“– Liberals mock Trump as ineffective at their own peril. Yes, it’s easy to joke about how Trump said during the campaign that he’d win so much people would get tired of winning. Both of his travel bans have been blocked – for now. An active FBI investigation into his associates is a big gray cloud over the White House. The president himself falsely accused his predecessor of wiretapping him. His first national security adviser registered as a foreign agent after being fired for not being honest about his contacts with the Russian ambassador. His attorney general, at best, misled Congress under oath.
— Despite the chaos and the growing credibility gap, Trump is systematically succeeding in his quest to “deconstruct the administrative state,” as his chief strategist Stephen K. Bannon puts it. He’s pursued the most aggressive regulatory rollback since Ronald Reagan, especially on environmental issues, with a series of bills and executive orders. He’s placed devoted ideologues into perches from which they can stop aggressively enforcing laws that conservatives don’t like. By not filling certain posts, he’s ensuring that certain government functions will simply not be performed. His budget proposal spotlighted his desire to make as much of the federal bureaucracy as possible wither on the vine.

— Trump has been using executive orders to tie the hands of rule makers. He put in place a regulatory freeze during his first hours, mandated that two regulations be repealed for every new one that goes on the books and ordered a top-to-bottom review of the government with an eye toward shrinking it.
Any day now, Trump is expected to sign an executive order aimed at undoing Obama’s Clean Power Plan and end a moratorium on federal-land coal mining. This would ensure that the U.S. does not meet its commitments under the Paris climate agreement.

The administration is also preparing new executive orders to re-examine all 14 U.S. free trade agreements, including NAFTA, and the president could start to sign some of them this week.

— Trump plans to unveil a new White House office today with sweeping authority to overhaul the federal bureaucracy and, potentially, privatize some government functions. “The Office of American Innovation, to be led by Jared Kushner, the president’s son-in-law and senior adviser, will operate as its own nimble power center within the West Wing and will report directly to Trump,” Ashley Parker and Philip Rucker report. “Viewed internally as a SWAT team of strategic consultants, the office will be staffed by former business executives and is designed to … create a lasting legacy for a president still searching for signature achievements. … Kushner’s team is being formalized just as the Trump administration is proposing sweeping budget cuts across many departments, and members said they would help find efficiencies.”

Kushner’s ambitions are grand: “At least to start, the team plans to focus its attention on re-imagining Veterans Affairs; modernizing the technology and data infrastructure of every federal department and agency; remodeling workforce-training programs; and developing ‘transformative projects’ under the banner of Trump’s $1 trillion infrastructure plan, such as providing broadband Internet service to every American. In some cases, the office could direct that government functions be privatized, or that existing contracts be awarded to new bidders.”

On Gorsuch, Deference, & The Administrative State

Hohmann’s points make quite a bit of sense to me — until he gets down to his rather remarkable conclusion that progressives should have invested more in a fight against Gorsuch. What? Just how would they have done that?  The GOP has the votes to confirm, as they will do, and there is nothing the Dems can do to stop it, except to look feeble, petty, and out of touch in the attempt.

The confirmation hearings revealed nothing that was not already known. Gorsuch should be a reliable conservative vote on the Court, perhaps, but not necessarily, even more than Justice Scalia. Surprise!

We just had an election during which McConnell’s scheme to block the nomination of Chief Judge Merrick Garland to the Supremes, the control of the Senate, and the ability of the next President to appoint a liberal (Hillary) or a conservative (Trump) as Scalia’s replacement were big issues. And, guess what? Whether Dems like it or not, the GOP won both the Presidency and the Senate and thereby the ability to appoint their man (in this case) as the next Justice.

What’s remarkable about that? It would have only been remarkable if President Trump had nominated someone less conservative than Judge Gorsuch. And, certainly, if Hillary had won and the Democrats won the Senate she could legitimately have chosen to resubmit Judge Garland or chosen an even more liberal candidate who would have duly been confirmed by the Democrats over the GOP’s objections. Elections have consequences, particularly when your party loses control of both of the political branches of Government.

I continue to suspect that while Justice Gorsuch will be very conservative, at some point in the future he will be persuaded to side with the so-called “liberal Justices” against some position that is key to the GOP — perhaps, the scope of Executive authority. At that point, the same GOP Senators who gushed on about his “judicial independence” will be screaming “betrayal,” while the Democrats will be congratulating him on “conscientiously following the law.”

Look at how Chief Justice Roberts went from poster boy for judicial conservatism to “dupe of the left” just by failing to veto Obamacare as the GOP had been counting on. All politicians want judges who exercise their “judicial independence” in a predictable way consistent with the political philosophy of the party that appointed them. Once on the bench, however, with lifetime tenure and only their judicial colleagues to answer to, few actually live up to all of the exceptions of their political appointers.

Moreover, I don’t agree with the supposedly “liberal” position that Executive Branch administrative judges (like I was) and bureaucrats (which I also was) should have the power to impose their views on legal issues, even if not particularly sound ones, on the Article III Judiciary. Chief Justice John Marshall must be turning over in his grave, while Thomas Jefferson dances on top of it, at this bizarre voluntary surrender of judicial authority known as “Chevron.”

There is always pressure on Executive Branch officials, be they administrative judges or just “regular agency bureaucrats,” to construe the law in ways that favor Executive policies and Executive power over the power and prerogatives of the other two branches of Government and often over the rights of individuals in the U.S.

Deciding difficult questions of law, where the answers are not clear, is what Article III Judges are paid to do, and what they are supposed to do under the Constitution! At one time, this is what they actually did! The pre-ChevronSkidmore doctrine” already gave the Article III Judiciary adequate latitude to recognize the expertise of certain Executive Branch officials and to defer to their interpretation when it appeared to be the best one, or at least as good as any of the alternatives.

But, Chevron basically substituted the concept of “any plausible interpretation” for the “best interpretation.”  That’s simply not the way an independent judiciary should function under the separation of powers established in our Constitution.

I say all of this as someone who spent the bulk of my professional career as a public servant within the “administrative state” and who, unlike the Bannons of the world, believes in the power of the Federal Government to do good things for the general population. But, I have also seen first-hand the weaknesses and biases of the Executive when it comes to interpreting the law.

Meaningful independent judicial oversight over the “administrative state,” which includes “de novo” (basically unrestricted) review of Executive legal decisions by the Article III Judiciary, is a requirement  for fairness and due process under our Constitution.

Finally, the Dems should abandon Schumer’s ill-conceived idea of a “Gorsuch filibuster.”  Of the minority of Americans who actually care about the Gorsuch confirmation, only a minority of those are opposed. In other words, the Dems are about to proceed on a futile parliamentary maneuver that really only speaks to a small number of voting Americans, who are already in their “base.” Absolutely no need to do that.

What is needed if the Dems don’t want another Gorsuch appointment is to start winning more elections, particularly in the U.S. Senate and for the Presidency the next time around. That will require more than feeble posturing, tilting at windmills, and some additional “Trump fails.”

The Democrats need some dynamic leadership (which currently is conspicuously absent) and some real, down to earth programs and proposals to solve America’s problems (something which I haven’t heard to date). What can the Dems do that the GOP can’t, and why should folks care?

Otherwise, the next nominee for the Supremes could be along the lines of Judge Jeannie or Judge Napolitano. And, the Dems will continue to be powerless to stop it.

Adios Amigo! — Xenophobia Trumps Rationality, Humanity, As ICE Boots Law-Abiding Indiana Hispanic Businessman Whose Wife Voted For Trump — “Mixed Family” Learns The Hard Way They Aren’t Welcome In The Trump-Pence America!

“Stories such as Beristain’s — in which law-abiding parents are deported because of their immigration status — have inundated the news media in recent months. The Twitter account “Trump Regrets” has amassed nearly 260,000 followers by retweeting disappointed and angry Trump voters.

“Previously,” as The Post’s Samantha Schmidt and Sarah Larimer reported last month, “the Obama administration prioritized the deportation of people who were violent offenders or had ties to criminal gangs. Trump’s executive order on Jan. 25 expanded priorities to include any undocumented immigrants who had been convicted of a criminal offense.”

“Personally, I think the president should be giving him a handshake,” Flora said. “Either Trump was lying when he said we were only deporting bad guys, or Trump’s view of bad guys is so expansive it can literally include every single immigrant.”

Days after Beristain’s arrest, Flora said, he filed a “stay of removal” to prevent deportation, but it was rejected March 15.

“Once the case is finalized and done, there’s really no reason to keep him around in their eyes,” Flora said, referring to ICE. “They think, ‘Why take up jail space for no reason if all the legal options have been exhausted?’ ”

Flora said the decision to deport Beristain is a “wildly disproportionate” response when measured against the law he broke nearly two decades ago.

“If you asked 100 people to paint you a picture of a bad guy, no one would draw anyone remotely resembling Roberto,” he said.
Helen Beristain told the Tribune that — in their effort to get her husband U.S. citizenship — the couple has had 10 attorneys over the past 18 years. Many of those attorneys, she said, told them that they had no choice but to wait for immigration laws to change.

Instead of changing in the couple’s favor, the laws evolved to make her husband more vulnerable to deportation, a development the Beristains never expected. She told the Tribune that Trump’s deportation measures — the one’s she thought her family would be exempt from — are harming “regular people.”

“I understand when you’re a criminal and you do bad things, you shouldn’t be in the country,” Helen told the CBS TV affiliate WSBT. “But when you’re a good citizen and you support and you help and you pay taxes and you give jobs to people, you should be able to stay.”

“We were for Mr. Trump,” she added. “We were very happy he became the president. Whatever he says, he is right. But, like he said, the good people have a chance to become citizens of the United States.”

And, folks can thank restrictionist, white nationalist “fellow travelers” like then-Senator, now Attorney General Jeff Sessions, egged on by the likes of current Presidential Advisors Steve Bannon and Stephen Miller, for blocking sensible immigration reform efforts in Congress. So, we’re spending taxpayer money and Government resources to make American a worse place by deporting members of the business community who have done nothing but good things for the country and those around them. You’d have to reside somewhere deep in the bowels of the “GOP Swamp” to make sense of this type of policy.

at about 3:45 PM EST, an already well-tanned man was sunning himself, dragging on a cigarette, enjoying a big glass of red wine, with tears of joy streaming down his face, his feet propped up, and thinking “YES, there is justice in this world!”

MATT FLEGENHEIMER and THOMAS KAPLAN write in the NY Times that Speaker Paul Ryan is now in “damage control mode” after he and President Trump were “stiffed” by their own party (no Trumpster, you can’t blame this on the Dems, who were kept “locked in the hallway” while this circus was going on, probably having to check Fox News to see what time the vote was scheduled), suffering a stunning, but well-deserved, defeat on their horrible bill to “repeal and replace Obamacare:”

“The episode not only demonstrated an inability to honor a longstanding pledge that powered Republicans through a string of election cycles. It was also a remarkable setback for Mr. Ryan as the body’s principal arm-twister, in his first major test as the speaker under a Republican president.

In January, he coasted to re-election with almost unanimous party support, prompting allies to gloat that he had tamed the hard-line House Freedom Caucus far more deftly than his predecessor, John A. Boehner.

By Friday, his bill had at once alienated those archconservatives and more moderate members who abandoned the legislation as Mr. Ryan and Mr. Trump began caving to demands of the far right, to little effect.

“We were a 10-year opposition party, where being against things was easy to do,” Mr. Ryan said at a sheepish news conference shortly after the bill was pulled, adding with uncharacteristic candor that Republicans were not yet prepared to be a “governing party.”

“We will get there,” Mr. Ryan said, “but we weren’t there today.”

His job will not get easier. With disparate coalitions in his conference, outside groups like the political arm of the Heritage Foundation pushing lawmakers to pursue conservative purity, and a less-than-popular president whom some members have appeared more willing to buck recently, there are few establishment forces helping Mr. Ryan keep the peace.”

Part IV: The Immigration Judge

There is widespread consensus that immigration courts are overwhelmed with immense caseloads, inadequate staffing, and lengthy backlogs (Arnold & Porter 2010). Non-detained immigrants in removal proceedings often wait two to three years to have their cases adjudicated. Cases on the detained docket move much faster. Despite the considerable time it takes to access counsel, determine eligibility for defenses to deportation, and gather evidence, the average life of a pro se detained immigrant’s case totals a mere 23 days (Eagly and Shafer 2015, 63).

In addition to facing institutional pressure to quickly move cases while immigrants are detained at government expense, judges are overburdened with the number of detained cases that must be efficiently adjudicated (Lustig et al. 2008). In 2015, immigration judges adjudicated and completed 51,005 detained cases, constituting 28 percent of all immigration cases completed that year (EOIR 2016, gure 11). Judges have very little face time with immigrants in their courtroom, and about half the time spent with pro se detainees involves requests for continuances to seek counsel (Eagly and Shafer 2015, 61). Furthermore, as administrative law judges, immigration judges have obligations to the respondents who appear pro se and are often required to step into the role of counsel in order to fully develop the record through interrogating, examining, and cross-examining an immigrant and any witnesses.”14

“April Able for the DHS.”
“What are we here for Ms. Baker?”

“Your Honor, we’re seeking a reasonable bond for my client, who has been in the United States for more than two decades. He’s a family man, the sole support of his wife and four US citizen children, who are sitting right behind me. He’s a skilled carpenter with a secure job. He pays his taxes. He’s a deacon at his church. His employer is here this afternoon and is willing to post bond for him. The respondent’s wife is out of work, and the family is on the verge of being evicted from their apartment. The oldest son and daughter are having trouble in school ever since their father was detained. The baby has developed asthma and cries all night.”

“I assume he’s in detention for a reason, Ms. Baker. What is it?”

“Well, Your Honor, he had a very unfortunate incident with one of his co-workers that resulted in his one and only brush with the law. I think he probably got some questionable legal advice, too.”

“What’s the conviction?”
“Aggravated assault with a deadly weapon.”
“Sentence?”
“18 months, with all but three months suspended, Your Honor.”

“Hmmm. Doesn’t sound very promising. What’s your take, Ms. Able?”

“He’s an aggravated felon, Your Honor, under the BIA and Fourth Circuit case law. Therefore, he’s a mandatory detainee. May I serve the records of conviction?”

“Yes, thank you Ms. Able. Isn’t Ms. Able right, Ms. Baker? He’s mandatory detained under the applicable law, isn’t he?”

“Well, Your Honor, technically that might be right. But we’re asking you to exercise your humanitarian discretion in this extraordinary situation.”

“As you know, Ms. Baker, I’m not a court of equity. The law gives me no discretion here. So, based on what you’ve presented, no bond. What’s next? Are you admitting and conceding removability and filing for relief?”

“The family wanted me to ask for bond, Your Honor.”

“You did, Ms. Baker. What’s the next step?”

“Well, the respondent has instructed me that if you didn’t grant a bond, he just wants a final order to go back to Mexico. He’s been in detention for some time now, and he just can’t wait any longer.”

“You’re sure that’s what Mr. Caceres wants to do?”

“Yes, Your Honor.”
“Mr. Caceres, this is Judge Schmidt, can you hear me?”

“Yes.”

“Because of the crime you committed, the law doesn’t permit me to set a bond for you. Your lawyer, Ms. Baker, tells me that you have decided to give up your rights to a full hearing and be removed to Mexico. Is that correct?”

“Yes, Your Honor. I can’t stand any more detention.”

“You understand that this is a final decision, and that once I enter the order you will be removed as soon as DHS can make arrangements.”

“Yes, judge, I understand.”

“And, you’ve discussed this with your family, sir?”

“I just want to go — no more detention. Can I go tomorrow?”

“Probably not. But the assistant chief counsel and DHS officer in court are noting that you want to go as soon as can be arranged.”

“Your Honor, may his wife and children come up and see him for a moment?”

“Yes, of course, Ms. Baker. Please come on up folks.”

“Your Honor, the respondent’s wife would like to make a statement to the court.”

“I don’t think that’s prudent, Ms. Baker. She’s already hysterical, and there is nothing I can do about the situation, as I’m sure you’ll explain to her. We have lots of other people waiting to see me this afternoon.”

“Understood. Thanks, Your Honor.’

“You’re welcome, Ms. Baker. You did the best you could. Take care folks. I’m sorry you’re in this situation. Mr. Caceres, good luck to you in Mexico. Please stay out of trouble. The clerk will issue the final order. Who’s next, Madam Clerk?”

The “Not-Quite-Ready-For-Prime-Time” (“NQRPT”) Lawyer

“That’s very true, Your Honor, but the power was out at our office for a day, and my son crashed his car and I had to take care of the insurance and the repairs.”

“All right, come back in three weeks with your filing, without fail.”

“Can I come back next week, Your Honor? My client has been in detention a long time.”

“I know that, counsel. That’s why I wanted you to file today, so we could set an individual date. I’m already overbooked for next week, and I can’t justify putting you in front of others who are prepared.”

“Ah, could we just set an individual date now, Your Honor, and I’ll promise to file within a week?”

“That sounds like a really bad idea, Mr. Queless, in light of actual performance to date. I want to see the completed filing before I assign the individual date. That’s how we do things around here. You’ve been around long enough to know that.”

“Excuse me, Your Honor, but may I be heard?”

“Yes, you may, Ms. Able.”

“With due respect, Your Honor, at the last master calendar you said this would be the final continuance. This detained case has been pending for months, and you have given counsel a more than reasonable opportunity to file for relief. At this point, the DHS must request that you deny any further continuance and move that you enter an order of removal.”

“Well, I sympathize with your position, Ms. Able. I did say this would be the last continuance, and I’m as frustrated as you are. But I note that the respondent is from a country where we routinely grant asylum, often by agreement or with no objection from your office. Therefore, I feel that we must get to the merits of his claim. Let’s do this. Mr. Queless, I’m going to give you an ‘incentive’ to get this filed. If the I-589 is not complete and ready to file at the next hearing — no more excuses, no more ‘dog ate my homework’ — I’m going to agree with Ms. Able, grant her motion, and enter an order of removal against your client. Do you understand?”

Mr. Garcia, this is a list of organizations in Virginia that might be willing to represent you at little or no charge if you can’t afford a lawyer. You should also check with family and friends to see if they can help you nd a free or low-cost lawyer to take your immigration case. I’ll set your case over for three weeks to give you a chance to look.”

“In Madison, a 64-year-old currently pays $1,852 a year through “Obamacare” after receiving $5,991 in tax credits, according to a Citizen Action of Wisconsin report released Tuesday.

Under the Republican plan, the same person would pay $7,764 a year in premiums after $4,000 in tax credits. That is $5,912 — or more than three times — more, the report says.

Republicans’ proposed American Health Care Act, which the House is expected to vote on Thursday, would reduce tax credits for some groups and allow insurers to charge older adults more.

Those changes mean a 64-year-old in La Crosse would have net premiums of $14,515 a year, up from $1,519 now, the Citizen Action report says. That is $12,996 — or more than eight times — more.

The Republican plan would “result in people suffering and dying prematurely,” said Dr. Cynthia Haq, a professor of family medicine and population health sciences at the UW School of Medicine and Public Health.

“People will have to forgo health insurance coverage,” Haq said. “They will not seek care. They will not get preventive services. They will not be able to manage their chronic diseases. As a result, they’ll show up in the emergency departments of hospitals in extreme crisis.”

NYT EDITORIAL: Like Preceding Administrations, Trump Happy To Punish Workers, But Not So Much Employers Who Violate The Laws — Why We Need Sensible Immigration Reform Including Legalization Now!

American employers continue to assume relatively little risk by hiring undocumented immigrants to perform menial, backbreaking work, often for little pay. Meanwhile, as Mr. Trump’s deportation crackdown accelerates, families are being ripped apart, and communities of hard-working immigrants with deep roots in this country are gripped by fear and uncertainty. The truth is pretty obvious. Employers and businesspersons vote and contribute to both parties. And, as we know, “money talks.” It’s also very clear that these workers are fulfilling a continuing need in our economy. So, why not get everyone “on the books,” have taxes withheld, and document them?

While I don’t  believe the Administration’s hype about undocumented migrants threatening our national security, I do think that it is a good idea to find our exactly who we have here, get them their own working Social Security numbers, withhold Federal and State taxes, Social Security, and Medicare as appropriate, and run fingerprint and background screening to weed out any serious criminals or genuine security risks.

It’s long past time to ditch the xenophobia campaign and have the parties work together for meaningful immigration reform, including some type of legalization, reasonable and effective enforcement, and an independent U.S. Immigration Court.

POLITICO: Trump Administration’s Xenophobic Immigration Policies Appear Out Of Line With Majority Of Americans!

“Six out of 10 Americans reached for a new poll released Friday by CNN said U.S. immigration policy should be geared towards aiding those who are employed and inside the country illegally with obtaining legal status, not deporting them as President Donald Trump has proposed.

Sixty percent of those polled said the top priority for the government when it comes to immigration should be “developing a plan to allow those in the U.S. illegally who have jobs to become legal residents.” Twenty-six percent said the U.S. should focus on a plan to stop more undocumented immigrants from crossing the border and 13 percent said the government’s priority should be deporting those who are already here.
Asked what should be done with undocumented immigrants who speak English, have jobs, are willing to pay back taxes and have been in the U.S. “for a number of years,” 90 percent of respondents said they would support legislation that allowed them to remain in the country and offered a path to U.S. citizenship. Support for such a policy had broad bipartisan support, backed by 96 percent of Democrats, 87 percent of Republicans and 89 percent of independents.”

Along the same line, in her Right Turn op-ed column in today’s Washington Post, Jennifer Rubin writes:

“In short, nothing was more central to Trump/Bannon than their ethno-nationalist fear-mongering, which played to the sense of alienation and displacement many white working-class Americans felt. The strategy was simple: Give them a scapegoat, rather than address complex problems. It’s a strategy employed for centuries by autocrats, bigots and charlatans. There is also nothing more un-American and violative of our historical and constitutional traditions. Let’s hope and pray Trump/Bannon have awoken a sleeping giant — the conscience of good and decent Americans.”

The Executive Order of January 27, 2017, suspending the entry of certain aliens, was authorized by statute, and presidents have frequently exercised that authority through executive orders and presidential proclamations. Whatever we, as individuals, may feel about the President or the Executive Order,1 the President’s decision was well within the powers of the presidency, and “[t]he wisdom of the policy choices made by [the President] is not a matter for our consideration.” Sale v. Haitian Ctrs. Council, Inc., 509 U.S. 155, 165 (1993).

1 Our personal views are of no consequence. I note this only to emphasize that I have written this dissent to defend an important constitutional principle—that the political branches, informed by foreign affairs and national security considerations, control immigration subject to limited judicial review—and not to defend the administration’s policy.

This is not to say that presidential immigration policy concerning the entry of aliens at the border is immune from judicial review, only that our review is limited by Kleindienst v. I had speculated at the time a Judge of the 9th Circuit requested a vote on rehearing en banc that it was part of a strategy not intended to actually force such review, but rather to give those Judges who disagreed with the 3-Judge panel a chance to publicly express dissenting views.  This dissent will be published.

Nevertheless, with only five of the 29 or so active Judges on the 9th Circuit joining Judge Bybee’s dissent, the prospect for the Administration obtaining any relief there from the TRO in State of Hawaii v. Trump enjoining Travel Ban 2.0 appears dim.

Notwithstanding President Trump’s claim that he will litigate Travel Ban 2.0 to the Supreme Court, that might not be so easy, particularly for the foreseeable future. The Supreme Court is not obligated to take any case just because the President wishes it.  The Court has discretion.

In exercising that discretion (known as a “petition for certiorari”) the Court generally does not like to intervene at the TRO or Preliminary Injunction stage, before a full record is developed. Also, the current eight member configuration, presenting the possibility of a tie vote, makes it less likely that the Court would take the case now.

And, one of the reasons for the Court taking such a case — a split in Circuits — doesn’t exist here. The Administration has consistently lost on the issue except for a single District Court ruling from Massachusetts.

Consequently, the Administration might have to wait for a full trial on the merits of the plaintiffs’ case, a process that would take weeks at a minimum and quite possibly months or even years. Even then, there is no guarantee that the Supreme Court would take the case, or that even with Justice Gorsuch on the bench the Administration’s position would prevail.

“Donald Trump’s presidential campaign capitalized on a familiar brand of nativist anti-immigrant slander usually reserved for our nation’s most desperate times. It was an ugly old vein to mine, but now that he’s managed to strike electoral gold there, he is not wrong to view his election as a mandate to carry out his promise to enforce federal immigration law to its fullest extent. This would be alarming to friends of the Constitution under any circumstances, but especially so given Trump’s open embrace of white supremacy—as a concept, if not a movement—in the primaries. The immigration system I keep hearing about from pundits and politicians (all of whom should know better) is almost entirely unmoored from actual fact. It seems to be a chimerical pastiche of the one we had before Ellis Island closed, the one we had just before the moon landing, and some sort of rosy Tomorrowland fantasy in which visas would be awarded to the undocumented if only they would do it the right way. This is not the system I work with every day.
When a white, native-born American says, “my family came here the right way,” what the speaker almost invariably means is that one or more of his ancestors came to the United States without a visa during a time of virtually unrestricted European migration. They boarded a trans-Atlantic ocean liner, stood in line at an immigration inspection station for the better part of a day, answered a standard series of twenty-nine questions, were subjected to a medical exam, and were admitted indefinitely to the United States. That’s how my Scottish great-grandparents did it in 1916. If you were born in the United States with European ancestors, it’s probably how you came to be here too. That system ended in 1924. Its successor, the “national origins” quota system (a more restricted but still relatively open “line”), was abolished in 1965. But I still regularly meet well-meaning fellow citizens who believe that anyone who deserves a chance can simply “fill out the forms,” “get in line,” and “come the right way, like my family did.” At which point, I have to patiently explain that they can’t.

For most of my undocumented neighbors, in East Boston and beyond, there are no forms. There is no line. There never was. Telling an undocumented Mexican dishwasher that he should “wait in line, like my family did” is no more realistic than advising him to switch to the same model of iPhone your great-grandfather used. Yet the lie persists, with nearly every presidential candidate since George H. W. Bush invoking the imaginary “line.”

[Bill] O’Reilly was too charitable. There is no reason to believe that Trump has ever understood the basic precepts of due-process protection. Commitment to due process would have been fundamentally incompatible with Trump’s record as a casino magnate, a New York City landlord, or an authoritarian game show host given unlimited license to “fire” contestants at whim.

Trump has signaled the likely place of due process in his immigration system by promising to immediately deport 2 to 3 million “criminal aliens.” This staggering number, nearly the entire urban population of Chicago, would represent more deportations than Obama (the current record-holder) completed in eight years, and more than twice as many as were carried out during Operation Wetback.

In fifty-eight immigration courts nationwide, immigration judges are operating (per a recent study) at a degree of mental stress equivalent to that of an emergency-room doctor. “This case,” sneered federal judge Richard Posner in a recent dissent, “involves a typical botch by an immigration judge.” Posner, punching down from the lofty heights of a federal appeals court, went on to concede graciously that the immigration court’s status as “the least competent federal agency,” might have something to do with congressional underfunding and the resultant “crushing workloads.”
Our nation’s roughly 250 immigration judges [now approximately 305] are now responsible for managing a record backlog of more than five hundred thousand pending deportation cases, with thousands more pouring into the system each day. The judges I appear before in the Boston immigration court are humane and learned experts who work long hours, in circumstances that couldn’t be less familiar to Judge Posner, but they are as susceptible to human error as any judge anywhere.

In an executive order signed within days of his inauguration, Trump authorized Congress to triple the number of Immigration and Customs Enforcement agents on the ground. He has made no mention of any plans to extend the courts the same courtesy, but this new flow of cases simply cannot be sustained within today’s judicial plumbing.”

Cameron’s full, hard-hitting article is definitely worth a read. And, as he points out, quite sadly, it’s likely to get much worse from a due process standpoint before it gets better.

I also think he is right that few U.S. Court of Appeals Judges would be able to survive working as U.S. Immigration Judges under today’s incredibly difficult circumstances and conditions.

HISTORY: New Ric Burns/Li-Shin Yu Documentary Film Explores Sordid Side Of Our History: “The Chinese Exclusion Act” — “It was democratic,” explains historian Renqiu Yu in the film. “It was legal. But it was wrong.” — “That’s Why I Become a Lawyer,” Says One U.S. Immigration Judge!

“In the last half of the 19th century, as Reconstruction was collapsing and the country slogged through an economic depression in the 1870s, politicians found easy scapegoats in Chinese immigrants. As a statesman, California Governor Bigler “wrangled a working class white rage at the fact that the Gold Rush had not been a stairway to heaven,” Burns says, “and all this transmogrified into hatred of the ‘other.’” Bigler called Chinese immigrants ignorant about and uninterested in joining American society, and described them as inferior, dishonest, and unassimilable in public addresses.

Passionate anti-Chinese sentiment manifested itself in the passage of punitive local ordinances that sought to criminalize or tax everyday Chinese life. San Francisco’s queue ordinances of the 1870s forbade city prisoners from keeping long braids. Pole ordinances prohibited the use of poles to balance vegetables and other wares; the use of a pole to balance heavy loads was a uniquely Chinese practice. Chinese immigrants were even prohibited from testifying in court against whites.

By the time the Chinese Exclusion Act became the law in 1882, Chinese immigrants were firmly established in the popular imagination as villainous culprits responsible for the country’s every economic woe. The law only codified a seething anti-immigrant sentiment that Americans latched on to. The law made it illegal for Chinese immigrants to come to the U.S., it made it illegal for those who left to re-enter the U.S., and it made it illegal for Chinese nationals to become U.S. citizens. The law was overturned only in the 1940s, and it wasn’t functionally dismantled until 1965 during the Civil Rights era — just 50 years ago.

“It was democratic,” explains historian Renqiu Yu in the film. “It was legal. But it was wrong.” That breach between legality and justice is exactly what Burns and Li-shin Yu sought to explore in their film. “Here’s a story that makes you think about how the way that democracy and jurisprudence work is not equal to justice,” Burns says.

The other chapter of the story of the Chinese Exclusion Act is one of resistance. Li-shin Yu says that in the years of making this film, the stories of resistance stood out to her over and over. “The greatest thing to have learned is that across time, the Chinese were standing up every step of the way,” Yu says.”

“One thing however is clear. Trump’s recent efforts to use blunt executive power to close our borders and prepare the way for deporting large numbers of undocumented immigrants are confronting far-reaching problems. Not only is there opposition from federal judges, the business sector, civil liberties groups, and others. There is also a major roadblock from another quarter: our already broken system of immigration laws and immigration courts.

The nation’s immigration laws needed repair long before Trump came to office. Even without the measures taken by the new administration, immigration courts face a backlog of hundreds of thousands of cases, while the existing detention system is plagued, not just by arbitrary arrests, but also by deep problems in the way immigrant detainees are handled by our courts, one aspect of which is the subject of a Supreme Court challenge.

But will the potential Trump excesses—driven by the president’s fear mongering about immigrant crimes and the alleged potential for terrorists to pose as refugees—be enough to light a fire under a Republican-led Congress that has for years balked at immigration reform?

For better or worse—and it may turn out to be worse if Congress continues to refuse to act—the Trump administration’s determination to enforce current laws has pushed long-standing inequities in immigration justice onto the front pages.

Take the matter of those immigration judges, who now number some three hundred and are scheduled to grow substantially under the Trump administration. In April 2013, the National Association of Immigration Judges issued a scathing report pleading for omnibus immigration reform. Describing the morale of the immigration judge corps as “plummeting,” the report found that “the Immigration Courts’ caseload is spiraling out of control, dramatically outpacing the judicial resources available and making a complete gridlock of the current system a disturbing and foreseeable probability.”

The judges also noted that, “as a component of the DOJ [Department of Justice], the Immigration Courts remain housed in an executive agency with a prosecutorial mission that is frequently at odds with the goal of impartial adjudication.” For example, the judges are appointed by the Attorney General and “subject to non-transparent performance review and disciplinary processes as DOJ employees.” As a result, “they can be subjected to personal discipline for not meeting the administrative priorities of their supervisors and are frequently placed in the untenable position of having to choose between risking their livelihood and exercising their independent decision-making authority when deciding continuances”—the postponement of a hearing or trial.

The immigration judges writing this complaint were working under the Obama administration Justice Department, with Eric Holder as attorney general. What will their situation be like with Attorney General Jeff Sessions, a believer in tighter immigration controls, as their boss?

As it is now, an immigration judge’s job is exhausting. They carry an average load of 1,500 cases, but have minimal staff support. In the 2013 report, the immigration judges noted that they have no bailiffs, no court reporters, and only one quarter of the time of a single judicial law clerk. The backlog of immigration cases in the United States now stands at roughly 542,000. Most important, the immigration judges claim some 85 percent of detained immigrants appearing before them are unrepresented by counsel.

Meanwhile, another pending lawsuit highlights a different long-running problem concerning our nation’s immigration judges. In June 2013, the American Immigration Lawyers Association, along with Public Citizen and the American Immigration Council (AIC) filed a case in federal district court in Washington, D.C., seeking documents that would disclose whether the federal government adequately investigated and resolved misconduct complaints against immigration judges.

Such complaints have been widespread enough that the Justice Department reports annually on the number. In fiscal 2014, the latest figures published, there were 115 complaints lodged against 66 immigration judges. Although 77 were listed as resolved, the outcomes are not described.”

This timely article was brought to my attention by my good friend and former colleague retired U.s. Immigration Judge (NY) Sarah Burr. Walter Pincus is a highly respected national security reporter. He’s not by any means an “immigration guru.”

As I have pointed out in previous blogs and articles, this problem is real! In the absence of sensible, bipartisan immigration reform by Congress, which must include establishing an independent immigration judiciary, our entire Federal Justice System is at risk of massive failure.

Why? Because even now, immigration review cases are one of the largest, if not the largest, components of the civil dockets of the U.S. Courts of Appeals. As due process in the Immigration Courts and the BIA (the “Appellate Division” of the U.S. Immigration Courts) deteriorates under excruciating pressure from the Administration, more and more of those ordered removed will take their cases to the U.S. Courts of Appeals. That’s potentially hundreds of thousands of additional cases. It won’t be long before the Courts of Appeals won’t have time for anything else but immigration review.

In my view, that’s likely to provoke two responses from the Article III Courts. First, the Circuits will start imposing their own minimum due process and legal sufficiency requirements on the Immigration Courts. But, since there are eleven different Circuits now reviewing immigration petitions, that’s likely to result in a hodgepodge of different criteria applicable in different parts of the country. And, the Supremes have neither the time nor ability to quickly resolve all Circuit conflicts.

Second, many, if not all Courts of Appeals, are likely to return the problem to the DOJ by remanding thousands of cases to the Immigration Courts for “re-dos” under fundamentally fair procedures. Obviously, that will be a massive waste of time and resources for both the Article III Courts and the Immigration Courts. It’s much better to do it right in the first place. “Haste makes waste.”

No matter where one stands in the immigration debate, due process and independent decision making in the U.S. Immigration Courts should be a matter of bipartisan concern and cooperation. After all, we are a constitutional republic, and due process is one of the key concepts of our constitutional system.

“Then came Trump’s address before Congress, and his true intentions were revealed. His talk of immigration reform, we now know, was just that: Talk. At best, his earlier statements about immigration reform were a publicity stunt designed to gin up interest (and ratings, which Trump is obsessed with) in his speech. At worst, this bait-and-switch was a cruel hoax perpetrated on millions of undocumented people who might have briefly hoped for a reprieve from possible deportation.
In fact, Trump’s speech offered little meaningful policy on immigration, beyond conflating immigrants with crime and misrepresenting key facts underlying illegal immigration. Tellingly, there was no mention of offering legalization to anyone.

Yes, such reform is possible, but it is unlikely Trump will expend any political capital making it happen. He was elected by a base that is fervently opposed to anything resembling “amnesty.” He has surrounded himself with advisers like white nationalist champion Steve Bannon, the xenophobic Stephen Miller, and Attorney General Jeff Sessions, who wants curbs on legal immigration.”

“One night in September 2014, when he was chief executive of Breitbart News, Stephen Bannon hosted cocktails and dinner at the Washington townhouse where he lived, a mansion near the Supreme Court that he liked to call the Breitbart Embassy. Beneath elaborate chandeliers and flanked by gold drapes and stately oil paintings, Jeff Sessions, then a senator from Alabama, sat next to the guest of honor: Nigel Farage, the insurgent British politician, who first met Sessions two years earlier when Bannon introduced them. Farage was building support for his right-wing party by complaining in the British press about “uncontrolled mass immigration.” Sessions, like other attendees, was celebrating the recent collapse in Congress of bipartisan immigration reform, which would have provided a path to citizenship for some undocumented people. At the dinner, Sessions told a writer for Vice, Reid Cherlin, that Bannon’s site was instrumental in defeating the measure. Sessions read Breitbart almost every day, he explained, because it was “putting out cutting-edge information.”

Bannon’s role in blocking the reform had gone beyond sympathetic coverage on his site. Over the previous year, he, Sessions and one of Sessions’s top aides, Stephen Miller, spent “an enormous amount of time” meeting in person, “developing plans and messaging and strategy,” as Miller later explained to Rosie Gray in The Atlantic. Breitbart writers also reportedly met with Sessions’s staff for a weekly happy hour at the Union Pub. For most Republicans in Washington, immigration was an issue they wished would go away, a persistent source of conflict between the party’s elites, who saw it as a straightforward economic good, and its middle-class voting base, who mistrusted the effects of immigration on employment. But for Bannon, Sessions and Miller, immigration was a galvanizing issue, lying at the center of their apparent vision for reshaping the United States by tethering it to its European and Christian origins. (None of them would comment for this article.) Talk about “the fox guarding the chicken coop!” And, I don’t share Bazelon’s view that DOJ career attorneys will be a significant moderating influence.

They all work for Jeff Sessions. Resisting Administration policies or positions could be considered insubordination — a ground for firing. Short of that, those who don’t “get with the program” could find themselves demoted, denied pay increases, transferred to obscure offices (perhaps in different locations), or given meaningless “busywork” assignments as punishment. In  DOJ lingo the disfavored and exiled are known as “hall walkers.”

Yes, it’s true that in many past Administrations those with opposing views were tolerated and often even had their differing perspectives considered and occasionally adopted. That often had a moderating effect. But, that assumes an Administration acting in good faith. Sounds like Sessions and his colleagues have already decided to dismantle those parts of the U.S. justice system that don’t fit their ultra nationalist, restrictionist, white-power-Christian-oriented agenda. It could be a long four years at the DOJ for career lawyers (those who survive). Sad!

Shocker — Is Trump’s Immigration Policy About To Take a More Pragmatic Turn? — Proposal For Reform Legislation Allowing Many To Stay In The Offing?

“WASHINGTON — President Trump, signaling a potential major shift in policy, told news anchors on Tuesday that he is open to a broad immigration overhaul that would grant legal status to millions of undocumented immigrants who have not committed serious crimes.

“The time is right for an immigration bill as long as there is compromise on both sides,” the president told the TV anchors at the White House, according to people present during the discussion. The people requested anonymity because they were not authorized to speak about the private meeting.

The idea is a sharp break from the broad crackdown on undocumented immigrants that Mr. Trump has taken in his first weeks in office and the hardline positions embraced by his core supporters that helped sweep him into the White House. The president hinted at the reversal just hours before he was to deliver his first address to Congress, although it was not clear whether he would mention it in his speech.
A move toward a comprehensive immigration overhaul would be a dramatic turnaround for the president, whose campaign rallies rang with shouts of “build the wall!” on the Mexican border and who signed an executive order last month directing the deportation of any undocumented immigrant who has committed a crime — whether or not they have been charged — or falsified any document. The standard could apply to virtually any one of the estimated 11 million people in the country illegally.”

This report was published before the President’s speech to Congress tonight. We might, or might not, get more details in the speech.

Reaching a compromise on immigration would be “smart governing” by the Administration. It would push most of the responsibility for formulating sound immigration policy back where it belongs — Congress.  Additionally, reform that allows those undocumented individuals with good records to remain in the United States could potentially clear much of the backlog of the overwhelmed U.S. Immigration Courts, thereby clearing the way for the Administration to work on its “criminal priorities” and for the Immigration Courts to concentrate on providing full due process to those placed in the removal process.

“He also pressed his policies on immigration, including his controversial proposal to build a wall along the U.S.-Mexico border.

“We want all Americans to succeed —- but that can’t happen in an environment of lawless chaos. We must restore integrity and the rule of law at our borders,” said Trump. “For that reason, we will soon begin the construction of a great wall along our southern border. It will be started ahead of schedule and, when finished, it will be a very effective weapon against drugs and crime.”

Trump challenged members of Congress who disagree with him: “I would ask you this question: what would you say to the American family that loses their jobs, their income, or a loved one, because America refused to uphold its laws and defend its borders?”

He did call for Republicans and Democrats to work toward reforming the immigration system into a merit-based program focused on the “well-being of American citizens.”

Trump argued that the country’s current focus on low-skilled immigration hurts American workers and strains the country’s finances.

The comments come hours after Trump said in a meeting with journalists that he would support comprehensive immigration reform efforts with a pathway to legalization for law abiding immigrants.
At his remarks before Congress, Trump did not specify the parameters of a compromise he would be willing to accept. But he outlined a preference for a system that favors immigrants who are able to support themselves financially.

“I believe that real and positive immigration reform is possible, as long as we focus on the following goals: to improve jobs and wages for Americans, to strengthen our nation’s security, and to restore respect for our laws,” Trump said.”

“ARLINGTON, Va. — In a small, windowless courtroom on the second floor of an office building, Judge Rodger Harris heard a string of bond requests on Tuesday morning from immigrants held in jail as they faced deportation.
The detainees appeared by video from detention facilities elsewhere in the state. Harris, an immigration judge since 2007, used a remote control to move the camera around in his courtroom so the detainees could see their lawyers appearing in-person before the judge, if they had one. The lawyers spoke about their clients’ family ties, job history, and forthcoming asylum petitions, and downplayed any previous criminal record.
In cases where Harris agreed to set bond — the amounts ranged from $8,000 to $20,000 — he had the same message for the detainees: if they paid bond and were set free until their next court date, it would mean a delay in their case. Hearings set for March or April would be pushed back until at least the summer, he said.
But a couple of months is nothing compared to timelines that some immigration cases are on now. Judges and lawyers interviewed by BuzzFeed News described hearings scheduled four, five, or even six years out. Already facing a crushing caseload, immigration judges are bracing for more strain as the Trump administration pushes ahead with an aggressive ramp-up of immigration enforcement with no public commitment so far to aid backlogged courts.
Immigration courts, despite their name, are actually an arm of the US Department of Justice. The DOJ seal — with the Latin motto “qui pro domina justitia sequitur,” which roughly translates to, “who prosecutes on behalf of justice” — hung on the wall behind Harris in his courtroom in Virginia. Lawyers from the US Department of Homeland Security prosecute cases. Rulings can be appealed to the Board of Immigration Appeals, which is also part of the Justice Department, and then to a federal appeals court.
As of the end of January, there were more than 540,000 cases pending in immigration courts. President Trump signed executive orders in late January that expanded immigration enforcement priorities and called for thousands of additional enforcement officers and border patrol officers. But the orders are largely silent on immigration courts, where there are dozens of vacant judgeships. And beyond filling the vacancies, the union of immigration judges says more judges are needed to handle the caseload, as well as more space, technological upgrades, and other resources.
Homeland Security Secretary John Kelly acknowledged the immigration court backlog in a memorandum released this week that provided new details about how the department would carry out Trump’s orders. Kelly lamented the “unacceptable delay” in immigration court cases that allowed individuals who illegally entered the United States to remain here for years.
The administration hasn’t announced plans to increase the number of immigration judges or to provide more funding and resources. It also isn’t clear yet if immigration judges and court staff are exempt from a government-wide hiring freeze that Trump signed shortly after he took office. There are 73 vacancies in immigration courts, out of 374 judgeships authorized by Congress.
“Everybody’s pretty stressed,” said Paul Schmidt, who retired as an immigration judge in June. “How are you going to throw more cases into a court with 530,000 pending cases? It isn’t going to work.”
