“Washington (CNN)President Donald Trump’s expected decision to end DACA, but leave some time to save it, punts the popular program that protects young undocumented immigrants to Congress — but passage of a legislative solution remains a steep uphill climb.

Trump is expected to announce Tuesday that he will end the Obama-era Deferred Action for Childhood Arrivals program, but will offer a six-month delay to give Congress time to come up with a fix, according to sources familiar. Those sources have cautioned that this was the President’s thinking as of Sunday night and could shift ahead of his scheduled Tuesday announcement.
Such a plan would put the issue on Congress’ shoulders amid a busy fall, squeezing Republican and Democratic leadership to decide what their bases could swallow to find a compromise that would keep the nearly 800,000 people who benefit from the program from having their lives upended.

. . . . But the devil is in the details — and it remains unclear to insiders of the debate whether both sides can swallow enough of a compromise to reach a solution.
They have been adamant that they will not accept any deal to fund even small amounts of a border wall or increased immigration enforcement, and cuts to legal immigration would be unacceptable.
“Already you’ve seen the fracturing with people saying you need to pass this as part of border security, or other people saying you need to pass this with cuts in legal immigration, and another group saying you need to pass this on its own, and already that lack of consensus makes this unfeasible in Congress,” said Leon Fresco, an immigration attorney, former Obama administration immigration official and former aide to Senate Minority Leader Chuck Schumer.
Fresco also pointed to advocacy groups on the left as key to Democrats’ decision-making. As long as those groups insist, as they do, that they won’t accept a DACA fix in exchange for more enforcement, Democrats are stuck.
“The politicians are being bolstered by the groups, and the groups themselves are saying don’t trade any enforcement for DACA,” Fresco said. “If that were to change, then the fundamental dynamics of the issue would change, but at the moment that’s not where the advocacy community is — they want a fight on DACA to show that the President is on the wrong side of these issues.”

Wall funding in return for a DACA with a path to green cards and eventually citizenship seems like a deal that would allow Trump to throw some “red meat” to his base by delivering on a key campaign promise while minimizing the human damage to our country, our ecomomy, and our future.

“At the end of August, a federal district court in Texas ruled against that state, halting an immigration enforcement law shortly before it was to go into effect.

The court issued a preliminary (temporary) injunction to halt the implementation of five allegedly unconstitutional provisions in Texas’ anti-sanctuary city law, Senate Bill 4 (SB 4), including one that would require law enforcement agencies in Texas to “comply with, honor, and fulfill” any immigration detainer issued by U.S. Immigration and Customs Enforcement (ICE).

This means that the court found a substantial likelihood that the plaintiffs (in this case, the parties opposing the state of Texas) will succeed in establishing that those provisions are unconstitutional when a decision is rendered on the merits of the case.

If the decision on ICE detainers is correct, which seems to be the case, it could cripple ICE’s ability to prevent removable criminal aliens from absconding when they are released from custody by state and local law enforcement agencies.

When Texas Governor Greg Abbott signed SB 4 into law, he said that denying detainer requests can have deadly consequences. This is illustrated by the case of Kate Steinle, who was shot dead by a criminal alien while she was walking with her father on a busy pier in San Francisco.

The alien was a repeat felon who had been deported five times, but the police department that had been holding him released him in disregard of a detainer request because San Francisco is a sanctuary city that does not honor detainer requests.

Preventing the use of detainers could have unintended consequences. If other federal courts agree with the decision’s disposition of the detainer issue; state and local police in every part of the country may have to stop honoring detainer requests, and ICE could use the time that would have been spent following up on detainers to go after noncriminal aliens.

ICE can encourage state and local police departments to participate in the federal 287(g) Program, which allows participants to enter into a partnership with ICE on the basis of a Memorandum of Agreement (MOA). They would receive training on immigration enforcement and delegated immigration authority, which includes the option of being able to detain aliens on the basis of detainers.

But ICE does not have the resources to train and supervise police in all of the state and local law enforcement agencies in the country.

The only solution is for Congress to grant state and local police the authority to detain aliens on the basis of an ICE detainer.”

I agree with Nolan that the Chief District Judge Orlando L. Garcia’s analysis of SB 4’s constitutional infirmities appears to be correct. I also agree that rationale should eventually require DHS to change its detainer policy nationwide to meet constitutional standards.

That means that a battery of DHS and DOJ attorneys, of which there is no shortage, will have to work with the enforcement branches to come up with effective enforcement methods that comply with our Constitution. Stuff like that happens all the time. That’s why the Government needs good lawyers.

I don’t agree with Nolan that the only way for DHS to function is for Congress to pass legislation turning untrained local cops into immigration officers for the purpose of honoring detainers. Seems like you end up with the same problem, just “dressed up” differently.

I spent over a decade working for the Legacy INS on immigration enforcement matters. Nobody ever doubted that immigration officers could effectively carry out their duties 1) in full compliance with the U.S. Constitution, and 2) without relying on state and local officials. Indeed, the “mantra” of INS Enforcement in those days was “we’re the immigration pros, leave enforcement to us.” I guess times must have changed; but not that much. And, the Fourth Amendment hasn’t changed at all.

I also don’t buy the claim that Abbott was interested in protecting Texans from dangerous crime. No, this was about a White Nationalist agenda designed to put down minorities, particularly in the Latino community, and prevent them from getting their fair share of political power. That’s why, although Latinos make up a large proportion of Texas’s population, Latino leaders generally opposed the GOP’s and Abbott’s racially divisive action.

A bill really aimed at protecting all Texans, regardless of ethnicity or status, from violent crime would have received support from about 98% of residents (who really wants to be a victim of violent crime — almost nobody, as the BIA has observed on a number of occasions) including the overwhelming number of Latinos. That it didn’t, and that a majority-Latino jurisdiction like El Cenizo is the lead plaintiff opposing the bill says all you need to know about the SB 4’s White Nationalist intent.

There will come a day when the Abbotts, Paxtons, and other denizens of the Texas White GOP will have to share power equitably with Latino and other minority Texans. When that happens, they can only hope that Latino leaders and politicians will have short memories, forgive the racism of the past, and move on to the future treating them with greater respect and consideration than they deserve based on their recent “sharp stick in the eyes” words and actions.

Until that happens — well, as I’ve said before, lots of work for lawyers and judges.

As sheriff of Maricopa County, Ariz., Joe Arpaio engaged in blatant racial discrimination. His officers systematically targeted Latinos, often arresting them on spurious charges and at least sometimes beating them up when they questioned those charges. Read the report from the Justice Department’s Civil Rights Division, and prepare to be horrified.

Once Latinos were arrested, bad things happened to them. Many were sent to Tent City, which Arpaio himself proudly called a “concentration camp,” where they lived under brutal conditions, with temperatures inside the tents sometimes rising to 145 degrees.

And when he received court orders to stop these practices, he simply ignored them, which led to his eventual conviction — after decades in office — for contempt of court. But he had friends in high places, indeed in the highest of places. We now know that Donald Trump tried to get the Justice Department to drop the case against Arpaio, a clear case of attempted obstruction of justice. And when that ploy failed, Trump, who had already suggested that Arpaio was “convicted for doing his job,” pardoned him.

By the way, about “doing his job,” it turns out that Arpaio’s officers were too busy rounding up brown-skinned people and investigating President Barack Obama’s birth certificate to do other things, like investigate cases of sexually abused children. Priorities!

Let’s call things by their proper names here. Arpaio is, of course, a white supremacist. But he’s more than that. There’s a word for political regimes that round up members of minority groups and send them to concentration camps, while rejecting the rule of law: What Arpaio brought to Maricopa, and what the president of the United States has just endorsed, was fascism, American style.

So how did we get to this point?

Trump’s motives are easy to understand. For one thing, Arpaio, with his racism and authoritarianism, really is his kind of guy. For another, the pardon is a signal to those who might be tempted to make deals with the special investigator as the Russia probe closes in on the White House: Don’t worry, I’ll protect you.

This bodes ill if, as seems all too likely, the Arpaio pardon is only the beginning: We may well be in the early stages of a constitutional crisis. Does anyone consider it unthinkable that Trump will fire Robert Mueller, and try to shut down investigations into his personal and political links to Russia? Does anyone have confidence that Republicans in Congress will do anything more than express mild disagreement with his actions if he does?

As I said, there’s a word for people who round up members of ethnic minorities and send them to concentration camps, or praise such actions. There’s also a word for people who, out of cowardice or self-interest, go along with such abuses: collaborators. How many such collaborators will there be? I’m afraid we’ll soon find out.”

“(CNN)It’s important to politicize Hurricane Harvey. Not politics in the sense of political parties, or politics to win elections. Politics to protect America.

The priority in the next hours and days is to save lives and reduce suffering, without hesitation and without question of costs or politics. But then must come the reckoning.

Once the immediate crisis ends, the governor of Texas, Greg Abbott, should resign with an apology to his state and his country. Then the Texas delegation in Congress should make a public confession. They have lied to their constituents for too long, expecting the rest of America to keep bailing them out.
The reason is this. Texas politics aims to bring profits to the oil and gas industry, but it does this at high cost and dire threat to Texas residents and the American people.
Hurricane Harvey was a foreseeable disaster. Indeed, a massive hurricane strike on Houston, followed by massive flooding, was widely anticipated.
But Houston is an oil town, and the American oil industry has been enemy No. 1 of climate truth and climate preparedness. Most oil companies and Texas politicians see nothing, say nothing, do nothing. Even worse, they hide the truth, and then beg for help as needed. Gov. Abbott has played this game one disaster too many.

Abbott, for example, was the governor to sign a new law in 2015 that prevents cities and municipalities in Texas from setting their own regulations that might rein in oil and gas drilling activities. On his watch, Texas supported withdrawal from the Paris Climate Agreement.
Over many years, he has raked in millions in campaign contributions from the oil industry, including in his former role as Texas attorney general, where he sued the Environmental Protection Agency repeatedly over rules designed to curb carbon emissions.
And the state, under Abbott’s direction, has taken no significant steps toward flood protection, despite the recognized risks of a mega-hurricane and flood.
The problem is not about his crisis management this week. I can’t judge that. It’s about his long-standing relentless opposition to environmental protection, including his blind eye to global warming and the grave dangers it poses.
The Texas Tribune and ProPublica published a 2016 award-winning report on “Hell or High Water,” explaining why Houston is a “sitting duck for the next big hurricane.” In 2015, Inside Climate News wrote that “as weather extremes like flooding batter Texas, its refusal to prepare for an even more volatile climate leaves residents at risk, experts say.”
On June 16 of this year, citing the city’s widening concrete sprawl and deaths from flooding in recent years, the UK Guardian wrote that “Houston fears climate change will cause catastrophic flooding: It’s not if, it’s when.”

So, what has been the policy response in Houston and Texas more generally in terms of prevention, resilience, and preparedness? Almost nothing until disaster hits. Then the response is to ask for federal bailouts.
In other words, Texas is the moral hazard state.
Here is what has not happened: There has been little or no effort at zoning protection to keep development clear of floodplains; little or no offshore and onshore infrastructure for flood protection; no discernible heed paid to the scientific evidence and indeed the growing practical experience of catastrophic flood risks; and of course, relentless, pervasive climate change denial, the mother’s milk of Texas politics.
So, here’s the deal. Those of us elsewhere in the US also suffering from flooding and other disasters from warming temperatures, rising sea levels, and more intense storms (such as New Yorkers who are still rebuilding from 2012 Hurricane Sandy) want truth from Texas politicians and the oil industry.
We are bearing the costs of your lies. We are tired of it. More importantly, we are in pain and solidarity with the good people of Houston who are losing lives, homes, and livelihoods because of your lies.

Gov. Abbott, we would like to bid you a political adieu. Perhaps you can devote your time to rebuilding Houston and taking night classes in climate science. Senators Ted Cruz and John Cornyn, you will soon be asking us for money to help Texas.
My answer will be yes, if you stop spewing lies about climate dangers, agree to put US and Texas policy under the guidance of climate science, back measures to lower carbon emissions and stay in the Paris Climate Agreement. Then, of course, let’s help your constituents to rebuild.
And to ExxonMobil, Chevron, Koch Industries, ConocoPhillips, Halliburton, and other oil giants doing your business in Texas: You put up the first $25 billion in Houston disaster relief. Call it compensation for your emissions. Tell the truth about growing climate threats. Then, as citizens seeking the common good, we will match your stake.”

The “common good” is something that never crosses the collective so-called “minds” of Texas’s corrupt GOP pols. They are all bought and paid for by “Big Oil” and other fat cats. And, they are busy picking on Blacks, Hispanics, refugees, migrants, children, the poor, gays, Muslims, Dreamers, etc.

So, not for the first time, it’s for the rest of us taxpayers to bail out Texas. (But, don’t think that will earn the support of hypocrites like Cruz & Co. the next time we might be in need — they are cruel, ignorant, and selfish because — well, because they can be and get away with it). Fortunately for Texas, some of us still do have the common good in mind.

But his performance was a fresh indication that he still feels far more comfortable, and perhaps motivated, to act as a political flamethrower who pulls at national divides than a President who wants to unite the nation.
Throwing gasoline onto political controversies, Trump threatened to shut down the government unless Congress funds his border wall and all but promised a pardon for Arizona Sheriff Joe Arpaio, who was convicted of contempt of court in a case related to racial profiling.”

“President Trump’s plan for an aggressive hiring surge of 15,000 Border Patrol and immigration personnel to help keep out undocumented immigrants is unrealistic — and the Department of Homeland Security has not made a case for it, the agency’s watchdog says.

A report released this week by the DHS inspector general concludes that based on its rigorous screening requirement for law enforcement jobs and the relatively high rate of attrition among Border Patrol agents, Homeland Security would have to vet 750,000 applicants to find 5,000 qualified personnel.

In addition, to hire the 10,000 Immigration and Customs Enforcement (ICE) agents the president called for in executive orders he issued in his first days in office, a pool of 500,000 candidates would need to apply, auditors found.

The report calls into question whether DHS officials even need 15,000 new hires to target undocumented immigrants. Agency leaders have done such poor planning for what their workforce should look like, with an understaffed, poorly trained human resources operation, that they cannot justify thousands of new employees, the report says.

“Neither [U.S. Customs and Border Protection] nor [ICE] could provide complete data to support the operational need or deployment strategies for the additional 15,000 agents and officers,” the report by the office of Inspector General John Roth said.

DHS officials told auditors that they are still three to four years from getting a system in place that will be able to tell them how many new personnel they need and where to deploy them.

“Without comprehensive staffing models, operational needs analyses, and deployment strategies, CBP and ICE will not be able to identify clearly the correct number and type of employees required, what positions must be filled, or where to deploy those employees,” the report said.

Trump promised on the campaign trail to vastly beef up enforcement against undocumented immigrants with a new border wall, a surge in agents to help seal off the Southwest border with Mexico and a “deportation force” to arrest people in the country illegally. The 15,000 new front-line employees would come with almost 9,600 more technical and support staff, the report said.”

CNN’S TAL KOPAN: Meet New Acting DHS Secretary Elaine Duke

“Washington (CNN)With Homeland Security Secretary John Kelly being tapped as President Donald Trump’s new White House chief of staff, leadership of the agency responsible for protecting the nation at home will fall to Elaine Duke, the deputy secretary.

According to the Department of Homeland Security, Kelly will remain the secretary until Monday, and then Duke will take over in an acting capacity.

The longtime veteran of government brings an expertise in business management and government acquisition to the role, with many of her past positions focused on the operational side of the bureaucracy.

Who is John Kelly, Trump’s new chief of staff?

Duke was sworn in as deputy secretary in April after a seven-year stint in the private sector. She was confirmed by the Senate on an overwhelmingly bipartisan vote, 85-14.

“I am grateful to have this opportunity to further mature the Department and continue improving its efficiency and effectiveness,” Duke testified at her confirmation hearing for the deputy position. “If confirmed, I promise to lead DHS in enforcing the law with respect and integrity. I will be honest in my assessments and recommendations, and relentless in pursuing excellence. Such commitments are critical at this juncture in homeland security.”

Since taking office, Duke has taken a lead role in many of the agency’s priorities, including an effort to increase security on large electronics in carry-ons on airplanes traveling to the US.

A public servant for nearly three decades, Duke spent the last eight years of her tenure with government at DHS, serving in a Senate-confirmed position as undersecretary for management from 2008 to 2010.

After working at DHS, she worked as the principal of Elaine Duke & Associates, described in her DHS bio as an acquisition and business consulting firm.

Reince Priebus out, John Kelly in as White House chief of staff

During her tenure at DHS, Duke worked in management and as chief procurement officer. She also worked in acquisition at the Transportation Security Administration. She took on that role less than a year after the September 11 attacks, according to an older speaker’s biography.

Duke also worked at the Department of Defense before she arrived at DHS.

She went to New Hampshire College for her undergraduate degree in business and received an MBA from Chaminade University of Honolulu.

According to DHS, she has received many honors during her public service career, including the Presidential Meritorious Rank Award, the DHS Secretary’s Medal, the TSA Silver Medal for Customer Service, the Department of the Army Commander’s Award for Public Service, and the Coast Guard’s Distinguished Public Service Medal.

Duke is married and has two sons, according to her Senate testimony.”

Duke looks like a total pro. And, it appears that, barring something unusual happening (which might be the norm in this Administration), she will be around until at least next year, even if she doesn’t get the nod for the Secretary appointment.

But, General Kelly also looked and sounded like a pro until his confirmation hearing was over. Then, Kelly bought into and carried out the zany max enforcement, minimum judgment, waste of resources White Nationalist immigration program of Sessions, Bannon, Miller, and ultimately Trump. In other words, he was unwilling or unable to stand up for smart and humane enforcement that could benefit the country and stop the waste of taxpayer dollars.

Duke has one thing going for her that Kelly didn’t: she is familiar with the formidable DHS bureaucracy and how to actually get things done. Notwithstanding his credentials, Kelly appeared afraid to “just say no” to the demands of some (but by no means all) DHS agents for unlimited discretion for “gonzo” enforcement. Presumably, Duke is no stranger to the concept that line agents should carry out policies (and have their views considered, among others, in determining policies), not “make them up as they go along.”

Will Duke continue the “gonzo” policy of overloading the already overwhelmed U.S. Immigration Courts and stripping DHS prosecutors of discretion to help manage dockets? Or, will she take responsibility for establishing rational Immigration Court filings by DHS and restore needed ability to exercise prosecutorial discretion to the Assistant Chief Counsel?

We’ll see what happens.

“Donald Trump’s immigration policies are likely to encourage migrants to risk more dangerous routes into the US, like the journey which this week ended with the death of ten people in a sweltering truck, border security experts have warned.

Dozens of people from Mexico and Central America were found packed into a non-air-conditioned cargo container in a Walmart parking lot in San Antonio at about 12.30am last Sunday.

The deaths are thought to have been caused by heat exposure, dehydration and suffocation. About 30 people were hospitalised.

Days later, at least four people – including two children – drowned trying to cross the swollen Rio Grande near El Paso.

As part of its campaign to crackdown on undocumented migration, the Trump administration wants to force so-called “sanctuary cities” to cooperate with federal immigration authorities, beef up frontier security and surveillance, and – eventually – build a wall along the border with Mexico.

But Alonzo Peña, a former deputy director of US Immigration and Customs Enforcement (Ice), said simplistic strategies would not deter people desperate to join family or seek a better life. Instead, closing off simpler routes would prompt migrants to attempt more dangerous crossings.

“I call it an unfortunate collateral consequence,” he said. “They will put themselves in the hands of unscrupulous criminals that see them as just a commodity.”

Asked if a wall would help, Peña, now a consultant in San Antonio, said: “Absolutely not – it probably will contribute to more tragedies.”

He said building better binational relationships, encouraging information-sharing and more use of informants were key to breaking up networks of smugglers and traffickers.

In recent years, stepped-up frontier security has meant that smuggling activities once orchestrated by small, loosely organised enterprises are being run by bigger, more ruthless and profit-oriented criminal gangs with indirect links to drug cartels.

Packing many people into a truck is a profitable strategy for such smugglers. A large vehicle is a better hiding place than smaller alternatives and reduces the number of trips, making evading detection more likely at busy interior US Border Patrol checkpoints placed along highways near the frontier.

“The policies to enforce the border have the unintended consequence of strengthening transnational smuggling networks and the connection of business with transnational criminal organisations. There’s money there,” said Guadalupe Correa-Cabrera, an associate professor at the University of Texas Rio Grande Valley who studies migration and trafficking. “You are increasing the incentives for corruption on both sides of the border.”

Texas this year passed a law banning so-called sanctuary cities – places that offer little or no cooperation with federal immigration agents. “Border security will help prevent this Texas tragedy,” John Cornyn, a US senator from Texas, wrote on Twitter.

But critics say that such enforcement does nothing to remove the “push factors” behind migration from Mexico and Central America, such as the lack of economic opportunity and violence by street gangs, security forces and crime groups.

A report published in March by the risk analysts Verisk Maplecroft termed Trump’s crackdown “a gift to human traffickers” by driving undocumented workers in the US deeper into the shadows, while a wall “would increase criminal trafficking fees, leaving migrants more deeply mired in debt and vulnerable to exploitation”.

But even this week’s deaths would not curtail demand, Correa-Cabrera said.

“They will still take trucks. They have been taking the journey and nothing has stopped them,” she said. “How many women are willing to take the journey even though they know there is a very high possibility of being raped?”

Folks are going to keep coming and keep dying until we make the needed, realistic changes to our legal immigration system. The smugglers will up their profits and expand their operations, making and taking more money than ever from already stressed individuals seeking to come. And the bodies will continue to pile up as a testament to the failed White Nationalist agenda of Trump and Sessions.

What “gonzo enforcement” has done, however, is to cut or eliminate the incentive for folks to use the legal system by coming to the border and presenting themselves for protection or by turning themselves in to the Border Patrol. Knowing that their rights under the law and as human beings will not be respected by the likes of Trump, Sessions, and Kelly’s replacement will merely put more individuals at the mercy of the smugglers. The smugglers are likely to get so good that we won’t have the faintest idea anymore how many forks are coming without documents until they wind up dead in a parking lot or a field. And, I suppose that CBP will come up with some formula like “for every dead body we figure there are 1,000 who made it into the interior.”

BREAKING NEWS FROM CNN’S TAL KOPAN — TRUMP’S WALL DELAYED BY BID PROTESTS!

“Washington (CNN)Construction on prototypes for President Donald Trump’s long-promised border wall has been delayed until winter at the earliest after bidders who were passed over filed protests about the decision, according to an update obtained by CNN.

The delay pushes back construction of the potential wall designs months beyond when the administration had hoped to break ground. The plan had originally been to build in June, and in recent weeks the Department of Homeland Security has insisted it was still on track to begin work on prototypes this summer.

But according to a memo sent out by the Customs and Border Protection legislative affairs office, obtained by CNN, two companies that were not selected to be finalists — who then were asked to submit more detailed proposals — filed a total of four protests of the process. While two of the protests, from WNIS, were dismissed, two from Penna Group are still under review and won’t be decided until October, the update said.

That sets the earliest that prototype construction could begin for November, to be completed by early December. That’s if no further protests are filed and if the original protests are dismissed, the update notes, and acknowledges that protests are a common part of government contracting.

CBP did not immediately respond to a request for comment.

The news comes as the House is set to vote Thursday night on a security funding package that would include money to build new border wall next fiscal year, though Democrats in the Senate have signaled they will oppose any such effort.

Since Congress has yet to appropriate any money for Trump’s signature campaign pledge, the prototypes have been the only step the administration has been able to take in executing Trump’s vision.”

TRUMP ADMINISTRATION’S WAR ON AMERICA — Proposals To Restrict Student Visas & Reduce Legal Immigration Will Hurt Economy, National Standing

These articles from today’s Washington Post highlight three “gonzo” immigration proposals driven by the Trump Administration’s white nationalist agenda.

First, the proposal to require nonimmigrant students in the U.S. to apply for annual extensions of stay would roll back the “duration of status program” for students — arguably the single best and most mutually beneficial efficiency move in the history of INS/USCIS. It would also create chaos in student visa programs that not only keep many colleges and universities financially viable, but also fuel American innovation and technological advances in the STEM fields.

Second, proposals to make visa issuance a law enforcement function within the DHS would lead to chaos in the visa issuing program and probably will result in retaliation by other friendly nations. Visas are part of the foreign commerce of the U.S., not a domestic law enforcement program.

Finally, proposals to reduce legal immigration and further restrict legal opportunities for unskilled workers would deprive the U.S. of workers at a time when the growing economy needs them the most. This short-sighted policy would likely lead to the same type of economic stagnation that has plagued EU countries and Japan over the past several decades.

“The vaudeville show that’s running at 1600 Pennsylvania Avenue didn’t book itself into the White House. Nearly 63 million Americans sent that burlesque comedy with headliner Donald Trump to Washington. That 66 million other voters thought otherwise is beside the point. Trump didn’t anoint himself president. Millions put him in office.

What does that tell us about the country?

Was hatred of President Barack Obama, fear of Hillary Clinton, outrage over America’s perceived direction enough to transfer the reins to Trump?

It’s not as if the Trump on display in the Oval Office is not the same Trump we saw on the campaign trail or on reality TV or out and about touting his businesses. He was, by any yardstick, the most unqualified presidential nominee in modern history.

Trump didn’t seize the presidency by deception. For months on end, he was out there for all voters to see, measure and judge. Some of us did offer our preelection assessments, based upon his campaign, well before time came to cast ballots.

In my view, Trump showed himself to be one who could be neither out-demagogued nor out-nastied.

And his attacks on people. Megyn Kelly: “You could see there was blood coming out of her eyes, blood coming out of her wherever.” Jews: “The only kind of people I want counting my money are little short guys that wear yarmulkes every day.” Sen. John McCain (R-Ariz.): “He’s not a war hero . . . I like people that weren’t captured.” My journalist colleague Serge Kovaleski, who has limited mobility in his arms: “Now the poor guy, you ought to see this guy,” Trump said, before contorting his arms in an apparent impersonation.

Trump the candidate showed himself to be an ignorant, undisciplined, ranting bully who exaggerated and lied without shame. A man who wore a tough-guy masculinity but was actually a coward, who picked on women, demeaned minorities and was thoroughly lacking in human decency.

Trump’s character defects were on full display well before the polls opened.

President Trump’s behavior in the White House has been equally as disgusting and beneath the dignity of that high office.

And now our nation’s capital is being wrenched apart by the Trump-Russia scandal and congressional and federal investigations into the Kremlin’s intrusion in the election.

The country can’t claim not to have seen this coming.”

One of the most disturbing aspects of the Trump fiasco is that although he might be “historically unpopular,” his support in the polls has remained steady at around 35% – 40%. That means that at least 1/3 of Americans are willing to accept incompetence, dishonesty, bias, racism, xenophobia, intentional cruelty and divisiveness, nepotism, bullying, anti-intellectualism, scientific ignorance, undermining national security, and misogyny as the “new norms” in America. It essentially means that a substantial number of our fellow Americans have put themselves out of reach of rational political dialogue. That’s going to make America “tough to govern” no matter who wins the next round of elections.

“Illegal immigration across the Southwest border rose yet again in June, according to the latest Homeland Security figures released Friday that show a noticeable jump over the last two months.

Border Patrol agents nabbed 16,089 illegal immigrants trying to sneak in, while Customs and Border Protection (CBP) officers identified another 5,570 illegal immigrants who showed up without authorization at the ports of entry.

The combined 21,659 illegal immigrants are still the lowest numbers for June in years, but the spike is worrisome because illegal immigration generally begins to slow in the summer months. Indeed, the last four years saw an average drop of 10 percent in Border Patrol apprehensions in June — but this year saw an 11 percent rise.

The number of illegal immigrant children and families also rose sharply. Unaccompanied children spiked 31 percent in June compared to May, and the total number of people coming as families shot up a stunning 47 percent last month.

The numbers could end up spurring action on President Trump’s border wall, which had been attacked as unnecessary earlier this year as the numbers of those attempting to cross the border plunged to 40-year lows.

Experts say the number of people caught is a rough yardstick of how many people are trying to cross, so a rise in apprehensions signals a rise in the overall level of illegal immigration.”

CNN’S TAL KOPAN: Congress “Stonewalls” Trump’s Wall!

“Washington (CNN)Building a border wall remains a stated top priority for President Donald Trump, but thus far he has precious little to show for it.

That’s largely because when Congress appropriated money earlier this year to fund the government, opposition from Democrats and some Republicans alike left the administration empty handed in terms of funding any new construction.

Trump’s Department of Homeland Security did get permission to reassign $20 million to fund prototypes for wall construction as well as new money for technology, maintenance and hiring for Border Patrol.

But the biggest thing Trump wants remains the biggest thing Democrats want to deny him — the ability to point at a structure and say: Here is the wall.

Multiple sources familiar with negotiations for both the fiscal year 2017 budget and 2018 cycle say that the White House did mobilize behind the wall — putting it in their proposed budget and having representatives like Budget Director Mick Mulvaney and Homeland Security Secretary John Kelly stump for it.

But Democrats from the outset threatened that inclusion of wall money would be a deal breaker on the budget, which needs Democratic votes to pass, meaning the White House risked a government shutdown standoff on the President’s 100th day in office if it forged ahead.

Where Trump’s border rhetoric meets reality

Ultimately, the White House accepted a budget deal that did not include the wall.

“Their priorities were made known, obviously,” said a House GOP aide, who requested anonymity to speak freely. But, the aide added, there was also an awareness that a second chance at money would be coming up this fall.

“I didn’t get the impression that they were deeply disappointed or unhappy,” the aide said of the White House. “I think they realized the situation and will continue to work toward to getting more money.”

Negotiations are well underway for the next chance, in the budget for fiscal year 2018.

But it’s an open question whether the administration will push Congress harder on getting money for the wall after caving on the signature campaign pledge this spring. The dynamics of the situation haven’t changed to give the White House any more leverage.

Already, Democrats have again signaled that a wall is a no-go. In a letter this week to their Republican counterparts, the top Senate Democrats in leadership and the Appropriations committee laid out their red lines.

“We are once again concerned with the President’s Fiscal Year 2018 request for a very expensive, ineffective new wall along the southern border with Mexico,” the Democrats wrote.

And other barriers in Congress remain. Border state lawmakers of both parties are largely against a massive wall in their districts, preferring technology and smart infrastructure. Even without Democratic support, it’s unclear if Republicans have the votes among themselves to move forward with a wall.”

“Washington (CNN)President Donald Trump has let a controversial Obama-era immigration policy continue — and conservative states are running out of patience.

Texas Attorney General Ken Paxton was joined by his counterparts in nine other states in a letter Thursday warning Attorney General Jeff Sessions that if the Trump administration does not move to end Deferred Action for Childhood Arrivals, they will file a court challenge to the program.
At the heart of the threat is ongoing litigation over a related program — giving the attorneys general an opening to squeeze the administration on DACA.
Despite explicitly pledging during the campaign to “immediately” rescind DACA, a program that gives undocumented immigrants brought to the US as children protection from deportation and the ability to work and study in the US, the Trump administration has continued to honor the program and issue new permits under it.
With its efforts, the administration appears to want to have it both ways, continuing the program and pledging to protect its participants while saying the situation isn’t necessarily permanent and arresting those who officials say have lost their DACA status. But that position has angered activists on both sides of the issue, who in a rare moment of agreement have expressed similar frustrations that the administration won’t clearly articulate its long-term plans for DACA.
At issue is pending litigation in Texas that has challenged an Obama administration program that’s similar to DACA but geared toward parents of childhood arrivals as well as an extension of the childhood arrivals program, both of which were never allowed to go into effect by the courts.
The Trump administration formally abandoned the Deferred Action for Parents of Americans and Lawful Permanent Residents program, known as DAPA, earlier this month to avoid having to defend it in court. But it left DACA on the books despite similar criticism of that program — namely that both programs were an overreach of executive authority.
Asked by CNN about that decision, Homeland Security Secretary John Kelly at the time called it “house cleaning,” saying the program for parents was blocked by the courts while the one for those who came to the US was children wasn’t.
But Paxton wrote that if the administration doesn’t end DACA by September 5, Texas will amend its complaint in the case to include that program — which would force the administration to defend the program in litigation or abandon it.
“We respectfully request that the Secretary of Homeland Security phase out the DACA program,” Paxton wrote in the ultimatum. “Otherwise, the complaint in that case will be amended to challenge both the DACA program and the remaining Expanded DACA permits.”
The Department of Justice and DHS did not respond to a request for comment on the letter. Sessions was asked about it on “Fox and Friends” on Friday and seemingly praised the states.
“The DAPA law has already been withdrawn,” Sessions said when asked what changes could be coming. “That was a big victory, and we’ll be looking at that. But I’ve got to tell you, I like it that our states and localities are holding the federal government to account, expecting us to do what is our responsibility to the state and locals, and that’s to enforce the law.”

Trying to throw 800,000 American young people — basically America’s future — out of the country and sow fear in local ethnic communities has nothing whatsoever to do with law enforcement. But, it has lots to do with racism and white nationalism. The real target here is Hispanic Americans and other ethnic Americans from immigrant roots.

Paxton, Texas Governor Greg Abbott, Kansas Secretary State Kris Kobach and their followers are the George Wallaces, Lester Maddoxes, and Orval Faubuses of our time. Yeah, white racists might be giving it one more go. But, like the Trump victory, it is the last gasp. Eventually, the screw will turn as it did for prior generations of racist politicians.

To point out the obvious, with 600,000 pending cases in U.S. Immigration Court, the Trump Administration could not actually remove another 800,000 individuals any time in the foreseeable future. So, it’s all about meanness, fear, racism, white nationalism, and trying to prevent these young people from fully participating in our society. In other words, to make them a permanent underclass. Sound familiar?

The Dream Act to protect these young people should have become law years ago. But, then Senator Jeff Sessions and other GOP right wingers blocked its passage, even though it had the support of the majority of Senators. So, although legislation would be the logical solution, I wouldn’t count on it under today’s polarized conditions.

And, today’s GOP has become the home of racists and white supremicists. Something that anyone who runs on the GOP ticket or pulls the lever for a GOP candidate should consider.
