“Trump fully embraces far right immigration playbook

President Donald Trump and his administration have been sending a message in recent weeks: Trump’s campaign rhetoric on immigration was not just talk. In fact, it was just the beginning.

Trump has never shied from his attacks on illegal immigration, which, alongside a US-Mexico border wall, was a core component of his campaign.

But doubts existed about his commitment level, as some of the more aggressive proposals considered by the administration languished in bureaucratic morass and as he said strongly favorable things about recipients of the Deferred Action for Childhood Arrivals program in September as he opted to end it.

Of late, however, Trump and the administration have upped their rhetoric on immigration.

Trump has railed in several instances against “chain migration” and lotteries for green cards. His administration is moving to alter a program for the spouses of high-skilled visa holders. And the White House and Congress remain far apart on how to address DACA.

In mid-September, Trump wrote, “Does anybody really want to throw out good, educated and accomplished young people who have jobs, some serving in the military?”

But since then, he has insisted on controversial immigration reduction proposals that would have a hard time passing even among some Republicans, including drastically cutting the overall number of green cards given out annually and transforming the way they are given out, placing a heavy emphasis on only highly skilled, English-speaking immigrants and not low-skilled individuals.

Groups that have long advocated for reducing overall immigration are energized.

“We’re excited about how the administration has held firmly to these issues,” said Dan Stein, president of the Federation for American Immigration Reform. “We’ve put almost $1 million into ads. … This is the moment we’ve been waiting for four decades.”

Stein was especially pleased with Trump’s recent insistence that any deal to save DACA, which protected young undocumented immigrants brought to the US as children, include cuts to family-based immigration, or “chain migration,” and the diversity visa program, which allows up to 50,000 individuals from countries with low levels of immigration to the US to come on visas distributed by lottery.

Chain migration focus

The administration also was quick to point out that two recent terrorist attacks in New York City were committed by individuals with connections to family-based migration and the diversity lottery.

“You think the countries’ giving us their best people?” Trump said Friday in a speech to law enforcement personnel. “No. What kind of system is that? They come in by lottery. They give us their worst people, put them in a bin, but in his hand when he is picking them is really the worst of the worst.”

The theme of the dangers of immigrants — despite no research showing them to be more prone to crime than the native-born population — has been particularly hammered by longtime immigration hardliner Attorney General Jeff Sessions.

“If we accept lawlessness, then we encourage lawlessness. When people break our laws without consequences, we shouldn’t be surprised when they continue breaking our laws,” Sessions said in a speech last week. “We should give priority to those who are likely to thrive here — such as those who speak English or are highly skilled — not someone chosen at random or who happens to be somebody’s relative.”

In reality, individuals in those countries are selected randomly but still must meet the security and eligibility requirements placed on all immigrants to actually get their visas. Diversity recipients specifically must also have at least a high school education or equivalent and job experience. The process includes an in-person interview, and anyone that is found to be a security threat would be inadmissible to the US.

While the diversity lottery only affects about 50,000 of roughly 1 million green cards given out to the US annually, Trump has supported legislation from two GOP senators that would drastically reduce family visa categories, cutting yearly numbers in half.

The administration has also made its own efforts to reduce immigration levels without Congress, including setting a historically low number of refugee admissions for next year, instituting the travel ban and submitting would-be visitors and immigrants to “extreme vetting.”

Late last week, the Department of Homeland Security revealed it intends to do away with work permits for spouses of high-skilled visa holders who are waiting in a years-long green card backlog. The announcement also said the agency intends to set a higher bar for the high-skilled visa itself.

New Homeland Security Secretary Kirstjen Nielsen spent last week establishing her hardline immigration bona fides, touting security at the border and attacking sanctuary cities and immigrant-related crime. Her tour came after weeks of broadsides from Trump-aligned sources like Breitbart, which had pejoratively nicknamed her “Lady DACA.”

Leon Fresco, an immigration attorney and Obama administration alum, said that while there may be some fraud in the immigration system, the Trump agenda goes beyond reasonably trying to resolve it.

“They’re not just fixing the system, they are signaling a belief that regardless of their skills and talent, people from foreign countries are not welcome,” Fresco said. “Many of these reforms that are being implemented are simply out of the wishlist of the anti-immigrant groups and are not serving a legitimate purpose of reforming the immigration system. … The goal is to reduce the total number of foreigners.”

DHS can use more lawyers, better technology, and some new equipment. The Dems certainly could offer up that.

The U.S. Immigration Court could use more resources. But, with “Gonzo” in charge, it’s probably a case of “throwing good money after bad.”

“The Wall” is overkill and has some bad symbology. But, in human rights terms, it’s not as overtly harmful as the other stuff on the restrictionist’s list.

The rest of the “restrictionist wish list” is pretty toxic. Don’t see how the Dems can vote for a bill that contains any of it.

YEAR 1 Under Authoritarianism

What to Expect?

  1. They will come to power with a campaign based on fear, scaremongering and distorting the truth. Nevertheless, their victory will be achieved through a democratic electoral process. But beware, as this will be their argument every time you question the legitimacy of their actions. They will claim a mandate from the People to change the system.

    Remember – gaining power through a democratic system does not give them permission to cross legal boundaries and undermine said democracy.

  2. They will divide and rule. Their strength lies in unity, in one voice and one ideology, and so should yours. They will call their supporters Patriots, the only “true Americans”. You will be labelled as traitors, enemies of the state, unpatriotic, the corrupt elite, the old regime trying to regain power. Their supporters will be the “People”, the “sovereign” who chose their leaders.

    Don’t let them divide you – remember you’re one People, one Nation, with one common good.

  3. Through convoluted laws and threats they will try to control mainstream media and limit press freedom. They will ban critical press from their briefings, calling them “liars”, “fake news”. They will brand those media as “unpatriotic”, acting against the People (see point 2).

    Fight for every media outlet, every journalist that is being banned, censored, sacked or labelled an “enemy of the state” – there’s no hope for freedom where there is no free press.

  4. They will create chaos, maintain a constant sense of conflict and danger. It will be their argument to enact new authoritarian laws, each one further limiting your freedoms and civil liberties. They will disguise them as being for your protection, for the good of the People.

    See through the chaos, the fake danger, expose it before you wake up in a totalitarian, fascist state.

  5. They will distort the truth, deny facts and blatantly lie. They will try to make you forget what facts are, sedate your need to find the truth. They will feed “post-truths” and “alternative facts”, replace knowledge and logic with emotions and fiction.

    Always think critically, fact-check and point out the truth, fight ignorance with facts.

  6. They will incite and then leak fake, superficial “scandals”. They will smear opposition with trivial accusations, blowing them out of proportion and then feeding the flame. This is just smokescreen for the legal steps they will be taking towards totalitarianism.

    See through superficial topics in mainstream media (see point 3) and focus on what they are actually doing.

  7. They will propose shocking laws to provoke your outrage. You will focus your efforts on fighting them, so they will seemingly back off, giving you a false sense of victory. In the meantime they will push through less “flashy” legislation, slowly dismantling democracy (see points 4 and 6).

    Focus your fight on what really matters.

  8. When invading your liberal sensibilities they will focus on what hurts the most – women and minorities. They will act as if democracy was majority rule without respect for the minority. They will paint foreigners and immigrants as potential threats. Racial, religious, sexual and other minorities will become enemies to the order and security they are supposedly providing. They will challenge women’s social status, undermine gender equality and interfere with reproductive rights (see point 7). But it means they are aware of the threat women and minorities pose to their rule, so make it your strength.

    Women and minorities should fight the hardest, reminding the majority what true democracy is about.

  9. They will try to take control of the judiciary. They will assault your highest court. They need to remove the checks and balances to be able to push through unconstitutional legislation. Controlling the judiciary they can also threat anyone that defies them with prosecution, including the press (see point 3).

    Preserve the independence of your courts at all cost, they are your safety valve, the safeguard of the rule of law and the democratic system.

  10. They will try to limit freedom of assembly, calling it a necessity for your security. They will enact laws prioritizing state events and rallies, or those of a certain type or ideology. If they can choose who can demonstrate legally, they have a legal basis to forcefully disperse or prosecute the rest.

    Oppose any legislation attempting to interfere with freedom of assembly, for whatever reason.

  11. They will distort the language, coin new terms and labels, repeat shocking phrases until you accept them as normal and subconsciously associate them with whom they like. A “thief”, “liar” or “traitor” will automatically mean the opposition, while a “patriot” or a “true American” will mean their follower (see point 2). Their slogans will have double meaning, giving strength to their supporters and instilling angst in their opponents.

    Fight changes in language in the public sphere, remind and preserve the true meaning of words.

  12. They will take over your national symbols, associate them with their regime, remake them into attributes of their power. They want you to forget that your flag, your anthem and your symbols belong to you, the People, to everyone equally. Don’t let them be hijacked. Use and expose them in your fight as much as they do.

    Show your national symbols with pride, let them give you strength, not associate you with the tyranny they brought onto your country.

  13. They will try to rewrite history to suit their needs and use the education system to support their agenda. They will smear any historical or living figure who wouldn’t approve of their actions, or distort their image to make you think they would. They will place emphasis on historical education in schools, feeding young minds with the “only correct” version of history and philosophy. They will raise a new generation of voters on their ideology, backing it with a distorted interpretation of history and view of the world.

    Guard the education of your children, teach them critical thinking, ensure their open-mindedness and protect your real history and heritage.

  14. They will alienate foreign allies and partners, convincing you don’t need them. They won’t care for the rest of the world, with their focus on “making your country great again”. While ruining your economy to fulfil their populist promises, they will omit the fact that you’re part of a bigger world whose development depends on cooperation, on sharing and on trade.

    Don’t let them build walls promising you security instead of bridges giving you prosperity.

  15. They will eventually manipulate the electoral system. They might say it’s to correct flaws, to make it more fair, more similar to the rest of the world, or just to make it better. Don’t believe it. They wouldn’t be messing with it at all if it wasn’t to benefit them in some way.

    Oppose any changes to electoral law that an authoritarian regime wants to enact – rest assured it’s only to help them remain in power longer.

And above all, be strong, fight, endure, and remember you’re on the good side of history.
EVERY authoritarian, totalitarian and fascist regime in history eventually failed, thanks to the PEOPLE.

“The Trump administration is considering measures to halt a surge of Central American families and unaccompanied minors coming across the Mexican border, including a proposal to separate parents from their children, according to officials with knowledge of the plans.

These measures, described on the condition of anonymity because they have not been publicly disclosed, would also crack down on migrants living in the United States illegally who send for their children. That aspect of the effort would use data collected by the Department of Health and Human Services (HHS) to target parents for deportation after they attempt to regain custody of their children from government shelters.

The Department of Homeland Security (DHS) has previously considered some of these proposals, but there is renewed urgency within the administration to address an abrupt reversal of what had been a sharp decline in illegal immigration since Trump took office in January.

In November, U.S. agents took into custody 7,018 families, or “family units,” along the border with Mexico, a 45 percent increase over the previous month, the latest  DHS statistics show. The number of “unaccompanied alien children,” or UAC, was up ­­26 percent.

Children’s shelters operated by HHS are at maximum capacity or “dangerously close to it,” an official from the agency said. Overall, the number of migrants detained last month along the Mexico border, 39,006, was the highest monthly total since Trump became president, according to DHS figures.

The proposals, which have been presented for approval to new DHS Secretary Kirstjen Nielsen, were developed by career officials at Immigration and Customs Enforcement (ICE) and other DHS agencies, administration officials said.

Tyler Houlton, a DHS spokesman, confirmed the agency has “reviewed procedural, policy, regulatory and legislative changes” to deter migrants. Without giving further details, he said some of the measures “have been approved,” and DHS is working with other federal agencies “to implement them in the near future.”

“The administration is committed to using all legal tools at its disposal to secure our nation’s borders, and as a result we are continuing to review additional policy options,” Houlton said.

The most contentious ­proposal — to separate families in detention — would keep adults in federal custody while sending their children to HHS shelters. This was floated in March by then-Secretary of Homeland Security John F. Kelly, who is now White House chief of staff. He told CNN at the time that the children would be “well cared for as we deal with their parents.”

Kelly did not move forward with the plan, in part because of the backlash it triggered, administration officials said, and also because illegal migration had plunged to historic lows.

Trump administration officials described the measures as unpalatable but necessarily tough policy options to discourage Central American families from embarking on the long, dangerous journey to the border — or hiring smugglers to bring their children north.

“People aren’t going to stop coming unless there are consequences to illegal entry,” one DHS official said.

Migrants from El Salvador, Guatemala and Honduras represent the largest share of families and children taken into U.S. custody along the border, with many telling border agents that they fear for their lives if sent back to their home countries. The three nations, known as the “Northern Triangle” of Central America, are crippled by gang violence and homicide rates that are among the world’s highest.

Trump administration officials say Central American migrants and the paid smugglers who bring them to the border shamelessly exploit Americans’ compassion, entering the United States illegally and gaming the asylum process.

If a migrant’s stated fear of being sent home is considered “credible,” they enter an asylum process that may take years to adjudicate, and the flood of such petitions in recent years has worsened the backlog of more than 600,000 cases pending in U.S. immigration courts.

Asylum seekers are typically issued work permits while they wait for the process to play out, and when their rejected appeals are exhausted, they often ignore court orders to leave the United States, choosing to remain in the country illegally.

The Trump administration wants to significantly expand immigration detention capacity, and hire more judges and expedite asylum cases to stop migrants from taking advantage of “loopholes” in the asylum process.

The proposal to separate parents from their children is viewed by the agency as a more immediate tool to halt the latest border surge.

DHS has three family detention centers — two in Texas, one in Pennsylvania — with about 2,200 beds available. But legal restrictions on its ability to detain children mean that families are typically given a court date and released from detention not long after they arrive. In November, the three detention centers reached their highest occupancy levels for the year, and they remain near maximum capacity, officials said.

“The parents that would undertake this perilous journey to the United States would be less likely to do it if they knew they would be separated from their kids,” said Andrew R. Arthur, a resident fellow at the Center for Immigration Studies, which seeks to reduce immigration. A former U.S. immigration judge and Republican congressional policy staffer, he called it “a reasonable step to take.”

“It might seem heartless, but it’s more heartless to give them the illusion they’re going to be able to enter the United States freely by hiring a smuggler to come here, because the dangers associated with smuggling along the southwest border are real,” Arthur said.

The unaccompanied minors are typically seeking to reunite with a parent already living illegally in the United States. By law, migrants under age 18 who arrived without a parent must be turned over to HHS within 72 hours of being taken into DHS custody. The shelters where they are housed are designed to be more like boarding schools than grim detention centers.

The minors are placed in the care and custody of the Office of Refugee Resettlement at HHS’s Administration for Children and Families (ACF), which seeks to identify an adult sponsor who can take custody of them.

The process takes about six weeks on average, HHS officials say. “It’s a little-known fact that over half of those who enter illegally are placed with a parent already in the United States,” ACF spokesman Kenneth Wolfe said.

The parents, or any other adult seeking to take custody of a child, must submit to an extensive background check that includes information about their immigration status. But administration officials say that information is neither checked against DHS biometric data nor shared with ICE for potential enforcement purposes. The new DHS proposals under consideration would change that.

If children are forcefully separated from their mothers and fathers, or if parents know they could be arrested or targeted for trying to reunite with their children, migrant advocates say the U.S. government will be inflicting “devastating” trauma on families fleeing Central America because they feel their lives are at risk.

“These measures will only drive families who are vulnerable to exploitation further into the hands of traffickers and smugglers,” said Greg Chen, director of government relations of the American Immigration Lawyers Association.

“These are families that have no other choice for their survival,” he said.”

We could absorb all of the “good guys” fleeing from gang violence in the Northern Triangle without any long-term adverse effects; in fact, it would likely help us prosper as a nation, and would be far more “cost-effective” than the various failing “strategies” we now employ, and have employed in the past, in a vain and counterproductive attempt to prevent the inevitable.

I wouldn’t necessarily give everyone a “Green Card” right off the bat. But, we should have a vastly expanded TPS program for the Northern Triangle, keeping open the possibility of eventually issuing everyone who wants to stay and who has demonstrated payment of taxes (something that even native born GOP rich guys, and most notably the Trumpster himself, hate to do) and no serious crimes to eventually qualify for the Green Card.

Responding to several recent “hate speeches” by Attorney General Jeff “Gonzo Apocalypto” Sessions, EOIR issued a new memorandum basically telling U.S. immigration Judges to revise their thinking and look for any way possible to “shaft” unaccompanied minors fleeing for their lives and asserting claims for protection under U.S. laws.

However, because it is drafted in dense bureaucratic doublespeak with a just a touch of “lip service” to the law, I will give you the “high points” as they would appear to most Immigration Judges:

  • The Attorney General hates UACS, and so should you if you want to keep your job.
  • While this Administration works on its announced plans to strip UACS of all statutory and Constitutional rights, you must always look for ways to effectively eliminate such “false rights” administratively in advance of any changes in the law.
  • Always look for ways to find that someone previously determined by DHS or the ORR to be a “UAC” is no longer, or never should have been, entitled to UAC benefits. 
  • The “best interests of the child” should NOT be an important consideration in an Immigration Court proceeding involving a UAC. 
  • Conversely, the “best interests of the Administration” should generally be given conclusive weight. 
  • Never let considerations of human empathy, misplaced kindness, false compassion, common sense, decency, or any other human emotion lead you to give a break or the benefit of the doubt to a UAC.  
  • Is is permissible, however, to create a false sense of informality and friendliness in your courtroom, so long as it doesn’t result in a grant of any type of protection or relief to the UAC. (Indeed, lulling a UAC into a false sense of comfort or security can be an effective strategy for insuring that he or she will not attempt to find a lawyer and will sign away or waive any rights.)
  • Remember that no matter how young, immature, discombobulated, confused, inarticulate, traumatized, or scared a UAC might be, he or she is NEVER entitled to appointed counsel or to any meaningful help from you in stating or supporting a claim for protection.
  • While all DHS requests should generally be treated as “priorities,” the only request from a UAC or his or her representative that should receive “priority” consideration is a request for immediate voluntary departure from the US. (You should never hesitate to grant such a request even if it appears to be the product of duress or against the UAC’s best interests.)
  • A good way to overcome the unfortunate tendency of some reviewing courts to find testimony of UACS “credible”” is to conclude that even if credible and facially sufficient to establish a claim for relief, the UAC’S testimony is “too generalized” or “not sufficiently detailed” (or any other kind of meaningless legal jargon you might come up with) to satisfy the “burden of proof” for protection.
  • Your main responsibility as an Immigration Judge, and the one for which you will be held accountable, is to ferret out and report fraud, not to insure fairness or due process for the UAC.
  • In discharging your duties as an Immigration Judge, you must always give primacy to the enforcement priorities of the Administration (including the overriding objective of deterrence and how it is advanced by REMOVAl orders, not relief) and the DHS over any legal claims advanced by a UAC.

There was a time in the (seemingly now distant) past when children and other vulnerable individuals were considered appropriate for “special humanitarian consideration,” and treatment. Now, they are “special targets” for Gonzo and his White Nationalist storm troopers: “Fish in a barrel,” “easy numbers, “low hanging fruit,” “roadkill.”

I was particularly impressed (not necessarily favorably) by the straightforward exhortation for the Immigration Court to establish itself as perhaps the only court in the America where the widely accepted principle of “the best interests of the child” is specifically to be given short shrift.

On the other hand, you should think about the possibility that some day you’ll get the question “What did you do during Trump’s War on America, Mommy (or Daddy)?” Do you really want to say:  “I stood by and watched Gonzo Apocalypto abuse, harm, and in some cases kill, helpless children?” We all have choices to make!

“A promised year-end deal to protect the young immigrants known as Dreamers from deportation collapsed Wednesday as Republicans in Congress — fresh off passage of their tax plan — prepared to punt nearly all remaining must-do agenda items into the new year.

Congressional leaders still hope that before leaving town this week they can pass an $81-billion disaster-relief package with recovery funds for California wildfires and Gulf Coast states hit during the devastating hurricane season. But passage even of that relatively popular measure remained in doubt as conservatives balked at the price tag.

Rather than finish the year wrapping up the legislative agenda, the GOP majorities in the House and Senate struggled over their next steps.

Congressional leaders had hoped to extend the Children’s Health Insurance Program, known as CHIP, which provides insurance for some 9 million children nationwide, and pass measures to stabilize the Affordable Care Act. Instead, they appeared resigned by the end of the day to simply avoiding a government shutdown Friday by extending into mid-January the deadline for passing money bills and picking up the legislative battles in 2018.

For Dreamers, young immigrants brought to the U.S. illegally as children, many of whom have been protesting for weeks at the Capitol, Sen. Richard J. Durbin of Illinois, the chamber’s second-ranking Democrat, had a simple message: “I’m sorry.”

“We have a long way to go,” said Durbin, who has led efforts to pass legislation known as the Dream Act in the Senate. “I’m sorry that what we thought would be a moment and an opportunity did not happen.

“At this point it looks unlikely.”

Nearly 800,000 immigrants who were protected under President Obama’s Deferred Action for Childhood Arrivals order are at risk of deportation now that President Trump has announced the end of the program in March. More than 1,000 immigrant advocates arrived in Washington this week pleading with lawmakers to negotiate a legislative solution before leaving town for the Christmas holiday, a deadline for action that Democratic leaders had insisted on earlier this year.

Durbin and others continued to hold out hope that Congress could act on a version of the Dream Act in January. At least one Republican who has been involved in negotiations on the issue, Sen. Jeff Flake of Arizona, predicted a deal was still at hand.

“Bipartisan #DACA bill will be on the Senate floor in January,” he tweeted.

Senate Majority Leader Mitch McConnell (R-Ky.) pledged Wednesday that he would bring a bill to the Senate floor for a vote that included a DACA fix and border security measures if negotiators can “develop a compromise that can be widely supported by both political parties” by the end of January — a promise that leaves him considerable flexibility.

Dreamer advocates said they would persist, despite their disappointment. “We have never been so close to protection as we are right now,” said Greisa Martinez Rosas, 29, the policy director at United We Dream, an immigration advocacy organization. “Whether it’s today or it’s January, immigrant young people are going to continue to grow our base and fight back. It’s about our lives.”

The Dreamers have a broad range of allies. Deep-pocketed Republican donors in the business world, including the U.S. Chamber of Commerce, have urged Congress to pass a bill. Charles Koch, the influential conservative billionaire, joined with Apple Chief Executive Tim Cook this week to write an op-ed supporting the young immigrants.

But negotiations to reach a deal have soured in recent days, according to officials involved in the talks. In a meeting with key senators, White House Chief of Staff John F. Kelly outlined a wish list of immigration law changes that Trump wanted in exchange for backing a DACA replacement. It included strict limits on new arrivals and went beyond the border security measures both sides already had largely agreed to.

Conservative Republicans who back cuts in legal immigration, including Sen. Tom Cotton (R-Ark.), joined the talks as the two sides moved further apart. The group met again on Wednesday.

Dreamer advocates have pressured Democrats to insist on a bill to resolve the status of the young immigrants even at the price of blocking money for federal agencies and provoking a partial government shutdown.

Democrats, although they are the minority party in both houses, have leverage because many conservative Republicans in the House refuse to vote for spending bills, meaning that GOP leaders must rely on Democrats to pass them. In the Senate, spending bills require 60 votes, so the GOP needs the cooperation of at least eight Democrats.

But although some Democrats said they would refuse to vote for any spending bill that did not solve the DACA issue, many moderates, especially in the Senate, made clear they were not willing to shut down the government over the issue, saying they could still resolve it next month.

House Minority Leader Nancy Pelosi (D-San Francisco), who has been under pressure from Dreamers to deliver, blamed Republicans for spending so much time and effort on their tax plan that other issues have been left undone.

“We will get it done,” she told reporters. “It’s shameful that we didn’t, because they’ve been too busy ransacking the middle class, robbing the children’s future and rewarding the rich.”

Meantime, Republicans scrambled to figure out a way forward on the spending and disaster bills, huddling in a basement strategy session late into the evening after celebrating passage of the tax bill at the White House.

House Majority Leader Kevin McCarthy (R-Bakersfield) was hoping enough Democrats would join Republicans to approve disaster funds, which include $4.4 billion for California in the aftermath of wildfires.

“If you look what’s in (it) for California, it’s very strong,” he told reporters.

The spending bill would probably be voted on separately from the disaster bill. It would provide a simple continuation of funds for the next few weeks, without the beefed-up Defense money Republicans wanted or the policy measures Democrats pushed for, including renewal of CHIP.

Also set aside, for now, were votes on measures to stabilize Obamacare sought by Sen. Susan Collins (R-Maine) as part of negotiations for her support on the tax bill.

Collins, however, said that House Speaker Paul D. Ryan (R-Wis.) called her Wednesday and told her the House “remains committed to passing legislation to provide for high-risk pools and other reinsurance mechanisms similar to the bipartisan legislation I have introduced.”

Let’s just focus on the most obvious. Today, the Washington Post and other major media reported that preventable deaths from the “opioid crisis” had slashed an astounding two months from the life expectancy of a child born in the U.S. during 2017!

The GOP Congress and the “Trump Kleptocracy” were far, far too caught up in self-congratulatory “victory dances,” and  looting the Treasury for the benefit of the “Fattest of Fat Cats” to pay any attention to, or have any realistic plan for combatting, opioid addiction deaths. Even though many such deaths occur in so-called “Trump Country,” the attitude is basically “tough luck suckers.” In  other words “Tough Noogies.”

Remember those revoltingly smarmy photos of smug Republicans celebrating gross irresponsibility with Trump today. When the “day of reckoning” for their greed, fundamental inhumanity, and gross irresponsibility arrives, don’t let GOP Trumpsters “off the hook” for their disgusting, irresponsible, selfish, and deadly behavior!

GONZO’S WORLD: JUDICIAL REBELLION – Less Than One Year Into Gonzo’s Reign at The DOJ, One of America’s Most Conservative Judiciaries Seeks Protection From His Plans to Politicize The U.S Immigration Courts!

“In a little noted, but quite extraordinary move, the National Association of Immigration Judges (“NAIJ”) has asked Congress to protect its members (Immigration Judges) from the Trump Administration (their employer). The reason? The Trump Administration is seeking to “evaluate judges’ performance based on numerical measures or production quotas.” According to NAIJ, “If EOIR is successful in tying case completion quotas to judge performance evaluations, it could be the death knell for judicial independence in the Immigration Courts.” “Judges can face potential termination for good faith legal decisions of which their supervisors do not approve.”

EOIR is developing a more efficient way to adjudicate cases (and it comes with a free drink!).

Let’s start with a bit of background. NAIJ is a voluntary organization of United States Immigration Judges. It also is the recognized representative of Immigration Judges for collective bargaining purposes(in other words, the IJs’ union): “Our mission is to promote the independence of Immigration Judges and enhance the professionalism, dignity, and efficiency of the Immigration Courts, which are the trial-level tribunals where removal proceedings initiated by the Department of Homeland Security are conducted.”

According to NAIJ, the most important regulation governing IJ decision-making is 8 C.F.R. § 1003.10(b). This regulation requires that immigration judges exercise judicial independence. Specifically, “in deciding the individual cases before them, and subject to the applicable governing standards, immigration judges shall exercise their independent judgment and discretion and may take any action consistent with their authorities under the Act and regulations that is appropriate and necessary for the disposition of such cases.” 8 C.F.R. §1 003.10(b).

Up until now, IJs were exempted from quantitative performance evaluations. According to NAIJ, “The basis for this exemption was rooted in the notion that ratings created an inherent risk of actual or perceived influence by supervisors on the work of judges, with the potential of improperly affecting the outcome of cases.”

The Trump Administration is now moving to change the way it evaluates IJs. The main reason for the change is the Administration’s goal of reducing the very-large backlog of cases in Immigration Court (currently, there are about 640,000 pending cases). The Executive Office for Immigration Review (EOIR – the office that administers the nation’s Immigration Courts) recently announced a plan to “transform[] its institutional culture to emphasize the importance of completing cases.” In other words, EOIR will judge its judges based–at least in part–on the number of cases completed.

NAIJ has called this development “alarming” and a threat to judicial independence. Why? Because when judges are forced to complete a certain number of cases, they may be unable to devote the necessary time to each case. As a result, the ability to make proper, well-thought-out decisions will suffer.

This is already a problem in Immigration Court. One IJ famously quipped that his job involved adjudicating death penalty cases in a traffic court setting. And so pushing judges to do more cases in less time will potentially impact the alien’s due process rights, and the integrity of our Immigration Courts.

NAIJ has long believed that the system needs a “structural overhaul” and has advocated for converting the Immigration Courts into Article I courts. Article I refers to the first article in the U.S. Constitution, the section on legislative (i.e., Congressional) powers. The idea is that Congress would establish an independent immigration court, much like it created a tax court and a court of veterans appeal. Such a court would be independent of the Executive Branch–the branch of government tasked with enforcing immigration law (currently, IJs are employees of the Department of Justice, a part of the Executive Branch).

NAIJ recognizes that creating Article I immigration courts “may not be feasible right now,” but it nevertheless urges Congress to protect the nation’s IJs from the new Trump Administration policy:

Congress can… easily and swiftly resolve this problem through a simple amendment to the civil service statute on performance reviews. Recognizing that performance evaluations are antithetical to judicial independence, Congress exempted Administrative Law Judges (ALJs) from performance appraisals and ratings by including them in the list of occupations exempt from performance reviews in 5 U.S.C. § 4301(2)(D). This provision lists ALJs as one of eight categories (A through H) of employees who are excluded from the requirement of performance appraisals and ratings. To provide that same exemption to Immigration Judges, all that would be needed is an amendment to 5 U.S.C. § 4301(2), which would add a new paragraph (I) listing Immigration Judges in that list of exempt employees.

The fact that IJs themselves are concerned about the Administration’s move is worrying. The Immigration Judges I know are conscientious and take their jobs very seriously (in contrast to the Trump Administration, which seems utterly lacking in seriousness). If EOIR is making it more difficult for IJs to do their duty, as they understand it, then something is clearly wrong.

Perhaps the IJs’ concerns are overblown. Maybe EOIR will implement the new case completion standards in a way that does not damage judicial independence or due process. But given the Administration’s track record in general, and the inexperienced acting director appointed to head EOIR, it’s difficult to have much confidence in the new policy. Since Congress is unlikely to act on NAIJ’s request for protection, I suppose we will see soon enough how these changes affect the Immigration Courts.

Finally, in my opinion, EOIR has largely misdiagnosed the problem. While some delay may be caused by IJs kicking the can down the road, or by aliens “playing” the system, most delay is systematic–it is caused by reshuffling Administration priorities, which affect how DHS and DOJ schedule cases. I doubt that imposing numerical quotas on IJs will do much to improve the situation. Other solutions–facilitating pre-trial conferences, reforming the Master Calendar system, better use of technology, imposition of costs, premium processing for certain applicants–might be more effective. Everyone agrees that reducing the backlog is a worthy goal, but case completion requirements are probably not the best way to achieve that end.”

“Extraordinary” to be sure! Folks, this isn’t the Ninth Circuit or even the Seventh, Second, or Fourth Circuit, all of which from time to time have “stood tall” for the Due Process rights of migrants.
For those unfamiliar with the process, the U.S. immigration Court is a “captive Administrative Court” functioning as part of the U.S. Department of Justice (“DOJ”) rather as an independent judiciary established under Article III or Article I of the U.S. Constitution.
For the past 17 years, the DOJ (with the exception of an ill-fated move by the Bush II Administration to hand out Immigration Judgeships as political rewards to their faithful) has gone out of its way to insure that those selected as Immigration Judges have a record demonstrating a “commitment to achieving agency priorities.” Translated from bureaucratese, that means that they understand the DHS immigration enforcement objectives and will not “rock the boat” by expanding or recognizing any new rights for migrants unless given permission to do so by the DOJ or DHS.
Not surprisingly, this has resulted in a judiciary where the overwhelming number of new U.S, immigration Judges appointed since 2000 — nearly 90% — come from “safe” government backgrounds, primarily from the DHS. Moreover, no “Appellate Immigration Judge” (or, “Board Member”) at the BIA has been appointed directly from outside the U.S. Government since the pre-21st Century “Schmidt Era” at the BIA. (For “EOIR trivia buffs,” the last two outside appointments to the BIA in 2000 were the late Hon. Juan P. Osuna and the Hon. Cecelia M. Expenoza who was exiled along with me and others during the “Ashcroft Purge” of 2003.)
So, we’re dealing with a basically conservative, government-oriented judiciary of  “non-boat rockers” who mostly achieved and retained their present judicial positions by “knowing and doing what the boss wanted” and making sure that any “deviations” were within limits that would be tolerated.
Yes, it’s OK to grant some asylum cases, particularly from Africa or the Middle East, over DHS objections; but “watch out” if you start granting lots of asylum to folks from the Northern Triangle or Mexico for whom the big “NOT WELCOME SIGN” has been hung out by the last three Administrations, or if you accept any new “particular social groups” which Administrations tend to view with fearful eyes as potentially “opening the floodgates” of protection to those who sorely need and can easily access it (in other words, to those whom the Geneva Refugee Convention actually was intended to protect.)
So, this isn’t a judiciary that normally would be expected to “buck the system.” Indeed, although the world has probably never been worse for refugees since World War II, the Immigration Courts seem to have inexplicably but dutifully reduced asylum grants since the clearly xenophobic, anti-refugee, and anti-asylum Trump Administration assumed office and Gonzo began delivering his anti-asylum, anti-lawyer, anti-immigrant rants.
Therefore, the threat to the limited judicial independence that U.S. Immigration Judges possess under the regulations (which haven’t prevented occasional “reassignments” for ideological or political reasons in the past) has to be presumed both real and immediate to prompt this group to take the risky action of publicly seeking protection. After all, Gonzo could potentially “retaliate” by further limiting the judges’ authority, further jacking up the already astronomically high stress levels under which the judges operate, or “reassigning” “unreliable” judges to more mundane or unattractive positions within the DOJ (sometimes known as “hallwalker” positions).
It’s definitely a further sign of an unhealthy judicial system on the verge of collapse. Before that happens, and 650,000+ additional cases spew forth into other parts of our justice system, it would be wise of Congress to make at least some immediate reforms to preserve independence and due process within the U.S. immigration Courts.
I also agree with Jason that attorneys and respondents are not the major problem driving uncontrolled backlogs in the U.S. immigration Courts. No, it’s all about “Aimless Docket Reshuffling” (“ADR”) generated by EOIR itself at the behest of its political handlers at the DOJ.
But, I don’t agree with Jason’s statement that EOIR has merely “misdiagnosed” the problem. No, EOIR and DOJ know exactly what the problem is, because they created it (egged on, no doubt by DHS and sometimes the White House).
Gonzo and EOIR are intentionally misrepresenting and misusing data to hide the truth about how screwed up the system has become because of the DOJ’s toxic combination of administrative incompetence with improper political and enforcement motives. In other words, DOJ is attempting to cover up its own “fraud, waste, and abuse” of public funds.
Even worse, and more reprehensible, Gonzo is attempting disingenuously to shift the blame to respondents and their overworked attorneys who are more often than not the actual victims of the scam being pulled off by the DOJ as part of the Trump Administration’s xenophobic, White Nationalist campaign to reduce the precious rights of asylum seekers and others. We can’t let him get away with it!

REGIME OF SCOFFLAWS — ADMINISTRATION’S CONTEMPT FOR CONSTITUTION, COURTS LIKELY TO CONTINUE UNABATED UNLESS & UNTIL SUPREMES GET BACKBONE — No Sign Of Any Endoskeleton @ High Court To Date!

“IN OCTOBER, the government tried and failed to keep an undocumented teenager in federal custody from ending an unwanted pregnancy. Yet officials appear to have learned little from 17-year-old Jane Doe’s victory in court over the government’s effort to keep her from the abortion clinic. Again, it has fought tooth and nail — and failed — to prevent two more pregnant teenagers from getting the medical care they desired.

Since his appointment by President Trump to head the Department of Health and Human Services’ Office of Refugee Resettlement (ORR), antiabortion activist E. Scott Lloyd has barred federally funded shelters for undocumented minors from “supporting” access to abortion without his approval. Mr. Lloyd has reached out personally to convince some teenagers against ending their pregnancies. Others, like Ms. Doe, are forced to attend “life-affirming options counseling.”

Last week, the American Civil Liberties Union filed suit on behalf of two more undocumented teenagers whom ORR blocked from obtaining abortions. Like Ms. Doe, both are pregnant and crossed into the United States without their parents.

Both will now be allowed to get their abortions. A federal district judge allowed one teenager to travel to a clinic as of Monday. And the Justice Department dropped its appeal of the other teenager’s case after discovering that she was 19 years old, not 17 — meaning that Immigration and Customs Enforcement, not ORR, should take custody of her as an adult. ICE has now released her. But even if it hadn’t, ICE allows undocumented women in its care to obtain abortions as a matter of policy.

The collapse of the court case demonstrates just how absurd ORR’s policy really is. The government acknowledges that the Constitution grants these teenagers the right to an abortion. Yet when a 17-year-old and a 19-year-old have the same right under Roe v. Wade, how can the government justify summarily blocking one from obtaining an abortion but not the other? The rest of the government’s case was equally flimsy. ORR argues that it has no obligation to “facilitate” the procedure — though in each case so far, the logistics and costs have been privately arranged, leaving ORR with the responsibility of simply getting out of the way.

ORR also made the case that the teenagers could simply leave the country or depart federal custody for a government-approved sponsor. But the fact that a person could cross back across the border doesn’t strip her of constitutional rights while in the United States. And each week it takes to find a suitable sponsor makes abortion more difficult and dangerous to obtain.

It’s welcome news that the government is no longer abusing its power over these two vulnerable teenagers. Yet even as the ACLU mounts a broader legal challenge to ORR’s behavior, it’s likely that ORR will continue to trap other undocumented teenagers in the same situation. Mr. Lloyd should abandon this cruel policy.”

We also learned elsewhere this week that Trump considered withdrawing his nomination of Judge Neil Gorsuch to the Supremes because Gorsuch had the audacity to stand up for his judicial colleagues in the face of outrageous attacks on their professionalism and integrity by Trump.

In other words, Gorsuch threatened to take his oath to uphold the Constitution seriously, rather than putting loyalty to Trump first in the manner of Vice Sycophant Mike Pence and many others in the GOP. (Witness the disgusting display of fawning and “public a— kissing/licking” of Trump by the GOP “establishment” like Ryan and McConnell after they pulled off the biggest heist of public funds for private enrichment in American history,)

Trump has exactly the same expectation of “judges as robed stooges for the executive” as do strongmen and Third World Dictator/Presidents for Life. Think Vladimir Putin, President Xi, President Duterte, or President Sisi want an independent judiciary looking over their shoulders? Neither does Trump! And these guys, not leaders of democracies, are the leaders that Trump admires and wants to emulate.

Scott Lloyd has decided not to follow the Constitution. In a normal Constitutional Government, the DOJ would decline to defend Mr. Lloyd in court, thus forcing him to comply.

But, fellow scofflaw Jeff “Gonzo Apocalypto” Sessions not only has defended Lloyd’s unconstitutional actions but made frivolous arguments in support of Lloyd. He’s even taken his frivolous positions all the way to the Supremes and outrageously made a further frivolous request for sanctions on the ACLU lawyers defending the Constitution!

 

Ironically, the only time when Sessions, Lloyd, and other GOP restrictionists have any concern for Hispanic children is when they are unborn. Once they are born, Gonzo, Homan, and the restrictionists are eager to abuse Hispanic kids by deporting their parents or siblings, breaking up families, terrorizing their communities, depriving them of support, health care, and education, and generally making their lives as miserable as possible.

Indeed, the Trump/Sessions White Nationalist “strategy” seems to be that if you mistreat US citizen kids of color badly enough, they eventually will leave and never return to exercise their rights. But, I actually think that most will remember what Trump/Sessions & the GOP White Nationalists are doing to them now. Once they become voting age, they can help insure that America is never again subjected to the travesty and preventable horror of the likes of Trump, Sessions, and other White Nationalists holding public office and attempting to force their vile, minority views on immigrants down the unwilling throats of the majority of us.

If private lawyers conducted themselves with such obvious contempt for the Constitution and Courts, they would be facing contempt of court charges, loss of law license  (in Gonzo’s case), and possible imprisonment. But, Lloyd and Gonzo are actually flaunting their lawless behavior and the unwillingness of a Court supposedly “bought and paid for” by the GOP to restrain an out of control GOP Administration.

Until the Supremes get serious about holding Constitutional scofflaws and bullies like Lloyd and Gonzo accountable, finding them in contempt, and throwing them in jail if they continue to abuse the Constitution and the time of the US Courts, the Administration’s all-out assault on the true “rule of law” will continue unabated!

The Trump Administration (certainly not undocumented migrants) is the single greatest threat to the continued existence of American democracy and American greatness. Will we wake up as a nation before it’s too late?

Top senactors and White House officials are laying the groundwork for a major immigration deal in January to resolve the fate of young undocumented immigrants whose legal protections were put in limbo by President Donald Trump.

At a Tuesday afternoon meeting with nearly a dozen senators deeply involved in immigration policy, White House chief of staff John Kelly pledged that the administration will soon present a list of border security and other policy changes it wants as part of a broader deal on so-called Dreamers, according to people who attended the meeting. The plan could come in a matter of days, senators said.

About a half-dozen senators have been negotiating a bipartisan package prompted by Trump’s decision to kill the Deferred Action for Childhood Arrivals program, an Obama-era executive action that granted work permits to nearly 800,000 undocumented immigrants who came here as minors. Yet the senators could not fully flesh out a deal before they knew what Trump was willing to sign.

“We couldn’t finish this product, this bill, until we knew where the administration was,” Sen. Jeff Flake (R-Ariz.), who has been negotiating a DACA compromise for weeks, said in an interview after the meeting with Kelly. “And that’s why this meeting was so important.”

Congressional Republicans and the White House have long said any DACA deal would need to be paired with security and other enforcement measures. Democrats say that’s fine as long as the provisions weren’t too onerous. But the border security question has been a sticking point for weeks, as senators swapped proposals without cutting a deal, so far.

And while liberal Democrats and grass-roots activists are pressuring Congress to enact permanent legal protections for Dreamers this year, both Democrats and Republicans at the meeting with Kelly said there was a consensus that legislation wouldn’t pass before lawmakers leave Washington. It was one of the clearest sign yet that a Dreamers agreement won’t, to the chagrin of liberals, come before 2018.

“Our belief is that if this matter is not resolved this week — and it’s not likely to be resolved — that come the omnibus and the caps, that we have another chance to finally come up with a bipartisan package of things to include” by mid-January, said Sen. Dick Durbin (D-Ill.), who also attended the meeting. “The closer we get [to the March deadline], the more nervous I get, not to mention the way these young people feel. I’m sorry that it’s taken this long.”

Flake said he believes he has a commitment from Senate Majority Leader Mitch McConnell (R-Ky.) to hold a cloture vote on the floor on an immigration deal by mid-January, before the next likely deadline to fund the government, Jan. 19.

A spokesman for McConnell did not immediately return a request for comment. But the majority leader said during a Fox News interview that he has talked about the immigration issue with his counterpart, Senate Minority Leader Chuck Schumer of New York.

“No, we’ll not be doing DACA … this week,” McConnell said. “That’s a matter to be discussed next year. The president has given us until March to address that issue. We have plenty of time to do it.”

At the Tuesday meeting, Kelly and other administration officials went into detail about how much of the southern border is currently fenced and how much more the White House would want in exchange for a DACA deal, according to people who attended.

Senators also pressed the White House on other immigration demands, such as an overhaul of the nation’s asylum system or a change in policy toward unaccompanied minors who are apprehended at the southern border, and whether they needed to be included in the current DACA talks.

“Which of those policy items, or immigration law changes, do we need to make as part of this and what can wait for something else?” Flake said, summing up the questions from senators. “There’s a lot of nice things we need to do as part of broader comprehensive reform, but we need to have a bill in January and we need to know what has to be in it and what the administration will support.”

The bipartisan group of senators — Flake and Durbin, Michael Bennet (D-Colo.), James Lankford (R-Okla.), Thom Tillis (R-N.C.), Lindsey Graham (R-S.C.) and Cory Gardner (R-Colo.) — has discussed a legalization plan that would marry the DREAM Act, drafted by Durbin and Graham, with a more conservative proposal for Dreamers written by Tillis and Lankford, Flake said.

Those seven senators attended Tuesday’s meeting with Kelly, as did Senate Majority Whip John Cornyn (R-Texas), and Republican Sens. Tom Cotton of Arkansas and David Perdue of Georgia.“I think what we’re trying to do is to get some clarity from the administration on what they require by way of border security and other enforcement measures,” Cornyn said as he left the meeting. “We got a promise to provide it to us and hopefully we’ll get that in short order. Maybe even this week.”

Republicans’ commitment to taking up a DACA deal next month won’t spare Democrats the fury of liberal groups that have demanded that any spending bill this year include a solution for Dreamers.

Democratic leaders have signaled that they won’t risk a government shutdown this month to secure relief for the Dreamers, though some lawmakers have vowed to withhold their votes for any must-pass funding measure without an immigration fix.

Durbin, the influential second-ranking Senate Democrat, is firmly in the camp of senators who won’t vote for a spending bill without help for Dreamers. That group also includes liberal Sens. Bernie Sanders (I-Vt.), Kamala Harris (D-Calif.), Kirsten Gillibrand (D-N.Y.), and Elizabeth Warren (D-Mass.).

Durbin was asked by reporters Tuesday if there was a divide between him and Schumer over where to draw the line on the issue, and acknowledged that there “may be.”

Schumer, for his part, put Republicans on notice Tuesday that they shouldn’t count on Democratic votes for a short-term funding package that includes just some of Democrats’ priorities — such as children’s health insurance — while leaving immigration for next year.

In the House, lawmakers, including several in the Congressional Hispanic Caucus, privately say they don’t see a path to secure a legislative fix for Dreamers before the end of the year. They acknowledge that the sides are now positioning themselves for a fight in January.

House Minority Leader Nancy Pelosi (D-Calif.) touched on dynamics during a private leadership meeting Monday night.

“We need to stick [together] and show that they need us,” said one Democratic member with knowledge of the strategy going into January. Republicans “are not going to be able to keep going on with the CRs. … Then we’re at an inflection point in January.”

That hasn’t stopped some members from making a last-ditch effort to reach a bipartisan agreement, in hopes Democrats can use it as leverage in the House if Republicans need their votes to pass a short-term funding bill later this week.

“I believe that my leadership is gonna close the deal and I have to believe that,” said CHC Chair Michelle Lujan Grisham (D-N.M.), noting she’s canceled all Christmas travel to stay in Washington and work on a legislative fix.

Reps. Will Hurd (R-Texas) and Pete Aguilar (D-Calif.) are behind one effort that would pair a proposal similar to the DREAM Act with border security, according to several members.

And the Problem Solvers Caucus, a bipartisan group of 48 moderate Democrats and Republicans, is preparing to publicly embrace a specific proposal in the next day or two. A subset of the group has been working for weeks to hammer out an agreement and the entire caucus planned to meet again Tuesday night.

“There’s certainly scenarios where this could get done this week. I’m not an expert on how all these pieces could unfold,” said Rep. Josh Gottheimer (D-N.J.), a co-chairman of the group. “But everything is clearly on the table, which is why we think it’s important we move and move quickly here.”

Ironically, as I’ve pointed out before, the controversial “Border Wall” seems to be the least overtly harmful to humans and the long-term interests of the US of the various unnecessary enforcement measures the GOP has put out there in negotiations. Yeah, it is a waste of money, a boondoggle for certain contractors, and makes us look like a nation of scared nincompoops.

But, ending normal family migration (or as GOP White Nationalists pejoratively have termed it “chain migration”), funding the “New American Gulag,” and/or providing more unneeded agents for the Trump-Sessions-Bannon “American Gestapo” all will do much more long-term damage to actual human beings and to the economic future and social fabric of our country,

Perhaps, at some better time in the future, we could pay a diverse group of native and immigrant workers to tear down “The Wall” as part of our gala Fourth of July celebration on TV.  Or, it could work as part of the celebration of the birthday of President Ronald Reagan. Or, we could implode The Wall on national TV.

It took Abigail Bautista less than a month of living in Langley Park to learn that her new neighborhood in Maryland had its own set of laws, written not in statutes but in gang graffiti and blood.

The Guatemalan mother of five was pushing a cart of merchandise along University Boulevard one winter morning in late 2012 when three young men approached.

“Do you know who we are?” one asked her in Spanish.

Bautista shook her head.

“We are La Mara Salvatrucha,” he said. “And here, there are rules.”

Pay $60 “rent” per week or there would be trouble, he said. Undocumented and afraid of being deported if she went to police, Bautista began handing over the cash.

She had heard of the international street gang growing up in Central America, where MS-13, as it’s known, controls cities through brutality and corruption. But she had lived for the better part of a decade in the United States without crossing its path.

Now, she realized, she’d unwittingly moved into MS-13 territory a mere seven miles from the White House.

As the gang has grown in strength in recent years, so has its sway over communities across the country. From Boston to Northern Virginia to Houston, a string of grisly MS-13 murders has highlighted its resurgence, drawing a response from the White House.

“One by one, we’re liberating our American towns,” President Trump said this summer in Long Island, where MS-13 has been linked to more than a dozen recent killings.

Left out of Trump’s speeches, however, is the fact that most of the gang’s victims are not Americans but undocumented immigrants like Bautista. And when it comes to the gang’s infamous motto of “kill, rape, control,” it’s the third — enforced daily through extortion and intimidation — that defines life for some immigrants in places such as Langley Park.

“They are preying on the communities that they are living in,” said Michael McElhenny, a supervisory special agent for the FBI in Maryland.

More than a decade after a string of MS-13 killings shook the heavily Latino neighborhood, Langley Park is still struggling to shake off the gang’s influence. Despite aggressive policing, the area continues to be plagued by MS-13 drug dealing, prostitution, robbery, extortion and murder, according to court records and interviews with residents, activists, prosecutors and gang experts, as well as local and federal law enforcement officials.

Federal authorities say the racketeering case and two other recent MS-13 indictments show they are serious about again dismantling the gang in Maryland. But Bautista won’t be satisfied until authorities lock up the man she suspects of leading MS-13 in Langley Park.

Two weeks after her son’s body was found, and a few days before his vigil, she said, a letter was slipped under her door.

“If you keep talking, there will be consequences,” it warned in childlike handwriting, according to Bautista.

It was signed, she said, by the roofer.

One thing is clear: The gang problem isn’t going to be “solved” by having having clueless, anti-Hispanic, White Guys like Trump and Sessions uttering threats against the entire immigrant community from Washington.

No, the irony is that prosecutions and deportations, although they might rack up impressive statistics, really don’t bother gangs much. Gangs control big chunks of the prisons, both in the US and, even moreso, in the Northern Triangle. To some extent, a prison sentence is just a “temporary work reassignment.”

And, deportations: well that’s actually how the MS-13 grew, when the US deported LA gang members to El Salvador during the Reagan Administration without thinking about how to deal with the long term problem — how they would grow to control and terrorize the places to which they were being deported.

It doesn‘t take a “rocket scientist” (just someone smarter and less racist than Trump and Sessions) to figure out that the overheated anti-immigrant rhetoric that lumps gang members with generally law abiding workers and asylum applicants is a “made to order” recruitment tool for the MS-13 and other gangs.

”Trump and Sessions don’t respect you and don’t want you in America. They don’t even like the ‘good’ immigrants, so don’t waste your time on the false ‘American Dream.’ We’re you’re ‘REAL’ family that isn’t afraid of Trump, and will give you power, respect, and control, as long as you remain loyal to us. What’s Trump got to offer Hispanic youth?”

Reducing gang violence will require a nuanced, time consuming, labor intensive multi-cultural approach that:

  • Treats Hispanic youth, documented and undocumented, with respect and shows them they are valued by society;
  • Provides positive role models from the Hispanic community;
  • Gives youth viable alternatives to gangs;
  • Gains the trust of all members of the Hispanic community, whether documented or not;
  • Involves bilingualism, more Hispanic police officers, and potentially dangerous undocover operations in the community;
  • Recognizes and deals with the problems of gang control in US prisons;
  • Deals with the difficult question of what happens when we deport gang members back to the Norther Triangle.

With respect to the latter point, if we merely send U.S. gang members back to terrorize communities in the Northern Triangle, that will lead more terrorized community members to flee to the U.S. The cycle will continue.

The Trump Administration’s ham-handed immigration policies taken from the “White Nationalist restrictionist playbook” will likely only exaberrate the problem of gangs and gang violence in the long run.

 I.  INTRODUCTION

 

Thank you so much for inviting me to speak at this wonderful event. I’m honored to be here. Thanks also to Crowell & Moring for providing this lovely facility.

 

When I got off the subway at Metro Center tonight, I came out on the corner of 12 & F Street, NW. I spent the first two years of my legal career right at that spot working as an Attorney Advisor for the Board of Immigration Appeals, the “BIA,” in the days before the creation of the Executive Office for Immigration Review (“EOIR”). The BIA was located on the top floor of the now long demolished “International Safeway Building,” which believe it or not, actually contained a functioning Safeway grocery store.

 

As the “new kids on the block,” the late Lauri Filppu and I got sent down to Safeway to buy beer and supplies for the office parties. A little like being the “Junior Justice” at the Supreme Court, I suppose – but, maybe, not so much. Interestingly, Lauri and I both went on to eventually serve as appellate judges – “Board Members” – at the BIA. He served with me when I was BIA Chair in the late 1990’s.

 

I don’t recognize much of the “Ol’ Hood.” Then, it was mostly wig shops, record stores, souvenir stands, and a few lunch counters that catered to the “work and tourist” lunch crowd. Not a place you wanted to be after dark.

 

The one remaining “landmark” is the Hotel Harrington. But the “Kitcheteria” and the aptly named “Pink Elephant Lounge” have been replaced by something called “Harry’s Family Bar & Grill” that still has kind of a “Kitcheteria/Pink Elephant” aura about it. At any rate, the ‘hood and the quarters at the BIA bore no resemblance to this splendid building and the Crowell & Moring “digs.”

 

The Women’s Bar Association of DC is a terrific organization,[1] and you are extremely fortunate to have such great lawyers, leaders, and amazing human beings as my friends Pauline Schwartz and Leticia “Letty” Corona involved.


They were part of the “life saving crew” at the Arlington Immigration Court during my tenure on the bench. They are also stalwarts of the “New Due Process Army” which I will discuss later. And, as I already mentioned, Pauline & Letty were the creators of the four hypotheticals and the “power points” that we used as a “lead in” tonight.

 

I also want to recognize my long-time friend and colleague retired U.S. Immigration Judge Joan Churchill whom I understand was your keynote speaker at this event last year. Joan and I actually met as BIA Attorney Advisors in 1973, and were part of the “lunch foursome.” So, we got to know the neighborhood’s culinary offerings very well. We also served together for a number of years on the bench after I was reassigned to the Arlington Immigration Court in 2003.

 

Courageous women are rightfully dominating our news. We should all recognize that Judge Churchill’s pioneering role as one of the first female U.S. Immigration Judges in the nation helped to pave the way for a more diverse judiciary and for all the women who serve as U.S. Immigration Judges today. And Judge Churchill definitely is a role model who, no mater how tough and challenging things got, absolutely could never be bullied or intimidated.

 

I was thinking of Judge Churchill as I walked over her tonight. After her initial appointment to the bench, she was the target of some petty but persistent attempts to drive her out by the “macho culture” that then prevailed at the “Legacy DHS” and was unhappy that she, rather than ”one of their own,” had been appointed to the judgeship.

 

We discussed what happened then and over the years. To the best of my knowledge, there was no overt sexual act involved. But, the pattern of harassment and attempts to create an inhospitable work environment were certainly directed at Judge Churchill’s gender as a woman. So, it fits today’s definition of “sexual harassment.”

 

In any event, in Judge Churchill’s case they “picked on the wrong person.” So, for those of you, particularly younger lawyers, and particularly women lawyers, who have never met her, tonight is you chance to meet a true “American legal and judicial hero” who paved the way for others to follow.

 

I’d also like to recognize another distinguished former colleague from the Arlington Immigration Court, Judge Lawrence O. Burman who is here tonight. As many of you know, through his tireless work with the Federal Bar Association, Judge Burman has been a leader in promoting better Immigration Court practice through continuing legal education.

 

And, in his capacity as an officer of the National Association of Immigration Judges, the “NAIJ, ”he has also been one of the leaders in fighting for the creation of an independent Article I U.S. Immigration Court. I trust that by the end of my speech tonight you will understand why that effort is so timely and critical to our nation’s justice system. For the record, both Judge Churchill and I are retired members of the NAIJ. Indeed, Judge Churchill is a past President of the NAIJ.

 

Now, as Judge Burman and Judge Churchill know, this is the point at which I used to deliver my comprehensive disclaimer giving everyone in Government “plausible deniability” for everything I might say, particularly anything that might come too close to the truth. I do not have to do that any more. But, I will give the Women’s Bar Association of DC the benefit by disclaiming that anything I might say tonight represents their views or any approximation thereof. No, folks, tonight everything I say is my view, and only my view: no bureaucratic “doublespeak,” no party line, no sugar coating! I’m going to tell you exactly what I really think!

 

II. THE DUE PROCESS CRISIS IN IMMIGRATION COURT

 

As many of you in this room probably recognize, there is no “overall immigration crisis” in America today. What we have is a series of potentially solvable problems involving immigration that have been allowed to grow and fester by politicians and political officials over many years.

 

And, unfortunately, the current Administration with its anti-immigrant attitudes and polarizing racial and ethnic rhetoric intends to make the problems worse rather than better. That starts with the absolute disaster in our beleaguered U.S. Immigration Courts.

 

There is a real crisis involving immigration: the attack on due process in our U.S. Immigration Courts that has brought them to the brink of collapse. I’m going to tell you seven things impeding the delivery of due process in Immigration Court that should be of grave concern to you and to all other Americans who care about our justice system and our value of fundamental fairness.

 

First, political officials in the last three Administrations have hijacked the noble mission of the U.S. Immigration Courts. That vision, which I helped develop in the late 1990s, is to “be the world’s best administrative tribunals guaranteeing fairness and due process for all.” The “fundamental flaw” here is that as mere “administrative courts” situated within the U.S. Department of Justice, the U.S. Immigration Courts are not truly independent in the same way as other major “specialized” court systems, such as the Tax Court and the Bankruptcy Courts.

 

In the best of times, placing the Immigration Courts within the Department of Justice is problematic. With the anti-immigrant, xenophobic, self-styled “immigration enforcer-in-chief “ Jeff Sessions as Attorney General, it is a disaster from a due process and fundamental fairness standpoint.

 

The Department of Justice’s ever-changing priorities, “Aimless Docket Reshuffling” (“ADR”), and morbid fascination with increased immigration detention as a means of deterrence have turned the Immigration Court system back into a tool of DHS enforcement. Indeed, Sessions recently announced a series of so-called “reforms” which, far from improving the Immigration Courts, mostly would further compromise fairness, professionalism, and due process.

 

He plans to impose case completion quotas – read “deportation quotas” — for judges. At the same time he mischaracterizes statistics in attempting disingenuously to “fob off “ primary blame for the current monumental backlog of 650,000 pending cases on overworked private attorneys, the “real heroes” of our system, and unrepresented migrants, the real victims of ADR, while ignoring and attempting to cover up the real cause of the problemAimless Docket Reshuffling (“ADR”) instituted by DOJ politicos attempting to use the Immigration Courts as an adjunct of DHS enforcement.

 

Sessions intentionally ignores his own data showing that that recent increases in requests for continuance are coming from DHS and EOIR itself, rather than from the private bar! Obviously, it is past time for a truly independent U.S. Immigration Court to be established outside the Executive Branch.

 

Second, there simply are not enough pro bono and low bono attorneys and authorized representatives available to assist all the individuals who need representation in Immigration Court. Removal proceedings conducted by U.S. Immigration Judges are considered “civil” in nature, although in many cases they have consequences far more serious than criminal prosecutions. Consequently, migrants appearing in Removal Proceedings are not entitled to appointed counsel, as they would be in criminal proceedings. Therefore, the role of private attorneys, and particularly those serving on a pro bono or “low bono” basis, as many of you in this room are doing or have done in the past, become absolutely critical to achieving due process.

 

This problem is particularly acute in so-called “detention courts.” We know that representation makes a huge difference. Represented individuals succeed at rates four to five times greater than unrepresented individuals.

 

Accordingly, an Attorney General truly interested in due process, fairness, and efficiency, would emphasize the need to insure adequate access to counsel. Instead, Sessions has gone out of his way to wrongly characterize attorneys as potential “fraudsters” who supposedly are impeding the progress of his “deportation railway” with dilatory requests for continuances and applications for asylum provided by U.S. and internal law. Session’s intentional distortion of what is really happening in Immigration Court should outrage every American who cares about the Constitutional right to due process and integrity and intellectual honesty from U.S. government officials!

 

There have been a number of studies documenting the substandard conditions in immigration detention, particularly those run by private contractors, which in some cases prove deadly or debilitating. Some of these studies have recommended that immigration detention be sharply reduced and that so-called “family detention” be discontinued immediately.

 

A rational response might have been to develop creative alternatives to detention, and to work closely with and support efforts to insure access to legal representation for all individuals in Removal Proceedings. Instead, the response of the current Administration has been to “double down” on detention, by promising to detain all undocumented arrivals and to create a new “American Gulag” of detention centers, most privately run, along our southern border, where access to attorneys and self-help resources intentionally is limited to non-existent.

 

The documentation of the need for attorneys to represent respondents in Removal Proceedings to achieve fundamentally fair results is extensive and widely available. Given that, I ask you what kind of Attorney General and what kind of Government would intentionally locate traumatized individuals, many women and children, who are seeking potentially life-saving relief under our laws, in obscure poorly run detention facilities where access to counsel is impeded? Is this something of which we can be proud as a nation or should accept as simply “business as usual” in the age of Trump and Sessions?

 

Third, the Immigration Courts have an overwhelming caseload. Largely as a result of “Aimless Docket Reshuffling” by Administrations of both parties, the courts’ backlog has now reached an astounding 650,000 cases, with no end in sight. Since 2009, the number of cases pending before the Immigration Courts has tripled, while court resources have languished.

 

The Administration’s detention priorities and essentially random DHS enforcement program are like running express trains at full throttle into an existing train wreck without any discernable plan for clearing the track!” You can read about it in my article in the May 2017 edition of The Federal Lawyer.

 

Fourth, the immigration system relies far too much on detention. The theory is that detention, particularly under poor conditions with no access to lawyers, family, or friends, will “grind down individuals” so that they abandon their claims and take final orders or depart voluntarily. As they return to their countries and relate their unhappy experiences with the U.S. justice system, that supposedly will “deter” other individuals from coming.

 

Although there has been a downturn in border apprehensions since this Administration took office, there is little empirical evidence that such deterrence strategies will be effective in stopping undocumented migration in the long run. In any event, use of detention, as a primary deterrent for non-criminals who are asserting their statutory right to a hearing and their constitutional right to due process is highly inappropriate. Immigration detention is also expensive, and questions have been raised about the procedures used for awarding some of the contracts.

 

Fifth, we need an appellate court, the Board of Immigration Appeals, that functions like a real court not a high-volume service center. Over the past decade and one-half, the Board has taken an overly restrictive view of asylum law that fails to fulfill the generous requirements of the Supreme Court’s landmark decision in Cardoza-Fonseca and the Board’s own precedent in Matter of Mogharrabi. The Board has also failed to take a strong stand for respondents’ due process rights in Immigration Court.

 

Largely as a result of the Board’s failure to assert positive leadership, there is a tremendous discrepancy in asylum grant rates – so-called refugee roulette.” Overall grant rates have inexplicably been falling. Some courts such as Atlanta, Charlotte, and some other major non-detained courts have ludicrously low asylum grant rates, thereby suggesting a system skewed, perhaps intentionally, against asylum seekers. Perhaps not coincidentally, the Board has become totally “government-dominated” with no member appointed from the private sector this century.

 

Moreover, Sessions has publicly delivered shockingly extreme anti-asylum statements directly to EOIR adjudicators. He intentionally and substantially mis-stated the full scope of asylum protection by suggesting that critical “particular social group” protection that is a key element of both U.S. and international protection laws is somehow “less worthy” than other grounds; suggested rampant asylum fraud without supporting evidence; criticized case law that has appropriately recognized rights to protection greater than Sessions and his restrictionist allies want; and suggested, again without evidence, that lawyers are the problem, rather than the solution.

 

Sessions’s “cure” would be further reductions in the rights of asylum seekers, and more use of “expedited removal” which assigns nearly absolute ability to block asylum seekers from receiving full hearings to totally unqualified and biased law enforcement personnel.

 

Since retiring, I have been a forthright critic of some of the Obama Administration’s misguided and overly restrictive immigration policies, particularly the unnecessary prioritization and detention of scared women and children from the Northern Triangle seeking asylum. However, Sessions has heaped unjustified criticism on the Obama Administration for the things they did absolutely correctly and in accordance with the law: correctly applying “credible fear standards in exactly the generous manner contemplated by law and for properly releasing good faith asylum seekers from detention, rather than making them part of Sessions’s un-American “New American Gulag.”

 

Folks, Senator Elizabeth Warren, Senator Corey Booker, and the Congressional Black Caucus tried to tell the nation and the world why Jeff Sessions was clearly unqualified to serve as Attorney General. They were ignored and in Senator Warren’s case rudely silenced by Majority Leader Mitch McConnell for speaking truth. Now those of us who believe in the Constitutional Due Process and fairness for all, the rule of law, and a proper and generous application of U.S. asylum and refugees laws are seeing the disturbing results.

 

That an individual with such high biased, legally inaccurate, factually unsupported, and inappropriately negative views of U.S asylum law and the plight of refugees and asylees would hold any position of responsibility in the Government of the U.S. is disturbing at best. That he would be in charge of a court system that is often the last and only resort for those seeking due process, fundamental fairness, and legal protection from persecution and torture under our domestic laws and international conventions is simply appalling.

 

 

Sixth, the DOJ selection process for Immigration Judges and BIA Members has become both incredibly ponderous and totally one-sided. According to a recent GAO study, it takes on the average nearly two years to fill an Immigration Judge position. No wonder there are scores of vacancies and an unmanageable backlog!

 

While Sessions claims that he has “streamlined” the process in some mysterious way, his goal of a 6-8 month hiring cycle is still beyond what should be necessary in a properly run and administered merit-based system.

 

And, the results to date have been less than impressive. Most of the recent hires appear to have been “in the pipeline” under the last Administration. As the system crumbles and the DOJ requests additional Immigration Judges, the reality is that 45 judicial positions, more than 10% of the total authorized, remain vacant.

 

And, it’s not that the results of this glacial process produce a representative immigration judiciary. During the Obama Administration, approximately 88% of the Immigration Judge appointments came directly from government backgrounds. In other words, private sector expertise has been almost totally excluded from the 21st Century immigration judiciary.

 

Sessions has actually done slightly better at hiring those with experience in the private sector. However, most attribute this to applicants whose selection was pending “background clearance” at the end of the last Administration, rather than to any conscious decision by Sessions to create a more diverse and representative Immigration Judiciary.

 

Seventh, and finally, the Immigration Courts need e-filing NOW! Without it, the courts are condemned to “files in the aisles,” misplaced filings, lost exhibits, and exorbitant courier charges. Also, because of the absence of e-filing, the public receives a level of service disturbingly below that of any other major court system. That gives the Immigration Courts an “amateur night” aura totally inconsistent with the dignity of the process, the critical importance of the mission, and the expertise, hard work, and dedication of the judges and court staff who make up our court.

 

Sessions has assured us that an “E-Filing Pilot Program” will be in place in the Immigration Courts at some point in mid-2018. But, folks, EOIR has been “studying” and “developing” e-filing since 2001 — a period of nearly 17 yearswithout achieving any meaningful end product! Indeed, most of us involved in that initial e-filing study are now retired, dead, or both. (Happily, I’m in “group one.”)

 

Moreover, those of us who have lived through past DOJ/EOIR “pilot programs,” “upgrades,” and “rollouts” know that they are often are plagued by slipping implementation dates, “Not Quite Ready For Prime Time”(“NQRFPT”) hardware and software, and general administrative chaos.

 

The U.S. Immigration Court, its employees, and its hundreds of thousands of frustrated “customers” deserve modern, professional court management which simply is not going to happen under the DOJ, particularly in the “Age of Trump & Sessions.”

 

III. ACTION PLAN

 

Keep these thoughts in mind. Not surprisingly, based on actions to date, I have no hope that Attorney General Sessions will support due process reforms or an independent U.S. Immigration Court, although it would be in his best interests as well as those of our country if he did.

 

Outrageously, Sessions actually proposes to move the court system in the opposite direction – elevating false efficiencies, case completions, and legislative and administrative gimmicks to truncate rights above fairness, quality, and guaranteeing due process for individuals. What kind of court system does that? Sounds like something out of a Third World dictatorship, not a 21st Century democracy!

 

However, eventually our opportunity will come. When it does, those of us who believe in the primary importance of constitutional due process must be ready with concrete reforms.

 

So, do we abandon all hope at present? No, of course not!   Because there are hundreds of newer lawyers out there who are former Arlington JLCs, interns, my former students, and those who have practiced before the Arlington Immigration Court.

 

They form what I call the “New Due Process Army!” And, while my time on the battlefield is winding down, they are just beginning the fight! They will keep at it for years, decades, or generations — whatever it takes to force the U.S. immigration judicial system to live up to its promise of “guaranteeing fairness and due process for all!”

 

What can you do to get involved now? The overriding due process need is for competent representation of individuals claiming asylum and/or facing removal from the United States. Currently, there are not nearly enough pro bono lawyers to insure that everyone in Immigration Court gets represented.

 

And the situation is getting worse. With the Administration’s expansion of so-called “expedited removal,” lawyers are needed at earlier points in the process to insure that those with defenses or plausible claims for relief even get into the Immigration Court process, rather than being summarily removed with little, if any, recourse.

 

Additionally, given the pressure that the Administration is likely to exert through the Department of Justice to “move” cases quickly through the Immigration Court system with little regard for due process and fundamental fairness, resort to the Article III Courts to require fair proceedings and an unbiased application of the laws becomes even more essential. Litigation in the U.S. District and Appellate Courts has turned out to be effective in forcing systemic change. However, virtually no unrepresented individual is going to be capable of getting to the Court of Appeals, let alone prevailing on a claim.

 

 

Several state and local government initiatives like those in New York, California, and Chicago have been very successful in expanding Immigration Court representation, particularly in detained cases, improving results, and resisting Administration enforcement overreach. I understand that a similar movement in Maryland might soon be underway. If it happens, all you Maryland residents in the audience should let your state legislators know that you stand behind due process, fairness, and justice for our immigrant communities.

 

I have been working with groups looking for ways to expand the “accredited representative” program, which allows properly trained and certified individuals who are not lawyers to handle cases before the DHS and the Immigration Courts while working for certain nonprofit community organizations, on either a staff or volunteer basis. The “accredited representative” program is also an outstanding opportunity for retired individuals, like professors, teachers, and others who are not lawyers but who can qualify to provide pro bono representation in Immigration Court to needy migrants thorough properly recognized religious and community organizations.

 

Even if you are a lawyer not practicing immigration law, there are many outstanding opportunities to contribute by taking pro bono cases. Indeed, in my experience in Arlington, “big law” firms were some of the major contributors to highly effective pro bono representation. It was also great “hands on” experience for those seeking to hone their litigation skills.

 

Those of you with language and teaching skills can help out in English Language Learning programs for migrants. I have observed first hand that the better that individuals understand the language and culture of the US, the more successful they are in navigating our Immigration Court system and both assisting, and when necessary, challenging their representatives to perform at the highest levels. In other words, they are in a better position to be “informed consumers” of legal services.

 

Another critical area for focus is funding of nonprofit community-based organizations, and religious groups that assist migrants for little or no charge. Never has the need for such services been greater.

 

Many of these organizations receive at least some government funding for outreach efforts. We have already seen how the President has directed the DHS to “defund” outreach efforts and use the money instead for a program to assist victims of crimes committed by undocumented individuals.

 

Undoubtedly, with the huge emphases on military expansion and immigration enforcement, to the exclusion of other important programs, virtually all forms of funding for outreach efforts to migrants are likely to disappear in the very near future. Those who care about helping others will have to make up the deficit. So, at giving time, remember your community nonprofit organizations that are assisting foreign nationals.

 

Finally, as an informed voter and participant in our political process, you can advance the cause of Immigration Court reform and due process. We have seen a graphic example this week of how decent citizens who have had enough of this Administration’s lawless behavior, anti-American attitudes, and trampling on our Constitution and our humane national values can rise up, be heard, and succeed in changing the future for the better, even against supposedly prohibitive odds. For the last 16 years politicians of both parties have largely stood by and watched the unfolding due process disaster in the U.S. Immigration Courts without doing anything about it, and in some cases actually making it worse.

 

The notion that Immigration Court reform must be part of so-called “comprehensive immigration reform” is simply wrong. The Immigration Courts can and must be fixed sooner rather than later, regardless of what happens with overall immigration reform. It’s time to let your Senators and Representatives know that we need due process reforms in the Immigration Courts as one of our highest national priorities.

 

Folks, the U.S Immigration Court system is on the verge of collapse. And, there is every reason to believe that the misguided “enforce and detain to the max,” “haste makes waste” policies being pursued by this Administration will drive the Immigration Courts over the edge. When that happens, a large chunk of the entire American justice system and the due process guarantees that make American great and different from most of the rest of the world will go down with it.

 

Trump, Sessions, and their arrogant cronies have a dark xenophobic, homophobic, Islamophobic plan for America that completely ignores or downgrades the essential contributions of immigrants of all types, all nationalities, and all economic and educational levels. It essentially “ disses” our true heritage and greatness as a “country of immigrants.”

 

This darkness does not represent my view of America as a humane, generous, and tolerant nation of immigrants, both “documented” and “undocumented,” nor do they reflect my understanding of the proper meaning of the Due Process Clause of the U.S. Constitution, which applies equally to all individuals in the U.S., not just citizens. I sincerely hope that they do not reflect your views either! If not, please join me in standing up and being heard in opposition to this Administration’s aggressively xenophobic, homophobic, Islamophobic programs and their intentional downgrading of due process and fairness in our U.S. Immigration Courts.

 IV. CONCLUSION

 

In conclusion, I have shared with you the U.S. Immigration Court’s noble due process vision and the ways it currently is being undermined and disregarded. I have also shared with you some of my ideas for effective court reforms that would achieve the due process vision and how you can become involved in improving the process.

 

Now is the time to take a stand for fundamental fairness! Join the New Due Process Army! Due process forever!

I’m a huge “Elizabeth Gibson Fan.” I’ve known Beth since she was a star student at Georgetown Law (one of the “Best Ever” of my “Refugee Law & Policy” — “RLP” — students), a terrific Legal Intern at the Arlington Immigration Court, and a spectacular Judicial Lw Clerk/Attorney Advisor at the New York Immigration Court before she was selected for the Immigrant Justice Corps (“IJC”) assigned to the New York Legal Assistance Group (“NYLAG”).

For those who don’t know, only the “best and brightest” with an overriding concern for social justice get into the IJC. Beth would excel at ANY legal job in America — “Nonprofit, “Big Law,” judging, teaching, writing, reporting, managing.

I’m inspired that with all these avenues open to her, Beth has chosen to use her “complete package” of talents to make the justice system work for the most vulnerable among us — those who have legal rights that are largely the same as all of us, but who are “bullied” and “intentionally mistreated” by our legal system (and our current Administration, in particular) in an attempt to prevent them from using and realizing those rights.

In  addition to being a weekly contributor to immigrationcourtside.com, Beth has acted as a “clearinghouse” for the vast amount of information and assistance available to the legal community involved in defending the rights of migrants. She has patiently taken many referrals of reporters and lawyers. She also has found time to write articles of her own, in addition to, of course, her main mission of helping her clients.

Maria’s always “on top” of the almost daily examples of cruel, intentionally inhumane, unconstitutional, wasteful “Gonzo” Enforcement by the Trump regime.  Here is some of what she reports on the deadly conditions in “NAG:”

“The inspector general for the Department of Homeland Security has criticized several immigration detention facilities for having spoiled and moldy food and inadequate medical care, and for inappropriate treatment of detainees, such as locking down a detainee for sharing coffee and interfering with Muslims’ prayer times.

Acting Inspector General John V. Kelly, who took over Dec. 1, said the watchdog agency identified problems at four detention centers during recent, unannounced visits to five facilities. The Dec. 11 report , released Thursday, said the flaws “undermine the protection of detainees’ rights, their humane treatment, and the provision of a safe and healthy environment.”

“Staff did not always treat detainees respectfully and professionally, and some facilities may have misused segregation,” the report found, adding that observers found “potentially unsafe and unhealthy detention conditions.”

Immigration and Customs Enforcement jails tens of thousands of immigrants for civil immigration violations, holding them until they are deported or released in the United States. The jails are not supposed to be punitive, according to the report.

ICE concurred with the inspector general’s findings and said it is taking action to fix the problems, some of which have already been addressed.

“Based on multi-layered, rigorous inspections and oversight programs, ICE is confident in conditions and high standards of care at its detention facilities,” the agency said in a statement. “To ensure the safety and well-being of those in our custody, we work regularly with contracted consultants and a variety of external stakeholders to review and improve detention conditions at ICE facilities.”

The Office of Inspector General said it launched the surprise inspections after receiving complaints from immigrant advocacy groups and on its hotline about treatment of detainees. The inspectors also interviewed staff members and detainees and examined records.

Advocates for immigrants said the report reaffirmed their long-standing calls for the detention facilities to be closed. Advocates have complained about reports of physical and sexual assaults, deaths in detention and other concerns for years under past presidents — and say their worries are increasing under President Trump.

Trump has pledged to dramatically increase deportations and is seeking congressional approval for more than 51,000 detention beds this fiscal year, up from about 30,000 under President Barack Obama.

Trump’s pick for the permanent director of ICE, Thomas D. Homan, previously ran the ICE detention system.

“The realities documented by the OIG inspectors, and many more, are endemic to the entire detention system,” Mary Small, policy director at Detention Watch Network, a nonprofit group that monitors immigration detention, said in a statement. “ICE has proven time and time again to be incapable of meeting basic standards for humane treatment.”

In a statement, Azadeh Shahshahani, legal and advocacy director of Project South, in Atlanta, cited the death in May of Jean ­Jimenez-Joseph.­ The 27-year-old Panamanian national was held in solitary confinement for 19 days at the Stewart Detention Center in rural Georgia, according to Project South.

Shahshahani said his death “should have served as a final wake-up call and resulted in the immediate closure of the facility.”

  • YES to “Dreamer Relief” with “no strings attached;”
  • YES to immigration reform that legalizes law-abiding residents already here and provides additional legal visas for the future to end the “false criminalization” of needed workers and refugees!

DOUG JONES “THEORETICALLY” WOULD HAVE “JUST SAID NO” TO GONZO AS AG — “too harsh on voting rights and criminal-justice issues!” — So What Else Is New?

“Doug Jones, weeks away from taking office as Alabama’s first Democratic senator since 1996, is not done talking about his win. On Wednesday, as national TV cameras rolled, he spent 26 minutes talking about his goals for 2018. On Thursday, he talked to the hosts of “Pod Save America” — a tastemaking podcast for liberals — about how he won. And on Sunday, he will be interviewed by Chris Wallace on Fox broadcast channel, and the show will be repeated later in the day on Fox News — a cable channel on which many Democrats refuse to appear.

So far, Jones has not made much news since his victory, ducking the Democratic fight over whether he should be seated in time to cast a vote on the GOP tax bill. (“We’ve still got a process in Alabama that we have to go though,” he said on “Pod Save America.”) He’s said more about how he won — as a “kitchen table” pragmatist and critic of Republican policy — and his hope that the South’s Republican dominance may start to crack.

“I believe we are on the road to having a competitive two-party state,” Jones said at Wednesday’s news conference.

Jones had been talking like that for months, though rarely before a national audience, and not in stump speeches. But as Republicans knew, and as they failed to exploit Tuesday, Jones did not run as a conservative and rarely took the Trump administration’s side on key issues. Most of Jones’s television ads, especially in the last month, portrayed the election as a choice between a Democrat who could “work with anybody” and a Republican who would engage in futile, embarrassing grandstanding.

In interviews, however, Jones often spoke of a different choice for Alabama — whether they wanted to send a new representative of the Deep South to the national stage. In an August interview with The Washington Post, before much national attention had driven toward his campaign, Jones said he would have theoretically opposed Jeff Sessions’s nomination for attorney general. He rattled off the reasons: Sessions was too harsh on voting rights and criminal-justice issues.”

Jones might have added “bigot, racist, xenophobe, White Nationalist, homophobe, Islamophobe, bully, liar, theocrat, sexist, and “D-grade legal mind,” to the reasons. But, we get the point. Even in Alabama, Sessions’s obvious bias, retrograde views, and general lack of qualifications for high office were well known.

In other words, if you remove the pedophelia, the ridiculous leather vest, poor little pony, waving pistol, and totally obnoxious wife, then “Gonzo” is “Ayatollah Roy.”

Unfortunately,  Gonzo has been able to do even more damage to our country, our Constitution, and our future (e.g.,our “Dreamers“) as an appointed official than he was in the Senate (perhaps because he was so, well, “Gonzo,” that even in his own party nobody took his “parallel universe” 1950’s segregationist view of America seriously). Probably happy enough to get rid of him as a colleague, the GOP inflicted him on the entire nation!

But, the majority of Americans who don’t believe in Gonzo’s “Apocalyptic Vision” don’t  have to put up with this travesty indefinitey. Hopefully, working with colleagues on both sides of the aisle, and drawing on the abysmal record of “Gonzo in action,” Doug Jones will be able to use “the system” to work cooperatively with others to remove the  most stunningly unqualified Attorney General since John Mitchell from office.

“More than a thousand children are counting on Nora Sándigo to become their guardian if their undocumented parents are deported. How many of those promises will she now have to keep?

Because she didn’t know what to tell her children, she tried not to tell them anything. When they asked where their father was, she gave flimsy excuses: Yes, he came home last night, but he left while you were still asleep. He’s working late, he’s working early, he just stepped out, he’ll be back soon. “You just missed him,” she found herself repeating.

The strategy worked, for a few days at least, with the youngest three. They were all under 5 and were used to the world going about its strange business without them. But then there was Kelly. She was 8 and sharp-eyed, a good student who preferred English to Spanish and wanted to someday be a doctor, or maybe a gymnast, and who had watched a presidential candidate on television say he wanted to send people back to Mexico, where both her parents grew up.

Kelly came home from school one day in October last year and demanded to know where her father was. Because his construction job started so early in the morning, Javier was usually the first home. That was part of how he and Kelly’s mother, T., fell in love. They boarded in the same house more than a decade ago, when she was 19 and freshly arrived in South Florida, having followed her sister from their small village in southern Mexico. T., who is being identified by her first initial to shield her identity, quit school after sixth grade. She helped her parents plant corn and beans but dreamed of something better for herself and her infant son; she decided to leave him in her mother’s care and support him from afar. Javier was from the same region, and because he finished work early, he cooked for her while she was still out in the Florida sun. The food was delicious and tasted like home. Soon they were a couple, and then Kelly was born, and her father, who fainted with anxiety in the birthing room, adored her, and she adored him back.

“He’s late from work,” T. told her daughter.

But Kelly wasn’t having it. Before heading to school that morning, she saw uniformed men come to the door and ask her mother for her father’s passport; she heard her mother on the phone, asking what had happened, what to do. “Don’t lie to me,” Kelly said, and started to cry. “Where did they take him? What did he do?”

By now T. knew. One of her first phone calls was to an immigrant advocate and former refugee named Nora Sándigo, who, in this poor area south of Miami, was the most powerful person in many people’s worlds: She knew lawyers, county commissioners, even members of Congress. After T. called her, Sándigo quickly discovered that Javier had been detained by the Department of Homeland Security. T. didn’t tell Kelly the details she had learned from Sándigo, or from Javier, when he was finally able to make a brief call. That they arrested him just a few yards away from their home, as he stood waiting for his ride to work. That now he was on the edge of the Everglades, in a gray-and-tan detention center adjacent to a state prison, a half-hour’s drive away, a distance that, for T., had suddenly become unbridgeable. “He was arrested,” she told Kelly, simply. “We have no papers to be here, like you do.”

“Will they take me, too?” Kelly asked. She didn’t know what papers her mother was talking about, what this thing was that she had and her parents didn’t.

T. didn’t tell her daughter the other reason she called Sándigo. Across South Florida, T. knew, undocumented parents of citizen children were preparing for possible deportation by signing power-of-attorney forms that allowed Sándigo to step in should their own parenthood be interrupted by a surprise visit from Immigration and Customs Enforcement, or ICE. If they were taken away, at least Norita, as they called her, could provide stability while the family sorted out what to do; she could also sign forms on their children’s behalf at school, or at the hospital, or in federal court.

Sándigo’s responsibilities extended to many hundreds of children, and were growing all the time. Parents, some of whom had never met her in person, were desperate for any solution. Her qualifications were simple. She was compassionate. She was willing. And, like their children, she was a United States citizen.

For years, T. never felt the need for such an extreme contingency plan. Now she was thinking of adding her own children to Sándigo’s list. “Imagine if they detained me too,” she said after Javier was gone. She couldn’t envision taking her American children with her to Mexico, where she “wouldn’t be able to give them education, shoes, clothes,” and where they would be separated from their friends and lives and ambitions, from the only home they had ever known. But what would happen if they stayed behind, with no parents left to care for them?

There’s a common misconception that having a citizen child — a so-called anchor baby — allows undocumented parents to gain legal status in the United States. In fact, parents of citizen children are deported annually by the tens of thousands, according to ICE’s own reports to Congress. Randy Capps, a demographer with the Migration Policy Institute, estimates that as many as a quarter of the people deported from the United States interior (who are counted separately from those deported at a border) are the parents of American children. Though immigration law prioritizes family connections, including legal status for the family members of Americans who petition on their behalf, children are the exception. They cannot, by law, petition for anyone until they turn 21 — by which time, of course, they won’t need their parents nearly as much.

Families like Kelly’s are known as “mixed status” — a reminder that the way we talk about immigration, with clear lines of legality separating groups of people, is often a fantasy. The reality is a world of families with separate legal statuses but intertwined fates. More than four million American children are estimated to have a parent in the country illegally. If deported, those parents face a difficult choice: Take their children to a country they do not know, whose language they may not speak and one that lacks the security and opportunities they have in the United States; or leave them behind, dividing the family. Courts have regularly responded to the argument that a parent’s deportation will deny a child, as one lawyer put it, “the right which she has as an American citizen to continue to reside in the United States,” with the counterargument that such children are not, in fact, deprived, because they retain the right to stay in their country and the right to live with their parents — just not both at the same time. “That’s what I call a choiceless choice,” says David B. Thronson, a professor at the Michigan State University College of Law, who helped found the Immigration Law Clinic.

But it’s a choice that’s familiar to millions of families, including Sándigo’s. “I lived that,” she said one day when I met her at her office in the suburbs of Miami, a one-story stucco house that serves as the headquarters of the Nora Sándigo Children Foundation. When she was 16, her parents sent her away from Nicaragua to escape the violence of its civil war; her family, she says, was targeted for opposing the Sandinistas. “I feel like I am one of those kids,” she continued, “because I came with the same problem. I had my father and mother, but I was an orphan without them. Separate from their parents, they become orphans, like me.” She remembers sobbing as she watched the country of her birth recede from the plane window.

When she left Nicaragua, Sándigo went to Venezuela, then France, “trying to get something legal,” and in 1988 finally ended up in the United States, where the organization that helped her settle here offered her a job working with other refugees from Central America and advocating for their asylum. The Nicaraguan Adjustment and Central American Relief Act was passed in 1997. In Miami, she helped other immigrants with paperwork and resettlement matters, like looking for apartments or jobs. She also started a business of small nursing homes, which, along with a plant nursery, helps cover her foundation’s bills. She never went back to Nicaragua, not even when her father was dying. He told her to stay in the United States and be safe. It was her country now, he said.

As Sándigo’s reputation grew, it became common for strangers in Miami’s immigrant communities to seek her out, asking for help; the requests opened Sándigo’s eyes to the depth of people’s need. She remembers bringing six towels to a woman with five children, who was shocked at the abundance: “So many!”

One call, in 2006, was for a new kind of assistance: A Peruvian woman, whom Sándigo had never met, was being held in a detention center, and she wanted to give Sándigo power of attorney to make decisions about her children’s care. (Unlike full legal guardianship, which is conferred by a court, power-of-attorney forms don’t involve a transfer of parental rights.) Others in the center had warned her that if she didn’t do something, she might lose her children to the child welfare system. Sándigo doesn’t know why the woman thought of her, but she felt honored, and obligated, by her trust: “When she called she had the papers signed and notarized already in my name.”

The Peruvian woman’s children never called on Sándigo, but word of what she had done got out. In 2009, a brother and sister, ages 9 and 11, showed up at Sándigo’s door with their uncle; their mother, they said, was in detention, and they weren’t going to eat until she was released. Sándigo remembers the oldest, Cecia, now a student at Georgetown University, saying, “We’ll stay with you,” to which she replied, “But this is an office, baby.” Still, she made a place for them. Jerryann, one of Sándigo’s two biological daughters, recalled: “You were like, ‘Oh, they’re going to stay the night.’ And then one night became forever.” The children moved in — they ended up staying for six years — the case attracted a lot of publicity and soon there was a steady stream of requests. “That gave the perception to the people, probably, that I was accepting the power of attorney from everyone in the same situation,” Sándigo said.

Many of the people who contacted Sándigo wanted only a temporary backup, a documented adult whom their kids could call in the moment of crisis to avoid ending up in the child-welfare system. According to an ICE spokeswoman, “ICE is committed to ensuring that the agency’s immigration-enforcement activities, including detention and removal, do not unnecessarily disrupt the parental rights of alien parents and legal guardians of minor children.” But navigating the immigration and child-welfare systems simultaneously can be difficult. Emily Butera, a senior policy adviser at the Women’s Refugee Commission, told me that many parents have come to believe that they will lose their rights automatically: “We’ve started explicitly saying to people, ‘Your children are not the property of the U.S. government.’ ”

Other parents planned for their children to stay with their undocumented friends or relatives, but wanted Sándigo to sign papers or fill official roles that they couldn’t. Still others hoped that their children would live with her, maybe for the remainder of their childhoods — something Sándigo wasn’t promising and worried that people assumed she was. But still, she never said no. When people came to her looking for help, Sándigo found it impossible to deny them. The numbers grew into the dozens, and then to the hundreds. “We never planned this,” Sándigo said one day. “It was planned by nobody. It just came.”

Two days later, nine adults and 36 children gathered at Sándigo’s house to pack into three rented vans for the 18-hour drive to Washington. T. tried to find space under a seat for a stroller — she was bringing all four daughters — while Sándigo stood in front of local news cameras, speaking in Spanish. “How can they be American citizens if in their own country they’re treated so harshly?” she asked. Kelly wandered into the frame, and Sándigo pointed to her: “Her father was deported,” she said. “It’s very hard.” Kelly noticed the cameras turning to her and darted away. “We hope they’ll listen to these American children,” T.’s sister told Telemundo.

Finally, space was found for all the diaper bags and suitcases and gallons of frozen milk. The kids lined up for a group photo around an American flag. The plan was to drive through the night, a challenge with so few licensable drivers among the adults. The vans pulled out past a small lineup of news cameras.

A few minutes later, they were back. Sándigo had gotten a call from the only English-language station to respond to her news release: The cameraman was running late. Sándigo agreed to redo the exit scene. “For us, the English news is the most important,” she said. Its viewers were the ones whom she most wanted to hear from the children, their fellow citizens.

Kelly and the others dutifully spilled out of the van into the sunshine. Valerie, in her native, teenage English, told the new camera the same things she’d told the others in Spanish: about missing her parents, about how hard it was. She was proud that she’d finally learned to talk about them without crying.

Then the children all climbed back inside for another try at reaching their nation’s capital.

The cameraman stood in the empty street for a long time, watching them disappear.”

Meanwhile, over at Newsweek reports on how, led by Chief Scofflaw Jeff “Gonzo Apocalyoto” Sessions, the Trump Administration continues its assault on our Constitution, women, Latinos, immigrants, and the REAL rule of law by attempting to force immigrant teenagers to carry pregnancies to term against their will:

“The Trump administration is attempting to block two young undocumented immigrant women in federal custody from obtaining an abortion, prompting the American Civil Liberties Union to head back to court today.

The two women, known to the court as Jane Roe and Jane Poe, requested to have an abortion. The Office of Refugee Resettlement refused their request.

The organization says this refusal, which has become common under Trump, shouldn’t be acceptable. The administration has been requiring these young women to go to religiously affiliated “Crisis Pregnancy Centers” that require patients to “have a medically unnecessary sonogram” and urges them to carry their pregnancy.

This case comes after the recent “Jane Doe” case in which the civil rights group stepped in and helped another immigrant receive the care she requested.

“We’ve already stopped the Trump administration from blocking one young woman’s abortion,” Brigitte Amiri, senior staff attorney with the ACLU Reproductive Freedom Project, said in a press release. “But the Trump administration is relentless in its cruelty, blocking abortion access for the most marginalized people in our country.”

The Jane Doe case was the first major abortion battle under Trump, in which a 17-year-old came to the U.S. from Central America in September. She was detained and learned that she was pregnant. When she was at the government-funded shelter, she attempted to get an abortion but the government didn’t allow it. That was the first undocumented immigrant abortion case the ACLU took to the court to fight the Trump administration.

According to a previous report by Newsweek, The ACLU told the court that the Trump administration unlawfully barred Jane Doe from having an abortion for a month. The court agreed with the ACLU and Jane obtained an abortion the next day, but the fight is still on between the group’s lawyers and the Trump administration.

After winning in court and receiving her abortion, Jane Doe said in a statement that she came to the U.S. for a better life.

“No one should be shamed for making the right decision for themselves,” she said in a statement released by the ACLU on October 25. “I would not tell any other girl in my situation what they should do. That decision is hers and hers alone.”

Easy to understand why there are so many “Sanctuary Jurisdictions” in the U.S. Hard to understand why all jurisdictions aren’t “Sanctuaries?” But, history will show who resisted and who went along with the “Fourth Reich!”

Immigrants detained at four large centers used by Immigration and Customs Enforcement are subject to inhumane treatment, given insufficient hygiene supplies and medical care, and provided potentially unsafe food, according to a federal report.

The “concerns” about the treatment of detained immigrants in facilities in California, Georgia, New Jersey and New Mexico is summarized in a report issued by the Inspector General’s Office of the Department of Homeland Security.

As NPR’s Joel Rose reports,

“The findings are similar to those of outside groups that have alleged ‘extensive’ human rights abuses at ICE detention centers.

“The inspector general’s report comes as the Trump administration is asking Congress for funding to expand the immigration detention system.

“ICE says some of its existing facilities are short-staffed. And the acting director has agreed to the report’s recommendations.”

The report was based on inspections of five detention facilities, four of which failed to meet certain federal standards, although “not every problem was present in all of them.”

The report summarized the results of the inspections:

“Upon entering some facilities, detainees were housed incorrectly based on their criminal history. Further, in violation of standards, all detainees entering one facility were strip searched. Available language services were not always used to facilitate communication with detainees. Some facility staff reportedly deterred detainees from filing grievances and did not thoroughly document resolution of grievances. Staff did not always treat detainees respectfully and professionally, and some facilities may have misused segregation. Finally, we observed potentially unsafe and unhealthy detention conditions.

Detainees … reported long waits for provision of medical care, poor conditions in bathrooms and insufficient hygiene supplies. OIG inspectors also observed expired, moldy, and spoiled foods in the kitchen in four facilities.”

The report also recommends that ICE improve its oversight of detention facility management and operations. In an official response, ICE concurred with the findings and promised to strengthen oversight and improve overall conditions.

Critics of President Trump’s immigration policies say the findings are not new as they predate the current administration.

A 2015 report by the National Immigrant Justice Center questioned ICE’s ability to oversee the detention centers it uses.

In a statement on the 2017 report, the Center’s Executive Director Mary Meg McCarthy said:

“ICE’s inability to provide for the safety and health of the tens of thousands of immigrants in its custody has been documented for years. Today, we are calling on Congress to demand accountability and drastically reduce ICE’s detention budget.

“While the Inspector General’s report provides documentation of extensive abuses, its remedy is incredibly insufficient: it directs ICE field office directors to review the areas of concern. We know from earlier directives that ICE’s internal review processes fail to generate meaningful change.”

The Women’s Refugee Commission said the report is consistent with what the organization and its partners have “documented for years” from visits to ICE detention facilities as well as with research it has conducted over 20 years. Katharina Obser, senior program officer at WRC said in a statement:

“This week’s OIG report spells out what WRC and our partners have documented for years, making clear the critical need for greater oversight and reform. Instead, the  Trump administration is intent on lowering or eliminating standards for immigration detention – putting detainees’ lives at risk – all while promising to ramp up detentionon a grand scale. As Congress continues to debate DHS FY 18 appropriations, the OIG’s findings show that now is not the time to expand a detention system that ICE is not capable of effectively and safely running. Detention must be reduced and, where needed, humane alternatives to detention, implemented in its place.”

Three years ago, the Department of Homeland Security Inspector General’s office reported on a series of unannounced visits to detention centers for unaccompanied children. The inquiry found evidence of inadequate food, temperature control problems and inconsistent employee-to-detainee ratios.”

These are hardly “new” developments! So, why are Sessions and his DHS “stooges” “doubling down” on detention of non-crimninal aliens in private facilities, rather than fixing these  life-threatening, unconstitutional conditions first. Sounds like clear Civil Rights violations to me. Why isn’t the DOJ’s Civil Rights Division “all over this like a cheap suit?” The answer to that is pretty obvious: They would have to prosecute  their boss for knowingly creating and furthering these conditions. All part of his “Gonzo deterrence strategy.” What if it were a member of YOUR family being held in inhumane conditions like these?
The solution?” Simple:  Let the non-dangerous immigrants (about 98% of them) out; put Sessions, Nielsen, Homan, and Miller in prison until the problems are fixed. Now THAT would finally be a use of detention that would have some real and appropriate deterrent value!
The true “rule of law” won’t be “restored” to America until “Gonzo” Sessions is removed from office.
