CMS RESEARCH DOCUMENTS TRUMP’S “MALICIOUS INCOMPETENCE” — “Mass Deportation Strategy” Is As Stupid As It Is Cruel — Removing Most Of Those Already Here Without Documents Would Have A Huge NEGATIVE Impact On America!
The New York Times reported that Immigration and Customs Enforcement (ICE) will soon begin conducting a large-scale enforcement action aimed at those with final removal orders, but that “might detain immigrants who happened to be on the scene, even though they were not targets of the raids.” The Center for Migration Studies (CMS) opposes mass deportations because of the immense cost to families, communities, and the US economy.

According to data from the Transactional Records Access Clearinghouse (TRAC) at Syracuse University, “the vast majority (58%) of individuals in ICE custody June 30 [2018] had no criminal record. An even larger proportion—four out of five—either had no record, or had only committed a minor offense such as a traffic violation.” CMS recommends deprioritizing the arrest and removal of long-term residents, persons with US family members, and those without criminal records or with only minor offenses. Here are two of CMS’s recent reports about the effects of deportation.

Mass Deportations Would Impoverish US Families and Create Immense Social Costs

In this paper for the Journal on Migration and Human Security, Donald Kerwin and Robert Warren offer a demographic analysis of the potential impact on US families and children of large-scale deportation of US undocumented residents. Here are some of the key findings:

  • Removing undocumented residents from mixed-status households would reduce median household income from $41,300 to $22,000, a drop of $19,300, or 47 percent, which would plunge millions of US families into poverty.
  • If just one-third of the US-born children of deported undocumented residents remained in the United States following a mass deportation program, which is a very low estimate, the cost of raising those children through their minority would total $118 billion.
  • 2.9 million undocumented residents were 14 years old or younger when they were brought to the United States.
  • About 1.2 million, or 23 percent, of the 5.3 million households that have undocumented residents have mortgages.

Communities in Crisis: Interior Removals and Their Human Consequences

With the Kino Border Initiative (KBI) and the Office of Justice and Ecology (OJE) of the Jesuit Conference of Canada and the United States, CMS studied both the quantitative and qualitative effects of deportation and surveyed 133 deportees, as well as interviewed 20 family members and other persons affected by deportation. Here are some key findings:

  • More than half (56 percent) of those surveyed first entered the country as minors (below age 18), and 21 percent below age 10.
  • Twenty-six percent had been US homeowners.
  • Respondents identified a range of close family members who depended on them financially prior to their deportation, including their mothers (72 percent), fathers (57 percent), and siblings (26 percent). Seventy-eight percent had US citizen children.
  • Roughly one-fourth of survey respondents reported spending no time in criminal custody and 22.6 percent spent a week or less prior to their deportation. However, 17.3 percent spent more than one year.

“My 14-year-old son wants to take on his dad’s responsibilities. Now he wants to go to work with his uncles. He asked them for work, but he doesn’t have the physical ability or age to work in construction, which was his dad’s occupation,” said a mother of three US citizen children and wife of detained immigrant who was interviewed for the report.

E.J. Dionne, Jr. writes in the Washington Post commenting on a recent speech by David Miliband, Chief Executive of the International Rescue Committee:

. . . .

“A new and chilling normal is coming into view,” Miliband concluded. “Civilians seen as fair game for armed combatants, humanitarians seen as an impediment to military tactics and therefore unfortunate but expendable collateral, and investigations of and accountability for war crimes an optional extra for state as well as nonstate actors.”

But these evils cannot be isolated from the larger political corrosion in the rest of the world — and this includes the long-standing democracies themselves. “The checks and balances that protect the lives of the most vulnerable people abroad,” he said, “will only be sustained if we renew the checks and balances that sustain liberty at home.”

This isn’t simply about aligning principle and practice. More fundamentally, when governments abandon a commitment to accountability domestically, they no longer feel any obligation to insist upon it internationally. It’s no accident, as Miliband noted, that under President Trump, the United States “has dropped the promotion of human rights around the world from its policy priorities.”

He pulled no punches: “The new order is epitomized in the photo of Russian President [Vladimir] Putin and Saudi Crown Prince [Mohammed bin] Salman high-fiving each other at the G-20 meeting in Argentina in November last year. With Syria in ruins, Yemen in crisis, and political opponents like Boris Nemtsov and Jamal Khashoggi dead, theirs was the embrace of two leaders unencumbered by national institutions or by the fear of international law.”

Miliband acknowledged the mistakes of an earlier era (including the Iraq War) but argued that “accountability, not impunity” was on the rise in the 1990s, when there was “an unusual consensus across the left-right divide” about “the need for global rules.” We have said goodbye to all that.

In 2002, Samantha Power, later the U.S. ambassador to the United Nations, published “ ‘A Problem from Hell’: America and the Age of Genocide,” a book that stirred consciences about the world’s obligations to helpless people unprotected — and often targeted — by sovereign governments.

Nearly two decades on, we are numb, distracted and inward-looking.

Miliband understands that democratic citizens, grappling with their own discontents, will be inclined to look away from the travails of others “until there is a new economic and social bargain that delivers fair shares at home.”

But an Age of Impunity not only poses immediate dangers to millions confronting violence far away. It also corrodes the sense of obligation of the privileged in wealthy nations toward those left behind. When anything goes, no one is safe.

The key point here for Americans who have been “tone deaf” to Trump’s (and his toadies at DHS, DOJ, DOS, and elsewhere) gross abuses of the rule of law, human rights, and human dignity is the following: “When anything goes, no one is safe.”

WASHINGTON, DC – On July 2, 2019, Attorney General (AG) Barr published a final rule, further expanding his authority to reshape immigration law. The rule was issued in a highly unusual manner by resurrecting an old proposed regulation from 11 years ago and making it final within 60 days without any opportunity for public comment.

AILA President Marketa Lindt said, “This regulation exemplifies why the immigration courts should not be housed under the Department of Justice (DOJ). Under this administration, the AG has already utilized the certification power in an unprecedented manner to unilaterally strip immigration judges of basic operational authorities, interfere with judicial independence, and even attempt to rewrite asylum and detention laws. The American legal system is designed with fundamental procedural protections, such as briefing by the parties, to ensure the decision maker-here the AG-hears all points of view before deciding an important case. This new rule, however, authorizes the AG to singlehandedly designate Board of Immigration Appeals (Board) decisions as precedent – and do so literally overnight bypassing the necessary legal procedures and without any checks and balances.”

AILA Executive Director Benjamin Johnson added, “This is the most aggressive effort to unify control over the immigration courts in 20 years; I have never seen an administration claw back a discarded rule like this in order to further assert its power. The scope of this power grab could be immense. This rule attempts to shield decisions issued by the Board – including decisions for which the Board didn’t even bother to write an opinion – from federal court review and tries to force the U.S. Courts of Appeals to presume that the Board reviewed all the available information and claims made by the parties even if there’s nothing to show the Board did so. Simply put, the AG will have more power with less oversight, and immigrants’ right to appeal to the federal courts will be far more limited. This attack on the judicial branch proves further that our nation urgently needs an independent immigration court system separate from the Department of Justice. Nothing less will suffice.”

Thanks, Laura, for speaking out!

Every Court of Appeals Judge who signs off on one of these constitutionally defective removal orders produced by EOIR, an illegitimate “court” that functions without either fundamental fairness or impartiality under procedures that no such judge would accept if applied to them or their loved ones, should hang his or her head in shame.

Once the Trump nightmare is over, courage and integrity to stand up against Government overreach should be the touchstone for all future Article III judicial appointments. No more “go along to get along” Federal Judges at any level of the system! The Judicial Branch was actually conceived and established as a protector of liberty and justice against tyranny, not as an enabler of, and apologist for, “abuses by the Crown” (or in this case, “the Clown”).

What kind of “judge” stands by and watches while empowered cowards like Trump and Barr unconstitutionally “beat up” on America’s most vulnerable who seek only the basic justice and fairness that our Constitution supposedly guarantees to “all persons.” Judges who allow the dehumanization and “de-personification” of others, in others words “Dred Scottification,” might someday find themselves and those they actually care about becoming “Dred Scott” by their dereliction of duty!

WASHINGTON — Government investigators have identified poor conditions in another sector of the southern border, publishing graphic photos showing extreme overcrowding in Rio Grande Valley migrant facilities and finding that children there did not have access to showers and had to sleep on concrete floors.

Investigators for the Department of Homeland Security who visited border stations in the El Paso, Texas, sector in May found similar conditions: Migrants being held in temporary facilities for weeks rather than days, single adults living in standing room-only cells with no space to lie down, and concerns about serious health risks.

The investigators for the DHS Office of the Inspector General toured five Border Patrol facilities and two ports of entry in the Rio Grande Valley sector during the week of June 10 and published their report as a “management alert” to the department on Tuesday.

Read the full report here.

The Rio Grande valley of Texas has the highest volume of immigrants along the United States-Mexico border. At the time of the visits by investigators, Border Patrol was holding 8,000 detainees in custody, with 3,400 being held longer than the 72-hour limit.

One senior manager at a facility called the situation a “ticking time bomb,” according to the report. When immigrants detained in the facilities saw investigators walking through, they banged on the cell windows and pressed notes against the plexiglass to show the length of time they had spent in custody. One said “Help 40 Day Here.”

On Monday, NBC News published findings by the inspector general that detailed poor conditions for migrants in border stations in El Paso as far back as May 7. Acting DHS Secretary Kevin McAleenan said at a press conference Friday that reports of poor conditions for children in border stations were “unsubstantiated.” McAleenan said children were given showers as soon as they could be made available.

“Most single adults had not had a shower in CBP custody despite several being held for as long as a month,” according to the latest report on conditions in the Rio Grande Valley.

The report also detailed what it called “security incidents” in which immigrants have tried to escape and once refused to return to their cells after being removed during maintenance. To address the problem, Border Patrol called in its special operations force to “demonstrate it was prepared to use force if necessary,” the report said.

Go to the link to see the DHS IG’s own photos documenting the abusive conditions and to get a link to the redacted report showing how McAleenan, Provost, Trump and others are coving up an intentionally created human rights disaster inflicted upon the most vulnerable.

We’re beyond “malicious incompetence” and basically into covering up possible criminal misconduct. Why haven’t McAleenan, Provost, and the other human rights abusers been fired? I guess it’s because this is the Trump Administration where neither the law nor morality matter!

And, this doesn’t even factor in the racism, misogyny, cruelty, and and white supremacy infecting the Border Patrol as exposed in a recent report by Pro Publica https://www.propublica.org/article/secret-border-patrol-facebook-group-agents-joke-about-migrant-deaths-post-sexist-memes

To state the obvious, if Pro Publica can find this “hidden in plain sight” trash, it’s been right there under the noses of McAleenan, Provost, Morgan, and other DHS malicious incompetents all along. They just chose to look the other way.

COURTSIDE HAS BEEN SAYING IT FOR YEARS; THE NY TIMES FINALLY PICKS UP: Trump & Co’s White Nationalist Racist Immigration Policies Are Corrupting America!

https://www.nytimes.com/2019/07/01/opinion/border-immigration.html

The NY Times Editorial Board writes:

Last year, as part of an effort to carry out President Trump’s promise of “extreme vetting” of visitors to the United States, the Department of Homeland Security began collecting social media account information from millions of people seeking to cross the border.

After all, a radical online could be a radical offline.

That’s why the stream of posts ricocheting around a 9,500-member Facebook group, comprising current and former Border Patrol agents as well as some people with no apparent connection to the Border Patrol, is so troubling. Members of the group, as documented by ProPublica this week, “joked about the deaths of migrants, discussed throwing burritos at Latino members of Congress visiting a detention facility in Texas on Monday and posted a vulgar illustration depicting Rep. Alexandria Ocasio-Cortez engaged in oral sex with a detained migrant, according to screenshots of their postings.”

Of a 16-year-old migrant from Guatemala who died while in Border Patrol custody in May, a member of the group wrote, “If he dies, he dies.”

Customs and Border Protection said on Monday that it had informed the Department of Homeland Security’s inspector general about the posts and had started its own investigation. The National Border Patrol union decried the posts as “inappropriate and unprofessional.”

A reckoning from their superiors is due for any border agents who dishonored their uniform by spreading vileness on social media. In June, when the Plain View Project, a nonprofit research effort, released documentation on dozens of police officers from eight departments across the country posting racist, misogynist and Islamophobic material, 72 police officers in Philadelphia were pulled off the streets and the top prosecutor in St. Louis said she would no longer accept cases from 22 officers.

In a larger sense, the Border Patrol Facebook posts reveal a worrying mind-set among some of those charged with administering the harshest crackdown on migrants and asylum-seekers in decades. “These are clearly agents who are desensitized to the point of being dangerous to migrants and their co-workers,” Representative Joaquin Castro, who heads the Congressional Hispanic Caucus, told ProPublica.

The realities of that crackdown have created conditions that Americans would condemn if they were in another country.

While lawmakers refuse to compromise on emergency aid for the humanitarian needs at the border, “children are held for weeks in deplorable conditions, without access to soap, clean water, showers, clean clothing, toilets, toothbrushes, adequate nutrition or adequate sleep,” groups supporting the children wrote in a recent court filing. A judge on Friday ordered Customs and Border Protection to allow health workers into facilities where children are being held to ensure that conditions are “safe and sanitary.

On Monday, Ms. Ocasio-Cortez toured facilities where migrants and asylum-seekers are being held. “Officers were keeping women in cells w/ no water & had told them to drink out of the toilets,” she tweeted.

As the congressional delegation arrived at one detention facility, they were heckled and cursed at by demonstrators, including one man wearing a Make America Great Again hat. (Another heckler hurled ethnic slurs at Representative Rashida Tlaib.)

Only a callous person could find mirth in the misery at the border. And only a desensitized nation could continue to permit the separation of children from their parents — and detaining all of them in atrocious conditions — as a morally acceptable form of deterrence.

*************************************************

The constant lies, false narratives, intentional inhumanity, and “deterrence only” of Trump’s self-created “border crisis” are merely the latest example of how White Nationalism demeans our nation. This Administration has all of the legal tools necessary to process arriving asylum seekers in a fair, timely, and orderly manner. They just refuse to use them as they were intended to solve, rather than intentionally create and aggravate, migration problems.

Contrary to Trump/GOP false narratives, that includes the present ability to establish a legitimate refugee application program in or near the Northern Triangle and to use it as an incentive for refugees to apply outside the United States rather than coming to the border to apply for asylum. However, to work as an incentive, rather than a failed deterrent, the refugee program must be administered in a fair and generous manner that would allow those who have legitimate fears of persecution on the basis of gender, actual or political opposition to gangs, ethnicity, or religious activities to be properly classified as refugees and resettled here or in some other truly safe location as determined in conjunction with the UNHCR and signatory countries outside the Northern Triangle who can actually provide at least a reasonable chance of safety.

That likely means a goal of admitting at least 50,000 to 100,000 refugees to the U.S. from Central America over the next year. That, along with robust aid to address the problems creating the refugee flow would be the legal and effective approach to the forced migration issue.

Additionally, the Administration has the ability to reauthorize and extend “Temporary Protected Status” (“TPS”) to qualified individuals from the Northern Triangle already present in the U.S. until such time as the conditions in their home countries can be stabilized. This would also have the advantage of tracking the presence of such individuals in the United States while reducing the pressure on the already backlogged U.S. Immigration Court system.

Of course, the Administration has no intention of using any of these tools to solve the problem. That would be inconsistent with their racist, restrictionist, White Nationalist agenda aimed primarily at keeping non-white individuals out of the United States and reducing the rights and political power of those who are already citizens. The purpose of refugee protection laws is actually to protect refugees, not, as this Administration posits, to kill as many of them as possible outside the U.S. or at our border to “deter” other refugees from coming.

Indeed, the Administration’s absurdly inhuman and unlawful  proposal to keep refugees from leaving the very countries where they are being persecuted, without addressing the conditions there, is basically that having them die, be tortured, or abused there is just fine with us. Whether folks like to face it or not, that is indeed a neo-Nazi philosophy. And, every day that Trump remains in the office for which he is so supremely unqualified further corrupts our nation.

COURTSIDE EXCLUSIVE — INSIDE EOIR — “TRASHED IN TRANSLATION: EOIR’S Latest Attack On Due Process In Immigration Courts Shocks Professional Interpreters, Outrages Judges!”

Once A Symbol of Fairness, Due Process, & Best Practices, Now Gone “Belly Up”

TRASHED IN TRANSLATION: EOIR’S Latest Attack On Due Process In Immigration Courts Shocks Professional Interpreters, Outrages Judges!

By Paul Wickham Schmidt for Immigrationcourtside.com

Alexandria, VA, July 1, 2019. No, it isn’t as dramatic as pictures of drowned families and caged toddlers. But, the effects of the latest move by those running our U.S. Immigration Courts and their political handlers could turn out to be just as deadly. Judges and interpreters were shocked by EOIR’s recently announced truncation of the right to receive effective live interpretations during master calendars as well as more management-ordered “aimless docket shuffling” which both denies due process and artificially “jacks up” already overwhelming backlogs.

How important is master calendar? It’s where individuals make their initial appearance in court and are advised about their right to a lawyer, procedures for obtaining pro bono counsel, given warnings, plead to charges of removability, seek bond if detained, have possible relief from removability explained, file applications for relief like asylum, have hearing dates and filing deadlines set, learn the DHS position on applications, have current address confirmed, receive DHS fillings, make and receive rulings on preliminary motions, and receive warnings as to the dire consequences of failure to appear and meet filing deadlines, to name just some things that go on. In other words, “important stuff.”

What happens when non-judicial politicos interfere with judges’ individual case scheduling and docketing by setting artificial limits on when and how they use interpreters? Cases that have been rescheduled numerous times over the years get “moved to the back of the bus” once again.

Individuals and their lawyers faithfully show up for their long-awaited individual “merits” hearings, sometimes after having traveled hundreds of miles, witnesses and families in tow, only to be informed by a clerk that their cases have been taken off the docket without notice for the “convenience of the agency” and will be rescheduled for some unspecified later date. Evidence goes stale, memories fade, witnesses become unavailable, lawyers move on to other jobs, and country conditions change as these cases drag on literally forever because of political meddling and management incompetence. Perhaps worst of all, these same politicos and bureaucrats engineering the delays and backlogs attempt to shift blame to the victims and judges by limiting legitimate continuances, “expediting” cases that aren’t ready to be heard, and dishonestly calling for totally unneeded restrictive changes in the law.

Ostensibly, the truncation of interpretation resulted from mismanagement on the part of these same politicos and bureaucrats who hired additional judges in a hurry without planning for those judges’ support needs, including in person interpreters. And, take it from me as someone who spent thirteen years on the immigration bench and heard thousands of cases, “telephonic interpretation” is not by any means the equivalent of “in person” interpretation Indeed, at some point, I found the process for telephonic interpretation so time wasting and inadequate, that I just stopped using it. But, that was way back when individual judges had at least a little control over what happened on their dockets and what was necessary to achieve due process in an individual case.

More likely, this move is just another step the intentional “dumbing down” of the immigration court process and the systematic dismantling of what little remains of constitutional due process for those pleading for their lives in a system doing its best to “tune them out.” It will result in more illegal removal orders.

However, these will be hard for appellate courts to detect upon review, because they might not be readily apparent from the English language version of the transcripts. Besides, some Article III courts have also abandoned their duties to the Constitution in a mad rush to “rubber stamp” as many defective removal orders as possible to “clear” their own overcrowded dockets at the expense of integrity, fundamental fairness, and quite frankly, innocent lives.

So shocking has become this “under the radar” further de-professionalization of what disingenuously holds itself out to be a ”court” that readers have been sending me anonymous comments from some distraught individual professional court interpreters. Here’s what one such concerned interpreter had to say (edited to preserve confidentiality);

“Bottomline, no more in-person interpretation for master calendars. In addition, in-person interpreters will be assigned in three-hour blocks only. Judges will no longer be allowed to have two languages in one hearing. I think this means no more relay interpretation between indigenous languages and Spanish. I’m concerned about language access being curtailed.”

These further disgraceful developments, showing a complete disregard for legal norms and individual fairness, should be carefully documented in congressional oversight hearings with an eye toward a future independent Article I immigration court. In the meantime, the Article III courts could and should put a stop to this travesty and force the system to meet at least minimal standards of professionalism and due process pending needed legislative reforms.

No American citizen would want to trust him or herself to this parody of a court system. Yet, due process under our Constitution applies equally to “all persons,” not just citizens, and the stakes in these cases often are life or death. If we refuse to defend the rights of the least among us, who will stand for our rights when the forces of oppression shift their ugly gaze? Even exaulted, yet too often complicit, life-tenured Article III judges should be asking themselves that question.

Thanks, Don, and well said! I’m proud to have you for our Representative here in Alexandria. You have been a constant voice of decency, common sense, and opposition to the “malicious incompetence” of the Trump Kakistocracy. And those of us in Virginia who survived the “Modern Day Jim Crow Era” of “Cooch Cooch” as Virginia Attorney General know just what a nasty, vile, unqualified, racist hack he has always been and always will be.  Heck, even Mitch McConnell can’t stand him, and that says something!

“Cooch Cooch’s” latest despicable act of note comes along with provoking an immediate rebellion among Asylum Officers. As I predicted, “Cooch Cooch” has already distinguished himself as a “lowlife among bottom dwellers.”

AMEN: A PRAYER IN THE TIME OF KAKISTOCRACY!

Judge (Ret.) Jeffrey S. Chase writes:

Hi all:  I volunteer on Tuesday nights at a free immigration law clinic run by the New Sanctuary Coalition, based in Judson Church In Greenwich Village, NYC.  As you can imagine, fear has been running high since the announcement of multi-city raids. Micah Bucey, a minister at Judson, composed the following non-denominational centering prayer that is now recited before each clinic.  I share with you for inspiration:

Spirit of Resistance,

You who are beyond the capacity of any border or name,

You who stretch beyond the indignity of any cage

You who envelop us in the power to persist, to protest, and to rehumanize, //

As we bring our passion and our pain to this place,

We offer gratitude for small gatherings that do monumental things,

We offer gratitude for a fierce community that unbuilds walls

And we offer gratitude for dreams of the world we are creating. //

We ask that you

Refresh us with new breath and energy for the long haul,

Guide us through fear, frustration, and panic,

Expand our hearts to envelop all those who pass through this room tonight and all those who have yet to make it to this room,

Ignite the fire of our faith in the truth that love knows no borders. //

Help us to never forget

That ICE is meant to melt,

That you cannot deport a movement,

And that the moral arc of the universe only bends toward justice if we keep bending it together. //

Amen

(Reuters) – Over two hours on June 1, a Honduran teenager named Tania pleaded with a U.S. official not to be returned to Mexico.

Immigration authorities had allowed her mother and younger sisters into the United States two months earlier to pursue claims for asylum in U.S. immigration court. But they sent Tania back to Tijuana on her own, with no money and no place to stay.

The 18-year-old said she told the U.S. official she had seen people on the streets of Tijuana linked to the Honduran gang that had terrorized her family. She explained that she did not feel safe there.

After the interview, meant to assess her fear of return to Mexico, she hoped to be reunited with her family in California, she said. Instead, she was sent back to Mexico under a Trump administration policy called the “Migrant Protection Protocols”(MPP), which has forced more than 11,000 asylum seekers to wait on the Mexican side of the border for their U.S. court cases to be completed. That process can take months.

Tania’s is not an unusual case. Once asylum seekers are ordered to wait in Mexico, their chances of getting that decision reversed on safety grounds – allowing them to wait out their proceedings in the United States – are exceedingly small, a Reuters analysis of U.S. immigration court data from the Executive Office for Immigration Review (EOIR) shows.

Here’s that panel’s “head in the sand” opinion in Innovation Law Labshttps://immigrationcourtside.com/wp-content/uploads/2019/05/Innovation-Law-Lab-19-15716.pdf.

It’s worth noting that almost every “ameliorating exception” described in the first paragraph of the panel’s opinion is demonstrably untrue — children and those clearly in danger are being returned and the “discretionary parole” is largely a fraud that seldom is granted — according to the Government’s own data (which likely is also falsified or manipulated to some extent to mask or distort abuses). In other words, a “three-reporter panel” of Reuters is more interested and capable of getting to truth than a panel of life-tenured judges.

Oh, that it could be these judges’ kids or grandkids separated from family and sent to live on the mean streets of Tijuana while pursuing their legal rights under US law. Really, how do these child abusers and human rights scofflaws hiding in judicial robes sleep at night?

Guess the can’t hear the screams and moans of those whose rights they are failing to protect and whose human dignity they reject. I’ve heard eyewitness accounts and seen video evidence from the pro bono lawyers courageously (and sometimes at the risk of their own health and safety) trying to protect the lives and rights of asylum seekers at the Southern Border from these abuses of human rights that are enabled by “Remain in Mexico” (a/k/a the disingenuously named “Migrant Protection Protocols”). The truth is no secret for those who actually seek it rather than to ignore it.

Complicit Article III Judges and Government lawyers are keys to Trump’s “dehumanization” program. History must hold them accountable for their abuses of humanity.

NEW REPORT EXAMINES WEAPONIZATION OF IMMIGRATION COURT SYSTEM

Advocates Launch Immigration Court Watch App to Ensure Greater Accountability, Transparency.

WASHINGTON, DC – The immigration court system has failed to fulfill the constitutional and statutory promise of fair and impartial case-by-case review, according to a new report released today by Innovation Law Lab and the Southern Poverty Law Center, entitled The Attorney General’s Judges: How the U.S. Immigration Courts Became a Deportation Tool.Download the press release here. The report, based on over two years of research and focus group interviews with attorneys and former immigration judges from around the country, links the current crisis of accountability to the Attorney General’s absolute control over the immigration court system. In conjunction with the report, the groups also announced the launch of an Immigration Court Watch app, which enables court observers to record and upload information on immigration judge conduct to create greater judicial accountability.

Under the Immigration and Nationality Act, the attorney general is required to create an immigration court system in which independent judges decide cases by applying law to the evidence on the record following a full and fair hearing. According to the report, however, today’s immigration courts are plagued by systemic bias and neglect.

“Despite the life-and-death stakes of many immigration cases within the current system, case outcomes have less to do with the rule of law than with the luck of the draw,” said Melissa Crow, Southern Poverty Law Center senior supervising attorney. “Under the Trump administration, the attorneys general have gone even further by actively weaponizing the immigration court system against asylum-seekers.”

The report explains how the Office of Attorney General has created an immigration court system that is biased, inconsistent and driven by political whims. It also examines the conflict that arises when immigration judges, who are expected to be neutral arbiters, are supervised by the United States’ chief law enforcement officer who prioritizes deterrence and deportation of immigrants, instead of an impartial review process.

The report recommends removing the immigration courts from the attorney general’s control and recreating them as Article I courts. To ensure that immigration judges are insulated from political pressures, they must be selected based on merit, receive tenure and be removed only for good cause. The immigration courts must also include more effective mechanisms of internal and appellate accountability.

“One of the key factors driving the immigration court crisis is the failure of judicial accountability,” said Stephen Manning, executive director of Innovation Law Lab. “The new Immigration Court Watch app addresses that lack of accountability, ensures greater transparency and will be a valuable resource for collecting and storing usable data on the pervasive abuses in the immigration court system.”

The new tool will allow data on immigration judge conduct to be gathered and stored in both individual and aggregate forms. This will provide advocates with valuable information to fight systemic patterns of bias and other unlawful court practices. This data can be used to bolster policy recommendations, advocacy and legal strategies.

Advocates, attorneys and other court watchers are encouraged to access the app available here.

“By establishing a presence in immigration courts within their communities and sharing their observations and information, advocates can help us leverage the power of technology, collaboration and strategic alignment to create the first interconnected information system which captures data about due process issues in U.S. immigration courts in real-time,” Manning said.

The report can be found here.

Maybe the “Article III Enablers In Robes” need to start envisioning their kids and grandkids in cages, their daughters and granddaughters being gang raped, and their close relatives and best friends unnecessarily suffering and dying from intentionally life threatening conditions in prison where they are sentenced to indefinite confinement without rights and without being convicted of a crime.

No, American institutions aren’t “standing up” to Trump. From the Supremes legally wrong , immoral, and unconstitutional decision in Jennings, to their licensing of blatant racial and religious bias in Travel Ban 3.0, to the Ninth Circuit’s complicity in the mocking of legal, statutory, and Constitutional rights under the fraudulent and illegal “Remain in Mexico,” which they now “own” lock stock, and barrel, to the Eleventh Circuit’s refusal to stop the “law, asylum, justice, and human dignity free zone” in the Atlanta Immigration Courts, Article III Judges are ignoring their oaths of office and turning blind eyes to immigration outrages that are transparent on the records they review and have been building in plain sight for years.

Those in positions of power who fail to fulfill their Constitutional duty to prevent abuse of the most vulnerable among us deserve to be condemned by public opinion and by history. And that goes for Article III Judges, as well as legislators, politicos, and bureaucrats.

SOLITARY VOICES: Thousands of Immigrants Suffer in Solitary Confinement in ICE Detention

ICIJ: ICE’s own directives say that isolating detainees — who under federal law aren’t considered prisoners and aren’t held for punitive reasons — is “a serious step that requires careful consideration of alternatives.” An investigation by The Intercept and the International Consortium of Investigative Journalists has found that ICE uses isolation as a go-to tool, rather than a last resort, to manage and punish even the most vulnerable detainees for weeks and months at a time.

White House Issues Memo Ordering Strict Enforcement of Sponsor-Reimbursement Laws

AILA: The White House issued a memo directing relevant agencies to update/issue procedures, guidance, and regulations, as needed, to strictly enforce existing income-deeming and reimbursement laws when sponsored immigrants seek certain means-tested public benefits, such as SNAP, Medicaid, and TANF. Burgeoning Immigration Judge Workloads

TRAC: The hiring pace for new judges continues to be insufficient to keep up with the Immigration Court’s workload. As a result, the court’s backlog continues to climb. While 47 new judges were hired during the first six months of FY 2019, others retired or left the bench. Thus, hiring resulted in a net gain of only 29 additional judges. As of the end of March, EOIR reports judge ranks had only climbed to a total of 424. And this total includes an unspecified number serving in administrative roles. Trump to place Ken Cuccinelli at the head of the country’s legal immigration system

WaPo: President Trump plans to install Ken Cuccinelli II as the new director of U.S. Citizenship and Immigration Services, placing the conservative activist and former Virginia attorney general at the head of the agency that runs the country’s legal immigration system, administration officials said Friday. L. Francis Cissna, the agency’s current director, has told his staff that he will leave his post June 1. The move extends the purge of senior leadership at the Department of Homeland Security, replacing Cissna, a Senate-confirmed agency head with deep expertise on immigration law, with Cuccinelli, a conservative firebrand disliked by senior GOP figures, including Senate Majority Leader Mitch McConnell (R-Ky.).

Mexico’s efforts did not appear to immediately appease President Donald Trump, who unleashed a broadside on Twitter on Tuesday. As usual, lots of “good stuff” (or “bad stuff” depending on how you look at it) in Elizabeth’s report. Here’s one of my “favorites” — a report that ties into what I have been saying about this White Nationalist misogynist Administration’s cowardly and concerted attack on women and girls who are victims of abuse and trafficking: https://lawprofessors.typepad.com/immigration/2019/05/report-report-abused-blamed-and-refused-protection-denied-to-women-and-children-trafficked-over-the-.html

JUSTICE BETRAYED: THE INTENTIONAL MISTREATMENT OF CENTRAL AMERICAN ASYLUM APPLICANTS BY THE EXECUTIVE OFFICE FOR IMMIGRATION REVIEW

By

Paul Wickham Schmidt

U.S. Immigration Judge (Retired)

Federal Bar Association Immigration Conference

Austin, Texas

May 17, 2019

Hi, Im Paul Schmidt, moderator of this panel. So, I have something useful to do while my wonderful colleagues do all the heavy lifting, please submit all questions to me in writing. And remember, free beer for everyone at the Bullock Texas State Museum after this panel!

Welcome to the front lines of the battle for our legal system, and ultimately for the future of our constitutional republic. Because, make no mistake, once this Administration, its nativist supporters, and enablers succeed in eradicating the rights and humanity of Central American asylum seekers, all their other enemies” — Hispanics, gays, African Americans, the poor, women, liberals, lawyers, journalists, civil servants, Democrats will be in line for Dred Scottification” — becoming non-personsunder our Constitution. If you dont know what the Insurrection Actis or Operation Wetbackwas, you should tune into todays edition of my blog immigrationcourtside.com and take a look into the future of America under our current leadersdark and disgraceful vision.

Before I introduce the Dream Teamsitting to my right, a bit of asylum history.

In 1987, the Supreme Court established in INS v. Cardoza-Fonseca that a well founded fear of persecution for asylum was to be interpreted generously in favor of asylum applicants. So generously, in fact, that someone with only a 10% chance of persecution qualifies.

Shortly thereafter, the BIA followed suit with Matter of Mogharrabi, holding that asylum should be granted even in cases where persecution was significantly less than probable. To illustrate, the BIA granted asylum to an Iranian who suffered threats at the Iranian Interests Section in Washington, DC. Imagine what would happen to a similar case under todays regime!

In the 1990s, the Legacy INSenacted regulations establishing that those who had suffered past persecutionwould be presumed to have a well-founded fear of future persecution, unless the Government could show materially changed circumstances or a reasonably available internal relocation alternative that would eliminate that well-founded fear. In my experience as a judge, that was a burden that the Government seldom could meet.

But the regulations went further and said that even where the presumption of a well founded fear had been rebutted, asylum could still be granted because of egregious past persecutionor other serious harm.

In 1996, the BIA decided the landmark case of Matter of Kasinga, recognizing that abuses directed at women by a male dominated society, such as female genital mutilation(FGM), could be a basis for granting asylum based on a particular social group. Some of us, including my good friend and colleague Judge Lory Rosenberg, staked our careers on extending that much-need protection to women who had suffered domestic violence. Although it took an unnecessarily long time, that protection eventually was realized in the 2014 precedent Matter of A-R-C-G-, long after our forced departurefrom the BIA.

And, as might be expected, over the years the asylum grant rate in Immigration Court rose steadily, from a measly 11% in the early 1980s, when EOIR was created, to 56% in 2012, in an apparent long overdue fulfillment of the generous legal promise of Cardoza-Fonseca. Added to those receiving withholding of removal and/or relief under the Convention Against Torture (CAT), approximately two-thirds of asylum applicants were receiving well-deserved, often life-saving legal protection in Immigration Court.

Indeed, by that time, asylum grant rates in some of the more due-process oriented courts with asylum expertise like New York and Arlington exceeded 70%, and could have been models for the future. In other words, after a quarter of a century of struggles, the generous promise of Cardoza-Fonseca was finally on the way to being fulfilled. Similarly, the vision of the Immigration Courts as through teamwork and innovation being the worlds best administrative tribunals guaranteeing fairness and due process for allwas at least coming into focus, even if not a reality in some Immigration Courts that continued to treat asylum applicants with hostility.

And, that doesnt count those offered prosecutorial discretion or PDby the DHS counsel. Sometimes, this was a humanitarian act to save those who were in danger if returned but didnt squarely fit the somewhat convoluted refugeedefinition as interpreted by the BIA. Other times, it appeared to be a strategic move by DHS to head off possible precedents granting asylum in close casesor in emerging circumstances.

In 2014, there was a so-called surgein asylum applicants, mostly scared women, children, and families from the Northern Triangle of Central America seeking protection from worsening conditions involving gangs, cartels, and corrupt governments. There was a well-established record of femicide and other widespread and largely unmitigated gender-based violence directed against women and gays, sometimes by the Northern Triangle governments and their agents, other times by gangs and cartels operating with the knowledge and acquiescence of the governments concerned.

Also, given the breakdown of governmental authority and massive corruption, gangs and cartels assumed quasi-governmental status, controlling territories, negotiating treaties, exacting involuntary taxes, and severely punishing those who publicly opposed their political policies by refusing to join, declining to pay, or attempting to report them to authorities. Indeed, MS-13 eventually became the largest employer in El Salvador. Sometimes, whole family groups, occupational groups, or villages were targeted for their public acts of resistance.

Not surprisingly in this context, the vast majority of those who arrived during the so-called surgepassed credible fearscreening by the DHS and were referred to the Immigration Courts, or in the case of unaccompanied minors,to the Asylum Offices, to pursue their asylum claims.

The practical legal solution to this humanitarian flow was obvious help folks find lawyers to assist in documenting and presenting their cases, screen out the non-meritorious claims and those who had prior gang or criminal associations, and grant the rest asylum. Even those not qualifying for asylum because of the arcane nexusrequirements appeared to fit squarely within the CAT protection based on likelihood of torture with government acquiescence upon return to the Northern Triangle. Some decent BIA precedents, a robust refugee program in the Northern Triangle, along with continued efforts to improve the conditions there would have sealed the deal.In other words, the Obama Administration had all of the legal tools necessary to deal effectively and humanely with the misnamed surgeas what it really was a humanitarian situation and an opportunity for our country to show human rights leadership!

But, then things took a strange and ominous turn. After years of setting records for deportations and removals, and being disingenuously called soft on enforcementby the GOP, the Obama Administration began believing the GOP myths that they were wimps. They panicked! Their collective manhooddepended on showing that they could quickly return refugees to the Northern Triangle to deterothers from coming. Thus began the weaponizationof our Immigration Court system that has continued unabated until today.

They began imprisoning families and children in horrible conditions and establishing so-called courtsin those often for profit prisons in obscure locations where attorneys generally were not readily available. They absurdly claimed that everyone should be held without bond because as a group they were a national security risk. They argued in favor of indefinite detention without bond and making children and toddlers represent themselvesin Immigration Court.

The Attorney General also sent strong messages to EOIR that hurrying folks through the system by prioritizingthem, denying their claims, stuffingtheir appeals, and returning them to the Northern Triangle with a mere veneer of due process was an essential part of the Administrations get toughenforcement program. EOIR was there to send a messageto those who might be considering fleeing for their lives dont come, you wont get in, no matter how strong your claim might be.

They took judges off of their established dockets and sent them to the Southern Border to expeditiously remove folks before they could get legal help. They insisted on jamming unprepared cases of recently arrived juveniles and adults with childrenin front of previously docketed cases, thereby generating total chaos and huge backlogs through what is known as aimless docket reshuffling(ADR).

Hurry up scheduling and ADR also resulted in more in absentiaorders because of carelessly prepared and often inadequate or wrongly addressed noticessent out by overwhelmed DHS and EOIR court staff. Sometimes DHS could remove those with in absentia orders before they got a chance to reopen their cases. Other times, folks didnt even realize a removal order had been entered until they were on their way back.

They empowered judges with unusually high asylum denial rates. By a ratio of nine to one they hired new judges from prosecutorial backgrounds, rather than from the large body of qualified candidates with experience in representing asylum applicants who might actually have been capable of working within the system to fairly and efficiently recognize meritorious cases, promote fair access to pro bono counsel, and insure that doubtful cases or those needing more attention did not get lostin the artificial backlogs being created in an absurdly mismanaged system. In other words, due process took a back seat to expedienceand fulfilling inappropriate Administration enforcement goals.

Asylum grant rates began to drop, even as conditions on the ground for refugees worldwide continued to deteriorate. Predictably, however, detention, denial, inhumane treatment, harsh rhetoric, and unfair removals failed to stop refugees from fleeing the Northern Triangle.

But, just when many of us thought things couldnt get worse, they did. The Trump Administration arrived on the scene. They put lifelong White Nationalist xenophobe nativists Jeff Sessions and Stephen Miller in charge of eradicating the asylum process. Sessions decided that even artificially suppressed asylum grant rates werent providing enough deterrence; asylum seekers were still winning too many cases. So he did away with A-R-C-G- and made it harder for Immigration Judges to control their dockets.

He tried to blame asylum seekers and their largely pro bono attorneys, whom he called dirty lawyers, for having created a population of 11 million undocumented individuals in the U.S. He promoted bogus claims and false narratives about immigrants and crime. Perhaps most disgustingly, he was the mastermindbehind the policy of child separationwhich inflicted lifetime damage upon the most vulnerable and has resulted in some children still not being reunited with their families.

He urged judgesto summarily deny asylum claims of women based on domestic violence or because of fear of persecution by gangs. He blamed the judges for the backlogs he was dramatically increasing with more ADR and told them to meet new quotas for churning out final orders or be fired. He made it clear that denials of asylum, not grants, were to be the new normfor final orders.

His sycophantic successor, Bill Barr, an immigration hard-liner, immediately picked up the thread by eliminating bond for most individuals who had passed credible fear. Under Barr, the EOIR has boldly and publicly abandoned any semblance of due process, fairness, or unbiased decision making in favor of becoming an Administration anti-asylum propaganda factory. Just last week they put out a bogus fact sheetof lies about the asylum process and the dedicated lawyers trying to help asylum seekers. The gist was that the public should believe that almost all asylum seekers from the Northern Triangle are mala fide and that getting them attorneys and explaining their rights are a waste of time and money.

In the meantime, the Administration has refused to promptly process asylum applicants at ports of entry; made those who have passed credible fear wait in Mexicoin dangerous and sometimes life-threatening conditions; unsuccessfully tried to suspend the law allowing those who enter the U.S. between ports of entry to apply for asylum; expanded the New American Gulagwith tent cities and more inhumane prisons dehumanizingly referred to as bedsas if they existed without reference to those humans confined to them;  illegally reprogrammed money that could have gone for additional humanitarian assistance to a stupid and unnecessary wall;and threatened to dumpasylum seekers to punishso-called sanctuary cities.Perhaps most outrageously, in violation of clear statutory mandates, they have replaced trained Asylum Officers in the credible fearprocess with totally unqualified Border Patrol Agents whose job is to make the system adversarialand to insure that fewer individuals pass credible fear.

The Administration says the fact that the credible fearpass rate is much higher than the asylum grant rate is evidence that the system is being gamed.Thats nativist BS! The, reality is just the opposite: that so many of those who pass credible fear are eventually rejected by Immigration Judges shows that something is fundamentally wrong with the Immigration Court system. Under pressure to produce and with too many biased, untrained, and otherwise unqualified judges, many claims that should be granted are being wrongfully denied.

Today, the Immigration Courts have become an openly hostile environment for asylum seekers and their representatives. Sadly, the Article III Courts arent much better, having largely swallowed the whistleon a system that every day blatantly mocks due process, the rule of law, and fair and unbiased treatment of asylum seekers. Many Article IIIs continue to deferto decisions produced not by expert tribunals, but by a fraudulent court system that has replaced due process with expediency and enforcement.

But, all is not lost. Even in this toxic environment, there are pockets of judges at both the administrative and Article III level who still care about their oaths of office and are continuing to grant asylum to battered women and other refugees from the Northern Triangle. Indeed, I have been told that more than 60 gender-based cases from Northern Triangle countries have been  granted by Immigration Judges across the country even after Sessionss blatant attempt to snuff out protection for battered women in Matter of A-B-. Along with dependent family members, that means hundreds of human lives of refugees saved, even in the current age.

Also significantly, by continuing to insist that asylum seekers from the Northern Triangle be treated fairly in accordance with due process and the applicable laws, we are making a record of the current legal and constitutional travesty for future generations. We are building a case for an independent Article I Immigration Court, for resisting nativist calls for further legislative restrictions on the rights of asylum seekers, and for eventually holding the modern day Jim Crowswho have abused the rule of law and human values, at all levels of our system, accountable, before the court of historyif nothing else!

Eventually, we will return to the evolving protection of asylum seekers in the pre-2014 era and eradicate the damage to our fundamental values and the rule of law being done by this Administrations nativist, White Nationalist policies.Thats what the New Due Process Armyis all about.

Here to tell you how to effectively litigate for the New Due Process Army and to save even more lives of deserving refugees from all areas of the world, particularly from the Northern Triangle, are three of the best ever.I know that, because each of them appeared before me during my tenure at the Arlington Immigration Court. They certainly brightened up my day whenever they appeared, and I know they will enlighten you with their legal knowledge, energy, wit, and humanity.

But that is what I told myself in the fall of 1954 — five months after the Supreme Court’s school desegregation decision — when I learned that students attending then-all-white Eastern, Anacostia and McKinley Technical high schools, and several white junior high schools in the District, had staged walkouts to protest the assignment of black kids to their schools. I was enrolled at then-all-black Dunbar High School at the time.

I really believed that racial integration was a step toward the goal of full equality and that, as the months wore on, those who walked out would shed their fear and anger. Instead, they and their families devoted the time remaining before the black students arrived to finding a means to flee the city.

Still I dreamed.

When, in 1956, students and adults shouted racial epithets and threw rotten eggs and rocks at a young black woman named Autherine Lucy who tried to enter the University of Alabama to obtain a degree in library science, I consoled myself with the thought that the hurlers of eggs and epithets would age out of the picture. Even when the University of Alabama expelled Lucy, under the guise of ensuring her personal safety, I thought those elders would one day be off the scene.

The same thought was in my head in the fall of 1957, when Arkansas Gov. Orval Faubus called the National Guard to surround Central High School in Little Rock to prevent nine African American students from attending the all-white school, declaring “blood will run in the streets” if black students attempted to enter.

But they were still around years later when, in the summer of 1964, Michael Schwerner and Andrew Goodman, two white New Yorkers, and James Chaney, a black Mississippian, were in Mississippi helping to register voters. Schwerner, Goodman and Chaney disappeared on their way back from investigating the burning of an African American church by the Ku Klux Klan. Their bodies were later discovered buried in an earthen dam near Philadelphia, Miss.

Through it all, I clung firmly to the belief that because those white men and women hellbent on making life miserable for people unlike themselves were getting up in age, they would soon die out and be replaced by a younger, more broad-minded, racially tolerant generation of white Americans. Unlike many of their elders, these young people would be unencumbered by ingrained racist ideas, I said to myself.

Evidence of that smacks us in the face.

Dylann Roof, the white supremacist who shot and killed nine black churchgoers in Charleston, S.C., in 2015, including the pastor and a state senator, was 21 at the time.

Holden Matthews, charged with burning three historically black churches in Louisiana a week before Easter, was 21 .

John Earnest, accused of a shooting that killed one and injured three at a synagogue in Poway, Calif., a few weeks after launching an arson attack at a San Diego County mosque, was 19 .

The man charged with the massacre at the Tree of Life synagogue in Pittsburgh that left 11 dead was no septuagenarian; Robert Bowers was 46 .

Then there are the two ninth-grade students at Walt Whitman High School in Bethesda who posted an image of themselves in blackface on social media and used the n-word as they described the photo. They were driven by the same racial animus that caused students to walk out of Eastern, Anacostia and McKinley Tech high schools 65 years ago.

The newly appointed archbishop of Washington, Wilton Daniel Gregory, has called racism “a grave moral disease whose recurrence, aggressiveness and persistence should frighten every one of us.”

What’s striking about today’s disease, Gregory wrote in a December 2016 article carried by the Catholic News Service, is that it “may seem to have been brought under control”; that it was on the wane.

Presciently, Gregory wrote, “We have returned to a moment in our nation’s history when racist feelings and sentiments have been condoned as acceptable to express publicly and publish openly.”

The response he called for would reflect the sentiment of my youth: to “disavow any vestige of racism and hatred of other people because of race, religion, legal status or gender.”

Eradicating and inoculating us from this disease is our hope and never-ending challenge — for each of us. For certain, hate won’t outgrow itself.

I have noticed before the similarity between the faces and expressions of the overwhelmingly white, mindlessly cheering crowds, behind Trump at his rallies as he rattles off his “normal litany” of lies, insults, and racist provocations and the absurd, yet ugly and dangerous, faces of white racists in the 1950’s and 1960’s South —- captured in black and white photos as they bullied and taunted African Americans at lunch counters or African American kids attempting to attend school. Really, I also wanted to believe that those days were gone, and the white folks pictured were either gone or would be embarrassed and humiliated by the cowardice, ignorance, and inhumanity of their past actions.

King is right: “hate won’t outgrow itself.” And Trump and his followers are are nurturing, growing, and harvesting that hate on a daily basis. The majority of us who don’t believe in Trump’s vile messages and unacceptable methods must take our country back before hate and bigotry consume it!

COURTSIDE HISTORY: Trump’s American White Nationalist Antecedents Were The Racist Pols & Pseudo-Scientists Of A Century Ago! — The Lies & Ugliness Of The Past Are Being Repeated — Only This Time It’s People Of Color Rather Than Italians, Irish, Slavs, Catholics, & Jews Who Are Targeted For “Dehumanization” (Although It Would Be Wrong To Underestimate Trump’s Responsibility For The Revival Of Anti-Semitism)!

Daniel Okrent writes in the NY Times:

In early 1921, an article in Good Housekeeping signaled the coming of a law that makes President Trump’s campaign for immigration restriction seem mild by comparison. “Biological laws tell us that certain divergent people will not mix or blend,” it read. “The dead weight of alien accretion stifles national progress.” The author was Calvin Coolidge, about to be sworn in as vice president of the United States. Three years later, the most severe immigration law in American history entered the statute books, shepherded by believers in those “biological laws.”

The anti-immigrant fervor at the heart of current White House policymaking is not a new phenomenon, nor is the xenophobia that has infected the political mainstream. In fact, race-based nativism comes with an exalted pedigree — and that pedigree is something we all should remember as the Trump administration continues its assault on immigrants of specific nationalities. The scientific arguments Coolidge invoked were advanced by men bearing imposing credentials. Some were highly regarded scholars from Harvard, Princeton, Yale and Stanford. One ran the nation’s foremost genetics laboratory. Another was America’s leading environmentalist at the time. Yet another was the director of the country’s most respected natural history museum.

Together, they popularized “racial eugenics,” a junk science that made ethnically based racism respectable. “The day of the sociologist is passing,” said the Harvard professor Robert DeCourcy Ward, “and the day of the biologist has come.” The biologists and their publicists achieved what their political allies had failed to accomplish for 30 years: enactment of a law stemming the influx of Jews, Italians, Greeks and other eastern and southern Europeans. “The need of restriction is manifest,” The New York Times declared in an editorial, for “American institutions are menaced” by “swarms of aliens.”

Keeping people out of the country because of their nationality was hardly a novel idea. The Chinese Exclusion Act of 1882 was avowedly racist. In 1923 a unanimous Supreme Court declared that immigrants from India could be barred from citizenship strictly on racial grounds.

The race-based ”Aryan Nationalism” of 1920’s America helped pave the way for the Nazi atrocities of World War II.

Out of the failure of the West to save lives when it was possible before the start of World War II and the horrible human exterminations that followed came the 1951 U.N. Convention on Refugees. It is that Convention which Trump and other nationalist leaders throughout the Western World are committed to destroying.

At the recent Louisiana State Bar Immigration Conference, held on April 26, 2019, Attorney R. Andrew Free of Nashville, TN, who had been to the border and observed firsthand the lawless, counterproductive, and inhumane behavior of both the Mexican and U.S. authorities toward asylum seekers, particularly women and children, made an excellent “historical perspective” presentation.

Free traced the origins of today’s xenophobic and racist-inspired restrictionist immigration policies policies to two historic events: 1) the Eisenhower Administration’s 1954 “Operation Wetback” directed against Mexicans which resulted in some Mexican-American citizens and lawful residents being swept up in the indiscriminate “dragnet,” without any hint of due process, directed against Hispanic appearing and Spanish speaking individuals along the Southern Border; and 2) the highly racist Immigration Act of 1924, praised by such “modern day Jim Crows” as Jeff Sessions and his acolyte White House Advisor Stephen Miller.

Do we as a people REALLY want to be remembered the way Coolidge, Albert Johnson, and the host of racist “pseudo-scientists” are described in this article? Or, are we willing to take a stand against the White Nationalist restrictionist agenda being pushed by Trump and his many enablers?

How can we forget our own immigrant heritages and the nasty racist stereotypes thrown at almost every group of new immigrants, including of course enslaved African Americans and other “involuntary forced migrants,” who built America into a great nation!

Due Process Forever — White Nationalism Never!

NY TIMES: Trump Mocks & Dehumanizes Vulnerable Refugees & His Administration Claims It’s OK To Return Them to Honduras; BUT The Facts Say The Opposite: Honduras Is An Armed Conflict Zone Where Gangs Exercise Quasi-Governmental Control & Those Who Resist Are Severely Punished, Often Maimed, Tortured Or Killed!

Azam Ahmed Reports for the NY Times:

. . . .

Shootouts, armed raids and last-minute pleas to stop the bloodshed formed the central threads of their stories. MS-13 wanted the neighborhood to sell drugs. The other gangs wanted it to extort and steal. But the members of Casa Blanca had promised never to let their neighborhood fall prey to that again. And they would die for it, if they had to.

Almost no one was trying to stop the coming war — not the police, not the government, not even the young men themselves. The only person working to prevent it was a part-time pastor who had no church of his own and bounced around the neighborhood in a beat-up yellow hatchback, risking his life to calm the warring factions.

“I’m not in favor of any gang,” said the pastor, Daniel Pacheco, rushing to the Casa Blanca members after the shooting. “I’m in favor of life.”

The struggle to protect the neighborhood — roughly four blocks of single-story houses, overgrown lots and a few stores selling chips and soda — encapsulates the inescapable violence that entraps and expels millions of people across Latin America.

Since the turn of this century, more than 2.5 million people have been killed in the homicide crisis gripping Latin America and the Caribbean, according to the Igarapé Institute, a research group that tracks violence worldwide.

The region accounts for just 8 percent of the global population, yet 38 percent of the world’s murders. It has 17 of the 20 deadliest nations on earth.

And in just seven Latin American countries — Brazil, Colombia, Honduras, El Salvador, Guatemala, Mexico and Venezuela — violence has killed more people than the wars in Afghanistan, Iraq, Syria and Yemen combined.

Average homicide rate per 100k people

By Allison McCann

Source: Igarapé Institute and the United Nations Office on Drugs and Crime. Cities include the 50 highest homicide rates in the world and a group of prominent others for comparison, all with populations of at least 250,000. Average homicide rates are from 2016-2018 or the latest data available.

The violence is all the more striking because the civil wars and military dictatorships that once seized Latin America have almost all ended — decades ago, in many cases. Most of the region has trudged, often very successfully, along the prescribed path to democracy. Yet the killings continue at a staggering rate.

They come in many forms: state-sanctioned deaths by overzealous armed forces; the murder of women in domestic disputes, a consequence of pervasive gender inequality; the ceaseless exchange of drugs and guns with the United States.

Underpinning nearly every killing is a climate of impunity that, in some countries, leaves more than 95 percent of homicides unsolved. And the state is a guarantor of the phenomenon — governments hollowed out by corruption are either incapable or unwilling to apply the rule of law, enabling criminal networks to dictate the lives of millions.

For the masses fleeing violence and poverty in Central America, the United States is both a cause and solution — the author of countless woes and a chance to escape them.

Frustrated with the stream of migrants treading north, President Trump has vowed to cut aid to the most violent Central American nations, threatening hundreds of millions of dollars meant to address the roots of the exodus.

But the surviving members of Casa Blanca, who once numbered in the dozens, do not want to flee, like tens of thousands of their countrymen have. They say they have jobs to keep, children to feed, families, neighbors and loved ones to protect.

“There is only one way for this to end,” said Reinaldo. “Either they kill us or we kill them.”

Trump’s complete lack of humanity, empathy, and his constant racist-inspired lies and misrepresentations about refugees and asylum seekers are truly reprehensible.

But, he and his henchmen like Stephen Miller are by no means the entire problem.

Every day in U.S. Immigration Court, DHS attorneys make demonstrably false representations minimizing the truly horrible conditions in the Northern Triangle, particularly for women. Every day, some U.S. Immigration Judges betray their oaths of office by accepting those false representations and using them, along with an unfairly skewed anti-asylum view of the law, to deny asylum cases that should be granted.

And, perhaps worst of all, every day some life-tenured Article III Circuit Judges turn a blind eye to the legal travesty and due process disaster taking place throughout our corrupted Immigration Courts by rubber stamping results that would be totally unacceptable in any other type of litigation and which don’t even pass the “straight face test.” I guess “out of sight is out of mind,” and the wrongfully deported are “out of sight” (or maybe dead, in hiding, or duressed into joining or cooperating with gangs after the U.S. failed to protect them)

But, there are folks our there resisting this malfeasance and dereliction of duty. Among other things, they are memorializing what is happening and making a record of where the “modern day Jim Crows” and their enablers stand and what they have done to their fellow human beings in the name of “expedience” and an “Alfred E. Neuman (“What Me Worry”)” view of the law and our legal system.

Donald Trump is horrible. But, his racism and infliction of lasting damage on our country and on humanity depend on too many judges and other supposedly responsible public officials supporting, acquiescing, enabling, or minimizing his inhumane, dishonest, counterproductive, and often illegal actions.

An appropriate response by an honest, competent Administration with integrity would be:

  • Establish legal precedents recognizing those fleeing politicized gang violence, domestic violence, and violence directed at famnilies as refugees;
  • Establish precedents incorporating the Article III decisions emphasizing the concept of “mixed motive” in determining “nexus” under asylum and withholding of removal laws;
  • Establish precedents granting temporary withholding of removal under the Convention Against Torture (“CAT”) to those who face torture at the hands of the gangs or Northern Triangle governments (or both), but who can’t establish the convoluted “nexus” for asylum, with a rebuttable presumption that the countries of the Northern Triangle will “acquiesce” in the torture;
  • Liberally use Temporary Protected Status (“TPS”) for nationals from Northern Triangle countries which perhaps would make large-scale asylum adjudication less of a priority and allow most cases to be dealt with in due course through the Asylum Offices rather than clogging Immigration Court dockets;
  • Work to insure that applicants for protection have assistance of counsel in developing and presenting their claims (which would also dramatically increase fairness and efficiency).
