Dear Mr. President:

I write today to appeal to your sense of morality, human dignity and as a fellow Catholic. While the Supreme Court has blocked your efforts to rescind the Migrant Protection Protocols (MPP), better known as the “Remain in Mexico” policy, while litigation against it proceeds through the court system, I urge you to act. These legal complications, and our backlogged immigration courts system, cannot become an excuse to strand thousands of people in dire conditions, especially when other options are available.

I know from firsthand experience just how desperate the situation is. MPP was implemented in my community in early 2019. Its effect was to force thousands of people into a makeshift “tent city” along the Mexican side of the Rio Grande river as they awaited rulings on whether they would be granted asylum.

I would visit the camp almost every single day. It was a blessing that hundreds of compassionate Americans crossed the border between Brownsville, Tex., and Matamoros, Mexico, several times a day to bring tents, food, clothing, and to tend to these families’ medical needs and legal issues. While supported by the good nature and assistance that staff and others provided, I often worried about how the women, men and children at the camp could survive in such conditions. How could they stand the scorching heat of our region’s hot sun or the occasional torrential downpours that turned their encampment into a mud pit?

The lack of care for humanity and the sounds of human misery accompanied me daily as I moved through the camp. I know that reports of these conditions have reached your ears, too: I met your wife, Jill Biden, here in 2019 as she donned rubber boots to wade through the mud and see for herself the misery in which asylum seekers, including many women and children, lived for as long as two years.

So, I rejoiced when you declared an end to this immoral policy on your first days in office, and despaired when the Supreme Court required your administration to implement it once again.

I pray for the Supreme Court justices as I do for all leaders. But in my heart, I know that surely, we can do better than return to the conditions and suffering I witnessed in 2019.

I invite you to come and see for yourself, as your wife did in 2019, what is happening on the border. There are many layers to the immigration realities behind the strident political rhetoric that dominates and obscures the issue today. But we must find ways to counter what Pope Francis calls a “globalization of indifference.”

Mr. President, please demonstrate to the world that the words of Jesus — whatsoever you do to the least of my brothers, you do unto me — are the foundation of not only our faith, but of the moral structure of our country.

She’s right: “We cannot allow a lack of creativity and fortitude to become an excuse to abandon the principle of compassion.” But, sadly, that’s exactly what the Biden Administration is doing by listening to the wrong advice from those wedded to the failed, illegal, and cruel concept of misusing the law and perverting process as a “deterrent.”

The experts, “practical scholars,” NGOs, intellectual leaders, and courageous progressive judicial talent who can solve this problem, folks like Sister Norma, Karen Musalo, Marielena Hincappie, Kevin Johnson, Michelle Mendez, Jaya Ramji-Nogales, Lenni Benson, Michele Pistone, Geoffrey Hoffman, Jason “The Asylumist” Dzubow, and Judge Ilyce Shugall, are all “on the outside looking in.” Moreover, rather than working with them to fix the asylum system at the border and bring essential progressive reforms to our dysfunctional Immigration Courts, the Administration has actively alienated and disrespected their views in favor of recycling “guaranteed to fail, Miller-Lite” deterrence only policies of the past.

The solutions are out there! Too bad the Administration has become “part of the problem,” rather than having the guts and creativity to solve the problem while saving lives! No courage, no convictions, no solutions! It’s a formula for disaster☠️ and death!⚰️

As Sister Norma says, using the words of Jesus, in her powerful conclusion: “whatsoever you do to the least of my brothers, you do unto me — are the foundation of not only our faith, but of the moral structure of our country.”  Right now, He couldn’t be very pleased with the conduct of the GOP nativists, the Supremes, righty Federal Judges, horrible GOP AGs, and the feckless bureaucrats and timid policy officials of the Biden Administration!

CA9 Upholds Injunction Against Asylum Rule

“On July 16, 2019, the Department of Justice and the Department of Homeland Security published a joint interim final Rule without notice and comment, entitled “Asylum Eligibility and Procedural Modifications” (the “Rule”). With limited exceptions, the Rule categorically denies asylum to aliens arriving at our border with Mexico unless they have first applied for, and have been denied, asylum in Mexico or another country through which they have traveled. We describe the Rule in detail below. Plaintiffs are nonprofit organizations that represent asylum seekers. They brought suit in district court seeking an injunction against enforcement of the Rule, contending that the Rule is invalid on three grounds: first, the Rule is not “consistent with” Section 208 of the Immigration and Nationality Act, 8 U.S.C. § 1158; second, the Rule is arbitrary and capricious; third, the Rule was adopted without notice and comment. The district court found that plaintiffs had a likelihood of success on all three grounds and entered a preliminary injunction against enforcement of the Rule, with effect in the four states on our border with Mexico. We hold that plaintiffs have shown a likelihood of success on the first and second grounds. We do not reach the third ground. We affirm.”

This isn’t rocket science. Neither the legal nor moral issues are particularly difficult in this case. Indeed, the Supremes should unanimously have tossed Solicitor General Noel Francisco out on his tail the last time he unethically requested their intervention. Instead, they rewarded him, thus enabling and encouraging further “crimes against humanity.”

Unfortunately, this Supremes’ majority has had a hard time seeing people of color, and particularly those seeking asylum and other legal protections under our laws, as human. Even though the lower Federal Courts have essentially made things easy by showing exactly why these racist-inspired policies are illegal, a Supremes majority has chosen to advance Stephen Miller’s White Nationalist agenda, sometimes hiding behind a smokescreen of nonsensical legal gobbledygook, while other times choosing to act without bothering to provide any rationale at all.

One thing is for certain. Someday, after the fall of Trump, and the banishment of Miller, the Justices who advanced their unconstitutional, illegal, racist immigration agenda will try to “save their legacies” by putting some distance between themselves and the neo-Nazi ramifications of their votes. It’s critically important for those of us who see exactly what’s happening to insure that the names of justices and judges who sided with Stephen Miller are inextricably linked for the rest of time with his disgraceful racist legacy of “crimes against humanity.”

There is only one side of history here! And, it’s certainly not with Stephen Miller and his enablers, be they judges, legislators, public officials, or voters.

She writes, in part:

Meanwhile, the pandemic has made it more difficult to care for those who are arriving at the border each day. Since that lone covid-19 case was identified, Mexico’s National Immigration Institute has not allowed the camps to accept any new arrivals. So refugees are being turned away and have no place to go. Some are being placed in hotels or churches, and volunteers are desperately looking for other options.

Within the camp, we have had to limit the volunteers’ activities — there are 10 to 20 volunteers allowed to enter and help provide the people with food, water and basic health care. We have set up areas for washing hands, and try to provide hope and reassurance amid the uncertainty. All this makes it even harder to keep the camps safe from the cartels and gangsters who continue to prey on these largely defenseless asylum seekers.

That young woman who tested positive for the coronavirus has been transferred to a covid-19 center operated by Doctors Without Borders. We pray for her recovery, and we pray for all the families’ safety, for their protection and for a resolution to their untenable situation.

While I know many people in many places are dealing with so much, I urge you not to look away from the border in this moment. Do not ignore the suffering occurring here. It is time that we put an end to it, and to end the MPP policy. Until that happens, we will continue to help those who are defenseless, whose only real “crime” is trying to seek protection for themselves and their families.

In addition to highlighting inhumanity, Sister Pimentel shows the gross intellectual fraud and immorality in the Trump Regime’s bogus claim that asylum seekers present a significant threat of spreading COVID-19. If anything, it’s the exact opposite which is most often the case with the Trump regime’s endless racist false narratives and fake “horror stories” about immigration.

It also exposes yet again both the intellectual dishonesty and immorality of those who present “pretextual justifications” for illegal acts being perpetrated by our Government against the most vulnerable and the spineless performance of judges who claim to accept at face value that which any reasonable person knows to be a pretext for racism and inhumanity.

The intent behind these bogus regulation changes and programs like the “Migrant Protection Protocols” (or, more properly, “Let ‘Em Die in Mexico”) is very clear: dehumanize “the other” – in this case primarily brown skinned asylum seekers. But, in the process of letting this happen and tolerating legislators and judges without the decency to stand up for the rights of our fellow humans, WE are the ones who actually are dehumanized. We’re not allowed to look away from the horrors being perpetrated by the Trump regime in our name!

SISTER NORMA PIMENTEL: A MESSAGE TO TRUMP FROM THE REAL BORDER

Dear Mr. President,

We welcome you to our community here in South Texas along the Rio Grande, which connects the United States to Mexico. I wish you could visit us. Our downtown Humanitarian Respite Center has been welcoming newcomers for the past four years.

When families cross the border, they are typically apprehended by authorities, held for a few days and released with a court date to consider their request for asylum. After they are released, we receive them at our respite center. By the time they find their way to our doors, most adults are wearing Border Patrol-supplied ankle bracelets and carrying bulky chargers to keep those devices powered up.

Helping these families has been our work since 2014, when tens of thousands of people, primarily from Guatemala, Honduras and El Salvador, crossed into the United States through the Rio Grande Valley Sector, creating a humanitarian emergency in our community. Before the respite center opened, dozens of immigrant families, hungry, scared and in a foreign land, huddled at the bus station with only the clothes on their back, nothing to eat or drink, and nowhere to shower or sleep. They waited hours and sometimes overnight for their buses.

Every day of the year, from morning to evening, families coming over the border are welcomed at our center with smiles, a warm bowl of soup, a shower and a place to rest. Most families are exhausted and afraid, carrying little more than a few belongings in a plastic bag. They come in all forms and at all ages. Few speak any English. Most are in great need of help. Some days, we see 20 people. Other days, it’s closer to 300. In recent weeks, it has been very busy. Some stay a few hours, but many spend the night before heading on to new destinations. Since we opened, more than 100,000 have come through our doors.

We work closely with the U.S. Customs and Border Protection Rio Grande Valley Sector, and our team has cultivated a culture of mutual respect and dialogue. Our center staff, in communication with the Border Patrol, prepares to receive groups of immigrants who have been released. We try to meet the need. It is vital that we keep our country safe, and I appreciate the work of the men and women in the U.S. Customs and Border Protection who are vigilant as to who enters our country. I pray for them daily.

Later in the day, you will meet some of the children who are playing in our small play yard and the mothers and fathers who are watching over them. Some will be resting, as for many of them this is the first place since they left their home countries where they feel safe.

In the evening, another group of volunteers arrives to cook and serve a simple dinner of pizza or tacos, beans and rice, Sometimes local restaurants donate the dinner. Either way, the families who will remain for the night have a meal and prepare to sleep. In the morning, we send them on their way, a little better off but armed with a sign (that we give them) that reads: “ PLEASE HELP ME. I DO NOT SPEAK ENGLISH. WHAT BUS DO I TAKE? THANK YOU FOR YOUR HELP!”

As the Most Rev. Daniel E. Flores, bishop of our diocese, says, “We must put human dignity first.”

This is a more accurate picture of Central American asylum seekers which reflects the inspirational qualities of courage, ingenuity,  perseverance, gratitude, and industry that I found in the most of the asylum-seeking individuals and families I came in contact with over my years at the Arlington Immigration Court.

Also, Sister Norma paints a more sympathetic picture of the U.S. Border Patrol which reflects some of my experiences when I worked with them at the “Legacy INS.”

Imagine what even a few billion (or even a few million) dollars invested in humanitarian assistance like that provided by Sister Pimentel and her organization could do as opposed to wasteful spending on more largely useless walls and wasteful and inhumane detention centers.

Walls, jails, prosecutions, threats, and disingenuous de-humanizing rhetoric are not effective or acceptable ways of dealing with a humanitarian crisis.
