(CNN)When all else fails, lock up children.  That’s the message from the Trump administration, which on Wednesday announced a regulation allowing it to indefinitely detain migrant families who arrive at our southern border. The new rule would replace a court agreement known as the Flores settlement, which sets minimum standards for migrant children in government custody, and limits their detention to 20 days.

Speaking at the White House, President Trump told reporters that his new rule will “make it almost impossible for people to come into our country illegally.”

What the rule won’t do is help solve the humanitarian crisis at the border. The new rule is legally and logistically suspect.  The only thing it guarantees is that more children will suffer greatly.

For decades, the treatment of detained migrant children has been governed by the Flores settlement. Aside from limiting the length of time that the government can keep immigrant children in custody, it mandates that kids be kept in the least restrictive setting possible, and that they receive food, water and other basic services.

Acting Secretary of the Department of Homeland Security Kevin McAleenan said the Flores settlement has been the driving force behind unauthorized migration from Central America to the U.S. “This single settlement has substantially caused, and continues to fuel, the current family unit crisis… until today,” he said Wednesday.

But he has no data to back him up.  On the contrary, ample research shows that the migrants are driven here by violence, gang activity, poverty and civil instability in Guatemala, Honduras and El Salvador.

As they have done throughout American history, people are fleeing for their lives from dangerous nations to seek safety, a new start and better lives in our country. They are not rushing to the US to take advantage of Flores.

Members of the Trump administration are fond of characterizing the Flores settlement as a “loophole” in need of fixing.

Not true.

The Flores settlement began as a 1985 class-action suit against the Immigration and Naturalization Service, the  predecessor to the Department of Homeland Security, over its treatment of migrant children. It took 12 years of litigation and negotiation to reach the final agreement in 1997.  The settlement was painstakingly crafted by immigrant advocates and government lawyers and has endured through Republican and Democratic administrations.

Getting rid of the Flores settlement would allow the government to lock children up for as long as their immigration cases take to resolve.  This is chilling and simply inhumane, and not just because detention centers have repeatedly been found to be crowded, dirty and unsafe. Just this summer, DHS’s own inspector general found conditions at migrant detention centers to be “an immediate risk to the health and safety” of detainees.

Beyond that, doctors and child welfare experts are unanimous in their conclusion that imprisoning children harms their physical, emotional and psychological development. At least six migrant children have died in the Trump administration’s custody. Why would anyone want to place kids in detention for longer periods of time?

Replacing Flores would also amount to a logistical nightmare. The US has three family detention centers with a combined capacity of about 3,000. Contrast that with the roughly 432,000 MEMBERS OF “family units” arrested at the border between October and July, according to Customs and Border Protection.  It defies reality to think that the administration could possibly come up with safe places to house such large numbers of people for long periods of time.

Instead they should be screened and processed in a timely manner, then released to family members or sponsors.  The vast majority of children and families seeking asylum show up for their court dates when they receive appropriate support, like the kind they received through the Ice Family Case Management Program. Yet the Trump administration abruptly terminated this program in June 2017,  indicating a lack of good faith in ensuring that migrants receive proper assistance and guidance with their immigration cases.

“No child should be a pawn in a scheme to manipulate our immigration system,” said McAleenan. He’s right.   But it is the Trump administration that is using children as pawns to further its xenophobic agenda. Central Americans have the legal right to apply for asylum, and families should not face indefinite detention for exercising this right.

The administration’s new rule is sure to face significant legal challenges. In fact, a federal court judge recently affirmed that using detention as a deterrent to seeking asylum is an unconstitutional violation of due process.

With all of their cruel and wasteful gimmicks, schemes, and illegal actions, the one thing the Trump Administration has been unwilling to do is just follow existing law:  Allow asylum applicants of all nationalities to be fairly and timely processed through the existing system under the law as it existed before the Trump Administration twisted it for the specific purpose of discriminating against legitimate asylum seekers. Then, we’d all finally know whether or not the individuals fleeing the Northern Triangle are “refugees” or something else. But, the Trump Administration won’t allow that to happen because it fears the answer.

Moreover, we should always keep in mind that even those who don’t meet the highly technical international definition of “refugee” might still be in real danger of harm or death upon return. They consequently could be strong candidates for some other type of temporary humanitarian protection (e.g., TPS, extended voluntary departure, prosecutorial discretion) short of asylum.

Also, as Reyes correctly points out, to maintain that a 20 year old consent decree in Flores, carefully developed and agreed upon among the Government, advocacy groups, and the U.S. District Judge to implement “best practices” in lieu of having the Judge unilaterally force the Government to take corrective action to meet basic constitutional standards, is the cause of a continuing Central American migration that has been happening to some extent or another over the past four decades, is beyond absurd. Indeed, the Government undoubtedly entered into the Flores consent decree to save itself from what almost certainly would have been a major litigation defeat on the merits and a public judicial rebuke of their unconstitutional treatment of minor children (which the Solicitor General probably would have declained to appeal to the 9th Circuit).

Only someone as disingenuous and subservient to Trump as “Big Mac With Lies” could possibly put forth such a ridiculously bogus theory in public with a straight face. Judge Gee should hold Big Mac and the rest of his White Nationalist restrictionist gang at DHS, DOJ, and the White House in contempt of court for even putting forth such a pack of lies (but, she won’t).

WASH­ING­TON—The Trump ad­min­is­tra­tion moved to al­low the gov­ernment to in­def­i­nitely de­tain fam­i­lies cross­ing the U.S.-Mex­ico bor­der and su­persede a decades-old court set­tle­ment that both lim­its how long mi­grant chil­dren can be held in cus­tody and sets stan­dards for their care.

The new rules are the Re­pub­li­can ad­min­is­tration’s lat­est ef­fort to tighten im­mi­gra­tion laws on its own, with Con­gress long un­able to agree on any le­gal over­haul. Wednesday’s pol­icy change could per­mit au­thor­i­ties to de­tain fam­i­lies through the du­ration of their im­mi­gra­tion pro­ceed­ings, rather than re­lease them or sep­a­rate chil­dren from their detained par­ents.

Im­mi­gra­tion-rights ad­vo­cates are ex­pected to chal­lenge the rules in fed­eral court, where they have blocked the ad­min­istra­tion be­fore. A le­gal chal­lenge would likely keep the pol­icy from tak­ing im­me­di­ate ef­fect.

As Michelle points out, McAleenan and his corrupt DHS flunkies are simply “making it up” as they go along to justify unconstitutional, racist policies intended to target legitimate asylum seekers based on the color of their skin. By continuously doing “in your face” moves, often with little expectation of success in the in the courts, but a great expectation of rallying racial animosity for political gain, Big Mac & Co. are misusing their access to Federal Courts, constantly violating their oaths of office, and making a mincemeat out of Federal and State professional ethics rules.

Contrary to Big Mac’s false blather, the “solution” to the exodus of refugees is straightforward and not prohibitively expensive:

  • Release them to community placements;
  • Help them find pro bono lawyers;
  • Ask judges to schedule court cases at the earliest possible date consistent with the legitimate needs of those pro bono lawyers;
  • See what happens on the merits of their asylum cases in a fairer, non coercive system where applicants are encouraged to fully develop claims assisted by lawyers who understand the complexities of asylum law. (This is actually the way the U.N. Convention-based system is supposed to work, but too often doesn’t).

As I have pointed out before, even with unabashed bias and the open encouragement by the Trump  Administration of blatant anti-asylum adjudications, a significant number of represented Central American applicants continue to win their claims both before the Asylum Office and in Immigration Court.

Without the effects of intentionally coercive detention, and gimmicks intended to limit access to counsel and inhibit preparation, many of those who lose in Immigration Court will have a fair opportunity to exercise their legal rights to pursue their claims before Article III Appellate Courts. While far, far too deferential to flawed agency decision makers, the Article IIIs are much closer to operating as fair, impartial, and unbiased decision-makers than are Immigration Judges working for Barr and his White Nationalist regime. 

Over time, I think many more asylum seekers will win their claims. But, whether that happens or not, the process will have more legitimacy. U.S. asylum law will come to represent more than the Administration’s anti-asylum ideology. Those who lose their cases after exhausting their legal avenues for appeal can be removed in a dignified and humane manner after receiving full Due Process. 

This incident also graphically illustrates the “reward” received by those Democrats who recently worked in good faith with the Administration to pass “emergency border funding.” Rather than returning that good faith by using funds to improve conditions in detention and to explore the many available options to reduce the instances of detention, the Administration is squandering money in an almost certain to be DOA attempt to expand their White Nationalist Gulag to unnecessarily punish more (Hispanic) families for asserting their legal rights to apply for protection under U.S. laws.

I have seen little or no evidence that this “emergency funding” — falsely advertised as “necessary” to put food in kids mouths and provide them medical care — has been used for those purposes. By all reliable accounts, conditions in DHS detention remain intentionally deplorable. Instead of working in good faith with public interest groups and Democrats to solve the problems with border detention, Big Mac & Co. are off wasting time and abusing their publicly funded salaries by spreading lies and insulting the intelligence of Federal Judges. 

Indeed, Big Mac regularly ignores the overwhelming body of medical evidence that any amount of detention has potential lifetime adverse effects upon young people. The idea that the “Flores settlement,” which has been in effect for years prior to the Trump regime, is primarily responsible for fueling a surge of children fleeing the Northern Triangle is beyond absurd. Moreover, as Big Mac is undoubtedly aware, the increase in child refugees is part of a worldwide trend that transcends any particular U.S. court settlement. Actually, it’s the dumb policies of the Trump Administration and their insistence on using gimmicks rather than the legal mechanisms available that has fueled the profits of smugglers.

Enough! This Administration simply cannot be trusted on anything involving immigration and humanitarianism. Democrats need to demand fundamental, demonstrable changes at DHS, including a phase out of most civil detention, and a commitment to fair access to the legal system, as a condition for providing any further funding.

The Supreme Court Friday night on a 5 to 4 vote revived the Trump administration’s plan to use $2.5 billion in Pentagon funds to build part of the wall project along the southern border.

The court’s conservatives set aside a U.S. Court of Appeals for the 9th Circuit ruling for the Sierra Club and a coalition of border communities that said a reallocation of the Defense Department money would violate federal law.

The unsigned ruling by the Supreme Court said the government “made a sufficient showing at this stage” the groups did not have proper standing to challenge transfer of money.

In a 2-to-1 decision earlier this month, the 9th Circuit majority noted that a stalemate between Congress and President Trump over the issue prompted the longest government shutdown in history. The judges reasoned that Congress made its intentions clear by allocating only about $1.4 billion for enhanced border protection.

The lower court said the public interest was “best served by respecting the Constitution’s assignment of the power of the purse to Congress, and by deferring to Congress’s understanding of the public interest as reflected in its repeated denial of more funding for border barrier construction.

After Congress’s decision earlier this year, Trump announced plans to use more than $6 billion allocated for other purposes to fund the wall, which was the signature promise of his presidential campaign

Environmentalists and the Southern Border Communities Coalition immediately filed suit to block the transfer of funds. Democrats in the House of Representatives filed a brief supporting them.

U.S. Solicitor General Noel Francisco told the Supreme Court that the 9th Circuit ruling was wrong. “The sole basis for the injunction — that the Acting Secretary exceeded his statutory authority in transferring the funds — rests on a misreading of the statutory text,” Francisco wrote. He was referring to Patrick M. Shanahan, who was acting secretary at the time.

Francisco said that the challengers did not have proper legal standing to challenge the transfer of funds. He added that even if they did, their “interests in hiking, birdwatching, and fishing in designated drug-smuggling corridors do not outweigh the harm to the public from halting the government’s efforts to construct barriers to stanch the flow of illegal narcotics across the southern border.”

The money was transferred from DOD personnel funds in response to a request from the Department of Homeland Security. Federal law allows such transfers for “unforeseen” reasons and for expenditures not previously “denied by the Congress.”

The administration contends that Congress did not reject the specific expenditures at issue, which would fund projects in California, New Mexico and Arizona.

The challengers said Congress was clear.

“Congress recently considered, and rejected, the same argument defendants [the government] make here: that a border wall is urgently needed to combat drugs,” said the brief from lawyers at the American Civil Liberties Union, which represented the groups.

“If defendants were nonetheless permitted to obligate taxpayer funds and commence construction, the status quo would be radically and irrevocably altered.”

The brief from the U.S. House of Representatives agreed.

“The administration refuses to accept this limitation on its authority, as clearly demonstrated by Acting White House Chief of Staff Mick Mulvaney’s statement that President Trump’s border wall ‘is going to get built with or without Congress,’ ” House General Counsel Douglas N. Letter wrote. “Under our constitutional scheme, an immense wall along our border simply cannot be constructed without funds appropriated by Congress for that purpose.”

And Letter said that the administration’s view of who is within the “zone of interest” to have standing to sue is “in reality, an argument that no one can challenge the conduct at issue here.”

Francisco moved quickly after the 9th Circuit’s July 3 ruling to ask the Supreme Court to dissolve the lower court’s injunction. It asked the justices to rule before July 26, so the Defense Department would have time to finalize construction contracts before the end of the fiscal year on Sept. 30.

Otherwise, he said, “the remaining unobligated funds will become unavailable.”

The challengers said the money already was unavailable.

The brief filed by the House said the money would not be lost, but would simply go back into the treasury, where the administration would again be free to make its request to Congress.

It noted there was no rush. “The administration has apparently completed only 1.7 of the 95 miles of border fencing Congress approved and appropriated funds for in fiscal year 2018,” it said.

The case is Trump v. Sierra Club, et al.

For those outside the legal community, “lack of standing” is often a legalistic ruse used by spineless judges who want to reach a particular result without explaining any real rationale on the actual merits of the case.

I just read another article by Andrew Sullivan about how our system is failing to hold Trump accountable for his lawless actions. http://nymag.com/intelligencer/2019/07/andrew-sullivan-the-american-system-is-already-failing.html.

I don’t agree with everything Sullivan says. In particular, his criticism of Democrats seems over the top. While the party has its failings, they only control 1/6 of the Government. Trying to leverage that into a strategy that preserves the American Republic by defeating Trump in 2020 is an essential endeavor, not an exercise in tilting at windmills. 

But, Sullivan’s “bottom line” might be disturbingly “on point:” 

The awful truth is that the American constitutional system is failing on almost every level. The system, it turns out, is not even strong enough to withstand one Trump term, let alone two. Trump intuited this in 2016, and if he wins reelection, as he now has a good chance of doing, what’s left of liberal democracy will be under acute duress.

The “extinction-level event” that I feared in the spring of 2016 is already here. Look around you. And it wasn’t even a fight.

upremes themselves to “short circuit” the lower Federal Courts in an unprecedented manner contributes mightily to the demise of the rule of law.

Chief Justice Roberts might self-righteously and self-servingly proclaim that there are no “Democratic Judges” or “Republican Judges.” But, actions speak louder than words, Chiefie!

The pathetic performance of Roberts and his fellow GOP appointees in this case gives lie to his claim. And Trump, for all his failings, sees and is willing to use the sad truth that Roberts denies in a never ending attack on our country and our supposedly governing principles.

It started with the “conservative” Justices’ outrageous abdication of duty in the “Travel Ban Case.” Rather than standing up to a President who spewed obvious lies, racism, and anti-Muslim venom in support of a political agenda that clearly violated Constitutional norms, the majority signaled that as long as Trump gave them “cover” by asserting clearly contrived and fabricated “national security” grounds, they would give him a free hand to destroy the nation. These “cowardly false conservatives” now find themselves presiding over the demise of our legal system.  

And, while they might feel that they are above paying attention to the human carnage caused by the their intransigence and dereliction of duty, that misbegotten “Travel Ban” majority opinion has caused, and continues to cause, trauma and probably death to innocent refugees caught up in Trump’s unconstitutional racist onslaught.

Trump has a history of turning against those who have served him, but outlive their usefulness. Who will the “GOP Gang of Five Justices” look to for protection when the screw turns again and they become the “aliens,” stripped of their rights and humanity in Trump’s (Not So) “Brave New World?”

Those who fail to stand up to tyranny and protect the rights of others might find themselves unprotected in their hour of need!

Ninth Circuit ruling could wipe out hundreds of family separations convictions

WASHINGTON — A federal appeals court in California substantially narrowed the government’s ability to charge people for crossing the border illegally — a case that could invalidate hundreds of prosecutions that were at the core of the Trump administration’s separations of migrant families last year.

The ruling comes as the federal law in the case, which makes it a crime to cross the border without authorization, is under scrutiny in the Democratic presidential campaign, with several candidates arguing it should be done away with altogether.

Wednesday’s ruling by a three-judge panel of the Ninth U.S. Circuit Court of Appeals in Pasadena could bolster the Democrats’ argument that the Trump administration is misusing the law to criminalize well-intentioned immigrants seeking asylum. It also adds further questions to the administration’s widely criticized prosecutions that resulted in thousands of family separations last year.

The Justice Department did not respond to a request for comment Thursday.

The 2-1 decision overturning a lower court ruling concerned the provision of U.S. law that makes improper entry to the country a misdemeanor, punishable by up to six months in jail. The law has three parts: entering the U.S. at an improper time or place, eluding immigration officers or entering the U.S. using false pretenses.

In an opinion written by Judge Jay Bybee, a George W. Bush-appointee, the court decided that the second part — eluding officers — could only apply to immigrants who are at a valid border crossing but who try to enter by evading detection, not immigrants picked up on the U.S. side having crossed somewhere else. That was the case with Oracio Corrales-Vazquez, a Mexican national whom officers found hiding in bushes miles from the border, whose conviction the court overturned.

Because part one of the statute already covers immigrants who surreptitiously enter where there is no legal crossing, the court held, the second part must exist to cover some separate activity. Otherwise, the court said, it would be redundant.

Circuit has already held that part one of the illegal-entry crime — entering at an improper time or place — does not apply to people who cross the border where officials can see them, in person or over cameras, and then seek out an officer and claim asylum. Those migrants are clearly not trying to avoid detection, court rulings have held.

It has become standard practice for federal authorities in Southern California to charge border crossers only using part two to avoid the defense to part one, said Kara Hartzler, an attorney with the nonprofit San Diego Federal Defenders who brought the case. Now, federal attorneys will not have part two as a back door to charge asylum seekers with illegal entry.

The court ruling means thousands of similar convictions could be thrown out, including hundreds that were the basis for family separations the Trump administration carried out last summer in the name of prosecuting a crime.

“All of the criminal cases that led to being separated from their families, … at least in San Diego, are at least convictions where the person was actually innocent because of this ruling,” Hartzler said.

David Leopold, a former president and general counsel of the American Immigration Lawyers Association, recalled then-Homeland Security Secretary Kirstjen Nielsen telling Congress the family separations were justified because the adults taken into custody had been charged with illegal-entry crimes.

“Well, here they weren’t even prosecuting those cases correctly,” Leopold said. “It puts a question mark next to every one of those convictions, which led to separation of children and in some cases the permanent separation of child from parent.”

The Trump administration separated thousands of families in the two months the program was in effect, before the president stopped it and a federal judge in San Diego ruled the practice was unconstitutional. In hundreds of those cases, parents were deported without their children, many of whom will not be reunited as the youths pursue a right to stay in the U.S.

The Justice Department does not make prosecution data public that would identify how many separated families could be affected by Wednesday’s ruling, but there could be hundreds of such cases. Nearly 4,000 immigration-related offenses were brought in the Southern District of California in 2018, according to court data, of which the most common charge is illegal entry.

The ruling also comes as some Democrats are attacking the notion that crossing the border should be a criminal rather than civil offense. Former Housing Secretary Julián Castro has made repealing the law a central focus of his presidential campaign, pointing to the Trump administration’s use of the law as a justification for separating the families last year. Twelve Democratic candidates have embraced the idea, according to a Politico tracker.

Castro and other critics of the law say it criminalizes asylum seeking. Other parts of the law make clear that an immigrant can file an asylum claim regardless of whether they entered the country legally.

Bill Hing, professor of law and migration studies at University of San Francisco, supports Castro’s arguments to remove the criminal part of the law, saying deportation is “already a pretty severe penalty” for anyone found not to have a valid asylum claim.

“Especially now, the vast majority of people gathered at the border are coming to seek protection — why criminalize that activity?” Hing said. “The statute should require something much more criminal in intent, and when it’s just simply to cross the border to seek protection, I think there’s a good argument that we should decriminalize that activity.”

The ruling applies only to the nine states covered by the Ninth Circuit, including California and Arizona along the Mexican border. But Hing says lawyers could seek similar rulings in other border states.

“Conceptually it actually makes sense,” Hing said. “It doesn’t make sense to have two parts of a law where the same act could qualify for the violation of both.”

Unfortunately, this much needed decision comes too late for many families who have been irreparably damaged by “Gonzo Apolcalypto’s” vile illegal and immoral abuse of Government prosecutorial authority. It’s too bad that there does not appear to be any way of holding “Gonzo Apocalypto” Sessions personally liable for his abuse of office, unconscionable distortion of our justice system, and the lifetime damage he inflicted on so many innocent children and families.

LOS ANGELES — A federal judge on Wednesday ordered the Trump administration to continue accepting asylum claims from all eligible migrants arriving in the United States, temporarily thwarting the president’s latest attempt to stanch the flow of migrants crossing the southern border.

Judge Jon S. Tigar of the United States District Court in San Francisco issued a preliminary injunction against a new rule that would have effectively banned asylum claims in the United States for most Central American migrants, who have been arriving in record numbers this year. It would have also affected many migrants from Africa, Asia and other regions.

The decision came on the same day that a federal judge in Washington, hearing a separate challenge, let the new rule stand, briefly delivering the administration a win. But Judge Tigar’s order prevents the rule from being carried out until the legal issues can be debated more fully.

The rule, which has been applied on a limited basis in Texas, requires migrants to apply for and be denied asylum in the first safe country they arrive in on their way to the United States — in many of the current cases, Mexico — before applying for protections here. Because migrants from Honduras, El Salvador and Guatemala make up the vast majority of asylum seekers arriving at the southern border, the policy would virtually terminate asylum there.

“This new rule is likely invalid because it is inconsistent with the existing asylum laws,” Judge Tigar wrote in his ruling on Wednesday, adding that the government’s decision to put it in place was “arbitrary and capricious.”

The government, which is expected to appeal the decision, has said that the rule intends to prevent exploitation of the asylum system by those who unlawfully immigrate to the United States. By clogging the immigration courts with meritless claims, the government argues, these applicants harm asylum seekers with legitimate cases who must wait longer to secure the protection they deserve.

Under the policy, which the administration announced on July 15, only immigrants who have officially lost their bids for asylum in another country or who have been victims of “severe” human trafficking are permitted to apply in the United States.

Hondurans and Salvadorans have to apply for asylum and be denied in Guatemala or Mexico before they become eligible to apply in the United States, and Guatemalans have to apply and be denied in Mexico.

The policy reversed longstanding asylum laws that ensure people can seek safe haven no matter how they got to the United States. On July 16, the day the new rule went into effect — initially in the Rio Grande Valley of Texas — the American Civil Liberties Union challenged the policy in court in San Francisco. The case in Washington was filed separately by two advocacy organizations, the Capital Area Immigrants’ Rights Coalition and Refugee and Immigrant Center for Education and Legal Services, or Raices.

“The court recognized, as it did with the first asylum ban, that the Trump administration was attempting an unlawful end run around asylum protections enacted by Congress,” said Lee Gelernt, the A.C.L.U. lawyer who argued the case in San Francisco.

The groups challenging the rule argued that immigration laws enacted by Congress expressly state that a person is ineligible for asylum only if the applicant is “firmly resettled” in another country before arriving in the United States. The laws also require an asylum seeker to request protection elsewhere only if the United States has entered into an agreement with that country and the applicant was guaranteed a “full and fair procedure” there, they said.

Judge Tigar agreed. “The rule provides none of these protections,” he said in his ruling.

During a hearing in the case on Wednesday, a lawyer for the Justice Department, Scott Stewart, said that a large influx of migrant families had spawned a “crisis” that had become “particularly stark” and created a “strain” on the asylum system.

“Migrants understand the basics of the incentives and are informed about how changes in law and policy can affect their options,” Mr. Stewart told the judge.

Judge Tigar voiced concern about forcing asylum seekers to apply for protection in Mexico or Guatemala. “We don’t see how anyone could read this record and think those are safe countries,” he said, referring to the rule’s language that migrants must apply to the first safe country.

The judge also said that the government did not address the “adequacy of the asylum system in Guatemala,” which is not equipped to handle a surge in applications.

Charanya Krishnaswami, advocacy director for the Americas at Amnesty International, said it was inhumane and cruel to force people fleeing violence to seek safety in places that are as dangerous as the homes they fled. “Everyone seeking protection has the right to humane treatment and a fair asylum process under U.S. and international law,” she said.

In federal court in Washington, two advocacy groups made similar arguments against the new policy.

But that judge, Timothy J. Kelly, found that the groups did not sufficiently support their claim that “irreparable harm” would be done to the plaintiffs in the case if the policy were not blocked. While the rule would affect migrants seeking asylum, the judge said, “the plaintiffs before me here are not asylum seekers.”

“They are only two organizations, one of which operates in the D.C. area, far from the southern border,” he added.

In recent years, the number of migrants petitioning for asylum has skyrocketed.

Migrant families and unaccompanied children have been turning themselves in to Border Patrol agents and then requesting asylum, which typically enables them to remain in the United States for years as their cases wind through the backlogged immigration courts. Only about 20 percent of them ultimately win asylum, according to the government, and many of those whose applications are rejected remain in the country unlawfully.

The administration announced the new asylum policy despite the fact that Guatemala and Mexico had not agreed to the plan, which means those countries have made no assurances that they would grant asylum to migrants intending to go to the United States. Talks with Guatemala broke down and the country’s president, Jimmy Morales, backed out of a meeting that had been scheduled for July 15 at the White House. On Wednesday, President Trump said that his administration was considering imposing tariffs on Guatemalan exports or taxing money sent home by migrants.

The new asylum rule is just one of many efforts by the Trump administration to curb the entry of migrants.

At ports of entry, Customs and Border Protection agents have significantly slowed the processing of applicants through metering — limiting how many migrants are processed to as few as a dozen per day.

And some 16,000 migrants are waiting in Mexican border towns like Tijuana under a policy commonly referred to as “Remain in Mexico,” which forces asylum seekers to wait in Mexico until the day of their court hearing. The policy makes it more difficult for the migrants to secure a lawyer to represent them in the United States, undermining their chances of winning protections.

In November, President Trump unveiled a separate policy that banned migrants from applying for asylum if they failed to make the request at a legal checkpoint. Judge Tigar, who was also hearing that case, issued a temporary restraining order blocking that rule. The case is currently on appeal in the Ninth Circuit.

Judge Tigar has been on the front lines of Trump’s war on Due Process and the rule of law. The 9th Circuit Court of Appeals on Monday ruled against the Trump administration’s policy allowing for the indefinite detention of certain asylum-seekers, saying a lower court ruling temporarily blocking it can remain in place.

In the ruling, the judges said the Department of Justice did not make a “persuasive showing that it will suffer irreparable harm if it is required to provide bond hearings pending the outcome of this appeal in the same way it had done for several years.”

However, the appeals court did not allow a district judge’s order requiring the government to release some asylum-seekers within a certain amount of time after immigration proceedings begin, saying it “would impose short-term hardship for the government and its immigration system.”

Barr first issued the order earlier this year, determining that asylum-seekers who pass a “credible fear” test and go on to full deportation proceedings aren’t entitled to bond hearings.

But Judge Marsh Pechman, a Clinton appointee in federal court in Seattle, ruled earlier this month that policy is unconstitutional and blocked it from being enforced.

The three-judge panel on the 9th Circuit — Carter appointees Judges Mary Schroeder and William Canby as well as Judge Morgan Christen, an Obama appointee — declined to place a stay on Pechman’s ruling.

“The government failed to show a likelihood of success on the merits of its underlying argument that the government may indefinitely detain the plaintiffs without affording bond hearings at all,” Monday’s order reads.

Pechman had also ruled earlier this year that the Trump administration must take several steps in regard to asylum-seekers who are detained during immigration proceedings, including that certain migrants should be released if they are not granted a hearing within seven days of those proceedings beginning.

But the judges said that lawyers for the Trump administration showed that those requirements would be “too burdensome,” and temporarily halted the order as the full appeal of Pechman’s ruling plays out.

The appeals court is set to rule on the policies further, and Monday’s order asked that arguments be scheduled in the case for October of this year.

The Trump administration was critical of Pechman’s ruling against Barr’s asylum policy, with White House press secretary Stephanie Grisham saying in a statement that the order is “at war with the rule of law.”

On Monday officials said they were pleased the panel partially granted the government’s request.

“Unfortunately, in the same decision, the Ninth Circuit also allowed a radical decision from a district judge to go into effect during the pendency of the government’s appeal, which had held unconstitutional a section of the Immigration and Nationality Act,” said Deputy Press Secretary Steven Groves in a statement. “Based on the unprecedented theory that illegal aliens who recently entered the country have a constitutional right to be released on bond into the United States, the district court struck down a statute passed by bipartisan majorities in Congress during the Clinton administration specifically requiring certain aliens to be detained pending their asylum proceedings.”

He said the administration expected to ultimately prevail in the appeal.

The 9th Circuit’s ruling comes as the Trump administration seeks to implement tighter restrictions on asylum.

Trump officials announced last week that they would not accept asylum claims from migrants who pass through another country while traveling to the U.S.’s southern border, with limited exceptions. That rule is currently being challenged in a pair of federal courts.

Notwithstanding the blather from new White House mouthpiece Grisham, this ruling was very predictable given the 9thCircuit’s prior decisions and the clear arbitrariness under the Due Process clause of indefinite, potentially life threatening, detention of those legally seeking asylum under our laws without reference to the facts or a chance or any type of independent review. Barr’s decision in Matter of M-S-, at issue here, was widely criticized on Constitutional, practical, and ethical grounds even before Judge Pechman enjoined it.

CIUDAD JUAREZ, Mexico — For the two dozen migrant children living inside a small church on the outskirts of Ciudad Juarez, most days go like this: breakfast at 8 a.m., dinner at 6 p.m. and hours of nothing in between.

There is no school, and except for a handful of worn Bibles, there are no books. Dangers abound in the surrounding hills, so most haven’t left the razor-wire-ringed compound in weeks or even months.

“I feel imprisoned,” said 16-year-old Alison Mendoza.

She left Nicaragua with her parents and two younger sisters in March after her father received death threats for demonstrating against President Daniel Ortega, whose government has jailed and killed thousands of dissenters.

The family has been waiting here in Juarez for nearly two months for their chance to request political asylum in the United States. A Trump administration policy allows only a handful of asylum seekers to pass through ports of entry at the U.S. border each day.

Mendoza and her sisters, Sol, 6, and Michele, 11, are among the thousands of migrant children languishing along the border as a result of changing migration trends and White House policies that seek to deter asylum seekers.

They left friends and relatives behind and endured the trials of the migrant trail only to end up stuck in camps, cheap hotels and shelters such as Buen Pastor, which is now home to children and their families from as far away as Ghana and Congo. Pawns in an adult’s dispute, their future is entirely uncertain.

Two recent Trump administration mandates are almost certain to result in even larger numbers of migrant children being stranded here.

One calls for asylum seekers to wait in Mexico while their cases are adjudicated. About 3,000 migrant children and their families have been returned to Juarez under that program since April, according to Chihuahua state officials.

A mandate announced this week calls for asylum to be denied to migrants who did not apply for protection in at least one country they passed through while trying to reach the United States.

The rules mean that there is a very strong likelihood that if the Mendozas finally do cross the border to plead their case, they will be sent right back to Juarez.

“What will we do?” said Donald Mendoza, 37, who left behind a good job at a Managua university that would have allowed him to pay for all three girls’ college educations.

The Mexican government has committed to providing schooling to migrants who are returned from the U.S., but Mendoza doesn’t want to raise his girls in notoriously dangerous Juarez, where 10 people were slain on Sunday alone.

“This is not the life I planned for my children,” he said.

Buen Pastor opened its doors about 20 years ago to migrants — back then almost always single men — who passed through Juarez before seeking to sneak across the border.

“They would come, rest for a night or two, and then cross,” said Pastor Juan Fierro Garcia.

But over the last two years, entire families began trudging up the dirt road that leads to the church.

Many had heard that U.S. authorities were releasing migrants as long as they requested asylum and were traveling with children.

“We didn’t know much about the situation, just that families were passing,” said Joseph Venegas, 26, who left Honduras last month with his wife and their two sons.

After crossing into the U.S. illegally last week, and turning themselves in to border authorities, Venegas and his family were held for two days and then released back into Juarez with an order to appear at an asylum hearing in October. A Mexican official told them how to get to Buen Pastor.

Ten-year-old Jose sobbed on the way there. “I want to go back to Honduras,” he wailed.

“We had bad luck,” his father explained. “The law is the law and we have to respect it.”

“We are doing all of this for you,” Venegas added.

Venegas said the family decided to leave because a teachers’ strike meant Jose hadn’t been able to go to school for months.

But now, as he watched Jose sit morosely in one corner of the shelter and his wife nurse their coughing 4-month-old baby on a nearby bench, he wondered whether leaving had been in the best interest of his kids.

“What kind of childhood is this?” he asked.

The experience is a little easier on the younger children, many of whom don’t understand exactly what is happening, and who run around the shelter in a tight pack. The youngsters from Africa speak only a small amount of Spanish, but they still manage to make friends.

The lack of toys means the children entertain themselves around a big table, beating it like a drum until their parents complain or turning it into a fort under which they hide and whisper.

There are several small buildings clustered around the compound — a men’s dormitory, a women’s dormitory and the church sanctuary where families camp out each night on mattresses squeezed between the pews.

The crowded conditions and a constant stream of visitors — nongovernmental organization workers, pro bono lawyers and journalists all asking the same tired questions — mean there is zero privacy. Young women groom themselves and change clothes under the cover of blankets.

A psychologist from the state comes once a week. On a recent morning, she gathered the children around a big round table and led them in breathing exercises.

She asked them to go one by one, saying their names and where they were from.

“I’m Natalia from Honduras,” one girl said.

“I’m Akasia from Congo,” said another.

A thin child from Guatemala declined to speak, burying her head in her arms.

“She is sad,” the 7-year-old boy next to her explained.

“It’s OK,” the psychologist said. “It’s okay to be sad.”

This kind of preventable harm inflicted by an Administration that has declared war on humanity and the rule of law is directly at the feet of three irresponsible Federal Judges of the Ninth Circuit who tanked by vacating the injunction against such gross abuses properly put in place by the U.S. District Judge in Innovation Law Labs v. McAleenan, ostensibly so that their colleagues could “deliberate” (actually “dither”) over a decision that would take responsible judges about 60 minutes to reach!  How do guys like this sleep at night?

The issue in Innovation Law Labs involves the bogus “Migrant Protection Protocols,” more accurately described as “Remain in Mexico” or “Die in Mexico” that intentionally violates both Fifth Amendment Due Process and numerous provisions of the INA, including the rights to access to counsel of one’s own choosing, fair notice of hearings, adequate time to prepare and present a case, and the right to assert withholding of removal to a country where one fears persecution or torture.

Failure of privileged Article III Judges to protect the most vulnerable among us from Executive overreach and abuse, in this case clearly racially motivated, has real life adverse consequences, beyond the “judicial ivory tower,” that in many cases are irreversible.

All of us who believe in justice should be outraged by the Ninth Circuit’s dilatory performance in this case! It’s nothing short of child abuse sanctioned by the Federal Judiciary.  It must stop!

The Supreme Court set forth a generous view of asylum law — even a 10% chance of persecution is enough to qualify — in the 1987 case Cardoza-Fonseca v. INS, discussed in this article. Following the Supreme Court’s directive, the BIA in Matter of Mogharrabi adopted a generous “reasonable person” standard for asylum eligibility, assuring everyone that asylum could be granted “even where persecution is significantly less” than probable.

However, judges like Judge Agnelis Reese have a different idea: treat asylum as a “loophole” and abuse your power over individuals’ lives by looking for bogus ways to deny protection rather than grant it. As pointed out by this article, one of the “best” of these “legal gimmicks” is simply arbitrarily to decide not to believe anyone’s claim or to “nit-pick” memories in a way that would establish Judge Reese and others like her as “inherently not credible” if applied to them. Much like the Trump Administration as a whole.

However, this is about more than just one ill-qualified asylum judge. For 22 years, Judge Reese was allowed to abuse asylum seekers with her one-sided decision making. That spanned two entire Administrations, one of each party, and two partial ones. Yet the BIA, EOIR, the DOJ, and life-tenured Article III Court of Appeals Judges failed to intervene to force Judge Reese, and other like her, to either apply asylum law in the fair, reasonable, and generous manner it was intended or to find other jobs.

There are “other Judge Reeses” out there today screwing the most vulnerable among us with dishonest interpretations of asylum law and facts, particularly in the area of credibility and “nexus” to a “protected ground.” Now, however, instead of being “outliers,” they are the kinds of “shining example” judges who implement the Administration’s White Nationalist false narrative that all asylum seekers from all countries are “gaming the system” and ought to be rejected en masse, without fair and impartial adjudications, in some cases amounting to literately “death sentences” without anything approaching due process.

All this is going on right under the noses of life-tenured Article III Judges who are supposed to be enforcing Due Process and fundamental fairness by insuring that the Immigration Court system provides fair and impartial adjudications (it doesn’t), that the generous criteria set forth in INS v. Cardoza-Fonseca and Matter of Mogharrabi are not just given “lip service” but are actually applied in every case (they aren’t), that credibility determinations are based on the record as a whole and all relevant factors (they aren’t), and that “mixed motive” for acts of persecution is properly considered and applied (it isn’t).

Of course, Congress and to some extent the voters are to blame for the current disgraceful parody of justice in our Immigration Courts. But, careers like that of Judge Reese are proof that the Article III Courts are also failing to live up to their statutory, constitutional, and human obligations and thus have become part of the problem, rather than part of the solution.

I can only hope that some future legal historian will analyze in detail, naming names, the failure of the Article III Courts, up to and including the Supremes, to perform their functions with integrity and thereby to have prevented the legal, constitutional, and human tragedy and mockery of justice taking place every day in our broken Immigration Courts.

Unqualified, yet empowered, judges like Reese are a symptom, rather than the cause of, that broken system.

Just yesterday, four distinguished legal organizations sent a joint letter to Congress calling for the establishment of an independent U.S. Immigration Court in view of the demonstrated catastrophic failure of the current system to provide Due Process to asylum seekers and other migrants:

WASHINGTON, D.C., JULY 9, 2019 —The American Bar Association has joined with three other legal organizations to call on Congress to establish a separate immigration court system that is independent of the U.S. Department of Justice.

ABA President Bob Carlson, along with the presidents of the American Immigration Lawyers Association, the Federal Bar Association and the National Association of Immigration Judges, will send a joint letter to Congress on July 11 stating that immigration courts “cannot meet the standards which justice demands” because they are not truly independent. This issue is particularly crucial as immigration courts struggle with crisis-level backlogs of almost 900,000 cases.

Under the current arrangement, immigration courts are part of the U.S. Department of Justice, and the judges in those courts are answerable to the U.S. Attorney General, who is also the nation’s chief prosecutor.

In their joint letter to Congress, the four organizations note that this inherent conflict of interest means that immigration judges are “particularly vulnerable to political pressure and interference.” In addition to the structural issues, the letter said that problems have “resulted in a severe lack of public confidence in the system’s capacity to deliver just and fair decisions in a timely manner.”

The lack of independence in the immigration court system was also addressed in the ABA’s recent updated report, “Reforming the Immigration System.” In the report, the organization urged removing the immigration courts from DOJ to ensure they are given the independence they need to be fair, impartial arbiters.

A telephone media briefing on the letter will be held Thursday, July 11, at 1pm ET/10am PT immediately following submission of the letter to Congress.

A group of roughly 100 Haitians, Africans and South Americans cross the Rio Grande, just shallow enough for adults to wade despite an overnight storm.

As they wait on the muddy bank near Del Rio, Texas, to surrender themselves to the Border Patrol, the voices of children in the group carry across the river to the Mexican side.

There, in the city of Ciudad Acuña, hundreds of migrants have formed an impromptu refugee camp in an ecological park bound on one side by the river. Just outside the park, the official port of entry to the United States sits at the end of a short bridge.

They’ve crossed thousands of miles by foot, boat and bus to seek asylum in the U.S., only to find themselves stalled in a purgatory of soggy tents and overflowing bathrooms. Now, they face an uncertain wait prolonged by Trump administration policy.

The temptation to make the risky and illegal river crossing mounts daily.

“If you see people jumping over the river, it is because they are tired of staying here,” said one resident of the camp, Luis, who declined to give his last name out of fear for the safety of his family back home.

Home for him would be the West African nation of Cameroon, where Luis was vice principal of a school until he fled last fall. He escaped a widening conflict between the country’s English-speaking minority and its Francophone-majority government, which receives security assistance from the U.S.

He was jailed and tortured before escaping to neighboring Nigeria, Luis said. After a trek across three continents, he landed here, where he has waited for six weeks to present himself to U.S. officials at the Del Rio port of entry.

He hopes to join a sister in Ohio.

“At times, it is really disheartening,” he said, “so it is difficult to wait.”

Cruel, “designed to fail” policies and complicit judges who fail to protect the statutory, constitutional, and human rights of others are unlikely to stop the flow of forced migrants in the long run. They will, however, succeed in killing some, torturing others, ruining many lives, and causing permanent damage to large numbers of their fellow human beings, particularly children.

Future generations will also find it difficult to understand and explain our national complicity, since the facts about the abuses the Trump Administration is heaping on humanity in our name are out in the open for life-tenured judges to ignore at the peril of their lasting reputations. And, too many of them are doing just that.

A federal appeals court Wednesday upheld an injunction barring the Trump administration from using military funds to pay for a wall along the southern border.

In a 2-1 decision, a panel of the U.S. 9th Circuit Court of Appeals said Trump was likely to lose his appeal and the injunction by a district judge should remain in place.

After failing to win funding for the wall from Congress, Trump announced in February that he planned to divert $8.1 billion for the border wall from funds slated for military construction and other Department of Defense operations.

The Sierra Club and the Southern Border Communities Coalition sued, winning an injunction in late May. The Trump administration asked the 9th Circuit to block that order while the case is on appeal.

In rejecting the administration’s request, the 9th Circuit said using the military funds “violates the constitutional requirement that the executive branch not spend money absent an appropriation from Congress.

The public interest is “best served by respecting the Constitution’s assignment of the power of the purse to Congress,” the 9th Circuit said.

The order was signed by Judges Richard Clifton, appointed by President George W. Bush, and Michelle Friedland, an Obama appointee.

Ninth Circuit Judge N. Randy Smith, appointed by President George W. Bush, dissented.

Basically, Trump tried to steal money Congress refused to give him and use it for a bogus political stunt — building a wall for political show that could have no real effect on legitimate law enforcement other than to enrich smugglers and kill some more innocent asylum seekers by forcing them to use smugglers to take them over a more dangerous spot or to tunnel, scale, or break through the wall.

For the record, Judge Randy N. Smith “tanked” on his oath of office and his Constitutional responsibilities to stop such nonsense. Fortunately, Judge Richard Clifton and Judge Michelle Friedland stood up for the Constitution and our right to have a Government that follows its own laws. 

Undoubtedly, there will be an appeal, so stay tuned. The Supremes are much more “marshmallowy” when comes to forcing Trump to operate within the Constitution.

A Seattle federal judge ruled Tuesday that asylum-seeking migrants detained for being in the U.S. illegally have the right to a bond hearing in immigration court rather than being held until their cases are complete.

U.S. District Judge Marsha Pechman said it is unconstitutional to indefinitely detain migrants who fled to the U.S. seeking asylum protections.

The decision reverses an April directivefrom Attorney General William Barr ordering immigration judges not to release migrants on bail after an applicant successfully establishes “a credible fear of persecution or torture” in the home country — a policy that has been in place since 2005.

“The court finds that plaintiffs have established a constitutionally-protected interest in their liberty, a right to due process, which includes a hearing before a neutral decision maker to assess the necessity of their detention and a likelihood of success on the merits of that issue,” Pechman wrote.

In her ruling, Pechman also took issue with an aspect of Barr’s policy that left open the possibility that migrants, still awaiting a hearing, could be re-detained by ICE after being released on bond.

“The Government’s unwillingness to unconditionally assert that Plaintiffs will not be re-detained means that the specter of re-detention looms and these Plaintiffs and many members of their class face the real and imminent threat of bondless and indefinite detention …,” she said.

The ruling comes amid a widespread shortage of immigration judges that has caused massive delays in processing hearings. The most recent dataavailable from The Transactional Records Access Clearinghouse shows a total of 424 judges nationwide face a backlog of 892,517 cases on the courts’ active dockets as of the end of April.

“The three largest immigration courts were so under-resourced that hearing dates were being scheduled as far out as August 2023 in New York City, October 2022 in Los Angeles, and April 2022 in San Francisco,” TRAC reports

Pechman also modified a preliminary injunction issued earlier this year. The new injunction requires the government to ensure bond hearings are held within seven days after they are requested by eligible asylum-seekers. If the government exceeds that limit, the undocumented immigrant must be released.

Immigrant rights advocates, including the American Civil Liberties Union and the Northwest Immigrant Rights Project, sued to block the policy, which was set to take effect this month.

In a statement, Matt Adams, legal director of Northwest Immigrant Rights Project, said: “The court reaffirmed what has been settled for decades: that asylum seekers who enter this country have a right to be free from arbitrary detention.”

Michael Tan, senior staff attorney for the ACLU’s Immigrants’ Rights Project, added: “Try as it may, the administration cannot circumvent the Constitution in its effort to deter and punish asylum-seekers applying for protection.”

The Department of Justice is expected to appeal the ruling quickly.

So, while the 9thCircuit is bopping along violating human rights by enabling Trump’s absurdly illegal “Kill ‘Em in Mexico Program,” as a result of a three-judge panel who tanked on their oaths of office, Judge Pechman and some others at the “retail level” of the Federal Judiciary are still on the job and upholding our Constitution against the all-out assault led by Barr on behalf of Trump.

 

It’s also worth remembering that the U.S. Attorney General is supposed to uphold the Constitution and protect individual rights, rather than serving as tool of racist White Nationalist extremism as Sessions and Barr have done. Already in shambles and a disgraceful ethical morass, there won’t be anything left of the “Justice” Department by the time Barr’s toxic tenure ends.

 

Bill Barr is a national disgrace and an affront to American justice. But, hey, it’s the Trump Adminisration, so what else is new?

WASHINGTON, DC – On July 2, 2019, Attorney General (AG) Barr published a final rule, further expanding his authority to reshape immigration law. The rule was issued in a highly unusual manner by resurrecting an old proposed regulation from 11 years ago and making it final within 60 days without any opportunity for public comment.

AILA President Marketa Lindt said, “This regulation exemplifies why the immigration courts should not be housed under the Department of Justice (DOJ). Under this administration, the AG has already utilized the certification power in an unprecedented manner to unilaterally strip immigration judges of basic operational authorities, interfere with judicial independence, and even attempt to rewrite asylum and detention laws. The American legal system is designed with fundamental procedural protections, such as briefing by the parties, to ensure the decision maker-here the AG-hears all points of view before deciding an important case. This new rule, however, authorizes the AG to singlehandedly designate Board of Immigration Appeals (Board) decisions as precedent – and do so literally overnight bypassing the necessary legal procedures and without any checks and balances.”

AILA Executive Director Benjamin Johnson added, “This is the most aggressive effort to unify control over the immigration courts in 20 years; I have never seen an administration claw back a discarded rule like this in order to further assert its power. The scope of this power grab could be immense. This rule attempts to shield decisions issued by the Board – including decisions for which the Board didn’t even bother to write an opinion – from federal court review and tries to force the U.S. Courts of Appeals to presume that the Board reviewed all the available information and claims made by the parties even if there’s nothing to show the Board did so. Simply put, the AG will have more power with less oversight, and immigrants’ right to appeal to the federal courts will be far more limited. This attack on the judicial branch proves further that our nation urgently needs an independent immigration court system separate from the Department of Justice. Nothing less will suffice.”

Every Court of Appeals Judge who signs off on one of these constitutionally defective removal orders produced by EOIR, an illegitimate “court” that functions without either fundamental fairness or impartiality under procedures that no such judge would accept if applied to them or their loved ones, should hang his or her head in shame.

Once the Trump nightmare is over, courage and integrity to stand up against Government overreach should be the touchstone for all future Article III judicial appointments. No more “go along to get along” Federal Judges at any level of the system! The Judicial Branch was actually conceived and established as a protector of liberty and justice against tyranny, not as an enabler of, and apologist for, “abuses by the Crown” (or in this case, “the Clown”).

WASHINGTON — Government investigators have identified poor conditions in another sector of the southern border, publishing graphic photos showing extreme overcrowding in Rio Grande Valley migrant facilities and finding that children there did not have access to showers and had to sleep on concrete floors.

Investigators for the Department of Homeland Security who visited border stations in the El Paso, Texas, sector in May found similar conditions: Migrants being held in temporary facilities for weeks rather than days, single adults living in standing room-only cells with no space to lie down, and concerns about serious health risks.

The investigators for the DHS Office of the Inspector General toured five Border Patrol facilities and two ports of entry in the Rio Grande Valley sector during the week of June 10 and published their report as a “management alert” to the department on Tuesday.

The Rio Grande valley of Texas has the highest volume of immigrants along the United States-Mexico border. At the time of the visits by investigators, Border Patrol was holding 8,000 detainees in custody, with 3,400 being held longer than the 72-hour limit.

One senior manager at a facility called the situation a “ticking time bomb,” according to the report. When immigrants detained in the facilities saw investigators walking through, they banged on the cell windows and pressed notes against the plexiglass to show the length of time they had spent in custody. One said “Help 40 Day Here.”

On Monday, NBC News published findings by the inspector general that detailed poor conditions for migrants in border stations in El Paso as far back as May 7. Acting DHS Secretary Kevin McAleenan said at a press conference Friday that reports of poor conditions for children in border stations were “unsubstantiated.” McAleenan said children were given showers as soon as they could be made available.

“Most single adults had not had a shower in CBP custody despite several being held for as long as a month,” according to the latest report on conditions in the Rio Grande Valley.

The report also detailed what it called “security incidents” in which immigrants have tried to escape and once refused to return to their cells after being removed during maintenance. To address the problem, Border Patrol called in its special operations force to “demonstrate it was prepared to use force if necessary,” the report said.

COURTSIDE HAS BEEN SAYING IT FOR YEARS; THE NY TIMES FINALLY PICKS UP: Trump & Co’s White Nationalist Racist Immigration Policies Are Corrupting America!

Last year, as part of an effort to carry out President Trump’s promise of “extreme vetting” of visitors to the United States, the Department of Homeland Security began collecting social media account information from millions of people seeking to cross the border.

After all, a radical online could be a radical offline.

That’s why the stream of posts ricocheting around a 9,500-member Facebook group, comprising current and former Border Patrol agents as well as some people with no apparent connection to the Border Patrol, is so troubling. Members of the group, as documented by ProPublica this week, “joked about the deaths of migrants, discussed throwing burritos at Latino members of Congress visiting a detention facility in Texas on Monday and posted a vulgar illustration depicting Rep. Alexandria Ocasio-Cortez engaged in oral sex with a detained migrant, according to screenshots of their postings.”

Of a 16-year-old migrant from Guatemala who died while in Border Patrol custody in May, a member of the group wrote, “If he dies, he dies.”

Customs and Border Protection said on Monday that it had informed the Department of Homeland Security’s inspector general about the posts and had started its own investigation. The National Border Patrol union decried the posts as “inappropriate and unprofessional.”

A reckoning from their superiors is due for any border agents who dishonored their uniform by spreading vileness on social media. In June, when the Plain View Project, a nonprofit research effort, released documentation on dozens of police officers from eight departments across the country posting racist, misogynist and Islamophobic material, 72 police officers in Philadelphia were pulled off the streets and the top prosecutor in St. Louis said she would no longer accept cases from 22 officers.

In a larger sense, the Border Patrol Facebook posts reveal a worrying mind-set among some of those charged with administering the harshest crackdown on migrants and asylum-seekers in decades. “These are clearly agents who are desensitized to the point of being dangerous to migrants and their co-workers,” Representative Joaquin Castro, who heads the Congressional Hispanic Caucus, told ProPublica.

The realities of that crackdown have created conditions that Americans would condemn if they were in another country.

While lawmakers refuse to compromise on emergency aid for the humanitarian needs at the border, “children are held for weeks in deplorable conditions, without access to soap, clean water, showers, clean clothing, toilets, toothbrushes, adequate nutrition or adequate sleep,” groups supporting the children wrote in a recent court filing. A judge on Friday ordered Customs and Border Protection to allow health workers into facilities where children are being held to ensure that conditions are “safe and sanitary.

On Monday, Ms. Ocasio-Cortez toured facilities where migrants and asylum-seekers are being held. “Officers were keeping women in cells w/ no water & had told them to drink out of the toilets,” she tweeted.

As the congressional delegation arrived at one detention facility, they were heckled and cursed at by demonstrators, including one man wearing a Make America Great Again hat. (Another heckler hurled ethnic slurs at Representative Rashida Tlaib.)

Only a callous person could find mirth in the misery at the border. And only a desensitized nation could continue to permit the separation of children from their parents — and detaining all of them in atrocious conditions — as a morally acceptable form of deterrence.

The constant lies, false narratives, intentional inhumanity, and “deterrence only” of Trump’s self-created “border crisis” are merely the latest example of how White Nationalism demeans our nation. This Administration has all of the legal tools necessary to process arriving asylum seekers in a fair, timely, and orderly manner. They just refuse to use them as they were intended to solve, rather than intentionally create and aggravate, migration problems.

 

Contrary to Trump/GOP false narratives, that includes the present ability to establish a legitimate refugee application program in or near the Northern Triangle and to use it as an incentive for refugees to apply outside the United States rather than coming to the border to apply for asylum. However, to work as an incentive, rather than a failed deterrent, the refugee program must be administered in a fair and generous manner that would allow those who have legitimate fears of persecution on the basis of gender, actual or political opposition to gangs, ethnicity, or religious activities to be properly classified as refugees and resettled here or in some other truly safe location as determined in conjunction with the UNHCR and signatory countries outside the Northern Triangle who can actually provide at least a reasonable chance of safety.

That likely means a goal of admitting at least 50,000 to 100,000 refugees to the U.S. from Central America over the next year. That, along with robust aid to address the problems creating the refugee flow would be the legal and effective approach to the forced migration issue.

 

Additionally, the Administration has the ability to reauthorize and extend “Temporary Protected Status” (“TPS”) to qualified individuals from the Northern Triangle already present in the U.S. until such time as the conditions in their home countries can be stabilized. This would also have the advantage of tracking the presence of such individuals in the United States while reducing the pressure on the already backlogged U.S. Immigration Court system.

 

Of course, the Administration has no intention of using any of these tools to solve the problem. That would be inconsistent with their racist, restrictionist, White Nationalist agenda aimed primarily at keeping non-white individuals out of the United States and reducing the rights and political power of those who are already citizens. The purpose of refugee protection laws is actually to protect refugees, not, as this Administration posits, to kill as many of them as possible outside the U.S. or at our border to “deter” other refugees from coming.

 

Indeed, the Administration’s absurdly inhuman and unlawful  proposal to keep refugees from leaving the very countries where they are being persecuted, without addressing the conditions there, is basically that having them die, be tortured, or abused there is just fine with us. Whether folks like to face it or not, that is indeed a neo-Nazi philosophy. And, every day that Trump remains in the office for which he is so supremely unqualified further corrupts our nation.

It’s where individuals make their initial appearance in court and are advised about their right to a lawyer, procedures for obtaining pro bono counsel, given warnings, plead to charges of removability, seek bond if detained, have possible relief from removability explained, file applications for relief like asylum, have hearing dates and filing deadlines set, learn the DHS position on applications, have current address confirmed, receive DHS fillings, make and receive rulings on preliminary motions, and receive warnings as to the dire consequences of failure to appear and meet filing deadlines, to name just some things that go on. In other words, “important stuff.”

What happens when non-judicial politicos interfere with judges’ individual case scheduling and docketing by setting artificial limits on when and how they use interpreters? Cases that have been rescheduled numerous times over the years get “moved to the back of the bus” once again.

Individuals and their lawyers faithfully show up for their long-awaited individual “merits” hearings, sometimes after having traveled hundreds of miles, witnesses and families in tow, only to be informed by a clerk that their cases have been taken off the docket without notice for the “convenience of the agency” and will be rescheduled for some unspecified later date. Evidence goes stale, memories fade, witnesses become unavailable, lawyers move on to other jobs, and country conditions change as these cases drag on literally forever because of political meddling and management incompetence. Perhaps worst of all, these same politicos and bureaucrats engineering the delays and backlogs attempt to shift blame to the victims and judges by limiting legitimate continuances, “expediting” cases that aren’t ready to be heard, and dishonestly calling for totally unneeded restrictive changes in the law.

Ostensibly, the truncation of interpretation resulted from mismanagement on the part of these same politicos and bureaucrats who hired additional judges in a hurry without planning for those judges’ support needs, including in person interpreters. And, take it from me as someone who spent thirteen years on the immigration bench and heard thousands of cases, “telephonic interpretation” is not by any means the equivalent of “in person” interpretation Indeed, at some point, I found the process for telephonic interpretation so time wasting and inadequate, that I just stopped using it. But, that was way back when individual judges had at least a little control over what happened on their dockets and what was necessary to achieve due process in an individual case.

More likely, this move is just another step the intentional “dumbing down” of the immigration court process and the systematic dismantling of what little remains of constitutional due process for those pleading for their lives in a system doing its best to “tune them out.” It will result in more illegal removal orders.

However, these will be hard for appellate courts to detect upon review, because they might not be readily apparent from the English language version of the transcripts. Besides, some Article III courts have also abandoned their duties to the Constitution in a mad rush to “rubber stamp” as many defective removal orders as possible to “clear” their own overcrowded dockets at the expense of integrity, fundamental fairness, and quite frankly, innocent lives.

So shocking has become this “under the radar” further de-professionalization of what disingenuously holds itself out to be a ”court” that readers have been sending me anonymous comments from some distraught individual professional court interpreters. Here’s what one such concerned interpreter had to say (edited to preserve confidentiality);

“Bottomline, no more in-person interpretation for master calendars. In addition, in-person interpreters will be assigned in three-hour blocks only. Judges will no longer be allowed to have two languages in one hearing. I think this means no more relay interpretation between indigenous languages and Spanish. I’m concerned about language access being curtailed.”

These further disgraceful developments, showing a complete disregard for legal norms and individual fairness, should be carefully documented in congressional oversight hearings with an eye toward a future independent Article I immigration court. In the meantime, the Article III courts could and should put a stop to this travesty and force the system to meet at least minimal standards of professionalism and due process pending needed legislative reforms.

No American citizen would want to trust him or herself to this parody of a court system. Yet, due process under our Constitution applies equally to “all persons,” not just citizens, and the stakes in these cases often are life or death. If we refuse to defend the rights of the least among us, who will stand for our rights when the forces of oppression shift their ugly gaze? Even exaulted, yet too often complicit, life-tenured Article III judges should be asking themselves that question.
