Dear Georgetown Law Colleagues & Community Members:

 

I agree 100% with the assessment by my colleague that Kevin McAleenan is a corrupt, immoral, and indecent human being. He is an affront to American democracy, human rights, and simple human decency, as well as a congenital liar. Imagine a person who would proudly negotiate incredibly dishonest “Safe Third Country” agreements with three of the most corrupt and dangerous countries in the world, none of which has a functional asylum system.

 

I have highlighted McAleenan’s despicable activities numerous times on my blog, immigrationcourtside.com. Mac also is spreader of the demonstrably false claim that asylum seekers don’t show up for their hearings (they show up nearly 100% of time, when represented), that their claims lack merit (he has never, to  my knowledge, adjudicated a single asylum claim and is a leading proponent of the Trump Administration’s intentional, racially and gender biased misapplication of asylum laws to Central Americans), and that the Flores settlement protecting children from abusive detention is a “loophole.”

 

He promoted regulations recently found by U.S. District Judge Dolly Gee to be patently illegal that would have authorized indefinite detention in substandard conditions of families and children whose “crime” was to seek legal protection under our laws. Rather than working cooperatively with pro bono lawyers, he has made it virtually impossible for dedicated, hard-working lawyers to represent individuals returned to Mexico. He has replaced Asylum Officers with totally unqualified Border Patrol Officers to improperly increase the number of “credible fear” denials, over the objection of the professional Asylum Officers. He runs detention centers with life threatening conditions and lies about it.

 

He has also abandoned the responsible use of prosecutorial discretion and overloaded the Immigration Court dockets with absolute “dreck” that should never been brought in the first place. Contrary to his bogus claims, the vast number of removals of non-criminals being pursued by ICE in the Immigration Courts are not only intentionally destroying the justice system but demonstrably harm the United States with each mindless, biased, and unnecessary removal of long-time law-abiding individuals who are contributing to their communities and often leave U.S. citizen family members behind. The recent proposal of DHS to misapply the “public charge” grounds to prevent individuals from gaining lawful permanent residence or U.S. citizenship is beyond disgraceful. His subordinates have gloried in spreading racially-motivated terror in ethnic communities throughout the United States.

 

I could go on for pages about Mac’s cowardly immorality and illegal behavior.

 

But, all of that being said, he’s an Acting Cabinet Secretary and should be heard. I think the best course is to publicize his misdeeds in advance, so those attending can be fully informed about what he actually stands for and his total disdain for human rights and the rule of law. I also believe that he should be confronted with his many lies and illegal and immoral actions and challenged to justify his unjustifiable positions. He needs to know that most of us do not agree with the Trump Administration’s perverted world view and disavowal of basic statutory, Constitutional, and human rights which he has dishonestly advanced and advocated.

 

Again, I appreciate my esteemed colleague’s courageously speaking out about McAleenan’s disgraceful record of misusing public service to abuse and threaten the lives of the most vulnerable among us. I also appreciate how it has affected him and his family personally. As a former public servant for three-and-one-half decades, I find Mac to be a vile disgrace to honest, ethical, and decent public service.

 

But, I think “hearing and confronting” is a better course than “tuning him out.” Maybe this occasion will help inform and energize the Georgetown Law Community about the abuses of American values, human rights, Constitutional Due Process, and the Rule of Law being carried out by our Government in our name every day against our fellow human beings who have the misfortune to be migrants in today’s world.

 

I also note that MPI and CLINIC, the sponsors of these presentations, are among the nation’s leading defenders of immigrants’ rights and social justice. That is another reason why I would defer to their decision to invite McAleenan to this event as an “opportunity to confront and understand the face of evil.”

They Fled Gang Violence And Domestic Abuse. An NYC Immigration Judge Denied Them Asylum

Seventeen year-old Josue and his mom, Esperanza, were visibly drained. They had just spent more than four hours at their asylum trial inside an immigration court at 26 Federal Plaza in Lower Manhattan, answering questions from their attorney and a government lawyer. We are withholding their full names to protect their identities because they’re afraid.

“It was exhausting,” said Josue, whose angular haircut was neatly combed for the occasion. In Spanish, he told us the judge seemed nice but, “you feel bad if you don’t know if you are going to be allowed to stay or if you have to go.”

The teen and his mother crossed the U.S. border in California in the summer of 2018. At the time, a rising number of families were entering the country, and the Trump administration wanted to send a message to them by swiftly deporting those who don’t qualify for asylum. But immigration judges are so busy, they can take up to four years to rule on a case. In November, judges in New York and nine other cities were ordered to fast track family cases and complete them within a year.

This is how Esperanza and Josue wound up going to trial just 10 months after they arrived in the U.S. and moved to Brooklyn. They were lucky to find attorneys with Central American Legal Assistance, a nonprofit in Williamsburg that’s been representing people fleeing the troubled region since 1985.

Winning asylum was never easy. But in 2018, former Attorney General Jeff Sessions made it tougher for people like Josue and Esperanza when he issued his own ruling on an immigration case involving a woman from El Salvador who was a victim of domestic violence. He wrote: “The mere fact that a country may have problems effectively policing certain crimes—such as domestic violence or gang violence—or that certain populations are more likely to be victims of crime, cannot itself establish an asylum claim.”

Immigration judges were bound to give heavy weight to that ruling. Their courts are run by the Department of Justice, whose boss is the Attorney General. And the AG’s boss, President Trump, frequently asserts that too many migrants lie about being threatened by gangs when they’re just coming for jobs. “It’s a big fat con job, folks,” he said at a Michigan rally this year.

Esperanza and Josue went to court soon after Sessions’ decision. She was fighting for asylum as a victim of domestic abuse; Josue claimed a gang threatened his life. Both would eventually lose their cases.

Josue’s case

Esperanza and Josue are typical of the Central American families seeking asylum these days, who say they’re escaping vicious drug gangs, violence and grinding poverty. The two of them came from a town outside San Pedro Sula, one of the most dangerous cities in the world.

During their trial, Josue testified under oath about how gang members repeatedly approached him outside his high school, asking him to sell drugs to the other students. He tried to ignore them, and gave different excuses for resisting, until one day when they spotted him playing soccer and became more aggressive. That’s when he said the gang leader put a gun in his face.

“He told me that if I didn’t accept what he wanted he was going to kill my whole family, my mother and sister,” he said, through a Spanish interpreter.

“I was in shock,” he said. “I had no other choice to accept and said yes.”

He told his mother and they left Honduras the next day. When Josue’s lawyer, Katherine Madison, asked if he ever reported the threat to the police he said no. “That was practically a suicide,” he said, explaining that the police are tied to the gang, because it has so much power.

Josue said his older sister later moved to Mexico because she was so afraid of the gang.

Winning asylum is a two-step process. You have to prove that you were persecuted, and that this persecution was on account of your race, religion, nationality, social group or political opinion. Madison, Josue’s attorney, argued that in Honduras, defying gangs is a risky political statement.

“They function in many ways as the de facto government of the areas where people like Josue lived,” she told WNYC/Gothamist, summing up the arguments she submitted to the judge. “They make rules. They charge basically taxes, they say who can live there and who can’t.”

And they’re known to kill people who don’t obey.

In her ruling, issued in August, Immigration Judge Oshea Spencer found Josue did experience persecution. But she denied his application for asylum. She said much of what he described “were threats and harm that exist as part of the larger criminal enterprise of the gangs in Honduras and not on the basis of any actual or perceived opposition to the gangs.”

Esperanza’s case

Esperanza’s attorney argued that her life was at risk because the gang member threatened Josue’s family. But Spencer didn’t find that specific enough. She wrote that the gang members “were motivated by their efforts to expand their drug trade, not the family relationship.” Among other cases, she referred to a recent decision by the current Attorney General, William Barr, that makes it harder for the relatives of someone who’s been threatened to win asylum.

Esperanza also lost on a separate claim that she deserved asylum because she was repeatedly beaten by Josue’s father. In court, she testified about years of abuse culminating in an incident in which he chased her with a machete. She said she couldn’t get the police to issue a restraining order, and said he kept threatening her after she moved to another town to stay with relatives.

Madison argued that women like Esperanza belong to a persecuted social group: they can’t get help from the authorities in Honduras because they’re viewed as a man’s property. The country is one of the deadliest places to be a woman; police are known to ignore complaints; and it’s extremely hard for women to get justice.

But Spencer ruled that there is no persecuted social group made up of “Honduran women who are viewed as property” for being in a domestic relationship.

Echoing the Sessions’ ruling, the judge said these categories “all lack sufficient particularity,” and called them “amorphous” because they could be made up of a “potentially large and diffuse segment of society.”

She also cited evidence submitted by the government that showed conditions in Honduras are improving for women. This evidence came from a 2018 State Department report on human rights in Honduras. Immigration advocates claim it’s been watered down from the much harsher conditions described in the last report from 2016. It’s also much shorter in length.

Jeffrey Chase, an immigration lawyer and former New York immigration judge, said it’s not surprising that Esperanza and Josue would each lose asylum. Judge Spencer only started last fall and is on probation for her first two years in the job.

“This was decided by a brand new judge who didn’t have any immigration experience prior to becoming an immigration judge,” he said, referring to the fact that Spencer was previously an attorney with the Public Utility Commission of Texas. He said she went through training which, “These days, includes being told that we don’t consider these to be really good cases.”

Sitting judges don’t talk to the media but Chase noted that they must consider the facts of each individual case, meaning the former Attorney General’s ruling doesn’t apply to all cases. He noted that some women who were victims of abuse are still winning asylum. He pointed to a case involving a Guatemalan woman who was raped by her boss. A Texas immigration judge found she did fit into a particular social group as a woman who defied gender norms, by taking a job normally held by a man.

During Josue and Esperanza’s trial, there was a lot of back and forth over their individual claims. A trial attorney from Immigration and Customs Enforcement questioned why Esperanza didn’t contact the police again after moving to another town, where she said her former partner continued to threaten her. Esperanza said it was because her brother chased him away and the police “don’t pay attention to you.”

The ICE attorney also asked Josue if his father was physically violent with anyone besides Esperanza. Josue said he did fight with other men. San Diego immigration lawyer Anna Hysell, who was previously an ICE trial attorney, said that could have hurt Esperanza’s case.

“The government was able to make the arguments that he didn’t target her because of being a woman that was in his relationship,” she explained. “He just was probably a terrible person and targeted many people.”

Hysell added that this was just her analysis and she wasn’t agreeing with the decision.

Attorney Anne Pilsbury said she believes Esperanza would have won her case, prior to the asylum ruling by Sessions, because she suffered years of abuse. But she said Josue would have had a more difficult time because gang cases were always tough. And like a lot of migrants, Josue had no evidence — he was too afraid to go to the cops. Pilsbury said immigration judges are even more skeptical now of gang cases.

“They’re getting so that they won’t even think about them,” she said. “They aren’t wrestling with the facts. They’re hearing gang violence and that’s it.”

She said Judge Spencer does sometimes grant asylum, and isn’t as harsh as other new judges. New York City’s immigration court used to be one of the most favorable places for asylum seekers. In 2016, 84 percent of asylum cases were granted. Today, that figure has fallen to 57 percent, according to TRAC at Syracuse University. Meanwhile, the government is forcing migrants to wait in Mexico for their immigration court cases or seek asylum in other countries before applying in the U.S., as the national backlog of cases exceeds one million.

Pilsbury, who founded Central American Legal Assistance in 1985, said immigration courts are now dealing with the result of a regional crisis south of the border that’s never been properly addressed since the wars of the 1980s.

“The anti-immigrant people feel it’s broken because people get to come here and ask for asylum and we feel it’s broken because people’s asylum applications aren’t seriously considered,” she explained. “We should be doing more to understand what’s going on in those countries and what we can do to help them address the chronic problems.”

Esperanza and Josue’s cases will now be appealed. Madison said she believes the judge ignored some of her evidence about gangs. She’s now turning to the Board of Immigration Appeals. However, it’s also controlled by the Justice Department — meaning the odds of getting a reversal are slim. If they lose again, the family can go to a federal circuit court which may have a broader definition of who’s eligible for asylum.

But Esperanza and Josue won’t be deported as long as their case is being appealed. On a late summer day, they seemed relaxed while sitting in a Brooklyn park. Esperanza talked about how happy she is that Josue is safe at his public high school, and can even ride a bike at night with his friends.

“He goes out and I’m always trusting the Father that just as he goes out, he comes back,” she said.

Even if they knew they would lose their asylum case, both said they still would have come to the U.S. because the risk of staying in Honduras was too great. Josue said the gang would definitely find him if he ever returned because their networks are so deep throughout the country. He’s now taking the long view. He knows there will be a Presidential election next year.

“It’s like a game of chess,” Josue said. “Any mindset can change at any moment. Maybe Trump changes his mind or maybe not. But I would have always made the decision to come.”

It’s not “rocket science.” Better, fairer outcomes were available that would have fulfilled, rather than mocked, our obligation to provide Due Process and protection under our own laws and international treaties.

Here’s how:

  • Esperanza’s claim is a clear asylum grant for “Honduran women” which is both a “particular social group” (“PSG”) and a persecuted group in Honduras that the government is unwilling or unable to protect.
  • Although the last two Administrations have intentionally twisted the law against Central American asylum seekers, Josue has a clear case for asylum as somebody for whom opposition to gang violence was an “imputed political opinion” that was “at least one central reason” for the persecution.   • In any event, on this record, Josue clearly showed that he faced a probability of torture by gangs with the acquiescence of the Honduran government, and therefore should have been granted mandatory protection by the Immigration Judge under the Convention against Torture (“CAT”).
  • The Immigration Judge’s assertion that things are getting better for women in Honduras, one of the world’s most dangerous countries for women where femicide is rampant, not only badly misapplies the legal standard (“fundamentally changed conditions that would eliminate any well founded fear”) but is also totally disingenuous as a factual matter.   • Additionally, Honduras remains in a state of armed conflict. See, e.g., https://www.tandfonline.com/doi/full/10.1080/23740973.2019.1603972?needAccess=true. Under an honest Government, granting TPS to Hondurans (as well as Salvadorans and Guatemalans affected by environmental disasters heightened by climate change) would be more than justified.
  • Under honest Government following the rule of law, well-documented cases like this one could be quickly granted by the USCIS Asylum Officer or granted on stipulation in short hearings in Immigration Court. Many more Central Americans could be granted CAT relief, TPS, or screened and approved for asylum abroad. They could thereby be kept off of Immigraton Court dockets altogether or dealt with promptly on “short dockets” without compromising anybody’s statutory or constitutional rights (compromising individual rights is a “specialty” of all the mostly ineffective “enforcement gimmicks” advanced by the Trump Administration).
  • Over time, the overwhelming self-inflicted Immigration Court backlogs caused by the Trump Administration’s “maliciously incompetent” administration of immigration laws (e.g., “Aimless Docket Reshuffling”) would be greatly reduced.
    • That, in turn, would allow the Immigration Courts to deal with cases on a more realistic timeline that would both aid rational, non-White-Nationalist immigration enforcement and provide real justice for those seeking protection under our legal system.
  • As I’ve said before, it’s not “rocket science.” All it would take is more honest and enlightened Government committed to Due Process, good court management, and an appropriate legal application of laws relating to refugees and other forms of protection. I doubt that it would cost as much as all of the bogus “enforcement only gimmicks” now being pursued by Trump as part of his racist, anti-migrant, anti-Hispanic agenda.
  • Poor judicial decision making, as well illustrated by this unfortunate wrongly decided case, not only threatens the lives of deserving applicants for our protection, but also bogs down an already grossly overloaded system with unnecessarily protracted litigation and appeals of cases  that should be “clear grants.”
  • Contrary to the intentionally false “party line” spread by “Big Mac With Lies” and other corrupt Trump sycophants at the DHS and the DOJ, a much, much higher percentage, probably a majority, of asylum applicants from the Northern Triangle who apply at our Southern Border should properly be granted some type of legal protection under our laws if the system operated in the fair and impartial manner that is Constitutionally required. The Trump Administration aided by their sycophants and enablers, all the way up to the feckless Supremes, are literally “getting away with murder” in far, far too many instances. 
  • Consequently, quickly identifying and granting relief to the many deserving applicants would be a more efficient, humane, and lawful alternative to the “Kill ‘Em Before They Get Here” deterrence  programs being pursued by Trump, with the complicity of the Supremes, the Ninth Circuit, and some of the other Federal Circuit Courts who have been afraid to put a stop to the extralegal nonsense going on in our Immigraton Courts, detention centers (the “New American Gulag”), our Southern Border, and countries like Mexico, El Salvador, Guatemala, and El Salvador where we are basically encouraging extralegal abuses and gross human right violations against migrants. It will eventually come back to haunt our nation, or whatever is left of our nation after Trump and his gang of White Nationalist thugs, supporters, appeasers, apologists, and enablers, are done looting and destroying it.

The Flores Exhibits

“I’m held with my son in a cage.  There are about 60 people in my cages, and more in some of the other cages.  There are six cages in my area. They are all very, very full.”

The above words are part of “Exhibit 29,” which is read by my friend Lenni Benson, a professor at New York Law School and founder of the school’s Safe Passage Project, which provides representation to unaccompanied children in immigration court.  The words are the sworn declaration of a 17-year-old girl, identified by the initial “L.”

There are 65 such declarations, each the actual statement of a child detained at border detention facilities in this country  in June 2019. Recently, Waterwell, the wonderful civic-minded theater and film production company responsible for the immigration court based play The Courtroom filmed a number of actors, lawyers, clinical professors, advocates, and other interested individuals in a dark studio in the East Village in New York City.  I was honored to be one of those filmed. We each sat at a simple table with the written exhibit and a glass of water, and under the direction of Waterwell’s Artistic Director, Lee Sunday Evans, each read a single declaration.

Article 37(b) of the Convention of the Rights of the Child states that “No child shall be deprived of his or her liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time.”  A 1997 settlement agreement, known as the Flores Settlement, legally binds our government in limiting the length of time it can detain immigrant children, and holding the government to a standard of humane treatment under prescribed conditions of health, hygiene, education, and privacy. From the contents of the declarations, the Trump Administration has made a mockery of these rules.

Exhibit 3, read by David Gomez, the president of Hostos Community College, memorializes the words of a five year old from Honduras separated from his father upon arrival at the border, as he states “I have not been told how long I have to stay here.  I am frightened, scared, and sad.” My fellow former immigration judge, Betty Lamb, read the statement of a 14 year old girl, who was taking care of two younger parentless girls (one of them 4 years old and sick), who said that she was holding the two in her lap as she spoke trying to comfort them.  She then added “I need comfort, too. I’m bigger than they are, but I am a child, too.” (Exhibit 54).

At this time when our nation is led by scoundrels, we are in need of heroes.  Towards this end, please take a moment to write down the name of Elora Mukherjee, a true hero.  She is a clinical professor of law and Director of the Immigrants’ Rights Clinic at Columbia Law School.  She has devoted her career to aiding immigrant children, whom she began visiting in detention facilities in 2007, and litigating violations of the Flores Settlement. Watching her read her own 22 minute statement gave me nightmares.  She described the overwhelming stench of the hundreds of detained children, who were very hungry and seriously traumatized. One six year old she tried to question ended up sitting in her lap crying inconsolably, until a guard eventually gave him a lollipop “as an incentive to bring him back to his cell.”  (Exhibit 63). Many of the children were seriously in fear of the guards. A number of the children were sick.

I am a native-born American citizen.  I have lived here my entire life. Yet I never felt more foreign than while watching these videos.  I hope that readers of these words feel the same way. No government of a country that is truly ours, that reflects the morals and values that we possess and believe in, could ever treat children this way.  And no decent, moral people, regardless of their political affiliation or their views on immigration, could ever support or approve of the government responsible for such treatment. These children will never get over this.  It is one thing for children to arrive here already traumatized and be granted safe haven under our laws. It is entirely another matter for the government of this country to deliberately cause children to suffer in a way that will scar them for life.

Long post….please read. Especially if you are an immigration Judge or an ICE attorney.

Two days. 100 degrees. 100% humidity. And a beautiful rainbow to start our second day this weekend in Matamoros with Project MPP Matamoros. We saw about 80 plus principal applicants (that means we didn’t count spouses and children so the real reach is much higher) to help them understand immigration court proceedings and asylum applications.

But not just that….today I met with 5 pregnant or just had their babies in the last week women. One thrown back into Mexico after CBP had taken her to hospital to stop her contractions, one so heavily pregnant she spent 7 days in the hielera only to be sent to Mexico to give birth less than 12 hours after CBP threw her back. Another 13 weeks along dehydrated, sick, living in inhumane conditions on the streets of Mexico that she fainted and then began vomiting. No one from the Mexican authorities came to assist. Myself and some other refugees grabbed some chairs to make a makeshift bed, had her drink rehydration salts and used peppermint oil to bring her back after the fainting spell. More electrolytes, water, and a granola bar I had in my bag. It took about 40 minutes until her pupils returned to normal. Luckily, a Cuban refugee with some EMT training was barking orders for us to try to find the various things he thought could help her all while checking her vitals super old school style with a watch to count her pulse and listening for her breaths as she laid on the makeshift bed. I guess street lawyering means you are also a nurse/EMT. Glad I had the things the Cuban man was barking orders to find.

There are so many stories I can tell. MPP is wrong on a moral level. MPP is wrong legally.

Then there are all the court documents that have fake addresses where CBP puts in an address to a shelter that no one can get in. They are homeless. But the judges buy those fake addresses and use them to deport people. The “tear sheets” which are supposed to instruct refugees how to appear to court are either not given at all or given with wrong information telling them to appear at the bridge at the same time their hearing is supposed to start which ensures they will not make it to their hearing on time. Then there are those thrown back without even giving them their court documents. When they go to the bridge to ask about their paperwork they are told CBP doesnt handle that…..when in fact it is CBP who does! How in the world are refugees supposed to know when and where to go to court when CBP won’t even give them the court documents. And of course I can not fail to mention all the defects in the court charging documents….it goes on and on.

We are better than this. The humanitarian crisis has not gone away it is just south of the border and worse than ever. In 24 years as a lawyer I have never seen so much extreme cruelty. Appellate Judges of the 9th Circuit, 5th Circuit, and the Supremes, whose sworn duty is to uphold the rule of law against such attacks, have instead gone “belly up,” thrown away their moral compasses, and joined the abusers, cowardly hiding in their “Ivory Towers” from having to actually witness the terrors they are inflicting on the most vulnerable, needy, and deserving of our protection. A truly disgusting performance in judicial spinelessness and task avoidance. Don’t know how those “robed dudes” with lifetime sinecures sleep at night!

 

And, of course, under GOP Senate leadership, Congress, which could and should have acted by veto proof margins to rebuke Trump and restore the rule of law has functionally ceased to exist. The GOP has made human rights abuses and false racially charged narratives about immigrants part of its official party platform.

 

And the Dems are “running out the clock” on an impeachment debate that most folks have ceased to care about and which everyone and his brother knows is never going to happen. Where is the House-enacted “Immigration Reform Agenda” that could be a blueprint for future change?

CATHERINE RAMPELL @ WASHPOST: Trump & His GOP’s Cowardly “War On Children” Should Outrage Every American! — Join The “New Due Process Army” & Fight To Save Humanity!

You’ve heard of the Wars on Drugs, Terror, Poverty, even Women. Well, welcome to the War on Children.

It’s being waged by the Trump administration and other right-wing public officials, regardless of any claimed “family values.”

For evidence, look no further than the report released Wednesday by the Department of Health and Human Services’s own inspector general. It details the trauma suffered by immigrant children separated from their parents under the Trump administration’s evil “zero tolerance” policy.

Thousands of children were placed in overcrowded centers ill-equipped to provide care for them physically or psychologically. Visits to 45 centers around the country resulted in accounts of children who cried inconsolably; who were drugged; who were promised family reunifications that never came; whose severe emotional distress manifested in phantom chest pains, with complaints that “every heartbeat hurts”; who thought their parents had abandoned them or had been murdered.

Such state-sanctioned child abuse was designed to serve as a “deterrent” for asylum-seeking families, as then-Chief of Staff John F. Kelly and other administration officials made clear.

Of course, they failed to recognize just how horrific are the conditions these asylum-seeking children are fleeing — conditions that further decreased HHS’s ability to adequately care for them.

“Staff in multiple facilities reported cases of children who had been kidnapped or raped” back in their home countries, the IG report states. Other children witnessed family members raped or murdered.

But hey, Trump believes these kiddos must be punished further for the crime of seeking refuge — a.k.a., the “invasion” of America.

Despite this and other abundant evidence that government facilities are not able to care for children for extended periods, last month, the administration also announced a new policy that would allow it to keep children (along with their families) in jail-like conditions for longer periods of time.

 

This is hardly the only way the administration has knowingly enacted policies that harm children.

In August, it finalized a rule that would make it more difficult for immigrants to receive green cards if they have used certain safety-net services they’re legally entitled to — or if government officials suspect they might ever use such services. Confusion and fear about the policy and whom it affects abound. This has already created a “chilling effect” for usage of social services, with immigrant parents disenrolling even their U.S.-citizen children just to be safe.

Last fall, for instance, I interviewed a green-card-holding mother who decided not to enroll her underweight newborn in a program that would have provided free formula (even though the program in question was not mentioned in the rule, and the baby is a U.S. citizen). Huge recent declines in children’s Medicaid and Children’s Health Insurance Program enrollment are also believed to be at least partly a result of fears about this policy change.

And lest you think only immigrant or brown children are being targeted in this war: U.S. servicemembers’ children, of all sorts of backgrounds, are being hurt, too.

The Trump administration is siphoning billions from various defense projects to fund border wall construction, despite promises that Mexico would pay for it. This might sound unlikely to affect kids, but somehow the Trump administration found a way. Among the projects losing funds are schools for the children of U.S. servicemembers based in Kentucky, Germany and Japan, and a child-care center at Joint Base Andrews in Maryland.

Trump’s proposed federal budgets have likewise axed funding for other programs that serve children, such as subsidized school meals and Medicaid. Indeed, both federal and state GOP officials more broadly are still working to kill the Medi­caid expansion, as well as other Affordable Care Act provisions that benefit kids.

The GOP has likewise ignored the pleas of children who want their lives protected from gun violence, or who want their futures protected from a warming planet.

A year ago, I offered a suggestion : that Democrats make children the theme of their midterm campaign. They mostly ignored me and still did okay. Nonetheless, I’m re-upping it.

Because even without Trump’s baby jails and proposed Medicaid cuts, our country’s emphasis on children’s well- being is seriously deficient.

Last year, for the first time on record, we spent a greater share of the federal budget servicing the national debt than we did on children, according to an analysis out next week from First Focus on Children. Spending on children as a share of the federal budget is also expected to shrink over the coming decade, crowded out by both debt service and spending on the elderly.

This is despite the fact that spending on children (especially low-income children) has among the highest returns on investment of any form of government spending.

Whatever the opposite of Trump’s War on Children is, that’s what Democrats should be running on.

INSIDE TRUMP’S “NEW AMERICAN GULAG” (“NAG”): Where So-Called “Civil Immigration Detainees” Asserting Their Legal Rights Are Punished In Ways That Would Be “Cruel & Unusual” If Applied To Convicted Criminals!

The Trump administration has attempted to close the door on asylum seekers who are looking for refuge in the United States. But even as it blocks entry — and sends tens of thousands of asylum seekers to Mexico to wait out their immigration proceedings — thousands of families with children are also being held in federal immigration detention facilities.

Because the administration has prohibited advocacy groups, journalists, immigration attorneys and even congressional staff from entering detention facilities to document conditions and interview detainees, the public has had only anecdotal glimpses into how detainees were treated. Now we have systematic evidence to support accounts of the harsh conditions that asylum seekers experience in immigration detention. In many ways, it is worse than we thought.

From October 2018 through June 2019, the San Diego Rapid Response Network (SDRRN) assisted approximately 7,300 asylum-seeking families at their shelters. These families, who were processed and then admitted into the U.S., totaled more than 17,000 people, including 7,900 children 5 years old or younger. My team and I at the U.S. Immigration Policy Center (USIPC) at UC San Diego independently analyzed intake data collected by the SDRRN for all of these families.

In a report released last week, we found that approximately 35% of the asylum-seeking heads of households we studied reported problems related to conditions in immigration detention, treatment in immigration detention, or medical issues. This finding is alarming since it’s very likely an underestimate, because the SDRRN was focused on providing needed services to the asylum-seeking families, not administering questionnaires. Moreover, abuses or problems in detention may be underreported by asylum seekers who are afraid that raising complaints may negatively affect their asylum case.

Of those who reported issues related to conditions in detention, approximately 6 out of 10 reported food and water problems, including not having enough to eat, being fed frozen food, being fed spoiled food, not being given formula for infants, not being given water, and having to drink dirty or foul-tasting water. Approximately half reported having to sleep on the floor, having to sleep with the lights on, overcrowded conditions, confinement, and the temperature being too cold in “la hielera,” the detention facilities known as the “iceboxes.” Approximately 1 out of every 3 reported not having access to clean or sanitary toilets, being able to shower or being able to brush their teeth.

About 1 out of 10 of the asylum-seeking heads of households — or more than 700 of them — reported verbal abuse, physical abuse or some form of mistreatment in immigration detention. Examples of verbal abuse include being told “we don’t want your kind here” and “you’re an ape,” among others. Examples of physical abuse include being thrown against the wall when attempting to get a drink of water.

The data also showed the great diversity of those who arrive at the southern border to seek refuge. The majority of the asylum-seeking families came from the “Northern Triangle” of Central America — Honduras, Guatemala and El Salvador. However, many also came from other continents, 28 in all, including the Democratic Republic of Congo, Russia, Kazakhstan, India, China and Vietnam, to name a few. Any changes to U.S. asylum policies meant to deter Central Americans from entering at the southern border will affect asylum seekers from all over the world who are also looking to the U.S. for safety.

We also found that just over 1 out of 5 of these families do not speak Spanish as their primary language. The languages spoken range from indigenous Central American languages — including K’iche’, Q’eqchi’ and Mam — to Creole, Mandarin, Portuguese, Russian, Hindi, Vietnamese and Romanian, among others. This linguistic diversity presents another set of challenges.

When asylum seekers are released from detention, they are given detailed instructions on a form called the “Notice to Appear,” including instructions about their immigration court dates, times and locations. On the notice, immigration officials indicate the language that the asylum seeker was given these instructions in. For those whose primary language is not Spanish, nearly 9 out of every 10 were nevertheless given instructions in Spanish. If these families are not provided instructions about their immigration proceedings in a language they can understand, they will not be able to navigate an extremely complex legal process, which may infringe on their basic rights to due process.

From substandard conditions in immigration detention to verbal and physical abuse to serious due process concerns, the data show that the Trump administration is not abiding by its obligations under U.S. and international asylum and refugee law to treat humanely those who are seeking protection from persecution.

With the administration now determined to hold asylum-seeking families for potentially as long as it takes for their immigration proceedings to play out (which could be years), conditions may get worse. Cruelty, after all, may very well be the point.

What kind of country allows its leaders to impose these types of abuses on vulnerable individuals whose “crime” is seeking protection under our laws and the international conventions that they implement? 

Why are “Big Mac” and other Trump sycophants at DHS allowed to lie with impunity about what is really happening in DHS detention, the real inhuman consequences of “Remain in Mexico” (a/k/a “Let ‘Em Die in Mexico”), and abuse “Safe Third Country” agreements by dishonestly pretending that Guatemala, one of the world’s most notoriously dangerous and corrupt “failed states,” meets the statutory requirements?

A key point in Professor Wong’s article is that many, probably the majority, of those released from detention receive inadequate explanations of their obligations to report current addresses and appear for both Immigration Court Hearings and separate ICE detention “check-ins.” Combined with this Administration’s obstinate refusal to work closely and cooperatively with legal services groups to maximize representation, it leads to many unnecessary, yet largely intentional on the part of DHS & EOIR, so-called “no shows.” These, in turn, get bogus “in absentia orders” from Immigration Judges operating under excruciating and inappropriate pressure to “produce numbers, not justice.” This, in turn, feeds the demonstrably false DHS narrative, oft repeated by “Big Mac With Lies” & others, that a large number of asylum seekers will “abscond” if released in the U.S.

It’s all part of a White Nationalist restrictionist immigration agenda that when finally exposed in detail after Trump and his cronies leave office will paint America as foolish, corrupt, and cowardly. Is this the “legacy” we truly want to leave to future generations?

A UN commission that spent the last 12 years investigating graft in Guatemala has described the country as “captured” by corruption in its final report, days before it is set to wrap up operations after President Jimmy Morales refused to renew its mandate.

The commission, known as Cicig for its initials in Spanish, said in its final report that there is a “mafia coalition” among members of government, the business community and private individuals that is “willing to sacrifice Guatemala’s present and future to guarantee impunity and preserve the status quo”.

The commission chief Iván Velásquez, a Colombian lawyer who has been barred by Morales’ government from entering Guatemala, said via video conference from Colombia that the report would be the commission’s last public act.

“We almost got to the nucleus of the structures that have captured the state,” Velásquez said. “This cannot be solved without a profound restructuring of the state.”

The commission began its work in Guatemala in 2007 at the request of then-president Óscar Berger and was given responsibility for dismantling illegality in the wake of the country’s 1960-1996 civil war.

Morales accused the body of overreaching its authority last year, after the commission brought investigations against him, some of his relatives and his inner circle. He was protected from prosecution as a sitting president and has denied wrongdoing.

While many observers praised the commission for its work, which resulted in the prosecution of more than 400 people, including the former president Otto Pérez Molina, his vice-president and much of his cabinet, Morales decided that Cicig had run its course, setting up its impending departure on 3 September.

Critics saw Morales’ refusal to renew the commission’s mandate as an attempt to protect himself and those close to him.

The report said the “impunity of power” in Guatemala dates to colonial times.

One of the reasons why corruption networks persist today, it said, is that “they have distorted democratic institutionality in their favor and they have molded the political system and designed mechanisms that allow them to occupy positions of power, manipulating legislation.”

“Between 2012 and 2015, an illicit, political-economic network took over the executive (branch), subordinated the legislative, manipulated and interfered in the election of judges to high courts and, in addition to looting the state, promoted laws and policies favoring private companies to the detriment of competition and the citizenry,” the report continued.

All that benefited drug trafficking networks, it added.

Together with Guatemalan prosecutors, the commission took down 70 organized crime networks. Those targeted for prosecution have included public officials, lawmakers, judges, businesspeople and other civilians.

It also investigated Morales’ National Convergence Front for alleged illegal political financing.

The report said illicit political money is “present in the majority of campaigns and parties” and comes from criminal organizations including drug traffickers seeking territorial control and political protection, as well as businesspeople seeking influence.

The Trump administration last week announced a new regulation that would allow the government to indefinitely detain migrant families who cross the border. If it goes into effect, it would terminate an agreement known as the Flores settlement that has been in place since 1997 to ensure that children are kept in the least restrictive setting possible, receive certain standards of care, have access to lawyers, and are generally released within 20 days. The effect would be to extend the well-documented suffering of migrant children in detention centers.

On Wednesday, the Trump administration released a regulation that would allow it to detain migrant children indefinitely. The new rule, which is not yet in effect, would end the 1997 consent decree known as the Flores Settlement Agreement, which put in place protections for migrant children who arrive at the border. The Flores agreement limits how long children can be detained and requires that they be placed in the least restrictive setting possible.

Many Americans first heard about the Flores agreement last summer, when the Trump administration began separating families at the border. The administration claimed that it had to separate children from their guardians because the Flores agreement would not let the government detain the families together long enough to resolve the parents’ immigration cases, which often takes months or years. Previous administrations usually released families until their cases were heard.

In response to public outrage, the Trump administration officially ended the family separation policy — but continued to separate hundreds of families under other rules. Meanwhile, the administration continued its efforts to do away with Flores altogether, culminating in this rule.

Here are four things to know about the new rule.

1. Long-term detention has lasting mental health effects on children

Acting homeland security secretary Kevin McAleenan said that the rule sets guidelines for the care of detained families in “campus-like settings” where all needs are ostensibly met. These “family residential centers,” he said, will have “appropriate” facilities for “medical, educational, recreational, dining” and housing needs. However, there is good reason to doubt that detention conditions will be adequate, given recent reports of the lack of even basic necessities at some facilities.

Detention is likely to have a lasting detrimental impact on children’s mental health. A 2017 American Academy of Pediatrics report concluded that detained immigrant children experience high levels of mental health problems such as anxiety, depression and post-traumatic stress disorder during and after detention. Detaining children with their families does not significantly mitigate the severe mental health impact. Any detention is especially traumatic for children; long-term detention only increases the likelihood of lasting effects.

In the week I spent earlier this year in the family detention center in Dilley, Tex., law students and I observed that the environment created continuing trauma for the children and families. One child I met cried silent tears throughout the legal meeting I held with her mother. A detained teenager was entertaining thoughts of suicide and refusing food.

2. The United States already detains some children for far longer than permitted by Flores

Flores imposed a 20-day limit for detaining migrant children, unless the parent opts to waive the child’s right to be released. The government already flouts this limit.

Children are detained more than 20 days when bureaucratic hurdles block their release. For example, in December 2018, the average stay in the children’s detention facility at Tornillo, Tex., was 50 days. Such waits are caused by a Trump-era Department of Homeland Security policy that requires background checks of the relative waiting to take in the child and also of every person in that relative’s home. Cornell Law School faculty members have met children detained in Brownsville, Tex., for up to 10 months.

3. The rule will not deter desperate families

McAleenan claimed that the rule will discourage adults from bringing children to the United States, whether those adults are the children’s parents, other relatives or smugglers. But such deterrence policies rarely work, researchers find. Pushed out of dangerous home countries by poverty, crime or other threats, migrants simply look for other ways into the United States.

For example, the Trump administration’s new Migrant Protection Protocols require migrants who present themselves at an official border point of entry to wait in Mexico for their asylum hearing. Knowing this, many detained women I spoke to in Dilley had avoided the point of entry. Instead, they crossed the Rio Grande at night on inflatable rafts, clutching their toddlers. They asked for asylum when Border Patrol apprehended them.

4. The rule faces several potential legal challenges

The administration published the rule in the Federal Register on Friday. It could take effect in 60 days, but only if it’s approved by federal judge Dolly M. Gee, who oversees the Flores agreement. Once the rule is published, the government has seven days to file a brief to obtain her approval. Last year, she denied the government permission to modify Flores to permit indefinite child detention. If she denies this request as well, the government will probably appeal.

Even if Gee grants the government’s request, the rule will probably be delayed by legal challenges from advocacy groups such as the Center for Human Rights and Constitutional Law, which originally filed the Flores case and continues to litigate it today. Advocates are likely to argue that the new rule violates Flores, putting the government in contempt of the court’s order.

If the rule does go into effect, advocates will probably bring a new class-action suit under some of the principles of the original 1985 Flores complaint, arguing that indefinite detention is a violation of due process and equal protection under the Constitution. They may also argue that the policy violates certain provisions of the Immigration and Nationality Act. Further, advocates could turn to international human rights law, arguing that the rule violates the right to personal liberty and security enshrined in the International Covenant on Civil and Political Rights.

Lawyers for detained children may also file individual writs of habeas corpus, a legal term for petitions for release alleging that the detention is an unconstitutional deprivation of freedom. Immigration attorneys have increasingly been filing habeas corpus petitions for immigrants in prolonged detention — at times successfully obtaining their clients’ release.

Beyond legal action, the indefinite child detention policy may again spark public outrage, as happened last summer over family separation. Collective public action could also prompt policy change.

(CNN)When all else fails, lock up children.  That’s the message from the Trump administration, which on Wednesday announced a regulation allowing it to indefinitely detain migrant families who arrive at our southern border. The new rule would replace a court agreement known as the Flores settlement, which sets minimum standards for migrant children in government custody, and limits their detention to 20 days.

Speaking at the White House, President Trump told reporters that his new rule will “make it almost impossible for people to come into our country illegally.”

What the rule won’t do is help solve the humanitarian crisis at the border. The new rule is legally and logistically suspect.  The only thing it guarantees is that more children will suffer greatly.

For decades, the treatment of detained migrant children has been governed by the Flores settlement. Aside from limiting the length of time that the government can keep immigrant children in custody, it mandates that kids be kept in the least restrictive setting possible, and that they receive food, water and other basic services.

Acting Secretary of the Department of Homeland Security Kevin McAleenan said the Flores settlement has been the driving force behind unauthorized migration from Central America to the U.S. “This single settlement has substantially caused, and continues to fuel, the current family unit crisis… until today,” he said Wednesday.

But he has no data to back him up.  On the contrary, ample research shows that the migrants are driven here by violence, gang activity, poverty and civil instability in Guatemala, Honduras and El Salvador.

As they have done throughout American history, people are fleeing for their lives from dangerous nations to seek safety, a new start and better lives in our country. They are not rushing to the US to take advantage of Flores.

Members of the Trump administration are fond of characterizing the Flores settlement as a “loophole” in need of fixing.

Not true.

The Flores settlement began as a 1985 class-action suit against the Immigration and Naturalization Service, the  predecessor to the Department of Homeland Security, over its treatment of migrant children. It took 12 years of litigation and negotiation to reach the final agreement in 1997.  The settlement was painstakingly crafted by immigrant advocates and government lawyers and has endured through Republican and Democratic administrations.

Getting rid of the Flores settlement would allow the government to lock children up for as long as their immigration cases take to resolve.  This is chilling and simply inhumane, and not just because detention centers have repeatedly been found to be crowded, dirty and unsafe. Just this summer, DHS’s own inspector general found conditions at migrant detention centers to be “an immediate risk to the health and safety” of detainees.

Beyond that, doctors and child welfare experts are unanimous in their conclusion that imprisoning children harms their physical, emotional and psychological development. At least six migrant children have died in the Trump administration’s custody. Why would anyone want to place kids in detention for longer periods of time?

Replacing Flores would also amount to a logistical nightmare. The US has three family detention centers with a combined capacity of about 3,000. Contrast that with the roughly 432,000 MEMBERS OF “family units” arrested at the border between October and July, according to Customs and Border Protection.  It defies reality to think that the administration could possibly come up with safe places to house such large numbers of people for long periods of time.

Instead they should be screened and processed in a timely manner, then released to family members or sponsors.  The vast majority of children and families seeking asylum show up for their court dates when they receive appropriate support, like the kind they received through the Ice Family Case Management Program. Yet the Trump administration abruptly terminated this program in June 2017,  indicating a lack of good faith in ensuring that migrants receive proper assistance and guidance with their immigration cases.

“No child should be a pawn in a scheme to manipulate our immigration system,” said McAleenan. He’s right.   But it is the Trump administration that is using children as pawns to further its xenophobic agenda. Central Americans have the legal right to apply for asylum, and families should not face indefinite detention for exercising this right.

The administration’s new rule is sure to face significant legal challenges. In fact, a federal court judge recently affirmed that using detention as a deterrent to seeking asylum is an unconstitutional violation of due process.

With all of their cruel and wasteful gimmicks, schemes, and illegal actions, the one thing the Trump Administration has been unwilling to do is just follow existing law:  Allow asylum applicants of all nationalities to be fairly and timely processed through the existing system under the law as it existed before the Trump Administration twisted it for the specific purpose of discriminating against legitimate asylum seekers. Then, we’d all finally know whether or not the individuals fleeing the Northern Triangle are “refugees” or something else. But, the Trump Administration won’t allow that to happen because it fears the answer.

Moreover, we should always keep in mind that even those who don’t meet the highly technical international definition of “refugee” might still be in real danger of harm or death upon return. They consequently could be strong candidates for some other type of temporary humanitarian protection (e.g., TPS, extended voluntary departure, prosecutorial discretion) short of asylum.

Also, as Reyes correctly points out, to maintain that a 20 year old consent decree in Flores, carefully developed and agreed upon among the Government, advocacy groups, and the U.S. District Judge to implement “best practices” in lieu of having the Judge unilaterally force the Government to take corrective action to meet basic constitutional standards, is the cause of a continuing Central American migration that has been happening to some extent or another over the past four decades, is beyond absurd. Indeed, the Government undoubtedly entered into the Flores consent decree to save itself from what almost certainly would have been a major litigation defeat on the merits and a public judicial rebuke of their unconstitutional treatment of minor children (which the Solicitor General probably would have declained to appeal to the 9th Circuit).

Only someone as disingenuous and subservient to Trump as “Big Mac With Lies” could possibly put forth such a ridiculously bogus theory in public with a straight face. Judge Gee should hold Big Mac and the rest of his White Nationalist restrictionist gang at DHS, DOJ, and the White House in contempt of court for even putting forth such a pack of lies (but, she won’t).

HERE’S WHAT the State Department recommends for U.S. travelers to Guatemala: Do not walk or drive at night. Request security escorts. In the capital, Guatemala City, do not hail taxis on the streets and avoid 10 specific neighborhoods, including one around the airport.

Here’s what the Trump administration recommends to non-U.S. travelers to Guatemala, namely those from other Central American countries: Stay there and apply for asylum. Don’t even think about continuing north to the U.S. border.

The juxtaposition is absurd but no less so than the agreement the administration struck last week with Guatemala — that it be considered a “safe third country” to which the United States will return asylum seekers if they have not already sought refuge there. If the administration’s contempt for Central Americans fleeing violence, hardship and persecution was not already clear, this new policy clarified it.

The rule, set to take effect in the coming weeks if U.S. or Guatemalan courts don’t block it, is mainly aimed at migrants from El Salvador and Honduras. They constitute the second- and third-largest cohorts of asylum seekers crossing the U.S. southwestern border in recent months, and most of them traverse Guatemala on their trek northward. (The largest cohort is Guatemalans themselves, who accounted for a majority of the more than 100,000 migrants stopped at the border monthly this past spring.)

President Trump, irate at the migrant flow, has used slander — “these are bad people,” he told reporters — and a grab bag of legally dubious deterrent measures. He is right that Customs and Border Protection and other agencies are struggling to handle the tide, which resulted in nearly 700,000 apprehensions in the current fiscal year through June, compared with scarcely 400,000 the entire previous year. But it is morally indefensible to attack a migration problem by putting migrants themselves at risk. That is precisely what the administration’s new move would do.

The United States maintains a safe-third-country agreement with Canada, meaning that asylum seekers can be returned to that country to apply for refuge if they crossed the border from there. That makes sense because Canada is generally safe; Guatemala is anything but. And the retort of acting homeland security secretary Kevin McAleenan, who noted that parts of the United States are also unsafe, is risible. Guatemala’s crime rate dwarfs that of the United States; the homicide rate there is five times higher.

The probable result of the administration’s policy, if it goes into effect, will be to transform legal asylum seekers into undocumented immigrants. They are unlikely to seek refuge in Guatemala, which has no administrative mechanism to process thousands of asylum applications — and which agreed to the deal with the United States only after Mr. Trump threatened severe sanctions. Instead, many will likely cross illegally into the United States and live in the shadows.

Mr. Trump’s response is to build his border wall, which got a lift last week when the Supreme Court said construction could proceed while challenges to funding it continue in the courts. But walls can be scaled, tunneled under and circumnavigated; Mr. Trump’s wall would not stanch the flow of migrants nor improve the conditions that drive them from their countries.

More confirmation of my observation that “Big Mac With Lies” is one of America’s most dangerous White Nationalist racist liars and enablers. Imagine what an ethical, honest public servant could do by having the courage and integrity to “blow the whistle” on Trump’s lies, fabrications, and racist attacks on the rule of law and on humanity!

Yes, the Post is right that “Big Mac’s” bogus claims about Guatemala are “risible,” meaning in plain English “laughable.” But there is nothing “funny” about a dishonest and cowardly public official whose lies and false narratives are killing innocent, vulnerable humans who (perhaps misguidedly) looked to the U.S. for legal protection.

Most outrageously, “Big Mac” and company think that they essentially can “get away with murder” (perhaps emboldened by Trump’s claim that he could shoot someone in board daylight and escape accountability). While, thanks to the Supremes, public officials have insulated themselves from most legal accountability for many of their outrageous misdeeds,  it’s up to history and future generations to insure that the legacy of McAleenan and his fellow “Germany 1939’ers” reflects their disingenuous disregard for the law, truth, and human values and their spineless support for the toxic policies of the worst and most immoral President in U.S. history. No, “just following orders” won’t be a defense for “Big Mac” before the Court of History.

Lawyers for the American Civil Liberties Union told a federal judge Tuesday that the Trump administration has taken nearly 1,000 migrant children from their parents at the U.S.-Mexico border since the judge ordered the United States government to curtail the practice more than a year ago.

In a lengthy court filing in U.S. District Court in San Diego, lawyers wrote that one migrant lost his daughter because a U.S. Border Patrol agent claimed that he had failed to change the girl’s diaper. Another migrant lost his child because of a conviction on a charge of malicious destruction of property with alleged damage of $5. One father, who lawyers say has a speech impediment, was separated from his 4-year-old son because he could not clearly answer Customs and Border Protection agents’ questions.

Acting Homeland Security secretary Kevin McAleenan has said that family separations remain “extraordinarily rare” and happen only when the adults pose a risk to the child because of their criminal record, a communicable disease, abuse or neglect. Of tens of thousands of children taken into custody at the border, 911 children were separated since the June 26, 2018, court order according to the ACLU, which cited statistics as of June 29 that the organization received from the government as part of ongoing legal proceedings.

During a July 12 tour of a detention center in McAllen, Tex., reporters saw almost 400 men being held in cages. They allegedly crossed the border illegally. (The Washington Post)While the judge recognized that parents and children might still be separated when a parent is found to pose a risk to their child, the ACLU and others say federal immigration and border agents are splitting up families for minor alleged offenses — including traffic violations — and urged the judge Tuesday to clarify when such separations should be allowed.Approximately 20 percent of the new separations affected children under 5 years old, the ACLU said, compared with about 4 percent last year.

“They’re taking what was supposed to be a narrow exception for cases where the parent was genuinely a danger to the child and using it as a loophole to continue family separation,” ACLU lawyer Lee Gelernt said in an interview. “What everyone understands intuitively and what the medical evidence shows, this will have a devastating effect on the children and possibly cause permanent damage to these children, not to mention the toll on the parents.”

The Justice Department and the Department of Homeland Security declined to comment Tuesday.

The tally of child separations adds to the approximately 2,700 children who were taken from their parents during a chaotic, six-week period from May to June 20 last year, when a Trump administration border crackdown triggered one of the worst crises of his presidency.

The policy sought to deter a crush of asylum seekers, who were surrendering as families at the U.S. southern border, by prosecuting parents for the crime of illegal entry and sending their children to federal shelters. Reports of traumatized, crying children led to widespread demands to reunite the families.

Trump ordered federal officials to stop separating families on June 20, 2018, and said it is the “policy of this Administration to maintain family unity” unless the parent poses “a risk” to the child.

Six days later in San Diego, U.S. District Judge Dana M. Sabraw, an appointee of President George W. Bush, ordered the Trump administration to reunite the families, a process that dragged on for months because the government had failed to track the parents and children after splitting them up. A still-unknown number of families were separated before the policy officially began.

McAleenan, who at the time signed off on the zero tolerance policy and carried it out as commissioner of U.S. Customs and Border Protection, told the Senate Homeland Security and Governmental Affairs Committee in May that family separations are “extraordinarily rare” and make up a tiny portion of the now more than 400,000 families taken into custody at the border since the court ruling.

At that time, he testified, about one to three family separations happened out of about 1,500 to 3,000 family members apprehended each day. He also said then that separations occur “under very controlled circumstances.”

Testifying before the U.S. House Oversight and Reform Committee on July 18, McAleenan emphasized that the separation process is “carefully governed by policy and by court order” to protect the children.

“This is in the interest of the child,” he said. “It’s overseen by a supervisor, and those decisions are made.”

Of the 911 child separations, 678 were for alleged criminal history, the ACLU said Tuesday, citing government records. Offenses included drunken driving, assault and gang affiliation, as well as theft, disorderly conduct and minor property damage.

Many cases lacked details about the alleged crimes, the ACLU said, and several charges were decades old. Among those separated because of concerns about parental fitness were an HIV-positive father of three young daughters and a mother who broke her leg and required surgery.

Child advocates and medical professionals have repeatedly warned that separating children from their parents can lead to lasting severe physical and emotional disorders.

“Forcibly separating children from their parents is like setting a house on fire,” Jack Shonkoff, a pediatrics professor at Harvard Medical School, said in an affidavit included in the ACLU’s motion. “Prolonging that separation is like preventing the first responders from doing their job and letting the fire continue to burn.”

Jennifer Nagda, policy director of the Young Center for Immigrant Children’s Rights, a child advocate for unaccompanied and separated children, told the U.S. House Committee on Oversight and Reform that the group represented about 120 children and found that nearly all separations were “contrary to the best interests of the child.”

“DHS officials with no child welfare expertise are making split-second decisions, and these decisions have traumatic, lifelong consequences for the children and their families,” Nagda said in her testimony. She also filed an affidavit in the ACLU’s case Tuesday.

It’s with very good reason that I consider “Big Mac With Lies” to be one of the most dishonest and dangerous public officials in America.

Some reporters seem to mistakenly “cut him some slack” because he: 1) served in the Obama Administration (which had its own very dismal record on treatment of families and children seeking asylum); and 2) unlike folks such as  “Gonzo,”  “Cooch Cooch,” Miller, Kobach, et al., he’s not a “lifelong White Nationalist ideologue.” 

But, I don’t see how being a liar, apologist, “cover up artist,” and human rights abuser in support of a racist White Nationalist Administration is somehow “better” than being a “true believer” in White Nationalist racism. Falsely claiming that Guatemala and Mexico are “Safe Third Countries,” that asylum applicants won’t show up for hearings (when they almost always do, particularly when they are given access to lawyers and have the system properly explained to them), and falsifying stats to paint an untruly negative picture of asylum seekers from Central America is no less vile than Trump’s lies and racist tweets.

As a lawyer and a graduate of Amherst Collge and Chicago Law, “Big Mac” is cerainly smart enough to know that places like Guatemala and Mexico don’t come remotely close to satisfying the legal definition of a “Safe Third Country.” He also has enough Government immigration enforcement experience to know for sure that the extralegal, cruel, and ineffective “enforcement only” approach he disingenuously advocates as a “Trump toady” won’t come anywhere near to solving the problems driving forced migration or saving the lives of the vulnerable.

I actually have a better understanding of what drives the Trumps, “Gonzos,” Millers, and “Cooch Cooches” of the world than what drives corrupt public servants like McAleenan to violate their oaths of office and to pick on those whose rights and human dignity they should be standing up for, no matter how vile the leadership of the Administration they nominally serve (actually, they serve the American people, not any particular political leader) might be.”Big Mac” is a disgrace to honest Federal civil servants and to all Americans who believe in democracy and “good government.” History must hold him accountable.
