The last time Sandra Rodríguez saw her son Gerson, she bent down to look him in the eye. “Be good,” she said, instructing him to behave when he encountered Border Patrol agents on the other side of the river in the United States, and when he was reunited with his uncle in Houston.

The 10-year-old nodded, giving his mother one last squinty smile. Tears caught in his dimples, she recalled, as he climbed into a raft and pushed out across the Rio Grande toward Texas from Mexico, guided by a stranger who was also trying to reach the United States.

Ms. Rodríguez expected that Gerson would be held by the Border Patrol for a few days and then transferred to a government shelter for migrant children, from which her brother in Houston would eventually be able to claim him. But Gerson seemed to disappear on the other side of the river. For six frantic days, she heard nothing about her son — no word that he had been taken into custody, no contact with the uncle in Houston.

Finally, she received a panicked phone call from a cousin in Honduras who said that Gerson was with her. The little boy was crying and disoriented, his relatives said; he seemed confused about how he had ended up back in the dangerous place he had fled.

Hundreds of migrant children and teenagers have been swiftly deported by American authorities amid the coronavirus pandemic without the opportunity to speak to a social worker or plea for asylum from the violence in their home countries — a reversal of years of established practice for dealing with young foreigners who arrive in the United States.

The deportations represent an extraordinary shift in policy that has been unfolding in recent weeks on the southwestern border, under which safeguards that have for decades been granted to migrant children by both Democratic and Republican administrations appear to have been abandoned.

Historically, young migrants who showed up at the border without adult guardians were provided with shelter, education, medical care and a lengthy administrative process that allowed them to make a case for staying in the United States. Those who were eventually deported were sent home only after arrangements had been made to assure they had a safe place to return to.

That process appears to have been abruptly thrown out under President Trump’s latest border decrees. Some young migrants have been deported within hours of setting foot on American soil. Others have been rousted from their beds in the middle of the night in U.S. government shelters and put on planes out of the country without any notification to their families.

The Trump administration is justifying the new practices under a 1944 law that grants the president broad power to block foreigners from entering the country in order to prevent the “serious threat” of a dangerous disease. But immigration officials in recent weeks have also been abruptly expelling migrant children and teenagers who were already in the United States when the pandemic-related order came down in late March.

Since the decree was put in effect, hundreds of young migrants have been deported, including some who had asylum appeals pending in the court system.

Some of the young people have been flown back to Central America, while others have been pushed back into Mexico, where thousands of migrants are living in filthy tent camps and overrun shelters.

In March and April, the most recent period for which data was available, 915 young migrants were expelled shortly after reaching the American border, and 60 were shipped home from the interior of the country.

During the same period, at least 166 young migrants were allowed into the United States and afforded the safeguards that were once customary. But in another unusual departure, Customs and Border Protection has refused to disclose how the government was determining which legal standards to apply to which children.

“We just can’t put it out there,” said Matthew Dyman, a public affairs specialist with the agency, citing concerns that human smugglers would exploit the information to traffic more people into the country if they knew how the laws were being applied.

On Tuesday, the Trump administration extended the stepped-up border security that allows for young migrants to be expelled at the border, saying the policy would remain in place indefinitely and be reviewed every 30 days.

Chad F. Wolf, the acting secretary of the Department of Homeland Security, said the policy had been “one of the most critical tools the department has used to prevent the further spread of the virus and to protect the American people, D.H.S. front-line officers and those in their care and custody from Covid-19.”

An agency spokesman said its policies for deporting children from within the interior of the country had not changed.

Kids suffer, the law is ignored, corrupt bureaucrats like Chad Wolf continue to wander around spreading lies. There is no evidence that any of those kids “rocketed” out of the country in violation of laws and human rights had coronavirus. 

And if they did, returning them to a poorer nation with even fewer resources to fight the pandemic without taking proper precautions and safeguards would be totally irresponsible, inhumane, and ultimately counterproductive. What goes around, comes around! 

This has absolutely nothing to do with “protecting” the U.S. from coronavirus (something that Trump otherwise largely eschews) and everything to do with advancing a racist, xenophobic, White Nationalist political agenda designed to appeal to a relatively narrow slice of Trump voters. So, how does this pass “legal muster?” Clearly, “It doesn’t!”

How do folks like Trump, Miller, Wolf, and their accomplices get away with it? Easy when GOP legislators and life-tenured Federal Judges look the other way rather than forcing the regime to comply with the rule of law and simple human decency. 

Congressional letters, particularly to a lawless regime, are useless unless accompanied by veto-proof legislation. Courts that fail to take a unified “Just Say No” approach to Trump’s systemic abuses, all the way up to the Supremes, and which rule without holding the officials and lawyers masterminding these abuses legally accountable are basically feckless! 

These are not difficult questions from either a legal or moral standpoint. What the Administration is doing is wrong! Period! Those who say otherwise are wrong! Period!

The Trump regime disguises their vicious attacks on human dignity and the rule of law as bogus “legal issues.” And, the Federal Courts encourage them by going along with the charade. This is no “normal Executive.” It’s a “rogue regime” and must be treated as such!

The failure to end these disgraceful practices and hold those who are abusing their authority accountable says much about the current state of our democratic institutions, justice system, civil servants, and the inadequacy and moral complacency of many of our current GOP legislators and Federal Judges.

This November, vote like your life and your humanity depends on it! Because it does!

WASHINGTON — Several immigrant rights organizations are outraged by a new choice U.S. Immigration and Customs Enforcement is presenting to migrant parents: Separate from your child or stay together in detention indefinitely.

Starting on Thursday, the groups claim, ICE began distributing a form in all three of its family detention centers that would allow parents to apply for their minor children to be released. The form, a copy of which was obtained by NBC News, states that it is in compliance with the Flores court agreement, which prohibits ICE from holding minors for more than 20 days.

The released children are placed with family members, sponsors or placed in the custody of the Department of Health and Human Services.

The Trump administration faced intense criticism for a Zero Tolerance policy in 2018 in which undocumented migrant children were separated from parents who had illegally crossed the order. The policy was implemented in May 2018 but reversed after an outcry in June.

The current, “voluntary” concept was previously termed “binary choice,” but has never been fully implemented. Now, lawyers representing clients in ICE family detention say parents may be persuaded to separate from their children if they are worried about exposing them to COVID-19 in detention.

The timing is no coincidence, said Shayln Fluharty, director of the Dilley Pro Bono Project, which provides legal services for families in detention in Dilley, Texas. A federal judge recently told ICE it was not in compliance with the Flores agreement, and the forms, said Fluharty, are a way for ICE to show that these parents have chosen to keep their children in detention.

Just another “in your face” unlawful move by DHS officials sending a strong message of contempt to the Federal Judges handling various aspects of the regime’s intentional child abuse, family separation, and punishing asylum seeking families by needless imprisonment in the New American Gulag (“NAG”).

 

Yes, the District Court Judges handling these matters have ordered the Government to take various forms of corrective action. But, even where the judges use forceful language, it’s largely ineffective to change illegal policies. The regime and its officials just play “hide the ball” and develop schemes and “work arounds” to violate the law and court orders in other ways. That they continue to do this over and over – a strategy known as “malicious compliance” – shows their total disrespect for the Federal Courts and that they share Trump and Miller’s belief that they are above the law.

 

So far, particularly in the immigration and refugee area, the scofflaws have largely prevailed. They have dismembered immigration and asylum laws with neither legislative enactments nor meaningful judicial consequences. They have publicly and arrogantly “thumbed their noses” at court orders they don’t like. Unless and until the Federal Judges back up their orders by holding Chad Wolf and other scofflaw officials in contemptreal contempt – jail time not just meaningless fines – the abuse and the open disregard for the rule of law and for the authority of Federal Judges will continue.

 

The law, our Constitution, and human rights will continue to be mocked. Even the best of Federal Judges will appear feckless unless and until they start treating immigration officials as the lawless criminals they actually are!

 

Undoubtedly, some of the children and families intentionally being abused, dehumanized, and punished  by the Trump regime as Federal Courts play bystander won’t survive long enough to tell their stories. But, some will. While those officials, legislators, and judges enabling, or in some cases masterminding and encouraging, these abuses appear likely to escape “temporal” legal accountability for their actions, moral and historical accountability are a different matter altogether. Lots of folks who believe they are “operating under the radar screen” are going to look very bad when the light of history shines on the grotesque human rights, moral, and constitutional violations at our borders and in our Gulags and those who carried them out or failed to effectively halt them.

The lesson of this case: The DHS intentionally puts superfluous information on its form NTA so it doesn’t make any difference whether they fill it in or not. The BIA is there to “fill in the blanks” and help their DHS buddies rack up maximo removals, preferably without in person hearings because it’s faster and helps fulfill “quotas,” under the Let ‘Em Die in Mexico Program (a/k/a “jokingly” as the “Migrant ‘Protection’ Protocols” (“MPP”) — which, of course, serve to intentionally endanger and discourage, not protect, asylum seekers). 

This follows Matter of J.J. Rodriguez where the BIA found that the DHS wasn’t required to put a usable mailing address for the respondent on the NTA. I can only imagine what would have happened in the Arlington Immigration Court if a respondent had given me “Fairfax County, Virginia, USA” as his one and only address! The former is actually probably a “better” address than “Known Domicile, Tijuana, Baja California, Mexico” which was used in this case. What a farce! But, of course, it’s not very funny when it’s your life, or that of a loved one or client that is going down the tubes☠️.

There actually is an old legal axiom of construing problems against the drafter of a document, particularly when the drafter is in a more powerful position than the recipient. It even has a fancy legal name: Contra proferentem. But, today’s EOIR follows a much simpler maxim: The respondent always loses, particularly in precedent decisions.

I suppose at some point the BIA will be called upon to enter an in absentia removal order in a case where the NTA is blank except for the respondent’s name. I have no doubt, however, that they will be “up to the job.”

To his credit, Judge Edward Kelly entered a brief “concurring opinion” specifically noting that the statutory or constitutional authority for the so-called MPP was not at issue. In plain terms, that means, thanks in large measure to a complicit Supremes’ majority, even if that program, certainly a illegal and unconstitutional hoax, were later found to be unconstitutional, it would be far too late for those already removed, extorted, kidnapped, maimed, tortured, sickened 🤮, or dead ⚰️ thereunder. But, of course, the BIA, like Trump himself, will take no responsibility for any of the deadly fallout of their actions.

Great way to run a government! But, it’s the “New America” under Trump. Most of those in a position to stop the abuse merely shrug their shoulders, look the other way, and plug their ears so as not to have their serenity and complicity, as well as their paychecks, bothered by the screams and fruitless pleas of the abused. Except, of course, for true sadists ☠️ like Stephen Miller and his White Nationalist cronies 🏴‍☠️ who actually “get off” on the death, ⚰️ torture, abuse, and suffering of “others” they believe to be of “inferior stock” and therefore deserving of dehumanization and death⚰️.

Apparently, the “Tower Rumor Mill” @ EOIR HQ says that Acting Chief Immigration Judge Christopher Santoro will soon be replaced by a permanent Chief Immigration Judge hand selected from among DOJ political hacks by none other than one of the American taxpayers’ most highly paid, unelected White Nationalists, White House Advisor Stephen Miller. The name of Gene Hamilton, like Miller an uber restrictionist former sidekick of “Gonzo Apocalypto” Sessions, still kicking around the DOJ, has been bandied about. However, other parts of the “rumor mill” have expressed skepticism about whether Hamilton really wants the job. He might be able to score more “kills” from his current job, whatever it is.

For more than a month, under the guise of fighting the coronavirus, the Trump administration has used the nation’s public health laws as a pretext for summarily deporting refugees and children at the border.

This new border policy runs roughshod over legal rights, distracts from meaningful measures to prevent spread of the coronavirus and undermines confidence in the Centers for Disease Control and Prevention, the nation’s top health protection agency, which delivered the directive that imposes these deportations.

The administration has weaponized an arcane provision of a quarantine law first enacted in 1893 and revised in 1944 to order the blanket deportation of asylum-seekers and unaccompanied minors at the Mexican border without any testing or finding of disease or contagion. Legal rights to hearings, appeals, asylum screening and the child-specific procedures are all ignored.

More than 20,000 people have been deported under the order, including at least 400 children in just the first few weeks, according to the administration and news reports. Though the order was justified as a short-term emergency measure, the indiscriminate deportations continue unchecked and the authorization has been extended and is subject to continued renewal.

The deportation policy was issued by the C.D.C. based on an unprecedented interpretation of the public health laws. The policy bears the unmistakable markings of a White House strategy imposed on the C.D.C. and designed to circumvent prior court rulings to achieve the administration’s political goals.

The Border Patrol is carrying out the C.D.C. directive by “expulsion” of anyone who arrives at U.S. land borders without valid documents or crosses the border illegally, not because they are contagious or sick but because they come from Mexico or Canada, regardless of their country of origin. The deportations violate the legal right to apply for asylum and ignore the special procedures for unaccompanied children.

Our immigration laws guarantee that any noncitizen “irrespective” of status, no matter how they arrive, is entitled to an asylum process. U.S. law has adopted the international obligation that refugees cannot be returned “in any manner whatsoever” to a place where they risk persecution. The courts have protected these rights again and again. When the administration tried to impose an asylum ban more than a year ago, the U.S. Court of Appeals for the Ninth Circuit blocked it, calling it an “end-run” around Congress, a decision the Supreme Court refused to overturn.

Now, with the C.D.C. directive, the administration is imposing an even more sweeping prohibition on asylum by exploiting pandemic fears, and U.S. Border and Customs Protection is labeling the policy a public health “expulsion” instead of an immigration deportation.

Despite what the administration says, the order is not part of any coherent plan to stop border travel or prevent introduction or spread of contagious people or the virus, which is already widespread in the United States. Nothing limits travel from Mexico or Canada by truck drivers, those traveling for commercial or educational purposes, and many others, including green card holders and U.S. citizens. And the restrictions that exist do not apply at all to travel if it’s by airplane.

The administration’s order expelling refugees and children tarnishes the C.D.C., does nothing to protect public health, targets the most vulnerable, tramples their rights and cloaks the deportations as fighting the coronavirus in order to escape accountability. “Flattening the curve” should not be an excuse for dismantling the law.

While the authors quite legitimately “out” the CDC for its corrupt performance, the real problem here goes much higher and cuts much more broadly across our failing democratic institutions of government. A feckless Congress, under the control of Moscow Mitch and the GOP, and the “J.R. Five” on the Supremes have given the “green light” to the Trump regime’s White Nationalist assault on the rights of asylum seekers and migrants. It’s “Dred Scottification” at its worst, and it threatens the continued existence of our nation and the lives and well-being of many of our fellow Americans.

Why is it only the four “moderate to liberal” justices that have an obligation to cross over and help the conservatives, Charlie, my man? Where was Chief Justice Roberts when the regime carried out the “Miller White Nationalist plan” running roughshod over decades of well-established legal and constitutional rights of refugees, asylum seekers, children, and other migrants, using  rationales so thin, fabricated, and totally dishonest that most high school civics students could have seen right through them. How does a bogus Immigration “Court” system run by uber partisan politicos like Jeff “Gonzo Apocalypto” Sessions and now Billy Barr come anywhere close to complying with the Due Process Clause of the Fifth Amendment?

Pretending like the Supremes aren’t a broken, politicized institution won’t help fix the problem. Even “regime change” in November won’t get the job done overnight. 

The damage is deep, severe, life-tenured, and ultimately life-threatening. But, insuring that corrupt kakistocrats like Trump and Mitch won’t be in charge of future appointments to the Supremes and rest of the Federal Judiciary is an essential starting place. 

A failure to vote this regime out of office in November likely spells the end of American democracy, at least as the majority of us have lived and understand it. And, even though they obviously, and arrogantly, believe themselves to be above the fray and accountability for their actions, the “J.R. Five” eventually would go down in the heap with the rest of our nation.

If nothing else, Trump has made it very clear that HE is the only “judge” he needs, wants, or will tolerate. We have only to look as far as the failed and flailing Immigration “Courts” under Billy Barr to see what the “ideal Trump judiciary” would look and act like.

This November, vote like your life depends on it. Because it does!

The Pulitzer judges cited O’Toole and Vice freelancer Emily Green for “The Out Crowd,” broadcast on NPR’s “This American Life,” for “revelatory, intimate journalism that illuminates the personal impact of the Trump administration’s ‘Remain in Mexico’ policy.”

O’Toole, 33, had covered immigration and border security for a decade and decided to look closely at a new policy targeting asylum seekers, not just people who had illegally crossed the border.

She found veteran asylum officers deeply troubled by directives that in effect forced them to push many Mexican and Central American immigrants back to deadly violence in their home countries.

“The officers felt very strongly about refugee asylum and the idea of the U.S. as a safe haven,” she said. “Now they were taking part in a policy that they felt was wrong, morally and legally. But they had few choices, either continue being part of this administration or quit and lose their career.”

Audio reporting is a new Pulitzer category in 2020.

They arrive 24 hours a day in the Mexican border city of Reynosa, groups of men, women and children deported by the United States. Each time, at the edge of the international bridge, Ricardo Calderón Macias and his team get ready.

They put on masks and gloves. They prepare their thermometers and health forms. They wonder, sometimes aloud: Will anyone in this group test positive?

“We’re worried that eventually, with these deportations, we’re all going to get infected,” said Calderón, the regional director of the Tamaulipas state immigration institute.

Since the coronavirus struck the United States, immigration authorities have deported dozens of infected migrants, leaving governments and nonprofits across Mexico, Central America and the Caribbean struggling to respond.

When some countries resisted continued deportations, U.S. officials said they would screen migrants slated for removal. But they did not commit to administering coronavirus tests. In many instances, the screenings, which consist primarily of taking a person’s temperature, have failed to detect cases. Even though overall deportations declined this month, the United States has returned thousands of people across the Western Hemisphere in April.

President Trump said late Monday he would “suspend immigration” to the United States. Even before that announcement, officials in the region were concerned about the deportations. Guatemala’s health minister spoke this month of the worrying number of infected deportees sent from the United States — the “Wuhan of the Americas,” he said.

Mexico’s Tamaulipas state, across the Rio Grande from the southern tip of Texas, is receiving roughly 100 deportees per day, officials there say. In some cases, repatriation workers have noticed that deportees are visibly sick as they arrive. Those deportations are blamed for at least one new outbreak in a Mexican migrant shelter.

On Monday, the Mexican government asked the U.S. Department of Homeland Security to test deportees for the virus, but DHS has not committed to doing so, according to a Mexican official with knowledge of the conversations who spoke on the condition of anonymity to describe diplomatic talks.

In Guatemala, at least 50 deportees have tested positive, about 17 percent of the country’s total confirmed cases. Three-quarters of passengers on a deportation flight to Guatemala City last month were infected, according to the country’s Health Ministry. Guatemalan officials said last week they would suspend returns from the United States.

In Haiti, the poorest country in the Western Hemisphere, three people sent back from the United States in early April have tested positive, officials said. The country has 62 ventilators for 11 million people. The Trump administration reportedly was planning another deportation flight to Haiti this week.

“Rather than be deported where they face serious harm if they fall ill and risk infecting thousands of others, they should be released from detention into the care of their friends and families so that they may safely quarantine,” a coalition of 164 human rights and religious organizations said in an open letter pleading for suspension of deportations.

In Mexico over the past week, two deportees tested positive for the virus. Calderón’s team spotted a deportee in Reynosa who was visibly ill, with a dry cough, red eyes and a fever. They wondered how the man, who arrived from Atlanta, had made it through U.S. health screenings.

A second man was deported to Nuevo Laredo from Houston “without knowing he was a carrier of the virus,” the Tamaulipas state government said in a statement, and was sent to a migrant shelter in the city.

That case apparently prompted an outbreak in the shelter, Casa del Migrante Nazareth; 14 others have since tested positive.

“The risk we face is bringing a massive contagion into our own country,” said Raúl Cardenas, the city manager of Nuevo Laredo. “We’re mortified that these deportations are continuing.”

MEXICO CITY — More than half the deportees flown back to Guatemala by U.S. immigration authorities have tested positive for coronavirus, the top Guatemalan health official said Tuesday.

Speaking to reporters in Guatemala City, Hugo Monroy, the minister of health, did not specify a time frame or the total number of deportees who had arrived home with infections.

But hundreds of Guatemalans have been returned in recent weeks, including 182 who arrived Monday on two flights from Texas.

Monroy said that on one flight — which he declined to identify — more than 75% of the deportees tested positive.

But he made clear this was not an isolated incident and said many deportees arrived with fevers and coughs and were immediately tested.

“We’re not just talking about one flight,” he said. “We’re talking about all the flights.”

In video later released by the government, Monroy contradicted his earlier statements and said he was referring to just one flight.

The Guatemalan Foreign Ministry said through a spokesman Tuesday that the “official” number of deportees diagnosed with COVID-19 is four, including one who arrived on one of the flights Monday.

A high number of infections among deportees would cast doubt on the official tally of how many of the more than 33,000 migrants in U.S. detention are infected. U.S. immigration officials have said that 77 have tested positive, noting that some of those may no longer be in custody.

The U.S. Department of Homeland Security did not respond to requests for comment.

For four decades, the U.S. has been deporting its problems to the poorest and most unstable countries in Central America. Gangs such as MS-13 and the 18th Street Gang actually originated in Los Angeles and were “exported” to Central America. Once there, they flourished, grew more powerful, became “de facto governments” in some areas, and instituted a reign of terror and persecution that sent hundreds of thousands of new refugees fleeing north to the United States over the years.

Now, Trump and his cronies once again believe that often illegal and irresponsible deportations to the Northern Triangle countries will allow us to escape accountability. But, it won’t. 

Irresponsibly spreading disease in poor countries where public health services are dismal at best will eventually have consequences throughout the Americas. And, we will not be immune from the long-term effects of empowering the Trump kakistocracy and its White Nationalist cronies. What goes around come around. The Trump administration has carried out nearly 10,000 summary deportations or “expulsions” since March 21, using emergency public health measures that have given U.S. Customs and Border Protection broad authority to bypass immigration laws, CBP officials said Thursday.

The measures have allowed the agency to quickly turn away most unauthorized migrants —  sending them back across the Mexican border. The moves have dramatically slashed the number of detainees held in border stations, where they fear the coronavirus could spread, the officials said. CBP currently has fewer than 100 detainees in custody, down from nearly 20,000 at this time last year during last year’s border crisis, officials said.

Since the implementation of the rapid expulsions, unlawful border crossings have dropped 56 percent, said acting CBP commissioner Mark Morgan. Morgan also acknowledged that the United States has all but closed its borders to asylum seekers who are fleeing persecution, including those who attempt to enter legally at U.S. ports of entry.

“Those who are undocumented or don’t have documents or authorization are turned away,” Morgan said.

Democratic lawmakers have accused the administration of defying U.S. laws and exceeding the authority of the coronavirus public health order, but Morgan defended the emergency measures as a necessary step to stop the spread of the disease.

“This is not about immigration,” Morgan said. “This is about public health. This is about putting forth aggressive mitigation and containment strategies.”

CBP said the number of migrants detained at the border fell to 33,937 in March, down 7 percent from February. Single adults from Mexico accounted for 70 percent to 75 percent of those taken into custody, and most of the remainder were from Central America’s Northern Triangle countries: Guatemala, El Salvador and Honduras.

The Mexican government has agreed to accept the rapid return of migrants from those nations at the border under an agreement reached with the Trump administration last month.

The recent expulsions include children who would otherwise be protected from rapid removal by U.S. anti-trafficking laws. Since the emergency order took effect, the United States has expelled nearly 400 underage migrants, according to the most recent tally by the Reuters news agency. The minors were released into Mexico or boarded onto planes and flown back to Central America without being transferred to the care of the U.S. Department of Health and Human Services.

It’s going to take more than a letter from Sen. Pat Leahy (D-VT) and other Dems to restore the Constitution and the rule of law. Indeed, with the help of J.R. and his Trumpist GOP majority on the Supremes, I would expect that asylum laws, like voting rights, Due Process, and other individual rights will remain a “dead letter” until we get both 1) regime change; and 2) reform in the appointment of Article III Judges.

There is little, if any, data right now to support the view that asylum seekers at the Southern Border have been a significant source for the initial spread of coronavirus in the U.S.; however, their arbitrary removal to other countries might have helped the worldwide spread of the disease.

Moreover, as COVID-19 spreads into the Gulag and the Immigration Courts from the rest of America, infections in those locations could help spread the virus, given the lawyers, Government employees, and contractors exposed at those dangerous locations. Nor were Asian Americans responsible.

We do, however, have some data to show that U.S. citizens and other travelers returning from Europe were inadvertently a source of the virus’s spread in New York, and that Trump’s ineptness and failure to heed early warnings contributed to the spread.

Who are these immigration judges? What exactly is detained court? And how is it able to get away with operating outside of what we might call normal law?

Disturbing and infuriating as Sam’s podcast is, I urge everyone to listen, even if you think you know what “really happens” in this godforsaken and deadly “darkest corner of the American ‘justice’ system.” Is this really the way we want to be remembered by generations that follow? As a country with so little collective courage and integrity that we allowed our fellow human beings to be treated this way? Think about it!

Even in this grimmest of worlds, their are true heroes. First and foremost, of course, are  the dedicated attorneys of the New Due Process Army (“NDPA”), many working pro bono or “low bono” to vindicate essential legal, constitutional, and human rights in a system designed to grind them into dust and “dehumanize and demonize the other.” 

Sound familiar? It should to anyone who studied Hitler’s rise to power in Germany. By and large, it wasn’t the “Brown Shirts” and the party faithful who enabled his rule. It was judges, lawyers, ministers, priests, businessmen, doctors, corporate moguls, and the average German who “facilitated” his annihilation of millions. 

And, it started gradually, with laws stripping Jews of citizenship, property, and all legal rights and judges who enthusiastically enforced them, even against their own former judicial colleagues. Once people aren’t “humans” any more (Hitler liked the term “subhumans”) or “persons” before the law, there is no limit to what can be done, particularly when complicit judges join in the “fun and games.”

At a time when too many with knowledge of the travesty of what’s going on in our “Star Chambers” have chosen to look the other way or “go along to get along,” Ilyce and Ashley have consistently “spoken truth to power” in the face of a regime that often abuses its authority by punishing truth, honesty, and decency. Indeed, Billy Barr’s highly unethical move to “decertify” the NAIJ is a blatant attempt to punish and silence Ashley for revealing the truth.

One minor correction. Sam says that the Immigration Judges and the prosecutors both work for the DOJ. Actually, the prosecutors work for DHS. But, it’s largely a “distinction without difference” because the agenda at both DOJ and DHS is set by Trump, Miller, and the rest of the White Nationalist nativist cabal.

Indeed, former AG Sessions told Immigration Judges they were “partners” with the DHS prosecutors in enforcing immigration laws. So, the observation that in many Immigration Courtrooms migrants, including the unrepresented and children, face “two prosecutors” — the “judge” and the DHS Assistant Chief Counsel is accurate. The podcast relates how in some courts the “judge speaks for the prosecution,” the Assistant Chief Counsel is a “potted plant,” and nobody speaks for justice or the rights of the migrants. What’s missing: The impartial “neutral decisionmaker” required by the Due Process Clause of the Fifth Amendment to the Constitution.

WASHINGTON  —  The U.S. and Mexico have agreed to restrict all nonessential travel across their shared border in an effort to slow the spread of the coronavirus, President Trump said Friday, adding that he was invoking the Defense Production Act to increase output of badly needed medical supplies.

The tax filing deadline has been extended from April 15 to July 15, Trump added at the news conference, noting that people who have refunds due can still file early.

“Both our countries know the importance of working together to limit the spread of the virus and to ensure the commerce that supports both our economies keeps flowing,” Secretary of State Michael R. Pompeo said after announcing the agreement with Mexico. The new restrictions will take effect on Saturday, he said.

The U.S. and Mexico were in discussions to ensure that workers, including legal agricultural workers, could continue to cross the border for their jobs, Pompeo said, noting that the aim was not to interfere with commerce.

Under the new rules, the Border Patrol will begin returning all undocumented immigrants directly to Mexico or Canada when they are caught at the border, rather than detaining them in the U.S., said Chad Wolf, acting secretary of Homeland Security.

Seems to me that the regime has been dumping and orbiting folks back across the border without any due process for some time now. So, can anybody explain what’s different about what they are doing now — except to promote the false implication that asylum seekers are responsible for the spread of the pandemic and that summarily removing them somehow ”solves a problem” or makes us “safer?”

Actually, what’s endangering our health is 1) gross lack of testing capacity; and 2) lack of a strong, clearly articulated, consistent, coordinated national response by the Feds. Neither has anything to do with asylum seekers. Indeed, had the regime not wasted so much time, attention, manpower, and money on focusing DHS almost exclusively on turning back bona fide asylum seekers, we likely would have been able to put together a better response to the real national emergency we now face.

GUATEMALA CITY — Guatemala on Tuesday became the first Central American nation to block deportation flights from the United States in an effort to prevent the spread of the coronavirus, a dramatic turnabout on Trump administration policies barring entry to asylum seekers from the region.

Guatemala’s Foreign Ministry announced that all deportation flights would be paused “as a precautionary measure” to establish additional health checks. Ahead of the announcement, President Alejandro Giammattei said in a Monday news conference that Guatemala also would close its borders completely for 15 days.

“This virus can affect all of us, and my duty is to preserve the lives of Guatemalans at any cost,” he said.

Guatemala, a major source of migration to the United States as well as a primary transit country for people from other nations headed to the U.S.-Mexico border, in recent days has blocked travelers from the U.S., as well as arrivals from Canada and a few European and Asian countries.

The Guatemalan government under Giammattei’s new administration had confirmed six coronavirus cases as of Monday morning. But it has taken a hard tack in its response to the pandemic to try to prevent the rapid spread seen in North America and elsewhere, becoming among the first in the region to bar entry of Americans.

Other nations in the Western Hemisphere, including El Salvador, Honduras, Panama, Colombia, Ecuador, Argentina, Chile and Peru, also have taken steps to bar foreigners and, in some cases, to shut their borders, including to their own returning citizens.

Guatemala’s move to refuse deportations will have a significant impact on the Trump administration’s efforts to ramp up a controversial agreement under which the United States sends migrants who are seeking asylum in the United States to Guatemala instead, even those who aren’t Guatemalan citizens.

The deal between the U.S. and Guatemala, called the Asylum Cooperative Agreement, denies the asylum seekers the opportunity to apply in the United States for refuge and instead allows them only to seek asylum in Guatemala.

Guatemala’s highest court initially blocked the agreement. Since November, the U.S. has sent Guatemala more than 900 men, women and children who have arrived at the border from El Salvador and Honduras.

On Monday, the ACLU and other groups filed suit against ICE, seeking the release of immigrants in detention who are particularly vulnerable to COVID-19. Immigration judges, prosecutors and lawyers also called on the Justice Department to close immigration courts.

Judge A. Ashley Tabaddor, president of the National Assn. of Immigration Judges, said judges had been told to continue holding hearings with immigrants during the health crisis.

“Call DOJ and ask why they are not shutting down the courts,” she said, referring to the Justice Department.

I suppose that the regime will just start dumping all deportees from all countries in Mexico. But, viruses know no borders. 

To date, Mexico’s reported number of coronavirus cases is much lower than the U.S. However, we don’t know whether or not that is a product of there actually being fewer cases or Mexico having poor testing and reporting procedures. But, eventually what happens in Mexico will affect the U.S. Of that, we can be sure. And, no wall or Executive Order will stand in the way.

Seems like it would be a good time for some mutual cooperation between the U.S. and Mexico to determine the best mutually effective ways of handling border control issues in the time of pandemic, consistent with controlling the spread of disease in both countries. The regime did reach an agreement with Canada on border limitations today. But, when dealing with countries to our south, the regime has shown a strong preference for unilateral actions or bogus “agreements” obtained by duress and threats.

In any event, the end of direct deportations by air could be a consequence of the pandemic. And, given the limitations on detention and its health risks, the regime might be forced to come up with other approaches on how best to treat all persons within our borders, whether we like it or not. The regime’s “4-D Immigration Policy” — Detain, Deny, Deport, Distort — might be “hitting the wall.”

Still not clear what’s happening in the Immigration Courts.

The Trump administration plans to immediately turn back all asylum seekers and other foreigners attempting to enter the United States from Mexico illegally, saying the nation cannot risk allowing the coronavirus to spread through detention facilities and border patrol agents, four administration officials said.

The administration officials said the ports of entry would remain open to American citizens, green-card holders and foreigners with proper documentation. Some foreigners would be blocked, including Europeans currently subject to earlier travel restrictions imposed by the administration. The points of entry will also be open to commercial traffic.

But under the new rule, set to be announced in the next 48 hours, border patrol agents would immediately return anyone to Mexico — without any detainment and without any due process — who attempts to cross the southwestern border between the legal ports of entry. They would not be held for any length of time in an American facility.

Although they advised that details could change before the announcement, administration officials said the measure was needed to avert what they fear could be a systemwide outbreak of the coronavirus inside detention facilities along the border. Such an outbreak could spread quickly through the immigrant population and could infect large numbers of border patrol agents, leaving the southwestern border defenses weakened, the officials argued.

Administration officials say many of the migrants who cross the border are already sick or lack sufficient documents detailing their medical history.

Confirmed cases of the virus in Mexico stand at 82, compared with around 5,600 in the United States and more than 470 in Canada. But Mr. Trump has suggested closing the border many times in the past, hoping to crack down on illegal immigration and press Mexico to do more to curb the northward flow of migrants.

Long before the coronavirus outbreak, he admonished his top Homeland Security advisers about the need to stop illegal immigration at the border by saying he wants to “shut it down.” In the spring of 2019, when migrants from Central America were surging, the president repeatedly threatened to shut the border, offering to pardon a top border official for doing so.

Mar. 11, 2020 letter from Sen. Elizabeth Warren and Sen. Edward Markey to EOIR Director McHenry:

“…We therefore urge EOIR to require the posting of the CDC signage, in English and Spanish, as well as any other relevant languages, in courtrooms and waiting areas to raise awareness of COVID-19 and how to avoid transmitting and contracting it. In addition, we request answers to the following questions by March 18, 2020:

  1. Why were immigration judges and immigration court administrators instructed to remove the CDC COVID-19 posters? What “authority” did they purportedly lack to place the posters?
  2. Who told Acting Chief Immigration Judge Christopher Santoro to issue the directive? Who in “leadership” was Judge Santoro referring to in his email regarding the posters?
  3. Did EOIR consult with qualified public health authorities before issuing its directive to remove the posters?
  4. Why was the directive reversed? Did negative publicity play any role in the decision?
  5. What steps is EOIR taking to protect immigration judges, support staff, immigrants, attorneys, and the public from the spread ofCOVID-19? A. Are sick employees and members of the public being told to go home? B. Are cleaning and disinfectant supplies being provided to all employees and to members of the public who come to the courts?
  6. How is EOIR coordinating with the rest of the Department of Justice about how to respond to COVID-19? Is it receiving guidance from any other federal agencies, such as CDC?
  7. In light of the public health concerns posed by COVID-19, will EOIR instruct immigration judges to allow immigrant respondents the opportunity to reschedule immigration court proceedings as necessary?”

NAIJ Asks EOIR to Suspend Non-Detained MCHs

“… we call on you to suspend all non-detained master calendar dockets for the duration of this public health crisis. Immigration Judges can use cancelled master calendar time to hear individual cases (including addressing the backlog of hundreds of thousands of long-pending cases scheduled for individual hearing) that do not involve unwarranted exposure to large numbers of people in our space-limited facilities. …”

As the situation deteriorates, America’s mismanaged “Clown Courts” 🤡🤡 continue to endanger the public while denying due process and wasting taxpayer money by having no contingency plans in place and failing to issue clear guidance to either their own employees or the public.

But, let the record show that they have plenty of time to develop unneeded and counterproductive “Immigration Judge dashboards,” tie up the system with frivolous litigation to “decertify” the NAIJ, and set up “TV pilot programs” to railroad kids through the Atlanta Immigration Court. All enforcement-related “gimmicks;” no time for due process or the public interest.

But, the record should also document the dereliction of duty by Congress and the Article IIIs for allowing this “clown show” to continue to inflict damage on the American public and our legal system.
