Please join me in congratulating Immigration Clinic student-attorney Gisela Camba, and her clients M-A and K-C, from Honduras.  This afternoon, after a three-hour hearing, Immigration Judge Robert P. Owens granted the clients’ asylum application.

K-C, then fourteen years of age, was accosted and threatened three times by a gang member while walking to school.  The gang member threatened to kidnap her, if she didn’t go with him voluntarily, and then kill her and her family.  After the third threat, her Mom, M-A, fled with her to the USA.  K-C, now sixteen, testified that around that time a girl in her neighborhood had been kidnapped by gang members and never heard from again.

Congratulations also to Sameen Ahmadnia, Dalia Varela, Sarah DeLong, Jonathan Bialosky, and Rachael Petterson, who previously worked on this case.

OFFICE OF IMMIGRATION LITIGATION (“OIL”) AT CENTER OF SEXUAL HARASSMENT SCANDAL AT DOJ! — Serious Problems Fester At Justice!

“Some of the most troubling allegations, Horowitz said, have been in the Justice Department’s Civil Division. His office examined the handling of those allegations, which occurred several years ago, after receiving a complaint that the Office of Immigration Litigation had not properly disciplined an attorney who had committed sexual misconduct.

In his report, the IG wrote that a senior, supervisory attorney in the Office of Immigration Litigation, Victor Lawrence, groped the breasts and buttocks of two female trial attorneys and made sexually charged comments to them at an office happy hour. Lawrence, whose name was redacted from the report but who was identified by people familiar with the incidents, had previously received a reprimand and diminution of title for sending emails of a sexual nature to co-workers.

After the second incident with the two women, Lawrence began a scheduled detail to another division “apparently with no notice to the component of the misconduct allegations,” the inspector general wrote. After the groping allegations were investigated, Lawrence received a written reprimand for inappropriate touching, a further change in title and relief from supervisory duties.

The IG noted that Lawrence received no suspension or loss in pay or grade. The deciding official in the Civil Division said a suspension “would unnecessarily deprive the government of [his] litigating services,” according to the report.

“I was terrified I was going to get in the elevator and he would be in there,” said a woman who was involved in one of the groping incidents.” The Post does not identify victims of sexual misconduct without their agreement.

Horowitz’s report also concluded that this case “presented potential criminal assault violations, yet we found no evidence in the case file that a referral was made to the [Inspector General] or any other law enforcement entity.”

Another senior attorney in the Office of Immigration Litigation admitted stalking a female attorney by hacking into her personal email account and conducting “a catfishing operation,” by creating a “fictitious online profile to entice her,” the inspector general found.

The attorney, Theodore Atkinson, who received a written reprimand and reduction in title, was restricted for one year from entering the building in which the attorney he had stalked worked and was moved to a different section in the Civil Division. But he received no suspension or loss in pay or grade.

The IG said this case also “raises potential criminal concerns, yet we found no evidence that a referral was made to [the Inspector General] or any other law enforcement entity,” the report said. Atkinson’s name was redacted from the report, but he was also identified by people familiar with the matter.

Atkinson was recently given a “Special Commendation Award from the Civil Division.”

Neither Atkinson or Lawrence responded to requests for comment.

A third attorney, even after being counseled about inappropriate behavior toward female co-workers and interns, allegedly “peered” through high windows into the offices of two different women who had closed their doors while they were pumping breast milk, according to an IG report. The attorney caught peeping told his supervisor that it was “an honest mistake,” an explanation the supervisor accepted, the IG report said. The matter was not fully investigated, the inspector general found, and the attorney was verbally counseled. He is still working in the Office of Immigration Litigation. His alleged behavior became such an issue that some women at the Justice Department have taped wrapping paper over the windows outside their offices.

All three Civil Division attorneys received performance awards after their misconduct, the report said.

“I’m shocked and really disappointed,” said a female attorney with knowledge of the incidents who spoke on the condition of anonymity because she was not authorized to speak to a reporter. “They got free passes. They got awards. They got to continue with their careers. It sounds like nothing is going to be done.”

Justice spokesman Prior said the department “does not discuss specific employee disciplinary actions or comment on personnel actions or matters that may impact personal privacy.”

“That said, the department was very disappointed with the issues that occurred in the previous administration and strives for a workplace free of harassment and other misconduct for all of our 115,000 employees,” he said. “That is why the Civil Division has implemented additional safeguards and systems to ensure that all misconduct allegations are handled appropriately going forward.”

These problems largely predate Sessions. But, perhaps he needs to spend less time doing DHS’s job of immigration enforcement and more time straightening out the mess in his own Department.

Franken could and should have saved himself, his victims, his party, his Congress, and the public from unnecessary, distracting melodrama and trauma by doing “the right thing” right off the bat.

When will Democrats finally stop shooting themselves in the foot by acting like Republicans when caught red-handed in inappropriate and indefensible situations? Yeah, we live in the age of Trump and the spineless, captive, immoral GOP.

But, if Dems want to offer a “better alternative,” they need to start acting like it. Neither the Franken nor the Conyers debacles are encouraging signs. But, give Senator Kirsten Gillibrand (D-NY), Sen. Kamala Harris (D-CA), and other Democratic women Senators lots of credit for getting the ball rolling in the right direction, after the so-called “men” in their party failed.

“We now address, under the substantial evidence standard, the question of whether Kamar will be persecuted by threat of death if she returns to Jordan, which is relevant to both withholding under the Act and relief under the Convention. Kamar testified at the merits hearing that her cousins, specifically Alias, want to restore their family’s honor by killing her, and her sister confirmed this. She knows this because of letters she received and communications with family and friends. The Board expressly found Kamar to be credible. On remand, the IJ concluded the letter from Alias was not credible and did not facially threaten Kamar. The IJ reasoned that even if it was credible, there was no indication that Alias knew that Kamar had gotten married and might not want to kill her anymore. The IJ found that the intent to kill Kamar was expressed only through an “ambiguous” comment in the letter from Kamar’s mother. The Board agreed that Kamar did not establish that her fear of persecution was objectively reasonable. The probability of harm occurring in these cases is an inference based on facts in the record. Considering the evidence, it is hard to reconcile these findings with the Board’s conclusion that even if Kamar had a subjective fear of persecution, this fear was not objectively reasonable. There is nothing to cast doubt on Kamar’s testimony. Even if the letter from Alias is not considered, the letter from Kamar’s mother states that Alias wishes to kill Kamar even if it is his last act on earth, and credible testimony confirms this. Nothing indicates that Alias does not still intend to carry out the honor killing. Both Kamar and her sister testified that it did not matter that Kamar married her second husband because Alias knows that she had sexual relations outside of marriage and believes that she committed adultery. The record overwhelming supports the finding that she will be persecuted if she returns.

Finally, we consider whether the Jordanian government would be “unwilling or unable” to protect Kamar from harm. In the country reports in the record, it has been established that governors in Jordan routinely abuse the law and use imprisonment to protect potential victims of honor crimes. These victims are not released from imprisonment unless the local governor consents, the victim’s family guarantees the victim’s safety, and the victim consents. One non-governmental organization has provided a temporary, unofficial shelter as an alternative.

On the other hand, successful perpetrators of honor killings typically get their sentences greatly reduced. Additionally, if the victim’s family, who is usually the family of the alleged perpetrator as well, does not bring the charges, the government dismisses the case. See also Sarhan, 658 F.3d at 657 (“After reviewing the evidence of the Jordanian government’s treatment of honor crimes, we conclude that . . . the government is ineffective when it comes to providing protection to women whose behavior places them in the group who are threatened with honor killings.”).

The Board’s decision outlined the Jordanian government’s efforts to combat honor crimes, including placing potential victims in “protective custody.” As the Ninth Circuit concluded in an analogous case, “This observation omits the fact that such protective custody is involuntary, and often involves extended incarceration in jail.” Suradi v. Sessions, No. 14-71463, 2017 WL 2992234, at *2 (9th Cir. July 14, 2017). While victim protection is necessary, incarceration is an insufficient solution. This practice is akin to persecuting the victim as she “must choose between death and an indefinite prison term.” Sarhan, 658 F.3d at 659. Further, nothing in the record suggests that the country conditions in Jordan have changed such that the government will be able to adequately protect Kamar from being killed. This showing satisfies both of the standards for finding governmental action for purposes of withholding of removal under the Act and also those for protection under the Convention, as it amounts to “pain or suffering” that is inflicted with the acquiescence of a public official or a person acting in an official capacity.

We do not address whether Kamar can safely relocate to escape persecution, which is also relevant to withholding of removal and protection under the Convention. The Board did not mention relocation, and the parties’ briefs do not address the issue. Like the particular social group inquiry, the issue of safe relocation must be addressed in the first instance by the Board. Gonzales v. Thomas, supra.

Substantial evidence does not support the Board’s refusal to find that Kamar will probably be persecuted if she is returned to Jordan, due to her membership in the particular social group we discussed, or that the Jordanian government can or will do nothing to help her. The Board’s decision with regard to those issues is reversed.

The Seventh Circuit has found that the Jordanian government’s “solution” to protect honor killing victims is actually a form of punishing the victims of these crimes amounting to mental “pain or suffering,” which is “inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.” 8 C.F.R. § 208.18(a)(1); see Sarhan, 658 F.3d at 659. Taking into account our reasoning and findings above on the factors relating to both withholding of removal under the Act and protection under the Convention, we agree that “[d]espite the contrary conclusion of the Immigration Judge and the Board, the record here also compels the conclusion that the government of Jordan acquiesces to honor killings.” Suradi, 2017 WL 2992234, at *1.

Given the likelihood that Kamar would be subject to involuntary imprisonment at the hands of the Jordanian authorities, resulting in mental pain and suffering, the Board erred in concluding that Kamar failed to establish that it was more likely than not that she would be tortured upon removal to Jordan. We grant the petition with respect to the Board’s reasoning under the Convention.“

This should have been an easy withholding grant by the Immigration Judge. Indeed, the 6th Circuit characterized the evidence of persecution as “overwhelming.”

Instead the BIA and the Immigration Judge spent literally years passing the case back and forth and still got it wrong! No wonder the system is backlogged when judges at both the trial and appellate levels get the law requiring protection wrong time after time! How would an unrepresented individual have any chance of vindicating her rights in a system this complicated and screwed up! Skewing the system as this Administration has done to make it more difficult for individuals to get effective representation is a direct attack on due process.

Instead of making a conscientious effort to fix this system to provide due process, Sessions’s clear xenophobia and his anti-immigrant, anti-refugee rants encourage  Immigration Judges and BIA Appellate Judges to treat asylum applicants unfairly and misapply the law to deny protection.

There will be no true due process and justice for migrants until the politicized DOJ and this highly biased Attorney General are removed from control of our US Immigration Court system! How would YOU like to be on trial for your life in a court system controlled by Jeff Sessions?

Within months, she had been brutally beaten and raped by the gang leader, who declared her his property. The attack meant she could finally return to the US and prove her asylum case.

Almost 10 months after returning, she is free, but only after struggling against immigration laws that weren’t written with victims like her — a target of an international criminal gang — in mind, and that make it nearly impossible for someone who has been deported to ever gain asylum. It took three tries to gain asylum, three times paying smugglers to take her on the dangerous journey across the border; finally in August, a judge blocked her deportation under an international treaty typically used to give criminal snitches sanctuary for their cooperation. But even that didn’t end things: The Trump administration made her wait in jail nearly a month before agreeing to not appeal her case.

Nancy Oretskin, the Salvadoran woman’s attorney and the director of the Southwest Asylum & Migration Institute, says changes to asylum law are needed to eliminate a perverse incentive for persecuted people to wait until they are tortured or raped before coming to the United States. “We can’t give them legal protection until they’re raped,” Oretskin said. “And even then, we deport many of them after they’ve been raped, and they’re killed. How does that happen in a civilized society?”

Change is unlikely under the current administration. A few months after President Trump was sworn in, Attorney General Jeff Sessions issued new guidance to Department of Justice attorneys that emphasized the need to use prosecutions to “further reduce illegality” and that instructed them to pursue more criminal charges against undocumented immigrants.

This illustrates the ugly results of immigration policies pushed by Trump, Sessions, Miller, and tone deaf GOP Legislators like Rep. Bob Goodlatte.  They are part of the outrageous Trump Immigration ”Deform” Program drafted by Miller. And this unholy and inhumane group seeks to make things even worse for scared asylum applicants like this. They should be held morally accountable for their behavior, even if they can’t be held legally responsible for the gross abuses of human rights they promote. They seek to turn the U.S. legal system into a major human rights violator. And, it’s not that some of these practices didn’t originate during the Obama Administration. Trump and his White Nationalist cronies have just tripled down on pre-existing abuses.

In fact, many of the women being imprisoned in the American Gulag then turned away are either entitled to asylum or would be if the DOJ-controlled BIA had not intentionally distorted asylum law to deny them protection. In any event, almost all of them should be offered protection under the mandatory Convention Against Torture. TPS or some other form of prosecutorial discretion would also be potential solutions.

But, sending young women back to be tortured and raped, the Trump Administration’s “solution,” is not acceptable.

“So, President Donald Trump is supposedly upset that a woman played his White House press secretary on “Saturday Night Live” last weekend.

Politico is reporting that seeing Sean Spicer depicted by a thunderous Melissa McCarthy bothered the president so much, particularly because he “doesn’t like his people to look weak.” Spicer himself said that he thought McCarthy “could dial back” the impression. The impression clearly bothered them both.
As a result, people have been excitedly starting to call for more women to play the men in Trump’s administration, hoping to further injure the president’s always sensitive ego, and maybe cause some behind-the-scenes drama.
Rosie O’Donnell, a longtime critic of the president, has already said she would be willing to play Trump adviser Steve Bannon if called upon by Lorne Michaels. To which we say: Why stop there? It’s time for “SNL” to throw the entire administration into a gigantic hissy fit by having women play them all.

To help out the people over at “SNL,” we decided to do a bit of the casting work for them, just so they can think about it. Look, “SNL” can do what it wants. But if what it wants is to create an existential crisis at the White House, it should do this.”
