As the economy has improved and consumers have begun recognizing that improvement, Republicans have pivoted to attacking President Biden on a different policy weakness: immigration. After all, virtually everyone — Democrats included — seems to agree the issue is a serious problem.

But what if that premise is wrong? Voters and political strategists have treated our country’s ability to draw immigrants from around the world as a curse; it could be a blessing, if only we could get out of our own way.

Consider a few numbers: Last week, the nonpartisan Congressional Budget Office released updated 10-year economic and budget forecasts. The numbers look significantly better than they did a year earlier, and immigration is a key reason.

The CBO has now factored in a previously unexpected surge in immigration that began in 2022, which the agency assumes will persist for several years. These immigrants are more likely to work than their native-born counterparts, largely because immigrants skew younger. This infusion of working-age immigrants will more than offset the expected retirement of the aging, native-born population.

Instead, GOP lawmakers scaremonger about the foreign-born, characterizing immigration as an invasion. As Rep. Mike Collins (R-Ga.) dog-whistled last week, “Import the 3rd world. Become the 3rd world.”

Alas, the faction working to turn the United States into a developing country is not immigrants but Collins’s own party. It’s Republicans, after all, who have supported the degradation of the rule of law; the return of a would-be dictator; the gutting of public education and health-care systems; the rollback of clean-water standards and other environmental rules; and the relaxation of child labor laws (in lieu of letting immigrants fill open jobs, of course).

America has historically drawn hard-working immigrants from around the world precisely because its people and economy have more often been shielded from such “Third World”-like instability, which Republican politicians now invite in.

Ronald Reagan, the erstwhile leader of the conservative movement, often spoke poignantly of this phenomenon. In one of his last speeches as president, he described the riches that draw immigrants to our shores and how immigrants in turn redouble those riches:

Thanks to each wave of new arrivals to this land of opportunity, we’re a nation forever young, forever bursting with energy and new ideas, and always on the cutting edge, always leading the world to the next frontier. This quality is vital to our future as a nation. If we ever closed the door to new Americans, our leadership in the world would soon be lost.

Reagan’s words reflected the poetry of immigration. Since then, the prose — as we’ve seen in the economic numbers, among other metrics — has been pretty compelling, too.

Already the media are “at it again,” most attributing Democrat Tom Souzzi’s easy win over his GOP opponent for the House seat vacated by George Santos to his “move right” on immigration. But, as Catherine suggests above, “what if that premise is wrong?”

There is certainly support for a more nuanced view, both anecdotally and in polls.  “Suozzi, [a voter]  said, would ‘protect us but also be fair to those who are seeking asylum.’” https://www.washingtonpost.com/elections/2024/02/13/new-york-district-3-special-election-george-santos/. Sadly, and outrageously, the so-called Senate “compromise” border bill that Souzzi touted and which has become the “darling” of the tone-deaf mainstream media does neither. Not even close!

Yet, supposedly responsible journalists are falling all over themselves touting the benefits to Dems of a horrible “Miller-Lite” bill that essentially would have destroyed the right to asylum while turning the border over to cartels and smugglers to exploit some of the world’s most vulnerable who are victims of our own failings. We don’t have to “guess” at the human consequences of the nativist-inspired “bipartisan” non-solution at the border being trumpeted and glorified by Post editorialists safely ensconced in their “ivory tower!” We know! The results of recent half-baked attempts to close the border and eliminate asylum seekers are clear and well documented: death and human carnage inflicted on legal asylum seekers! So, here’s a more intellectually honest “rewrite” of today’s lead editorial:

POST EDITORIAL BOARD: Death, Murder, Rape, Torture, Assault, Robbery, Extortion, Kidnapping of Hispanics, Blacks, Other Forced Migrants A Small Price To Pay For Bipartisan Deal To Outsource Migration To Gangs, Cartels, and Traffickers!

We Must Not Only “Turn Away The St. Louis,” But Torpedo It So Every Man, Woman, & Child Goes To The Bottom Where They Will Be Effectively Deterred From Ever Again Invoking Our Laws & Moral Obligations!

Nowhere, and I repeat nowhere, are the voices of those with decades of actual hands on experience working with migrants at the border, and the voices of those migrants themselves, being heard and heeded in this “non-debate” that resulted not in a “compromise” but in a “human rights giveaway.” What gives us the right to arrogantly and immorally give away rights and human lives that are NOT ours in the first place as if they were “table favors at a political fundraiser?“

As Beatriz so pointedly said:

Thanks to the moral vapidity of Dem politicos and the Administration the “game” for the lives, rights, future, and human dignity of asylum seekers is now being “played” between the “Good Guys’”goal line and their ten yard line! We are being offered a “choice” between “cruel and stupid” and “crueler and dumber!” Certainly, the Dems and our nation could and should do better!

Supporting fairness, orderly processing, and actions that protect asylum and the community would be a far more prudent choice for Dems than the virulent “death to asylum craze” (the unstated part of which is that it also means “death to asylum seekers”) that currently seems to be “in vogue” with both parties and mindlessly hyped by the media. 

It’s quite possible that Souzzi won not because of his extreme position on asylum, but because his position was “less extreme” that that of his GOP opponent and her openly xenophobic party. This conclusion is actually supported by polls that show that while most voters understandably want “order at the border,” they also want to protect the right to claim asylum and a fair process for doing so. There is opportunity here for Dems to change minds and create a stronger coalition for asylum seekers and other immigrants. NGO experts like Beatriz Lopez need to partner with Congressional Dems who understand asylum and the border (like Rep. Hillary Scholten (D-MI) and Rep. Joaquin Castro (D-TX)) to reach out and meet with Rep. Souzzi and others like him to explain practical solutions and useful changes at the border that would create order while maintaining and enhancing fair and timely asylum processing. 

Among these is the low-budget, common sense proposal advanced by retired Wisconsin Judge Thomas Lister and me for “Judges Without Borders,” essentially “leveraging” voluntary service by trained, retired State and Federal Judges to work with groups informing and advising individuals before they make the dangerous journey to our Southern Border. Budget-friendly humane solutions that can reduce the pressure on the border should be a bipartisan winner. Read more about our proposal here! Beyond that, advocates must explain and model how migrants themselves can help resolve the problems facing Rep. Souzzi’s district and improve the quality of life for all. They must show how migrants are “part of the solution,” perhaps, for example, by establishing public-private partnerships that would involve migrant communities in constructing high-quality, attractive affordable housing that would help the entire community. Working on various civic improvement projects might also be a mutually beneficial option.

Advocates, NGOs, and political supporters of migrants must do more than just point to graphs and cite statistics about the long-term economic and societal benefits of immigration. They must actually model and create practical joint projects and expand opportunities for the benefit of migrants and the communities to which they have been relocated. 

Problem-solving needs to be brought into the “here and now” rather than just being presented to U.S. communities as a vague promise of future benefits. My experience is that most people react to what’s before them today rather than than relying on a constructed view of tomorrow, now matter how attractive and statistically supported that future vision might be.

In addition to the misguided “Miller Lite nonsense” from the editorial board and, disappointingly, even the usually responsible and insightful Karen Tumulty, today’s WashPost contained useful observations from Eduardo Porter about the need to get migrants to places in the U.S. where they, their job skills, and their work ethic would be welcomed, appreciated, and useful.

But, both the Biden Administration and Congress have shamefully failed to convert this “low-hanging fruit” into reality. Even worse, that has allowed White Nationalist demagogues like Abbott and DeSantis to waste and divert millions in public funds to make the situation worse and to convert those who want to help America succeed and prosper into hapless “political footballs” being tossed back and forth between GOP nativists and wimpy Dem politicos who long-ago lost their moral bearings. Although NGOs and advocates are weary and overburdened, if they don’t take the initiative to make this happen, on at least some scale, the opportunity will be lost and the nativist myth-makers will prevail.

Only by modeling actual results in real time will we be able to demonstrate the fallacy and counterproductivity of the GOP’s nativist “burden myths.” There’s no time like the present to start!

To no one’s surprise, this past week the bipartisan border bill, creatively named “The National Security Act, 2024” and introduced by an all white cast of Senators, failed to pass the chamber. Many Democratic Senators who once stood beside immigration advocates at rallies to push back against the proposal fell in line with their president and voted in favor of a flawed and dangerous bill that would fall short of mitigating migration. None but the beltway nerds and press were paying attention to C-SPAN as the proposal died, triggering Democratic political operatives to salivate over the “gotcha” vote that’ll be used against Republicans on the campaign trail.

For many of us battle-tested, seasoned advocates, there was no true satisfaction at seeing Republicans implode or an undesirable proposal fall apart. Hanging above our heads like a Florida cockroach threatening to fly into our faces was the fact that the Biden administration, Majority Leader Chuck Schumer, Senator Chris Murphy, and Democrats who voted for the bill had officially moved the goalpost on immigration.

‘Tis a slippery slope to empower the nation’s president to shut the border down to block asylum seekers and codify measures to make it nearly impossible to claim asylum and easier and faster to deport people back to dangerous conditions while hoping a developing nation with its own set of serious problems cracks down on vulnerable children and families seeking safety and refuge. To be okay with all of this means you’ve – as Isabel Wilkerson so aptly wrote – gone through a “process, a programming” to dehumanize both the issue and those at our doors, begging for shelter and freedom.

And look I get it. I’ve heard the rhetorical, exasperated questions: what else are Democrats supposed to do when migrants keep coming to the border? When Republicans keep hammering us on the border? And Chicago and New York are struggling to manage those bussed into the cities? And in a pivotal election year, these questions carry an extra ounce of GTFO.

And to them I say – I hear you. I’m listening. I’m worried, too. But I’m not concerned about the tenacity and brilliance of local leaders and NGOs on the ground working to help newly-arrived immigrants to settle in this powerful and abundant country. Or least of all anxious over visionary funders and creative mayors and governors seeking ways to welcome new settlers into regions eager for consumers and workers. I’m not even worried about Trump and Republicans relentlessly attacking Democrats on the campaign trail – it’s nothing new.

What I am truly troubled by is Democrats choosing flight over fight.

The current conundrum that President Biden and Democrats find themselves in goes beyond the challenges of global migration. Since 2017, Democratic messaging has been devoid of pro-immigrant messaging. Were it not because of the loud cries of a toddler separated from her mother and the incredible journalistic accounting that shook the soul of America did it spring even moderate Democrats into action. But, when it came to political advertising and a constant drumbeat of both values-based immigration messaging and Republican accountability on the issue, you had to search far and wide to find solid examples. Thanks to the David Shor’s of the political class, most Democrats chose to avoid the issue, leaving a vacuum gladly filled by Stephen Miller types.

The Democratic choice to neither proudly display their position on immigration or celebrate the immigration wins has left the American people believing they’re for “open borders” or wondering where they stand on the issue and have they done anything on it? What’s worse, they consistently fail to counter their opponent’s radical, Trumpian rhetoric and anti-immigrant ideas. While racist and radical media and online influencers, such as Tucker Carlson, yell anti-immigrant obscenities and the GOP spend millions upon millions trying to convince Americans that immigrants are bad people who are trying to replace them, infiltrate their communities with drugs and crime, and steal their jobs and social security, Democrats have responded by pivoting to other kitchen table issues.

The gradual damage of this messaging to America’s psyche and perception of the other – immigrants – has created the current moment. Now, even reporters from major news outlets are asking me why and how Trump dismantled our immigration system and what actions President Biden had taken to restore the system. The first question often leaves me baffled, for how quick we forget the heinous wrongs of the past, and the second is no surprise, just sad.

It’s really disappointing that not many people, reporters included, don’t know that the Biden administration has taken over 500 actions that have had such a positive impact on women, families, children and workers in the U.S.

No Democrat should be afraid of their immigration shadow. It’s time to stop running away or running to the right of the issue. You can be sensible without spite. Until Republicans can treat the cancer that is Trump, Democrats have to go to bat for the issue with gutsy resolve, bold solutions and radical empathy. They have to be in it for the short and long game. Like investing in an index fund or supporting reproductive rights or gay marriage, it’ll pay off to tell Americans and Republicans that Democrats stand for an immigration system that lives up to our values and meets our nation’s economic demands, that we’ll secure our border with smart and humane solutions – not band-aids that create chaos and jeopardize lives – that we’ll do whatever it takes to deliver a path to citizenship for Dreamers and hard-working immigrants who have waited too long for our government to act, and that we’ll fight like hell against Trump and anyone who threatens to separate families, deport our neighbors en masse, and divide our communities.

No one is immune to mistakes or bad votes. For Democrats, this is a moment to reflect and admit you fucked up. Now do better. Yes, use the vote to hold Trump and Republicans accountable – but don’t you dare use that bill as a model for legislation or campaign rhetoric.

You can’t out-Trump Trump.

Humanize the issue. Show courage and compassion. Talk solutions. Remind voters what and who you stand for and what’s at stake if Trump and anti-immigrant Republicans have it their way. Be disciplined and keep repeating. Throw some money behind that messaging. And I promise you, you’ll win.

This should be required reading for every Dem politico!

Case in point: A very recent Congressional Budget Office (“CBO”) study reaffirmed what those who work with migrants have always known: Directly contrary to the GOP and media myths, migrants of all types — regardless of status — are a huge source of economic growth for America. They will help fuel a $7 trillion boost in the U.S. economy over the next decade! See, e.g., https://time.com/6692645/immigration-economy-us-gdp-growth-cbo-report/.

But, you sure wouldn’t know this from the one-sided “debate” about migration going on today. The GOP spreads (and the media promotes, largely without critical analysis) blatant lies and myths about the largely fabricated and often self-created “burdens” of migration (see, Abbott, DeSantis). Yet rather than rebutting them and embracing truth, Dems basically look the other way and try to change the conversation.

This has caused them to “run away from” and “downplay” one of the Biden Administration’s most important positive achievements — functioning parole programs that move migrant flows from the “irregular” to the “regular!” Moreover, that  processing takes place in advance, outside the United States, rather than adding to the border pressure or becoming part of the overhyped asylum backlog resulting from poor performance by Administrations of both parties and Congress over decades (but hugely aggravated by the Trump kakistocracy). Even the immediate work authorization problem is solved by the advance parole programs.

Are these programs perfect? No, they are far too limited both in terms of numbers and scope of eligible nationalities. They also don’t answer questions about the long-term fate of those paroled. But, they are certainly a step in the right direction that could be built upon and “model” the case for more durable long-term legislative expansions of visa programs.

The GOP’s irrational attacks on what is working and helps our country and the world shows just how little they care about solving problems or the long-term prosperity, stability, and strength of our nation.  Yet, the largely indisputable benefits of parole and the willingness of the Administration to engage in creative and successful problem-solving gets scant mention from either the Biden campaign or Congressional Dems.

And, the media is no better. Given the current high-profile of immigration on the national scene, one might reasonably have expected “front page coverage” of the CBO report and findings, particularly since it directly contradicts many of the false claims raised by both parties during the recent failed “Senate compromise” proposal. Instead, even I had to do some “digging” to come up with articles featuring the CBO report.

Curiously, the GOP plays to the most extreme, dangerous, and unreasonable elements of its far right base.

Conversely, Dems run against the values and views of some of the most reasonable, dedicated, and energizing elements of their progressive base.

Not smart!

Commentary: During turbulent times, Maine invests in its people

During the latest legislative session, much was done to ensure that prosperity is within reach of all Maine citizens and residents.

The times in which we live are, and have been, difficult. Turbulence confronts us at every corner, upon every turn. Around us things are constantly changing – economically, politically, medically, socially. There is too often too little upon which to rely to attain and maintain a degree of certainty in one’s life.

As we emerge from the COVID pandemic, we find its effects lingering in large workforce and societal shifts: lost jobs, lost day care, essential care workers leaving the workforce, older workers retiring early or moving into part-time work to stay afloat, small businesses closing, women leaving jobs to care for young, sick and elderly family members, people moving to and from communities, and rents and housing prices skyrocketing. These effects persist; regaining some degree of stability will take time.

ABOUT THE AUTHORS

Luisa S. Deprez is professor emerita of sociology and the Edmund S. Muskie School of Public Service at the University of Southern Maine. Lisa Miller is a former legislator who served on the Health and Human Services and Appropriations and Financial Affairs committees. They are members of the Maine chapter of the national Scholars Strategy Network, which brings together scholars across the country to address public challenges and their policy implications.

Yet we now see a glimmer of hope, a light at the end of the tunnel. Definite improvements in the overall economy are emerging: unemployment rates are at a historic low, housing starts are increasing, the manufacturing sector has seen an increase in orders for the past few months, consumer confidence has risen dramatically, and inflationary pressures are subsiding.

Maine’s policymakers are now tasked with ensuring that Mainers share in that rebound – that families and communities can build new pathways to prosperity and well-being. Enhancing and promoting prosperity must be the primary concern of policymakers and elected officials.

Classic views of “prosperity” usually refer to economic success and building wealth. But broader definitions of prosperity include becoming or remaining strong and healthy and flourishing. In other words, thriving. Yes, individual initiative and responsibility is critical to building prosperity, but the assurance to do so is rarely achievable in the absence of government support. Nor is success sustained without such support.

Policymakers and state officials know this well, as seen in recent bills and initiatives that emerged from this past legislative session:

• Workers can take paid family leave to combat illness or care for a loved one.

• New child tax credits provide additional support to low-income families.

• Older Mainers will receive financial support for medical costs and property tax bills.

• Child care gets a boost through improved wages and broader subsidies.

• More affordable-housing initiatives were funded.

• A new business incentive program was created.

• A workforce training tax credit will help employers grow the skill level of Maine workers.

• Additional support for emergency food and shelter was funded.

These achievements should be celebrated as they will certainly contribute greatly to the rebound necessary for individuals, communities, and the state to regain some of the losses.

But there was much left undone to build prosperity for everyone. The Wabanaki nations are still denied rights and protections; immigrants continue to be denied access to MaineCare; health care costs are even more burdensome for an increasing number of Mainers; pay disparities by gender and race remain; agricultural workers continue to be exempt from basic labor laws; workers with low salaries remain ineligible for overtime, and corporate loopholes and tax-avoidance prevail, leaving communities to carry the load for citizen and community investments.

During this legislative session, many organizations and individuals lobbied tirelessly to ensure that prosperity is within reach of all Maine citizens and residents. Both Gov. Janet Mills and the Legislature responded with investment of tax dollars to help everyday people stay in their jobs or seek new ones, become healthier, and be more productive.

Political and moral philosopher J.S. Mill would argue that “societies tend to flourish when individuals have a wide scope for directing the course of their own lives.” Many of the bills passed by the Maine Legislature do just that. But more needs to come. We are not done.

Unfortunately, the ridiculously short 30-day comment period and that this major reversal of the positions and values that Biden and Harris campaigned upon, without meaningful input and discussion with experts who actually understand the borders and have been present there, indicates that the the comments are likely to be largely ignored. That’s going to lead to big time litigation — from both progressives and GOP nativist/restrictionists. 

But, discouragingly, the Biden Administration has shown itself to be willing to tie up time and resources insanely (and not necessarily successfully) doing battle with its own would-be supporters rather than fighting the right! Just who they think is going to be the “winner” here — other than, perhaps, Donald Trump and Jim Crow  — is beyond me!

Biden taking this stance on criminal justice issues comes after the administration recently announced a series of restrictions on asylum seeking so stringent that some former Biden staffers are likening them to Donald Trump’s policies.

I think these decisions are largely about electoral politics. A big part of Biden’s 2024 strategy is to win Michigan, Pennsylvania and Wisconsin again. These states are disproportionately White and have a lot of swing voters who are moderate or conservative on issues such as immigration.

“Electoral politics trump values when it comes to access to asylum,” a Biden administration official recently told the Los Angeles Times.

But I am still not convinced these moves are good politics. Republicans are going to cast Democrats as too lenient on crime and immigration no matter what. I am skeptical these Republican attacks would be significantly more effective because Biden let the D.C. criminal code revisions go into effect or was more lenient to asylum seekers. It’s not as if he has delivered a major speech calling for open borders or defunding the police.

At the same time, voters know the Democratic Party is the one that is more supportive of immigration and making the criminal justice system less punitive. So I am also skeptical that Biden moving to the right on these issues in early 2023 in fairly subtle ways is going to help that much.

And while the electoral effects are fairly unclear, the policy ones are very obvious. Biden is embracing immigration limitations that a future President Trump or DeSantis would build on. The next Republican president will try to silence critics by noting that a Democratic president did similar things.

There will be some people who truly deserve asylum who won’t get it because of Biden’s new policies. It is hard to imagine a Republican president respecting D.C. home rule if a Democratic one won’t. It is extremely disappointing that a heavily White coalition (congressional Republicans, swing-district Democrats and Biden) is reversing the decisions of the government of heavily Black D.C.

Biden appears to be emulating his Democratic predecessors. It’s hard to definitively prove when a politician does something for electoral reasons. But the list of actions taken by Bill Clinton and Barack Obama as candidates and presidents that likely were done in part to appeal to White swing voters is long and troubling: Clinton’s criticism of the rapper Sister Souljah, in part to distance himself from Jesse Jackson, the leading civil rights activist of that time; his decision to leave the campaign trail to preside over an execution in his role as Arkansas governor; his enactment as president of anti-crime and anti-welfare provisions that embraced anti-Black stereotypes of that era; Obama, as a senator from Illinois, criticizing the Rev. Jeremiah Wright, who conducted Obama’s wedding; and Obama often ducking addressing racial issues, particularly in his first term.

I assume Clinton and Obama would argue that their actions were better than letting a Republican be elected. And that they sincerely believed in most or all of them. Biden might argue that his moves to the right will literally save democracy, because the Republican Party of today is so radical.

But if you have to override the elected local representatives of a place (D.C.) that has no representation in Congress to woo swing voters in Wisconsin, you are trying to preserve something less than an ideal democracy.

There must be ways for Biden to appeal to White swing voters that don’t involve backtracking from core principles such as asylum rights, D.C. home rule and a fair criminal justice system. His reelection is a big thing. It’s not the only thing.

So, according to Biden and the toady Dems (“DINOs?”) who surround him, “access to asylum” — which happens to be a legal right guaranteed by law — is just another “strategic option” — totally expendable, like the many grass roots progressive Dems who support it and helped elect Biden/Harris in 2020.

The progressive social justice movement thus finds itself at a perilous crossroads. It has grown and amassed a remarkable wealth of talent, energy, and a commitment to taking a diverse America into a better democratic future. It also represents values and practical solutions that should appeal to the majority of Americans.

Yet, it finds itself without a political home and lacking meaningful political influence. Thanks to Biden, progressives find themselves spending far too much of their time and energy re-fighting fundamental battles that they won years ago, undone by Trump, and now adopted and “normalized” by Biden. 

And despite many impressive successes in defending democratic principles in increasingly conservative courts, progressives lack the political power and strategy to “out-punch” the radical neo-fascist right. The latter group consistently “punches above its weight” politically.

Can “Kids in Cages” — perhaps displayed outside next year’s Democratic Convention to show that this Administration is “tough as nails” when it comes to beating up on the most vulnerable and ignoring laws they are too incompetent and cowardly to implement — be far behind?

I’ve said this before: Until progressives can band together and develop a political strategy (perhaps not unlike the “Freedom Caucus” in the GOP) for making spineless Dems like Biden and Harris pay a political price for abandoning values and disrespecting grass roots supporters, they will continue to be abused, humiliated, and treated as expendable by a Dem Party that time and time again has demonstrated an inability and unwillingness to govern according to principles and fundamental values. Why keep voting, funding, and supporting folks who don’t represent your values any more than the GOP does?

That’s a serious question that progressives need to answer. It’s particularly pertinent for younger progressives whom Dems see as the “future of the  party,” while taking your support for granted and without committing to represent or stand up for your deeply held values. Sounds like a bad deal to me!  

Dems, as a whole, suffer from a chronic inability to distinguish their friends from their enemies. Progressives, particularly the “younger generation,”  would do well to learn the difference and act accordingly!

Stern does a “victory lap” over Biden’s 40 great Article III judicial appointments to the lower Federal Courts, closing with the astounding claim that: “Democrats are finally playing hardball with the courts.”

In truth, Dems are only belatedly starting to do what the GOP has been doing over four decades: Get your guys in the positions where they make a difference for better (Dems, in theory) or worse (GOP in practice).

Appointing a diverse, talented, progressive group of 40 out of 870 Article III Judges is an important, necessary, and long, long overdue start; but, it’s not going to make a cosmic difference overnight!

By contrast, there are about 550 Immigration Judges, the majority appointed by GOP restrictionist AGs, many with mediocre to totally inadequate credentials for the job. And, it shows in the consistently substandard performance and mistake-riddled, haphazard “jurisprudence” emanating from Garland’s EOIR.

The main qualifications for a number of these pedestrian to totally outrageous appointments appears to be willingness to carry out former GOP AGs’ restrictionist, nativist policies, or at least to adhere to the DOJ’s enforcement-oriented agenda, while ignoring, distinguishing, or downplaying the due process rights of migrants!

This is “complimented” by an appellate branch (the BIA) with about two dozen judges hand-selected or retained for notorious anti-immigrant records or willingness to “go along to get along” with the wishes of DHS Enforcement. The BIA turns out some truly horrible, almost invariably regressive, “precedents.” A number are so lacking in substance and coherent analysis that they are unceremoniously “stomped” by the Article IIIs despite limitations on judicial review and the travesty of so-called “Chevron deference” that serves as a grotesque example of Supremes-created “judicial task avoidance” by the Article IIIs.

From an informed Dem progressive perspective, it’s an infuriating, ongoing, unmitigated disaster! Only one BIA appellate judge, recently appointed “progressive practical scholar” Judge Andrea Saenz, would appear on any expert’s list of the “best and brightest” progressive legal minds in the field.

Unlike Article III Judges, who are life-tenured, EOIR Judges serve at the pleasure and discretion of the Attorney General and can be replaced and reassigned, including to non-quasi-judicial attorney positions, “at will.” 

Starting with Attorney General John Ashcroft’s notorious “BIA Purge of ‘03,” GOP AGs haven’t hesitated to remove, transfer, “force out,” marginalize, demoralize, discourage from applying, or simply not select EOIR judges who stood for due process and immigrants’ rights in the face of nativist/restrictionist political agendas.

Yet, for eight years of the Obama Administration and now a year into the Biden Administration, Dem AGs have lacked the guts, awareness, and vision to fight back by “de-weaponizing” the regressive GOP-constructed Immigration Judiciary and recruiting replacements from among the “best and the brightest” among the “deep pool” of expert, intellectually fearless “progressive practical scholars.”

Not only that, but Dems have totally blown a unique opportunity to remake and establish the Immigration Judiciary not only as “America’s best judiciary” — a model for better Article IIIs — but also as a training ground for the diverse progressive judiciary of the future! 

Even more significantly, tens of thousands of lives that should have been saved by an expert, due-process-oriented, racially sensitive judiciary have been, and continue to be, sacrificed on the alter of GOP nativism and Dem indifference to quality judging and human suffering in the Immigration Courts!

Compare the diverse, progressive backgrounds and qualifications of “Stern’s 40” with those on the totally underwhelming list of the most recent Garland “giveaways” of precious, life-determining Immigration Judge positions! See, e.g., https://www.justice.gov/eoir/page/file/1457171/download

The progressive talent is definitely out there to change the trajectory of the Immigration Courts for the better! Garland’s failure to inspire, recruit, appoint, and tout the “best and brightest” in American law for his Immigration Courts is a horrible “whiff” with disturbing national and international implications!

Article III Federal Courts deal with the mundane as well as the profound. By contrast, lives and futures are on the line in every single Immigration Court case! Often effective judicial review of EOIR’s haphazard, widely inconsistent, unprincipled, and one-sided decisions is unavailable, either as a legal or practical matter. The exceptionally poor performance of the Immigration Courts that continues under Garland threatens the underpinnings of our entire justice system and American democracy!

Right now, Garland’s broken system has a largely self-created 1.5+ million case ever-expanding backlog! At a very conservative estimate of four family members, co-workers, employees, employers, students, co-religionists, neighbors, and community members whose lives are intertwined with each of those stuck in Garland’s hopelessly broken, biased, and deficient system, at least 6 million American lives hang in the balance — twisting in the wind among Garland’s “backlog on steroids!” Yet, amazingly, it’s “below the radar screen” of Stern and other leading progressive voices!

I doubt that any Federal Court in America, with the possible exception of the Supremes, holds as many human lives and futures in its hands. Not to mention that “dehumanization” and “Dred Scottification” of the other in Immigration Court drifts over into the Article III Courts on a regular basis. Once you start viewing one group of humans as “less than persons” under the Constitution, it’s easy to add others to the “de-personification” process.

Yet, Garland cavalierly treats the Immigration Courts as just another mundane piece of his reeling bureaucratic mess at the DOJ. The long overdue and completely justified “housecleaning” at Trump’s anti-democracy insurrectionist regime seems far from Garland’s serenely detached mind!

For Pete’s sake, even ICE Special Agents understand the need to “rebrand” themselves by escaping the inept and disreputable ICE bureaucracy left over from Trump:

They say their affiliation with ICE’s immigration enforcement role is endangering their personal safety, stifling their partnerships with other agencies and scaring away crime victims, according to a copy of the report provided to The Washington Post.

But, Garland doesn’t understand the well-deserved toxic reputation of EOIR among legal experts? Gimme a break!

Garland also stands accountable for his spineless failure to insist on a dismantling of the bogus, illegal, immoral, and ultimately ineffectual Title 42 abomination at the Southern Border and an immediate return to the rule of law for asylum seekers.

Unless and until the Dems get serious about gutsy, radical progressive reforms of the Immigration Courts, the downward spiral of American justice will continue! Lives will be lost, and many of those who helped put Dems in power will be pissed off and “de-motivated” going into the midterms. That’s a really bad plan for Dems and for America’s future!

That — not a false sense of achievement — should have been the “headliner” for Stern and other progressive voices!

The CAP [Center for American Progress] can also be a critical friend. “During the spike in Haitian asylum seekers at the Texas border, when the world saw those reprehensible images of how those asylum seekers were being treated, I didn’t hesitate as the president of CAP to speak out against the policies and to personally go to the border to bear witness to what was occurring and to call for and demand different practises in how we adjudicate those matters.”

There has been “tremendous progress” at the border since then, he says. But Biden’s approval rating remains stubbornly low and there is a sense of gloom in the air. As the president nears his first anniversary in office, what is Gaspard’s verdict so far? “My god, can we step back for a second and have some perspective?

“If someone had told me or anyone on January 5th that 11 months later Joe Biden would have managed to pass a bipartisan infrastructure bill, successfully advanced a historic stimulus bill that’s led to the fastest 11 month job growth in America that we’ve ever had … and was also on the precipice of passing a piece of legislation that will expand access to Medicare benefits, lift up low wage workers who are the frontlines of the care economy, make the most progress on investments in climate change in two generations, I would have taken all of that if you’d offered it to me.”

In his inaugural address, Biden vowed to address the interlocking crises of climate, coronavirus, economy and racial justice. On the last of these, police reform and voting rights have stalled in Congress, raising fears that last year’s Black Lives Matter protests after the police murder of George Floyd could prove a moment, not a movement, after all.

Gaspard, however, believes the momentum is sustainable. “Of course there was the white knuckle moment of George Floyd and the explosion of pent-up advocacy and rage but now there’s a lot of good, thoughtful work. You’re going to have your setbacks but there’s also been extraordinary progress in a number of states – Missouri, Ohio, California – where you can quantify what’s changed. That will continue. Civil rights just does not move in a linear way.”

Less than a year after the 6 January insurrection at the US Capitol, however, the existential threats to democracy itself persist in a deeply divided nation. Gaspard describes himself as “radically optimistic” but not “Pollyannish” about the gathering storm.

“This is a thing I hesitate to say out loud but I really do believe that we should have the understanding that in 2024, when we are conducting elections across the country, there is the potential for us to experience January 6 on steroids, for us to see it in state after state in state capitols.”

“There’s the potential for that kind of civil disruption if we are not on our side intentional about pushing back now and about making as persuasive an argument for democracy as we can and an argument that’s manifest in actual legislation and executive orders.”

Reagan famously referred to America as a “shining city on a hill”; Biden has said the country can be defined in one word: “possibilities”. It was such promises that enticed Gaspard’s parents here half a century ago. But the turmoil of recent years has tarnished its image. Does he think his mother and father would have made the same choice today?

“We have seen that America, as an aspirational brand, has taken a hit the last several years. There’s a direct relationship between that and the previous president of the United States and how he postured on the world stage and projected us as a closed, hyper sovereign space that did not cooperate in a multilateral way and that led with military might and ‘America first’ as opposed to partnership and cooperation.

“There is a fear that I hear among immigrants that are in our community: they worry that the face of America has changed. When they see things like ‘the great replacement’ conspiracy that’s driving all kinds of not just rhetoric but actual policy on the ground for conservatives, they worry about what kind of violence it can visit on their children. All that anxiety is real.”

But again he sees the glass as half full. “I can tell you I’m pretty confident that if my parents were faced with that choice today that America is still the place they would see as this shining beacon of hope and opportunity, irrespective of its challenges which are real and more nakedly exposed than they have been in some time.

Gaspard needs to pick up the phone, call his fellow “child of immigrants” in the White House, and remind her that “die in place” and “rot in Mexico” aren’t “progressive human rights and racial policies!”

He also might challenge her to rethink the Administration’s regressive decision to allow AG Merrick “What Me Worry” Garland to run the nation’s largest, and probably second most important, nationwide Federal “court” system with a non-diverse group of many questionably qualified non-life-tenured “holdover” judges and a “de facto Supreme Court of human rights and racial justice” with horribly performing appellate judges appointed or retained by Sessions and Barr because of their “Miller-think” anti-immigrant philosophies and mis-interpretations of the law.

Patrick commendably went to the border to “bear witness” to the miserable Administration policies directed at Haitians and other asylum seekers of color. Now, I think he should show up in Immigration “Court” and “bear witness” to the systemic denial of due process, fundamental fairness, racial justice, and human dignity (not to mention mediocre judging) being inflicted on immigrants and their lawyers (if they are fortunate enough to even have one) on a daily basis! 🏴‍☠️ Then, call up President Biden and urge him to live up to his campaign promises!

There are many areas of damage to the American system, particularly the Article III Federal Courts, that are beyond the power of the President to immediately change. But, the Immigration Courts, under the total control of the Executive, are one where immediate progressive change is not only possible, it’s long overdue. If you can’t “put your own house in order” what’s the chance of achieving other portions of the vision for a better, fairer, and more just America?

Under Trump and McConnell, The Federalist Society and the Heritage Foundation “owned” the Article III appointment process, while far-right nativist groups FAIR and Center for Immigration Studies (“CIS”) did likewise for the immigration bureaucracy and the Immigration Courts. 

So, why is it that CAP and other progressive groups haven’t been able to achieve progressive reforms and better-quality judicial appointments in the Immigration Courts and the BIA? Progressives appear to have once again been outflanked, out-maneuvered, out-visioned, and out-strategized by far-right xenophobic restrictionist and nativist interest groups!

To be perfectly honest, the current Administration policies on refugees, asylees, and human rights in Immigration Court and at the border (the two are intertwined) more closely resemble those of “Gauleiter” Stephen Miller than they do of Patrick Gaspard and other supposedly influential progressives and humanitarians! I predict that future historians will find Garland’s mis-handling of EOIR to be one of the greatest, if not the greatest, “blown opportunities” in American progressivism!

At some point, being progressive and standing up for a racially just America that welcomes immigrants means more than just “talking progressive” or “remaining optimistic” in the face of lies and evil. It means taking action to combat the forces and enablers of anti-democratic, biased, authoritarianism and hate in America!

According to sources inside and outside EOIR, Attorney General Merrick Garland will appoint former BIA Chair and retired EOIR Senior Executive David Neal to the key position of EOIR Director, in charge of the nation’s dysfunctional and hopelessly backlogged Immigration Courts. He certainly will be an improvement over the last permanent Director, Judge James McHenry, who was hand-selected by former Attorney General Jeff “Gonzo Apocalypto” Sessions. 

But, progressives can’t expect the bold reforms and laser focus on due process that experts recommended. That’s simply not David’s “style,” nor is it his history at EOIR. 

Progressives had hoped that the selection would come from among the many exceptionally well-qualified potential candidates in the private sector who spearheaded the effort to oppose the Trump regime and keep due process alive at EOIR. Indeed, many had anticipated, apparently in vain, that Garland would tap one of the many well-qualified minority female “practical scholars” from the NDPA to lead the court reform effort. Since its founding in 1983, EOIR has never had a female Director, and has only had one minority Director, the late Juan Osuna during the Obama Administration. 

Neal will become the sixth White Male to serve as Director. He also would continue the “DOJ tradition” of appointing “insider bureaucrats” to the job rather than dynamic experts from the private sector. The latter might actually take bold actions to turn EOIR into an independent judiciary that would fulfill the now-abandoned vision of “through teamwork and innovation becoming the world’s best administrative tribunals, guaranteeing fairness and due process for all.”

Alas, Garland appears to have just as little interest in restoring that noble vision as his predecessors over the past two decades. That’s likely to not only further alienate the progressive advocacy community, but also to spell doom and suffering for many migrants and their frustrated, often pro bono, lawyers who must seek justice on a daily basis Garland’s regressive and totally dysfunctional “courts.”

On March 25, 1911, Frances Perkins was visiting with a friend who lived near Washington Square in New York City when they heard fire engines and people screaming. They rushed out to the street to see what the trouble was. A fire had broken out in a garment factory on the upper floors of a building on Washington Square, and the blaze ripped through the lint in the air. The only way out was down the elevator, which had been abandoned at the base of its shaft, or through an exit to the roof. But the factory owner had locked the roof exit that day because, he later testified, he was worried some of his workers might steal some of the blouses they were making.

“The people had just begun to jump when we got there,” Perkins later recalled. “They had been holding until that time, standing in the windowsills, being crowded by others behind them, the fire pressing closer and closer, the smoke closer and closer. Finally the men were trying to get out this thing that the firemen carry with them, a net to catch people if they do jump, the[y] were trying to get that out and they couldn’t wait any longer. They began to jump. The… weight of the bodies was so great, at the speed at which they were traveling that they broke through the net. Every one of them was killed, everybody who jumped was killed. It was a horrifying spectacle.”

By the time the Triangle Shirtwaist Fire was out, 147 young people were dead, either from their fall from the factory windows or from smoke inhalation.

Perkins had few illusions about industrial America: she had worked in a settlement house in an impoverished immigrant neighborhood in Chicago and was the head of the New York office of the National Consumers League, urging consumers to use their buying power to demand better conditions and wages for workers. But even she was shocked by the scene she witnessed on March 25.

By the next day, New Yorkers were gathering to talk about what had happened on their watch. “I can’t begin to tell you how disturbed the people were everywhere,” Perkins said. “It was as though we had all done something wrong. It shouldn’t have been. We were sorry…. We didn’t want it that way. We hadn’t intended to have 147 girls and boys killed in a factory. It was a terrible thing for the people of the City of New York and the State of New York to face.”

The Democratic majority leader in the New York legislature, Al Smith—who would a few years later go on to four terms as New York governor and become the Democratic presidential nominee in 1928—went to visit the families of the dead to express his sympathy and his grief. “It was a human, decent, natural thing to do,” Perkins said, “and it was a sight he never forgot. It burned it into his mind. He also got to the morgue, I remember, at just the time when the survivors were being allowed to sort out the dead and see who was theirs and who could be recognized. He went along with a number of others to the morgue to support and help, you know, the old father or the sorrowing sister, do her terrible picking out.”

“This was the kind of shock that we all had,” Perkins remembered.

The next Sunday, concerned New Yorkers met at the Metropolitan Opera House with the conviction that “something must be done. We’ve got to turn this into some kind of victory, some kind of constructive action….” One man contributed $25,000 to fund citizens’ action to “make sure that this kind of thing can never happen again.”

The gathering appointed a committee, which asked the legislature to create a bipartisan commission to figure out how to improve fire safety in factories. For four years, Frances Perkins was their chief investigator.

She later explained that although their mission was to stop factory fires, “we went on and kept expanding the function of the commission ’till it came to be the report on sanitary conditions and to provide for their removal and to report all kinds of unsafe conditions and then to report all kinds of human conditions that were unfavorable to the employees, including long hours, including low wages, including the labor of children, including the overwork of women, including homework put out by the factories to be taken home by the women. It included almost everything you could think of that had been in agitation for years. We were authorized to investigate and report and recommend action on all these subjects.”

And they did. Al Smith was the speaker of the house when they published their report, and soon would become governor. Much of what the commission recommended became law.

Perkins later mused that perhaps the new legislation to protect workers had in some way paid the debt society owed to the young people, dead at the Triangle Shirtwaist Fire. “The extent to which this legislation in New York marked a change in American political attitudes and policies toward social responsibility can scarcely be overrated,” she said. “It was, I am convinced, a turning point.”

But she was not done. In 1919, over the fervent objections of men, Governor Smith appointed Perkins to the New York State Industrial Commission to help weed out the corruption that was weakening the new laws. She continued to be one of his closest advisers on labor issues. In 1929, when Franklin Delano Roosevelt replaced Smith as New York governor, he appointed Perkins to oversee the state’s labor department as the Depression worsened. When President Herbert Hoover claimed that unemployment was ending, Perkins made national news when she repeatedly called him out with figures proving the opposite and said his “misleading statements” were “cruel and irresponsible.” She began to work with leaders from other states to figure out how to protect workers and promote employment by working together.

In 1933, after the people had rejected Hoover’s plan to let the Depression burn itself out, President-elect Roosevelt asked Perkins to serve as Secretary of Labor in his administration. She accepted only on the condition that he back her goals: unemployment insurance; health insurance; old-age insurance, a 40-hour work week; a minimum wage; and abolition of child labor. She later recalled: “I remember he looked so startled, and he said, ‘Well, do you think it can be done?’”

She promised to find out.

Once in office, Perkins was a driving force behind the administration’s massive investment in public works projects to get people back to work. She urged the government to spend $3.3 billion on schools, roads, housing, and post offices. Those projects employed more than a million people in 1934.

In 1935, FDR signed the Social Security Act, providing ordinary Americans with unemployment insurance; aid to homeless, dependent, and neglected children; funds to promote maternal and child welfare; and public health services.

In 1938, Congress passed the Fair Labor Standards Act, which established a minimum wage and maximum hours. It banned child labor.

Frances Perkins, and all those who worked with her, transformed the horror of the Triangle Shirtwaist Fire into the heart of our nation’s basic social safety net.

“There is always a large horizon…. There is much to be done,” Perkins said. “It is up to you to contribute some small part to a program of human betterment for all time.”

Perkins is one of the most important and under-recognized heroes of modern American history. Perkins believed that Government was there to promote the public good.

But, it wasn’t just a hollow slogan like those spouted by many of today’s politicos. She actually “walked the walk,” using her powerful intellect, energy, talent, advocacy skills, persistence, and influence with FDR to make America a much better place.

Just think of it: “unemployment insurance; health insurance; old-age insurance, a 40-hour work week; a minimum wage; and abolition of child labor.” An amazing list of accomplishments for which she has received far, far too little credit from historians. Today, most Americans probably think of Perkins, if at all, as the “first female Cabinet Secretary.” But she was more than that. Much more!

Perkins also used her position as Labor Secretary (prior to WW II the cabinet officer with responsibility for immigration) creatively in an attempt to save Jewish refugees from Nazi Germany. Although she won a major legal battle on the positive use of “charge bonds” to assist refugees, the actual effects of her humanitarian efforts appear to have been unfortunately limited. 

In the xenophobic, anti-Semitic, isolationist America of the 1930s, she also became a target of the far right for her strong commitment to human rights. In 1939, Congressional xenophobes initiated an unsuccessful impeachment attempt.

In 1940, FDR transferred responsibility for immigration from the Labor Department to the Department of Justice. That spelled not only the end of Perkins’s efforts to help Jewish refugees, but also was a death sentence for many who might have been saved. 

The DOJ threw up a powerful combination of restrictive requirements and bureaucracy to guarantee the death of more European Jews in the Holocaust. Indeed, the DOJ went one better by putting Japanese-American U.S. citizens in concentration camps based on “national security” claims that have since been shown to be both bogus and racially motivated. Sound familiar?

I really enjoyed Rebecca’s very lively, accessible historical writing that brings to life one of the ugliest episodes in modern American history, now largely swept under the carpet by today’s nativist revisionists. It’s also covered in the a Holocaust museum, an exhibit that contains much of  the same bogus “America is full” xenophobic rhetoric spouted by too many of today’s GOP nativists. 

This really horrible response by Western democracies to lives in peril was what gave rise to the Geneva Refugee Convention, the basis for the Refugee Act of 1980 and our current refugee and asylum system! How quickly we forget! The Trump Administration, with help from the Supremes, basically abrogated the legal system for refugees and asylees, without legislation. Despite promises to restore the rule of law, the Biden Administration has basically allowed most of Trump’s illegal and immoral policies to continue damaging humanity and diminishing us as a nation.

What would Frances Perkins have done? Certainly more than Garland and Mayorkas! At any rate, I enjoyed Rebecca’s historical writing and look forward to more!

A few years ago, Cathy and I had the pleasure of touring the Perkins Family Homestead, near Damariscotta, Maine, now owned by the Frances Perkins Center, with our dear, now departed Boothbay Harbor neighbor Sue Bazinet. It certainly opened my eyes to what true progressive values, lived and acted upon, were and still are!

In The Atlantic, journalist Jonathan Karl gives us a short look at Trump attorney general William Barr’s last weeks in power according to William Barr himself, who was kind enough to grace Karl with a series of interviews out of the innate goodness of his heart. Oh, and because Barr is now seen by many as the most thoroughly partisan and corrupt attorney general in a generation, which is going to seriously cut down on future speaking fees if he can’t figure out how to massage the record back into something vaguely defensible.

The actual news out of it is Not Damn Much, but this is a good opportunity to revisit the First Rule Of News Consumption: Be aware of the source. From the nation’s top powerbrokers to man-on-the-street interviewees, anyone talking to a reporter about their own doings is going to tell that reporter the most flattering version of events they think they can get away with. Many of the most important details about what Trump and his core team did in their attempts to overturn a United States election remain murky because those most in the know, like ex-House Republican turned chief of staff Mark Meadows, are clamming up.

So again we have a situation in which everyone around Trump was pretty damn certain he had gone off the rails, jumped the trolley, sprung a brain-leak, and had become devoid of marbles but nobody in government, from Secret Service on down, was willing to toss him in a burlap sack, tie it shut, and declare that Mike Pence was taking charge because the sitting president had developed a serious case of bananapants.

The key takeaway for progressives is that Barr is the guy that AG Merrick Garland HONORED by appointing 17 of his flawed selections to an Immigration Judiciary already reeling from a one-sided infusion of judges with questionable qualifications into a system weaponized against individual asylum seekers, other migrants, and their lawyers.

So far zero (0) progressive judges from the community of experts and advocates who helped show Barr the exit and elect Biden and Harris have been tapped for these “life or death” quasi-judicial positions. Rumor has it that’s about to change. But, that will hardly restore scholarship, due process, and balance to a disastrously “out of wack” deportation railroad!

The EOIR Tower in Falls Church might appear shiny from the outside, but inside it’s still just about as opaque as the lives of those caught up in Garland’s Star Chambers!

1) The Richmond video “court” is opening soon to hear more cases in secret without public access.

2) Several IJs working from home are now hearing cases by VTC from their residences. But, there’s no provision for those hearings to be open to the public contrary to the regulations. More VTC just means more problems.

3) EOIR has hired 10 or 11 new IJs but hasn’t disclosed the names publicly. Can “Dandy Dan” Kowalski & other news-hounds smoke out the names again?

4) At least one inexcusable, major setback on long overdue progressive judicial leadership @ EOIR! Unfortunately, the AG decided not to remove Wetmore as Chairman and his probation period has passed. 

So, are we stuck with a Miller/Barr/Trump toady “plant” in charge of a “court” that probably has more to do with racial and gender justice in America than any “judicial” (using the term lightly) body short of the Supremes and that “gets it wrong” — often dead wrong — in well-publicized bad opinions “outed” by the Article IIIs on a regular basis?  No, doesn’t make sense! 

Progressives, the NDPA, and anybody who cares about due process and equal justice in America should be raising hell with the Administration until we get the change we voted for! 

“Passing probation” doesn’t guarantee anyone a particular SES position or a quasi-judicial position at EOIR. Just ask legions of past DOJ “Hallwalkers!” 

Garland was sitting around the Ivory Tower while the NDPA was fighting in the trenches for human lives and the survival of Americans democracy. That’s a big reason why Garland, Biden, Harris, and the rest of the Administration have their jobs now! Don’t stand for an immigration bureaucracy and justice system controlled and populated by disciples and plants of “Gauleiter Miller,” “Billy the Bigot,” and “Gonzo Apocalypto.”

5) On the much brighter side, Courtside has confirmed from several sources that the long-extinguished flames of due process, fundamental fairness, best practices, humanity, compassion, and intellectual courage should soon be re-ignited in the opaque darkness and “rabbit warrens” of the 24th Floor of the Tower where the BIA hangs out. 

Will the “walls  of bias and intentional exclusion of the best and brightest American justice has to offer from outside government” that has plagued the BIA and demeaned American Justice for the past two decades finally be cracked? Will that crack become a breach that eventually becomes a flood of scholarship, fairness, efficiency, respect, and teamwork that will transform a “Tower of Darkness” in to a “Beacon of Justice” that can be seen from coast to coast?

6) Stay tuned! And, keep demanding better, much much better, from Garland, Monaco, Gupta, Clarke, and the rest of the Biden immigration, civil rights, human bureaucracy at DOJ! They seem to think that “elections only have consequences” in immigration and human rights when the GOP wins. 

Evidently, they view themselves as above the fray just treating EOIR like another piece of their dysfunctional DOJ bureaucracy. Nothing very proactive or bold! Just let the abuses be unearthed by others and dribble out a bit at a time.Then do a little damage control and “message massaging.” 

That’s a prime reason why, despite representing the majority of Americans, and having access to better ideas, the Dems have had trouble governing, retaining power, and turning their agenda into action over the past half-century!  It’s also a prime reason why humanity is suffering in our dysfunctional Immigration “Courts,” in a broken DHS that continues to run Gulags and has shamefully retaliated against NDPA members fighting for justice, and in the inexcusable human carnage at our borders fueled by the DOJ’s participation in corruption, intellectual dishonesty, and the illegal suspension of the rule of law! 150 days in and still no functioning asylum system? Come on man!

Five years ago, after retiring, I tried to tell the Clinton folks that not appointing a progressive immigration/human rights expert to be Attorney General would be a huge mistake. Obviously, that became a “moot point” in November 2016.

Ironically, however, the Trump Administration got my message in a negative way. They turned the DOJ over to radical White Nationalist nativists determined to use the negative power of bureaucracy and immigration to batter down the foundations of Americans democracy and spread the gospel of racism, misogyny, and unbridled xenophobia. And,  it worked! Big time!

I’m certainly not the only one who vainly tried to tell the Biden Administration NOT to repeat the same mistakes at Justice. Better candidates for AG, folks like the Castro brothers, Chairman Zoe Lofgren, Rep. Jamie Ruskin, and Dean Kevin Johnson were out there. Real, courageous, dedicated progressive leaders and due process mavens! Folks who would have shaken up EOIR, gotten rid of the deadwood and incompetence, cut the unnecessary backlog, instituted best practices, and reestablished a robust, functioning asylum system at the border by now! Folks with the proven backbone to stand up for justice, against all threats, internal and external! Folks who would take seriously their oaths “to protect the Constitution against all enemies, foreign and domestic!”

The slow and ineffectual pace of personnel and other achievable internal reforms at EOIR continues to be an insult to those who are the future of American democracy — if American democracy indeed has a future! That’s still up in the air!

We can see the effect of delay in making the necessary bold progressive immigration and human rights reforms in VP Harris’s foundering performance at the border. No rule of law, no program for fairly and efficiently adjudicating asylum, no open ports of entry, no coherent message on the realities of human migration, no order, kids in bad placements, Border Patrol agents “apprehending” folks who only want their prompt, fair asylum screening from Asylum Officers! What an (avoidable) mess!

The nativist opposition hasn’t folded their tents! Stephen Miller & co. are energized by Garland’s failure to heed the advice of and bring in the expertise of progressives at EOIR. He’s like “Voldemort” — every day Garland dawdles, Miller gets stronger.

After 8 years of “lockout” by Obama — yielding a quite predictable human rights and legal disaster — are the folks who revived democracy and kept the fires burning in Immigraton Court REALLY willing to put up with another four years of THIS? Are Dems REALLY THIS DUMB (not to mention ungrateful)?

First Steps

On June 16, Attorney General Merrick Garland finally, mercifully vacated three decisions that formed a key part of the Trump administration’s unrelenting attack on the law of asylum.1  Matter of A-B-,  issued by Jeff Sessions in June 2018, took aim in particular at victims of domestic violence.2  Matter of L-E-A-, issued the following year by William Barr, sought to undermine protection for those targeted by gangs due to their familial ties.3  And on January 14, 2021, six days from the end of the Trump Administration, acting A.G. Jeffrey Rosen issued a second decision in A-B-, gratuitously criticizing the method for determining nexus in asylum claims employed by the U.S. Court of Appeals for the Fourth Circuit, while conveniently evading that court’s review of the original decision in the case through remand.4

Garland’s action restores the law to where it stood prior to June 11, 2018, but only for the time being.  Proposed rules on the subject (which Garland referenced) are due by October 30, when they will first be subjected to a period of public comment.  If final rules are eventually published, it will occur well into next year.

As we sigh in collective relief and celebrate the first steps towards correcting our asylum laws, let’s also take note of the imperfect place in which the case law stands at present.

As to domestic violence claims, the BIA’s 2014 decision in Matter of A-R-C-G- (which Matter of A-B- had vacated) has been restored as binding precedent.5  That decision was issued at a time when (as now) regulations addressing particular social groups were being contemplated by DHS and EOIR.6  While A-R-C-G- was an extremely welcome development, the Board used it to recognize a rather narrowly-defined group: “married women in Guatemala who are unable to leave their relationship.”  In a footnote to the decision, the Board declined to address the argument of several amici (including UNHCR) that a particular social group may be defined by gender alone.  Although A-R-C-G- led to many grants of asylum, some immigration judges relied on the limited scope of the group’s definition to deny claims involving slightly broader variations, in particular, where the victim was not legally married, but nevertheless in a domestic relationship that she was unable to leave.  While the BIA reversed some of those denials in unpublished decisions, it declined to speak to the issue through binding precedent.

As to Matter of L-E-A-, Garland’s recent action returns us to the BIA’s original opinion in that case.7  While the decision acknowledged that families constitute particular social groups (a point that was not in dispute, having been universally recognized for some 35 years and stipulated to by DHS), the BIA still denied asylum by invoking a legally incorrect standard for establishing nexus that it has continued to apply in all family-based asylum claims.

For these reasons, the content of the forthcoming regulations will be extremely important in determining the future of asylum in this country.  While a return to the test for social group cognizability expressed in the BIA’s 1985 precedent in Matter of Acosta tops most regulation wish lists, I will focus the discussion here on a couple of more specific items necessary to correct the shortcomings of Matter of A-R-C-G- and Matter of L-E-A-.

First, the regulations need to explicitly recognize that a particular social group may be defined by gender alone.  In its 2002 Gender Guidelines, UNHCR identified women “as a clear example of a social subset defined by innate and immutable characteristics, and who are frequently treated differently than men,” and whose “characteristics also identify them as a group in society, subjecting them to different treatment and standards in some countries.”8  However, over the nineteen years since those guidelines were issued, the BIA has consistently avoided considering the issue.

The peril of defining gender-based groups in the more narrow manner employed by the BIA has been addressed by two distinguished commentators, who explain that such practice results in “constant re-litigating of such claims,” sometimes creating “an obstacle course in which the postulated group undergoes constant redefinition.”9  And of course, that is exactly what has happened here, as A-R-C-G- gave way to A-B-, which led to differing interpretations among different courts until Garland’s recent reset.  The above-mentioned commentators further decried the “nitpicking around the margins of the definition” resulting from the narrow approach when the true reason for the risk of persecution to the applicant “is simply her membership in the social group of ‘women.’”10  Regulations recognizing gender alone as a particular social group would thus provide clarity to judges and asylum officers, eliminate the wastefulness of drawn out litigation involving “nitpicking around the margins,” and bring our laws into line with international standards.

But as L-E-A- demonstrates, recognition of a group alone does not guarantee asylum protection.  In order for a group’s recognition to be meaningful, the regs must also address an ongoing problem with the BIA’s method for determining nexus, or whether persecution is “on account of” the group membership.

The BIA is accorded deference by Article III courts when it reasonably interprets immigration laws, provided that the meaning of the language in question is ambiguous.  However, the “on account of” standard included by Congress in defining the term “refugee” is quite clear; its meaning is long established, and in fact, is not particular to immigration law.

The Supreme Court referenced this standard last year in a non-immigration case, Bostock v. Clayton County.  The Court explained that the test

incorporates the “‘simple’” and “traditional” standard of but-for causation…. That form of causation is established whenever a particular outcome would not have happened “but for” the purported cause….In other words, a but-for test directs us to change one thing at a time and see if the outcome changes. If it does, we have found a but-for cause.11

In a 2015 decision, the U.S. Court of Appeals for the Fourth Circuit applied this exact test in the asylum context to conclude that persecution was on account of family, determining that the petitioner’s “relationship to her son is why she, and not another person, was threatened with death if she did not allow him to join Mara 18.”12  But for some reason, the BIA has felt entitled to reject this established standard outside of the Fourth Circuit in favor of its own excessively restrictive one.

Had the proper test for nexus been employed in L-E-A-, asylum would have been granted.  Under the facts of that case, once the familial relationship is removed from the equation, the asylum-seeker’s risk ceases to exist.  However, the BIA instead imposed an incorrect test for nexus requiring evidence of an “animus against the family or the respondent based on their biological ties, historical status, or other features unique to that family unit.”13

As a former circuit court judge, Garland is particularly qualified to recognize the error in the Board’s approach, as well as the need to correct its course.  The problem is compounded by the particular composition of the BIA at present.  For example, of the ten immigration judges who were promoted to the BIA during the Trump administration, nine denied asylum more than 90 percent of the time (with the tenth denying 85 percent of such claims).  Three had an asylum denial rate in excess of 98 percent.14

This matters, as those high denial rates were achieved in part by using faulty nexus determinations to deny asylum in domestic violence claims, even before the issuance of Matter of A-B-.  This was often accomplished by mischaracterizing the abuse as merely personal in nature, referencing only the persecutor’s generally violent nature or inebriated state.  The analysis in those decisions did not further examine whether gender might also have been one central reason that the asylum seeker, and not someone else, was targeted.

One BIA Member appointed under Trump recently found no nexus in a domestic violence claim by concluding that the persecutor had not targeted the asylum seeker because of her membership in the group consisting of “women,” but rather because she was his woman. There is no indication in the decision that the Board Member considered why the persecutor might view another human being as belonging to him and lacking the same rights he seems to enjoy.  Might it have been because of her gender?

Without a correction through published regulations, there is little reason to expect different treatment of these claims moving forward.  Let’s hope that the Attorney General views his recent action as only the first steps on a longer path to a correct application of the law.

Without progressive intervention, this is still headed for failure @ EOIR! A few things to keep in mind.

    • Former Attorney General, the late Janet Reno, ordered the same regulations on gender-based asylum to be promulgated more than two decades ago — never happened!
    • The proposed regulations that did finally emerge along the way (long after Reno’s departure) were horrible — basically an ignorant mishmash of various OIL litigation positions that would have actually made it easier for IJs to arbitrarily deny asylum (as if they needed any invitation) and easier for OIL to defend such bogus denials.
    • There is nobody currently at “Main Justice” or EOIR HQ qualified to draft these regulations! Without long overdue progressive personnel changes the project is almost “guaranteed to fail” – again!
    • Any regulations entrusted to the current “Miller Lite Denial Club” @ the BIA ☠️ will almost certainly be twisted out of proportion to deny asylum and punish women refugees, as well as deny due process and mock fundamental fairness. It’s going to take more than regulations to change the “culture of denial” and the “institutionalized anti-due-process corner cutting” @ the BIA and in many Immigration Courts.
    • Garland currently is mindlessly operating the “worst of all courts” — a so-called “specialized (not) court” where the expertise, independence, and decisional courage is almost all “on the outside” and sum total of the subject matter expertise and relevant experience of those advocating before his bogus “courts” far exceeds that of the “courts” themselves and of Garland’s own senior team! That’s why the deadly, embarrassing, sophomoric mistakes keep flowing into the Courts of Appeals on a regular basis. 
    • No regulation can bring decisional integrity and expertise to a body that lacks both! 
    • Any progressive who thinks Garland is going to solve the problem @ EOIR without “outside intervention” should keep this nifty “five month snapshot of EOIR under Biden” in mind:
      • Progressive judges appointed to BIA: 0
      • Progressive judges appointed to Immigration Court: 0
      • Progressives installed in leadership positions @ EOIR permanently or temporarily: 0
      • Billy Barr Selected Immigration Judges Appointed: 17
      • “Miller Lite” holdover individuals still holding key positions @ EOIR: many (only two removed to date)
      • Number of BIA precedents decided in favor of respondent: 2
      • Number of BIA precedents decided in favor of DHS: 9

That’s right, folks: Billy Barr and Stephen Miller have had more influence and gotten more deference from Garland at EOIR than have the progressive experts and advocates who fought tirelessly to preserve due process and to get the Biden Administration into office. How does that a make sense?

Asylum clinic wins release for Cuban doctor detained by ICE

In April 2020, COVID-19 reached the U.S. Immigration and Customs Enforcement (ICE) Detention Center in Eloy, Arizona. Dr. Merlys Rodriguez Hernandez, who had been detained there for six months, said she knew it would spread quickly.

Rodriguez Hernandez is originally from Cuba, where she and her husband, Lazaro, practiced medicine before they were forced to flee government persecution, she said. When they reached the U.S. border, they applied for asylum. Both were detained, in separate facilities, Merlys said. After eight months, Lazaro was granted protection from having to return to Cuba. Merlys’ petition, based on identical circumstances, was tried in a different immigration court – and denied, she said.

Cornell Law School’s Asylum Clinic took her case, under the direction of Stephen Yale-Loehr, professor of immigration law practice, and Ian M. Kysel, visiting assistant clinical professor of law. Law students Conor Bednarski, J.D. ’21, and Michelle Zhu, J.D. ’21, litigated an appeal to the U.S. Board of Immigration Appeals.

Meanwhile, Rodriguez Hernandez was trapped in a detention system raging with COVID-19, she said. She fell ill with the virus in May 2020 and spent 40 days in isolation, suffering from joint pain, body aches and severe diarrhea and confined to a cell she was expected to sanitize herself, she said. Tara Pilato, co-executive director emerita of the Weill Cornell Center for Human Rights at Weill Cornell Medicine, who consulted on the case, observed that “the conditions Merlys reported were not only inhumane, but against all best practices for caring for patients with COVID-19.”

“Watching this preventable tragedy unfold week after week, as we were told to shelter in place, was the hardest part of working on this case,” Bednarski said.

As the pandemic spread, Bednarski and Zhu tried to secure Rodriguez Hernandez’s release, and then supported a collaboration with pro bono counsel who filed a habeas corpus writ in federal court.

Kayleigh Yerdon, J.D. ’21, took the lead on the case during the fall 2020 term. With Spanish interpretation assistance from Cornell doctor of juridical science student Ana Ruival, LLM ’19, Yerdon won her client’s release on bond. Rodriguez Hernandez was released in October 2020, after 13 months in detention, Yerdon said.

“As a law student, being able to step into court for the first time via teleconference and win, knowing my client would walk free as a result, was just an incredible experience,” Yerdon said. She also took on Lazaro’s case, successfully litigating a motion to reopen his case, and eventually securing him asylum, she said. Yerdon was recently honored with the Law School’s Freeman Award for Civil-Human Rights, in part in recognition for her clinical work.

Meryls’ case shows that some of the most harmful flaws in the immigration system can be addressed by applying basic rights principles, Kysel said.

Rodriguez Hernandez and her husband are now living in Kentucky as they work to appeal the denial of her request for asylum. She said she hopes to become an advocate for immigrants who remain detained during the pandemic. Meanwhile, the legal team has continued its efforts to engage in other advocacy and to amplify the impact of their legal work on the doctor’s case, Kysel and Yale-Loehr said.

Recently, Rodriguez Hernandez told her story in a first-person essay in the New England Journal of Medicine, with the support of her Cornell Law clinic team and a team from the Weill Cornell Center for Human Rights, led by Pilato and Dr. Gunisha Kaur, assistant professor of anesthesiology.

“As one of our colleagues in the medical field, Merlys’ harrowing experience deserved attention from a medical-legal perspective,” said Pilato and Kaur. “The inhumane conditions in ICE detention centers have triggered some of the worst COVID-19 outbreaks in the country.”

In the piece, Rodriguez Hernandez wrote, “It is a bitter irony that while the first waves of the pandemic ravaged the U.S., I remained in a detention system when I could have made a difference to patients in a health care system in dire need of providers.”

Note that in the dangerous and defective “court system” being run by Garland, the Respondent continues to struggle with appeals of her asylum denial even though her husband’s identical case was GRANTED! Worse yet, both cases should have been “no brainer” asylum grants that could have been rapidly granted by the Asylum Office without detention or Immigration Court in a properly functioning system with expert judges setting correct asylum precedents at the BIA.

No wonder this system is continuing to deny justice, threaten lives, waste resources, and create backlogs under Garland! As noted in the above posting, even the New England Journal of Medicine is up in arms about this outrageous situation and mockery of our legal process!

But, Garland and his merry band at DOJ and EOIR seem impervious to criticism, rationality, or the rule of law! And to date, they have shown little or no willingness to engage constructively with progressive human rights and Immigration experts. I guess that’s what “Miller Lite Justice” is all about!

There is simply no excuse for Garland’s continued mishandling of EOIR and asylum law generally! And, bureaucratic “Dedicated Dockets” run from the Falls Church Tower won’t solve the problem. Not by a long shot!

Progressive advocates and members of the NDPA need to stay energized, stay angry, and keep letting the Biden Administration feel the outrage at Garland’s inexcusable continued mishandling of EOIR! These problems will NEVER be solved with the group currently calling the shots at EOIR!

So, the question remains, with all this expertise available and some obvious solutions to some really dumb and life-threatening procedures and policies, why are Garland and Mayorkas “groping in the dark”  rather than bringing in and empowering the progressive experts who will solve these problems? 

Due Process Forever! Let your continuing outrage at EOIR’s failure to deliver due process and fundamental fairness with efficiency and humanity be heard and felt by the Biden Administration! Don’t take “Good Enough for Government Work” as Equal Justice in America from Democrats or Republicans! “Just say no” to more “Miller Lite Dred Scottification” of asylum seekers and other migrants! Wonder why our nation is struggling with racial justice? Look no further than Garland’s mishandling of EOIR!

President Biden has put Vice President Harris in charge of border issues and racial justice reforms. Progressive advocates should let her know directly that Garland is NOT getting the job done at Justice, and that they are sick and tired of not being consulted and having their expert candidates for EOIR snubbed in favor of Trump holdovers and non-progressives! If her “legacy” includes EOIR’s racially and gender insensitive, due-process denying, intentionally non-diverse “Kangaroo Courts” carrying out the Miller/Sessions/Barr White Nationalist nativist agenda, it won’t be a “good look” for her or her future! And, it most certainly will be bad, perhaps fatal, for our nation’s future as a liberal democracy!

No, real “courts” don’t have this bureaucratic nonsense created specifically to suppress judicial independence and to create political influence on what is supposed to be independent, expert judging. It also fed the nonsensical Barr attempt to pass off Immigration Judges (basically reduced to the status of “deportation clerks on an assembly line” under Trump) as “policy officials” to “bust” their union (NAIJ) and keep it from exposing abuses and fighting for judicial independence from political meddling.

FULL DISCLOSURE: I am a retired member of the NAIJ.

“Real courts” might have “Chief Judges,” basically “first among equals” who handle administrative tasks on behalf of their colleagues in addition to performing daily judicial duties. They DON”T have a plethora of “Chiefs, Deputy Chiefs, Chiefs of Staff, Directors, Deputy Directors, Associate Directors, Assistant Chiefs, Unit Chiefs, Executive Assistants, Office Heads, and “Counsel to” many of the foregoing.

As many of us pointed out to the Biden Transition Team, Garland should have “lost” the “bureaucratic, Vatican-style, hierarchical, wasteful, ineffective, bloated bureaucracy” @ EOIR and replaced it with “leaner, progressive, expert judicial leadership” who would:

  • See that qualified progressive expert judges were appointed on a merit basis; 
  • Replace the BIA with qualified, progressive, “practical scholar” judges to provide uniform legal guidance and enforce due process; 
  • Change the hiring criteria and recruiting practices to encourage diversity and more applicants from the private sector; 
  • Get a functioning e-filing system and other basic professional support for judges and the public in place;
  • Fend off attempts by politicos at the DOJ, DHS, and White House to interfere with judicial independence once qualified progressive judges are in place at EOIR.

If there is any “legal policy” to be made, that’s the job of the BIA, once comprised of practical experts in due process, immigration, and human rights. 

If there are “administrative policies” that need to be instituted to improve due process and efficiency, those should be developed by an “Immigration Judicial Conference” composed of sitting judges, BIA Judges, and perhaps Circuit Court Judges, with meaningful dialogue and input from the private sector and the DHS.

Support functions should be coordinated by a lean, professional “Administrative Office” patterned on the “Administrative Office for U.S. Courts” that serves the Article III Judiciary.

There should also be a transparent system, with public members and judges, to handle ethics and conduct complaints about judges.

Additionally, a training function with some model judicial training should be part of the structure.

There is absolutely no need for all the current ridiculous “quotas, ratings, supervision, policy memos, performance work plans, adjudication centers, and other bureaucratic nonsense” that eat up resources without furthering the mission of guaranteeing fairness and due process for all.

Bureaucrats are incapable of phasing out bureaucracy and replacing it with something better. That’s why every day that Garland dawdles in getting in the progressive talent from outside Government necessary to reform EOIR, ditch the bureaucracy, and turn it into a functioning, progressive, model court system is a “killer” — both figuratively and literally! 

If there is a single “ask” I would have of Judge Garland, it’s for him to stop thinking like the DOJ bureaucrat he once was and start acting like an independent Federal Judge (which he also once was) constructing a completely new progressive court system designed to be the “world’s best!” 

That’s NOT going to happen by mindlessly and wastefully hiring more “insider Attorney Advisors” for a bogus and unnecessary “Office of Policy!”
