Proving My Point — The Sessions, Kelly, Trump Claim That More Than 300 Refugees Are Subjects Of Counterterrorism Investigations Earns “Three Pinocchios” From the WashPost “Fact Checker!”

Michelle Ye Hee Lee writes in the Washington Post:

“It’s irresponsible for the administration to tout this number repeatedly without context or giving the public additional information to understand whether refugees are a threat to the U.S. homeland. The burden of proof is on the speaker, yet administration officials repeatedly declined reporters’ requests for more information. Moreover, the administration’s credibility on factual accuracy is open to question, given the frequent false claims made by the president and other senior officials.
This 300 figure, without context, is problematic for three reasons. It represents a tiny fraction of all resettled refugees in the United States per year (83,380 on average), and since the refugee program began in 1980 (3 million). Since Sept. 11, 2001, roughly 190,000 refugees were accepted into the United States from the six countries listed in the immigration executive order. The 300 figure represents a fraction — though unclear how small or big — of the total open counterterrorism investigations (which could be 1,000 or up to 10,000). And we have no idea what charges are involved, or if these investigations will even result in any charges (or convictions, for that matter).

In the absence of context or additional information from the administration, we find this figure highly misleading, worthy of Three Pinocchios. Should the administration decide to share more information to place this figure into context, we’re happy to reconsider the evidence and the rating.”

Coulda been worse, as in “Four Pinochios” the “Lowest Award.” And, there is always a chance that the Administration could eventually provide real evidence to back up its largely fictional claims that refugees are a major threat to our national security.  But, I wouldn’t count on it.

In the meantime, as I suggested in the previous post, Gen. Kelly is likely to see his sterling reputation go down the drain if he continues to go along with the Sessions, Bannon, Miller crowd. All of the latter have spent their lives living in an “alternate universe” largely free of truth, common sense, perspective, reflection, humanity, and common decency (yes, there is a difference between “geniality” and “courtesy” for which Sessions is known and “human decency” of which he has exhibited depressingly little in his long career in public service).

Philip Lacovara and Lawrence Robbins write in the Washington Post:

“Attorney General Jeff Sessions made a seemingly false statement under oath during his confirmation hearing. Admittedly, not every potential perjury case gets prosecuted, and Sessions may well have defenses to such a charge. But as lawyers at the Justice Department and attorneys in private practice who have represented individuals accused in such cases, we can state with assurance: Federal prosecutors have brought charges in cases involving far more trivial misstatements and situations far less consequential than whether a nominee to be the nation’s chief law enforcement officer misled fellow senators during his confirmation hearings.

Certainly there is precedent for a prosecution in this context. Part of the fallout from Watergate included the special prosecutor’s investigation of Richard Kleindienst, who had resigned from his position as attorney general, for alleged false statements during his confirmation hearing before the Senate Judiciary Committee. Kleindienst was asked whether the White House had interfered with a Justice Department antitrust action against the International Telephone and Telegraph Corporation. He stated, “I was not interfered with by anybody at the White House” — but President Nixon and one of his top aides had each called Kleindienst regarding the case. Kleindienst pleaded guilty to a misdemeanor charge for “refus[ing] and fail[ing] to answer accurately and fully” questions at a congressional hearing.

Those facts left no room for any colorable defense on the “knowledge” issue. But when Justice Department officials decide whether to bring a case against Sessions — or, more appropriately, when an independent counsel is appointed and resolves that question — this must be done against the backdrop of other perjury cases that the department has chosen over the years to bring. And the department has prosecuted individuals who advanced defenses very similar to Sessions’s arguments here, often where there was far less at stake.”

POLITICO: “Street-Corner Rules” — Sessions’s Fate Entirely In The Hands Of His GOP Colleagues & Trump — Dems Irrelevant (What’s New?)

“Want to understand the key to the way the Jeff Sessions story is playing out today? Then leave the stately halls of the Capitol, and come with me to the playgrounds and streets of New York, where I first learned one of the most reliable of political rules.

We had no Little League, no organized games of any kind, and certainly no umpire to preside over stickball contests, or pickup games in Riverside Park. So pretty much every other play resulted in an argument (it was, coincidentally or not, a Jewish neighborhood). And the arguments always ended the same way: when a member of one team conceded.
“Yeah, he was out.”

“See?—your own man says so.”

When a political figure gets in trouble, that street-corner rule is the most significant metric of how to measure the depth of the trouble. President Richard M. Nixon could have survived the Watergate scandal had Republican senators backed him; there were 42, well over the one-third-plus-one needed to keep him in office. But when Barry Goldwater, Senate Minority Leader Hugh Scott and other GOP leaders went to the White House on August 6 to tell him his support had melted away, Nixon understood he was finished.

By contrast, President Bill Clinton retained almost total support from his part in Congress—just five House Democrats voted for impeachment—and his survival was assured. As New York Times reporter Peter Baker details in his book on the Monica Lewinsky scandal, “The Breach,” had Senate Democratic leader Tom Daschle and House leader Dick Gephardt gone to the White House with a call to resign, the outcome might well have been very different.

So far, congressional Republicans have protected President Donald Trump from a host of otherwise troubling issues. No tax returns? No problem. Blatant family conflicts of interest? Nothing to see here. Cabinet members with “incomplete” disclosures? Only Labor nominee Andrew Puzder’s nomination was derailed, and that took everything from hiring an undocumented housekeeper to allegations of spousal abuse. (“Fake news,” in Puzder’s telling.)

The story of Attorney General Jeff Sessions is another matter. Rep. Darrell Issa—who as chair of the House Oversight Committee launched approximately 24,598 investigations of Obama administration malfeasance—called for Sessions to recuse himself from looking into charges of Russian meddling in American campaigns. The committee’s current chair, Jason Chaffetz, did the same. So did Rep. Raúl Labrador, one of the leaders of the House Freedom Caucus, the most militant of conservative voices.”

K.O.D.????? — Trump Has “Total Confidence” In Sessions — Few Politicos Survive This!

“President Trump said Thursday that he has “total” confidence in Attorney General Jeff Sessions, who has come under fire for not disclosing his contacts with the Russian ambassador during the 2016 presidential campaign.

Speaking aboard the aircraft carrier USS Gerald Ford in Newport News, Va., Trump told reporters that he was not aware of Sessions’s contact with the Russian ambassador. Trump also said that Sessions “probably” testified truthfully during his confirmation hearing last month before the Senate Judiciary Committee.

Asked whether Sessions should recuse himself, Trump added: “I don’t think so.”

Several top Republican lawmakers have said that Sessions should recuse himself from ongoing investigations into Russian interference in the 2016 election, including potential contacts between Trump campaign officials and associates and Russian officials.

The Washington Post reported Wednesday that Sessions met twice with Russian Ambassador Sergey Kislyak in 2016. When asked a direct question during his confirmation hearing in January about whether he had any contact with Russian officials, Sessions said no.
The meetings occurred during the height of concerns about Russian interference in the U.S. election and at a time when Sessions was chairman of the Senate Armed Services Committee, as well as a top Trump surrogate and adviser.

Democratic leaders called on Sessions to resign, and several said he had perjured himself in his confirmation hearing. The swift response among some Republicans, although more muted, signaled increasing concern about the potential political fallout.”

As far as I can figure out, few people outside the Trump family have as much standing with the President as Jeff Sessions. Ordinarily, that spells JOB SECURITY. But, more often than not, “inside the Beltway,” once the “Boss” has to make the “full confidence” (or “total confidence”) public statement, the handwriting is already on the wall. Remember President George W. Bush and “Brownie, you’re doing a heck of a job?”

And, according to former Bush II Administration Ethics Chief Richard W. Painter, it’s already time for Sessions to go. If nothing else, he’s fast becoming the problem rather than the solution, even from the Administration’s standpoint.

Painter sees parallels with the situation of former Nixon Attorney General Richard Kleindienst who eventually pleaded guilty to misdemeanor “failure to provide accurate information,” resulting in a reprimand from the Arizona State Bar. But, at least he didn’t get convicted of a felony and do time in Federal Prison like his predecessor, Attorney General John Mitchell (although Mitchell had left the position by the time he committed his felony).

And, remember, this is an Administration that at the urging of extreme restrictionists like Sessions, Bannon, and Miller is trying to convince the American public that any foreign national who is even accused of a crime (even if not convicted) is a “bad hombre” deserving detention  and removal.

We’ll see how this all plays out. President Trump greatly appreciates loyalty. But, this might be one that even Jeff Sessions can’t survive.

Law You Can Use — Arlington Immigration Court Attorney Advisor Roberta Oluwaseun Roberts Explains How Possible Document Fraud Can Be Examined In Immigration Court While Respecting Due Process!

“The Board of Immigration Appeals has long emphasized that “no decision should ever rest, or even give the slightest appearance of resting, upon generalizations derived from evaluations of the actions of members of any group of aliens. Every adjudication must be on a case-by-case basis.” Matter of Blas, 15 I&N Dec. 626, 628 (BIA 1974). But what if counsel for the Department of Homeland Security (“DHS”) or the Immigration Judge notices significant similarities between the documents submitted in an applicant’s proceedings and the proceedings of another applicant with a similar claim? How can officers of the court raise these types of concerns about possible indications of fraud without compromising confidentiality or the due process rights of the applicant? In 2007, the United States Court of Appeals for the Second Circuit encouraged the Board to provide a framework for addressing inter-proceeding similarities and provide “expert guidance as to the most appropriate way to avoid mistaken findings of falsity, and yet identify instances of fraud.” Mei Chai Ye v. U.S. Dep’t of Justice, 489 F.3d 517, 524 (2d Cir. 2007). The Board provided this guidance in a 2015 decision, Matter of R-K-K-, 26 I&N Dec. 658 (BIA 2015), which has thus far been cited approvingly in published and unpublished decisions by two circuit courts of appeals. See, e.g., Wang v. Lynch, 824 F.3d 587, 591–92 (6th Cir. 2016); Zhang v. Lynch, 652 F. App’x 23, 24 (2d Cir. 2016).

This article analyzes the procedural framework articulated by the Board in Matter of R-K-K- for considering document similarities in immigration proceedings. First, the article will briefly discuss the need for such a framework. Second, the article will provide examples of what may—or may not—constitute each step that must be met in the three-step framework. Finally, the article will discuss due process and confidentiality concerns that arise when considering inter-proceeding similarities in making credibility determinations.”

SLATE: Bannon, Sessions, Miller Plan To Use Justice Department To Implement Far Right Agenda!

“One night in September 2014, when he was chief executive of Breitbart News, Stephen Bannon hosted cocktails and dinner at the Washington townhouse where he lived, a mansion near the Supreme Court that he liked to call the Breitbart Embassy. Beneath elaborate chandeliers and flanked by gold drapes and stately oil paintings, Jeff Sessions, then a senator from Alabama, sat next to the guest of honor: Nigel Farage, the insurgent British politician, who first met Sessions two years earlier when Bannon introduced them. Farage was building support for his right-wing party by complaining in the British press about “uncontrolled mass immigration.” Sessions, like other attendees, was celebrating the recent collapse in Congress of bipartisan immigration reform, which would have provided a path to citizenship for some undocumented people. At the dinner, Sessions told a writer for Vice, Reid Cherlin, that Bannon’s site was instrumental in defeating the measure. Sessions read Breitbart almost every day, he explained, because it was “putting out cutting-edge information.”

Bannon’s role in blocking the reform had gone beyond sympathetic coverage on his site. Over the previous year, he, Sessions and one of Sessions’s top aides, Stephen Miller, spent “an enormous amount of time” meeting in person, “developing plans and messaging and strategy,” as Miller later explained to Rosie Gray in The Atlantic. Breitbart writers also reportedly met with Sessions’s staff for a weekly happy hour at the Union Pub. For most Republicans in Washington, immigration was an issue they wished would go away, a persistent source of conflict between the party’s elites, who saw it as a straightforward economic good, and its middle-class voting base, who mistrusted the effects of immigration on employment. But for Bannon, Sessions and Miller, immigration was a galvanizing issue, lying at the center of their apparent vision for reshaping the United States by tethering it to its European and Christian origins. (None of them would comment for this article.) That September evening, as they celebrated the collapse of the reform effort — and the rise of Farage, whose own anti-immigration party in Britain represented the new brand of nativism — it felt like the beginning of something new. “I was privileged enough to be at it,” Miller said about the gathering last June, while a guest on Breitbart’s SiriusXM radio show. “It’s going to sound like a motivational speech, but it’s true. To all the voters out there: The only limits to what we can achieve is what we believe we can achieve.”

Talk about “the fox guarding the chicken coop!” And, I don’t share Bazelon’s view that DOJ career attorneys will be a significant moderating influence.

They all work for Jeff Sessions. Resisting Administration policies or positions could be considered insubordination — a ground for firing. Short of that, those who don’t “get with the program” could find themselves demoted, denied pay increases, transferred to obscure offices (perhaps in different locations), or given meaningless “busywork” assignments as punishment. In  DOJ lingo the disfavored and exiled are known as “hall walkers.”

Yes, it’s true that in many past Administrations those with opposing views were tolerated and often even had their differing perspectives considered and occasionally adopted. That often had a moderating effect. But, that assumes an Administration acting in good faith. Sounds like Sessions and his colleagues have already decided to dismantle those parts of the U.S. justice system that don’t fit their ultra nationalist, restrictionist, white-power-Christian-oriented agenda. It could be a long four years at the DOJ for career lawyers (those who survive). Sad!

Problems Mount For Administration On Travel Ban — Can’t Find Support For Their “Pre-Hatched” Conclusions — Stephen Miller Shoots Off Mouth Again — DOJ Litigators Undoubtedly Cringe As In-Court Statements Undermined!

“Senior policy adviser Stephen Miller said President Trump’s revised travel ban will have “mostly minor technical differences” from the iteration frozen by the courts, and Americans would see “the same basic policy outcome for the country.”

That is not what the Justice Department has promised. And legal analysts say it might not go far enough to allay the judiciary’s concerns.

A senior White House official said Wednesday that Trump will issue a revised executive order on immigration next week, as the administration is working to make sure the implementation goes smoothly. Trump had said previously that the order would come this week. Neither the president nor his top advisers have detailed exactly what the new order will entail. Miller’s comments on Fox News, while vague, seem to suggest the changes might not be substantive. And that could hurt the administration’s bid to lift the court-imposed suspension on the ban, analysts said.

“If you’re trying to moot out litigation, which is to say, ‘Look, this litigation is no longer necessary,’ it is very bad to say our intent here is to engage in the prohibited outcome,” said Leon Fresco, who worked in the office of immigration litigation in President Barack Obama’s Justice Department.”

Jennifer Rubin writes in Right Turn in today’s Washington Post:

“Opponents of President Trump’s travel ban have one big advantage — the Trump White House. If not for the confusion, lack of staffing (nary a deputy, let alone an undersecretary or assistant secretary, has been named in national security-related departments), organizational disarray, policy differences or all of the above, the administration might have put together on its first try a legally enforceable executive order. It might by now even have come up with a new executive order, thanks to a road map provided by the 9th Circuit. However, the rollout has been pushed back to next week.

Understand that if this is such a matter of urgent concern, the president would have had his advisers working around the clock on this (not transgender bathroom assignments, plans to deport non-criminal illegal immigrants or haggling with Mexican officials over a wall that Trump insists they pay for). In fact, since the point of the ban is to initiate a review of our vetting procedures, you’d think that the Homeland Security Department would already have come up with its proposed “extreme vetting” recommendations.

Meanwhile, the president and his staff continue to provide legal ammunition to opponents of the ban. On Tuesday, senior adviser Stephen Miller in a Fox News interview boldly declared, “Fundamentally, you’re still going to have the same basic policy outcome for the country, but you’re going to be responsive to a lot of very technical issues that were brought up by the court.” Just to remind the courts of the administration’s arrogance, Miller proclaimed that there was nothing wrong with the first order.

“By saying that the policy effects of the new travel ban will be essentially the same as those of the travel ban that so many federal judges found constitutionally suspect, Miller is effectively inviting federal courts to suspend the new one as well, given that the religiously discriminatory history of the ban can’t be ignored, much less erased, simply by purporting to start over again,” Supreme Court litigator and professor Larry Tribe tells me. “If, as I am told, the new ban is a more artfully disguised version of [an] anti-Muslim measure, without explicit preferences for religious minorities in Muslim-majority countries (i.e., for Christians) written into the very text of the ban, then some judges might be less inclined to issue a temporary restraining order, but most federal judges would be savvy enough to recognize that they are being treated to a masquerade.”

Meanwhile, Jake Tapper and Pamela Brown on CNN highlight more difficulties with the Administration’s “shoot first, ask questions later” approach:

“Washington (CNN)President Donald Trump has assigned the Department of Homeland Security, working with the Justice Department, to help build the legal case for its temporary travel ban on individuals from seven countries, a senior White House official tells CNN.

Other Trump administration sources tell CNN that this is an assignment that has caused concern among some administration intelligence officials, who see the White House charge as the politicization of intelligence — the notion of a conclusion in search of evidence to support it after being blocked by the courts. Still others in the intelligence community disagree with the conclusion and are finding their work disparaged by their own department.
“DHS and DOJ are working on an intelligence report that will demonstrate that the security threat for these seven countries is substantial and that these seven countries have all been exporters of terrorism into the United States,” the senior White House official told CNN. “The situation has gotten more dangerous in recent years, and more broadly, the refugee program has been a major incubator for terrorism.”

The report was requested in light of the Ninth Circuit Court of Appeals’ conclusion that the Trump administration “has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the United States.” The seven counties are Iraq, Iran, Libya, Somalia, Sudan, Syria and Yemen.
The senior White House official said the desire to bolster the legal and public case that these seven countries pose a threat is a work in progress and as of now, it’s not clear if DHS and DOJ will offer separate reports or a joint report.
One of the ways the White House hopes to make its case is by using a more expansive definition of terrorist activity than has been used by other government agencies in the past. The senior White House official said he expects the report about the threat from individuals the seven countries to include not just those terrorist attacks that have been carried out causing loss of innocent American life, but also those that have resulted in injuries, as well as investigations into and convictions for the crimes of a host of terrorism-related actions, including attempting to join or provide support for a terrorist organization.
The White House did not offer an on-the-record comment for this story despite numerous requests.

Asked about the report Thursday on “The Lead,” Rep. Dan Donovan, R-New York, emphasized that the intelligence community be nonpartisan.
“They should take data, take information, shouldn’t interpret it in a political way and provide the President the information he needs to make decisions to protect our country,” he said.
Also commenting on the report was Richard Haass, the president of the Council on Foreign Relations, who acknowledged that he hadn’t seen the specifics but “it looks wrong to me.”
“We ought to be doing the intel first, then set the policy and in large part based upon the intelligence,” Haass said. “If these reports are true, it’s yet another example where this administration is having real trouble ing a functional relationship with the intelligence community.”

I was never a “line litigator.” But, I was involved in defending and prosecuting thousands of cases during the “Legacy INS Phase” of my career. I also participated in thousands more cases as an appellate and trial judge during the last 21 years at EOIR.

One of my jobs in providing litigation assistance as the Deputy General Counsel of the INS was to make sure my “institutional clients” did not comment on pending cases. Such comments both unnecessarily antagonized the judges hearing the cases and, on occasion, when folks didn’t heed my instructions, completely “tanked” our positions by giving our opponents new arguments.

As a sitting judge, I can guarantee that one of the least successful approaches was for a lawyer to insult my intelligence or integrity and then turn around and ask me to help out his or her client. Sure, in the end, I had to separate the law from the lawyer and do the right thing. But, it certainly interfered with the effectiveness of the lawyer’s communication and made it more difficult for me to get to the substance of his or her client’s case.

And, one thing that certainly infuriated all judges, including me, was for a lawyer to represent one thing in court and then have his or her client do something else. It made me lose confidence in the lawyer’s reliability and integrity and his or her ability to control and speak for the client. I can remember “chewing out” several lawyers at Master Calendar for misrepresenting facts or law to me in their briefs or oral arguments.

It appears that the Trump Administration’s combination of arrogance, ignorance, and disrespect for the court system and the role of judges is undermining both their credibility and the credibility of the Department of Justice career lawyers whose job is to represent them over and over again before most of the same judges. Once a judge loses faith in the credibility of a lawyer and/or her or his client, “bad things will happen” and they do.

NYT Editorial Blasts Trump Administration’s Anti-Immigrant Fear Mongering!

In an Editorial that first appeared on Feb. 18, 2017, the NY Times wrote:

“Another DACA recipient, Daniela Vargas of Jackson, Miss., barricades herself in her home after agents detain her father and brother. A mother of four, Jeanette Vizguerra, seeks refuge, alone, in a Denver church basement. A group of Latino men leaving a church-run homeless shelter near Alexandria, Va., are surrounded by a dozen immigration agents who question them, scan their fingerprints and arrest at least two of them. [Emphasis Added.]

President Trump’s defenders say the arrest numbers from Immigration and Customs Enforcement are comparable to those under President Barack Obama, an energetic deporter-in-chief. That may be true, for the moment, but the context is vastly different. Mr. Trump’s campaign pledges, his flurry of immigration-related executive orders, including his ban on certain travelers from Muslim countries, have a common thread. They reflect his abandonment of discretion, of common sense, his rejection of sound law-enforcement priorities that stress public safety and respect for the Constitution.

They prioritize fear instead.

ICE and the Border Patrol under Mr. Obama were ordered to focus on arresting serious criminals and national-security risks. Mr. Trump has removed those restraints in the name of bolstering his “deportation force.” He wants to triple the number of ICE agents. He wants to revive federal agreements to deputize state and local police officers as immigration officers. He wants to increase the number of detention beds and spur the boom in private prisons.

This vision is the one Donald Trump began outlining at the start of his campaign, when he slandered an entire country, Mexico, as an exporter of rapists and drug criminals, and an entire faith, Islam, as a global nest of murderers. This is the currency of the Trump aides Stephen Bannon and Stephen Miller, who have brought the world of the alt-right, with its white nationalist strain, into the White House.

Where could the demonizing and dehumanizing of the foreign born lead but to a whiter America? You have heard the lies from Mr. Trump: that immigrants pose a threat, when they are a boon. That murders are up, when they are down. That refugees flow unimpeded into the country, when they are the most meticulously vetted people to cross our borders. That immigrants and refugees are terrorists, when they are the ones being terrorized.

For those who would resist the administration, there is much to do, and not a lot of time. Congress is not a check. Democrats there are outnumbered, speaking out but waging symbolic resistance for now. Republicans are mostly split between avoiding the subject and cheering on Mr. Trump.”

On a personal note, the “church shelter incident” involved the Rising Hope Mission Church in the Alexandria area of Fairfax, Co., VA. This church is devoted to meeting the needs of the most vulnerable in our community and is a mission outreach project funded by local United Methodist Churches, including the Beverley Hills Community United Methodist Church to which my wife and I belong. Among other things, Rising Hope serves as a hypothermia shelter, and actions like this by ICE serve to discourage individuals from seeking potentially life-saving assistance.

Jack Shafer In Politico: Leaks Are An All-American Tradition!

“Un-American? Why, there is nothing more All-American than a leak! The Pentagon Papers, for example, which revealed the inner machinations of U.S. war policy and were published by the New York Times, the Washington Post and elsewhere. The Iran-Contra revelations. The diplomatic and military documents liberated by Chelsea Manning and disseminated by WikiLeaks. The Snowden cache. The Panama Papers leaks and the day-by-day leaking of classified and confidential information upon which the foundation of Page One journalism rests.

To a one, these leaks helped citizens and officeholders learn what powers were being flexed behind the scenes in their names but without their sanction. Now that he’s president and not a mere campaigner, Trump has taken the convenient position that leaks are dangerous and illegal things and that secrets should be kept secret in the name of national security. But as Sen. Daniel Patrick Moynihan noted long ago, excessive secrecy harms national security by blocking policymakers from the information that aids informed decision-making. For example, the U.S. Army and FBI denied President Harry Truman access to the “Venona decryptions”—the intercepts that documented Soviet espionage in the United States, because they deemed his White House too leaky!”

The leaks that have just exposed the lies of former national security adviser Michael Flynn have done the nation—and Vice President Mike Pence—a great mitzvah by unmasking his subterfuges. Flynn, you’ll recall, lied to Pence’s face about his pre-inauguration contacts with the Russians, and Pence carried those lies onto TV, where he shared them in January. It wasn’t until he read a Washington Post report about Flynn’s lies that he began his inquiries and learned what other White House officials had learned a couple of weeks earlier. Thus did Pence avoid becoming his generation’s Truman.

Elements of the conservative media (Daily Beacon and Daily Caller, for example) have attempted to sketch the Flynn leaks as a counterintelligence operation by the “Deep State” and former Obama officials to undermine the Trump presidency, a theory the president himself appears to endorse in his tweets. Without a doubt, the sharp knives of the existing and exiled bureaucracy can hobble and gimp the incoming administrations they oppose. It’s called obstruction, and both parties play the game, denying the Flynn leaks any status as exceptional.

Information is power, which is why bureaucracies hoard and declare it secret. Leaks, as the history books, memoirs and newspaper archives show us, are one of the most important ways government bureaucracies inform government bureaucracies what the government bureaucracies are doing. Only somebody who lived on an island of naiveté would ever move into the White House and think the Deep State won’t leak against him. Likewise, every president dispenses privileged information to the press and political allies to assist in his policymaking. Once—and if—he gets his bearings, President Trump will help himself to these behaviors. This is leaking, too, and it’s All-American, too.”

Some leaks of intelligence information endanger lives. That’s highly problematic and is what classification and security rules were meant to prevent.

But, overall, after more than three decades in Government (during which I carefully followed the rules on confidential information), my take is that the Government regularly stretches the privilege of classifying or otherwise restricting the use of information. Much of that which is “leaked” appears to be kept “secret” largely to prevent embarrassment, hide poor performance, or gain some political advantage, particularly when it concerns politicos like Flynn.

One of the most amazing things about the whole Flynn incident is his failure to recognize that his communications with Russian officials were likely to be monitored and his decision to “forget” what he had very recently told the Russian Ambassador. Surprisingly, his memory wasn’t “jogged” even when he saw Vice President Pence publicly misrepresent the facts, based on mis-information furnished by Flynn himself. Seems like a resignation would have been in  order at that point.

Here’s How Torture “Works” — Does President Trump Really Want The U.S. To Follow The Lead Of The World’s Most Brutal Dictators?

“The majority of those executed at Sednaya were political prisoners, including many of the ordinary people who joined in the peaceful protests against Assad, the report says. Some were rebels who took up arms, and others were officers and soldiers who defected from government forces. But for the most part they were “doctors, engineers, protesters,” one former prison official is quoted as saying. “They were somehow understood to be linked to the revolution. Sednaya is the place to finish the revolutionaries. It’s the end for them.”

The report describes in chilling detail how the prisoners were taken out of their cells in batches, of up to 50 at a time, twice a week and in the middle of the night, typically on Mondays and Wednesdays.
They were given only cursory trials lasting one to three minutes at one of two military field courts that offered no semblance of judicial process, with sentences typically handed down on the basis of confessions extracted under torture. When the time came for their executions, the prisoners were handcuffed, blindfolded and led to a basement cell containing 10 stands and 10 nooses.

A former judge from the military court described the executions, saying it would often take up to 10 to 15 minutes for the prisoners to die. “Some didn’t die because they are light. For the young ones, their weight wouldn’t kill them. The officers’ assistants would pull them down and break their necks. Two officers’ assistants were in charge of this.”

Religion: Stephen Mattson In Sojourners: “American ‘Christianity’ Has Failed”

“Because while the gospels instruct followers of Christ to help the poor, oppressed, maligned, mistreated, sick, and those most in need of help, Christians in America have largely supported measures that have rejected refugees, refused aid to immigrants, cut social services to the poor, diminished help for the sick, fueled xenophobia, reinforced misogyny, ignored racism, stoked hatred, reinforced corruption, and largely increased inequality, prejudice, and fear.

. . . .

By these standards — and by the ultimate example that Jesus himself set for us by example — mainstream Christianity in America has failed. It looks nothing like Jesus.
But the reality is that following Jesus is extremely hard. It demands giving away your most prized possessions and abandoning your biggest fears. So while there might be political, economic, financial, and safety reasons for implementing policies that harm people and refuse them help, there are certainly no gospel reasons.

Nobody understood this better than the early church. Those first Christ followers who refused to bow to the emperor and go along with the policies of the Roman government. For them, they gave everything — to the point of being persecuted, arrested, tortured, and eventually martyred — for the purpose of serving Christ and serving others, the result of choosing to dedicate their lives to the truths of Jesus rather than the ideals of the ruling empire.

The question is, will American Christians ever learn to do the same?”

The Asylumist (Jason Dzubow) Urges Public Servants In Immigration Enforcement And Adjudication To “Stay” — “You Are Exactly The Type of Person We Need!”

In his “Open Letter” to Feds, Dzubow writes:

“In speaking to some DOJ and DHS attorneys and officers since the recent election, I have seen a certain level of demoralization. Some people have expressed to me their desire to leave government service. While these individuals respect and follow the law–even when the results are harsh–they are not ideological. They do not hate immigrants (or non-white people, or Muslims) and they do not want to enable or contribute to a system that they fear will become overtly hostile to immigrants that President Trump considers undesirable. I suppose if I have one word of advice for such people, it is this: Stay.

If you are a government attorney or officer and you are thinking of leaving because you fear an overtly ideological Administration, you are exactly the type of person that we need to stay. As has often been the case in recent decades, an honest, competent bureaucracy is the bulwark against our sometimes extremist politics.

It’s likely that if you are a government employee who is sympathetic to non-citizens, your job will get more difficult, the atmosphere may become more hostile. It will be harder to “do the right thing” as you see it. Opportunities for promotions may become more limited. Nevertheless, I urge you to stay. We need you to help uphold the law and ensure due process for non-citizens and their families. To a large extent, our immigration system is as good or as bad as the people who administer the law. We need the good ones to stay.”
