Kevin Euceda, a 17-year-old Honduran boy, arrived at the U.S.-Mexico border three years ago and was turned over to the custody of the Department of Health and Human Services until his request for asylum could be decided by immigration courts. During that period, he was required, as are all unaccompanied minors in custody, to meet with therapists to help him process what he had gone through.
In those sessions, Kevin was encouraged to speak freely and openly and was told that what he said would be kept confidential. So he poured out his story of a brutalized childhood, of how MS-13 gang members moved into the family shack after his grandmother died when he was 12, of how he was forced to run errands, sell drugs and, as he got older, take part in beating people up. When he was ordered to kill a stranger to cement his position in the gang, Kevin decided to run.
His therapists submitted pages of notes over several sessions to the file on him, as they were expected to do. But then, HHS officials — without the knowledge of the teen or the therapists — shared the notes with lawyers for Immigration and Customs Enforcement, who used them in immigration court to paint the young migrant as a dangerous gang member who should be denied asylum and sent back to Honduras. In sharing those therapy notes, the government did not break any laws. But it most assuredly broke its promise of confidentiality to Kevin, violated standard professional practices — the first therapist involved quit once she learned her notes had been shared — and offended a fundamental expectation that people cannot be compelled to testify against themselves in this country.
Kevin, whose story was detailed by the Washington Post, wasn’t the only unaccompanied minor to fall victim to such atrocious behavior, though how many have been affected is unknown. The government says it has changed that policy and no longer shares confidential therapy notes, but that’s not particularly reassuring coming from this administration. It adopted the policy once; it could easily do so again.
Last week, Rep. Grace F. Napolitano (D-Norwalk) and Sen. Jeff Merkley (D-Ore.) introduced the Immigrants’ Mental Health Act of 2020 to ban the practice, which is a necessary preventive measure. The bill would also create a new training regimen to help border agents address mental health issues among migrants and require at least one mental health expert at each Customs and Border Patrol facility. Both of those steps are worth considering too.
That the government would so callously use statements elicited from unaccompanied minors in therapy sessions to undercut their asylum applications is part of the Trump administration’s broad and inhumane efforts to effectively shut off the U.S. as a destination for people seeking to exercise their right to ask for sanctuary. Jeff Sessions and his successor as attorney general, William Barr, have injected themselves into cases at an unprecedented rate to unilaterally change long-established practices and immigration court precedent.
They have been able to do so because immigration courts are administrative and part of the Justice Department, not the federal court system, and as a result they have politicized what should be independent judicial evaluations of asylum applications and other immigration cases. Advocates argue persuasively that the efforts have undermined due process rights and made the immigration courts more a tool of President Trump’s anti-immigration policies than a system for measuring migrant’s claims against the standards Congress wrote into federal law.
Of course, trampling legal rights and concepts of basic human decency have been a hallmark of the administration’s approach to immigration enforcement — witness, for example, its separation of more than 2,500 migrant children from their parents. Beyond the heartlessness of the separations, the Health and Human Services’ inspector general last week blasted the department for botching the process. Meanwhile, the administration has expanded detention — about 50,000 migrants are in federal custody on any given day, up from about 30,000 a decade ago — and forced about 60,000 asylum seekers to await processing in dangerous squalor on Mexico’s side of the border.
There are legitimate policy discussions to be had over how this government should handle immigration, asylum requests and broad comprehensive immigration reform. In the meantime, no government has the right to treat people with such abject inhumanity. History will remember Trump for this, but it will also remember the people who enable such atrocious acts.

Put simply: When some of the most despised and powerless among us ask the Supreme Court to spare their lives, the conservative justices turn a cold shoulder. When the Trump administration demands permission to implement some cruel, nativist, and potentially unlawful immigration restrictions, the conservatives bend over backward to give it everything it wants. There is nothing “fair and balanced” about the court’s double standard that favors the government over everyone else. And, as Sotomayor implies, this flagrant bias creates the disturbing impression that the Trump administration has a majority of the court in its pocket.

First, the Government has come to treat “th[e] exceptional mechanism” of stay relief “as a new normal.” Barr v. East Bay Sanctuary Covenant, 588 U. Claiming one emergency after another, the Government has recently sought stays in an unprecedented number of cases, demanding immediate attention and consuming lim- ited Court resources in each. Having first sought a stay in the New York cases based, in large part, on the purported harm created by a nationwide injunction, it now disclaims that rationale and insists that the harm is its temporary inability to enforce its goals in one State.
Second, this Court is partly to blame for the breakdown in the appellate process. That is because the Court—in this case, the New York cases, and many others—has been all too quick to grant the Government’s “reflexiv[e]” requests. Ibid. But make no mistake: Such a shift in the Court’s own behavior comes at a cost.
Stay applications force the Court to consider important statutory and constitutional questions that have not been ventilated fully in the lower courts, on abbreviated timeta- bles and without oral argument. They upend the normal appellate process, putting a thumb on the scale in favor of the party that won a stay. (Here, the Government touts that in granting a stay in the New York cases, this Court “necessarily concluded that if the court of appeals were to uphold the preliminary injunctio[n], the Court likely would grant a petition for a writ of certiorari” and that “there was a fair prospect the Court would rule in favor of the govern- ment.” Application 3.) They demand extensive time and resources when the Court’s intervention may well be unnec- essary—particularly when, as here, a court of appeals is poised to decide the issue for itself.
Perhaps most troublingly, the Court’s recent behavior on stay applications has benefited one litigant over all others. This Court often permits executions—where the risk of ir- reparable harm is the loss of life—to proceed, justifying many of those decisions on purported failures “to raise any potentially meritorious claims in a timely manner.” Mur- phy v. Collier, 587 U. S. ___, ___ (2019) (second statement of KAVANAUGH, J.) (slip op., at 4); see also id., at ___ (ALITO, J., joined by THOMAS and GORSUCH, JJ., dissenting from grant of stay) (slip op., at 6) (“When courts do not have ad- equate time to consider a claim, the decisionmaking process may be compromised”); cf. Dunn v. Ray, 586 U. S. ___ (2019) (overturning the grant of a stay of execution). Yet the Court’s concerns over quick decisions wither when prodded by the Government in far less compelling circumstances— where the Government itself chose to wait to seek relief, and where its claimed harm is continuation of a 20-year status quo in one State. I fear that this disparity in treatment erodes the fair and balanced decision making process that this Court must strive to protect.

Of course, the regime’s use of manufactured and clearly bogus “national emergencies” or fake appeals to “national security” is a perversion of both fact and law, as well as a mocking of Constitutional separation of powers. This obscenely transparent legal ruse essentially was invited by the Roberts and his GOP brethren. Roberts somewhat disingenuously claims to be a “student of history.” But, whether he takes responsibility for it or not, he has basically invited Trump & Miller to start a new “Reichstag Fire” almost every week with migrants, asylum seekers, Latinos, and the less affluent as the “designated usual suspects.”
Powerful as her dissent is, Justice Sotomayor actually understates the case against her GOP colleagues. Every racist, White Nationalist, nativist, and/or authoritarian movement in American history has been enabled, advanced, and protected by morally corrupt and intellectually dishonest jurists who have intentionally provided “legal cover” for those official misdeeds. How about “states rights,”“separate but equal,”“plenary power,” and a host of other now discredited legal doctrines used to justify everything from slavery to denying voting, and other Constitutional rights including life itself to African Americans? They were all used to “cover” for actions that might more properly have been considered “crimes against humanity.”
Who knows what legal blather Roberts and his four fellow rightist toadies will come up with to further promote the destruction of humanity and the disintegration of American democracy at the hands of Trump, Miller, Barr, Putin, and the rest of the gang?
But, courageous “outings” like those by Justice Sotomayor will help insure that history will be able to trace the bloody path of needless deaths, ruined lives, wasted human potential, official hate mongering, and unspeakable human misery they are unleashing directly to their doors and hold them accountable in a way that our current system has disgracefully failed to do.
Trump was right about at least one thing: There are indeed “GOP Justices” on the Supremes wholly owned by him and his party. They consistently put GOP rightist ideology and and authoritarianism above the Constitution, human rights, the rule of law, intellectual honesty, and simple human decency. Other than that, they’re a “great bunch of guys!”
The head of the Federal Judges Association is taking the extraordinary step of calling an emergency meeting to address the intervention in politically sensitive cases by President Trump and Attorney General William P. Barr.
U.S. District Judge Cynthia M. Rufe, the Philadelphia-based judge who heads the voluntary association of around 1,100 life-term federal judges, told USA Today that the issue “could not wait.” The association, founded in 1982, ordinarily concerns itself with matters of judicial compensation and legislation affecting the federal judiciary.

On Sunday, more than 1,100 former Justice Department employees released a public letter calling on Barr to resign over the Stone case.
A search of news articles since the group’s creation revealed nothing like a meeting to deal with the conduct of a president or attorney general.
Rufe, appointed to the bench by President George W. Bush, could not be reached for comment late Monday.
The action follows a week of turmoil that included the president tweeting his outrage over the length of sentence recommended by career federal prosecutors for his friend Roger Stone and the decision by Barr to withdraw that recommendation.
In between, Trump singled out the judge in the Stone case, Amy Berman Jackson of the U.S. District Court in Washington, for personal attacks, accusing her of bias and spreading a falsehood about her record.
“There are plenty of issues that we are concerned about,” Rufe said to USA Today. “We’ll talk all this through.”
Trump began disparaging federal judges who have ruled against his interests before he took office, starting with U.S. District Judge Gonzalo P. Curiel. After Curiel ruled against Trump in 2016 in a pair of lawsuits detailing predatory marketing practices at Trump University in San Diego, Trump described him as “a hater of Donald Trump,” adding that he believed the Indiana-born judge was “Mexican.”

Faced with more than 100 adverse rulings in the federal courts, Trump has continued verbal attacks on judges.
Rufe’s comments gave no hint of what the association could or would do in response.
Some individual judges have already spoken out critically about Trump’s attacks generally, among them U.S. District Judge Paul L. Friedman, a colleague of Jackson’s in Washington, and most recently, the chief judge of the court in Washington, Beryl A. Howell.

How soon we forget!
Will Trump & Barr eventually separate Article III Judges’ families or send them to danger zones in Mexico or the Northern Triangle to “deter” rulings against the regime? Will Mark Morgan and Chad Wolf then declare “victory?” Will their families be scattered to various parts of the “New American Gulag” with no plans to reunite them? Will they be put on trial for their lives without access to lawyers? Are there costs for failing to take a “united stand” for the rule of law, Constitutional Due Process, human rights, and the human dignity of the most vulnerable among us?
Why does it take the case of a lifetime sleaze-ball like Roger Stone to get the “life-tenured ones” to “wake up” to the attacks on humanity and the rule of law going on under noses for the past three years?
WASHINGTON — More than 1,100 former federal prosecutors and Justice Department officials called on Attorney General William P. Barr on Sunday to step down after he intervened last week to lower the Justice Department’s sentencing recommendation for President Trump’s longtime friend Roger J. Stone Jr.
They also urged current government employees to report any signs of unethical behavior at the Justice Department to the agency’s inspector general and to Congress.
“Each of us strongly condemns President Trump’s and Attorney General Barr’s interference in the fair administration of justice,” the former Justice Department lawyers, who came from across the political spectrum, wrote in an open letter on Sunday. Those actions, they said, “require Mr. Barr to resign.”
A Justice Department spokeswoman declined to comment.
After prosecutors on Monday recommended a prison sentence of up to nine years for Mr. Stone, who was convicted of obstructing a congressional inquiry, Mr. Trump lashed out at federal law enforcement. Senior officials at the department, including Mr. Barr, overrode the recommendation the next day with a more lenient one, immediately prompting accusations of political interference, and the four lawyers on the Stone case abruptly withdrew in protest.
The Justice Department said the case had not been discussed with anyone at the White House, but that Mr. Trump congratulated Mr. Barr on his decision did little to dispel the perception of political influence. And as the president widened his attacks on law enforcement, Mr. Barr publicly reproached the president, saying that Mr. Trump’s statements undermined him, as well the department.
“I cannot do my job here at the department with a constant background commentary that undercuts me,” Mr. Barr said during a televised interview on Thursday with ABC News.
In the days after the interview, Mr. Trump has been relatively muted. He said on Twitter that he had not asked Mr. Barr to “do anything in a criminal case.” As president, he added, he had “the legal right to do so” but had “so far chosen not to!”
But lawyers across the Justice Department continue to worry about political interference from the president despite public pushback by Mr. Barr, long considered a close ally of Mr. Trump’s.
Protect Democracy, a nonprofit legal group, gathered the signatures from Justice Department alumni and said it would collect more.
In May, Protect Democracy gathered signatures for a letter that said the Mueller report presented enough evidence to charge Mr. Trump with obstruction of justice were that an option. At the close of his investigation, the special counsel Robert S. Mueller III declined to indicate whether Mr. Trump illegally obstructed justice, citing a decades-old department opinion that a sitting president cannot be charged with a crime. That letter was also critical of Mr. Barr.
Even as the lawyers condemned Mr. Barr on Sunday, they said they welcomed his rebuke of Mr. Trump and his assertions that law enforcement must be independent of politics.
But Mr. Barr’s “actions in doing the president’s personal bidding unfortunately speak louder than his words,” they said.
The letter comes days after some Democratic senators pressed for Mr. Barr to resign, and after the New York City Bar Association said that it had formally reported the attorney general’s behavior to the Justice Department’s inspector general.
Strikingly, the lawyers called upon current department employees to be on the lookout for future abuses and to be willing to bring oversight to the department.
“Be prepared to report future abuses to the inspector general, the Office of Professional Responsibility, and Congress,” they wrote, and “to refuse to carry out directives that are inconsistent with their oaths of office.”
Prosecutors who currently work at the department should withdraw from cases that involve abuses or political interference, the lawyers said.
As a last resort, they asked Justice Department employees “to resign and report publicly — in a manner consistent with professional ethics — to the American people the reasons for their resignation.”

DOJ Alumni Statement on the Events Surrounding the Sentencing of Roger Stone
We, the undersigned, are alumni of the United States Department of Justice (DOJ) who have collectively served both Republican and Democratic administrations. Each of us strongly condemns President Trump’s and Attorney General Barr’s interference in the fair administration of justice.
As former DOJ officials, we each proudly took an oath to support and defend our Constitution and faithfully execute the duties of our offices. The very first of these duties is to apply the law equally to all Americans. This obligation flows directly from the Constitution, and it is embedded in countless rules and laws governing the conduct of DOJ lawyers. The Justice Manual — the DOJ’s rulebook for its lawyers — states that “the rule of law depends on the evenhanded administration of justice”; that the Department’s legal decisions “must be impartial and insulated from political influence”; and that the Department’s prosecutorial powers, in particular, must be “exercised free from partisan consideration.”
All DOJ lawyers are well-versed in these rules, regulations, and constitutional commands. They stand for the proposition that political interference in the conduct of a criminal prosecution is anathema to the Department’s core mission and to its sacred obligation to ensure equal justice under the law.
And yet, President Trump and Attorney General Barr have openly and repeatedly flouted this fundamental principle, most recently in connection with the sentencing of President Trump’s close associate, Roger Stone, who was convicted of serious crimes. The Department has a long-standing practice in which political appointees set broad policies that line prosecutors apply to individual cases. That practice exists to animate the constitutional principles regarding the even-handed application of the law. Although there are times when political leadership appropriately weighs in on individual prosecutions, it is unheard of for the Department’s top leaders to overrule line prosecutors, who are following established policies, in order to give preferential treatment to a close associate of the President, as Attorney General Barr did in the Stone case. It is even more outrageous for the Attorney General to intervene as he did here — after the President publicly condemned the sentencing recommendation that line prosecutors had already filed in court.
Such behavior is a grave threat to the fair administration of justice. In this nation, we are all equal before the law. A person should not be given special treatment in a criminal prosecution because they are a close political ally of the President. Governments that use the enormous power of law enforcement to punish their enemies and reward their allies are not constitutional republics; they are autocracies.
We welcome Attorney General Barr’s belated acknowledgment that the DOJ’s law enforcement decisions must be independent of politics; that it is wrong for the President to interfere in specific enforcement matters, either to punish his opponents or to help his friends; and that the President’s public comments on DOJ matters have gravely damaged the Department’s credibility. But Mr. Barr’s actions in doing the President’s personal bidding unfortunately speak louder than his words. Those actions, and the damage they have done to the Department of Justice’s reputation for integrity and the rule of law, require Mr. Barr to resign. But because we have little expectation he will do so, it falls to the Department’s career officials to take appropriate action to uphold their oaths of office and defend nonpartisan, apolitical justice.
For these reasons, we support and commend the four career prosecutors who upheld their oaths and stood up for the Department’s independence by withdrawing from the Stone case and/or resigning from the Department. Our simple message to them is that we — and millions of other Americans — stand with them. And we call on every DOJ employee to follow their heroic example and be prepared to report future abuses to the Inspector General, the Office of Professional Responsibility, and Congress; to refuse to carry out directives that are inconsistent with their oaths of office; to withdraw from cases that involve such directives or other misconduct; and, if necessary, to resign and report publicly — in a manner consistent with professional ethics — to the American people the reasons for their resignation. We likewise call on the other branches of government to protect from retaliation those employees who uphold their oaths in the face of unlawful directives. The rule of law and the survival of our Republic demand nothing less.

It’s NOT Too Late! Let YOUR Voice Be Heard For Justice In America!
The Freudian concept of psychological projection refers to the behavior of people who, unable to acknowledge their own weaknesses, ascribe those same failings to others. President Trump provides a striking example in his multiple post-impeachment rants calling those who sought his removal “vicious” and “mean.” His choice of the word “mean” caught my attention, because I’ve been thinking for some time now that the United States has become a mean country.
There has been meanness, and worse, in the world, of course, long before there was a President Trump. But it doesn’t require suffering from the agitation of Trump derangement syndrome to observe that something toxic has been let loose during these past three years.
Much of it has to do with immigration: the separation of families at the border and the effort to terminate DACA, the program that protects from deportation undocumented young people brought to the United States as children. Removing this protection for hundreds of thousands of productive “Dreamers,” now pursuing higher education or holding jobs (or both), is an obvious lose-lose proposition for the country. It is also simply mean.
And the meanness radiates out from Washington. The mayor of Springfield, Mass., one of the biggest cities in one of the bluest states, has taken the president up on his offer to let local officials veto the resettlement of refugees in their communities. Tennessee enacted a law to cut off state money to cities that declare themselves “sanctuaries” from federal immigration enforcement. (At the same time more than a dozen counties in Tennessee have endorsed a growing “Second Amendment sanctuary” movement for gun rights.)
The meanness spreads to the lowest ranks of the country’s judiciary. USA Today reported two weeks ago that a common pleas judge in Hamilton County, Ohio, has adopted the practice of summoning ICE whenever he has a “hunch” that the defendant standing before him is an undocumented immigrant. “I’m batting a thousand. I haven’t got one wrong yet,” Judge Robert Ruehlman boasted.
In the Arizona desert, where thousands of border-crossing migrants have died from exposure and dehydration in the past decade, Border Patrol agents have been filmed kicking over and emptying bottles of water left for the migrants by volunteers. (This practice evidently preceded the Trump administration; the Border Patrol, in its union’s first-ever presidential endorsement, endorsed Mr. Trump’s candidacy in 2016, deeming him “the only candidate who actually threatens the established powers that have betrayed our country.” )
The United States attorney’s office in Tucson has been prosecuting people who enter the Cabeza Prieta National Wildlife Refuge without a permit to leave lifesaving bottles of water and cans of food along common migratory routes. In 2018, a federal magistrate judge, in a nonjury trial, convicted four people for illegal entry and abandoning property in the desert wilderness. The four are volunteers for No More Deaths/No Más Muertes, a ministry of the Unitarian Universalist Church of Tucson.
In their appeal before a federal district judge, Rosemary Márquez, the four invoked the Religious Freedom Restoration Act, arguing that their actions were driven by their faith and their belief in the “sanctity of human life.” The government responded that the four had simply “recited” religious beliefs “for the purpose of draping religious garb over their political activity.” (I’m not holding my breath for the Trump administration to similarly ridicule the religious claims of employers who say they can’t possibly include the birth-control coverage in their employee health plans, as the Affordable Care Act requires, lest they become complicit in the sin of contraception.)
The administration met its match in Judge Márquez. On Jan. 31, finding that the Religious Freedom Restoration Act barred the prosecution, she overturned the convictions. Her 21-page opinion noted that human remains were regularly found in the area, and she had this to say about that fact:
“The government seems to rely on a deterrence theory, reasoning that preventing clean water and food from being placed on the refuge would increase the risk of death or extreme illness for those seeking to cross unlawfully, which in turn would discourage or deter people from attempting to enter without authorization. In other words, the government claims a compelling interest in preventing defendants from interfering with a border enforcement strategy of deterrence by death. This gruesome logic is profoundly disturbing.”
The headline on this column promises some thoughts about the Supreme Court, so I’ll now turn to the court. The country’s attention was focused elsewhere two weeks ago when five justices gave the Trump administration precisely what it needed to put into effect one of the most meanspirited and unjustified of all its recent immigration policies. This was the radical expansion of the “public charge” rule, which bars from admission or permanent residency an immigrant who is “likely at any time to become a public charge.”
The concept of “public charge” in itself is nothing new. It was part of the country’s early efforts to control immigration in the late 19th century, where it was used to exclude those likely to end up in the poor house or its equivalent. That historic definition — “primarily dependent on the government for cash assistance or on long-term institutionalization” — was codified in 1999 “field guidance” issued to federal immigration officers.
Last August, the administration put a new definition in place. Any immigrant who receives the equivalent of 12 months of federal benefits within a three-year period will be deemed a public charge, ineligible for permanent residency or a path to citizenship. The designated benefits include nutrition assistance for a child under the SNAP program; receipt of a Section 8 housing voucher or residence in public housing; and medical treatment under Medicaid. The new rule, titled Inadmissibility on Public Charge Grounds, aggregates the benefits — that is, three of the benefits received in a single month count as three months of the 12.
States, cities, and nonprofit organizations around the country promptly filed lawsuits, with varying preliminary outcomes. The plaintiffs argued that the drastic change in definition was “arbitrary and capricious,” violating the Administrative Procedure Act’s core requirement of “reasoned decision making.”
In October, a federal district judge in New York, George Daniels, ruled in favor of two sets of plaintiffs, one group headed by New York State and the other, a coalition of nonprofit organizations. Judge Daniels noted that the government was “afforded numerous opportunities to articulate a rational basis for equating public charge with receipt of benefits for 12 months within a 36-month period, particularly when this has never been the rule,” but that its lawyers “failed each and every time.” He explained that “where an agency action changes prior policy, the agency need not demonstrate that the reasons for the new policy are better than the reasons for the old one. It must, however, show that there are good reasons for the new policy.”
And Judge Daniels added: “The rule is simply a new agency policy of exclusion in search of a justification. It is repugnant to the American dream of the opportunity for prosperity and success through hard work and upward mobility.” Noting that the policy would immediately cause “significant hardship” to “hundreds of thousands of individuals who were previously eligible for admission and permanent residence in the United States,” he issued a nationwide injunction to block its implementation.
The United States Court of Appeals for the Second Circuit put the government’s appeal on a fast track but refused, in the interim, to grant a stay of the injunction. So, predictably, the administration turned to its friends at the Supreme Court and, equally predictably, got what it wanted. By a vote of 5 to 4, the court granted a stay of the injunction to last through a future Supreme Court appeal.
Granting a stay at this point was a breathtaking display of judicial activism. The Second Circuit will hear the case promptly; briefs are due on Friday. More to the point, the court’s summary action, without full appellate review, changes the lives of untold numbers of people for the worse, people who immigrated legally to the United States and who have followed every rule. Being kicked off the path to citizenship puts them directly on the path to deportation, without any explanation from the highest court in the land of why this should be the case.
Of the five justices in the majority — Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh — only Justices Gorsuch and Thomas deigned to write anything. In a four-page concurring opinion, they made clear their determination to hold up this case, Department of Homeland Security v. New York, as an example of “the gamesmanship and chaos” that they said was attendant on “the rise of nationwide injunctions.”
I don’t remember such hand-wringing a few years back when anti-immigrant states found a friendly judge in South Texas to issue a nationwide injunction against President Barack Obama’s expansion of the DACA program to include parents of the “Dreamers.” The Supreme Court let that injunction stand.
Do the justices realize how they are being played? I started this column by mentioning psychological projection, a distorted view of others engendered by a distorted view of oneself. That’s Donald Trump, seeing himself the innocent victim of attacks from vicious and mean people. There’s another kind of projection, the image reflected when light strikes a mirror. Who do these five justices see when they look in their mental mirrors? Could it be Donald Trump?

In reality, judges were among those inside Germany who might have effectively challenged Hitler’s authority, the legitimacy of the Nazi regime, and the hundreds of laws that restricted political freedoms, civil rights, and guarantees of property and security. Instead, over the 12 years of Nazi rule, during which time judges heard countless cases, most not only upheld the law but interpreted it in broad and far-reaching ways that facilitated, rather than hindered, the Nazis ability to carry out their agenda.

How soon we forget!
Yes, Linda, I think the Supremes’ Justices and other Article IIIs who aid the “dehumanization” and “Dred Scottification” of migrants, asylum seekers, and “the other” by the regime know full well that they are “being played.” They are willing, sometimes as in the case of the recent totally gratuitous nonsense about targeting nationwide injunctions flowing off the pens of Gorsuch and Thomas actually eager, to “go along to get along” — even when it often means hanging braver lower court colleagues who had the courage to speak truth to power and stand up to tyranny “out to dry.”
Like judges during the Jim Crow era and other disastrous episodes of legal history, they think they can hide out in their ivory towers behind legal gobbledygook that most first-years law students can recognize as the nonsense “cop out” that it is. They also knowingly and intentionally betray the legions of courageous, ethical lawyers, many working pro bono in dangerous and unhealthy conditions, to uphold the rule of law in America and to defend human rights and human decency.
Hopefully, our Republic will survive this dark time, and these folks “working at the retail level,” many “charter members” of the New Due Process Army, will form the core of a future, better judiciary that will put Due Process and humanity first, above party loyalty and bizarre, often nonsensical, right wing theories used to justify lawlessness, injustice, unfairness, and invidious discrimination.
Even before he was hired as Donald Trump’s attorney general, William Barr made it clear that he would be acting as the president’s lackey first and the chief lawyer for the United States second, having auditioned for the role by sending an unsolicited letter to the Justice Department calling the Russia inquiry “fatally misconceived” and describing Robert Mueller’s actions as “grossly irresponsible.” Since then, Barr has told Congress it’s perfectly okay for the president to instruct aides to lie to investigators, suggested that Mueller’s report fully exonerated Trump, which of course it did not, and attempted to bury the “urgent“ whistle-blower report that became the basis of the House’s impeachment proceedings.
Now, if it were up to Barr, he’d happily carry on doing the president’s dirty work, but for one problem: Trump, with his flapping yap and quick trigger finger, has been making it a little too obvious that the DOJ, in its current form, exists to punish his enemies and spare his friends. The most recent example of this, of course, came this week, when the president tweeted, at 1:48 a.m., that the sentencing recommendation of seven to nine years for his longtime pal Roger Stone was “horrible,” “very unfair,” and a “miscarriage of justice.” Then, after Barr’s DOJ intervened with a new filing calling for a much lighter sentence—which prompted the four prosecutors on the case to withdraw from it—the president tweeted his thanks, congratulating the attorney general on getting involved in matters relevant to his personal interests.
For many people long aware of Barr’s status as a boot-licking hack, this was a bridge too far. The calls for him to resign or be impeached were swift. And they got so bad that on Thursday, the attorney general felt compelled to sit down with ABC News and send the message to the president that if he’d like the DOJ to continue to do his dirty work, he needs to stop tweeting about it. Do criminals tell their social-media followers “Check out this sweet scam I just pulled”? No! Of course, rather than stating directly that the president’s penchant for telling the world about the many ways he’s corrupted the government have made it difficult for that corruption to continue, Barr had to pretend his comments were all about ensuring the DOJ’s independence, which would be a funny, not-at-all-believable thing for him to start caring about now.
“I’m not going to be bullied or influenced by anybody….whether it’s Congress, newspaper editorial boards, or the president,” Bill Barr tells @ABC News.
“I cannot do my job here at the department with a constant background commentary that undercuts me.”
“I’m not going to be bullied or influenced by anybody,” Barr insisted to ABC News chief justice correspondent Pierre Thomas. “Whether it’s Congress, a newspaper editorial board, or the president. I’m gonna do what I think is right. And you know…I cannot do my job here at the department with a constant background commentary that undercuts me.” Just in case that extremely obvious hint was lost on its intended audience, Barr added: “I think it’s time to stop the tweeting about Department of Justice criminal cases.”
Maybe it’s not the tweets damaging his integrity but the nakedly partisan and quasi-legal decisions he’s made on the tweeter’s behalf?Just a thought.
Asked about the decision to reverse the sentencing recommendation for Stone, Barr insisted that it definitely had nothing to do with the guy being a longtime friend of Trump’s, claiming that he came to the unbiased conclusion on his own that the seven-to-nine-years call was excessive and that he was planning to file an update even before Trump tweeted about it being “horrible and unfair.” (He was not asked about the NBC News report that he additionally removed a U.S. attorney from her post for failing to punish Trump’s enemy Andrew McCabe, or that the Justice Department also intervened to change the sentencing recommendation for convicted criminal and former national security adviser Michael Flynn.)
Barr said Trump’s middle-of-the-night tweet put him in a bad position. He insists he had already discussed with staff that the sentencing recommendation was too long. “Do you go forward with what you think is the right decision or do you pull back because of the tweet? And that just sort of illustrates how disruptive these tweets can be,” he said.
Barr also told ABC he was “a little surprised” that the entire Stone prosecution team had resigned from the case—and one from the DOJ entirely—which presumably has something to do with the fact that after using your department to do the president’s bidding for so long, you sometimes forget that other people will take issue with such behavior.
Asked if he expected Trump to react to his criticism of the tweets, Barr responded: “I hope he will react.”
“And respect it?” Thomas asked.
“Yes,” Barr said. You hear that, Mr. President? Let the man turn the judicial branch into your own personal score-settling operation in peace!
Even smart folks like The NY Times’David Leonhardt are babbling about, perhaps, giving Billy “the benefit of the doubt.” Come on, man!
As BessLevin points out, Barr’s faithfully been doing Trump’s “dirty work” for him since even before he set foot inside the DOJ again. It’s not like he’s suddenly had a “moral awakening” or discovered human decency.
No, Trump is the “unitary Executive” that Billy and some of his GOP righty neo-fascists have always salivated over. But, understandably he’d prefer more privacy as he deconstructs the DOJ and undermines fair and impartial justice, including, of course, further trashing the Immigration Courts that, incredible as it might seem in a country that actually has a written Constitution supposedly guaranteeing Due Process to “all persons,” belong exclusively to him.
Remarkably, and quite stunningly to anyone who has actually studied the law, the Article III Courts, all the way up to the feckless Supremes, have gone along with this absurd charade. You get the message: Immigrants, migrants, and asylum seekers aren’t really “persons” at all. They have been dehumanized by the regime and “Dred Scottified” by the Article IIIs.
There is no particular legal rationale or justification for this ongoing miscarriage of justice. It’s just a matter of enough folks in black robes being too cowardly or self-absorbed, or maybe in a few cases too ignorant, to stand up for the Constitutional and human rights of the most vulnerable among us.
To paraphrase an expression from the world of religion: “What would Jesus think about this blindness to human suffering?” Nothing good, I’m sure!
If he’s actually out there among us today, he’s undoubtedly among those suffering in the regime’s “New American Gulag” or waiting in squalor along the Mexican border for a “fixed hearing” that’s probably never going to happen anyway. I know where he isn’t: among the sign waving crazies shouting hateful slogans glorifying human rights abuses at the “hate fests” z/k/a “Trump rallies!”
In Immigration Court, the conflicts of interest and threats to human decency aren’t just “implied” or “apparent.” They are very real, and they are destroying real human lives, even killing innocent folks, every day.
And, unlike U.S. District Judge Amy Berman Jackson, whose life tenure allows her to “ignore the noise and do what she thinks is right” (as Trump’s GOP toadies love to point out), Immigration Judges are “wholly owned commodities” of Billy and the regime: disposable, subservient, and told to “follow orders.” They can’t even schedule their own cases without political interference, let alone apply the law in a way that conflicts with Billy’s unethical precedents or those entered by his “wholly owned appellate body,” the Board of Immigration Appeals!
The latter has recently gone out of its way to show total subservience to the regime’s White Nationalist anti-asylum, anti-due-process, anti-immigrant agenda. Indeed, they have even drawn the ire of at least one conservative GOP-appointed Article III Judge by contemptuously disobeying a direct court order in favor of a footnote in a letter from the Attorney General.
“Shocking” as this professional malpractice and contempt for the justice system might be to those journalists and former DOJ employees who haven’t been paying attention, it’s nothing new to those of us involved in immigration. For the last three years, the regime has been actively and unethically “gaming” the unconstitutional Immigration “Court” system against the very migrants and asylum seekers whose legal rights and human dignity they are actually supposed to be protecting!How is this “just OK?”
Feckless Article III Courts have largely “gone along to get along,” although they might be showing less patience now that the scofflaw actions and disrespectful attitudes promoted by Billy and his predecessor “Gonzo Apocalypto” Sessions are directed at them personally rather than just screwing vulnerable migrants and asylum seekers.
While it’s nice that at least some Article III Judges are finally reacting to being “given the finger” by Barr, Trump, and their gang of White Nationalist thugs, outrage at their own disrespectful treatment pales in comparison with the death, torture, rape, extortion, and the other parade of horribles being inflicted daily on vulnerable migrants by the Immigration “Courts” and the human rights criminals in the Trump regime while the Article IIIs fail to step in and save lives.
In the end of the day, as history will eventually show, human lives, which are the key to the “rule of law,” will prove to be more important than “hurt feelings” among the Article III “lifers” or the kind of legal gobbledygook (much of it on “jurisdiction” which often translates into “task avoidance”) that Article IIIs, particularly those from the right wing, like to throw around to obscure their legal tone-deafness and moral failings from their fellow humans.
Due Process Forever; Complicity in the Face of Tyranny Never!
In June 1939, about 900 Jewish refugees sailed close to Florida on the St. Louis in hopes of finding protection in the United States. U.S. authorities refused to let the ship dock. Desperate passengers sent cables to President Franklin D. Roosevelt, who never responded.
A State Department telegram stated that the passengers must “await their turns on the waiting list and qualify for and obtain immigration visas before they may be admissible in the United States.” Nearly all the passengers had already been refused admission to Cuba. Canada rejected them too. They had no choice but to return to Europe, where 254 of the passengers were eventually killed in the Holocaust.
Eighty years later, a modern version of this tragedy takes place daily at our southern border. This time, most of these people are fleeing rape, assault and death from the northern triangle of Central America — Honduras, El Salvador and Guatemala — as well as political oppression in Cuba, Venezuela and elsewhere. They are fleeing to save their lives and their children’s lives. They hope to find safety in the United States. When they get to America, U.S. authorities turn them around.
I spent a week recently in Juárez, Mexico, with four of my law students. We visited shelters across the city and its outskirts to provide pro bono legal services to some of the estimated 20,000 migrants there who are trying to apply for asylum in the U.S.
We met political dissidents from Cuba who had been jailed and beaten for refusing to join party meetings, mothers from Central America who had survived excruciating years of domestic violence and fled to save their children’s lives, and fathers with the courage to resist the ever-increasing violence of gangs in their communities. Nearly all genuinely feared being harmed and killed in their home countries.
Why are they in Juárez? A slew of policy changes enacted over the last year by the Trump administration has made it nearly impossible for asylum seekers to enter the United States through the southern border. Among them is the Migrant Protection Protocols program, which requires asylum seekers who try to enter the United States through the southern border to remain in Mexico while their asylum cases are processed in U.S. immigration courts. Since last January, when the new protocols were put in place, more than 60,000 asylum seekers have been stranded in Mexico.
The new rules make it nearly impossible for asylum seekers to find lawyers who can represent them in immigration court. Hardly any lawyers are willing to cross into Juárez to represent asylum seekers. Given the complexity of immigration law and language and cultural barriers, the process of seeking asylum when someone is in the United States is hard enough. Requiring asylum seekers to remain in Mexico makes navigating the process virtually impossible. Ninety-six percent of individuals stranded in Mexico do not have a lawyer to help them apply for asylum.
Of the 29,309 cases that had been completed under MPP as of December, just 187 people had been granted asylum — a reflection of the almost insurmountable barriers imposed by the new protocols. U.S. law requires asylum seekers to be given “credible fear” interviews to allow them into the U.S. while they go through the asylum process; MPP has eliminated that step.
While asylum seekers, including thousands of children and women, wait in Mexico they have become targets for vicious crimes by local and transnational gangs and cartels. According to a recent report from Human Rights First, there have been at least 816 publicly reported cases of murder, rape, torture, kidnapping and other violent assaults, including 201 cases of children being kidnapped or nearly kidnapped. These numbers almost certainly understate the violence since many victims don’t report crimes committed against them for fear of reprisal.
When U.S. officials rejected the St. Louis, the horrors that would befall the passengers were foreseeable. Congress and the U.S. State Department eventually apologized for refusing to let in the refugees on board — but it was 70 years too late.
One year after the inception of MPP, we clearly see the dangers befalling asylum seekers forced to remain in Mexico. U.S. government officials know that these regions of the border are extremely dangerous. The U.S. State Department’s travel advisories warn U.S. citizens not to travel to some of the same Mexican border towns where American authorities send asylum seekers. These areas are designated as level 4 risks — the same danger assessment as for Afghanistan, Iraq and Syria.
The Trump policy is not only inhumane and dangerous, it is also illegal. Under U.S. immigration law, asylum seekers are not to be turned away at the border when they have credible fears of persecution. As the union representing DHS asylum officers explained, “MPP abandons our tradition of providing a safe haven to the persecuted and violates our international and domestic legal obligations.”
We can’t turn a blind eye to the daily tragedies inflicted by Migrant Protection Protocols. The Asylum Seeker Protection Act, which would prohibit the use of federal funds to carry out MPP, has been pending in Congress for months. It’s time to uphold our nation’s core commitment to protecting those seeking safety in this country.

Last Tuesday, in explaining her vote to acquit Donald Trump of abuse of power and obstruction of Congress, Sen. Susan Collins suggested that the president had learned a “pretty big lesson” simply from being impeached and that he would be “much more cautious” about engaging in similar behavior again. By Friday, Trump had issued a series of firingsof public officials who had testified against the president during the impeachment inquiry, demonstrating his takeaway from impeachment: He can use the powers of his office to do whatever he wants. Having gotten away with abuses of power again and again, Trump is now unleashed to continue to corruptly use the powers of his office without consequence. He has already begun to show what that will look like over the remainder of his presidency.
In legal escapades outside of the realm of impeachment, for instance, Trump and his administration have internalized the lesson that if no one will stop you, there’s no reason to stop. Less than two years ago, the Supreme Court upheld the third iteration of the president’s ban on entry by nationals of several Muslim-majority countries (the “travel ban”). By upholding the ban, the court made clear that it would not stop the president from incorporating his bigotry into official immigration policy. Since then, the president has dramatically expanded the scope of the travel ban to other countries with substantial Muslim populations and has enacted several other immigration restrictions that disproportionately disadvantage nonwhite immigrants. After receiving a pass on xenophobia, the president has continued to do it again and again. Last week, he expanded the entry ban to cover five additional countries (Nigeria, Kyrgyzstan, Sudan, Eritrea, and Myanmar) with substantial Muslim populations. In one of those countries (Myanmar), a group of Muslims (the Rohingya) are fleeing religious persecution and genocide. The president had previously said, according to the New York Times, that Nigerians should “go back to their huts.”
With respect to impeachment, several senators came close to admitting that their impeachment votes signify that they are unwilling to stop the president from abusing his office. Sen. Lamar Alexander of Tennessee explained his vote against calling witnesses in almost exactly those terms. The senator claimed that there was no point in hearing from additional witnesses because he had already concluded that the president engaged in the conduct he was accused of. (The House has maintained that the president corruptly threatened to withhold financial assistance to Ukraine to get Ukraine to announce an investigation into former Vice President Joe Biden.) The senator explained that, in his final analysis, the president’s conduct mattered less than the Senate’s ability to continue to confirm more conservative judges and the risk that a Democrat would win the presidency.
That reasoning obviously invites the president to do the same thing—or worse—again and he wasted no time in retaliating against impeachment witnesses Lt. Col. Alex Vindman and Ambassador to the European Union Gordon Sondland. If Republicans senators and their constituents value conservative judges and tax breaks for the wealthy more than holding a president accountable for wrongdoing, then the president will just keep doing wrong.
Again, it is not just the Senate that has failed to curb the president’s worst impulses and told the president that he can get away with even more than he’s already done. As a candidate, Trump had promised to ban Muslims from entering the United States. After his election, the president immediately suspended entry from several Muslim-majority countries without so much as informing, much less consulting, any relevant agencies. And his advisers admitted that the travel ban was an effort to make a Muslim ban that looked (somewhat) more legal. The Supreme Court ultimately blessed that effort in 2018 under a 5–4 vote that split along ideological lines.
The five conservative justices, much like the Republican senators, said they didn’t care. In fact, the justices, like the Republican senators, acknowledged that the entry ban may very well have been motivated by anti-Muslim animus. But they claimed that, in light of the president’s expansive powers over immigration, the court would uphold the entry ban so long as someone could think that the ban had a valid purpose (such as protecting national security) even if the ban actually had an illegitimate one (such as targeting Muslims). And, the court continued, a person could think the president’s entry ban had a valid purpose because the ban did not apply to all of the world’s Muslims, among other reasons.
Again, it does not take a genius to see how that decision signals that the court is unwilling to stop the president from making policy based on bigoted, thinly veiled Islamophobia or racism. The president received the message and has run with it. His expanded travel ban clearly targets countries based on race and religion. The odds of this Supreme Court reversing course and stopping him this time is virtually nil.
Indeed, the administration apparently felt so emboldened by the court’s earlier ruling that its expanded entry ban largely abandoned the original pretense of the rationale for the earlier entry ban. Previously, the administration stated it was responding to information sharing deficiencies in some countries. The administration now suggests it is trying to restrict immigration: Officials stated they are suspending entry from Nigeria because some Nigerians overstay their visas.
The administration has created other immigration restrictions that likewise disadvantage nonwhite immigrants. They have refused to process asylum applications from Central American migrants who did not apply for asylum in other countries they passed through on their way to the United States. They have tried to prohibit asylum applications from people who enter the United States outside of ports of entry. And they have authorized immigration officials to refuse to admit immigrants who might ever use public benefits (even temporarily). The Supreme Court approved this last effort just two weeks ago, again through a 5–4 decision split along ideological lines.
With the Senate’s blessing, the president will continue to corruptly abuse the powers of his office to undermine elections and our rule of law—and, as demonstrated by the Friday Night Massacre, he will do so in even more aggressive and ostentatious ways. With the court’s blessing, the president will expand his racist, xenophobic, and anti-Muslim immigration practices with little limit to what he may try to enact.
Neither the Senate nor the Supreme Court has been willing to stand up to the president for abusing the powers of his office for personal benefit or to stoke bigotry for partisan ends. By failing to do so, they have encouraged Trump to abuse his powers even more. It is unclear what, if anything, can stop him now.

Those at risk are people like Santos Amaya, a Salvadoran police officer who had received death threats from gang members. He was deported from the United States in April 2018 and was shot dead, allegedly by gangs, that same month. People like a young Salvadoran woman who fled domestic violence and rape and was deported to El Salvador in July 2018. She now lives in fear, hiding from her abusers.
These lives hang in the balance while the Trump administration attacks every legal means of protecting them in the United States.
On Feb. 5, Human Rights Watch released a report that identified 138 cases of Salvadorans who had been killed since 2013 after being deported from the United States; more than 70 others were beaten, sexually assaulted, extorted or tortured. These numbers are shocking but certainly an undercount, because no government or entity tracks what happens to deportees.
The Trump administration has put pressure on immigration judges to use overly narrow readings of the definition of a refugee. This approach may result in judges denying asylum to people like Amaya and the young Salvadoran woman — survivors of domestic violence, people who fear violence at the hands of gangs, or people who fear being targeted based on their family relationships. The administration has further proposed several new obstacles to gain asylum, including barring people convicted of illegal reentry into the United States, an offense often committed by people desperate to seek safety.
The Trump administration has tried to destroy the U.S. asylum process in other ways — among them by forcing people to remain in dangerous and inhumane conditionsin Mexican border towns while their claims are processed under its Migrant Protection Protocols. A Syracuse University analysis of government data revealed that as of December, 7,668 Salvadorans have been forced to wait in Mexico for their asylum claims to be processed. We have documented cases, included in a tallymaintained by Human Rights First, of Salvadorans who have been kidnapped and attacked while waiting.
The United States is also returning asylum seekers to Guatemala, after pressing its government to sign an “asylum cooperation agreement,” despite the fact that many Guatemalans are fleeing for the same reasons as their Salvadoran neighbors.
Salvadorans in the United States are at risk for reasons other than the Trump administration’s attempt to eviscerate the right to seek asylum. More than 220,000Salvadorans are affected by the administration’s decision to end temporary protected status and Deferred Action for Childhood Arrivals (DACA) protections. The administration also decided to end work authorization for Salvadorans with TPS, which allowed many Salvadorans to come to the United States in 2001 after a series of natural disasters.
These policies cover people who have worked, raised families, educated themselves and built their lives in the United States. This alone should be reason to value their relationship to the United States and regularize their legal status. But the killings and abuse that many Salvadorans will face if they are returned makes the need for Congress to enact legislation to protect recipients of these programs even more acute.
Former long-term residents of the United States face unique risks. Salvadorans who have lived in the United States are often extorted by gangs, as two cases we investigated in detail illustrate. In each, the person’s long-term residence meant that they were seen as having more wealth than most Salvadorans. They were repeatedly extorted by gangs and ultimately killed for their refusal to pay bribes.
But the Trump administration is not solely at fault here. Existing law, passed long before President Trump took office, has largely barred people with criminal convictions from seeking asylum, even when they face harm. They include a young man whose case we investigated, who at age 17, in 2010, fled gang recruitment and violence for the United States. After serving a sentence for two counts related to burglaries in the United States, he was denied protection, deported in 2017 and killed about three months later.
There is a simple way to prevent the murders and abuse we spent the past year and a half investigating: Give all noncitizens a full and fair opportunity to explain what abuses they fear before deporting them. As Sen. Robert Menendez (D-N.J.) said in a statement after we released our report, the United States must stop “knowingly signing a death sentence by forcibly returning vulnerable people to the very place they fled.”
The right to a fair hearing on claims for protection should apply to everyone — including the more than 59,000 people waiting in dangerous and inhumane conditions in Mexican border towns, people who had been living under the TPS or DACA programs, or those who have paid their debt to society after serving criminal sentences.
Now U.S. authorities are on notice about what is likely to happen when they deport Salvadorans without adequately considering their cases. This shameful and illegal practice should stop.

Indeed, I’d argue that death, torture, rape, extortion, and exploitation of refugees from the Northern Triangle has always been a main objective of the Trump regime’s White Nationalist, anti-asylum policies, just like inflicting punishment through child separation and thereby achieving “deterrence” was the real objective of the “zero tolerance policy.”
Obviously, folks in charge lied about it to the press, the Congress, and to the U.S. courts. And, to date, they have gotten away with it. But, oppressors, particularly arrogant and self-righteous ones, usually leave “paper trails.” Despite shredding machines and “lost” databases, I imagine that the truth about Miller, Bannon, Sessions, Barr, Cuccinelli, and others will eventually come out when historians finally get their hands on the “Trump regime papers.” I’ll be long gone by then. But, I can virtually guarantee that the whole truth will be much, much worse than we can even imagine at this point.
It isn’t that the regime and even the Article III Federal Courtsdon’t know what happens or is likely to happen to those “orbited” to the Northern Triangle. It’s just that the don’t care. As I constantly point out, this is all about dehumanizationand “Dred Scottification“ of “the other.”If we dehumanize them, its easier to ignore what we’re doing to them. How else could anybody justify the absolute unconstitutional farce and mockery of fundamental fairness and the rule of law that unfolds in our Immigration “Courts,” run by an openly enforcement-driven DOJ every day, right in plain view. A federal judge has ruled that President Donald Trump’s administration, which often boasts about defending religious liberty, has violated the religious rights of a group of volunteers at the U.S.-Mexico border.
The Trump administration has spent years cracking down on the work of No More Deaths/No Más Muertes, a Unitarian Universalist ministry in Arizona that provides water and food to migrants crossing a treacherous stretch of desert along the border where dozens have died. Various members of No More Deaths have faced fines and even jail for what they consider to be faith-based, life-saving humanitarian aid.
But for the second time in months, a judge has ruled that the government shouldn’t be punishing these volunteers for putting their faith into practice.
U.S. District Judge Rosemary Márquez ruled Monday that four volunteers who left water and food for migrants at the Cabeza Prieta National Wildlife Refuge were acting according to their “sincerely held religious beliefs.” As a result, the government substantially burdened the volunteers’ religious liberty by prosecuting them for this work, Marquez said.
“Given Defendants’ professed beliefs, the concentration of human remains on the [refuge], and the risk of death in that area, it follows that providing aid on the [refuge] was necessary for Defendants to meaningfully exercise their beliefs,” the judge wrote.
Márquez’s ruling reversed the decision of a lower court, where another judge dismissed the volunteers’ religious liberty claims and sentenced them to probation and fines last March.

The case against the four volunteers ― Natalie Hoffman, Oona Holcomb, Madeline Huse and Zaachila Orozco-McCormick ― goes back to December 2017, a year when 32 sets of human remains were recovered from the Cabeza Prieta National Wildlife Refuge. The volunteers were charged with misdemeanors for entering the wildlife refuge without proper permits and leaving behind jugs of water and cans of beans, which the government called abandonment of property.
The volunteers’ defense hinged on the Religious Freedom Restoration Act of 1993 (RFRA). The law states that if a defendant can prove that the government is substantially burdening her “sincerely held religious beliefs,” then the government has to show that it’s using the “least restrictive” path to achieving its goals.

RFRA initially had broad bipartisan support. But more recently, the religious right has been using RFRA as a way to secure exemptions for conservative beliefs about abortion and LGBTQ rights. The evangelical Christian owners of the Hobby Lobby craft stores famously used RFRA to avoid paying for insurance coverage for contraception.
Under Trump, the Department of Justice has urged a narrow reading of RFRA claims made by people of faith who do not share the administration’s policy goals, according to Katherine Franke, faculty director of Columbia University’s Law, Rights, and Religion Project.
“The Trump Department of Justice has taken a biased approach to defending and enforcing religious liberty rights under RFRA, robustly protecting the rights of conservative Evangelical Christians while prosecuting people whose faith moves them to oppose the government’s policies,” Franke told HuffPost in an email.
Michael Bailey, the Trump-nominated U.S. attorney for Arizona, said his team has no issue with Márquez’s finding that strong religious beliefs motivated the defendants’ acts.
“We highly value religious freedom without regard to where on the spectrum one’s beliefs might fall,” Bailey told HuffPost in a statement.

No More Deaths is a Unitarian Universalist ministry. But all four volunteers are technically religiously unaffiliated, which means they are part of a growing group of Americans who decline to identify with any specific religious tradition.
During testimonies, the four described feeling a spiritual calling to volunteer, inspired by beliefs about the sanctity of human life. They also spoke about taking moments of silence in the refuge to reflect on the suffering of those crossing the desert.
Holcomb said that she had constructed a “personal altar” at her home that included a ring of water bottles she picked up in the desert.
“There is … for me, I will say, like a deep spiritual need and a calling to do work based on what I believe in the world,” Holcomb testified, according to the judge’s opinion.
In its response to the volunteers’ appeal, the government argued that their beliefs were not truly religious because they didn’t explain how they fit into a “particular system of religious or spiritual beliefs.” The government also asserted that the volunteers were “draping religious garb” over “secular philosophical concerns.”
In her opinion, Márquez said that the volunteers’ RFRA claims can’t be dismissed just because they described their beliefs in broad terms and don’t belong to an established religion. She pointed out that religious and political motivations overlapped in the Hobby Lobby case. ThatSupreme Court verdict has shown that government faces an “exceptionally demanding” obligation to be minimally restrictive while imposing on a person’s religious exercise, Márquez said.
Ultimately, the government had failed to demonstrate that prosecuting the volunteers was the least restrictive means of achieving a compelling governmental interest, the judge said.

Márquez’s decision comes months after another No More Deaths volunteer, Scott Warren, was acquitted of a federal misdemeanor charge for leaving water jugs in the Cabeza Prieta National Wildlife Refuge for migrants. The judge in that case also acknowledged that Warren’s action was protected by his right to religious freedom. That was one of the first times progressive religious beliefs related to immigration have been protected in this way, the Law, Rights, and Religion Project told HuffPost in November.
Franke said there are other cases where progressive people of faith are making religious exemption claims. The Rev. Kaji Douša, a New York pastor and immigrant rights activist, claims the federal government violated her religious freedom when she was detained and placed on a watch list for ministering to asylum seekers at the U.S.-Mexico border. The government has “trivialized” Douša’s RFRA claims and urged the court to dismiss them, Franke said.
In Philadelphia, the DOJ is trying to prevent a faith-based overdose prevention organization from opening a safe injection site, arguing that its “true motivation is socio-political or philosophical — not religious — and thus not protected by RFRA.”
Franke said that when Congress passed RFRA in 1993, the statute was meant to protect the religious liberty of people across a wide spectrum of beliefs, “not just some, and certainly not only those who hold religious beliefs that were shared with the current federal administration.”
Parker Deighan, a spokesperson for No More Deaths, told HuffPost that Márquez’s ruling on Monday reaffirms that “providing humanitarian aid is never a crime.”
“This ruling shows that religious freedom is not just for the Christian right, as the Trump administration would have us believe,” she said. “We hope that that Judge Marquez’s ruling signifies a shift towards religious freedom exemptions being used to protect the work of people and organizations fighting on the side of justice, such as migrant solidarity organizations and indigenous peoples fighting for protection of their sacred lands and traditions, rather than protection for discrimination and bigotry.”

So, here’s the deal.
The Trump (the least religious and most immoral President in U.S. History) regime uses a bogus “religious protection” rationale to cloak far-right programs of hate, intolerance, dehumanization, marginalization, and cruelty directed at people of color, the LGBTQ community, migrants, refugees, women, children, Muslims, Jews, and other vulnerable groups. According to the regime, “religious freedom” is limited to the “extremist religious right.”
Then, the regime attempts to misuse “the law” to punish those who actually “show Christ-like love in word and in deed.” To her credit, U.S. District Judge Rosemary Márquez “just said no” to this disingenuous nonsense.
The only way to stop the intellectual dishonesty, mockery of religious humanitarian principles, and misuse of our laws is to oust Trump and his enablers from office at every level. Otherwise, we can expect the persecution and cruelty to continue.
And don’t be surprised if the “J.R. Five” on the Supremes find a way to manipulate the system to enable the persecution of others to continue and grow worse. It’s what complicit “judges” do in the face of tyrants.
While the regime is using your tax dollars to pervert the law to persecute humanitarian workers, they are simultaneously violating our Constitution, our statutes, and our international obligations, with the connivence of the Supremes and Federal Appeals Courts who choose to look the other way rather than standing up for individuals’ rights against authoritarian overreach.
It’s time to stand up for our Constitutional rights, human rights, and human decency. Throw the corrupt and immoral GOP and their collaborators out of office at the next election, and bring in Government officials, legislators, and life-tenured judges who are willing and able to stand up for their oaths of office!
Impeach-O-Meter Goes to the Senate: Schiff Takes His Losses Like a Winner

The re-relaunched Impeach-O-Meter is a wildly subjective and speculative estimate of the likelihood that Donald Trump will be removed from office by impeachment trial before the end of his first term.
At 1:31 a.m., the tail end of a long Tuesday night in the Senate, Rep. Adam Schiff stepped to the lectern to deliver his final remarks on the Senate Democrats final attempt to amend Senate Majority Leader Mitch McConnell’s proposed rules for the impeachment trial of Donald Trump. Schiff, the lead impeachment manager from the House, had been talking off and on for hour upon hour, as legal Twitter marveled at his agility and endurance, the president’s legal team snarled derisively at his arguments, and the rock-solid Republican majority voted again and again to ignore whatever his side was proposing.
This time it was a measure to give Chief Justice John Roberts, presiding over the trial, the authority to resolve disputes about which witnesses would or wouldn’t be relevant to the case—if McConnell’s rules ever did allow any witnesses to be called. Jay Sekulow, the president’s personal attorney, had mounted the argument against it, making a terse case that continued along the path established by all the previous defense arguments, heading inexorably toward the legal doctrine of Nuh-Uh.
“With no disrespect to the chief justice,” Sekulow said, “this is not an appellate court. This is the United States Senate. There is not an arbitration clause in the United States Constitution. ‘The Senate shall have the sole power to try all impeachments.’ We oppose the motion—the amendment.”
Sekulow had been hunched over the podium, visibly annoyed at the length of the proceedings. Roberts, throughout the day, had lost his own famous bloom of boyishness till he looked more and more like his predecessor William Rehnquist. But Schiff smiled a little as he started speaking.
“Well,” he said, “this is a good note to conclude on, because don’t let it be said we haven’t made progress today. The president’s counsel has just acknowledged for the first time that this is not an appellate court. I’m glad we have established that. This is the trial, not the appeal. And the trial ought to have witnesses, and the trial shouldn’t be based on the cold record from the court below, because there is no court below, because, as the counsel has just admitted, you are not the appellate court.”
This was, in a certain sense, a triumph. The premise behind McConnell’s trial rules, worked out in advance with Trump’s defense team, was supposed to be that the House has already given the president’s misdeeds a full airing. The Senate is simply there to review the House’s conclusions, and if the House failed to secure all the witnesses and documents to make the case indisputable—thanks to blanket executive defiance of subpoenas, backed by judicial slow-walking—then the Senate has no constitutional duty to try to learn more.
The premise was absurd, but the president’s defenders had been arguing absurd things all day, when they weren’t arguing false ones. Schiff had patiently, thoroughly countered each argument. And now he had maneuvered Trump’s personal lawyer into making the case against the ostensible core of the defense strategy.
It was elegant and pointless, like seeing a basketball player put on a scoring exhibition in an empty gym after even the janitor has swept up and gone home. The real core of the defense strategy is that Mitch McConnell is going to acquit the president no matter what happens. Trump is obviously guilty of abusing his power to try to force Ukraine to advance his political interests for him; between impeachment and trial, the Government Accountability Office helpfully affirmed that his plain undisputed act of withholding aid funds was illegal all on its own.*
The figurative gutters of Fifth Avenue are awash in blood and spent shell casings. What the Senate cameras recorded was a day-long showdown between reason and brute force. Schiff and the other impeachment managers have all the facts and principles on their side. The president’s defenders had nothing to counter them with but nonsense and lies. Nonsense, lies, and 53 votes.

But, Trump gets a rigged guaranteed acquittal in a “show trial’ without regard to the evidence, engineered by corrupt GOP “jurors” who pre-pledged to violate their oaths of fairness and impartiality.
It’s hard to keep up with President Donald Trump’s scandals. One day he’s covering up taxpayer-funded travel expenses for his family. The next, he’s stealing money for his border wall. The next, he’s being implicated by an accomplice in the extortion of Ukraine. But one horror is right out in the open: Trump is a remorseless advocate of crimes against humanity. His latest threats against Iran, Iraq, and Syria are a reminder that he’s as ruthless as any foreign dictator. He’s just more constrained.
In Africa and the Middle East, Trump proudly advocates plunder. In October, he said the United States should have taken Iraq’s oil to make sure we were “paid back” for the costs of our occupation of that country. In Syria, he stationed U.S. forces at oil fields, explaining that he viewed those fields as a revenue stream. (“$45 million a month? Keep the oil.”) He proposed a business arrangement to exploit Syria’s oil: “What I intend to do, perhaps, is make a deal with an ExxonMobil or one of our great companies to go in there and do it properly.” Last Friday, in a Fox News interview, the president repeated that he cared only about the oil. “I left troops to take the oil,” he told Laura Ingraham. “The only troops I have are taking the oil.”
Two weeks ago, the United States killed Iranian Gen. Qassem Soleimani in a drone strike.
To deter retaliation, Trump threatened to bomb Iran’s cultural sites—an explicitwar crime. “If Iran strikes any Americans, or American assets,” he tweeted, “we have targeted 52 Iranian sites … some at a very high level & important to Iran & the Iranian culture, and those targets, and Iran itself, WILL BE HIT VERY FAST AND VERY HARD.” In an exchange with reporters, Trump dismissed legal objections to his threat. “They’re allowed to kill our people. They’re allowed to torture and maim our people,” he fumed. “And we’re not allowed to touch their cultural site? It doesn’t work that way.”
Iraq’s Parliament, furious that Trump had killed Soleimani on its soil and without its consent, voted to expel American troops. But Trump refused to comply unless Iraq paid ransom. “We have a very extraordinarily expensive air base that’s there,” he told reporters. “We’re not leaving unless they pay us back for it.” He threatened to “charge them [the Iraqis] sanctions like they’ve never seen before.” Later, Trump told Ingraham that Iraq would also “have to pay us for embassies.” When she asked him how he planned to extract the payment, Trump replied, “We have $35 billion of their money right now sitting in an account. And I think they’ll agree to pay. … Otherwise, we’ll stay there.”
Trump views the military as a mercenary force he can send around the world for hire. A Very Stable Genius, the new book by Philip Rucker and Carol Leonnig of the Washington Post, describes a White House meeting at which Trump said American troop deployments should yield a profit. Trump told Ingraham he’s doing exactly that: “We’re sending more [troops] to Saudi Arabia, and Saudi Arabia’s paying us for it.” He recounted his business pitch to the Saudis: “You want more troops? I’m going to send them to you, but you’ve got to pay us.” And he proudly reported that the Saudis had accepted the deal. “They’re paying us,” he told Ingraham. “They’ve already deposited $1 billion in the bank.”
Trump’s amorality—his complete indifference to rules against theft, abuse, exploitation, and killing—is a public relations problem for his apologists. They struggle to cover it up. First they softened his Muslim ban to a “travel ban” on certain majority-Muslim countries. Then they concocted non-sadistic rationales for his family-separation policy. Last week, after Trump threatened Iran’s cultural sites, Secretary of State Mike Pompeo assured the public that Trump would obey the law. Pompeo also whitewashed Trump’s threats against Iraq, insisting that American troops were in that country to protect its “sovereignty.” Mark Esper, the secretary of defense, claimed that when Trump spoke of Saudi Arabia paying for U.S. troop deployments, “What the president is referring to is burden sharing.”
But Trump refuses to be silenced. Hours after Pompeo promised that the president wouldn’t target Iran’s cultural sites, Trump repeated that he would. Later, Trump stiff-armed Ingraham’s attempts to clean up his language about stealing Syrian oil. “I left troops to take the oil,” he told her. She tried to correct him: “We’re not taking the oil. They’re protecting the facilities.” Trump shrugged off this reformulation. “Well, maybe we will, maybe we won’t,” he said. “Maybe we should take it. But we have the oil.”
Having an evil president doesn’t make the United States evil. We have a lot to be proud of: a culture of freedom, a strong constitution, vigorous courts, democratic accountability, and laws that protect minorities and human rights. On balance, we’ve been a force for good in the world. But Trump’s election and his persistent approval from more than 40 percent of Americans are a reminder that nothing in our national character protects us from becoming a rapacious, authoritarian country. What protects us are institutions that stop us from doing our worst.

I’d argue that far from being a strong bulwark against Trump’s authoritarian tyranny, our democratic institutions – Congress, Article III Courts, the bureaucracy, and even much of the media — are in a state of constant meltdown under his regime’s relentless attacks. We can see that graphically played out every day in the GOP’s largely fact free and totally dishonest defense of Trump’s running roughshod over both the Congress and our Constitution.
I can’t detect a sliver of desire on the part of the GOP and its enablers to hold Trump accountable for any misdeed — even soliciting foreign interference in our electoral process and then lying to cover it up. The facts really aren’t in dispute here. Whether the U.S. could survive another four years of Trump and remain a democratic republic is still, unfortunately, an open question.
We can hope for the best. But, without “regime change” in November 2020, the worst might still be ahead.
In the meantime, the Article III Courts should do their constitutional duty and stop “coddling” the regime’s various schemes and gimmicks to commit, encourage, and enable “crimes against humanity.” We certainly aren’t going to get any accountability or restraint on Trump’s misconduct and open contempt for American institutions from a Congress where the Senate is led by “Moscow Mitch” and his enablers.
It was a 25-year-old Martin Luther King Jr., whose birthday is celebrated on Monday, who stood in the pulpit of Detroit’s Second Baptist Church on Feb. 28, 1954. The Montgomery bus boycott, which would launch the future leader of the American civil rights movement to national prominence, was nearly two years away.
King roused the Second Baptist congregation that Sunday morning with a sermon that did not once mention race. Discrimination, segregation, protest demonstrations — these were not on his agenda. The young preacher went deeper, if such a thing was possible during an era of racial turmoil.
King got the congregation thinking about values, a subject as relevant today as it was in 1954.
King talked about lost values and the need for rediscovering them.
Something seemed fundamentally wrong in society, he preached. And it wasn’t because society didn’t know enough. Scientific progress was amazing. King said in 18th-century America, it took three days for a letter to go from New York City to Washington; in 1954, a person could go from Detroit to China in less time.
It’s even more astonishing today. Breakfast can be had in Washington, teatime enjoyed in London and a nightcap swallowed in New York City — all in the same day.
The trouble, he said, was not that we don’t know enough but that “we aren’t good enough.” Scientific genius, he said, has outpaced “our moral genius.” The greater danger facing the country in ’54, King noted, was not “the atomic bomb that was created by physical science” that could be dropped on the heads of thousands of people, but “that atomic bomb which lies in the hearts and souls of men, capable of exploding into the vilest of hate and into the most damaging selfishness.”
That thought calls to mind the more than three dozen countries in the world with unmanned, missile-armed drones capable of being launched from afar under remote control and striking and killing with precision. Think about what lies within the hearts and souls of leaders in countries such as North Korea, China, Iran, Russia, Turkey and, yes, the United States.
King called attention to shaky moral foundations and the “relativistic ethic” that was being applied to right and wrong. He described it as an ethic that says “since everybody is doing it, it must be right” — an ethic that means “people can’t stand up for their . . . convictions, because the majority of people might not be doing it.” He said it’s “a sort of numerical interpretation of what’s right.”
King’s teaching got me to thinking about the 53 Senate Republicans who know that some things are right and some things are wrong, but adjust their attitudes relative to the behavior of President Trump.
King said he was at Second Baptist to say that some things are right and wrong, eternally and absolutely. “It’s wrong to hate,” he declared. “It has always been wrong, and it always will be wrong. It’s wrong in America, it’s wrong in Germany, it’s wrong in Russia, it’s wrong in China. It was wrong in 2000 B.C., and it’s wrong in 1954 A.D. It always has been wrong, and it always will be wrong!”
That got me thinking about White House senior policy adviser Stephen Miller. How can a person who pushes white nationalism, invokes a 1924 American immigration law extolled by Adolf Hitler, is bigoted and racially intolerant — how can he end up in the White House?
Then I stopped to think about who put Miller where he is — President Trump. The same President Trump who recently retweeted to his 71 million followers a doctored photo of House Speaker Nancy Pelosi (D-Calif.) wearing a hijab and Sen. Charles E. Schumer (D-N.Y.) with a turban on his head in front of an Iranian flag with a caption reading, “the corrupted Dems trying their best to come to the Ayatollah’s rescue.” Why wouldn’t an insulter of Islam and Muslims, who also inflicts cruelty at our southern border, want to have the likes of Stephen Miller at his side?
King’s sermon derided what he regarded as a pragmatic test applied to right and wrong: “If it works, it’s all right. Nothing is wrong but that which does not work. If you don’t get caught, it’s right.”
=Which made me think of Trump using the powers of his office to solicit a foreign government to help take down a domestic political opponent, lying about his successes and taking credit for things he didn’t do — all because it works. And his adoring believers eat it up.
King reminded the Second Baptist worshipers that “it’s possible to affirm the existence of God with your lips and deny his existence with your life.”
Which makes me visualize Trump basking at evangelical rallies and paying lip service to God, while paying actual service to himself.

President Trump made a stark appeal to black Americans during the 2016 election when he asked, “What have you got to lose?” Three years later, black Americans have rendered their verdict on his presidency with a deeply pessimistic assessment of their place in the United States under a leader seen by an overwhelming majority as racist.
The findings come from a Washington Post-Ipsos poll of African Americans nationwide, which reveals fears about whether their children will have a fair shot to succeed and a belief that white Americans don’t fully appreciate the discrimination that black people experience.
While personally optimistic about their own lives, black Americans today offer a bleaker view about their community as a whole. They also express determination to try to limit Trump to a single term in office.
More than 8 in 10 black Americans say they believe Trump is a racist and that he has made racism a bigger problem in the country. Nine in 10 disapprove of his job performance overall.
The pessimism goes well beyond assessments of the president. A 65 percent majority of African Americans say it is a “bad time” to be a black person in America. That view is widely shared by clear majorities of black adults across income, generational and political lines. By contrast, 77 percent of black Americans say it is a “good time” to be a white person, with a wide majority saying white people don’t understand the discrimination faced by black Americans.
Courtney Tate, 40, an elementary school teacher in Irving, Tex., outside Dallas, said that since Trump was elected, he’s been having more conversations with his co-workers — discussions that are simultaneously enlightening and exhausting — about racial issues he and his students face everyday.
“As a black person, you’ve always seen all the racism, the microaggressions, but as white people they don’t understand this is how things are going for me,” said Tate, who said he is the only black male teacher in his school. “They don’t live those experiences. They don’t live in those neighborhoods. They moved out. It’s so easy to be white and oblivious in this country.”
Francine Cartwright, a 44-year-old mother of three from Moorestown, N.J., said the ascent of Trump has altered the way she thinks about the white people in her life.
“If I’m in a room with white women, I know that 50 percent of them voted for Trump and they believe in his ideas,” said Cartwright, a university researcher. “I look at them and think, ‘How do you see me? What is my humanity to you?’ ”
The president routinely talks about how a steadily growing economy and historically low unemployment have resulted in more African Americans with jobs and the lowest jobless rate for black Americans recorded. Months ago he said, “What I’ve done for African Americans in two-and-a-half years, no president has been able to do anything like it.”
But those factors have not translated positively for the president. A 77 percent majority of black Americans say Trump deserves “only some” or “hardly any” credit for the 5.5 percent unemployment rate among black adults compared with 20 percent who say Trump deserves significant credit.
In follow-up interviews, many said former president Barack Obama deserves more credit for the improvement in the unemployment rate, which declined from a high of 16.8 percent in 2010 to 7.5 percent when he left office.
Others said their personal financial situation is more a product of their own efforts than anything the president has done.
“I don’t think [Trump] has anything to do with unemployment among African Americans,” said Ethel Smith, a 72-year-old nanny who lives in Lithonia, Ga., a suburb of Atlanta. “I’ve always been a working poor person. That’s just who I am.”
Black Americans report little change in their personal financial situations in the past few years, with 19 percent saying it has been getting better and 26 percent saying it has been getting worse. Most, 54 percent, say their financial situation has stayed the same.
A similar 56 percent majority of African Americans rate the national economy as “not so good” or “poor,” contrasting with other surveys that find most Americans overall rate the economy positively, although there are sharp political divides on this question.
Beyond questions about the economy, African Americans see a range of concerns impacting the country overall as well as their own communities.
Just 16 percent of black Americans believe that most black children born in the U.S. today have “a good opportunity to achieve a comfortable standard of living.” A 75 percent majority think most white children have such an opportunity.
More than 8 in 10 say they do not trust police in the United States to treat people of all races equally, and 7 in 10 distrust police in their own community.
Black Americans also widely sense that their experiences with discrimination are underappreciated by white Americans. Just about 2 in 10 say that most white Americans understand the level of discrimination black Americans face in their lives, while nearly 8 in 10 say they do not.
The starkly negative outlook appears to be a turnabout from previous points during both the Obama and George W. Bush presidencies, according to surveys asking related questions. A 2011 Washington Post-Kaiser Family Foundation survey found 73 percent of black women said it was a “good time” to be a black woman in America, while a similar survey in 2006 found 60 percent of black men saying it was a good time to be a black man.
Yet the Post-Ipsos poll also finds that 65 percent of black Americans say they feel optimistic about their own lives most or all of the time. This positive personal outlook crosses age and political groups, and while it peaks among those who are older and with higher incomes, roughly half of black Americans with incomes under $35,000 annually say they feel optimistic about their own lives.
Dana Clark, a father of 11 children in Ontario, Calif., said he tells all of his children that it’s possible to succeed in America, but that they’ll have to work harder than the white children they encounter.
“I tell them we’re going to set this plan up. Whatever you want to do you’re going to be able to do it,” he said. “But it ain’t going to be easy, especially if [you] want to make some money because you’re going to be in a world where they’re not going to expect you to be there. You can get what you want, but you’ve got to work harder, faster and stronger.”
The survey, by The Post and Ipsos, a nonpartisan research firm, is one of the most extensive recent surveys focused on views of the country and President Trump among black Americans, who are often represented by only small samples in customary national polls. It was conducted among 1,088 non-Hispanic black adults, including 900 registered voters, drawn from a large online survey panel recruited through random sampling of U.S. households.
Few black voters responded positively to Trump’s campaign appeal for their votes. Exit polls taken during the 2016 election showed just 8 percent of African Americans supported Trump and 89 percent backed Democratic nominee Hillary Clinton, although black turnout was significantly lower than in 2008 and 2012 for the election and reelection of Obama, the country’s first black president.
In the Post-Ipsos poll, roughly three-quarters of black adults say the things that Trump is doing as president are “bad for African Americans,” while a similar majority says Obama’s actions as president were good.
Kenneth Davis, a truck driver who lives outside Detroit, said that when Trump was elected, co-workers who secretly harbored racist thoughts felt emboldened to publicly express them.
“One gentleman is waving the Confederate flag on the back of his pickup truck,” said Davis, 48, who is a Marine Corps veteran. “He was very brave to say ‘Trump’s president, I’m going to get my window (painted).’ ”
Retired federal prison warden Keith Battle said the political climate has exposed “unresolved racial issues” and that Trump has emboldened white supremacists. Battle, who lives in Wake Forest, N.C., said white supremacists “are not the majority of whites in America, but there is a significant amount still, I’d say 30 percent, and I think they’re just leading the country down a path of, eventually, chaos. They’re feeling jeopardized of losing their white privilege.”
Survey respondents were asked to say how Trump’s presidency has affected them personally or African Americans in general. The responses illuminated the data in the poll.
“Donald Trump has not done anything for the African American people,” said one person.
“He has created an atmosphere of division and overt racism and fear of immigrants unseen in many years,” said another.
A third said, “He has taken hatred against people of color, in general, from the closet to the front porch.”
Others echoed that sentiment, saying that the president has emboldened those with racially prejudiced views and therefore set back race relations for years. “I sense a separation between myself and some of my white associates,” one person wrote.
Trump’s overall approval rating among black Americans stands at 7 percent, with 90 percent disapproving, including 75 percent who disapprove “strongly.”
Similarly large majorities of black men and women disapprove of Trump, as do black Americans across different age, education and income levels. Trump receives somewhat higher marks among self-identified black conservatives, with 25 percent approving of his performance, compared with 5 percent of moderates and 3 percent among liberals.
Few black Americans appear open to supporting Trump’s bid for reelection at this point. He receives between 4 and 5 percent support among black registered voters in head-to-head matchups against eight potential Democratic nominees. But the level of Democratic support depends on who is the party’s nominee, peaking at 82 percent for former vice president Joe Biden and falling to 57 percent for former South Bend, Ind., mayor Pete Buttigieg.
The Post-Ipsos survey was conducted Jan. 2-8, 2020, through Ipsos’s KnowledgePanel, a large online survey panel recruited through random sampling of U.S. households. Overall results have a margin of sampling error of plus or minus 3.5 percentage points among the sample of 1,088 black adults overall, and four points among the sample of 900 registered voters.

Unfortunately, it’s painfully simple. The GOP is the “21st Century Party of Jim Crow.” Those of us who believe in the 14th Amendment, equal justice, and human decency had better hang together to remove Trump and as many of his GOP toadies as possible from office in 2020.

Today’s biggest story set the scene for news that continues to develop about the Ukraine scandal.
The big story, in terms of its ability to frame the crazy events coming at us at top speed, happened last night, when Attorney General William Barr gave a speech to the Federalist Society, a group of conservative and libertarian lawyers who argue for an originalist interpretation of the Constitution. The conviction of members of the Federalist Society that courts should not do anything that is not listed in the original Constitution makes them great friends to business and to white men, since they focus on the protection of property and deny that laws can regulate business, provide a basic social safety net, or protect minority or women’s rights. The Federalist Society organized in 1982 to push back against what its members felt was an activist court system that tried to reorganize society from the bench. It has been extraordinarily successful in taking over the courts: currently five members of the nine-member Supreme Court are current or past Federalist Society members: Clarence Thomas, John Roberts, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh.
In his speech, Attorney General William Barr claimed he was going truly to be an originalist, and explained by taking American history back to its roots. In contrast to every single American historian in, well, American history, Barr argued that Americans had rebelled not against King George III in 1776, but rather against Parliament. What the Founders feared, he said, was not a strong executive, but rather a strong Parliament. (You can tell where this is going, right?) Barr was setting up the idea that Congress has grown far too strong lately (in fact, virtually every scholar will tell you that it is the Executive that has grown terribly strong since 1981) and that it is badly hampering the president’s ability to do his job. The president should be able to act on his own initiative, and not be checked by either congressional or judicial oversight, Barr insisted, in a theory known as that of the “unitary executive.”
Barr did not stop there, though. He went on to blame “The Resistance” for sabotaging the Trump administration, and claimed that its members were “engaged in a war to cripple, by any means necessary, a duly elected government.” More, he claimed “the Left” is “engaged in the systematic shredding of norms and the undermining of the rule of law.” Conservatives, he said, were at a disadvantage against progressive’s “holy war” because they “have more scruple over their political tactics” especially when facing “a hyper-partisan media.” (You might want to reread those last two sentences.)
Richard Painter, who was George W. Bush’s ethics lawyer, called this a “lunatic authoritarian speech.” Attorneys General are supposed to be non-partisan, and Barr lumped all opposition to Trump as the dangerous far left. The “Left,” in America, generally refers to those few people who advocate for communism—a system in which the government owns and controls all industries and businesses– or anarchy, a system in which there is no central authority at all. It’s actually a pretty small group. But Barr, and other recent Republicans, have included in “the Left” everyone who believes that the government has any role to play in regulating business, providing a basic social safety net, and promoting infrastructure, all those things the Federalist Society opposes. In fact, most of us, regardless of whether we vote Republican or Democratic, want some basic regulations, social welfare programs, and infrastructure development.
But now the Attorney General, who is charged with overseeing our justice system, has declared that anyone standing in the way of Trump is not just a member of “the Left” but also is waging war against America. Painter is quite right: this is the language that enables a leader to imprison people he considers his enemies.
Barr is not saying all this in a vacuum. More news dropped today about the Ukraine scandal, filling in the lines we already suspected. Congress released transcripts today from Tim Morrison and Jennifer Williams, both of whom were deeply involved in the Ukraine mess and were on the July 25 call between Trump and Zelensky. A long-time career official in the State Department, Morrison replaced Fiona Hill as the Senior Director for Russia and Europe in July 2019. Williams is another long-standing career officer in the State Department. Since April 2019, she has been the Special Adviser for Europe and Russia for Vice President Mike Pence. Morrison said that Ambassador to the European Union Gordon Sondland made it clear that aid was being withheld until there was an announcement about an investigation into Burisma, the company on whose board Hunter Biden sat.
This jibed with the opening statement of David Holmes, the political counselor at the Embassy in Kyiv, who testified for seven hours yesterday behind closed doors. Holmes was an eye-witness to the efforts of Trump, his lawyer Rudy Giuiliani, and Ambassador to the European Union Gordon Sondland, to pressure the new Ukraine president Volodymyr Zelensky into announcing an investigation into Burisma, the company on whose board Hunter Biden sat. Holmes’s opening statement was explosive. It was not only first hand, but also it tied Trump directly into the efforts, and it made very clear that the administration was demanding the announcement of an investigation before it would release the money Congress had appropriated for Ukraine’s fight against Russian incursions. Holmes also said that he had reported what he had heard to John Eisenberg, Legal Advisor to the National Security Council, the same man to whom Lt. Col. Alexander Vindman had reported the July 25 call, and, once again, Eisenberg had done nothing. (Eisenberg is refusing to honor a subpoena to testify.)
Then, CNN dropped the story that at last year’s White House Hanukkah party Lev Parnas and Igor Fruman met privately with Trump and Giuiliani. After the meeting, Parnas told two people that the president had given him a secret mission to pressure the Ukraine government to investigate Joe and Hunter Biden. The Wall Street Journal reports that in February, Parnas and Fruman met with the Ukraine President at the time, Petro Poroshenko, and his Prosecutor General Yuriy Lutsenko, offering to invite Poroshenko to a White House State dinner if he publicly announced an investigation. As I wrote here two days ago, this would have boosted both Poroshenko’s and Trump’s reelection campaigns. In March, Lutsenko smeared U.S. Ambassador to Ukraine Marie Yovanovitch to an American reporter and Sean Hannity ran with the story on his show, but the scheme fell apart when voters elected Zelensky instead of reelecting the corrupt oligarch Poroshenko. Then they had to scramble to come up with a new plan, and the whole ham fisted Ukraine scandal took off.
The Ukraine scandal is fleshing out, and it is truly astonishing that there is not more evidence that can be read in Trump’s favor. This increasingly just looks like a shakedown that weakened national security to help Trump rig the 2020 election. Meanwhile, in northern Syria, where Turkish and Russian troops moved in when we moved out, the Russians boasted yesterday that they have now occupied a former U.S. air base.
Trump spent several hours today at Walter Reed hospital. The visit was unexpected and unannounced, but the White House said he had decided to have portions of his annual physical done three months early.
Attorney General Bill Barr Is Getting Roasted for His Outrageous Speech Blasting Progressives
As the impeachment hearings continued, Attorney General Bill Barr on Friday trash-talked Democrats for attempting to “drown the executive branch with oversight demands,” saying they were working for political gain without thinking of the consequences.
“In waging a scorched-earth, no-holds-barred war against this administration, it is the left that is engaged in shredding norms and undermining the rule of law,” Barr told a room of attorneys at the annual gathering of the Federalist Society, a conservative legal group that has been influential in determining President Donald Trump’s nominees for federal judges.
The remarks about Democrats ignoring the rule of law were especially ironic because they came a mere hours after Roger Stone, one of Trump’s previous advisers, was convicted on all counts for lying to Congress during its probe into Russia’s interference in the 2016 election. The attorney general’s speech also came on the second day of presidential impeachment hearings examining allegations that Trump attempted to interfere in the 2020 elections by asking Ukrainian President Volodymyr Zelensky to investigate former Vice President Joe Biden and his son Hunter.
Barr criticized Democrats for launching a “holy war” and using “any means necessary to gain momentary advantage,” while he said conservatives “tend to have more scruple over their political tactics and rarely feel that the ends justify the means.”

Barr reportedly received a standing ovation, but outside the halls of the Federalist Society, his remarks sparked outrage and intensified calls from the left to impeach not only the president, but the attorney general himself. Others were quick to roast Barr for his statements. “Bill Barr is the type of bare knuckles lawyer the Church would have hired thirty years ago to cover up sex abuse cases,” Richard Painter, a former White House ethics counsel, tweeted.

“Yesterday AG Barr addressed a radical political group and gave one of the most vicious partisan screeds ever uttered by a US cabinet officer,” Rep. Bill Pascrell (D-N.J.) tweeted Saturday morning. “Barr says trump should have king-like powers. Barr is a liar and a fanatic and should be impeached and stripped of his law licenses.”

Hours after a new witness testified in the House’s latest impeachment hearing on Friday, Attorney General William Barr railed against Democrats for declaring a “war of resistance against this administration.”
In a speech before the conservative Federalist Society, Barr rebuked lawmakers for probing President Donald Trump’s potential power abuses, suggesting their efforts are illegitimate.
“The sheer volume of what we see today ― the pursuit of scores of parallel investigations through an avalanche of subpoenas ― is plainly designed to incapacitate the executive branch, and indeed is touted as such,” Barr said. “The costs of this constant harassment are real.”
Barr’s portrayal of oversight as harassment echoes Trump’s repeated claims that he is the victim of a partisan “witch hunt” rather than the subject of a justified inquiry into his dealings with Ukraine, which remain at the heart of Democratic-led impeachment proceedings.
“The fact of the matter is that, in waging a scorched earth, no-holds-barred war of resistance against this administration, it is the left that is engaged in the systematic shredding of norms and undermining the rule of law,” Barr added. “This highlights a basic disadvantage that conservatives have had in contesting the political issues of the day.”
President Trump is convinced he has the “absolute right” to do anything from asking other countries to investigate his political opponents to pardoning himself. But he couldn’t possibly tell you why — aside from his innate conviction that “when you’re a star, they let you do it” — you can get away with anything. Enter Attorney General William P. Barr to put a pseudo-intellectual gloss on Trump’s authoritarian instincts. In a Friday night speech to the Federalist Society, Barr gave a chilling defense of virtually unlimited executive authority.
Barr’s wrongheaded assumption was that “over the past several decades, we have seen steady encroachment on presidential authority by the other branches of government.” His view faithfully reflects the conservative consensus of the 1970s when he was a CIA analyst and a law student. Few serious analysts share that view today at a time when the president claims the authority to kill suspected terrorists anywhere in the world without any judicial oversight. In fact, conservatives decried President Barack Obama’s tendency to rule by fiat — for example, in protecting “dreamers” from deportation or reaching a nuclear agreement with Iran that wasn’t submitted for Senate ratification.
Trump has now taken rule-by-executive-order to the next level by declaring a “state of emergency” to spend money on his border wall that Congress refused to appropriate. Trump has also misused his authority in myriad other ways, including obstructing justice (as outlined in a special counsel report that Barr deliberately mischaracterized) and soliciting a bribe from Ukraine to release congressionally appropriated military aid.
Yet, to hear Barr tell it, Trump is somehow denied power by the nefarious “Resistance.” Barr decried Trump critics who do not view “themselves as the ‘loyal opposition,’” but rather “see themselves as engaged in a war to cripple, by any means necessary, a duly elected government.”
Earth to Barr: Trump does not treat his critics as “the loyal opposition.” He calls them “human scum,” “traitors” and “the enemy of the people,” using the language of dictators. And it is Trump and his toadies — not his opponents — who are “willing to use any means necessary to gain momentary advantage.”
Barr went on to blame the “Resistance” for Trump’s failure to get more nominees confirmed. The real problem is Trump’s incompetence and his preference for “acting” appointees to dodge the constitutional requirement to seek the Senate’s “advice and consent.” (Trump has not nominated anyone for nearly 20 percent of the top federal jobs.) If Barr wants to find a real abuse of the confirmation process, he should talk to Merrick Garland.
As devoid of self-awareness as his master, Barr whines about “the pursuit of scores of parallel ‘investigations’ through an avalanche of subpoenas.” He conveniently forgets that Republicans tried to impeach President Bill Clinton for lying about sex and spent years probing the Benghazi, Libya, attack in a failed attempt to blame Hillary Clinton. Trump is stonewalling congressional subpoenas at an unprecedented rate, forcing Congress to seek judicial assistance to enforce legitimate requests for documents and witnesses. But Barr denies that the courts have any right to “resolve … disputes” between the executive and legislative branches — effectively allowing the president to act like a king.
The attorney general went on to rail against judicial review of administration actions such as “the travel ban.” This was ultimately upheld by the Supreme Court after the administration rewrote the initial versions, which constituted clear discrimination on religious grounds. Yet Barr is still aggrieved that the courts dared “to inquire into the subjective motivation behind governmental action” — i.e., to look at Trump’s own words about banning Muslims rather than accept the administration’s disingenuous explanations.
Barr blamed the courts and the president’s critics for the fact that so many administration actions have been challenged in court. The truth is Trump has nobody but himself to blame. Many of the lawsuits accuse the administration of violating the Administrative Procedure Act, which the executive branch can comply with simply by showing that its actions are not “arbitrary and capricious.” This is an incredibly low standard, which is why the normal “win rate” for the government in such cases is about 70 percent. According to the Institute for Policy Integrity at the New York University School of Law, the Trump administration’s win rate is less than 7 percent.
Trump likes to blame such setbacks on “Obama judges,” but many of the judges ruling against him are Republican appointees. Chief Justice John G. Roberts Jr., for example, wrote the 5-to-4 decision in June in which the Supreme Court blocked Trump’s attempt to include a citizenship question on the 2020 Census.
“In this partisan age,” Barr sanctimoniously concluded, “we should take special care not to allow the passions of the moment to cause us to permanently disfigure the genius of our Constitutional structure.” He is right, but not in the way he intended. The real threat to “our Constitutional structure” emanates not from administration critics who struggle to uphold the rule of law but from a lawless president who is aided and abetted in his reckless actions by unscrupulous and unprincipled partisans — including the attorney general of the United States.

He claimed that Barr — a member of the conservative Catholic society Opus Dei — is “the type of bare knuckles lawyer the Church would have hired thirty years ago to cover up sex abuse cases.”

Somewhat “below the radar screen:” Barr’s repetition of Session’s blatantly unethical performance by acting as a “quasi-judicial decision maker” in Immigration Court cases where he clearly has both an actual and apparent bias in favor of a party, the DHS, and against another party, the individual migrant, particularly any asylum seeker.
Obviously, viewed through Barr’s perverted historical lens, we’ve made some seriously wrong moves.According to Barr’s interpretation, we should have allied ourselves with Hitler during World War II. Now, there’s a guy who understood the concept of the “Unitary Executive.” And, he sure knew how to deal with opposing legislators, “the resistance,” and others who were “enemies of the state” or of “inferior stock.” Why on earth would we have aligned ourselves with, and helped rebuild, the noxious parliamentary democracies of the West?
One of our allies, Stalin, did actually demonstrate the wonderful power of the “Unitary Executive” — talk about a guy who WAS the State and annihilated all opposition, real and imagined! He certainly would have known what to do with subversives who preached “impeachment” under the Constitution!
But, concededly, Stalin’s godless communism doesn’t fit in well with Barr’s Catholic Christian theocracy (minus, of course, the social justice teachings of Christ and the Catholic Church). Hitler’s pure Aryian Christian superiority was a much better fit with Barr’s historical outlook.
Of course, according to the Barr view, the seminal figure in Republicanism, Abe Lincoln, erred by not aligning himself with Jeff Davis and the Confederacy. Davis certainly knew how to operate without much legislative accountability. And the founders of the Confederacy also possessed Barr’s superior understanding of the relationship between the State and the Divine: “establish justice, insure domestic tranquillity, and secure the blessings of liberty to ourselves and our posterity — invoking the favor and guidance of Almighty God.”
Sure, easy to believe that God was always a big fan of enslavement, rape, brutality, white privilege, and theft of services from enslaved African Americans, who also happened to be believers in God. Fits right in with Barr’s dehumanization of Hispanic workers, trashing of LGBTQ Americans, denial of rights to asylum seekers, threats to political opponents, and war on Hispanic Americans who have the audacity of wanting to vote and live peacefully in their communities without being terrorized by DHS enforcement.
George Washington, who wrongly refused to install himself as either King or “President for Life” was, according to Barr’s historical perspective, a dangerous wimp who diminished the potential powers of the “Unitary Executive.”
Undoubtedly, our Founders had their flaws. After all, the Constitution not only enshrined the dehumanization of African Americans, who had actually made the success and prosperity of the American Republic possible, but also excluded the majority of inhabitants from political participation.
But, unlike Barr and his fellow “originalists,” our Founders were largely persons of vision and good will who had enough self awareness and humility to see a better and more dynamic future. They would certainly be shocked and dismayed to find out that rather than viewing our Constitution rationally, as a blueprint to be built upon for a better, more inclusive, more tolerant future, two plus centuries later, individuals like Barr holding supposedly responsible positions under our Republic, would be mindlessly and immorally urging us never to escape the limitations and mistakes of our distant past.
Disturbingly unqualified as he is to serve as our Attorney General, Barr does illustrate the moral and legal bankruptcy of the “fake doctrine” of “originalism.” It’s actually an intellectually indefensible excuse for an empowered, largely White, predominantly male, minority to exclude the majority of America’s inhabitants and their hopes and dreams from full participation in our democracy. It’s as ugly and dishonest as Barr’s own tenure as Attorney General.
I haven’t posted for a while. I’ve been extremely busy, but there was something else: my response to so many recent events has been just pure anger. Although I’ve written the occasional “cry from the heart,” I don’t want this blog to turn into the rantings of an angry old man.
So I resume posting with a case that provides a glimmer of hope (and, hopefully, a hint of things to come?). Last week, the U.S. Court of Appeals for the Eleventh Circuit, a court generally known for its conservatism, issued an order granting an emergency stay of removal in the case of Manuel Leonidas Duran-Ortega v. U.S. Attorney General. As is common in such types of grants, the three-judge panel issued a decision consisting of two sentences, granting the stay, and further granting the request of interested organizations to allow them to file an amicus (“friend of the court”) brief.
What made this decision noteworthy is that one of the judges on the panel felt the need to write a rather detailed concurring opinion. Among the issues discussed in that opinion is the impact of the Supreme Court’s decision in Pereira v. Sessions (which I wrote about here: https://www.jeffreyschase.com/blog/2018/9/1/the-bia-vs-the-supreme-court) on Mr. Duran-Ortega’s case. As in Pereira, the document filed by DHS with the immigration court in order to commence removal proceedings lacked a time and date of hearing. In her concurring opinion, Judge Beverly B. Martin observed that under federal regulations, jurisdiction vests, and immigration proceedings commence, only when a proper charging document is filed. The document filed in Mr. Duran-Ortega’s case purported to be a legal document called a Notice to Appear. But as Judge Martin noted, “The Supreme Court’s recent decision in Pereira appears to suggest, as Duran-Ortega argues, that self-described “notice to appears” issued without a time or place are not, in fact, notice to appears” within the meaning of the statute.
Judge Martin (a former U.S. Attorney and Georgia state Assistant Attorney General) continued that the Pereira decision “emphasized” that the statute does not say that a Notice to Appear is “complete” when it contains a time and date of the hearing; rather, he quotes the Pereira decision as holding that the law defines that a document called a “Notice to Appear” must specify “at a minimum the time and date of the removal proceeding.” The judge follows that quote with the highlight of her decision: “In other words, just as a block of wood is not a pencil if it lacks some kind of pigmented core to write with, a piece of paper is not a notice to appear absent notification of the time and place of a petitioner’s removal proceeding.”
As this Reuters article reported (https://www.reuters.com/article/us-usa-immigration-terminations/u-s-courts-abruptly-tossed-9000-deportation-cases-heres-why-idUSKCN1MR1HK) enough immigration judges had a similar reading of Pereira to terminate 9,000 removal cases in the two months between the Supreme Court’s decision and the issuance of a contrary ruling by the Board of Immigration Appeals, in which the BIA’s judges, out of fear of then-Attorney General Jeff Sessions, chose appeasement of their boss over their duty to reach fair and independent decisions.
Judge Martin referenced that BIA decision, Matter of Bermudez-Cota, but stated: “This court need not defer to Bermudez-Cota if the agency’s holding is based on an unreasonable interpretation of the statutes and regulations involved, or if its holding is unambiguously foreclosed by the law…In light of Pereira and the various regulations and statutes at issue here, it may well be the case that deference is unwarranted.”
For those readers who are not immigration practitioners, attorneys with ICE (which is part of the Department of Homeland Security) and the Office of Immigration Litigation (“OIL”) (which is part of the Department of Justice, along with the BIA) have been filing briefs opposing motions to terminate under Pereira using language best described as snarky. A recent brief fled by OIL called the argument that proceedings commenced with a document lacking a time and date must be terminated under Pereira “an unnatural, distorted interpretation of the Supreme Court’s opinion,” and a “labored interpretation of Pereira.” A brief recently filed by ICE called the same argument an “overbroad and unsupported expansion of Pereira [which] is unwarranted and ignores the Court’s clear and unmistakable language.”
There is an old adage among lawyers that when the facts don’t favor your client, pound the law; when the law doesn’t favor your client, pound the facts; and when neither the law nor the facts favor your client, pound the table. I find the tone of the government’s briefs as sampled above to be the equivalent of pounding the table. The government is claiming that to interpret the Supreme Court’s language that “a notice that lacks a time and date is not a Notice to Appear” as meaning exactly what it says is an unnatural, distorted interpretation that is labored and ignores the clear language of the Court. The government then counters by claiming that the natural, obvious, clear interpretation is the exact opposite of what Pereira actually says.
So although it is just the view of one judge in one circuit in the context of a concurring opinion, it nevertheless feels very good to see a circuit court judge calling out the BIA, OIL, and DHS on their coordinated nonsense. Three U.S. district courts have already agreed with the private bar’s reading of Pereira, in U.S. v. Virgen Ponce (Eastern District of Washington); in U.S. v. Pedroza-Rocha (Western District of Texas); and just yesterday, in U.S. v. Soto-Mejia (D. Nev.). At this point, this is only cause for cautious optimism. But as an immigration lawyer named Aaron Chenault was articulately quoted as saying in the above Reuters article, for now, Pereira (and its proper interpretation by some judges) has provided “a brief glimmer of hope, like when you are almost drowning and you get one gasp.” Well said.

ORDER
Before the Court is Mr. Soto-Mejia’s Motion to Dismiss [ECF No. 21] the Indictment in this case, for the reasons stated below the Court GRANTS the Motion to Dismiss.
I. Factual Findings
Based upon the record, including the joint stipulation of fact submitted by the parties [ECF No. 41], the Court makes the following factual findings. Mr. Soto-Mejia was encountered by immigration officials on February 7, 2018 in California. On that same day, February 7, the Department of Homeland Security issued a Notice to Appear for Removal Proceedings (NTA) against Soto-Mejia. The Notice to Appear stated that Soto-Mejia was to appear before an immigration judge on a date and time “[t]o be set” and at a place “[t]o be determined.” Soto-Mejia was personally served with the Notice to Appear at 10400 Rancho Road in Adelanto, California, 92401. The Notice to Appear contained allegations and provided a potential legal basis for Soto-Mejia’s removal from the United States. The Notice to Appear was filed with the Immigration Court in Adelanto, California on February 12, 2018.
On February 27, 2018 an order advancing the removal hearing was served on a custodial officer for Soto-Mejia. On February 27, 2018, a letter entitled “Notice of Hearing in Removal Proceedings” addressed to Soto-Mejia at the Adelanto Detention Facility on 10250 Rancho Road

in Adelanto, California, 92301 was served on a custodial officer for Soto-Mejia. The letter indicated that a hearing before Immigration Court was scheduled for March 7, 2018 at 1:00 p.m. The Notice of Hearing did not reference the nature or basis of the legal issues or charges for the removal proceedings. The Notice of Hearing also did not reference any particular Notice to Appear.
On March 7, 2018, the “Order of the Immigration Judge” indicates that Soto-Mejia appeared at the Immigration Court hearing and that he was ordered removed from the United States to Mexico. Soto-Mejia was deported on March 8, 2018. Subsequently, Soto-Mejia was encountered in the United States again and was ordered removed on March 19, 2018. The March 19 Order, as a reinstate of the prior order, derived its authority to order removal from the March 7 Order. The Indictment in this case explicitly references and relies upon the March 7 and March 19 removal orders as a basis for establishing a violation of 8 U.S.C. § 1326 by Soto-Mejia.
II. Legal Standard
Since a prior order of removal is a predicate element of 8 U.S.C. § 1326, a defendant may collaterally attack the underlying removal order.United States v. Ubaldo-Figueroa, 364 F.3d 1042, 1047 (9th Cir. 2004). To prevail on such a collateral challenge to a deportation order, the individual must demonstrate that (1) he exhausted any administrative remedies he could have used to challenge the order (or is excused from such exhaustion); (2) the deportation proceedings deprived the individual of judicial review (or is excused from seeking judicial review); (3) the entry of the order was fundamentally unfair. 8 U.S.C. 1326(d); Ramos, 623 F.3d at 680.
A removal order is “fundamentally unfair” if (1) an individual’s due process rights were violated by defects in the underlying proceeding, and (2) the individual suffered prejudice as a result. Ubaldo-Figueroa, 364 F.3d at 1048.
III. Discussion
The Defendant argues that this case must be dismissed because his criminal prosecution derives from a defective immigration proceeding in which the immigration court did not have

jurisdiction to commence removal proceedings against him because the Notice to Appear initiating the proceeding was defective. He argues that the March 7 Order is thus void as the immigration court did not have jurisdiction to issue an order. He further argues that, as the initial March 7, 2018 deportation order is void, the subsequent reinstatement removal order of March 19, 2018 is also void as it derived its authority from the March 7 Order. Specifically, Soto-Mejia argues that the initial Notice to Appear that issued in his case did not include a time and location for the proceeding. Relying upon the United States Supreme Court’s recent decision in Pereira v. Sessions, 138 S.Ct. 2105 (2018), Soto-Mejia argues that a notice to appear must contain a location and time for a removal hearing in order to create jurisdiction for the immigration court. Id. at 2110. As the Notice to Appear in this case did not contain such information, the immigration court, according to Soto-Mejia, did not have jurisdiction to issue a removal or deportation order.
The government responds with several arguments. First, the government argues that Soto-Mejia waived his argument regarding jurisdiction—claiming that it is personal rather subject matter jurisdiction which is at issue—by not raising a jurisdictional objection in the immigration proceeding and conceding to the immigration court’s jurisdiction by appearing. Second, the government avers that the immigration court’s jurisdiction is determined by the federal regulations and that the Notice to Appear in this case contained the information it must pursuant to those regulations to vest the immigration court with jurisdiction. See 8 C.F.R. §§ 1003.14(a), 1003.15(b) and (c). Third, the government argues that the holding in Pereia is limited to the cases in which a court must determine the validity of a particular notice to appear as it relates to the triggering of the “stop-time rule.” Id. at 2116. Fourth, the government argues that there is no prejudice to Soto-Mejia as any defect was cured by the Notice of Hearing and Soto-Mejia’s participation in the removal proceedings. The Court rejects all of the government’s arguments.
A. The Removal Orders of March 7 and March 19 Violated Due Process As the Immigration Court Lacked Subject Matter Jurisdiction
The Court finds that Supreme Court’s holding in Pereira to be applicable and controlling in this case. First, the Court finds pursuant to the plain language of the regulations that the jurisdiction of the immigration court “vests” only “when a charging document is filed with the

Immigration Court.” 8 C.F.R. §1003.14. A “Notice to Appear” is such a “charging document.” Id. at § 1003.13. Relying upon the reasoning of Pereira, this Court finds that the definition of a “Notice to Appear” is controlled by statute and not regulation, as the Supreme Court expressly rejected in Pereira the regulation-based interpretation by the Board of Immigration Appeals in Matter of Camarillo, 25 I. & N. Dec. 644 (2011). Pereira, 138 S. Ct. at 2111-14. And, pursuant to Pereira, a Notice to Appear must include the time and location for the hearing. Id. at 2114-17. As the Notice to Appear in this case failed to include the time and location for the hearing, the immigration court did not have jurisdiction to issue its March 7 deportation order.
The Court rejects the government’s argument that Soto-Mejia waived his jurisdictional argument by not raising it earlier and by participating in the underlying immigration proceeding. The government’s argument conflates personal jurisdiction with subject matter jurisdiction. Soto-Mejia’s argument is founded upon his assertion that the immigration court lacked subject matter jurisdiction and not personal jurisdiction. Subject matter jurisdiction is a limitation on “federal power” that “cannot be waived” so “a party does not waive the requirement [of subject matter jurisdiction] by failing to challenge jurisdiction early in the proceedings.” Ins. Corp. of Ireland v. Compagnie des Bauxites, 456 U.S. 694, 702-03 (1982). Moreover, the plain language of the regulation establishing the immigration court’s jurisdiction explicitly notes that an immigration court’s authority only “vests” with the filing of a “charging document” and the regulation makes no reference to a waiver exception to this requirement for subject matter jurisdiction. 8 C.F.R. § 1003.14(a).
The Court also rejects the government’s argument that the holding in Pereira is limited to cases determining the applicability of the stop-time rule. As noted, the Supreme Court’s holding in Pereira was based upon the plain language of the text of 8 C.F.R. §§ 1003.13 and 1003.14 and 8 U.S.C. § 1229(a). Pereira, 138 S. Ct. at 2111-13. Section 1003.13 specifies which documents can constitute a “charging document” for immigration proceedings after April 1, 1997. The parties all concede in this case that the only document in this record that is a “charging document” is the Notice to Appear. Id. The Court in Pereira explained that the text of Section 1229(a) lays out the statutory definition of and requirements for a “Notice to Appear” which includes the time and

location for the hearing. 138 S. Ct. at 2114. The Supreme Court unambiguously proclaimed: “A putative notice to appear that fails to designate the specific time or place of the noncitizen’s removal proceedings is not a ‘notice to appear under section 1229(a).“‘”Id. at 2113-14 (emphasis added). While the Supreme Court applied this definition to the determination of the applicability of the stop-time rule, the express language of this holding does not suggest any limitation on the Court’s definition of what is and is not a “Notice to Appear” under Section 1229(a) with respect to the requirement for the notice to contain a time and location.
There is no basis to assume or conclude that the definition of a “Notice to Appear” under Section 1229(a) would be different without reference to the stop-time rule. That is because the fundamental question that the Supreme Court was answering in Pereira is whether a notice must contain the time and location of the hearing to be a “notice to appear” under Section 1229(a). 138 S. Ct. at 2113-17. In answering this foundational question, the Court did not rely upon the stop-time rule to determine the definition of a notice to appear under Section 1229(a). To the contrary, the Court spent considerable time explaining why consideration of the stop-time rule’s “broad reference” to all of the paragraphs of Section 1229(a) did not alter the fact that the essential definition of and requirements for the notice arise in the first paragraph. 138 S. Ct. at 2114 (noting that the “broad reference to §1229(a) is of no consequence, because as even the Government concedes, only paragraph (1) bears on the meaning of a ‘notice to appear'”). This first paragraph requires that the notice contain the time and location for the removal proceeding.
The Court is also unpersuaded that a defect in a “Notice to Appear” can be ‘cured’ as the government suggests by the filing and/or serving of the Notice of Hearing on Soto-Mejia. That is because such an argument is contrary to the plain text of the regulation, Section 1003.14(a), which unequivocally states that an immigration court’s jurisdiction only “vests” or arises with the filing of a “charging document.” A Notice of Hearing is not one of the “charging documents” referenced in Section 1003.13. A Notice of Hearing cannot therefore commence an immigration proceeding by subsequently providing a time and location for a removal hearing. Consequently, if the immigration court’s jurisdiction never arose because the Notice to Appear was invalid, then there is no proceeding in which a Notice of Hearing could properly be filed. There is nothing to cure.

Moreover, the Court also finds that the Notice of Hearing in this case did not reference a specific Notice to Appear. Indeed, the government conceded and the Court finds that the Notice of Hearing form does not generally, or in this case, reference a prior specific Notice to Appear and it does not contain information about the legal issues or charges which serve as a basis for the removal proceedings. The two documents only common identifying information is the A-file number of the particular person—Soto-Mejia in this case. This means that if an individual had multiple potential charges or legal issues related to his immigration status, the Notice of Hearing could not inform him about which charges were at issue in the upcoming hearing and the Notice of Hearing could be filed months or years after the Notice to Appear. Indeed, this is the very reason that the Supreme Court in Pereira rejected the argument that the “Notice to Appear” did not have to include the time and location of the removal proceeding, because that would defeat the ultimate objective of requiring notice—allowing the person to prepare for the hearing and potentially consult with counsel. 138 S. Ct. at 2114-15. As the Court noted, if there was no requirement for this information “the [g]overnment could serve a document labeled ‘notice to appear’ without listing the time and location of the hearing and then, years down the line, provide that information a day before the removal hearing when it becomes available.” Id. at 2115. Under such an interpretation “a noncitizen theoretically would have had the ‘opportunity to secure counsel,’ but that opportunity will not be meaningful” as the person would not truly have the opportunity to consult with counsel and prepare for the proceeding.” Id. As a Notice of Hearing, like the one here, is not explicitly connected to a particular Notice to Appear and the associated charges, the Court finds that it cannot serve to ‘cure’ a defective Notice to Appear such as in this case.
The Court further finds that the Soto-Mejia suffered prejudice as a result of the defect in the underlying proceeding. Specifically, he was subjected to removal twice based upon the initial

March 7 Order which the immigration court did not have jurisdiction to issue. The government’s argument that Soto-Mejia was not prejudiced because he “participated” in the removal proceedings misses the point. It is immaterial if he participated in the proceedings. He suffered prejudice by the issuance of the deportation orders because the immigration court lacked jurisdiction to order his removal on March 7, 2018.
IV. Conclusion
For the reasons stated, the Court finds that the March 7 and March 19 deportation orders are void due to the immigration court’s lack of jurisdiction. As these orders are void, the Court finds that the government cannot establish a predicate element—the prior removal or deportation of Soto-Mejia—of the sole offense in the Indictment. The Indictment in this case must therefore be dismissed.
Accordingly,
IT IS HEREBY ORDERED that the Motion to Dismiss is GRANTED. The Indictment in this case is DISMISSED. The Clerk of Court shall close this case.
IT IS FURTHER ORDERED that, as this Court has no authority to detain Defendant Soto-Mejia pursuant to this case, he is ORDERED IMMEDIATELY RELEASED.

Unlike the BIA’s convoluted reasoning in Matter of Bemudez-Cota, 27 I&N Dec. 441 (BIA 2018), Judge Boulware’s analysis is very straightforward and complies with both the statutory language and the Supreme Court decision. What’s not to like about that?
As I’ve pointed out before, Sessions was so busy artificially “jacking up” the backlog and intimidating the Immigration Judges working for him that he never bothered to address the many solvable legal and administrative problems facing the Immigration Courts. That could mean not only more failed criminal prosecutions, but perhaps more significantly, could invalidate the vast majority of the 1.1 million case backlog that Sessions artificially increased with his short-sighted, racially motivated “gonzo” polices and interpretations.
And Whitaker is following in his footsteps by taking issues off the “restrictionist checklist” for screwing asylum seekers and migrants, rather than addressing the real legal and administrative deficiencies that make the Immigration Court a parody of justice in America.
Darn, perhaps carried away with all the tributes to Bush I, I had hoped for a conservative, law enforcement oriented, but non-racist, non-White-Nationalist approach to immigration. Something like firm, but fair, unbiased, professional, and rationally managed. Guess that just isn’t going to happen under a GOP that has made racist appeals, xenophobia, false narratives, and anti-democracy part of its official agenda. I have a tendency to give everyone the “benefit of the doubt” at least until proven otherwise. I guess I have to alter that when dealing with anyone associated with today’s GOP.
That’s why the New Due Process Army must continue to be America’s bastion against the forces of darkness that threaten us all.
Late Monday, a U.S. district judge in San Francisco blocked the Trump administration from denying asylum to migrants who crossed the southern border illegally, saying the president violated a “clear command” from Congress to allow them to apply. Trump’s reaction was to add “Obama” judges, specifically those sitting on the 9th Circuit out West, to his list of those responsible for what he calls the nation’s “open borders.”
“This was an Obama judge,” the president said. “And I’ll tell you what, it’s not going to happen like this anymore. Everybody that wants to sue the United States, they file their case in — almost — they file their case in the 9th Circuit. And it means an automatic loss no matter what you do, no matter how good your case is.” He strung out the theme on Thanksgiving, demonizing the judges who, he tweeted, will be responsible for “bedlam, chaos, injury and death” for not letting law enforcement do their jobs.
His attack on Judge Jon S. Tigar, who issued the temporary order on asylum, was sufficient to arouse Supreme Court Chief Justice John G. Roberts Jr. “We do not have Obama judges or Trump judges, Bush judges or Clinton judges,” Roberts said in a statement. “What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”

As unusual as Roberts’s comments were, he could have said so much more, like maybe, you’ve got to be kidding, Mr. President, if you think your judicial problems are confined to “Obama” judges in a single circuit.
He could have noted that the number of rulings against his administration’s actions now stands somewhere in the range of about 40 to 50, according to a rough estimate by The Washington Post. Norman Siegel, writing at Law.com in January, counted 37 “major” losses, and that was in January, before numerous other rulings that thwarted Trump administration decisions.
And he could have observed that all of this is a bit of a surprise. All presidents lose cases. But a losing streak of this magnitude for a president is a new phenomenon.
Despite the endless decades of rhetoric about “judicial activism,” judges at the district court level are generally a timid lot when it comes to confronting presidents. Historically, they are inclined to do what former federal judge Nancy Gertner calls “duck, avoid and evade.”
“Now,” she wrote in the April issue of NYU Law Review, “I am not so certain. . . . Perhaps ‘judging in a time of Trump’ ” is different, she wrote. “It is one thing to ‘duck, avoid and evade’ when you believe that official actors are acting more or less within constitutional bounds. It is another to do so when you are concerned about real abuse of power.”
An abuse of power was what Tigar found: “Whatever the scope of the President’s authority,” he wrote, “he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden.” Trump did not discuss Tigar’s actual findings.
The biggest defeats have included four decisions blocking the president’s travel ban before the Supreme Court finally upheld its third iteration; his attempt to rescind Deferred Action for Childhood Arrivals, blocked by at least four courts; and the proposed ban on transgender people in the military, stopped in its tracks by no fewer than four judges, with two of the rulings upheld by appeals courts. Judges in Chicago and Philadelphia, as well as California, temporarily stopped Trump’s “sanctuary cities” crackdown.
Trump calls court ‘totally out of control’

A total of five rulings, by judges in Oregon, New York and the District of Columbia, among other places, enjoined the administration from cutting off funds to teen pregnancy prevention programs that failed to preach abstinence to the satisfaction of the Department of Health and Human Services.
This doesn’t count environmental rulings, like the Nov. 8 one halting construction of the Keystone XL pipeline issued by a judge in Montana. Judge Brian Morris was indeed appointed by President Barack Obama, though he clerked for the most conservative chief justice in modern history, William H. Rehnquist.
Roberts could have noted that those defeats have come at the hands of judges appointed not just by Democratic presidents but by Republicans dating all the way back to Ronald Reagan.
It was U.S. District Court Judge Dana M. Sabraw, for example, a California jurist appointed by President George W. Bush, who ripped the administration repeatedly for its family separation debacle.
And how could Trump forget that it was his own appointee, Timothy J. Kelly of the U.S. District Court for the District of Columbia, who slapped down the effort to ban CNN’s Jim Acosta from the White House.
Many of these judges do indeed sit on the U.S. Court of Appeals for the 9th Circuit (which covers a vast swath of territory of nine states — California, Nevada, Arizona, Montana, Washington, Oregon, Hawaii, Alaska and Idaho — and Guam and Northern Marianas, and is a traditional target for conservatives).
But as noted, rulings thwarting Trump have also come from judges sitting in New York, Maryland, the District of Columbia, Pennsylvania, Illinois, Massachusetts, Virginia, Michigan and beyond.
While there’s no scientific way of comparing judicial rhetoric, Republican appointees outside the 9th Circuit have actually seemed more inclined than others to lecture the president about the Constitution.
One of the toughest dressings-down came from a decision blocking Trump’s “sanctuary cities” crackdown written by Judge Ilana Rovner, appointed by President George H.W. Bush to the U.S. Court of Appeals for the 7th Circuit, based in Chicago. In a decision joined by a Gerald Ford appointee and a Reagan appointee upholding a lower-court ruling by a Reagan appointee, she lit into the Trump administration for assuming powers to withhold money not granted to it by Congress to punish states and cities that didn’t go along with efforts to round up those in the country illegally.
Her message to Trump and then-Attorney General Jeff Sessions, translated, was basically, who do you think you are?
Our role in this case is not to assess the optimal immigration policies for our country. . . . The founders of our country well understood that the concentration of power threatens individual liberty and established a bulwark against such tyranny by creating a separation of powers among the branches of government. If the Executive Branch can determine policy, and then use the power of the purse to mandate compliance with that policy by the state and local governments, all without the authorization or even acquiescense of elected legislators, the check against tyranny is forsaken.
There was one possibly accurate observation in Trump’s comments: He said his losses sometimes seem “automatic.”
Based on the record, that’s not far from the truth.
Much of what Trump says are outright lies or racist, White Nationalist false narratives. While sadly that has proved to sometimes be a “winning” political strategy (because of a system that allows minority rule), it’s seldom a good litigating strategy in the 21st Century.
So, it’s hardly surprising that Trump is a “Big Loser” in court. It’s predictably outrageous for Trump to make the bogus claim that the courts are “out of control.” In fact, Trump and his scofflaw Administration are totally out of control, particularly in their often illegal and always immoral immigration policies. Indeed, until next January when the Democrats retake control of the House, the Federal Courts have actually been the only meaningful control on Trump. Perhaps their efforts will be enough to save the country from the greatest existential threat since world War II. Only time will tell.
