Several “quick takes” from Tea’s interview with Senator Gillibrand:

  • She has introduced an “Article I Immigration Court Bill” in the Senate and believes it’s the type of bipartisan initiative that might interest enough GOP legislators to form a “working bipartisan majority.” A similar bill introduced by Rep. ‘Focus on what’s in front of you’

Sitting in the chamber after 15 rounds of votes for speaker that felt like “democracy had been hijacked by a handful of extremists,” Rep. Hillary J. Scholten (D-Mich.) was left “wondering what in the world we had gotten ourselves into with this Congress.” But then she found herself clapping alongside Republicans when McCarthy promised that a GOP majority was committed “to stop wasteful Washington spending” while lowering the price of groceries, gas and housing for families. It’s a similar message to what Scholten ran on in a district where she beat a Trump-endorsed Republican and became the first Democrat in decades to represent her part of western Michigan.

“I campaigned a lot on fiscal responsibility,” she said in an interview. “At the center of fiscal responsibility is making sure that we are keeping our government running. I am looking for no-nonsense partners on the other side, and within my own caucus as well, who are not going to play games with the budget and our deficit.”

Democrats are keeping an open mind about what legislation to tackle with Republicans, knowing that the GOP sets the tone for which bills to pursue on the floor. Democratic leaders have repeatedly said that their caucus will not support legislation proposed by far-right Republicans or policies that are too extreme, like a border security bill by Rep. Chip Roy (R-Tex.) that detractors say would end all asylum claims.

Scholten has spoken with Republicans about immigration reforms and how best to close supply chains so the United States can remain competitive globally without relying on foreign workers to do so. She and [Rep. Jared] Moskowitz [D-FL] both voted in support of establishing a select committee on China, crossing the aisle for the first time with 144 other Democrats.

In a sign of solidarity, Scholten and freshman Republican Rep. John James (Mich.) decided to sit together during their first State of the Union address to “demonstrate the spirit of bipartisanship” that has already helped them begin finding compromise on clean water legislation and to protect a fighter mission at a local Air National Guard base.

“I think it’s so important, especially in these troubling and trying times, to show that even as neighbors right here in the office and states-mates, that more unites us than divides us,” James said.

“We’re ready to get to work,” Scholten said before they high-fived.

As those who know her predicted, Hillary is making her presence felt “right off the bat.” She’s also using her quick grasp of issues, collegiality, and outstanding team building skills that she was known for during her time as an EOIR attorney. Those are important attributes! I might add that they are in short supply at today’s dystopian EOIR, according to sources in the agency as well as those affected by its historically poor, and literally life-threatening,  performance (or lack thereof) over the past two Administrations!

🗽 MAINE DELEGATION RENEWS BIPARTISAN PUSH FOR EARLIER EMPLOYMENT AUTHORIZATION FOR ASYLUM SEEKERS! — Effort Has Little Traction In Congress!

Federal and state lawmakers are renewing efforts to shorten the amount of time asylum seekers must wait before they can work and become self-sufficient.

Local officials in communities such as Portland, a destination for waves of people seeking asylum, have called on federal officials for years to reduce the waiting period for work permits, which is a minimum of six months and often much longer. They argue speeding up the process is a way to address workforce shortages as well as reduce the costs of providing financial assistance to asylum seekers who aren’t allowed to support themselves.

But every effort dating to at least to 2015, when Sen. Angus King of Maine submitted a bill to shorten the wait period to 30 days, has failed to gain traction in Congress because the appeals have been caught up in partisan and regional conflicts over immigration reform and border security.

Republican Sen. Susan Collins and Rep. Chellie Pingree, D-1st District, have proposed similar bills in recent years. And both are doing so again this session, while King, an independent, is signing on as a co-sponsor.

Despite national polarization over the issue, calls for allowing asylum seekers to work and become self-sufficient are widely supported in Maine by Republicans, Democrats and independents. The fact that Maine has more jobs available than there are workers to fill them is a key reason for the broad support.

Even former Gov. Paul LePage, who opposed efforts to help asylum seekers during his eight years in office, revised his position during the gubernatorial campaign last fall, saying at a debate in Portland that “if asylum seekers are here, and (President) Joe Biden is not going to enforce federal law on immigration … I want to put them to work.”

Collins started pushing for the reform in 2019 and announced on Friday that she introduced a bill with Sen. Kyrsten Sinema, an Arizona independent and former Democrat, that would reduce the waiting period from six months to 30 days for asylum seekers who have gone through preliminary screening. And Pingree plans to reintroduce her bill in the House in the coming weeks.

Gosh, when even former GOP right-wing Gov. Paul LePage is on board, seems like it should be a “no-brainer” for Congress. But, that isn’t the way things work (or don’t) on the Hill these days.

As to requesting a “waiver” of the current 180 day statutory “lock out” provision, there currently doesn’t appear to be any process for that. The statute does state that:  “An applicant for asylum is not entitled to employment authorization, but such authorization may be provided under regulation by the Attorney General.”

Therefore, it appears that the Biden Administration could establish a waiver process by regulation if it chose to. I’m not aware of any plans by the Administration to propose such a regulation.

The Administration has addressed immediate work authorization in their recently announced parole program for certain nationals of Venezuela, Nicaragua, Haiti, and Cuba. Individuals approved for this program abroad will be “paroled” into the U.S. for two years with work authorization.

The relief for states like Maine under this parole program is limited, because 1) only nationals of the four specified countries can apply; 2) the program applies prospectively only; 3) it’s uncertain what will happen to parolees after two years (one can imagine that any future GOP Administration would terminate the program, given that GOP politicos are now suing to halt it); and 4) the is no clear path to a green card for these paroled individuals.

To date, the Administration has not “leveraged” other potential legal mechanisms to expedite employment authorization.

One option would be to greatly expand use of the new regulatory authority for USCIS Asylum Officers to grant asylum status to applicants arriving at the border. This would result in immediate admission in an orderly, work-authorized asylum legal status and avoid the current 2.1 million Immigration Court backlog. It also would trigger a statutory process for asylees to apply for green cards after being physically present in the U.S. for one year. Additionally, granting asylum expeditiously at the AO would be available to all asylum applicants, not just those from the four specified nations.

Another option, that could be used in conjunction with the first one, would be to ramp up much more robust and inclusive refugee programs outside the U.S. This could be in the countries in crisis or in third countries. Like asylees, refugees enter the U.S. in a legal status that authorizes them to work immediately. Like asylees, they have access to a statutory provision for obtaining a green card after being physically present in the U.S. for one year. Refugee status is potentially available to refugees from any country where the President finds a “special humanitarian concern” following “consultation” with Congress.

Unfortunately, in my view, the Biden Administration has shown little interest in, nor aptitude for, maximizing the mechanisms available to legally admit refugees, from abroad or as asylum seekers. As pointed out above, doing so also would address the issues in Maine and other states who have welcomed refugees and asylum seekers. 

Instead, the Administration has relied on a mishmash of:

  1. Trump-era, nativist, deterrence policies, many with questionable legal basis;
  2. A series of ever-changing, ad hoc, subjective, discretionary “exceptions” to those policies administered without any transparency or accountability;
  3. An ad hoc, nationality specific, parole program divorced from the statutory “refugee” definition, having a much more tenuous legal basis than using the established refugee and asylum admission provisions now in the INA, and certainly leaving the future fate of those “paroled” thereunder “up in the air” and subject to maximum political gamesmanship.

The sum total is to leave too many refugees and asylees, and the individuals and communities in the U.S. trying to help them, “dangling in the air” without the necessary support and humanitarian leadership from the Administration.

Thanks Craig for speaking truth when so many are spreading false information and advocating trading human rights that aren’t ours to give away for “benefits” that should be conferred on their own merits with no “strings attached.” 

Unhappily, even the normally reliable and sensible Greg Sargent @ WashPost is spouting some of this absolute nonsense! He speaks of indefinitely extending massive violations of legal and human rights (“Title 42”), prisons for asylum seekers (“processing centers”), and expedited dockets (“deportation railroads without due process”) as if they are “OK trade-offs” for so-called “immigration reform.”

Notably, there is nothing now stopping the Administration from processing more refugees outside the U.S., providing grants to innovative organizations like “VIISTA Villanova” for training more qualified pro bono asylum representatives without having to rely exclusively on law schools, replacing poorly qualified Asylum Officers and Immigration Judges with asylum and human rights experts, appointing a new expert BIA qualified to establish affirmative precedents to guide Asylum Officers, IJs, and lawyers on both sides in how to recognize, document, and grant asylum in accordance with the generous intent of the law and the U.N. Convention on which it is based, providing grants to NGOs for systemic resettlement of asylees and applicants away from the border, targeting and prosecuting  human smugglers, and expeditiously removing those arriving at or near the border who can’t establish a “credible fear” of persecution.

That the Administration has failed to bring in the necessary visionary, dynamic, competent leadership to accomplish any of the foregoing, and that  a Dem-controlled Congress has failed in its oversight responsibilities and to push the Administration to fulfill its legal obligations to asylum seekers is a question of competence and will, NOT the fault of asylum seekers and their advocates. Nor is it a basis to reduce the already unfairly and illegally compromised rights of asylum seekers

Craig basically echoes some of the themes I set forth this week in my “Dissenting Opinion!”

I dissent. 

I was outraged when I read in this morning’s Washington Post about the horrible “Sinema/Tillis misnamed immigration compromise” (actually a “sellout”) being negotiated during the lame duck session of Congress. In short, that proposal apparently would trade long overdue protection for “Dreamers” for the rights and lives of refugees and asylum seekers.

Incredibly, in the face of U.S. District Judge Emmet Sullivan’s findings that the intentional illegal use of Title 42 had resulted in countless clear violations of the legal rights of asylum seekers, subjecting them to a litany of horrors and abuses that he described as “dire harm,” these legislators would extend those abuses for an indefinite period! That’s notwithstanding evidence not only of the irreparable harm that Title 42 has caused, but also the rather obvious fact that once we “normalize” those abuses, they will never end. 

There will always be another fabricated reason for extending the Title 42 charade. Indeed, once we start mischaracterizing abuse as “law,” we can’t even call it “abuse” and hold the abusers accountable! That’s all part of the dehumanizing or “Dred Scottification” process! 

Additionally, in the place of a functioning working asylum and refugee system, the proposal would eventually substitute so called “processing centers” and “expedited procedures” to railroad asylum seekers out of the country without due process. And, it wouldn’t address the total dysfunction and denial of due process in our Immigration “Courts” by enacting another long overdue provision:  the “Lofgren Article I Immigration court bill!” What a farce!

Let’s be clear about what’s happening here! The legal and human rights of refugees and asylum seekers are not “ours” to trade away for relief for another deserving group that has long been irrationally denied! “Processing centers” are a euphemism for “immigration prisons” — part of the “New American Gulag.” “Expedited processing” is a euphemism for “railroading.” Both detention and artificially expediting dockets have been proven to be ineffective and unjust, over and over. Yet, here we go again! 

My outrage turned to shock and dismay when I learned that some erstwhile defenders of due process, human rights, and racial justice for asylum seekers (incredibly) thought that this type of immoral compromise was a “good idea!” Not me!

Restrictionist/nativist Dems masquerading as “moderates” are a huge problem. They play right into the GOP’s hands. 

When committing crimes against humanity or giving away refugees’ rights becomes a “strategy,” “option,” or “bargaining chip,” we’re lost as a nation. And, that’s exactly where we’re heading with horrible, immoral proposals like this.

Human rights and due process are non-negotiable! And, I guarantee that extending Title 42, building additional Gulag (rather than making the existing legal asylum and refugee systems work), and railroading asylum seekers will empower smugglers and lead to further growth of our underground population. 

Human migration won’t be stopped by ineffective and immoral “deterrence.” And, although many hate the idea, refugees basically “self-select” and are driven by forces beyond our immediate control. 

Refugees are, by definition, folks who can’t return! So, there is no reason to believe that true refugees (of which there are many) are going to be “deterred.” They might be “incentivized” to seek refuge in particular, relatively safe, places; but, nobody seems interested in a “carrot” approach — even though the “stick approach” has failed and continues to do so!

Look at the folks who continue to die in vessels in the Mediterranean even though they are fully aware that they are unwanted and that the EU will stop at no cruelty to keep them out. 

And, examine the wealth of documentation that folks forced to “remain in Mexico” — and apply under what we know to be a corrupt and inadequate system — are systematically abused and exploited. 

This time, we’re not just “pushing the St. Louis out to sea.” We’re torpedoing her and watching the passengers drown. And Dems are a huge part of the problem!

Other (soon to be former) progressive Democrats might choose to “go along to get along” with heaping additional abuses on largely defenseless refugees and asylum seekers. But, not me! I dissent!

Immigration Reform: Might Past Be Prologue?

It’s been over 30 years since Congress enacted the most recent set of comprehensive immigration reforms: the Immigration Reform and Control Act of 1986 and the Immigration Act of 1990. These bipartisan yet hotly contested bills passed only after a debate spanning five presidential administrations, eight congressional sessions, and painful compromises by all parties. Even then, both bills died on the House floor before being resurrected at the 11th hour.

Can lessons learned during the last round of reform be applied to future debates? Charles Kamasaki, author of “Immigration Reform: The Corpse That Will Not Die” (Mandel Vilar Press, 2019), thinks so. The book provides a history of how the 1980s-era reforms were enacted, along with a summary of developments since then. It concludes with seven lessons that advocates and lawmakers should consider in advancing future immigration reform.

Supposedly, the main political issues right now are the economy and inflation. But, the economy and inflation are largely determined by the Fed, markets, global conditions, weather, and a certain amount of pure luck — all things beyond the direct control of the political branches of the USG.  

As mentioned by Chuck Todd on last Sunday’s NBC “Meet the Press,” many experts say that the most effective tool that the Administration and Congress have to improve the economy without triggering a recession is to increase legal immigration — sooner rather than later. But, neither party is interested. The GOP sees an anti-immigrant stance as a key to political success. And, the Dems are “actively disinterested” in the issue. So, the opportunity passes.

But, the reality is that, in the long run, no amount of shipping containers, walls, prisons, family separations, deportations, exclusions to death or despair, hate rhetoric, or restrictive legal roadblocks will halt the future flow of human migration, and not incidentally, the internal relocation in America as certain areas become “unlivable.” 

According to a government report published in today’s Washington Post:

 The U.S. can expect more forced migration and displacement

Already, the authors of Monday’s report said, major storms such as Hurricane Maria, as well as extended droughts that strained lives and livelihoods, have led people to leave their homes in search of more-stable places.

In the hotter world that lies ahead, they write, additional climate impacts — along with other factors such as the housing market, job trends and pandemics — are expected to increasingly influence migration patterns.

“More severe wildfires in California, sea level rise in Florida, and more frequent flooding in Texas are expected to displace millions of people, while climate-driven economic changes abroad continue to increase the rate of emigration to the United States,” the report finds.

Such shifts are inherently complicated and fraught.

Several Indigenous tribes in coastal regions, facing fast-rising seas, have already sought government help to relocate, but have struggled to do so without significant hurdles.

“Forced migrations and displacements disrupt social networks, decrease housing security, and exacerbate grief, anxiety and mental health outcomes,” the authors write.

Neither political party appears serious about addressing these migration realities — already underway. The ideas that we can wall ourselves off, invest in “sending countries,” detain, and deport our way out of migration are not  “solutions.”  

Failure to act boldly and expansively on legal immigration will create a huge class of exploitable, disenfranchised, extralegal residents and plenty of work for border agents, internal police, righty judges, and jailers. It will also be a huge boon to smugglers and cartels who basically will “own” the American migration franchise. But, in the long run, building a large “underground humanity” won’t be enough to offset the “downside” of lacking a robust, realistic, orderly, legal immigration process.

Eventually, those nation-states that figure out how to harness, welcome, and distribute the power of human migration will rule the future. Right now, America’s leaders, of both parties, seem wedded to a “sure to fail” approach of either opposing or ignoring the realities and unlimited potential of human migration. Too bad — for all of us!

🇺🇸 IN MEMORIAM: HON. ROMANO L. “RON” MAZZOLI (1932 – 2022) — Co-Architect Of Bi-Partisan 1986 Immigration Reform Act

I personally knew Congressman Mazzoli (D-KY), and worked with him and his staff on the Immigration Reform & Control Act of 1986 (“IRCA”), as I did with Senator Alan Simpson (R-WY) and his staff on the Senate side. At that time I was the Deputy General Counsel and later Acting General Counsel of the “Legacy INS.”

Shortly before I left INS for private practice, in 1987, Congressman Mazzoli invited me to his hometown of Louisville to speak on immigration reform. I was presented with a ceramic “Big Balloon,” representing the City of Louisville, to memorialize that occasion.

We kept up for a time after I went into private practice. He was friendly with Harris Miller who worked with me at Fragomen during my stint as DC Managing Partner. Harris, who recently, sadly, died at 71, had worked for Ron and the Democrats on the House Judiciary staff. I remember Harris, his wife Deborah, Ron, his wife Helen, my wife Cathy, and me having dinner at the Occidental Restaurant in DC shortly after he left Congress and just before I left Fragomen to become the BIA Chair in 1995. Ron supported my application. 

At that time, Ron was putting together plans to teach at his alma mater U. of Louisville Law. I believe Harris and I might have offered him some “syllabus pointers,” although, in actuality, he hardly needed any help from us given his decades of experience in Congress. 

Eventually, we lost touch. But I still have fond memories of Ron, Harris, and a time when the immigration debate, although always spirited and contentious, was more civilized and empirically based.

Given our familiarity with the record at this point, we are prompted to note that it is not at all apparent to us how an application of the Frentescu factors to Dor’s case would lead to a particularly-serious-crime determination. For instance, consider again the June 1 incident — the BIA relied on a police officer’s assessment that Dor had a “large amount” of marijuana on him, but this on-the-scene appraisal by an officer is largely irrelevant to an immigration-law-driven determination that a crime is particularly serious pursuant to the guiding statutes, especially when the actual amount (25 grams, a small amount) is available. See Matter of Castro Rodriguez, 25 I. & N. at 703; Moncrieffe, 569 U.S. at 194 n.7. Consider, too, that while the BIA identified the type of sentence imposed as a Frentescu factor but never mentioned (or weighed) Dor’s sentences, we observe that

Dor received lenient sentences with respect to both offenses (a two-year probation and a one-year suspended sentence that never went into effect since Dor completed a violation-free probation period).

As to Dor’s involvement in trafficking as part of the calculus here, based on the amount in question, and again on the face of this record, this characterization seems ambitious. The May 20 offense officers observed Dor sell “20 bucks[‘ worth]” of marijuana to another individual; the June 1 incident revealed Dor had in his possession a digital scale, a large amount of U.S. currency, and 25 grams of marijuana.

Bottom line: The BIA’s particularly-serious-crime conclusion is devoid of any actual application of the Frentescu factors, and even if we considered it a solid application of the law to Dor’s case, we still do not have a sufficiently rational explanation of the BIA’s particularly-serious-crime conclusion as to Dor’s minor marijuana offenses, and a rational explanation is necessary to ensure Dor was appropriately precluded from obtaining the humanitarian relief he seeks.

In sum, the Government has identified no evidence that supports divisibility. The statute, the case law, and the available state court documents all support the opposite conclusion.11 Because Pennsylvania’s stalking statute is indivisible as to intent, we apply the categorical approach. And under the categorical approach, Section 2709.1(a)(1), which sweeps more broadly than its generic counterpart in the INA, is not a categorical match. Vurimindi’s offense of conviction therefore does not qualify as a removable offense.

Interestingly, the BIA’s defective decision in Dor involved improper reliance on police reports. This comes just as a new NIJC report shows how improper reliance by EOIR on police reports means that “racism and inequities in the criminal legal system and policing carry over into the immigration system.” https://default.salsalabs.org/T59538212-844f-4d6d-ade1-0428b5eef400/e9c83407-de3b-4bcf-a318-704cbcd599a2. 

The Dor case also presents a familiarly outrageous characteristic of American immigration policy — still going strong in the era of Biden, Harris, and Garland — “Dred Scottification” — that is systemic injustice — directed at Black Haitian refugees. Indeed, Dor is lucky to be in the “system” at all — no matter how biased and poorly functioning. Following in the footsteps of the overtly racist and xenophobic Trump Administration, under Biden more than 25,000 potential Haitian refugees have been arbitrarily returned under Title 42 with no process at all — not even the “veneer of due process” provided by EOIR! The cases described above have been pending for three and six years, respectively. EOIR presents the worst of both worlds: lengthy delays and backlogs without due process and careful expert consideration of the issues involved. Injustice at a high cost, in more ways than one!

After trips to three levels of our broken immigration justice system, countless hours of legal time, and untold trauma and uncertainty for the individuals subjected to this dysfunctional system, these cases remain far from final resolutions. Now they go back into Garland’s incredible nearly two million case backlog!

Sometimes, the BIA uses this as an opportunity to invent a new “bogus theory of denial.” Other times, the files get lost or reassigned. In other words, they are subject to EOIR’s “specialty:” “Aimless Docket Reshuffling!”

Garland doesn’t lose any sleep over it because: 1) not his life on hold, 2) not his time and money being wasted, and 3) he isn’t paying attention! This is unacceptable public service! Plain and simple! And, there appear to be few, if any, real consequences for anybody except the individuals whose lives and futures are at stake and their (often pro bono) lawyers!

How completely “out of touch” is Garland? He has put bogus, “Mickey Mouse” time limits on new asylum adjudications. Doing incompetent and biased adjudications faster isn’t going to solve the problem. It will actually make backlogs worse and more importantly, increase the number of defective asylum denials — already at beyond unacceptable levels.

You can’t fix a broken system by making it “pedal faster!” Why, after all  these years, Garland doesn’t understand that “fundamental rule of Goverment bureaucracy” is totally beyond me!

The obvious solution: Put emphasis on getting these cases right at the first instance. That means “canning” the “anti-immigrant default and assembly line process” and getting expert IJs willing to rule in favor of individuals where appropriate and a revamped BIA of expert judges willing to issue precedents favorable to individuals and insure that IJs properly follow them. It also means a BIA who will follow precedent even where it doesn’t produce a “DHS Enforcement-friendly result.”  

Additionally, “lose” OIL’s often-dilatory or quasi-frivolous arguments designed to cover up EOIR failures and block justice! (HINT: The Assistant AG, Civil, one of the key sub-cabinet positions at DOJ, and OIL’s “boss,” remains unfilled approaching the halfway point of the Biden Administration.) This system is broken from top to bottom, including the litigation “strategy” that attempts to shield unfair and legally incorrect EOIR decisions from critical substantive review by Article III judges independent from the Executive. 

Yes, Garland recently has “pruned” some of the deadwood at EOIR and brought in a few widely-respected expert “real judges.” That’s some progress.

But, he’s barely scratched the surface of the anti-immigrant culture, “haste makes waste” atmosphere, and shoddy decision making at EOIR and the poorly conceived litigation strategies at OIL! In particular, the dysfunctional DOJ immigration bureaucracy glaringly lacks inspired progressive due-process-committed, human-rights-focused, racial-justice-sensitive leadership willing to stand up for individual rights against Government overreach and abuses!

Of course, the “real” solution is to get the Immigration Courts out of DOJ and into an independent Article I structure. But, unfortunately, that isn’t going to happen tomorrow.

In the meantime, there is plenty that Garland could be doing to improve due process and professionalism and to “pave the way” for the eventual transition to Article I. The more dysfunctional Garland makes his system the more difficult and rocky that transition will be.

Garland isn’t getting the job done! Everyone who cares about the future of our nation and the rule of law should be asking why and demanding better from Garland and his “asleep at the switch” lieutenants!

High-powered lawyers like Courtney Saleski, National Co-Chair of DLA’s White Collar Practice, who successfully litigated Vurimindi in the 3rd Circuit have some “juice.”  They need to team up with the ABA, FBA, AILA, ACLU, Human Rights First, NIJC, the NAACP, Catholic Conference, HIAS, and other human rights and civil rights groups and “camp on Garland’s doorstep” until he “pulls the plug” on his dysfunctional, unprofessional EOIR and brings in due-process-focused competence! How many resources and human lives can our nation afford to waste on Garland’s EOIR disgrace?

The entire team at Kids In Need of Defense is devastated by the news that at least 46 people were found dead in an abandoned tractor-trailer in Texas and more than a dozen others in the truck, including children, were taken to local hospitals for treatment. While we wait for more details to emerge, we wanted to share the following statement from our President, Wendy Young.

 

“As rising violence, natural disasters, and other threats force migrants to make impossible choices in their quest to find safety, our nation’s response cannot be to place families and children in further harm by indefinitely closing our borders to people seeking protection and ignoring the dangers they face in their home countries. This most recent tragedy and the disturbing rise in migrant deaths globally underscore the need to create safer pathways to protection for refugees. The Biden Administration should see this heartbreaking tragedy for what it is, a clarion call to abandon deeply flawed and dangerous immigration policies. It must reinstate humane and orderly processing, including reopening official ports of entry, hiring child welfare experts to care for and screen children, and provide fair adjudication of protection claims. It is time for the United States to regain its footing as a leader in the protection of migrant families and children.”

The key part of Wendy’s statement: “including reopening official ports of entry, hiring child welfare experts to care for and screen children, and provide fair adjudication of protection claims.” 

Denial rates for recent arrivals who manage to get hearings (see, e.g., Garland’s bogus “dedicated dockets,” — actually “dedicated to denial” and nothing else), many of them children and unrepresented, hover around 100%. They are “guided” by a “largely holdover,” anti-asylum BIA that lacks true asylum expertise and issues no positive precedents instructing judges on how to consistently and legally grant asylum. Consequently, there is no “fair adjudication” of asylum claims. That feeds the toxic nativist myth that nobody at the Southern Border is a “legitimate” asylum seeker. 

Unless and until Garland tosses the unqualified jurists at EOIR and replaces them with experts committed to due process, fundamental fairness, and correct, generous, practical precedents and proper applications of asylum law, the system will remain in failure. It’s a monumental mistake by the Biden Administration not to fix that which they absolutely control — starting with the Immigration Courts at EOIR.  

Refugees will continue to die at the hands of smugglers who were given control of our immigration system by the Trump Administration and remain empowered by Garland’s & Mayorkas’s  poor performance combined with biased, White Nationalist, Federal Judges appointed by Trump at all levels of our failing justice system!  

Today’s WashPost editorial described how far-right nativists have basically turned our immigration system over to smugglers:

The absence of any workable legal system that would admit migrants systematically, in numbers that would meet the U.S. labor market’s demand, is the original sin of the chaos at the border. That is Congress’s bipartisan failure, a symptom of systemic paralysis for many years. More recently, a public health rule has had the effect of incentivizing unauthorized migrants to make multiple attempts to cross the border. The rule, imposed by the Trump administration, retained for more than a year by the Biden administration, and now frozen in place by Republican judges, allows border authorities to swiftly expel migrants, but with no asylum hearings or criminal consequences for repeated attempts to cross the border. That has been a boon to migrant smuggling networks.

I take issue with the term “bipartisan failure” in the legislative context. It’s true that the Dems inexplicably squandered a golden chance to fix many immigration problems when they had 60 votes in the Senate in Obama’s first two years. But, before and after that time, the failure to achieve realistic, humane, robust legal immigration reform legislation has been on the nativist right of the GOP that now dominates the party. Pretending otherwise is useless and dishonest.

Democrats have made numerous reasonable legislative proposals to bring Dreamers and other long-term productive residents of America out of the underground and into the legal mainstream of our society. All of these proposals would have made long-overdue, common sense reforms to eliminate hopeless backlogs, benefit our economy, strengthen our legal system, and facilitate better allocation of Government resources. Yet, there has been scant GOP interest in improving the system. The GOP appears to believe that promoting a dysfunctional immigration system, denying human rights, and guaranteeing a large “extralegal population” available as scapegoats and exploitable labor best serves their parochial political interests.

Senators say they’re interested in bipartisan immigration plan; here are some suggestions

Sens. Thom Tillis (R-N.C.) and Dick Durbin (D-Ill.) plan to bring together a group of senators interested in trying to revive immigration discussions after the April recess. They “want to sit at a table and ask members who have immigration, bipartisan immigration bills, to come and propose those bills to us and see if we can build a 60-vote plus margin for a group of bills.”

 

Are they serious about immigration reform, or are they just doing this so they will be able to say in the upcoming midterm elections that they sponsored a number of immigration reform bills?

 

It won’t take much effort to repackage bills that have already been introduced.

 

In any case, they seem at least to be open to a variety of approaches to immigration reform, so I will take this opportunity to offer them a few suggestions.

 

Registry — The Democrats tried to include a registry provision update in a reconciliation bill in September 2021, but the Senate parliamentarian made them remove it. That was unfortunate. The registry provision has not been updated since 1986.

 

The registry provision grants lawful permanent resident status to certain undocumented immigrants who have resided continuously in the United States since before Jan. 1, 1972. This means that registry currently is available only to undocumented immigrants who have lived here continuously for half a century, which greatly reduces the value of the provision.

 

The Democrats went too far in the other direction with the update they put in the reconciliation bill. It would have changed this date to Jan. 1, 2011, which would make legalization available to approximately 6.7 million undocumented immigrants.

 

At some point, an undocumented immigrant has been here so long that it would be unconscionable to make him leave. It’s just a matter of reaching an agreement on when that point has been reached.

 

I encourage the senators to include the registry provision in their bipartisan discussion to see if there is a date that would be acceptable to both parties.

Nolan doesn’t claim that enactment of these provisions would “solve all problems” — an ambitious task. But, the package would be a very significant improvement, building on legal and administrative mechanisms that have been successful in the past. 

Here are some major things that could be accomplished:

  • Dramatically cutting into the unmanageable backlogs at both USCIS and EOIR in a way that should actually be “self-funding” and relatively free of litigation;
  • Reducing pressure on the border without the type of “gimmicks” that have proved unsuccessful in the past and giving individuals the ability to  apply and get an answer without making the journey to the border;
  • Combatting employer exploitation of undocumented workers and maintaining an adequate wage scale for all American workers;
  • Increasing the pool of legally authorized employment (including employment in “essential occupations”) at a time when it is badly needed; and, incidentally,
  • Substantially increasing tax revenues. 

It would be great to believe that folks on the Hill and in the Administration are actively thinking about such timely, achievable, practical solutions to ongoing problems.

Thank you for inviting me this afternoon. I’m honored to be here. Beyond that, I wish to congratulate and thank Neela Nesari and the rest of you for your courage, dedication, and humanity in standing up and speaking out for social justice in America. 

Of course, I will start out by giving you my “standard comprehensive disclaimer.” What I’m about to tell you represents solely my views and not the views or opinions of any individual, institution, organization, or group with which I am associated, have been associated in the past, or might associate with in the future! 

My time on the stage is winding down. But yours, my friends, is just beginning. You are the ones who control your destinies and must decide what kind of world you want to live in and what you want to leave behind for the next generations. 

Relief for families granted cancellation of removal is a “just cause” that should be a “no-brainer” in a fair, well-functioning, human-values-based society. That neither such badly-needed specific remedial changes nor long overdue “big picture” reforms to fix our broken and dysfunctional Immigration Courts, restore fairness and functionality to our shattered refugee and asylum programs, and make our legal immigration system robust, realistic, workable, and serving the national interest says something about our current national mood and our political leadership that should be quite concerning to you as the upcoming generation!   

My friends, both our Immigration Courts and our democratic republic are in a grave existential crisis. There are powerful and well-organized forces with a very dark, exclusive, intolerant, sometimes belligerent vision of America’s future: one that reverses generations of human progress and knowledge and actively promotes intolerance, misinformation, dehumanization, and deconstruction of our democratic institutions and fundamental human values. 

They actively promote an intentionally “whitewashed” version of American history: One that denies the ingenuity, creativity, and forced labor of generations of African Americans who literally built our country!  It disregards the courage, tenacity, skill, and strength of Asian Americans who built our Transcontinental Railroad and literally brought our nation together. And, of course, it dismisses the legions of Hispanic Americans who have been “making America great” since before “America was America,” with their culture, hard work, determination, and commitment to the “real” American dream, not the “whitewashed” version. It basically devalues the essential contributions of almost all non-Western-European immigrants! 

The future envisioned by these dark forces “x’es out” many, probably the majority, of you in this room. It says that their so-called individual rights to do as they please outweigh the common interests of society and humanity as a whole. Yet, few seem willing to challenge them and stand up for the rights and human dignity of  “the others” which are being demeaned, devalued, and, in some cases, erased. Don’t let their darkness, willful ignorance, and often threatening demeanor be your future and that of generations to come. 

Look around you here at the real history and the real America represented by this audience. The future is yours! Don’t let the forces of darkness and a “past that never was” deny your destiny!

Now is the time to take a stand for Due Process, fundamental fairness, human rights, human dignity, social justice, and human decency! Become the “next generation leaders” of the New Due Process Army and fight to make equal justice under law and the constitutional and human rights of everyone a reality rather than an unfulfilled promise! Due process forever!

What is CLAW?

CLAW is a campaign initiated by teenager and immigration activist, Neela Nesari. The campaign aims to bring about a change to increase the 4000 limitation cap on 240A cancellation cases.

Neela is initiating an awareness month about this issue in March of 2022 and needs your help. The goal is to educate, organize and advocate for legislative changes to the immigration system with respect to the defense of cancellation of removal.
