TRUMP DECLARES WAR ON AFRICAN-AMERICAN ATHLETES — DISSES CURRY, NFL, NBA, LEBRON JAMES REACTS! — Packers & Other NFL Teams Push Back Against President’s Appeals To Racism & Disrespect For Constitution!

“On one level, this is classic Trump. He feels as though he is being disrespected — whether by NFL players not standing for the national anthem or by Curry saying if it was up to him, the Golden State Warriors would not visit the White House. (The Warriors, in a statement Saturday afternoon, said they would come to Washington and do events to promote diversity and inclusiveness rather than meet with Trump.)
They hit him, so he hit back.
But, there’s something far more pernicious here. Both the NFL and the NBA are sports in which the vast majority of the players are black and the vast majority of owners are white. In the NFL, there are 0 black owners of the 32 teams. In the NBA, Michael Jordan is the lone black owner of a team.
Consider that in the context of what Trump said both Friday night and Saturday.
In Alabama, Trump called the players who refuse to stand for the anthem “sons of bitches” and insisted that any owner worth his or her salt should fire them immediately.
That got a lot of attention — and rightly so. But it’s what Trump said next that’s really telling. “Total disrespect of our heritage, a total disrespect of everything that we stand for,” he said — adding for emphasis: “Everything that we stand for.”
Notice the use of “our heritage” and “we” in those two sentences above.
But wait, there’s more. In both his Curry tweet and his two NFL tweets, Trump expressed frustration that these lucky athletes felt the need to be ungrateful.
Trump noted the “great honor” of going to the White House and the “privilege of making millions of dollars in the NFL.” You should just be thankful for what you have and not be making any trouble, Trump is telling these players.
Here’s the thing: Even if we lived in a color-blind society, that would be a dangerous sentiment. After all, freedom of expression is right there in the First Amendment. And our brave soldiers didn’t fight and die so that everyone stood during the national anthem. They fought so people could have the right to make a choice about whether or not they wanted to stand. That’s the whole damn point of the First Amendment.
The thing is: We don’t live in a color-blind society. Slavery sits at the founding roots of America. The goal of racial equality remains a goal, not an achievement. To pretend otherwise is to willfully blind yourself to hundreds years of history.
Even more context darkens the picture for Trump. He played at racially coded language throughout his presidential campaign. He also displayed a stunningly simplistic view of the black community.
“You’re living in poverty, your schools are no good, you have no jobs, 58% of your youth is unemployed — what the hell do you have to lose?” Trump said of African-Americans in a speech to a largely white audience in Michigan during the campaign. When NBA star Dwyane Wade’s cousin was shot in Chicago, Trump tweeted: “Dwayne Wade’s cousin was just shot and killed walking her baby in Chicago. Just what I have been saying. African-Americans will VOTE TRUMP!”” He took an inordinate amount of time to condemn former Ku Klux Klan leader David Duke. And so on.
As President, Trump has done little too ease concerns about his racial views — and, in fact, has heightened them. His handling of the Charlottesville, Virginia, protests — in which white supremacists and neo-Nazis marched in protest of the removal of a statue of Robert E. Lee — was particularly alarming.
Even as the protests turned violent — one woman was killed — Trump claimed that there were violent factions “on many sides” to be blamed. Days later, he doubled down on that false premise; “I watched those very closely, much more closely than you people watched it,” Trump said. “And you have — you had a group on one side that was bad, and you had a group on the other side that was also very violent, and nobody wants to say that, but I’ll say it right now.”
Although his administration tried desperately to move on from his remarks, it was made clear recently that Trump meant exactly what he said. The day after meeting at the White House with South Carolina Sen. Tim Scott — the lone black Republican in the Senate — Trump was quick to note that he had been right in his initial comments after Charlottesville.
“I think especially in light of the advent of Antifa, if you look at what’s going on there, you have some pretty bad dudes on the other side also, and essentially that’s what I said,” Trump told reporters.
And now, this.
I’ve long believed that Trump is simply saying whatever comes to mind, that there is no broader strategy to his comments. But it’s impossible to conclude that after Charlottesville, Trump is totally ignorant of the racial context in which his remarks on the NFL and NBA land. No one is that oblivious.
When, given all the water under the bridge — both in terms of our country’s history and the more narrow history of Trump’s campaign — you make comments about how the athletes in predominantly black pro sports leagues should just be happy with what they have and not complain, you aren’t doing it by accident. You really believe it.
Play football or basketball so we can be entertained, Trump seems to be telling these athletes. No one wants to hear your lack of gratitude for what you’ve been given.
There’s so many things wrong with that view.
First of all, no one gave these players anything. They worked for it.
Second, just because you are a professional athlete doesn’t mean you don’t get to be a citizen, too. We don’t tell accountants, for example, that they can’t express their opinions on politics and the culture more broadly, right? So why should we be in the business of telling professional athletes? And would Trump feel the same way if the majority of those protesting the anthem were white?
Trump defenders will note that Trump didn’t name names — other than Curry — when he blasted professional athletes. That “we” are adding color to it, not him.

But that doesn’t fly. As I noted above, both the NFL and NBA are majority black. And those refusing to stand during the national anthem are, with one exception, also all black.
Trump knows this. He is an avid consumer of TV and culture. Which means that he is purposely playing at and with racial animus here. That is a dark thing to do as the leader of the United States. And something he deserves to be condemned for.”

As reported in the Green Bay Press Gazette, Packer President/CEO Mark Murphy issued the following statement:

We strongly believe that players are leaders in our communities and positive influences. They have achieved their positions through tremendous work and dedication and should be celebrated for their success and positive impact.

“We believe it is important to support any of our players who choose to peacefully express themselves with the hope of change for good. As Americans, we are fortunate to be able to speak openly and freely.”

Trump’s racism and his condescending attitude toward minorities should come as no surprise given his campaign, his base, the GOP’s racially divisive agenda, and the folks surrounding him. It also should come as no surprise that Trump’s remarks came in Alabama, a state unable to advance beyond its disgusting racist history (except on the football field in Tuscolusa in the Fall) and move into the present.

It will be interesting to see what happens tomorrow at NFL stadiums. It will also be interesting to see whether African-American athletes put their money, time, and prestige behind encouraging others to vote so that Trump will never happen again and that the GOP stranglehold on our Government and our country will be broken.

Finally, why do we sing the National Anthem at sporting events in the first place? These athletic contests are entertsinment, not expressions of patriotism. We don’t sing it before concerts, movies, plays, and other performances. It doesn’t belong at sporting events either.

It is a bizarre and sad state of affairs when the President of the Green Bay Packers has to “school” the President of the United States on the meaning of our Constitution and an appropriate tone for race relations in our country!

“Washington (CNN)The Trump administration on Monday announced an end to protections for Sudanese immigrants, a move that advocates fear could be a sign of things to come.

The Department of Homeland Security announced Monday afternoon that it would be ending Temporary Protected Status for Sudan after a 12-month sunset period. It opted to extend, however, Temporary Protected Status for South Sudan, which gained its independence in 2011, through May 2019.
The decision was overdue. By law, decisions on TPS designations are required 60 days before an expiration deadline. With both countries’ status set to expire on November 2, the decision was due September 3. DHS said it made a decision in time, but kept it quiet for more than two weeks and did not respond to requests for an explanation.
While the decision on the future of Temporary Protected Status for Sudanese and South Sudanese immigrants only affects just over 1,000 people in the US, the decision is being closely watched as a harbinger of where the administration will go on upcoming TPS decisions that affect more than 400,000 people in the US.
Under Acting DHS Secretary Elaine Duke’s direction on Monday, recipients of protections from Sudan will be allowed to remain protected from deportation and allowed to work under the program until November 2, 2018, during which they are expected to arrange for their departure or seek another immigration status that would allow them to remain in the US.
Individuals from South Sudan will be able to extend their status until May 2, 2019, when DHS will make another decision on their future based on conditions in the country.
According to USCIS data, at the end of 2016 there were 1,039 temporarily protected immigrants from Sudan in the United States and 49 from South Sudan.
Temporary Protected Status is a type of immigration status provided for by law in cases where a home country may not be hospitable to returning immigrants for temporary circumstances, including in instances of war, epidemic and natural disaster.
While DHS did not explain the delay in publicizing the decision, which the agency confirmed last week was made on time, the law only requires “timely” publication of a TPS determination. The decision was made as the administration was preparing to announce the end of the Deferred Action for Childhood Arrivals program, or DACA, a popular program that has protected nearly 800,000 young undocumented immigrants brought to the US as children from deportation since 2012.

Some of the affected individuals have been living in the US for 20 years. TPS is not a blanket protection — immigrants have to have been living in the US continuously since a country was “designated” for TPS in order to qualify.

For example, Sudan was first designated in 1997 and was re-designated in 1999, 2004 and 2013, meaning people had opportunities to apply if they’ve been living in the US since any of those dates. South Sudan’s TPS was established in 2011 and had re-designations in 2014 and 2016.
Both countries were designated for TPS based on “ongoing armed conflict and extraordinary and temporary conditions.”

The situation in Sudan has improved in recent years, but there are still concerns about its stability and human rights record. In January, outgoing President Barack Obama eased sanctions on Sudan but made some moves contingent upon further review. President Donald Trump has extended that review period. South Sudan, meanwhile, remains torn by conflict.

Advocates for TPS have expressed fear that if the administration were to begin to unwind the programs, it could be a sign of further decisions to come. In the next six months, roughly 400,000 immigrants’ status will be up for consideration, including Central American countries like El Salvador that have been a focus of the Presidents’ ire over illegal immigration and gang activity.

California Rep. Zoe Lofgren, the top Democrat on the immigration subcommittee for the House Judiciary Committee, said in an interview before the decision that ending Sudan’s protections could be a sign of more to come.

“I mean look what’s going on in Sudan,” Lofgren said. “If that is a wise decision, what’s an unwise one?”

Let’s take a closer look at some of those supposedly “improved conditions,” using the Government’s own information, the U.S. Department of State’s latest (2016) Country Report on Human Rights Conditions for Sudan:

“The three most significant human rights problems were inability of citizens to choose their government, aerial bombardments of civilian areas by military forces and attacks on civilians by government and other armed groups in conflict zones, and abuses perpetrated by NISS with impunity through special security powers given it by the regime. On January 14, the government launched an intensive aerial and ground offensive against Sudan Liberation Army-Abdul Wahid (SLA/AW) strongholds in the Jebel Marra area of Darfur. This operation displaced more than 44,700 persons by January 31, according to the UN Office for the Coordination of Humanitarian Affairs (OCHA). In February the government established in Darfur a suboffice of the National Human Rights Commission to enhance the commission’s capacity to monitor human rights in Darfur. Meanwhile, ground forces comprising Rapid Support Forces (RSF) and Border Guards carried out attacks against more than 50 villages in an attempt to dislodge the armed opposition. Attacks on villages often included killing and beating of civilians; sexual and gender-based violence; forced displacement; looting and burning entire villages; destroying food stores and other infrastructure necessary for sustaining life; and attacks on humanitarian targets, including humanitarian facilities and peacekeepers. In September, Amnesty International issued a report alleging that, through September the government engaged in scorched-earth tactics and used chemical weapons in Jebel Marra, Darfur. UN monitors were unable to verify the alleged use of chemical weapons, due in part to lack of access to Jebel Marra, including by rebel commanders loyal to Abdel Wahid. By year’s end the Organization for the Prohibition of Chemical Weapons (OPCW) had not been presented with sufficient corroborating evidence to conclude chemical weapons had been used. The NISS continued to show a pattern of widespread disregard for rule of law, committing major abuses, such as extrajudicial and other unlawful killings; torture, beatings, rape and other cruel or inhuman treatment or punishment; arbitrary arrest and detention by security forces; harsh and life-threatening prison conditions; incommunicado detention; prolonged pretrial detention; obstruction of humanitarian assistance; restrictions on freedom of speech, press, assembly,association, religion, and movement; and intimidation and closure of human rights and nongovernmental organizations (NGOs). Societal abuses included discrimination against women; sexual violence; female genital mutilation/cutting (FGM/C); early childhood marriage; use of child soldiers; child abuse; sexual exploitation of children; trafficking in persons; discrimination against ethnic and religious minorities, persons with disabilities, and persons with HIV/AIDS; denial of workers’ rights; and child labor. Government authorities did not investigate human rights violations by NISS, the military or any other branch of the security services, with limited exceptions relating to the national police. The government failed to adequately compensate families of victims of shootings during the September 2013 protests, make its investigations public, or hold security officials accountable. Impunity remained a problem in all branches of the security forces.

The 2005 Interim National Constitution prohibits torture and cruel, inhuman, and degrading treatment, but security forces, government-aligned groups, rebel groups, and ethnic factions continued to torture, beat, and harass suspected political opponents, rebel supporters, and others. In accordance with the government’s interpretation of sharia (Islamic law), the penal code provides for physical punishments, including flogging, amputation, stoning, and the public display of a body after execution, despite the constitution’s prohibitions. With the exception of flogging, such physical punishment was rare. Courts routinely imposed flogging, especially as punishment for the production or consumption of alcohol. The law requires police and the attorney general to investigate deaths on police premises, regardless of suspected cause. Reports of suspicious deaths in police custody were sometimes investigated but not prosecuted. For example, in November authorities detained a man upon his return from Israel. He died while in custody, allegedly from falling out a window, although the building had sealed windows. The president called on the chief prosecutor and chief justice to ensure full legal protection of police carrying out their duties and stated that police should investigate police officers only when they were observed exceeding their authority. Government security forces (including police, NISS, and military intelligence personnel of the Sudanese Armed Forces (SAF)) beat and tortured physically and psychologically persons in detention, including members of the political opposition, civil society, religious activists, and journalists, according to civil society activists in Khartoum, former detainees, and NGOs. Torture and other forms of mistreatment included prolonged isolation, exposure to extreme temperature variations, electric shock, and use of stress positions. Some female detainees alleged NISS harassed and sexually assaulted them. Some former detainees reported being injected with an unknown substance without their consent. Many former detainees, including detained students, reported being forced to take sedatives that caused lethargy and severe weight loss. The government subsequently released many of these persons without charge. Government authorities detained members of the Darfur Students Association during the year. Upon release, numerous students showed visible signs of severe physical abuse. Government forces reportedly used live bullets to disperse crowds of protesting Darfuri students. There were numerous reports of violence against student activists’ family members.

Security forces detained political opponents incommunicado, without charge, and tortured them. Some political detainees were held in isolation cells in regular prisons, and many were held without access to family or medical treatment. Human rights organizations asserted NISS ran “ghost houses,” where it detained opposition and human rights figures without acknowledging they were being held. Such detentions at times were prolonged. Journalists were beaten, threatened, and intimidated (see section 2.a.). The law prohibits (what it deems as) indecent dress and punishes it with a maximum of 40 lashes, a fine, or both. Officials acknowledged authorities applied these laws more frequently against women than men and applied them to both Muslims and non-Muslims. Courts denied some women bail, although by law they may have been eligible. There were numerous abuses reported similar to the following example: On June 25, the Public Order Police arrested several young women and men in Khartoum under the Public Order Act for “indecent dress.” During the sweep, all women who did not have their hair covered were taken into custody. The Public Order Police further arrested two young men for wearing shorts. According to NGO reports, the Public Order Police released the young women and men later the same day without charges.

Security forces, rebel groups, and armed individuals perpetrated sexual violence against women throughout the country; the abuse was especially prevalent in the conflict areas (see section 1.g.). As of year’s end, no investigations into the allegations of mass rape in Thabit, Darfur, had taken place (see section 6).”

What I’ve set forth above is just a small sample of some of the “lowlights.” Virtually every paragraph of the Country Report is rife with descriptions of or references to gross abuses of Human Rights.

Clearly, these are not the type of “improved country conditions” that would justify the termination of TPS for Sudan. Moreover, since it affects only 1,000 individuals, there are no overriding policy or practical reasons driving the decision.

No, the Administration’s totally disingenuous decision is just another example of wanton cruelty, denial of established facts, and stupidity.  Clearly, this is an Administration that puts Human Rights last, if at all.

As pointed out by Nolan Rappaport in a a recent post, the best solution here is a legislative solution that would provide green cards to long-time “TPSers” through the existing statutory device of “registry.” With some lead time to work on this, hopefully Lofgren can convince enough of her colleagues to make it happen.

“(CNN)President Donald Trump retweeted an edited video Sunday morning that showed him swinging a golf club and appearing to hit his former presidential campaign rival Hillary Clinton with a golf ball.

The animated GIF image Trump retweeted spliced together footage of Trump taking a swing on a golf course with footage of Clinton tripping and falling as she boarded a plane in 2011 as secretary of state. The footage is edited to make it appear as though Clinton is hit in the back with a golf ball before her fall.
The tweet revealed a President still reverting to his old social media habits, namely, those likely to earn him quick criticism, less than two months after retired Gen. John Kelly took over as White House chief of staff.
While Kelly has not sought to stop Trump from tweeting, he has encouraged the President to allow him to vet the tweets before posting them — a request Trump has sometimes acquiesced to.
The White House did not immediately respond to a request for comment Sunday about the President’s tweet and whether Kelly was aware of it.
A spokesperson for Hillary Clinton declined to comment on the tweet.
Former Office of Government Ethics Director Walter Shaub, who repeatedly criticized the administration about potential conflicts of interest before resigning in July, slammed Trump for the retweet and said he reported it to Twitter for violating the social media platform’s rules of conduct.
“The President of the United States just retweeted a video vignette that imagines him assaulting his political rival. The man is unfit,” tweeted Shaub, who joined the ethics office as a staff attorney early during the George W. Bush administration and was appointed as the office’s director by President Barack Obama.
The tweet, which came as Trump prepares to head to New York for a critical round of powerhouse diplomacy with world leaders at the United Nations, followed a week during which Clinton reemerged in the spotlight as she promoted her new book, “What Happened,” about the 2016 campaign, reviving her fiercest criticisms of Trump and his supporters and reigniting the debate about her stunning, unanticipated loss.
Trump slammed Clinton over her new book earlier this week too, tweeting that she “blames everybody (and every thing) but herself for her election loss.”
Trump’s Sunday morning Twitter post was one of more than a half-dozen supporters’ tweets the President retweeted Sunday before 8:30 a.m.
Those other tweets included an image predicting Trump would win every state for reelection in 2020, another showing Trump hauling US companies that have outsourced manufacturing abroad and a tweet claiming that “only true Americans can see that president Trump is making America great.”

“As part of the Trump administration’s extreme vetting, they are now examining the social media accounts of people applying for visas to see if they have ties to ISIS-related groups. Well, they must do the same to determine if a person seeking to enter our country has any ties to white-supremacist or neo-Nazi organizations in their home countries.

No one wants anyone with ties to ISIS allowed in the United States. We must also guard against allowing those with ties to dangerous white supremacist groups from setting foot on our soil. They, too, are a potential threat to the people of our nation.
This sick ideology is not just limited to America, as we saw in January in Canada when a young white man described as an “ultra-nationalist white supremacist” walked into a Quebec mosque and shot and killed six Canadian Muslims as they prayed.

And after Charlottesville, white nationalist groups in various European nations cheered the attack by the man who killed Heather Heyer. Do you really want people with those views granted visas to visit our country?


Although, to be blunt, the greatest threat likely comes from white supremacists already within our own borders.

If you think Charlottesville is the only deadly white supremacist terrorist attack in recent times, you haven’t been paying attention.

In May, we saw a self-professed white supremacist in Portland, Oregon, stab two people to death on a train after they stood up to his anti-Muslim tirade directed at a young Muslim-American woman. In March, a 28-year-old white man who was a reader of white supremacist websites traveled to New York for the sole purpose of killing African-Americans. He killed one black man before being arrested and charged with terrorism by the Manhattan district attorney.

In December, another white supremacist was sentenced to 30 years in prison for plotting a domestic terrorist attack involving a radioactive device that he planned to kill Muslims with in New York state.

All of these domestic terrorist attacks prove that it’s time that Trump take the deadly threat of white supremacists as seriously as the threat that ISIS poses. And one big step he can take — in addition to enacting policies and allocating resources to fight their hateful ideology — is making it clear on Twitter that he views white supremacists as “losers.” The lives of Americans depend on it.”

Trump never speaks to or deals with the “real” America: the diverse, multicultural, multitalented, multiracial, ecumenical America where the majority of us live. Not surprising, perhaps, considering that this is the America that by and large didn’t vote for him. Yet, it’s also the “majority America” that a much less diverse minority of Americans elected him to govern.

No, instead Trump chooses carefully orchestrated “campaign-style rallies” where he speaks to crowds of “True Believers:” nearly all white folks wearing red baseball caps, waving American flags, and chanting inane nationalist slogans like “build the wall” and cheering wildly as Trump does things like heap praise upon  the racist, scofflaw, hate-monger “Racist Joe.” Whipping up destructive and divisive passions while spreading a false narrative praising the myth of the “Great White America” is a “clear and present danger” to our national security and our national values.

Meanwhile, the Administration doubles down on the contrived message that we should fear visa holders and exhaustively vetted refugees from a few Muslim countries. When will those charged with protecting us turn their attention to the real security threats among the far right and how their own ill-conceived actions and inflammatory words actually increase the danger to all of us?

“President Donald Trump told lawmakers Wednesday that he’s open to signing legislation protecting thousands of young immigrants from deportation even if the bill does not include funding for his promised border wall. But Trump remains committed to building a barrier along the U.S.-Mexican border, even if Democrats say it’s a non-starter.
Trump had dinner with Sen. Chuck Schumer and top Democrat Nancy Pelosi Wednesday night, and they reached a deal on DACA, according to a joint statement by the democrats.
“We agreed to enshrine the protections of DACA into law quickly, and to work out a package of border security, excluding the wall, that’s acceptable to both sides,” the statement read.
Trump, who was deeply disappointed by Republicans’ failure to pass a health care overhaul, infuriated many in his party when he reached a three-month deal with Sen. Schumer and House Democratic Leader Pelosi to raise the debt ceiling, keep the government running and speed relief to states affected by recent hurricanes.

Trump ended the program earlier this month and has given Congress six months to come up with a legislative fix before the so-called “Dreamers'” statuses begin to expire.
“We don’t want to forget DACA,” Trump told the members at the meeting. “We want to see if we can do something in a bipartisan fashion so that we can solve the DACA problem and other immigration problems.”
As part of that effort, Trump said he would not insist on tying extending DACA protections to wall funding, as long as a final bill included “some sort of border security,” said Democratic Rep. Henry Cuellar of Texas, who attended the meeting.

“He said, ‘We don’t have to have the wall on this bill,'” recalled Cuellar. “He said: ‘We can put that somewhere else, like appropriations or somewhere.’ But that was very significant because a lot of us don’t want to tie DACA and the wall. We’re not going to split the baby on that one. So he himself said, ‘We’re not going to put the wall tied into this.'”
Trump has made a sudden pivot to bipartisanship after months of railing against Democrats as “obstructionist.” He has urged them to join him in overhauling the nation’s tax code, among other priorities.
“More and more we’re trying to work things out together,” Trump explained Wednesday, calling the development a “positive thing” for both parties.

“If you look at some of the greatest legislation ever passed, it was done on a bipartisan manner. And so that’s what we’re going to give a shot,” he said.
The “Kumbaya” moment appeared to extend to the thorny issue of immigration, which has been vexing lawmakers for years. Funding for Trump’s promised wall had been thought to be a major point of contention between Republicans and Democrats as they attempted to forge a deal.
Democrats have been adamant in their opposition to the wall, but both Pelosi and a top White House staffer indicated Tuesday that they were open to a compromise on border security to expedite DACA legislation.

White House legislative director Marc Short said during a breakfast that, while the president remained committed to the wall, funding for it did not necessarily need to be linked directly to the “Dreamers” issue. “I don’t want us to bind ourselves into a construct that makes reaching a conclusion on DACA impossible,” he said.”

I have to admit that I’m stunned by this swing of the pendulum. But, I’m pleased and relieved for the great Dreamers if it works. The Devil is often in the details, particularly with immigration.

On this occasion, I’ll have to agree with the President that bipartisan legislation putting the best interests of the country first is a good thing, and a smart way for the President to get credit for some legislative achievements.

We’ll have to see what happens, But, it’s nice to end the day on a more optimistic note.

The Devil is indeed in the details!  According to this more recent article from Sophie Tatum at CNN (forwarded by my friend and fellow insomniac Nolan Rappaport) the “deal” is far from done and the White House version of  the meeting is not the same as the Schumer-Pelosi statement:

“White House press secretary Sarah Sanders immediately pushed back on the idea the wall would be dropped.
“While DACA and border security were both discussed, excluding the wall was certainly not agreed to,” Sanders said.
White House Legislative Affairs Director Marc Short confirmed that the President and Democrats agreed to work to find a legislative fix for DACA, but he called Democrats’ claim of a deal that would exclude wall funding “intentionally misleading.”

“To qualify for protections from El Salvador, recipients must have lived in the United States since 2001, and for Honduras, it’s 1998, meaning any revocation of the program would upend lives built in the United States for nearly 20 years.
Lawmakers have been pressing the Trump administration to preserve temporary protected status for the countries whose deadlines for redesignation are coming up soon, citing the communities that would be harmed. At a meeting in July with members of the Congressional Hispanic Caucus, then-Homeland Security Secretary John Kelly indicated he could end Haiti’s status but hadn’t made a decision on Central America.
In addition to the humanitarian concerns, supporters of the program point to analyses that show an economic impact from revoking it.
“If El Salvador terminates, literally 260,000 eligible workers will fall out of the workforce at the stroke of midnight on whatever day that happens,” Rodriguez said.
An analysis by the Immigrant Legal Resource Center, which advocates for pro-immigration policies, found that deporting all the immigrants from El Salvador, Honduras and Haiti who have temporary protected status would cost $3.1 billion and take away $6.9 billion in contributions to Social Security and Medicare and $45.2 billion to the gross domestic product over a decade. Turnover costs for their employers would total nearly $1 billion.
“There’s different elements to the concern,” said Rep. Zoe Lofgren, a Democrat from California. “First, in the case of people who’ve been here a considerable period of time, people become members of their community, and so … a couple decades later, you own businesses, you have families, you have grandchildren, you’re kind of part of our situation here.”
Lofgren said the designated countries often remain in dire straits, and sending people back to them would be “unwise.”
The program is one of the issues that Congress needs to tackle as part of immigration reform because insisting on keeping recipients’ status temporary becomes untenable, she said.
“There should be some rational way to transition people who have been here for a long time, and in the case of these people, they’ve been here in legal status, who because of the length of their stay have basically become valued members of our community,” Lofgren said. “That’s a matter of a change of immigration law.”

Terminating TPS would further de-stabbilize the U.S. Immigration Court system because many, probably the majority of TPS recipients have court cases that were “administratively closed” and therefore taken off that Court’s docket (currently totalling more than 610,000 cases with some hearings already scheduled four or more years in the future). Merely the preliminary act of “moving to re-calendar” the TPS cases all at once could crash the court system, given its current non-automated, largely manual, paper intensive procedures and lack of any e-filing.
If hundreds of thousands of individuals were returned to El Salvador it would likely de-stabllize the country and lead to collapse and internal chaos. Additionally, loss of “remittances” sent to El Salvador by legally working TPS individuals in the U.S. would almost certainly send the El Salvadoran economy into a tailspin. For that reason, a prior plan during the Clinton Administration for a phase-out of Salvadoran TPS led to panicked entreaties from the Salvadoran Government to the Administration to leave the TPS program in place.
From my perspective as an Immigration Judge, TPS was one of the “smartest” programs ever. It allowed many deserving individuals with difficult asylum cases that would have taken many hours of hearing time to be removed from the court docket with minimal work for the Immigration Court and our overburdened staff. Even “de novo review” of a TPS denial could ordinarily be accomplished in a 30 minute “short block” of hearing time rather than a 3-hour “full block” hearing.
TPS combined efficient adjudication by USCIS with needed work authorization for American families, while “demurring” on the more difficult questions of green card status or a path to citizenship. It also had an effective  enforcement mechanism. Those relatively few TPS individuals who committed a felony or two or more misdemeanors were arrested, placed in detention, stripped of status, and in most cases removed from the U.S. promptly under the policies placed in effect by the Obama Administration.

“Washington (CNN)Conservative states may have boxed President Donald Trump into announcing an end for the Deferred Action for Childhood Arrivals program — but Democratic state attorneys general are already fighting back.

A coalition of 16 Democratic and nonpartisan state attorneys general filed suit in New York federal court on Wednesday to stop Trump’s sunset of DACA — the Obama-era program that protected young undocumented immigrants brought to the US as children from being deported — and they say Trump’s comments about Mexicans should be used against him.
The groups laid out five different constitutional arguments against Trump’s move, saying it was motivated by discriminatory reasons, that it violated due process by being “fundamentally unfair,” and that it violated laws that dictate procedures for federal regulations.
The lawyers note that most DACA recipients are of Mexican origin and devote a whole section to inflammatory statements Trump has made about Mexicans, including his attacks on a federal judge of Mexican descent.
“As President Trump’s statements about Mexico and those with Mexican roots show, the President has demonstrated a willingness to disparage Mexicans in a misguided attempt to secure support from his constituency, even when such impulses are impermissible motives for directing governmental policy,” the attorneys general wrote.
Trump’s statements as a candidate and President have been used against him in previous lawsuits, most notably challenges against his travel ban earlier this year.
The lawsuit also devotes a section to Texas, the state that pushed Trump to end the program, using a section to describe Texas as “a state found to have discriminated against Latinos/Hispanics nine times since 2012.”

Trump on Tuesday moved to sunset the DACA program, acting in response to a threat from 10 states led by Texas Attorney General Ken Paxton sent in late June, threatening Trump that they’d sue in an unfriendly court if the President didn’t end the program by September 5.
The President said his administration would not accept any new DACA applications from Tuesday onward and that any two-year DACA permits expiring after March 5, 2018, would not be renewed.
Now, those state officials’ Democratic counterparts are hoping they can have the opposite effect on the administration, succeeding in the courts to reinstate the program that has protected nearly 800,000 young people in its time and currently has nearly 700,000 people enrolled.
“Immigration is the lifeblood of New York State,” New York Attorney General Eric Schneiderman said in a statement. “The Trump administration’s decision to end DACA is cruel, inhumane, and devastating to the 42,000 New Yorkers who have been able to come out of the shadows and live a full life as a result of the program.”
“I filed suit against President Trump and his administration to protect DACA because Dreamers are just as American as first lady Melania Trump,” New Mexico Attorney General Hector Balderas said in a statement.

Justice Department spokesman Devin O’Malley said the department is ready to defend itself.
“As the attorney general said yesterday: ‘No greater good can be done for the overall health and well-being of our Republic, than preserving and strengthening the impartial rule of law,'” O’Malley said. “While the plaintiffs in today’s lawsuits may believe that an arbitrary circumvention of Congress is lawful, the Department of Justice looks forward to defending this administration’s position.”

I agree with Steve Yale-Loehr and other experts that Federal Courts (other, of course, than Judge Hanen in Texas) usually are reluctant to get into the area of prosecutorial discretion (“PD”). During my “Legacy INS” days, we successfully fended off numerous attempts to judicially review PD.

There were two areas, however, where we sometimes got “pushback” from Federal Judges. One involved claims of systematic racial, political, or nationality bias in PD decisions. The other involved claims that the Government had promised foreign nationals PD as an inducement for testimony or evidence in connection with criminal investigations.

Both of these appear to be implicated here. Indeed, Sessions’s anti-immigrant, anti-Latino rant from yesterday, replete with demonstrable misrepresentations and unfounded innuendo, should be a “treasure trove” for plaintiffs.

Additionally, as I pointed out in a blog from earlier this week, some Federal Judges are already on record as finding unfairness in the DHS practice of soliciting applications for humanitarian relief and then using the application information as proof of removability. The overwhelming majority of DACA applicants were not in enforcement proceedings. The came forward to USCIS voluntarily in response to a Government campaign urging them to apply and promising that application information would not be used against them.

In the past, the racially charged bombastic statements of Trump and his minions have been very useful to plaintiffs in making out a case of invidious motivation.

Finally, the claim that the Sessions DOJ is interested in  preserving and strengthening the rule of law might well provoke laughter in the courtroom. And, Sessions won’t be able to prosecute Federal Judges for reacting to his disingenuous claims the same way he can threaten his activist critics. Indeed, I can only hope that the Federal Judge assigned to this case is astute enough to note that such a ridiculous claim is being made in behalf of a President who consistently disrespects the Federal Judiciary and whose sole act of  clemency to date has been to pardon the notorious racist scofflaw “Sheriff Joe” who was held in  contempt of Federal Court. “Rule of law” indeed!

COURTSIDE COMMENTARY/ANALYSIS: AG Jeff “Gonzo Apocalypto” Sessions Might Be A Clown 🤡 — But His White Nationalist Plan To Destroy The American Justice System Is No Joke — He Has Already Done Untold Damage To Our Country & Our Rights — And, He And His White Supremacist Buddy Steve Bannon, The Alt-Right, And Other Haters Are Just Getting Started On Their Plan To Turn America Into A “Whites Only” Paradise!

Three articles from today show the “clear and present danger” to American democracy, our national security, and our fundamental values stemming from Jeff “Gonzo Apocalypto” Sessions and his radical right — some would say fascist is more accurate — cabal.

While Trump increasingly appears to be a looney incompetent functioning primarily in the early morning “tweetosphere,” Sessions & Co. know a thing or two about how to take over and sabotage government of the people, by the people, and for the people. (Ironically, the “Party of Lincoln” has morphed into  the “anti-Lincoln,” opposed to equality, generosity, democracy, and inclusion.)

First, Dana Milbank in the Washington Post describes “Gonzo the Clown’s” ludicrous attempts to use and abuse criminal law to suppress free public expression of opinions:

“Did you hear the one about Jeff Sessions?

I’d like to tell you, but I can’t. You see, it’s illegal to laugh at the attorney general, the man who on Tuesday morning announced that the 800,000 “dreamers” — immigrants brought here illegally as children — could soon be deported. If you were to find my Sessions jest funny, I would be an accessory to mirth.

This is no joke, because liberal activist Desiree Fairooz is now being put on trial a second time by the Justice Department — Jeff Sessions’s Justice Department — because she laughed at Sessions during his confirmation hearing. Specifically, she laughed at a line about Sessions “treating all Americans equally under the law” (which is, objectively, kind of funny).”

Yeah, I guess what Sessions, a well-established liar, probably a perjurer, really meant was “all Americans except Blacks, Hispanics, Asian Americans, immigrants, migrants, Dreamers, gays, lesbians, transgendered, bisexual, criminal defendants, Democrats, non-Christians, protestors, non-GOP women, and the poor.” Read the rest of Dana’s article here:

But, the following list of hostile actions that Sessions has already taken at Justice, compiled by CNN’s Gregory Krieg, are no laughing matter:

“*Directed federal prosecutors to pursue the stiffest possible charge in every single criminal case — potentially triggering draconian mandatory minimum sentences the Obama administration tried to avoid on fairness grounds for non-violent offenders.

*Withdrawn an Obama administration directive offering protections for transgender students who wanted to use bathrooms corresponding to their gender identity.

*Reversed an Obama DOJ order that the federal Bureau of Prisons back off new deals with private facilities. “I direct the Bureau to return to its previous approach,” Sessions said in a memo citing concerns that the “future needs of the federal correctional system” would be “impaired.”

*Launched a broad-based effort to reduce federal oversight of local police departments, like those put under increased scrutiny following investigations into alleged abuses. The deputy attorney general and associate attorney general were ordered to review lots of things, including all “contemplated consent decrees.”

*In a move criticized by voting rights advocates, asked state election officials in June to lay out their processes for purging voter rolls of individuals who have become ineligible due to, among other reasons, “death or change of residence.”

*Put in place a policy that could pave the way for an increase in a certain kind of civil asset forfeiture, a controversial practice — in this case a joint federal, state and local version that some departments were accused of using to get around state law — that allows police to seize money or property from suspects who haven’t been convicted of a crime. (The DOJ says it has put new safeguards in place to prevent abuse.)

And more.
Consider Trump’s plan to end DACA. When it came down to it, the President steered clear of the spotlight and let Sessions be the public face of a decision officials from both parties have described as unfair or even cruel.
It’s not the first time Trump has been happy enough — or detached enough, depending on your assessment of the his mindset on these issues — to defer to Sessions or, in cases where executive action is required, follow his lead. Where Trump is primarily focused on how he’s covered in the press and how his actions play with “the base,” officials like Sessions and EPA Administrator Scott Pruitt have shown themselves to be laser-focused on very specific policy points.

And, in the Washington Post,  Sarah Posner puts it all in scary context by describing the Bannon-led White Nationalist’s larger program to turn America into a White Theo-Fascist State:

“Now that he is out of the White House, Bannon’s ambitions, if anything, appear to seek an even more enduring footprint on Republican politics. His grand plan is to remake American conservatism, by shifting it away from its long-standing “three-legged stool” coalition of tax-cutters, defense hawks and the religious right. His strategy is to peel away Christian conservatives from that coalition, and to build a new coalition with anti-immigrant, anti-Muslim, far-right nationalists, in order to make the Trump revolution permanent, even after Trump has left the White House.
Consider the headline on a prominently placed “exclusive” published on the site late last night, which heaps the most coveted of Breitbartian praise on Moore: “Judge Roy Moore Embodies Jeff Sessions.” In an interview with Breitbart, Moore says he shares Sessions’s views on immigration and trade, and that he, too, is a “very strict constructionist of the Constitution.” He says he favors impeaching federal judges, even Supreme Court justices, and singles out Obergefell v. Hodges , the landmark 2015 case legalizing same-sex marriage, as warranting impeachment.
Bannon hinted at some of his designs in an interview with me last year. He said that, without the religious right, his base alone lacks the numbers to “to ever compete against the progressive left.”
In Moore, Bannon has found an unabashed proponent of “biblical law.” Bannon doesn’t appear to care much about “biblical law,” but Moore’s overheated depiction of the overreach of the federal government dovetails with the Bannon goal of “the deconstruction of the administrative state.”
Indeed, the Breitbart-Moore alliance is the most vivid example to date of the anti-government, white-nationalist Breitbart forces teaming up with a candidate with shared views on issues such as immigration and the role of the federal government, but which are driven by outwardly theocratic aspirations. Bannon is not seen as an overtly religious figure, but he has actively sought the religious right’s imprimatur for purely political purposes.
As Politico reports, Bannon himself is now using Breitbart to help “orchestrate the push” for Moore’s candidacy in high-level meetings with influential conservative groups.
There is a good deal of overlap between Bannon’s depiction of Trumpism as a revolt against global elites and Moore’s own rhetoric. Moore has long railed at elitists and “tyrannical” government overreach, albeit from a theocratic point of view. He first became a national hero to the religious right over a decade ago, after he was stripped of his post as chief justice of the Alabama Supreme Court for defying a federal court order to remove a 2.6-ton Ten Commandments monument from the state courthouse, because it violated the separation of church and state.
Undeterred, Moore ran unsuccessfully for governor and then again for his state’s top judicial post, regaining his seat in 2012. After a federal court struck down the state’s ban on same-sex marriage in early 2015, Moore pointedly told Alabama’s governor that complying with the federal court order could violate God’s law.
Although Breitbart hardly teems with religious language, Moore shares its conspiratorially dark vision of America, and particularly America’s perceived enemies. When I saw him speak in 2011, when Barack Obama was still president, Moore maintained: “Our government is infiltrated with communists, we’ve got Muslims coming in and taking over where we should be having the say about our principles.” On immigration, he said the government was failing “to protect against invasions” and was “letting anybody come in!”
Ultimately, the Breitbart-Moore alliance offers a hint at where the Trump base is headed. If Bannon has his way, it will evolve into a kind of coalition of anti-immigrant, anti-Muslim white nationalists seeking to disrupt the GOP from within by joining forces with the Christian right, long an essential component of the GOP base. Whether or not Moore wins, if Bannon can keep pushing the Trumpist base in that direction by continuing to solidify that coalition, we can only guess at the consequences that will have for the GOP over the long term.”

Consequences for the GOP, Sarah? What about the consequences for the world and humanity of turning America into a White Fascist State incorporating the worst parts of Christian mythology, while leaving the kind, merciful, inclusive, and forgiving message of Jesus Christ in the dust?

In the first place, fortunately, only a minority of Americans share the Bannon-Sessions White Nationalist dream. So, making it come to fruition has to involve suppressing and overcoming by unlawful or unconstitutional means the will and rights of those of us in the majority.

That’s an old Bolshevik trick. And, indeed, Bannon is a self-proclaimed “Leninist revolutionary” — Sessions is his Trotsky. (Can’t really picture Stephen Miller as Stalin —  but his ability to concoct lies at a moment’s notice and his cold lack of humanity or any discernible decency or human values, along with his disdain for representative government and love of the dictatorial model certainly fits “Papa Joe” to a tee. You could definitely imagine Miller as leader of a Trump “personality cult” in a fascist regime.)

But, that’s not all folks! Intentionally cruel, racist, and gonzo as Sessions’s grand plan of “ethnic cleansing” of Dreamers might be, it would actually cost the US economy an astounding  $215 billion, and that’s a conservative estimate that doesn’t even factor in the billions that would be wasted by DHS and EOIR in arresting and deporting America’s future stars (basically, because they aren’t White. As I’ve said before, no sane person thinks we’d be having this orchestrated “immigration debate” if the migrant population were predominantly white, English as a first language, Christians)!

According to Vanessa Wang in Buzzfeed:

“Reversing the Deferred Action for Childhood Arrivals program could cost the economy $215 billion in lost GDP and cost the federal government $60 billion in lost revenue over ten years, according to the libertarian think tank the Cato Institute.
Ike Brannon, a visiting fellow at Cato, wrote in a recent blog post: “It is important to note that these estimates are conservative, as DACA recipients will likely end up being more productive than their current salaries indicate, as they complete their degrees and gain experience in the workplace. Nor does this analysis factor in the enforcement cost of physically deporting recipients should the program be eliminated, which we believe would be significant.”
California, New York and Florida would bear the greatest costs, according to the Cato Institute’s analysis.
The New American Economy — a coalition of business leaders and mayors “who support immigration reforms that will help create jobs for Americans today” — estimated that the DACA-eligible population earns almost $19.9 billion in total income annually, contributes more than $1.4 billion to federal taxes, more than $1.6 billion to state and local taxes and represent almost $16.8 billion in spending power.
“Despite the rhetoric claiming undocumented youths are a drain on the U.S. economy, 90% of the DACA-eligible population who are at least 16 years old are employed” and contribute meaningfully to the economy, the coalition wrote in a brief.
“Ending DACA will disrupt hundreds of thousands of promising careers and cost the US economy dearly,” said John Feinblatt, President of New American Economy in a statement on Tuesday.
On Tuesday, the Department of Homeland Security said it would shut down DACA in six months, potentially giving Congress some time for a legislative solution. House Speaker Paul Ryan has said there are DREAMers “who know no other country, who were brought here by their parents and don’t know another home. And so I really do believe there that there needs to be a legislative solution.”
“Now it’s imperative for Congress to do what’s right and economically smart – protect the young achievers who know no home but America,” said Feinblatt.”

That’s right folks! The Bannon-Sessions White Nationalists would be willing to damage our economy to the the tune of probably a quarter of a trillion dollars for the sheer joy of ruining human lives and entrenching their White Power structure. In most other contexts, there would be a name for such conduct: “domestic terrorism!”

Finally, a number folks have noted that DACA is a DHS/USCIS program. So, why was the Attorney General, who pointedly was stripped of his immigration deportation functions and responsibilities by the Act creating DHS, out there acting like he is the deporter-in-chief and administrator of the DHS (which, by statute, he no longer is.)

 

Well, not suprisingly, I’m not in the Trump Administration’s “inner circle.” So, who knows for sure.

But, to me two things were evident. First, Donald Trump is a coward who didn’t have the guts to be the front man for his own inhumane policy — particularly since Sessions contradicted Trump’s public assurances that he “loved Dreamers,” understood their plight, and that they had “nothing to fear” from him and his Administration because he was going to come up with a”great solution” to their situation.

Second, Sessions has never accepted his secondary statutory and Constitutional role in immigration enforcement. With the weak Gen. Kelly in charge of DHS, Sessions simply pretended like the AG was back at the helm of immigration enforcement. After all, Sessions has spent a lifetime attempting to turn back the clock. This is just the first time that he has gotten away with it without any real opposition.

Kelly was a “bobblehead,” meekly agreeing with Sessions’s most outrageous, unlawful, and inhumane statements. He even lent his name to an infamous Sessions-Miller contrived “letter” asking the President for Travel Ban 2.0 and citing facially bogus statistics and disingenuous arguments attempting to tie individuals from Muslim countries to unrelated terrorist threats. In other words, on immigration enforcement, Kelly’s “substance” was about 1/16″ deep, and I’m being generous.

Obviously, killing the Dreamers’ future while heaping scorn on them was Session’s version of “Super Bowl Sunday:” a chance to publicly reclaim the role of deporter-in-chief, while inflicting gratuitous harm on a gallant but vulnerable (largely non-White) group of young people, and tossing in some gratuitous racist insults and nativist lies in the process. For a guy who has spent a lifetime heretofore unsuccessfully trying to “get back to Jim Crow” (where not coincentally, bogus “rule of law” arguments and “state’s rights” were used by Sessions’s Alabama antecedents to deny Black Americans not only their constitutional rights but in many cases their very lives in the process) this had to be “hog heaven.” Let’s not forget that Sessions has endorsed the blatantly racist and anti-semitic “Immigration Act of 1924” as a model for White Nationalist restrictionist policies. I’m sure Gonzo pines for the “good old days” of the Chinese Exclusion Laws when America knew how to use the “rule of law”  and just how to treat the folks who built the trans-continental railroad, most of California, lots of New York, and points in between. Declare them to be an “inferior race” — a threat to our cultural integrity —  and throw them out before they can displace the White Americans who exploited their ingenuity and hard labor.

Also, make no mistake about it, if Sessions were able to carry out his gonzo plans to deport Dreamers to foreign lands that most of them have hardly lived in, some will actually die in the process. But, hey, the lives of non-Whites are just “collateral damage” in the Bannon-Sessions world vision.

Sessions is part of our nation’s racist, White Supremacist past that we will need to get beyond to continue to prosper as a country and to lead the free world. The Dreamers can help us do that! The only question for the rest of us is what legal channels are available to move Sessions and his cohorts out of the way so that the Dreamers, along with other immigrants and minorities, can help lead us to a brighter future as a proudly diverse, humane, and powerful nation.

Fresco also pointed to advocacy groups on the left as key to Democrats’ decision-making. As long as those groups insist, as they do, that they won’t accept a DACA fix in exchange for more enforcement, Democrats are stuck.
“The politicians are being bolstered by the groups, and the groups themselves are saying don’t trade any enforcement for DACA,” Fresco said. “If that were to change, then the fundamental dynamics of the issue would change, but at the moment that’s not where the advocacy community is — they want a fight on DACA to show that the President is on the wrong side of these issues.”

The Trump administration has been discussing for weeks what to do about DACA, responding to the deadline on an ultimatum issued by 10 state attorneys general, led by Texas. The threat: Sunset DACA by September 5 or the states will try to end it in court.
Discussions have heated up this week as officials have met to chart a path forward. While a decision had been possible Friday, and one source familiar had believed a decision was pending Friday morning, by midday, sources familiar with the deliberations did not expect a decision before the weekend.
Parts of the Department of Homeland Security, which administers DACA, have been told to prepare for a decision but have not been given any potential details of what a decision may be.

Sources inside and outside the administration said the White House continues to explore buying itself time and is also considering allowing the attorneys general to proceed with their threat.

Any action by the President to sunset DACA would put immediate pressure on Congress to act, something the White House and a senior congressional source recognize would be a challenge with many other pressing priorities at the moment, from Harvey relief to the debt ceiling to government spending. A go-slow approach on DACA is preferred, the congressional source added.
Big congressional boost
Ryan has long been sympathetic to the plight of Dreamers. At a CNN town hall at the beginning of the year, Ryan was asked by a young woman protected under DACA whether he wanted her deported. He said he was working with the Trump administration and seeking a “humane solution.”
“What we have to do is find a way to ensure that you can get right with the law,” the speaker told the young woman.
But until now, leadership has not helped the push by moderate Republicans to advance legislation to do so. Four different options have been introduced in Congress, including two bipartisan solutions led by Sens. Lindsey Graham, a South Carolina Republican, and Dick Durbin, an Illinois Democrat. Another proposal from Florida Republican Rep. Carlos Curbelo has entirely Republican support and is expected to be introduced in a similar form in the Senate by North Carolina Republican Thom Tillis.
In addition to Ryan’s endorsement, another conservative boost on Friday came from Utah Sen. Orrin Hatch, a staunch conservative who has in the past supported immigration reform.
“I’ve urged the President not to rescind DACA, an action that would further complicate a system in serious need of a permanent, legislative solution,” Hatch said in a statement. “Like the President, I’ve long advocated for tougher enforcement of our existing immigration laws. But we also need a workable, permanent solution for individuals who entered our country unlawfully as children through no fault of their own and who have built their lives here. And that solution must come from Congress.”
Colorado Rep. Mike Coffman, a moderate Republican, announced on Thursday he would try to force a vote on one of the bipartisan bills when Congress returns next week through what’s known as a discharge petition, which would require a majority of House members to sign on to work. The speaker’s office had no comment on that effort.”

Supporters of the program, including Washington Gov. Jay Inslee, came to its defense this week, urging the White House to keep DACA intact. Those ranks swelled with hundreds of corporate executives, lawyers and other organizations who made largely economic arguments in a separate open letter.

“Dreamers are vital to the future of our companies and our economy,” the letter said. Signatories include Amazon.com chief executive Jeff Bezos, Microsoft CEO Satya Nadella, and Starbucks boss Kevin Johnson.”

“(CNN)It’s important to politicize Hurricane Harvey. Not politics in the sense of political parties, or politics to win elections. Politics to protect America.

The priority in the next hours and days is to save lives and reduce suffering, without hesitation and without question of costs or politics. But then must come the reckoning.

Once the immediate crisis ends, the governor of Texas, Greg Abbott, should resign with an apology to his state and his country. Then the Texas delegation in Congress should make a public confession. They have lied to their constituents for too long, expecting the rest of America to keep bailing them out.
The reason is this. Texas politics aims to bring profits to the oil and gas industry, but it does this at high cost and dire threat to Texas residents and the American people.
Hurricane Harvey was a foreseeable disaster. Indeed, a massive hurricane strike on Houston, followed by massive flooding, was widely anticipated.
But Houston is an oil town, and the American oil industry has been enemy No. 1 of climate truth and climate preparedness. Most oil companies and Texas politicians see nothing, say nothing, do nothing. Even worse, they hide the truth, and then beg for help as needed. Gov. Abbott has played this game one disaster too many.

Abbott, for example, was the governor to sign a new law in 2015 that prevents cities and municipalities in Texas from setting their own regulations that might rein in oil and gas drilling activities. On his watch, Texas supported withdrawal from the Paris Climate Agreement.
Over many years, he has raked in millions in campaign contributions from the oil industry, including in his former role as Texas attorney general, where he sued the Environmental Protection Agency repeatedly over rules designed to curb carbon emissions.
And the state, under Abbott’s direction, has taken no significant steps toward flood protection, despite the recognized risks of a mega-hurricane and flood.
The problem is not about his crisis management this week. I can’t judge that. It’s about his long-standing relentless opposition to environmental protection, including his blind eye to global warming and the grave dangers it poses.
The Texas Tribune and ProPublica published a 2016 award-winning report on “Hell or High Water,” explaining why Houston is a “sitting duck for the next big hurricane.” In 2015, Inside Climate News wrote that “as weather extremes like flooding batter Texas, its refusal to prepare for an even more volatile climate leaves residents at risk, experts say.”
On June 16 of this year, citing the city’s widening concrete sprawl and deaths from flooding in recent years, the UK Guardian wrote that “Houston fears climate change will cause catastrophic flooding: It’s not if, it’s when.”

So, what has been the policy response in Houston and Texas more generally in terms of prevention, resilience, and preparedness? Almost nothing until disaster hits. Then the response is to ask for federal bailouts.
In other words, Texas is the moral hazard state.
Here is what has not happened: There has been little or no effort at zoning protection to keep development clear of floodplains; little or no offshore and onshore infrastructure for flood protection; no discernible heed paid to the scientific evidence and indeed the growing practical experience of catastrophic flood risks; and of course, relentless, pervasive climate change denial, the mother’s milk of Texas politics.
So, here’s the deal. Those of us elsewhere in the US also suffering from flooding and other disasters from warming temperatures, rising sea levels, and more intense storms (such as New Yorkers who are still rebuilding from 2012 Hurricane Sandy) want truth from Texas politicians and the oil industry.
We are bearing the costs of your lies. We are tired of it. More importantly, we are in pain and solidarity with the good people of Houston who are losing lives, homes, and livelihoods because of your lies.

Gov. Abbott, we would like to bid you a political adieu. Perhaps you can devote your time to rebuilding Houston and taking night classes in climate science. Senators Ted Cruz and John Cornyn, you will soon be asking us for money to help Texas.
My answer will be yes, if you stop spewing lies about climate dangers, agree to put US and Texas policy under the guidance of climate science, back measures to lower carbon emissions and stay in the Paris Climate Agreement. Then, of course, let’s help your constituents to rebuild.
And to ExxonMobil, Chevron, Koch Industries, ConocoPhillips, Halliburton, and other oil giants doing your business in Texas: You put up the first $25 billion in Houston disaster relief. Call it compensation for your emissions. Tell the truth about growing climate threats. Then, as citizens seeking the common good, we will match your stake.”

“Washington (CNN)Tuesday marks the fifth anniversary of a program that protects young undocumented immigrants from deportation — but supporters worry this one could be its last.

The Deferred Action for Childhood Arrivals program, or DACA, was implemented in 2012 under President Barack Obama, and President Donald Trump’s administration has continued running despite heated rhetoric against it from Trump on the campaign trail.
But DACA has arguably never been on shakier ground, and advocates for the program are desperately trying to protect it, including with a planned march Tuesday on the White House.
Nearly 800,000 undocumented immigrants have benefited from DACA, which protects individuals who were brought to the US illegally as children from deportation, and offers them the ability to work, study and drive legally. Applicants must meet certain criteria, pass a background check and maintain a clean record.
But despite the fact that the administration has continued to issue permits, concerns are increasing that the program could be ended.
“DACA is under grave threat,” Nevada Democratic Sen. Catherine Cortez Masto said on a conference call with reporters Monday.
Ten state attorneys general, led by Texas Attorney General Ken Paxton, have issued an ultimatum to the Trump administration — sunset DACA by September 5, or we’ll challenge it in court. The attorneys general have threatened to petition a court that’s considering a similar but separate Obama administration deferred action program, for parents, to also weigh the legality of DACA.
Experts believe that given the makeup of the court hearing the case, and its previous ruling against the parents program, the judges involved would likely strike down DACA as well.
If the court allows arguments against DACA, the Justice Department would be forced to decide whether it will defend the program. While Trump has recently spoken about how sympathetic he is to the “Dreamers” who receive DACA, saying the choice is “very, very hard to make,” he campaigned on a pledge to immediately rescind it. And the US attorney general, former Sen. Jeff Sessions, has been a chief opponent of the program.
The White House offered a cryptic statement on the program’s future, expressing only concern with illegal immigration.
“The President’s priority remains protecting the jobs, wages and security of American workers, families and communities — including the millions of Hispanic and African American workers disadvantaged by illegal immigration,” an administration official said.
On the call with reporters and a DACA recipient, Masto and California Democratic Sen. Kamala Harris extolled its virtues, citing estimates that the US economy would lose hundreds of billions of dollars without the contributions of DACA recipients.
“This is not just about what is morally right, this is not only a point about what is right in terms of fighting for the ideals of our country,” Harris said. “This is also right and smart in terms of public benefits.”
Both are co-sponsors of one bipartisan proposal to make the program permanent in Congress, the Dream Act, which also has three Republican co-sponsors. It’s one of four proposed bills that would codify DACA if the administration were to rescind it or the courts were to strike it down.
The Department of Justice did not respond to a CNN request for comment.
US Citizenship and Immigration Services, the division of the Department of Homeland Security, said the program remains under review.
“The Department of Homeland Security’s stance remains the same — the future of the DACA program continues to be under review with the administration,” said USCIS press secretary Gillian Christensen. “The President has remarked on the need to handle DACA with compassion and with heart.
