Biden Administration Has Admitted One Million Migrants to Await Hearings

NYT: Under a pandemic-driven public health rule, migrants have been turned away at the U.S. border 1.7 million times since Mr. Biden took office, a figure that includes some people who have attempted to cross multiple times. But the United States has allowed others to stay temporarily for a range of reasons, including because Mexico or their own countries will not take them back. Nearly 300,000 of those who have been allowed in — including many heads of families — have been outfitted with tracking devices so that Immigration and Customs Enforcement can keep tabs on their whereabouts while they await their day in court. ‘Human crisis’: Chicago seeks help as Texas buses over migrants

AlJazeera: Chicago Mayor Lori Lightfoot recently told reporters that about 125 migrants have arrived in the city on board buses from Texas, including 50 people who arrived on Sunday alone, most of them families. See also Texas spends more than $12 million to bus migrants to Washington, DC, and New York; Chicago welcomes immigrants bused out of Texas with open arms.

 

No longer young, ‘dreamers’ uneasily watch a legal challenge

WaPo: The oldest recipients were in their early 30s when DACA began and are in their early 40s today. At the same time, fewer people turning 16 can meet a requirement to have been in the United States continuously since June 2007.

 

Dozens of migrant children reported missing in Houston, raising alarms

Reuters: The agency found that since late last year, 57 unaccompanied migrant kids had been reported missing in Houston, the HHS official, and two additional sources familiar with the situation, said. Included in the count were nine kids who ran away from HHS shelters in the Houston area, the official said.

 

Venezuela’s refugee crisis similar to Ukraine’s in scale, but not aid

WaPo:   The exodus from Venezuela has grown to the point that its refugee numbers are now close to those displaced by the conflict in Ukraine — but the European crisis has drawn disproportionately more financial support, according to an advocacy group. See also Ecuador begins regularization process for thousands of Venezuelan migrants.

 

California may be 1st to ban solo confinement for immigrants

CA: California would be the first U.S. state to ban solitary confinement in private civil detention centers used for immigrants who are under threat of deportation, under a bill that advanced Tuesday.

 

Feds Say Biz Lined Pockets With Migrant Kids’ Shelter Funds

Law 360: Federal prosecutors accused a Texas contractor of misappropriating hundreds of thousands of dollars worth of funding from the U.S. Department of Health and Human Services that was intended to be used for housing unaccompanied migrant children.

 

Afghan Resettlement Efforts Will Now Prioritize US Family Ties

Law 360: The Biden administration will focus on bringing over Afghans who have U.S. families in the next stage of its effort to relocate those fearing for their lives under the Taliban’s rule, a State Department spokesperson said Thursday.

American Samoa Gov’t Argues Against Birthright Citizenship

Law 360: The American Samoa government told the U.S. Supreme Court Monday that imposing birthright citizenship on American Samoans would deprive them of the right to decide their status, going against American Samoa-born individuals who earlier appealed to the high court.

 

1st Circ. Calls Removal Statute ‘Hard-Hearted’ In Affirming BIA

Law 360: The First Circuit was bound Wednesday to stand by an immigration appeals board decision that ordered a Guatemalan man removed from the country despite the hardship it would cause his children, saying the call was in line with the “hard-hearted” and “stringent statutory requirement.”

 

1st Circ. Says Fuzzy Memory Of Assault Doesn’t Bar Asylum

Law 360: The Board of Immigration Appeals was wrong when it refused to consider a psychological report explaining why an El Salvadoran teen seeking asylum had trouble remembering the details of sexual assaults that occurred when she was a child, a split First Circuit has ruled.

 

CA3 On Credibility, CAT: Njoka V. Garland (unpub)

LexisNexis: [U]nder the law of this circuit, an adverse credibility finding is “not determinative” of a claim for CAT protection…The Board was thus obliged to also consider Njoka’s independent evidence in the context of his claim for CAT protection.

 

CA9 On INTERPOL Red Notice, CAT: Gonzalez-Castillo V. Garland

LexisNexis: This court has long interpreted “serious reasons to believe,” the standard set by the statute for the serious nonpolitical crime bar, as equivalent to probable cause. In this case, the INTERPOL Red Notice cannot, by itself, establish probable cause.

 

Another CA5 Pereira / Niz-Chavez Remand: Parada V. Garland – Now Published!

LexisNexis: [T]he BIA’s decision to deny Parada’s motion to reopen was based on a legally erroneous interpretation of the statutes governing Notices to Appear and the stop-time rule. The Supreme Court has since reinforced the holding of Pereira and held—again— that to trigger the stop-time rule, a Notice to Appear must come in the form of “a single document containing all the information an individual needs to know about his removal hearing.”

 

CA9: BIA Must Consider New Evidence For Immigration Credibility

Law 360: The Ninth Circuit revived a Sikh man’s second attempt at obtaining asylum in the United States, finding that the Board of Immigration Appeals should have considered new information he presented in his later bid about the dangers of living as a Sikh in India.

 

9th Circ. Rules Ariz. Drug Convictions Trigger Deportations

Law 360: A Ninth Circuit panel on Monday ruled that Arizona’s drug possession laws can support federal immigration removal orders despite banning a broader list of substances than the federal drug schedule because the Grand Canyon State requires juries to determine the specific drug type involved in each conviction.

 

Calif. Judge Imposes New Rules For Migrant Youth Placement

Law 360: The U.S. Department of Health and Human Services’ Office of Refugee Resettlement must notify young detained migrants and their counsel when it decides against releasing them to their parents or relatives and provide reasons for withholding release, a California federal judge has ordered.

 

ICE Inks $4.8M Deal With Migrant Teens In Detention Litigation

Law 360: U.S. Immigration and Custom Enforcement has agreed to pay $4.8 million to resolve a class action claiming the government routinely failed to consider safer options before transferring teens to adult detention facilities after they turned 18, according to a proposed settlement filed Thursday in D.C. federal court.

 

Judge Recommends Immigrant Class Cert. In NY Detainer Suit

Law 360: Immigrants suing New York’s Suffolk County and its sheriff’s office over their practice of holding people past their release date by request of U.S. Immigration and Customs Enforcement have won over a federal judge, who recommended their proposed class be certified.

 

Iranian Diversity Visa Applicants Say They Were Skipped Over

Law 360: Two California chapters of a national Muslim civil liberties group and 159 Iranian diversity visa applicants have sued the Biden administration in federal court, claiming they have been “skipped over” and “unreasonably delayed” in the processing of their applications “for no explicable reason.”

 

USCIS Extends and Expands Employment Authorization for Individuals Covered by DED for Liberia

USCIS: U.S. Citizenship and Immigration Services (USCIS) today published a Federal Register notice for the extension and expansion of eligibility for Deferred Enforced Departure (DED) for Liberians and explaining how eligible Liberians may apply for Employment Authorization Documents (EADs).

 

USCIS Resumes Cuban Family Reunification Parole Program Operations

USCIS: U.S. Citizenship and Immigration Services (USCIS) is resuming operations under the Cuban Family Reunification Parole (CFRP) program, beginning with pending CFRP program applications.

 

USCIS Updates Guidance Related to Religious Workers

USCIS: U.S. Citizenship and Immigration Services (USCIS) is issuing policy guidance in the USCIS Policy Manual to reorganize and expand on existing guidance related to special immigrant and nonimmigrant religious workers.

 

EOIR to Open Sterling Immigration Court

EOIR: The Executive Office for Immigration Review (EOIR) today announced it will open a new immigration court in Sterling, Virginia, on Oct. 3, 2022. The Sterling Immigration Court will include 19 immigration judges. It will be the second immigration court to open in the National Capital Region this calendar year.

 

Call for Examples: IJ Use of Boilerplate

CAIR: Peter Alfredson from CAIR Coalition’s Immigration Impact Lab is seeking examples of problems related to how IJs are using boilerplate addenda/statements of law in oral decisions. Please contact him at peter@caircoalition.org with any specific issues you’ve experienced with the addenda, including, but not limited to: IJs referring to the addenda but never actually providing them; addenda misrepresenting the law in a prejudicial way; and IJs using the addenda and engaging in little/no actual legal analysis in a particular case.

NIJC: If you have examples of prosecutorial discretion you are willing to share (anonymously to your client if you wish), please fill out this form: Amicus Stories. Also: if you are a nonprofit and would be interested in signing on as an amici, please fill out this form: Joining Amici. In particular, we are thinking of cases that fit into the following categories: Grants or Denials under the Mayorkas Memo of PD for the purpose of seeking some non-EOIR benefit, such as: Eligibility for U visa, Eligibility for adjustment of status, Eligibility for SIJS. Grants or Denials under the Mayorkas Memo of PD based on particular humanitarian or unique considerations: Military service (self or family), Undercover or confidential informant situation, Family separation. DACA / DREAMers, MPP, Old convictions / rehabilitation. Stories (even if they predate the Mayorkas Memo) involving: Circumstances where individuals who would have been subject to 236(c) were not placed in removal proceedings, and the person was able to pursue relief with USCIS because no proceedings were ever initiated. Circumstances where individuals who could have been subject to reinstatement of a prior removal order did not have that order reinstated and were able to do things like pursue a U or T visa before USCIS, without being detained or placed in removal proceedings.

Lack of analysis, prejudged cases, overt anti-immigrant bias, and absence of “applied” immigration, human rights, and due process expertise is an endemic problem at EOIR. Using canned law (some of it flat out wrong or at least questionable) in “addenda” appears to be another “built to fail,” due process denying, haste make waste “gimmick.”

Lousy analysis and basic mistakes appear in Federal Court rebukes of EOIR highlighted here, on LexisNexis, on ImmigrationProf  blog, and other resources on an almost daily basis. And, we by no means are able to catalogue all of the abject failures being cranked out by Garland’s EOIR — many of which would embarrass an L-1! Why not get 1) better judges, 2) a better BIA, and 3) better training?

Garland has been “nibbling around the edges,” at best. A few enlightened appointments of well-qualified “practical scholars” to newly created judgeships in a failed system of some 600 judges nationwide with a fatally flawed “Trump holdover” appellate body, the BIA, won’t cut it.

EOIR needs new, exceptionally well-qualified, dynamic, due process oriented expert leadership and a new BIA that will begin solving the problems rather than aggravating them and shuffling them on to the Circuits. Hopefully, the CAIR effort will lead to “dialing up the pressure” on Garland and his lieutenants to “get their collective heads out of the clouds and kick some tail at what (despite the efforts of Article III right wing hacks like Judge Aileen “Loose” Cannon to claim the title) remains “America’s worst court system” — where due process, fundamental fairness, legal scholarship, and best practices “go to die.” 🪦

I don’t dispute that America’s judicial system is failing from top to bottom. But, unlike the  Article IIIIs, where there are long-term structural issues with constitutional roots that make “quick fixes” impossible, EOIR is “wholly owned and operated” by the Executive. 

Systemic institutional reforms like replacement or reassignment of unqualified judicial and administrative personnel could, and should, have been a top priority for the Biden Administration. But, instead the tone deaf “it’s only immigration not a real priority” approach by Garland has allowed life-threatening legal malfeasance at EOIR to fester, spread, and undermine confidence in the ability of our democracy to survive.

News flash for Garland: EOIR is where the “rubber meets the road” for American justice. You continue to ignore and downplay the need for bold decisive corrective action at your own peril — and our nation’s!

Whatever happened to the teaching of basic legal ethics and responsibilities to society? The Jim Crow agendas of today differ little from those of the pre-civil rights era of the 20th Century. These are NOT debates between legitimate “differing viewpoints,” but essentially questions of truth vs. lies, hate v. tolerance, integration v. exploitation; 
  • The White Nationalist Right is taking over school boards and local governance in the false name of “parents’ rights” — actually meaning the rights of far right parents to impose their minority religious doctrines and false social doctrines on others. The fight for social justice begins at the local level where where teaching of truth and legitimate debates are being drowned out by disgruntled, anti-democracy, empowered White Nationalist theocrats who claim they want liberty but actually are trying to impose autocracy and minority rule;
  • The fight for social justice never ends!

But over the airwaves and online, another story is playing out: an absolute torrent of ads meant to frighten and anger voters about immigration.

A new report from the pro-immigration group America’s Voice seeks to document this ongoing phenomenon. One of its key conclusions: “Republicans have made their nativist narrative a top messaging priority.”

In the world of Republican campaign ads, very little has changed since the xenophobic Trump presidency, and some of what’s in these ads is truly repellent.

Three themes dominate these ads, the report finds, and they are all wildly inflammatory and profoundly dishonest: The Biden administration has created “open borders,” undocumented immigrants are responsible for fentanyl overdoses and a full-blown “invasion” is underway.

The borders are anything but open; the Biden administration is pursuing, arresting and deporting people seeking to come to the United States by the thousands. The vast majority of fentanyl that comes in is smuggled through ports of entry in cars, boats and planes, not carried by undocumented immigrants. And as for an “invasion,” that’s no more true now than it was when Trump warned that caravans were about to overrun the country.

But the Republican ads portray horror and chaos — usually with a non-White face. Some ads show pictures of young Black men walking through rivers on their way to “invade” America, with language suggesting this “invasion” brings “terrorists, drugs and crime.”

Other ads say the Biden administration is supposedly “importing 20 million illegals and giving them amnesty” (the image for that one is people in Haiti), which can only be stopped by “a declaration of invasion.”

In some ads it’s not just an open border but a “wide open border” — once again, illustrated with pictures of Haitians. In others we’re told that “human, sex and drug trafficking are out of control because of Democrat governance,” while Democratic candidates “refuse to oppose Biden’s open border policy.”

Of course, there is no open border policy, but why should the fact that it doesn’t exist stop Democrats from opposing it? That just shows how sinister they are, these ads say, because they “want to destroy this country.”

All of this captures something essential about this political moment. For months, Republicans were certain they could spread fears of chaos in order to ride to victory in the midterms. They’d run on crime and immigration, not just to excite the base but also to scare unsettled swing voters.

Yet the dynamic unexpectedly shifted, and now disorder and, dare we say it, crime — as in the potential crimes of Donald Trump and many Jan. 6 defendants — are not necessarily playing in the GOP’s favor. The overturning of Roe v. Wade has unleashed another form of chaos and a host of new dangers threatening women. And all of these things are energizing Democrats.

“Republicans are indulging in the worst kind of White nationalist rhetoric,” Frank Sharry, the executive director of America’s Voice, told us. “And an issue they thought would win over swing voters is at best a base mobilizer for voters they already have.”

What makes this all really ugly, however, is that the messaging remaining under the radar — which Democrats bear some blame for, having gone quiet on the issue — allows it to continue mostly unexamined. This, even though its worst incarnations — such as “great replacement theory” — have inspired recent mass shootings.

Along these lines, it’s worth keeping an eye on Blake Masters, the GOP Senate candidate in Arizona. He has trafficked heavily in great replacement theory and has run truly vile ads on immigration, including one that features machine-gun fire at the border. Yet in a place President Biden won by a whisker that’s also a border state, Masters is trailing by a meaningful margin.

As Sharry told us, Masters’s whole “declare an invasion” line “is not working, in a state where one-third of the voters are independents and border security is a top issue.”

Yet whether it works with independents and swing voters, this foul sewage has been flowing unabated. And it will surely continue to do so.

The idea that individuals seeking to find a U.S. official who will listen to their asylum cases would be trucking along large amounts of fentanyl in their backpacks is facially absurd.

Ending scofflaw Trump failures to follow asylum and refugee laws at the border and beyond would not halt all illegal entries. No policy will do that, nor has there ever been one that even came close, although illegal incursions have risen and fallen over the years.

But, fair refugee and asylum programs that actually interpreted the applicable domestic and international laws correctly (instead of the “any reason to deny, no matter how wrong attitude” still widespread and tolerated at both Mayorkas’s DHS and Garland’s DOJ) and generously granted protection as was the intention behind the UN Refugee Convention in the first place would certainly encourage large segments of those now forced to irregularly cross the border instead to apply abroad or at legal ports of entry. 

It would also facilitate the USG working with NGOs, the UNHCR, states, and localities to get individuals needed assistance so that their legal claims could be processed in a fair, efficient, and timely manner. The latter objectives seem to have totally eluded both Mayorkas and particularly Garland. They continue to “blow off the experts” and flounder with mindless, “designed to fail,” “deterrence-focused” gimmicks. Talk about a lose-lose!

Also to state the obvious, if CBP were less focused on apprehending individuals who pose no real threat to the U.S., but merely want a fair shot at applying for legal protection — something our laws require that Trump annihilated, the Federal Courts have flubbed,  and Biden has done a substandard job of re-instituting — they would have time to focus more resources on drug and human smugglers. 

Instead, in perhaps one of the dumbest and most wasteful juxtapositions in recent American history, the CBP focus is on “apprehending” (a term I use lightly, since many individuals “want” to be “found,” so they can get access to the system otherwise improperly denied to them by CBP) those  merely seeking to comply with the law! To do that, CBP ignores or misses many of those who actually pose threats. At the same time, both DHS and DOJ use methods, attitudes, and legal interpretations that themselves undermine fundamental fairness, the rule of law, and humanity itself.

Immigrants are America’s past, present, and future! Indeed, climate change, rising oceans, drought, starvation, transportation improvements, globalized commerce, wars, religious bigotry, pandemics, and other factors beyond the control of any one government will continue to drive worldwide migration. 

Building walls, prisons, hate, resentment, and constructing bogus “invasion myths” will not change the reality of human migration and the necessity to adopt to and harness it in a smart, humane, realistic manner. Doing the opposite, will only diminish us as a nation and inhibit our own chances for future prosperity. But, in the end, it won’t stop human migration.

Sometimes we write a lot of words on Steady. Today will be an exception. Because for all that there is to say, for all that needs to be said, for all that an accounting for history requires we say, the general sentiments are quite simple:

They knew. They all knew.

It was clear to anyone who had an ounce of appreciation for what the job of the presidency entails, to anyone who respected the constitutional order of our government, to anyone who worried about the health and safety of this nation, to anyone with a moral compass, to anyone who prizes the common sense of purpose that great leaders can summon, that Donald J. Trump had no business anywhere near the presidency.

Now, as he melts down in the face of a serious criminal investigation, as we see pictures of how he stored classified material and his utter disregard for our nation’s most sensitive secrets, as we are left to wonder what he was up to and what damage was done, we should recognize that we would not be where we are today without his enablers, apologists, and hangers-on.

They heralded his outrageousness in a chorus of sycophancy.
They feted his vileness.
They viciously attacked those who pointed out the obvious, that Trump was mentally, emotionally, intellectually, morally, and constitutionally unfit for his office.

And who are they? They are the Republican politicians, the so-called serious ones who expressed their concerns in private even as they used Trump to achieve their desired tax cuts and judges. They are the members of his administration — senior and junior — who jockeyed to maximize their career benefit at the expense of doing the necessary work for the American people. They are the lawyers who twisted themselves into pretzels to try to legalize his inherent lawlessness. They are the media personalities who saw Trump as a printing press for their accrual of wealth and power. They are the capitalists who put corporate earnings ahead of the well-being of the nation.

While Trump’s voters were primed with a toxic stew of hatred, bigotry, and divisiveness, the small cabal playing the inside game didn’t bother with the MAGA hats. They were too busy trading access for favors. The naked self-interest was so rampant that Trump’s West Wing could be considered a nudist colony where decency was shed instead of clothing.

But make no mistake…

In their cowardice, they knew.
In their cynicism, they knew.
In their contempt, they knew.
In their rationalizations, they knew.
In their acquittals of his conduct, even for impeachment, they knew.

They knew when they could have stopped him — before he became president, and once he was president.

But they didn’t stop him. And with their inaction, they encouraged him.

As the Trump bubble begins to pop, all these people who knew what he was all along will likely scurry like cockroaches when the lights go on. They will make all sorts of excuses for their complicity. They will gaslight, lie, and try to rewrite history. You can already see it in many of their so-called tell-all books. Except what they are telling is only the story they want people to hear. It is not the truth.

The truth is that they don’t dare say what we all know. They knew.

The IJ credited Bimpong’s testimony, and the BIA did not disturb this finding. Yet the BIA concluded that Bimpong’s persecution was a personal land dispute that lacked any nexus to his membership in the Ashanti tribe. In doing so, the BIA deferred to the IJ’s conclusion that “the record is devoid of any evidence indicating that the [Enzema] Tribe targeted the applicant because of membership in the Ashanti Tribe.” AR 97 (emphasis added). That conclusion defies the record, which is replete with evidence that Bimpong’s tribal affiliation was a central reason for his persecution. See, e.g., AR 157, 162-63, 167–68, 185, 596, 598. Typical BIA BS prejudged, form denial “boilerplate.” “Devoid of evidence” — gimmie a break! We tried (obviously unsuccessfully) to eliminate this type of non-analytical nonsense several decades ago. It’s indicative of a totally broken system that is unfair and biased against migrants! Why is Garland allowing this continuing systemic injustice?

Demand that Garland replace his inept, unprofessional, unconstitutional, “Trump holdover” BIA with real judges who are experts in immigration, asylum, human rights, and fully committed to due process and fundamental fairness! 

To quote my good friend and Round Table 🛡 colleague, Hon. “Sir Jeffrey” Chase:

At the IJ level, the ACIJs have to be charged with determining if the IJ actually doesn’t know the law, or if they are choosing not to follow it.  Of course, you need ACIJs who actually know immigration law, which isn’t always the case anymore.  If it’s the former, you schedule additional training; if it’s the latter, they may need to suspend or remove the IJ.  That should be a priority for the next Chief IJ.

But why isn’t this being caught at the BIA level?  They continue to act as a rubber stamp.  There have been a few cases just in the past couple of weeks where the errors were really major and apparent.
A BIA that would “rubber stamp” denials without question or meaningful analysis so that OIL could then argue “deference” to railroad refugees and other individuals entitled to relief out of the country is precisely what Barr and Sessions intended to create. In other words, a “parody of justice” that would carry out the White Nationalist restrictionist agenda without giving it any thought. And, it’s no coincidence that this unconstitutional agenda falls hardest on the backs of  asylum seekers and other migrants of color. It also serves to reinforce the vile concept that individuals of color in the U.S. are not equal under the law.
The real question here is why Garland hasn’t effectively changed the system by bringing in real judges who are experts in immigration and human rights and who would be fair to all coming before his Immigration Courts regardless of race or status? “Gradual change” is unacceptable when individuals (and their conscientious representatives) are being subjected to deadly quasi-judicial incompetence on a daily basis. Tell Garland you’ve had enough!

As MAGA thugs are wont to do, their reaction to the lawful search at former president Donald Trump’s Mar-a-Lago home, which we now know might have been related to nuclear secrets (which Trump has denied), amounted to an stream of insults and threats designed to whip up unhinged, violent characters.

While the exact motives of the person who attacked FBI offices in Cincinnati on Thursday remain unknown, reports indicate he was in D.C. in the days leading up the Jan. 6 insurrection and might have been at the U.S. Capitol that day. The GOP’s cycle of incitement and violence continues.

FBI Director Christopher A. Wray was properly outraged. “Unfounded attacks on the integrity of the FBI erode respect for the rule of law and are a grave disservice to the men and women who sacrifice so much to protect others,” he said in a written statement on Thursday. “Violence and threats against law enforcement, including the FBI, are dangerous and should be deeply concerning to all Americans. Every day I see the men and women of the FBI doing their jobs professionally and with rigor, objectivity, and a fierce commitment to our mission of protecting the American people and upholding the Constitution. I am proud to serve alongside them.”

“Undesirable Immigrants: Why Racism Persists in International Migration”

In the book, you dispute the assumption that the right to border control and to exclude foreigners is an inherent feature of sovereign states. Instead, you frame it as a “modern consequence of racism.” Why do you see it that way?

The nation-state is a relatively modern invention on the scale of human history. Today, we have this conventional wisdom floating around that it is the natural right and duty of nation-states as sovereign entities to be able to restrict foreigners and have these really hard borders—and that it’s that ability that makes a state what it is. Actually, if you go back in time and look at the international legal thought that emerged from the 15th through the 19th centuries on what it actually means to be a state, the commonly held assumption that people like the late Justice [Antonin] Scalia and others talk about, is actually an invention of the 19th century. In the 16th and 17th centuries, the great thinkers of international legal jurisprudence or of state theory either thought that states had a right or an obligation to be hospitable to foreigners and to allow them free passage into their territory or, at most, it was up for raucous debate. It was only in the 19th century, when immigrant-receiving countries like the United States began receiving a large influx of racially different outsiders like the Chinese, that this presumption that sovereign states have a right and an obligation that can be tied back to their status as sovereign states to restrict outsiders emerged.

People like Texas Governor Greg Abbott seem to invoke that supposed inherent right when they describe migrants at the border as an “invasion.”

Precisely. These types of “declarations of war” are one of the clearest examples of this ideology seeping into public debate, which leads everyday people to create this idea that migrants are undesirable outsiders who are not fit for, or are undeserving of reaping the benefits of living in the United States or participating in our society.

The myth of the “undesirable immigrant” — at the heart of the anti-immigrant rabble rousing of Trump, Miller, Bannon, DeSantis, Abbott, Cotton, Hawley, etc. — has deep roots in American racial history.

I’ve said it many times: There will be neither racial justice nor equal justice for all without justice for immigrants (regardless of status). Laws like the Refugee Act of 1980, that very explicitly make arrival status irrelevant to access to a fair legal process, have been intentionally misinterpreted and misapplied by right-wing judges from the Supremes all the way down to the Immigration Courts. 

Advocates for civil rights, womens’ rights, LGBTQ+ rights, voting rights, disability rights, and other fundamental rights that have been unlawfully restricted or diminished, usually, but certainly not exclusively, by the right, who continue to ignore the primacy of dealing with the intentional unfair, racially biased treatment of migrants do so at their own peril!

Al Otro Lado v. Mayorkas

U.S. District Judge Cynthia Bashant minces no words in blasting both the unlawful, cruel, and unconstitutional policy and the Supreme’s toxic decision to look the other way as immigration enforcement runs roughshod over legal, constitutional, and human rights. 

In its September 2, 2021 decision, this Court held the right to access the U.S. asylum

process conferred vis a vis § 1158(a)(1) applies extraterritorially to noncitizens who are

arriving at Class A POEs along the U.S.-Mexico border, but who are not yet within the

jurisdiction of the United States, and is of a constitutional dimension. (Op. Granting in

Part and Denying in Part Parties’ Cross-Mots. for Summ. J. (“MSJ Opinion”), ECF No.

742.) It further held that Defendants’ systematic turnbacks of asylum seekers arriving at

Class A POEs (the “Turnback Policy”) amounted to an unlawful withholding by

immigration officials of their mandatory ministerial “inspection and referral duties”

detailed in 8 U.S.C. § 1225 (“§ 1225”), in violation of the Administrative Procedures Act,

5 U.S.C. § 706(1) et seq., and the Fifth Amendment Due Process Clause. (MSJ Opinion at

33–34, 37–38); see 8 U.S.C. §§ 1225(a)(3) (mapping out immigration officials’ duty to

inspect asylum seekers), 1225(b)(1)(A)(ii) (mapping out immigration officials’ duty to

refer asylum seekers to the U.S-asylum process).

In casting appropriate equitable relief to rectify the irreparable injury Defendants’

unauthorized and constitutionally violative Turnback Policy has inflicted upon members

of the Plaintiff class,2 this Court ordinarily would be guided by the fundamental principle

that an equitable remedy should be commensurate with the violations it is designed to

vindicate. See Columbus Bd. of Educ. v. Penick, 443 U.S. 449, 465 (1979) (“[It is an]

accepted rule that the remedy imposed by a court of equity should be commensurate with

the violation ascertained.”). Equitable relief should leave no stone unturned: it should

correct entirely the violations it is aimed at vindicating. That cornerstone of Article III

courts’ equitable powers generally is unfaltering, whether the party against whom an

injunction is sought is a private entity, a state actor, or, as here, a federal official. Thus, in

2 Plaintiffs consist of the named Plaintiffs listed in the case caption, along with a certified class

consisting of “all noncitizens who seek or will seek to access the U.S. asylum process by presenting

themselves at a Class A [POE] on the U.S.-Mexico border, and were or will be denied access to the U.S.

asylum process by or at the instruction of [Customs and Border Protection] officials on or after January 1,

2016.” (Class Certification Order at 18, ECF No. 513.) The Court also certified a subclass consisting of

“all noncitizens who were or will be denied access to the U.S. asylum process at a Class A POE on the

U.S.-Mexico border as a result of Defendants’ metering policy on or after January 1, 2016.” (Id.)

the ordinary course of things, this Court would not hesitate to issue broad, programmatic

relief enjoining Defendants from now, or in the future, turning back asylum seekers in the

process of arriving at Class A POEs, absent a valid statutory basis for doing so.

Yet the circumstances with which this Court is presented are not ordinary because

of the extraordinary, intervening decision of the United States Supreme Court in Garland

v. Aleman Gonzalez, 142 S. Ct. 2057 (2022). That decision takes a sledgehammer to the

premise that immigration enforcement agencies are bound to implement their mandatory

ministerial duties prescribed by Congress, including their obligation to inspect and refer

arriving noncitizens for asylum, and that, when immigration enforcement agencies deviate

from those duties, lower courts have authority to issue equitable relief to enjoin the

resulting violations. It does so through unprecedented expansion of a provision of the

Illegal Immigration Reform and Immigrant Responsibility Act of 1989 (“IIRIRA”), 8

U.S.C. § 1252(f)(1) et seq. (“§ 1252(f)(1)”), which for years the Ninth Circuit has

interpreted as placing a relatively narrow limit on injunctive relief. In essence, Aleman

Gonzalez holds that § 1252(f)(1) prohibits lower courts from issuing class-wide injunctions

that “require officials to take actions that (in the Government’s view) are not required” by

certain removal statutes, including § 1225, or “to refrain from actions that (again in the

Government’s view) are allowed” by those same provisions. Id., 142 S. Ct. at 2065.

Federal courts (except for the Supreme Court) now may only issue injunctions enjoining

federal officials’ unauthorized implementation of the removal statutes in the individual

cases of noncitizens against whom removal proceedings have been initiated. See id.

In no uncertain terms, the logical extension of Aleman Gonzalez appears to bestow

immigration enforcement agencies carte blanche to implement immigration enforcement

policies that clearly are unauthorized by the statutes under which they operate because the

Government need only claim authority to implement to immunize itself from the federal

judiciary’s oversight.

With acknowledgment that its decision will further contribute to the human suffering

of asylum seekers enduring squalid and dangerous conditions in Mexican border

communities as they await entry to POEs, this Court finds the shadow of Aleman Gonzalez

inescapable in this case. Even the most narrow, meaningful equitable relief would have

the effect of interfering with the “operation” of § 1225, as that term is construed by the

Aleman Gonzalez Court, and, thus, would clash with § 1252(f)(1)’s remedy bar. Aleman

Gonzalez not only renders uneconomical vindication of Plaintiff class members’

statutorily- and constitutionally-protected right to apply for asylum, those inefficiencies

inevitably will lead to innumerable instances in which Plaintiff class members will be

unable to vindicate their rights at all. Thus, while the majority and dissent in Aleman

Gonzalez hash out their textual disagreements concerning § 1252(f)(1)’s scope in terms of

remedies, make no mistake, Aleman Gonzalez leaves largely unrestrained immigration

enforcement agencies to rapaciously scale back rights. See Tracy A. Thomas, Ubi Jus, Ibi

Remedium: The Fundamental Right to a Remedy Under Due Process, 41 San Diego L.

Rev. 1633, 1634 (2004) (“Disputes over remedies provide a convenient way for dissenters

to resist conformance to legal guarantees. Courts can declare rights, but then default in the

remedy to avoid a politically unpopular result.” (footnote omitted)).

Although it is no substitute for a permanent injunction, class-wide declaratory relief

is both available and warranted here. In lieu of even a circumscribed injunction enjoining

Defendants from again implementing a policy under which they turn back asylum seekers

presenting themselves at POEs along the U.S.-Mexico border, the Court enters a

declaration in accordance with its MSJ Opinion that turning back asylum seekers

constitutes both an unlawful withholding of Defendants’ mandatory ministerial inspection

and referral duties under § 1158 and § 1225 in violation of both the APA and the Fifth

Amendment Due Process Clause. The Court also issues relief as necessary to named

Plaintiff Beatrice Doe.

Meanwhile, Secretary Mayorkas exercised the authority recognized by the Supremes in Biden v. Texas to terminate the reprehensible and illegal “Remain in Mexico” (a/k/a “Let ‘Em Die in Mexico”) program engineered by Trump and Miller. Predictably, the same scofflaw, restrictionist “Red AG’s” who had instituted frivolous litigation to block this long overdue action filed more specious objections with the Trump-appointed US District Judge, as advocacy groups like Justice Action Center (“JAC”) pledged to fight the racist right until this vile (and highly ineffective) program is finally ended.

JAC Responds to Official Termination of Remain in Mexico, Attempts by Texas to Delay Wind-Down

WASHINGTON, D.C. — In a victory for immigrants’ rights movement, the Remain in Mexico program has been officially terminated after court proceedings following the Supreme Court’s ruling in Biden v. Texas on June 30. Below is a statement from Justice Action Center founder and director Karen Tumlin:

“The official end to shameful Remain in Mexico program is a victory for the immigrants’ rights movement and the right to asylum. RMX is a stain on the country’s history, having harmed tens of thousands of people fleeing for their lives since the Trump Administration instituted the unlawful and immoral program in 2019.

“Since the Supreme Court’s ruling affirming the authority of the Biden Administration to end the RMX program, the #SafeNotStranded campaign has called on the President and DHS to implement a swift and humane wind-down, including halting all new enrollments and allowing everyone in RMX to safely pursue their asylum claims in the U.S. Yesterday, DHS stated its wind-down has begun and new people will not be enrolled in the program, and that it would disenroll individuals with upcoming RMX hearings. These are important first steps to finally redress just some of the immense harm inflicted by the program.

“This commitment by DHS, following such a significant SCOTUS victory, illustrates the strength and resilience of the immigrants’ rights movement. But even after a clear loss, Texas is continuing its hateful attempts to keep this deadly program in place for as long as possible: After the District Court rightfully vacated its injunction of the RMX wind-down yesterday, Texas unfortunately—yet unsurprisingly—filed an amended complaint challenging the second DHS memo rescinding RMX, as well as a motion asking the District Court to stay the memo’s effective date.

“But we will not be deterred: advocates will continue to fight back against ongoing red state efforts to continue Trump’s racist and xenophobic agenda and work towards a world where all people fleeing danger can be safe, not stranded.”

Border Chron: Facial recognition has become the primary biometric technology for CBP. Everyone who enters the country has their picture taken, though supposedly people can opt out (that often isn’t obvious, thanks to a lack of signage; I cross the border constantly and have never seen anything about opting out). The surveillance technology has also been deployed at 32 airports for people exiting the country. CBP partners with airports and airlines to add another layer to this private-public nexus.

Much has been made of the ensuing polarization in our politics, and it’s true that moderates are a vanishing breed. But the problem isn’t primarily polarization. The problem is that one of our two major political parties has ceased good-faith participation in the democratic process. Of course, there are instances of violence, disinformation, racism and corruption among Democrats and the political left, but the scale isn’t at all comparable. Only one party fomented a bloody insurrection and even after that voted in large numbers (139 House Republicans, a two-thirds majority) to overturn the will of the voters in the 2020 election. Only one party promotes a web of conspiracy theories in place of facts. Only one party is trying to restrict voting and discredit elections. Only one party is stoking fear of minorities and immigrants.

Admittedly, I’m partisan — not for Democrats but for democrats. Republicans have become an authoritarian faction fighting democracy — and there’s a perfectly logical reason for this: Democracy is working against Republicans. In the eight presidential contests since 1988, the GOP candidate has won a majority of the popular vote only once, in 2004. As the United States approaches majority-minority status (the White population, 76 percent of the country in 1990, is now 58 percent and will drop below 50 percent around 2045), Republicans have become the voice of White people, particularly those without college degrees, who fear the loss of their way of life in a multicultural America. White grievance and White fear drive Republican identity more than any other factor — and in turn drive the tribalism and dysfunction in the U.S. political system.

Other factors sped the party’s turn toward nihilism: Concurrent with the rise of Gingrich was the ascent of conservative talk radio, followed by the triumph of Fox News, followed by the advent of social media. Combined, they created a media environment that allows Republican politicians and their voters to seal themselves in an echo chamber of “alternative facts.” Globally, south-to-north migration has ignited nationalist movements around the world and created a new era of autocrats. The disappearance of the Greatest Generation, tempered by war, brought to power a new generation of culture warriors.

But the biggest cause is race. The parties re-sorted themselves after the epochal changes of the 1960s, which expanded civil rights, voting rights and immigration. Richard Nixon’s “Southern Strategy” began an appeal to White voters alienated by racial progress, and, in the years that followed, a new generation of Republicans took that racist undertone and made it the melody.

It is crucial to understand that Donald Trump didn’t create this noxious environment. He isn’t some hideous, orange Venus emerging from the half-shell. Rather, he is a brilliant opportunist; he saw the direction the Republican Party was taking and the appetites it was stoking. The onetime pro-choice advocate of universal health care reinvented himself to give Republicans what they wanted. Because Trump is merely a reflection of the sickness in the GOP, the problem won’t go away when he does.

If not, the younger generation of the NDPA needs to come up with ways of keeping the GOP out of political power from the top to the bottom.

Between 2015 and 2020, about fifty bodies were recovered each year in Brooks County, according to an S.T.H.R.C. report. Then came Title 42, a policy enacted by the Trump Administration at the start of the COVID-19 pandemic that closed ports of entry and blocked most avenues for asylum claims, ostensibly for public-health reasons. The policy, which is still in place in a modified form, has increased business for smuggling cartels and spurred people to cross in more dangerous places. “Before Title 42, the calls we got used to be, like, eighty-per-cent apprehended, twenty-per-cent missing,” Canales said. “Now it’s flipped—it’s more like twenty-per-cent apprehended, eighty-per-cent missing.” So far this year, there have been nearly seventy recoveries of remains in Brooks County, putting 2022 on track to be the deadliest year on record.

So, before the Trump Administration’s bogus, racist “invocation” of Title 42, 80% of migrants came to the border or were easily apprehended close thereto — most probably because they turned themselves in to seek asylum through the legal system. And, lets not forget, this was with an already badly broken, fundamentally unfair, asylum legal adjudication system intentionally biased and “loaded” against legitimate refugees seeking protection!

Smart, honest public policy would have improved asylum adjudication at USCIS and at EOIR to quickly recognize and grant, with the assistance of NGOs and legal assistance groups, the many cases of legitimate refugees so that they could take their rightful, legal places in our society.

Additionally, by taking refugees seeking legal determinations “out of the equation,” enforcement against those seeking to evade legal processing — certainly a much, much smaller “universe” than is “out there now” — would have been enhanced. Business would have declined for smugglers, as those seeking protection would have been motivated to use a humane, fair, functioning legal system rather than being forced into “do it yourself” refuge!

You don’t have a genius to figure this out — just not be motivated solely by racism like Stephen Miller and his Trump regime cronies! Better qualified — non-Jim Crow righty — Federal Judges would also produce more humane, honest, and rational results.

Additionally, by running a legitimate asylum system, and complementing it with an honest, robust, legal refugee system for Latin America, the Caribbean, and Africa, we would finally have sound data on how many of those seeking to enter at the Southern Border are entitled to immigrate as legal refugees and how many are non-refugees. That’s something on which we now have no reliable information  — just myths and anecdotes, many provided by racist restrictionists and nativists with neither expertise in asylum law nor any real interest in the rule of law at the border.

As a result of Title 42, and the unqualified “Jim Crow” Federal Judges, GOP nativist AGs, and their apologists (including some in the media who repeat or republish, without critical examination, GOP racist lies about the border), we now have a deadlier than ever border; the legal immigration system at the border has been functionally abolished and replaced with an underground, extralegal system; the U.S. Government has ceded control of border migration policy to cartels and smugglers; and the job of the Border Patrol — forced to spend time apprehending legal refugees who seek only the protection to which they are legally entitled — has become impossible.

That’s what happens when we let GOP nativist pols, overt racists, and bad, right wing Federal Judges take over the immigration policies that were actually enacted by Congress — a key part of which are legitimate refugee and asylum systems and a fair, functioning, expert Immigration Court. Right now, we have NONE of the foregoing. And, innocent migrants at the border are too often paying the price — with their lives!

“Enforcing the law” does NOT mean unfairly, unwisely, and illegally abrogating the legal asylum system and fair adjudications in Immigration Court at the border. It means fixing the legal asylum system including USCIS Asylum Offices. Perhaps most of all, it means reforming and replacing where necessary the broken, dysfunctional, leaderless, and non-expert Immigration Courts and a BIA that continues to misinterpret asylum and protection laws on a daily basis. We need a BIA of real judges with the expertise and guts to establish fair, humane, correct, positive precedents and to rein in or remove from asylum cases those Immigration Judges who are “programmed to reject, not protect!”

I, along with many others, watched the Brittney Griner travesty unfold. I saw the irony. President Biden was rightfully blasting the outrageous “kangaroo court” show trial that passes for justice in Russia. But, at the same time, he, Harris, and Garland are basically running a farcical “Russian style” dysfunctional immigrant “justice” system at EOIR and calling it a “court!”

Perhaps, in addition to blasting the Griner farce, President Biden, VP Harris, and AG Garland need to take a closer look at the “Russian-style” justice being inflicted on migrants in their wholly-owned Immigration “Courts”  — which particularly target women, children, and migrants of color seeking justice under US laws. Indeed, many are still being arbitrarily returned without ANY process at all! Others get “off the wall” denials of their valid claims. Its this REALLY any way for a self-proclaimed “nation of laws” to operate?

The entire team at Kids In Need of Defense is devastated by the news that at least 46 people were found dead in an abandoned tractor-trailer in Texas and more than a dozen others in the truck, including children, were taken to local hospitals for treatment. While we wait for more details to emerge, we wanted to share the following statement from our President, Wendy Young.

 

“As rising violence, natural disasters, and other threats force migrants to make impossible choices in their quest to find safety, our nation’s response cannot be to place families and children in further harm by indefinitely closing our borders to people seeking protection and ignoring the dangers they face in their home countries. This most recent tragedy and the disturbing rise in migrant deaths globally underscore the need to create safer pathways to protection for refugees. The Biden Administration should see this heartbreaking tragedy for what it is, a clarion call to abandon deeply flawed and dangerous immigration policies. It must reinstate humane and orderly processing, including reopening official ports of entry, hiring child welfare experts to care for and screen children, and provide fair adjudication of protection claims. It is time for the United States to regain its footing as a leader in the protection of migrant families and children.”

The key part of Wendy’s statement: “including reopening official ports of entry, hiring child welfare experts to care for and screen children, and provide fair adjudication of protection claims.” 

Denial rates for recent arrivals who manage to get hearings (see, e.g., Garland’s bogus “dedicated dockets,” — actually “dedicated to denial” and nothing else), many of them children and unrepresented, hover around 100%. They are “guided” by a “largely holdover,” anti-asylum BIA that lacks true asylum expertise and issues no positive precedents instructing judges on how to consistently and legally grant asylum. Consequently, there is no “fair adjudication” of asylum claims. That feeds the toxic nativist myth that nobody at the Southern Border is a “legitimate” asylum seeker. 

Unless and until Garland tosses the unqualified jurists at EOIR and replaces them with experts committed to due process, fundamental fairness, and correct, generous, practical precedents and proper applications of asylum law, the system will remain in failure. It’s a monumental mistake by the Biden Administration not to fix that which they absolutely control — starting with the Immigration Courts at EOIR.  

Refugees will continue to die at the hands of smugglers who were given control of our immigration system by the Trump Administration and remain empowered by Garland’s & Mayorkas’s  poor performance combined with biased, White Nationalist, Federal Judges appointed by Trump at all levels of our failing justice system!  

Today’s WashPost editorial described how far-right nativists have basically turned our immigration system over to smugglers:

The absence of any workable legal system that would admit migrants systematically, in numbers that would meet the U.S. labor market’s demand, is the original sin of the chaos at the border. That is Congress’s bipartisan failure, a symptom of systemic paralysis for many years. More recently, a public health rule has had the effect of incentivizing unauthorized migrants to make multiple attempts to cross the border. The rule, imposed by the Trump administration, retained for more than a year by the Biden administration, and now frozen in place by Republican judges, allows border authorities to swiftly expel migrants, but with no asylum hearings or criminal consequences for repeated attempts to cross the border. That has been a boon to migrant smuggling networks.

I take issue with the term “bipartisan failure” in the legislative context. It’s true that the Dems inexplicably squandered a golden chance to fix many immigration problems when they had 60 votes in the Senate in Obama’s first two years. But, before and after that time, the failure to achieve realistic, humane, robust legal immigration reform legislation has been on the nativist right of the GOP that now dominates the party. Pretending otherwise is useless and dishonest.

Democrats have made numerous reasonable legislative proposals to bring Dreamers and other long-term productive residents of America out of the underground and into the legal mainstream of our society. All of these proposals would have made long-overdue, common sense reforms to eliminate hopeless backlogs, benefit our economy, strengthen our legal system, and facilitate better allocation of Government resources. Yet, there has been scant GOP interest in improving the system. The GOP appears to believe that promoting a dysfunctional immigration system, denying human rights, and guaranteeing a large “extralegal population” available as scapegoats and exploitable labor best serves their parochial political interests.

Over the last few weeks the long overdue and essential process of weeding out poorly qualified Immigration Judges — still on “probation” at EOIR — finally got off to a very modest start. 

Imagine yourself as a refugee fighting for your life in an asylum system that’s already stacked against you and where the “judges” work for the Attorney General, part of the Executive Branch’s political and law enforcement apparatus. 

How would you like your life to be in the hands of (now) former Immigration Judge Matthew O’Brien. He was appointed in 2020 by former AG Bill Barr — a staunch defender of the Trump/Miller White Nationalist, xenophobic, anti-immigrant agenda.

Nativism A “Qualification?”

What made O’Brien supposedly “qualified” to be a “fair and impartial” administrative judge? 

Was it his enthusiastic support for the cruel, inhumane, illegal, and unconstitutional “policy” of family separation? See, e.g., https://www.fairus.org/issue/border-security/truth-about-zero-tolerance-and-family-separation-what-americans-need-know.

Thankfully, O’Brien will pass into history. But, the damage inflicted by the “official policy of child abuse” will adversely affect generations.

Or, perhaps it was O’Brien’s intimate connection with a leading nativist group. Immediately prior to his appointment, he was the “Research” Director for the Federation for American Immigration Reform (“FAIR”) — a group renowned for sloppy to non-existent “research” and presenting racially-motivated myths and fear mongering as “facts.”

As noted by Nowrasteh, that’s not the only example of FAIR providing “bogus research papers” designed to “rev up hate” and demean the contributions of immigrants both documented and undocumented.

Indeed, recent legitimate scholarly research, based on facts and statistics rather than personal bias, refutes the anti-immigrant myths peddled by FAIR and other nativist shill groups. The Anti-Defamation League (“ADL”), one of America’s most venerable anti-hate, anti-misinformation groups, founded more than a century ago “To stop the defamation of the Jewish people and to secure justice and fair treatment to all,” had this to say about O’Brien’s former employer:

While the majority of the extreme anti-immigrant sentiment in the U.S. emanates from fringe groups like white supremacists and other nativists, there are a number of well-established anti-immigrant groups such as Federation for American Immigration Reform (FAIR), Center for Immigration Studies (CIS), NumbersUSA and The Remembrance Project which have secured a foothold in mainstream politics, and their members play a major role in promoting divisive, dangerous rhetoric and views that demonize immigrants. A number of these groups have attempted to position themselves as legitimate advocates against “illegal immigration” while using stereotypes, conspiracy theories and outright bigotry to disparage immigrants and hold them responsible for a number of societal ills.  A decade ago, most of this bigotry was directed primarily at Latino immigrants, but today, Muslim and Haitian immigrants, among others, are also targeted.

There is a distinct anti-immigrant movement in this country, whose roots can be traced back to the 1970s. Groups such as the Federation for American Immigration Reform (FAIR) and Center for Immigration Studies (CIS) hope to influence general audiences with somewhat sanitized versions of their anti-immigrant views. In their worldview, non-citizens do not enjoy any status or privilege, and any path to citizenship for undocumented immigrants or refugees is portrayed as a threat to current citizens. Like some other problematic movements, the anti-immigrant movement also has a more extreme wing, which includes border vigilante groups, as well as groups and individuals that seek to demonize immigrants by using racist, sometimes threatening language.

Insurmountable Bias

So, perhaps, you say, once actually “on the bench,” Judge O’Brien was able to overcome his biases and knowledge gaps and function as a fair and impartial judicial officer. Nope! Not in the cards!

According to TRAC, O’Brien denied almost every asylum case he heard (96.4% denials). That was, astoundingly, nearly 40% above the average of his colleagues in Arlington and nearly 30% higher than the nationwide asylum denial rate of approximately 67%.

But, to put this in perspective, we have to recognize that this denial rate had already been intentionally and artificially increased by a expanded,”packed,” politicized, “weaponized,” and intentionally “dumbed down” EOIR during the Sessions/Barr era at DOJ. For example, approximately 10 years ago, more than 50% of asylum, cases were being granted annually nationwide, and approximately 75% of the asylum cases in Arlington were granted. See, e.g., https://trac.syr.edu/immigration/reports/judge2014/00001WAS/index.html. And, even then, most asylum experts would have said that the nationwide grant rate was too low.

Gaming The System For Denial

It’s not that conditions in “refugee/asylum sending” countries have gotten better over the past decade! Far from it! The refugee situation today is as bad as it has ever been since WWII and getting worse every day. 

So, why would legal refugee admissions be plunging to record lows (despite a rather disingenuous “increase in the refugee ceiling” by the Biden Administration) and asylum denials up dramatically over the past decade? 

It has little or nothing to do with asylum law or the realities of the worldwide refugee flow, particularly from Latin American and Caribbean countries. No, it has to do with an intentional move, started under Bush II, tolerated or somewhat encouraged in the Obama Administration, but greatly accelerated during the Trump-era, to “kneecap” the legal refugee and asylum processing programs. Indeed, the “near zeroing-out” of refugee and asylum admissions and the illegal replacement of Asylum Officers by totally unqualified CBP Agents by the Trump Administration are two of the most egregious examples. 

This was “complimented” by an intentional move to weaponize the Immigration Courts at EOIR as a tool of Stephen Miller’s White Nationalist immigration enforcement regime. The number of Immigration Judges doubled, hiring was expedited using an opaque and intentionally restrictive process, and most new appointees were from the ranks of prosecutors — some with little or no experience in asylum law. Even conservative commentators like Nolan Rappaport at The Hill expressed grave concerns about the problematic qualifications of many of the new hires.  See, e.g.https://immigrationcourtside.com/2020/02/05/no-expertise-necessary-at-the-new-eoir-immigration-judges-no-longer-need-to-demonstrate-immigration-experience-just-a-willingness-to-send-migrants-to-potential/.

Ironically, the EOIR backlog tripled. Under the “maliciously incompetent management” of the Trump group at DOJ, more judges actually meant more backlog! How is that giving taxpayers “value” for their money?

Some of the new judges, like O’Brien and some of the Immigration Judges “elevated” to the BIA, were appointed specifically because of their established records of anti-asylum bias, rude treatment of attorneys, and dehumanizing treatment of asylum seekers and other migrants. 

“Ignorance And Contempt”

It’s not like O’Brien was just your “garden variety” “conservative jurist.”  (I’ve actually worked with many of the latter over the years). No, he was notorious for his lack of scholarship, rudeness, and bias!

Here are a few of the comments he received on “RateYourJudge.com:”

      • “Rarely grants cases. No knowledge of the law, only there to deny cases. He needs to be removed.”

    • “Biased judge, hates immigrants and even kids of immigrants.”
    • “Incompetent.”
    • “One of the most condescending and self-righteous judges I have had the displeasure to hear. His word choice and tone left absolutely no doubt that he considered the Respondent to be beneath his notice, even to the point of referring to her as “the female Respondent” and to her domestic partner as a “paramour”. I have heard other judges’ oral opinions on very similar sets of facts, and they were accomplished in a fifth of the time with no loss of dignity to anyone.”
    • “This guy’s ignorance about immigration law and contempt for the people who appear before him is staggering. The way he threatens lawyers is reprehensible. EOIR is a disgrace.”
    • “Horrible human being with no business being on the bench. Shame on EOIR for allowing him to continue adjudicating cases.”
    • “Late, abusive, made up his mind before the case even started, frequently interrupted testimony, yelled at immigrants and their lawyer, and refused to listen to anything we said. Ignorant of the law and facts of the case. He should go back to directing hate groups.”
    • “If I could give 0 stars I would.”

To be fair:

  • Among the stream of negative comments there were three “positive” comments about O’Brien;
  • Most of the comments both positive and negative were “anonymous” or apparent user “pseudonyms;”
  • RateMyImmigrationJudge” is neither comprehensive nor transparent.

Flunking the “Gold Standard”

So, was O’Brien really as horrible as most experts say? Let’s do another type of “reality check.” 

Among the other IJs at the Arlington Immigration Court, two stand out as widely respected expert jurists who have served for decades across Administrations of both parties. Judge John Milo Bryant was first appointed as an Immigration Judge in 1987 under the Reagan Administration. Judge Lawrence Owen Burman was appointed in 1998 under the Clinton Administration. With 66 years of judicial service between them, they would be considered more or less the “gold standard” for well-qualified, subject matter expert, fair and impartial Immigration Judges.

Significantly, according to the last TRAC report, O’Brien’s asylum grant rate of 3,6% was  approximately 1/15th of Judge Bryant’s and approximately 1/22 of Judge Burman’s. https://trac.syr.edu/immigration/reports/judgereports/. Case closed! O’Brien should never have been on a bench where asylum seekers lives were at stake and expertise and fairness are supposed to be job requirements!

“Worse Than O’Brien”

What about now former Arlington Immigration Judge David White who was removed at the same time as O’Brien? Apparently, during his relatively short tenure (appointed by Barr in 2020), White was unable to deny enough asylum to qualify for TRAC’s system (100 decisions minimum). 

Yet, he made an indelible impression on those “sentenced” to appear before him. Here are comments from RateMyImmigrtionJudge.com:

    • “This judge is absolutely terrible. Unfair and biased. He is only here to deny asylum cases regardless of what the person has been through. Completely misstates the facts, doesn’t know the law so goes after credibility (using those misstated facts) as an excuse to say there’s no past persecution. Absolute disgrace.”

    • “Worst judge ever. The clerks at the Immigration Court told the private bar attorneys that they have NEVER seen this judge approve an asylum case. Not one. They have running bets and jokes about him, but he never grants. He writes the denial during the trial instead of listening to the person testify. He is insulting and rude and not at all compassionate about trauma.”

    • “This is the worst immigration judge in Arlington, hands down. He’s even worse than O’Brien, and O’Brien is an former hate-group director.”

    • “Terrible immigration judge. Had his mind made up well before our hearing. Came in with a prewritten denial that misstated the law. Was rude and dismissive about my client’s trauma.”

Wow! Worse than O’Brien. That’s quite an achievement.

GOP Court Packing

Fact is, the overt politicization, “weaponization,” and “dumbing down” of the Immigration Courts goes back nearly two decades to AG John Ashcroft and the Bush II Administration. Ashcroft reduced the size of the BIA as a gimmick to “purge” the supposedly “liberal” judges — those, including me, who voted to uphold the legal rights of migrants against government overreach. In other words, our “transgression” was to stand up for due process and the individual rights of immigrants — actually “our job” as properly defined.

And, the downward spiral has continued. The DOJ Office of Inspector General (“OIG”) actually confirmed some of the Bush II improper Immigration Judge hires. But, they avoided dealing with the “BIA purge” that got the ball rolling downhill at EOIR! The GOP has been much more skillful than Dems in reshaping the Immigration Courts to their liking.

During the Trump Administration, putting clearly unqualified IJs who were some of rudest highest denying in America on the BIA was certainly “packing” and “stacking” EOIR against legitimate asylum seekers. Again, however, the OIG failed to “seal the deal” regarding this outrageous conduct that has undermined our entire justice system, fed uncontrollable backlog, and cost human lives that should and could have been saved. 

Trump’s “court packing scheme” was no “small potatoes” matter, even if some in the Biden Administration are willfully blind to the continuing human rights and due process disaster at EOIR.

Removing two of the most glaringly unqualified Barr appointees in Arlington is a very modest step by AG Garland in the right direction. But, it’s going to take more, much more, decisive action to clean out the unqualified and the deadwood, bring in true expertise and judicial quality, and restore even a modicum of legitimacy and integrity at EOIR.

Reactionaries’ Predictably Absurdist Reaction 

Meanwhile, even this long overdue, well justified, and all too minimal change at EOIR produced totally absurdist reactions from O’Brien and fellow nativists (including some still “hiding out in plain sight” at DOJ) which were picked up by the Washington Times (of course). Don’t believe a word of it!

Tip Of The Iceberg

The removal of guys like O’Brien and White — who never had any business being placed in “quasi-judicial” positions where they exercised life or death authority over refugees of color whose humanity and legal rights they refused to recognize, is just a beginning. The ethical, competence, and judicial attitude rot at EOIR goes much deeper. 

Garland has been dilatory in “cleaning house” at EOIR. Vulnerable individuals who were wrongly rejected rather than properly protected have needlessly suffered, and probably even died, as a result. Poor Immigration Judging and lack of effective, correct, courageous, positive asylum guidance by the BIA has helped fuel a human rights disaster and rule of law collapse at the border!

Perhaps, at long last, Garland has slowly started fixing the unconscionable and unnecessary dysfunction and  intentionally ingrained institutional bias at EOIR. But, I’ll believe it when I see it!

Keep Up The Pressure

In the meantime, it’s critical that NDPA members: 1) keep applying for EOIR judgeships; and 2) ratchet up the pressure and demand the removal of all unqualified Immigration Judges and Appellate Immigration Judges who are undermining sound scholarship, due process, fundamental fairness, and human dignity at EOIR!

Human rights matter! Individual rights matter! Immigrants’ rights matter! Good judges matter!

Today, we are surrounded by too many bad judges, at all levels of our justice system, who reject the first three in favor of warped far-right ideologies, dangerous myths, and disregard for human dignity. The existential battle to get good judges into our system has begun. And, Immigration Courts are the primary theater of action!
