LEGISLATION: SENATORS GRAHAM & DURBIN TAKE ANOTHER SHOT AT A BIPARTISAN DREAM ACT! — “When they write the history of these times, I’m going to be with these kids.”

https://www.theguardian.com/us-news/2017/jul/20/trump-undocumented-immigrants-dream-act-congress

Sabrina Siddiqui reports for The Guardian:

“A top Republican senator has challenged Donald Trump to make “a moral decision” on the fate of hundreds of thousands of undocumented immigrants brought to the US as children, part of a revamped bipartisan push to grant permanent residency to so-called Dreamers.

“The moment of reckoning is coming,” South Carolina senator Lindsey Graham warned the president and his Republican colleagues at a press conference Thursday to unveil a new iteration of legislation known as the Dream Act.

Graham was joined by Illinois senator Dick Durbin, the Democratic cosponsor of the bill who first introduced legislation of the same name 16 years ago. Their proposal, which mirrors previous legislation that failed to pass Congress multiple times, would grant legal status and a path to citizenship to Dreamers if they were longtime residents of the US.

In a sign of tough odds facing the bill, the White House swiftly rejected the notion that the president would support such a measure.

“The administration has opposed the Dream Act and we are likely to be consistent in that,” said Marc Short, the White House legislative affairs director, in an off-camera briefing with reporters on Wednesday.

Graham acknowledged the president’s candidacy was rooted in a hardline approach to immigration but cast the debate as an existential question for the party that now controls the White House and both chambers of Congress.

“President Trump, you’re going to have to make a decision,” Graham said. “The campaign is over.”

“The question for the Republican party is, what do we tell people? How do we treat them?” he added. “Here’s my answer: we treat them fairly. We do not pull the rug out from under them.”

. . . .

An emotional Graham said he first became engaged on the issue of immigration at the request of his close friend John McCain, the Arizona senator who made public on Wednesday his diagnosis with brain cancer.

Graham said he spoke with McCain three times by phone on Thursday morning, in which his closest ally’s message amounted to: “No more ‘woe is me’.”

“He is yelling at me to buck up,” Graham said. “So I’m going to buck up.”

“I’ve stopped letting 30% of the people who are mad about immigration to determine how I behave … When they write the history of these times, I’m going to be with these kids.”

Senator Graham makes an excellent point. When the history of these times is written, long after we’re all gone, folks like Donald Trump, Mike Pence, Jeff Sessions, Steve Bannon, Steve Miller, Kris Kobach and many others, primarily from the GOP, are going to look every bit as bad as they actually are. And their supporters aren’t going to look good to future generations either.  Being on the wrong side of history is always a bad idea.

COUNTING ON THE FEDERAL COURTS TO SAVE US FROM TRUMP’S EXCESSES? — Not So Fast — Trump Is Rapidly Reshaping Them In His Own Image, And The Results Will Be Felt For Decades After He Leaves Office — “Polemicists In Robes!”

https://www.washingtonpost.com/opinions/the-one-area-where-trump-has-been-wildly-successful/2017/07/19/56c5c7ee-6be7-11e7-b9e2-2056e768a7e5_story.html?utm_term=.cc543104398a

Ronald A. Klain writes in the Washington Post:

“Progressives breathed a sigh of relief recently when Justice Anthony M. Kennedy decided to remain on the Supreme Court for presumably at least one more year. But no matter how long Kennedy stays, a massive transformation is underway in how our fundamental rights are defined by the federal judiciary. For while President Trump is incompetent at countless aspects of his job, he is proving wildly successful in one respect: naming youthful conservative nominees to the federal bench in record-setting numbers.

Trump’s predecessors all slowly ramped up their judicial nominations during their first six months in office. Ronald Reagan named Sandra Day O’Connor to the Supreme Court and made five lower-court nominations in that period; George H.W. Bush made four lower-court nominations; Bill Clinton named Ruth Bader Ginsburg to the high court but no lower-court judges; and George W. Bush named four lower-court judges who were processed by the Senate (plus more than a dozen others sent back to him and later renominated). The most successful early actor, Barack Obama, named Sonia Sotomayor to the Supreme Court and nine lower-court judges who were confirmed.

What about Trump? He not only put Neil M. Gorsuch in the Supreme Court vacancy created by Merrick Garland’s blocked confirmation, but he also selected 27 lower-court judges as of mid-July. Twenty-seven! That’s three times Obama’s total and more than double the totals of Reagan, Bush 41 and Clinton — combined. For the Courts of Appeals — the final authority for 95 percent of federal cases — no president before Trump named more than three judges whose nominations were processed in his first six months; Trump has named nine. Trump is on pace to more than double the number of federal judges nominated by any president in his first year.

Moreover, Trump’s picks are astoundingly young. Obama’s early Court of Appeals nominees averaged age 55; Trump’s nine picks average 48. That means, on average, Trump’s appellate court nominees will sit through nearly two more presidential terms than Obama’s. Many of Trump’s judicial nominees will be deciding the scope of our civil liberties and the shape of civil rights laws in the year 2050 — and beyond.

How conservative are Trump’s picks? Dubbed “polemicists in robes” in a headline on a piece by Slate’s Dahlia Lithwick, Trump’s nominees are strikingly . . . Trumpian. One Trump nominee blogged that Kennedy was a “judicial prostitute” for trying to find a middle ground on the court, and said that he “strongly disagree[d]” with the court’s decision striking down prosecution of gay people under sodomy laws. Another equated the Supreme Court’s decision in Roe v. Wade, upholding a woman’s right to choose to have an abortion, to the court’s 19th-century Dred Scott finding that black people could not be U.S. citizens. Another advocated an Alabama law that denied counsel to death-row inmates.

Progressives who are increasingly counting on the federal courts to be a bulwark against Trump’s initiatives will increasingly find those courts stocked with judges picked by, and in sync with, Trump. With federal judges serving for life, one might think that the process of dramatically changing the makeup of the federal judiciary would take a long time. But given Trump’s unprecedented pace, in just one more year, one-eighth of all cases filed in federal court will be heard by a judge he appointed.

With the abolition of the filibuster, Trump’s nominees need only the votes of Republican senators to win confirmation. Yes, if Kennedy resigns and Trump nominates someone who might overturn Roe v. Wade, pro-choice Republicans could balk; and a few of Trump’s most outrageous lower-court nominations might be unnerving enough to attract GOP opposition. But the reality is that most of Trump’s rapid-fire, right-wing, youthful lower-court nominations are poised to make it to the bench. ”

If you want to have a say in the shaping of the Federal Judiciary, you have to win the White House, the Senate, or, like the GOP did, both. Elections have consequences, particularly for the losers.

THE CUT: SESSIONS UNDER FIRE FOR SPEECH TO ANTI-LGBT GROUP!

https://www.thecut.com/2017/07/jeff-sessions-speech-anti-lgbtq-hate-group-alliance-defending-freedom.html?utm_source=Sailthru&utm_medium=email&utm_campaign=Cut%2520-%2520July%252013%252C%25202017&utm_term=Subscription%2520List%2520-%2520The%2520Cut%2520%25281%2520Year%2529

Claire Landsbaum reports:

“Attorney General Jeff Sessions is being criticized for delivering a speech to an anti-LGBTQ hate group. On Tuesday night he addressed the Alliance Defending Freedom, a Christian law firm that advocates against LGBTQ rights, but the Justice Department won’t release his remarks, according to ABC.

The event reportedly aimed to “bring together prominent legal advocates, scholars, cultural commentators, business executives and church leaders to examine the current state of religious freedom,” and “develop legal and cultural strategies to allow freedom to flourish in the United States and around the world.” A spokesperson for the Alliance Defending Freedom said it was “working through channels” to release Sessions’s remarks at the gathering.

The ADF was classified as a hate group by the Southern Poverty Law Center in 2016; according to the center’s website, the ADF “is a legal advocacy and training group that specializes in supporting the recriminalization of homosexuality abroad, ending same-sex marriage, and generally making life as difficult as possible for LGBT communities in the U.S. and internationally.” This characterization doesn’t sit well with the ADF, which recently published a column defending its ideology.

Sessions’s voting record as an Alabama senator was generally in line with the ADF’s stances — for example, he supported a constitutional ban on same-sex marriage; voted against adding sexual orientation and gender identity to categories protected against hate crimes; and voted against repealing the military’s “don’t ask, don’t tell” policy. But although his attendance at an event involving the ADF isn’t surprising, some LGBTQ advocates are worried about the message it sends.

Wisconsin Senator Tammy Baldwin, who’s the first openly gay person elected to the U.S. Senate, told ABC it “sends a very troubling message that our attorney general, America’s top law-enforcement official, is not committed to standing up to anti-LGBT hate.”

Think The Federal Courts Are Going To Save Our Republic From Trump? — Guess Again! — Trump (Or, More Accurately The Heritage Foundation) Is About To Remake Them In His Own Image!

http://www.huffingtonpost.com/entry/trump-judicial-nominees-federalist-society_us_59497166e4b04c5e50256f0c?lq

HuffPost reports:

“WASHINGTON ― Most days, it seems like President Donald Trump is sabotaging his own agenda, one tweet at a time. But the White House has been quietly plowing ahead in one area that will affect generations of people: the courts.

Trump is unbelievably well-positioned to fill up federal courts with lifetime judges. He inherited a whopping 108 court vacancies when he became president ― double the number of vacancies President Barack Obama inherited when he took office.

The reason Trump gets to fill so many seats is partly because Obama was slow to fill court vacancies early in his tenure. But the main reason is Republicans’ years-long strategy of denying votes to Obama’s court picks. They refused to recommend judicial nominees, filibustered others, used procedural rules to drag out the confirmation process and, by Obama’s final year, blocked nominees they had recommended just to prevent him from filling more seats.

ALISSA SCHELLER/HUFFPOST

Court vacancies have only increased since Trump took office, as older judges have steadily retired. Trump has already nominated more than three times as many judges as Obama had at this point in his presidency ― 21 compared with six for Obama.

With Republicans in control of the Senate, Trump’s court picks will have a relatively easy time getting confirmed, too. The chairman of the Judiciary Committee, Sen. Chuck Grassley (R-Iowa), has hinted that he may tweak the committee’s rules to make it easier for Republicans to advance some of Trump’s nominees without Democratic support. And once nominees make it to the Senate floor, it takes only 51 votes to advance their nominations and confirm them. There are 52 Republicans, which means they could confirm all of Trump’s district and circuit court nominees without a single Democratic vote.

It used to take 60 votes to advance district and circuit court nominees, but Senate Democrats changed the filibuster rule in 2013 in order to get around a Republican blockade on Obama’s court picks. Now Trump benefits from that change.

It is, in effect, the perfect combination of factors for conservatives eager to tilt the nation’s courts to the right. Trump has piles of seats to fill, a list of nominees recommended to the White House by outside conservative groups, and a Republican Senate eager to confirm them.

“It is a huge opportunity,” said Carl Tobias, a University of Richmond law professor who specializes in judicial nominations. “The question is how quickly they will move in the future. A lot of what they’ve done so far is low-hanging fruit and pretty easy to do.”

ALISSA SCHELLER/HUFFPOST

A good chunk of Trump’s judicial nominees so far have come through recommendations from The Federalist Society, a right-wing legal organization. Its executive vice president, Leonard Leo, was instrumental in helping the White House put Neil Gorsuch on the Supreme Court. He recommended Gorsuch to Trump last fall and took a temporary leave from his job earlier this year to help prepare Gorsuch for his Senate confirmation hearing.

Leo also gave Trump a list of names of potential judicial picks that conservatives would like to see on the federal bench. Trump has already nominated several of them.

One of them is John Bush, a Kentucky lawyer who runs a local chapter of The Federalist Society. Trump nominated Bush, 52, last month to a lifetime post on the 6th U.S. Circuit Court of Appeals. Progressive groups are vowing to fight his confirmation given some of his past remarks, which include comparing abortion to slavery and referring to them as “the two greatest tragedies in our country.” Bush has also said he strongly disagrees with same-sex marriage, mocked climate change and proclaimed “the witch is dead” when he thought the Affordable Care Act might not be enacted.

Damien Schiff, also a member of The Federalist Society, is Trump’s nominee to the U.S. Court of Federal Claims. The 37-year-old attorney at the conservative Pacific Legal Foundation would serve a 15-year term if confirmed. He came under fire for calling Supreme Court Justice Anthony Kennedy “a judicial prostitute” on a blog several years ago. He has also criticized efforts to prevent bullying of LGBTQ students, referring to messages of equality as “teaching ‘gayness’ in schools,” and has argued that states should be allowed to criminalize “consensual sodomy.”

Both of those nominees had their Senate confirmation hearings last week. They’re now waiting for the Judiciary Committee to reconvene and vote out their nominations.

It’s not unusual for a president to consult with outside groups for potential judicial nominees. What’s different, says Tobias, is how heavily Trump seems to be relying on this particular group versus working directly with senators for judicial recommendations from their states, which is the standard path.

“I think Leonard Leo is just feeding him those people,” he said. “There are real questions about that, whether that’s good for the courts and gets us the finest nominees.”

Remember, folks, these are lifetime appointments, so although, one way or another, Trump will eventually be gone, his judges will be around for decades. And, because Democrats can’t win Senate elections, they have lost their power to exert any influence whatsoever over Trump’s choices.

Sessions Likely To Take Heat For Role In Comey Firing After Recusal!

http://www.cnn.com/2017/06/12/politics/jack-reed-attorney-general-jeff-sessions-cnntv/index.html

CNN reports:

“(CNN)A Democratic senator who will question Attorney General Jeff Sessions at tomorrow’s Senate intelligence committee hearing wants to know why he was involved in the decision to fire former FBI director James Comey after he had recused himself from the Russia investigation.

“I think it’s important to establish why he was involved in the dismissal of Director Comey since he had recused from, apparently, all matters related to the Russia investigation, and (President Donald Trump) himself has indicated that he, indeed, based his dismissal of Comey on the Russia Investigation,” Rhode Island Sen. Jack Reed said on CNN’s “Erin Burnett OutFront.” “The attorney general’s involvement is highly questionable, to be blunt, and I think those questions will be raised.”
The White House initially cited memos from Sessions and Deputy Attorney General Rod Rosenstein recommending Comey’s firing over his handling of the Hillary Clinton email probe as the reason for his dismissal, and did not mention the Russia investigation. Trump later said in an interview with NBC News’s Lester Holt that he was going to fire Comey “regardless of the recommendation” and that he was thinking of the investigations into Russian involvement in the 2016 election when he decided to let the FBI director go.
Sessions will answer lawmakers’ questions on those matters Tuesday at the hearing. Reed said he expects Sessions to be asked if he was aware that Trump was factoring Comey’s handling of the Russia investigation in his decision to fire Comey. And, if Sessions was aware of the President’s rationale, Reed said he expects that senators will ask why he did not remove himself from discussions about Comey.
Asked if he thinks Sessions will answer these questions, Reed said, “I don’t know frankly. I would hope that he would answer the questions.”

******************************

Sessions is a pretty slippery character with a conveniently bad memory for some things (like who the Russian Ambassador is, what he looks like, and what the question was). But, he is a lawyer, so I wouldn’t expect the Committee to get anything except platitudes from him (like at his Comformation hearings where he obscured his White Nationalist philosophy and his predetermined plans to undermime civil rights, tank sentencing reform, and “go gonzo” on immigration enforcement).

Chris Cillizza In WashPost: Gonzo’s Bad Week! AG Appears Both Out Of Favor & Under Investigation — What More Could You Want From The USG’s Top Lawyer?

http://www.cnn.com/2017/06/10/politics/jeff-sessions-worst-week/index.html

“Washington (CNN)When stories about you offering to resign due to increasingly strained relations with your boss are the high point of your week, you know it’s not been a good seven days.

That’s how it went for Attorney General Jeff Sessions this week.
Things started off poorly when a series of pieces detailed his ongoing issues with President Donald Trump. This, from CNN’s Sara Murray and Stephen Collinson, paints an ugly picture for Sessions:
“Sessions and the President have had a series of heated exchanges in recent weeks, prompted by the attorney general’s decision to recuse himself from the probe into Russia interference in the election and alleged collusion by Trump aides, a source close to Sessions told CNN on Tuesday.”
“At one point, Sessions made clear he would be willing to resign if Trump no longer wanted him.”
Comey: AG may have met ambassador a third time

Comey: AG may have met ambassador a third time 01:34
Trump doesn’t like to ever apologize, retreat or concede. On anything. Sessions did just that, in Trump’s eyes, when he recused himself from the federal Russia probe after it was revealed he had not disclosed two meetings with Russian Ambassador Sergey Kislyak during the 2016 campaign. Trump didn’t like the decision at the time and has come to view it as the root of everything that led to the appointment of Bob Mueller as special counsel to oversee the Russia investigation.”

Regardless of whether he gets indicted, Gonzo Apocalypto’s sleaze factor is high. And his “gonzo” policies on immigration, crime, civil rights, and human rights are bad for American justice. It was also clear from Comey’s testimony that he didn’t view Sessions as a person of integrity, nor did he trust him as far as he could throw him.

Gee Whiz, Where Are The Emperor’s Clothes? Even Some In GOP Starting To Admit That Trump’s Travel Ban Is Bogus!

https://www.washingtonpost.com/powerpost/new-opposition-emerges-as-trump-pushes-for-travel-ban/2017/06/04/5914e7fa-4973-11e7-a186-60c031eab644_story.html?utm_term=.55a8e530861c

Paige Winfield Cunningham reports in the Washington Post:

“As President Trump renewed his push Sunday for a travel ban in the wake of another terrorist attack in England, new opposition emerged from Republican and Democratic lawmakers.

Several lawmakers suggested in TV interviews Sunday that Trump’s proposed ban, which blocked immigrants from six majority-Muslim countries but was halted by federal courts, is no longer necessary since the administration has had the time it claimed it needed to develop beefed-up vetting procedures to screen people coming to the United States.

“It’s been four months since I said they needed four months to put that in place,” Sen. Roy Blunt (R-Mo.), a member of the Intelligence Committee, said on “Fox News Sunday.” “I think you can do that without a travel ban and hopefully we are.

Sen. Mark R. Warner (Va.), the top Democrat on the panel, said Trump’s administration has had plenty of time at this point to examine how immigrants are let into the United States and make any improvements that are needed. “If the president wanted 90 days to re-examine how individuals from certain countries would enter the United States, he’s had more than 90 days,” Warner said on CBS’s “Face the Nation.”

. . . .

“The enhanced procedures would be in place by the beginning of October,” said Mark Tushnet, a law professor at Harvard University. “By that time, the travel ban would not be in effect.”

As more time goes by with no appearance of effort toward stronger vetting, it could undermine the administration’s legal justification for a temporary travel ban.

“I think the travel ban is too broad, and that is why it’s been rejected by the courts,” Sen. Susan Collins (R-Maine) said Sunday on Face the Nation. “The president is right, however, that we need to do a better job of vetting individuals who are coming from war-torn countries into our nation . . . but I do believe that the very broad ban that he has proposed is not the right way to go.”

Actually, it’s always been about power, and factors unrelated to national security. That being said, the State Department reportedly has beefed up visa vetting at some embassies over the past several months. That’s all they needed to do in the first place. But, from a Trump standpoint, that wouldn’t have been a sufficient show of unbridled power and wouldn’t ‘t have helped whip up a frenzy of anti-Muslim, anti-refugee, and anti-immigrant furor to please “the base.”

CNN BREAKING: Dem Sens Asked Comey To Investigate Sessions For Perjury!

CNN reports;

“Sens. Patrick Leahy and Al Franken — Democrats on the Senate Judiciary Committee — sent the requests to Comey and, later, acting FBI Director Andrew McCabe in three letters dated March 20, April 28 and May 12.
First on CNN: Sources: Congress investigating another possible Sessions-Kislyak meeting
First on CNN: Sources: Congress investigating another possible Sessions-Kislyak meeting
“We are concerned about Attorney General Sessions’ lack of candor to the committee and his failure thus far to accept responsibility for testimony that could be construed as perjury,” Franken and Leahy wrote to Comey in their first request.
Leahy and Franken both grilled Sessions during his nomination hearing about any contacts he had with Russian officials about the 2016 campaign. At the time, Sessions said he had none. But following a Washington Post report that showed Sessions had met twice with Kislyak, Sessions acknowledged the meetings and recused himself from oversight of the Russia probe.
CNN reported Wednesday that congressional investigators were now examining whether Sessions and Kislyak met a third time.
“Earlier this year, Attorney General Sessions provided false testimony before the Senate Judiciary Committee in response to our questions regarding his contacts with Russian officials,” Franken and Leahy said in a joint statement Thursday. “The attorney general never fully explained or even acknowledged the misrepresentations in his testimony, and we remained concerned that he had still not been forthcoming about the extent of his contacts with Russian officials.”
Leahy and Franken said that, if Sessions did perjure himself, he should resign.
“We served with the attorney general in the Senate and on the Judiciary Committee for many years,” they wrote. “We know he would not tolerate dishonesty if he were in our shoes. If it is determined that the attorney general still has not been truthful with Congress and the American people about his contacts with Russian officials during the campaign, he needs to resign.”
This story is breaking and will be updated.”

MARJORIE COHN IN HUFFPOST: Destroying American Justice From The Inside — The “Gonzo-Apocalypto Era” Takes Hold At The USDOJ!

http://www.huffingtonpost.com/entry/jeff-sessions-department-of-injustice_us_590dd80ee4b0f711807244f1

Cohn writes:

“Motivated by his deep-seated biases and those of President Donald Trump, Attorney General Jeff Sessions is pursuing a draconian agenda on voting rights, immigration, crime, policing, the drug war, federal sentencing and the privatization of prisons.

Sessions, now head of the Department of Justice, which is charged with enforcing the Voting Rights Act, once called the act “intrusive.” In 2013, after the Supreme Court issued a decision in “Shelby County v. Holder” that struck down the section of the act that established a formula for preclearance of jurisdictions with a history of racial discrimination, Sessions called it “a good day for the South.”

Sessions and Trump tout the existence of what the Brennan Center for Justice at New York University Law School calls a “phantom crime wave.” While this administration scaremongers about high crime rates, in reality, national crime and murder rates are at a near-historic low: 50 percent less than they were at their peak in 1991.

Trump’s campaign mantra was “law and order,” a euphemism for tolerating excessive force by police officers, often against people of color. Trump speaks of “American carnage” in the cities and a “war” on the police. His bogus rhetoric is aimed at Black Lives Matter, which arose in response to increasing numbers of police shootings, particularly of nonwhites.

The president depicts police reform measures as “anti-law enforcement” and Sessions is fully on board with this framing. In 2015, when he was a senator, Sessions said that police reform movements endanger public safety and hinder police work.

Sessions opposes consent decrees, which are court-enforced agreements aimed at eliminating racial profiling and excessive force by police in agencies that demonstrate “a pattern or practice” of violating civil rights. Sessions says the federal government should not be “dictating to local police how to do their jobs” (except when it comes to immigration enforcement, that is).

Amnesty International warns that Trump and Sessions’ “law and order” rhetoric could lead to higher levels of mass incarceration, long sentences and prolonged solitary confinement.

. . . .

Trump and Sessions are not disappointing the white nationalists who favor using immigration policy as a wedge to further their “alt-right” program.

Kevin de León, President pro Tempore of the California State Senate, noted, “It has become abundantly clear” that Sessions and Trump “are basing their law enforcement policies on principles of white supremacy ― not American values.”

From January to mid-March of this year, immigration arrests have increased by 33 percent. Since Trump’s inauguration, the number of arrests of immigrants with no criminal records has doubled. Roughly half of the 675 arrested in early February raids had either driving convictions or no criminal record at all, according to data obtained by The Washington Post.

Sessions drastically increased penalties for illegal reentry into the United States and ordered immigration officials to charge undocumented immigrants with higher-penalty crimes.

Although Sessions’ heavy-handed actions are based on Trump’s spurious claim that immigrants disproportionately murder and rape US citizens, studies have shown that immigrants actually commit fewer crimes than citizens.

Agents from Immigration and Customs Enforcement (ICE) are arresting immigrants who come to the courthouse. This egregious practice motivated California Supreme Court Chief Justice Tani Cantil-Sakauye to complain in a letter to the Departments of Justice and Homeland Security that ICE agents “appear to be stalking undocumented immigrants in our courthouses to make arrests.”

Terrorizing immigrants with frightful measures discourages immigrant witnesses from reporting crimes, and discourages victims from seeking legal measures and services that are meant to protect their own safety and well-being.

By March, the Los Angeles Police Department had seen a 25 percent drop in the number of Latinos reporting sexual assault and a 10 percent decrease in Latinos’ reports of domestic violence. By early April, there was a 42.8 percent drop in the number of Latinos who reported rapes to the Houston Police Department. And a health care center in Los Angeles reported a 20 percent decrease in food stamp enrollments and a 54 percent drop in enrollments for Medicaid.

The Trump administration has been arresting ― even deporting ― “Dreamers” who relied on Barack Obama’s assurances they would be protected if they came out of the shadows and provided their personal information to ICE. Dreamer Juan Manuel Montes Bojorquez is a registrant in Obama’s Deferred Action for Childhood Arrivals (DACA) program, and was the first DACA recipient to be deported. Bojorquez, who is now in Mexico, is suing the US federal government.

On January 25, 2017, Trump signed an executive order to halt federal funding to municipal governments that don’t facilitate federal immigration enforcement. Trump’s order is aimed at “sanctuary cities” that protect immigrants from deportation.

In March, Sessions threatened officials in nine jurisdictions with losing their 2016 grants if they failed to certify by June 30 that they were in compliance with a law that forbids local authorities from forcing officials to withhold information about immigration status from federal authorities.

But the majority of sanctuary policies do not cover information sharing. Most address how to handle “detainers,” where federal immigration officials request that state or local authorities continue to detain people who are eligible for release. Courts have said jurisdictions cannot be forced to honor those detainers.

Trump’s January 25 order is blocked, for now. US District Judge William H. Orrick III issued a nationwide preliminary injunction that forbids the federal government from withholding funds from municipal governments that don’t fully cooperate with immigration agents.

Orrick also ruled the federal government can’t legally force counties to hold undocumented people beyond their release dates. The judge concluded Trump’s order likely violates due process, the separation of powers doctrine, and the 10th Amendment, which prevents federal interference with state and local self-government. Only Congress can limit spending, Orrick wrote.

This is Trump’s third executive order halted by federal courts. His first and second Muslim bans are now pending in the 9th and 4th Circuit Courts of Appeals.

. . . .

After Trump nominated Sessions for attorney general, Rep. Luis Gutiérrez (D-Illinois) stated, “No senator has fought harder against the hopes and aspirations of Latinos, immigrants and people of color than Sen. Sessions.”

Indeed, no one is worse equipped to lead the Department of Justice. Sessions’ racism is prominently on display in every action he has taken during his short tenure in Trump’s cabinet.

It is critical that “we the people” continue to resist, in every way we can, the Trump-Sessions pattern and practice of injustice.

HUFFPOST: How White Nationalist “Know Nothing” Jeff “Gonzo Apocalypto” Sessions Tanked Needed Police Reform In Chicago Without Even BOTHERING TO READ The DOJ’s 160 Page Report!

http://www.huffingtonpost.com/entry/doj-police-reform-jeff-sessions-chicago_us_58f50a77e4b0da2ff86254cf?ncid=inblnkushpmg00000 report on HuffPost:

Ryan J. Reilly & Kim Bellware report in HuffPost:

“CHICAGO ― In the final months of the Obama administration, the Justice Department’s Civil Rights Division scrambled to complete its biggest-ever investigation of a city police department: a 13-month probe of Chicago’s 12,000-strong police force that wrapped up just a week before President Donald Trump’s inauguration.

For more than a year, the division’s lawyers reviewed thousands of Chicago Police Department documents, visited all 22 police districts, went on 60 ride-alongs, reviewed 170 police shooting files, examined over 425 incidents of less-lethal force, interviewed 340 department members and talked to about 1,000 Chicago residents.

Their final report, issued Jan. 13, recognized the tough job officers had in Chicago as they dealt with spiking gun violence, and praised the “diligent efforts and brave actions of countless” officers. But a “breach in trust” eroded Chicago’s ability to prevent crime, because officers were able to escape accountability when they broke the law, the report found. Because “trust and effectiveness in combating violent crime are inextricably intertwined,” the report found “broad, fundamental reform” was needed in Chicago.

Without a formal legal agreement to reform — known as a consent decree — and independent monitoring, the report concluded, reform efforts in Chicago were “not likely to be successful.”

Jeff Sessions, Trump’s attorney general, disagrees. In recent weeks, Sessions has expressed deep skepticism about the role of the federal government in fixing broken police departments, leaving serious doubts about the ultimate outcome of the Justice Department’s work in Chicago.

Sessions wants the Justice Department to serve as the “leading advocate for law enforcement in America.” While admitting he hadn’t read the full Chicago report, he called it “anecdotal” and “not so scientifically based.” Earlier this month in Baltimore, a Justice Department lawyer said Sessions had “grave concerns” about an agreement previously reached between that city and the Obama administration. A federal judge signed off on the deal over Sessions’ objections.

In an interview with a conservative radio host this month, Sessions seemed to suggest that Justice Department investigations and consent decrees were resulting in “big crime increases.” In an op-ed for USA Today last week, Sessions wrote that consent decrees could amount to “harmful federal intrusion” that could “cost more lives by handcuffing the police instead of the criminals.” There’s too much focus on “a small number of police who are bad actors,” Sessions wrote, and “too many people believe the solution is to impose consent decrees that discourage the proactive policing that keeps our cities safe.”

Chicago has a serious violent crime problem. Last year was the deadliest in the city in two decades, with 762 homicides. But supporters of police reform like Jonathan Smith, a former official in the Justice Department’s Civil Rights Division, said that Sessions was “simply wrong” to suggest that crime goes up as a result of reform (or, in Chicago’s case, an investigation). DOJ investigations can increase community confidence in police departments and make people safer, Smith argued.

Lorie Fridell, a criminologist and police bias expert from whom the Chicago’s Police Accountability Task Force solicited information for its report released last year, said DOJ investigations not only help to usher in badly need reforms to the specific departments probed, but other departments also rely on the reports to determine if their own departments are meeting constitutional standards.

“I think it’s very unfortunate the DOJ is no longer going to prioritize police reform,” Fridell said. ”The future of police reform is therefore going to have to come from the ground up. It’s going to be important for concerned individuals to demand high-quality policing.”

“GONZO-APOCALYPTO:” The Ominous Cloud Hanging Over American Justice — In Good Friday Editorials, Both NYT & WashPost Blast Sessions’s Dark, Distorted, “Gonzo-Apocalypto” Vision Of America!

First, the Washington Post ripped Sessions’s “embarrassing” withdrawal of support from African Americans and other minorities challenging the State of Texas’s scheme to disenfranchise them. A Federal Judge has twice found in favor of the plaintiffs — once with the DOJ’s support and once without!

“BLASTING “A PATTERN of conduct unexplainable on nonracial grounds, to suppress minority voting,” U.S. District Court Judge Nelva Gonzales Ramos on Monday repudiated Texas’s voter-ID law, the strictest in the country. Asked by appeals court judges to reconsider her expansive 2014 ruling against the law using slightly different evidence, Ms. Ramos reaffirmed her previous determination that “the law places a substantial burden on the right to vote, which is hardly offset by Texas’s claimed benefits to voting integrity.” She found that racial discrimination was at least a partial motivation for the law, a step toward reestablishing federal supervision over Texas’s voting procedures, per the Voting Rights Act.

Given the ruling and the mountain of evidence, it is embarrassing that the Trump Justice Department dropped its support for the contention that the Texas voter law is purposely discriminatory.

The legal question is not close. “There has been a clear and disturbing pattern of discrimination in the name of combating voter fraud,” Ms. Ramos wrote in 2014. The only type of fraud the law could combat — voter impersonation — hardly ever happens. Meanwhile, the law’s backers knew it would disproportionately impact minority voters; in fact, they designed it so. “The Texas Legislature accepted amendments that would broaden Anglo voting and rejected amendments that would broaden minority voting,” Ms. Ramos found in her 2014 examination. Texas accepts relatively few forms of identification at the polls, and those it does accept, such as gun licenses, are those white Texans tend to hold. Unlike many voter-ID states, Texas does not relax ID rules much for the elderly or the indigent, though obtaining an accepted ID can be surprisingly time-consuming and expensive.”

*******************************************

Meanwhile, A NY Times editorial slammed Session’s disingenuous plan to make immigrants the “#1 target” of law enforcement in the “Trump era.” The emphasis is mine.

Here’s the full editorial:

Attorney General Jeff Sessions went to the border in Arizona on Tuesday and declared it a hellscape, a “ground zero” of death and violence where Americans must “take our stand” against a tide of evil flooding up from Mexico.

It was familiar Sessions-speak, about drug cartels and “transnational gangs” poisoning and raping and chopping off heads, things he said for years on the Senate floor as the gentleman from Alabama. But with a big difference:  Now he controls the machinery of federal law enforcement, and his gonzo-apocalypto vision of immigration suddenly has force and weight behind it, from the officers and prosecutors and judges who answer to him.

When Mr. Sessions got to the part about the “criminal aliens and the coyotes and the document forgers” overthrowing our immigration system, the American flag behind him had clearly heard enough — it leaned back and fell over as if in a stupor. An agent rushed to rescue it, and stood there for the rest of the speech: a human flag stand and metaphor. A guy with a uniform and gun, wrapped in Old Glory, helping to give the Trump administration’s nativist policies a patriotic sheen.

It was in the details of Mr. Sessions’s oratory that his game was exposed. He talked of cities and suburbs as immigrant-afflicted “war zones,” but the crackdown he seeks focuses overwhelmingly on nonviolent offenses, the document fraud and unauthorized entry and other misdeeds that implicate many people who fit no sane definition of brutal criminal or threat to the homeland.

The problem with Mr. Sessions’s turbocharging of the Justice Department’s efforts against what he paints as machete-wielding “depravity” is how grossly it distorts the bigger picture. It reflects his long fixation — shared by his boss, President Trump — on immigration not as an often unruly, essentially salutary force in American history, but as a dire threat. It denies the existence of millions of people who are a force for good, economic mainstays and community assets, less prone to crime than the native-born — workers, parents, children, neighbors and, above all, human beings deserving of dignity and fair treatment under the law.

Mr. Sessions is ordering his prosecutors to make immigration a priority, to consider prosecution in any case involving “transportation and harboring of aliens” and to consider felony charges for an extended menu of offenses, like trying to re-enter after deportation, “aggravated identity theft” and fraudulent marriage.

He said the government was now detaining every adult stopped at the border, and vowed to “surge” the supply of immigration judges, to increase the flow of unauthorized immigrants through the courts and out of the country. He has ordered all 94 United States attorney’s offices to designate “border security coordinators,” no matter how far from “ground zero” they are.

Mr. Sessions and the administration are being led by their bleak vision to the dark side of the law. The pieces are falling into place for the indiscriminate “deportation force” that the president promised. Mr. Sessions and the homeland security secretary, John Kelly, have attacked cities and states that decline to participate in the crackdown. Mr. Sessions has threatened these “sanctuary” locales with loss of criminal-justice funding, on the false assertion that they are defying the law. (In fact, “sanctuary” cities are upholding law and order. They recognize that enlisting state and local law enforcement for deportation undermines community trust, local policing and public safety.)

Mr. Kelly recently told a Senate committee that all unauthorized immigrants are now potential targets for arrest and deportation. And so an administration that talks about machete-waving narco killers is also busily trying to deport people like Maribel Trujillo-Diaz, of Fairfield, Ohio, the mother of four citizen children, who has no criminal record.

“Be forewarned,” Mr. Sessions said in Arizona. “This is a new era. This is the Trump era.”

Let’s talk about this era. It’s an era when the illegal border flow, particularly from Mexico, has been falling for 20 years. When many of those arriving from Central America immediately surrender to border agents — having fled to the United States to find safety, not to do it harm. When American border cities enjoy safety and vitality, thanks to immigrants. When a large portion of the unauthorized population has lived here for years, if not decades, with clean records and strong roots. When polls show that Americans back reasonable and humane immigration policies giving millions a chance to get right with the law.

President Trump has shown his mind to be a place where ideas and principles can morph without warning or explanation. It is a vacuum that allows ideologues like Mr. Sessions — who know their minds — to do their worst. On immigration, that is a frightening thing to contemplate.

*************************************

“Gonzo-Apocalypto” has to be the “word of the day.” What a perfect term to describe Jeff Sessions.

In a grotesque display of disingenuous hypocrisy, Sessions referred to “drug cartels and ‘transnational gangs’ poisoning and raping and chopping off heads.” These are exactly the things causing scared, defenseless women and children to flee for their lives from the Northern Triangle and seek refuge in the U.S. But, instead of refuge they find: well, Jeff Sessions, Donald Trump, Steve Bannon, Stephen Miller, Gen. John Kelly and others anxious to stomp out their humanity in the false name of “law enforcement.”

Turning to civil rights, I watched on the TV news last night two clips of brutal beatings and stompings of African Americans by white police officers. One victim was accused of “jaywalking”  — that’s right, “jaywalking.” The other was “driving without a license plate.” I was wondering how, after all the recent publicity, those officers could have engaged in such conduct, “on camera” no less.

Unfortunately, the answer is pretty simple “Black Lives Don’t Matter,” an attitude that obviously has just become instinctive for too many U.S. police officers. I couldn’t imagine a white pedestrian or a white motorist being treated that way in our multi-racial but predominantly white neighborhood.

Yes, the officers involved were disciplined. I believe that most or all of them were either fired, prosecuted, or both. But, that’s not the point!

The object is to prevent misuse of force by police, not to fire, prosecute, or otherwise discipline more policemen. And, prevention without compromising effectiveness of policing is exactly what the carefully crafted “consent decrees” with some problematic cities developed by the Civil Rights Division under AGs Loretta Lynch and Eric Holder achieved.

Those are the very decrees that Sessions immediately announced an intent to “review” with an obvious eye toward withdrawing or undermining them. Look at the childish behavior in the U.S. District Court in Baltimore, MD, when DOJ attorneys, acting on Sessions’s behalf, withdrew their support from the consent decree and basically refused to participate in a long-scheduled public hearing. Fortunately, the judge has the good sense to go ahead and approve and finalize the consent decree without any participation by DOJ, leading to even more childish whining from Sessions about the horrors of infringing on local law enforcement in the name of African American citizen’s constitutional rights.

The very public “green light” that Sessions has given to law enforcement to run over citizen’s rights as they please, without any fear of DOJ intervention, so long as they are “enforcing the law” — like busting jaywalkers, license plate violators, and presumably undocumented aliens — no doubt plays a role in the continuing anti-minority policing being conducted by some law enforcement agencies.

Sessions “bristles” when anyone uses the term “racist” to describe him. Sessions was given a chance to make good on his (obviously false) promise during his confirmation hearings to turn over a new leaf and look at the responsibilities of being Attorney General for all Americans differently from representing Alabama in the U.S. Senate.

Unfortunately,  his actions have proved that all of the charges his detractors made against him are as true now as they were when he was, quite properly, denied a U.S. judgeship many decades ago. If the shoe fits, wear it. And, sadly, this “shoe” fits Sessions “like a glove.” Liz was “right on.”

Finally, DHS Secretary John Kelly will see his distinguished career in public service end in ignomany if he continues “toadying up” to the ethno-nationalist views of the Sessions-Bannon-Miller crowd on immigration enforcement. Most of the arrests, deportations, detentions, denials of asylum, and removals Sessions is touting in his haste to become the new “Immigration Czar,” actually are within the jurisdiction of DHS. But, these days, you’d hardly know that Sessions isn’t in charge of DHS enforcement as well as Justice. If Kelly isn’t careful, he’s going to develop a neck injury from constantly nodding his head to every absurd “gonzo-apocalypto” immigration enforcement initiative announced by Sessions.

HUFFPOST POLITICS: Despite Bannon’s Apparently Waning Influence, “Turbocharged” Sessions Will Keep “Ethno-Nationalist Agenda” Rolling At Full Speed At DOJ! Bad News For Immigrants, African-Americans, Refugees, Muslims, LBGT Individuals, Forensic Science, Innocent Defendants, Minor Offenders, Taxpayers, The U.S. Constitution, Many Women, & Social Justice In America!

http://www.huffingtonpost.com/entry/jeff-sessions-steve-bannon_us_58efb376e4b0bb9638e23542

Paul Blumenthal writes:

“No matter what Bannon’s fate, however, his strand of ethno-nationalism will live on in the Trump Justice Department under Attorney General Jeff Sessions. The 70-year-old former Alabama senator has already set the Justice Department on a new path by targeting immigrants, reining in police department reform efforts and curtailing efforts to protect voting rights.

“While many are focused on how Bannon is losing influence in the White House, those concerned with immigrant justice ― and I suspect those concerned with racial justice, police reform and voting rights, too ― are focused on the rise of a turbocharged Sessions,” Frank Sharry, executive director of the pro-immigration reform group America’s Voice, said in an email to HuffPost.

Bannon and Sessions share a long history of mutual support and policy agreement. They spent months together with Stephen Miller, a former Sessions aide who now works in the White House, plotting strategy on how to enact their shared agenda of limiting immigration to the U.S. in order to maintain a European and Christian identity. In 2016, Bannon declared Sessions “one of the intellectual, moral leaders of this populist, nationalist movement in this country.” After both moved to Trump’s administration, Bannon called Sessions the White House “clearinghouse for policy and philosophy.” Like Bannon, Sessions declares his policy objective as defeating “soulless globalism.”

. . . .

In another appearance on Bannon’s radio show, Sessions endorsed the Immigration Act of 1924, which specifically limited immigration based on race and religion, in the context of current immigration trends. “In seven years, we’ll have the highest percentage of Americans, non-native born, since the founding of the Republic,” Sessions said, while praising the 1924 law that was used to prevent Jewish immigration before and during the Holocaust.

Like Bannon, Sessions believes immigration from Middle Eastern countries poses a national security risk. He agrees that Western leaders have failed to protect their Judeo-Christian heritage by opening the door to refugees.

In one radio interview, after Bannon compared the migration of Syrian refugees to an infamous racist French book, he asked Sessions.: “Do you believe the elites in this country have the backbone, have the belief in the underlying principles of the Judeo-Christian West to actually win this war?”

“I’m worried about that,” Sessions replied.

The two nationalist Trump supporters share more than immigration policy preferences. The reversal of police reform efforts and reinvigoration of the War on Drugs pushed by Sessions as attorney general fits with Bannon’s efforts at Breitbart to label Black Lives Matter protesters as racists, while perpetuating racist stereotypes of African Americans through the site’s Black Crime section.”

*************************************

For those who hoped that President Trump’s sudden shift to more “centrist” positions on trade and foreign policy might carry over into immigration policy, dream on! Bannon might be “on the ropes,” but Sessions and Stephen Miller still have the President’s ear on their restrictionist, nationalist positions on immigration.

While badly needed, reasonable bipartisan immigration reform would be within Trump’s reach, that’s not going to happen. Buoyed by the immediate decrease in Southern Border apprehensions, Trump, Sessions, and MIller (Gen. Kelly appears to gone AWOL on immigration policy — he just parrots what Sessions and the nationalist restrictionists tell him — his stature as former General with integrity shrinks every day) intend to arrest, detain, deport, and threaten unless and until the Article III Courts stop them. And whether that will happen is still an open question.

Liz was right!

THE HILL: N. Rappaport Says Time For Congress To Pull The Plug On Troubled EB-5 Investor Program

http://thehill.com/blogs/pundits-blog/immigration/328386-congress-pull-fraud-laden-visa-program-for-mostly-chinese

Nolan concludes:

“So, should the EB-5 program be terminated?

Yes, Congress has had more than 25 years to fix the EB-5 program. There is not going to be a legislative “fix.” The only viable alternative is to terminate it and start over.

I have a few suggestions for the new investment program. It should:

  • Raise the investment amounts;
  • Establish more detailed statutory requirements for regional centers;
  • Require Chinese investors to establish that they have permission from the Chinese government to remove enough money from China to meet the investment requirement;
  • Provide for input from the states on designating Targeted Employment Areas but have the designations made by the federal government;
  • Establish guidelines for making the “Targeted Employment Area” designations which eliminate the current gerrymandering process and ensure that the investment money goes where it is supposed to go; and
  • Include measures to eliminate fraud from the program.

Some lawmakers have given up already. Rep. Steve King (R-Iowa) and Sen. Dianne Feinstein (D-Calif.) introduced bills to terminate the EB-5 program. These members have the right idea. It is time to put an end to a failing, faulty program and implement immigration policies that actually yield the intended result.”

Judge Neil Gorsuch Confirmed By Senate On 54-45 Vote — Will Be Sworn In As Associate Justice On Monday, Replacing The Late Justice Antonin Scalia!

https://www.wsj.com/articles/senate-expected-to-confirm-neil-gorsuch-as-supreme-court-justice-1491557404

The WSJ reports:

“WASHINGTON—The Senate on Friday confirmed Neil Gorsuch to the Supreme Court, ending a 14-month vacancy on the high court that spanned two presidential administrations and sparked one of the most bitter political fights in Washington in recent memory.

In a vote that fell largely upon partisan lines, Judge Gorsuch was approved as the next associate justice of the Supreme Court by 54-45. Three Democrats crossed the aisle to support Judge Gorsuch’s nomination, while he drew unanimous support from Senate Republicans.

“This brilliant, honest, humble man is a judge’s judge. And he will make a superb justice,” said Sen. Chuck Grassley, an Iowa Republican and chairman of the Senate Judiciary Committee.

Senate Minority Leader Chuck Schumer (D., N.Y.), who had opposed Judge Gorsuch as an out-of-the-mainstream conservative, acknowledged defeat but said he hoped the new justice wouldn’t be bound by the conservative groups that advised President Donald Trump on the choice.

“We are charging Judge Gorsuch to be the independent and fair-minded justice that America badly needs,” Mr. Schumer said. “If he is instead a justice for the Federalist Society and the Heritage Foundation, that will spell trouble for America.”

The only senator not voting was Johnny Isakson (R., Ga.), who is recovering from surgery.

The new justice will be sworn in Monday morning during a private ceremony at the Supreme Court, followed later in the day by a public ceremony at the White House. He will join his new colleagues on the bench on April 17, filling the seat held for three decades by the late Justice Antonin Scalia.”

*************************************

I continue to think that the Democrats made a mistake in picking the Gorsuch nomination to make a “stand.”  A stand on what? That a GOP President doesn’t have a right to appoint a well-qualified conservative jurist to the Court? How does that follow? Doesn’t a Democrat have a right to appoint a well-qualified more liberal jurist?

Yes, the GOP and Senate Majority Leader Mitch McConnell (R-KY) treated an outstanding, moderately liberal jurist, Chief Judge Merrick Garland with total shabbiness and disrespect. But, hey, we’re talking about Mitch McConnell here; perhaps one of the wiliest and shrewdest legislators ever to walk the halls of the Senate, but hardly anyone’s choice for the classiest or most decent.

And none of this was Judge Gorsuch’s fault. He respects Chief Judge Garland and made it clear that he did not agree with the way he was treated.

The political problem was that the Democrats had lost control of the Senate, and notwithstanding making control of the Supremes a major campaign issue, they lost both the Presidency and the Senate in 2016. Winners have leverage, losers don’t.

The real solution here is for the Dems to get out there and win some elections, at all levels. And, if anything, the ill-advised Gorsuch battle made them look no more like the “party of adults” than the  GOP.

I think Justice Gorsuch will be engaged, scholarly, collegial, and fair within his own very conservative philosophical framework. And, all of us who are or have been judges are, to some extent, prisoners of our own backgrounds, philosophies, and life experiences.

But, being on a collegial court with those holding other views forces a judge to listen to other views, consider other possible outcomes, and to reexamine carefully the legal and intellectual justifications for one’s own positions. That’s about all you can ask of a jurist. And, I’m relatively certain that somewhere down the line, Judge Gorsuch will cast some votes, write, and join some opinions that will surprise both his supporters and detractors.  And, that will be a good thing for the U.S. justice system. It’s what judicial independence and separation of powers is all about.

MORE TRUMPIAN DISCONNECT — THE WAR ON AMERICAN CITIZENS’ RIGHTS CONTINUES: Sessions’s DOJ “Civil Rights” Div. Sent Out To Undercut Civil Rights In Baltimore Court Case — “Unprecedented And Extraordinary” — “We Are In Uncharted Territory” — “Dissed” Citizen-Victim Left In Tears By DOJ Action — In The “World Of Sessions,” Citizens’ Constitutional Rights Take Back Seat To “Fighting Crime” — Duh, Isn’t Unwarranted/Unnecessary Police Violence A Crime, Jeff? — Liz Was “Right On!”

https://www.washingtonpost.com/local/public-safety/justice-department-expresses-skepticism-in-court-over-baltimore-police-consent-decree/2017/04/06/64d2a756-1a40-11e7-9887-1a5314b56a08_story.html

Peter Hermann and Justin Jouvenal report in the Washington Post:

“BALTIMORE — A Justice Department attorney expressed “grave concerns” Thursday about moving forward with a federal plan to make changes to this city’s police department, telling a federal judge that the Trump administration prefers that revisions be made and overseen by local government.

The hearing to gather public input on the proposed consent decree became a clash over the future of police departments, as Baltimore residents affected by police shootings and beatings forcefully pushed back against any delays.

The hearing came just days after U.S. Attorney General Jeff Sessions announced that he would have top deputies review such agreements with departments nationwide.

Sessions said he wanted to ensure the agreements align with administration priorities of promoting officer safety and morale while fighting violent crime, but advocates say the move could stymie much-needed changes to departments in the wake of high-profile police shootings of minorities in recent years.

The tension was on display Thursday, as well as an unusual role reversal — the Justice Department distanced itself from its plan negotiated by President Barack Obama’s administration, while Baltimore officials, residents and activists openly embraced it.

“Please do not delay this decree,” implored Greta Carter-Willis, whose 14-year-old son was fatally shot by a police officer several years ago. “We need to turn this police department around.”

She later broke down crying.

The consent decree follows a blistering Justice Department report that found widespread constitutional violations and discrimination in the Baltimore Police Department. The report was prompted by the 2015 death of Freddie Gray, who was fatally injured in police custody.

John Gore, the acting assistant attorney general for the civil rights division of Justice, said in court Thursday that the department wanted a 30-day delay on a decision to implement the plan “so new leadership can reanalyze and engage with the city as necessary.

Ultimately, “it is up to local communities to try and work with police to try and ensure reforms are implemented fully,” Gore said. “We have grave concerns that this consent decree is what is needed” as the means to change the police force and help fight crime.”

. . . .

Jonathan Smith, executive director of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, called the situation in Baltimore “unprecedented and extraordinary.” He said there is no precedent for a lead party to pull out after a consent decree is signed and the matter is before the court. “We are in uncharted territory.”

Smith, was in the Justice Department’s civil rights division under the Obama administration from 2010 through 2015 and negotiated a consent decree with the New Orleans Police Department.”

**************************************

The grotesque spectacle of Jeff Sessions in charge of the U.S. Department of Justice continues to get more jaw-dropping every day.

It wasn’t long ago that Senate Majority Leader Mitch “Nuke Em” McConnell (R-KY) shut down Sen. Elizabeth Warren (D-MA) while she was trying to “complete the record” on Sessions’s total unsuitability to be in charge of overseeing the delivery of justice in America and protecting the constitutional rights of all Americans (which actually includes immigrants who are entitled to constitutional due process protections). Everybody who doubted the truth of her message owes Sen. Warren a huge apology. And, those Senators who voted to confirm Sessions as AG should be ashamed.

Ever wonder how much damage one man can do the the U.S. justice system? Well, we’re finding out. And, it isn’t pretty.
