“FBI Director Christopher A. Wray has been resisting pressure from Attorney General Jeff Sessions to replace the bureau’s deputy director, Andrew McCabe, a frequent target of criticism from President Trump, according to people familiar with the matter.

The tension over McCabe and other high-level FBI officials who served during James B. Comey’s tenure has reached the White House, where counsel Donald McGahn has sought to mediate the issue, these people said.

As Sessions tried to push Wray to make personnel changes, Wray conveyed his frustration to the attorney general, these people said. Sessions then discussed the matter with McGahn, who advised him to ease off, which he did, these people said.

One person familiar with the discussions said Wray has not addressed FBI personnel matters with the president, but in December, after The Washington Post reported that McCabe planned to retire in Marchwhen he becomes eligible for his full pension benefits, Trump tweeted about his criticisms of McCabe, a target of his since the 2016 presidential campaign.

Much of the discussion between Wray and Sessions about housecleaning at the FBI also came in December, according to people familiar with the matter.

Axios was first to report the Session-Wray dispute on Monday evening, indicating that Wray had threatened to resign if Sessions did not stop pressuring him to fire McCabe. But several people familiar with the dynamic told The Post that they were not aware of Wray making such an explicit threat. Firing McCabe could be problematic because he has limited civil service protections as a government employee. Such a move, in the aftermath of public criticism from the president and others, could prompt litigation.

Sessions, Republican lawmakers and some members of the Trump administration have argued for weeks that Wray should conduct some kind of housecleaning by demoting or reassigning senior aides to his predecessor, Comey, according to people familiar with the matter. These people added that Sessions himself is under tremendous political pressure from conservative lawmakers and White House officials who have complained that the bureaucracy of federal law enforcement is biased against the president.”\

A heightened sense of unease gripped the White House on Thursday, as President Trump lashed out at reports that he’s under scrutiny over whether he obstructed justice, aides repeatedly deflected questions about the probe and Vice President Pence acknowledged hiring a private lawyer to handle fallout from investigations into Russian election meddling.

Pence’s decision to hire Richard Cullen, a Richmond-based lawyer who previously served as a U.S. attorney in the Eastern District of Virginia, came less than a month after Trump hired his own private lawyer.

The hiring of Cullen, whom an aide said Pence was paying for himself, was made public a day after The Washington Post reported that special counsel Robert S. Mueller III is widening his investigation to examine whether the president attempted to obstruct justice.

A defiant Trump at multiple points Thursday expressed his frustration with reports about that development, tweeting that he is the subject of “the single greatest WITCH HUNT in American political history,” and one that he said is being led by “some very bad and conflicted people.”

Trump, who only a day earlier had called for a more civil tone in Washington after a shooting at a Republican congressional baseball practice in Alexandria, Va., fired off several more tweets in the afternoon voicing disbelief that he was under scrutiny while his “crooked” Democratic opponent in last year’s election, Hillary Clinton, escaped prosecution in relation to her use of a private email server while secretary of state.”

Shortly after Trump took office, I predicted that while he was unlikely to be able to keep most of his promises about “job creation,” he was likely to be a boon for at least one segment of our economy: the legal industry.

By the time this ends, however it ends, Trump will be ruing the day that he got rid of Jim Comey (who, apparently, wasn’t investigating him). While Trump and his White House and Cabinet cronies have had little but open contempt for government service and public servants, he’s finding out the hard way that lots of public servants take their jobs and their oath to uphold the Constitution seriously, and that they are very good at what they do. This isn’t “reality TV,” SNL, or some real estate deal where he can schmooze and BS his way through. And, he’s not going to be able to “settle up” by throwing a few million on the table and expecting everyone to go away happy. Nope. This is the “reality” of being President of the US. And, Trump is quickly cementing his place in history as the most unqualified individual ever elected to the job.

WashPost: Another View — Former AG Bill Barr Says Comey Firing Is All Good!

Barr writes in an op-ed:

William Barr was U.S. attorney general from 1991 to 1993.

“Having served as both attorney general and deputy attorney general in the Justice Department, I had responsibility for supervising the FBI, working on virtually a daily basis with its senior leadership. From that experience I came to understand how fortunate we are as a nation to have in the FBI the finest law-enforcement organization in the world — one that is thoroughly professional and free of partisanship. I offer this perspective on President Trump’s removal of FBI Director James B. Comey.

Comey is an extraordinarily gifted man who has contributed much during his many years of public service. Unfortunately, beginning in July, when he announced the outcome of the FBI investigation into Hillary Clinton’s use of a private email server while secretary of state, he crossed a line that is fundamental to the allocation of authority in the Justice Department.

While the FBI carries out investigative work, the responsibility for supervising, directing and ultimately determining the resolution of investigations is solely the province of the Justice Department’s prosecutors. With an investigation as sensitive as the one involving Clinton, the ultimate decision-making is reserved to the attorney general or, when the attorney general is recused, the deputy attorney general. By unilaterally announcing his conclusions regarding how the matter should be resolved, Comey arrogated the attorney general’s authority to himself

It is true, as I pointed out in a Post op-ed in October, that Attorney General Loretta E. Lynch, after her tarmac meeting with Bill Clinton, had left a vacuum by neither formally recusing herself nor exercising supervision over the case. But the remedy for that was for Comey to present his factual findings to the deputy attorney general, not to exercise the prosecutorial power himself on a matter of such grave importance.

Until Comey’s testimony last week, I had assumed that Lynch had authorized Comey to act unilaterally. It is now clear that the department’s leadership was sandbagged. I know of no former senior Justice Department official — Democrat or Republican — who does not view Comey’s conduct in July to have been a grave usurpation of authority.

It is telling that none of the president’s critics are challenging the decision on the merits. None argue that Comey’s performance warranted keeping him on as director. Instead, they are attacking the president’s motives, claiming the president acted to neuter the investigation into Russia’s role in the election.

The notion that the integrity of this investigation depends on Comey’s presence just does not hold water. Contrary to the critics’ talking points, Comey was not “in charge” of the investigation.

. . . .

According to news reports, the investigation is in full swing, with the Justice Department using a grand jury to subpoena relevant information, indicating a degree of thoroughness not evident in the investigation into Clinton’s email server. Comey’s removal simply has no relevance to the integrity of the Russian investigation as it moves ahead.”

So, according to Barr, that the Administration lied about the real reasons for firing Comey, the Russia investigation, should be of no concern to us. We should be reassured because the investigation is proceeding under the direction of DOJ underlings, who owe their continued employment to Jeff Sessions and report to DAG Rod “The Dupe” Rosenstein, who helped the White House provide a “non-Russian” rationale for the firing, which Trump later repudiated. And, we should believe that the Director of the FBI was not “in charge” of the Bureau’s most significant and high-profile investigation. So then, it doesn’t make any difference who Trump picks for the next Director because he (or she) will just be a figurehead, having no responsibility for the work of subordinates.

Wow! Why have an FBI Director at all, if you believe Barr. Maybe you buy Barr’s reasoning, but I don’t. In fact, I find his entire argument highly disingenuous.

NYT OP-ED: DAVID LEONHARDT: Web Of Lies!

Leonhardt writes:

“The ninth week of Donald Trump’s presidency began with the F.B.I. director calling him a liar.

The director, the very complicated James Comey, didn’t use the L-word in his congressional testimony Monday. Comey serves at the pleasure of the president, after all. But his meaning was clear as could be. Trump has repeatedly accused Barack Obama of wiretapping his phones, and Comey explained there is “no information that supports” the claim.

I’ve previously argued that not every untruth deserves to be branded with the L-word, because it implies intent and somebody can state an untruth without doing so knowingly. George W. Bush didn’t lie when he said Iraq had weapons of mass destruction, and Obama didn’t lie when he said people who liked their current health insurance could keep it. They made careless statements that proved false (and they deserved much of the criticism they got).

But the current president of the United States lies. He lies in ways that no American politician ever has before. He has lied about — among many other things — Obama’s birthplace, John F. Kennedy’s assassination, Sept. 11, the Iraq War, ISIS, NATO, military veterans, Mexican immigrants, Muslim immigrants, anti-Semitic attacks, the unemployment rate, the murder rate, the Electoral College, voter fraud and his groping of women.

He tells so many untruths that it’s time to leave behind the textual parsing over which are unwitting and which are deliberate — as well as the condescending notion that most of Trump’s supporters enjoy his lies.

Trump sets out to deceive people. As he has put it, “I play to people’s fantasies.”

Caveat emptor: When Donald Trump says something happened, it should not change anyone’s estimation of whether the event actually happened. Maybe it did, maybe it didn’t. His claim doesn’t change the odds.

Which brings us to Russia.”

Refugees Already Are Given “Extreme Vetting!”

Former U.S. Immigration Officer and refugee processor Natasha Hall writes in the Washington Post:

“This is what President Trump’s recent executive order has done. The order bans entry for citizens of seven countries for 90 days, suspends all refugee admissions for 120 days, halves the total number of refugees allowed into the United States this year and bars refugees from Syria indefinitely. It demands “a uniform screening standard and procedure,” “questions aimed at identifying fraudulent answers and malicious intent,” “a mechanism to ensure that the applicant is who the applicant claims to be” and “a mechanism to assess whether or not the applicant has the intent to commit criminal or terrorist acts.”

Whoever wrote this order is evidently not aware that these screenings, procedures and questions already exist.

During nearly four years as an immigration officer, I conducted in-person interviews with hundreds of refugees of 20 different nationalities in 10 countries. I saw countless refugees break down crying in my interview room because of the length and severity of the vetting process. From that experience and numerous security briefings, it’s clear that the authors of Trump’s order are unfamiliar with the U.S. immigration system, U.S. laws, international law and the security threats facing our nation. I can’t speak for all refugee and asylum officers, but I can say that those who have been working in immigration for years from opposite ends of the political spectrum are appalled by these new policies.”

The current ruckus over “vetting” has led to many folks failing to appreciate the outstanding job that the much-maligned DHS, the State Department, The FBI, our NGO partners, U.S. Intelligence Agencies, and the Obama Administration, working together, did in keeping our country safe from foreign terrorist attacks.
