His defense of the indefensible went over like a lead balloon with those whose lives have been upended by the radical right Justices’ political agenda!

Every time a GOP politico or media sycophant preferences remarks with “I’m not a racist,” you know that some outrageous racist statement is about to follow. What they are doing is dishonestly attempting to preemptively “shift the blame and focus” to those who call out their vile, dishonest conduct!

Over the weekend, Chief Justice John Roberts, drifted down a similar discredited path of disingenuous “preemptive denial.” In a ludicrously tone deaf statement that echoed Tricky Dick’s “I’m not a crook” speech, Roberts lamely attempted to defend the legitimacy of his Court’s stripping of fundamental human rights from women. In doing so, he basically reinforced critics’ points about the Court’s illegitimate, extralegal, right-wing, political war on individual and human rights with a good bit of misogyny thrown in!

Never mind that the Court basically aligned itself with authoritarian theocrats promoting “forced birth” and overt subjugation of a woman’s fundamental right to decide whether or not to reproduce. Indeed, advancing that minority political agenda was the fundamental reason why Roberts and his GOP crew are on the Court in the first place! To pretend otherwise is off the wall!

There are some strong moral, societal, economic, and  medical arguments to be made about why women should or should not choose to have children. Under the First Amendment, both those who favor abortion and those who oppose it have always been free to argue their points. 

But, the idea that these choices should be removed from those directly concerned and placed in the hands of political and religious authorities is preposterous. Lacking convincing arguments to persuade all women facing that choice to their side, the far right theocracy did a preemptive strike! And, their “wholly-owned Justices” went along!

Needless to say, Roberts’s insultingly disingenuous defense of the indefensible did not fare well with informed critics.

On Sunday, McCaskill – an MSNBC political analyst – tore into Roberts for taking the country backward and recalled that the jurists who signed onto Alito’s originalist rationalization misled the public during their respective Senate confirmation hearings.

“He’s so so out of touch. I mean really, this interview shows why the numbers for the Supreme Court are so bad. For him to say something like that, he just doesn’t get it. You don’t take away a right that’s been around for 50 years and you don’t have a party go to extremes of trying to make sure rape victims have to have forced birth,” McCaskill said.

“You don’t do that and not have it splash back on the Supreme Court,” she continued. “And they all said they respected precedent when they were confirmed. I heard them. America heard them. Clearly, they didn’t, and you can feel me getting angry at John Roberts right now because he knows better when he says that stuff.”

“Roberts’s failure to understand why the court has lost credibility with so many Americans smacks of ‘Let them eat cake,’ ” Joyce White Vance, a former prosecutor and a distinguished professor of the practice of law at the University of Alabama law school, told me. “The Supreme Court has a proud history of defending our rights, not taking them away. The Roberts court will go down in history as the first one” to strip away people’s rights.

University of Michigan law professor Leah Litman said: “I would be embarrassed to say something that naive and divorced from reality if I had said it as a first-year law student. For the chief justice to say it is just an insult to the intellect of everyone who knows anything about the court, American democracy and politics.”

If Roberts and the conservative bloc were to engage in just a tiny amount of self-reflection, they would understand that their own actions have brought them to this point. Law professor Stephen I. Vladeck, of the University of Texas school of law, asked me rhetorically: “If the court’s legitimacy doesn’t come from public acceptance of the principled nature of its decision-making, where does it come from?”

While Roberts might not have written the most egregious opinions, he has joined in them, from the abortion ruling in Dobbs, to the prayer-in-schools ruling in Bremerton, to a Brnovich decision on voting rights, written by Alito, that “blatantly ignored the plain language of the law and rewrote it to fit his partisan and ideological views,” as political scientist Norman Ornstein told me. Moreover, Ornstein said, it is Roberts who has “ignored Clarence Thomas’s blatant conflicts of interest and continues to oppose applying the judicial code of ethics to the Supreme Court, even as its credibility plummets.”

He concluded: “John G. Roberts Jr. is far from the worst justice undermining the fundamental legitimacy of the court, but he is surely culpable.”

The court has failed to regulate itself and instead has abused its power. None of the six right-wing justices acknowledge, nor do they signal they want to halt, the conduct that has lost the public’s confidence.

So it’s up to Congress and the president to shore up the court’s credibility. Allocating more seats to correct the damage done by Sen. Mitch McConnell’s court-packing, imposing term limits on all justices and enacting a mandatory code of ethics would be good places to start.

In this case, Roberts would have done better to confine himself to “calling balls and strikes.” Sadly, he and his GOP colleagues have gotten out from behind the plate and taken the field in their “Federalist Society” uniforms. He’s going to have to learn to live with objections and catcalls from those in the stands who see what’s really going on here and are understandably upset about the Court’s overreach, substandard legal performance, lack of accountability, absence of self-awareness, and, yes, lack of legitimacy.

Better judges for a better, fairer America — from the Immigration Courts to the Supremes! 

By the way, we can’t change the Supremes overnight. But, Biden, Harris, & Garland COULD have reformed, repaired, and legitimized the Immigration Courts, including the BIA, that they control. That they have failed to do so is the biggest “unforced error” of the Biden Administration — one that will haunt Democrats and Americans for ages! 

Every day Garland’s parody of a court system, still largely bearing the unmistakable stamp of White Nationalists Sessions, Barr and Miller, continues to run roughshod over individual rights, often in life or death cases, while degrading the judicial process. Misogyny and racism are also on full display, as a disproportionate brunt of their unprofessional, wrong-headed, result-oriented “any reason to deny” decision-making falls on refugee women of color (and often on their accompanying children).

There is a very direct connection between “DHS agents in robes” in our Immigration Courts and “right-wing politicos in robes” at the Supremes. Part of the idea is to “normalize” injustice directed at “the other” — just so long as YOUR life isn’t directly affected, who cares? It’s also known as “Dred Scottification.”  It’s the “polar opposite” of Dr. Martin Luther King’s observation that “injustice anywhere is a threat to  justice everywhere.” If Dems don’t “connect the dots,” they might not be able to save our democracy!

While corporations are going on life support thanks to this huge government bailout, undocumented immigrants and their families, among them US citizens, are being allowed to suffer, to starve, and, without access to health care, perhaps even to die. As things already stood, undocumented immigrants were ineligible for any federally funded public health insurance programs. On top of that, the millions who have tax IDs, so that they can work without formal authorization, are now denied help in the form of unemployment benefits—they are the only US taxpayers excluded from the coronavirus stimulus package.pastedGraphic.png

It’s also troubling to single out immigrants because of the historic scapegoating of immigrants during other health crises. The historian Alan M. Kraut writes that in the 1830s, Irish immigrants were stigmatized as bearers of cholera, and at the end of the nineteenth century, tuberculosis was dubbed the “Jewish disease.” Scapegoating also obscures a longer thread in a bigger pattern, regardless of which party or administration is in power. According to Professor Viladrich, the American government’s denying assistance to this group of working immigrants is the historic norm.

“A lot of this is related to a labor force that is disposable,” she said. “There is no contradiction here; it is very consistent with ACA, with welfare reform, all of that. The systematic exclusion of immigrants is parallel with the systematic exploitation of immigrants.”

Senator Rand Paul, Republican of Kentucky, lobbied hard to ensure that people without work authorization would be excluded from the CARES Act. On the Senate floor, he spoke against child tax credit going to people without social security numbers:

If you want to apply for money from the government through the child tax credit program, then you have to be a legitimate person… It has nothing to do with not liking immigrants. It has to do with saying, taxpayer money shouldn’t go to non-people.

His office later said he was referring to people who fraudulently claimed a child in order to reap the federal benefit. Whatever he meant by “legitimate person” and “non-people,” the effect was the same: in the eyes of the law, undocumented immigrants would be non-people.

Giorgio Agamben, an Italian philosopher, used the term “bare life” to describe a life reduced to plain biological facts, the robbing of a person’s political existence by those who have the power to define who is included as a worthy human being and who is excluded. While the labor of undocumented people is gladly accepted, their humanity has been tidily erased by lawmakers in Washington, D.C.

The immigration and legal historian Daniel Kanstroom reminds us that in times of trouble, like wars or national emergencies, immigrants are the first to get thrown overboard. It was in part due to the ban on Chinese immigrants back in the late nineteenth century and early twentieth century that the demand for Mexican workers increased dramatically. In his 2007 book Deportation Nation: Outsiders in American History, Kanstroom explained how this ban combined with wartime labor needs in 1917 led to the US government’s systematic recruitment of Mexican workers: “From 1917 through 1921, an estimated 50,000–80,000 Mexican farm workers entered the United States under this program, establishing a legal model and cultural mindset that endured for decades to come.”

Kanstroom cites a line from the 1911 Dillingham Commission, an extensive bipartisan investigation into immigration, that “The Mexican… is less desirable as a citizen than as a laborer.” The precedent was set, and what followed was a cycle of recruitment, restriction, and expulsion. More than one million people of Mexican ancestry were forcibly removed from the United States during the Depression years. Some of the people deported by the government to Mexico were US citizens, but then as now, because of their undocumented relatives, they were subject to the same brutal treatment.

In 1942, as a wartime labor shortage loomed, the US worked out an agreement with Mexico for short-term, low-wage workers to fill in the gap. The Bracero Program, as it was known, continued until 1964, with some 4.5 million Mexican workers legally entering the country during those years. There were enormous contradictions in the way those workers were treated: ad hoc legalization programs designed to help big farmers took place at some times; then, at others, there were huge deportation drives when the demand for labor fell off—most notoriously, the terrifying round-ups of 1954’s so-called Operation Wetback.

According to the scholar of migration Nicholas De Genova, “It is precisely their distinctive legal vulnerability, their putative ‘illegality’ and official ‘exclusion,’ that inflames the irrepressible desire and demand for undocumented migrants as a highly exploitable workforce—and thus ensures their enthusiastic importation and subordinate incorporation.” It is no mistake that there remain millions of “illegal” workers of Latino ethnicity contributing their labor, taxes, and humanity to this country; it suits America very well in the good times, and always has.

Under federal immigration law, noncitizens cannot receive a green card if the government believes that they are likely to become reliant on government assistance. The dispute now before the court arose last year, after the Trump administration defined “public charge” to refer to noncitizens who receive various government benefits, such as health care, for more than 12 months over a three-year period. The challengers had argued that the rule is “impeding efforts to stop the spread of the coronavirus, preserve scarce hospital capacity and medical supplies, and protect the lives of everyone in the community” because it deters immigrants from seeking testing and treatment for the virus out of fear that it will endanger their ability to obtain a green card. The federal government countered that it has made clear that the use of publicly funded health care related to COVID-19 “will not be considered in making predictions about whether” immigrants are likely to become a public charge.

The Government’s argument doesn’t pass the “straight face” test. The monetary savings from this rule are minuscule; its overriding purpose was to dump on immigrant families and intimidate ethnic, primarily Hispanic, communities. It was the “brainchild” of neo-Nazi Stephen Miller. What greater proof could there be of its White Nationalist purpose? Given the regime’s well-established record of lies and unbridled hostility toward immigrants and communities of color, why would anyone have confidence in the regime’s often hollow or disingenuous “promises?”

Those of us who believe in honoring our immigrant heritage, making our constitutional guarantees reality rather than unfulfilled promises, that human values, empathy, and kindness matter, and that we can and must do better than shallow, often outright evil, folks like Trump, Miller, Cuccinelli, Roberts, Barr, et al. need to retake our Government at the ballot box this November and build a better, fairer, more humane future for America and all persons in our country.

Most Americans Want Undocumented Immigrants To Be Able To Stay Legally

The majority of Americans believe it is important for the U.S. to establish a way for most undocumented immigrants in the country to remain here legally, a new study has found.

The revelation from the Pew Research Center’s findings, which were published on Tuesday, comes as the Supreme Court deliberates over whether the Trump administration can legally end the Deferred Action for Childhood Arrivals (DACA) program.

Under the DACA program, nearly 800,000 undocumented immigrants brought to the U.S. by their parents have been allowed to live and work in the country.

However, the Trump administration has sought to bring the program to an end, a bid which was temporarily blocked by courts and which will now be brought before the Supreme Court this week.

According to the Pew Research Center’s findings, two-thirds of Americans (67 percent) said it was “very or somewhat important” for the U.S. to establish a way for “most immigrants in the country illegally to remain her legally.” 

While support for a pathway for undocumented immigrants to remain in the U.S. fell largely along party lines, nearly half (48 percent) of Republican and Republican-leaning participants said they were in favor of the idea. 

Meanwhile, 82 percent of Democrats and Democratic-leaning independents said they felt it was an important goal. 

In addition to establishing a route for most undocumented immigrants to be able to remain in the U.S., Americans also expressed support for taking in refugees fleeing war and violence.

Seventy-three percent of the 9,895 respondents who were surveyed between September 3 and 15 said they felt it was important for the U.S. to take in refugees, with Republicans showing greater support for that goal than in previous years. 

In 2016, Pew said, just 40 percent of Republicans identified admitting refugees as an important initiative. This year, however, a majority of Republicans (58 percent) said they supported that goal.

While the majority of Americans were in favor of both of the above initiatives, they also expressed support for strengthening security along the U.S.-Mexico border, with 68 percent of participants in favor of that goal. 

Around 9 in 10 Republicans (91 percent) said they were in favor of increasing security at the border, while about half of Democrats and Democratic-leaning respondents (49 percent) said they believed it was an important bid. 

The apparent divide between Republicans and Democrats is also significant when it comes to increasing deportations of immigrants unauthorized to be in the U.S. 

Roughly eight-in-ten Republicans (83 percent) said they were in favor of increasing deportations, including 51 percent who identified that initiative as “very important.”

Meanwhile, among Democrats, support for that bid was much lower, with around just three-in-10 (31 percent) in favor of boosting deportations and only 10 percent calling it a “very important” goal.” 

Despite what the American public thinks, the decision on whether DACA is allowed to move forward currently sits in the Supreme Court’s hands. 

Justices will be deliberating on whether federal courts should have been able to block the Trump administration’s decision to end the program—and whether Trump had the legal right to end it in the first place. 

If the program does come to an end, the thousands of people who benefit the program, as well as the many who might have applied for DACA protections in the future could face deportation from the U.S. 

In an interview with Newsweek on Monday, Carolina Fung Feng, a DACA recipient and plaintiff in one of the cases before the Supreme Court, said that if the Supreme Court rules in the Trump administration’s favor, she could lose her job and be deported back to a country that she left when she was 12-years-old. 

“I’d be separated from my family here in New York and, also, I would lose the ability to be independent,” Feng said. “Right now, I live on my own with my younger brother, so if they were to eliminate the DACA program permanently I wouldn’t be able to help my brother pay for the house.”

Feng, who is now 30 and works in the U.S. helping adult learners earn their high school equivalency diplomas, said she cannot understand why the U.S. government would want to see the country lose a population that has contributed to the country’s economy and strengthened its local communities. 

“We contribute to this economy. We haven’t done anything wrong,” she said. “We’re just human beings who want to live a better life and we want to protect our families and do the best we can so they can have a better life.”

A majority of the Supremes appear ready to “go along to get along” with the latest move by the Trump Administration to screw, demean, and dehumanize undocumented American young people who are continuing to contribute to our society.

A Court that not so long ago had little trouble treating inanimate and amoral large corporate interests as “persons” under the Constitution appeared to have no such concerns for the rights and dignity of a large class of human beings actually living, working, and studying in America.

By either agreeing with the bogus legal argument half-heartedly presented by the Solicitor General or saying Trump could act for no particular reason other than his White Nationalist political agenda, the Supremes appeared willing to allow young people to be held hostage for an extreme nativist anti-immigrant legislative program.

Trump gave his usual “off-the-wall tweet.” First, he smeared so-called “Dreamers” as containing among their ranks “tough, hardened criminals” (even though such individuals were specifically excluded from the program by the Obama Administration). At the same time, he said that if his Supremes gave him what he demanded he would cut a “deal” with the Dems for Dreamer relief. We’ve heard that before.

That’s highly unlikely to happen without regime change in the Executive and the Senate. Similar to the last failed exercise, the Trump Administration would almost certainly demand an end to refugee and asylum programs, sharp cuts to legal immigration, massive new funding for the New American Gulag, and a free hand to summarily deport almost anyone without due process in return for even limited Dreamer relief. That’s a “deal” the Dems aren’t going to make.

Therefore, most Dreamers likely will continue to “twist in the wind” for another election cycle and perhaps longer. With Immigration Court backlogs at an astounding 1.3 million and growing, they won’t be forcibly removed any time in the near future, even if Trump wins re-election. 

On the other hand, deprived of work authorization and “color of law” status, most will face obstacles to legal employment or study in the U.S. This will leave them with the “choice” of “going underground” or “self-deportation.” Either way, America will be deprived of the full potential of some of our most talented and dedicated younger generation.

Of course, I hope that my gloomy analysis is wrong. But, things are sure looking like another avoidable judicially-enabled nightmare in a nation that has empowered a White Nationalist minority to run roughshod over individual rights with judicial complicity.

I would expect the Supreme majority’s decision to be  loaded with some disingenuous and self-serving references as to how disputes like the fate of the Dreamers should be determined by the “political system.” Then, it will be good to remember that this is a Court that has chosen to take a “pass” on partisan gerrymandering and other gimmicks used by the GOP and the Trump Administration to disenfranchise racial minorities, suppress the vote, and circumvent true democratic rule. In other words, the Supremes know full well that the “political system” is broken to a large extent because they have helped enable its demise.

That’s why it’s important for the New Due Process Army and others who believe in the Constitution, the rule of law, and basic human decency to get out the vote, remove the GOP across the board, and pave the way for better, more intellectually honest judges, who will uphold individual rights and true Constitutional values rather than siding with the tyranny of an unrestrained, unprincipled Executive and inanimate corporate interests in derogation of human rights. 

Obviously, there are lots of folks out there, even among the GOP, who don’t “buy in” to Trump’s unrelenting cruelty toward migrants (except, I guess, those migrants he marries and their foreign-born families). The Dems shouldn’t be afraid to run on a program of Dreamer relief combined with other practical, common sense reforms that would allow us to “rationalize” the inevitable and largely positive forces of human migration. We could actually be “beefing up” our revenue collections with a sane immigration policy, rather than hemorrhaging billions on cruel, inhumane, and ultimately futile “enforcement only” schemes and gimmicks. And, yes, with a more rational and realistic system in place, including for the processing of legitimate refugees and asylees, removal of those who evade it would become more efficient, effective, and uniform than it is under our current broken system, at least as administered by the Trump Administration.
