Twenty-nine parents from across Central America who were separated from their children by U.S. immigration agents last year crossed the U.S. border on Saturday, demanding asylum hearings that might allow them to reunite with their children.

The group of parents quietly traveled north over the past month, assisted by a team of immigration lawyers who hatched a high-stakes plan to reunify families divided by the Trump administration’s family separation policy last year. The 29 parents were among those deported without their children, who remain in the United States in shelters, in foster homes or with relatives.

At about 5 p.m. local time, the families were taken to the U.S. side of the border by immigration agents, where their asylum claims will be assessed.

Although the Trump administration’s family separation policy has prompted congressional hearings, lawsuits and national protests, the parents have for nearly a year suffered out of the spotlight at their homes in Honduras, Guatemala and El Salvador. They celebrated birthdays and Christmas on video calls, trying to determine whether their children were safe.

Now, they will pose a significant test to the embattled American asylum system, arguing that they deserve another chance at refuge in the United States, something rarely offered to deportees.

Before the Trump administration, families had never been systematically separated at the border. And before Saturday, those families had never returned to the border en masse.

More than 2,700 children were separated from their families along the border last year, according to the Department of Health and Human Services. About 430 of the parents were deported without their children, and at least 200 of them remain separated today. Some waited in the hope that U.S. courts would allow them to return to the United States. Others paid smugglers to get them back to the border. Then came Saturday’s confrontation.

The group of parents walked toward the border here, flanked by local religious officials, and then waited at the entrance to the United States as the lawyers negotiated with U.S. officials. The parents sat on wooden benches, surrounded by their luggage, while officials decided how many of the parents to allow into the country.

Over the past three weeks, the parents stayed in a Tijuana hotel, sharing rooms and preparing for asylum hearings. They showed one another documents that their children had sent them: photos of foster families and report cards from Southwest Key, a company that runs shelters for migrant children.

A woman explained through tears how her daughter had tried to kill herself while in government custody. A man spoke about trying to communicate with his daughter, who is deaf, over a shelter’s telephone. Others carried bags full of belated Christmas gifts for their children.

Many of the parents, like José Ottoniel, from the tiny town of San Rafael Las Flores, Guatemala, said they had been pressured into signing deportation papers after being separated from their children, before they could begin their asylum claims. When he returned home after being deported in June, Ottoniel was told that his 10-year-old son, Ervin, was still in the United States at a shelter.

The family chose to keep Ervin in the United States with an uncle, rather than forcing him to return to the violence and poverty of their home village. It was a wrenching decision that Ottoniel’s wife, Elvia, who had remained in Guatemala when Ottoniel had tried to cross the border, eventually decided she couldn’t live with. In January, she paid a smuggler $8,000 to travel to the United States to reunite with Ervin in Arkansas, applying for asylum in South Texas.

A few days later, Ottoniel received a call from an American immigration lawyer with the Los Angeles-based legal advocacy group Al Otro Lado, which means “to the other side.” The attorney asked him if he was willing to travel the 2,500 miles from his village to the U.S.-
Mexico border to deliver himself once again to immigration agents.

Al Otro Lado had received more than a million dollars in financial assistance from organizations such as Families Belong Together and Together Rising, which mounted fundraising campaigns in the midst of the government’s separation policy. The lawyer told Ottoniel that the organization would pay for his buses, flights and hotels.

“At that point, we were already seeing some of these parents paying smugglers to bring them back to the U.S.,” said Erika Pinheiro, litigation and policy director for Al Otro Lado, which had interviewed deported parents from across Central America who feared for their lives because of violence in their home countries. “We needed to provide them with another option.”

For Ottoniel, who referred to his family as “disintegrated,” it seemed his best shot at a reunion.

“It was a chance to see my son again. How could I say no?” he said.

Ottoniel and other parents converged at a three-story hotel in Tijuana,where lawyers told them to remain quiet about their plans. They rehearsed how they would address U.S. immigration officials. They watched telenovelas. At night, they called their children across the border.

There was Luisa Hidalgo, 31, from El Salvador, whose daughter, Katherinne, 14, is in the Bronx with a foster family. The girl texted her mother the same words over and over: “Fight for me.”

There was Antolina Marcos, 28, who said she fled Guatemala after gangs began killing members of her family. She was separated from her 14-year-old daughter, Geidy, in May. “How can I live when she’s so far away?” Marcos said.

There was Santos Canelas, 44, who said he fled Honduras with his 16-year-old daughter, Merin, in May after gang members threatened to sexually assault her. She is living in New Orleans with a cousin. “Without my daughter, I’m dead inside,” he said.

In most of the 2,700 cases from when the Trump administration separated families at the border last year, both the parents and children remained in the United States, sometimes held in shelters and detention centers thousands of miles apart. Almost all of those families have now been reunified and are in the process of pursuing their asylum claims.

But the cases of about 430 parents deported without their children were particularly difficult. Often, the government lost track of which child belonged to which parent, and it did not link their immigration cases, sending parents back to Central America without telling them where their children were.

In some of those cases, parents later made the painful decision to leave their children in the United States, typically with relatives, rather than bringing them back to the violence and poverty from which the families fled. In other cases, the U.S. government determined that the parents were unfit to receive their children, often based on their criminal records.

After Trump signed an executive order officially ending the family separation policy on June 20, lawyers launched a legal battle to reunify many of the deported parents and their children in the United States. The American Civil Liberties Union filed a lawsuit demanding that the government allow 52 parents back into the United States to pursue their asylum claims, which the lawyers argued had been stymied after the parents were separated from their children at the border.

But the government has not responded to that appeal and later said it needed more information about the parents from the ACLU. It remains unclear when, or if, the U.S. government will invite those parents back to the United States to launch new asylum claims.

“The government has resisted bringing anyone back who was separated and deported without their kids,” said Lee Gelernt, deputy director of the ACLU’s Immigrants’ Rights Project. “We hope the government will take a fresh look at these cases.”

But as the government declined to articulate any plan to reunify the families, Pinheiro decided waiting much longer would put the parents at risk. Some had relocated to a safe house in Guatemala City to escape threats in El Salvador and Honduras. Some had already been without their children for more than a year, and those separations were taking a psychological toll.

“We gave them the option — you can wait for the court process, or you can do it this way,” Pinheiro said. Al Otro Lado worked with the ACLU to identify the separated parents in Central America, but the ACLU was not involved in bringing the 29 parents back to the border.

With few other options, Pinheiro said, almost every parent she approached accepted her offer. The parents first gathered in the Guatemalan city of Tecun Uman before crossing into Mexico with humanitarian visas that Al Otro Lado helped arrange. They flew to Mexico City and then to Tijuana, eventually taking a bus to Mexicali.

“We’re traveling back to the border where we lost our children in the first place,” said Pablo Mejia Mancia, 53, of Honduras, who was separated from his daughter, who is now 9 years old, when they crossed the border into Texas in May.

It’s likely that some of the parents could be detained for months if the government decides to process their asylum claims. The U.S. policy of forcing asylum seekers to wait in Mexico has not yet been put into practice in Mexicali.

“They’re standing right at the border, preparing to reenter a system that traumatized their families months earlier,” Lindsay Toczylowski, executive director of the Immigrant Defenders Law Center, who counseled the parents in Tijuana, said before the parents crossed into the United States. “It says a lot about what they’re fleeing, and what they lost.”

Never forget that the damage already done to these families and children might well be irreparable and that we are responsible as a nation for the atrocities, deceptions, and mindless cruelty carried out by Trump and his minions in our name. Yes, as these pictures by Carolyn Van Houten show, there are real human beings out there, decent people much more like us than we might choose to believe, who are suffering because of what our Government has become.

It could be a long uphill fight to save our republic.  But, that’s what the New Due Process Army is fighting to do every day!

SUPREMES: DEAD JUDGES CAN’T VOTE! — Federal Judges Serve For Life, Not Eternity!

“Federal judges are appointed for life, not for eternity,” the Supreme Court concluded Monday, saying the late judge Stephen Reinhardt’s vote should not have been counted in a decision issued after his death.

In an unsigned opinion, the justices sent back a decision of the U.S. Court of Appeals for the 9th Circuit that found a practice of the Fresno County Office of Education violated the Equal Pay Act of 1963.

Reinhardt died March 29, 2018, but the 9th Circuit counted his vote after that. He was listed as the author of an en banc decision — one made by a majority of the full court — 11 days later.

“Without Judge Reinhardt’s vote, the opinion attributed to him would have been approved by only 5 of the 10 members of the en banc panel who were still living when the decision was filed,” the opinion stated. “Although the other five living judges concurred in the judgment, they did so for different reasons. The upshot is that Judge Reinhardt’s vote made a difference.”

“That practice effectively allowed a deceased judge to exercise the judicial power of the United States after his death,” the opinion said. “But federal judges are appointed for life, not for eternity.”

Because the opinion is unsigned, lost perhaps for eternity will be the identity of the justice who penned that line. But it was not Justice Sonia Sotomayor, who noted that she “concurs in the judgment.”

The case, Yovino v. Rizo, returns to the 9th Circuit.

A bipartisan group of 58 former senior national security officials issued a statement Monday saying that “there is no factual basis” for President Trump’s proclamation of a national emergency to build a wall on the U.S.-Mexico border.

The joint statement, whose signatories include former secretary of state Madeleine Albright and former defense secretary Chuck Hagel, comes a day before the House is expected to vote on a resolution to block Trump’s Feb. 15 declaration.

The former officials’ statement, which will be entered into the Congressional Record, is intended to support lawsuitsand other actions challenging the national emergency proclamation and to force the administration to set forth the legal and factual basis for it.

Albright served under President Bill Clinton, and Hagel, a former Republican senator from Nebraska, served under President Barack Obama.

Lawmakers argue over Trump’s national emergency declaration

Republican Sen. Lindsey O. Graham (R-S.C.) said he supported President Trump’s national emergency declaration to build the wall Feb. 17.

Also signing were Eliot A. Cohen, State Department counselor under President George W. Bush; Thomas R. Pickering, President George H.W. Bush’s ambassador to the United Nations; John F. Kerry, Obama’s second secretary of state; Susan E. Rice, Obama’s national security adviser; Leon E. Panetta, Obama’s CIA director and defense secretary; as well as former intelligence and security officials who served under Republican and Democratic administrations.

Trump’s national emergency declaration followed a 35-day partial government shutdown, which came after Congress did not approve the $5.7 billion he sought to build a wall.

In announcing his declaration, Trump predicted lawsuits and “possibly . . . a bad ruling, and then we’ll get another bad ruling” before winning at the Supreme Court.

Trump’s actions are also drawing criticism from at least two dozen former Republican congressmen, who have signed an open letter urging passage of a joint resolution to terminate the emergency declaration. The letter argues that Trump is circumventing congressional authority.

The former security officials’ 11-page declaration sets out their argument disputing the factual basis for the president’s emergency.

Among other things, they said, illegal border crossings are at nearly 40-year lows. Undetected unlawful entries at the U.S.-Mexico border decreased from 851,000 to nearly 62,000 between 2006 and 2016, they said, citing Department of Homeland Security statistics.

Similarly, they state that there is no drug trafficking emergency that can be addressed by a wall along the southern border, noting that “the overwhelming majority of opioids” that enter the United States are brought in through legal ports of entry, citing the Justice Department.

They also argue that redirecting money pursuant to the national emergency declaration “will undermine U.S. national security and foreign policy interests.” And, they assert, “a wall is unnecessary to support the use of the armed forces,” as the administration has said.

Their views were filed as a joint declaration and later as a friend-of-the court brief in lawsuits challenging the original order and subsequent revisions, and it was cited by almost every federal judge who enjoined the ban. By the time the challenges reached the Supreme Court, the administration had significantly narrowed the ban, which the high court upheld on a 5-to-4 vote.

With respect to the declared national emergency, plaintiffs have filed two cases in the District of Columbia, two in California and one in Texas.

PINOCCHIO 4.0: Stephen Miller Spews Forth Lies About Immigrants & Crime From White House Perch!🤥🤥🤥🤥

This article has been updated with a comment from the White House

Miller slipped this line in the final seconds of his contentious interview with host Chris Wallace over President Trump’s emergency declaration to fund a wall along the southern border, so some viewers might have missed it. But it’s an astonishing statement, suggesting that undocumented immigrants kill thousands of Americans every year.

The White House did not respond to a query concerning Miller’s math, but other anti-immigration advocates have made similar claims. Rep. Mo Brooks (R-Ala.) claimed in December that there are “thousands of Americans who are dead each year because [of] the Democrats’ refusal to secure our borders.” President Trump claimed in 2018 that 63,000 Americans have been killed by illegal immigrants since the Sept. 11, 2001, attacks, which works out to about 3,700 a year.

But there is no evidence these claims are true. In fact, the available evidence suggests these claims are false. This is a good example about how a paucity of data allows political advocates to jump to conclusions.

The Facts

First, some context: There is no nationwide data set on crime committed by undocumented immigrants, so researchers have tried to tease the answer from less-than-complete data. Yet study after study shows that illegal immigration does not lead to increased crime, violence or drug problems. In fact, the studies indicate that undocumented immigrants commit crimes at lower rates than native-born Americans.

A 2018 study published in the peer-reviewed journal Criminology, led by Michael Light, a criminologist at the University of Wisconsin at Madison, examined whether places with higher percentages of undocumented immigrants have higher rates of violent crime such as murder or rape. The answer: States with larger shares of undocumented immigrants tended to have lower crime rates than states with smaller shares in the years 1990 through 2014. Similar results were found in another peer-reviewed study by the same researchers that looked at nonviolent crime, such as drug arrests and driving under the influence (DUI) arrests.

Similarly, the libertarian Cato Institute in 2018 looked at 2015 criminal conviction data among undocumented immigrants in Texas — one of the few states to record whether a person who has been arrested is in the country illegally or not. Researcher Alex Nowrastehfound that criminal conviction and arrest rates in Texas for undocumented immigrants were lower than those of native-born Americans for homicide, sexual assault and larceny.

“As a percentage of their respective populations, there were 50 percent fewer criminal convictions of illegal immigrants than of native-born Americans in Texas in 2015,” Nowrasteh wrote. “The criminal conviction rate for legal immigrants was about 66 percent below the native-born rate.”

In 2015, there were 785 total homicide convictions in Texas. Of those, native-born Americans were convicted of 709 homicides (a conviction rate of 3.1 per 100,000), illegal immigrants were convicted of 46 homicides (2.6 per 100,000), and legal immigrants were convicted of 30 homicides (1 per 100,000). In other words, homicide conviction rates for illegal and legal immigrants were 16 percent and 67 percent below those of native-born Americans, respectively.

Some advocates of restraining immigration have sought to make the case that undocumented immigrants commit more crimes by relying on data from the State Criminal Alien Assistance Program (SCAAP), a federal program that offers states and localities some reimbursement for the cost of incarcerating certain criminal non-U. S. citizens. The Government Accountability Office (GAO) in July issued an updated report on SCAAP data, but GAO (and SCAAP) only counts total incarcerations, not individuals. Thus the numbers are not helpful for drawing conclusions about the criminality of undocumented immigrants.

In other words, the available research indicates that, when compared with U.S. citizens, illegal immigrants commit fewer crimes. But we understand that some people might argue that any crime committed by an illegal alien is one too many. Miller is involved in a counting exercise — thousands of deaths that in theory would not otherwise have happened if the undocumented immigrant had not set foot on U.S. soil.

But the available evidence does not support a count of thousands of deaths a year, either.

Nowrasteh pointed The Fact Checker to the Texas data. For the five years from 2014 through the end of 2018, there were 200 homicide convictions of illegal immigrants. We’ll assume each conviction represents one person, although, of course, someone could have been convicted of multiple murders.

According to the Department of Homeland Security Estimate of the Illegal Alien Population Residing in the United States in January 2015, there were 1.9 million illegal residents in Texas, or about 16 percent of the 12 million undocumented immigrants estimated by the agency nationwide. If one assumes that the homicide conviction rate is the same across the country — admittedly a big assumption — then that adds up to 1,250 homicide convictions over a five-year period, or 250 a year.

In the same five-year period, there were about 75,000 murders in the United States. The United States has a 70 percent conviction rate for murder, according to the Bureau of Justice Statistics, so that translates to illegal immigrants accounting for about 2.3 percent of homicide convictions from 2014 to 2018 while accounting for about 3.8 percent of the population.

Miller said “thousands of Americans” die each year. People tend to murder who they know and live with, so odds are many of these 250 or so murders are of other illegal immigrants, not Americans.

While the White House did not respond to a query about where Miller got his calculation, we should note that Brooks has justified his figure by citing people “murdered by illegal aliens, vehicular homicides by illegal aliens, or the illegal narcotics that are shipped into our country by illegal aliens and their drug cartels.”

That slippery wording can be used to justify just about any American death from heroin. But while 90 percent of the heroin sold in the United States comes from Mexico, virtually all of it comes through legal points of entry. “A small percentage of all heroin seized by [Customs and Border Protection] along the land border was between Ports of Entry (POEs),” the Drug Enforcement Administration said in a 2018 report.

Miller spoke vaguely about “threats crossing our southern border,” adding: “We have families and communities that are left unprotected and undefended. We have international narco terrorist organizations.” The clear implication, especially with the use of the word “terrorist,” was that people were being murdered. Adding drug deaths to the total is not justifiable given that Trump’s proposed wall would not stem the flow of drugs.

There’s a website of victims that says it’s “in honor of the thousands of American citizens killed each year by Illegal Aliens.” There are entries as recently as January, but fewer than 300 people are listed even though entries date as far back as 1994. The anecdotal stories are moving, but one would expect a much longer list if thousands of people were really killed each year.

Update, Feb. 22: A day after this fact check was published, we received the following statement from White House Principal Deputy Press Secretary Hogan Gidley:

“Stephen Miller’s comment is 100 percent correct because, sadly, thousands die every year from threats crossing our Southern Border. In the last two years alone, ICE arrested criminal aliens charged or convicted of approximately 4,000 homicides (and those are only the offenders authorities could track down). Three hundred Americans die every week from heroin overdoses – 90 percent of which enters from the Southern Border – and that horrific number doesn’t even take into account deaths from cocaine, fentanyl and meth pouring across at record amounts. This is a dangerous and deadly situation that needlessly kills thousands of Americans every single year – and while the sad statistical truth may not aid the Washington Post’s political agenda, the fact remains.”

(Regular readers know that this 4,000 figure is misleading in this context. It conflates charges and convictions, and there is no indication how long ago homicides may have taken place. As we noted, most drugs come through ports of entry.)

The Pinocchio Test

Miller is the senior presidential adviser responsible for immigration policy in the White House, so it’s especially important for him to stick to verifiable facts on such an important issue. There’s no evidence that thousands of Americans are killed by undocumented immigrants, especially in light of credible studies showing they commit crimes at lower rates than native-born Americans. He earns Four Pinocchios.

Before President Trump declared a national emergency on the U.S. southern border on Feb. 15, he cited concerns that the United States was being flooded with murderers, kidnappers and other violent offenders from foreign countries.

According to new U.S. Immigration and Customs Enforcement figures obtained by The Washington Post, the nation’s immigration jails were not filled with such criminals. As of Feb. 9, days before the president’s declaration, nearly 63 percent of the detainees in ICE jails had not been convicted of any crime.

Of the 48,793 immigrants jailed on Feb. 9, the ICE data shows, 18,124 had criminal records. An additional 5,715 people had pending criminal charges, officials said, but they did not provide details. ICE also did not break down the severity of the crimes committed by or attributed to detainees.

“It proves this is a fake emergency,” said Kevin Appleby, policy director at the Center for Migration Studies, a New York-based nonpartisan immigration think tank. “It really shows that what the president’s doing is abusing his power based on false information.”

We know that most of the migrants held in the “New American Gulag” (“NAG”) are neither security threats nor realistic dangers to our communities. From my experience many of those held because they are “criminals” have either relatively minor offenses (e.g., driving without a license) or even if the offenses were more serious have long ago completed criminal sentences and have been free in society without recurring problems.

So, why are the “non-criminals” being held in the NAG? Well, DHS would say it’s because they are threats to “abscond” before hearings, citing highly questionable “self-fulfilling” numbers opaquely generated by EOIR and DHS. But outside studies of DHS and EOIR statistics have shown a much different picture.

Individuals with lawyers and applications filed, particularly for asylum, who have the system and their obligations thereunder carefully explained to them in their own language, show up almost all the time for Immigration Court.

Likewise, migrants released on moderate bonds (in the $1.5 to $5K range — much lower than the current “national average”) also appear with regularity, as do those with ankle monitors and other “alternatives to detention.”

Thus, a reasonable Administration genuinely interested in the integrity of the Immigration Court process would severely curtail the use of civil immigration detention, particularly by private entities, which is both wastefully expensive and inhumane.

Instead, they would rely on a proven combination of lower-cost, more humane, and due process promoting alternatives:  getting applicants matched with lawyers, pro bono, low bono, or paid; encouraging individuals to locate in communities where lawyers, family resources, and NGOs are available; and using reasonable bonds, ankle monitors and other types of “call in monitoring” to help insure appearance at further hearings.

An improved Immigration Court system where all judges were uniformly fair, impartial, and courteous to applicants and their lawyers, and where asylum was granted more generously in accordance with the standards set forth in the Refugee Act of 1980, the Supreme Court’s decision in INS v. Cardoza-Fonseca, the BIA’s precedent in Matter of Mogharrabi, and the regulations establishing a strong presumption of future persecution for those who have been persecuted in the past would also help.

Hope tends to draw people. Hostility and bias understandably tend to repel them. As long as we have a U.S. Immigration Court that tolerates, and even aids, abets, and encourages, some biased, anti-asylum, unprofessional judges in the “Jeff Sessions mode” who deny asylum at rates exceeding 90%, it will lack credibility.

Without credibility and a demonstrable commitment to fairness, impartiality, and due process above the DHS’s and the Administration’s often questionable and other times downright bogus “enforcement priorities,” the system will continue to fail our country, inflict unjustifiable harm and suffering on the most vulnerable among us, and indirectly harm every one of us who believes in Constitutional Government and a firm commitment to respecting human rights. Critical examination of the Government’s positions against a rigorous standard of legality, reasonableness, and fundamenal fairness under the Due Process Clause of the Fifth Amendment to our Constitution is essential to an independent judiciary. It isn’t happening in today’s “captive” Immigration Courts. That’s a national disgrace that must be fixed.

Magdalene Menyongar’s day starts with a 5:30 a.m. conference call with women from her church. They pray together as Menyongar makes breakfast and drives to work, reflecting on everything they are thankful for.

But lately, the prayers have turned to matters of politics and immigration. They pray with increasing urgency for Congress or President Trump to act before Menyongar, 48, faces deportation to her native Liberia, where she fled civil war nearly 25 years ago.

In less than six weeks, the order that has allowed her and more than 800 other immigrants from the former American colony in West Africa to live in the United States for decades will end, the result of Trump’s decision last year to terminate a program that every other president since George H.W. Bush supported. Come March 31, Menyongar will face a choice: Return to Liberia and leave behind her 17-year-old daughter, an American citizen, or stay in the United States, losing her work authorization and becoming an undocumented immigrant.

Menyongar is among thousands of Liberian immigrants who were given temporary permission to stay in the United States in 1999, when President Bill Clinton implemented “deferred enforced departure.” DED was routinely extended by previous administrations but is set to end under Trump’s effort to terminate programs for immigrants without permanent status, which also has endangered Deferred Action for Childhood Arrivals and temporary protected status for immigrants from 10 other countries.

Temporary protected status, or TPS, was established by Congress in 1990 for citizens of countries suffering from war, environmental disaster, health epidemics or other unsafe conditions. They are given temporary permission to work in the United States and travel abroad without fear of deportation.

But that court action does not apply to the smaller and lesser-known DED program, which operates purely at the president’s discretion and gives no statutory basis on which to sue.

Without a change of heart from the president — or new legislation from Congress — Liberians living in the United States under DED will lose their work authorization and become subject to deportation. Instead of self-deporting, many are expected to stay in the United States in hopes of getting a hearing in immigration courts, a process that could take years.

But critics say his move to end protection for Liberians, leaving them undocumented after decades in the country legally, reflects an immigration policy that is capricious and, at worst, driven by racial bias.

“There comes a point where even if relief started as temporary, it needs to end with some possibility for permanence,” said Royce Murray, managing director of programs at the American Immigration Council, an advocacy group. “These are people who have built their lives here, have invested in their communities and are raising American citizens.”

Last week, a group of DED holders from Minnesota traveled to Washington to lobby representatives, and Democrats have responded with legislative efforts. Rep. Dean Phillips, a freshman Democrat who represents Menyongar’s Minnesota district, pushed unsuccessfully for a DED provision to be included in the spending bill Trump signed.

Opponents of the programs say they have outlasted their original intent, to provide temporary protection, and represent a misuse of executive authority.

RJ Hauman, government relations director at the Federation for American Immigration Reform, which favors reduced immigration and greater enforcement, calls DED and TPS “flagrant abuses of our immigration system.”

“Both of these ‘temporary’ designations have been on autopilot for years, with one unmerited, open-ended extension after another,” Hauman said. “These individuals should return to their homeland, which has since recovered, and use their skills to enrich Liberian society.”

Liberians don’t have to register with the federal government to qualify for DED, so there’s no reliable count of how many people depend on the program. But as of March 2018, approximately 840 had work authorization under DED, according to U.S. Citizenship and Immigration Services. Liberians must have lived in the United States continuously since 2002 or earlier to qualify.

Most of the original DED beneficiaries have since left the country, died or gained permanent status, Murray said. She estimates as many as “a few thousand” may remain in the country but have not renewed their optional work permits, which cost a total of $495 in annual fees.

Gabby’s primary focus these days is preparing for college, possibly in Atlanta to be close to her father’s family and escape the frigid Midwest winters. She said she didn’t understand that her mother could have to leave until last March, when Trump declared a one-year “wind-down period” for DED. She has told her best friend how worried she is about the situation but avoids talking about it otherwise.

A second family, a second home

Minnesota is home to the nation’s largest Liberian community, concentrated in the northwestern suburbs of Minneapolis. A few times each week, Menyongar makes a 20-minute drive to Bethel Robbinsdale — one of several Liberian churches in the Twin Cities area — where she serves as president of the women’s ministry.

After communion during a recent Sunday service, the band and choir struck up a euphoric tune while Menyongar joined the congregation in dancing through the pews. Dressed in a brightly colored jumpsuit and a turquoise head wrap, she exchanged handshakes and hugs along the way.

“The church is my second family,” Menyongar said. “It’s like a support system that we have for each other.”

Friday knows Menyongar isn’t the only member of his church who could face deportation, but he can’t say for sure how many will. Many keep their immigration status secret.

“These people, if you grant them permanent residence, they are going to be so patriotic,” Friday said. “The burden would be lifted off their shoulders to know that they can finally live a normal life.”

Liberian immigrants have taken prominent positions in Minneapolis and its suburbs, such as Brooklyn Center, which recently elected its first Liberian-born mayor. They moved in part for the job market — a shortage of nurses and other health-care workers drew many, like Menyongar, to work in hospitals and assisted-living facilities.

Mary Tjosvold, who owns group homes for seniors and people with disabilities, employs more than 150 Liberians. Although she does not track how many of her employees are protected by DED, she said losing even a few workers would have wide ripple effects.

“People have had these jobs for a long time. They’re important parts of businesses,” said Tjosvold. “On an economic basis, it doesn’t make any sense, no matter what you think politically.”

An end to the policy also has economic implications abroad. Remittances sent from those working in the United States to their relatives in Liberia act as “a source of de facto foreign aid,” said Paul Wickham Schmidt, a former immigration judge and current adjunct professor at Georgetown Law School.

Menyongar works a combined 60-plus hours each week at two nursing homes, and her paychecks support her 97-year-old mother and other relatives in Liberia.

Schmidt said the idea that Liberians losing DED will self-deport is unrealistic.

“My experience is that most people go home not because they’re threatened, but because they deem it in their overall best socioeconomic interest,” he said. “A lot depends on what faces you at home, which is why this administration’s policy doesn’t work.”

Mark Krikorian, executive director of the Center for Immigration Studies, a Washington think tank that supports sharp immigration restrictions, argues that a president should not be able to prolong temporary programs like DED without congressional approval. Even so, he said, “When we’ve permitted people to lawfully reside here for decades, it’s practically and politically and morally problematic to say, ‘Okay, now time is up.’ ”

Liberia has been emerging from war during the past 15 years and last year saw its first peaceful transfer of power since 1944. In a memorandum announcing the end of the temporary status, Trump wrote, “I find that conditions in Liberia no longer warrant a further extension of DED.”

Menyongar strongly disagrees with that assessment, citing violent crime, poor health care and infrastructure, and a lack of jobs in explaining why she could not return to her country of birth.

“The Liberia that I knew and grew up in is not the Liberia of today,” she said.

ANOTHER PERSPECTIVE: There Is Nothing Inherently Wrong With TPS Or DED — But, There Is Plenty Wrong With The Trump Administration’s Mistreatment Of 800 Long-Term Residents From Liberia

Far from being a “problem,” as Trump and his restrictionist “naysayers” like to falsely claim, the TPS/DED program for Liberians has been a tremendous success! With a little “Congressional tinkering,” it could easily become a model for resolving future humanitarian situations without overburdening the US asylum system and adding to the huge existing U.S. Immigration Court backlog.

The US was able to provide humanitarian assistance to at least 10,000 Liberians during the darkest time for their country. This was accomplished without the time, expense, and often inconsistent and unsatisfactory results of forcing them into the formal US asylum system.

While in TPS/DED, Liberians were able to work legally, pay taxes, raise their families, live in peace, and otherwise contribute to American society.  Over the years, many were over able to fit within our legal immigration system. Some died. Others found that with changes in Liberia, it made socio-economic sense for them to return there. A very few violated the rules of our hospitality and were duly arrested and removed after receiving Immigration Court hearings (most before the Trump Administration “trashed” due process in Immigration Court). The Government might even have turned a slight profit on the routine renewals of work authorization for which a fee was charged that probably exceeded the actual time it took to adjudicate them.

Now, we have approximately 800 long-term residents remaining who would like to stay here with their families, jobs, and communities. Passing the necessary legislative fix to allow them to get green cards should be a “bipartisan no brainer” — indeed if the Administration introduced and supported such a fix, it almost certainly would pass by huge margins and be signed into law. Presto — problem fixed and everyone wins! At a minimum, a rational Administration would exercise “prosecutorial discretion” (“PD”) to maintain the status quo and allow the few remaining Liberians to reside in the US and work legally pending good behavior and a legislative solution.

The law might or might not have been specifically designed for this outcome. But, wiser Administrations in the past used the available legal mechanisms along with Executive authority and common sense to solve human problems in a practical, efficient manner.  Thanks exactly what “good government” is supposed to do.

That the Trump Administration chooses to use laws selectively to create “bogus emergencies” and “engineer problems” where none existed, rather than solving problems in a way that promotes the common good, should be of concern to all of us who favor good government and humane solutions to humanitarian issues.

This cactus forest on the U.S.-Mexico border was quiet one recent day. No mass crossings of migrant families. No sprinters. Just two men caught sneaking into the Arizona desert.

Then U.S. Border Patrol Agent Daniel Hernandez spotted a youth alone under a juniper tree, dressed as if he were headed to church. When the agent approached, the boy quickly surrendered.

“Are you afraid?” Hernandez asked in Spanish. The youth nodded and said his name was Marco and that he was from Guatemala. He was 14 but looked small in an oversize jacket, pressed shirt and pants, and too-large black oxford shoes.

Hernandez lifted his sunglasses to appear less intimidating. He asked Marco who had left him, how he knew where the border was, and whether he carried food and water.

“Are you hungry?” he asked. “When was the last time you ate? Yesterday? You want a cookie?”

The deaths of two Guatemalan children in December and the massive groups of Central American families crossing the border are increasingly transforming the Border Patrol’s role from national security to humanitarian relief, even as President Trump declares the situation a national emergency.

Well over half the people taken into custody in recent months have been parents and children, with hundreds surrendering at a time, often in isolated locations. In other cases, youths such as Marco are dropped off by themselves. More than 1,800 Central American parents and children, a record high, crossed illegally last week on the day Trump went to El Paso to tout the need for a border wall.

Homeland Security Secretary Kirstjen Nielsen promised “extraordinary protective measures” following the deaths of Jakelin Caal, 7, and Felipe Gómez Alonzo, 8, who crossed into the United States with their fathers. Since then, the federal government says it has dramatically increased its medical staff at the border.

A Mexican man detained by U.S. Customs and Border Protection died this week at a medical facility, however. And advocacy groups warn that the remote areas where families are crossing, and the agency’s crowded detention facilities, still pose serious risks — especially for young children.

Medical teams from the Coast Guard, the Department of Health and Human Services, and new private contractors have been triaging and examining migrant children on the border. Border agents, hundreds of whom are also paramedics, are patrolling more far-flung areas, backed up by helicopters, buses and SUVs. The U.S. military has also helped with the evaluation and treatment of migrants.

“We’ve been adapting to these new realities,” said a senior adviser for Customs and Border Protection who was allowed to speak only on the condition of anonymity.

The deaths of Jakelin and Felipe remain under investigation, and the official said the Department of Homeland Security so far hasn’t found any sign of a widespread public health crisis on the border. The biggest challenge, Border Patrol agents say, are the large groups of migrants — 200 to 300 people at a time — crossing in distant locations, swamping the agency’s resources.

Fifty-eight large groups crossed from October to January, compared with 13 groups over the same period last year.

Some migrants arrive with colds, sprained ankles, broken bones, chicken pox and “gripe,” otherwise known as the flu. A toddler who fell from a moving vehicle in Mexico was brought to the U.S. border in January with a possible broken arm. A teenage girl cracked several vertebrae after slipping from an 18-foot-high border wall in December.

CBP has given Border Patrol agents “enhanced” field guidance to check every child — including those arriving in large groups — and ask if they are sick, injured, dehydrated or hungry. Agents have also stocked up on baby formula, diapers and women’s sanitary supplies in sectors such as Yuma, where 90 percent of border crossers in January were family members and unaccompanied minors.

Migrants who are ill are sent to a hospital. The rest are taken to Border Patrol stations for more-comprehensive screenings. Doctors and nurses check their vital signs, take their medical histories and administer medicine.

In one instance, on Jan. 24, the DHS flew in a physician and other staff via helicopter to a Border Patrol station in the Tucson sector to examine 130 minors. Two youths with high fevers were taken to a hospital.

Still, the huge numbers of families arriving carry significant risk, officials say, because many cross into the United States in less-populated areas, with few agents and limited or no medical facilities.

The CBP official said the agency is deploying general-practitioner physicians who can treat a wide array of people — including children and pregnant women. But the American Academy of Pediatrics said it has urged CBP Commissioner Kevin McAleenan to hire medics trained in pediatrics, or at least accept volunteer pediatricians, because children require more specialized care.

“Sick children are very different from adults,” said Colleen Kraft, the immediate past president of the academy, whose term ended Dec. 31. “If you don’t have the pediatric training . . . you’re going to miss those children who are becoming very, very ill.”

Doctors and advocates said young children should not be housed in cold and crowded processing cells, where migrants describe sleeping on mats on the floor under silver Mylar blankets.

“It’s a law enforcement mentality,” said Marsha Griffin, a pediatrician who volunteers at a shelter in McAllen, Tex., and the co-chair of the academy’s special-interest group on immigrant health. “They are treating people as prisoners, not as children and families.”

On a tour of the Border Patrol’s Tucson sector in January, agents did not allow a Washington Post reporter to visit the cells where migrants are held, citing privacy concerns. But some migrants recently released from those cells and dropped off in vanloads at a Tucson shelter praised the medical attention their children received in federal custody.

Julio, a schoolteacher from Guatemala, said his daughter Jakeline, 15, was taken to the hospital with the flu and had recovered.

“The care was excellent,” he said, speaking at Casa Alitas, a Catholic Community Services of Southern Arizona shelter on a palm-tree-lined street. Shelter officials asked that the migrants be identified only by their first names to protect their privacy.

Imagine what could be achieved if the Administration simply followed the law by getting enough Refugee Officers, Inspectors, Asylum Officers, Immigration Judges, Court Clerks, and Private Attorneys to process the cases fairly, efficiently, and in accordance with the law, our international obligations, and Due Process. Folks would be encouraged to apply abroad or at ports of entry. The Border Patrol could actually return to real law enforcement duties.

 

It wouldn’t cost anything close to $8 billion.  And it wouldn’t tie up the Federal Courts with avoidable litigation because of the Administration’s disrespect for the law, our Constitution, and Congressional intent.

 

It could happen.  But, not unless we change to a Non-White-Nationalist Regime. Essentially, everyone including the Border Patrol is being adversely affected by Trump’s bad, and ultimately unsustainable, restrictionist immigration policies.

IT IS hard to single out any single event in Donald Trump’s presidency as the most untethered from truth and reality. Still, Friday’s news conference, in which Mr. Trump tried to defend his end run around Congress based on a make-believe emergency at the southern border, was, to use the president’s own words, a “big con game.”

Mr. Trump’s technique is to spin fiction as fact, secure in the knowledge that minds will reel as fact-checkers labor to deconstruct his ziggurat of falsehoods. So let’s stick to one big, basic truth: There is no crisis at the southern border.

There is no crisis, and there is no justification to specifically and surgically contravene the will of Congress, which just weighed and dismissed Mr. Trump’s demand for $5.7 billion to build a border wall, opting instead to grant him $1.375 billion.

Fact: Illegal crossings between ports of entry, as measured by Border Patrol arrests along the Mexican border, have plummeted since the turn of the century, falling to just below 400,000 in the most recent fiscal year, from more than 1.6 million in 2000. That nose-dive in illegal crossings coincides with better economic conditions in Mexico and a major increase in Border Patrol agents, technology and infrastructure along the southwest frontier.

Fact: Most illegal drugs that enter the country from Mexico are discovered by authorities at legal crossing points, not in remote areas where a wall would serve as a deterrent. That was the case, according to U.S. Customs and Border Protection, for 90 percent of the heroin seized along the border. It’s not a Democratic talking point. Fact: The number of illegal immigrants in the United States has been falling for more than a decade, and two-thirds of those who remain have been here for more than a decade. An estimated 10.7 million unauthorized migrants were in the country in 2016, about 1.5 million fewer than in 2007, according to the Pew Research Center.

Fact: Mr. Trump, having conjured a nonexistent crisis, simply could not countenance his failure to persuade Congress to pay for his border wall. The source for this assertion is the president himself, who acknowledged in his news conference Friday that “I didn’t need to do this” and “I just want to do it faster.”

The emergency for Mr. Trump is purely political, impelled by expectations inflated by his campaign promises to build a border wall and force Mexico to pay. Having conflated a political crisis with a national one, Mr. Trump chooses to dodge, dissemble and lie. A self-respecting Congress would not let stand this manufactured emergency.

We shouldn’t think that just because 1) the courts  likely will stop Trump; and 2) even if they don’t, he’s too incompetent to build much wall anyway, no matter how long his regime lasts, everything “will be OK.”

The real tragedy and shameful disgrace is that with the time, money, and resources being squandered on “Trump’s fraud on America,” a competent “real” Administration could actually solve the problem in less time using current legal procedures.

A “real government” with those resources could:

  • Hire more Asylum Officers to do “credible fear” interviews;
  • Hire more U.S. Immigration Judges and Court staff to hear asylum cases in accordance with Due Process;
  • Provide lawyers for all asylum applicants; and
  • Hire more CBP Inspectors for Ports of Entry.

It’s not “rocket science;” it’s just using common sense to solve problems in accordance with the law, the (not alternative) facts, and without racist bias.

With competent apolitical professional management, which is undoubtedly available but unsought by this Administration, it could happen in the foreseeable future. And, unlike the “wall hoax,” a solution consistent with the law and due process actually would be as “durable” as anything can be in the 21st Century!

Today, a wall looms large in my thoughts. It isn’t the structure President Trump has in mind for our southern border. I’m thinking of the Wall of Honor at the African American Civil War Memorial, located at Vermont Avenue and U Street NW.

Listed on the wall are the names of 209,145 U.S. Colored Troops who fought during the Civil War. One of those names is that of Isaiah King, my great-grandfather.

I think of those courageous black men as America’s original “dreamers.”

Today’s dreamers are in their teens and 20s, having arrived in this country as children. King’s generation of dreamers were former slaves or descendants of slaves brought to these shores against their will.

However, the black men who fought in the Civil War had the same status as today’s dreamers: noncitizens without a discernable path to citizenship.

My great-grandfather was born in the slave-holding city of Washington in 1848, but his mother was a freed woman. She moved the family to New Bedford, Mass., when he was 4. Around the time of his 17th birthday, Isaiah King enlistedin the 5th Massachusetts Cavalry (Colored), thinking, “I would have it easier riding than walking,” he told the New Bedford Evening Standard in an interview on the eve of Memorial Day services in 1932.

Black men such as my great-grandfather signed on to fight for a Union in which the right to citizenship was reserved for white people. The Supreme Court ruled in Dred Scott v. Sandford, in 1857, that black people were not citizens of the United States. Putting it bluntly, the high court said black people were “so far inferior that they had no rights which the white man was bound to respect.”

In his book “The Fifth Massachusetts Colored Cavalry in the Civil War,” Steven M. LaBarre cited the first disparity: It was enshrined in the Second Confiscation and Militia Act of July 17, 1862, which authorized recruitment of black men into the Union army. The law stated that a “person of African descent [of any rank] . . . shall receive ten dollars per month . . . three dollars of which monthly pay may be in clothing.” White privates at the time received $13 per month plus a $3.50 clothing allowance. It wasn’t until July 15, 1864, that Congress granted equal pay to black soldiers.

Yet, serve they did.

As evidence of the regard in which they were held, LaBarre quoted Massachusetts Gov. John Albion Andrew’s commendation of the 5th Massachusetts Cavalry when it was launched: “In this hour of hope for our common country and for themselves; at a time when they hold the destiny of their race in their own grasp; and when its certain emancipation from prejudice, as well as slavery, is in the hands of those now invited to unite in the final blow which will annihilate the rebel power, let no brave and strong man hesitate. One cannot exaggerate the call sounding in the ears of all men, in whose veins flows the blood of Africa, and whose color has been the badge of slavery. It offers the opportunity of years, crowded into an hour.”

According to National Archives, by the end of the Civil War, roughly 179,000 black men were serving as soldiers — 10 percent of the Union army — and 19,000 served in the Union navy. Nearly 40,000 black soldiers died over the course of the war — 30,000 of infection or disease. By war’s end, 16 black soldiers had been awarded the Medal of Honor .

King came back to the capital in May 1864 as a private with the 5th Massachusetts Cavalry to defend the city against attack by Confederate troops. His unit participated in the Siege of Petersburg. They guarded Confederate prisoners at Point Lookout, Md. And his unit was among the first Union regiments to enter Richmond, capital of the dying Confederacy, on April 3, 1865.

The Civil War ended, but not his service. Three months later, the 5th Massachusetts Cavalry was sent to Texas to defend against threats from Mexico. (Sound familiar?) He was mustered out of service on Oct. 31, 1865, at Clarksville, Tex. — still not a citizen of the United States.

The men with names on the African American Civil War Memorial’s Wall of Honor fought and died to end two centuries of slavery, without being able to count democracy as their own.

For their descendants, the fight for full rights, for full participation in every part of our democracy, goes on.

That fight must continue on behalf of today’s dreamers, the disenfranchised, the demeaned and left out, and all freedom-loving people in this nation.

Thanks, Colby, for putting the current plight of “Dreamers” (and I might add refugees and other migrants who are serving, contributing, and building our society despite their disenfranchisement and the government-sponsored dehumanization being inflicted upon them) in the historical context of the fight for civil rights and human dignity in America.

That’s why the “21st Century Jim Crows” like Trump, Sessions, Stephen Miller, Sen. Tom Cotton, Rep. Steve King, and others (largely associated with the GOP) are so pernicious. Like the “Jim Crows of the past,” these guys use degrading racial stereotypes, intentionally false narratives, and bogus “rule of law” arguments to generate hate and bias, sow division, and use the law to suppress and violate rights rather than advancing them.

While sycophant DHS Sec. Kirstjen Nielsen does not appear to be an “ideological racist,” her mindless and disingenuous parroting of the Trump White Nationalist “party lies” and “enforcement” (read “de-humanization”) agenda certainly makes her a “functional racist.”

It’s quite outrageous and dangerous that individuals with these types of views have been elevated to powerful public offices in the modern era, after the death of Rev. Martin Luther King, Jr. When will we ever learn, when will we ever learn?

At President Trump’s big rally in El Paso on Monday night, you could see signs everywhere that proclaimed: Finish the wall.

Thats some amusingly dishonest sleight of hand — it’s meant to create the impression that the wall is already being built, which is a lie Trump tells regularly. Thus, it substitutes an imaginary Trump win for a real one, since apparently support for Trump among his voters on such an important symbolic matter is too delicate to withstand the unbearable prospect of him losing without withering or shattering.

Now that negotiators have reached an agreement in principle for six months of spendingon the border, however, its once again clear that Trumps win on the wall will remain firmly in the category of the imaginary.

It includes only $1.375 billion for new bollard fencing in targeted areas. Thats nothing like Trumps wall — it’slimitedto the kind of fencing that has already been built for years— and its substantially short of the $5.7 billion Trump wants. Its nothing remotely close to the wall that haunts the imagination of the president and his rally crowds. The $1.375 billion is slightly lessthan what Democrats had previously offered him. It cant even be credibly sold as a down paymenton the wall.

 Trump’s political and media allies are already in a rageover this point. And Trump may not accept the deal, or perhaps hell agree to it and try to find the wall money through executive action.

The compromise, to be clear, is a mixed bag for progressives. But on balance, based on what we are learning now, its plainly more of a victory than not.

 The deal will include substantialhumanitarian spending

A House Democratic aide tells me that negotiators also agreed that the deal would include “substantial” expenditures to address the humanitarian plight of migrants arriving at the border.

Such money would go toward medical care, more efficient transportation, food and other consumables,” to “upgrade conditions and services for migrants,as the original Democratic proposalat the start of conference committee talks put it.Democrats had called for $500 millionfor this purpose. It’s not yet clear how much the final deal will include, as negotiations are ongoing, but it is likely to be in the hundreds of millions.

The details on this spending will matter greatly. But if structured well, it could be significant. The goal would be to upgrade current facilities where migrants are held before entering the system, which were not designed to cope with a new type of immigration: the arrival of asylum-seeking families and children, which has spikedeven as adults looking to sneak across illegally — the type Trump mostly rages about — is at historic lows.

Such an upgrade could address some terrible things weve seen: migrant families herded into tight conditions, and migrant children stacked up on concrete floorsand at medical riskdue to a lack of transportation out of remote areas, or proper screening and treatment.

Here’s the bad news

Unfortunately, Democrats backed down on a core demand: a cap on Immigration and Customs Enforcement detention beds. Democrats hoped this would force ICE to focusresources on dangerous undocumented immigrants, thus picking up fewer longtime noncriminal residents.

But Democrats instead agreed to fund 45,000 detention beds. To understand this, note that ICE is currently overspending against last years budget, by funding around 49,000 beds. So relative to that, Democrats are cutting the number of beds. But as Heidi Altman notes, what Democrats agreed to is higher than the actual number of beds legitimatelyfunded last year. So thats a hike. And if there is no hard statutory cap on beds, ICE can find money elsewhere to fund extra beds, detaining more people than funding levels suggest. As one advocate told me, the deal contains no new controls on ICE overspending.

 Thats a very serious problem. But overall, if the humanitarian money turns out to be real, the emerging agreement could prove to be a far-from-perfect but nonetheless decent one.

Some of Trumps worst designs are getting frustrated

The larger context here is that Trump and top adviser Stephen Miller have pushed on many fronts to make our immigration system as cruel as possible. Theyd hoped to use the first government shutdown to force Democrats to agree to changes in the law that would make it harder for migrant children to apply for asylum, and easier to deport migrant children and to detain migrant families indefinitely.

The overriding goal behind such changes is to reduce the numbers of immigrants in the United States — not just through deportations, but also through deterring people from trying to migrate and/or apply for asylum. That was the goal of Trumps family separations, and after those were halted last year, he renewed the push for those other changes.

 Trump’s first surrender three weeks ago temporarily conceded that he would not be able to make those things happen. Now the new compromise suggests Republicans want him to agree to reopen the government for far longer, without getting those legal changes orthe wall.

We have yet to see the details in writing, but based on news reports, Id say this deal is a huge loss for Donald Trump and Stephen Miller,Frank Sharry, the executive director of the pro-immigrant Americas Voice, told me.

This deal has no money for his concrete wall and less money for barriers than was on offer last December,Sharry added. Trump tried to use a shutdown to force through radical policy changes, and at this point, Republicans are saying, ‘Let’s keep the government open and move on.’”

Sharry conceded that the failure to get detention bed caps is a real setback.But he also noted that in six months, Democrats can renew the battle for caps, now that a lot of lawmakers understand that ICE is detaining many more people than Congress funds. We live to fight another day.

Trump and Republicans suffered an electoral wipeout in an election that Trump turned into a referendum on his xenophobic nativist nationalism. He then used a shutdown to try to force the new Democratic House to accept both his wall and radical legal changes that would have made our immigration system far more inhumane. He isnt getting his wall or those changes, and it looks as though a lot of humanitarian money will be channeled to the border to address the actual crisis there.

 

In other words, the fake crisis that Trump invented — and with it, his broader immigration vision — is getting repudiated. The only question is whether Trump will agree to the surrender Republicans are trying to negotiate for him.

Bad news for Trump on immigration is great news for America!

And, don’t forget how Trump’s devotion to himself, first, foremost, and always, as opposed to our country or even his White Nationalist restrictionist supporters played out at the DOJ. Trump’s concern for his own skin caused him to unceremoniously dump loyal White Nationalist acolyte former AG Jeff “Gonzo Apocalypto” Sessions, the “role model” for Stephen Miller.

In fewer than two years on the job, Sessions managed to push for the White Nationalist restrictionist immigration agenda in every possible way. In a sea of ethically questionable behavior during his tenure at the DOJ, the “original sin,” in Trump’s eyes, was Sessions’s following DOJ ethical advice to recuse himself from the Mueller investigation. Ethics is a dirty word in the Trump world.

Fact is, the gangs are in many practical ways the “de facto government” in El Salvador. That makes Sessions’s suggestion that persecuted individuals can get reasonable protection from the government or avoid persecution in a tiny, totally gang-infested country absurdly disingenuous. It also calls into question the judicial integrity of those U.S. Immigration Judges who mindlessly “parrot” Sessions’s “parallel universe” dicta regarding conditions in El Salvador. Also, this article illustrates the absurdity of the position often taken by the BIA and some Immigration Judges that resistance to gangs is not a “political act.” In a country where gangs and government are inextricably intertwined, and gangs actually control more of the country than does the national government, of course resisting or publicly standing up against gangs is an expression of political opposition to those in power. And, it’s a political statement for which the consequences all too often can be deadly.

Matter of A-B- has yet to be tested in a Court of Appeals. But, it spectacularly “flunked” its initial judicial test before Judge Sullivan in Grace v. It’s important for advocates to press all challenges to Matter of A-B- in the Circuit Courts of Appeals. If appellate judges agree with Judge Sullivan, all of the erroneous “summary denials” of asylum based on A-B- will come back to Immigration Court for rehearings, thus further adding to the Administration-created mess in America’s most dysfunctional and fundamentally unjust court system, where Due Process for asylum seekers has become a bad joke rather than the watchword.

Public and private contractors running immigration jails violated federal detention standards thousands of times in recent years — including failing to report allegations of sexual assaults and staff misconduct to U.S. Immigration and Customs Enforcement — but were fined only twice, according to a report issued Friday.

The Department of Homeland Security’s inspector general called on ICE to improve oversight of facilities that detain roughly half the 45,000 immigrant detainees held every day across the United States, and to do a better job holding federal contractors accountable for their health and safety.

ICE defended its oversight in a letter to the Inspector General that was included in the report, and said generally it can terminate contracts or relocate immigrants if it believes facilities are unsafe.

ICE documented 14,003 violations from Oct. 1, 2015 through June 30 at 106 facilities nationwide, the report said. The fines assessed by the agency amountedto $3.9 million, or 0.13 percent of the more than $3 billion ICE paid to the contractors during that period.

One facility was fined after “a pattern of repeat deficiencies over a 3-year period, primarily related to health care and mental health standards,” the report said. Another fine followed a Labor Department order against the facility for failing to pay proper wages.

In other cases, the inspector general found, immigration officials granted waivers allowing some contractors to bypass detention standards or avoid punishment for violations. From September 2016 through July, 65 waivers were approved — most for indefinite time periods.

One waiver authorized a facility to use CS gas, or tear gas, even though it is 10 times as toxic as pepper spray.

The inspector general said immigration officials lacked formal policies to oversee waivers and that some officials “without clear authority” were granting them.

“Key officials admitted there are no policies, procedures, guidance documents, or instructions to explain how to review waiver requests,” the report said.

The inspector general issued a series of recommendations urging ICE to shore up its oversight of detention facilities and ensure paperwork is included in contracts that will make clear when the agency should impose penalties on contractors that fail to follow federal rules.

“ICE has a strong record of holding detention facilities accountable when deficiencies are identified,” spokesman Matthew Bourke said in a statement.

He said the waiver process in the inspector general’s report is a “rarely used mechanism.”

The report comes as the White House and Congress are preparing for a heated battle over detention funding, building a wall on the southern border and other aspects of President Trump’s immigration crackdown. This week, Democratic lawmakers unveiled a proposal to “significantly” reduce ICE detention beds, require more detention facility inspections, and limit ICE’s leeway to detain more immigrants than Congress allows.

The 106 facilities in the report housed an average of 25,000 immigrants a day as of fiscal year 2017. They are under ICE’s direct oversight. About 100 other facilities are run by the U.S. Marshals Service and are not included in the report.

ICE contractors are required to comply with detention standards that outline their responsibilities, the services they must provide to immigrants and what each facility must do to provide a “safe and secure detention environment for staff and detainees,” the report said.

As immigration policy hangs over the ongoing conflict over whether the government is going to remain open, there’s something missing from this discussion, something so fundamental that it’s quite remarkable that we all seem to have forgotten to even ask about it. The president is demanding his border wall, Democrats are fighting against him, and occasionally we bring up issues like the fate of the Dreamers and those here under Temporary Protected Status.

But what nobody asks is this: What kind of immigration system do we actually want?

Not what might happen in the next negotiation or what each side would be willing to give up, but what does each side see as the ultimate goal they’re working toward? If they could look forward ten or twenty years and say “This is where we should get to,” what would that look like?

It’s a vital question, because whatever we’re doing at the moment should be guided by our long-term goals. Once we understand what those goals are, we can think more clearly about where we should go after we get this whole shutdown ridiculousness behind us. And we all ought to be able to agree that there is some future we’re trying to arrive at, a point at which we have a system that works to our satisfaction and immigration isn’t something we’re constantly at each other’s throats about.

That may not be possible, but I’ll start with what liberals would like to see. There are certainly disagreements not just on the left generally but among immigration advocates as well, but there is a basic vision one can identify.

The first thing they want, of course, is to take the 11 million or so undocumented immigrants who are in the country now and give them a path to citizenship. That’s something even some Republicans agree with, and if you put requirements like learning English and paying back taxes on it, support becomes nearly universal.

Second, liberals would like to see an expansion of the legal immigration system, which is a consistent source of frustration and a driver of illegal immigration. When it can take decades to get approved to move to the United States, of course many people are going to opt for the illegal route, even if it can be dangerous and uncertain. If the legal immigration works, people will go through it and not around it.

And if you have a well-functioning legal system, you can make illegal immigration less attractive, with things like an E-Verify process that makes it harder to find work if you’re undocumented. There may always be some kind of black market for workers, but if you’re simultaneously offering people a legal path — both toward permanent residency and with temporary work visas for people who are looking only to make some money and then return to their home countries — it will be much smaller problem.

So in the liberal vision, we might end up with about the same number of immigrants coming into the country as we have now, it’s just that the overwhelming majority would be coming legally. We’d have security at the border, but we wouldn’t need ICE breaking down doors and tearing parents from their children’s arms. We’d have a robust system to evaluate asylum claims so we wouldn’t have to be throwing people in cages. We certainly wouldn’t pretend that one day there will be no more demand in the labor market for immigrant workers.

There are many Republicans who could be okay with that future, even if it wasn’t exactly what they wanted. But the conservative vision is complicated. For years, we heard Republican politicians say, “I’m for legal immigration. I’m against illegal immigration.” They may not usually have been advocating significant increases in legal immigration, but it’s important to remember that the current venomous hostility toward immigrants was not always the standard Republican position. Ronald Reagan and George W. Bush were both far friendlier toward immigrants than Donald Trump is.

Conservatives might disagree with this characterization, but as I see it, their ultimate goal is a system in which coming into the country illegally is utterly impossible, but levels of legal immigration don’t change much. In other words, we still have immigration, but the flow slows to a trickle. And the Trump administration is making attempts to drastically reduce legal immigration. With the president’s enthusiastic support, domestic policy adviser Stephen Miller is driving a nationalist agenda that seeks to drastically reduce the inflow of immigrants to the country and even looks for every possible means to deport both legal and undocumented immigrants, even if they’ve been living here for years or decades.

That’s a somewhat extreme position even within the Republican Party, but it does reflect a discomfort with immigration that is common on the right. It’s the cultural problem, the fact that many people just don’t like having contact with people who don’t look like them or don’t speak the same language they do or eat the same foods they do. Trump very skillfully played to that discomfort by essentially telling voters he could wind back the clock to the time when they were young, before all this disconcerting change happened. His targets were the people who say “I don’t recognize my country anymore,” and when he said he would make America great again, “great again” meant “like things were when you were young.”

That’s a demand that can never be satisfied, even if it’s only a portion of the Republican electorate that really dreams of an America where there are almost no new immigrants and most of those who are already here just disappear. Unfortunately, that portion currently not only controls the White House but exercises a veto over any attempt at comprehensive immigration reform, because the rest of the GOP is so terrified of them.

Which is why it’s highly unlikely that we’ll achieve such reform, even reform most Republicans could live with, without both houses of Congress and the White House in Democratic hands. But that will happen sooner or later. Then we’ll see if we can get closer to a solution that everyone can live with over the long run.

A PRESIDENCY WITHOUT INTELLIGENCE IS A THREAT TO OUR NATIONAL SECURITY: By Contrast, Individuals Seeking Asylum Through Our Legal System @ Our Southern Border Are No Such Thing — “None of the [U.S. intelligence] officials said there is a security crisis at the U.S.-Mexico border, where Trump has considered declaring a national emergency so that he can build a wall.”

— Here are five of the main issues where the intelligence community leaders broke with Trump:

  1. Coats “said that North Korea was ‘unlikely to completely give up its nuclear weapons and production capabilities,’ which the country’s leaders consider ‘critical to the regime’s survival.’ That assessment threw cold water on the White House’s more optimistic view that the United States and North Korea will achieve a lasting peace and that the regime will ultimately give up its nuclear weapons.’”

  2. None of the officials said there is a security crisis at the U.S.-Mexico border, where Trump has considered declaring a national emergency so that he can build a wall.”

I’ve been saying on “Courtside” for some time that the real existential threat to our national security is Trump. While the Administration has undoubtedly completely screwed up our asylum system at the border and in the U.S. Immigration Courts that has almost nothing to do with “national security.”

It’s simply a matter of common sense: We know (or should know) almost exactly what the number oF arrivals is going to be, particularly when they travel in slow-moving “caravans” that easily can be tracked and anticipated. We certainly could “funnel” almost all of them into the legal screening system for asylum.

Get the Inspectors and Asylum Officers down there to do the screening, and the necessary Immigration Judges, ICE lawyers, and defense counsel to decide cases of those screened in! Take lower priority cases, most involving long-term residents who have been here and likely will continue to be here for years, off the overcrowded Immigration Court dockets!

This would allow processing of the “new influx” in a timely manner, with full due process, and without creating more “Aimless Docket Reshuffling” in the Immigration Courts. It would also avoid the always ineffective, wasteful, and usually illegal “gimmicks” that the Administration has used to “game” the asylum system against applicants. And, certainly in this respect, getting more pro bono lawyers involved would be a much bigger help than more unneeded troops or Border Patrol Agents.  Let the Border Patrol go back to their job of apprehending those border crossers who aren’t turning themselves in at or near the border to apply for asylum. Stop wasting resources and solve the problem!

Meanwhile, we should all be scared by Trump’s disregard of the prudent advice of his “national security and intelligence team.”

Attorney  ’s client made a passionate case to the judge about our unjust system

This month, I went to court with José. He came to the United States without papers from Mexico when he was 15, in 1999. Now he has a wife, three kids and a job in construction in Raleigh, N.C. It all came apart when police pulled him over and arrested him for driving without a license. He soon landed in the Stewart Detention Center in Lumpkin, Ga. He fought his deportation case alone for several months before his family finally called my law firm.

We first told him we couldn’t take his case because he had no chance of winning, so ethically we couldn’t take his money. Most people in deportation proceedings have few if any options to stay in the United States through the immigration courts. I urged him to take voluntary departure, which enables people to leave the country without getting a deportation order on their records, so it is easier to come back legally in the future. But he told me he was certain that, if he could just tell the court his story, the judge would see that letting him stay was right and just and fair. I told him that our immigration system had many rules and laws, but little or no justice.

In truth, I think José knew he had no chance, and he knew he’d have to leave. But he didn’t want to leave quietly. We agreed that I would accompany him — I wouldn’t say “help,” because he could have realized his plan without me, and I didn’t charge a penny — but he would address the judge directly. One of the most important things I do as an attorney is to just be present. Since the immigration laws are so defective, and the judges often play by their own rules (routine bond requests are usually denied, and this Georgia court has one of the lowest approval rates for asylum cases in the country), and the detention/deportation centers are designed to break people’s spirits, often there is not much else that can be done. Based on what transpired, I’m glad I went.

José’s whole family came to support him — his wife and his kids and a friend. When we sat down at the bench, I told the judge that José would be speaking for himself. In immigration courts, migrants usually just answer questions, so the judge asked me if I was requesting to withdraw. I said I wasn’t: I was staying at the table, but José was going to do all the talking. And the judge, to his credit, heard him out.

The judge explained the law and what José would have to prove in order to win. Before hiring us, José had submitted an application, on his own, for “cancellation of removal.” There are four elements: He had to prove that he had been living here for more than 10 years, that he was a person of good moral character and that he hadn’t broken any laws that would bar him under the statutes from applying. José could show all of these things. But the fourth criterion is the hardest. José would have to prove that if he were deported, it would cause an “exceptional and extremely unusual hardship” to a spouse, parent or child who is a U.S. citizen or lawful permanent resident. Usually it means you have a child with cancer, or a spouse with a disability that makes them unable to work or support a family — something on that scale. If you can convince the court merely that your family would be made homeless or that your children would subsist on food stamps, that is not considered sufficient. That is just the usual hardship that deportees’ families experience.

Without missing a beat, José said to the judge, “I have the first three, your honor, but I do not have the fourth.” Turning around to look at his family, with obvious pride, he told the judge: “This is my family. These are my children. Everything I do, I do for them. But thankfully they are all healthy, which for the moment seems for some reason to be bad.” Truly, logic has no place in immigration court.

The judge said that, based on this testimony, he would have to deny his application for cancellation of removal. Still, the judge offered José voluntary departure and explained, as I had, that it would make it easier for him to return.

I had met with José’s wife, Maria, too, and explained “VD,” which is a safer option than exiting the nation through the usual deportation machinery. People who are deported to Mexico from Stewart and many other detention centers are just dumped on the border, where gangs await them. (People deported to other countries are flown.) They are often robbed, kidnapped, raped or killed. Those who take VD, on the other hand, don’t get to leave jail, but they fly back on a regular commercial flight.

The problem with voluntary departure, though, is the cost: You have to buy your own fare, and it is very expensive, currently around $1,250. Immigration and Customs Enforcement will accept only a “Y” class ticket, or a full-cost coach fare, which can often cost more than first class. José thanked the judge and declined. “The tickets cost a lot of money, and my family will need the money after I leave.”

Maria interjected, crying. “Take the voluntary,” she said. “Take the voluntary!” My client began crying, too, followed by his kids.

I decided to take a chance. I asked the judge if José could talk to his wife over the barrier. Any direct communication and especially physical contact is strictly forbidden in this courtroom. To my surprise, he agreed. So Maria came forward, and she and José started hugging and kissing and crying. The bailiff moved to intervene, but I just shook my head and mouthed the word “Please.”

The couple talked for a few minutes, and then José sat back down and offered that he would take voluntary departure. But he’d gotten to hug his 6-, 8- and 12-year-old children across the barrier. Imagine that. Humanity in what passes for a court. This is not usually how immigration cases go. The judge gave José 30 days to buy his ticket before he would lose the “privilege” of taking VD.

In the end, José sat there smiling. And proud. He was still smiling as his family left the courtroom. And smiling when he gave me a hug. He’d known all along he wouldn’t win, but he wanted to be able to call out the injustice. And the judge, who has low rates of approval for just about anything, heard him out. (Only 31 of 347 judges denied asylum claims at a higher rate, according to the Transitional Records Access Clearinghouse.) It wasn’t a victory, exactly. José wouldn’t be staying with his family. But speaking a truth, to a hostile power, is still a kind of achievement.

But it was a discordant one for such a ruthless corner of the law. And eventually the logic of our immigration system superseded his brave act.

This past week, according to a friend of his who called me to share the news, ICE came to his cell early one morning and said it would fly him to Mexico City; he wouldn’t even have to pay for his ticket. Then, that afternoon, officials came and handcuffed him, brought him to a room to wait with other detainees for several hours and deposited him on a bus. Not to the airport, as they had promised. They drove him to the border and dumped him out in Matamoros. I am looking into his legal options, because apparently no act of courage goes unpunished.

Thanks Marty, for giving us insight into the “parody of justice” that goes on daily in our Immigration Courts at the direction of a Department of “Justice” that long ago lost both its way and purpose and must be wrested from control of a major dysfunctional court system that it is so ethically and functionally unable to administer in anything approaching a fair and efficient manner.

I give the Immigration Judge credit for taking time to listen and allowing Jose to speak in court. In the toxic age of Trump, Sessions, Whitaker, and likely also Barr, Immigration Judges are pressured to prejudge cases and cut corners by denying claims without listening to the evidence to keep up with artificial “deportation quotas” imposed by Sessions and to keep up “productivity” which has replaced “guaranteeing fairness and Due Process” as the mantra of today’s “Clown Courts.”

On the other hand, there are alternatives available. The BIA precedents on what constitutes “exceptional and extremely hardship” are intentionally vague and subject to interpretation. How do I know? They were issued while I was serving as BIA Chair (one over my dissent).

They were supposed to be part of a group of cases, sometimes knows as the “basket of pain,” defining the term in a number of different contexts. But, after Ashcroft’s “Saturday Night Massacre” at the BIA “took out” those judges, including me, who sometimes ruled in favor of respondent’s positions, the project was abandoned. My remaining colleagues were afraid that ruling on anything so controversial, and particularly granting anything to a respondent, could be “career threatening,” probably with good reason. So, Immigration Judges were left to their own devices. Many of the BIA panels on the other hand, took a pretty hard line, all, of course, in unpublished decisions.

Coming to the Arlington Immigration Court from the BIA, I actually underwent some “culture shock.” In an early cancellation case, I was thinking that the respondents, although great folks who were doing good things for America and their citizen family, probably wouldn’t “make the cut” under the standards that my last BIA panel had been applying. But, when the Assistant Chief Counsel got up to make a closing, after I had given respondents’ counsel a rather “hard time,” I was surprised to hear an impassioned, well-reasoned, and well-supported plea joining counsel’s request for a finding of “exceptional and extremely unusual hardship” and granting the case. “It’s Recinas, not Andazola,” as we came to say in Arlington, after the names of the BIA precedents that appeared to reach conflicting conclusions.

Some Immigration Judges would have found that deprivation of the support of the “primary breadwinner” is “exceptional and extremely unusual hardship” and granted Jose cancellation of removal. And, some ICE Assistant Chief Counsel would have waived appeal. Just shows what a “crapshoot” justice has become in the Immigration Courts.

BS (“Before Sessions”) at the Arlington Immigration Court, the Assistant Chief Counsel would probably have offered “prosecutorial discretion” or “PD” to Jose. And, I would have encouraged Marty to take that offer and “live to fight another day.” I would have given Jose and his family my “bad things will happen if you screw up again in any way speech,'” “administratively closed” the case, and taken it off my docket. The court and both counsel would have saved time and Jose and his family could have gone on living their lives and contributing to America pending good behavior and an eventual legalization program by Congress.

Not a perfect solution to be sure. But, a fundamentally just one that allowed me, ICE, and the private bar to move on and deal with other higher priority cases that really needed my judicial attention.

Trump, Sessions, Nielsen and their White Nationalist Gang have stripped the Immigration Courts of whatever little sense of justice and judicial control remained. They intentionally have turned a struggling system into a totally dysfunctional and fundamentally unjust and unconstitutional one.

We can only hope that at some point the Article III Courts will have seen enough and will put this totally bankrupt system into “receivership;” or that some future Congress and a more competent and honest Administration will create an independent Immigration Court focused, as it should be, on fairness and Due Process. Until then, justice and logic will continue to be a bad joke in the “U.S. Clown Courts.” 🤡
