“The Russia investigation may be undercutting Attorney General Jeff Sessions’ credibility, but it has not undermined his efforts to take the U.S. Justice Department back in time.

The time Sessions wants to go back to features an unforgiving system of mass incarceration that disproportionately targets people of color in a legal structure too often stacked against them.

To do this, the attorney general has issued a slew of policy rollbacks — unfortunate for a Justice Department that was only incrementally making progress toward equal justice under President Barack Obama and Attorney General Eric Holder.

In this sense, Sessions’ Justice Department might be the most effective unit of the Trump administration. If Trumpism’s goal is, at least in, part to destroy the progress achieved under the Obama administration, Sessions’ scorecard so far outstrips his GOP colleagues in the Cabinet and former colleagues in the Senate.

In March, for example, the nation’s top law enforcement officer visited St. Louis, next-door to Ferguson, ground zero for the Black Lives Matter movement. Sessions was in St. Louis talking about crime initiatives but also seeming to criticize one of the most useful tools for documenting police brutality: civilian cell phone videos. The choice of venue could not have been a coincidence. By focusing on “targeted police killings,” he deflected attention from the challenges now confronting law enforcement.

In fact, Sessions has had little to say on how the Justice Department might address matters of police brutality, much less on the matter of Black Lives Mattering. Instead, he has mostly showcased President Donald Trump’s belief that strong policing and incarceration are key to maintaining law and civil order.

It is as if Sessions’ Justice Department is operating on a set of alternative facts. Because the statistics are well known: Whites and blacks use and sell drugs at roughly the same rates, and African Americans make up roughly 13 percent of the U.S. population. Yet law enforcement records are remarkably different for each demographic. According to Human Rights Watch: “Black adults are more than two-and-a-half times as likely as white adults to be arrested for drug possession. In 2014, Black adults accounted for just 14 percent of those who used drugs in the previous year but close to a third of those arrested for drug possession.” In many states, a felony conviction also means losing the right to vote.

It is as if Sessions’ Justice Department is operating on a set of alternative facts.

Sessions looks eager to re-open the “war on drugs” — or, more appropriately, the war on poor people who use drugs. No available metric on this decades-long war shows any significant success in limiting access to drugs in the United States or in reducing addiction to controlled substances.

What the “war on drugs” has been good at is: stigmatizing poor people afflicted with the disease of addiction; profiling black and brown folks and arresting them at rates exponentially greater than their white counterparts; and creating revenue streams for the Prison Industrial Complex.

Sessions’ success will be key if Trump wants to make good on his law-and-order promises.

Sadly, it is working. The Justice Department is slowly transforming into an injustice department right before our eyes.

Mass incarceration, its impact on families and communities and the often racially biased ways in which its policies operate is still one of the most pressing human rights issues of our time. It’s a shame that, in the era of Trump, we are unable to effectively address the challenges we face.

LOCAL “DREAMERS” FILE SUIT OVER DHS’S UNFAIR RENEWAL POLICIES!

“At 26, Nurimaro Park was living paycheck to paycheck, helping support his undocumented parents on a tutor’s salary. So when his work permit expired in May, he waited to renew it because the rules allowed for that. He needed time to save up the $495 fee.

Now, he and thousands of others who let their Deferred Action for Childhood Arrivals permits expire are without legal status in the United States. He and another young immigrant in Northern Virginia are suing the Trump administration in federal court in Alexandria, saying their due process rights have been violated.

“You can’t change the rules on someone without giving them a heads-up first,” said Simon ­Sandoval-Moshenberg, an attorney for the Legal Aid Justice Center representing the two.

Until September, DACA recipients, known as “dreamers,” could file a renewal of their two-year permits up to a year after expiration, a policy laid out on the U.S. Citizenship and Immigration Services website.

“Money is a huge issue; $495 is hard to save up,” said Park, who lives with his parents in Fairfax County. “You have a year of grace period . . . and I was taking advantage of that.”

Then, on Sept. 5, Attorney General Jeff Sessions announced that the program would end in six months. Although immigrants whose permits are set to expire before March 5 were given the chance to renew them one last time, anyone whose permit had already expired could not.

The DACA program, created by President Barack Obama in 2012, allowed hundreds of thousands of immigrants brought to the United States as children to work legally and attend college.”

“President Trump’s vision of a “big, beautiful” wall along the Mexican border may never be realized, and almost certainly not as a 2,000-mile physical structure spanning sea to sea.

But in a systematic and less visible way, his administration is following a blueprint to reduce the number of foreigners living in the United States those who are undocumented and those here legallyand overhaul the U.S. immigration system for generations to come.

Across agencies and programs, federal officials are wielding executive authority to assemble a bureaucratic wall that could be more effective than any concrete and metal one. While some actions have drawn widespread attention, others have been put in place more quietly.

The administration has moved to slash the number of refugees, accelerate deportations and terminate the provisional residency of more than a million people, among other measures. On Monday, the Department of Homeland Security said nearly 60,000 Haitians allowed to stay in the United States after a devastating 2010 earthquake have until July 2019 to leave or obtain another form of legal status.

Even as they fight court orders seeking to halt parts of Trump’s immigration agenda, Sessions, White House senior adviser Stephen Miller and other key players are finding ways to shrink the immigration system. Miller was an aide to Sessions before both men joined the administration; in less than a year, their immigration policy prescriptions have moved from the realm of think-tank wish lists to White House executive orders.

In October, the White House — in a plan led by Miller — said it had conducted a “bottom-up review of all immigration policies” and found “dangerous loopholes, outdated laws, and easily exploited vulnerabilities in our immigration system — current policies that are harming our country and our communities.”

Trump’s tough talk alone appears to be one of the administration’s best bulwarks: Illegal crossings along the border with Mexico have plunged to their lowest level in 45 years, and U.S. agents are catching a far greater share of those attempting to sneak in. Applications for H-1B skilled visas and new foreign-student enrollment have also declined.

William Frey, a demographer at the Brookings Institution, said that until now U.S. immigration rates have largely spared the country from the challenges facing advanced industrial nations such as Japan and Germany that can’t replace aging workers fast enough. By slashing immigration, Frey said, the country could end up with labor shortages and other workforce issues.

But although some of Trump’s most fervent supporters see curbing immigration as a way to turn back the United States’ rapid racial and ethnic transformation, Frey said it is an unrealistic goal. By 2020, census projections show minorities will account for more than half of the under-18 U.S. population, because of higher birthrates in nonwhite populations. And by 2026, the number of whites is projected to begin declining in absolute numbers, he said, as deaths exceed births.

“You can slow the rate of Latino and Asian immigration, but it won’t make the population whiter,” Frey said. “It will just become less white at a slower pace.”

Trump continues to insist his administration will build a border wall, despite exorbitant cost projections and senior DHS officials saying a 2,000-mile structure is impractical. His supporters say they admire the president for plowing ahead in his overhaul efforts and see a historic, generational shift underway.

“There is more than one way to get to the goal,” Dane said. “Legislative solutions are all great, but clearly the administration has done things behind the scenes. . . . The results have been dramatic.”

It’s no surprise that guys like Jeff “Gonzo Apocalypto” Sessions and his henchman Stephen Miller are leading this racist-inspired, xenophobic “race to the bottom” that if successful would likely tank our economy and cause even more inequality and social unrest as well as inflicting all sorts of unnecessary pain and suffering on long time residents, needed and productive workers, and the most vulnerable individuals seeking protection under U.S. and international laws.  Really, hard to see how guys like this with retrograde ideas that come right from the “Jim Crow era” of American history get into positions of power for which they are so totally unqualified, both by background and temperament. But, then again, look at whom we have elected our President to represent us on the international scene.

The good news for the majority of Americans is that  the “turn back the clock” plan is ultimately likely to fail. We will eventually move forward again as a diverse, productive, “country of immigrants,” and restore humane and humanitarian values to our national and international profile.

GONZO’S WORLD: Sessions Gives Congress The “Scarface Treatment” Again — Then He Jokes About Russia — Will Mueller Eventually Wipe The Smirk Off Gonzo’s Face?

“Jeff Sessions’s memory works in mysterious ways. He has “no clear recollection” of the March 2016 meeting where George Papadopoulos offered to set up a meeting between Donald Trump and Vladimir Putin — but the attorney general does remember shooting down the campaign aide’s unseemly suggestion.

Or, so Sessions tells the House Judiciary Committee.

In October, Sessions testified to the Senate that he did not have any “continuing exchange of information” with Russian operatives — and that he wasn’t “aware of anyone else [on the Trump campaign] that did.” Weeks later, Special Counsel Robert Mueller revealed

“Papadopoulos’s confession to the crime of lying to the FBI. In that written statement, the former Trump campaign national security adviser claimed that he had told Sessions about “connections” he had that “could help arrange a meeting between then-candidate Trump and President Putin” in March of last year. In his testimony before Congress Tuesday, Sessions tried to account for this apparent discrepancy.

“I do now recall the March 2016 meeting at Trump Hotel that Mr. Papadopoulos attended, but I have no clear recollection of the details of what he said at that meeting,” Sessions explained. “After reading his account, and to the best of my recollection, I believe that I wanted to make clear to him that he was not authorized to represent the campaign with the Russian government, or any other foreign government, for that matter.”

Later, Sessions said more firmly, “At the meeting, I pushed back.”

So, the attorney general has no clear memory of the meeting, but has a vivid recollection of behaving admirably during it.

This isn’t the first time that Sessions’s memories of last year have failed him. In January, the attorney general testified to the Senate that he had not “been in contact with anyone connected to any part of the Russian government about the 2016 election, either before or after election day.” Months later, the Washington Post revealed that Sessions had met with the Russian ambassador to the United States multiple times during the 2016 campaign. Sessions responded to these revelations by insisting that he’d met with Ambassador Sergey Kislyak in his capacity as U.S. senator (not as a Trump surrogate), and that they did not discuss the 2016 election. Sessions later conceded that it was “possible” that Trump’s positions on U.S.-Russia relations came up in his discussions with Kislyak.

Some Democrats have suggested that Sessions’s multiple false statements to Congress this year were conscious lies. The former senator responded to such charges with indignation Tuesday.

“My answers have not changed,” Sessions said. “I have always told the truth, and I have answered every question as I understood them and to the best of my recollection, as I will continue to do today … I will not accept and reject accusations that I have ever lied under oath. That is a lie.”

Meanwhile, speaking to a friendly audience over at the Heritage Foundation, Gonzo treated the Russia investigation as a joke. Mary Papenfuss reports for HuffPost:

“Attorney General Jeff Sessions had lawyers rolling in the aisles with a surprising string of Russian quips at the start of a speech he gave Friday.

Sessions was the keynote speaker at the National Lawyers Convention at Washington’s Mayflower Hotel hosted by the conservative Federalist Society.

He thanked the applauding crowd for welcoming him. Then, smiling mischievously, he added: “But I just was thinking, you know, I should ― I want to ask you. Is  Ambassador Kislyak in the room? Before I get started ― any Russians?” As the laughs grew louder, he continued: “Anybody been to Russia? Got a cousin in Russia?” The audience roared.

The jarring jokes came just three days after Sessions was pressed in Congress on apparent discrepancies in his previous testimony about Trump associates’ meetings with Russians during the 2016 campaign.

Sergey Kislyak, then Russia’s ambassador to the U.S., met with several members of Donald Trump’s campaign during the Republican National Convention, Kislyak and some Trump associates have revealed. Kislyak was widely believed a top spy recruiter.

Kislyak has said he discussed Trump’s policy positions during the campaign with Sessions, an early Trump supporter who was an Alabama senator at the time, The Washington Post reported.

But during his confirmation hearings to become attorney general ― before the Post report ― Sessions said he “never met with or had any conversations with any Russians or any foreign officials concerning any type of interference with any campaign or election.”

Sessions later recused himself from Special Counsel Robert Mueller’s probe into Russian interference in the U.S. election.

Critics were stunned by Sessions’ attitude in the lawyers’ speech.

Sessions “still doesn’t get it” — he’s “in trouble,” Rep. Ted Lieu (D-Calif.) told Wolf Blitzer later on CNN.

“He’s not in trouble where he happened to be in places where there are Russians,” said Lieu, a member of the House Judiciary Committee who grilled Sessions this week. “He is in trouble because he had a nearly hour-long meeting with Ambassador Kislyak — also a spy — and then he failed to disclose the existence of that meeting under oath to the U.S. Senate. That’s why Jeff Sessions is in trouble.”

Blitzer noted that Kislyak “now says he spoke with so many Trump officials it would take him more than 20 minutes to name them all.”

NBC NEWS: JOSÉ ANTONIO VARGAS — “The myth of the ‘acceptable immigrant’ is tearing families apart!”

“In the story of our country, the Trump administration’s dismantling of the DACA program is a national tragedy that will be a source of confusion for generations to come. The program was one of the few compromises that the Obama administration made in attempt to right unjust, inhumane and outdated immigration laws. Our own history tells us that laws are fluid and change over time; they do not dictate morality, but are dictated by morality (or the lack thereof). It wasn’t until the 20th century, for example, that we saw women first granted the right to vote and the abolishment of Jim Crow laws.

The pervasive rhetoric around immigrants who received DACA and their families is predicated on an underlying judgement that their mere presence in this country is a crime. It is not: Being in the U.S. without authorization is a civil offense.

Yet if a crime has been committed, someone must be responsible, right? If you qualify for DACA, it means that you were under a certain age when you came here, so you were too young to have committed a “crime.” You are a “good,” “acceptable,” “assimilated” one. But your parents are not. America will accept you — provisionally — but you must condemn the actions of your family members who brought you here.

“Divide and conquer.”

No wall has yet been built, no border yet drawn, no law yet written that overpowers the love of parents for their children. Let us celebrate and give thanks to the resilience of immigrant families who, despite all possible obstacles, find ways to survive, even thrive. Our laws and various languages may separate them, but united they stand.

One of the most offensive things that Sessions consistently does is to undervalue the contributions of immigrants, both documented and undocumented. This was particularly true in his slandering of “Dreamers.” They are America’s youth; we’re fortunate to have them!

The closely related idea of GOP White Nationalist restrictionists that “chain migration” is bad is equally insulting and totally wrong. Family immigration has contributed as much to America as has so-called “employment-based” immigration. Undocumented migrants have also contributed to our success, particularly our economic success.

Our real problem is with White Nationalists and restrictionists who insist on overly restrictive immigration policies that are unenforceable, expensive, corrosive, and against our national interests.

O CANADA: TRUMP POLICIES AID CANADIAN LOBSTERMEN AT THE EXPENSE OF MAINE! — CANADA BRACES FOR INFLUX OF “TPSers” FLEEING US!

“When Americans think about lobster, Maine often comes to mind. But Nova Scotia has emerged as a fierce competitor in exporting lobsters, particularly to Europe. Last year, American lobstermen sold only slightly more to Europe than their Canadian counterparts.
That balance could soon shift given the Canadian-European trade pact, which eliminated an 8 percent European tariff on live lobster when it went into effect in September. Tariffs on frozen and processed Canadian lobster will be phased out in the next three to five years as part of the agreement.
The elimination of European tariffs is “the single most challenging issue” for the American lobster industry, said Annie Tselikis, the executive director of the Maine Lobster Dealers’ Association, which represents companies that buy lobster from Maine fishermen. “This trade agreement does give Canada a huge leg up in the European marketplace,” she said.
Ms. Tselikis said the pact was encouraging American companies to invest in new facilities in Canada to qualify for the lower European tariff.
“If the argument is you’re not going to develop this trade policy because you’re worried about outsourcing jobs — well, here we are, potentially outsourcing jobs due to an absence of trade policy,” she said.”

Meanwhile, Alan Freeman reports in the Washington Post that the Trump Administration might be on the verge of  driving tens of thousands of American residents with useful job skills over our Northern Border:

“OTTAWA — In late October, starkly worded warning signs began appearing on the Canadian border with New York state and Vermont aimed at discouraging would-be asylum seekers fleeing the United States.

“Stop. It is illegal to cross the border here or any place other than a Port of Entry. You will be arrested and detained if you cross here.”

“Not everyone is eligible to make an asylum claim,” reads a second sign. “Claiming asylum is not a free ticket into Canada.”

As the Trump administration signals that it may soon remove the Temporary Protected Status designation from more than 300,000 Central Americans and Haitians, threatening them with deportation, Canadian officials are bracing for a new wave of asylum seekers flooding over the border.

Already this week, acting U.S. Homeland Security Secretary Elaine Duke announced she was lifting protected status for 2,500 Nicaraguans, effective January 2019. And while she extended the same protection for 57,000 Hondurans until July 2018, she warned that protection may end at that time.

The U.S. government decided to protect both groups from deportation following the devastation wrought by Hurricane Mitch in 1999, and the measures were repeatedly renewed until this year. Duke said the original conditions justifying that protection “no longer exist.” Canada and its immigrant-friendly policies may be seen as a viable alternative for those reluctant to return to their countries of origin.

Just last week, the government published a three-year plan aimed at accepting almost 1 million immigrants as permanent residents, with a clear bias toward economic migrants, who will make up 58 percent of the total. The balance will be shared between family and refugee classes.

 

Public reaction to the plan, which will see intake grow steadily from 300,000 in 2017 to 310,000 in 2018, 330,000 in 2019 and 340,000 in 2020, has been generally positive with many of the critics, including the government’s own council of economic advisers, saying Canada should be accepting even more immigrants.

Canada has an increasingly diverse population, with visible minorities making up 22.3 percent of the population in 2016, according to recently released census figures, compared with just 4.7 percent in 1981. By 2036, visible minorities are expected to make up 33 percent of the population.

“Canada is probably the best country in the world to be an immigrant because we give immigrants a chance to climb the ladder to success,” said Kareem El-Assal, senior research manager at the Conference Board of Canada, a think tank, where he specializes in immigration.

Assal said Canada’s immigration system works in part because the Canadian government helps newcomers integrate through language, skills and job training at a cost of almost a billion dollars a year. Furthermore, immigrants benefit from Canada’s universal health-care system and its good public education and reasonably priced universities.

Public opinion surveys continue to show that Canadians are pro-migration. A survey by the Environics Institute last spring showed that 72 percent of respondents agreed that “overall, migration has a positive impact on the economy.” Yet in the same survey, 54 percent said that “too many immigrants do not accept Canadian values.”

As for those border warning signs, Fortin, the union leader, says that asylum seekers are reading them and then crossing the border anyway.

“It doesn’t seem to have a very big dissuasive effect,” he said.”

Maine needs all the economic help it can get. And, I had lots of successful “TPSers” pass through my courtroom in Arlington. Good folks, industrious with useful job skills in the types of positions that we need but most Americans don’t want to do: child care, home health care, roofing, drywalling, cleaning, washing, making beds, waiting on tables, brewing coffee, making sandwiches, landscaping, pouring concrete, building things, meat processing, running convenience stores, etc. And, the vast majority had kids who were US citizens or in the DACA program. Our loss is likely to be Canada’s gain. The concept that there are lots of Native-born Americans out there (at a time of effectively full employment) waiting to take these jobs is a restrictionist fairy tale. But, if and when these folks leave, Americans who depend on them for essential services (like child care and Home improve,wants, for example, or restaurant and hotel owners) are going to find themselves out of luck.

So far, overall incompetence has saved us from the full adverse effects of Trump’s “Make America (Not So) Great” policies. But, if they ever do go into full effect, it will be bad for most Americans, including those gullible enough to have voted for Trump.

NPR: More Jurisdictions Get On Board For Providing Legal Assistance To Migrant Residents — Stand Up To Administration’s Bogus Anti-Immigrant Fear-Mongering Campaign!

“While the Trump administration continues the federal government’s already-massive deportation program, 11 cities and counties will be joining the list of jurisdictions providing legal defense for undocumented immigrants at risk of deportation.

The Vera Institute of Justice, a nonprofit that researches and advocates changes in the criminal justice system, launched the Safety and Fairness for Everyone (SAFE) Cities Network this past week. The cities and counties making up the network will be providing legal counsel for immigrants facing deportation proceedings.

Vera says it selected the jurisdictions for committing to invest public money toward defending immigrants against deportation. The nonprofit says it will use a fund it administers to match the public money.

“Immigration is part of our nation’s past, present, and future, and our communities will find more opportunities to grow and thrive when we recognize and embrace this fact,” Vera Institute President Nicholas Turner said in the statement. “That means that all residents must see their justice systems — from our law enforcement to our courts — as delivering on our country’s promise of fairness.”

The cities and counties making up the SAFE Cities Network are:

They’re joining a growing list of cities and states with similar programs. Late last year and earlier this year, lawmakers in Los Angeles, San Francisco, Washington, D.C., and New York City decided to allocate public funds for defense in immigration courts, while New York state created the first statewide immigrant defense fund.

In Maryland, Baltimore Mayor Catherine Pugh announced on Thursday that the city had joined the SAFE Cities Network.

“Our community is safest when our neighbors trust their officials and institutions and know they will be treated justly and with dignity,” Pugh said in a news release. “Providing legal representation to those facing deportation maintains trust in law enforcement and our local institutions and keeps us all safe. If our residents don’t feel safe — for example, coming forward to report crimes and cooperating with law enforcement — all of us are at more risk.”

These communities recognize that the Administration’s White Nationalist inspired “Gonzo Enforcement” and attempts to short circuit the statutory and constitutional rights of migrants to fair and dignified treatment ultimately threatens the safety and rights of all of us. And, as all evidence shows, as migrants get lawyers and are able to actually assert their rights (rather than being railroaded out of the country) more and more are found to have the legal right to remain.

This Administration stubbornly refuses to adjust its enforcement strategy to the reality that many so-called undocumented individuals should not be targeted for enforcement and that realistic reform that maintains the status quo by allowing the vast majority of productive, law-abiding individuals without status to remain is the only reasonable solution.

LA TIMES: MAJORITY OF CALIFORNIANS VALUE MIGRANTS (REGARDLESS OF STATUS) — OPPOSE TRUMP ADMINISTRATION’S “GONZO” IMMIGRATION ENFORCEMENT!

“Despite the Trump administration’s repeated attempts to frame illegal immigration as a threat to public safety, the poll also found an overwhelming majority believe that people without legal residency help revitalize cities as opposed to increasing crime.

The survey results, poll analysts and policy experts said, reflect ongoing trends in California, where through the decades the public has tended to support immigrants in the country illegally, even when federal or state political leaders have stoked anti-immigrant sentiment to rally their bases.

“We have seen this in California forever,” said Jill Darling, the survey director for the Center for Economic and Social Research at USC. “People, including Republicans, have been more supportive of immigrants and reform, even to the point of supporting a path to citizenship, more so than Republican leadership.”

Most poll participants also expressed positive perceptions of people without legal residency in the country.

Nearly 63% of people surveyed said they believed immigrants without legal status strengthened the economy, as opposed to roughly 38% who said they took away jobs. Sixty-six percent said immigrants in the country illegally helped revitalize cities, and about 34% — including more than 72% of Republicans — believed they increased crime.

Policy experts said the poll results reflect the explosive growth of Latinos, Asians and other minority communities that tend to lean Democratic. California’s families are so diverse, they said, that nearly everyone knows someone who came to the country as an immigrant — legally or illegally.

It also reflects a shift away from the “us-versus-them” rhetoric that damaged the Republican brand in the 1990s, political consultants and immigration policy experts said. During that time, Gov. Pete Wilson was criticized for using footage of people running across the border to dramatize the problem of illegal immigration, and voters passed propositions to bar immigrants in the country illegally from public benefits, outlaw affirmative action programs and teach only English in schools.

That “no longer reflects our reality,” said Mindy Romero, director of the California Civic Engagement Project. “In a state like California, immigrants are us.”

Andrew Medina, state policy manager for Asian Americans Advancing Justice, said he wasn’t surprised by the results of the poll — or by the approval among California residents for the sanctuary state law. A study released in February by the Public Policy Institute of California found that a solid majority of Californians believe the state and local governments should make their own policies and take action to protect the rights of immigrants who are here illegally.

The final language of the sanctuary state law was the result of months of tough negotiations among Gov. Jerry Brown, Senate leader and bill author Kevin de León (D-Los Angeles), and law enforcement officials.

It will largely prohibit state and local law enforcement agencies from holding or sharing information about people with federal immigration agents unless those individuals have been convicted of one or more offenses from a list of 800 crimes outlined in a 2013 state law.

Federal immigration authorities still will be able to work with state corrections officials — a key concession Brown had demanded — and will be able to enter county jails to question immigrants. But the state attorney general’s office will be required to publish guidelines and training recommendations to limit immigration agents’ access to personal information.

“It is positive that these polls show that there is support for immigrant communities, and it is especially positive in this era,” Medina said.

Still, Romero advised caution.

“Discrimination against immigrants is very real and a danger,” she said, pointing to anti-immigrant rhetoric at the national level. “I think we can’t rest on a changing landscape in California and just assume that things will continue to be more receptive and open.”

“LONG BEACH, Pacific County — Named after a character in a cowboy book, Police Chief Flint Wright describes himself as pretty conservative.

A portrait of Ronald Reagan hangs in his office, along with photos of John Wayne, and his father and grandfather on horses — capturing the rural lifestyle of Pacific County, which curves around Willapa Bay in the state’s southwest corner.

He doesn’t talk about it much, but he voted for Donald Trump, helping Pacific County go with the Republican presidential candidate for the first time in decades. Among other things, he liked Trump’s promise to secure the borders. Economic migrants are not a problem in his mind — he’s seen how hard they work — but he wondered, “who’s coming with them?” Terrorists, he feared.

Then came the July arrest of Mario Rodriguez by U.S. Immigration and Customs Enforcement (ICE).

“I was kind of in shock, to be blunt with you,” Wright said.

Rodriguez, whose visa had expired, had lived in the area for more than a dozen years. He had worked in bilingual education and periodically tipped police to trouble spots.

“He was real pro-law enforcement,” the police chief said. “Shoot, anybody would like to have him as a neighbor.”

Trump, on the campaign, had talked about kicking out Mexican “drug dealers, criminals, rapists.” And that’s the kind of immigration crackdown a lot of people here were expecting.

“Yeah, we don’t want that element,” Wright said. But Rodriguez? The police chief couldn’t believe sending him back to Mexico would do anybody any good.

That kind of shock is reverberating throughout the county as Trump’s toughened immigration policy hits home. ICE has arrested at least 28 people in the county this year, according to numbers provided to the Sheriff’s Office.

While that’s just a small share of the roughly 3,100 ICE arrests overseen by its regional office in Seattle — which covers Washington, Oregon and Alaska — it represents a pronounced upward trajectory. Last year, ICE reported eight Pacific County arrests to the sheriff and for a long stretch of years before that, zero.

In a county of small, close-knit communities — Long Beach, population 1,400, is one of the largest — it’s noticed when someone goes missing. The number is magnified by those who have moved, gone into hiding or followed family after a deportation. People have lost neighbors, schools have lost students and businesses have lost employees.

Shellfish farmers face many uncertainties, Sheldon explained.

The weather is a big one, periodically disrupting work on the water.

“One minute they’re here. Another minute they’re not,” Sheldon said. “It’s not like there’s any warning.”

She and other employers say they get required paperwork for every worker — though documents might be fake — and don’t know who is illegally here.

“It’s been a huge impact,” said Kathleen Nisbet-Moncy, vice president of the Willapa-Grays Harbor Oyster Growers Association, of ICE’s arrests. Many of the area’s two dozen companies are small businesses. Losing key employees is a big deal. One, she said, lost a worker of 25 years.

And the industry already faced a labor shortage.

Workers need to have an understanding of tides; they carry tide tables like Bibles, arranging their days accordingly. Some operate boats. Others shuck oysters or process fish, not easy when done quickly.

Paid by volume, they sometimes work seven day weeks, or days that take in both early-morning and late-night tides cycles.

“Don’t you want people to work?” Sheldon asked. “Why don’t we say you can’t sell cigarettes to illegal immigrants?”

She was joking. But things didn’t make sense to her.

It was hurting her business. So many people have been arrested or moved that she can no longer fill empty positions. She has had scale back orders and turn away customers.

“Tell him I say hi”

In Long Beach Culbertson Park, as after-school football practice got started, 10-year-old Danner Walters broke into tears.

He was on the sidelines talking about his friend Joel. A week before, Joel left for Mexico with his mom and siblings to rejoin his dad, who had been deported months before.

“We’ve been best friends since kindergarten,” Danner said.

Too bad folks don’t think through all of the implications before they pull the lever for immoral and irrational candidates like Trump and the GOP restrictionists. Truth is what the restrictionists don’t want you to hear or think about: the vast majority of the allegedly 11 million undocumented individuals here are law-abiding, productive members of the American community, doing jobs that help, rather than hurt, American workers, doing them exceptionally well, and raising or being part of part of “mixed families” with citizens, immigrants, and undocumented individuals all mixed together.

Removing them is a senseless and cruel waste of time and money. The only reasons for doing it have to do with racial and cultural bias — that’s why guys like Trump, Sessions, Bannon, and Miller have to come up with bogus economic and law enforcement rationales in an attempt to “rationalize” basically irrational policies.

Actually, the number of undocumented individuals in the United States is a boon to our country, our economy, and our culture. It shows that we remain a vibrant nation, and that we should have been admitting hundreds of thousands of additional legal immigrants annually. That’s why GOP proposals to restrict legal immigration are so wrong-headed.

Because we failed to do what we should have, the system basically “self corrected” largely by the operation of free market forces, but with some adverse effects like the use of smugglers, the exploitation of the undocumented, and the colossal amount of money wasted by “dumb” immigration enforcement and detention over many Administrations and Congresses.

But, it’s not too late to get it right by legalizing the productive, law-abiding individuals already here and expanding our legal immigration system to realistic levels that are more consistent with our needs as a nation. That will reduce or eliminate the “job magnet” and cut the business for smugglers without vast expenditures of law enforcement funds.

EUGENE ROBINSON IN WASHPOST: The Master Of Racial Identity Politics & His GOP Stooges!

“By now it should be clear that racism is a feature of the Trump administration, not a bug.

White House Chief of Staff John F. Kelly’s hideous rewriting of Civil War history is merely the latest evidence. Can anyone really believe “the lack of an ability to compromise” caused that bloody war? Is it possible to become a four-star Marine general without knowing that the Constitution itself was structured around a compromise on slavery? Or that the first half of the 19th century saw a series of equally immoral compromises that let slavery continue?

How can a man whose son died in service of his country believe that “men . . . of good faith” is an acceptable description of military officers who committed treason and took up arms against the United States, as did Robert E. Lee and the rest of the Confederate generals? Do people of good faith hold others in cruel bondage, buy and sell them like chattel and forcibly compel their unpaid labor?

Kelly buys into the racist, revisionist, dripping-with-Spanish-moss version of history that white Southerners concocted as they were imposing the system of Jim Crow repression. Anyone ignorant enough to believe the war was about anything other than slavery should read the declarations issued by the Confederate states upon secession. Here is a quote from Mississippi’s proclamation, which is vile but at least forthright:

“Our position is thoroughly identified with the institution of slavery — the greatest material interest of the world. Its labor supplies the product which constitutes by far the largest and most important portions of commerce of the earth. These products are peculiar to the climate verging on the tropical regions, and by an imperious law of nature, none but the black race can bear exposure to the tropical sun. These products have become necessities of the world, and a blow at slavery is a blow at commerce and civilization.”

Those who profited handsomely from slavery — including the growing financial markets of Wall Street and the bustling textile mills of New England — knew full well that it was wrong. They just didn’t want to give it up.

Kelly’s “good faith” historical claptrap would be bad enough in a vacuum. But it alarmingly echoes President Trump’s “many sides” analysis of the Charlottesville incident — and continues a tone that Trump set at the outset of his campaign, when he vilified Mexican immigrants as drug dealers and rapists.

When Trump miscalibrates and strays into explicit racism, as he did in the case of Charlottesville, there are expressions of shock and horror from fellow Republicans and even members of his Cabinet. But nobody renounces him, except senators who are about to retire. Nobody quits his administration on principle. Trump’s enablers meekly go back to the all-important business of cutting rich people’s taxes.

Making whites feel embattled and aggrieved is central to the Trump presidency. It is what makes him different from all other recent presidents, perhaps going back as far as Woodrow Wilson, who imposed Jim Crow segregation on the federal workforce. It is what makes Trump so corrosive to the national fabric.

There is one master practitioner of identity politics in the United States today. Shamefully, he lives in the White House.”

Before joining the Law School faculty as director of the Immigration Clinic in 1996, Professor Benítez was on the faculty of the legal clinics at Chicago Kent College of Law and Northwestern University School of Law. Prior to becoming a clinician, he was a staff attorney at the Chicago Lawyers’ Committee for Civil Rights Under Law and the Legal Assistance Foundation of Chicago, as well as an intern at the Centro de Estudios Legales y Sociales in Buenos Aires, Argentina. Professor Benítez teaches Immigration Law. In addition, in the summers he has taught at the law schools of the Instituto Tecnológico Autónomo de México and the Universidad Panamericana, in Mexico City. In the spring 2003 semester Professor Benítez was a visitor at the Boyd School of Law of the University of Nevada at Las Vegas, assisting in the development of that law school’s immigration clinic.

Professor Benítez has devoted his entire legal career to working in the public interest, generally with aliens, and so he is familiar with immigration law in its proper context. Evictions, domestic violence, public benefits, etc., these are areas of law that influence the decisions made by the aliens. Professor Benítez was fortunate early in his career to be associated with several supportive, dedicated lawyers who enabled him to learn and progress from them. Therefore, he tries to pass on what he learned and how he learned it to his students, in particular the “learn by doing” system that his early colleagues used with him. Good afternoon, and thanks so much to you and my good friend and Alexandria neighbor Professor Alberto Benitez for inviting me. I want to express my deep appreciation for all of the great help that your Clinic gave to vulnerable migrants and to the Judges of the U.S. Immigration Court in Arlington, VA in carrying out our due process mission over the years that I was on the bench, from 2003 to 2016. I’m also delighted that the amazing Paulina Vera, a “distinguished alum” of the Arlington Immigration Court Internship Program is your Assistant Instructor.

 

Professor Benitez tells me that all of you have read my recent article from Bender’s Immigration Bulletin entitled “Immigration Courts: Reclaiming the Vision.” I of course was referring to the noble vision of “being the world’s best administrative tribunals guaranteeing fairness and due process for all.”

 

As you also know, my article set forth a “five step” program for achieving this: 1) a return to Due Process as the one and only mission – ditching the current political manipulation of the courts; 2) an independent Article I Court structure, to replace the current outmoded “agency structure” in the DOJ: 3) professional court management along the lines of the Administrative Office for U.S. Courts and merit-based selection of judges; 4) an independent appellate body that functions in the manner of an Article III court, not as an “Agency Service Center;” and 5) an e-filing system to replace the current “files in the aisles.”

 

The question is how do we get there from here. Sadly, the individual who should be pushing these reforms, our Attorney General Jeff Sessions, has shown absolutely no interest in meaningful court reforms or protecting due process, beyond rather mindlessly proposing to throw many more new untrained judges into an already dysfunctional and disturbingly inconsistent judiciary and to force a system already careening out of control to “pedal even faster.” That’s a program for failure. Moreover, in my view, Sessions has demonstrated through his public statements and actions to date a clear pro-enforcement and anti-immigrant bias that makes him the wrong individual to be in change of a due process court system.

 

The other group who should be solving this problem is Congress. Immigration Court reform should be a bipartisan “no-brainer.” Both sides of the “immigration debate” should want a fair and efficient Immigration Court system that fully complies with due process, gets the results correct, and doesn’t accumulate huge backlogs. Unfortunately, however, Congress currently seems preoccupied with other issues that well might be less important to our country but more “politically expedient.” Although there is a fine draft “Article I Bill” floating around “The Hill,” prepared by the Federal Bar Association with input from the National Association of Immigration Judges, to date I am aware of no actual Congressional sponsor who has “thrown it in the hopper.”

 

So, do we abandon all hope? No, of course not!   Because there are hundreds of newer lawyers out there who are former Arlington JLCs, interns like Paulina, my former students, and those who have practiced before the Arlington Immigration Court, and folks like you who have had the great leadership of Professor Benitez and others like him in Immigration, Refugee, and Asylum clinics throughout the country!

        

They form what I call the New Due Process Army!And, while my time on the battlefield is winding down, they are just beginning the fight! They will keep at it for years, decades, or generations — whatever it takes to force the U.S. immigration judicial system to live up to its promise of guaranteeing fairness and due process for all!

        

What can you do to get involved now? The overriding due process need is for competent representation of individuals claiming asylum and/or facing removal from the United States. Currently, there are not nearly enough pro bono lawyers to insure that everyone in Immigration Court gets represented.

       

And the situation is getting worse. With the Administrations planned expansion of so-called expedited removal,lawyers are needed at earlier points in the process to insure that those with defenses or plausible claims for relief even get into the Immigration Court process, rather than being summarily removed with little, if any, recourse.

 

Additionally, given the pressure that the Administration is likely to exert through the Department of Justice to movecases quickly through the Immigration Court system with little regard for due process and fundamental fairness, resort to the Article III Courts to require fair proceedings and an unbiased application of the laws becomes even more essential. Litigation in the U.S. District and Appellate Courts has turned out to be effective in forcing systemic change. However, virtually no unrepresented individual is going to be capable of getting to the Court of Appeals, let alone prevailing on a claim.

 

So, what you are doing here at the GW Immigration Clinic directly supports the Immigration Court reform movement by insuring that the system will not be able to continue to run over the rights of the unrepresented or underrepresented and that individuals who are unfairly denied relief at the Immigration Court and BIA levels are positioned to seek review in the independent Article III Courts.

 

I also have been working with groups looking for ways to expand the accredited representativeprogram, which allows properly trained and certified individuals who are not lawyers to handle cases before the DHS and the Immigration Courts while working for certain nonprofit community organizations, on either a staff or volunteer basis. Notwithstanding some recently publicized problems with policing the system, which I wrote about on my blog immigrationrcourtside.com, this is a critically important program for expanding representation in Immigration Courts. Additionally, the accredited representativeprogram is also an outstanding opportunity for retired individuals, like professors, who are not lawyers to qualify to provide pro bono representation in Immigration Court to needy migrants thorough properly recognized religious and community organizations.

        

Even if you are not practicing or do not intend to practice immigration law, there are many outstanding opportunities to contribute by taking pro bono cases. Indeed, in my experience in Arlington, big lawfirms were some of the major contributors to highly effective pro bono representation. It was also great hands onexperience for those seeking to hone their litigation skills.

 

Those of you with language and teaching skills can help out in English Language Learning programs for migrants.   I have observed first hand that the better that individuals understand the language and culture of the US, the more successful they are in navigating our Immigration Court system and both assisting, and when necessary, challenging their representatives to perform at the highest levels. In other words, they are in a better position to be informed consumersof legal services.

        

Another critical area for focus is funding of nonprofit community-based organizations and religious groups that assist migrants for little or no charge. Never has the need for such services been greater.

 

But, many of these organizations receive at least some government funding for outreach efforts. We have already seen how the President has directed the DHS to “defund” outreach efforts and use the money instead for a program to assist victims of crimes committed by undocumented individuals.

 

Undoubtedly, with the huge emphases on military expansion and immigration enforcement, to the exclusion of other important programs, virtually all forms of funding for outreach efforts to migrants are likely to disappear in the very near future. Those who care about helping others will have to make up the deficit. So, at giving time, remember your community nonprofit organizations that are assisting foreign nationals.

 

The Federal Bar Association (“FBA) has been a strong moving force for court reform resulting in an Article I U.S. Immigration Court. So, becoming a “student member” of the FBA and getting involved with our local chapter is another way to support reform.

 

Finally, as an informed voter and participant in our political process, you can advance the cause of Immigration Court reform and due process. For the last 16 years politicians of both parties have largely stood by and watched the unfolding due process disaster in the U.S. Immigration Courts without doing anything about it, and in some cases actually making it worse.

 

The notion that Immigration Court reform must be part of so-called comprehensive immigration reformis simply wrong. The Immigration Courts can and must be fixed sooner rather than later, regardless of what happens with overall immigration reform. Its time to let your Senators and Representatives know that we need due process reforms in the Immigration Courts as one of our highest national priorities.

 

Folks the U.S Immigration Court system is on the verge of collapse. And, there is every reason to believe that the misguided enforce and detain to the maxpolicies being pursued by this Administration will drive the Immigration Courts over the edge. When that happens, a large chunk of the entire American justice system and the due process guarantees that make American great and different from most of the rest of the world will go down with it.

In conclusion, I have shared with you the Courts noble due process vision and my view that it is not currently being fulfilled. I have also shared with you my ideas for effective court reform that would achieve the due process vision and how you can become involved in improving the process.

“The Department of Justice said Friday it is aiming to slash the massive immigration court backlog in half by 2020 by adding judges, upgrading technology and refusing to tolerate repeated delays in deportation cases.

Officials, who briefed reporters on condition that they not be identified by name, said the effort is part of the Trump administration’s broad plan to more efficiently handle cases of undocumented immigrants, who number 11 million nationwide.

The administration has reversed Obama-era policies that allowed prosecutors to indefinitely postpone low-priority cases, which the Justice Department officials said allowed some immigrants to delay “inevitable” deportations. In other cases, they said, immigrants who deserved to win their cases were delayed for years because of the backlog.

The immigration court backlog has tripled since 2009, the year former president Obama took office, to more than 630,000 cases in October.

“That is what this administration is committed to, getting this done right, ensuring that we’re never in this place again,” a Justice Department official said. “Really and truly, when you look at the numbers . . . it reflects the fact that the last administration likely wasn’t as committed to ensuring that the system worked the way that Congress intended it to.”

The agency, which oversees the administrative immigration courts, said it plans to hire new immigration judges, use technology such as videoconferencing, and increase judges’ productivity by setting case-completion guidelines, though officials would not give details.

The department also will have a “no dark courtrooms” policy, the officials said, explaining that there are at least 100 courtrooms nationwide that are empty every Friday because of judges’ alternate work schedules. The Justice Department is tapping retired judges to fill those courts.

The immigration court overhaul comes as the Trump administration is carrying out policies that could generate even more cases in coming months. Arrests and deportations from the interior of the United States are rising sharply, and the Trump administration has ended Obama-era protections for some undocumented immigrants, including 690,000 undocumented immigrants who arrived in the United States as children.

By Monday, the Trump administration is also expected to say if it will renew temporary protected status for thousands of longtime immigrants from Honduras and Nicaragua whose permits expire next year.

The Justice Department officials said they are no longer widely using certain protections for undocumented immigrants, including a tool known as prosecutorial discretion that allowed the government to set aside low-priority deportation cases.

DOJ officials criticized immigration lawyers, saying they “have purposely used tactics designed to delay” immigration cases. As of 2012, the officials said, there were an average of four continuances for each case before the court.

Gregory Chen, director of government relations for the American Immigration Lawyers Association, said the administration’s plan to cut the backlog would “undermine judicial independence” in the immigration courts.

“This administration has been extremely hostile toward the judiciary and the independence of immigration judges, as well as other judges,” Chen said.

Speeding up cases depends partly on congressional funding. It also rests partly on the actions of immigration judges, who have expressed concerns about due process for immigrants, many of whom are facing deportation to some of the world’s most violent countries. Immigrants are not entitled to a government-appointed lawyer in these courts and often handle cases on their own.

The Justice officials would not comment on reports that they will impose case-completion quotas on judges, which raised an outcry from the judges’ union. But the officials said they would give judges clear standards to complete cases and add more supervisors.

Officials say they are already seeing results from efforts this year to improve efficiency. From February to September, judges ordered 78,767 people to leave the country, a 33 percent jump over the same period in 2016. The total number of final decisions, which includes some immigrants who won their cases, is 100,921.”

THE GOOD:

  • Using retired U.S. Immigration Judges to fill in while Immigration Judges are on leave or otherwise scheduled to be out of court is a good idea. Indeed, the National Association of Immigration Judges (“NAIJ”) has been pushing this idea since the Clinton Administration with no results until now. Additionally, finally taking advantage of the available “Phased Retirement Options” for the the many Immigration Judges nearing retirement could also be helpful.
  • Over time, hiring additional Immigration Judges could be helpful, at least in theory. But, that depends on whether the hiring is done on a merit basis, the new judges are properly trained, and they have the space, equipment, and support staff to function. The DOJ/EOIR’s past record on accomplishing such initiatives has been beyond abysmal. So, it’s just as likely that additional hiring will harm the Immigraton Courts’ functioning as it is that it will help.

THE BAD:

  • “Productivity standards” are totally inappropriate for an independent judiciary. They are almost certain to infringe on due process by turning judges into “assembly line workers.”  Moreover, if hiring is done properly, judges should be self-motivated professionals who don’t need “Micky Mouse performance evaluations” to function. While it might be helpful to have some “periodic peer review” involving input from those appearing before the courts and judges of courts reviewing the judges’ work, such as takes place in some other independent judicial systems, that clearly isn’t they type of system this Administration has in mind.
  • More use of Televideo is problematic. In person hearings are definitely better for delivering due process. The EOIR Televideo equipment tends to be marginal from a technology standpoint. “Pushing the envelope” on Televideo could well force the Article IIIs to finally face up and hold at least some applications of this process unconstitutional.
  • More “Supervisory Judges” are totally unnecessary and a waste of resources. In the “EOIR World,” Supervisory Judges often don’t hear cases. Moreover, as noted previously, professional judges need little, if any, real “supervision.” The system might benefit from having local Chief Judges (“first among equals”), like in other independent judicial systems, who can address administrative issues with the Court Administrator and the public, But, judges don’t need supervision unless the wrong individuals are being selected as judges. And, as in the U.S. District Courts, local Chief Judges should carry meaningful case loads.
  • Every other court system in the U.S., particularly the U.S. District Courts, rely on heavy doses of “Prosecutorial Discretion” (“PD”) by government prosecutors to operate. By eliminating PD from the DHS Chief Counsels, then touting their misguided actions, this Administration has  guaranteed the ultimate failure of any backlog reduction plan. Moreover, this stupid action reduces the status of the DHS Assistant Chief Counsels. There is no other system I’m aware of where the enforcement officials (“the cops”) rather than professional prosecutors make the decisions as to which cases to prosecute. PD and sensible use of always limited docket time is part of the solution, not the problem, in the Immigration Courts.

THE UGLY:

  • The DOJ and EOIR continue to perpetuate the myth that private attorneys are responsible for the backlogs. No, the backlogs are primarily the result of Congressional negligence multiplied by improper politically motived docket manipulation and reschuffling to meet DHS enforcement priorities by the last three Administrations, including this one! This Administration was responsible for unnecessarily “Dark Courtrooms” earlier this year in New York and other heavily backlogged Immigration Courts.
  • Although not highlighted in this article, EOIR Acting Director James McHenry recently admitted during Congressional testimony that EOIR has been working on e-filing for 16 years without achieving any results! Thats incredible! McHenry promised a “Pilot Program” in 2018 with no telling when the system will actually be operational. And DOJ/EOIR has a well-established record of problematic and highly disruptive “technology rollouts.”

THE INCREDIBLE:

  • As usual, the DOJ/EOIR “numbers” don’t add up. EOIR “touts” compleating approximately 100,000 cases in the 7-month period ending on August 31, 2017. That’s on a pace to complete fewer than 200,000 cases for a fiscal year. But, EOIR receives an average of at least 300,000 new cases each year (even without some of the “Gonzo” Enforcement by the Trump DHS).  So, EOIR would have to “pick up the pace” considerably just to keep the backlogs from growing (something EOIR hasn’t done since before 2012). Not surprisingly, TRAC and others show continually increasing backlogs despite having more judges on board. To cut the backlog from 640,000 to 320,000 (50%) by 2020, the courts would have to produce an additional 160,000 annual completions in 2018 and 2019! That, in turn, would require completing a total of at least 460,000 cases in each of those years. That’s an increase of 230% over the rate touted by DOJ/EOIR in the Post article. Not going to happen, particularly since we’re already more than one month into FY 2018 and Congress has yet to authorize or appropriate the additional resources the DOJ wants!

WHAT’S CLEAR:

  • The DOJ hocus pocus, fake numbers, unrealistic plans, political scheming, cover-ups, blame shifting, and gross mismanagement of the U.S. Immigration Courts must end!
  • Unless and until Congress creates an independent, professionally managed Article I Immigration Court, any additional resources thrown into the current Circus being presided over by Jeff Sessions’s DOJ would be wasted.

Kids and other vulnerable individuals seem like a logical targets for bullies like Trump, Sessions, and the rest of the GOP White Nationalist Gang.

Good things aren’t going to happen to a country that picks on children and enables cowardly leaders.

But, after all, these Dudes are still defending the Confedracy, rebellion against the USA, and the fight to preserve slavery! I guess once on the wrong side of history, always on the wrong side of history. The real question is where to the rest of us stand, and what are we can do about the steady erosion of law, morality, and humane values by the Trump Administration and its supporters.

Most “real” courts reserve to themselves some authority to return, remand, or otherwise force action on the part of parties. For example, when the Obama Administration announced an expanded “Prosecutorial Discretion”  (“PD”) program, at least one Court of Appeals required that the Government review each case on their Petition for Review docket and state in advance whether or not it intended to exercise “PD.” Those PD cases were then “un-docketed” by the Article III Court.

Given the huge backlogs for new non-detained asylum cases in most U.S. Immigration Courts, allowing Immigration Judges on a case-by-case basis to require the DHS to decide whether or not they would grant asylum before proceeding to place a case on an overcrowded “Individual Hearing” docket makes lots of sense to me. Perhaps one reason that the Immigration Court docket is in such bad shape is that DOJ and EOIR routinely allow themselves to be “pushed around” by DHS in ways that few other courts would tolerate from a Government party.

If any independent party ever did a detailed analysis of the “Immigration Court Backlog,” I’m betting that they would find a significant number of cases being “warehoused” by EOIR for the DHS. These are cases that could and should have been resolved favorably to the Respondent by the DHS without a trip to Immigration court. But, a rational approach to the backlog is not going to happen with the current Administration’s “Gonzo” enforcement policies and a “captive” Immigration Court system .
