barr even be on the Supreme Court in the first place!

Actually knowing how the law works on human lives, experiencing the practical effects of bad judging, and having represented the most vulnerable trying to make their way through our “intentionally user unfriendly” system is 10x more important for a qualified Justice than an Ivy League law degree and fancy political connections. If we really want “equal justice for all” in America, rather than just another snappy buzz-phrase, we’ve been looking at the wrong candidates for our highest Federal Courts!

Does anyone really think that America would still have “Baby Jails” and “Immigration Star Chambers” if the Justices on our highest Court had actually experienced Professor Phil Schrag’s Baby Jails: The Fight to End The Incarceration of Refugee Children in America?” Of course not! But, “Baby Jails” are alive and well in America today, while the Supremes dither over how else to advance Trump’s agenda. Moral leadership and the courage to “just say no” to tyranny and racism counts! But, you wouldn’t know it by today’s Supremes’ majority.

How do we expect to achieve equal justice for all with a majority of Justices who lack the knowledge and experience to make the Constitution function in the real world? They also lack the human empathy, flexibility, ambition, and philosophical inclination to learn from others and make amends for their past mistakes. By, their often wooden, tone-deaf, and sometimes intentionally incomprehensible jurisprudence they show that they fully intend to retain their blind spots and continue making the same mistakes that promote inequality and injustice until someone stops them.

Of course there is institutionalized racism in America! How can it be otherwise when we have allowed a political party led by an overt racist like Trump to be in charge of our institutions?

Dr. Martin Luther King said “Injustice anywhere is a threat to justice everywhere.” That’s why the murder of George Floyd affects us all.

I understand Dr. King’s message; you understand it. But a majority of the Supremes neither understand it nor are willing to honor it. Until we get a Court where the majority of the Justices actually believe in and stand up for equal justice under law, we won’t achieve it as a nation.

America needs and deserves a better Supreme Court. November is perhaps our last chance to start the process of change that we will need to move our nation forward to a future with equal justice for all. We can’t get there as long as we have a majority of Justices who share, enable, and support Trump’s and Miller’s belief that black, brown, and immigrant lives don’t matter and act accordingly.

The Police Are Rioting. We Need to Talk About It.

It is an attack on civil society and democratic accountability.

If we’re going to speak of rioting protesters, then we need to speak of rioting police as well. No, they aren’t destroying property. But it is clear from news coverage, as well as countless videos taken by protesters and bystanders, that many officers are using often indiscriminate violence against people — against anyone, including the peaceful majority of demonstrators, who happens to be in the streets.

Rioting police have driven vehicles into crowds, reproducing the assault that killed Heather Heyer in Charlottesville, Va., in 2017. They have surrounded a car, smashed the windows, tazed the occupants and dragged them out onto the ground. Clad in paramilitary gear, they have attacked elderly bystanders, pepper-sprayed cooperative protesters and shot “nonlethal” rounds directly at reporters, causing serious injuries. In Austin, Texas, a 20-year-old man is in critical condition after being shot in the head with a “less-lethal” round. Across the country, rioting police are using tear gas in quantities that threaten the health and safety of demonstrators, especially in the midst of a respiratory disease pandemic.

None of this quells disorder. Everything from the militaristic posture to the attacks themselves does more to inflame and agitate protesters than it does to calm the situation and bring order to the streets. In effect, rioting police have done as much to stoke unrest and destabilize the situation as those responsible for damaged buildings and burning cars. But where rioting protesters can be held to account for destruction and violence, rioting police have the imprimatur of the state.

What we’ve seen from rioting police, in other words, is an assertion of power and impunity. In the face of mass anger over police brutality, they’ve effectively said So what? In the face of demands for change and reform — in short, in the face of accountability to the public they’re supposed to serve — they’ve bucked their more conciliatory colleagues with a firm No. In which case, if we want to understand the behavior of the past two weeks, we can’t just treat it as an explosion of wanton violence; we have to treat it as an attack on civil society and democratic accountability, one rooted in a dispute over who has the right to hold the police to account.

African-American observers have never had any illusions about who the police are meant to serve. The police, James Baldwin wrote in his 1960 essay on discontent and unrest in Harlem, “represent the force of the white world, and that world’s real intentions are simply for that world’s criminal profit and ease, to keep the black man corralled up here in his place.” This wasn’t because each individual officer was a bad person, but because he was fundamentally separate from the black community as a matter of history and culture. “None of the police commissioner’s men, even with the best will in the world, have any way of understanding the lives led by the people they swagger about in twos and threes controlling.”

Go back to the beginning of the 20th century, during America’s first age of progressive reform, as the historian Khalil Gibran Muhammad does in “The Condemnation of Blackness: Race, Crime, and the Making of Modern Urban America,” and you’ll find activists describing how “policemen had abdicated their responsibility to dispense color-blind service and protection, resulting in an object lesson for youth: the indiscriminate mass arrests of blacks being attacked by white mobs.”

The police were ubiquitous in the African-American neighborhoods of the urban North, but they weren’t there to protect black residents as much as they were there to enforce the racial order, even if it led to actual disorder in the streets. For example, in the aftermath of the Philadelphia “race riot” of 1918, one black leader complained, “In nearly every part of this city peaceable and law-abiding Negroes of the home-owning type have been set upon by irresponsible hoodlums, their property damaged and destroyed, while the police seem powerless to protect.”

If you are trying to understand the function of policing in American society, then even a cursory glance at the history of the institution would point you in the direction of social control. And blackness in particular, the historian Nikhil Pal Singh argues, was a state of being that required “permanent supervision and sometimes direct domination.”

The simplest answer to the question “Why don’t the American police forces act as if they are accountable to black Americans?” is that they were never intended to be. And to the extent that the police appear to be rejecting accountability outright, I think it reflects the extent to which the polity demanding it is now inclusive of those groups the police have historically been tasked to control. That polity and its leaders are simply rejected as legitimate wielders of authority over law enforcement, especially when they ask for restraint.

Truth is, we have the legal tools to do things like prosecute police misconduct, honor the human and civil rights of African Americans, overcome the years of unfair and discriminatory treatment of African Americans in education, employment, and leadership, promote community cooperation to allow each individual to reach maximum levels of contribution and enjoyment, correct the due process and bias flaws in court systems, tax more rationally and equitably, grant asylum to refugees we are now unfairly and illegally turning away, end inhumane and counterproductive “civil” detention, stop putting disproportionate numbers of minority communities in jail and prison, and end “Dred Scottification” of the other.

What we lack is 1) the honest, courageous, humane, and wise public officials necessary to make the laws and existing tools work; 2) the political will to get those types of officials into the correct offices.

I don’t know how much it would cost. But, whatever it is, we need to invest in it. And some “ready funds” could be made available if we stop building unneeded walls, detention centers, prisons, separating kids, and wasting legal and judicial resources fighting  against the institutional fascism and tyranny of the Trump regime.

This November, vote like your life depends on it! Because it does!

Shouting Into the Institutional Void

Demonstrators are hammering on a hollowed-out structure, and it very well may collapse.

The urban unrest of the mid-to-late 1960s was more intense than the days and nights of protest since George Floyd was murdered by a Minneapolis policeman. More people died then, more buildings were gutted, more businesses were ransacked. But those years had one advantage over the present. America was coming apart at the seams, but it still had seams. The streets were filled with demonstrators raging against the “system,” but there was still a system to tear down. Its institutions were basically intact. A few leaders, in and outside government, even exercised some moral authority.

In July 1967, immediately after the riots in Newark and Detroit, President Lyndon B. Johnson created a commission to study the causes and prevention of urban unrest. The Kerner Commission—named for its chairman, Governor Otto Kerner Jr. of Illinois—was an emblem of its moment. It didn’t look the way it would today. Just two of the 11 members were black (Roy Wilkins, the leader of the NAACP, and Edward Brooke, a Republican senator from Massachusetts); only one was a woman. The commission was also bipartisan, including a couple of liberal Republicans, a conservative congressman from Ohio with a strong commitment to civil rights, and representatives from business and labor. It reflected a society that was deeply unjust but still in possession of the tools of self-correction.

The commission’s report, written by the executive director, David Ginsburg, an establishment liberal lawyer of New Deal vintage, appeared at the end of February 1968. It became an instant million-copy best seller. Its language is bracing by the standards of any era: “What white Americans have never fully understood—but what the Negro can never forget—is that white society is deeply implicated in the ghetto. White institutions created it, white institutions maintain it, and white society condones it.” The report called for far-reaching policy reforms in housing, employment, education, and policing, to stop the country from becoming “two societies, one black, one white—separate and unequal.”

It was too much for Johnson, who resented not being credited for his efforts to achieve civil rights and eradicate poverty, and whose presidency had just been engulfed by the Tet Offensive in South Vietnam. He shelved the report. A few weeks later, on the evening of April 4, Martin Luther King Jr. was killed in Memphis. The next night, Johnson—who had just announced that he wouldn’t run for reelection—spoke to a country whose cities were burning from coast to coast. “It is the fiber and the fabric of the republic that’s being tested,” he said. “If we are to have the America that we mean to have, all men of all races, all regions, all religions must stand their ground to deny violence its victory in this sorrowful time, and in all times to come. Last evening, after receiving the terrible news of Dr. King’s death, my heart went out to his family and to his people, especially to the young Americans who I know must sometimes wonder if they are to be denied a fullness of life because of the color of their skin.” To an aide, he was more blunt in assessing the uprising: “What did you expect? I don’t know why we’re surprised. When you put your foot on a man’s neck and hold him down for 300 years, and then you let him up, what’s he going to do? He’s going to knock your block off.”

King’s murder and the riots it sparked propelled Congress to pass, by an overwhelming and bipartisan margin, the decade’s last major piece of civil-rights legislation, the Civil Rights Act of 1968, which enforced fair standards in housing. Johnson signed it on April 11. It was too late. The very best reports, laws, and presidential speeches couldn’t contain the anger in the streets. That year, 1968, was when reform was overwhelmed by radicalization on the left and reaction on the right. We still live in the aftermath. The language and ideas of the Kerner Report have haunted the years since—a reminder of a missed chance.

The difference between 1968 and 2020 is the difference between a society that failed to solve its biggest problem and a society that no longer has the means to try. A year before his death, King, still insisting on nonviolent resistance, called riots “the language of the unheard.” The phrase implies that someone could be made to hear, and possibly answer. What’s happening today doesn’t feel the same. The protesters aren’t speaking to leaders who might listen, or to a power structure that might yield, except perhaps the structure of white power, which is too vast and diffuse to respond. Congress isn’t preparing a bill to address root causes; Congress no longer even tries to solve problems. No president, least of all this one, could assemble a commission of respected figures from different sectors and parties to study the problem of police brutality and produce a best-selling report with a consensus for fundamental change. A responsible establishment doesn’t exist. Our president is one of the rioters.

After half a century of social dissolution, of polarization by class and race and region and politics, there are no functioning institutions or leaders to fail us with their inadequate response to the moment’s urgency. Levers of influence no longer connect to sources of power. Democratic protections—the eyes of a free press, the impartiality of the law, elected officials acting out of conscience or self-interest—have lost public trust. The protesters are railing against a society that isn’t cohesive enough to summon a response. They’re hammering on a hollowed-out structure, and it very well may collapse.

If 2020 were at all like 1968, the president would go on national television and speak as the leader of all Americans to try to calm a rattled country in a tumultuous time. But the Trump administration hasn’t answered the unrest like an embattled democracy trying to reestablish legitimacy. Its reflex is that of an autocracy—a display of strength that actually reveals weakness, emptiness. Trump’s short walk from the White House to St. John’s Episcopal Church had all the trappings of a strongman trying to show that he was still master of the country amid reports that he’d taken refuge in a bunker: the phalanx of armored guards surrounding him as he strutted out of the presidential palace; the tear gas and beatings that cleared his path of demonstrators and journalists; the presence of his daughter, who had come up with the idea, and his top general, wearing combat fatigues as if to signal that the army would defend the regime against the people, and his top justice official, who had given the order to raid the square.

William Barr has reacted to the killing of George Floyd like the head of a secret-police force rather than the attorney general of a democratic republic. His first act was not to order a federal investigation into the Minneapolis Police Department, but—as he’s done before—to rush out ahead of the facts and try to control public opinion, by announcing that the violence following Floyd’s death was the work of left-wing agitators. Streets of the nation’s capital are now blocked by security forces from Barr’s Department of Justice—many from the Federal Bureau of Prisons—wearing uniforms that make them impossible to identify, like paramilitary troops with unknown commanders.

The protests have to be understood in the context of this institutional void. They resemble the spontaneous mass cry of a people suffering under dictatorship more than the organized projection of public opinion aimed at an accountable government. They signify that democratic politics has stopped working. They are both utopian and desperate.

Some public figures—politicians, policy experts, civic leaders—have come forward with proposals for changing the mindset and tactics of the police. Terrence Floyd, the brother of the murdered man, urged protesters to educate themselves and vote. But the overwhelming message of the protests is simply “end racism,” which would be a large step toward ending evil itself. The protesters are demanding an absolute, as if they’ve stopped expecting the state to produce anything that falls a little short. For white protesters—who are joining demonstrations on behalf of black freedom and equality in large numbers for the first time since Selma, Alabama, 55 years ago—this demand means ending an evil that lies within themselves. It would be another sign of a hollow democracy if the main energy in the afterglow of the protests goes into small-group sessions on white privilege rather than a hard push for police reform.

This is where we are. Trust is missing everywhere—between black Americans and police, between experts and ordinary people, between the government and the governed, between citizens of different identities and beliefs. There’s an election coming in five months. It won’t end racism or the pandemic, or repair our social bonds, or restore our democracy to health. But it could give us a chance to try, if we get that far.

Well said! The only thing missing is specific reference to the toxic failure of the U.S. Supreme Court. 

We once had a Court with the legal experience, ethics, vision, and moral courage to lead America forward toward a more just and equal society. That’s been totally dissipated by years of GOP erosion of the Court’s legal expertise, practical problem-solving ability, humanity, courage, vision of a better future for all in America, and integrity.

The “journey downward and march backward” from Brown v. Board of Education to legal travesties like Trump v. Hawaii and Wolf v. Innovation Law Lab (to name just two glaring examples of the Court’s disgraceful and illegal “Dred Scottification” of the other in our society) is certainly one of the most outrageous, disturbing, and disgusting tales in post-Plessy v. Ferguson American jurisprudence.

The Court’s abject failure to move forward and make voting rights and equal justice for all a reality is in no small measure linked to the death of George Floyd and other Americans of color and the nationwide protests of injustice. Failure of judicial integrity, vision, and leadership — in other words failures of both legal and moral justice —  imperils our nation and many of its inhabitants. 

America already faces long-term threats to our justice system and those it supposedly serves from the irresponsible and poorly-qualified life-tenured judicial appointments of Trump and the Mitch-led GOP. To them, things like “equal justice for all,” “voting rights,” “due process for all,” “women’s rights,” and “human rights” are just cruel hoaxes — things to be privately mocked, publicly “lip-serviced,” then buried forever beneath an avalanche of disingenuous and opaque legal gobbledygook intended to hide their true anti-democratic, White Nationalist enabling intent. The appointment of any more Justices along the lines of the “J.R. Five” likely would be the final “nail in the coffin” for our democratic republic! 🏴‍☠️👎🏻🥵

This November, vote like your life depends on it! Because it does!
