Gorsuch’s abrupt pivot to arrogance has been on full display in his bumptious opinions and questions from the bench. Whispers emerging from the court indicate Gorsuch is more likely to alienate than influence even his conservative colleagues.

Throughout his presidential campaign, Donald Trump maligned undocumented immigrants as violent criminals and sexual predators who deserved to be rounded up and deported. Once in office, Trump transformed this rhetoric into policy, implementing a nationwide crackdown on immigrant communities. Now, the president’s dehumanizing disparagement of undocumented people has now seeped into his administration’s legal positions. This week, the Department of Justice is arguing in court that undocumented, unaccompanied minors have no right to abortions—and that undocumented immigrants may have no constitutional rights at all. This argument does not only contravene Supreme Court precedent. It also draws upon an inhuman notion of constitutional liberty most notoriously espoused in Dred Scott v. Sandford.

The Justice Department’s radical new theory arose out of a disturbing case in Texas that revolves around a 17-year-old referred to as Jane Doe in court filings. Doe arrived in the United States several months ago, unaccompanied by her parents and lacking documentation. She was placed in a federally funded Texas shelter, at which point she learned she was pregnant. Doe requested an abortion, but under state law, minors cannot receive the procedure without either parental consent or judicial approval. So Doe obtained what’s known as a judicial bypass and asked permission to attend a state-mandated counseling session before undergoing the procedure.

Her shelter refused to allow her to attend that counseling session, citing federal regulations promulgated by the Office of Refugee Resettlement, a wing of the Department of Health and Human Services. In March, ORR announced that federally funded shelters could not take “any action that facilitates” abortion for unaccompanied minors, including “scheduling appointments, transportation, or other arrangement,” without “direction and approval” from Scott Lloyd, the agency’s director. A Trump appointee and longtime anti-abortion activist, Lloyd has refused to allow minors to access abortion services. Instead, he has directed shelters to take these women to “crisis pregnancy centers,” which “counsel” them not to get abortions. At least once, Lloyd himself called a pregnant minor to talk her out of terminating her pregnancy. If a minor still wants to get an abortion after navigating these obstacles, ORR instructs its shelters to block her from attending her appointment.

Doe’s shelter followed these guidelines, taking her to a crisis pregnancy center and calling her mother to tell her Doe was pregnant. But Doe persisted, and in October, her court-appointed attorneys filed suit along with the American Civil Liberties Union in a federal district court in Washington, where ORR is headquartered. Doe argues that ORR’s rules violate her constitutional rights by placing an undue burden on her access to abortion.

On Wednesday, U.S. District Judge Tanya Chutkan held a hearing in the case. While defending the government, Department of Justice attorney Scott Stewart strongly implied that undocumented women do not have a right to abortion. Here, Stewart was echoing an amicus brief filed by the Texas attorney general’s office, which proclaimed that “unlawfully present aliens” living in the United States have no constitutional right to abortion access. Chutkan then asked Stewart whether Doe has any constitutional rights; Stewart declined to make that “concession.”

Chutkan ruled against the government and issued a temporary restraining order guaranteeing Doe the ability to terminate her pregnancy. (She is currently 15 weeks pregnant, and abortion is illegal after 20 weeks in Texas.) The DOJ appealed to the U.S. Court of Appeals for the District of Columbia Circuit, which will hear arguments in the case on Friday morning. In its motion, the agency argued that the government’s “interest in promoting fetal life and childbirth over abortion” justified its refusal to let a minor go to an abortion clinic. It also claimed that, even if undocumented minors have a constitutional right to abortion care, the administration was not unduly burdening that right, because minors who want to terminate their pregnancies can leave the country. This argument is merely another way of stating that women like Doe have no right to an abortion in the United States.

By excluding undocumented immigrants from the protections of Planned Parenthood v. Casey, the Trump administration is essentially asserting that they do not qualify as “person[s]” under the Due Process Clauses of the Fifth and 14th Amendments. The Supreme Court has ruled that the liberty component of the Due Process Clause protects a woman’s right to terminate her pregnancy without a substantial obstacle. If arbitrary regulations that severely burden clinics qualify as such an unconstitutional obstacle, as the Supreme Court has held, then surely self-deportation does as well. Thus, the sole plausible interpretation of the DOJ’s posture is that the Due Process Clause does not protect undocumented women like Doe. Put simply, undocumented women are not people for constitutional purposes.

If the government can force Doe to carry her pregnancy to term, what can’t it do?
This theory parallels the Supreme Court’s most infamous ruling. Dred Scott was a black man born into slavery who moved with his “master” from a slave state to a free state. Upon his master’s death, Scott sued for his freedom. In 1857, Chief Justice Roger B. Taney—a virulent racist whose statue was removed from the grounds of the Maryland State House in August—wrote an opinion dismissing Scott’s suit. Taney held that black people were not “persons” based on the language of the Constitution and that Scott, as a black man, therefore had no right to sue in the federal courts. Black men, Taney wrote, were “so far inferior” to whites that they had “no rights which the white man was bound to respect.”

Following the Civil War, Dred Scott was overturned by the 13th and 14th Amendments. These amendments ensured that everyone born in the United States would be a citizen. They also granted all “person[s]”—not just citizens—due process and equal protection under the law. Trump has already raised the specter of Dred Scott through his call to end birthright citizenship, the constitutional command that lay at the heart of the Civil War amendments. Now his administration is invoking the decision again in its attempt to deprive undocumented immigrants of their personhood under the Constitution.

The government has rarely alleged that undocumented immigrants may be deprived of rights protected by the liberty component of due process, what’s also known as “substantive” due process. Its few attempts have been unsuccessful. In 2003, the Bush administration argued that substantive due process does not apply to immigrants who reside in the country illegally. The 6th U.S. Circuit Court of Appeals, sitting en banc, emphatically rejected this claim, explaining

If excludable aliens were not protected by even the substantive component of constitutional due process, as the government appears to argue, we do not see why the United States government could not torture or summarily execute them. … [W]e do not believe that our Constitution could permit persons living in the United States—whether they can be admitted for permanent residence or not—to be subjected to any government action without limit.
Perhaps recognizing the extremism of its argument, the Trump administration has left open the possibility that undocumented immigrants are entitled to some unspecified “minimal standards” of constitutional protection. But if those minimal standards don’t include the basic right to bodily autonomy, then the 6th Circuit’s query still stands. If the government can force Doe to carry her pregnancy to term against her will, what can’t it do? The administration’s attempt to exert complete control over Doe’s reproductive system is a straightforward deprivation of constitutional liberty that opens the door to equally egregious future abuses.

On Friday morning, the Justice Department will return to court once more to argue, in effect, that Jane Doe is not a “person” worthy of due process protections. It might as well cite Dred Scott for the proposition that the government may strip undocumented immigrants of their constitutionally protected liberty. The 14th Amendment was designed to end such capricious discrimination against individuals living in the United States. But to the Trump administration, immigrants like Doe aren’t even people—just possessions of the state, awaiting deportation.”

The 2017-’18 NFL season is objectively worse right now than it was on Sunday morning. Green Bay quarterback Aaron Rodgers broke his collarbone, and, for the foreseeable future, the league’s best player will be spending his Sundays watching games rather than playing in them.

The injury occurred in the the first quarter of Green Bay’s game against Minnesota. Vikings linebacker Anthony Barr tackled Rodgers to the turf, and the quarterback crumpled awkwardly on his arm and shoulder. (It’s a bit of frustrating irony that Rodgers’ offensive line on Sunday was in the best shapeit’s been in all year.)

After Rodgers was carted to the locker room for tests, Brett Hundley replaced him under center. Hundley is a promising young player, but, unfortunately for the Packers, he is one of the roughly 7 billion people on earth who is not Aaron Rodgers, meaning he will represent a downgrade at the quarterback position. With Rodgers, the Packers are a consistent threat to challenge for the Super Bowl. Without him … well, we’re about to find out.

Rodgers had been enjoying a terrific season, leading the Packers to a 4-1 record atop the NFC North. Just last weekend he performed his customary late-game vivisection of the Dallas Cowboys, which was exhilarating at the time but rather irritating in retrospect as it perfectly encapulates what fans will be missing due to his broken collarbone.

In 2013, Rodgers suffered a similar injury when he fractured his left clavicle in week nine. However, he was able to recover in time for the last game of that season, an affair in which he threw a last-gasp, game-winning touchdown to win the NFC North for the Packers and usher them into the playoffs. It was a miraculous performance that Green Bay fans will be careful not to label “once-in-a-lifetime” just yet.

Football carries more potential energy per play than any other sport. You never know when a routine tackle will result in something devastating, but the possibility is always there. While these high stakes may make the sport exciting, they can also conspire to result in the exact opposite outcome. Aaron Rodgers’ broken collarbone is an example of this, and the league will suffer as a result.

Pack backup QB Brett Hundley didn’t “knock anyone’s socks off” in the first “real action” of his career.  He was 18-33, 157 yards, 1 TD, 3 INT.  Not going to win many games with stats like those. But, perhaps, with knowledge that he’ll be starting and time to practice with the starters, he’ll do better next time out.  We can only hope.

Some folks (including me) think that Packer General Manager Ted Thompson would do well to ring up CBS Broadcaster Tony Romo (Wisconsin native) and/or notorious former 49er Colin Kaepernick (also a Wisconsin native).

The Pack (4-2), carrying lots of injuries in addition to Rodgers, are now tied with the Vikes atop the NFC Central (although the Vikes now own the “tiebreaker”). They play the New Orleans Saints at Lambeau next Sunday.

GONZO’S WORLD: HOMOPHOBIC AG ATTACKS LGBTQ COMMUNITY WITH BOGUS LEGAL MEMO STRIPPING TRANSGENDER INDIVIDUALS OF CIVIL RIGHTS PROTECTIONS!

“US Attorney General Jeff Sessions has reversed a federal government policy that said transgender workers were protected from discrimination under a 1964 civil rights law, according to a memo on Wednesday sent to agency heads and US attorneys.

Sessions’ directive, obtained by BuzzFeed News, says, “Title VII’s prohibition on sex discrimination encompasses discrimination between men and women but does not encompass discrimination based on gender identity per se, including transgender status.”

It adds that the government will take this position in pending and future matters, which could have far-reaching implications across the federal government and may result in the Justice Department fighting against transgender workers in court.

“Although federal law, including Title VII, provides various protections to transgender individuals, Title VII does not prohibit discrimination based on gender identity per se,” Sessions writes. “This is a conclusion of law, not policy. As a law enforcement agency, the Department of Justice must interpret Title VII as written by Congress.”

But Sharon McGowan, a former lawyer in the Justice Department’s Civil Rights Division and now an attorney for the LGBT group Lambda Legal, countered that Sessions’ is ignoring a widespread trend in federal courts.

“It’s ironic for them to say this is law, and not policy,” McGowan told BuzzFeed News. “The memo is devoid of discussion of the way case law has been developing in this area for the last few years. It demonstrates that this memo is not actually a reflection of the law as it is — it’s a reflection of what the DOJ wishes the law were.”

“The sessions DOJ is trying to roll back the clock and pretend that the progress of the last decade hasnt’ happened,” she added. “The Justice Department is actually getting back in the business of making anti-transgender law in court.”

The memo reflects the Justice Department’s aggression toward LGBT rights under President Trump and Sessions, who reversed an Obama-era policy that protects transgender students after a few weeks in office. Last month, Sessions filed a brief at the Supreme Court in favor of a Christian baker who refused a wedding cake to a gay couple. And last week, the department argued in court that Title VII doesn’t protect a gay worker from discrimination, showing that Sessions will take his view on Title VII into private employment disputes.

At issue in the latest policy is how broadly the government interprets Title VII of the Civil Rights Act of 1964, which does not address LGBT rights directly. Rather, it prohibits discrimination on the basis of sex.

But the Equal Employment Opportunity Commission, an independent agency that enforces civil rights law in the workplace, and a growing body of federal court decisions have found sex discrimination does include discrimination on the basis of gender identity and sex stereotyping — and that Title VII therefore bans anti-transgender discrimination as well.

Embracing that trend, former attorney general Eric Holder under President Obama announced the Justice Department would take that position as well, issuing a memo in 2014 that said, “I have determined that the best reading of Title VII’s prohibition of sex discrimination is that it encompasses discrimination based on gender identity, including transgender status. The most straightforward reading of Title VII is that discrimination ‘because of … sex’ includes discrimination because an employee’s gender identification is as a member of a particular sex, or because the employee is transitioning, or has transitioned, to another sex.”

But Sessions said in his latest policy that he “withdraws the December 15, 2014, memorandum,” and adds his narrower view that the law only covers discrimination between “men and women.”

“The Department of Justice will take that position in all pending and future matters (except where controlling lower-court precedent dictates otherwise, in which event the issue should be preserved for potential future review),” Sessions writes.

Sessions adds: “The Justice Department must and will continue to affirm the dignity of all people, including transgender individuals. Nothing in this memorandum should be construed to condone mistreatment on the basis of gender identity, or to express a policy view on whether Congress should amend Title VII to provide different or additional protections.”

Devin O’Malley, a spokesperson for the Justice Department, explained the decision to issue the memo, telling BuzzFeed News, “The Department of Justice cannot expand the law beyond what Congress has provided. Unfortunately, the last administration abandoned that fundamental principle, which necessitated today’s action. This Department remains committed to protecting the civil and constitutional rights of all individuals, and will continue to enforce the numerous laws that Congress has enacted that prohibit discrimination on the basis of sexual orientation.”

McGowan, from Lambda Legal, counters, “The memo is so weak that analysis is so thin, that it will courts will recognize it for what it is — a raw political document and not sound legal analysis that should be given any weight by them.”

Virulent homophobia has always been a key element of the “Gonzo Apocalypto Agenda.” Check out this report from Mark Joseph Stern at Slate about how when serving as Alabama’s Attorney General Gonzo attempted to use an Alabama statute that had been ruled unconstitutional by a Federal Judge to both publicly demean LGBTQ students and stomp on their First Amendment rights. (So much for the disingenuous BS speech that Gonzo delivered on Free Speech at Georgetown Law last week.)  Here’s what happened:

“Attorney General Jeff Sessions delivered a speech at Georgetown University Law Center in which he argued that “freedom of thought and speech on the American campus are under attack.” As my colleague Dahlia Lithwick explained, the attorney general said this in “a room full of prescreened students who asked him prescreened questions while political demonstrators outside were penned off in ‘free speech zones.’ ” Ensconced in a safe space of his own, Sessions blasted the notion that speech can be “hurtful,” criticizing administrators and students for their “crackdown” on “speech they may have disagreed with.”

Sessions’ hypocrisy on speech issues is not a new development. In 1996, the then–attorney general of Alabama used the full power of his office to try to shut down an LGBTQ conference at the University of Alabama. Sessions took his battle to court, asking a federal judge to let him block the conference altogether—or, at the very least, silence students who wished to discuss LGBTQ issues. He ultimately failed, but his campaign reveals a great deal about his highly selective view of free expression. Sessions claims to support freedom for “offensive” speech, but when speech offends him, he is all too happy to play the censor.

When Sessions served as Alabama attorney general, the state still criminalized sodomy. A 1992 law, Alabama Education Code Section 16-1-28, also barred public universities from funding, recognizing, or supporting any group “that fosters or promotes a lifestyle or actions prohibited by” the sodomy statute, either “directly or indirectly.” The law also forbade schools from allowing such organizations to use public facilities. Sessions’ predecessor, Jimmy Evans, had interpreted the statute to effectively outlaw the discussion or promotion of gay rights on public campuses, with that prohibition even extending to AIDS awareness campaigns.

In 1995, the University of South Alabama’s Gay Lesbian Bisexual Alliance sued in federal court to block Section 16-1-28. That summer, the U.S. Supreme Court had ruled that, under the First Amendment, public universities may not deny access to facilities or funding for student organizations on the basis of their viewpoints. This decision, the GLBA asserted, rendered Section 16-1-28 unconstitutional. U.S. District Judge Myron H. Thompson agreed, holding the law to be invalid in a January 1996 ruling.

This decision was excellent news for the Gay Lesbian Bisexual Alliance at the University of Alabama at Tuscaloosa. The GLBA had planned to host the Fifth Annual Lesbian, Gay, and Bisexual College Conference of the Southeastern United States in February 1996. Sessions, by now attorney general, was trying his hardest to shut it down.

“University officials say they’re going to try to obey the law,” Sessions said at the time, as CNN’s Andrew Kaczynski reported in December of last year. “I don’t see how it can be done without canceling this conference. I remain hopeful that if the administration does not act, the board of trustees will.” Sessions didn’t give up even after Judge Thompson struck down the law. “I intend to do everything I can to stop that conference,” he said.

In a last-ditch effort, Sessions returned to Thompson’s court and asked permission to ban the conference. “The State of Alabama,” he explained in court filings, “will experience irreparable harm by funding a conference and activities in violation of state law.” Failing a total ban, Sessions implored Thompson to let him censor any discussion of “safe sex and the prevention of sexually transmitted diseases.” Sessions claimed that, by talking about LGBTQ issues, conference attendees were essentially conspiring to promote criminal activity, and Alabama should not be obligated to support their criminality. Predictably, Thompson rejected Sessions’ arguments, writing that the attorney general was endeavoring to violate students’ free speech rights. Sessions then appealed to the 11th U.S. Circuit Court of Appeals, which unanimously ruled against Alabama. The conference went on as planned.

Cathy Lopez Wessell, a lead organizer and spokeswoman for the conference, told me Sessions’ intervention “was incredibly stressful. We got threatening phone calls. We were attacked from all sides.” She continued, “We were the abomination of the month. I didn’t feel safe in the world for a while. I started to internalize some of the judgment leveled at our group. I thought, there must be something deeply wrong with you if you need to be silenced.”

Lopez Wessell explained that Sessions’ campaign against the conference registered as a broader attack on LGBTQ students.

“If we can’t talk, do we have a right to exist?” Lopez Wessell asked. “If our speech is so dangerous that it needs to be stopped, then are we dangerous? We weren’t promoting any particular activity; we just wanted to talk—about our experiences, about our existence.”

Denying the humanity as well as the human rights of those he is biased against is a staple of the Gonzo Apocalypto agenda. Just look at his constant attempts to tie all members of the Hispanic ethnic community to crime, drugs, and gangs (even though all credible studies show that immigrants or all types have markedly lower crime rates than native-born U.S. citizens) and his false and gratuitous attempts to tie “Dreamers” to crime, terrorism, and loss of jobs!

There is no more certain way of knowing that a DOJ “legal” memo is all policy and no law than the statement: “This is a conclusion of law, not policy.“ In other words, “Don’t you dare accuse me of doing what I’m actually doing!”

SURPRISE: Dreamer “Agreement” Coming Apart — Trump’s Position Unclear!

“First and foremost,” Iowa Sen. Chuck Grassley, the chairman of the committee, said in his opening remarks, “any potential deal on DACA has to include robust border security, and by that, I don’t mean a wall.”

This was the quote that garnered the most coverage and inspired some optimistic tea leaf reading. If congressional Republicans weren’t going to insist on a border wall as part of a deal to protect Dreamers, as per the “deal” Democratic leaders struck with President Trump last month, then a Dreamer-saving compromise would be much more assured.

But the wall isn’t shaping up to be the problem. The problem is what Grassley brought up a few seconds later.

“Second, and equally as important as robust border security,” he said, “we’ve got to make sure any deal includes meaningful interior enforcement.”

This is a development that Dreamers themselves have been concerned about since Democrats announced they would engage with the president to find a replacement for DACA. As the New York Times reported over the weekend, Dreamers fear that their “own long-term safety might be secured only in exchange for an increased threat of deportation for their undocumented parents and friends who do not qualify for such protections under the program.” The latest version of the DREAM Act could secure green cards for 1.5 million people. But if such a deal increases the likelihood of deportation for the vast majority of the nation’s roughly 11 million undocumented immigrants, it’s not exactly a feel-good trade.

The problem with making any handshake agreement with Trump, as House Minority Leader Nancy Pelosi and Senate Minority Leader Chuck Schumer did last month, is that he will most likely change his mind once he finds himself in a roomful of different people with different demands. That meeting took place Monday night, when Trump hosted a dinner with congressional Republicans who expect much more out of a DACA deal. Trump surely wanted to win that room, too.

The agreement Trump made with Schumer and Pelosi—so they thought—would have been to pass the DREAM Act in exchange for non-wall border security measures. You know, drones and lasers and radar gizmos and stuff. But according to Arkansas Sen. Tom Cotton, an immigration hawk who was at the dinner on Monday night, “the president was very clear” that any deal should only pertain to those Dreamers who “have a DACA permit today,” a significantly lower number than the amount that would be covered under the DREAM Act, and that “it ought to include some kind of enhanced measures, whether it’s on the border or interior enforcement or what have you.” As Georgia Sen. David Perdue, a fellow immigration hawk who’s co-sponsored a bill with Cotton to reduce legal immigration, told me Tuesday, it was clear that any Dreamer deal he’d be willing to support would encompass “enforcement” on both the border and the interior.

Ratcheting up the deportation apparatus to a new level is not what congressional Democrats signed up for when they engaged President Trump in finding a DACA replacement.

Connecticut Sen. Chris Murphy told me Tuesday that an insistence on ramped-up interior enforcement would be “a problem” for his caucus. “I’m not sure that you can get much tougher interior enforcement than you have today,” he said, “as we’re watching pretty arbitrary deportations happen all across our country.” When I asked Hawaii Sen. Mazie Hirono what would constitute a bridge too far for Democrats, she said any give-and-take needs to be kept “in proportion.” As she pointed out, Republicans are starting to ask for all of the border security and interior enforcement measures included in the failed 2013 comprehensive immigration bill, in exchange for far fewer of that bill’s protections for undocumented immigrants. “I think, as [Illinois Democratic Sen.] Dick Durbin says, that is way too much,” Hirono told me.”

Dreamer relief should be a “no-brainer.” But, the GOP appears to be looking for ways to “tank” it, perhaps because Trump had the audacity to speak to the Dems first. Also, the GOP’s restrictionist views are out of line with the majority of Americans and with nearly all credible immigration experts. Yet, the minority restrictionist position is immensely popular with the GOP’s White Nationalist, xenophobic, racist “base.” And today’s GOP is so beholden to that base that they won’t work with the Dems on reasonable immigration proposals.

If anything should be clear at this point it’s that giving DHS more enforcement personnel at present is close to insane. The waste, incompetence, and gratuitous cruelty in the current DHS enforcement operations are astounding. Until existing personnel are used and deployed in a rational, efficient, and honest manner, there is simply no case for more.

Don’t know how this will come out. Perhaps, the parties are just jockeying for position and playing to their respective bases. But, it could turn ugly for both the Dreamers and for America.

“NEW YORK—The U.S. Court of Appeals for the 2nd Circuit had a burning question for Donald Trump’s Department of Justice on Tuesday: What are you doing in our courthouse? By the end of the day, the answer still wasn’t clear. Something else was, though: The DOJ’s new anti-gay legal posture is not going to be received with open arms by the federal judiciary.

The Justice Department’s latest wound was fully self-inflicted, as Tuesday’s arguments in Zarda v. Altitude Express should not have involved the DOJ in the first place. The case revolves around a question of statutory interpretation: whether Title VII of the Civil Rights Act of 1964 outlaws anti-gay workplace discrimination. Title VII bars employment discrimination “because of sex,” which many federal courts have interpreted to encompass sexual orientation discrimination. The 2nd Circuit is not yet one of them, and Chief Judge Robert Katzmann signaled recently that he would like to change that. So on Tuesday, all of the judges convened to consider joining the chorus of courts that believe Title VII already prohibits anti-gay discrimination in the workplace.

It’s important to understand some background before getting further into how those arguments went. The Equal Employment Opportunity Commission decided in 2015 that Title VII’s ban on sex discrimination does protect gay employees. Under President Barack Obama, the Justice Department took no position on this question. But in late July, Attorney General Jeff Sessions’ DOJ unexpectedly filed an amicus brief in Zarda arguing that Title VII does not protect gay people. The 2nd Circuit had not solicited its input, making the brief both puzzling and gratuitous. Its purpose only became apparent in September, when the DOJ filed a similarly uninvited brief asserting that bakers have a free speech right not to serve same-sex couples. Both anti-gay briefs were startlingly incoherent, seemingly the product of political pandering rather than legal reasoning.

Regardless, the DOJ’s decision to weigh in on Zarda ensured that oral arguments would include the weird spectacle of one federal agency opposing another in court. That doesn’t happen often—and really shouldn’t happen—because the executive branch is expected to speak with one voice on legal affairs. But the EEOC’s commissioners serve fixed terms and haven’t gotten the memo placing politics above the law yet. And so they were not exactly delighted to see political appointees at the Justice Department trash their theories in court on Tuesday when the two agencies faced off over what it means to discriminate “because of sex.”

That set the stage for Mooppan’s appearance, which, to put it mildly, did not go well at all. Chief Judge Katzmann immediately wanted to know: Why didn’t the DOJ defer to the EEOC on Title VII, as it normally does? Mooppan’s basic reply was that the Justice Department is the nation’s “largest employer”—meaning, in short, that it has an interest in retaining its capacity to fire gay people for being gay.

“What is the process with regard to the EEOC and the DOJ in terms of filing a brief?” Katzmann followed up.

“That’s a complicated question,” Mooppan responded.

“Try to help us,” Katzmann implored. He also wanted to know what career attorneys at the DOJ’s civil rights division think about the agency’s position. But Mooppan wouldn’t answer: “That’s not appropriate for me to disclose,” he told the judge. Katzmann looked alarmed. Judge Pooler jumped in: “Does the Justice Department sign off on a brief that EEOC intends to file?” she wondered.

“That’s not appropriate for me to disclose,” Mooppan repeated.

“It’s procedure, not internal deliberations,” Pooler responded.

“I don’t think it’s appropriate,” Mooppan said again, stonewalling. Now a majority of the judges looked irritated. As a general rule, attorneys are supposed to answer questions posed by the court, not dodge them as though they’re taking the Fifth. It was a terrible start for Mooppan, and both Pooler and Katzmann looked genuinely perplexed that a DOJ attorney would show such blatant disrespect. Finally, Judge Dennis Jacobs broke the impasse: “I, for one, am prepared to proceed on the assumption that you’re here,” he said.”

HOW RACISM, WHITE PRIVILEGE, & THE CULTURE OF LIES HAVE ALL COME TOGETHER IN THE PERSONA OF TRUMP & HIS MINIONS

“Most intriguingly, some have said that black players ought to protest exclusively in ways white football fans approve of. The author John Pavlovitz has explicitly named this latter critique “the arrogant heart of privilege.” As he put it, this defines that core of white privilege: “being the beneficiaries of systematic injustice, and then wanting to make the rules for the marginalized in how they should speak into that injustice.”

This is an incredibly astute and important observation, but in the past few days another more sinister theme has emerged in the attack on professional athletes and their acts of silent protest. It’s a second coming of Trump’s ongoing war on truth, except in this iteration, the attack is on the truths of others. No longer content to simply lie about things, this White House wants to tell you what other people actually mean when they speak. Nobody better captured this mentality than Trump’s press secretary, Sarah Huckabee Sanders. During Monday’s White House press briefing, Sanders was asked why the president wouldn’t acknowledge that players who knelt during the national anthem were doing so to protest racism and police brutality. Questioned about Trump’s claim that “the issue of kneeling has nothing to do with race,” Sanders responded, “I think the focus has long since changed.” She amplified that unsupported claim by saying that the players were protesting incorrectly to begin with. “I think if the debate is really, for them, about police brutality, they should probably protest the officers on the field that are protecting them instead of the American flag,” she offered.

That takes us from privilege to silencing, and it’s not a move that should go unremarked.
So, when Colin Kaepernick explicitly says time and time and time again that he is protesting police brutality, he is wrong. And when another player, Eric Reid, said on Monday that players are taking a knee expressly not to protest the flag or the military, but to protest the “incredible number of unarmed black people being killed by the police,” he is also wrong. What Sanders and Trump are saying here exemplifies one of the most grotesque aspects of unchecked privilege. It transcends even patronizing lectures about how black men should protest in such a way as to avoid offending white people. This is an attempt to dictate—with the threat of job loss—the very ability of some black men to have and maintain control over their own speech. What the president and Sanders are claiming is that they are better situated than the actual speakers to understand what those speakers are saying. That takes us from privilege to silencing, and it’s not a move that should go unremarked.

The president and Sarah Huckabee Sanders have the double luxury of being able to claim to know what NFL players really mean by their protests, and also being able to invent fake after-the-fact rationales with which to cover their own false and racially inflammatory statements. Colin Kaepernick doesn’t have that luxury. He doesn’t—at this moment—even have a job. If we are truly interested in anything that resembles truth seeking anymore, instead of allowing this controversy to be sidetracked by those who would put false words in a protester’s mouth, let’s give him the dignity of accepting at face value the real words and intentions he claims for himself.“

Attorney General Jeff Sessions had attempted to prevent cities and states from receiving these funds unless they cooperatedwith immigration officials’ crackdown on undocumented immigrants. The court held that Sessions in fact has no power to attach new restrictions to the grants, rendering most of his new rules unlawful.

Friday’s decision marked the second time a court has blocked Sessions’ attempts to penalize sanctuary cities by depriving them of federal grants. It also comes on the heels of a sweeping ruling that froze the most controversial provisions of Texas’ new anti–sanctuary cities bill. Earlier this month, the White House declared that Donald Trump is “restoring law and order to our immigration system.” But in their haste to adopt a restrictionist immigration regime, Trump, Sessions, and their fellow Republicans have shown a consistent disdain for federal statutes and constitutional protections.

Consider Sessions’ latest sanctuary cities imbroglio. In July, the attorney general created new criteria for Byrne Memorial Justice Assistance grants, which dispense hundreds of millions of dollars to state and local law enforcement. Under these rules, jurisdictions would not be eligible for Byrne grants unless they collaborate with Immigration and Customs Enforcement officials. Most pertinent here, law enforcement officials would have to give ICE agents access to local jails and, if the agency is interested in detaining an undocumented immigrant, notify ICE 48 hours before that person is set to be released. Chicago sued, alleging that the new rules were illegal.

Where does Sessions get the authority to impose these conditions on Byrne grants? Nowhere, as Judge Harry D. Leinenweber of the Northern District of Illinois pointed out in his ruling siding with Chicago. The Constitution grants Congress, not the executive branch, authority to impose conditions on federal funding. And Congress has never authorized the Justice Department, which is part of the executive branch, to force Byrne grantees to work with ICE. Sessions simply usurped Congress’ authority to make new rules.

When Chicago sued Sessions over the Byrne conditions in August, the attorney general put out a Trumpian statement asserting that the city “proudly violate[s] the rule of law” by protecting undocumented immigrants. But as Leinenweber explained on Friday, it was Sessions, not Chicago, who was acting lawlessly.

It’s surprising that Sessions would try to meddle with Byrne grants given that his first foray into sanctuary city–bashing failed so spectacularly. In Trump’s first days in office, the president issued an executive order directing the attorney general and Homeland Security secretary to withhold all federal grants and funding from sanctuary jurisdictions. Multiple cities quickly filed suit to defend their sanctuary policies. Sessions’ Justice Department, which apparently realized this order would violate multiple constitutional provisions, told a federal court that in reality, the order was nothing more than a narrow warning to sanctuary cities that the government would enforce current grant conditions.

In April, U.S. District Judge William Orrick blocked the order as an unconstitutional abomination. In his decision, Orrick essentially mocked the Justice Department, writing that he would not accept the DOJ’s “implausible” interpretation as it would transform Trump’s order into “an ominous, misleading, and ultimately toothless threat.” Instead, he analyzed the text of the order and found that it infringed upon constitutional separation of powers; coerced and commandeered local jurisdictions in violation of the 10thAmendment; and ran afoul of basic due process principles.

The White House promptly complained that Orrick “unilaterally rewrote immigration policy for our Nation” in an “egregious overreach.” Ironically, that is almost exactly what Trump had done through his executive order, illegally attaching new conditions to federal funds without congressional approval. Orrick had merely enforced the law; it was Trump who tried to change it unilaterally.

Neither of the Trump administration’s unlawful immigration power-grabs is as startling as SB 4, a Texas bill targeting sanctuary cities that Sessions’ Justice Department has defended in court. Confident in their measure’s legislative success, Texas Republicans turned SB 4 into a compendium of the most draconian possible attacks on sanctuary jurisdictions. The bill compelled local police to enforce immigration law, cooperate with ICE agents, and detain potentially undocumented immigrants; it also censored local officials who wished to speak out against the law. Law enforcement officers who ran afoul of SB 4 would face massive fines, jail time, and removal from office. Government employees who criticized the measure could also be fined and stripped of their positions.”

Let’s get this straight: the “rule of law” to Sessions means laws aimed disproportionately at Latinos, Blacks, Muslims, undocumented migrants, non-white immigrants, LGBTQ individuals, ethnic communities, jurisdictions that voted for Democrats, legal marijuana users and businesses, innocent victims of civil forfeitures, and “leakers” (many would say “whistleblowers”) who are career civil servants. In other words law enforcement that in some disturbing ways parallels the “Jim Crow” laws in Alabama and other Southern States to which Sessions would apparently like to return (only with a greater emphasis on targeting Latinos, rather than Blacks, although he has little use for the latter now that the confirmation process is complete during which he “conned” a couple of Blacks into saying he wasn’t a racist.)

I remember from my youth hypocritical Southern racists like George Wallace asserting the false mantle of “the rule of law” and “states rights” for enforcing blatantly discriminatory racial laws while stomping on the actual legal and constitutional rights, and often lives, of Black citizens. Sessions has little or no intention of enforcing laws relating to civil rights protections, voting rights, protections for LGBTQ individuals, protections against local police abuses, due process for migrants in and outside of the U.S. Immigration Court process, environmental protection, constitutional conditions of detention, and ethics. Sessions is clearly a liar, if not a perjurer (which he might be) under legal definitions.

We should all be concerned that this totally unqualified and disingenuous individual has been put in charge of the U.S. justice system. I’ve commented earlier on the glaring unsuitability of individuals like Greg Abbott and Ken Paxton to be governing a state with a significant Hispanic population.

And, Stern’s article didn’t even raise Trump’s greatest and most audacious abuse of the rule of law: his totally unjustified and inappropriate abuse of the Presidential Pardon authority by pardoning the unrepentant, unapologetic “Racist Joe.” Think about what “Racist Joe” stands for, as described by a U.S. District Judge who found him guilty of contempt of court after trial for his continuing, knowing, and intentional abuses of the constitutional rights of Latino citizens and prisoners, among others. In what way does “Racist Joe” deserve a pardon? How would you feel if you were a Hispanic citizen or a detainee who had his or her constitutional rights intentionally violated and was victimized by this arrogant, bullying, racist? The innocent suffer while the guilty go unpunished. What kind of “rule of law” is that?

Then think of all the GOP “politicos” who “palled around” with “Racist Joe” and his toxic sidekick Kris Kobach and even sought their endorsements! That’s because it would help with the racist, White Supremacist “core vote” that has allowed the GOP to gain control of much of the U.S. governing structure notwithstanding the party’s extremist views and generally destructive agenda.

This is very reminiscent of how the “White Southern racist base” helped the Democrats maintain a stranglehold on government for the bulk of the mid-20th Century. Assume that the “Trump base” is 20% of the electorate and only 15% fit my foregoing description. That means without the racist White Supremacist vote, the GOP and Trump would have polled  around 31% of the popular vote, not enough to win even with the idiosyncrasies of our electoral system that favor the GOP minority!

GONZO’S LATEST TARGET: LGBTQ Americans — DO”J” Gratuitously Files “Embarrassing” Brief With Supremes SUPPORTING Homophobia: “politicized bigotry dressed up in inane legalese!”

“On Thursday afternoon, the Department of Justice filed an amicus brief in Masterpiece Cakeshop v. Civil Rights Commission, a constitutional challenge to LGBTQ nondiscrimination laws. The DOJ urged the Supreme Court to rule that laws barring businesses from refusing to serve gay couples may violate the First Amendment’s free speech guarantee. Its brief is an exercise in cynical dishonesty, one that’s difficult to read as anything less than politicized bigotry dressed up in inane legalese.

Even worse, the brief does not explain why homophobia deserves special respect under the law. The Supreme Court has said that homosexuality is immutable, like race. Why, then, should animus toward same-sex couples be treated differently from animus toward interracial couples? And what about religious bigotry? Can a devout baker refuse to sell a cake to an interfaith couple, and can an atheist one say a Christian can’t buy cupcakes for a christening? Can a sexist baker refuse to serve a female customer? What if his misogyny is derived from religion? And why stop at a cake? Shouldn’t the preparation of other foods qualify as expressive conduct, too? Doesn’t every good or service involve some measure of expressive conduct or association that the First Amendment could theoretically protect?

In its brief, the DOJ implicitly raises all of these questions without answering them because it can’t answer them—not honestly, at least. The reality is that the courts cannot, with any logical coherence or consistency, deny civil rights protections to some groups but not others. Either nondiscrimination law are constitutional or they aren’t. The First Amendment does not grant greater rights to homophobic bakers than racist or sexist ones. Plenty of bigoted business owners wish they could assert a constitutional privilege not to associate with specific groups. If the courts open the door to one, they’ll open the door to all. Shopkeepers do not have a special right to turn away gays from their stores.

The brief strives to avoid this problem because it is, at bottom, a political document. Attorney General Jeff Sessions recently gave a speech to ADF thanking the organization for its “important work” defending “religious liberty.” Through Sessions, President Trump is discharging his obligation to appease the bigots in his base. The DOJ’s efforts, however, may prove counterproductive. This brief will delight the court’s reactionaries who favor religious supremacy and disdain gay rights. But it can only estrange Kennedy—who notably, has allowed an LGBTQ nondiscrimination policy to trump a First Amendment claim in the past. Kennedy is always eager to protect the “equal dignity” of same-sex couples; the DOJ now seeks to undermine it. The Trump administration might score political points with this brief, but it won’t win enough votes at the court.

One more thing

“When President Trump pardoned former Maricopa County Sheriff Joe Arpaio—then under contempt of court for bucking a federal injunction—he defended the action as necessary for the preservation of law and order. Lawmakers and advocacy groups expressed outrage, and for good reason. Arpaio hadn’t been a force for either law or order. Throughout his career, he repeatedly and flagrantly violated the constitutional rights of the men and women in his jails, to say nothing of his racial profiling, measures that consumed resources at the expense of actual crime in his community. Celebrated for his cruelty, Arpaio embodied a homegrown authoritarianism defined by its racism. And in shielding the Arizona sheriff from the legal consequences of his actions, Trump undermined actual rule of law, subjecting it to his whims and prejudices.

It was ironic, then, to see the president cite the rule of law in criticizing Deferred Action for Childhood Arrivals, an Obama-era executive decree that shielded unauthorized immigrants who had come as children from deportation provided they paid a fee, met certain requirements, and registered with the government. Announced in 2012, almost two years after a successful Republican filibuster of legislation that would have the same effect, the consensus among legal scholars is that the action was legal. But President Trump disagrees. “As President, my highest duty to defend the American people and the Constitution of the United States of America,” he said in an official statement. “At the same time, I do not favor punishing children, most of whom are now adults, for the actions of their parents. But we must also recognize that we are [a] nation of opportunity because we are a nation of laws.”

His attorney general, Jeff Sessions, echoed Trump’s concerns in announcing the end of DACA. “No greater good can be done for the overall health and well-being of our republic, than preserving and strengthening the impartial rule of law,” said Sessions. “To have a lawful system of immigration that serves the national interest, we cannot admit everyone who would like to come here.”

But both odes to the rule of law are difficult to square with the rationale for the Arpaio pardon, even if the pardon was clearly permissible under the president’s broad powers. The former sheriff didn’t just break the law: He violated the constitutional rights of American citizens and disobeyed a court order to cease that conduct. A president seriously concerned with rule of law would not claim Arpaio as an ally (as Trump did) much less pardon him of his offenses.

The natural explanation for this inconsistency is that “rule of law” is a smokescreen meant to obscure the actual reason for ending DACA. That reason is Trump’s own nativism—a driving force of his campaign for president, reflected in the cultural and racial anxiety of his voters—and the anti-immigrant ideologies of key advisers like Sessions and Stephen Miller (who was mentored by Sessions in the Senate). Both men hold deeply nativist worldviews and highly restrictionist agendas for immigration, with the goal of limiting and removing as many immigrants as possible, and creating an inhospitable environment for those who remain.

“Law and order” is just a smokescreen for exclusion.
The official statements from Sessions and the White House illustrate those views. The attorney general, for example, stated that DACA—which he called an “open-ended circumvention of immigration laws”—denied jobs to “hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens,” a claim with no basis in fact but in the myth that immigrants take jobs from Americans. Later, Sessions declares that the failure to enforce immigration laws puts “our nation at risk of crime, violence and even terrorism.” This may be true in the general sense, but it has no relevance to the actual policy in question, which deals with those undocumented immigrants who came to the United States through no act of their own, and who seek to live and work in peace. The statement simply serves to associate immigrants with crime and disorder.

The White House statement is even more reliant on anti-immigrant myths. Trump says that DACA contributed to a “massive surge of unaccompanied minors from Central America” that included “young people who would become members of violent gangs throughout our country, such as MS-13.” This, my colleague Mark Joseph Stern finds, is simply false, an allegation “touted by far-right xenophobes.” Later, the president—like Sessions—connects DACA to a “decades-long failure” to enforce immigration law that has led to “the illicit entry of dangerous drugs and criminal cartels” in addition to other ills. Again, there’s little to support this claim other than familiar anti-immigrant tropes.”

COURTSIDE COMMENTARY/ANALYSIS: AG Jeff “Gonzo Apocalypto” Sessions Might Be A Clown 🤡 — But His White Nationalist Plan To Destroy The American Justice System Is No Joke — He Has Already Done Untold Damage To Our Country & Our Rights — And, He And His White Supremacist Buddy Steve Bannon, The Alt-Right, And Other Haters Are Just Getting Started On Their Plan To Turn America Into A “Whites Only” Paradise!

Three articles from today show the “clear and present danger” to American democracy, our national security, and our fundamental values stemming from Jeff “Gonzo Apocalypto” Sessions and his radical right — some would say fascist is more accurate — cabal.

While Trump increasingly appears to be a looney incompetent functioning primarily in the early morning “tweetosphere,” Sessions & Co. know a thing or two about how to take over and sabotage government of the people, by the people, and for the people. (Ironically, the “Party of Lincoln” has morphed into  the “anti-Lincoln,” opposed to equality, generosity, democracy, and inclusion.)

First, Dana Milbank in the Washington Post describes “Gonzo the Clown’s” ludicrous attempts to use and abuse criminal law to suppress free public expression of opinions:

“Did you hear the one about Jeff Sessions?

I’d like to tell you, but I can’t. You see, it’s illegal to laugh at the attorney general, the man who on Tuesday morning announced that the 800,000 “dreamers” — immigrants brought here illegally as children — could soon be deported. If you were to find my Sessions jest funny, I would be an accessory to mirth.

This is no joke, because liberal activist Desiree Fairooz is now being put on trial a second time by the Justice Department — Jeff Sessions’s Justice Department — because she laughed at Sessions during his confirmation hearing. Specifically, she laughed at a line about Sessions “treating all Americans equally under the law” (which is, objectively, kind of funny).”

Yeah, I guess what Sessions, a well-established liar, probably a perjurer, really meant was “all Americans except Blacks, Hispanics, Asian Americans, immigrants, migrants, Dreamers, gays, lesbians, transgendered, bisexual, criminal defendants, Democrats, non-Christians, protestors, non-GOP women, and the poor.” Read the rest of Dana’s article here:

But, the following list of hostile actions that Sessions has already taken at Justice, compiled by CNN’s Gregory Krieg, are no laughing matter:

“*Directed federal prosecutors to pursue the stiffest possible charge in every single criminal case — potentially triggering draconian mandatory minimum sentences the Obama administration tried to avoid on fairness grounds for non-violent offenders.

*Withdrawn an Obama administration directive offering protections for transgender students who wanted to use bathrooms corresponding to their gender identity.

*Reversed an Obama DOJ order that the federal Bureau of Prisons back off new deals with private facilities. “I direct the Bureau to return to its previous approach,” Sessions said in a memo citing concerns that the “future needs of the federal correctional system” would be “impaired.”

*Launched a broad-based effort to reduce federal oversight of local police departments, like those put under increased scrutiny following investigations into alleged abuses. The deputy attorney general and associate attorney general were ordered to review lots of things, including all “contemplated consent decrees.”

*In a move criticized by voting rights advocates, asked state election officials in June to lay out their processes for purging voter rolls of individuals who have become ineligible due to, among other reasons, “death or change of residence.”

*Put in place a policy that could pave the way for an increase in a certain kind of civil asset forfeiture, a controversial practice — in this case a joint federal, state and local version that some departments were accused of using to get around state law — that allows police to seize money or property from suspects who haven’t been convicted of a crime. (The DOJ says it has put new safeguards in place to prevent abuse.)

And more.
Consider Trump’s plan to end DACA. When it came down to it, the President steered clear of the spotlight and let Sessions be the public face of a decision officials from both parties have described as unfair or even cruel.
It’s not the first time Trump has been happy enough — or detached enough, depending on your assessment of the his mindset on these issues — to defer to Sessions or, in cases where executive action is required, follow his lead. Where Trump is primarily focused on how he’s covered in the press and how his actions play with “the base,” officials like Sessions and EPA Administrator Scott Pruitt have shown themselves to be laser-focused on very specific policy points.

And, in the Washington Post,  Sarah Posner puts it all in scary context by describing the Bannon-led White Nationalist’s larger program to turn America into a White Theo-Fascist State:

“Now that he is out of the White House, Bannon’s ambitions, if anything, appear to seek an even more enduring footprint on Republican politics. His grand plan is to remake American conservatism, by shifting it away from its long-standing “three-legged stool” coalition of tax-cutters, defense hawks and the religious right. His strategy is to peel away Christian conservatives from that coalition, and to build a new coalition with anti-immigrant, anti-Muslim, far-right nationalists, in order to make the Trump revolution permanent, even after Trump has left the White House.
Consider the headline on a prominently placed “exclusive” published on the site late last night, which heaps the most coveted of Breitbartian praise on Moore: “Judge Roy Moore Embodies Jeff Sessions.” In an interview with Breitbart, Moore says he shares Sessions’s views on immigration and trade, and that he, too, is a “very strict constructionist of the Constitution.” He says he favors impeaching federal judges, even Supreme Court justices, and singles out Obergefell v. Hodges , the landmark 2015 case legalizing same-sex marriage, as warranting impeachment.
Bannon hinted at some of his designs in an interview with me last year. He said that, without the religious right, his base alone lacks the numbers to “to ever compete against the progressive left.”
In Moore, Bannon has found an unabashed proponent of “biblical law.” Bannon doesn’t appear to care much about “biblical law,” but Moore’s overheated depiction of the overreach of the federal government dovetails with the Bannon goal of “the deconstruction of the administrative state.”
Indeed, the Breitbart-Moore alliance is the most vivid example to date of the anti-government, white-nationalist Breitbart forces teaming up with a candidate with shared views on issues such as immigration and the role of the federal government, but which are driven by outwardly theocratic aspirations. Bannon is not seen as an overtly religious figure, but he has actively sought the religious right’s imprimatur for purely political purposes.
As Politico reports, Bannon himself is now using Breitbart to help “orchestrate the push” for Moore’s candidacy in high-level meetings with influential conservative groups.
There is a good deal of overlap between Bannon’s depiction of Trumpism as a revolt against global elites and Moore’s own rhetoric. Moore has long railed at elitists and “tyrannical” government overreach, albeit from a theocratic point of view. He first became a national hero to the religious right over a decade ago, after he was stripped of his post as chief justice of the Alabama Supreme Court for defying a federal court order to remove a 2.6-ton Ten Commandments monument from the state courthouse, because it violated the separation of church and state.
Undeterred, Moore ran unsuccessfully for governor and then again for his state’s top judicial post, regaining his seat in 2012. After a federal court struck down the state’s ban on same-sex marriage in early 2015, Moore pointedly told Alabama’s governor that complying with the federal court order could violate God’s law.
Although Breitbart hardly teems with religious language, Moore shares its conspiratorially dark vision of America, and particularly America’s perceived enemies. When I saw him speak in 2011, when Barack Obama was still president, Moore maintained: “Our government is infiltrated with communists, we’ve got Muslims coming in and taking over where we should be having the say about our principles.” On immigration, he said the government was failing “to protect against invasions” and was “letting anybody come in!”
Ultimately, the Breitbart-Moore alliance offers a hint at where the Trump base is headed. If Bannon has his way, it will evolve into a kind of coalition of anti-immigrant, anti-Muslim white nationalists seeking to disrupt the GOP from within by joining forces with the Christian right, long an essential component of the GOP base. Whether or not Moore wins, if Bannon can keep pushing the Trumpist base in that direction by continuing to solidify that coalition, we can only guess at the consequences that will have for the GOP over the long term.”

Consequences for the GOP, Sarah? What about the consequences for the world and humanity of turning America into a White Fascist State incorporating the worst parts of Christian mythology, while leaving the kind, merciful, inclusive, and forgiving message of Jesus Christ in the dust?

In the first place, fortunately, only a minority of Americans share the Bannon-Sessions White Nationalist dream. So, making it come to fruition has to involve suppressing and overcoming by unlawful or unconstitutional means the will and rights of those of us in the majority.

That’s an old Bolshevik trick. And, indeed, Bannon is a self-proclaimed “Leninist revolutionary” — Sessions is his Trotsky. (Can’t really picture Stephen Miller as Stalin —  but his ability to concoct lies at a moment’s notice and his cold lack of humanity or any discernible decency or human values, along with his disdain for representative government and love of the dictatorial model certainly fits “Papa Joe” to a tee. You could definitely imagine Miller as leader of a Trump “personality cult” in a fascist regime.)

But, that’s not all folks! Intentionally cruel, racist, and gonzo as Sessions’s grand plan of “ethnic cleansing” of Dreamers might be, it would actually cost the US economy an astounding  $215 billion, and that’s a conservative estimate that doesn’t even factor in the billions that would be wasted by DHS and EOIR in arresting and deporting America’s future stars (basically, because they aren’t White. As I’ve said before, no sane person thinks we’d be having this orchestrated “immigration debate” if the migrant population were predominantly white, English as a first language, Christians)!

According to Vanessa Wang in Buzzfeed:

“Reversing the Deferred Action for Childhood Arrivals program could cost the economy $215 billion in lost GDP and cost the federal government $60 billion in lost revenue over ten years, according to the libertarian think tank the Cato Institute.
Ike Brannon, a visiting fellow at Cato, wrote in a recent blog post: “It is important to note that these estimates are conservative, as DACA recipients will likely end up being more productive than their current salaries indicate, as they complete their degrees and gain experience in the workplace. Nor does this analysis factor in the enforcement cost of physically deporting recipients should the program be eliminated, which we believe would be significant.”
California, New York and Florida would bear the greatest costs, according to the Cato Institute’s analysis.
The New American Economy — a coalition of business leaders and mayors “who support immigration reforms that will help create jobs for Americans today” — estimated that the DACA-eligible population earns almost $19.9 billion in total income annually, contributes more than $1.4 billion to federal taxes, more than $1.6 billion to state and local taxes and represent almost $16.8 billion in spending power.
“Despite the rhetoric claiming undocumented youths are a drain on the U.S. economy, 90% of the DACA-eligible population who are at least 16 years old are employed” and contribute meaningfully to the economy, the coalition wrote in a brief.
“Ending DACA will disrupt hundreds of thousands of promising careers and cost the US economy dearly,” said John Feinblatt, President of New American Economy in a statement on Tuesday.
On Tuesday, the Department of Homeland Security said it would shut down DACA in six months, potentially giving Congress some time for a legislative solution. House Speaker Paul Ryan has said there are DREAMers “who know no other country, who were brought here by their parents and don’t know another home. And so I really do believe there that there needs to be a legislative solution.”
“Now it’s imperative for Congress to do what’s right and economically smart – protect the young achievers who know no home but America,” said Feinblatt.”

That’s right folks! The Bannon-Sessions White Nationalists would be willing to damage our economy to the the tune of probably a quarter of a trillion dollars for the sheer joy of ruining human lives and entrenching their White Power structure. In most other contexts, there would be a name for such conduct: “domestic terrorism!”

Finally, a number folks have noted that DACA is a DHS/USCIS program. So, why was the Attorney General, who pointedly was stripped of his immigration deportation functions and responsibilities by the Act creating DHS, out there acting like he is the deporter-in-chief and administrator of the DHS (which, by statute, he no longer is.)

 

Well, not suprisingly, I’m not in the Trump Administration’s “inner circle.” So, who knows for sure.

But, to me two things were evident. First, Donald Trump is a coward who didn’t have the guts to be the front man for his own inhumane policy — particularly since Sessions contradicted Trump’s public assurances that he “loved Dreamers,” understood their plight, and that they had “nothing to fear” from him and his Administration because he was going to come up with a”great solution” to their situation.

Second, Sessions has never accepted his secondary statutory and Constitutional role in immigration enforcement. With the weak Gen. Kelly in charge of DHS, Sessions simply pretended like the AG was back at the helm of immigration enforcement. After all, Sessions has spent a lifetime attempting to turn back the clock. This is just the first time that he has gotten away with it without any real opposition.

Kelly was a “bobblehead,” meekly agreeing with Sessions’s most outrageous, unlawful, and inhumane statements. He even lent his name to an infamous Sessions-Miller contrived “letter” asking the President for Travel Ban 2.0 and citing facially bogus statistics and disingenuous arguments attempting to tie individuals from Muslim countries to unrelated terrorist threats. In other words, on immigration enforcement, Kelly’s “substance” was about 1/16″ deep, and I’m being generous.

Obviously, killing the Dreamers’ future while heaping scorn on them was Session’s version of “Super Bowl Sunday:” a chance to publicly reclaim the role of deporter-in-chief, while inflicting gratuitous harm on a gallant but vulnerable (largely non-White) group of young people, and tossing in some gratuitous racist insults and nativist lies in the process. For a guy who has spent a lifetime heretofore unsuccessfully trying to “get back to Jim Crow” (where not coincentally, bogus “rule of law” arguments and “state’s rights” were used by Sessions’s Alabama antecedents to deny Black Americans not only their constitutional rights but in many cases their very lives in the process) this had to be “hog heaven.” Let’s not forget that Sessions has endorsed the blatantly racist and anti-semitic “Immigration Act of 1924” as a model for White Nationalist restrictionist policies. I’m sure Gonzo pines for the “good old days” of the Chinese Exclusion Laws when America knew how to use the “rule of law”  and just how to treat the folks who built the trans-continental railroad, most of California, lots of New York, and points in between. Declare them to be an “inferior race” — a threat to our cultural integrity —  and throw them out before they can displace the White Americans who exploited their ingenuity and hard labor.

Also, make no mistake about it, if Sessions were able to carry out his gonzo plans to deport Dreamers to foreign lands that most of them have hardly lived in, some will actually die in the process. But, hey, the lives of non-Whites are just “collateral damage” in the Bannon-Sessions world vision.

Sessions is part of our nation’s racist, White Supremacist past that we will need to get beyond to continue to prosper as a country and to lead the free world. The Dreamers can help us do that! The only question for the rest of us is what legal channels are available to move Sessions and his cohorts out of the way so that the Dreamers, along with other immigrants and minorities, can help lead us to a brighter future as a proudly diverse, humane, and powerful nation.

Liz Warren was right! America is better than Jeff Sessions! It’s time we showed it!

SLATE: “Jeff Sessions Spews Nativist Lies While Explaining Why Trump Is Killing DACA!”

“Many Republicans have made clear in recent weeks that they favor the basic policy DACA enshrined, and merely oppose its executive implementation. Sessions, who helped persuade Trump to kill the program, is not one of those Republicans. In his remarks, he directly denounced the very idea of granting any kind of amnesty to undocumented individuals brought to the U.S. as children through no fault of their own. At the heart of his speech were two lies, straight from Breitbart, explaining why DACA must end:

The effect of this unilateral executive amnesty, among other things, contributed to a surge of unaccompanied minors on the southern border that yielded terrible humanitarian consequences. It also denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.

Let’s examine these falsehoods in turn.

First: Sessions claimed that DACA “contributed to a surge of unaccompanied minors on the southern border.” This allegation, often touted by far-right xenophobes, is false. A study published in International Migration, a peer-reviewed academic journal, found that the surge in unaccompanied minors actually began in 2008. (DACA was announced in 2012.) The authors pointed to a host of factors contributing to this phenomenon, including escalating gang violence in Central America, as well as drug cartels’ willingness to target and recruit children in Mexico. But the study found that DACA was not one of these factors. Its authors concluded that “the claim that DACA is responsible for the increase in the flow of unaccompanied alien children is not supported by the data.”

Even without the study, it should be obvious that DACA played no role in this surge of unaccompanied minors because the theory itself makes no sense. Undocumented children who arrived in the United States following DACA’s implementation would not qualify for the program. Only those individuals who “have continuously resided in the United States since June 15, 2007” and “were physically present in the United States on June 15, 2012” could receive DACA status. Why would parents send their children to the U.S. to participate in a program in which they are not legally permitted to participate?

Second: Sessions alleged that DACA has “denied jobs to hundreds of thousands of Americans by allowing those same jobs to go to illegal aliens.” This line is obviously drawn from the false narrative that immigrants steal jobs from American citizens. There is no actual evidence that DACA recipients have taken jobs from any Americans, let alone “hundreds of thousands.” There is, however, strong evidence that killing DACA will significantly damage the economy—a fact that Sessions conveniently omitted from his speech.

Once DACA is fully rescinded, its former recipients will lose their work permits (and thus their jobs) and face possible deportation. According to the left-leaning Center for American Progress, about 30,000 people will lose their jobs each month as their DACA status expires. The loss of these workers could reduce the national GDP by $280 billion to $433 billion over the next decade. According to estimates by the libertarian Cato Institute, DACA’s demise will cost employers $2 billion and the federal government $60 billion. Trump’s decision to end DACA isn’t a job-saver; it’s a job-killer.

Toward the end of his speech, Sessions praised the RAISE Act, a Republican-backed bill that would tightly curtail immigration into the U.S. Sessions claimed the act would “produce enormous benefits for our country.” In reality, the measure marks an effort to return America to an older immigration regime that locked out racial and ethnic minorities. Sessions has praised the 1924 law that created this regime—a law whose chief author declared that his act was meant to end “indiscriminate acceptance of all races.” On Tuesday, Sessions revived this principle in slightly more polite language.

The attorney general’s utterly gratuitous defamation of young Latino immigrants tells you everything you need to know about the decision to kill DACA. Before Tuesday, the Trump administration seemed eager to frame its DACA decision as respect for constitutional separation of powers: Congress, it insisted, not the president, must set immigration policy. But after Sessions’ speech, it is difficult to view this move as anything other than an attempt to implement the white nationalism that Trump and Sessions campaigned on.”

It shouldn’t be news by now that “Gonzo Apocalypto” is a lifelong racist and White Nationalist totally unfit to serve as Attorney General. That’s what Liz Warren and others said during the confirmation process when Sessions’s GOP “fellow travelers” were so eager to brush over his un-American record and his anti-American views.

Latinos, Asians, Blacks, Jews and other American minorities need to unite with those of us who don’t want a return to the “Jim Crow” American South of the earlier 20th Century (which spawned the likes of Sessions and where the white GOP population is still racially and culturally tone deaf) behind some good candidates, get out the vote, and throw the White Nationalists and their GOP enablers and apologists (guys like Mitch McConnell, Paul Ryan, and most of the rest of the today’s GOP legislators who take responsibility for nothing while encouraging the Trump Administration’s outrageous conduct by refusing to join with Congressional Democrats to “just say no'”) out of office at the ballot box.  Otherwise, there won’t be an America in the future. We’ve got to stop letting “the “30%” who either never knew or have forgotten what it means to be a real American run roughshod over our country and particularly our kids. It’s going to be a long four years. Feels like it already.

This is the reason Trump’s campaign attracted, and his administration employs, men like Jeff Sessions, Stephen Bannon, and Stephen Miller. Sessions, a staunch opponent of federal civil rights enforcement and proponent of radical immigration restriction. Miller, his protégé, whose young career is marked by the same contempt for racial pluralism. Bannon, an entrepreneur with intellectual pretensions whose literary touchstones include virulently racist propaganda, and who brought that sensibility to Breitbart, a news website where “black crime” was a vertical and writers churn out stories on dangerous Muslims. Each shares a vision of a (white) America under siege from Hispanic immigration to the South and Islam to the East. All three are influential in the Trump White House as strategists and propagandists, taking the president’s impulses and molding them into a coherent perspective.

That is the key context for President Trump’s recent remarks in Warsaw, Poland, where he made a defense of “Western civilization.” He praised Poland’s resilience in the face of Nazi aggression and Soviet domination (and stayed quiet on Nazi collaboration within Poland), and celebrated the nation as a beacon of Western values. “A strong Poland is a blessing to the nations of Europe, and they know that. A strong Europe is a blessing to the West and to the world.” (It should be said that U.S. allies in Western Europe are less enthusiastic about the current right-wing Polish government.) From here, Trump presented the West as an empire under siege: “We have to say there are dire threats to our security and to our way of life. You see what’s happening out there. They are threats. We will confront them. We will win.”

Although marked by Trump’s characteristic bombast, much of this was in line with past presidential rhetoric, especially during the Cold War when American presidents routinely engaged in this kind of clash of civilizations rhetoric. (It is unclear, though, if previous presidents would have endorsed a narrative that erases victims of Polish anti-Semitism.)

But this isn’t the Cold War. The Soviet Union no longer exists. For Trump then, what are these “dire threats”? The chief one is “radical Islamic terrorism” exported by groups like ISIS. But he doesn’t end there. For Trump, these threats are broader than particular groups or organizations; they are internal as well as external.

“We must work together to confront forces, whether they come from inside or out, from the South or the East, that threaten over time to undermine these values and to erase the bonds of culture, faith, and tradition that make us who we are,” said Trump. “If left unchecked, these forces will undermine our courage, sap our spirit, and weaken our will to defend ourselves and our societies.”

Not content to leave his message understated, Trump hammered home this idea in a subsequent line. “The fundamental question of our time is whether the West has the will to survive,” said the president, before posing a series of questions: “Do we have the confidence in our values to defend them at any cost? Do we have enough respect for our citizens to protect our borders? Do we have the desire and the courage to preserve our civilization in the face of those who would subvert and destroy it?”

In the context of terrorism specifically, a deadly threat but not an existential one, this is overheated. But it’s clear Trump has something else in mind: immigration. He’s analogizing Muslim migration to a superpower-directed struggle for ideological conquest. It’s why he mentions “borders,” why he speaks of threats from “the South”—the origin point of Hispanic immigrants to the United States and Muslim refugees to Europe—and why he warns of internal danger.

This isn’t a casual turn. In these lines, you hear the influence of Bannon and Miller. The repeated references to Western civilization, defined in cultural and religious terms, recall Bannon’s 2014 presentation to a Vatican conference, in which he praised the “forefathers” of the West for keeping “Islam out of the world.” Likewise, the prosaic warning that unnamed “forces” will sap the West of its will to defend itself recalls Bannon’s frequent references to the Camp of the Saints, an obscure French novel from 1973 that depicts a weak and tolerant Europe unable to defend itself from a flotilla of impoverished Indians depicted as grotesque savages and led by a man who eats human feces.

For as much as parts of Trump’s speech fit comfortably in a larger tradition of presidential rhetoric, these passages are clear allusions to ideas and ideologies with wide currency on the white nationalist right.

Defenders of the Warsaw speech call this reading “hysterical,” denying any ties between Trump’s rhetoric in Poland and white nationalism. But to deny this interpretation of the speech, one has to ignore the substance of Trump’s campaign, the beliefs of his key advisers, and the context of Poland itself and its anti-immigrant, ultranationalist leadership. One has to ignore the ties between Bannon, Miller, and actual white nationalists, and disregard the active circulation of those ideas within the administration. And one has to pretend that there isn’t a larger intellectual heritage that stretches back to the early 20thcentury, the peak of American nativism, when white supremacist thinkers like Madison Grant and Lothrop Stoddard penned works with language that wouldn’t feel out of place in Trump’s address.

“Unless we set our house in order, the doom will sooner or later overtake us all. And that would mean that the race obviously endowed with he greatest creative ability, the race which had achieved most in the past and which gave the richer promise for the future, had passed away, carrying with it to the grave those potencies upon which the realization of man’s highest hopes depends,” wrote Stoddard in his 1920 book The Rising Tide of Color Against White World-Supremacy. Compare this to the crest of Trump’s remarks in Warsaw, which follows his warning of internal threat and his praise of Western civilization:

What we have, what we inherited from our—and you know this better than anybody, and you see it today with this incredible group of people—what we’ve inherited from our ancestors has never existed to this extent before. And if we fail to preserve it, it will never, ever exist again.

Those lines fit comfortably into a long history of white nationalist rhetoric. They in no way resemble Ronald Reagan’s words in Berlin or John Kennedy’s speeches in defense of the “free world.”

To read those previous presidential speeches is to see what makes Trump distinctive. Kennedy and Reagan defined “the West” in ideological terms—a world of free elections and free markets. It’s an inclusive view; presumably, any country that adopts these institutions enters that community of nations. For Trump, “the West” is defined by ties of culture and religion. It’s why a government that disdains democratic institutions, like Poland’s, can still stand as a vanguard of Western civilization, and why Muslim immigration is a chief threat to the integrity of Europe. What makes this racial is its relationship to Trump’s other rhetoric. If Western civilization is defined by religion and culture, then Mexico—with its Catholic heritage and historic ties to European monarchies—is unquestionably an outpost of “the West.” But for Trump and his advisers, it too is a threat to the Western order.

Donald Trump went to Europe and, in keeping with his campaign and influences, gave a speech with clear links to white nationalist thought. To pretend otherwise, to ignore the context of this address—to place Trump in a vacuum of history and politics, divorced from his own persona—is, at best, to cross the line into willful ignorance.”

Trump has clearly shown himself to be a person of no values whatsoever. Although his xenophobic, white nationalist/racist agenda appears to be little more that political opportunism — parroting concepts developed by Sessions, Bannon, Miller & company — that doesn’t make it any less problematic — or dangerous.

BREAKING: GOP SENATORS ANNOUNCE PLAN TO TRASH HEALTH CARE FOR 10S OF MILLIONS OF AMERICANS, FUND MORE TAX BREAKS FOR RICH CRONIES! — Why? — Because They CAN!

And it’s not hard to understand why the bill is so unpopular. What’s mystifying is why Republicans insist on passing it, acting as if there won’t be political consequences for a plan that promises pain for tens of millions of Americans.

At Obamacare’s least popular moment, in the fall of 2014, 56 percent of Americans held a negative view of the law, versus 37 percent who approved. Compare that with the Republican version of the AHCA that passed the House of Representatives in early May. In a recent survey from CBS News, 59 percent of Americans disapprove of the GOP proposal, versus 32 percent who approve. A Roper Center analysis shows the proposal with just 29 percent support, making it the most unpopular piece of legislation Congress has considered in decades. And its unpopularity isn’t just a function of blue states like California, New York, and Illinois—there is no state in the union where a majority of voters support the bill.

If the AHCA ends up improving outcomes for Americans—if it delivers affordable health insurance or protects families from medical bankruptcy—it might recover some popularity in the implementation, as was true with the Affordable Care Act, which now has majority support. But we know from the Congressional Budget Office’s evaluation of the House bill that it would increase the number of uninsured by an estimated 23 million people; there are no signs the Senate version will be any less damaging. What’s more, the AHCA may upend the employer health market as well; its deregulatory measures could result in lifetime limits and substantially higher out-of-pocket costs for people who receive insurance through work. The universe of people potentially left worse off by the Republican bill is close to a cross-section of the American public: salaried employees, ordinary workers who rely on the Obamacare exchanges, and the millions of low-income people, children, elderly, and disabled Americans who rely on Medicaid.

Under most circumstances, this would be the ballgame. As a general matter, lawmakers don’t pass hugely unpopular legislation that might harm constituents in such a direct way. It’s easy to say that, for House and Senate Republicans, their “constituents” are those wealthy Americans who receive huge tax cuts under the bill. Still, it’s also true that winning donors isn’t the same as winning elections. Politicians don’t need to value the public interest to reject a bill like the AHCA; a survival instinct should be enough.

Which gets to what’s mystifying about the present situation. If the health care bill becomes law, there’s every indication the Republican Party will suffer for passing it. It is already responsible for a substantial and so-far enduring decline in the president’s approval rating, and it is fueling grass-roots opposition to the already-unpopular Trump administration. If Republicans face an increasingly difficult environment for the 2018 general election, it is at least in part because of the AHCA. And yet, Republicans are intent on passing the bill. Senate Majority Leader Mitch McConnell has cannily adopted an unprecedentedlysecretive process meant to insulate the proposal from criticism and expedite its passage. There have been no hearings and no debate. The plan, as it exists, is for a one-week period of public input before Congress votes.

It’s likely that Republicans know the bill is unpopular and are doing everything they can to keep the public from seeing its contents before passing it. As we saw with the Affordable Care Act, the longer the process, the greater the odds for a major backlash. But this presupposes a pressing need to pass the American Health Care Act, which isn’t the case, outside of a “need” to slash Medicaid, thus paving the way for large-scale, permanent tax cuts. The Republican health care bill doesn’t solve any urgent problem in the health care market, nor does it represent any coherent vision for the health care system; it is a hodgepodge of cuts and compromises, designed to pass a GOP Congress more than anything. It is policy without any actual policy. At most, it exists to fulfill a promise to “repeal Obamacare” and cut taxes.

Perhaps that’s enough to explain the zeal to pass the bill. Republicans made a promise, and there are forces within the party—from hyperideological lawmakers and conservative activists to right-wing media and Republican base voters—pushing them toward this conclusion. When coupled with the broad Republican hostility to downward redistribution and the similarly broad commitment to tax cuts, it makes sense that the GOP would continue to pursue this bill despite the likely consequences.

But ultimately it’s not clear the party believes it would face those consequences. The 2018 House map still favors Republicans, and the party is defending far fewer Senate seats than Democrats. Aggressively gerrymandered districts provide another layer of defense, as does voter suppression, and the avalanche of spending from outside groups. Americans might be hurt and outraged by the effects of the AHCA, but those barriers blunt the electoral impact.

The grounds for political combat seem to have changed as well. If recent special elections are any indication—where GOP candidates refused to comment on signature GOP policies—extreme polarization means Republicans can mobilize supporters without being forced to talk about or account for their actual actions. Identity, for many voters, matters more than their pocketbooks. Republicans simply need to signal their disdain—even hatred—for their opponents, political or otherwise. Why worry about the consequences of your policies when you can preclude defeat by changing the ground rules of elections, spending vast sums, and stoking cultural resentment?

It seems, then, that we have an answer for Republicans insist on moving forward with the American Health Care Act. Because they can. And who is going to stop them?”

Here’s some analysis of the GOP Senate Bill from the Washington Post:

“The Senate proposal largely mirrors the House measure with significant differences, according to a discussion draft circulating Wednesday among aides and lobbyists. While the House legislation would peg federal insurance subsidies to age, the Senate bill would link them to income, as the ACA does.

The Senate measure would cut off expanded Medicaid funding for states more gradually than the House bill but would enact deeper long-term cuts to the health-care program for low-income Americans. It also would eliminate House language aimed at prohibiting federally subsidized health plans from covering abortions, a provision that may run afoul of complex Senate budget rules.

But McConnell faces the prospect of an open revolt from key conservative and moderate GOP senators, whose concerns he has struggled to balance in recent weeks. Republicans familiar with the effort said Senate leaders have more work to do to secure the 50 votes needed to pass the measure, with Vice President Pence set to cast the tiebreaking vote, from the pool of 52 GOP senators. No Democrats are expected to support the bill.

According to two Republicans in close contact with Senate GOP leadership granted anonymity to describe private conversations, McConnell is threatening to bring the bill to a vote next week even if he doesn’t have the votes to pass it. But some believe that message is aimed at trying to pressure Republicans to support the bill, rather than an absolute commitment. A McConnell spokeswoman declined to comment.

Republican aides stressed that their plan is likely to undergo more changes to secure the votes needed for passage, but there were major concerns Wednesday from senators on opposite ends of the GOP spectrum.

“My main concern is I promised voters that I would repeal — vote to repeal Obamacare. And everything I hear sounds like Obamacare-lite,” said Sen. Rand Paul (R-Ky.).

Sen. Shelley Moore Capito (R-W.Va.), whose state expanded Medicaid and has been pushing for a more gradual unwinding of that initiative than many conservatives prefer, said she is waiting to scrutinize what is released but has not seen anything yet that would make her drop her concerns with the proposal.

“Up to this point, I don’t have any new news — tomorrow we will see it definitively — that would cause me to change that sentiment,” she said.

Like the House bill, the Senate measure is expected to make big changes to Medicaid, the program that insures about 74 million elderly and lower-income Americans and was expanded in most states under the ACA. In effect, the revisions would reduce federal spending on the program.

The Senate measure would transform Medicaid from an open-ended entitlement to one in which federal funding would be distributed to states on a per capita basis. The Senate measure would also seek to phase out the program’s expansion — although at a more gradual rate than the House version.

Yet the Senate bill would go further than the House version in its approach to cutting Medicaid funding in the future. In 2025, the measure would tie federal spending on the program to an even slower growth index than the one used in the House bill. That move could prompt states to reduce the size of their Medicaid programs.”

As long as folks stubbornly keep voting for their own demise, that is, against their own best interests, Trump and the GOP are going to take them to the cleaners every time. The GOP Congressional leadership has “bought into” the Trump “Time Square” theory:   “There’s absolutely nothing that we could do that would make these folks vote against us. And, we’re going to take full advantage of them by sticking it to them just like they were Democrats or minorities (or both).”

I suppose if it works, why not line your pockets (and those of your buddies) to the full extent possible at the expense of the People until the party ends (which it might never do — and, if it does, the GOP will be laughing all the way to the bank)?
