October 1, 2023

Saturday, at the 12th hour, GOP Speaker Kevin McCarthy (D-CA) finally did the obvious — reached out to Dems to save America from insurrectionist, anti-American GOP extremists by passing a last-minute continuing resolution that will fund American government until Nov. 17.

All Dems except one (who was protesting the GOP’s pro-Putin defunding of Ukraine aid) voted for the House bill, while 90 GOP insurrectionists voted to tank America and manufacture a needless crisis. The bill passed the nominally Dem-controlled Senate in about 30 seconds, and was signed by President Biden before midnight. The message about which party is serious about governing for the common good is obvious to all real patriots, even if a shocking number of GOP voters have foisted these far-right GOP clowns upon the rest of us.

The mainstream media uses the namby-pamby misnomer “border security,” to refer to the GOP’s proposed racist-nativist attack on immigration, destruction of the long-established right to asylum, and bogus attempts to reinstate “proven to fail,” draconian deterrence measures. As happened when tried unsuccessfully in the past, the GOP would turn over control of border migration policies to cartels, smugglers, and organized crime, while deflecting attention and undermining law enforcement efforts to control human and drug smuggling.

A true accounting for the GOP extremist agenda would clearly show how firmly on the side of Putin and border bandits today’s dangerous, “destroy America” GOP has become. Too bad the so-called “mainstream media” has so little interest in digging beyond the cosmetics on the border issues and Ukraine aid.

The mainstream media is also salivating about the bogus prospect of MAGA-maniac Matt Gaetz (R-Outer Space) unseating McCarthy. The fact that Gaetz is an extremist idiot who has nobody to replace McCarthy with doesn’t seem to have dawned on the “mainstreamers.” (“Matt Gaetz’s Motto is, ‘I’m an Asshole, What are You Going to Do About It?’” https://www.google.com/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwjnkLH8h9WBAxXPkYkEHcr5CdoQFnoECBIQAQ&url=https://buzzflash.com/articles/matt-gaetz&usg=AOvVaw2XoHad3KzJeQitggMsTve3&opi=89978449).

In perhaps the ultimate example of clueless, Fox News inspired, “mainstream journalism,” CBS’s “This Sunday” saw fit to inflict Gaetz and his bombastic nonsense on hapless viewers today. NBC, on the other hand, maybe still smarting from new-host Kristen Welker’s disastrous, totally uncalled for, “inaugural” interview with a raving, incoherent, lie-spouting Trump, gave us wall-to-wall coverage of the Ryder Cup in place of “Meet the Press.” Honestly!

Look forward to more clownish theatrics and anti-American posturing from the GOP and their “Chief Clown” Trump, and more insipid reporting from the mainstreamers as America careens toward another likely GOP-generated “crisis” in mid-November. It’s NOT a “Washington problem! It’s purely a GOP that lacks any interest whatsoever in responsible governing.

Multiple House Democrats have expressed anger and frustration over President Biden’s decision to sign a resolution ending a Washington, D.C., crime bill, after they were led to believe he would veto the resolution and protect the bill.

According to The Hill, some of these Democratic Party lawmakers are so outraged over Biden’s decision that they’ve resorted to blasting the White House in expletive-laden epithets. One told the outlet that this is “F—ING AMATEUR HOUR.”

The same lawmaker claimed that the White House “f—ed this up royally.” Others said Biden’s decision was “disappointing.”

🇺🇸COURTSIDE POLITICS: REP. HILLARY SCHOLTEN (D-MI) IS PART OF A BIPARTISAN GROUP OF NEW HOUSE MEMBERS REACHING ACROSS THE AISLE IN AN ATTEMPT TO GOVERN FOR THE PUBLIC GOOD — WashPost

‘Focus on what’s in front of you’

Sitting in the chamber after 15 rounds of votes for speaker that felt like “democracy had been hijacked by a handful of extremists,” Rep. Hillary J. Scholten (D-Mich.) was left “wondering what in the world we had gotten ourselves into with this Congress.” But then she found herself clapping alongside Republicans when McCarthy promised that a GOP majority was committed “to stop wasteful Washington spending” while lowering the price of groceries, gas and housing for families. It’s a similar message to what Scholten ran on in a district where she beat a Trump-endorsed Republican and became the first Democrat in decades to represent her part of western Michigan.

“I campaigned a lot on fiscal responsibility,” she said in an interview. “At the center of fiscal responsibility is making sure that we are keeping our government running. I am looking for no-nonsense partners on the other side, and within my own caucus as well, who are not going to play games with the budget and our deficit.”

. . . .

Democrats are keeping an open mind about what legislation to tackle with Republicans, knowing that the GOP sets the tone for which bills to pursue on the floor. Democratic leaders have repeatedly said that their caucus will not support legislation proposed by far-right Republicans or policies that are too extreme, like a border security bill by Rep. Chip Roy (R-Tex.) that detractors say would end all asylum claims.

Scholten has spoken with Republicans about immigration reforms and how best to close supply chains so the United States can remain competitive globally without relying on foreign workers to do so. She and [Rep. Jared] Moskowitz [D-FL] both voted in support of establishing a select committee on China, crossing the aisle for the first time with 144 other Democrats.

In a sign of solidarity, Scholten and freshman Republican Rep. John James (Mich.) decided to sit together during their first State of the Union address to “demonstrate the spirit of bipartisanship” that has already helped them begin finding compromise on clean water legislation and to protect a fighter mission at a local Air National Guard base.

“I think it’s so important, especially in these troubling and trying times, to show that even as neighbors right here in the office and states-mates, that more unites us than divides us,” James said.

“We’re ready to get to work,” Scholten said before they high-fived.

As those who know her predicted, Hillary is making her presence felt “right off the bat.” She’s also using her quick grasp of issues, collegiality, and outstanding team building skills that she was known for during her time as an EOIR attorney. Those are important attributes! I might add that they are in short supply at today’s dystopian EOIR, according to sources in the agency as well as those affected by its historically poor, and literally life-threatening,  performance (or lack thereof) over the past two Administrations!

. . . .

During her victory remarks on Tuesday night, Spanberger spoke of her “deep and abiding love for the country” and a “profound sense of responsibility.” The former CIA agent reiterated that the country was founded on “a dream” that it need not bound by the past or be ruled by kings and queens. Quoting Benjamin Franklin’s admonition that the constitutional convention delivered a republic “if you can keep it,” she declared, “We must all work hard to keep it.”

As a moderate, Spanberger has managed to balance fidelity to Democratic causes such as investment in green energy and the preservation of abortion rights with an independent, reform-minded streak that sometimes put her at odds with party leadership. (Speaker Nancy Pelosi, for example, has not allowed a floor vote on Spanberger’s bill that would ban House members and their spouses from holding individual stocks.)

With this win, Spanberger reaffirms her status as a rising star in the party. Her formula — bipartisan problem solving, strong national security credentials, anti-corruption crusading and support for women’s reproductive rights — has proved successful. But she also had another advantage: a Democratic record of legislative success, including the infrastructure bill, the Chips and Science Act, an expansion of veterans’ health care and measures to reduce prescription drug prices.

Here’s what Hillary had to say in her victory statement:

It’s a new day in West Michigan. I have officially been elected to represent West Michigan in Congress.

Make no mistake: this is a historic victory. We flipped a crucial House seat from red to blue, elected West Michigan’s first-ever Democratic Congresswoman, and sent a strong message that will not tolerate anti-democratic, anti-American extremism here.

I am a proud fourth-generation West Michigander. I know we’re a community that values service over self, building up over tearing down, and unity over division. We’re a community that cares for its poor, supports its vulnerable, and welcomes the stranger. A community where differences are not feared, but valued.

My promise to you is that I will never forget where I come from or who I work for. I will always show up for my community and look forward to getting to work serving West Michiganders.

Forever thankful,
Hillary

By sharp contrast, the GOP has no known values: divide, bully, lie, demean, hate, misinform, blame, deny, discriminate, humiliate, oppress, smear, shame. Those aren’t values: just highly negative attributes!

The GOP did claim concern about inflation and the economy. But, they offered no coherent plan for addressing it in any practical, bi-partisan manner.

Instead, they promised to wreck Government, mindlessly oppose anything Biden proposes, and even threatened to collapse the worldwide economy by “playing chicken” with the artificially-created “debt ceiling.”

To the extent that any GOP candidate could explain their economic “plan” (most couldn’t or wouldn’t), it was a muddled variation of proven-to-fail “trickle down economics.” Yup, the same nonsense and bureaucratic doublespeak that has destroyed the British economy and led the Conservatives to be a laughingstock of “unstable government by clowns🤡!” Basically slash programs that benefit everybody to reward fat-cats with more un-needed and unfunded tax breaks.

Do we really need to make guys like Musk, Zuckerberg, Bezos, McConnell, and the “geniuses” who invented “cryptocurrency” richer? Make sense? Of course not! I doubt that there is a shortage of “investment capital” in the U.S. right now.

Is preventing IRS from processing returns in a timely manner and collecting back-taxes owed really the key to reducing budget deficits? Preposterous! Yet GOP pols say so!

Undoubtedly, we need prudence, responsibility, and focus in government spending — from both parties. As working mothers, Abigail and Hillary know a thing or two about making responsible fiscal decisions and insuring that their constituents get the most bang for each hard-earned tax dollar spent. And neither is afraid to speak out against “fraud, waste, and abuse” in any and all forms!

As former Federal civil servants, they recognize the need for cutting waste and getting more value for each dollar. In that respect, I think that requiring competent management, accountability, expertise, innovative customer service, and focused enforcement in the hugely expensive yet highly wasteful, ineffective, and often counterproductive immigration bureaucracy would be a good starting point for achieving much more without drastic resource increases.

It doesn’t hurt that Abigail and Hillary are really really smart and use their brains to help others and society rather than for self-aggrandizement or to lord it over others. Tough as they are, they are also nice, kind, and compassionate. In other words, non-ideologues.

Go, Abigail and Hillary! Make America the best that we can be: A diverse society and powerful nation where everyone can reach their full potential, independence, and self-sufficiency, not just the “chosen few!”

Hillary Scholten defeats Trump-backed John Gibbs for West Michigan congressional seat

Hillary Scholten (D) and John Gibbs (R) face off for Michigan 3rd Congressional District seat

GRAND RAPIDS, MI — Hillary Scholten will become the first Democrat to represent Grand Rapids in Congress since 1977 after defeating Trump-backed Republican John Gibbs in a race that’s drawn national attention.

Scholten, an immigration attorney from Grand Rapids who worked in the U.S. Department of Justice during the Obama administration, defeated Gibbs 53% to 44%, according to unofficial results from the Associated Press.

The AP called the race for Scholten just before 2 a.m. Wednesday morning, with 63% of votes counted.

Scholten campaigned as a common-sense, problem-solving candidate who supports abortion rights, lowering the cost of health care and prescription drugs, and protecting Social Security and Medicare. Scholten cast Gibbs as an extreme candidate focused overturning the 2020 election results and “doing Donald Trump’s bidding on West Michigan.”

Scholten could not immediately be reached for comment early on Wednesday, Nov. 9. Her campaign spokesperson, Larkin Parker, said Scholten would be live-streaming a speech this morning.

Gibbs took to Twitter after AP called the race, saying “we believe this call is premature.”

“There are plenty more votes outstanding and we expect the vote count to go well into Wednesday,” said Gibbs, who grew up in Lansing and served in the U.S. Department of Housing and Urban Development during Trump’s presidency.

The last time a Democrat was elected to represent Grand Rapids in Congress was 1974. Attorney Richard Vander Veen was elected that year, in what was then the 5th Congressional District. He replaced U.S. Rep. Gerald Ford, who resigned from the seat to become vice president during Richard Nixon’s second term.

. . . .

After the polls closed Tuesday, Scholten spoke to supporters at Paddock Place, a restaurant and event venue in Grand Rapids. She described her campaign as a unifying effort to draw in voters from both sides of the political spectrum, as opposed to the “divisiveness” of her opponent’s campaign.

“This campaign has, and continues to build, something new here in West Michigan,” Scholten said. “A new political home for people on the right, the left, the center, who are tired of politics as usual, who are ready to cast aside the old frame of division, ‘us versus them,’ and join hands together for a better, brighter West Michigan for all of us.”

. . . .

Hillary has always been a widely respected “bridge builder.” She’s intellectually powerful, value-driven, dynamic, “tough as nails,” yet always kind and compassionate!

To my knowledge, she’s the first NDPA stalwart and first BIA employee to be elected to Congress. I hope she inspires others who share her values to enter the political arena and help those of us who believe in rational, practical, people and values-centered government and equal justice for all to save America from extremist ideologues!

🇺🇸 Congrats again and Due Process Forever! Practical, human values, and the courage to stand-up for them against lies and tyranny CAN win elections!

John Gibbs, Hillary Scholten Michigan race pursues the middle – The Washington Post

By Marianna Sotomayor

. . . .

Republicans argue that economic woes in an area that has traditionally valued fiscal conservatism will make it possible for Gibbs to keep the district under GOP control.

Democrats have in turn rallied around their candidate, Hillary Scholten, who lost to Meijer in the 2020 general election. They counter that Gibbs’s embrace of Trump, his previous criticism of women’s right to vote and other inflammatory statements are incompatible with a race that requires that a candidate appeal to the district’s growing middle.

The district’s new lines — encompassing more suburban parts of Grand Rapids, as well as the lakeshore cities of Muskegon and Grand Haven — have Democrats confident they can close the six-point gap that marked Scholten’s previous loss to Meijer. Republicans also acknowledged that possibility, with several strategists who spoke on the condition of anonymity to discuss private deliberations noting that Meijer’s moderate bona fides made him the most likely GOP candidate to keep the seat.

. . . .

PolitiFact has rated as false the claims that Scholten “dismissed” the destruction that rioters caused during the George Floyd protests. At the time, Scholten put out a statement encouraging people to “continue to speak out for George and all victims of violence” but pleaded “with those who take to the streets to make that effort peaceful and to not resort to violence and destruction.”

Scholten jokes that the Republican ads have earned her a new nickname at home from her two young sons: “Agent of Chaos.”

As a fourth-generation West Michigander and deacon in her Dutch Reformed Church, Scholten says she is confident that her reputation will usurp what she describes as “baseless attacks by someone that has no connection” to the district. (Gibbs recently moved to Grand Rapids, but he was born and raised in Lansing, the state capital.)

“I think it’s almost having a boomerang effect, where people see that attack against someone like me that has such deep connection and respect in our community, and it reflects more negatively on the person that is insulting them,” she said.

“You weren’t here then,” Scholten said in response to claims by Gibbs and the GOP about the protests. “You don’t know.”

In an effort to attract the middle, Scholten also has been critical of her party, especially on fiscal issues.

“We’re doing everything to cope with rising prices, but Washington doesn’t seem to be doing anything at all,” she says in her most recent ad. “Democrats, stop the spending. And Republicans, stop putting politics before people.”

Scholten also is trying to highlight differences with her opponent on abortion rights. Voters in November will decide whether to protect reproductive freedom in the Michigan Constitution or adopt a 1931 law that bans abortions except if the mother’s life is threatened and criminalizes the person who performs the procedure.

A recent CNN poll showed 54 percent of Michigan’s registered voters support the amendment that would enshrine protections for reproductive freedom.

Scholten pushed back against Gibbs’s characterization that she is in favor of abortions until birth, noting that she is “not pro-abortion” while speaking about it in personal terms. At 13 weeks pregnant, Scholten was offered an abortion by a doctor after a diagnosis of Turner syndrome. She and her husband “chose life,” Scholten said, but the fetus had died by Scholten’s 19-week appointment.

Gibbs has said he would support a 15-week federal ban on abortion, saying it is a “position based on common sense” because most European countries have more conservative laws limiting abortion. That is a slightly more moderate position than he espoused before the primary, where he downplayed the need for exceptions because, he said, medicine was sufficiently advanced to save the life of the mother. He told The Detroit News, “There are many great Americans all around the country who were actually conceived from rape, and they’re doing great things.

. . . .

For voters like Killion, Gibbs’s apparent attempt to distance himself from Trump may not be persuasive. He says that touting the connection to Trump “throws up an alarm” since he believes many in the Republican Party have put “blinders on” and follow only the former president.

“At the end of the day, I don’t care about who endorses you. I want to know what you plan on doing,” he said.

These days, running for office on a platform of real family values, practical problem solving, fiscal responsibility, common sense, individual freedom, and human decency is an act of great courage. Obviously, Hillary has had to “take the cheap shots and low blows” from her opposition. Also, she was “caught in the middle” on the very dubious political “strategy” of the national Democratic Party to promote the far-right Gibbs over the more moderate Congressman Peter Meijer (D-MI), who bested Hillary in the “pre-redistricting” 2020 race and who was one of the few GOP Reps voting to impeach Trump.

The folks in Michigan-3 can be confident that in casting a vote for Hillary they will get a responsible, non-ideological, approachable Representative who understands the community and is laser-focused on solving their problems and addressing their concerns. She exudes integrity and humanity. She knows what it is like to raise a family while working full-time on demanding and sometimes emotionally draining jobs. Hillary is smart, informed, courageous, a great team member, and someone who will work cooperatively with anybody to get the job done for her district and for America. She is just what we need in Washington right now.

I hear lots of talk about “what it will take to get America back on track!” Electing Hillary Scholten won’t solve all of our nation’s problems, but it would be a fantastic start that will pay dividends for many year to come!

Go Hillary!

GRAND RAPIDS, Mich. — Hillary Scholten, a 40-year-old Democratic congressional hopeful, only had to knock on a handful of doors last Saturday in a residential neighborhood here before she encountered Maria D’Angelo, who was sitting on her front porch, about to have coffee with her neighbor, Sara VanderArk.

Both women in the historically conservative but now Democratic-leaning district are overwhelmingly focused on a single issue this November: women’s rights.

“I’ve had to voice publicly and to family members that I never intended to tell that I’ve had abortions,” D’Angelo, a Democrat, told the Globe about the fallout from the Supreme Court’s June decision to overturn Roe v. Wade. VanderArk, who identifies as an independent, said she was inspired by the court ruling to join abortion rights protests and that her vote would largely hinge on the issue in the fall.

They are exactly the type of galvanized voters that Democratic candidates up and down the ballot in Michigan and across the country are hoping will give them a boost in the November midterm elections. Midterm years are historically bad news for the president’s party even without high inflation and sagging presidential approval ratings, but Democrats now are nursing a sliver of hope: They’re narrowing the enthusiasm gap — the motivation level of voters — and popular opinion on the issue of abortion is on their side.

That’s especially true in Michigan, a battleground state where, like Kansas before it, there has been a surge in the number of women who’ve registered to vote since Roe v. Wade was overturned in June after almost 50 years as settled precedent, according to an analysis by TargetSmart, a Democratic data firm. A recent poll commissioned by AARP, the interest group for older Americans, showed the issue was among voters’ top concerns. And Michigan’s new third congressional district, where Scholten is running, is a rare congressional race where Democrats aren’t just having to focus on defending their turf, they feel bullish about their odds of flipping the seat.

“The level of engagement on this issue is just so high,” Scholten told the Globe in an interview at her campaign office last weekend. “It’s the only thing I hear about. Women stop me in the grocery store and grab my arms and are like, please do something about this.”

Scholten, an attorney and former Department of Justice official, said she saw a surge of volunteers, fund-raising, and willingness of voters to answer doors and talk to her after the Dobbs decision.

This may sound strange in a district that has historically voted Republican. Its congressman is Republican Peter Meijer, a scion of a Midwest grocery store dynasty, and its voters have backed Republicans in the last three presidential elections. But the district’s newly drawn boundaries that are in place for the first time this election cycle make it significantly friendlier to Democrats. Since Meijer, who was one of just 10 House Republicans to vote to impeach former President Trump, lost his primary to his more right-wing and anti-abortion opponent John Gibbs, Democrats hope to motivate the more Democratic-leaning voters in Grand Rapids and its suburbs who are now part of the district and are mad as hell about the abortion rights repeal.

“Everywhere around the state, when we knock on doors, people bring up abortion — it’s not a negative anywhere,” said Michigan state Senator Winnie Brinks. “People used to be pro-choice, but they were quiet about it. Now they’re not quiet about it. They’re like, ‘Nope, this is on the line, we’re gonna talk about it.’”

That was clear in interviews with voters in downtown Grand Rapids for the city’s “3rd Thursdays,” where residents congregate for live music and can go into the city’s art museum for free courtesy of the Meijer Foundation. It was clear in interviews on the other end of the district on the shore of Lake Michigan, where voters strolled watching the sun set over the lake on a Friday night. And it was clear in the views expressed by voters Scholten met knocking on doors.

“I will for sure be there to vote,” said Erica Kochaney, a Democrat and Grand Rapids resident who was at Grand Haven State Park on Friday evening. Reproductive freedom “is my number one reason for getting out there for sure.”

On the Scholten-Gibbs race and the issue of abortion, she added, “I know where she stands on it, and I’m fine, and I feel like I know where he stands on it, and I’m not fine with it.”

A “home grown daughter” of her Michigan District, Hillary is an experienced, resilient, courageous, values-based problem solver committed to making Government work for the common good rather than infringing on individual liberties, invading bedrooms and doctors’ offices, banning books, interfering with elections, and “dumbing down” education.

She is also a highly successful working parent who knows that the same teamwork, caring, creativity, and unselfishness that goes into the challenges of raising a family also can apply on a larger scale to American society. She knows that problems like inflation, infrastructure, climate change, health, safety, and education affect all Americans, regardless of party affiliation.

As a DOJ attorney working in one of the most fractured areas of American law and public policy, Hillary has seen first hand what works and what doesn’t work in today’s Government. She knows that “same old, same old” won’t get the job done for 21st Century America! She seeks a better America — for all Americans, regardless of race, color, creed, gender, or status.

Several weeks ago I wrote about under-appreciated American “good government hero” Frances Perkins, our first female cabinet secretary, appointed by FDR.  https://immigrationcourtside.com/2022/08/14/%e2%9a%96%ef%b8%8f%f0%9f%97%bd%f0%9f%a6%b8%f0%9f%8f%bb%e2%99%80%ef%b8%8f%f0%9f%8e%96-a-true-american-hero-gets-her-due-frances-perkins-was-the-mother-of-americas-safety-net/

Frances Perkins
Hillary Scholten is following in the footsteps of another “Good Government Trailblazer,” Frances Perkins (1880-1965)
U.S. Secretary of Labor (1933-45)
PHOTO: Public realm

Perkins was driven by her life experiences and values, yet courageously and effectively “worked the system” (then basically an “Old Boys’ Club”) to achieve successes and innovations that have shaped our nation for generations (Social Security is just one of her achievements). Hillary Scholten embodies qualities that made Perkins a successful leader who made life better for all Americans!

No one legislator can do it all. But if anyone can bring fact-based legislating, the hopes, fears, and positive values of people in the heartland, and informed debate to our national legislative process, it’s Hillary and other “practical problem solvers” like her! Values, progress, innovation, and humanity over political expediency — that’s Hillary! She is a good listener and team-builder — willing and able to find common ground with those who might not share all her views.

I know Hillary as an unusual combination of intellectual and moral toughness with kindness, compassion, humanity, and common sense. She’s one of the nicest people you’d ever want to meet — makes you want to be on her team! She gets things done by inspiring others, not by threatening , demeaning, or excluding them!

The good folks of Mich 3 have a chance to do something really great — for their own district and for the future of America — by sending Hillary to Washington! We need you, Hillary, now more than ever!

🗽IMMIGRATIONPROF BLOG: FIVE THINGS OMITTED FROM BIDEN’S IMMIGRATION BILL: A Long-Overdue Independent Immigration Court Is One!

https://lawprofessors.typepad.com/immigration/2021/02/the-five-biggest-omissions-in-massive-biden-immigration-bill.html

Dean Kevin Johnson writes:

The provisions of the U.S. Citizenship Act is getting lots of attention, from the change in alien terminology to a path to legalization for undocumented immigrants and more.  Anna Giaritelli for the Washington Examiner, a self-declared conservative publication, notes five things that the Biden administration’s comprehensive immigration reform bill does not address.  Some of the omissions might bother readers; some might not:

1.    Family and children detention protocols:  The bill does not incorporate the Flores settlement governing the detention of immigrant minors.  The Trump administration tried but failed to abrogate the settlement.

2.    Border wall infrastructure:  No surprise.  The U.S./Mexico border wall, which President Trump championed, is not part of the bill’s enforcement plans.  The Biden administration already had made it clear that construction of the wall was not a priority of his administration.

3.    Decriminalization of illegal entry into the United States:  This was an issue in the 2020 Democratic presidential primaries.  Representative Julian Castro called for the repeal 8 U.S.C. § 1325, which criminalizes unlawful entry into the country.

4.    Immigration courts: The immigration bill calls for an additional 220 immigration judges but fails to make major improvements in the immigration court system, such as increasing their independence, neutrality, and professionalism of the corps of immigration judges. The American Bar Association has declared that the immigration court system is “on the brink of collapse.

5. No end to private-run detention facilities:  Immigrant rights advocates have called for the end of private (for profit) immigrant detention.  President Biden has ended private prisons for inmates.

As I have previously mentioned, I expect a “stand alone” Article I Bill 🧑🏽‍⚖️ to be introduced in the House shortly.  It could be combined with the Immigration Court improvements in the Biden Bill.

We need to keep the pressure on until Article I happens!

INSIDE THE ADMINISTRATION’S “KIDDIE GULAG:” Thousands Of Allegations Of Sexual Abuse Surface!

https://www.cnn.com/2019/02/26/politics/hhs-documents-minors-sexual-abuse/index.html

Sophie Tatum reports for CNN:

Washington (CNN)The Department of Health and Human Services received more than 4,500 complaints of sexual abuse against unaccompanied minors from 2014-2018, according to internal agency documents released Tuesday by Florida Democratic Rep. Ted Deutch.

In addition,1,303 complaints were reported to the Justice Department during that same time frame, according to the documents.
Deutch addressed the documents during a high-profile House hearing Tuesday on the Trump administration’s “zero tolerance” policy that resulted in thousands of immigrant children being separated from their parents.
He said that the documents “demonstrate over the past three years, there have been 154 staff on unaccompanied minor, let me repeat that, staff on unaccompanied minor allegations of sexual assault.”
“This works out on average to one sexual assault by HHS staff on unaccompanied minor per week,” he added.
Axios first reported the documents.
“I am deeply concerned with documents that have been turned over by HHS that record a high number of sexual assaults on unaccompanied children in the custody of the Office of Refugee and Resettlement,” Deutch said. “Together, these documents detail an environment of systemic sexual assaults by staff on unaccompanied children.”
HHS spokesperson Caitlin Oakley addressed the reports in a statement, saying minors’ safety is a “top concern,” and noted that there are “rigorous standards” in place for employees, which include mandatory background checks.
“These are vulnerable children in difficult circumstances, and ORR fully understands its responsibility to ensure that each child is treated with the utmost care. When any allegations of abuse, sexual abuse, or neglect are made, they are taken seriously and ORR acts swiftly to investigate and respond,” Oakley said.
At the hearing Tuesday, HHS’ US Public Health Service Commissioned Corps commander, Jonathan White, defended his agency against accusations of sexual abuse when asked by Rep. Tom McClintock, a California Republican, to respond to allegations that they were all “but serial child molesters” during a “drive-by slander a few minutes ago.”
“We share concern that I think everyone in this room feels. Anytime a child is abused in the care of ORR is one too many,” White said.
He added that “the vast majority of allegations prove to be unfounded when they are investigated by state law enforcement and federal law enforcement and the state licensure authorities to whom we refer them.”
“It is important to note that I am not aware of a single instance anywhere of an allegation against the ORR federal staff for abuse of a child,” White said.
Some of the incidents that were reported to the Justice Department included allegations against staff members who were accused of having relationships with minors, unwanted sexual touching and showing the minors pornographic videos, according to Axios. Axios also reported that of the thousands of complaints, there were 178 accusations against the adult staff.

******************************************

The Administration’s responses sound like a cover up to me. And they were “coaxed out” by GOP Reps who appear eager not to have the abuses engendered by the Administration’s toxic immigration enforcement policies fully vetted. Seems doubtful, based on my decades of Government experience, that “where there are 4,500 reports of smoke, there are no fires.”

Additionally, lawyers from the DOJ were still in court this week advancing specious and disingenuous arguments for avoiding responsibility for unconstitutional child separation that their clients had intentionally caused.

In fairness, these problems also existed under the Obama Administration. But, faced with extensive evidence of a broken system, the Trump Administration “doubled down” on problematic practices.

Eventually, there will be accountability for the detention disaster. And, when it happens both the responsible officials and the GOP legislators who are trying so hard to cover up the truth should face a reckoning.

TAL @ SF CHRON WITH SOME GOOD NEWS ABOUT WHAT’S IN THE “BORDER SECURITY” BILL THAT TRUMP (APPARENTLY) WILL SIGN BEFORE DECLARING HIS TOTALLY BOGUS “NATIONAL EMERGENCY!”

https://www.sfchronicle.com/politics/article/Funding-deal-blocks-ICE-from-arresting-adults-13617721.php

Funding deal blocks ICE from arresting adults taking in undocumented children

By Tal Kopan

WASHINGTON — A government funding deal on the verge of congressional passage would block federal officers from arresting undocumented immigrants solely because they come forward to take in migrant children.

The constraint on the Immigration and Customs Enforcement agency comes after The Chronicle reported that the government had made scores of such arrests — including more than 100 people who were taken into custody from July through November despite having no criminal record. Immigrant and child welfare advocates had assailed the practice as endangering young people by keeping them in detention longer and by giving immigrants an incentive to conceal potential sponsors’ true identities.

The population of undocumented children in government custody skyrocketed to record levels as immigration officials investigated the potential sponsors.

The ban on arresting sponsors with no criminal record is included in a bill to fund roughly one-quarter of the government through September. The appropriations legislation is the product of weeks of intense negotiations to avert a repeat of the partial shutdown that began Dec. 22 and lasted 35 days.

The Senate passed the bill Thursday and the House was expected to follow suit before government funding runs out Friday. The White House said President Trump would sign it.

House Democrats pushed strongly for the provision during negotiations over the funding package, said a Democratic aide who was not authorized to speak publicly about the talks. Florida Democratic Rep. Debbie Wasserman Schultz offered the specific legislative language.

“Arresting potential sponsors only ensures that children who flee dangerous circumstances will languish longer in overly crowded detention facilities,” Wasserman Schultz said. “Democrats agree, this cruel, immoral Trump trap does nothing to make America safer.”

At issue is the process of finding homes for undocumented immigrant children who come to the U.S. by themselves or are separated from an adult at the border.

Those children end up detained in a national network of shelters until they can be released to an adult, usually a relative. The shelters are designed to be a temporary bridge for often-traumatized children to more stable homes, in which they can pursue their case to stay in the country legally.

To sponsor a child, adults have long had to go through background checks for any criminal history or other red flags that might endanger the child. Immigration status is not weighed as a risk factor.

But last year the Trump administration added additional layers of review, including working with Immigration and Customs Enforcement to run fingerprints of potential sponsors. That caused concern within the immigrant community that sponsors, many of whom are undocumented themselves, could be ensnared in the administration’s no-limits immigration enforcement. The revelation that ICE had in turn used that information to arrest potential sponsors, most of whom had no criminal record, confirmed that fear.

Under the administration’s policies, the number of children in custody reached nearly 15,000, breaking records even after the government halted the practice it implemented in spring 2018 of separating families at the border. In December, the Department of Health and Human Services stopped requiring that every additional adult in a sponsor’s home be fingerprinted, a practice that had greatly slowed the process, keeping children detained longer. Since then, the number of children in custody has dropped to 11,500.

The government funding bill bars the administration from detaining or moving to deport undocumented immigrants based solely on information provided by Health and Human Services, which runs the unaccompanied children program, unless it provides evidence of a past child abuse-related felony or potential human trafficking.

Thanks, Tal, for putting the Chron “on top” of this grotesque mistreatment of children by the Trump Administration. Obviously, your courageous and timely reporting of abuses of human rights that DHS was trying to hide from public view has had a “real life” impact on legislation and people’s lives.

The intentional abuses of children and families that the Trump Administration is perpetrating in the name of our country is simply outrageous! Bad things happen to countries that make child abuse a national policy!

It also shows that the Democrats are right in challenging funding for abusive, wasteful, and unnecessary DHS detention. While they lacked the votes to succeed this time around, the battle certainly will continue, on both legislative and litigation fronts. As it does so, the full range of abuses, corruption, and unethical behavior by the Administration and DHS will be exposed and recorded for posterity.

As I’ve said before, it’s time for Article III Judges who have been lied to by Administration officials and whose orders to reunite families have been arrogantly ignored by the Trump Administration to put some of the Administration officials who have planned and carried out these gross human right abuses and thumbed their noses at court orders in jail for contempt.

Again, Tal, thanks for all you do for “truth, justice, and the American way!” And, thanks to conscientious legislators of both parties who helped put these restrictions on anti-social behavior in place. When the system works for the greater good, everyone benefits.

AOC & CO. ARE RIGHT TO SPEAK OUT ON INEFFECTIVE, INHUMANE, WASTEFUL, OFTEN ILLEGAL DHS POLICIES DRIVEN BY A WHITE NATIONALIST AGENDA – But, They Might Be Better Served By Holding Their Fire For Meaningful Oversight & The Next Budget Cycle – Like It Or Not, DHS Is Here & Isn’t Going Anywhere & We Do Need An Orderly System For Controlling Migration & Processing Refugees At Our Border!

https://www.wsj.com/articles/liberals-urge-democrats-to-take-a-hard-line-on-border-11549323945

Kristina Peterson & Louise Radnofsky report for the WSJ:

WASHINGTON—House Democratic leaders held firm through the five-week government shutdown that ended last month. Still, the party’s liberal wing is keeping up pressure on leadership as negotiations over a border-security deal heat up.

A group of liberal House Democrats and advocacy groups are urging Democrats in a bipartisan negotiating committee to refuse further funding for the Homeland Security Department, which oversees the border with Mexico. The group’s 17 lawmakers have less than two weeks to reach a deal before government funding expires again.

President Trump has said several times he is pessimistic lawmakers can reach a deal that he would accept, and he has threatened to take action to build his long-promised border wall on his own, including possibly declaring a national emergency.

Congressional leaders have been optimistic the group of House and Senate lawmakers can reach an agreement, but any bipartisan deal is unlikely to appease some in the party’s left wing.

A letter to House Democrats, written by freshman Democratic Reps. Ayanna Pressley of Massachusetts, Ilhan Omar of Minnesota, Rashida Tlaib of Michigan and Alexandria Ocasio-Cortez of New York, and signed by at least three others, criticizes Homeland Security for practices including prosecution and detention of immigrants.

The department and its frontline enforcement units—Immigration and Customs Enforcement and Customs and Border Protection—have become high-profile targets as they implement the Trump administration’s attempts to step up deportations and the zero-tolerance policy that last year resulted in family separations at the border.

“These agencies have promulgated an agenda driven by hate—not strategy,” the lawmakers wrote. They argue that the agencies’ ability to shift funds makes it impossible to prevent money from being used for policies that Democrats generally oppose.

Refusing funding for the agency housing the president’s top political priority isn’t going to draw Republican support, a House Democratic aide said, which the committee would need to produce a deal.

“It’s totally unrealistic,” Sen. Roy Blunt (R., Mo.), who is in the negotiating group, said of the Democratic letter. “That basically says you don’t want to secure the border.”

Democrats overall say they favor border security, just not Mr. Trump’s border wall, and immigration advocates said their task is to counter the president.

. . . .

Read the complete WSJ report from these “emerging stars on the immigration beat.”

There hasn’t been any meaningful oversight of DHS or the mess DOJ politicos have created at EOIR in two years. So, while there certainly should not be additional funding for DHS’s already overused and abused detention system, for now, Democrats should probably work with DHS as the “only game in town” on the Southern Border.

Over the next year, DHS and DOJ politicos should be required to testify and should be held accountable for the absolute, largely avoidable, chaos and inefficiency they have intentionally, incompetently, or maliciously created in immigration enforcement, our Immigration Courts, the refugee and asylum system, and the system for granting immigration benefits.

Then, based on the record, make rational, fact-based proposals for needed improvements in immigration enforcement, administration, and adjudication for the next budget cycle.

POLITICS: “CONVENTIONAL WISDOM” – “AOC’s” Predecessor Advised Her & Her Predominantly Female Colleagues To Basically “Sit Down, Shut Up, & ‘Learn The Ropes’ From Your (Mostly White Male) Betters” – She Ignored Him!

https://apple.news/AFBlLI9WJQk6Wy1AWo-8jXw

Hunter Schwarz for CNN:

Former Democratic New York Rep. Joe Crowley offered a bit of advice to new members of Congress during an exit interview with Vice News. “Don’t come here thinking you’re going to change the world overnight,” he said.

It was perhaps advice for the woman taking his spot, Rep. Alexandria Ocasio-Cortez, who defeated Crowley last summer in a upset primary victory and who’s rocketed to the top of her class as the most high-profile freshman on Capitol Hill.

In her first month in office, Ocasio-Cortez — or AOC as she’s short-handed commonly in the press — has remained a news cycle fixture for her clapbacks, policy proposals and more than 350 tweets or retweets since January 3.

Here’s how she’s spent her first month in Congress.

Sworn in on at the age of 29 on January 3, becomes the youngest member of the 116th Congress.

Surpassed House Speaker Nancy Pelosi in Twitter followers (@aoc vs. @SpeakerPelosi) her second day in office.

Posted her most retweeted tweet on January 4, a video of her dancing in front of her office, to poke fun at the video of her dancing in college that surfaced and was mocked following her swearing in. The new Twitter video received more than 20.7 million views and more than 160,000 retweets.

Co-sponsored her first piece of legislation, H.R. 242, repealing the PAYGO Act on January 4.

Her proposal to raise taxes on the rich to pay for the so-called “Green New Deal” proposal ended up on the cover of the January 5 issue of New York Daily News with the headline “Radical Solution.”

She got a shoutout from Cher on Twitter.

Sat for an interview with CBS’ “60 Minutes” that aired January 6 in which she said the super rich should be taxed more heavily after making $10 million, and that there’s “no question” Trump is racist.

Search interest in “Green New Deal” reached its highest ever point on Google Trends the day after her “60 Minutes” interview.

Said Trump saying “Who cares?” when asked about her calling him racist proves she got under his skin, in a January 14 tweet.

Got in an argument with former Wisconsin Gov. Scott Walker over taxes on Twitter on January 15.

Named to the House Financial Services Committee, which oversees things like banking and lending, which she announced on January 15. It’s led by Chairwoman Maxine Waters of California.

Gave her first speech from the House floor on January 16, where she spoke about a constituent who missed a paycheck from the shutdown, and said the shutdown isn’t about a wall or the border, but “the erosion of American democracy and the subversion of our most basic governmental norms.”

Her speech became C-SPAN’s most-viewed Twitter video ever, with more than 3.34 million views.

She and other freshmen Democrats delivered a letter to Senate Majority Leader Mitch McConnell on January 16 calling for an end to the shutdown a start a #WheresMitch social media campaign.

She and Democratic Rep. Jim Himes of Connecticut taught a class to fellow lawmakers on how to use social media on January 17 where she counseled them to not use memes if they don’t know what memes are, and not to talk like the Founding Fathers on Twitter.

Spoke at a Women’s March event in New York City on January 19.

Spoke at the MLK Now event in New York City on January 21 where Ta-Nehisi Coates said he thinks she is the person in politics today who represents King’s radical vision.

Named to the House Oversight Committee, which can investigate the Trump administration, on January 22.

The Washington Post Fact Checker gave some of her claims about living and minimum wage at the King event three Pinnochios on January 24. Ocasio-Cortez responded on Twitter criticizing the fact check’s citation of “a Walmart-funded think tank as reference material for wage fairness” and responded with her own “4 Geppettos.” (Click here for CNN’s fact-check of AOC and several other politicians’ comments on climate change)

When asked by Stephen Colbert on the January 21 episode of “The Late Show” how many “f****” she gives about Democrats who’ve criticized her, she said, “zero.”

Shared her skincare routine on Instagram Stories on January 28 after being asked about it from a follower.

Co-wrote a letter along with other freshmen Democrats asking for a reduction in Department of Homeland Security funding because of spending on things including detention facilities.

***************************************

Who am I to advise AOC. But, from my parochial perspective she could make herself even more of a political force if she hired a full-time “fact checker” for her staff. I think her already resonant message would be even more powerful if it were invariably backed with “true facts.” (Although Rudy Giuliani, who once famously told Chuck Todd that “truth isn’t truth,” might disagree.)
