Alexandria, VA.  Along with many others, I am saddened to learn of the death, over the weekend, of my former “boss” and judicial colleague, Judge David Crosland of the Baltimore Immigration Court. He was 85.

First and foremost, David was a dedicated public servant. A graduate of Auburn University and the University of Alabama School of Law, David served in the Civil Rights Division of the US Department of Justice during the tense and dangerous days of the 1960s. That was a time when speaking out for justice for African Americans in the South could be a life-threatening proposition.

Among many difficult and meaningful assignments, he helped prosecute Klansmen in Mississippi and also was assigned to prosecutions arising out of racially motivated police and National Guard killings in Detroit in 1967-68. After leaving the DOJ, he became the Director of the Atlanta Lawyers’ Committee for Civil Rights Under Law.

At Auburn, David had studied Agriculture. He sometimes liked to regale Immigration Court interns with tales of his “days on the farm” during summers in college! 

I first met Dave in 1977, when Judge Griffin Bell appointed him to be the General Counsel of the “Legacy INS.” Shortly thereafter, David selected me to be his Deputy General Counsel, thus initiating my career as a Government manager and executive. During the second half of the Carter Administration, Dave was the Acting Commissioner of Immigration, and I was the Acting General Counsel. 

In those days, my hair was actually longer than Dave’s, a situation that would become reversed in later years as our respective careers progressed. Indeed, during his “ponytail and gold earring days” in private practice, I reminded him of the times in “GENCO” where he used to encourage me to “get a haircut.”

We went through lots of exciting times together including the Iranian Hostage Crisis, litigation involving Haitian asylum seekers, Nazi War Criminal prosecutions, the Mariel Boatlift, the creation of the Asylum Offices, and the beginnings of a major restructuring of the INS nationwide legal program that eventually brought all lawyers under the direct supervisory control of the General Counsel.

Following the 1980 election, Dave went into private practice and became a partner in Ober, Kaler, Grimes & Shriver and then Crosland, Strand, Freeman & Mayock. He rejoined Government in 1997, when Attorney General Janet Reno appointed him as an Immigration Judge in Otey Mesa, CA. He later became an Assistant Chief Immigration Judge for several courts, as well as a Temporary Member of the BIA. 

Our paths crossed again when we both served on the bench at the Arlington Immigration Court, roughly between 2009 and 2014. Then, David returned to Baltimore to be closer to his son and his residence in Maryland. He also served at various times as an Adjunct Professor of Law at GW Law and UDC Law.

David was a “character,” for sure. He had his own way of doing things that wasn’t always “strictly by the book.” But, he cared about the job and the people, was kind to the staff, and kept at it years after most of his contemporaries, including me, had retired.

One of the most moving tributes to David is from a member of court administrative staff who worked with him for years: 

We just learned that Judge Crosland passed away this weekend at the grand age of 85 years. No funeral requested by him as his last wishes. Please keep him and his family in prayer. He was an amazing man, had a brilliant career and he was a genuinely kind person, hardworking to the end. Judge Crosland was very good to me, and he would walk me to my car after the long work days that turned into nights. Always a true gentleman, he would make me his famous lemon ice box pie! God bless Judge Crosland.

My time with Dave at the “Legacy INS” will always be with me as one of the most exciting, sometimes frustrating, but highly rewarding and formative parts of my career. Rest In Peace ☮️  my friend and colleague. You will be missed.

BELOW THE RADAR SCREEN: Career Prosecutor Jonathan Fahey Quietly Installed As Head Of Office Of Principal Legal Advisor (“OPLA”) @ ICE

According to the ICE website, Jonathan Fahey is now the Principal Legal Advisor (“PLA”) at ICE. The “PLA” selects and supervises hundreds of ICE Chief and Assistant Chief Counsel who represent DHS in Immigration Courts nationwide as well as advises the Director of ICE and the Secretary of DHS on ICE legal matters.

Curiously, the prior PLA, Tony H. Pham is listed on the ICE website as “Senior Official Performing the Duties of The Director.” That’s bureaucratic gobbledygook for “Acting Director.” However, Fahey is not listed as “acting” in the PLA position. That leaves the question of exactly what Pham’s “official” position is these days.

Of course, it’s all part of a Trump regime “policy” of using “actings” and various related gimmicks to evade the Senate confirmation process and accompanying public scrutiny of senior political leadership at DHS. It also makes it easier for the White House to “lean on” and threaten, remove, or transfer senior officials because they lack the legitimacy and “political constituency” that comes from Senate confirmation. The ICE Director (formerly known as “Assistant Secretary”) requires Senate confirmation, the PLA does not. Incredibly, notwithstanding its “high visibility,” ICE has not had a duly appointed and confirmed Director during this Administration.

This ICE website doesn’t list Fahey’s bio. But, he’s no stranger to lawyers practicing in Northern Virginia. Here’s what Politico had to say when he joined ICE in April 2020:

DHS ARRIVAL LOUNGE — Jonathan Fahey is now a senior adviser at DHS. He previously was in the U.S. attorney’s office in the Eastern District of Virginia for 17 years, with a brief stint in 2018 as general counsel of the White House Office of National Drug Control Policy.

Historical footnote: The DHS Chief Counsel program is the “direct descendent” of the “Legacy INS” Chief Legal Officer and later District Counsel programs that I helped establish as INS Deputy General Counsel (and occasionally Acting General Counsel) under the leadership of then INS General Counsel (now Immigration Judge) Dave Crosland and his successor the late Maurice C. “Iron Mike” Inman, Jr. Prior to that, INS Trial Attorneys were selected by the General Counsel, but were supervised and evaluated by the District Directors, actually their “clients.”

This ushered in the era of “independent legal advice” at INS, patterned on the “U.S. Attorney model.” Among other changes, it resulted in the appointment of many additional “Special Assistant U.S. Attorneys” (“SAUSAs”) from INS to assist with both civil and criminal litigation in the U.S. District Courts. It also resulted in the assignment of “Sector Counsel” to advise Border Patrol Chiefs. Additionally, a “failed power move” by the “Nelson/Inman/Schmidt Cabal” to take over the U.S. Circuit and District Court litigation from the DOJ Criminal Division, prompted the creation of the Office of Immigration Litigation (“OIL”) in the DOJ Civil Division, as well as the creation of EOIR as a separate entity to house the Immigration Courts and the BIA in 1983.

But, institutional change never comes easily, particularly at a place like the “Legacy INS.” I remember the first “Annual Commissioner’s Conference” during the tenure of the late Commissioner Al Nelson, held during the early months of the Reagan Administration. Perhaps the location was at the Federal Law Enforcement Training Center (“FLETC”) in Glynco, Georgia. In any event, it was in a “classroom-type setting.”

I found myself “in the pit” of an “amphitheater-type” classroom, the seats filled with super-irate INS District Directors and Regional Commissioners screaming that I had “stolen their attorneys.” Of course it’s always a bad idea to scream at the “loudest voice in the room” — me! So, I was shouting back at a decibel level that must of carried halfway to Atlanta!

Meanwhile, my “new boss,” “Iron Mike” was sitting in the first row alternately guffawing and shaking his head as I “aggressively defended” our policies and tried to explain how it would be a “win-win” for everyone. (It was! Eventually, almost everyone in the room was “lobbying” me for more lawyers, SAUSAs, and “personal assistance” in handling their never-ending legal problems).

Afterwards, Mike came up to me and said “Jesus, Schmidt, you managed to piss off and out-yell every manager in the country. Great job!”

Of course, “Iron Mike” was no slouch when it came to the “strategic yell” — once in a “Bobby Knight moment” sending one of our budget analysts into a fainting spell. “GENCO” in the “Time Iron Mike” wasn’t a place for the faint of heart!

And, of course his “favorite tactic” was to yell at me: “What did they teach you at that lefty law school in Madison?” No “Legal Executive Council” meeting was complete without us getting into least one “knock down drag ‘em out” in front of the “troops.” But, the relationship worked. We actually complemented each other and got a lot accomplished.

So, for better or worse (mostly seems like the latter, these days), I was one of the “Founding 
Fathers” of the modern DHS Chief Counsel/Assistant Chief Counsel system.

Leonhardt writes:

Edward Levi and Griffin Bell were very different men. One was the son and grandson of rabbis, a legal scholar whose life revolved around the University of Chicago. The other was a country lawyer who became a master operator in the Atlanta legal world. One was appointed to high office by a Republican president, the other by a Democrat.

Yet for all their differences, Levi and Bell came to share a mission. Together, they created the modern Department of Justice and, more important, the modern American idea of the rule of law.

They were the first two attorneys general appointed after Watergate — Levi by Gerald Ford and Bell by his fellow Georgian Jimmy Carter. And they both set out to refashion the Justice Department into the least political, most independent part of the executive branch. “Our law is not an instrument of partisan purpose,” Levi said. It cannot become “anyone’s weapon.” Bell described the department as “a neutral zone in the government, because the law has to be neutral.”

They understood Richard Nixon’s deepest sins: He saw the law as an instrument not of justice but power. Yet Levi and Bell also knew that Nixon hadn’t been the only problem. Other administrations had also misused the law — investigating enemies and rivals, like civil-rights leaders. So Levi and Bell made sure that the crisis of Watergate didn’t go to waste.

They changed the rules for F.B.I. investigations. They put in place strict protocols for communication between the White House and Justice Department. They made clear — with support from Ford and Carter — that the president must have a unique relationship with the Justice Department.

“It’s perfectly natural and fine for the president and others at the White House to have interactions with the Justice Department on broad policy issues,” Sally Yates, the former deputy attorney general, told me last week. “What’s not O.K. is for the White House, and especially the president, to have any involvement with criminal prosecutions. That really turns the rule of law on its head.”

No administration has been perfect in the pursuit of neutral justice, but every one from Ford’s through Barack Obama’s stayed true to the post-Watergate overhaul. They allowed uncomfortable investigations to proceed unimpeded. They did not treat the law as a weapon.

Then came President Trump.

The story of Levi and Bell highlights how fragile the rule of law is. Much of it does not depend on the Constitution or legislation. It depends on political culture and habits. And that culture and those habits can change. In the sweep of history, the reforms of Levi and Bell are still quite young.

The most obvious ways that Trump is undermining the law involve the Russia investigation. Like Nixon, Trump is enraged that anyone in his administration would investigate anyone else in it. But Russia is only one part of the problem: Trump really does view the law as a weapon, to protect his allies and strike his enemies.

The incomplete list includes: He suggested an end to the prosecution of someone he likes (Joe Arpaio) and the start of prosecutions of people he hates (Hillary Clinton, James Comey). Trump defended his personal lawyer by claiming that the government regularly fabricates evidence. Trump has dragged federal prosecutors into politics, bringing one of them — John Huber, Utah’s top federal prosecutor — to the White House to give a speech lobbying for new immigration laws.

Other presidents did none of this. It undermines the idea of equal justice. It tells Americans that our legal system is merely another instrument of partisan battle, that our prosecutors and law-enforcement officers are political hacks in disguise.

The Trump attacks on the justice system demand a stronger response. The media can’t become numb. His aides and appointees need to stand up to him more often — rather than, for example, assenting to a baseless new inquiry into Clinton, overseen by none other than Huber.

And other Republicans, in Congress and private life, should summon more courage. “We don’t see senior Republican officials, either current or past, defending the Department of Justice and the F.B.I.,” John Bellinger III, a veteran of the George W. Bush administration, said last week at a Georgetown University conference on democratic norms. “It’s just inexplicable.”

Where are the Republican defenders of law and order? Where are you, John Ashcroft? What about C. Boyden Gray, Larry Thompson, Paul Clement, Ted Olson, Susan Collins and Ben Sasse? At least a few of them should be willing to take a little heat in defense of the American system of justice.

In retrospect, Levi almost seemed to be pleading with them in his 1977 goodbye speech as attorney general: “We have shown that the administration of justice can be fair, can be effective, can be nonpartisan. These are goals which can never be won for all time. They must always be won anew.”

Yup! And, in some cases, the disguise is pretty transparent — perhaps the only “transparency” in today’s DOJ.

This time period comes close to spanning my career in the DOJ. I worked for both Attorney General Ed Levi and Attorney General Griffin Bell (“known on the “5th Floor” of the DOJ as “Judge Bell”).

I don’t have a recollection of personally meeting Attorney General Levi. However, I did have a strong impression of his integrity because he disqualified himself from a key BIA disbarment case being then being written by my office mate Lauri Steven Filppu who later served with me as an Appellate Judge at the BIA.

The case was Matter of Koden, 15 I&N Dec. 739 (BIA 1974; A.G., BIA 1976), aff’d , 564 F.2d 228 (7th Cir. 1977). The conflict apparently involved the fact that Levi’s wife served on the board of  a charitable organization in Chicago where Koden had worked as an attorney.

Compare that with Jeff Sessions who continues to interfere in BIA cases by certification notwithstanding the obvious conflict of interest and ethically required disqualification stemming from his many pejorative (often untrue and/or distorted) statements about migrants exercising their legal rights, particularly asylum seekers.

I knew Judge Bell better. As INS Deputy General Counsel I accompanied my then boss General Counsel (now Judge) David Crosland to a number of meetings in Bell’s office. I believe that our response to the Iranian Hostage situation was the main topic. I remember him as having a very pronounced Southern accent and being just what I expected of a former judge — concerned with the fair enforcement of the law.

Those days are long gone. The DOJ now appears to have reverted to what it was in the Nixon Administration, when Attorney General John Mitchell actually plotted Federal Crimes from his office.
