STATE DEPARTMENT PAVES WAY FOR MORE INHUMANITY AND CHAOS IN US, CENTRAL AMERICA, AND HAITI WITH RECOMMENDATION TO TERMINATE “TPS” PROTECTIONS!

“More than 300,000 Central Americans and Haitians living in the United States under a form of temporary permission no longer need to be shielded from deportation, the State Department told Homeland Security officials this week, a few days ahead of a highly anticipated DHS announcement about whether to renew that protection.

On Tuesday, Secretary of State Rex Tillerson sent a letter to acting DHS secretary Elaine Duke to inform her that conditions in Central America and Haiti that had been used to justify the protection no longer necessitate a reprieve for the migrants, some of whom have been allowed to live and work in the United States for 20 years under a program known as Temporary Protected Status (TPS).

Tillerson’s assessment, required by law, has not been made public, but its recommendations were confirmed by several administration officials familiar with its contents. The officials spoke on the condition of anonymity to discuss internal deliberations.

DHS has until Monday to announce its plans for roughly 57,000 Hondurans and 2,500 Nicaraguans whose TPS protections will expire in early January. Although most arrived here illegally, they were exempted from deportation after Hurricane Mitch devastated Central America in 1998. Their TPS protections have been renewed routinely since then, in some cases following additional natural disasters and resulting insecurity

Advocates say removing TPS would be a cruel blow to long-standing, law-abiding immigrants, forcing them to decide between remaining in the country illegally or leaving their homes and families. According to a recent study by the left-leaning Center for American Progress, TPS recipients have nearly 275,000 U.S.-born children.

If recipients lose their protections but defy orders to leave, it would not be difficult for immigration enforcement agents to find them. The provisional nature of their status requires them to maintain current records with DHS; the agency has their addresses, phone numbers and other personal information.

“Terminating TPS at this time would be inhumane and untenable,” a group of Catholic charity leaders wrote to Duke in a recent letter, arguing that it would “needlessly add large numbers of Hondurans and Salvadorans to the undocumented population in the U.S., lead to family separation, and unnecessarily cause the Department of Homeland Security to expend resources on individuals who are already registered with our government and whose safe return is forestalled by dire humanitarian circumstances.”

If DHS ends the TPS protections, it is expected to grant recipients a grace period of at least six months or more to give them time to prepare for departure.”

With the Caribbean recovering from storm damage, the US unable to take care of Puerto Rico, and individuals arriving in the US daily in flight from violence and disorder in Central America (one of the most violent and dangerous regions in the entire world) this seems like a boneheaded, politically motivated decision. Hopefully, as Nolan Rappaport has mentioned several times in this blog, Congress and the Administration will be able to work something out for these folks.

If not, most folks aren’t going anywhere soon. Most individuals with TPS do not have final orders of removal from the US. Therefore, they would have to be processed through the US Immigration Courts which currently have a 640,000 case backlog.

The Trump Administration continues to operate in its own world of cruelty, disorder, incompetence, and squandering of Government resources, without regard to either reality or humananitarian factors.

THE HILL: N. Rappaport On The Diversity Program

“What is the Diversity Visa Program?

Section 201(e) of the Immigration and Nationality Act (INA) provides 55,000 visas a year for a class of immigrants known as “diversity immigrants,” from countries with historically low rates of immigration to the United States.

The number temporarily has been reduced to 50,000, to make up to 5,000 visas a year available for use by Nicaraguans who are eligible for the NACARA program.

The eligibility requirements are stated in section 203(c). The applicant must have been born in a designated country. There are exceptions based on other connections to the designated country. Also, he must have at least a high school education or its equivalent, or two years of work experience that required at least two years of training or experience to perform.

Reasons for terminating it.

While it may be difficult to justify terminating the program on account of the recent terrorist attack, there should be some benefit to offset the fact that the program could bring terrorists to the United States. If the New York City terrorist hadn’t been here, he wouldn’t have been able to commit a terrorist act here.

The claimed benefit is diversity, but does the program really make America more diverse? The United States has a population of 326,199,506people, and that number is increasing by one international migrant (net) every 32 seconds. How does adding 50,000 aliens a year make the country more diverse?

Nevertheless, the program is bringing a lot of people in an absolute sense. Since 1995, it has made visas available to roughly one million people who have no ties to the United States. Is this fair to American citizens and legal permanent residents who get visa petitions approved to bring family members here and then have to wait years for visas to become available?

Lastly, the visas are allocated randomly on the basis of a lottery run by the Department of State.

“A lottery is a crazy way to run an immigration system,” according to Steve Yale-Loehr, an immigration law professor at Cornell. “No other country selects immigrants based on a lottery.”

Wouldn’t the program add as much diversity if the same number of aliens, from the same group of countries, were to be selected on a merit-based point system?

My prediction is that the program will be terminated to make the visas available to family and/or employment-based immigrants.”

I don’t know that I see enough information to justify terminating the program at this time. But, Nolan’s point that the visas might better be used for other categories as part of overall immigration reform seems like something that should be part of the discussion.

WASHPOST: TRUMP’S ANTI-IMMIGRANT WHITE NATIONALIST HYSTERIA & UNJUSTIFIED ATTACKS ON OTHERS DIMINISHES OUR COUNTRY AND MAKES US LESS SAFE!

Three Editorials in today’s Washington Post emphasize the extremely counterproductive nature of Trump’s response to the NY terrorist attack.

First, on his inappropriate attempt to blame immigrants for the incident:

“IN LOWER MANHATTAN on Tuesday, not far from the memorial to the 9/11 attack on the World Trade Center, eight people were killed and 12 injured when a man espousing fidelity to the Islamic State drove a rented pickup down a busy bike path along the Hudson River. “It was gruesome. It was grisly. It was surreal,” one witness said of bicyclists and pedestrians being mowed down. The attack on innocent people enjoying a fine autumn day was a chilling reminder of the persistent threat posed to the United States by Islamist extremists — and their ingenuity in finding ways to commit murder.

Some small comfort can be taken in the fact that in the 16 years since the fall of the twin towers, improvements in protecting the homeland and fighting terrorism abroad have lessened the terrorists’ strength to strike and improved our ability to respond. The quick actions of police and other first responders during Tuesday’s tragedy should be applauded. So must the resilience and strength of the people of New York City, who made clear they will not be cowed by fear.

Far less inspiring — indeed, downright dispiriting — was the reaction of President Trump. In a series of tweets that apparently were informed (a word we use loosely) by his viewing of “Fox & Friends,” Mr. Trump went on a harangue about immigration and attacked Senate Minority Leader Charles E. Schumer (D-N.Y.). On Wednesday, Mr. Trump signaled he might upend the judicial process by declaring the suspected attacker an enemy combatant to be shipped off to the Guantanamo Bay prison; federal terrorism charges filed against him later in the day likely would foreclose that from happening. Note that the White House wouldn’t discuss gun control after last month’s mass shooting in Las Vegas, on the grounds that it would politicize a tragedy, but it had no problem launching partisan attacks following a terrorist strike that ought to unify all Americans. Note also, as The Post’s Philip Bump pointed out, that Mr. Trump is quick to jump to conclusions when there are incidents involving immigrants but is far more circumspect when nonimmigrants are involved.

What’s really needed from the Trump administration is not blame-shifting but a serious attempt to investigate and learn from this latest attack. Were others involved or aware of the alleged plans dating back a year that went into the attack? Are authorities right in their initial assessment that the suspect became “radicalized domestically” while living in the United States? Were signals missed when he appeared on the radar of law enforcement in connection with the investigations of other suspects? The 29-year-old, authorities said, allegedly “followed almost exactly to a T” instructions that the Islamic State has put out on its social-media channels on how to carry out attacks. So what can be done to detect and deter other would-be followers?

Among those killed Tuesday were five Argentines who were part of a group of school friends who traveled to New York to celebrate the 30th anniversary of their high school graduation. It was their dream trip to a city known for being open and generous and diverse. Those are the traits that make America great; to undermine them in response to Tuesday’s attack only plays into the hands of terrorists.”

“PRESIDENT TRUMP, ever prone to seek out scapegoats, fastened on a new target in the wake of the terrorist attack in New York: the state’s senior Democratic senator, along with a 27-year-old visa program that offers applicants from dozens of countries a shot at immigrating to the United States.

Mr. Trump singled out Sen. Charles E. Schumer, who, in 1990, sponsored the diversity visa program, through which the alleged attacker in New York, Sayfullo Saipov, is reported to have immigrated to the United States from his native Uzbekistan. In a tweet, the president derided the program as “a Chuck Schumer beauty.”

Never mind that Mr. Schumer’s legislation establishing the program attracted bipartisan support; or that it was signed into law by President George H.W. Bush, a Republican; or even that Mr. Schumer himself unsuccessfully bargained to end the program, in 2013, in return for a bill granting legal residence to millions of undocumented immigrants already in the United States. Neither the facts nor the normal political imperative to avoid partisanship in the wake of a terrorist attack appeared to move Mr. Trump.

His tweet made it appear that his overriding interest in an assault allegedly backed by the Islamic State is to use it to assail immigration — in this instance, a legal program whose beneficiaries represent a speck in the overall number of immigrants. Managed by the State Department since 1995, the program now grants up to 50,000 visas annually, via a random lottery, to citizens of dozens of countries who would otherwise be mostly overlooked in the annual influx of green-card recipients. In recent years, many of the winners have been from Africa and Eastern Europe.

Having reaped political advantage as a candidate in vilifying illegal immigrants, Mr. Trump has set his sights in office on legal migrants, including refugees, from a handful of mostly Muslim countries, whom he’d like Americans to see as an undifferentiated mass of potentially violent interlopers. Gradually, he is chipping away at what was once a national consensus that immigrants are a critical source of vitality, invention and international appeal.

Like almost any immigration program, the diversity visa lottery is imperfect and susceptible to abuse. The fortunate winners, who represent less than 1 percent of those who have applied annually in recent years, are not uniformly equipped to thrive in this country; many lack an education beyond high school. As Mr. Saipov may turn out to prove, even the extensive vetting required of all who immigrate through the program does not provide an ironclad guarantee that it is impervious to applicants who might seek to harm the United States.

The lottery program might be improved. Still, the fact that more than 11 million people applied for it in fiscal 2016 reflects the magnetic appeal the United States continues to exert around the world. Satisfying a small fraction of that demand, through the lottery or some other legal means, is a powerful tool of public diplomacy in countries whose citizens might otherwise have no hope of coming here.”

“Asked about the suspect Wednesday, President Trump called him an “animal.” Prompted to say whether he thought Saipov should be sent to the detention facility at Guantanamo Bay, Cuba, Trump said, sure, he’d consider it. Later, at Wednesday’s White House press briefing, Sarah Huckabee Sanders said flatly that the White House considered the suspect an “enemy combatant.”

The president also said yesterday that the American justice system (presumably including his own Justice Department) is a “joke” and a “laughingstock.” He further opined, “We also have to come up with punishment that’s far quicker and far greater than the punishment these animals are getting right now,” Trump said. (Terrorists are subject to the death penalty, so it’s unclear what he had in mind.) “They’ll go through court for years … We need quick justice, and we need strong justice,” he said.

Thankfully, the Justice Department, like the Pentagon, has learned when to ignore Trump. On Wednesday, Saipov was charged in federal court. By Thursday morning, Trump was backing off his support for sending Saipov to Guantanamo. Once again, the ignorant president shot from the hip and had to creep back to reality.

Just how harmful were Trump’s statements? It is reprehensible for the president to defame our justice system, which is not a “joke” nor a “laughingstock” but the envy of the world. Moreover, in the terrorist context, it has proved remarkably efficient in trying and convicting terrorists, and then handing out maximum punishments. The surviving Boston Marathon bombing defendant was convicted in just this way and sentenced to death.

Based on today’s tweet, we were right to assume that neither Trump nor Sanders had any idea what he/she was talking about (always a good assumption). We will watch with pride as American justice takes its course — and with horror as Trump continues to wreck havoc from the Oval Office.”

Having spent a professional lifetime working on immigration and refugee issues, I can confirm that Trump and his GOP “restrictionist cronies” like Sessions, Miller, and Bannon have managed to transform what used to be “a national consensus that immigrants [and particularly refugees] are a critical source of vitality, invention and international appeal” into a highly partisan and racially-charged attack on the national origins and futures of some of our most productive citizens and residents — those who far more than Trump or his cronies are likely to help us in building a better, safer future for all Americans.

Having worked on all sides of our U.S. Justice System, served as an administrative judge on the trial and appellate levels for more than 21 years, listened to and/or read thousands of accounts of what made people leave their “home countries,” and studied in detail the reasons why some failing countries are “senders” of talented migrants and others, like the U.S., are fortunate enough to be on the “receiving” end, I can say unequivocally that the fairness of our justice system and the overall honsety and integrity of civil servants in the U.S. Government are the primary differences between the “sending” and “receiving” countries, like ours.

As I have observed before, Trump and his cronies are launching what is basically a “Third-World autocratic attack” on our Constitution and our democratic institutions. If they succeed, the immigration “problem” might eventually be “solved” because nobody will want to come here any more. How many people risked their lives trying to get into the former Soviet Union?
Donald Trump, his cronies, and his enablers are and will remain a much greater threat to our safety and Constitutional institutions than any foreign terrorist could ever be. We ignore his dangerous and fundamentally un-American rants at our own peril!

“One of the biggest future crises in U.S. health care is about to collide with the hottest political issue of the Trump era: immigration.

As the largest generation in American history – the baby boom – heads into retirement and old age, most of those aging boomers will need someone to help take care of them for at least some portion of their twilight years. Demand for home health aides is expected to outstrip the growth for nearly all other jobs in coming decades, with the Bureau of Labor Statistics projecting the number of home health aide positions will increase 38 percent by 2024. That puts it among the top five fastest-growing U.S. occupations.

So who’s going to do it? The question is one of the biggest uncertainties looming over not only the health care, but the labor market overall. Health policy experts have been raising the alarm for some time: No matter how you look at it, the United States is going to need a lot more caretakers and home health aides. And we’re going to need them soon.

Right now, immigrant workers fill a significant share of the formal and informal caretaker workforce. In health care overall, immigrants (both legal and undocumented) make up roughly 17 percent of workers, on par with their representation in the broader labor force. When it comes to home health care, however, that figure is considerably higher: about 24 percent, according to the nonpartisan Migration Policy Institute.

There’s a reason foreign-born workers take so many home health jobs: they’re low-paid, low-skilled and increasingly plentiful. Barriers to entry are low; a high school degree is not usually a requirement and neither is previous work experience. Much caretaking comes from family members, of course. But with families getting smaller, more Americans living alone and chronic diseases growing more complex, a lot of that care in the future will need to come from professionals.

 

The job also isn’t easy. Home health aides can be tasked with bathing and feeding clients, cleaning the person’s house, driving them to doctor’s appointments and even helping with trips to the bathroom. It’s one of those occupations that comes to mind “when people say that immigrants do the jobs that Americans don’t want to do,” notes Patricia Cortés, an assistant professor of markets, public policy and law at Boston University’s Questrom School of Business.

Bianca Frogner, an associate professor at the University of Washington School of Medicine, said the low barriers to entry make it a natural fit for immigrants who are new to the U.S. workforce. “It’s easy to get into and they’re in high demand,” she said.

This is where politics comes in: The current move to curb immigration threatens to cut off the main supply of potential new workers to care for aging Americans.

Illegal immigration isn’t the issue. The home health care immigrant workforce is vastly legal. The Pew Research Center found that just 4 percent of nursing, psychiatric and home health aides are in the country without legal status, based on an average from 2005 to 2014. Some home health aide positions require certification, which may drive down the ranks of undocumented immigrants in those positions.

The question for the health care system is what will happen to the flow of legal immigrants. Trump and immigration hawks in Congress have endorsed a bill that would cut legal immigration in half over a decade. The bill would also refocus the immigration system to prize better-educated and more highly skilled immigrants — potentially choking off the supply of lower-skilled workers who are the likeliest candidates to fill the home health aide jobs of the future.

In theory, native-born Americans could take some of those jobs, but there are reasons to assume they won’t.

The strange thing about home health care work is that immigrants don’t appear to drive down wages, as happens in some other fields. If anything, they tend to push wages higher. Naturalized citizens who worked as nursing, psychiatric and home health aides earned 22 percent more than their U.S.-born counterparts, according to 2015 American Community Survey data analyzed by the University of Washington Center for Health Workforce Studies.

Lindsay Lowell of Georgetown University’s Institute for the Study of International Migration, said the wage phenomenon and the fact that the work is a natural fit for new immigrants make it a no-brainer: Immigrants are our best caretaking option for the foreseeable future. “You put all that together,” Lowell said, “and I think it’s a good thing.”

In a sane system led by competent individuals with the common good in mind, this would be a “no brainer.”  Legalize the existing undocumented workforce to provide some “upward and sideways” mobility to staff these jobs in the short run, while expanding legal immigration opportunities for these positions in the future. More legal immigration would also contribute to the tax coffers and add needed workers to the Social Security contribution base. Moreover, it would conserve considerable Government funds now being squandered on counterproductive immigration enforcement and unnecessary detention, as well as relieving the pressure on the overwhelmed Immigration Courts. That, in turn, would free up enforcement resources to concentrate on removing serious criminals and shutting down international smuggling cartels.

However, when policy is driven by bias, prejudice, and irrationality, as with guys like Trump, Sessions, Bannon, Miller, and the “RAISE Act Bunch” the results are a lose – lose.

CLOWNS RULE: TRUMP-SESSIONS GONZO IMMIGRATION ENFORCEMENT UNDERMINES ADMINISTRATION’S OWN CENTRAL AMERICAN POLICY!

“MEXICO CITY — The United States and Mexico are teaming up in a new effort to stem the flow of immigrants from Central America, even as President Trump carries out policy changes that critics argue could spur insecurity in the region and drive more people north.

In recent years, more people entering the U.S. illegally have come from Central American countries than from Mexico, with more than 200,000 Central Americans detained at the border in 2016.

The new initiative aims to discourage people from leaving Honduras, El Salvador and Guatemala by funding projects over the next six months to improve the economies and security situation in those countries while reducing corruption.

“We’re taking on what we both recognize as the drivers of mass migration,” said Mark Green, the administrator for the U.S. Agency for International Development, who announced the collaboration Thursday after meeting with his counterparts in Mexico City.

Migrants don’t want to leave their homes and family behind, Green said. “If we can take on those drivers at home, then kids get a normal life.”

While Trump asked for a reduction in funding for Central America in his proposed budget to Congress earlier this year — part of a suggested 30% cutback across the State Department — the initiative is a continuation of a strategy forged by his predecessor.

President Obama persuaded Congress to approve more than $750 million in development aid for Central America after more than 68,000 children traveling without an adult were apprehended at the border in 2014. Most of them came from the so-called Northern Triangle countries of El Salvador, Guatemala and Honduras.

In June, Vice President Mike Pence seemed committed to that approach when he met with leaders from Mexico and the Northern Triangle to discuss ways to prevent citizens from migrating to the United States.

Still, experts said those efforts could be undercut by Trump’s other actions in the region.

In August, Trump ended an Obama-era program that granted temporary legal residence in the U.S. to Central American children who could prove they were under threat of violence. The program was designed as a safe and legal alternative for children who might have otherwise sought to migrate alone. Without it, migrant advocates fear more minors will head north with smugglers.

Advocates also warn that other migration-related policies the administration has enacted or is weighing could destabilize the region by leading to much higher levels of deportations of Central Americans from the U.S.

In September, Trump announced that he would be ending the Deferred Action for Childhood Arrivals program, an Obama-era initiative that shields from deportation 800,000 migrants brought to the U.S. as children.

Trump is also weighing whether to renew protections for immigrants living in the country with Temporary Protected Status, which was granted to tens of thousands of migrants in the wake of natural disasters in Honduras, El Salvador and several other countries.

The president has repeatedly called for deporting members of MS-13, a gang active in both the U.S. and El Salvador. In a speech this summer, Trump called the gang members “animals” and promised “they’ll be out of here quickly.”

Mass deportations could be seriously disruptive in the small, poor countries of Central America, said Eric Olson, an expert on the region at the nonpartisan Wilson Center think tank in Washington. It was the large-scale deportation of MS-13 gang members to El Salvador beginning in the 1990s, he said, that helped turn the country into one of the most violent in the world.

“The Trump administration runs the risk of undermining its own policy goals,” Olson said. “If at the same time they’re sending back tens of thousands or hundreds of thousands of people who can’t really integrate well, you may create more instability, and eventually more migration.”

“Few American industries are as invested in the decades-long political battle over immigration as agriculture. Paying low wages for backbreaking work, growers large and small have historically relied on immigrants from south of the Rio Grande. These days, over one-quarter of the farmhands in the United States are immigrants working here illegally.

This is how the growers will respond to President Trump’s threatened crackdown on immigration: They will lobby, asking Congress to provide some legal option to hang on to their foreign work force. They will switch to crops like tree nuts, which are less labor-intensive to produce than perishable fruits and vegetables. They will look for technology to mechanize the harvest of strawberries and other crops. And they will rent land in Mexico.

There is one thing they won’t do. Even if the Trump administration were to deploy the 10,000 immigration agents it plans to hire across the nation’s fields to detain and deport farmhands working illegally, farmers are very unlikely to raise wages and improve working conditions to attract American workers instead.

“Foreign workers will always be harvesting our crops,” Tom Nassif, who heads the Western Growers Association, told me. The only question for policymakers in Washington is whether “they want them to be harvesting in our economy or in another country.” If they choose the latter, he warned, they might consider that each farmworker sustains two to three jobs outside the fields.”

So far, our country and our economy have been saved primarily by the overall incompetence of guys like Trump, Sessions, and their minions. But, it’s an expensive and divisive way to (not) “run the railroad.” We’re actually paying scarce taxpayer dollars for misguided policies that if actually successful would threaten our economic well-being and make our country a worse place to live.

The United States has been created by successive waves of immigration over the course of centuries. Each wave of immigrants from different parts of the world has helped to build the U.S. economy and enrich U.S. society. And each wave of immigrants has provoked a chorus of dire warnings from nativists worried that the presence of too many immigrants will somehow dilute the American sense of identity.

The Center for Immigration Studies (CIS) is one of the groups that routinely issue such warnings. One of the more subtle ways in which they do this is to present immigration statistics in as dramatic a way as possible, with the implication being that native-born Americans are in danger of being over-run by foreigners. In a recent report, for instance, CIS takes advantage of newly released Census data to sound the alarm over the size of the immigrant population in the United States.

Of course, CIS offers no context for this data; no discussion of the historical, economic, political, and social environment within which immigration occurs. Just panicked pronouncements that the immigrant population hit a “record” 43.7 million in 2016—or one out of every eight people in the country.

In fact, immigrants now make up 13.5 percent of the U.S. population, which is less than the 14.7 percent share in 1910. For good measure, CIS also throws in an estimate of how large the foreign-born population might be by 2060 (at which point 78 million immigrants may account for 18.8 percent of the population).

However, the real story is not the number of immigrants; it’s what immigrants do once they’re here. Specifically, the contributions they make to the U.S. economy and the degree to which they integrate into U.S. society.

For instance, based on data from 2015 and 2014, we know that nearly half of all immigrants are naturalized U.S. citizens and that seven out of ten speak English reasonably well. More than one-quarter have a college degree.

There are more than 27 million immigrant workers in the country who make outsized contributions to occupations both low-tech and high-tech. Immigrant households pay hundreds of billions of dollars in taxes each year and wield hundreds of billions in consumer spending power.

And immigrant business owners generate tens of billions of dollars in business income.

This is the kind of context that CIS fails to offer in its run-down of Census numbers. The not-so-subtle implication of the CIS report is that native-born Americans are drowning is a sea of foreigners.

But when you actually start to enumerate the many ways that immigrants (and their children) add value to the U.S. economy as workers, entrepreneurs, consumers, and taxpayers—and integrate into U.S. society while enriching U.S. culture—the numbers represent good news.

You can bet that the CIS false narrative about the “Alien Invasion” and the threat to our culture and our society will be picked up in speeches by Trump, Sessions, Miller, Bannon, and other restrictionists to justify cuts in legal immigration, reducing family immigration, removing undocumented Latino and African workers, cutting rights of asylum seekers (particularly those from Central America and predominantly Muslim countries), and “shutting out” so-called “unskilled immigrants” in favor of guys with college degrees who show up speaking English.

The whole “Immigration Is A Threat To America” that therefore must be reduced, artificially limited, and punished is bogus! It stands in the way of serious discussions of how to reform and re-design our legal immigration system to channel more of the historical flow of needed workers and refugees into legal channels, prevent exploitation of immigrant workers by unscrupulous employers, and thereby reduce the incentives and the flow of “extralegal” migration to levels that can be controlled by non-draconian immigration enforcement working with market forces rather than in opposition to them.

As Sasha Polakow-Suransky, the author of “Go Back to Where You Came From: The Backlash Against Immigration and the Fate of Western Democracy,” warns in The New York Review of Books:

Liberal democracies are better equipped than authoritarian states to grapple with the inevitable conflicts that arise in diverse societies, including the threat of terrorist violence. But they also contain the seeds of their own destruction: if they fail to deal with these challenges and allow xenophobic populists to hijack the public debate, then the votes of frustrated and disaffected citizens will increasingly go to the anti-immigrant right, societies will become less open, nativist parties will grow more powerful, and racist rhetoric that promotes a narrow and exclusionary sense of national identity will be legitimized.

The threat to democracy posed by the current outbreak of populist nationalism has become a matter of concern for both scholars and ordinary citizens. The central topic at a conference at Yale earlier this month was “How Do Democracies Fall Apart,” and the subject will be taken up again in November at a Stanford conference called “Global Populisms: A Threat to Democracy?

I contacted several of the participants at the Yale gathering and was struck by their anxiety over the future prospects of democratic governance.

One of the most insightful was Adam Przeworski, a political scientist at N.Y.U., who has written, but not yet published, his own analysis of current events under the title “What’s Happening.”

First and foremost, Przeworski stresses,

there is nothing “undemocratic” about the electoral victory of Donald Trump or the rise of anti-establishment parties in Europe.

These parties and candidates, he points out:

Do not advocate replacing elections by some other way of selecting rulers. They are ugly — most people view racism and xenophobia as ugly — but these parties do campaign under the slogan of returning to ‘the people’ the power usurped by elites, which they see as strengthening democracy. In the words of a Trump advertisement, “Our movement is about replacing a failed and corrupt political establishment with a new government controlled by you, the American people.”

In support of Przeworski’s argument, it is clear that the success of the Trump campaign in winning the Republican nomination was the result of a classic democratic insurgency: the Republican electorate’s rejection of its party’s establishment.

The danger in the United States, in Przeworski’s view, is the possibility that the Trump administration will use the power of the presidency to undermine the procedures and institutions essential to the operation of democracy:

That the incumbent administration would intimidate hostile media and create a propaganda machine of its own, that it would politicize the security agencies, that it would harass political opponents, that it would use state power to reward sympathetic private firms, that it would selectively enforce laws, that it would provoke foreign conflicts to monger fear, that it would rig elections.

Przeworski believes that

such a scenario would not be unprecedented. The United States has a long history of waves of political repression: the “Red Scare” of 1917-20, the internment of Japanese citizens during World War II, the McCarthy period, the Nixon presidency.

Along similar lines, Anna Grzymala-Busse, a political scientist at Stanford, replied by email to my inquiry:

My big worry is not simply that formal institutions have been eroded, but that the informal norms that underpin them are even more important and even more fragile. Norms of transparency, conflict of interest, civil discourse, respect for the opposition and freedom of the press, and equal treatment of citizens are all consistently undermined, and without these the formal institutions become brittle.

Trump, in Grzymala-Busse’s assessment, “articulates a classic populist message that we see in Europe: the elite establishment is a collusive cartel uninterested in the problems of ‘the people,’” and, she continued, he has begun to follow the path of European populist leaders:

Much of Trump’s language and actions are also familiar: there is a standard authoritarian populist template, developed in Hungary and faithfully followed in Poland and in Turkey: first, go after the courts, then the media, then the civil society, churches, universities.

The attacks on the courts, media and universities

are not simply the ravings of a lunatic, but an established strategy for undermining democratic oversight and discrediting the opposition.

Paul Waldman, writing in The Washington Post on Oct, 17, summed up Trump’s approach to veracity and to reality itself:

Trump takes his own particular combination of ignorance, bluster and malice, and sets it off like a nuclear bomb of misinformation. The fallout spreads throughout the country, and no volume of corrections and fact checks can stop it. It wasn’t even part of a thought-out strategy, just a loathsome impulse that found its way out of the president’s mouth to spread far and wide.

Trump’s recklessness is disturbing enough on its own. But what makes it especially threatening is that much of the public — well beyond the 40 percent of the electorate that has shown itself to be unshakable in its devotion to the president — seems to be slowly accommodating itself to its daily dose of the Trump reality show, accepting the rhetorical violence that Trump inflicts on basic standards of truth as the new normal.”

“A decline in emergency room visits and calls to the police isn’t good news; people are just afraid to ask for help. A domestic abuser will threaten to call Immigration and Customs Enforcement if his spouse threatens to call the cops. A social worker at Las Americas, a public high school for immigrants in Houston, told me despair has set in. Instead of helping families cope with living in the nation’s fourth-largest city, she helps them plan for “when you are deported how can you stay alive the longest.” The students tell her: “Nobody wants me. I have no home.”

They are not wrong; the point of the federal and state legislation is to make Texas so uncomfortable for the undocumented that they move on. I suppose this makes sense if, say, you are constantly faced with competition from the far right, which every Republican, including Gov. Greg Abbott, is. Or if you have seen the growing Latino majority in Texas and know that it isn’t securely nestled in the Republican fold.

But it doesn’t make sense if you are looking at a state whose work force was shrinking even before the devastation of Hurricane Harvey. The people who came to rebuild New Orleans after Hurricane Katrina aren’t feeling the love here. Why should they?

“There are 47 other states that would love to see Texans fall on their butts,” Stan Marek, who has been in construction for years here, told me. Unless we have fair and sane immigration reform, like the “ID and Tax” plan many business leaders here support because it offers fair wages and work-visa status, our immigrants will vote with their feet, and businesses will follow.

That’s the price for trading a welcome mat for an ankle bracelet.

A microcosm of the bias-driven stupidity of the whole Trump-GOP Restrictionist “gonzo” immigration enforcement program. THE BIG IDEA: Jeff Sessions was the personification of a hostile witness whenever a Democratic lawmaker questioned him during a contentious five-hour oversight hearing on Wednesday.

The attorney general set the tone early in his first appearance before the Senate Judiciary Committee since his January confirmation. “I can neither assert executive privilege nor can I disclose today the content of my confidential conversations with the president,” Sessions said in his opening statement.

There were several yes-or-no questions that should have been easy for Sessions to answer, but he refused. Sometimes what someone will not say is more interesting than what they do.

THE SPECIAL COUNSEL:

— Sessions said he has not been interviewed by special counsel Robert S. Mueller III. But has his team requested an interview? “I don’t think so,” the attorney general told Sen. Richard Blumenthal (D-Conn.), reflecting the cautiousness he showed all day. “I don’t know … I don’t want to come in here and be trapped. … I will check and let you know.” Later, Sessions announced: “My staff handed me a note that I have not been asked for an interview at this point.”

— The attorney general declined to express personal confidence in Mueller, a former FBI director: “I think he will produce the work in a way he thinks is correct and history will judge,” Sessions said.

— He also declined to say whether he would resign if President Trump tried to fire Mueller. Sessions said getting rid of Mueller would be up to Deputy Attorney General Rod Rosenstein because he has recused himself. (Rosenstein was interviewed by Mueller’s team this summer.)

Sessions says he can’t disclose ‘confidential conversations’ with Trump

“THE CLOUD”:

— Sessions declined to discuss anything the president told him before firing James Comey. He pointedly refused to answer multiple questions about whether Trump told him that getting rid of the FBI director would “lift the cloud” of the Russia investigation. “I do not confirm or deny the existence of any communication with the president,” Sessions replied. Yet he didn’t hesitate to defend the president’s dubious rationale for axing Comey, which was the former FBI director’s alleged mishandling of the Hillary Clinton email investigation.

— If Trump hadn’t mentioned “the cloud,” why not just say so? In sworn testimony this June, Comey recounted a phone call he received from Trump at the FBI on March 30: “He described the Russia investigation as ‘a cloud’ that was impairing his ability to act on behalf of the country. He said he had nothing to do with Russia, had not been involved with hookers in Russia, and had always assumed he was being recorded when in Russia. He asked what we could do to ‘lift the cloud.’ … He finished by stressing ‘the cloud’ was interfering with his ability to make deals for the country and said he hoped I could find a way to get out that he wasn’t being investigated.”

Trump called again on April 11 to ask for an update on when Comey was going to announce publicly that he was not personally under investigation. “I replied that I had passed his request to the Acting Deputy Attorney General, but I had not heard back,” the former FBI director said. “He replied that ‘the cloud’ was getting in the way of his ability to do his job. … That was the last time I spoke with President Trump.”

— Sessions also would not say whether he was aware of Trump’s draft letter detailing some of the real reasons that he wanted to remove Comey, which Mueller has been reviewing.

PARDONS:

— Can the president pardon someone under investigation by Mueller before they’ve been charged? “Well, the pardon power is quite broad,” Sessions replied. “I have not studied it. I don’t know whether that would be appropriate or not, frankly.” Pressed further, he added later: “My understanding is a pardon can be issued before a conviction has occurred.” (He said that he’d like to reply with more detail in writing. That was one of his go-to lines throughout the day, though Democrats have complained for months that the Justice Department doesn’t respond to their letters.)

— Could the president pardon himself? Sessions again said he hadn’t studied the issue.

— Did Trump discuss pardoning Arizona sheriff Joe Arpaio with Sessions before he announced it? “I cannot comment on the private conversations I’ve had with the president,” he replied.

— What was the process that led to Arpaio’s pardon? “I don’t know that I remember or I know it precisely,” Sessions dodged.

Sessions: ‘I don’t know that I can make a blanket commitment’ to not jail reporters

JAILING REPORTERS:

— Will he commit to not putting reporters in jail for doing their jobs? “Well, I don’t know that I can make a blanket commitment to that effect,” Sessions replied to Sen. Amy Klobuchar (D-Minn.). “But I would say this: We have not taken any aggressive action against the media at this point. But we have matters that involve the most serious national security issues, that put our country at risk, and we will utilize the authorities that we have, legally and constitutionally, if we have to.”

Durbin slams Sessions for wanting safer cities, withholding police grants

LGBT DISCRIMINATION:

— Two weeks ago, Sessions sent a memo to all federal agencies on “protections for religious liberty.” Sen. Dick Durbin (D-Ill.) asked about it: “Could a Social Security Administration employee refuse to accept or process spousal or survivor benefits paperwork for a surviving same-sex spouse?

After four seconds of silence, Sessions replied: “That is something I have never thought would arise, but I would have to give you a written answer to that, if you don’t mind.”

Durbin followed up: Would the guidance Sessions released permit a federal contractor to “refuse to provide services to LGBTQ people, including in emergencies, without risk of losing federal contracts?”

“I’m not sure that is covered by it,” Sessions said, “but I will look.”

“The questions were hardly out of left field — or unfamiliar to the Justice Department,” BuzzFeed notes, adding that the Justice Department has been declining to answer them for weeks.

— The evasiveness played out on a host of other policy questions:

Did Sessions talk with the Texas attorney general about DACA before convincing Trump to end the program? He said such a conversation, if it happened, would be tantamount to “work product” and thus privileged.

Is there any evidence to support Trump’s claim on Monday that the Cuban government was behind the sonic attacks on U.S. diplomats in Havana? “I’m just not able to comment,” Sessions replied.

Democrats noted that Sessions, when he was a member of the committee, would never have tolerated one of Barack Obama’s appointees being so evasive.

— Republicans mostly rallied to Sessions’s defense. Sen. Chuck Grassley (R-Iowa), the chairman of the Judiciary Committee, noted that Eric Holder refused to turn over documents relating to the Fast and Furious program by asserting executive privilege. Though, Grassley added, “The American people have a right to know why (Comey) was fired.”

Sessions stumbles through questions about communicating with Russia

RUSSIA CONTACTS:

— The main headline out of the hearing is that the nation’s chief law enforcement officer is still getting his story straight on his interactions with the Russians: “Sessions offered a slightly new wrinkle Wednesday, asserting that he may have discussed Trump campaign policy positions in his 2016 conversations with (Ambassador Sergey) Kislyak,” Matt Zapotosky, Sari Horwitz and Devlin Barrett report. “The attorney general said it was ‘possible’ that ‘some comment was made about what Trump’s positions were,’ though he also said, ‘I don’t think there was any discussion about the details of the campaign.’The Post reported in July that Kislyak reported back to his superiors in the Kremlin that the two had discussed campaign-related matters, including policy issues important to Moscow. Sessions has previously said he did not ‘recall any specific political discussions’ …”

— Another significant admission: Sen. Ben Sasse (R-Neb.) asked whether the U.S. government is doing enough to prevent Russian interference in future elections. “We’re not,” Sessions responded.

— In the testiest exchange of the day, Sen. Al Franken (D-Minn.) sparred with Sessions over whether he told the truth during his confirmation hearing:

Gonzo would have been a “perfect fit” in the Nixon Administration which gave birth to the term, “stonewalling!”

Let’s see, Gonzo’s “progressed” from saying under oath that he had no contact whatsoever with any Russians during the campaign, to later “clarifying” that he met with none other than the Russian Ambassador during the campaign (while at least implying that these meetings were in his capacity as a Senator, not a campaign official), to saying that he “may have discussed Trump campaign policy positions in his 2016 conversations with (Ambassador Sergey) Kislyak.” Gosh, that sounds to me like enough to sustain an “adverse credibility finding” in U.S. Immigration Court if said by an immigrant!

But, Gonzo says it’s all the fault of bullies like Sen. Al Franken for springing “trick” questions on him. After all, who would have thought that a major figure in the Trump Campaign (one of his earliest, most vocal, and proudest supporters) would be asked nasty questions about the Russia probe?

Gonzo basically refused to discuss the dark implications of his war on LGBTQ Americans, while allowing as how he might target reporters in the future (this Dude recently made speeches on the First Amendment?) if necessary to stop national security leaks.

And, on DACA, Tal Kopan reports for CNN:

“Attorney General Jeff Sessions told senators they have an “opportunity to do something historic” on immigration on Wednesday as he was pressed repeatedly on the administration’s move to terminate a popular protection for young undocumented immigrants.

“We have got to have more than just an amnesty,” Sessions said in his opening remarks. “We need a good improvement in the illegality that’s going on, and there is an opportunity right now, I’m telling you, an opportunity to do something historic.”

Despite multiple follow-ups, Sessions did not diverge much from the remarks, repeatedly telling lawmakers the future of the Deferred Action for Childhood Arrivals program was in their hands.

Testifying before the Senate judiciary committee, the longtime immigration hardliner was asked by senators from both parties about the administration’s plans for DACA, which President Donald Trump has opted to end, citing Sessions’ recommendation.

Sessions did not lay out details of what the administration may want to do for the Obama-era program, which protects young undocumented immigrants brought to the US as children from deportation. Sessions has long railed against the program and once again expressed his belief that the executive action was unconstitutional.

Illinois Democratic Sen. Dick Durbin, though, who has pursued legislation that would offer DACA-like protections for nearly two decades, pressed Sessions on how he could recommend to Trump that the program is unconstitutional and would be found the same in the courts when the Justice Department still maintains a 2014 Office of Legal Counsel memo on its website that found DACA would be constitutional.

“I believe this is accurate, that the so-called approval of DACA by OLC, Office of Legal Counsel, was based on the caveat or the requirement that any action that’s taken be done on an individual basis,” Sessions said, then appeared to mix up court precedent on the issue.

Sessions said a court had struck down the program because individual decisions were not made, but was seemingly referring to a decision made about an expansion of the program to parents. Courts have not found DACA to be unconstitutional to date. 

Durbin noted that each DACA applicant is evaluated individually. All go through background checks before receiving the two-year permits.

Growing frustrated at Session’s answers, Durbin referenced his former colleague’s past on the other side of the dais. “I believe this is just about the moment that Sen. Sessions would have blown up,” Durbin said. 

Later in the hearing, Hawaii Democratic Sen. Mazie Hirono, also a lawyer, asked Sessions if he considered any due process or “bait and switch” issues in recommending the program be ended, since DACA recipients willingly gave the Department of Homeland Security their information in exchange for protection when the program was created. Sessions said he didn’t believe it was discussed.

“It’s a valid issue,” Sessions said. “You’re right to raise it.”

But when Hirono pressed Sessions on what might happen to the individuals covered under the program if it ends in six months, Sessions deflected.

“The answer to that is in your hands,” he said. “Congress has the ability to deal with this problem in any number of ways.” He reiterated he did not support “simply an amnesty” without additional anti-illegal immigration measures, but said “if we work together, something can be done on that.”

In other words, Sessions continued to assert his conclusory, essentially “law free” position that DACA is unconstitutional. He didn’t even know which case he was wtalking about (and it’s not that he didn’t have any idea that Durbin and others were going to quiz him on DACA). At the same time, he can’t bring himself to acknowledge that the DACA young people have been a great boon to the US and to our economy and that they deserve a path to citizenship. Indeed, if Gonzo had his way and the “Dreamers” were actually removed from the US, it would actually “TANK” our economy by reducing our GNP by nearly one-half trillion dollars! And, Gonzo goes on to press his absurd demand that any relief from “Dreamers” be “offset” by  Trump’s “off the wall” immigration restrictionist program. Dreamers are contributing over $400 billion to our GNP, so what’s there to “offset?” We should be happy to have them as permanent members of our society.

No, the real problem here is that the Dreamers and their families (who also are contributing to our society and economy) should have been screened and admitted through our legal immigration system. The solution isn’t to extract a “penalty” from the Dreamers, but rather to expand our legal immigration system so that future Dreamers and their hard-working productive families can be properly screened and legally admitted into the United States in the first place!

That Gonzo, others in the Administration, and the “restrictionist wing” of the GOP keep pushing in exactly the opposite direction is truly reprehensible. The real  “national debate” that we should be having on immigration is how to get Dreamers and other law-abiding undocumented residents on a track to full integration into our society, how many MORE legal immigrants we should admit each year, and how we should select them to achieve the most both for our country’s future and for those vibrant, hard-working, and much-needed future immigrants that we should be attracting! Legal immigration is a good thing, to be valued and welcomed! It’s NOT something to be feared and restricted as Gonzo and his cronies would have us believe! And, by converting most of the flow of “undocumented migrants” into “legal immigrants” we would reduce the need for DHS enforcement directed at the immigrant community. Those resources could be redirected at removing the “real bad guys.”

“Washington (CNN)The administration’s top immigration enforcement official on Tuesday said his agency will vastly step up crackdowns on employers who hire undocumented immigrants — a new front in President Donald Trump’s hardline immigration agenda.

Acting Immigration and Customs Enforcement (ICE) Director Tom Homan spoke at the conservative Heritage Foundation and was asked whether his agency would do more to target not just undocumented workers, but their places of work.
Homan said he has instructed Homeland Security Investigations (HSI), the investigative unit of ICE, to potentially quintuple worksite enforcement actions next year.
He said he recently asked HSI to audit how much of their time is spent on work site enforcement, and said he has ordered that to increase “by four to five times.”
“We’ve already increased the number of inspections in work site operations, you will see that significantly increase this next fiscal year,” Homan promised, saying the goal is to remove the “magnet” drawing people to enter the US illegally.

And he said his agency would approach the task in a way that’s “a little different” than in the past, by going just as aggressively after employees.
“Not only are we going to prosecute the employers that hire illegal workers, we’re going to detain and remove the illegal alien workers,” Homan said.
“When we find you at a work site, we’re no longer going to turn our heads,” Homan elaborated after the event. “We’ll go after the employer who knowingly hires an illegal alien … but we’re always going to arrest a person who is here illegally. That is our job.”
ICE still has posted the previous administration’s policy on work site enforcement, which prioritizes targeting employers that use undocumented labor as a business model, engage in human smuggling, mistreat employees, commit identity fraud, launder money or are otherwise involved in criminal activity.
ICE spokeswoman Liz Johnson said the strategy “continues to address both” employers and employees.
“While we focus on the criminal prosecution of employers who knowingly hire illegal workers, under the current administration’s enforcement priorities, workers encountered during these investigations who are unauthorized to remain in the United States are also subject to administrative arrest and removal from the country,” Johnson said.
According to a 2015 Congressional Research Service report, ICE arrested 541 individuals on immigration charges and 362 individuals on criminal charges in work site actions in 2014, continuing a downward trend in actions from a peak in 2011.”

Been there, done that, likely to be just as unsuccessful and wasteful as ever. Indeed, back in the late 1970’s while I was INS Deputy General Counsel we developed the famous (or infamous, depending on which side one was on) “Blackie’s Warrants” (referencing the then well-known but now defunct Washington, D.C. eatery “Blackie’s House of Beef” a noted employer of undocumented workers) for entry into workplaces for civil immigration enforcement purposes. Workplace operations were a fertile source of Federal Court litigation, alleged constitutional violations, some class actions and injunctions, but not many final orders of removal.
Compounding the problem — lots of the employers whose workers will be hauled off in cuffs are likely to be GOP donors who aren’t going to like it when the law is enforced against them, rather than just food cart operators and lawn mowers. My recollection is that politicos of both parties weren’t too happy either, particularly when key industries like tourism, restaurants, and hotels were hit during “prime season.” But, why not keep repeating the same failed “strategies” over and over again just to prove that they still don’t work?
Let’s see, with 630,000+ pending cases in U.S. Immigration Court and counting, some of these new “employee cases” might come up for trial by the end of 2020, with luck. That is, unless under Sessions the DOJ does yet another round of “ADR.” But, since many of the folks now working in the U.S. probably have at least arguable avenues for relief, most cases probably will take even longer. And, of course, in a “saturated” court system, every “low priority” case mindlessly placed on the docket displaces another case, which might be older or higher priority. But, that’s what “Gonzo enforcement” and wasting Government resources is all about.
Oh yeah, we also happen to have extremely low unemployment. That probably means that no “other U.S. workers” are going to be rushing in to fill those jobs supposedly vacated by Homan’s operations. Been there, done that too — never saw it work successfully in the long run — particularly since the Trumpsters seem determined to cut off or diminish legal work visa opportunities.

“In Texas, Florida, Puerto Rico and the Virgin Islands, mammoth hurricanes have left behind a colossal amount of work. The cleanup and reconstruction efforts are going to take years. That means a severe demand for salvage and demolition crews, roofers, carpenters, IMMIGRANT workers at a makeshift camp in Mississippi following Hurricane Katrina in 2005. (Marcio Jose Sanchez Associated Press) drywall installers, painters, plumbers and workers in all manner of other trades and skills. And if recent history tells us anything, much of this demand will be met by immigrants — migrant laborers, many of them highly skilled, and many of them lacking legal status.

This wasn’t a problem only for immigrants. As long as labor was exploitable and cheap, American-born workers and local businesses suffered too, as conditions and wages slid toward rock bottom.

If we had a federal government sensitive to these issues, the solution would be a moratorium on immigration enforcement in disaster zones. This would ensure that the rebuilders could keep working, and that those depending on them could return home as soon as possible. Given the Trump administration’s relentless attacks on immigrants, there’s little hope for this sensible fix. In the absence of such a moratorium, governors and mayors should insist that federal labor laws be enforced in these areas while reconstruction is underway. Labor laws guarantee workers payment, safe working conditions and the ability to report mistreatment, among other things.

When workers are vulnerable and afraid, aware that their immigration status can be used against them, they are easy targets for abuse. They know that one complaint could mean a quick call to immigration. Their fear of being deported and losing everything shackles them to bad employers.

Diaz and the other workers organized, protesting the discrimination and illegal treatment. In retaliation, the employer evicted them without compensation. When they demanded their pay, the employer called local police and Immigration and Customs Enforcement, which arrested the workers immediately. After spending 78 days in jail, Diaz convinced the district attorney that the workers had been the victim of employer retaliation. The D.A. withdrew the charges, but ICE still detained the workers and sought to deport them.

These abuses, and the exploitation that took place after Katrina, occurred during the George W. Bush administration, which supported comprehensive immigration reform. The climate of fear is far worse today, with agents and officers from ICE and the Border Patrol running roughshod over immigrant communities, goaded by President Trump’s toxic rhetoric.

Nevertheless, immigrants will still risk their lives to come here. Their need is that dire — and our demand is that urgent. The credit rating company Moody’s estimates that the damage from Hurricanes Harvey and Irma could total $150 billion to $200 billion — considerably more than the $108 billion or so in damage left by Katrina. Irma destroyed an estimated 25% of homes in the Florida Keys. In Harris County, Texas, which includes Houston, more than 136,000 homes and other structures were flooded by Harvey. In the aftermath of these disasters, there has been talk of rebuilding homes and cities with greater attention to long-term sustainability and resilience.

Some have even called for a “green New Deal” that marries these goals with stronger social safety nets for storm victims. This worthy vision can and should take into account the people who are doing the rebuilding, making sure they are safe, secure and paid a fair wage. And that means starting with meaningful protections for the immigrant workers who help storm victims return home.

In encourage you to go over to The Hill at the above link and read Nolan’s complete article. As always, whether you agree with Nolan or not, his articles are always thought-provoking and timely. Nolan is definitely a “player” in the immigration dialogue! (And, frankly, by going over to The Hill, Nolan gets a few more “hits” which give him a few more “hard-earned nickels” in his pockets. Gotta help out my fellow retirees!)

I can agree with Nolan’s bottom line:

“It would be better to help undocumented aliens by working on comprehensive immigration reform legislation that meets essential political needs of both parties.”

The challenge will be figuring out what those points might be. So far, the GOP “Wish List” is basically an “incendiary White Nationalist screed” drafted by notorious racist xenophobe Stephen Miller (probably with backing from Sessions and certainly incorporating parts of Steve Bannon’s alt-right White Nationalist world view) that contains virtually nothing that any Democrat, or indeed any decent person, could agree with. Indeed, the very involvement of Miller in the legislative process is a “gut punch” to Democrats and whatever “moderate GOP” legislators remain.

What are some “smart enforcement” moves that Democrats could agree with: more funding for DHS/ICE technology; improvements in hiring and training for DHS enforcement personnel; U.S. Immigration Court reforms;  more attorneys and support (including paralegal support) for the ICE Legal Program; more funding for “Know Your Rights” presentations in Detention Centers.

But more agents for “gonzo enforcement,” more money for immigration prisons (a/k/a the “American Gulag”), and, most disgustingly, picking on and targeting scared, vulnerable kids seeking protection from harm in Central America by stripping them of their already meager due process protections: NO WAY!

Although “The Wall” is a money wasting folly with lots of negative racial and foreign policy implications, it probably comes down to a “victory” that Democrats could give to Trump and the GOP without actually hurting any human beings, violating any overriding principles of human rights law, or diminishing Constitutional Due process. It also inflicts less long-term damage on America than a racially-oriented “point system” or a totally disastrous and wrong-headed decrease in legal immigration when the country needs the total opposite, a significant increase in legal immigration opportunities, including those for so-called “unskilled labor.”

While this GOP Congress will never agree to such an increase — and therefore workable “Immigration Reform” will continue to elude them — the Democrats need to “hold the line” at current levels until such time as Americans can use the ballot box to achieve a Congress more cognizant of the actual long-term needs of the majority of Americans.

There were other tense exchanges as well, including from the former top Democrat on the committee, Vermont Sen. Pat Leahy, who especially took issue with the Justice Department representative. At the outset of the hearing Chairman Chuck Grassley noted that DOJ had not submitted written testimony for the hearing, and acting Assistant Attorney General Chad Readler, of the civil division, said he was limited in speaking outside of what was already public because of ongoing lawsuits over the administration’s termination of DACA.

Leahy pressed Readler on Attorney General Jeff Sessions’ letter about the rescission of DACA, which suggested lax immigration enforcement was responsible for crime, violence and even terrorism.
“Can you provide this committee with any examples of Dreamers being involved in terror activity? … You don’t have to give me hundreds, just give me one!” Leahy said, raising his voice.
“I’m not aware of any examples,” Readler said.
“Neither is the attorney general when he said that,” Leahy said.
After further back-and-forth about what Sessions meant, Readler noted he would be testifying before this committee himself this month.
“He’s taken longer than any attorney general since I’ve been here, but I’ve only been here 42 years,” Leahy said.

Under questioning from Republican Sen. Lindsey Graham, of South Carolina, who has co-sponsored Durbin’s bill, the DHS officials did say they supported a pathway to citizenship for DACA-eligible individuals in an eventual solution — and said they were largely the type of people the US should want.
“They’re a benefit to the country as are many immigrants coming in,” Dougherty said. “They are a valuable contribution to our society, we need to regularize their status through legislative means.”
He also said DHS did not support the notion of creating a permanent visa status that would never allow people to be naturalized — saying the White House would be of the same mind.
“I think creating second-class citizens or people who are never able to naturalize is not a good model,” Dougherty said, adding “I do” when asked if he thinks the President agrees.”

“The first day of the Supreme Court’s new term on Monday will feature a rare legal showdown: The Justice Department will face off against another federal agency. It’s unusual for the Justice Department, representing the United States government, to disagree with an executive agency, much less send its top lawyer to try to defeat that agency before the Supreme Court—but it’s only the first of several such confrontations in the Trump administration.

There are currently three major cases in which the Justice Department under Attorney General Jeff Sessions has taken a position in opposition to another executive agency. The nation’s top court will referee one of these disagreements on Monday, and the other two are likely to reach the Supreme Court next year. The situation is partially explained by politics: The department is opposing agencies whose missions—protecting the interests of workers and consumers—are less likely to align with the goals of a conservative administration. But it’s also a signal of how aggressive the Justice Department plans to be in pursing its conservative agenda through the courts.

“It’s highly unusual to have two lawyers, both representing the federal government, taking opposite positions in a court,” says Deepak Gupta, an appellate lawyer who has filed briefs in two of the cases opposing the Justice Department’s positions. “The fact that it’s happening in multiple instances across a broad range of issues is really remarkable and is a sign of how aggressively the Trump administration is flipping positions on a broad range of issues.”

The case going before the court on Monday concerns workers’ right to collective action. The other two will decide whether the creation of the agency in charge of protecting consumers violates the Constitution and whether the 1964 Civil Rights Act protects employees from being fired because of their sexual orientation. The Justice Department’s willingness to take on other agencies is even more notable because in two of the cases, the department’s top lawyers had to change the department’s position in order to oppose the agencies. Such changes are generally not made without serious deliberation and restraint because the department is expected to have a consistent position on legal issues.

“You would expect the justices to perhaps want to look a little bit more closely at precisely what the government’s position is,” says Jonathan Adler, a professor of constitutional and administrative law at the Case Western Reserve University School of Law, “to make sure that any change is in fact well considered and not something that’s being done cavalierly or superficially.”

On Monday, the US solicitor general, a Republican lawyer named Noel Francisco who was confirmed by the Senate earlier this month, will argue against the National Labor Relations Board (NLRB), which his office was representing until a few months ago. Under President Barack Obama, the solicitor general prepared to represent the NLRB, the federal agency charged with protecting workers from unfair labor practices, before the Supreme Court. But in June, the solicitor general’s office switched sides. “After the change in administration, the Office reconsidered the issue and has reached the opposite conclusion,” the office announced in a brief. The NLRB would now need to represent itself, and the solicitor general would appear in court on the other side. Labor advocates say they have to go back to the Reagan administration to find an analogous situation, in which a new administration changed its position before the Supreme Court for what appeared to be largely political reasons. 

This is not normal, even in a change of administration,” says Celine McNicholas, a labor attorney at the Economic Policy Institute, a progressive think tank, and a former counsel at the NLRB. Politics always affect agencies’ agendas, she says, but for the solicitor general to change his office’s stance before the Supreme Court for what appear to be political reasons “is a significant shift.”

The stakes in the NLRB case are high. The question is whether employment contracts can prohibit employees from joining together to seek better working conditions or higher wages or to address grievances, instead forcing them into secret, individual arbitration proceedings. Since 2012, the NLRB has held that these increasingly common mandatory arbitration clauses are illegal because they violate employees’ right to join together, which is enshrined in the 1935 National Labor Relations Act. The Justice Department has taken the position that in order to get a job, workers can be forced to waive any right to petition collectively in the future. If the department and the employers it is siding with prevail, such employment contracts are likely to proliferate further, giving every employer the ability to escape any chance of a class-action lawsuit or other type of collective agitation.

In March, the Justice Department filed a motion before the DC Circuit Court of Appeals in which it agreed with PHH. A “removal restriction for the Director of the CFPB is an unwarranted limitation on the President’s executive power,” the department wrote in a court filing announcing its new position.The Justice Department has also switched positions in a case over the Consumer Financial Protection Bureau (CFPB), the agency created after the financial collapse in 2008 to protect consumers from predatory mortgages, credit cards, student loans, and other financial products. The agency, the brainchild of Sen. Elizabeth Warren (D-Mass.), has been a target of Republicans since its inception. Now the Trump administration has seized on a chance to weaken it. The case originated when the CFBP levied a $109 million fine against PHH Corporation, a mortgage services provider that it alleged was referring customers to specific insurers in what was tantamount to a kickback scheme. PHH sued, claiming that in creating the CFPB’s leadership structure, Congress made the agency more independent from the president than is allowed under the Constitution. The agency’s director serves a five-year term and can only be fired by the president for cause.

Gupta, a former top official at the CFPB, sees this case as the most troubling of the three because, rather than execute the laws passed by Congress as required by the Constitution, the administration has opted to argue against an act of Congress. This is not unheard of; in 2011, the Obama administration announced that it would no longer defend a federal law that banned the recognition of same-sex marriages. But in announcing that decision, then-Attorney General Eric Holder explained that it was made in consultation with Obama and after an extensive review of the issue.

In contrast, the Trump administration’s decision to flip its position on the constitutionality of the CFPB seemed to lack serious deliberation. Three weeks before the administration announced its new position in a court filing, the department took the opposite position in a case that raised the same constitutional objection to another agency—the Federal Housing Finance Agency (FHFA)—with the same leadership structure as the CFPB. In February, the department filed a brief, signed by acting assistant attorney general Chad Readler, in which it argued that the challenge to the FHFA’s structure was an “illogical thesis” and “wholly without merit.” Three weeks later, Readler made the opposite argument about the CFPB. Acknowledging the conflict, Readler advised the court retroactively in the FHFA case that the government “does not urge reliance” on the argument it had previously advocated.”

But under Sessions, the Justice Department has decided not only to take on other executive agencies, but also to switch positions in a number of other cases, including multiple voting rights cases. How judges will react to this fickleness—particularly in the coming Supreme Court term—could affect the Trump administration’s ability to uphold its broader agenda in the courts. “Of all the offices in the federal government,” says Adler, “we tend to expect the solicitor general’s office to be the most candid about what the law requires versus what’s a policy judgment, and to really not overplay that or overstate that.”

“This is not normal.” That pretty much sums up the Trump Administration and the entire career of “Gonzo Apocalypto” Sessions in a nutshell! The worst thing is that U.S. taxpayers are being ripped off for clowns like Sessions and his fellow travelers who are out to trash the rights and interests of the majority of Americans and to rip apart the rule of law and decency in Government at the same time.

It’s sorta like when guerrillas support themselves by extorting their political enemies or perceived enemies (something that the BIA in its wrong-headed rush to restrict asylum protection doesn’t recognize as “persecution,” even though it’s one of the oldest and most classic forms of political persecution). Make no mistake about it, Gonzo and his team of politicos are waging “guerrilla warfare” against career lawyers and the rule of law at the U.S. Department of Justice and in the Federal Courts. And, to date, they have largely gotten away with it.

These unquestionably are “law-free” bias-driven policy decisions by Gonzo. I’ve never seen any evidence whatsoever that Sessions actually reads or has even basic knowledge of American law. It’s just not necessary for a lifelong member of “The Wrecking Crew.” What is clear, however, is that he arrived at DOJ not with legal books, but with “cue cards” prepared for him by the Heritage Foundation, restrictionist immigration groups, and his White Nationalist buddies Miller and Bannon. His memoranda and briefs are studies in disingenuous doublespeak, complete nonsense, White Nationalist myths, and an overall intellectual shallowness that almost matches that of Trump.

It also shows why nobody should take seriously Gonzo’s disingenuous babbling about the Constitution or the “Rule of Law,” both of which he mocks nearly every day he remans in the high office for which he is so spectacularly unqualified. Liz was definitely right!

The good news, if any, is that by the time this disaster is over, the Solicitor General’s Office will have lost its last shred of credibility in the Article III Federal Courts. And, perhaps it will be a good thing for American justice when the “SG” loses his or her “privileged position” and is finally viewed as just another suspect and self-interested litigant in court. And, not a very smart or very well-qualified litigant at that.

Once lost, credibility can seldom be regained. Think about that one, Noel Francisco, before you and your subordinates become complete shills for the legally and morally bankrupt positions of Gonzo and Trump.
