Oct. 11, 2019. Acting Homeland Secretary Kevin McAleenan’s resignation was announced by Trump this evening. It contained the minimal “faint praise” for his efforts and the standard disingenuous bureaucratic BS about wanting to spend more time with the family and pursuing interests in the private sector. At least Big Mac has a family left, unlike those asylum seekers who died seeking legal protection, illegally separated children, abused asylum applicants living on streets in Mexico, and mindlessly deported long-time residents who suffered under his corrupt, yet inept, leadership at DHS. 

Some news reports claim it was Big Mac’s decision. But, that seems unlikely, since he never was on the “Trump/Miller A Team.” It’s more likely that Big Mac actually was forced out by the White Nationalist Cabal lead by neo-Nazi Miller.

While cruel, corrupt, and complicit, Big Mac didn’t appear sufficiently ideologically committed to Miller’s racist restrictionist hate agenda. He certainly willingly abused human rights, but he didn’t do it with the obscene glee and delight in unnecessary human suffering consistently exhibited by Trump, Miller, and “Cooch Cooch.”

The DHS Secretary position has been a parade of horrors for the American Constitution, the Rule of Law, human rights, and human decency. McAleenan, like his predecessors General John Kelly and Kristjen Nielsen, came to the job with an undeserved reputation for professionalism and bipartisanship. In practice, he followed in the footsteps of his predecessors by performing like a typical political hack and Trump sycophant.

Illegal child separations, deaths in substandard detention conditions, misappropriation of funding for the Wall, totally absurd and dishonest “Safe Third Country” agreements with some of the most dangerous and “asylum free” countries in the world, abuse of legal asylum seekers under the “Let ‘em Die In Mexico” program, disrespect for and hindrance of attorney representation, bogus claims about failures to appear, expansion of the “New American Gulag,” illegal regulations aimed at indefinite detention of families and children, trashing the U.S. Refugee Program, illegal attempts to impose discriminatory “public change” requirements, illegal use of unreliable information to apprehend individuals, false imprisonment of U.S. citizens, mindless deportation of long-term residents who were actually benefitting America, tremendous backlogs of applications for legal stratus, overloading the Immigration Courts with improvidently commenced cases, schemes to discourage legal immigrants, insults to Federal Judges, lack of candor in dealing with Congress, and disrespect for Congressional Representatives are just some of the abominations that took place on Big Mac’s watch.

Indeed, in the past month lower Federal Courts have slammed as illegal at least five of the racist gimmicks that Big Mac and the DHS have tried to foist on the migrant community at the urging of Miller, “Cooch Cooch,” and the other White Nationalists. Some of Big Mac’s most egregious actions came in connection with the “in your face” regulations that DHS & DOJ presented to Judge Dolly Gee in the Flores litigation. Those regulations proposed unlimited abuses to be inflicted on detained children in unregulated facilities during indefinite detention, which was just the opposite of what Judge Gee had ordered. The DOJ’s unethical arguments in support of Big Mac’s indefensible position left Judge Gee incredulous.

Undoubtedly, he will be replaced by someone with a more overt ideology of racism and hate. Neo-Nazis like Ken “Cooch Cooch” Cuccinelli, now illegally serving as head of USCIS, or some of the DHS underlings who have been competing for Miller’s attention with public statements of cruelty, anti-immigrant sentiment, and disrespect for the law are strong possibilities. Trump has a penchant for finding and selecting the worst that humanity has to offer to serve him. 

Indeed, it’s quite likely that Trump’s next choice will be so spectacularly unqualified and unpalatable, even to some in the GOP (see, “Cooch Cooch”), that “Moscow Mitch” might balk at pushing the nomination through. But, since Trump prefers to flaunt the Constitution and to operate with “acting toadies” anyway, that probably won’t make any difference. 

The Trump Administration is a kakistocracy. So, expect the worst, but be prepared for something far more grotesque and absurd. In the meantime, Big Mac should be remembered for the laws he broke, his attacks on human rights and human decency, his intellectual dishonesty, his immorality, his cowardice in the face of tyranny, the cruel and unnecessary pain he inflicted on legal asylum seekers invoking our laws, and the many lives that he needlessly ruined in service to the worst and most unqualified President in U.S. history.

Trump dealt 3 legal defeats on immigration

White House assails ‘misguided’ court rulings it says hinder law enforcement.

In a third defeat in less than a day for the Trump administration, a federal judge blocked it from vastly extending the authority of immigration officers to deport people without first allowing them to appear before judges.

The decision late Friday came before the policy, which was announced in July, was even enforced. The move would have applied to anyone in the country less than two years.

The decision came just after a federal judge barred Immigration and Customs Enforcement from relying solely on flawed databases to target people for being in the country illegally.

Early Friday, the administration suffered what would be its first defeat on the immigrant front in less than 24 hours when a federal judge blocked its plan to dismantle protections for immigrant youths and indefinitely hold families with children in detention.

Those protections are granted under the so-called Flores agreement, which was the result of a landmark class-action court settlement in 1997 that said the government must generally release children as quickly as possible and cannot detain them longer than 20 days, whether they have traveled to the U.S. alone or with family members.

In a statement Saturday, the White House responded angrily to the decision to halt its plans for expedited removal of immigrants.

“Once again, a single district judge has suspended application of federal law nationwide — removing whole classes of illegal aliens from legal accountability,” the statement read in part. “For two and a half years, the Trump administration has been trying to restore enforcement of the immigration laws passed by Congress. And for two and a half years, misguided lower court decisions have been preventing those laws from ever being enforced — at immense cost to the whole country.”

The American Civil Liberties Union, which had sought the injunction, granted just before midnight, celebrated the result.

“The court rejected the Trump administration’s illegal attempt to remove hundreds of thousands of people from the U.S. without any legal recourse,” said ACLU attorney Anand Balakrishnan, who argued the case. “This ruling recognizes the irreparable harm of this policy.”

In the first setback Friday for the Trump administration, U.S. District Judge Dolly Gee said new rules it planned to impose violated the terms of the Flores settlement. Gee issued a strongly worded order shortly after, slamming the changes as “Kafkaesque” and protecting the original conditions of the agreement.

Gee wrote that the administration cannot ignore the terms of the settlement — which, she pointed out, is a final, binding judgment that was never appealed — just because leaders don’t “agree with its approach as a matter of policy.”

Barring a change in the law through congressional action, she said, “defendants cannot simply impose their will by promulgating regulations that abrogate the consent decree’s most basic tenets. That violates the rule of law. And that this court cannot permit.”

The new regulations would have eliminated minors’ entitlement to bond hearings and the requirement that facilities holding children be licensed by states.

They also would have removed legally binding language, changing the word “shall” to “may” throughout many of the core passages describing how the government would treat immigrant children.

The government is expected to appeal.

In the second decision Friday, U.S. District Judge Andre Birotte Jr. issued a permanent injunction barring ICE from relying solely on databases when issuing so-called detainers, which are requests made to police agencies to keep people who have been arrested in custody for up to two days beyond the time they would otherwise be held.

ICE is also blocked from issuing detainers to state and local law enforcement in states where there isn’t an explicit statute authorizing civil immigration arrests on detainers, according to the judge’s decision.

The decision affects any detainers issued by an ICE officer in the federal court system’s Central District of California.

That designation is significant because the Pacific Enforcement Response Center, a facility in Orange County, is an ICE hub from which agents send out detainer requests to authorities in 43 states, Guam and Washington, D.C. It is covered by the Central District.

“ICE is currently reviewing the ruling and considering our legal options,” Richard Rocha, an agency spokesman, said in a statement.

“Cooperation between ICE and local law enforcement agencies is critical to prevent criminal aliens from being released into our communities after being arrested for a crime.”

Tens of thousands of the requests are made each year to allow ICE agents additional time to take people suspected of being in the country illegally into federal custody for possible deportation. Approximately 70% of the arrests ICE makes happen after the agency is notified about someone being released from local jails or state prisons.

In fiscal year 2019, ICE has lodged more than 160,000 detainers with local law enforcement agencies, according to the agency.

Although police in California do not honor these ICE requests because of earlier court rulings that found them unconstitutional, agencies in other parts of the country continue to enforce them.

The civil case, which has wound its way through years of delays and legal wrangling, has broad implications for President Trump’s crackdown on illegal immigration as the ACLU and other groups sought to upend how immigration officers target people for being in the country illegally.

“I think the decision is a tremendous blow to ICE’s Secure Communities deportation program and to Trump’s effort to use police throughout the country to further his deportation programs,” said Jessica Bansal, senior staff attorney with the ACLU of Southern California.

The class-action lawsuit, which represents broad categories of people who have been or will be subjected to detainers, alleged the databases that agents consult are so badly flawed by incomplete and inaccurate information that ICE officers should not be allowed to rely on them as the sole basis for keeping someone in custody.

The judge agreed with that assessment, finding that the databases often contained “incomplete data, significant errors, or were not designed to provide information that would be used to determine a person’s removability.”

These errors, according to the decision, have led to arrests of U.S. citizens and lawfully present noncitizens. From May 2015 to February 2016, of the 12,797 detainers issued in that time frame, 771 were lifted, according to ICE data. Of those 771, 42 were lifted because the person was a U.S. citizen.

The detainer process begins when police arrest and fingerprint a person. The prints are sent electronically to the FBI and checked against the prints of millions of immigrants in Homeland Security databases. If there is a match — such as someone who applied for a visa or was apprehended by Border Patrol — it triggers a review process, which often culminates with an agent at the center deciding whether to issue a detainer.

Last year, the Pacific Enforcement Response Center issued 45,253 detainers and alerted agents at field offices to more than 28,000 additional people released from law enforcement custody before ICE could detain them.

Trump has singled out police in California and elsewhere for their refusal to honor detainers, using them to highlight what he says are problems with the country’s stance on immigration enforcement and the need to take a more hard-line approach.

In the years since the lawsuit was filed, ICE has amended its policies, saying the changes made the process for issuing detainers more rigorous.

AMERICA’S “MASS ATROCITY” — Professor Kate Cronin-Furman Says Don’t Kid Yourself About What The Trump Administration Is Doing In Your Name & How “Ordinary Civil Servants” Carry Out The Unthinkable & Unacceptable!

The debate over whether “concentration camps” is the right term for migrant detention centers on the southern border has drawn long-overdue attention to the American government’s dehumanizing treatment of defenseless children. A pediatrician who visited in June said the centers could be compared to “torture facilities.” Having studied mass atrocities for over a decade, I agree.

At least seven migrant children have died in United States custody since last year. The details reported by lawyers who visited a Customs and Border Protection facility in Clint, Tex., in June were shocking: children who had not bathed in weeks, toddlers without diapers, sick babies being cared for by other children. As a human rights lawyer and then as a political scientist, I have spoken to the victims of some of the worst things that human beings have ever done to each other, in places ranging from Cambodia to the Democratic Republic of the Congo to Sri Lanka. What’s happening at the border doesn’t match the scale of these horrors, but if, as appears to be the case, these harsh conditions have been intentionally inflicted on children as part a broader plan to deter others from migrating, then it meets the definition of a mass atrocity: a deliberate, systematic attack on civilians. And like past atrocities, it is being committed by a complex organizational structure made up of people at all different levels of involvement.

Thinking of what’s happening in this way gives us a repertoire of tools with which to fight the abuses, beyond the usual exhortations to call our representatives and donate to border charities.

Those of us who want to stop what’s happening need to think about all the different individuals playing a role in the systematic mistreatment of migrant children and how we can get them to stop participating. We should focus most on those who have less of a personal commitment to the abusive policies that are being carried out.

Testimony from trials and truth commissions has revealed that many atrocity perpetrators think of what they’re doing as they would think of any other day job. While the leaders who order atrocities may be acting out of strongly held ideological beliefs or political survival concerns, the so-called “foot soldiers” and the middle men and women are often just there for the paycheck.

This lack of personal investment means that these participants in atrocities can be much more susceptible to pressure than national leaders. Specifically, they are sensitive to social pressure, which has been shown to have played a huge role in atrocity commission and desistance in the Holocaust, Rwanda and elsewhere. The campaign to stop the abuses at the border should exploit this sensitivity and put social pressure on those involved in enforcing the Trump administration’s immigration policies.

Here is what that might look like:

The identities of the individual Customs and Border Protection agents who are physically separating children from their families and staffing the detention centers are not undiscoverable. Immigration lawyers have agent names; journalists reporting at the border have names, photos and even videos. These agents’ actions should be publicized, particularly in their home communities.

This is not an argument for doxxing — it’s about exposure of their participation in atrocities to audiences whose opinion they care about. The knowledge, for instance, that when you go to church on Sunday, your entire congregation will have seen you on TV ripping a child out of her father’s arms is a serious social cost to bear. The desire to avoid this kind of social shame may be enough to persuade some agents to quit and may hinder the recruitment of replacements. For those who won’t (or can’t) quit, it may induce them to treat the vulnerable individuals under their control more humanely. In Denmark during World War II, for instance, strong social pressure, including from the churches, contributed to the refusal of the country to comply with Nazi orders to deport its Jewish citizens.

The midlevel functionaries who make the system run are not as visibly involved in the “dirty work,” but there are still clear potential reputational consequences that could change their incentives. The lawyer who stood up in court to try to parse the meaning of “safe and sanitary” conditions — suggesting that this requirement might not include toothbrushes and soap for the children in border patrol custody if they were there for a “shorter term” stay — passed an ethics exam to be admitted to the bar. Similar to the way the American Medical Association has made it clear that its members must not participate in torture, the American Bar Association should signal that anyone who defends the border patrol’s mistreatment of children will not be considered a member in good standing of the legal profession. This will deter the participation of some, if only out of concern over their future career prospects.

The individuals running detention centers are arguably directly responsible for torture, which could trigger a number of consequences at the international level. Activists should partner with human rights organizations to bring these abuses before international bodies like the United Nations Human Rights Council. They should lobby for human rights investigations, for other governments to deny entry visas to those involved in the abuses, or even for the initiation of torture prosecutions in foreign courts. For someone who is “just following orders,” the prospect of being internationally shamed as a rights abuser and being unable to travel freely may be significant enough to persuade them to stop participating.

When those directly involved in atrocities can’t be swayed, their enablers are often more responsive. For-profit companies are supplying food and other material goods to the detention centers. Boycotts against them and their parent entities may persuade them to stop doing so. Employees of these companies can follow the example of Wayfair workers, who organized a walkout on Wednesday in protest of their company’s sale of furniture to the contractor outfitting the detention centers. Finally, anyone can support existing divestment campaigns to pressure financial institutions to end their support of immigration abuses.

Many Americans have been asking each other “But what can we DO?” The answer is that we call these abuses mass atrocities and use the tool kit this label offers us to fight them. So far, mobilization against what’s happening on the border has mostly followed standard political activism scripts: raising public awareness, organizing protests, phoning our congressional representatives. These efforts are critical, but they aren’t enough. Children are suffering and dying. The fastest way to stop it is to make sure everyone who is responsible faces consequences.

Inside a Texas Building Where the Government Is Holding Immigrant Children

Some of the lawyers interviewing immigrant children held in Border Patrol detention facilities were so disturbed by what they saw that they have decided to talk to the media.

Hundreds of immigrant children who have been separated from their parents or family members are being held in dirty, neglectful, and dangerous conditions at Border Patrol facilities in Texas. This week, a team of lawyers interviewed more than fifty children at one of those facilities, in Clint, Texas, in order to monitor government compliance with the Flores settlement, which mandates that children must be held in safe and sanitary conditions and moved out of Border Patrol custody without unnecessary delays. The conditions the lawyers found were shocking: flu and lice outbreaks were going untreated, and children were filthy, sleeping on cold floors, and taking care of each other because of the lack of attention from guards. Some of them had been in the facility for weeks.

To discuss what the attorneys saw and heard, I spoke by phone with one of them, Warren Binford, a law professor at Willamette University and the director of its clinical-law program. She told me that, although Flores is an active court case, some of the lawyers were so disturbed by what they saw that they decided to talk to the media. We discussed the daily lives of the children in custody, the role that the guards are playing at the facility, and what should be done to unite many of these kids with their parents. Our conversation has been edited for length and clarity.

How many lawyers were in your party? And can you describe what happened when you arrived?

We had approximately ten lawyers, doctors, and interpreters in El Paso this past week. We did not plan to go to the Clint Facility, because it’s not a facility that historically receives children. It wasn’t even on our radar. It was at a facility that historically only had a maximum occupancy of a hundred and four, and it was an adult facility. So we were not expecting to go there, and then we saw the report, last week, that it appeared that children were being sent to Clint, so we decided to put four teams over there. The teams are one to two attorneys, or an attorney and an interpreter. The idea is that we would be interviewing one child at a time or one sibling group at a time.

How many interviews do you do in a day?

We do a screening interview first to see if the child’s most basic needs are being met. Is it warm enough? Do they have a place to sleep? How long have they been there? Are they being fed? And if it sounds like the basic needs are being met, then we don’t need to interview them longer. If, when we start to interview the child, they start to tell us things like they’re sleeping on the floor, they’re sick, nobody’s taking care of them, they’re hungry, then we do a more in-depth interview. And those interviews can take two hours or even longer. So it depends on what the children tell us. So I’d say, with a team of four attorneys, if you’re interviewing several groups, which we sometimes try to do, or if you interview older children who are trying to take care of younger children, then you are interviewing, let’s say, anywhere from ten to twenty children per day.

How many kids are at the facility right now, and do you have some sense of a breakdown of where they’re from?

When we arrived, on Monday, there were approximately three hundred and fifty children there. They were constantly receiving children, and they’re constantly picking up children and transferring them over to an O.R.R. [Office of Refugee Resettlement] site. So the number is fluid. We were so shocked by the number of children who were there, because it’s a facility that only has capacity for a hundred and four. And we were told that they had recently expanded the facility, but they did not give us a tour of it, and we legally don’t have the right to tour the facility.

We drove around afterward, and we discovered that there was a giant warehouse that they had put on the site. And it appears that that one warehouse has allegedly increased their capacity by an additional five hundred kids. When we talked to Border Patrol agents later that week, they confirmed that is the alleged expansion, and when we talked to children, one of the children described as many as three hundred children being in that room, in that warehouse, basically, at one point when he first arrived. There were no windows.

As Trump launches his latest “human hostages for outrageous ransom” scheme, it’s important for Democrats to hang tough against any reduction in rights for asylum seekers. The whole “loopholes” bogus claim is just another piece of this toxic White Nationalist racist narrative.

 

The only “change” needed would be to require the Trump Administration to comply with its domestic, international, and Constitutional duties to administer asylum laws fairly and generously for the protection of asylum seekers. An end of child abuse should be a prerequisite for any discussions.

 

The reality to keep in mind is that while ICE’s ability to inflict pain and suffering on ethnic communities as part of the racially-motivated “New Operation Wetback” is real, their capacity to actually remove undocumented residents is quite limited.

 

Contrary to the bogus narrative, several million of the 10 million so-called undocumented residents are actually here with permission and are therefore not currently subject to removal. Those include individuals with DACA, TPS, PD, Deferred Action, and in the EOIR Court System, or whose cases are pending in the Courts of Appeals.

 

Additionally, many, perhaps the majority, of those with so-called final “in absentia” orders of removal never received proper legal notice of their hearings and will be entitled to file a “motion to reopen” with an automatic stay while those motions are pending. Those who are not yet in the EOIR system will go to the end of a backlog that stretches out for many years.

 

Given their notoriously poor record keeping, it’s likely that many of ICE’s “last known addresses” are no good. Plus, the resistance that ICE’s racist fear-mongering tactics have engendered in many communities will hamper operations.

 

Additionally, ICE keeps claiming that is detention capacity is already “saturated.” Thus, most of those picked up, who will not be “immediately removable,” will have to be released.

 

In short, while we can expect some human tragedies and human rights abuses, the result of the Trump/DHS/ICE “saber rattling” will likely be another resounding operational failure that fuels the “Abolish ICE Movement” while energizing the vote to remove Trump and his GOP White Nationalist Cabal from office in 2020. Kind of an “everyone loses” outcome – but, despite all of his lies, boasting, and shamelessly false self-promotion, that’s all Trump has ever been about.

Cages With ‘Kids’ Pop Up Around NYC To Protest Immigrant Detention

The art installations were meant to bring awareness to the horrific conditions children and other migrants face at the southern U.S. border.

Some people in New York City were confronted with an alarming image as they walked down the street on Wednesday morning: a chain-link cage on the sidewalk containing a child-size mannequin wrapped in a foil blanket, with audio playing of migrant children crying.

More than 20 cages were placed around Manhattan and Brooklyn ― from Union Square to the Barclays Center sports arena ― as part of a campaign called #NoKidsInCages by immigration nonprofit RAICES and ad agency Badger & Winters.

It was meant to draw Americans’ attention to the children and other migrants being held in alarming conditions at the U.S.-Mexico border.

Speakers in the cages played the viral recording released by ProPublica last summer of kids wailing for their “mamá” and “papá” after having been separated from them at the border as a result of the Trump administration’s “zero tolerance” immigration policy.

“We want to bring this back to the consciousness of the American people,” RAICES CEO Jonathan Ryan told HuffPost. “One of the many unfortunate consequences of the repeated traumatic stories coming from the border is that, as horrified and angry as people have been, we also become desensitized. It’s important for people … to be confronted with the reality that this is about children, human beings, whose lives are forever affected.”

“This is being done in our name by people who we elected,” he added. “And if we don’t do something to stop this, this will become who we are.”

About two dozen cages were dropped around the city from about 4 a.m. to 5 a.m., Ryan said. By midafternoon most of them had been taken down by police or city employees, with three remaining around 2 p.m., per Ryan. The New York Police Department confirmed to HuffPost that more than half a dozen cages had been removed around Manhattan, but did not respond to questions as to why.

The online campaign associated with the installations recalls the family separations under President Donald Trump’s hard-line zero-tolerance policy, which led to the separation of thousands of children from their parents last year. The policy sparked protests nationwide and was reversed by executive order in late June. But a January report from the Department of Health and Human Services found the administration may have separated thousands more kids from their families than was previously known, and it did not know how many or whether they were reunited.

RAICES also wants people to become aware of other issues migrants face, Ryan said.

He noted undocumented immigrant families are still separated “routinely” at the border, including when migrant kids are split from other guardians like uncles and aunts or older siblings. Separations occur inside the country too, he said, when a child’s undocumented mom or dad is arrested by immigration agents, for instance in a workplace raid.

U.S. Customs and Border Protection apprehended over 109,000 people at the border in April ― more than double the number of migrants detained during that month last year. A majority of the migrants apprehended were either families traveling together or unaccompanied kids.

A Department of Homeland Security watchdog, reporting on Border Patrol facilities in El Paso, Texas, found last month that detained migrants were kept in dirty and extremely crowded conditions, forcing some people to stand on toilets to get some breathing room.

Last week, Trump said he reached an agreement with Mexico that includes “rapidly” returning to Mexico anyone who crosses the border seeking asylum in the U.S. Advocates are concerned about the dangerous conditions in cities such as Tijuana and Ciudad Juárez, where more migrants will now be forced to wait as their claims are processed.

“When the American people hear stories of this problem being fixed by the ‘remain in Mexico’ policy, it hasn’t been fixed, it’s just further from their view,” Ryan said. “The suffering will only increase.”

Escobedo v. Illinois(1964) – I remember the case from law school and it is one of those cases that stay with you.  It’s a case that spoke so firmly to our profession and the constitutional right that our profession guards – the right to counsel.   It’s the case where the attorney is trying to see the client, and the client keeps asking to see the attorney, and they are both at the police station, but the police continue to deny both the ability to meet and talk before the person is interrogated by police.  The case fascinated me because the situation seemed so remarkable, really, incredible, and, of course, the Supreme Court, at that time, gave what I thought the correct response.  I still think it is the correct response but what I missed then, and sometimes now, is how many of us think, then and now, it was not.  But Escobedo is a Sixth Amendment case that applies in the context of criminal prosecutions so although I have thought of it often in the past three weeks, it is uncertain precedent to rely on in the context of immigration proceedings.  It also strikes me now who Escobedo is, and I remember when we first discussed this case in law school, the complete absence of a discussion about his race and national origin, in the classroom.

I also think often of Fong Yue Ting v. United States (1893) and the U.S. Supreme Court’s reasoning that “The order of deportation is not a punishment for crime,”  And what this reasoning means in a world where persons are incarcerated, prevented from touching, hugging and kissing their closest relatives, including their children, simply because they are immigrants in removal proceedings (a civil process, the Court continues to tell us – not a criminal process) and where persons are not allowed to meet with their attorneys in a room in which they can go over documents or testimony together, but instead meet only in cubicles that are completely separated from each other except for a quarter inch slit at the bottom of a plastic/glass divider.  So it is literally physically impossible to point at a statement in a document and ask the client a question about that statement.  And it is in fact physically impossible for a client to hand over to their attorney documents.  They have to be taken apart and slipped across through that quarter inch slit.  It took a client over an hour to slip over to me part of the file.

This is the world at La Salle Detention Center in Jena, Louisiana, one of the Geo owned and managed detention centers in Louisiana that currently houses only immigrant detainees. But the guards at La Salle know better – they are housing criminals at La Salle and the guards think of them as criminals, call them criminals, and treat them like criminals.  Criminals, apparently, are undeserving of any kind of protection. The reason for the cubicle, I am told, is to make impossible the passing of contraband.  I ask what contraband.  I ask further, by attorneys?  Attorneys are bringing in contraband?  I ask amazed.  And the answer I am given is yes, you’d be surprised.  And I persist, What?  What kind of things are attorneys bringing in?  And the answer I get eventually is things like food.

At La Salle, inmates are separated and designated by clothing of different colors into different groups based on their alleged “dangerousness” or “security.” Inmates are written up for asking questions or making requests or complaining about things like missed mail or failures to deliver mail.  Inmates are also restricted in accessing outside time, private time, and so many of the things those of us who are free take for granted, and those of us who are committed to serve a criminal sentence are denied.  But these “inmates” aren’t serving a criminal sentence, as I remind the guards.  They are civil detainees – they are not supposed to be treated like criminals serving a criminal sentence.

At La Salle, civil detention is criminal detention.   I have had greater physical access to persons convicted of murder or persons who’ve been accused of criminal offenses.  I’m somewhat nonplussed by the restrictions on meeting with someone who is facing removal from this country; and the impact of those restrictions on their right to counsel.

But I am even more nonplussed when those restrictions start being applied directly to me. In order to see a client, I have to turn my car keys in to the facility.  I cannot take my bag or purse with me.  This is for my safety I am told.  Every time I visit a person at La Salle, I ask for access to the person.  I know there is a room at La Salle in the visiting area that allows for that.  I know that the facility has made this room available to consular officials visiting persons in the facility.  But the facility refuses to make this room available for attorney-client visits.  I ask every time and am refused every time.  I leave multiple phone messages for the Warden but no one ever calls me back and no one with authority ever agrees to talk to me.

When I come for the hearing at La Salle Immigration Court with the family of a person I am representing, the guard refuses to allow the children of the person into the courtroom. I ask why not. Federal policy is that children 12 and older can attend court proceedings.  There are signs in the waiting room at the facility that state this.  But when I come with six law students and the family, the officer says no they have to be 15 and older (after looking the children over).  So I ask why again.  I explain that I’ve checked with the Court administrator and federal guidelines and the ICE–ERO on the case and the Court administrator said the children were allowed to attend.  No one had indicated otherwise.  So the officer goes off to check with someone.  When she returns she says the ICE officer in charge of the facility has determined that the children cannot go in.  I ask why?  She says that’s what he’s decided.  I say may I speak to him.  That is not consistent with the federal policy and the court administrator approved it.  I’d like to speak to him.  She goes out again and comes back a bit later.  Then a person not in uniform comes in waves to me and takes me into a bigger office.  There he proceeds to threaten me with arrest – first, it sounds like he is going to arrest me himself but then he threatens that he is going to call the sheriff and have the sheriff arrest me.  I ask him why he would do that.  I am just trying to find out why the children can’t attend the hearing, given that it’s federal policy and I’ve gotten approval of the court administrator.  He is physically shaking with anger as he tells me again he is going to call the sheriff and have me arrested.  I agree to be arrested but remind him that the facility operates by force of law and regulation – it can’t operate as if law doesn’t apply here.  I am an attorney, I explain, I have to be able to assert my client’s interests.

Who are the “real criminals” here?

It takes lots of corruption, cowardice, and complicity to make this happen:  A Congress that doesn’t care, a Supreme Court that disingenuously manufactures ridiculous legal fictions and turns a blind eye to glaring Constitutional violations, Article III Courts who can see that the results are inherently biased, coercive, and unfair but look the other way, a thoroughly corrupt Attorney General who has no interest whatsoever in justice, complicit politicos and bureaucrats at DOJ, EOIR, and DHS willing to violate ethical standards and their oaths of office, and those minions at the “bottom of the pyramid” who glory in the chance to exercise power in an arbitrary and abusive way.  

Thanks goodness for dedicated, courageous lawyers like Isabel who are members of the “New Due Process Army,” fight for the legal rights of the most vulnerable among us, refuse to give in to the oppressors, and document and expose the vileness and lawlessness of the Trump Administration and its many enablers and retainers like Geo and its guards.

Seeking Refuge, Legally, and Finding Prison

Power is condemning lawful asylum seekers to a system designed for criminals.

For more than seven months, Ysabel has been incarcerated without bond at an immigrant detention center in southern Arizona, part of a vast network of for-profit internment facilities administered by private companies under contract with the Department of Homeland Security.

I visit Ysabel (who has asked not to be identified by her real name for her protection) every two weeks as a volunteer with the Kino Border Initiative, one of ahandful of migrant advocacy groups running desperately needed visitation programs in Arizona, including Mariposas Sin Fronteras and Transcend. As volunteers, our primary role is to provide moral support; facilitate communication with family members and legal service providers; and serve as a sounding board for frustration, confusion and, often, raw despair.

Ysabel and the other asylum seekers we visit often ask for simple forms of support, such as small deposits into their commissary accounts to let them call relatives or purchase overpriced goods like dry ramen, tampons, shampoo or headphones for watching telenovelas. They often ask us to send them books in Spanish — one of the few things that they are permitted to receive through the mail without clearance from a property officer. Large-print Bibles are the most popular, along with books of song and prayer, bilingual dictionaries and English course books, romance novels, and other books that provide ways to pass the time — word puzzle collections, coloring books, books for learning how to draw and instruction manuals for making origami figurines.

Ysabel arrived at the United States border last October after leaving her home and two children in eastern Venezuela. The region she fled was plagued by disorder long before the more widely reported upheavals of recent months, suffering frequent power outages, widespread violence and unrest, and severe shortages of food, water and medication. In the years leading up to her flight from the country, Ysabel told me that she had been kidnapped, robbed at gunpoint multiple times and shot at during an attempted carjacking.

Beneath all of the Trump Administration’s diversionary tactics and overt White Nationalist racism is an even more disturbing truth: our country is systematically denying due process, fundamental fairness, and humane treatment to those who, unlike Trump and his scofflaws, are actually following our laws and deserve a “fair shot” at receiving life-saving protection.

Folks like Yasabel pose no “threat” to the United States other than the color of their skin. But, Trump, Stephen Miller, Bill Barr, and the rest of the Trump sycophants, their supporters, and their GOP enablers, pose an existential threat to our continued existence as a nation.

Outrageously, the U.S. Immigration Courts, supposedly a courageous bastion of protection for the legal and constitutional rights of asylum applicants and others against Government overreach, have become “weaponized” under Barr and Sessions. Now, they function as tools of repression, not justice.

Nobody, and I mean nobody, in the United States will escape the eventual consequences of the systemic abuses of our legal system and human dignity being carried out under our noses by the Trump Administration through the seriously corrupted Immigration “Court” System.

Yes, 1939 can happen in America, and it’s coming closer all the time! Trump’s disgusting rhetoric is the same as fascists before him: hate, shame, blame, vilification and dehumanization of the innocent and most vulnerable.

— Hundreds of minors are being held at U.S. facilities at the southern border beyond legal time limits. Abigail Hauslohner and Maria Sacchetti report: “Federal law and court orders require that children in Border Patrol custody be transferred to more-hospitable shelters no longer than 72 hours after they are apprehended. But some unaccompanied children are spending longer than a week in Border Patrol stations and processing centers, according to two Customs and Border Protection officials and two other government officials. … One government official said about half of the children in custody — 1,000 — have been with the Border Patrol for longer than 72 hours, and another official said that more than 250 children 12 or younger have been in custody for an average of six days. …

The McAllen Border Patrol station, a facility near the southern tip of Texas that is routinely overwhelmed, was holding 775 people on Tuesday, nearly double its capacity. The Washington Post this week made a rare visit inside the facility, where adults and their toddler children were packed into concrete holding cells, many of them sleeping head-to-foot on the floor and along the wall-length benches, as they awaited processing at a sparsely staffed circle of computers known as ‘the bubble.’ … Experts say transferring children out of detention facilities as quickly as possible is critical, especially for ‘tender age’ children — those 12 or younger, who face physical and mental health issues even during short periods in detention. They sleep fitfully, do not eat well and suffer anxiety, said Amy Cohen, a child psychiatrist and expert witness in the Flores case.”

— Border agents apprehended 1,036 migrants in a record roundup near El Paso earlier this week. The apprehensions, which included 63 children traveling alone, reflect an uptick in the number of large groups trying to cross the border. Border agents apprehended a group of 424 migrants, the previous record, just last month. (NBC News)

Our dishonest and unqualified “President” makes idiotic threats against our “friends” because his Administration has been too maliciously incompetent to deal with a relatively predictable flow of individuals merely seeking to exercise their legal rights. I toured an immigration detention center. The prison-like atmosphere was mind-numbing.

Immigration detention is supposed to be a temporary stop — not an endless jail sentence with the goal of causing migrants to self-deport.

Immigration detention is supposed to be a temporary stop, not a prison. But what else can one call a place with razor wire covered fences, holding cells, head counts, locked dormitories, solitary confinement, limited recreation, inadequate mental health services and no-contact visits?

While visiting the New Mexico border area as volunteers with Catholic Charities Immigration Legal Services of Southern New Mexico in March, a group of undergraduates, three law students, a campus minister and I toured the Otero County Processing Center. Management & Training Corp. (MTC) runs the facility for the federal Immigration and Customs Enforcement service.

A smiling ICE officer greeted us at the start of our visit, explaining that ICE likes giving tours of Otero to dispel criticisms circulating about immigration detention.

Our first stop was the count room dominated by a large board covered with more than 900 colored tags on hooks — mostly blue and orange — representing the detainee population and designating the level of security and privileges afforded based on jumpsuit color. “Blues” have no known criminal history and simply entered the United States without papers. “Oranges” are divided into two groups — individuals who have a history of very minor crimes such as public intoxication, and those arrested for or convicted of other nonviolent crimes. “Reds” have arrests, convictions or other history involving violent activity.

Stories from the border: The women asylum seekers I met need protection, not barriers

In the intake area, we found newly arrived men lingering in a large holding cell behind a locked, metal door waiting to be processed. A security officer explained the intake procedure, but it was hard for me to focus on his words because I couldn’t take my eyes off the mountain of duffel bags and backpacks full of their belongings piled next to a shower room. I later learned that same image haunted my students.

We passed through the medical unit where individuals receive basic medical care. Those with more serious conditions, we were told, are sent outside of the facility. Our guides told us that a psychiatrist visits once a month to oversee medication, and one full-time counselor is available for the 900 or more detainees. There is a small room where detainees deemed suicidal are watched.

Our guides also brought us into one of the dorms — locked housing where 50 men sleep on thin mattresses in rows of bunk beds. I was overcome with a sense of time standing still; boredom pervaded the room. Despite MTC’s commitment to “provide an atmosphere that is comfortable, safe, and conducive to making time pass quickly for those who find themselves in our care,” individuals are limited to two hours of recreation a day.

One of the students asked whether English classes are offered. Our guide replied that they are working on it, that such programs have not been instituted because those at Otero only stay for six to eight weeks. But we met detainees who reported being there for six to eight months or more.

The blues and oranges able to secure a job in the facility (only four of the 50 men in the dorm we visited were working at the time) earn at least $1 a day, the ICE-stipulated minimum wage. I couldn’t help but wonder whether the detainees we saw raking the grounds, mopping hallways, doing laundry or preparing food allowed MTC to meet its labor needs without actually paying for them.

A glimpse through a narrow window revealed the Secured Housing Unit — the solitary confinement block — a row of small cells where individuals causing problems are sent. Men who are vulnerable to bullying or abuse (including transgender women) can also request a move here for protection, though they would have to be pretty desperate to do so.

Immigrants need asylum, not imprisonment

Facilities like Otero are not supposed to be prisons. Most ICE detainees have not been convicted of any crime. For many others, they are detained even though a U.S. court had dismissed charges, authorized release while awaiting trial, or convicted and imposed a minimal sentence already served.

None of these men belong in jail.

Yet the realization that we were in a jail only intensified at our last stop — the visiting area. We found a large glass window running the length of a long table, seats placed on either side. Detainees are kept separate from loved ones and communicate by phone.

Immigration detention is supposed to be a temporary stop for individuals seeking a determination of whether they have a legal basis for staying in the United States. Yet many at Otero are eligible to apply for asylum and other forms of humanitarian protection.

Why are U.S. taxpayers paying a private company to provide housing, food and 24/7 security for individuals, the majority of whom pose no security threat and have a right under U.S. law to seek protection?

Why are these men consigned to live in a mind-numbing, prison-like atmosphere that leads many — in Otero and similar facilities around the country — to become so desperate to get out that they abandon valid claims and self-deport?

Unfortunately, my students and I came to the troubling conclusion that this desperation is not just the inevitable result of immigration confinement, but may actually be the goal in the first place.

In the final “Kafkaesque” twist, perhaps Trump’s “maliciously incompetent” immigration policies will simply convince individuals needing refuge that our legal system is as worthless and dishonest as the ones they are leaving behind.

For the right price and degree of risk (and refugees are by nature risk takers) smugglers will be able to eventually get persistent individuals to the interior. There, as I have pointed out, their chances of avoiding forced removal will be much better than their odds of getting asylum in an unfairly biased, increasingly lawless system that uses illegal coercive methods and is stacked against their claims, no matter how valid or compelling.

Right now these folks are NOT a security risk, no matter what lies Trump and the restrictionists spread. A smart, humane, competent, and law-abiding Administration would simply encourage them to arrive at ports of entry, promptly screen them, apply the asylum laws in the generous way that they were intended, integrate those granted (probably the majority, under a fair, generous application of the law, in accordance with Cardoza-Fonseca) into our society, and return those who do not qualify after full due process in a humane and dignified manner.

Why would folks cross the border between ports of entry to turn themselves in to the Border Patrol if they could present themselves at a border port and be treated promptly, humanely, and fairly? That’s what would actually give us a secure border as well as many grateful, productive new residents who will help the U.S. It would also promptly separate out those who clearly can’t qualify for protection before they establish ties to the U.S.

With a smarter, common-sense approach to the Immigration Courts, universal access to counsel, and better, more professional, judges who were actually well-trained in recognizing and granting meritorious asylum cases (and not expected to function as a “Border Patrol junior auxiliary”), asylum cases could be completed in compliance with full Due Process in months, rather than years. The Border Patrol could go back to real law enforcement, which they are largely ignoring right now in a rush to do Trump’s bidding.

Instead, Trump seems determined to create a situation where many will die, smugglers will get richer, but more individuals will get to the interior where they will live, unscreened and perhaps exploited, but alive, as part of a growing “underground” or “immigration black market.” The Border Patrol won’t even be able to count them or “arrest” (arguably an inappropriate term for
“turn ins”) them as they do now to support their bogus claims of  a “law enforcement emergency.” This self-created “emergency” — actually a humanitarian tragedy —has little to do with legitimate law enforcement. How maliciously incompetent can one Administration get?

And, no, “Trump’s Big Beautiful Wall” won’t stop professional smugglers! They are already laughing at his ineptness and anxiously waiting to see how his next nativist-driven dumb policy will improve their business and fill their coffers. The dumbest smuggler is probably smarter than Trump, and much less dangerous to America.

U.S. Immigration and Customs Enforcement is holding on to more than $200 million in bond money that belongs to immigrants who have been in the agency’s custody, cash that has yet to be returned to thousands of immigrant families or the U.S. citizens who bailed them out, according to data obtained through open records requests.

The unreturned bond money stood at $204 million as of July 31, 2018, according to the data, which immigration law clinics at Stanford University and the University of California at Davis obtained and shared exclusively with The Washington Post. The pot of immigrant bond money grew by $57.3 million between September 2014 and July 2018, the data shows.

More than 18,000 bond payments went unclaimed in that four-year period, according to the data.

Though the trust fund — which the Treasury Department maintains — cannot be used for any other purpose, getting the money back to immigrants and their friends and families has proved a difficult and lengthy process. ICE officials said the agency makes multiple attempts to reach the people who posted the bond, but paperwork and checks mailed to them sometimes are undeliverable or receive no response, and it can be impossible to find the people if they moved out of the country. Those who do submit claims, ICE said, receive their funds within a month.

ICE did not provide data on average wait times to claim the money, and several lawyers and immigrants told The Post they have in some cases waited a year or longer after submitting for reimbursement.

Invisible walls: The lives altered by Trump’s crackdown on immigration

Numerous immigration attorneys said the system for reclaiming the funds is mystifying and nearly impossible to navigate without a lawyer or English-language proficiency, and some who pay the bonds are unlikely to see the money again. As bond amounts remain on the rise, lawyers said thousands of people are putting their life savings in ICE’s hands to secure an immigrant’s temporary freedom without any idea of when or if they’ll see the money again. Many immigrants say it takes far longer than a month to reclaim their funds.

“The toll on a poor family having to pay thousands of dollars in bond can’t be overstated,” said Jayashri Srikantiah, director of Stanford’s Immigrants’ Rights Clinic. “Clearly, something is breaking down when there are hundreds of millions of dollars sitting in an account that belongs to those immigrant families. If nothing else is clear, that is clear.”

Srikantiah and Holly S. Cooper, co-director of UC Davis’s Immigration Law Clinic, said they intend to push for congressional oversight of ICE’s bond system. They said the amassing of bond money indicates a serious problem and could amount to a massive theft from people who can least afford it.

Marco Antonio Torres Rojas, a father of three from Mexico, won his immigration case in August, but it took roughly seven months for ICE to return the $25,000 bond his family and friends paid to gain his release — seven years ago.

When he was detained in 2012 — for overstaying an H-2B work visa — an immigration attorney assured his family that paying the $25,000 bond would be the only way to stave off deportation. But for Rojas, a landscaper and snowplow driver in Minnesota, the sum appeared impossible. He and his wife had just a few thousand dollars in savings.

“We felt a sense of desperation,” Rojas said.

Pay legal fees, or bond fees?

While criminal defendants typically can pay a bondsman 10 percent of the set bail amount to gain release, in the immigration system about 90 percent of bonds require cash for the whole amount upfront.

ICE initially sets bonds on a “case-by-case basis,” the agency said, though not everyone is eligible for bond or release.

For those who are eligible, bonds have been steadily rising since the second half of the Obama administration, after an influx of Central American immigrants. The average bond set by a judge was $3,000 to $5,000 for years, but it rose to $8,000 in fiscal year 2016, according to data from the Executive Office of Immigration Review. Bonds have remained at that level or slightly higher into the first months of fiscal year 2019.

“I hear from people who call me asking, ‘Should I use the money to pay legal fees or pay the bond fees?’ ” Cooper said. “ ‘I only have one truck. If I sell it, it’s $5,000.’ ”

Once the money is raised — often from numerous people in each case — only a U.S. citizen or legal permanent resident can post the bond. Because many immigrants don’t have a close relative who fits the definition, they sometimes turn to acquaintances or neighbors, said Michelle N. Mendez, an immigration attorney at the Catholic Legal Immigration Network in Silver Spring, Md. That person, according to ICE policies, is the only one who will ever get a copy of the bond paperwork.

Mendez said many immigrants don’t know that once the bond is posted, only the person who posted the bond can get it back.

The person who posted the bond money might move across the country or even out of the country; they might lose the original paperwork required to reclaim the money back, creating additional hurdles; the obligor might die.

Gloria Contreras Edin, an immigration attorney in Minnesota, said she had one undocumented client whose obligor was on the brink of dying of cancer. Before the man died, her client wheeled him into her office so he could sign over the bond responsibilities to someone else. Her client, Anibal El Verengue, a Guatemalan who lives in Minnesota and was ordered removed in 2015 for entering the country illegally, said he would not have known to do this if he did not have an attorney to advise him.

“One friend who I owe money won’t even speak to me, because he doesn’t trust me anymore,” El Verengue said, whose application for asylum is pending.

Money just sits there

Mendez said she discovered how dire the problem was in 2009, two years after a well-publicized immigration raid at a Baltimore 7-Eleven resulted in numerous deportations. When Mendez checked in on some of the families of the deported men, she discovered they were living in poverty.

“I wanted to make sure that when the breadwinner got deported, the family would have some money,” Mendez said. “Those were the cases where I started to think: How do we get this money back? Nobody really knew . . . At that point, they’re really so far removed from the bond posting — thinking, ‘Oh well. I lost my case. I’m not entitled to anything’ — that they just let it be.”

“ICE does not notify the alien for whom the bond was executed, because its contract is with the obligor,” ICE said in a statement.

ICE makes three attempts to locate the person, but if the person who posted the bond did not file paperwork indicating a change of address, it might not be possible to find them.

And even those who follow the procedures said the process is rife with delays.

María Sosa, a legal permanent resident in California, said her husband won his immigration case in October but that she did not receive a bond cancellation notice from ICE until January. Unable to speak English, she made numerous visits to an ICE office to understand what she needed to do to get her money back; she received it on March 29.

She said she and her husband could not afford to attend his funeral.

“The whole system is created in a way that doesn’t foster the accessibility to those funds,” Contreras Edin said. “And so many times the money is left and just sits there.”

ICE pays interest on bond money while unclaimed, up to one year. After that, the funds are transferred to the Treasury Department. The Treasury Department said it does not know what year the $204 million began accumulating. The U.S. government is not allowed to use the money unless immigrants fail to adhere to bond conditions and forfeit it, otherwise known as a bond breach.

Bonds can be breached for reasons such as failure to show up in court or failure to turn the immigrant over to authorities if ICE asks the obligor to do so. But there can also be mistakes. Mendez recalled a case in which ICE breached her client’s bond for failure to show up to be deported — but her client was still appealing the removal order, and ICE had apparently missed that information, according to 2015 correspondence with ICE she provided to The Post.

About $34.5 million in bonds are forfeited each year, money that ICE uses to defray detention and apprehension costs.

Advocates at Stanford and UC Davis argue that the arrangement creates a conflict of interest.

“They obviously have incentive to not exercise discretion favorably and to breach more bonds,” said Emily Child, who worked on the Stanford and UC Davis research with Cooper. “That money goes right back into their pockets.”

ICE said that all breach decisions can be appealed to the U.S. Citizenship and Immigration Service. When breaching bonds, agents consider whether the violation was an accident or intentional and whether the obligor or immigrant was acting in good faith, ICE said in a statement.

‘An incredible amount’

Rojas was getting nervous. It was March, and he had been waiting seven months for a check that would be addressed to his brother’s wife, the U.S. citizen who posted his bond.

He called his attorney, Contreras Edin, expressing his fear that something had fallen through the cracks. The lawyer’s office contacted ICE bond specialists. A few weeks later, the check arrived.

Cooper and Srikantiah said they believe that working with an attorney is crucial to recovering the bond money, and many immigrants and those who post the bonds don’t have lawyers or can’t afford one.

They argue that ICE’s systems are outdated and cumbersome, and they believe immigrants should receive copies of their bond paperwork in a language they can understand, something that could mitigate the possibility of fraud and ensure that those who pay bonds receive the money back when they are entitled to it.

“While something like $5,000 or $10,000 might not be a lot of money to the federal government, to an individual family that has pulled all of their money together in order to get a loved one out of detention, it’s an incredible amount,” Srikantiah said. “With detention growing at the rate it is, we think this is a really good time for Congress to provide some oversight and actually investigate why this is happening.”

On the stretch of highway careening south from Columbus to Lumpkin, patches of Georgia red clay lie like open sores on the road’s shoulder. The sun burns bright orange, through air that is hazy with pollen and smoke from controlled forest fires.

The land here was once valuable. It was coveted. Nearly 200 years ago, white men named this county Stewart, after a revolutionary war militia general. White men massacred the men, women and children of the Creek Confederacy over this land.

Wealthy white men forced black men, women and children to scrape this land and stuff it with cotton. They gouged this land. Farmers, laborers and enslaved Africans dug deep ditches, taking no steps to avoid soil erosion, and those ditches became pits. In one part of Lumpkin, flowing water carved out the enormous pinnacles that mark Providence Canyon State Park. Nicknamed Georgia’s “Little Grand Canyon,” it is a beautiful scar of a violent extractive history.

Today, Stewart is one of the poorest counties in the state of Georgia. Its economic and population peak was in the mid-1800s, when slavery still reigned. Now, nearly half the roads in this majority-black district are still unpaved. Lumpkin’s downtown area, the county seat, has one four-way stop and many boarded up businesses.

The city’s population more than doubles when you include the 2,000 people locked away at the county’s main employer, Stewart Detention Center. The immigration prison is made of concrete and steel, but is sustained by a diversity of barriers.

First, there are the barriers you see: The trees hide Stewart from the roads, the two layers of curly-cue barbed wire fences insulate the facility, the formidable red gates stand tall, and the freshly cut grass stretches like a moat around the building.

Then, there are the barriers you experience: You leave your phone and any other connection to the outside world in your car, wait at two red gates outside the building entrance for an unseen force to open them, endlessly wait for one of three designated rooms to open for visitation, remove your jacket and shoes to endure the TSA-style security process to enter, and then you wait in the empty visitation room for a man with sleepless, red eyes to appear behind the thick, protective, plastic partition.

Next, there are the barriers you hear: the screech of your chair whenever you shift positions, the distracting human resources video blaring in the hallway outside of the visitation room, the echoes reverberating in the small concrete space that prevent you and the immigrant who sits behind the plastic barrier from being able to hear each other, and the static crackling across the telephone line that you must use to listen to the man who is sitting only feet away.

Then, there are the barriers that comprise the very reason this man sits in front of you: the violent political divisions in his home country, the obstacles to making a living wage, the language barrier, the gap in education needed to navigate the labyrinth of immigration bureaucracy.

And, last but not least, there is the barrier that is the entire reason for this place and this situation: the American border.

The logo of CoreCivic Inc. – the private, for-profit prison company that the government pays to run this facility – is a deformed American flag that is missing its stars, leaving only stripes that resemble the bars of a cage.

Through the entrance to the courtroom, President Donald Trump smiles in the lobby from his portrait above the list of that day’s hearings. In those hearings, detainees who have come from all over the world will sit on hard, wooden pews facing the U.S. Department of Justice seal.

Here, an attorney for the government will argue why each of these men and trans women should stay at this immigrant prison, or be sent back to the country they fled. In many cases, these immigrants might not have an attorney to represent them, because they do not have the constitutional right to counsel. Sometimes, family and friends can sit in on the hearing to show support for their loved one’s case.

Here, an immigration judge in black robes will methodically determine whether each of these people will remain caged at Stewart, be returned to the country they escaped, or be allowed to leave the prison. The verdict is delivered either by the judge with an authoritative tone, or the courtroom interpreter with a clinical lilt. If a person is allowed to leave, they will most likely have to continue waiting in this immigrant prison until someone on the outside can pay their bond, which is typically thousands of dollars. If they do leave, it will likely be late in the evening – too late to find transportation out of Stewart County.

The men and trans women who churn through Stewart’s machinery are called by their A-number, not their name. They are reduced to numbers. CoreCivic receives approximately $62 of taxpayer money for each body that fills a bed in its institution each day, according to Shadow Prisons, an SPLC report about the immigration system that is rife with civil rights violations, poor conditions, and little commitment to the safety of detainees. CoreCivic pays the people who are detained here as little as $1 a day for their “voluntary” labor.

To gain their freedom, these detained individuals must prove, through financial statements, that they will not be an economic burden on the government.

This is the knot of racist bureaucracy that staff of the Southeast Immigrant Freedom Initiative (SIFI)a project of the SPLC that provides pro bono legal counsel to those facing deportation proceedings in the Southeast – patiently work each day to untangle. The U.S. immigration system presses every parent, child, sibling and caregiver it entraps into an anonymous mold — a serial number in scrubs — that can be delivered to immigration prisons in a fleet of white vans.

SIFI staff see past the mold. They look into the eyes of each person they represent. They recognize the details that belong to that individual, and that individual alone: their family on the outside working for their release, the aches and pains that prevent them from sleeping, the professional skills they worked for years to achieve.

For many detained individuals, their bureaucratic purgatory in Stewart has been the end of an Odyssean journey to escape torture, the murders of loved ones, and threats on their lives. Every one of these tragic epics is woven with contagious trauma.

Yet, the men and women of SIFI are strong – even when the battles seem uphill every day. They model for volunteers how to confidently perform quality legal work, while treating each client with respect and compassion.

The small community of immigrants’ rights activists in Lumpkin, which also includes local immigration attorneys and the hospitality ministry El Refugio, often supports one another. They celebrate victories — the release of a client, the grant of a low bond amount — and quietly mourn defeats.

Stewart Detention Center is a painful symptom of violent injustice. It festers in a South Georgia landscape that bears deep, historic wounds.

Here, the men and women of SIFI are trying to heal the system.

Grotesque abuses of Constitutional Due Process, fundamental fairness, and human decency, not to mention errors of law, go on daily in the “NAG” aided and abetted by its EOIR enablers. What kind of “court” operates in such a one-sided and coercive atmosphere. Why don‘t those in charge insist on neutral hearing sites rather than those controlled by one of the parties in interest?

Bill Barr just went to great pains to insure that even those who pass “credible fear” and who can prove financial responsibility won’t in the future be released from detention (unless, of course, ICE runs out of detention space, which is already happening).

In fact, they won’t even get a chance to make the case for relief to an Immigration Judge. That’s the kind of mindless “Jim Crow” use of the law to promote cruelty and unfairness that corporate “stuffed shirts” like Barr, more concerned with covering for his corrupt boss than upholding the Constitution, can mete out from his protected perch at the DOJ. But, perhaps the folks at SIFI will be able to stuff Barr’s disregard for the Fifth Amendment back in his face in the “real” Federal Courts.

In any event, history won’t forget the Barrs of the world, any more than they have forgotten the Wallaces and others who were on its “wrong side.”

If nothing else, the performance of Bill Barr over the last several days shows why a true “court system” can’t possibly run under his auspices.

Trump White House plots amped-up immigration crackdown

The purge of Homeland Security leaders will allow the president to shift direction on policy.

President Donald Trump’s dramatic purge of Homeland Security leaders is about more than personnel: It helps clear the way for him to take controversial new steps to curb illegal immigration, including an updated version of his furiously criticized family separation policy.

Leading the new charge is Trump’s top White House immigration aide Stephen Miller, who wants tent cities to house migrants on the border and is pressing to extend the amount of time U.S. immigration officials can detain migrant children beyond the current 20-day limit imposed by a federal judge. Miller wants to force migrant parents arrested at the border to choose between splitting apart from their children or remaining together indefinitely in detention while awaiting court proceedings, according to five people familiar with the plans.

Those hard-line policies could get new traction after a major staffing shakeup at the Homeland Security Department over the past several days. Secretary Kirstjen Nielsen resigned Sunday and Secret Service Director Randolph Alles was ousted Monday. Those moves came after the White House on Friday unexpectedly withdrew its nominee for director of Immigration and Customs Enforcement, Ronald Vitiello. Other officials could be on the chopping block in coming days, according to three other people familiar with the White House’s considerations.

The dramatic proposals and leadership purge are politically risky — family separation has sparked more political anger than almost any other issue in Trump’s presidency — and come as Trump has alarmed his fellow Republicans with abrupt threats to kill Obamacare and to shut down the border. But Trump is determined to make immigration central to his reelection push, betting that he can once again energize his core conservative voters on a promise to secure America’s borders.

Trump and Miller have become increasingly frustrated as the number of Central American migrants massing at the southwest border surges to levels not seen in a decade. Now Miller — who’s even started calling mid-level federal officials to demand they do more to stem the influx — will have a new opportunity to pursue his tougher approach amid the leadership vacuum at DHS.

Trump said Sunday that Customs and Border Protection Commissioner Kevin McAleenan would become acting DHS secretary. Other top DHS positions currently filled by acting officials will be the deputy secretary, ICE director, inspector general and administrator of the Federal Emergency Management Agency. Three of those jobs lack a nominee from the White House.

Miller did not respond to a request for comment.

A federal judge on Monday temporarily blocked a plan to send certain non-Mexican asylum seekers back to Mexico while they await a resolution to their case. The order will not be effective until Friday evening, which allows the administration a chance for a quick appeal.

Still, Miller has a set of new policies he wants to try, according to the five people familiar with the plans, including a “binary choice” between separation or joint detention for families, an idea that first surfaced in the run-up to the midterm elections. Miller also wants to fast-track the regulation that would allow migrant children to be detained for longer than the 20-day limit. He’s eager to finalize the so-called public charge rule, which could block immigrants from obtaining a green card if they’ve received public benefits in the past or are deemed likely to do so in the future.

In addition, Miller has pressed for the federal government to set up tent cities along the border, so that cases can be swiftly resolved — and migrants with non-meritorious claims can be deported.

He’s also pushing for the purge at DHS to continue.

“If you lose Claire, and John, and Francis, I don’t know where that leaves us. But it’s not in a good place,” this person said.

At least some of the personnel moves are getting pushback from immigration restrictionist groups, who like Cissna’s approach.

Roy Beck, president of NumbersUSA, a grassroots organization that seeks lower levels of immigration, said he’s confounded by reports that Cissna may be removed from his post at USCIS.

“He’s great. He’s worked in this issue for years, he’s extremely knowledgeable,” Beck said. “He’s exactly the type of person who needs to be in DHS in leadership.”

But Miller has pressed Cissna, unsuccessfully, to launch more experimentally and legally questionable policies, according to three people familiar with the situation.

Cissna’s defenders contend that he tried to adhere to the law while Miller pressed to overstep legal boundaries.

“If they push out the uber-competent guy that the left hates because he’s getting things done within the law and the right loves because he’s actually being faithful to the president’s campaign promises, they’re even bigger idiots than we already know,” one former DHS official said.

  • The lack of sensitivity training and proper application of the legal standards for asylum that was allowed to go on for many years in this Immigration Courtroom is appalling;
  • The BIA, whose job is supposed be insuring that individuals’ Due Process rights are respected and asylum law is applied in a fair and impartial manner, failed to do its job;
  • The qualification of individuals for asylum based on gender classifications has been well established since Matter of Tobago-Alfonso, 20 I&N Dec. 819 (BIA 1990) was published (at the direction of then-Attorney General Janet Reno) in 1994;
  • LGBTQ cases were well-documented, credible, and routinely granted by the U.S Immigration Judges at the Arlington Immigration Court during my tenure there;
  • I don’t remember ever denying a transgender case — most were either stipulated or agreed upon by the DHS Office of Chief Counsel — yet EOIR failed to institutionalize those “best practices” that would have promoted justice, consistency, and efficiency;
  • Immigration Judges are bound to follow not only BIA precedents, but also the precedents by the U.S. Circuit Courts in the jurisdiction where they sit — that obviously was not happening here — a clear violation of both law and ethics;
  • You can see the difference when an Immigration Judge does listen, properly applies the law in the generous manner dictated by the Supreme Court in INS v. Cardoza-Fonseca and the BIA in Matter of Mogharrabi, and gives the respondent “the benefit of the doubt” as set forth in the U.N. Handbook on the Refugee Convention;
  • The difference in people’s lives and the benefits to the U.S. when judges properly apply asylum law to protect individuals, as intended, is obvious;
  • Those without lawyers and those held in long-term detention are being treated unfairly and not in accordance with Due Process;
  • This system needs reform so that it operates independently, impartially, and under the legal standards established by law and by Article III Circuit Courts;
  • Immigration Judges who are biased against asylum seekers must be uniformly reversed and “outed” by a real Appellate Tribunal, not the current “go along to get along” version of the BIA;
  • Judges who unwilling to threat asylum applicants and other foreign nationals fairly should not be reappointed to the bench in a competitive, merit-based process;
  • Trump’s recent “we don’t need no stinkin’ judges for asylum cases” rhetoric is as absurd as it is ignorant, unconstitutional, and damaging to both our precious  justice system and vulnerable human beings who need and are legally entitled to our protection.

Public and private contractors running immigration jails violated federal detention standards thousands of times in recent years — including failing to report allegations of sexual assaults and staff misconduct to U.S. Immigration and Customs Enforcement — but were fined only twice, according to a report issued Friday.

The Department of Homeland Security’s inspector general called on ICE to improve oversight of facilities that detain roughly half the 45,000 immigrant detainees held every day across the United States, and to do a better job holding federal contractors accountable for their health and safety.

ICE defended its oversight in a letter to the Inspector General that was included in the report, and said generally it can terminate contracts or relocate immigrants if it believes facilities are unsafe.

ICE documented 14,003 violations from Oct. 1, 2015 through June 30 at 106 facilities nationwide, the report said. The fines assessed by the agency amountedto $3.9 million, or 0.13 percent of the more than $3 billion ICE paid to the contractors during that period.

One facility was fined after “a pattern of repeat deficiencies over a 3-year period, primarily related to health care and mental health standards,” the report said. Another fine followed a Labor Department order against the facility for failing to pay proper wages.

In other cases, the inspector general found, immigration officials granted waivers allowing some contractors to bypass detention standards or avoid punishment for violations. From September 2016 through July, 65 waivers were approved — most for indefinite time periods.

One waiver authorized a facility to use CS gas, or tear gas, even though it is 10 times as toxic as pepper spray.

The inspector general said immigration officials lacked formal policies to oversee waivers and that some officials “without clear authority” were granting them.

“Key officials admitted there are no policies, procedures, guidance documents, or instructions to explain how to review waiver requests,” the report said.

The inspector general issued a series of recommendations urging ICE to shore up its oversight of detention facilities and ensure paperwork is included in contracts that will make clear when the agency should impose penalties on contractors that fail to follow federal rules.

“ICE has a strong record of holding detention facilities accountable when deficiencies are identified,” spokesman Matthew Bourke said in a statement.

He said the waiver process in the inspector general’s report is a “rarely used mechanism.”

The report comes as the White House and Congress are preparing for a heated battle over detention funding, building a wall on the southern border and other aspects of President Trump’s immigration crackdown. This week, Democratic lawmakers unveiled a proposal to “significantly” reduce ICE detention beds, require more detention facility inspections, and limit ICE’s leeway to detain more immigrants than Congress allows.

The 106 facilities in the report housed an average of 25,000 immigrants a day as of fiscal year 2017. They are under ICE’s direct oversight. About 100 other facilities are run by the U.S. Marshals Service and are not included in the report.

ICE contractors are required to comply with detention standards that outline their responsibilities, the services they must provide to immigrants and what each facility must do to provide a “safe and secure detention environment for staff and detainees,” the report said.

Time for 1) some House oversight, 2) accountability for those at DHS and their contractors responsible for these abuses, and 3) Congressional action to phase out and strictly limit DHS’s grossly overused and under supervised detention function.

The Trump administration may have separated thousands of migrant children from their parents at the border for up to a year before family separation was a publicly known practice, according to a stunning government review of the health department’s role in family separation.

A report by the health department’s Office of Inspector General (OIG) published Thursday said officials at the health department estimated “thousands of separated children” were put in health department care before a court order in June 2018 ordered the reunification of 2,600 other children.

“The total number of children separated from a parent or guardian by immigration authorities is unknown,” the report said.

In 2017, officials at the health department’s Office of Refugee Resettlement (ORR) observed a steep increase in the number of children referred to ORR care who had been separated from their parents or guardians by the Department of Homeland Security (DHS), according to the report.

In response to the increase, officials began informally tracking separations. “Thousands of children may have been separated during an influx that began in 2017, before the accounting required by the court, and HHS has faced challenges in identifying separated children,” the report said.

US attorney general Jeff Sessions announced the “zero tolerance” policy that made family separations possible in April 2018, but advocacy groups had been warning for months that family separations were already taking place.

In June 2018, a federal judge ordered 2,600 children to be reunited with their parents, but the health department said in the five months following the order, it was still identifying children who should have been considered separated but were not being clearly tracked in government systems.

At the Berks Family Residential Center, an immigrant detention facility in Leesport, Pennsylvania, advocates and former detainees say it’s normal for children held there to have health problems.

One mother, who asked to use her middle name Arely, told the Guardian that children often had fevers or vomited when she was detained at Berks. She said she watched helplessly as her two-and-a-half-year-old daughter threw up blood for three days.

Another woman – who asked to be referred to only by her middle name Fernanda because she still fears her antagonists in her home country – remembered children with the flu and respiratory illnesses, and how the on-site medical professionals would take their temperatures but never give out medicine. When Fernanda’s own daughter had fever, she had to go to the hospital just to get Tylenol, she said.

Since attorney Jacquelyn Kline began representing immigrant families detained at Berks in the summer of 2014, she said the majority of her clients have gotten sick. Usually, the illnesses have been minor. But sometimes, when common problems have gone ignored or untreated, they have spiraled to become something more.

“In my experience, [the staff] do the bare minimum and they don’t want to do more than that unless it becomes a situation where they have to do it,” Kline said. “Because they don’t address things when there are minor issues, it allows them to become more serious issues.”

One Berks resident wrote to US Immigration and Customs Enforcement (Ice) in late 2015 that though her son’s skin disease had spread to his genitals and bled when scratched, the clinical team had not provided him with medication.In May 2016, a three-year-old boy who had been suffering from fevers and loss of appetite for months was finally diagnosed with an intestinal parasitism after his mother found a worm in his diaper.

Berks did not respond to a request for comment. Ice’s public affairs officers are out-of-office for the duration of the government shutdown, according to an automated email from the Pennsylvania officer’s account. Ice confirmed that he is currently furloughed.

The fact that serious medical conditions occur and go untreated for days, weeks or months while immigrant children are under the government’s protection may come as a surprise to many. But advocates who have been on the ground at detention facilities under the purview of the Department of Homeland Security (DHS) are well acquainted with stories such as these that point to a wider trend.

“I am surprised that more children or parents have not died while in DHS custody, given the systemic failure on the part of the government to provide medical services,” said Kathryn Shepherd, national advocacy counsel for the Immigration Justice Campaign at the American Immigration Council.

In late 2018, the deaths of two migrant children while in US custody near the southern border made national headlines and refocused attention on immigrant children who are in the country illegally. First, seven-year-old Jakelin Amei Rosmery Caal Maquin died from cardiac arrest associated with dehydration on 8 December after being apprehended by DHS’s Customs and Border Protection (CBP).

Then, on Christmas Eve, eight-year-old Felipe Gómez Alonzo became the second child in a matter of weeks to succumb to illness after being taken into custody by CBP. It was later determined that he had the flu.

At first glance, the deaths appeared an exceptional phenomenon. Homeland security secretary Kirstjen M Nielsen has said that before last December, an immigrant child had not died in CBP custody in more than a decade.

But for those familiar with the ways in which DHS holds immigrant families beyond the border through Ice, the deaths felt part of a long medical history of neglect, misdiagnoses and close calls associated with undocumented children. This history dates to at least 2014, when the department ramped up mass incarceration of immigrant families under President Barack Obama.

“I don’t think that this is a new problem,” said Shepherd. “I think that this is something that’s been a problem for a long time.”

Before accepting her current post, Shepherd served as managing attorney for a pro-bono project representing asylum-seeking families at the South Texas Family Residential Center in Dilley, Texas. Women and children detained there have beenairlifted or rushed to a hospital in an ambulance on a number of occasions, she said. Last summer, Vice News reported that a toddler had died six weeks after leaving the Ice detention center, where she contracted what started as a common cold but evolved into a deadly virus.

Brad Berman, a clinical professor of pediatrics at the University of California- San Francisco and fellow of the American Academy of Pediatrics, said the DHS facilities he is aware of that hold immigrant families crossing through the US’s southern border appear to be “providing inadequate or substandard medical care”.

“They are violating their own standards – federal standards, as well as state standards, as well as ethical standards,” he said.

Vincent Picard, deputy assistant director to Ice public affairs, said that Ice spends more that $250m annually on healthcare for their charges. He cited the June 2017 DHS inspector general’s report that found the agency’s family residential centers to be “clean, well-organized and efficiently run”.

“Ice takes very seriously the health, safety and welfare of those in our care,” Picard said in a statement. “Ice is committed to ensuring the welfare of all those in the agency’s custody, including providing access to necessary and appropriate medical care. Comprehensive medical care is provided to all individuals in Ice custody.”

An independent medical evaluation Berman did tells a different story. He found that the standards of pediatric medical care and mental health evaluations and care” for one immigrant child “were breached during her stay” at Berks, the Ice family detention center in Pennsylvania, in 2016. The girl, whose mother Maria requested she be referred to by her middle name Beatriz, was bedwetting after traveling to the US from El Salvador. She was nine years old.

Soon after arriving at Berks, Beatriz had several appointments with Michael Mosko, a psychologist provided by the facility. In his notes from one of the sessions, Mosko wrote that after conferring with an interpreter , he was under the impression that the bedwetting “was related to nothing more than laziness”.

After Beatriz was released from Berks, she visited a pediatric urologist and nephrologist who diagnosed her with chronic renal failure – or loss of kidney function. Though the condition was likely associated with Beatriz’s premature birth, it was exacerbated by a misdiagnosis during her time in detention, Berman said.

Now, Beatriz takes pills every night for her illness, which Maria said can’t be cured.

“She looked good when we were in El Salvador,” Maria said. “It was when she came here that she got sick.”

For Maria and Beatriz – as for many of the families from Central America who have crossed the US-Mexico border in recent years – leaving El Salvador was an attempt at self-preservation. When licensed clinical social worker Kathryn S Miller evaluated Beatriz, her report indicates that Beatriz and Maria shared stories about how the child watched her mother get robbed at knifepoint, experienced a home invasion, and overheard accounts of family friends being murdered by gang members.

Over the course of a year, Miller evaluated a handful of children who were detained at Berks. She said there was no doubt that each of them had been exposed to repeated trauma while in their home countries and had legitimate reasons for requesting asylum.

While families seeking asylum make their case, many of them fall into DHS custody and rely on the medical professionals the department supplies.

“There’s just basic needs that children have,” said Miller. “And if they’re going to be tasked with taking care of vulnerable children, they need to have the training and support to make sure they’re taking good care of them.”
