Dear Judge Schmidt,

I hope this email finds you well, with the holiday season upon us.

I wanted to write and tell you again how much the training last spring stands out in my mind as a highlight for 2023.  I received my full accreditation in June and have represented three different clients in proceedings so far.  The judges in San Antonio have been very open to dismissing cases, and two of the three cases were dismissed as an exercise of prosecutorial discretion!  Our clients have been able to apply for asylum affirmatively and hopefully will be successful, even though we anticipate a very long wait for their interviews.  I have also completed U visa filings, a T visa filing, family petitions and lots and lots of work permits.  Mailing every filing fills me with so much hope.

I hope that I will get a chance to see you again at a future VIISTA event!

☠️ MORE THAN 40 MIGRANTS DEAD IN TEXAS TRAGEDY!

SAN ANTONIO — At least 40 migrants were found dead in the back of a tractor-trailer in San Antonio Monday, according to two federal law enforcement officials briefed on the horrific finding.

Rescuers pulled at least 15 others from the vehicle and they were taken for medical treatment, said one of the officials, who spoke on the condition of anonymity to provide preliminary information.

The truck was found by agents from Homeland Security Investigations, a branch of U.S. Immigration and Customs Enforcement that specializes in human trafficking cases, one of the officials said. HSI agents are leading the investigation.

This year’s theme is “The Road to Rehabilitation: Reconnecting with Humanity.”

Professor Cristina Rodriguez is the co-author (with Professor Adam B. Cox of NYU Law) of the widely acclaimed book The President & Immigration Law. Recently she worked on EOIR issues for the Biden-Harris Transition Team.

Shaw Drake is Staff Attorney & Policy Counsel, Border & Immigrants’ Rights, ACLU of Texas. He was one of my all-star Refugee Law & Policy students @ Georgetown Law and a Charter Member of the New Due Process Army (“NDPA”).
