Republican-led states have been hit the hardest. Last week, Florida and Texas alone made up one out of every three new cases, and now Florida is the center of the pandemic. On Friday, the Centers for Disease Control and Prevention reported 23,903 new cases in Florida that day alone. Hospitals are filling up as unvaccinated Americans need medical care; Austin, Texas, activated an emergency alert this weekend as its hospitals were overwhelmed.

But Republican lawmakers stand against the mask requirements and vaccines that would help stop the spread. Texas governor Greg Abbott has banned mask and vaccine mandates across the state, as has Arkansas governor Asa Hutchinson (who has since said the law was an “error”). South Carolina and Arizona have banned mask mandates in schools.

Today, in just the latest example, Senator Rand Paul (R-KY) said, “It’s time for us to resist. They can’t arrest all of us…. No one should follow the CDC.” He claimed that masking and remote learning was physically and emotionally damaging for children, and there was no reason they should not return to school full time, without masks. He said he would work to defund any school or government agency or school that did not simply resume its pre-pandemic operations.

Instead of trying to stop the spread of the virus, Republicans are blaming Biden for it. They claim that it is sparked by his handling of immigration on our southern border and that infected immigrants are responsible for the spike in the deadly disease.

When Biden asked Republican governors on August 3 to help or get out of the way, Florida governor Ron DeSantis responded: “Joe Biden has the nerve to tell me to get out of the way on COVID while he lets COVID-infected migrants pour over our southern border by the hundreds of thousands. No elected official is doing more to enable the transmission of COVID in America than Joe Biden with his open borders policies,” and claimed: “He’s imported more virus from around the world by having a wide-open southern border.”

DeSantis is not an outlier. Trump has pushed this line, Fox News Channelpersonality Sean Hannity hammers on it, and right-wing publications from the Daily Wire to National Review to the Wall Street Journal’s editorial page all insist that immigrants are to blame for the spread of the virus. Rand Paul has gone so far as to claim that administration officials are deliberately sending infected immigrant children around the country to spread the variant. Yesterday, Trump legal adviser Jenna Ellis called for Biden’s impeachment over the issue.

In fact, the administration continues to reject or expel border crossers under a public health order known as Title 42. It does permit the entry of unaccompanied minors and some vulnerable families. Migrants who cross the border are immediately required to wear masks. They are not tested at Customs and Border Patrol unless they show symptoms, but all are tested if they move into the system, and those who test positive for coronavirus are quarantined. Those slated for deportation are quarantined before they are deported. While infection rates are climbing, because of both the Delta variant and the crowding at Border Patrol, immigrants test positive at a lower rate than the rate of non-immigrants around them.

And yet, Republicans are using the deadly new coronavirus variant to stoke anti-immigrant fires.

It is cynical, it is deadly… and it takes us one more step toward authoritarianism.

In my Georgetown Law Immigration Law & Policy class, we recently talked about the racist roots of naturalization policy set forth in the Naturalization Act of 1790 with my friend and colleague Professor Cori Alonso Yoder. Obviously, the racism of our “Founding Fathers” went well beyond the institution of slavery.

Naturalization was a “whites only” proposition that transcended status as free or enslaved. White foreign nationals who had resided here for two years could be citizens. Free African Americans, Native Americans, and other free people of color could not become U.S. Citizens even if they had been born here and lived here for their entire lives. Yup, you don’t have to think too deeply to recognize the overt racism there!

Not to mention that America was literally built on the backs of enslaved African Americans whose free labor also supported a number of the white Founding Fathers, their white families, their often lavish lifestyles, and their sometimes endemic fiscal irresponsibilities. See, e.g., T. Jefferson, drafter of the Declaration of Independence whose estate had to sell off slaves to pay his debts.

No wonder White Supremacists, including many ignorant and dishonest pols, don’t want the truth of our nation’s history taught. The truth isn’t always pretty. And, it often has little to do with the various White Nationalist myths and skewed narratives foisted upon us.  

Since those bogus myths exclude or distort the roles of the majority of today’s Americans, the “truth deniers” are going to have a tough time shoving their “whitewashed” version of American history down our throats in the long run! (That’s true, even though the “forces of ignorance, racism, bias, and thought suppression” on the right have been quite active lately and, shamefully, have succeeded in writing some of their racist nonsense into state and local laws). An honest reckoning with our past, including our past mistakes, is necessary for us to move forward into a better future. 

One has only to look at Justice Alito’s mythologized version of America set forth in his recent majority opinion suppressing the voting rights of African Americans and other minorities, and to read Justice Kagan’s cogent rebuttal of his legal sophism, to see that “Dred Scott” is still alive at the Supremes! It’s not the first time our legal system has refused to carry out the clear mandate of the 15th Amendment against attacks by states trying to suppress the political power of their African-American citizens. One would like to think it will be the last. But, that’s unlikely given the current composition of the Supremes, Congress, and many state legislatures.

There might be no immediate solution for the Supremes, Congress, and state legislatures. The political process simply takes time, and the forces of regression have found and exploited all of the “anti-democratic seams” in our institutions that give them political power beyond their numbers.

However, there is one potentially powerful court system out there that progressives could reform and reconstitute NOW into a judiciary committed to due process, fundamental fairness, best practices, and equal justice for all persons in the United States regardless or race, creed, or status. So far, the Biden Administration and AG Garland have been both tone deaf and remarkably inept at transforming the Immigration Courts into the better judiciary needed for our future! Progressives need to “raise hell” until the Biden Administration fixes the one now-dysfunctional Federal Court system that they actually control!

The future will belong to those unafraid to face the sometimes unattractive realities of our collective past, to respect and honor those who fought through the mistreatment and injustice inflicted upon them, and learn from our history rather than denying or rewriting it! It will also belong to those wise, courageous, and bold enough to take advantage of opportunities for improving American justice that are staring them in the face. So far, Dems have shown themselves not up to the job in the Immigration Courts. Until they are, racial justice and sustained progress in America are likely to remain illusions.

“[T]he BIA has not addressed the question of the applicability of the color-of-law rule regarding state involvement in torture. … The parties agree that a remand is the best alternative where the BIA has made an unauthorized or inadequately supported factual finding on the likelihood of torture, thereby leaving unresolved whether the IJ failed to apply the rule-of-law theory of state involvement in torture. Accordingly, we conclude that the prudent course is to remand the case to the BIA. … We further order the BIA to remand the case to the IJ for a clear factual finding on the likelihood of torture and for the IJ’s clarification, if necessary, on the question of state involvement in light of the color-of-law rule. … PETITION GRANTED; VACATED AND REMANDED WITH INSTRUCTIONS TO REMAND.”

Congrats to Matthew Nickson! Getting justice for a migrant in the notoriously pro-Government 5th Cir. is no mean feat! Think of how much easier your job would be if AG Garland hired some “real judges” at EOIR —  experts in immigration and human rights who have represented individuals in Immigration Court and who are committed to due process and fundamental fairness above all else!

When you’re out to stick it to Hondurans (actually all Northern Triangle migrants), regardless of facts or law, to please your sleazy White Nationalist political bosses in the Trump regime, bad things are going to happen. 

Let’s not forget that the Trump regime entered into a totally corrupt and bogus “Safe Third Country” agreement with Honduras, probably one of the least safe countries in the Hemisphere with no functional asylum system at all. Given this level of overt political fraud by the “bosses,” I doubt that the regime would have appreciated BIA bureaucrats correctly finding that torture with government acquiescence is likely in Honduras. 

Sure, these failures were before Garland took over. But, he has made little effort to date to either acknowledge and root out the deep corruption and anti-immigrant weaponization of the Immigration Courts or to address the inadequate “go along to get along judging” that was encouraged at EOIR. In plain terms, respondents did not get, and still do not get, qualified, fair, and impartial judges at EOIR to adjudicate their claims. 

You have only to look at the comedy of errors and ineptitude at EOIR in this case “outed” by one of the most pro-Government Circuits in America to see the proof! That’s unconstitutional!

Remand after remand to “get it right” also “jacks backlog.” Just getting a case back on an Immigration Judge’s docket takes time and effort in a non-automated system with no e-filing and traditionally overwhelmed and demoralized staff. Instead of fixing “customer service” @ EOIR, the Trump kakistocracy invested in ludicrous, due-process-destroying “IJ Dashboards” to keep the quotas filled and the unconstitutional “nativist deportation railroad” moving. Yet, Garland, Monaco, Gupta, and Clarke pretend that none of these constitutional and civil rights absurdities, not to mention grotesque management fraud, waste, and abuse, happened!

Don’t stand for any of Garland’s dishonest “expedited dockets” which implicitly blame those seeking justice under law and their courageous lawyers for the ungodly mess he and his lieutenants inherited but have failed to address! And, “dedicated docket for asylum seekers” is just a euphemism for more backlog-building, due-process denying “Aimless Docket Reshuffling” and continuing mismanagement by Garland.

I’ll bet that qualified experts could cut the largely self-inflicted backlog by at least 50% in 90 days without stomping on anyone’s due process rights merely by administratively closing or terminating without prejudice hundreds of thousands of non-priority aged cases. Many of those could better be handled at USCIS. 

It shouldn’t be this difficult to get an Administration that ran and got elected on a “reform” and “return to good government” platform to do the right thing here. But, it is! EOIR needs reform, including a new BIA and competent, expert judges who know asylum law, respect due process, and will treat migrants and their attorneys fairly, respectfully, and humanely. It’s not a “big ask!” So why is it “above Garland’s pay grade?”

President Joe Biden has taken some steps toward reversing his predecessor’s legacy of broad, indiscriminate immigration enforcement, including a recent announcement that it will no longer detain immigrants at two locations under scrutiny for alleged abuses.

But Republicans are adamant that increased immigration enforcement be a prerequisite to any broader immigration reform.

“There’ll be no immigration reform until you get control of the border,” Sen. Lindsey Graham (R-SC) told Roll Call last month.

There are now nearly 40 percent more people in immigration detention compared to when Biden first took office, and his administration is continuing to turn away most migrants arriving on the border under pandemic-related restrictions put in place by his predecessor, President Donald Trump, which have led to the expulsions of more than 350,000 people this year alone.

But research shows that the threat of detention and deportation in the US doesn’t dissuade migrants from making the journey to the southern border, especially if they are victims of violence and may be seeking to escape the “devil they know” in their home countries.

“Managing migration at the border, particularly the kind of migration we’re seeing now, from a strictly deterrence, enforcement lens is just not sustainable in the long run and is not having the impact that people think it should have,” Theresa Cardinal Brown, managing director of immigration and cross-border policy at the Bipartisan Policy Center, said. “That’s why we need to rethink our paradigm for how we talk about migration and everything that we do at the border.”

Knowledge of US immigration detention, however, did have an unintended effect on survey takers in Ryo’s experiment — it made them more likely to think outcomes and legal procedures in the American immigration system are unfair. That is worrisome, given that perceptions of fairness are significant predictors of people’s willingness to obey the law and cooperate with legal authorities, Ryo said.

“We really ought to be concerned about the extent to which generating these kinds of perceptions of unfairness can backfire in terms of more people disregarding our laws and undertaking that dangerous journey in order to get to our border and try to cross it,” she added.

“Enforcement only doesn’t work” has been one of the key “themes” of Courtside since “Day 1.” The answer has also been clear — due process, fundamental fairness, racial equity, practical scholarship leading to durable solutions. 

The converse of “enforcement only doesn’t work” is also true:  A more realistic, more generous legal immigration system that advances due process and equality while taking advantage of “market factors” that attract and drive migration would also lead to more efficient and effective enforcement. Many, perhaps the majority, of those we are now wasting time and money on cruel and ultimately futile attempts to detain, deter, and remove would actually be a huge benefit to our nation if they were allowed to migrate legally on either a permanent or temporary basis.  

I’ve been saying for a long time now that convincing folks that our legal system is basically bogus — falsely promising a fairness and dignified treatment we aren’t delivering — merely serves to drive migrants to enter the “extralegal” or “black market” system that helps support our economy. The real “beneficiaries” of “mindless immigration enforcement” and a dysfunctional legal system are smugglers, cartels, and exploitative employers. Also, obviously, corrupt GOP politicos benefit from having a permanent, disenfranchised, traumatized, largely non-White “black market labor pool” to prop up their economy while serving as an easy target to “whip up” their racist base. 

Bad policies, driven by ignorance, myths, bias, cowardice, and racism will continue to produce lousy results — for the migrants and for our nation. Smarter, more courageous, more intellectually honest legislators and public officials are necessary. Whether voters will be wise enough to elect them remains to be seen.

Donald Trump never did much to hide his dangerous belief that the US justice department and the attorneys general who helmed it should serve as his own personal lawyers and follow his political orders, regardless of norms and the law.

Former senior DoJ officials say the former president aggressively prodded his attorneys general to go after his enemies, protect his friends and his interests, and these moves succeeded with alarming results until Trump’s last few months in office.

But now with Joe Biden sitting in the Oval Office, Merrick Garland as attorney general and Democrats controlling Congress, more and more revelations are emerging about just how far Trump’s justice department went rogue. New inquiries have been set up to investigate the scale of wrongdoing.

Trump’s disdain for legal principles and the constitution revealed itself repeatedly – especially during Bill Barr’s tenure as attorney general, during most of 2019 and 2020. During Barr’s term in office, Trump ignored the tradition of justice as a separate branch of government, and flouted the principle of the rule of law, say former top justice lawyers and congressional Democrats.

In Barr, Trump appeared to find someone almost entirely aligned with the idea of doing his bidding. Barr sought to undermine the conclusions of Robert Mueller’s inquiry into Russian interference in the 2016 elections, independent congressional oversight, and Trump critics in and out of government, while taking decisions that benefited close Trump allies.

But more political abuses have emerged, with revelations that – starting under attorney general Jeff Sessions in 2018 – subpoenas were issued in a classified leak inquiry to obtain communications records of top Democrats on the House intelligence committee. Targets were Adam Schiff and Eric Swalwell, who were investigating Kremlin election meddling, and also several committee staffers and journalists.

Democrats in Congress, as well as Garland, have forcefully denounced these Trumpian tactics. Garland has asked the department’s inspector general to launch his own inquiry, and examine the subpoenas involving members of Congress and the media. Congressional committees are eyeing their own investigations into the department’s extraordinary behavior.

“There was one thing after another where DoJ acted inappropriately and violated the fundamental principle that law enforcement must be even-handed. The DoJ must always make clear that no person is above the law,” said Donald Ayer, deputy attorney general in the George HW Bush administration.

Ayer thinks there could be more revelations to come. “The latest disclosure of subpoenas issued almost three years ago shows we don’t yet know the full extent of the misconduct that was engaged in.”

The record of anti-immigrant, White Nationalist bias at EOIR and the DOJ’s “Dred Scott” approach to justice for asylum applicants and other migrants is crystal clear! Thanks to the NDPA, courageous journalists, some “inside sources,” and the remarkable number of rebuffs from Federal Courts, the record on misfeasance and bias at EOIR, OIL, and the SG’s Office is clear. 

For example, there is no “issue” that Sessions’s “child separation policy” violated the Constitution, that he and other Government officials like Rod Rosenstein and Kristen Nielsen lied about it ( ‘We Need to Take Away Children,’ No Matter How Young, Justice Dept. Officials Said

Every day, Garland’s lackadaisical approach to restoring “justice @ Justice” and his apparent indifference to individual human rights and fair judging continue to harm vulnerable asylum seekers and other individuals and disintegrate our legal system. It’s “not OK!”

Progressives and members of the NDPA must recognize, if they haven’t already, that they can’t count on Garland! They will have to continue to use litigation, legislation, oversight, FOIA, public opinion, and political pressure to get the immediate common sense progressive reforms and overdue personnel changes that Garland, Monaco, Gupta, and Clarke are avoiding. Garland might view “justice” as too abstract a concept to require his immediate attention. Many of us don’t agree!

On June 16, Attorney General Merrick Garland finally, mercifully vacated three decisions that formed a key part of the Trump administration’s unrelenting attack on the law of asylum.1  Matter of A-B-,  issued by Jeff Sessions in June 2018, took aim in particular at victims of domestic violence.2  Matter of L-E-A-, issued the following year by William Barr, sought to undermine protection for those targeted by gangs due to their familial ties.3  And on January 14, 2021, six days from the end of the Trump Administration, acting A.G. Jeffrey Rosen issued a second decision in A-B-, gratuitously criticizing the method for determining nexus in asylum claims employed by the U.S. Court of Appeals for the Fourth Circuit, while conveniently evading that court’s review of the original decision in the case through remand.4

Garland’s action restores the law to where it stood prior to June 11, 2018, but only for the time being.  Proposed rules on the subject (which Garland referenced) are due by October 30, when they will first be subjected to a period of public comment.  If final rules are eventually published, it will occur well into next year.

As we sigh in collective relief and celebrate the first steps towards correcting our asylum laws, let’s also take note of the imperfect place in which the case law stands at present.

As to domestic violence claims, the BIA’s 2014 decision in Matter of A-R-C-G- (which Matter of A-B- had vacated) has been restored as binding precedent.5  That decision was issued at a time when (as now) regulations addressing particular social groups were being contemplated by DHS and EOIR.6  While A-R-C-G- was an extremely welcome development, the Board used it to recognize a rather narrowly-defined group: “married women in Guatemala who are unable to leave their relationship.”  In a footnote to the decision, the Board declined to address the argument of several amici (including UNHCR) that a particular social group may be defined by gender alone.  Although A-R-C-G- led to many grants of asylum, some immigration judges relied on the limited scope of the group’s definition to deny claims involving slightly broader variations, in particular, where the victim was not legally married, but nevertheless in a domestic relationship that she was unable to leave.  While the BIA reversed some of those denials in unpublished decisions, it declined to speak to the issue through binding precedent.

As to Matter of L-E-A-, Garland’s recent action returns us to the BIA’s original opinion in that case.7  While the decision acknowledged that families constitute particular social groups (a point that was not in dispute, having been universally recognized for some 35 years and stipulated to by DHS), the BIA still denied asylum by invoking a legally incorrect standard for establishing nexus that it has continued to apply in all family-based asylum claims.

For these reasons, the content of the forthcoming regulations will be extremely important in determining the future of asylum in this country.  While a return to the test for social group cognizability expressed in the BIA’s 1985 precedent in Matter of Acosta tops most regulation wish lists, I will focus the discussion here on a couple of more specific items necessary to correct the shortcomings of Matter of A-R-C-G- and Matter of L-E-A-.

First, the regulations need to explicitly recognize that a particular social group may be defined by gender alone.  In its 2002 Gender Guidelines, UNHCR identified women “as a clear example of a social subset defined by innate and immutable characteristics, and who are frequently treated differently than men,” and whose “characteristics also identify them as a group in society, subjecting them to different treatment and standards in some countries.”8  However, over the nineteen years since those guidelines were issued, the BIA has consistently avoided considering the issue.

The peril of defining gender-based groups in the more narrow manner employed by the BIA has been addressed by two distinguished commentators, who explain that such practice results in “constant re-litigating of such claims,” sometimes creating “an obstacle course in which the postulated group undergoes constant redefinition.”9  And of course, that is exactly what has happened here, as A-R-C-G- gave way to A-B-, which led to differing interpretations among different courts until Garland’s recent reset.  The above-mentioned commentators further decried the “nitpicking around the margins of the definition” resulting from the narrow approach when the true reason for the risk of persecution to the applicant “is simply her membership in the social group of ‘women.’”10  Regulations recognizing gender alone as a particular social group would thus provide clarity to judges and asylum officers, eliminate the wastefulness of drawn out litigation involving “nitpicking around the margins,” and bring our laws into line with international standards.

But as L-E-A- demonstrates, recognition of a group alone does not guarantee asylum protection.  In order for a group’s recognition to be meaningful, the regs must also address an ongoing problem with the BIA’s method for determining nexus, or whether persecution is “on account of” the group membership.

The BIA is accorded deference by Article III courts when it reasonably interprets immigration laws, provided that the meaning of the language in question is ambiguous.  However, the “on account of” standard included by Congress in defining the term “refugee” is quite clear; its meaning is long established, and in fact, is not particular to immigration law.

The Supreme Court referenced this standard last year in a non-immigration case, Bostock v. Clayton County.  The Court explained that the test

incorporates the “‘simple’” and “traditional” standard of but-for causation…. That form of causation is established whenever a particular outcome would not have happened “but for” the purported cause….In other words, a but-for test directs us to change one thing at a time and see if the outcome changes. If it does, we have found a but-for cause.11

In a 2015 decision, the U.S. Court of Appeals for the Fourth Circuit applied this exact test in the asylum context to conclude that persecution was on account of family, determining that the petitioner’s “relationship to her son is why she, and not another person, was threatened with death if she did not allow him to join Mara 18.”12  But for some reason, the BIA has felt entitled to reject this established standard outside of the Fourth Circuit in favor of its own excessively restrictive one.

Had the proper test for nexus been employed in L-E-A-, asylum would have been granted.  Under the facts of that case, once the familial relationship is removed from the equation, the asylum-seeker’s risk ceases to exist.  However, the BIA instead imposed an incorrect test for nexus requiring evidence of an “animus against the family or the respondent based on their biological ties, historical status, or other features unique to that family unit.”13

As a former circuit court judge, Garland is particularly qualified to recognize the error in the Board’s approach, as well as the need to correct its course.  The problem is compounded by the particular composition of the BIA at present.  For example, of the ten immigration judges who were promoted to the BIA during the Trump administration, nine denied asylum more than 90 percent of the time (with the tenth denying 85 percent of such claims).  Three had an asylum denial rate in excess of 98 percent.14

This matters, as those high denial rates were achieved in part by using faulty nexus determinations to deny asylum in domestic violence claims, even before the issuance of Matter of A-B-.  This was often accomplished by mischaracterizing the abuse as merely personal in nature, referencing only the persecutor’s generally violent nature or inebriated state.  The analysis in those decisions did not further examine whether gender might also have been one central reason that the asylum seeker, and not someone else, was targeted.

One BIA Member appointed under Trump recently found no nexus in a domestic violence claim by concluding that the persecutor had not targeted the asylum seeker because of her membership in the group consisting of “women,” but rather because she was his woman. There is no indication in the decision that the Board Member considered why the persecutor might view another human being as belonging to him and lacking the same rights he seems to enjoy.  Might it have been because of her gender?

Without a correction through published regulations, there is little reason to expect different treatment of these claims moving forward.  Let’s hope that the Attorney General views his recent action as only the first steps on a longer path to a correct application of the law.

Without progressive intervention, this is still headed for failure @ EOIR! A few things to keep in mind.

    • Former Attorney General, the late Janet Reno, ordered the same regulations on gender-based asylum to be promulgated more than two decades ago — never happened!
    • The proposed regulations that did finally emerge along the way (long after Reno’s departure) were horrible — basically an ignorant mishmash of various OIL litigation positions that would have actually made it easier for IJs to arbitrarily deny asylum (as if they needed any invitation) and easier for OIL to defend such bogus denials.
    • There is nobody currently at “Main Justice” or EOIR HQ qualified to draft these regulations! Without long overdue progressive personnel changes the project is almost “guaranteed to fail” – again!
    • Any regulations entrusted to the current “Miller Lite Denial Club” @ the BIA ☠️ will almost certainly be twisted out of proportion to deny asylum and punish women refugees, as well as deny due process and mock fundamental fairness. It’s going to take more than regulations to change the “culture of denial” and the “institutionalized anti-due-process corner cutting” @ the BIA and in many Immigration Courts.
    • Garland currently is mindlessly operating the “worst of all courts” — a so-called “specialized (not) court” where the expertise, independence, and decisional courage is almost all “on the outside” and sum total of the subject matter expertise and relevant experience of those advocating before his bogus “courts” far exceeds that of the “courts” themselves and of Garland’s own senior team! That’s why the deadly, embarrassing, sophomoric mistakes keep flowing into the Courts of Appeals on a regular basis. 
    • No regulation can bring decisional integrity and expertise to a body that lacks both! 
    • Any progressive who thinks Garland is going to solve the problem @ EOIR without “outside intervention” should keep this nifty “five month snapshot of EOIR under Biden” in mind:
      • Progressive judges appointed to BIA: 0
      • Progressive judges appointed to Immigration Court: 0
      • Progressives installed in leadership positions @ EOIR permanently or temporarily: 0

That’s right, folks: Billy Barr and Stephen Miller have had more influence and gotten more deference from Garland at EOIR than have the progressive experts and advocates who fought tirelessly to preserve due process and to get the Biden Administration into office. How does that a make sense?

Visavakumar Thamotar, a Sri Lankan citizen of Tamil ethnicity, seeks review of the Board of Immigration Appeals’ (“BIA”) order affirming an Immigration Judge’s discretionary denial of his application for asylum and grant of withholding of removal. Mr. Thamotar argues that because removal was withheld, federal regulation 8 C.F.R. § 1208.16(e)1 required reconsideration of his asylum claim, which the Immigration Judge and BIA failed to give. We agree with Mr. Thamotar that the agency failed to conduct the proper reconsideration. When an asylum applicant is denied asylum but granted withholding of removal, 8 C.F.R.

§ 1208.16(e) requires reconsideration anew of the discretionary denial of asylum, including addressing reasonable alternatives available to the petitioner for family reunification.2 And where the Immigration Judge has failed to do so, the BIA must remand for the Immigration Judge to conduct the required reconsideration.

Here, the Immigration Judge failed to reconsider Mr. Thamotar’s asylum claim under § 1208.16(e). The BIA’s failure to remand on this issue was therefore

manifestly contrary to law and an abuse of discretion. It is clear that neither the Immigration Judge nor the BIA conducted the proper reconsideration because the record contained no information about Mr. Thamotar’s ability to reunite with his family, information that the agency must review under § 1208.16(e). Thus, the BIA should have remanded the case for further factfinding. We grant the petition, vacate the BIA’s order, and remand to the BIA with instructions to remand to the Immigration Judge for reconsideration of the discretionary denial of asylum.

Lots of work for a bogus asylum denial by EOIR! And the utter nonsense isn’t over! Just a “remand” to give EOIR  yet another chance to deny for specious reasons (as they have already done twice). This  idiocy will continue until Judge Garland replaces the BIA with real judges who will properly, fairly, and timely apply the law and regulations! 

The poor analysis of the IJ, mindlessly affirmed by the BIA, failed to come anywhere close to the “most egregious adverse factors” requirement of the BIA’s own precedent in Matter of Kasinga, 21 I&N Dec. 357, 367 (BIA 1996):

A grant of asylum to an eligible applicant is discretionary. The final issue is whether the applicant merits a favorable exercise of discretion. The danger of persecution will outweigh all but the most egregious adverse factors. Matter of Pula, 19 I&N Dec. 467, 474 (BIA 1987). 

Get this, folks! The IJ and the BIA both found that meeting the higher standard for withholding of deportation based on probability of persecution somehow was an “adverse factor” that outweighed family separation! That’s right, an “adverse factor!”  

I can’t imagine how this gang of so-called “judges, got through law school and admitted to the bar! Maybe “imposters” took their exams for them! THIS is the best American justice has to offer? If not, why are they making life or death decisions and imposing potential permanent family separation on refugees?

Notwithstanding the assembly line climate and lackadaisical approach to law in Garland’s Immigration “Courts,” these are NOT TRAFFIC COURTS! They are more like “death penalty courts” or “courts of last resort” and those humans appearing before them and their representatives deserve better. 

Judge Garland and his team should hypothesize that this type of inferior justice were being meted out in life or death cases to THEIR FAMILY MEMBERS AND LOVED ONES — actual human beings, NOT “just migrants” who, according to Garland’s EOIR, appear to exist in a twilight zone beneath the rest of humanity. That’s what the ongoing “Dred Scottification of the other” still being permitted and  promoted by Garland at DOJ is all about!

A fitting celebration of the first Federal Juneteenth Holiday would have been to remove the entire BIA so that they can no longer inflict “Dred Scottification” on migrants of color, their families, their friends, and their communities, among others! Symbolism is only effective if followed by action. And, so far, Garland’s actions on wiping out the “vestiges of Dred Scott at Justice” have fallen woefully short!

This raises serious, unaddressed questions of why such weakly qualified individuals are on the bench in the first place when there are many immigration experts out there who can and would do better. Much better! And it wouldn’t take them years and multiple hearings, appeals, and trips to the Circuit to grant asylum. 

This isn’t a “deep” case except that it represents the “deep dodo” 💩 at EOIR, the stench of which is fouling our entire justice system and shaking the foundations of our democracy! This case is about following the Code of Federal Regulations, properly applying precedent, and fairly treating asylum seekers. It’s “Law 101” — things L-1s would have to know to get to L-2! I can’t begin to think what the paper would look like like if one of my students gave me this kind of garbage on a final exam. Fortunately, to date, nobody ever has!

Nor is this a Circuit renowned for critical analysis or holding the Government to a high standards in immigration cases. Indeed, the Eleventh Circuit itself bears some responsibility for this mess! They are well aware of the anti-asylum bias and poor decision-making emanating from the Atlanta Immigration Court, within their jurisdiction, and have chosen to ignore it. It’s a “comedy” of errors, questionable ethics, and amateurish legal work that the DOJ should be ashamed of and which Garland should end — NOW! No wonder this ridiculous national embarrassment has created an unnecessary 1.3 million case backlog that continues to grow under Garland! 

Don’t let Garland or anyone else in the Administration tell you that this self-created backlog justifies a truncation of due process or more “bogus attempts to expedite” asylum cases. NO! What it requires is for Garland to bring in real judges and experts from the private/NGO sector to fix the Immigration Courts so they comply with due process and fundamental fairness!

Judge Garland, “come on man!” These deadly robed clowns and their “defenders” represent YOU — “the top legal officer in our Executive Branch!” YOU have a responsibility to the American people (NOT just the failed DOJ or the President) to “get out the big hook” and “yank” these anti-due process, anti-immigrant, anti-asylum, anti-racial-justice clowns 🤡 off YOUR bench and replace them with competence and fairness. A little (now missing) diversity wouldn’t hurt either! It’s called fulfilling the promises made by Biden and Harris during the election!

It’s not going to improve until Garland replaces the BIA with qualified judges, hires only Immigration Judges who know how to fairly adjudicate asylum cases, (with outstanding public reputations for fairness, scholarship, timeliness, teamwork, and respect), and AAG Vanita Gupta brings in better leadership at OIL to put an end to this tragic, totally unnecessary, disgracefully wasteful abuse of our Federal Judicial system and the resulting human carnage! 

NDPA warriors, don’t be fooled or lured into complacency by this week’s long overdue positive developments in A-B- and L-E-A- — things that experts said should have been done by Judge Garland on “Day 1.” Keep showing your total dis-satisfaction and disgust with the glacial pace of reform at DOJ and the myriad of highly unqualified “judges” still being allowed to continue to inflict racial injustice and “worst imaginable practices” on vulnerable individuals (and their lawyers) who are entitled to due process and justice — not a continuing deadly ☠️ clown 🤡 show! Keep letting Garland, Monaco, Gupta, Clarke, Biden, Harris, Congress, the Article IIIs, and the American people know that “The EOIR Clown Show Has Got To Go!” NOW! There will be neither racial justice nor equal justice for all in America (wake up, Vanita Gupta and Kristen Clarke) while Garland operates his “star chamber courts” at EOIR!

Judges Khan and Marks are already on the DOJ payroll. Garland should have brought them in to Falls Church, on at least a temporary basis, to start cleaning up the mess and instituting long overdue due process and judicial independence reforms! The NAIJ which they represent should have been reinstated to represent Immigration Judges.

Recent retirees on the Round Table like Judges Honeyman and Dornell could have been rehired on a temporary basis under available authority to help root out and change the inane quotas, bad precedents, terrible exclusionary hiring processes, and mind-boggling “Aimless Docket Reshuffling” that continues to build backlog, deny due process, and promote reactionary White Nationalist policies in the failed and flailing Immigration “Courts.”

The continuing problems at Garland’s DOJ start with EOIR, but by no means end there! Apparently, Garland’s lackadaisical, permissive attitude toward corruption at DOJ under Trump & his cronies doesn’t get the Hill Dems’ attention unless they and their families were personally targeted by the illegality and misconduct. Otherwise, it’s just the lives of immigrants, asylum seekers, and “the others,” mostly people of color and abused women and children, so who cares? 

It’s worthy of noting that it has largely fallen to the press and public interest groups to expose the corruption allowed to fester at Trump’s DOJ. Only then does Garland make tardy and half-hearted efforts to investigate or take action. Cleaning up corruption, changing bad and illegal policies, and rooting out those who carried out such abuses should have been “job one” for the incoming Attorney General. Instead, it’s an “afterthought,” at best!

And, of course, good government and ethics aren’t part of the “institutional culture” @ DOJ that Garland is so anxious to defend. Does every Administration have a “right” to have its illegal actions and corruption covered up and defended by its successor? Will it really deter “good government” if you believe that you might be held accountable by the next Administration for acts of unconstitutionality or illegality? 

How come using the law as a “deterrent” is fine as applied to migrants of color, but “deterring” present and future DOJ bureaucrats and politicos from abusing the law in support of a corrupt Administration’s illegal policies isn’t?

Sure, I recognize that guys like Sessions and Barr have a perverted view of what’s unconstitutional. But, the object is to make it difficult for horrible opponents of American democracy like them to become Attorney General in the future and to insure that there will be institutional resistance to any future efforts to corrupt our justice system.

“Normalizing” the unprecedented overtly corrupt behavior of theTrump regime is a continuing problem! We need to fight it all levels of our society and government!

Dishonesty appears to be the main “bipartisan institutional value” at DOJ. No wonder it was so easy for Sessions and Barr to get their corrupt agendas carried out by career lawyers and bureaucrats! 

Unless and until Congress finally lights a fire under Garland and his team, and creates an independent Article I Immigration Court, that’s unlikely to change.

Our DOJ is quite obviously broken and reeling. Why isn’t fixing it one of our highest national priorities?

CGRS Urges V.P. Harris to Reject Short-Sighted Policies that Endanger Central Americans

San Francisco, CA (June 10, 2021) – This week Vice President Kamala Harris visited Guatemala and Mexico, meeting with government and civil society leaders to discuss issues of corruption, violence, and poverty. During a Monday press conference with Guatemalan president Alejandro Giammattei, Harris offered a callous and woefully misguided message to Central Americans. “I want to be clear to folks in the region who are thinking about making that dangerous trek to the United States-Mexico border,” Harris said. “Do not come. The United States will continue to enforce our laws … If you come to our border, you will be turned back.” These remarks reflect a deep misunderstanding of our laws and of the conditions forcing people to seek asylum at our border. The Center for Gender & Refugee Studies (CGRS) urges the vice president and the Biden-Harris administration to do better.

For people fleeing Central America it is no secret that the voyage north is dangerous, and that they will likely face hostility at the U.S. border. Yet thousands continue to make the treacherous journey because widespread violence, poverty, and disasters in their home countries leave them no other option. Vice President Harris and the Biden-Harris administration should understand this: People flee home because their lives, and the lives of their children, depend on it. The administration’s advice that Central Americans, Haitians, and others escaping grave dangers simply “not come” – as if they have any choice in the matter – is cruel and wildly out of touch. Moreover “enforcing our laws” should mean upholding the right to seek asylum, which is enshrined in both U.S. and international law. Turning people away without the slightest concern for the dangers they’ll face, as the Biden-Harris administration has continued to do under the illegal Title 42 policy, is a blatant violation of our laws.

“Our country has played a direct role in the dangerous conditions that plague Central America by bolstering oppressive regimes and contributing to the violence and instability driving refugee flight from the region,” CGRS Manager of Regional Initiatives Felipe Navarro Lux said today. “Instead of taking responsibility and addressing the harm we have caused, the United States time and time again has doubled down on ineffective and draconian policies that punish Central Americans and other refugees for seeking U.S. protection. We have a legal and moral obligation to do better.”

Our immigration and foreign policies should seek not to suppress migration, but to expand safe and orderly pathways to refugee protection and, in the long term, to make the region safer, so that migration is increasingly an option, rather than a necessity, for Central Americans. We can do so by:

  • Encouraging transparent and accountable governments that uphold the rights of their residents: The United States should stand with Central American civil society organizations (CSOs) working for change – not abusive or authoritarian governments – to combat corruption, advance the rule of law, and promote respect for human rights, particularly for vulnerable groups including youth, women, Indigenous, Black, and LGBTQ+ people.
  • Prioritizing humanitarian protection over deterrence. Pressuring countries in the region to increase migration enforcement and militarize their borders only forces people seeking protection to make more dangerous journeys, exposing them to increased human rights violations.
  • Expanding and developing new pathways for migrants and asylum seekers: We should expand protections those fleeing persecution, increase opportunities for family reunification, and address the needs of those displaced by climate change.
  • Designating Temporary Protected Status (TPS) for Guatemala, and re-designating TPS for Honduras, El Salvador, and Nicaragua: TPS allows immigrant communities in the United States to live and work without fear of deportation, and to send remittances to family members in their home countries still recovering from the effects of back-to-back hurricanes and the COVID-19 pandemic.

CGRS urge a la vicepresidente Harris rechazar políticas miopes que ponen en peligro a los centroamericanos

San Francisco, CA (10 de junio de 2021) – Esta semana la vicepresidente Kamala Harris visitó Guatemala y México, reuniéndose con líderes de los gobiernos y la sociedad civil para discutir asuntos de corrupción, violencia, y pobreza. Durante una rueda de prensa junto con el presidente guatemalteco Alejandro Giammattei, Harris leofreció un mensaje cruel y tristemente equivocado a los centroamericanos. “Quiero ser clara con las personas en la región que están pensando en hacer el peligroso viaje a la frontera de Estados Unidos-México”, dijo Harris. “No vengan. Estados Unidos hará cumplir sus leyes… Si vienen a nuestra frontera, serán regresados”. Estas palabras relejan un profundo desconocimiento de nuestra legislación y de las condiciones que obligan a las personas a pedir asilo en nuestra frontera. El Centro de Estudios de Género y Refugiados (CGRS por sus siglas en inglés) urge a la vicepresidenta y al gobierno Biden-Harris a realizar un mejor trabajo.

Para las personas que huyen de Centroamérica no es un secreto que el viaje al norte es peligroso, y que muy seguramente serán recibidos con hostilidad en la frontera de EE. UU. Aun así, miles continúan migrando porque la violencia, pobreza, y desastres en sus países de origen no les dejan otra opción. La vicepresidente Harris y el gobierno Biden-Harris deben entender esto: Las personas huyen de sus hogares porque sus vidas, y las vidas de sus hijos, dependen de ello. El consejo que este gobierno le da a los centroamericanos, haitianos, y otros que escapan de graves peligros cuando les dice que “no vengan” – como si fuera una opción – es cruel y se aleja de la realidad. Mas aún, “hacer cumplir nuestras leyes” debería significar proteger el derecho a solicitar asilo, el cual se encuentra consagrado en la ley nacional e internacional. Retornar a personas en la frontera sin la menor preocupación por los peligros que puedan enfrentar, como el gobierno Biden-Harris continúa haciendo bajo la ilegal política del “Título 42”, es una violación descarada de nuestras leyes.

“Al apoyar gobiernos opresivos y contribuir a la violencia e inestabilidad en Centroamérica, nuestro país ha jugado un papel directo en la creación de los peligros que obligan a miles a huir”, dijo Felipe Navarro-Lux, Gerente de Iniciativas Regionales de CGRS. “En vez de asumir nuestra responsabilidad y aminorar el daño que hemos causado, una y otra vez Estados Unidos ha implementado políticas ineficientes y draconianas que castigan a los centroamericanos y otros refugiados por buscar protección en este país. En vez de buscar suprimir la migración, nuestras políticas exteriores y migratorias se deben enfocar en crear y ampliar opciones seguras y ordenadas de acceso a protección para refugiados y, a largo plazo, mejorar las condiciones en la región para que la migración sea cada vez más una opción, y no una necesidad, para los centroamericanos. Podemos hacer esto al:

  • Promover gobiernos que respeten los derechos de todos sus residentes, urgiendo transparencia y rendición de cuentas: Estados Unidos debe apoyar a las organizaciones de la sociedad civil que trabajan para efectuar cambios – y no a gobiernos corruptos y autoritarios – para combatir la corrupción, reforzar el estado de derecho, y promover el respeto por los derechos humanos, particularmente para la juventud, mujeres, personas indígenas, negras y LGBTQ+.
  • Priorizar la protección humanitaria sobre la disuasión migratoria. SAN MIGUEL, El Salvador — Rejected by her family, Zashy Zuley del Cid Velásquez fled her coastal village in 2014, the first of a series of forced displacements across El Salvador. She had hoped that in the larger city of San Miguel she could live as a transgender woman without discrimination and violence, but there she was threatened by a gang.

She moved away from San Miguel, then back again in a series of forced moves until the 27-year-old was shot to death April 25, sending shock waves through the close-knit LGBTQ community in San Miguel, the largest city in eastern El Salvador.

“Zashy was desperate; her family didn’t want her … and the gangsters had threatened her,” said Venus Nolasco, director of the San Miguel LGBTQ collective Pearls of the East. “She knew they were going to kill her. She wanted to flee the country, go to the United States, but they killed her with a shot through her lung.”

One day after Del Cid’s slaying, U.S. Vice President Kamala Harris identified anti-LGBTQ violence in Central America as one of the root causes of migration in the region during a virtual meeting with the president of neighboring Guatemala, Alejandro Giammattei. She is visiting Guatemala and Mexico this week.

Transgender migrants were present in the Central American caravans that attempted to reach the United States border in recent years, fleeing harassment, gang extortion, violence and police indifference to crimes against them. Even in those large migrant movements, they say they faced harassment.

Things had been rough during Del Cid’s first stint in San Miguel. She had been living in a neighborhood where, as in many parts of the country, the MS-13 gang was the ultimate local authority. Gang members began to harass her, then brutally beat her, breaking her arm in 2015, Nolasco said.

“They warned her to leave, but she didn’t listen,” Nolasco said.

Del Cid moved in with Nolasco in the same neighborhood. One day, the gang grabbed Del Cid again.

“They took her, they wanted to kill her,” Nolasco said. “I begged them not to kill her, to let her go and she would leave the neighborhood.”

Del Cid moved back to her hometown, but her family rejected her again. She tried to please them, but she couldn’t, Nolasco said. Del Cid joined a church, got a girlfriend and had a baby girl, but could not maintain that life, she said.

She returned to San Miguel, where initially things seemed to go better. In 2020, Del Cid received humanitarian and housing support from COMCAVIS TRANS, a national LGBTQ rights organization, and the United Nations High Commissioner for Refugees.

Del Cid rented a home and opened a beauty salon there. She hired another woman to help her and was participating in an entrepreneurship program. She was preparing a business proposal to move the salon into its own space.

But Del Cid was shot in the back walking alone at night down the street. Passersby tried to help her and took her to a hospital, where she died. So far, police have made no arrests, and Nolasco believes that like other hate crimes in the country, “it will be forgotten; they’re not interested in what happens to us.”

Laura Almirall, UNHCR representative in El Salvador, said Del Cid’s killing frightened her community and saddened everyone who knew her.

“She was excited about her new plans and her new life. And unfortunately and tragically, everything came to an end,” she said.

Nolasco said that in San Miguel, some 70 miles east of the capital, the transgender community endures constant harassment from intolerant residents and gangs. They have rocks thrown at them, are beaten and are victims of extortion. If they go to police to make a report, they are insulted and demeaned. “Don’t come here to claim rights, because there are no rights for you,” police tell them, Nolasco said.

Despite some legal nonsense from EOIR and sometimes from uninformed Circuit Judges who have never represented asylum seekers and know little of actual conditions in the Northern Triangle, neither El Salvador nor the other Northern Triangle governments are “willing and able” to protect most individuals suffering gender-based and other forms of persecution. Decisions claiming otherwise are, in most cases, legally wrong and disingenuous to boot.

The U.S. asylum system needs expert Asylum Officers at DHS and progressive expert Immigration Judges at EOIR. Babbling (misleadingly) about “sealed borders” won’t take the place of telling Garland and Mayorkas to stop screwing around, bring in progressive experts, and fix the U.S. asylum system before more die! V.P. Harris could have taken the first necessary step toward “fixing the Southern Border” without even leaving DC.

How are we going to promote the rule of law in other nations when we ourselves are unwilling to exhibit honesty and follow the law with respect to the most vulnerable in the world seeking legal refuge at our borders?

Every individual, regardless of status, has a legal right to apply for asylum at our border. This law was enacted on 1980 to carry out our legal obligations under the U.N. Convention and Protocol on the Status of Refugees, to which we have been party since 1968. 

Right now, the U.S. has neither a legal asylum system operating at ports of entry nor does it have a functioning refugee program in Central America. Borders were illegally closed and legal immigration avenues were suspended by the White Nationalist Trump Administration on various pretexts involving false narratives about COVID, labor market impact, and national security, among others. At one point Trump even made the absurdist claim that America is “full!”

The Biden Administration has peddled rhetoric about re-establishing legal immigration. But, to date they have neither re-established the rule of law for asylum seekers at our Southern Border nor have they instituted an operational refugee program for Central America. 

How bogus is the Biden/Harris continuation of the COVID facade for closing the border? Well, I didn’t hear much mention from Harris in Guatemala of COVID as a reason not to come or any promise to restore the legal asylum system once the “fake COVID emergency” is resolved.

So, there is no legal way for those in Guatemala and other countries to seek refuge in the U.S. Ignoring requests from experts and humanitarian NGOs, the Biden Administration has also stubbornly failed to repeal biased “precedents” from the Trump DOJ designed to make it difficult for refugees fleeing Latin America, particularly women, to qualify for legal protection despite the fact that their lives and safety will be in danger if returned. 

Our scofflaw actions actually leave refugees needing protection no choice but to cross the border surreptitiously. We have suspended the rule of law for legal asylum seekers, while dishonestly claiming that they, not we, are the “law breakers.” After nearly 50 years in and sometimes out of the immigration bureaucracy, I know bureaucratic doublespeak when I hear it.

Remarkably, Vice President Harris seems to have cribbed her public statements on Guatemalan asylum from Gauleiter Stephen Miller. Even more astoundingly, Miller’s influence on the Biden Administration’s failing immigration policies, particularly at Garland’s dysfunctional EOIR, continues to far exceed that of the diverse coalition of progressive experts, human rights advocates, and civil rights leaders who helped elect Biden and Harris! Talk about disrespect and being taken for granted!

In other words, America has totally “welched” on our legal and moral obligations to refugees and asylum seekers. Yet, incredibly, Harris warns them to stay in places where their lives and safety are in immediate danger, rather than taking a calculated risk of finding safety in the United States.

Since the U.S. no longer has a rule of law for asylum seekers or refugees, this usually means trying to enter with the aid of paid smugglers who offer them something the U.S. is unwilling to provide — a realistic possibility of refuge in time to save their lives! It’s certainly “not rocket science!” But, disturbingly, it appears to be above Harris’s pay grade!

As smugglers point out, the possibility of getting to the interior of the U.S., and there finding “do it yourself” refuge in our intentionally-created and often exploited “underground population,” actually far exceeds the chance of being granted asylum, even when we had a “somewhat” functioning asylum system. That’s largely because our law has long been improperly politically “gamed” (by Administrations of both parties) against asylum seekers from Central America. 

So, nobody actually knows how many would qualify for asylum under a fair and unbiased system. We’ve never had the moral courage to set up such a procedure. Instead, we have used imprisonments, family separations, racist rhetoric, criminal prosecutions, and skewed legal denials from “captive courts” tilted in favor of DHS enforcement as “deterrents” to desperate refugees from our own Hemisphere.

Our nation fears complying with our own laws! Not much of a “profile in courage” here!

The Vice President concedes that the “in place” assistance she is offering to individuals in some of the world’s most corrupt and lawless countries is unlikely to have any impact for years to come. And, that’s assuming that the Biden Administration’s aid plan is better than those that have failed in the past, which it well might be. It certainly will be better than the insane cruelty and improper “enforcement only” efforts of the Trump Administration.

She is correct that most, but not all, Guatemalans would prefer to live in Guatemala if that were possible. But, the problem she insists on “papering over” is that survival in Guatemala currently is not reasonably likely for many Guatemalans. Unless and until Congress creates a more realistic legal immigration system, there is simply no realistic opportunity for many Guatemalans other than to apply for asylum at the border. 

While asylum law would not cover them all, a proper interpretation and application through a re-established and meaningfully reformed system, overseen by expert judges (currently eschewed by Garland’s dysfunctional Immigration Courts) could admit many more legally and timely than the current non-existent system or past ones intentionally skewed against asylum seekers in a futile, improper attempt to use the legal process as a “deterrent.” It would also encourage and motivate asylum seekers to apply at legal ports of entry rather than crossing surreptitiously.

Yet Harris’s “clear message” (of non-hope) to the oppressed people in the Northern Triangle is for them to “die in place,” while awaiting long-term solutions that might or might not ever happen. Meanwhile, the world’s richest nation lacks the will and determination to re-establish a legal asylum screening and adjudication system at our Southern Border. 

Harris also wants the desperate masses “yearning to breath free” to know that the beacon of freedom no longer burns in America. We think it would be better if they died where they are, largely out of our sight and out of our mind.

We resent their efforts at survival, forcing us listen to their screams at our border for help that we prefer to deny (in violation of our legal obligations). We are bothered by the stench of the dead and annoyed by the news media’s incessant reporting on the Administration’s continuing failures of legality and humanity. Better (for us, not them) if they don’t come.

It’s an interesting “lesson” on racial and immigrant justice, as well as gender justice, from a Vice President who apparently prefers “inspiring” future generations to taking the tough, courageous moral and legal stands necessary to preserve and protect the current ones!

The Vice President might be correct on the rudiments of a better and more realistic long-term migration and economic plan for the Northern Triangle. But, her failure to recognize the essential first step of making the existing legal asylum asylum system work, and her unwillingness to tell Garland and Mayorkas to stop the foot-dragging and start complying with our laws and our Constitution, will doom her efforts long before they could ever have any positive impact.

The Southern Border is a big challenge. The solution has eluded all of Harris’s male predecessors, including her current boss, for the last half-century. 

It requires an end to “Milleresque” platitudes and an honest recognition of the human realities of forced migration. It cries out for a strong knowledgeable leader who will re-establish the legal asylum system already in the law, insist that for the first time in our history it be operated by experts with robust humanitarian protection goals, real progressive expert judges, and full constitutional due process. It demands an end to the mindless dehumanization and demeaning of asylum seekers and recognition that those granted asylum are legal immigrants, a source of strength, and a benefit to our nation, not a phenomenon to be demonized and feared.

It requires a robust refugee program in the Northern Triangle that takes the pressure off the border asylum system until needed changes in the legal immigration system can be pushed through Congress and the longer-term improvements in infrastructure and governance in the Northern Triangle take effect.

It also requires a leader with the comprehensive knowledge and moral courage to defend robust legal refugee and asylum systems and more legal immigration from the onslaught of racially-charged, myth-based attacks from White Nationalists and nativists that are sure to follow. She would also have to deal with pushback from an entrenched immigration bureaucracy and weak leadership from Garland and others who have continued to feed the problems rather than solve them.

Unfortunately for Vice President Harris, our nation, and, most of all, the forced migrants whose lives and humanity are on the line every day, right now the job appears to be bigger than the person.

However, despite advice from public health experts and condemnation by UNHCR, expulsions under Title 42 continue and the human cost has been devastating. Though refugees come from countries all over the world, the Department of Homeland Security expels them to Mexico, just on the other side of the border.

Reports by Human Rights First document the terrifying realities they face once there: kidnappings, violence, sexual assault, extortion and even murder in border towns where criminal gangs and cartels prey on recently expelled children and families. Just this spring, a 4-year-old Honduran boy and his asylum-seeking mother were kidnapped in Nuevo Laredo immediately after they were expelled under Title 42.

Expulsions don’t just impact migrants from Mexico and Central America. Despite the recent designation of temporary protected status for Haitian migrants within the United States, the Biden administration has sent plane after plane of asylum-seeking families back to Haiti, with some Haitians being expelled to Mexico. The UndocuBlack Network and the Haitian Bridge Alliance, for example, document a Haitian woman expelled to Mexico with her three-day-old baby, where she will face extreme anti-Black discrimination and be at risk of violence and homelessness.

Just the start: Biden will no longer detain migrants at two county jails. That’s good but not enough.

Public health has often been used as a pretext for restrictionist immigration policies. Beginning as early as 1793, when Haitians were blamed for bringing yellow fever to Philadelphia, nativism and xenophobia have long merged with concerns about public health to exclude immigrants and refugees. These concerns were not justified by science then, and they certainly are not justified now.

Thanks, my friends, for speaking out about the continuing outrages perpetrated by the Biden Administration at our Southern Border. So many,  many “practical experts” out here in the “real world,” like Lindsay and Sarah, who would be heads and shoulders above current immigration “leadership” at DHS, DOJ, and EOIR and who would bring “real, qualified, expert judging” to the BIA and the Immigration Courts.

The Biden Administration’s failure to actively recruit, attract, and promptly bring on board the “best and the brightest” that American law has to offer for these critical jobs (which do NOT require Senate confirmation) is a disgrace! Betcha Stephen Miller could tell them how to do it! But, curiously, the Biden Immigration Team seems to think that alienating the best progressive minds in the business, the folks who helped them get elected and can fix their immigration problems, is smart politics and great public policy! Go figure!

Suspending the rule of law and international treaty obligations is never “OK” and it’s not something to be “studied.” “Gee whiz, should we comply with the law or continue to violate it; should we continue to send people to possible kidnapping, rape, torture, extortion, and/or death with no process or should we give them fair hearings; should we continue unqualified Trump hacks in key positions and keep defending illegal policies or should we hire qualified experts from the NDPA to restore and promote due process?” These are the “questions” that folks like Garland, Mayorkas, and their “spear carriers” are being paid to “study” while innocent humans are daily being abused and dying in the “real world” that these Biden Cabinet officers appear to have absented themselves from? Gimme a break! 

We need an end to the deadly nonsense at DHS, DOJ, and EOIR NOW! Keep the outrage, the op-eds, the law suits, and the exposure and documenting of Mayorkas’s and Garland’s illegal, immoral, and incompetent actions coming until we get change and our Government delivers on the Constitutionally-required promise of due process, equal protection, and racial justice for all persons!

Day after day they flock to the emerald green house on Estévez Street, seeking news of loved ones who have vanished without a trace.

“They say there are lots in there, maybe 40,” said Jessenia Elizabeth Francia, a 38-year-old housewife who had travelled 20 miles to reach the heavily guarded building under a punishing midday sun.

Francia had come to Chalchuapa, a small town in western El Salvador, in search of her son, Luis Fernando, who disappeared seven years ago at the age of 16. “I just want to find at least his bones so I can bury them and find peace,” she said, clutching a cellphone showing a photograph of her missing child and the words: “I have faith.”

Others sought daughters or wives, Central American women feared to have fallen prey to the house’s proprietor, the former police officer and alleged serial killer Hugo Ernesto Osorio Chávez, who is feared to have buried his victims inside.

“She was 24,” said Candelaria Carranza Castro, a silver-haired mother whose daughter went missing in July 2015 and who was among those to visit the house on Monday. “Whatever has happened I want to find her.”

The mass grave at No 11 Estévez Street was discovered on the night of 7 May after neighbours called police having heard the cries of a young woman. By the time police arrived more than an hour later she and her mother were dead – reportedly bludgeoned to death with an iron tube by Osorio, who confessed to the crimes. While taking the 51-year-old into custody, police stumbled across the half-buried bodies of two men in the house’s patio and, when they started digging, found more corpses below in a series of pits.

Authorities have yet to announce the precise number of bodies buried inside but the excavators still probing its foundations believe there could be as many as 40, and no fewer than 15.

Quit using a pandemic policy to expel migrants

In a steadily growing encampment mere yards south of the U.S.-Mexico border, we are led to a little girl with a fever. She lies dehydrated and wrapped in her parents’ possessions inside a waterlogged tent. Recently deported from the United States under a Trump-era pandemic policy, the family is camped next to the border wall with thousands of others who have nowhere to go.

In recent months, much attention and political outrage have focused on unaccompanied children crossing into the U.S. and being detained in government custody. But less scrutiny has been given to the mass deportations of migrant families and vulnerable adults expelled with no due process during the pandemic under a U.S. health law called Title 42, which allows the government to bar people from countries where communicable disease exists.

For more than a year — and in the name of public health — the government has been summarily expelling migrants arriving at the U.S.-Mexico border, ignoring epidemiologists and health experts, violating the migrants’ human rights and creating a critical situation in Tijuana and other border towns.

As medical professionals who provide care in encampments and shelters in Tijuana, we’ve seen how this expulsion policy has caused a humanitarian emergency in northern Mexico. Even as these encampments become increasingly overcrowded and unsafe, many migrants and their families are still being denied entry or quickly expelled by the U.S. government. The Biden administration has carried out roughly 350,000 expulsions, including nearly 50,000 families.

The administration, as part of a legal settlement, recently agreed to process up to 250 asylum seekers a day deemed vulnerable by advocacy groups so they may continue to pursue their asylum cases in the United States.

However, this is nowhere near sufficient to address the widespread human rights violations and humanitarian crisis we see every day in Tijuana. There are still many thousands of asylum seekers along the border who were previously subjected to inhumane detention and expulsions — and who are now grappling with the subsequent fallout and trauma.

Migrants in Tijuana are subjected to targeted violence by cartels, squalid conditions in encampments and shelters, and despair after the U.S. lied to many of them about their expulsions. Some asylum seekers have said Border Patrol agents told them they were being transferred to a shelter in another U.S. city when, in fact, they were sent to Mexico.

As co-founders of an organization providing healthcare to migrants stranded in Tijuana, we have been working around the clock to provide medical care.

We have seen increasing dehydration, malnutrition and infectious diseases associated with overcrowding. At an encampment in Tijuana that shelters about 2,000 asylum seekers, there are no formal sanitation facilities; gastrointestinal illnesses are causing severe illness in newborns and young children. Chronic diseases and mental health disorders, left untreated, could become death sentences. The migrants have been forced to camp amid very cold temperatures at night during winter months.

Disease is not the only threat. Families fear cartel activity and kidnappings since vulnerable migrants are often targeted for violence. More than 80% of LGBTQ refugees in Baja California reported surviving an assault in Mexico from mid-February to March. Last month, we received a late-night phone call from a lawyer asking for our help. The client — a transgender woman — had been stabbed, forced into hiding and was afraid to go to the local hospital in Tijuana because they are often unsafe places for sexual minorities. We were able to provide her basic medical care, but many others are not as lucky.

The Title 42 expulsion order has been used by the U.S. to essentially eliminate asylum at the border and put thousands of people in immediate danger by either returning them to their countries of origin or to Mexican border cities, even if the asylum seekers are not Mexican or do not speak Spanish. While the administration recently ceased cross-border expulsion flights — a reckless approach during the pandemic used to transfer and expel migrants to Mexico — officials have reserved the right to reinstate them as needed.

The policy has disproportionately affected Black migrants, who are often Haitian. They are expelled without due process back to persecution in Haiti or to pervasive anti-Black violence in northern Mexico — leaving them without access to healthcare, psychological support, safety or asylum.

“I appeal to the government of the United States to swiftly lift the public health-related asylum restrictions that remain in effect at the border and to restore access to asylum for the people whose lives depend on it, in line with international legal and human rights obligations.

I welcome the US government’s plans for much needed reform and capacity building to manage border processes and the positive steps that have been taken to exempt unaccompanied children and some families in situations of acute vulnerability from these severe restrictions. A system which allows a small number of asylum seekers to be admitted daily, however, carries with it a number of risks, and is not an adequate response. There is an urgent need to take further steps to provide access at ports of entry which remain closed to most asylum-seekers owing to the Title 42 public health order by the US Centers for Disease Control and Prevention (CDC), in place since March last year.

The Title 42 order has resulted in the expulsions of hundreds of thousands of people to Mexico or their countries of origin, denying their access to asylum procedures. Guaranteed access to safe territory and the prohibition of pushbacks of asylum-seekers are core precepts of the 1951 Refugee Convention and refugee law, which governments are required to uphold to protect the rights and lives of refugees. The expulsions have also had serious humanitarian consequences in northern Mexico.

We at UNHCR, the UN Refugee Agency, have maintained since the start of the pandemic that protecting public health and protecting access to asylum, a fundamental human right, are fully compatible. At the height of the public health emergency, many countries put in place protocols such as health screening, testing and quarantine measures, to simultaneously protect both public health and the right to seek asylum.

I encourage the US administration to continue its work to strengthen its asylum system and diversify safe pathways so asylum-seekers are not forced to resort to dangerous crossings facilitated by smugglers.

For our part, UNHCR stands ready to support the implementation of such a decision.”

The suffering of migrants continues as does the indifference of Biden officials to racial and gender injustice. Such tone deafness and spinelessness doesn’t bode well for voting rights, police reform, criminal law reform, pay equity, health care, or any other civil rights/social justice initiatives from the Biden Administration!

The Biden folks can’t keep relying on the crimes against humanity by Trump as an excuse for continuing them! Not rocket science — but it should be the number one national priority now that COVID-19 seems to be getting under control and the economy is rebounding.

We aren’t gong to solve the centuries-old problems in the Middle East tomorrow! But, we could and should begin fixing our broken and dysfunctional immigration system and Immigration Courts today (actually should have been underway since Day 1 of the Biden Administration)!
