President Trump has made immigration crackdown a central focus of his presidency, and a new Washington Post-ABC News poll shows a growing number of Republicans and Democrats agree that the worsening situation on the border is a “crisis.”

But Trump is offering a solution that relatively few Americans like. In fact, his newly announced decision to make it harder to seek asylum is even less popular than his border wall national emergency, according to the same poll.

The Post-ABC poll shows that 30 percent of Americans favor making it more difficult for those seeking asylum in the United States to obtain it. About as many — 27 percent — favor making it easier, while 34 percent want to leave the process as-is.

Even among Republicans, just 46 percent favor making it more difficult. Among the few groups where a majority support the idea are conservative Republicans (51 percent) and those who approve of Trump (53 percent). Even in the latter group, though, 29 percent say leave the system as-is, and 11 percent want to make it easier to seek asylum.

Late Monday, the White House announced that it was proposing a new fee for asylum seekers. It is also seeking to prevent those who cross the border illegally from obtaining work permits, and it set the ambitious goal of requiring asylum cases to be decided within 180 days.

There has been a huge uptick in the number of asylum seekers in recent months. More than 103,000 immigrants crossed the U.S.-Mexico border last month, and 60 percent of them were Central American families who have requested asylum. The system has become overburdened, and even critics of Trump’s immigration approach acknowledge the situation must be addressed.

But saying there’s a problem and saying this is the solution are two different things. Trump has repeatedly argued that asylum seekers are exploiting weak U.S. immigration and asylum laws and that many of them are criminals and gang members who are told to claim asylum even though they don’t need it. He has called the concept of asylum “a big con job.” Yet, even as the situation at the border is exacerbated by a growing number of asylum seekers, Americans are still clearly uncomfortable with increasing the burdens on them.

Because the poll was conducted before Trump’s announcement, it didn’t test the specific details of his proposal. A fresh debate about the specific proposals could feasibly change the levels of public support. But Trump has been pushing the idea that asylum seekers are exploiting the system for months, and it doesn’t seem to have led to a chorus of support within his base for tightening the rules.

The level of support is even less than the backing for his national emergency to build a border wall. The Post-ABC poll shows just 34 percent of Americans favor that, while 64 percent oppose it. But at least on that proposal, Trump’s base is strongly onboard. Seventy percent of Republicans back the border wall national emergency.

Trump’s overall approval on immigration stands at 39 percent, with 57 percent disapproving, according to The Post-ABC poll.

Bottom line: On asylum, the public essentially is split in thirds among 1) more generous; 2) less generous; and 3) current system. That means that neither radical retractions nor radical expansions of the current system are likely to be achievable at present. That opens the door for the Dems to put together a powerful coalition to strengthen and fairly and efficiently administer the current asylum system.  

It’s not rocket science — more like basic governing competence. Here are the elements:

  • Establish an independent Article I U.S. Immigration Court;
  • Invest in representation of asylum seekers; 
  • Add more Asylum Officers, Immigration Judges, and Port of Entry Inspectors;
  • Provide comprehensive basic and continuing training for all asylum adjudicators from experts in asylum law;
  • Use prosecutorial discretion (“PD”) to reduce Immigration Court backlogs to allow Immigration Judges to concentrate on timely hearings for recently arrived asylum cases;
  • Reduce immigration detention;
  • Hire more anti-smuggling, undercover, and anti-fraud agents for DHS;
  • Invest in improving conditions in “sending” countries in Central America.

It would 1) cost less than the money Trump is now squandering on “designed to fail” enforcement and detention efforts; 2) create a political constituency for funding and future improvements; 3) protect human rights; and 4) give the U.S the substantial benefits of integrating asylees and their talents into our society and economy through the legal system. Those found ineligible could also be removed in a humane and timely manner after receiving due process.

Now is the time for House Dems to hang tough on demanding some real border security for the money — in plain terms, require the money to be spent in exactly the ways described above, not on more of Stephen Miller’s White Nationalist, anti-asylum schemes and gimmicks.  

Additionally, there should be specific prohibitions on: 1) wall and barrier building beyond what Congress has already authorized; 2) any additional spending for detention of non-criminal asylum applicants beyond the time needed to give them credible fear interviews; 3) family detention; 4) “tent cities;’ 5) “Remain in Mexico,” 6) “metering” of asylum applicants at Ports of Entry; 6) charging fees for asylum applications; 7) denial of work authorization for non-frivolous asylum applicants; 8) denial of reasonable bond to asylum applicants unless individually determined to be “threats to the community;” and 9) use of the military except to assist in providing humanitarian aid. There should also be a specific mechanism for accounting and constant Congressional oversight on how the Administration spends the extra funding.

U.S. Immigration and Customs Enforcement is holding on to more than $200 million in bond money that belongs to immigrants who have been in the agency’s custody, cash that has yet to be returned to thousands of immigrant families or the U.S. citizens who bailed them out, according to data obtained through open records requests.

The unreturned bond money stood at $204 million as of July 31, 2018, according to the data, which immigration law clinics at Stanford University and the University of California at Davis obtained and shared exclusively with The Washington Post. The pot of immigrant bond money grew by $57.3 million between September 2014 and July 2018, the data shows.

More than 18,000 bond payments went unclaimed in that four-year period, according to the data.

Though the trust fund — which the Treasury Department maintains — cannot be used for any other purpose, getting the money back to immigrants and their friends and families has proved a difficult and lengthy process. ICE officials said the agency makes multiple attempts to reach the people who posted the bond, but paperwork and checks mailed to them sometimes are undeliverable or receive no response, and it can be impossible to find the people if they moved out of the country. Those who do submit claims, ICE said, receive their funds within a month.

ICE did not provide data on average wait times to claim the money, and several lawyers and immigrants told The Post they have in some cases waited a year or longer after submitting for reimbursement.

Invisible walls: The lives altered by Trump’s crackdown on immigration

Numerous immigration attorneys said the system for reclaiming the funds is mystifying and nearly impossible to navigate without a lawyer or English-language proficiency, and some who pay the bonds are unlikely to see the money again. As bond amounts remain on the rise, lawyers said thousands of people are putting their life savings in ICE’s hands to secure an immigrant’s temporary freedom without any idea of when or if they’ll see the money again. Many immigrants say it takes far longer than a month to reclaim their funds.

“The toll on a poor family having to pay thousands of dollars in bond can’t be overstated,” said Jayashri Srikantiah, director of Stanford’s Immigrants’ Rights Clinic. “Clearly, something is breaking down when there are hundreds of millions of dollars sitting in an account that belongs to those immigrant families. If nothing else is clear, that is clear.”

Srikantiah and Holly S. Cooper, co-director of UC Davis’s Immigration Law Clinic, said they intend to push for congressional oversight of ICE’s bond system. They said the amassing of bond money indicates a serious problem and could amount to a massive theft from people who can least afford it.

Marco Antonio Torres Rojas, a father of three from Mexico, won his immigration case in August, but it took roughly seven months for ICE to return the $25,000 bond his family and friends paid to gain his release — seven years ago.

When he was detained in 2012 — for overstaying an H-2B work visa — an immigration attorney assured his family that paying the $25,000 bond would be the only way to stave off deportation. But for Rojas, a landscaper and snowplow driver in Minnesota, the sum appeared impossible. He and his wife had just a few thousand dollars in savings.

“We felt a sense of desperation,” Rojas said.

Pay legal fees, or bond fees?

While criminal defendants typically can pay a bondsman 10 percent of the set bail amount to gain release, in the immigration system about 90 percent of bonds require cash for the whole amount upfront.

ICE initially sets bonds on a “case-by-case basis,” the agency said, though not everyone is eligible for bond or release.

For those who are eligible, bonds have been steadily rising since the second half of the Obama administration, after an influx of Central American immigrants. The average bond set by a judge was $3,000 to $5,000 for years, but it rose to $8,000 in fiscal year 2016, according to data from the Executive Office of Immigration Review. Bonds have remained at that level or slightly higher into the first months of fiscal year 2019.

“I hear from people who call me asking, ‘Should I use the money to pay legal fees or pay the bond fees?’ ” Cooper said. “ ‘I only have one truck. If I sell it, it’s $5,000.’ ”

Once the money is raised — often from numerous people in each case — only a U.S. citizen or legal permanent resident can post the bond. Because many immigrants don’t have a close relative who fits the definition, they sometimes turn to acquaintances or neighbors, said Michelle N. Mendez, an immigration attorney at the Catholic Legal Immigration Network in Silver Spring, Md. That person, according to ICE policies, is the only one who will ever get a copy of the bond paperwork.

Mendez said many immigrants don’t know that once the bond is posted, only the person who posted the bond can get it back.

The person who posted the bond money might move across the country or even out of the country; they might lose the original paperwork required to reclaim the money back, creating additional hurdles; the obligor might die.

Gloria Contreras Edin, an immigration attorney in Minnesota, said she had one undocumented client whose obligor was on the brink of dying of cancer. Before the man died, her client wheeled him into her office so he could sign over the bond responsibilities to someone else. Her client, Anibal El Verengue, a Guatemalan who lives in Minnesota and was ordered removed in 2015 for entering the country illegally, said he would not have known to do this if he did not have an attorney to advise him.

“One friend who I owe money won’t even speak to me, because he doesn’t trust me anymore,” El Verengue said, whose application for asylum is pending.

Money just sits there

Mendez said she discovered how dire the problem was in 2009, two years after a well-publicized immigration raid at a Baltimore 7-Eleven resulted in numerous deportations. When Mendez checked in on some of the families of the deported men, she discovered they were living in poverty.

“I wanted to make sure that when the breadwinner got deported, the family would have some money,” Mendez said. “Those were the cases where I started to think: How do we get this money back? Nobody really knew . . . At that point, they’re really so far removed from the bond posting — thinking, ‘Oh well. I lost my case. I’m not entitled to anything’ — that they just let it be.”

“ICE does not notify the alien for whom the bond was executed, because its contract is with the obligor,” ICE said in a statement.

ICE makes three attempts to locate the person, but if the person who posted the bond did not file paperwork indicating a change of address, it might not be possible to find them.

And even those who follow the procedures said the process is rife with delays.

María Sosa, a legal permanent resident in California, said her husband won his immigration case in October but that she did not receive a bond cancellation notice from ICE until January. Unable to speak English, she made numerous visits to an ICE office to understand what she needed to do to get her money back; she received it on March 29.

She said she and her husband could not afford to attend his funeral.

“The whole system is created in a way that doesn’t foster the accessibility to those funds,” Contreras Edin said. “And so many times the money is left and just sits there.”

ICE pays interest on bond money while unclaimed, up to one year. After that, the funds are transferred to the Treasury Department. The Treasury Department said it does not know what year the $204 million began accumulating. The U.S. government is not allowed to use the money unless immigrants fail to adhere to bond conditions and forfeit it, otherwise known as a bond breach.

Bonds can be breached for reasons such as failure to show up in court or failure to turn the immigrant over to authorities if ICE asks the obligor to do so. But there can also be mistakes. Mendez recalled a case in which ICE breached her client’s bond for failure to show up to be deported — but her client was still appealing the removal order, and ICE had apparently missed that information, according to 2015 correspondence with ICE she provided to The Post.

About $34.5 million in bonds are forfeited each year, money that ICE uses to defray detention and apprehension costs.

Advocates at Stanford and UC Davis argue that the arrangement creates a conflict of interest.

“They obviously have incentive to not exercise discretion favorably and to breach more bonds,” said Emily Child, who worked on the Stanford and UC Davis research with Cooper. “That money goes right back into their pockets.”

ICE said that all breach decisions can be appealed to the U.S. Citizenship and Immigration Service. When breaching bonds, agents consider whether the violation was an accident or intentional and whether the obligor or immigrant was acting in good faith, ICE said in a statement.

‘An incredible amount’

Rojas was getting nervous. It was March, and he had been waiting seven months for a check that would be addressed to his brother’s wife, the U.S. citizen who posted his bond.

He called his attorney, Contreras Edin, expressing his fear that something had fallen through the cracks. The lawyer’s office contacted ICE bond specialists. A few weeks later, the check arrived.

Cooper and Srikantiah said they believe that working with an attorney is crucial to recovering the bond money, and many immigrants and those who post the bonds don’t have lawyers or can’t afford one.

They argue that ICE’s systems are outdated and cumbersome, and they believe immigrants should receive copies of their bond paperwork in a language they can understand, something that could mitigate the possibility of fraud and ensure that those who pay bonds receive the money back when they are entitled to it.

“While something like $5,000 or $10,000 might not be a lot of money to the federal government, to an individual family that has pulled all of their money together in order to get a loved one out of detention, it’s an incredible amount,” Srikantiah said. “With detention growing at the rate it is, we think this is a really good time for Congress to provide some oversight and actually investigate why this is happening.”

The Trump administration has manufactured and exacerbated an immigration “crisis” to further the president’s most consistent goal: to Make America White Again.

Tens of thousands of Central American asylum seekers, even hundreds of thousands, do not constitute a serious crisis — not for a continent-spanning nation of 330 million, a nation built through successive waves of immigration. The migrants have severely taxed and at times overwhelmed the systems at the border that must process and adjudicate their claims for refuge, but this is a simple matter of resources. We need more border agents, more immigration judges, more housing.

President Trump, however, treats the migrant surge like an existential threat. “We can’t take you anymore. We can’t take you. Our country is full,” he said this month at the border in California. But, of course, our vast nation is anything but full. Instead of “can’t,” what Trump really means is “won’t.”

On almost any issue you can think of, Trump is all over the map. But there is one position on which he has never wavered: antipathy toward nonwhite immigration. From his campaign charge that Mexican immigrants are “rapists,” to his fruitless quest to get funding for a border wall, to his gratuitously cruel policy of family separations, to his declaration of a national emergency, Trump has left not an iota of doubt about how he feels.

To be sure, sometimes the president uses anti-immigration rhetoric to inflame his base. But unlike with other issues, Trump seems actually to believe his demagoguery about would-be Latino migrants.

The administration acts as if it considers the asylum seekers to be less than human. What other conclusion can be drawn, after thousands of young children were taken from their parents and shipped to detention centers far away, as a deterrent to others who might seek entry? How else can anyone characterize the notion — now under active consideration, according to the White House — of transporting migrants hundreds or thousands of miles, not out of necessity but simply so they can be released in “sanctuary cities” and the districts of Trump’s political opponents?

Trump threatened to close the border. Here’s what could happen if he did

President Trump has pivoted from closing the southern border to imposing new tariffs on Mexico. But who will be the most affected?

That last Bond-villain idea is apparently the brainchild of White House adviser Stephen Miller, who seems to be the closest thing Trump has to an operational chief of staff — someone who shares his vision, however warped, and will move heaven and earth to bring it to life.

Trump has said that the countries from which asylum seekers and economic migrants are fleeing are not sending “their best” people, and that entry should be based on “merit,” not on family connections. That would be a complete departure from the immigration policies that allowed Trump’s and Miller’s forebears to come to this country, but it sounds debatable — until you take into account Trump’s other remarks. He has reportedly disparaged nonwhite countries with a vulgar epithet and expressed a preference for immigrants from places like Norway, which happens to be one of the whitest countries on the planet. In the context of immigration policy, he has regaled crowds with the story — likely apocryphal — of his friend “Jim,” who used to go to Paris all the time but doesn’t anymore because “Paris is no longer Paris.”

Trump isn’t talking about gridlocked traffic on the Boulevard Peripherique. He’s talking about the black and brown immigrants who are changing the city’s complexion.

He might at least feign compassion for men, women and children who risk their lives to flee deadly violence at home. Instead, Trump cut off aid to Guatemala, Honduras and El Salvador, the countries from which most of the asylum seekers are coming. He does not comfort or embrace. He seeks only to punish.

The real crisis is that we have a president who wants to put up a “No Vacancies” sign for nonwhite immigrants — just like the “No Coloreds” signs I used to see in the Jim Crow South.

A federal court dealt a major blow to the Guantanamo Bay military commissions Tuesday, throwing out more than three years of proceedings in the case against the alleged mastermind of the 2000 bombing of the USS Cole.

In a unanimous decision, a three-judge panel from the U.S. Court of Appeals for the District of Columbia Circuit ruled that former military judge Vance Spath “created a disqualifying appearance of partiality” by pursuing a position as an immigration judge while also overseeing the case.

The judges also voided an order issued by Spath that sought to require two defense attorneys for the defendant, Abd al-Rahim al-Nashiri, to return to the case against their will.

The ruling is the latest blemish for the troubled commissions set up in the wake of the Sept. 11, 2001, attacks to try prisoners held at Guantanamo Bay, Cuba. Of a once-vast detainee population there, only 40 inmates remain. Nearly two decades after the attacks, the start of the trial of 9/11 suspects remains far off amid seemingly endless legal wrangling and procedural delays.

Nashiri, a Saudi national in his 50s, faces a possible death penalty for his alleged orchestration of a string of plots to bomb Western vessels, including the Cole attack, which killed 17 Americans. After his capture, Nashiri was subject to extensive torture in CIA custody.

“Many years ago, when Abd al-Rahim first heard he was being handed over to the Americans, he was actually happy because he thought the United States was a country of laws and rights and that he’d at least be treated fairly,” said Navy Lt. Alaric Piette, a member of Nashiri’s defense team. “Finally, after 16 years, with this ruling, that has actually happened. Which is to say that this will mean a lot to him.”

A year into his involvement in the case, Spath meanwhile quietly applied to the Justice Department for a position as an immigration judge. Such judges are appointed by the attorney general.

The D.C. Circuit judges, in a stinging rebuke, responded this week by throwing out rulings in the case from the commission and at least some from its appeals body, beginning at the moment when Spath initiated his job application in November 2015.

“This much is clear: whenever and however military judges are assigned, rehired, and reviewed, they must always maintain the appearance of impartiality,” Tatel wrote.

The CMCR is the Guantanamo appeals body. Tatel was joined on the panel by Judges Judith Rogers and Thomas Griffith.

Michael Paradis, an attorney who represented Nashiri in the D.C. Circuit case, said the opinion revealed the judges’ frustration “that the system is cavalier about such basic roles and so broken as a consequence. The whole thing has become so shambolic.”

The government could appeal the ruling. A spokeswoman for the Justice Department declined to comment on pending litigation.

Spath’s successor on the military court also left to become an immigration judge.

Legislative reform establishing an independent Article I Immigration Court outside the Executive Branch should be a bipartisan “no-brainer.”
Instead, while Congress diddles, the misdirected and mismanaged U.S. Immigration Courts under the DOJ continue full steam toward operational and legal disaster.  Without a timely Congressional remedy, that could eventually leave the entire removal system in the hands of the Article IIIs.
Notably, the “precipitating event” here was the Military Judge applying to the DOJ to become an Immigration Judge while handling a case in which the DOJ had an interest.
How about Attorneys General who have taken “point position” on the Administration’s harsh and often illegal immigration enforcement initiatives intervening in individual cases (sometimes over the objection of both parties) to change results to give DHS Enforcement, a party, a victory? Or, that all Immigration Judges are selected, evaluated, assigned, and directed by the Attorney General, a non-quasi-judicial official who is the “chief enforcer” and “chief prosecutor?”

On November 15, 2018, CMS hosted an event on access to justice, due process and the rule of law to honor the legacy of Juan Osuna, a close colleague and friend who held high-level immigration positions in four administrations over a 17-year period. Prior to his government service, Mr. Osuna served as a respected editor and publisher and a close collaborator with many civil society organizations. As a follow-up to its November 15th gathering, CMS will be posting and publishing a series of blogs, essays, talks, and papers on the values and issues to which Mr. Osuna devoted his professional life, and ultimately compiling them as part of a CMS special collection in his memory.


I found immigration law quite by accident in 1976, the summer between my second and third years of law school. I responded to an ad for a part-time law clerk. The small law office was near school, paid well, and had nice support staff, so I took the job, barely knowing what the daily work would be. The field of immigration law was so small at that time that my law school only offered one, semester-long immigration law course every other year. It was not offered in the one year I had left before graduation.  I have never taken an academic immigration law class, but rather learned my trade from generous practitioners who gave up their Saturdays once a month to teach free seminars to new practitioners. It was from that perspective that I developed a profound respect for immigration lawyers, so many of whom freely shared their knowledge in the hope of ensuring that quality legal services were offered to the immigrant community.

For me, the daily practice of immigration law was akin to love at first sight. It was the perfect mix of frequent client contact with fascinating people from all walks of life and all socioeconomic backgrounds that made me feel as if I was travelling the world; and a combination of social work and complex legal puzzles that intellectually intrigued me. As I became immersed in the field, I became totally hooked by the compelling stories behind my cases, as well as the complicated legal strategies that many cases required. At the time I began my career, I did not understand why immigration lawyers were generally ranked only slightly above ambulance chasers. My experience allowed me to interact with brilliant lawyers dedicated to helping their clients, often with little acknowledgement and meager remuneration.

When I began to practice and tried to explain the basics of immigration law to interested legal friends, it became clear to me that the statutory structure of this field of law was quite unique, but fairly sensibly built on general parameters of who would be a benefit to our country and thus should be allowed to find a way to legalize their status; and who were the bad actors who should not be allowed into the country or allowed to stay even if their initial entry had been legal. It struck a balance between family reunification and business and labor needs. There was even a category for industrious, pioneering individuals to come without sponsorship so long as they were able to support themselves financially. In short, it seemed to me to be a logical balance, with fair criteria to limit legal status to deserving, law-abiding people. Some of the hurdles that had to be overcome — for example, to test the labor market to protect US workers where one wanted to immigrate as an employee, or lengthy quotas that resulted in separation of families of lawful permanent residents (LPRs) — were clunky and cumbersome, but on the whole the system seemed to work fairly rationally.

While some aspects were frustrating and individual immigration officers sometimes seemed inflexible or even a bit irrational, I do not remember the legal community who helped immigrants being tormented by draconian twists and turns in the law on a daily basis, which is how it has seemed lately. When someone was in deportation proceedings, there was the possibility of showing that, after having lived in the United States for more than seven years as a person of good moral character, if one’s deportation would cause oneself or a qualifying US citizen (or LPR) spouse, parent, or child extreme hardship, one could qualify for suspension of removal and eventual permanent resident status. There was also the possibility of qualifying for withholding of deportation if one was more likely than not to suffer persecution if returned to one’s homeland if one had fled a communist country or certain specified geographic areas. Yes, the preference quotas could be problematic, but all in all, it seemed to me at that time that most people who wanted to regularize their status could carve out a reasonably achievable path towards their goal, while the bad actors who were sent home deserved that fate. Every so often there were sad cases of nice people who could not find a category that allowed them to stay, but somehow it just did not seem as harsh a result for so many people as it does lately.

The codification of the Refugee Act in 1980 ushered in a particularly exciting time. A large portion of my client base was from El Salvador, Guatemala, and Nicaragua, and the civil wars raging in the late 1970s were generating an influx of refugees. The stories I began to hear were exceedingly disturbing accounts of war and the cruelty which all too often accompanies it, but the horror was counterbalanced by the satisfaction of finding a way to protect people from further victimization by helping them secure safe haven in the United States. From an academic perspective, seeing how a statute evolved, through real-time interpretation and application, was a fascinating process — something many lawyers do not experience in their entire career. Then, to top it off, the Ninth Circuit set the stage to allow me to present oral argument in a case before the US Supreme Court in 1986. I am very proud that I, along with colleagues Kip Steinberg, Bill Hing, and Susan Lydon, were able to establish lasting precedent through our representation of Luz Marina Cardoza-Fonseca, making it clear that the use of the term “well-founded fear” was a significant change in the law and assuring that the adherence of the United States to the UN Protocol on Refugees was intended by Congress to guide our interpretation of US asylum law.[1]

Just as the briefs were being submitted, I learned that there was an opening for a judge at the immigration court in San Francisco, a location I had vowed never to leave. I struggled with the decision of whether or not to leave a practice with partners I truly loved, or to dive into a new adventure, in the hope that I could lead by example and prove that a former private practitioner could be viewed as an impartial and fair judge, respected by both the prosecution and defense bars. It was an exciting time at the immigration court because only a few years earlier, in 1983, the Executive Office for Immigration Review (EOIR) was created as a separate agency outside the Immigration and Naturalization Service (INS) as a component in the Department of Justice (DOJ). That step was a vital step forward, acknowledging the important distinction which must exist between the prosecutor and the judge in deportation hearings. I went for it and became a member of a corps of 68 immigration judges working for EOIR at that time.

I found the transition to the bench challenging. There was far less interaction and discussion among peers as to how thorny legal issues might be resolved. In addition, because of the need to remain distant from the lawyers who appeared before me, I was much lonelier than I had been in private practice. While I found the interactions in the courtroom just as fascinating as in the first days of my legal career, there was a part of me that was unfulfilled. The stories I heard were riveting and the ability to resolve a conflict in a fair way extremely satisfying. However, I soon realized just how large a part advocacy played in my personality and path to personal satisfaction. This was quite a dilemma for a neutral arbiter who was determined to show the world that a former private practitioner could give both the government and the respondent a fair day in court! I searched to find an appropriate outlet for that aspect of my character, and the answer came in the form of my volunteer work for the National Association of Immigration Judges (NAIJ).

The NAIJ was formed in 1979 as a professional association of immigration judges to promote independence and enhance the professionalism, dignity, and efficiency of the immigration courts.  Through my membership and eventually leadership at NAIJ, I was able to help my colleagues as a traditional labor union steward, as well as to educate the public about the important role played by the immigration court and the reality which exists behind the cloak of obscurity the DOJ favors. Many people, lawyers included, are surprised to learn that the DOJ insists on categorizing immigration judges as attorney employees, which gives rise to a host of problems for both the parties and for judges themselves.

While the creation of EOIR was a huge step forward, there was still considerable influence wielded by the INS. From courtrooms to management offices, ex parte communications occurred at all levels, and our relatively small system remained dwarfed by the behemoth immigration enforcement structure. My NAIJ colleagues and I worked hard to elevate the professionalism of our corps, to adhere to the American Bar Association (ABA) Model Code of Judicial Ethics, and to insulate our courts from political or ideological driven agendas, with the goal of assuring that all who appeared before us had a fair day in court. But we have always faced the headwinds of our classification as attorneys in an enforcement-oriented agency and the tension caused by enforcement goals that run counter to calm, dispassionate deliberation and decisional independence.

Despite the creation of EOIR and its early promise that we would benefit from enhanced equality with those who enforced our nation’s immigration laws, we remained “legal Cinderellas,” mistreated stepchildren who seemed to be doomed to endless hard work without adequate resources or recognition for our efforts. From the time I became an immigration judge, we have never received the resources we needed in a timely or well-studied manner, but instead for decades we have played catch-up, had to make do with less, and have faced constant pressure to do our work faster with no loss of quality. Immigration judges scored a legislative victory when our lobbying efforts codified the position of immigration judge in the mid-1990s, and again in 2003 when we succeeded, quite against the odds, to remain outside the enforcement umbrella of the Department of Homeland Security (DHS) when it was created. Those accomplishments were quite sweet, but unfortunately, they did not go far enough — a fact predicted by my NAIJ colleagues and me.

When I fast-forward to today, I see a substantive law which has spiraled out of control and a court system on the brink of implosion. The law has become so misshapen by unrelated, sometimes conflicting or overly repetitive congressional tweaks that it has become an almost unnavigable labyrinth, where many are lost on the way to their ultimate goal because of unanticipated interactions by the various incarnations of the statute. For example, the myriad criminal provisions interact illogically and conflict in ways that allow some clever lawyers to navigate a path for their clients, while pro se respondents become blocked from status with far less serious criminal histories because of an inability to parse nuances and wage creative legal battles.

And many provisions of the statute would surprise, or even shock, members of the public. Many people do not know that there is no such thing as “anchor babies” because US citizens cannot sponsor a parent until they are over 21 years of age, and even then, the parent’s years of unlawful presence in the United States often present a virtually insurmountable bar to legal status. Many do not realize that US citizen children are routinely de facto deportees when their parents are removed, or that parental rights can be terminated for responsible, loving parents who are held in immigration detention and thus are prevented from appearing in family court to exercise their parental rights. Nor does someone become a US citizen (or even lawful resident) just because of marriage to a US citizen. But perhaps the most sobering fact that is little known by the public is the fact that there is no statute of limitations for crimes under the immigration laws. Therefore, LPRs can be deported decades after a conviction for a relatively minor drug crime because there is no mechanism in the law which allows them to remain, despite deep roots in the community and sometimes being barely able to speak the language of the country of their birth.

I am deeply concerned that decisions on immigration legislation so often seem to be based on sound bites or knee-jerk reactions to individual horror stories rather than careful and unbiased analysis of documented facts and trends. I fear the public is deprived of the ability to form a well-reasoned opinion of what the law should provide because the rhetoric has become so heated and the facts so obscured. The immigration law has grown away from allowing decision-makers, especially immigration judges, to make carefully balanced decisions which weigh nuanced positive and negative considerations of someone’s situation. Instead, rigid, broad categories severely limit the ability of those of us who look an immigrant in the eye and see the courtroom filled with supporters from carefully tailoring a remedy, which can make our decisions inhumane and disproportionate. Such rigidity reflects poorly on our legacy as a country that welcomes immigrants and refugees and leads to results which can be cruel and not in the public’s interest.

In the rush to reduce the backlog that was decades in the making, our immigration courts are once again in the hot seat, and individual judges are being intensely pressured to push cases through quickly. Immigration judges are placed in the untenable position of having to answer to their boss because of their classification as DOJ attorneys who risk loss of their jobs if they do not follow instructions, and yet we judges are the ones who are thrown under the bus (and rightfully so) if the corner we cut to satisfy that unrealistic production demand ends up adversely impacting due process. That pressure is intense and the delicate balance is one that often must be struck in an instant through a courtroom ruling —  made all the more difficult because of the dire stakes in the cases before us. But, just to make it abundantly clear to immigration judges that productivity is paramount, last October our personnel evaluations were changed so that an immigration judge risks a less than satisfactory performance rating if s/he fails to complete 700 merits cases in a year. The DOJ’s focus and priority in making that change is not subtle at all, and the fact that our corps has recently expanded so fast that dozens, if not hundreds, of our current judges are still on probation, makes this shift an even more ominous threat to due process. The very integrity of the judicial process that the immigration courts are charged by statute to provide are compromised by actions such as this. Production quotas are anathema to dispassionate, case-by-case deliberation. One size does not fit all, and quantity can take a toll on quality. Perhaps most important, no judge should have his or her personal job security pitted against the due process concerns of the parties before them.

I know I am not alone in feeling the weight that this constellation of circumstances of an out-of-date law and political pressure on immigration judges has created. All around me, I see frustration, disillusionment, and even despair among immigration law practitioners who are also suffering the consequences that the speed-up of adjudications places on their ability to prepare fully their cases to the highest standards. I see many colleagues leaving the bench with that same mix of emotions, a sad note upon which to end one’s career. Yet I can completely relate to the need to leave these pressures behind. I have witnessed several judges leave the bench prematurely after very short terms in office because they felt these constraints prevented them from being able to do the job they signed up to perform.

It is supremely discouraging and, frankly, quite a challenge to remain behind in that climate. But as I write these reflections, I know I am not ready to leave quite yet. We must learn from history. We must do better for ourselves and the public we serve. Our American ideal of justice demands no less. When we canaries in the immigration courtrooms began to sing of our need for independence decades ago, we were seen as paranoid and accused of reacting to shadows in the mirrors of our cages. Finally now, we are seen as prescient by thousands of lawyers, judges, and legislators across the country, as reflected by proposals by the ABA, Federal Bar Association, National Association of Women Judges, Appleseed Foundation, and American Immigration Lawyers Association. There are signs that these calls are being heeded by lawmakers, although the legislative process seems both glacial and mercurial at best. The creation of an Article I Immigration Court is no longer a fringe view, but rather the solution to the persistent diminution of essential safeguards our system must have, clearly acknowledged by experts and stakeholders alike.

The challenges our nation faces as we struggle to reform our immigration law to meet modern needs are many, but a single solution for a dramatic step towards justice has become crystal clear: we must immediately create an Article I Immigration Court. We cannot afford to wait another 40 years to do it. Besides, I want to see it happen in my professional lifetime so that the chapter can be complete and the clock is ticking…

Because she successfully argued INS v. Cardoza-Fonseca before the Supremes, establishing the generous “well-founded fear” standard for asylum, I often refer to Dana as one of the “Founding Mothers” of U.S Asylum Law. *

One thing is for certain:  The current immigration mess can’t be resolved until we have an independent Article I U.S. Immigration Court.

Given the inappropriate, unethical, and frankly idiotic, regulatory proposals just made by the DOJ under Barr, guaranteed to further screw up appellate review at EOIR, the Article III Courts of Appeals are soon going to be bearing the brunt of more sloppy, unprofessional, biased decision-making by EOIR on a widespread, never before seen, scale. Unless the Article III’s completely tank on their oaths of office, there will have to be “massive pushback” that will eventually bring the removal system close to a halt until Congress does its job and restores Due Process under our Constitution.

Last time a similarly overt attack on Due Process in the appellate system happened under Ashcroft, the results at the Article III level weren’t pretty. But, guys like Barr are too dense, biased, and committed to the White Nationalist restrictionist program to do anything constructive.

Given the increased volume and the “malicious incompetence” of this Administration, as well as a much better prepared and even more talented and highly motivated private bar and NGO community (the “New Due Process Army”), the DOJ should continue to set new records for court losses and squandering of taxpayer funds on what would be deemed “frivolous litigation” if brought by any private party.

That’s not to say, however, that thousands of human beings won’t have their rights denied and be screwed over by the Trump Administration in the process. Some will die, some will be tortured, some will be maimed, some disfigured, some damaged for life.  That’s the human toll of the Trump scofflaws and their malicious  incompetence.

* HISTORICAL FOOTNOTE: At the time of Cardozoa-Fonseca, I was the Deputy General Counsel and then Acting General Counsel of the “Legacy INS.” I helped the Solicitor General develop the agency’s (ultimately losing) position and was present in Court the day of the oral argument sitting with the SG’s Office.

CHANGING THE NARRATIVE BY REJECTING THE POLITICS OF HATE & RACISM: Cities Can Embrace Asylum Applicants, Help Them Win Status, & Reach Full Potential!

Here’s a message to President Trump: Seattle is not afraid of immigrants and refugees. In fact, we have always welcomed people who have faced tremendous hardships around the world. Immigrants and refugees are part of Seattle’s heritage, and they will continue to make us the city of the future.

What does scare us? A president and federal government that would seek to weaponize a law enforcement agency to punish perceived political enemies. A would-be despot who thinks the rule of law does not apply to him.

On Friday, Trump took to Twitter to confirm a Post report that the White House wants to place detained immigrants in so-called sanctuary cities represented by Democrats.

In doing so, he trotted out his favorite playbook: He is demonizing immigrants and refugees to incite fear and to distract the American public from his own failures. Despite his party having control of the whole federal government for two years, Trump has utterly failed to fix our immigration system, to provide real opportunity for middle America or to improve the lives of the Americans in the places that supported him.

It’s clear he hates the fact that the very cities he scorns are engines of innovation, opportunity and economic power. But we will not be deterred. The president’s threats won’t intimidate me as a mayor of a city with an open door, as a former federal prosecutor or as the granddaughter of a teenager who fled a war-torn, starving and impoverished country only to be welcomed in America.

This president believes that immigrants and refugees burden our country and burden cities like ours. But he could not be more wrong.

In Seattle, we know that our immigrant and refugee communities make our city a stronger, more vibrant place. Our immigrant neighbors make up more than 18 percent of our population, and 21 percent of our population speaks a language other than English at home. They create businesses and jobs. They create art and culture. They help teach our kids, serve in law enforcement and the military, and lead our places of faith.

Our immigrant and refugee neighbors have helped Seattle become the fastest-growing big city in the country and become home to some of the world’s most iconic companies. And we know that today’s immigrants are tomorrow’s U.S. citizens who should have the chance to contribute to the economic, cultural and civic life of Seattle — and our nation.

Contrary to what this president thinks, in Seattle, we have strong American values of inclusiveness and opportunity. Instead of threatening immigrant families and the cities that welcome them, this president should spend a little bit more time trying to learn from us.

In Seattle, we have started to provide tuition-free college for our public high school graduates, regardless of a young person’s immigration status. We’re expanding internship and apprenticeships opportunities to connect all our young people with the jobs and opportunities of the future. We’re working to help tens of thousands of legal permanent residents become U.S. citizens as part of the New Citizen Campaign and our other citizenship programs. Our Ready to Work program connects people with case managers and English language education to help our immigrant and refugee neighbors gain the skills necessary to enter our booming jobs market.

We will not allow a president who continues to threaten our shared values of inclusion, opportunity and diversity to jeopardize the health and safety of our communities. That’s why, shortly after taking office, I issued a mayoral directive strengthening Seattle’s “Welcoming City” laws that make clear that our city will not ask about — or improperly divulge information about — a resident’s immigration status. And our police officers will continue to focus on local law enforcement — not serve as federal immigration enforcement officials. This is what the president means when he uses the term “sanctuary city.”

Our city has already taken on this president and won. When Trump and the Justice Department threatened to withhold federal funding over our policies, we beat him in court. When he announced his cruel plan to separate children and families, Democratic mayors stood up to say we are better than this as a country.

So if this president wants to send immigrants and refugees to Seattle and other welcoming cities, let me be clear: We will do what we have always done, and we will be stronger for it. And it will only strengthen our commitment to fighting for the dignity of every person. We will not allow any administration to use the power of America to destroy the promise of America.

Many, probably the majority, of these families legally seeking asylum are forced migrants. Out of detention, with access to counsel, community support, time to prepare, and without being regulated to “detention center judges,” many of whom are notoriously biased against asylum seekers, the asylum grant rates should go up substantially.
In fact, it’s quite possible that a majority will succeed, because we know that representation generally increases success rates by 4X with a much greater differential for women and children. Those who are unfairly denied will also have a chance to pursue appeals up to the “real” Article III Courts.
It’s a great opportunity for Democrats to put an end to the Trump Administration’s lies about forced migrants “gaming” the system and to strengthen local communities and economies by bringing into the legal immigration system many courageous, talented, determined individuals who seek only survival and a better life and will be grateful for the opportunities given them.

White House officials have tried to pressure U.S. immigration authorities to release detainees onto the streets of “sanctuary cities” to retaliate against President Trump’s political adversaries, according to Department of Homeland Security officials and email messages reviewed by The Washington Post.

Trump administration officials have proposed transporting detained immigrants to sanctuary cities at least twice in the past six months — once in November, as a migrant caravan approached the U.S. southern border, and again in February, amid a standoff with Democrats over funding for Trump’s border wall.

House Speaker Nancy Pelosi’s district in San Francisco was among those the White House wanted to target, according to DHS officials. The administration also considered releasing detainees in other Democratic strongholds.

White House officials first broached the plan in a Nov. 16 email, asking officials at several agencies whether members of the caravan could be arrested at the border and then bused “to small- and mid-sized sanctuary cities,” places where local authorities have refused to hand over illegal immigrants for deportation.

The White House told U.S. Immigration and Customs Enforcement that the plan was intended to alleviate a shortage of detention space but also served to send a message to Democrats. The attempt at political retribution raised alarm within ICE, with a top official responding that it was rife with budgetary and liability concerns, and noting that “there are PR risks as well.”

After the White House pressed again in February, ICE’s legal department rejected the idea as inappropriate and rebuffed the administration.

A White House official and a spokesman for DHS sent nearly identical statements to The Post on Thursday, indicating that the proposal is no longer under consideration.

“This was just a suggestion that was floated and rejected, which ended any further discussion,” the White House statement said.

Pelosi’s office blasted the plan.

“The extent of this administration’s cynicism and cruelty cannot be overstated,” said Pelosi spokeswoman Ashley Etienne. “Using human beings — including little children — as pawns in their warped game to perpetuate fear and demonize immigrants is despicable.”

President Trump has made immigration a central aspect of his administration, and he has grown increasingly frustrated at the influx of migrants from Central America. He often casts them as killers and criminals who threaten U.S. security, pointing to cases in which immigrants have killed U.S. citizens — including a notable case on a San Francisco pier in 2015. And he has railed against liberal sanctuary-city policies, saying they endanger Americans.

“These outrageous sanctuary cities are grave threats to public safety and national security,” Trump said in a speech to the Safe Neighborhoods Conference in Kansas City, Mo., on Dec. 7, less than a month after the White House asked ICE about moving detainees to such cities. “Each year, sanctuary cities release thousands of known criminal aliens from their custody and right back into the community. So they put them in, and they have them, and they let them go, and it drives you people a little bit crazy, doesn’t it, huh?”

The White House believed it could punish Democrats — including Pelosi — by busing ICE detainees into their districts before their release, according to two DHS whistleblowers who independently reported the busing plan to Congress. One of the whistleblowers spoke with The Washington Post, and several DHS officials confirmed the accounts. They spoke on the condition of anonymity to discuss internal deliberations.

Senior Trump adviser Stephen Miller discussed the proposal with ICE, according to two DHS officials. Matthew Albence, who is ICE’s acting deputy director, immediately questioned the proposal in November and later circulated the idea within his agency when it resurfaced in February, seeking the legal review that ultimately doomed the proposal. Miller and Albence declined to comment Thursday.

Miller’s name did not appear on any of the documents reviewed by The Post. But as he is White House senior adviser on immigration policy, officials at ICE understood that he was pressing the plan.

Trump has been demanding aggressive action to deal with the surge of migrants, and many of his administration’s proposals have been blocked in federal court or, like the family separation policy last year, have backfired as public relations disasters.

Homeland Security officials said the sanctuary city request was unnerving, and it underscores the political pressure Trump and Miller have put on ICE and other DHS agencies at a time when the president is furious about the biggest border surge in more than a decade.

“It was basically an idea that Miller wanted that nobody else wanted to carry out,” said one congressional investigator who has spoken to one of the whistleblowers. “What happened here is that Stephen Miller called people at ICE, said if they’re going to cut funding, you’ve got to make sure you’re releasing people in Pelosi’s district and other congressional districts.” The investigator spoke on the condition of anonymity to protect the whistleblower.

The idea of releasing immigrants into sanctuary cities was not presented to Ronald Vitiello, the agency’s acting director, according to one DHS official familiar with the plan. Last week, the White House rescinded Vitiello’s nomination to lead ICE, giving no explanation, and Vitiello submitted his resignation Wednesday, ending his 30-year-career.

Trump praises Sessions’s work to shut down sanctuary cities

President Trump said on March 8 that the Justice Department is doing a “fantastic job” to get rid of sanctuary city policies.

The day after Vitiello’s nomination was rescinded, President Trump told reporters he wanted to put someone “tougher” at ICE. DHS officials said they do not know whether ICE’s refusal to adopt the White House’s plan contributed to Vitiello’s removal. His departure puts Albence in charge of the agency as of Friday.

The White House proposal reached ICE first in November as a highly publicized migrant caravan was approaching the United States. May Davis, deputy assistant to the president and deputy White House policy coordinator, wrote to officials with U.S. Customs and Border Protection, ICE and the Department of Homeland Security with the subject line: “Sanctuary City Proposal.”

“The idea has been raised by 1-2 principals that, if we are unable to build sufficient temporary housing, that caravan members be bussed to small- and mid-sized sanctuary cities,” Davis wrote, seeking responses to the idea’s operational and legal viability. “There is NOT a White House decision on this.”

Albence replied that such a plan “would create an unnecessary operational burden” on an already strained organization and raised concerns about its appropriateness, writing: “Not sure how paying to transport aliens to another location to release them — when they can be released on the spot — is a justified expenditure. Not to mention the liability should there be an accident along the way.”

The White House pushed the issue a second time in the midst of the budget standoff in mid-February, according to DHS officials, and on the heels of a bitterly partisan 35-day government shutdown over Trump’s border wall plan. The White House discussed the immigrant release idea as a way to punish Democrats standing in the way of funding additional detention beds.

ICE detainees with violent criminal records are not typically released on bond or other “alternatives to detention” while they await a hearing with an immigration judge, but there have been instances of such detainees being released.

The White House urged ICE to channel releases to sanctuary districts, regardless of whether immigrants had any ties to those places.

“It was retaliation, to show them, ‘Your lack of cooperation has impacts,’ ” said one of the DHS officials, summarizing the rationale. “I think they thought it would put pressure on those communities to understand, I guess, a different perspective on why you need more immigration money for detention beds.”

Senior officials at ICE did not take the proposal seriously at first, but as the White House exerted pressure, ICE’s legal advisers were asked to weigh in, DHS officials said.

A formal legal review was never completed, according to two DHS officials familiar with the events, but senior ICE attorneys told Albence and others that the plan was inappropriate and lacked a legal basis.

“If we would have done that, we would have had to expend transportation resources, and make a decision that we’re going to use buses, planes, etc., to send these aliens to a place for whatever reason,” a senior DHS official said. “We had to come up with a reason, and we did not have one.”

The proposal faded when House Democrats ultimately relented on their demand for a decrease in the number of detention beds, a final sticking point in budget talks between the White House and House Democrats.

The number of immigrant detainees in ICE custody has approached 50,000 in recent months, an all-time high that has further strained the agency’s budget. Those include immigrants arrested in the U.S. interior, as well as recent border-crossers transferred from U.S. Border Patrol. With unauthorized migration at a 12-year high, the vast majority of recent migrants — and especially those with children — are quickly processed and released with a notice to appear in court, a system that Trump has derided as “catch and release.”

The process has left Trump seething, convinced that immigration officials and DHS more broadly should adopt a harsher approach.

Vitiello’s removal from ICE last week was followed Sunday by the ouster of DHS Secretary Kirstjen Nielsen, who lost favor with Trump and Miller by repeatedly warning the White House that the administration’s policy ideas were unworkable and likely to be blocked by federal courts.

The sanctuary city proposal ran contrary to ICE policy guidelines, as well as legal counsel. ICE officials balked at the notion of moving migrants to detention facilities in different areas, insisting that Congress only authorizes the agency to deport immigrants, not relocate them internally, according to DHS officials.

The plan to retaliate against sanctuary cities came just after Trump agreed to reopen the government in late January, following a five-week shutdown over wall funding. The president gave lawmakers three weeks to come up with a plan to secure the border before a second fiscal deadline in mid-February.

During the talks, Republicans and Democrats sparred over the number of detention beds, with House Democrats pressing for a lower number amid pressure from their left flank.

It was during that mid-February standoff that one whistleblower went to Congress alleging that the White House was considering a plan to punish Democrats if they did not relent on ICE funding for beds. A second official independently came forward after that.

According to both, there were at least two versions of the plan being considered. One was to move migrants who were already in ICE detention to the districts of Democratic opponents. The second option was to bus migrants apprehended at the border to sanctuary cities, such as New York, Chicago and San Francisco.

A federal judge on Monday blocked an experimental Trump administration policy that requires asylum seekers to wait in Mexico while their cases make their way through the immigration court system, a major blow to President Trump as border crossings have surged to their highest point in more than a decade.

U.S. District Court Judge Richard Seeborg in San Francisco enjoined the Migrant Protection Protocols policy days after outgoing Homeland Security Secretary Kirstjen Nielsen pledged to expand the program. The policy began in January.

Trump has justified blocking asylum seekers from entering the United States by claiming that many asylum seekers are trying to carry out a scam — that they are coached to file false asylum claims knowing that they will be released into the country because of a lack of detention bed space. The administration had hoped to keep more asylum seekers in Mexico — and off U.S. soil — while they await court hearings on their claims.

Migrants who reach U.S. soil — including areas that are outside U.S. border barriers but inside U.S. territory — have the legal right to seek asylum. They generally are either held in detention facilities to await rulings in their cases or are released into the United States.

The policy had been one idea to stem the flow of migrants into the country, but Seeborg said his order ending the policy will take effect at 5 p.m. on April 12. Within two days, he said, the 11 migrants named in the lawsuit must be allowed to enter the United States, and the administration may not implement or expand the program.

The American Civil Liberties Union, one of the groups that filed the lawsuit, hailed the ruling as a “very important decision” on an “unpredecented” attempt to block asylum seekers from setting foot on U.S. soil.

“What it will mean is that nobody else can be sent to Mexico,” said Judy Rabinovitz, an ACLU lawyer. “They can’t enforce this policy.”

Will Democrats be held accountable for diverting attention from border crisis when there was time to fix it?

As Chairman of the Committee on Homeland Security, Congressman Bennie G. Thompson (D-Miss.) must know what is happening at the border. Yet he asserted at a recent hearing that President Donald Trump issued a national emergency declaration on the basis of a “nonexistent emergency” at the border.
Thompson claimed that when it comes to border security, the Trump administration is misleading the American people. Maybe, but I watched a video of the hearing and it seemed to me that the Democrats are the ones who are misleading the American people.
According to the testimony of the hearing’s only witness, DHS Secretary Kirstjen Nielsen, the country is facing a very real humanitarian and security crisis. Uncontrolled illegal migration is posing a serious and growing risk to public safety, national security, and the rule of law.
She is not the first DHS Secretary to make that claim. Every DHS Secretary since the Department’s inception has sounded the alarm about our unsecured border.
Nielsen testified that DHS expects to apprehend more migrants crossing the border illegally in the first half of fiscal 2019 than it did in the entirety of fiscal 2017, and the numbers are rising. This, however, is not the only problem.
There also has been a change in who is making the illegal crossings.
Historically, illegal crossers were predominantly single adult males from Mexico who generally could be removed within 48 hours if they had no legal right to stay. Now, more than 60 percent of them are family units and unaccompanied alien children.
The detention facilities were intended to be short-term processing centers that would hold adult men for 72 hours or less. They are not suitable for lengthy detentions of women and children.

  • Something that jumps out: those who are represented succeed at a significantly higher rate, understand the system better, and are highly likely to appear. Therefore, the single most cost efficient and obvious measure to take would be providing funding for universal representation of asylum seekers. It’s much cheaper than cruel, expensive, and unnecessary “civil” detention and walls that will have no effect on the current rule flow of asylum seekers. And, as more cases are granted the less necessary it becomes for DHS to waste court time by contesting every case and the more the “problem of removals” diminishes.  Those granted asylum don’t have to be removed  or monitored — they can actually go to work and begin contributing to our society.
  • Addressing the causes of the human rights debacle in the Northern Triangle would also be more helpful, logical, and cost effective in the long run than more gimmicks and futile attempts to solve a refugee situation unilaterally at the “receiving” end by “designed to fail” enforcement efforts, while ignoring or intentionally aggravating the causes of the refugee flow.

On Feb. 22, a young Honduran migrant woman went into premature labor and gave birth to a stillborn baby boy at the Port Isabel Detention Center in South Texas, four daysafter being detained by Immigration and Customs Enforcement.

The incident raises new questions about the detention of pregnant migrant women, and concerns that border control officials are infringing on the reproductive rights of migrant women and undermining their health and that of their babies. And there’s reason to worry: Such actions have historically been frequent and quite intentional. Nativist movements have long feared the reproductive capacity of migrant women and its potential for changing the demographic contours of the United States. This incident, and others like it, remind us once again how deeply intertwined women’s rights are with questions of immigration today.

In 1901, a Japanese teenager named Kaoru Yamataya arrived in Seattle visibly pregnant. Her pregnancy made Yamataya a target of a zealous immigration inspector named Thomas Fisher. Fisher claimed that Yamataya was “likely to become a public charge,” grounds for deportation under the dominant immigration law, and took her into U.S. custody. Two months after her arrival, Yamataya gave birth to a baby boy. Two months later, the infant died of pneumonia while he and his mother were still in the custody of the U.S. government.

This death created hardly a ripple in the press, a sign of shifting winds in U.S. immigration policy. Targeting women, particularly of Asian descent, as “public charges” was already commonplace. Its roots were in the Page Law of 1875, which barred contract laborers and prostitutes from “any Oriental country” from entering the United States. The Page Law created a system of immigration control that targeted women’s sexual practices.

But Yamataya’s case was at the leading edge of this desire to control immigrant women’s bodies extending to include greater focus on their reproductive capabilities. By 1924, Sen. James D. Phelan (Calif.) openly pleaded with Congress to pass legislation to exclude all Japanese women because, as he falsely claimed, they accounted for 33 percent of all births in California. Phelan’s fear was that “every child born is an American citizen under our very generous Constitution, intended to encourage population by European immigration of an earlier date when Asia was a closed book. What a Pandora’s box we opened when Admiral Perry went there and opened the gates of Japan!”

While Fisher said nothing so explicit in adjudicating Yamataya’s case, he pushed forward with the deportation process despite the death of her son. The inspector charged Yamataya with entering the United States under “surreptitiously clandestine” intentions, code for prostitution. Throughout the hearing in 1903, Yamataya denied the charge. She claimed to have immigrated to the United States for educational purposes, a claim backed by family members on both sides of the Pacific. Still, Fisher was unrelenting, and the law was on his side, giving him discretionary power to interpret and execute the law as he wished.

Yamataya’s case went to the Supreme Court, and on April 6, 1903, the court upheld the constitutionality of Immigration Act of 1891, as well as Yamataya’s deportation. However, it also established an immigrant’s right to a deportation hearing. Unfortunately for Yamataya, the court ruled that the ad hoc hearing conducted by Fisher and his colleagues constituted a legitimate hearing, and she returned to Japan in 1906.

Cases like Yamataya’s or that of the Honduran woman have become a major flash point over the past two decades, as a new nativist movement focuses on the threat that migrant mothers, especially those visibly pregnant, pose to their conceptions of America. The key is, as Phelan lamented nearly a century ago, the birthright citizenship enshrined in the 14th Amendment. This provision guarantees citizenship to all who are born in the United States, including the children of immigrant parents.

In the 21st century, such fears drove the rise of a new term: anchor babies. The Harvard political scientist Samuel Huntington popularized this phrase in the early 2000s to pejoratively refer to the American-born children of undocumented immigrants, and it stuck, giving nativists a new language to express their fears.

But this new language should not obscure the reality: Suspicions about migrant women’s reproduction have historically shaped immigration policy and practice. Given this history, we need to understand the current immigration crisis from a different perspective. At stake are not just migrant rights, but women’s rights as well.

Migrant mothers, whether carrying a child in their wombs or in their arms, have faced the brunt of anti-immigration fervor, and they need allies to publicize such abuses and to mobilize to change the law that has failed women for over a century.

No matter what happens with Thursday’s vote on President Trump’s declaration of a national emergency, the real root of the difficulties at the U.S.-Mexico border won’t be addressed.

The whole approach the U.S. government takes at the border is geared to yesterday’s problem: Our border security system was designed to keep single, young Mexican men from crossing into the United States to work. Every day, more evidence mounts that it’s not set up to deal with the families and unaccompanied children now arriving from Central America — in search not just of jobs, but also of refuge. The mismatch is creating intolerable humanitarian conditions and undermining the effectiveness of border enforcement.

From the 1960s to the early 2000s, the reality of illegal immigration at the southwest border was overwhelmingly economic migration from Mexico. The U.S. responded, especially once the Sept. 11, 2001, attacks prompted tighter security everywhere, by building up a well-resourced, modernized, hardened border enforcement infrastructure, with more staff and more sophisticated strategies. Successive Congresses and administrations under the leadership of both Democrats and Republicans have supported major investments in border security as an urgent national priority. About $14 billion was allocated in fiscal year 2017 for U.S. Customs and Border Protection, a steep rise from $9.5 billion a decade earlier.

From a peak of 1.6 million apprehensions in fiscal 2000 — with 98 percent of those apprehended Mexicans — border apprehensions have fallen by about three-quarters, to 397,000 last year. More Mexicans now return to Mexico annually than enter the United States. The turnaround has been dramatic and is due to the combined effects of economic growth, falling fertility rates and improved education and job prospects in Mexico; job losses in the United States surrounding the 2008-2009 recession; and significant border enforcement successes.

At the same time, an entirely different type of migration became more common. Beginning in 2012, the number of unaccompanied minorsfrom Central America — principally El Salvador, Guatemala and Honduras — crossing the border illegally jumped sharply. Modest numbers of such migrants had been arriving for many years. However, by 2014, the arrival of unaccompanied children spiked to more than 67,000 and, for the first time, the number of non-Mexican apprehensions exceeded those of Mexicans.

By 2016, the Central American flows became predominantly families with young children. Some were fleeing their countries in search of economic opportunity, but many were seeking safety and protection from widespread violence and gang activity that especially targets young people approaching or already in their teens.

Last year, 40 percent of border apprehensions were either of migrant families or unaccompanied minors, as compared to 10 percent in 2012. The proportion has risen to 60 percent in recent months, and just-released numbers show 66,450 apprehensions last month, the highest February total in a decade.

The important story, however, is not so much the numbers, which remain well below earlier peaks, as it is the change in the character of the flow. Today’s migrants include especially vulnerable populations, a large share of whom are seeking safety. As my organization reported recently, more than one in three border crossers today is an unaccompanied child or asylum seeker, up from approximately one in 100 a decade ago.

Yet the U.S. government’s posture has not been recalibrated, remaining pointed toward an illegal immigration pattern that has largely waned.

Today, many people who cross the border illegally actively seek out and turn themselves in to enforcement officials so they can apply for asylum. Others have been presenting themselves at ports of entry, seeking protection. Ground sensors, camera towers and similar surveillance technology and infrastructure are less helpful as a result.

Border Patrol facilities are designed for holding people only for short periods because that used to be all they needed to do: Most Mexicans who are apprehended are processed and returned across the border within hours. The same is not the case for Central Americans and others from noncontiguous countries, increasing numbers of whom are arriving exhausted and in ill health after lengthy, arduous journeys. They can’t simply be driven back to Mexico, because they’re not from there in the first place.

Border Patrol stations are ill-suited for dealing with these vulnerable populations, as the tragedy of the two young children who died recently in Border Patrol custody sadly illustrates. The situation has been further taxed by the increasing numbers of what the Border Patrol refers to as large-group arrivals: In the first five months of this fiscal year, the Border Patrol encountered 70 groups of more than 100 migrants crossing illegally, up from 13 last year and two the year before.

Asylum officers and immigration judges, not Border Patrol and port-of-entry inspectors, make the decisions in asylum cases. The asylum and immigration court systems don’t have anywhere near the sustained funding spent on border enforcement programs. As larger shares of migrants have arrived claiming asylum, workloads have ballooned into huge backlogs as a result. And even in cases where resources have been provided, they are not always used: Congress has allocated funding for 534 immigration judges, and yet only 427 are serving. Children and families are vulnerable to physical and emotional health dangers that argue for minimal detention periods, but their cases can take months or years to decide. And policies that precipitated the separation of more than 2,700 children from their parents have only added to the trauma.

These and other factors point to the need for dramatically different border management policies and budget decisions from those made in the past, largely successfully, to deter illegal inflows from Mexico.

Testifying in Congress last week, Homeland Security Secretary Kirstjen Nielsen said the situation at the border has reached a “breaking point.” There is a crisis, but it is a crisis of an asylum system that is severely overburdened by the major uptick in humanitarian protection claims.

The asylum system can only work effectively with timely, fair decisions about who is eligible for protection — and who is not, and therefore must be returned to their country of origin. More broadly, just as improved conditions in Mexico have been key to reducing illegal crossings of Mexicans, the best way to prevent Central Americans from fleeing their native countries must include attacking the violence, corruption and poverty driving them to leave home.

Yet the Trump administration has curtailed access to asylum and ended a program allowing some Central Americans to apply for protection from within the region to keep pressure off the border. Most recently, the administration rolled out a new policy that forces some asylum seekers to stay in Mexico in highly uncertain conditions to await asylum decisions, which they are told may take up to a year. Such measures seem only to be spurring on prospective migrants to journey to the U.S. before policies get even more restrictive.

This is not to say there are easy answers. Dealing with mixed flows is a challenge not only for the United States but for other major migrant destinations in Europe and beyond. Building systems that can sift through mixed flows to fairly and efficiently provide protection to those who truly qualify and identify and remove those who don’t is difficult.

But course corrections are well past due.

Steps that could be taken now include devoting money and applying new strategies to the asylum and immigration court systems so they can effectively handle a burgeoning caseload, rather than greatly narrowing who can access them. Building suitable Border Patrol facilities for receiving children and families and training agents and other staff to spot and act upon medical and other emergencies would also be required. The government could foster networks of community-based monitoring and case management programs with legal representation that provide alternatives to detention so migrants are detained for minimal periods, at less overall expense and are treated more humanely, but still appear for their asylum interviews and deportation hearings.

Ramped-up anti-smuggling initiatives and intelligence cooperation with neighboring countries are a must. Affected communities on both sides of the border need support and new partnerships with government actors, especially in the face of caravans, a method of movement on the rise among Central Americans to gain safety in numbers but posing new logistical and political difficulties for governments. And U.S. policies must give greater priority to our geographic neighborhood in developing longer-term solutions with Mexico and Central America that are in our joint national interests.

Rather than unproductive political fights over walls and national emergency declarations, these steps would go a long way to restoring order at the border. It is past time for policymakers and the public to recognize there are no quick fixes but that, even with migrant arrivals on the rise, the border can be managed through an array of proven policy initiatives.

It’s no surprise to me that an Administration committed to a racist, White Nationalist political agenda, rather than governing in the public interest, will consistently fail to solve problems and will govern incompetently.

Families who turn themselves in to the Border Patrol at the first opportunity to apply for asylum are by no stretch of the imagination “law enforcement issues” except to the extent that Trump’s inappropriate unwillingness to process them fairly at ports of entry and to establish a robust refugee program for the Northern Triangle has created a misdirection of law enforcement resources.  To claim otherwise is totally disingenuous.

David Frum’s cover essay in the latest issue of the Atlantic calling for immigration restrictions is generating some well-deserved scorn. Even his central premise — that if liberals don’t enforce immigration laws, the nation will turn to fascists — is bedeviled by reality. President Trump, Fox News and the Republican Party tried with all their might to demagogue immigration before the midterm elections. The GOP got clobbered. Democrats did especially well in elections in New Mexico, Texas, Arizona and California, the states that border Mexico. In fact, all nine members of Congress who represent the districts along the Mexico border oppose funding for Trump’s border wall.

According to Gallup, 67 percent of Americans think immigration levels should either stay the same or increase, and 75 percent think immigration is a “good thing,” an all-time high. Over the past two years, the percentage who want to restrict immigration from current levels has averaged 30 percent, the lowest figure since Gallup began asking this question in 1965. An NBC News-Wall Street Journal poll found that 61 percent of Americans think immigration helps the country more than it hurts, also an all-time high, and an incredible 49-point swing from 2005. There’s virtually no evidence that support for more immigration is a political liability, other than in Frum’s mind. At worst, an immigration supporter will lose the 30 percent of voters he or she would have lost anyway.

Frum’s essay also includes some bizarre, anti-historical observations. This one might be the strangest: “America was built on the revolutionary idea, never fully realized, that those who labor might also govern—that every worker should be a voter.” The United States was, of course, actually founded on the still-revolutionary — but not nearly as revolutionary — idea that every white, male landowner should be a voter. We weren’t even ready to admit that the people doing the most work at the time were full human beings. Not only was slavery thriving at the American founding, not only was it acknowledged and enshrined in the Constitution, but the effort to preserve the institution also formalized the bond between race, second-class citizenship and servitude. Even the Declaration of Independence, the founding document, was altered from Thomas Jefferson’s first draft to omit the word inherent as a descriptor of our rights, a nod to the fact that even the Enlightenment thinkers weren’t quite ready to recognize the existence of inalienable rights outside their immediate social status, much less to slaves.

In another fit of historical ineptitude, Frum pines for the years 1915 to 1975, a period of immigration restrictionism, which he bizarrely describes as the “years in which the United States became a more cohesive nation.” (Frum also conveniently leaves out how those policies were grounded in racism.) The economist Noah Smith obliterated this argument in a pretty devastating Twitter thread. This was a period of Jim Crow, lynching, red scares, the Depression, race riots, labor rights, mass incarceration, racial assassinations, internment camps and domestic terrorism. Under no circumstances would you describe it as an era of broad social cohesion.

If we wanted to look at the single metric most indicative of social cohesion, we’d probably look at murder rates. The U.S. homicide rate began to increase in the mid-1960s, then generally rose until it peaked with the crack epidemic in the early 1990s. Immigration began to increase in the early 1970s, but really began to soar in the 1990s. From about 1994 to about 2014, undocumented immigration soared while violent crime spiraled.

In fact, from about the late 1990s on, nearly every social indicator in the United States began to move in an encouraging direction — dropout rates, teen pregnancy rates, divorce rates, juvenile crime, rape, property crimes, you name it. Meanwhile, immigration boomed. I don’t think immigration caused all of those good things to happen. But Frum’s argument, that immigration unravels social cohesion, is simply contradicted by the data.

Frum goes on to list of a number of consequences of modern immigration, most of which Frum thinks bode ill for the sort of society to which Frum believes we should be aspiring. But most of the negative consequences Frum lists aren’t the result of immigrants themselves, but of people who share Frum’s view that we have too many immigrants. The line I quoted above, for example, is part of a broader argument Frum makes — because undocumented immigrants operated outside of the law, they aren’t afforded the same legal protection, social status and political representation as citizens and legal residents. But undocumented people live outside the law largely because (a) there is demand here for low-skilled workers, (b) it is virtually impossible for low-skilled workers to come here legally and (c) people who share Frum’s policy preferences have made it politically difficult to grant those who do come any sort of legal protection or political representation.

Frum also cherry-picks his data. He argues, for example, that employers in immigrant-heavy industries are shirking their safety obligations because immigrants lack the political power to demand or enforce regulations. He writes:

Forestry, fishing, and farming are three of the most dangerous industries in the United States. They are 46 percent reliant on immigrant laborers, half of them undocumented. (Documented and undocumented immigrants together make up only 17 percent of the U.S. workforce as a whole.) Building and grounds maintenance is surprisingly dangerous work: 326 people died in 2017. Some 35 percent of grounds workers are immigrants. About 25 percent of construction workers are immigrants, but immigrants supply almost half the workers in the most dangerous areas, notably roofing and drywalling. When so many workers in a job category toil outside the law, the law won’t offer much protection.

Note that Frum moves freely between percentages and raw numbers. Building and grounds maintenance may be “surprisingly dangerous work,” but without some other figures for context, 326 deaths is a meaningless statistic. How does that compare to other professions? According to the Bureau of Labor Statistics, the most dangerous class of occupations falls under the heading “transportation and moving materials.” This group of jobs accounted for nearly a quarter of worker deaths in 2017 — over four times as many workers died in that field as in maintenance. Within that field, the most dangerous sub-field is called “heavy tractor and trailer truck drivers.” And according to a 2012 American Community survey, immigrants make up less than 16 percent of truck drivers. If we look at rates, Frum’s argument also falls flat. The highest fatality rate is comparatively immigrant-spare transportation, at 15.9 deaths per 100,000 workers. Immigration heavy maintenance comes in at 6.6 deaths per 100,000.

There is some evidence that immigrant representation in even these fields is growing, as native-born Americans move out of blue-collar jobs and into more lucrative occupations. But Frum’s policy prescriptions will only exacerbate the very problems that allegedly worry him. Remember, Frum also suggests curbing legal immigration. Contrary to the claims of restrictionists, people don’t come to the United States to get free welfare and health care. Undocumented immigrants contribute more to the economy than they take out, and are less reliant on social welfare than native-born Americans. People come to the United States — legally and illegally — when there is demand for their labor. When the jobs dry up, immigrants stop coming. If demand persists, and the number of legal avenues for immigration continue to dwindle, the immigrants won’t stop coming, they will just increasingly stop coming legally. That means more — not fewer — people in the shadows, unrepresented, unprotected and un-franchised.

But I think my favorite bit of Frum-ian logic comes when discussing the opioid epidemic:

Without the immigrant workers less prone to abuse drugs than the native-born, American elites might have noticed the opioid epidemic before it killed more Americans than died in the Vietnam, Korean, and Iraq Wars and the 9/11 attacks combined.

This is nonsense, on a number of levels. First, there’s little evidence that American elites “missed” the opioid epidemic. The Centers for Disease Control and Prevention has been dutifully publishing overdose statistics each year, as it always has. I’ve talked to several medical examiners in recent years who believe the epidemic may even be overstated. Overdose isn’t always easy to diagnose, and because there’s a nationwide shortage of medical examiners, cause of death isn’t always the product of careful medical analysis so much as a rough guess by an elected coroner with little or no medical training. This isn’t to say that there’s nothing to worry about, but ask any pain patient who is struggling to find treatment — the opioid crisis has certainly not gone unnoticed.

More to the point, Frum’s argument here is a bit of rhetorical jujitsu. The nativist line has long been that immigrants — particularly those who are unskilled and undocumented — are diseased, crime-ridden and drug-addicted. Faced with evidence that immigrants are lesslikely to be addicted to opioids, Frum flips an asset into a liability. Now, the fact that immigrants don’t abuse drugs unfairly distracts elite attention from the native-borns who do.

It reminds me of one of my favorite-ever anti-immigration arguments, from longtime nativist Mark Krikorian. Back in 2004, Krikorian lamented over a Boston Globe story about how dedicated, hardworking immigrants were robbing native-born American teenagers a rite of passage — the privilege of slacking off at their first job. He wrote:

One economist said employers “like the fact that immigrants can work more hours and more shifts than teenagers.” A job counselor said “Typically when kids apply for a summer job they might want a week off to go to camp or do something else. I tell them, ‘You can’t do that. You are up against someone who is going to be there every day and you need to deal with that.’” As a result, the percentage of teenagers holding jobs is the lowest it’s been since statistics started being compiled in the 1940s.

Is it healthy for the future of our society to freeze our children out of low-wage, rite-of-passage jobs? When I was younger, I washed dishes in restaurants, packed tomatoes, did lawn work — this kind of thing is essential if we are to preserve a middle-class society that values work, rather than the Old World model that mass immigration is pushing us toward, where only inferiors ever get their hands dirty.

Of course, Krikorian also regularly argues that the same immigrants employers prefer because of their dedication and work ethic are simultaneously a drain on the welfare system.

The thing to remember here is the only consistent principle behind immigration restrictionism is opposition to immigrants. As a nativist, you’re free to argue that immigrants are both lazy and hardworking. They’re both assimilating too quickly and refusing to assimilate. They’re both violent drug pushers who are crowding our prisons, and they’re teetotaling law-abiders whose good citizenship is unfairly diverting attention from overdose deaths and mass incarceration among the native-born. Pick and chose these points as you need them. Any old argument will do.

In a dusty lot along the U.S.-Mexico border fence, a single Border Patrol agent was stuck with few options and falling temperatures.

A group of 64 parents and children had waded through a shallow bend in the Rio Grande to turn themselves in to the agent on the U.S. side. He radioed for a van driver, but there were none available. By 2 a.m., the temperature was 44 degrees.

The agent handed out plastic space blankets. The group would have to wait.

Groups like this arrived again and again in February, one of the coldest and busiest months along the southern border in years. U.S. authorities detained more than 70,000 migrants last month, according to preliminary figures, up from 58,000 in January. The majority were Central American parents with children who arrived, again, in unprecedented numbers.

During a month when the border debate was dominated by the fight over President Trump’s push for a wall, unauthorized migration in fiscal 2019 is on pace to reach its highest level in a decade. Department of Homeland Security officials say they expect the influx to swell in March and April, months that historically see large increases in illegal crossings as U.S. seasonal labor demand rises.

The number of migrants taken into custody last year jumped 39 percent from February to March, and a similar increase this month would push levels to 100,000 detentions or more.

It was a surge in the border numbers in March 2018 that infuriatedPresident Trump and launched his administration’s attempt to deter families by separating children from their parents. Trump stopped the separations six weeks later to quell public outrage. But the controversy the policy generated — and its widely publicized reversal — is now viewed by U.S. agents as the moment that opened the floodgates of family migration even wider, worsening the problem it was meant to fix.

While arrests along the border fell in recent years to their lowest levels in half a century, they are now returning to levels not seen since the George W. Bush administration, driven by the record surge in the arrival of Central American families.

For U.S. border agents, the strain has grown more acute, as they struggle to care for children using an enforcement infrastructure made in an era when the vast majority of migrants were Mexican adults who could be quickly booked and deported. The Central American families — called “give-ups” because they surrender instead of trying to sneak in — have left frustrated U.S. agents viewing their own role as little more than the facilitators for the last stage of the migrants’ journey. They are rescuing families with small children from river currents, irrigation canals, medical emergencies and freezing winter temperatures.

“We’re so cold,” said Marlen Moya, who had left Guatemala with her sons six weeks earlier and crossed the Rio Grande with the group of 64.

Moya’s son Gael, 6, was sick with a fever and moaning, his face streaked with tears. “In Juarez, we were shoved and yelled at,” she said, looking back across the river to Ciudad Juarez, Mexico. “We slept on the street.”

Asked why she didn’t cross during the day, when temperatures were mild, Moya said she worried that Mexican police would stop them. “We’ve already come this far,” she said.

Marlen Moya, who had left Guatemala with her sons six weeks earlier, holds Gael, 6, as they wait along with Anderson, 8. Moya said she fled Guatemala City after being threatened and robbed at gunpoint at her beauty salon.

Much of the attention last fall was focused on caravan groups, mostly from Honduras, as they reached Tijuana, Mexico, not far from San Diego. Then concern shifted to Arizona and New Mexico, where groups of rural Guatemalan families began showing up at remote border outposts. Two Guatemalan children died in December after being taken into U.S. custody, as Homeland Security officials declared a humanitarian and national security crisis.

The border deal Trump and Democrats reached last month includes $415 million to improve detention conditions for migrant families, including funds to potentially open a new processing center in El Paso. But in the meantime, families continue to arrive in groups large and small, in faraway rural areas and right in downtown El Paso.

“The numbers are staggering, and we’re incredibly worried that we will see another huge increase in March,” said a Homeland Security official who spoke on the condition of anonymity to discuss the unpublished figures.

The lone U.S. agent with the group was the only one available along that span. Drug smugglers have been using the groups as a diversion, so the agent couldn’t leave the riverbank.

No vans or buses arrived to pick up the families. Other agents were busy at the nearby processing center because so many groups had arrived in El Paso that night, and still others were at the hospital, where they were helping parents and children receive treatment for severe flu symptoms.

Homeland Security officials have been urging lawmakers to grant them broader powers to detain and quickly deport families in a search for deterrent measures. Their attempts to crack down using executive actions have been blocked repeatedly in federal court.

The Trump administration has begun sending some asylum-seeking Central Americans back to Mexico to wait while their claims are processed, but so far that experiment has been limited to California’s San Ysidro port of entry.

About 150 migrants were sent back across the border in February, according to Mexican authorities, but that is a small fraction of the more than 2,000 unauthorized migrants coming into U.S. custody on an average day.

Homeland Security officials said Friday that the pilot program, which they call Migrant Protection Protocols, will expand to El Paso and potentially other locations in coming weeks, predicting that the number of Central Americans sent back would grow “exponentially.” Some of the cities where they will wait are among the most dangerous in Mexico.

Mexican officials are cooperating by providing general assistance and job placement for those sent back to wait, but privately they have warned the Americans that their capacity to take parents with children is extremely limited, especially families that need welfare assistance and enrollment in already-crowded public schools.

They were given one of the most dangerous tasks in policing: Take down MS-13.

They were bankrolled by the United States and trained by FBI agents. But members of the Salvadoran police have been killed by the dozens in each of the past three years, most in attacks that investigators and experts blame on MS-13, an international street gang. At least nine officers were killed in the first month of this year.

Now, a number of El Salvador’s police officers are fleeing the gang they were tasked with eliminating.

There is no list in either El Salvador or the United States of Salvadoran police officers who have fled the country. But The Washington Post has identified 15 officers in the process of being resettled as refugees by the United Nations and six officers who have either recently received asylum or have scheduled asylum hearings in U.S. immigration courts. In WhatsApp groups, police officers have begun discussing the possibility of a migrant caravan composed entirely of Salvadoran police — a caravana policial, the officers call it.

The exodus of Salvadoran police points to how the country’s security forces have failed to break the stranglehold of organized crime. It also shows that among those seeking refuge in the United States during the Trump administration are some of America’s closest security partners.

“These are among the most vulnerable people in El Salvador,” said Julio Buendía, the director of migration at Cáritas El Salvador, a nonprofit organization that works with the United States and United Nations on refugee resettlement.

The United States has been bolstering the Salvadoran police, part of a regional strategy intended to stabilize Central America’s most violent countries and reduce migration. The State Department spent at least $48 million to train police in El Salvador, Guatemala and Honduras from 2014 through 2017, according to the Government Accountability Office.

The department opened a law enforcement training academy in San Salvador, where 855 Salvadoran officers were trained by the FBI and other American law enforcement agencies in those four years.

“The Salvadoran government, with U.S. government support, has made significant gains in the area of security, including reductions in homicides and every other category of violent crime measured,” the State Department said in a statement issued in response to an inquiry by The Post.

Citing “privacy reasons,” the department would not comment on whether it was receiving asylum or refugee applications from Salvadoran police officers.

By some measures, the U.S.-backed security efforts appeared to be showing results. In 2018, El Salvador’s murder rate was 50.3 per 100,000 inhabitants. That was still among the highest in the world, but it was down from 60.8 per 100,000 in 2017 and 81 per 100,000 in 2016.

MS-13 was born in Los Angeles in the late 1970s, expanding as more Salvadorans arrived in the United States after fleeing the country’s civil war. The group splintered, with Barrio 18 becoming a chief rival, and both groups grew in American prisons before reaching El Salvador through mass deportations. Between 2001 and 2010, the United States deported 40,429 ex-convicts to El Salvador, according to the Department of Homeland Security.

El Salvador’s government adopted an “iron fist” response to the gangs, including more police operations. When that approach failed, it tried to broach a truce with the gangs in 2014. The pact quickly disintegrated and was followed by another surge in violence. It was then that the gangs began to explicitly broadcast their threats against police officers.

“If you kill a ‘pig,’ or a police officer, you’re more respected in these gangs. That’s the policy — using death as exchange currency,” said Héctor Silva Ávalos, a journalist and researcher who has written a book on the Salvadoran police and has served as an expert witness at several asylum hearings for former police officers in the United States.

With salaries of $300 to $400 per month, the low-level police officers who make up the majority of the force often have no choice but to live in neighborhoods vulnerable to gangs. And so, in the vast majority of the cases, police officers are killed when they are home from work or are on leave.

In August, Manuel de Jesús Mira Díaz was killed while buying construction materials. In July, Juan de Jesús Morales Alvarado was killed while walking with his 7-year-old son on the way to school. In November, Barrera Mayén was killed after taking leave to spend time at home with his family.

The police investigated a number of the killings since 2014 and found members of the major gangs responsible.

“They have more control than we do. When we go home, we’re in neighborhoods where there’s one police to 100 gang members. We’re easy victims,” said one officer in the country’s anti-gang unit, who, after being threatened by MS-13 in his home, is awaiting refugee status from the United Nations. He spoke on the condition of anonymity out of fear for his safety.

An MS-13 member killed a man on a New York subway platform. The gang dates back to the 1970s.

Police arrested a 26-year-old man, who they said is an MS-13 member, after he fatally shot an alleged rival gang member Feb. 3 in Queens.

Complicating their response to the threats, Salvadoran police are also not legally allowed to take their weapons home with them.

“I bring it home anyway. I sleep with it on my waist,” said a female officer, who is awaiting refugee status from the United Nations and spoke on the condition of anonymity out of fear for her safety. “My husband and I take turns sleeping. We know they are going to come for us.”

Many units in the Salvadoran police are forbidden to wear balaclavas to conceal their identities. In anti-gang units, officers are allowed to wear such masks during operations, but they are frequently asked to testify in court, where they must show their faces and identify themselves by name while gang members look on.

In 2017, El Salvador’s attorney general, Douglas Meléndez, urged the government to do more to protect off-duty police, asking the parliament to pass a “protection law” for police and soldiers that would also provide funding to protect their families. The law was never passed.

Last month, security concerns played a central role in a presidential election won by San Salvador’s 37-year-old former mayor, Nayib Bukele. At least 285 people were killed in January, leading up to the vote, which many saw as the gangs’ attempt to leverage their influence amid the election campaign. In a security plan leaked to the Salvadoran news media, Bukele’s campaign wrote: “The expansion of these criminal groups is undeniable, as is the impact on the lives of ordinary citizens.”

In response to the targeting of police officers this year, El Salvador’s police chief introduced a policy: For their own protection, officers were not allowed to return to their homes. The police chief declined multiple interview requests.

Many officers, feeling unprotected by their own force, have said their only option is to leave the country.

Organizations that work with the United Nations to resettle Salvadoran refugees in the United States say they have found more and more police officers arriving unannounced at their offices. In addition to the 21 asylum seekers and refugees identified by The Post, several others have recently arrived in Spain and Mexico, according to news reports, applying for humanitarian visas or other forms of protection. Lawyers for police officers and many officers themselves say that far more officers are preparing to flee.

One of the cases that Buendía, the migration director of Cáritas, referred to the United Nations High Commissioner for Refugees is an officer who survived two attacks while off duty. First, he was shot eight times by suspected gang members; then, two years later, he was shot four times. The officer pleaded for protection from his commander.

Buendía included a letter from the commander in the officer’s refugee application. “There’s nothing we can do for you,” the commander wrote. “You need to protect yourself.”

A police spokesman declined to comment on the letter.

In one case, concerning a police officer now applying for asylum in U.S. immigration courts, gang members threatened to kidnap the officer’s child at an elementary school in rural El Salvador.

“That’s not what these guys signed up for. It’s one thing to be shot at on the job. It’s another for your family to be targeted while you’re off duty,” said Emily Smith, the attorney representing the officer.

Lawyers such as Smith who are representing the officers typically try to explain to immigration judges that as former police officers, their clients would be persecuted if they were forced to return to El Salvador. But the attorneys are also aware of how narrowly U.S. asylum law can be applied, and that the courts are unlikely to grant asylum to all former officers.

“What we chose to do is focus on the specific threats facing our client,” said Patrick Courtney, who last year represented a Salvadoran officer who had been physically assaulted in his home before fleeing. “We focused on his anti-gang views, on the fact that the threats were directed at him individually.”

Courtney’s client was granted asylum late last year. They discussed where he would live in the United States, and what he would do next. The former officer had only one goal: He wanted to join the United States military.

Former policemen have been recognized by BIA precedent as a “particular social group” for asylum for many years. Matter of Fuentes, 19 I&N Dec. 658 (BIA 1988). However, in their rush to deny asylum to Central Americans, particularly under  this xenophobic Administration, some U.S. immigration Judges and BIA panels simply choose to ignore precedent or to manufacture other reasons to deny asylum.

Granting asylum to endangered former police officers clearly is appropriate; but, granting it to the women targeted because of their gender whom those police cannot protect is equally required. Nevertheless, Sessions simply “streamrolled” the asylum law in Matter of A-B-.

While some U.S. Immigration Judges have recognized that even A-B-, properly read without regard to its pernicious dicta, leaves plenty of room for protecting refugee women who have suffered or fear domestic violence, others, and a number of BIA “panels” have jumped on the “Sessions deportation express.” I wouldn’t count on new AG Bill Barr to restore justice to this system, particularly since he has retained some of Sessions’s worst and most unqualified henchmen on his staff.

That’s why we need a legitimate, independent Immigration Court system not beholden to prejudiced “enforcement only” officials in the DOJ and the Executive Branch.
