For all the world, it looks like the BIA just signed off on a “canned language, rote denial” that had little or nothing to do with the actual record and the arguments raised on appeal. Apparently, as long as the bottom line is to “dismiss” the respondent’s appeal, what goes above it is largely irrelevant to the “Deniers’ Club” that Garland employs as “appellate judges.”

In a system already struggling with a largely self-inflicted backlog of 1.7 million cases, unnecessary remands caused by poor BIA performance are NOT a “no harm, no foul” proposition. Moreover, how in good faith can Garland propose to “expedite” asylum cases at the border when many of his trial judges possess neither the expertise nor the temperament to fairly and efficiently decide asylum claims and the Trump holdover appellate body charged with providing guidance, enforcing best practices, and guaranteeing fairness is itself a major part of the problem? That’s what “designed for disaster” is all about!

Wouldn’t it be refreshing to have an AG who made due process, fundamental fairness, correct results, and careful, “practical scholarly” analysis the touchstone of “his courts” and who cared enough about our justice system to appoint a BIA of real, expert judges — “practical scholars, if you will, of which there are plenty outside of EOIR — capable of focusing on and achieving the foregoing values?

Apparently, in his comfy 5th floor office at DOJ where he thinks great thoughts and does little to achieve them, Garland can’t put himself in the unnecessarily frustrating position of actual human beings and their lawyers who are subjected to EOIR’s incompetent nonsense and “judicial malpractice” on a regular basis! He doesn’t even seem capable of relating to the Courts of Appeals Judges who are constantly called upon to correct fundamental mistakes and clear injustices that Garland ignores and his DOJ attorneys mindlessly defend! Perhaps this “blind spot” is because on the DC Circuit, Garland was absolved from the task of reviewing individual petitions for review emanating from the dysfunctional Immigration Courts that he inherited from his White Nationalist predecessors. 

Whatever the reason for his lackadaisical performance, America needs and deserves an AG who takes immigrant justice, racial justice, due process, and equal justice for all seriously!

“We are fully persuaded that, as discussed in Romero and Meza Morales, the regulations afford IJs and the Board authority to take any action (including administrative closure) as is appropriate and necessary (in the context of each case) for the disposition of such case to resolve questions in a timely and impartial manner consistent with the Act and regulations. After applying the standard tools of interpretation, by considering the text, structure, history, and purpose of 8 C.F.R. §§ 1003.10(b) and 1003.1(d)(1)(ii), we hold that the plain language establishes that general administrative closure authority is unambiguously authorized by these regulations. … For the reasons stated above, we conclude that the relevant regulations confer the general authority to administratively close cases to IJs and the Board. We therefore grant the petition for review, vacate the Board’s order, and remand for proceedings consistent with this opinion.”

So, the Third joins the Fourth and the Seventh in rejecting Castro-Tum, while the Sixth (wrongly) upheld it. In the other Circuits, Castro-Tum remains in effect “by default.” I’ve received reports, though, that some IJ’s in the Fourth Circuit simply ignore the Circuit precedent, emboldened by the “in your face contemptuous attitude” inculcated by the Trump Administration. Apparently, they fear their “enforcement boss” — the AG — more than life-tenured Article III judges. And, to date, Garland has done little or nothing to dispel that attitude.

Shortly after the election, many experts pointed out to the incoming Biden Administration the critical importance of “hitting the ground running” on EOIR reform: immediately vacating the Sessions/Barr precedents; ousting incompetents and restrictionists from EOIR “management,” replacing the BIA with expert progressive judges who could issue correct guidance and keep nativist judges in line; slashing artificial backlogs; reinstating the NAIJ; establishing progressive criteria for hiring and retaining judges; re-establishing a legal asylum system, particularly at the border; ending misogynistic attitudes and treatment of women of color; and bringing in nationally recognized immigration/human rights experts to reestablish due process and best practices nationwide.

Garland has basically ignored the experts in favor of an incomprehensible “Stephen Miller Lite” program of continued injustice, disrespecting and ignoring the needs of stakeholders and foreign nationals, and promoting chaos, inconsistency, and inept practices.

For example, without Castro-Tum, the majority of cases languishing in the 1.3 million backlog probably would be prime candidates for administrative closing under the Biden Administration’s own criteria of what constitutes a “priority.” Having differing and uncertain rules from Circuit to Circuit, along with tolerating IJs who feel empowered to ignore Circuit law, is a recipe for further disaster.

So far, 75% of the Circuits to consider the question have rightly rejected Castro-Tum. If this plays out, hundreds of thousands of cases will be subject to redos, reconsideration, and reopening because of Sessions’s poor judgment combined with Garland’s failure to engage with the endemic problems in “his” courts.

Demeaning rape victims! ☠️🤮👎🏻 So, what else is new @ EOIR? “Gonzo” Sessions 🦹🏿‍♂️ set the tone for anti-asylum, racially motivated misogyny in Matter of A-B- and “his judges” have taken it from there! (I repeat my oft-made observation: What kind of “due process” system lets a characters like Sessions, Whitaker, and Barr “own” judges?  How would you like to be a woman on trial for her life before a “judge” selected, directed, and “owned” by the likes of  these men with clear records of “applied contempt” for equal justice? Sessions, Whitaker, Barr, & Jeffrey Rosen are gone — but their legacy of bias and injustice lives on @ EOIR!)

One of my esteemed Round Table 🛡⚔️ colleagues summed up the latest set of outrageous miscarriages of justice from Falls Church:

All of these decisions demonstrate the degree of careful and detailed analysis that these cases require.And yet the BIA couldn’t keep staff attorneys after McHenry capped them at GS-13 (entry level), and keeps increasing the monthly quotas for BIA staff attorneys.Plus of course the Board Members themselves are now all these types who only review the decisions to make sure they end in the word “dismissed.”

If you were trying to create a recipe for disaster, you couldn’t have planned it better.

I heard the latter comment twice yesterday from immigration/human rights/due process experts on opposite sides of our country who observe and participate in the system at various levels.

To quote Justice Sotomayor’s recent dissent: “This is not justice.”

Historical Footnote:  One of my first actions as BIA Chair in 1995 was to establish a “GS-15 Career Ladder” for all Attorney Advisors at the BIA. This made the BIA competitive with the rest of the DOJ. 

It allowed us to attract and retain not only “top talent” coming from the “DOJ Honors Program” (how I got my first job at the BIA in 1973), but also outstanding career attorneys who wanted an opportunity to do research, writing, and “applied scholarship” that made a difference in individuals’ lives. Indeed, at various times the BIA has had on its staff former Senior Executives seeking a “change of  focus” to a career that allowed them to do the things they liked best about the law.

One of them was a former SES colleague at the “Legacy INS” who found in transferring to a GS-15 BIA Attorney Advisor position a career satisfaction, fulfillment, and sense of meaningful contribution that person had been missing in INS management at that time.

Reducing the top grade for Attorney Advisors is not only professionally and personally demeaning, it also marks the entire organization as “second class” and shows just how stupid and incompetent (and, in recent history, overpaid) EOIR “management” has become! And, as pointed out in my colleague’s comments above, it has not only adversely affected careers but the human lives in the balance on the BIA’s docket.

As I understood my “mission” from then Attorney General Janet Reno in 1995, the BIA was supposed to be about “attracting the best and the brightest judges and supporting them with the best and brightest staff.” Essentially getting it to function like the “12th Circuit” was a description mentioned during my interview process for the Chair job. 

Sadly, now, it has become an assembly line of expediency, injustice, shoddy legal work, mindless “corner cutting,” unprofessional behavior, and human misery.

To repeat my colleague’s comment: “If you were trying to create a recipe for disaster, you couldn’t have planned it better.”

All of these cases should have been resolved in the foreign national’s favor without ever getting to the Courts of Appeals! Bad judging, grossly incompetent administration, and lack of qualified, dynamic, judicial leadership from respected “practical scholars” costs lives, produces unacceptable and unfair inconsistencies, and clogs the Article III Courts with unnecessary litigation.

Indeed, the First Circuit’s decision in Granados basically reveals OIL’s “smorgasbord” of bogus arguments to uphold the BIA’s incorrect decision as “without merit” — actually frivolous! There are deep problems @ DOJ resulting from the ongoing corruption and disregard for ethics and professional leadership from the now-departed kakistocracy! They go far beyond the mess at EOIR!

Sure hope that Judge Garland, Vanita Gupta, and their incoming team @ DOJ have a comprehensive plan for replacing the BIA and reforming EOIR! The human beings suffering in this disgracefully inept and abusive “court system” and their courageous, long suffering attorneys are counting on you! Think of it this way: What if YOUR daughter were the rape victim demeaned, dehumanized, and denied justice by EOIR?

analysis, which has come to be known as the “categorical approach,” sounds simple in theory but has proven difficult (and often vexing) in practice, necessitating a “modified categorical approach” and generating an evolving jurisprudence around when the categorical or modified categorical approach applies.

That difficulty is borne out in the convoluted history of this case. Here, in what is now Lazaro Javier Larios’s third petition for review from prior reversals, the Board of Immigration Appeals (BIA) applied the categorical approach and held Larios ineligible for cancellation of removal under 8 U.S.C. § 1229b(b)(1) for having been convicted of “a crime involving moral turpitude.” 8 U.S.C. § 1182(a)(2)(A)(i)(I). Because we conclude the crime at issue—New Jersey’s terroristic-threats statute, N.J. Stat. Ann. § 2C:12-3(a)—should have been analyzed under the modified categorical approach, and, under that approach, the particular offense of which Larios was convicted is not a crime involving moral turpitude, we will grant the petition for review.

The language is clear. Pereira holds that an NTA shall contain all the information set out in section 1229(a)(1). An NTA which omits the time and date of the hearing is defective. To file an effective NTA, the government cannot, in maybe four days or maybe four months, file a second – and possibly third – Notice with the missing information. And it makes sense to have such a bright-line rule: The ability of the noncitizen to receive and to keep track of the date and place of the hearing, along with the legal basis and cited acts to be addressed at the hearing, is infinitely easier if all that information is contained in a single document – as described in

Moreover, it seems to us to be no great imposition on the government to require it to communicate all that information to the noncitizen in one document. If a notice is sent to the noncitizen with only a portion of the statutorily required information, a valid NTA can easily be sent later which contains all the required information in one document – at such time as the government has gathered all that information together. The complete NTA would then trigger the stop-time rule.

The government argues, however, that the BIA’s

decision in Matter of Mendoza-Hernandez should be given

Chevron16 deference as a reasonable reading of an ambiguous

statute. There, the BIA relied on Pereira’s position that “the

What does it mean:

    • In the 3rd Circuit, undocumented individuals who have been continuously physically present in the U.S. for at least 10 years prior to receiving a “Pereira-compliant” Notice to Appear” (“NTA”) are exempt from the “stop time” rule for non-lawful-permanent resident cancellation of removal.
    • An “after the fact” Notice of Hearing from EOIR does NOT remedy the “Pereira-defect” in the NTA for purposes of the stop-time rule.
    • Those whose cancellation of removal applications were improperly denied, or who were not given a chance to apply, because of the stop-time rule should be able to reopen their cases. This should add to the “Aimless Docket Reshuffling” and jack up the backlog some more, at least within the 3rd Cir.
    • The 3rd Circuit covers Pennsylvania, New Jersey, and Delaware.
    • This mess was largely self-inflicted by DHS & EOIR. They had many chances to remedy the “Pereira problem’ over the years, but chose not to do so.
    • Meanwhile, we have a Circuit conflict. The 9th Circuit previously had rejected Mendoza-Hernandez in Lopez v. Barr, https://immigrationcourtside.com/2019/05/28/courts-as-bia-continues-to-squeeze-the-life-out-of-pereira-9th-circuit-finally-pushes-back-why-the-lost-art-of-bia-en-banc-review-dissent-is-so-essential-to-due-process/. However, that case was vacated and rehearing en banc was granted. As noted by the Third Circuit, the Sixth Circuit agreed with the BIA. So, wrong as it is, Mendoza-Hernandez will remain in effect except in the Third Circuit, unless and until other Circuits reject it.
    • I would expect the DOJ to find a petition for rehearing in this case, as they did in the Ninth Circuit. That could result in the Third Circuit’s decision being put “on hold.”
    • This split will eventually have to be resolved by the Supremes. But, that’s unlikely to happen until next year.
    • Congratulations and much appreciation to the six BIA Appellate Immigration Judges, led by former Judge John Guendelsberger, who courageously dissented from the en banc decision in Mendoza-Hernandez:

    • Dissent remains important, if exceedingly rare at today’s BIA, where DOJ politicos and EOIR bureaucrats actively encourage “go along to get along,” pro-regime jurisprudence. Also, en banc decisions are disfavored at today’s BIA.
