When a local security brigade in Nigeria learned Peter Udo and his boyfriend were seen having sex in a hotel room, they seized and beat the couple for six hours and later told Udo he should be put to death.

Udo’s mother used her family savings to enable him to flee the country and he wound up in California, where an immigration judge rejected his plea for asylum and ordered him deported because his description of the events gave a false name for the hotel where he had been captured. That order has now been firmly rejected by a federal appeals court.

The judge and the Board of Immigration Appeals, which upheld the deportation order, failed to give any “reasoned consideration” to the evidence Udo presented, the Ninth U.S. Circuit Court of Appeals in San Francisco said Wednesday in a ruling requiring the board to review his claim that he would be tortured if returned to Nigeria.

That evidence included an “excommunication notice,” signed by leaders of the community’s Council of Traditional Rulers, notifying Udo and his family that anyone engaging in homosexual acts is “subjected to public execution” and that his mother and five other relatives were no longer considered citizens of the community.

“Remarkably, the (Board of Immigration Appeals) did not reference the excommunication notice at all” in its ruling that would have returned Udo to Nigeria, Judge M. Margaret McKeown said in the appeals court’s 3-0 decision, which included a copy of the notice.

Udo’s lawyer, David Casarrubias, said the ruling was a victory for asylum seekers.

“The opinion stands for the proposition that although Congress may enact laws that make it harder for asylum seekers to prevail as a result of minor discrepancies in their applications, there are other international laws like the Convention Against Torture that still have teeth,” Casarrubias said.

regarding whether it was “more likely than not” that Ali would be subject to abuse severe enough to constitute torture rather than a finding that it attributed to the IJ regarding the limited severity of the abuse that Ali had shown that he was likely to suffer. But, as we explained in connection with Ali’s challenge to the BIA’s “other private actors”-related ruling, the IJ did not make that finding either. And, in any event, as we have noted, that is a strained reading of the BIA’s opinion, given that the opinion expressly quotes only from the portion of the relevant regulations that purports to define how severe abuse must be to constitute torture, see 8 C.F.R. § 1208.18(a)(2) (“Torture is an extreme form of cruel and inhuman treatment . . . .”), rather than a regulation concerning how “likely” it must be that the noncitizen will be subjected to abuse that is severe enough to constitute torture, see, e.g., id. §§ 1208.16(c)(2), (4).11

Finally, the government contends that we still must affirm the BIA’s ruling because, although Harper described violence, “she did not describe the injuries to the Somalis she

witnessed being beaten or kicked . . . such that the agency could reasonably conclude she provided insufficient detail to show that such abuse by Somali security forces rose to the level of torture or that Ali was at risk that it likely would rise to the level of torture.” But, the IJ did not find that Ali had failed to meet his burden to show that he would likely be tortured by security forces in Somalia on any such basis. Rather, the IJ rejected his “security forces”-related ground for requesting deferral of removal pursuant to the CAT solely because the IJ found that “Harper indicated that the main motivation” of the security forces who “mean to do the respondent harm” is “they are either too busy to protect themselves and therefore they cannot protect other people” or to “harass people based on cultural differences,” such that they would not be acting “with the consent or acquiescence of a public official or other person acting in an official capacity” in visiting any abuse on Ali.

These are complicated cases. Indeed, the 1st Circuit spent 33 pages analyzing this particular case. 

By contrast, a supposedly (but, clearly not) “expert” BIA  appears to have taken about 5 minutes to “rubber stamp” the clearly defective denials prepared by staff attorneys in these life or death matters! How is this due process or fundamental fairness? No way!

If this were a law school exam, rather than a life or death “court” case, the BIA’s effort probably would have received a “D-“ or an “F.” Yet, Garland finds this ridiculously deficient level of performance acceptable where “only” the rule of law, constitutional due process, and human lives are at stake! 

One might expect this from a GOP AG. But, is this really what human rights advocates and progressives elected Biden to churn out?

I say “No.” This is NOT acceptable performance by the BIA! Nor is it acceptable professional performance by Garland, Monaco, Gupta, Prelogar, and the other members of the “Clueless Crew” supposedly in charge of the DOJ!

An immigration judge has blocked the deportation of a Sacramento man to his native Iraq where he would face trial, and likely execution, for a terrorist murder — a murder that, according to a U.S. magistrate, took place while the man was in another country.

Omar Ameen was granted U.S. refugee status in 2014 by immigration officials who said he would face persecution in Iraq. But the U.S. government jailed him in August 2018 while Iraq sought to extradite him on a murder charge.

Last April, U.S. Magistrate Judge Edmund Brennan found that the crime Iraq accused Ameen of committing, the fatal shooting of a police officer in 2014 before his departure for the U.S., had taken place while Ameen was 600 miles away in Turkey, where he had fled from Iraq more than two years earlier.

U.S. Immigration and Customs Enforcement then sought to deport Ameen to Iraq, saying he had lied about his alleged terrorist connections and other subjects, and kept him in custody. But Immigration Judge Tara Naselow-Nahas of Van Nuys (Los Angeles County) ruled last week that Ameen could not be deported to Iraq because he was likely to be jailed and tortured there. She did not dismiss ICE’s claim that Ameen had made false statements, but said she found no evidence of terrorist connections.

Three days after President Trump took his re-election campaign to a construction site of his border wall in Arizona, a federal appeals court ruled Friday that he had defied Congress’ constitutional authority over federal spending by redirecting $2.5 billion in military funds to build 130 miles of barriers in California, Arizona and New Mexico.

Congress appropriated the funds for military pay, weapons and other Defense Department purposes, and never authorized Trump to spend them on wall construction, the Ninth U.S. Circuit Court of Appeals in San Francisco said in a pair of 2-1 rulings.“Funding for the wall had been denied by Congress,” and the Trump administration “lacked independent constitutional authority to authorize the transfer of funds,” said Chief Judge Sidney Thomas, joined by Judge Kim Wardlaw. Both were appointed by President Bill Clinton.

Judge Daniel Collins, a Trump appointee, dissented from both decisions. He said the military funds were legally transferred and also that the plaintiffs — California and 15 other states, the Sierra Club and and an advocacy group for border communities — had no right to sue over the alleged violation of congressional spending powers.

Although the appeals court upheld a federal judge’s injunction against construction of the wall segments, the ruling did not halt construction. The Supreme Court voted 5-4 last July to allow the work to continue while the case proceeded. Its brief, unsigned decision said the administration “has made a sufficient showing at this stage that the plaintiffs have no cause of action” — that is, that they had not shown direct harm from the construction that would entitle them to challenge it in court.

The appeals court majority reached a different conclusion, citing the plaintiffs’ claims that the wall was harming the environment and wildlife at the border and the states’ ability to enforce their own environmental laws. Similar issues are pending before the same panel in a case over $3.6 billion for additional wall segments, and the dispute could soon return to the high court.

In 21 months as the nation’s attorney general, Jeff Sessions affected no area of public policy more than immigration, from his “zero tolerance” orders to arrest and prosecute all unauthorized border crossers to establishing new rules speeding up deportations and limiting legal challenges.

But with his dismissal by President Trump the day after the Nov. 6 election, one part of Sessions’ immigration agenda remained unfinished: his reconsideration, and often reversal, of pro-immigrant rulings by the immigration courts, particularly on the rights of migrants seeking political asylum in the United States.

Because immigration courts are a branch of the Justice Department, the attorney general has the authority to review and overturn their rulings. Sessions used that authority at an unprecedented pace, reversing decisions that had allowed immigration judges to delay or postpone hearings to give immigrants time to apply for legal status, and eliminating grounds for asylum that were commonly invoked by migrants from Central America.

In October, he announced plans to reconsider a ruling that, if repealed, would keep thousands of asylum-seekers locked up even after they convinced hearing officers that they had a case for fearing persecution in their homeland.

A 2005 ruling by the Board of Immigration Appeals allowed immigrants seeking asylum to be freed on bond after an immigration officer ruled that they have a “credible fear” of persecution if deported. They remain free until the immigration courts decide whether their fear of persecution is “well founded,” entitling them to asylum, a work permit and legal residence. If not, they can be deported.

That determination sometimes takes a year or longer. Immigration rights advocates and legal commentators say tens of thousands of asylum-seekers would be locked up for that period if the attorney general overturned the 2005 decision.

“It’s a dramatic change in policy … part of a pattern of efforts to implement the ‘zero-tolerance’ policy” that Sessions declared in April for unauthorized border-crossing, said Kevin Johnson, UC Davis law school dean and an immigration law expert.

This was “Sessions, on his own initiative, trying to rewrite immigration law,” said Paul Wickham Schmidt, a retired immigration judge, former chairman of the Board of Immigration Appeals and publisher of the ImmigrationCourtside blog.

Now the decision will be left to Sessions’ successor. Or maybe not.

Sessions’s biased jurisprudence and his intentional mismanagement resulted in a largely artificial “backlog” of 1.1 million cases and a group of demoralized judges who are treated as assembly line workers on a deportation conveyor belt. This preventable disaster is a major contributor to the bogus crisis on the Southern Border.

Sessions admittedly built on and intentionally aggravated pre-existing problems left by the Bush II and Obama Administrations. Nearly two decades of abuse and misuse of the U.S. Immigration Court System by the DOJ for political aims often unrelated to due process and fairness won’t be resolved “overnight.”

But competent court administration combined with a return to an exclusive focus on delivering full due process with maximum achievable efficiency would certainly make an immediate difference and put the Immigration Courts back on track to fulfilling their noble (now abandoned) vision of “being the world’s best tribunals, guaranteeing fairness and due process for all.” No rational observer would say that these courts are moving in that direction under Trump and his toadies at the DOJ and DHS.
