ASYLUM AT THE END OF THE BIDEN ADMINISTRATION: A Disturbing, Dangerous, Dehumanizing Legacy of Betrayal, Missed Opportunities, and Abandonment of Humane Values!

Successive Administrations, aided by Congress and abetted by the Federal Courts, have broken the U.S. asylum adjudication system almost beyond recognition. Yet, they now have the audacity to blame their victims, hapless asylum applicants and their dedicated, hard working advocates, for the Government’s grotesque failures to carry out their statutory and constitutional duties to establish a fair, efficient, timely, humane, accessible system for asylum adjudication in the U.S. and at our borders.

I. INTRODUCTION & DISCLAIMER

Please listen very carefully to the following important announcement. 

Today, you will hear no party line, no bureaucratic doublespeak, no sugar coating, no BS, or other such nonsense. Just the truth, the whole truth, and nothing but the truth, of course as I define truth and see it through the lens of my five decades of work with and in the American immigration system.

I hereby hold you and anybody else associated with this event harmless for my remarks. The views expressed herein are mine, and mine alone, for which I take full responsibility. They also do not represent the position of any group, organization, individual, or other entity with which I am presently associated, have associated with in the past, or might become associated with in the future.  

Because we are approaching Christmas, I have a special gift for each of you. It’s a free copy of my comprehensive 3-page mini-treatise entitled “Practical Tips for Presenting an Asylum Case in Immigration Court.” 

I also want to caution you that much of what I’m telling you about asylum might become “OHIO” — that is “of historical interest only.” That’s because many believe that that if not living at the end of time, we are living at the end of asylum, at least as we know it. 

America has elected a party that basically pledges to destroy asylum along with many of our other precious democratic institutions. But, tragically, the so-called “opposition party” is running scared and has gone “belly up” on asylum and human rights. Not only are they unwilling to defend legal asylum seekers, but they are actively engaged in dismantling the legal asylum system at our borders with some of the worst regulations and policies since the enactment of the Refugee Act of  1980. 

It’s truly an appalling situation. We seem determined to repeat some of the most disgraceful parts of our history. I call it a “return to 1939” when xenophobia, myths, and lies about our ability to absorb refugees sent the German Jews aboard the notorious “St. Louis” back out to sea, where most of them eventually perished in the Holocaust. I ask you: “Is that really the world you want for yourselves and future generations?”

What I’m giving you today, is a very broad overview of U.S. asylum law. By necessity, there are many complexities, exceptions, special situations, and variables that I will not be able to cover in this type of survey. 

II. REFUGEE DEFINITION

I’m going to start with the definition of the term “refugee” in the Immigration and Nationality Act (“INA”) which was derived in large part from the U.N. Convention on Refugees, created after World War II to deal with the unacceptable response of Western democracies to the mass persecutions that lead directly to the Holocaust. Sadly, how soon we forget where we came from, in more ways than one.

Basically, a “refugee” is:

any person who is outside any country of such person’s nationality . . . and who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of, that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion, . . . . The term “refugee” does not include any person who ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion . . . . 

I have omitted special provisions relating to statelessness, certain refugees in their native countries, and so-called “coercive population control.” 

Under U.S. law, the term “refugee” generally refers to those who apply under our statutory overseas refugee system. Refugees who apply for protection from within the U.S. or at our border are referred to as “applicants for asylum” or, if successful, “asylees.” It is this group that I will discuss further.

III. ELEMENTS

    1. Persecution

Interestingly, the Act does not define the key term “persecution.” Courts and administrative authorities are literally “all over the place” on determining where “mere discrimination” or “harassment” ends and “persecution” begins. These determinations are often referred to as “rise to the level.” 

During my days on the bench, at both levels, I observed some judges who, remarkably, purported to believe that having a coke bottle shoved up your rectum, being made to stand in a barrel of cold water for days, or being beaten “only” a few times with a belt buckle was “just another bad day at the office” for hapless asylum seekers. I, on the other hand, was a little less immune to pain, my own or others. 

On the trial bench, I eventually found helpful guidance in a definition developed by the well-known former 7th Circuit Judge and prolific legal scholar Judge Richard Posner. In distinguishing among the three foregoing concepts, he stated:

Persecution involves, . . . the use of significant physical force against a person’s body, or the infliction of comparable physical harm without direct application of force (locking a person in a cell and starving him would be an example), or nonphysical harm of equal gravity —[for example,] refusing to allow a person to practice his religion is a common form of persecution even though the only harm it causes is psychological. Another example of persecution that does not involve actual physical contact is a credible threat to inflict grave physical harm, as in pointing a gun at a person’s head and pulling the trigger but unbeknownst to the victim the gun is not loaded.

B. Protected Grounds

Significantly, not all forms of severe harm, even those “rising to the level of persecution” under the foregoing definition, qualify an individual for asylum. The persecution must be “on account of” one of the five so-called “protected grounds:” race, religion, nationality, political opinion, or membership in a particular social group.

Of these, the first four are fairly straightforward. It’s the last ground “membership in a particular social group,” that is “where the action is” these days. 

That’s because the meaning of particular social group or “psg” is not readily apparent, and therefore somewhat malleable. For advocates, this presents a chance to be creative in behalf of clients. But, for government bureaucrats, including Immigration Judges, it often creates the fear of “opening the floodgates” and therefore becomes something that should be restrictively construed and sparingly applied.

My decision in Matter of Kasinga,  represents an early positive application of the “immutability or fundamental to identity” characteristic to grant psg protection to a young woman who feared female genital mutilation, or “FGM.” Since then, however, following the so-called “purge” of the Board of Immigration Appeals (“BIA”) by Attorney General Ashcroft, the requirements of “particularity” and “social distinction” have been added in an attempt to restrict the psg definition. 

C. Two schools of thought

As we move further into the refugee definition, I will introduce the “two schools of thought” or philosophies prevalent among government asylum adjudicators, including Immigration Judges.

Some believe that asylum law should be construed and applied to further the aims and purposes of the Refugee Convention and the Refugee Act: that is, to generously protect individuals fleeing persecution whenever possible. I’ll call this school “Mother Hens.”

The other school consists of those who believe that asylum is a “loophole” to “normal immigration” and therefore must be construed as narrowly and restrictively as possible in support of DHS enforcement. I call this school “Dick’s Last Resorters.” 

Since the Immigration Judiciary and the Asylum Office come disproportionately from the ranks of former prosecutors or government officials, “resorters” overall outnumber the “hens.” Conveniently, denying asylum is generally thought to be less likely to come to the attention of, and annoy or displease, the political officials who control both the Asylum Office and the Immigration Courts. Therefore, denial is often perceived to be more “career friendly” than being in the forefront of those generously granting protection. 

D. Nexus

 

Since many applicants are able credibly to establish that they have, or will face, severe harm upon return, the immigration bureaucracy has developed several methods for limiting the number of successful claims.

One is by “downplaying” the level of harm and straining to find that it “does not rise to the level of persecution.” That explains the “coke bottle up the rectum not a problem if you can still walk afterwards group” that I mentioned earlier. 

Another way of  denying facially legitimate claims involving severe harm is to actively search for ways to “disconnect” that harm from any of the five protected grounds. This works even in cases where the harm is very severe, clearly rising to the level of persecution. This focus on causation is called “nexus.”  

The “no nexus approach” often requires the adjudicator to ignore or circumvent the applicable doctrine of  “mixed motive.” By law, a protected ground does not have to be the sole, primary, or even predominant ground for the persecution. It is enough if a protected ground is “at least one central reason” for persecuting the applicant. But, by mis-characterizing the protected motive as merely “trivial” or “tangential” an adjudicator can attempt to avoid “mixed motive.” 

Normally, in law, an adjudicator would apply the “but for” test for determining causation. That is, if the harm would not have occurred “but for” the characteristic, then a chain of causation for that factor is established. 

However, in immigration, the rules have been turned upside down so that the adjudicator is encouraged to look for any “non-protected motive” and characterize that as the real overriding cause or motivation. Thus, in one infamous precedent involving harm to a family involved in a land dispute,  the BIA found, in the words of my esteemed colleague retired Judge Jeffrey S. Chase, that “another non-protected ground renders the family membership ‘incidental or subordinate’ and thus lacking the nexus required for asylum.”   In other words, the BIA converted the “but for” test that likely could have been met here into an “anything but” test that searched for a non-protected motive to defeat the claim.

E. Burden of proof/standard of proof

Moving on, the applicant has the burden of proof on asylum. To carry this burden, they must show a “well-founded fear” of future persecution. 

The Supreme Court in 1987 established that the standard for a well-founded fear was significantly less than a probability, the position unsuccessfully argued by the Government, and suggested that it could be as low as a 10% chance.   

Following that decision, the Board of Immigration Appeals, the “BIA,” the highest administrative tribunal in immigration, expressed the well-founded fear standard as a “reasonable likelihood” or “reasonable person,” a familiar legal rubric.  In doing so, the BIA specifically noted that asylum could be granted even where persecution is substantially less than probable. In other words, the asylum applicant should be treated generously in accordance with the “benefit of the doubt” described in the U.N. Handbook for adjudicators under the Refugee Convention, a guide that actually was given significant weight by the Supreme Court.  

Despite these overt expressions of legal generosity in applying the well-founded fear standard, the reality has proved quite different. Some Immigration Judges, BIA Appellate Judges, and Circuit Court Judges do generously adjudicate asylum claims in accordance with these legal precedents. But, for many, these standards have become mere “boilerplate citations” that are too often not actually followed in practice. Thus asylum denial rates, even for substantially similar cases, have varied widely depending on the predilections of individual Immigration Judges. 

F. Past Persecution

You might remember that, in addition to referencing a well-founded fear of future persecution, the refugee definition also states that “persecution” can be a basis for asylum eligibility. This has been taken to refer to “past persecution” as a potentially independent basis for establishing asylum eligibility.

In one of the few administrative actions that actually benefits asylum seekers, and helps implement a more generous and legally appropriate construction of well-founded fear, there are regulations that combine the concepts of past and future persecution. 

Thus, an individual who can establish that they have suffered past persecution is entitled to a regulatory presumption of a future well-funded fear of persecution in that country. The burden of proof then shifts to the DHS to rebut that presumption.

The DHS can achieve this in two ways. One is to show that the applicant has a “reasonably available internal relocation alternative” within the country that would allow them to avoid future persecution. The other is to demonstrate “fundamentally changed circumstances” that would obviate the well-founded fear of future persecution.

However, even if the DHS succeeds in rebutting the presumption, asylum may still be granted in the absence of a current well-founded fear, as a matter of discretion, in two situations.

One is if the applicant can establish “other serious harm” — not persecution but harm of a similar level — if returned to their native country. This can be things such as natural disaster, famine, civil disorder, or environmental catastrophe.

The other is if the applicant can show “compelling reasons” arising out of the severity of the past persecution. These are sometimes known as “Chen grants,” after a landmark BIA precedent.  In that case, asylum was granted to an applicant whose family had suffered terribly during China’s “cultural revolution,” even though the cultural revolution was by then over. 

These are also sometimes described as discretionary grants of “humanitarian asylum.” However, it is wrong to assume that Immigration Judges have a general authority to grant asylum in any humanitarian situation. 

These discretionary grants are available only if and when an applicant successfully establishes past persecution and the DHS rebuts that presumption. As we can see, therefore, the concept of “past persecution” is important and carries a number of important benefits for an applicant who can establish it. I will now turn to an additional benefit. 

G. Countrywide Fear

Normally, the burden is on an applicant to establish that the well-founded fear of persecution operates “countrywide.” In other words, that they can not reasonably avoid persecution by relocating internally. 

However, in two common situations under the regulations, the applicant enjoys a rebuttable presumption that the danger exists countrywide. One is where the government is the persecutor. The other is where the applicant establishes past persecution. In both these instances, the burden would then shift to the DHS to rebut the presumption.

H. Other Key Elements: Credibility, Corroboration, Pattern Or Practice

In any asylum adjudication, the credibility of the applicant is a key factor.  Although the regulations state that credible testimony could be enough to support asylum eligibility, this is more theoretical than real. In most asylum cases, a combination of credible testimony supported by reasonably available corroborating evidence will be necessary for success.

There is also a regulatory provision allowing individuals to qualify for asylum, if they can establish a “pattern or practice” of persecution in their home countries. All of the foregoing are important and complex concepts that could easily be the subject of a full class or even a course. Needless to say, they are beyond the scope of this presentation.

I.  Exclusions From Asylum

There are a number of categories of individuals who are specifically excluded from asylum eligibility by statute or regulation. Some of these provisions relate directly to exclusions contained in the Refugee Convention. Others do not.

Individuals are ineligible if they are “firmly resettled” in another country. 

They are also ineligible if they fail to file for asylum within one year of arriving in the United States. There are exceptions for “exceptional circumstances” directly related to the delay in filing and “materially changed circumstances.”

Persecutors, such as Nazi war criminals, are excluded, as are terrorists and national security risks. It’s worth remembering, however, that “one person’s terrorist could be another’s ‘freedom fighter.’” Ironically, George Washington and other leaders of the American Revolution would be “terrorists” under the INA’s expansive definition.

Another significant class of ineligibles are individuals who have committed “particularly serious crimes” in the U.S. Those convicted of “aggravated felonies” under state or federal law — a statutorily defined category that covers some crimes that are neither felonies nor particularly “aggravated” — are specifically covered by this definition. But, other crimes may also be found to be “particularly serious” on a case by case basis involving the weighing of the circumstances surrounding the crime.

Additionally, some individuals who had an opportunity to apply for asylum in what is deemed to be a “safe third country” are also excluded from asylum in the U.S. Right now, the only specifically designated “safe third country” is Canada. Nevertheless, both the Trump and Biden Administrations have de facto treated other countries, some demonstrably dangerous and without functioning asylum systems, as “safe” for various purposes without regard to the law or reality.

Moreover, in what are known as the “Death to Asylum Regulations,” promulgated just before they left office in 2021, the Trump Administration tried to expand the exclusions from asylum to include just about everyone who conceivably could have otherwise qualified. The implementation of these regulations remains enjoined by court order. Nevertheless, the Biden Administration was able to implement forms of some of these exclusions at the border. Undoubtedly, the attempt to finally kill off asylum will be renewed under “Trump 2.0.”

J. Discretion 

The granting of asylum is not mandatory. Individuals who “run the gauntlet” to establish eligibility must still merit a favorable exercise of discretion from the adjudicator. 

The standard for exercising discretion in asylum cases was previously set forth in my decision in Matter of Kasinga.  Consistent with the generous purposes of the Convention and the Refugee Act, asylum should be granted to eligible applicants in the exercise of discretion in the absence of any “egregious” adverse factors.

The previously-mentioned “Death to Asylum Regulations” would have encouraged Immigration Judges and Asylum Officers to deny asylum in the exercise of discretion to almost anyone who might have survived their expanded proposed categories of “mandatory exclusions.” Although those particular regulations remain enjoined, the Biden Administration has invoked various presumptions and restrictions that use discretion to basically shut out most applicants not using their defective “CBP One App” to schedule an appointment at a port of entry. 

IV. BENEFITS OF ASYLUM

Among the many benefits of asylum, an asylee is authorized to work in the U.S., can bring in dependents derivatively, can travel with a Refugee Travel Document (although not back to the home country), and has automatic access to the process for a green card after one year of “good behavior.” That, in turn, eventually can lead to eligibility for citizenship. 

V. WITHHOLDING OF REMOVAL AND CONVENTION AGAINST TORTURE (“CAT”)

Those denied asylum for mandatory or discretionary reasons can still apply for withholding of removal and protection under the Convention Against Torture, affectionately known as the “CAT!” Although similar in some ways to asylum, there are some major differences, which I can’t go into in detail here.

Generally, withholding and CAT have higher standards to qualify and are mandatory, rather than discretionary in nature. However, they offer less advantageous protection in a number of ways: they don’t protect against removal to third countries; they don’t allow the recipient to bring dependents; they provide no permanent status, path to a green card, or route to U.S. citizenship; they require individual applications for work authorization; and they don’t allow travel. In fact, departure from the U.S will execute the underlying order of removal and bar reentry!

For many who will be denied asylum at the border and beyond under restrictions imposed by Biden and Trump, withholding and CAT, notwithstanding their drawbacks, might become the sole remaining methods for securing protection from persecution and or/torture. 

VI. ACCESS TO THE SYSTEM

The INA states that: 

Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum . . . .

Individuals arriving at our border are supposed to be asked about fear of return and screened by a trained Asylum Officer for “credible fear” a lesser standard that determines if they have a plausible claim that should be given a full adjudication by EOIR.

Within the U.S., individuals can apply for asylum “affirmatively” to the USCIS Asylum Office or “defensively” before the Immigration Court. Those “affirmatives” not granted by the Asylum Office after interview are “referred” to EOIR for a full hearing on their application.

These very straightforward statutory rights have been violated in numerous ways by the last two Administrations, so much so that the asylum system at border is close to extinction.

We don’t have time to go into all the complex and often incomprehensible details of this scurrilous “bipartisan attack on the legal right to asylum.” Basically, the Biden Administration recently finalized highly restrictive regulations that most experts find blatantly illegal. Essentially, anybody who applies for asylum between legal ports of entry is “presumed ineligible” unless they meet narrow exceptions.

The only somewhat viable alternative is waiting in extremely dangerous, and often squalid, conditions in Mexico to schedule an appointment through a notoriously inadequate “CBP One App” — a process that can take many months, at best. However, the incoming Trump Administration irrationally has pledged to eliminate CBP One thus effectively cutting off access to asylum at the border.

Disgracefully both the Trump and Biden Administrations have encouraged Mexico, Panama, and other countries in Central America to stop migrants from reaching the U.S., often using force, without any access to fair asylum adjudication. Sometimes, the U.S. actually funds these lawless deportations by so-called “transit countries.”

VII. WOES OF ADJUDICATING BODIES

Both the Asylum Office and EOIR are running ungodly backlogs, including well over one million un-adjudicated asylum cases at each agency! Additionally, EOIR has an overall backlog of Immigration Court cases approaching four million, and growing as we speak.

Both the Asylum Office and EOIR suffer from endemic inefficiency, antiquated procedures, severe quality control issues, shortage of staff, and chronic leadership problems that Administrations of both parties have failed to address in a serious manner. In fact, each of the last few Administrations has aggravated these problems in many ways, leading to an astounding level of dysfunction and systemic unfairness.

Moreover, in Immigration Court, there is no right to appointed counsel, despite the “life or death” stakes. So, many applicants are forced to face the system unrepresented or with woefully inadequate representation. Detention of many asylum seekers in substandard, inherently and intentionally coercive conditions, in obscure locations compounds these problems. EOIR also has a huge inconsistency problem with individual Immigration Judge asylum grant rates “ranging” from 0-99%.

Somewhat ironically, despite all of the anti-asylum bias and roadblocks in the system, individuals fortunate enough to get well-qualified representation, and to have applied before the onslaught of “death to asylum regulations and policies,” win their asylum cases on a daily basis. This adds to the “crap shoot” atmosphere for “life or death” justice that disgracefully has been fostered by Administrations of both parties. Nevertheless, we must remember that even in these challenging times, there are many thousands of lives out here that can be saved through great lawyering!

VIII. CONCLUSION

In summary, successive Administrations, aided by Congress and abetted by the Federal Courts, have broken the U.S. asylum adjudication system almost beyond recognition. Yet, they now have the audacity to blame their victims, hapless asylum applicants and their dedicated, hard working advocates, for the Government’s grotesque failures to carry out their statutory and constitutional duties to establish a fair, efficient, timely, humane, accessible system for asylum adjudication in the U.S. and at our borders.

Nobody in the “power structure” of any branch of the Government, in either party, appears seriously interested in fixing this dysfunctional travesty of American justice. The result has been a series of gimmicks, restrictions of access, skewed results, and failed “deterrents” that have put lives in jeopardy and undermine our entire justice system.

One political party “gins up” fear mongering, hate, and lies about asylum seekers in an attempt to eradicate them for political advantage. The other party is too cowardly to defend them.

Few, if any, politicos on the national level have the moral courage and clear vision to mount a well-justified, evidence-based defense of asylum seekers and other migrants. Likewise, few of them advocate for investing in achievable improvements in the system. Instead, they seek partisan political advantage, on the backs of the desperate and disenfranchised, by eagerly and cynically pouring money and manpower into cruel, ultimately ineffective, enforcement and “deterrence” gimmicks. 

The latter, not incidentally, have spawned a highly profitable and politically potent industry that benefits from every deadly, failed border deterrence “enhancement.” No wonder positive change and creative problem solving are so elusive, and so many of our politicos lack the guts effectively to protect immigrants’ lives, human dignity, and rights at the border and beyond!

More than 50 years of experience working in our immigration systems, at different levels, and from many angles, tell me the following inalienable truths:

  • Human migration is real;
  • Forced migration is exactly that;
  • It won’t be stopped by walls, prisons, deterrents, or other cruelty;
  • Asylum is a human and legal right; 
  • Immigrants are good for America; and
  • Due process for all persons in the U.S. is essential. 

My time on the stage is winding down. But, yours, my friends, is just beginning. I call on you to join our New Due Process Army (“NDPA”), use your skills, commitment, and power to resist the haters, oppose the wobbly enablers, expose political bullies who trade away lives and rights that aren’t theirs, and fight to finally deliver on our nation’s yet-unfulfilled promise of due process, fundamental fairness, and equal justice for all in America!

Nilu Chadwick recognizes some of the children’s names right away. Chadwick, a lawyer for Kids in Need of Defense, has spent the past five years poring over lists of families separated under the Trump administration’s “zero tolerance” policy whose cases have yet to be resolved. Some of the children’s names stand out because she crossed paths with them back in 2018, when she represented them at their immigration hearings after they were torn from their parents’ side at the southern border. Those names always remind her of what she witnessed that year. The eerie silence of the children’s shelters. The kids so young that they couldn’t even explain who they were or where they came from. The hearing she had to pause in order to soothe a client with a nursery rhyme. Then there are the names that have simply grown familiar through repetition: the children whose cases appeared on the lists years ago and remain open.

The process of reunifying families separated under “zero tolerance” began in June 2018, two months after the policy was officially implemented. The ACLU had filed a class-action lawsuit on behalf of separated families, Ms. L. v. U.S. Immigration and Customs Enforcement, and during the litigation, a federal judge halted Trump’s policy and ordered its victims reunified within 30 days. Some of these reunifications were relatively straightforward. The government had records of around 2,800 separated families, and most of those parents and children were still in the U.S. — maybe they’d been sent to separate ICE facilities or the parents were in detention while their children had been placed in the custody of the Office of Refugee Resettlement. But for about 470 families, the parents had already been deported. When the Trump administration declined to track them down, Lee Gelernt, the head lawyer for the plaintiffs, stood up in court and said the ACLU would do it. A steering committee was put together comprising a team from the New York law firm Paul, Weiss and representatives from three NGOs, including Kids in Need of Defense and the organization Justice in Motion. “Little did I know what we were taking responsibility for,” Gelernt told me.

The first hurdle the committee faced was the total disorganization with which “zero tolerance” had been implemented. “There was no intention of reuniting families, and so they didn’t design the system to be able to keep track,” Nan Schivone, Justice in Motion’s legal director, told me. The agencies involved — Customs and Border Protection, which took families into custody; ICE, which oversaw their detainment; the ORR, which was responsible for the separated children — didn’t have a comprehensive system to share data with one another, nor did they always keep records linking parents with their children. If children were released from ORR custody into the care of family or friends, the government did limited follow-up. “We give you a luggage tag for your luggage,” said Gisela Voss, a former board member of Together & Free, which supports families seeking asylum. “We separated parents from their kids and didn’t give them, like, a number.”

It took two months, until August 2018, for the administration to provide the steering committee with the phone numbers of the deported parents; a quarter of the numbers were missing. The committee began its search, making calls and performing social-media investigations. Then, in January 2019, the HHS Office of Inspector General revealed that more families had been separated than the Trump administration had previously disclosed. Nine months later, the Justice Department finally produced those names. There were 1,500 of them, and the vast majority of the parents had been deported.

But the more that people who have dedicated their lives to this task continue to search, the more it becomes apparent that there will never be a clean resolution. There will always be another family. They know, too, that reunification solves only one problem. Families may be together again, but whether they will ever be whole is another question entirely.

LOS ANGELES — The Trump administration intentionally separated thousands of migrant children from their parents at the southern border in the spring of 2018, an aggressive attempt to discourage family crossings that caused lasting trauma and drew widespread condemnation.

What is only now becoming clear, however, is that a significant number of U.S. citizen children were also removed from their parents under the so-called zero tolerance policy, in which migrant parents were criminally prosecuted and jailed for crossing the border without authorization.

Hundreds, and possibly as many as 1,000, children born to immigrant parents in the United States were removed from them at the border, according to lawyers and immigrant advocates who are working with the government to find the families.

In many cases, the U.S.-born children were placed into foster care for lengthy periods, and some have yet to be reunited with their parents, lost in the system nearly five years after the separations took place.

‘Kings and Queens’ of Border Puzzle Courts Divided on Liability

Welcome back to Opening Argument, a column where I dig into complicated legal fights, unpack issues dividing appeals courts, and discuss disputes ripe for Supreme Court review. On tap today: a look at when border patrol agents can be sued for violating someone’s constitutional rights.

Border patrol agents allegedly took Anas Elhady’s coat and shoes, and held him in a near-freezing cell without a blanket after he legally crossed the border back into the U.S. from Canada. Robert Boule was allegedly shoved to the ground by a border patrol agent who came onto his property without a warrant to check the immigration status of a guest at the inn Boule owns in Washington.

Can they each sue the agents for damages? The answer right now depends on which court is hearing their case.

The Supreme Court is expected to provide more clarity in a case it’s hearing later this term. Depending on how the justices rule, it could further insulate border patrol agents from liability.

If there’s no way to hold individual agents accountable for their conduct at the border, “then custom agents are kings and queens unto themselves,” said Elhady’s attorney Gadeir Abbas, a senior litigation attorney at the Council on American-Islamic Relations.

A 1971 Supreme Court decision gave people the right to hold federal officials liable when their constitutional rights are violated, but courts have been trying to figure out if or when that applies to immigration officials. So far, they’re coming to different conclusions.

The U.S. Court of Appeals for the Sixth Circuit said Elhady, who claimed his detainment violated his Fifth Amendment right to due process, didn’t have a right to sue the agents involved. The Ninth Circuit said Boule did.

But the Supreme Court specifically refused to consider whether Bivens should be overruled when it agreed to hear the agent’s appeal in the Boule case. The justices will instead decide if you can bring a suit under Bivens for a First Amendment retaliation claim and whether you can sue federal officers engaged in immigration-related functions for allegedly violating your Fourth Amendment rights. Oral arguments in the case haven’t yet been scheduled.

“I could imagine a Supreme Court, in an opinion by Justice Alito saying something like ‘Yes Bivens still is the law, but we find that in this case involving enforcement of the immigration laws, Bivens claims really don’t fit and don’t belong, and limit Bivens one step further and say immigration cases are different,” said Kevin Johnson, the dean of University of California Davis School of Law.

If the court does that, Johnson, who’s written extensively on immigration law and civil rights, said it would embolden border patrol agents to feel like they can act with a great deal of discretion that will never be questioned.

Here’s a telling excerpt from the foregoing report issued by the SPLC in 2020:

The number of deaths resulting from an interaction with CBP officers are indicators of the horrific culture of abuse, corruption, and disregard for human life that plagues the nation’s largest federal law enforcement agency. Unfortunately, these killings are not the only examples of abuse of power and corruption within CBP.

Numerous studies — both internal and external — have shown that CBP is plagued with a culture of impunity, corruption, and abuse. Its systemic problems also run deep. The discovery of a secret Facebook group full of racist, misogynist and xenophobic posts by Border Patrol agents brought to light more evidence of the agency’s culture of abuse. In it, agents routinely made sexist jokes, made fun of migrant deaths, and shared other hateful content. A year later, little action was taken by CBP, again pointing to the lack of transparency and accountability for the agency. Countless other reports have linked CBP to cases of officer misconduct, corruption and a general lack of accountability for criminal conduct and abusive actions.

Doesn’t sound to me like an ideal candidate for freedom from individual constitutional tort liability! Indeed, the reasons for applying Bivens to immigration agents appear quite compelling. Hard to think of a law enforcement agency more in need of “strict scrutiny.”

But, with the current Court majority, who knows? Kevin’s “highly educated guess” is as good or better than anyone else’s. After all, the Supreme’s majority had little difficulty enabling constitutional and human rights abuses carried out by the Trump regime on asylum seekers and other vulnerable migrants — in other words, “Dred Scottification” of the “other!”

Judge Kacsmaryk was appointed to the bench by Trump & McConnell in 2019. He is a former Federal prosecutor, deputy general counsel of a right wing religious group, and member of the Federalist Society. His nomination was (obviously unsuccessfully) opposed by more than 200 prominent civil rights, religious tolerance, and human rights groups.

Here’s an excerpt from their letter in opposition addressed to the Senate:

On behalf of The Leadership Conference on Civil and Hum­­­­an Rights, a coalition of more than 200 national organizations committed to promoting and protecting the civil and human rights of all persons in the United States, I write in strong opposition to the confirmation of Matthew Kacsmaryk to be a U.S. District Judge for the Northern District of Texas.

Nominees to the federal courts must be committed to respecting the law, Constitution, and core American values of justice, fairness, and inclusivity.  Mr. Kacsmaryk does not meet this standard.  He is an anti-LGBT activist and culture warrior who does not respect the equal dignity of all people.  His record reveals a hostility to LGBT equality and to women’s health, and he would not be able to rule fairly and impartially in cases involving those issues.

Interestingly, the letter was signed by none other than Vanita S. Gupta, then President & CEO of the Leadership Conference on Civil and Human Rights and currently the Associate Attorney General of the U.S. 

Gupta and her colleagues had Judge K “pegged” as an unqualified righty bigot then! But, with the lineup currently in place at the 5th and the Supremes, it remains to be seen whether there is any effective short-term remedy for his grotesque abuses of power and human rights.

Judicial appointments are important! Maybe it’s time for Gupta and others at DOJ to treat Immigration Judge and BIA appointments as such!

President Joe Biden has taken some steps toward reversing his predecessor’s legacy of broad, indiscriminate immigration enforcement, including a recent announcement that it will no longer detain immigrants at two locations under scrutiny for alleged abuses.

But Republicans are adamant that increased immigration enforcement be a prerequisite to any broader immigration reform.

“There’ll be no immigration reform until you get control of the border,” Sen. Lindsey Graham (R-SC) told Roll Call last month.

There are now nearly 40 percent more people in immigration detention compared to when Biden first took office, and his administration is continuing to turn away most migrants arriving on the border under pandemic-related restrictions put in place by his predecessor, President Donald Trump, which have led to the expulsions of more than 350,000 people this year alone.

But research shows that the threat of detention and deportation in the US doesn’t dissuade migrants from making the journey to the southern border, especially if they are victims of violence and may be seeking to escape the “devil they know” in their home countries.

“Managing migration at the border, particularly the kind of migration we’re seeing now, from a strictly deterrence, enforcement lens is just not sustainable in the long run and is not having the impact that people think it should have,” Theresa Cardinal Brown, managing director of immigration and cross-border policy at the Bipartisan Policy Center, said. “That’s why we need to rethink our paradigm for how we talk about migration and everything that we do at the border.”

Knowledge of US immigration detention, however, did have an unintended effect on survey takers in Ryo’s experiment — it made them more likely to think outcomes and legal procedures in the American immigration system are unfair. That is worrisome, given that perceptions of fairness are significant predictors of people’s willingness to obey the law and cooperate with legal authorities, Ryo said.

“We really ought to be concerned about the extent to which generating these kinds of perceptions of unfairness can backfire in terms of more people disregarding our laws and undertaking that dangerous journey in order to get to our border and try to cross it,” she added.

“Enforcement only doesn’t work” has been one of the key “themes” of Courtside since “Day 1.” The answer has also been clear — due process, fundamental fairness, racial equity, practical scholarship leading to durable solutions. 

The converse of “enforcement only doesn’t work” is also true:  A more realistic, more generous legal immigration system that advances due process and equality while taking advantage of “market factors” that attract and drive migration would also lead to more efficient and effective enforcement. Many, perhaps the majority, of those we are now wasting time and money on cruel and ultimately futile attempts to detain, deter, and remove would actually be a huge benefit to our nation if they were allowed to migrate legally on either a permanent or temporary basis.  

I’ve been saying for a long time now that convincing folks that our legal system is basically bogus — falsely promising a fairness and dignified treatment we aren’t delivering — merely serves to drive migrants to enter the “extralegal” or “black market” system that helps support our economy. The real “beneficiaries” of “mindless immigration enforcement” and a dysfunctional legal system are smugglers, cartels, and exploitative employers. Also, obviously, corrupt GOP politicos benefit from having a permanent, disenfranchised, traumatized, largely non-White “black market labor pool” to prop up their economy while serving as an easy target to “whip up” their racist base. 

Bad policies, driven by ignorance, myths, bias, cowardice, and racism will continue to produce lousy results — for the migrants and for our nation. Smarter, more courageous, more intellectually honest legislators and public officials are necessary. Whether voters will be wise enough to elect them remains to be seen.

SAN DIEGO (AP) — The Biden administration on Friday announced plans for tens of thousands of asylum-seekers waiting in Mexico for their next immigration court hearings to be allowed into the United States while their cases proceed.

The first of an estimated 25,000 asylum-seekers in Mexico with active cases will be allowed in the United States on Feb. 19, authorities said. They plan to start slowly with two border crossings each processing up to 300 people a day and a third crossing taking fewer. Administration officials declined to name them out of fear they may encourage a rush of people to those locations.

The move is a major step toward dismantling one of former President Donald Trump’s most consequential policies to deter asylum-seekers from coming to the U.S. About 70,000 asylum-seekers were enrolled in “Remain in Mexico,” officially called “Migrant Protection Protocols,” since it was introduced in January 2019.

On Biden’s first day in office, the Homeland Security Department suspended the policy for new arrivals. Since then, some asylum-seekers picked up at the border have been released in the U.S. with notices to appear in court.

Earlier this week, Press Secretary Jen Psaki appeared to say it would take weeks if not months for the Administration to develop a plan to dismantle “Remain in Mexico.”

These are all individuals who have been previously screened and found to have a “credible fear” of persecution by a USCIS Asylum Officer. Many have been waiting for hearings for more than one year and have had their hearings postponed by EOIR time after time.

Additionally, many of  the Immigration Judges assigned to the “Remain in Mexico” Program have notoriously high asylum denial rates, some approaching 100% denials.

I sure hope that the Pro Bono Bar is working with USCIS and EOIR to insure that all of these individuals are represented. As we know, that’s the key not only to insuring court appearances, but also to increasing the chances for success on the asylum application.

Vigorous representation of asylum seekers will also be the key to dismantling the aggressive anti-asylum, anti-due-process “jurisprudence” that the defeated regime attempted to implement at a “weaponized” EOIR. Where necessary, these cases must be litigated to the Courts of Appeals and used as examples of the pressing need for reform of the broken, unfair, and dysfunctional U.S. Immigration Courts.

For now, it remains unclear what will happen to newly arriving asylum applicants. Will they receive the “credible fear” screening to which they are legally entitled? (It appears that some families applying for asylum have been screened and released to await hearings in the U.S.) Or, will they be arbitrarily returned to harm’s way with no process at all, pursuant to Stephen Miller’s bogus “CDC border closing order” that has yet to be repealed?

After days of confusion about changes along the southern border, the Biden administration on Wednesday said immigrants should not try to enter the US because most will still be turned away under a Trump-era policy that has recently come under legal scrutiny.

Confusion about who was being allowed into the US in recent days forced the administration to issue a stronger warning. Last week, reports of some families being allowed into the US after being apprehended at the border resulted in speculation that immigrants would no longer be immediately expelled and instead be allowed to fight their immigration cases from within the United States. In the Rio Grande Valley in South Texas, immigration advocates have reported seeing about 100 people a day released by Customs and Border Protection. In other parts of Texas, shelters have also seen increasing numbers of immigrant families, but it is not clear why.

Attorneys and advocates who work with immigrants along the border have been bombarded with phone calls and texts about whether they should try their luck at getting into the US. Erika Pinheiro, policy and litigation director with the immigrant advocacy group Al Otro Lado, said it was “incredibly disappointing” that the Biden administration has continued to expel immigrants under the CDC order.

“We know now that the CDC order prohibiting asylum processing at the border did not arise from public health concerns but rather was part of Stephen Miller’s efforts to dismantle the US asylum system and was implemented despite opposition from CDC leadership,” Pinheiro said, referring to one of Trump’s former senior advisers. “US expulsions of asylum-seekers, including infants, constitute plain violations of domestic and international laws meant to protect vulnerable refugees. CBP absolutely has the resources to process asylum-seekers in a safe and humane way.”

The turnbacks, known as expulsions, are legally different from deportations, which would mean an immigrant had actually undergone the immigration process and found to not be legally allowed to stay in the US. Critics say the government is using the public health orders as an excuse to turn back immigrants at the border.

“While we recognize that the Biden administration has been saddled with a lot of bad policy and structural problems, it cannot continue the Trump administration practice of turning away people in danger based on illegal policies, such as the notorious and pretextual Title 42 policy,” said Lee Gelernt, an attorney with the ACLU.

“Go suffer and die somewhere else, out of our sight,” might not be the best message for an Administration trying to re-establish its human rights and humanitarian leadership and credentials. Ever hear of the “St. Louis Incident?” It’s always easy to find a way to “just say no” to refugees — and the consequences are seldom pretty. 

Those who won’t learn from history are destined to repeat it. Refugee and forced migration situations happen in the “here and now;” they can’t be “back burnered” — no matter how much policy officials might wish otherwise. In a forced migration situation, “doing nothing” is an action that produces consequences for both the forced migrant and those who ignore their plight.

There are many daily potentially deadly and dehumanizing consequences of continuing to ignore asylum laws and Constitutional due process for asylum seekers at our Southern Border.

One predictable one: Instead of turning themselves in at the border or to the Border Patrol shortly after entry, as had been happening until Miller & co. intervened, those seeking refuge apparently have gotten the message that our legal system is and remains a sham for them. Consequently, increasingly they are simply evading the Border Patrol and disappearing into the interior with no screening whatsoever — health, legal, or background. Why not harness the expertise and proven problem solving abilities of folks like Lee, Erika, and many other members of the New Due Process Army rather than fighting with and resisting them? 

Instead, it looks like time and resources will continue to be wasted on forcing policy changes through litigation. Meanwhile, vulnerable asylum seekers and their families will continue to suffer as illustrated by this recent article from HuffPost about the human consequences for those caught up in the Government’s scofflaw border policies.

 Last week, 9000 Hondurans were beaten and tear-gassed in Guatemala as they tried to make their way to the U.S. border. More will be coming. The Biden administration just introduced the most comprehensive immigration bill since Ronald Reagan and also hopes to embark on a new strategy for the Northern Triangle of El Salvador, Honduras and Guatemala.

This is undisputedly good news for a region ravaged by two Category 5 hurricanes in 2 weeks and an economy devastated by the Covid pandemic. But, unless that aid directly addresses the rampant corruption that has taken hold in the region, it will not stop thousands of desperate people from fleeing countries that give them little hope to survive much less flourish.

Make no mistake, it is corruption that has stolen hope from the region. Elites steal from school and hospital budgets to fund political campaigns and line pockets. Politicians give family members and supporters coveted government positions that should go to those most qualified. Police are bribed and threatened to look away while drug traffickers and gangs shatter communities.

Until this staggering systemic corruption is dismantled and the education, health and security institutions strengthened, Central Americans have little reason to hope for a future in their own countries.

During his presidential campaign, Joe Biden issued just one policy position for the Western Hemisphere and it was on Central America. In it he proposed a number of worthy initiatives, but one merits special consideration– a Central American anti-corruption commission that operates outside the control of the elites who are most threatened by its existence.

To be successful, this commission must learn from past experiences in Guatemala (CICIG), Honduras (MACCIH) and El Salvador (CICIES). While the first two enjoyed significant success, as soon as U.S. and local political pressure waned even a little, the local elites joined together to expel them.

Easier said than done. Many of the corrupt governing elites in Central America have close ties to our Government. They aren’t lightly going to let foreign assistance, whether from governments, NGOs, or private agencies go anywhere but their own pockets.

Also, Republicans in Congress have shown no willingness to deal with the overt corruption, grafting, and grafting of the Trump regime. 

But the article is spot on about two things. Most Central American migration is driven by political punishment and exploitation of the people by corrupt government elites and those allied with them (gangs, in many instances). Far from being “random violence” or “common crime” as many restrictionists and border bureaucrats claim, it’s simply a variation of classic political, ethnic, and social group persecution. Those fleeing this abuse are refugees. Only by abdicating the law, intentionally skewing it, and too often just overtly violating it (sometimes with the complicity of courts, sometimes in violation of court orders) has our Government been able to avoid granting them the legal protection they deserve.

Second, desperate refugees are going to continue to come as long as they perceive it’s safer here than in their broken home countries or any of the other countries they will have to cross to get there. No walls, prisons, death at the border, violations of domestic and international law, racist rhetoric, illegal deportations, child abuse, misogyny or or other cruel, inhuman, and immoral policies will stop human migration.

We know roughly how many have been illegally returned and imprisoned. We have some “guesstimates” as to how many additional border crossers our failed policies have killed. 

But, we have little or no idea how many have taken to heart our message about the falseness of our claim to be a “nation of laws” and the readily apparent bankruptcy of our legal system. Undoubtedly, those who “get it” have or will in the future simply keep crossing the border until they die in process or get to the interior where their chances of melding in and surviving are much better than their chances of getting a asylum or other protections from an EOIR that still appears to be carrying out the Steven Miller White Nationalist agenda.

The “government policies” of actively discouraging and punishing asylum applicants who apply in an orderly way at the border is as insanely stupid as it is cruel and illegal. Actually, allowing individuals to apply for asylum at the border “regardless of status” is a hallmark of the Refugee Act of 1980!

A few thousand desperate refugees who walk here from Central America pose no realistic threat to America or our national security. They merely detract attention from the real threats: armed right wing insurrectionists launching a deadly attack on our Capitol, right wing domestic terrorists energized by Trump, and maskless “magamorons” running around spreading deadly disease. 

Process those applying at the border promptly under the appropriate generous legal criteria after giving them access to trained asylum advocates. Admit those who qualify after proper health and security screening. Work with the UNHCR and NGOs on how to handle those who don’t meet refugee criteria. Just aimlessly returning them to danger zones in the middle of a pandemic is obviously a nonstarter. So, we’re going to need smarter people, with real expertise and a humanitarian outlook, working on better solutions. We know lots about what DOESN’T work. Now, we need to come up with what WILL work.

The following three papers have been prepared as part of a process, organized jointly by the Center for Migration Studies of New York (CMS) and the Zolberg Institute on Migration and Mobility at the New School, to identify ways to strengthen the US immigration and refugee protection systems through administrative action. Rebuilding the US Refugee Resettlement Program

This paper offers an historic review of the US refugee resettlement program. It spans the colonial era, to the establishment of the first distinct US admissions policies for persons fleeing persecution in 1917, to the creation of the formal US Refugee Admissions Program (USRAP) in 1980, and to the Trump administrations’ denigration of and attempts to eviscerate the program. It proposes ways that a new administration can rebuild this crucially important program and put it on more secure footing. In particular, it recommends that a new administration:

  • Reframe the discourse on refugee resettlement to emphasize its central importance to the nation’s identity and the way it serves the national interest.
  • Rebuild the capacity of the federal government to administer the program and the badly depleted community-based resettlement infrastructure that is central to the program’s success.
  • Hold emergency consultations with Congress to increase refugee admissions in Fiscal Year (FY) 2021, and consult soon after the inauguration with international, state and local, and non-governmental partners to plan FY 2022 resettlement goals, including a robust admissions ceiling and budget.
  • Reform and reinvigorate federal consultations with states and localities to ensure their receptivity, capacity and support for refugees, and eliminate the current veto power of states and municipalities over resettlement in their jurisdictions.
  • Explore legislative fixes to the refugee admissions process and attempt to depoliticize the process by setting a “normal flow level” that does not require an annual Presidential determination.
  • Join the Global Compact on Refugees, which seeks to expand the availability of durable solutions for refugees, and encourage other nations to follow the US example of resettling larger numbers of refugees.

Border Enforcement Developments Since 1993 and How to Change CBP

Enforcement along the US-Mexico border has intensified significantly since the early 1990s. Social scientists have documented several consequences of border militarization, including increased border-crosser deaths, the killing of more than 110 people by Customs and Border Protection (CBP) agents over the past decade, and expanded ethno-racial profiling in southwestern communities by immigration authorities. Less attention has been paid to the pervasive and routine mistreatment migrants experience on a daily basis in CBP custody.

This paper traces major developments in border enforcement to three notable initiatives: the “prevention-through-deterrence” strategy, the aftermath of the 9/11 terrorist attacks, and the Department of Homeland Security (DHS) Consequence Delivery System, initiated in 2011. Despite the massive buildup in enforcement, CBP has operated with little transparency and accountability to the detriment of migrants. The paper provides an overview of the findings of nongovernmental organizations and social scientists regarding migrant mistreatment while in CBP custody. It then highlights important shifts in migration patterns over the past decade, as well as changes in border enforcement efforts during the Trump administration. It discusses how these transformations affect migrants’ everyday encounters with CBP officials.

The paper concludes by providing specific recommendations for improving CBP conduct. Its core theme is the need to emphasize and inculcate lessons of appropriate police behavior, civil rights, and civil liberties in training and recruiting agents and in setting responsibilities of supervisors and administrators. It offers recommendations regarding important but underrecognized issues, including ending the use of CBP agents/officers as Asylum Officers, as well as better-known issues such as militarization and the border wall.

Strengthening the US Immigration System through Legal Orientation, Screening and Representation: Recommendations for a New Administration

This paper highlights the importance of legal orientation, screening, and representation to the US immigration system. It proposes that a new administration facilitate legal representation in order to establish a fairer and more efficient removal adjudication system and to place more immigrants on a path to permanent residence and citizenship. As is well-documented, legal assistance can:

  • Improve the ability of immigrants to identify and articulate their claims in removal proceedings and produce better-informed case outcomes.
  • Increase the efficiency and contribute to the integrity of the removal adjudication system.
  • Lead to better-prepared applications for immigration benefits, and thus a more just and efficient legal immigration system.
  • Place more non-citizens on a path to permanent residence and naturalization by identifying their potential eligibility for immigration benefits or relief, and, in some cases, their existing US citizenship.

Legal representation and expertise can also contribute to resolving some of the substantial problems that afflict the US immigration system, such as lengthy court and asylum backlogs. In addition, it can identify and help to correct legal and factual errors by immigration adjudicators, and abuses by enforcement officers and private contractors.

The paper’s first section describes federal legal orientation and assistance programs for non-citizens in removal proceedings. The second section discusses the need for large-scale legal screening and representation of US undocumented residents, Deferred Action for Childhood Arrivals (DACA) recipients, and Temporary Protected Status (TPS) beneficiaries. Its third section examines the proliferation of universal representation programs—supported by states, localities, and private funders—for non-citizens in removal proceedings before an immigration judge, and in summary removal processes administered by the US Department of Homeland Security (DHS). The paper concludes with a series of administrative measures that a new administration could take in its first year to strengthen and expand legal representation. It also outlines longer-term policy recommendations that would require legislation.

The Trump administration is turning legal immigrants into undocumented ones.

That is, the “show me your papers” administration has literally switched off printers needed to generate those “papers.”

Without telling Congress, the administration has scaled back the printing of documents it has already promised to immigrants — including green cards, the wallet-size I.D.’s legal permanent residents must carry everywhere to prove they are in the United States lawfully.

In mid-June, U.S. Citizenship and Immigration Services’ contract ended with the company that had been printing these documents. Production was slated to be insourced, but “the agency’s financial situation,” USCIS said Thursday, prompted a hiring freeze that required it to ratchet down printing.

USCIS, which is funded almost entirely by fees, is undergoing a budget crisis, largely caused by financial mismanagement by political leadership. The printing disruptions are no doubt a preview of chaos to come if the agency furloughs about 70 percent of its workforce, as it has said it will do in a few weeks absent a congressional bailout.

In recent conversations with congressional staffers about cutting contracts to save money, USCIS mentioned only one contract, for a different division, that was being reduced — and made no reference to this printing contract, according to a person who took part in those discussions. The company that had this contract, Logistics Systems Inc., did not respond to emails and calls this week requesting comment.

The administration has taken other steps in recent months that curb immigration. Presidential executive orders have almost entirely ended issuance of green cards and work-based visas for people applying from outside the country; red tape and bureaucracy have slowed the process for those applying from within U.S. borders. For a while, the agency refused to forward files from one office to another. The centers that collect necessary biometric data remain shuttered.

These pipeline delays are likely to dramatically reduce the number of green cards ultimately approved and issued this year.

Under normal circumstances, immigrants who need proof of legal residency but haven’t yet received their green card would have an alternative: get a special passport stamp from USCIS. But amid covid-related changes, applicants must provide evidence of a “critical need,” with little guidance about what that means.

“The bottom line is that applicants pay huge filing fees, and it appears that these fees have apparently been either squandered through mismanagement or diverted to enforcement-focused initiatives, to the great detriment of applicants as well as the overall efficiency of the immigration process,” says Anis Saleh, an immigration attorney in Coral Gables, Fla. “The administration has accomplished its goal of shutting down legal immigration without actually changing the law.”

It should come as no surprise that an agency under unqualified White Nationalist Ken “Cooch Cooch” Cuccinelli is being run into the ground and has lost its mission through misdirection and mismanagement. That’s basically Cooch’s story in a nutshell as those of us know in Virginia, where we count ourselves most fortunate not to have him as our Governor.

I have written previously about how the regime’s “malicious incompetence” has bankrupted once self-sustaining USCIS while destroying our legal immigration and asylum systems that benefit the US and individual migrants and refugees in numerous ways. I made the rather obvious point that the House Dems should not bail out this regime on USCIS, but rather require that the money be found by reprograming funds from bloated, wasteful, ineffective, and inhumane DHS enforcement programs, starting with the wall.

The solution to maliciously incompetent freeloaders like the Trump immigration kakistocracy is not to provide more bailouts as rewards for their misconduct and mismanagement.

A recent report from the American Immigration Council shows how DHS enforcement spending has bloated to over $25 billion annually at then same time the Trump kakistocracy has mismanaged USCIS into bankruptcy. https://www.americanimmigrationcouncil.org/research/the-cost-of-immigration-enforcement-and-border-security

And, we haven’t really gotten much return on that investment, Here’s a key quote from the AIC Report:

What has this spending bought? The United States currently has roughly 700 miles of fencing along the Southern border, record levels of staff for ICE and CBP, as well as a fleet of drones, among other resources. Some of these resources have been spent on ill-conceived projects, such as the $1 billion attempt to construct a “virtual fence” along the Southwest border, a project initiated in 2005 that was later scrapped for being ineffective and too costly. CBP announced a similar project in July 2020 to install a total of 200 “Autonomous Surveillance Towers” along remote areas of the southern border at a reported cost of several hundred million dollars.

Even with record level spending on enforcement, enforcement alone is not sufficient to address the challenges of undocumented migration. It also has significant unintended consequences; according to U.S. Border Patrol statistics, the Southwest border witnesses close to one death per day. All of these efforts that have accumulated in the name of security, however, do not necessarily measure border security properly, or make the border more secure. It is past time for the United States to turn away from costly and haphazard efforts to secure the border and instead focus on reining in the costs of border enforcement.

I argue that the regime’s focus on removing folks who were peacefully residing in the U.S. and contributing to our economy, many with U.S. citizen family members who are then left in dire straits, has actually been detrimental to America, in addition to killing the Immigration Courts.

Likewise, the shutdown of our legal refugee, asylum, and immigration systems without legislation has not only placed our nation among the ranks of human rights violators and harmed or endangered human lives, but also deprived us of individuals with a powerful history of making outsized contributions to our society and our economy.

I doubt that a rational immigration policy and system that looked at the real national interest, rather than the mythologized White Nationalist, fundamentally racist version of it, would require such a huge, yet largely counterproductive, enforcement apparatus. At a minimum, costs for civil detention and removals could be cut substantially in a better system.

Due Process Forever! More public welfare handouts for the kakistocracy, never!

Nearly 400 migrant children intercepted at the U.S.-Mexico border have been deported in the past two weeks under new border restrictions.

WASHINGTON/NEW YORK (Reuters) ― U.S. immigration officials have rapidly deported nearly 400 migrant children intercepted at the U.S.-Mexico border in the past two weeks under new rules billed as seeking to limit the spread of the novel coronavirus in the United States, according to government data seen by Reuters.

President Donald Trump’s administration implemented new border rules on March 21 that scrapped decades-long practices under laws meant to protect children from human trafficking and offer them a chance to seek asylum in a U.S. immigration court. Under the new rules, U.S. officials can quickly remove people without standard immigration proceedings.

Overall, U.S. border officials have expelled nearly 7,000 migrants to Mexico since the new procedures took effect, according to the data and a Mexican government official, who spoke on condition of anonymity. Of those, 377 were minors, the data showed.

The overall number of 7,000 was first published by ProPublica, but the figure for children deported has not previously been reported.

Around 120 of the minors, who arrived at the U.S.-Mexico border without a parent or legal guardian, were quickly sent on planes back to Guatemala, Honduras and El Salvador, according to data from March 27 to April 2. It was not clear whether the remainder of the children intercepted at the border were pushed back to Mexico or returned to their home countries during the preceding week.

U.S. Customs and Border Protection (CBP) declined to comment. The agency in the past has said that all people caught crossing illegally, including minors, could be subjected to the new restrictions, which aim to cut the time migrants arrested at the border are held in U.S. custody.

Before the pandemic of COVID-19, the potentially lethal respiratory disease caused by the novel coronavirus, unaccompanied minors caught at the border were placed in shelters run by the U.S. Department of Health and Human Services (HHS).

Children traveling with adults other than parents or legal guardians would also be classified as “unaccompanied” and put into HHS care, even if the adults they were traveling with were family members. Under the new rules, however, they are now called “single minors” and can be sent back to Mexico, according to a CBP official.

Trump’s “methods” are highly problematic in terms of human lives and legal requirements. Also, since the “enforcement only” approach fails to deal with the causes of forced migration, I doubt that the “success” will be sustainable in the long run.

The border crisis that President Donald Trump used to justify declaring a national emergency was never real, but a different crisis at the border is now starting to escalate as immigration officials hold hundreds of parents and children in makeshift facilities, including a parking lot.

During a press conference in El Paso, Texas, Customs and Border Protection Commissioner Kevin McAleenan argued Wednesday that a surge of incoming Central American migrants has pushed the U.S. immigration system to a “breaking point” and that all available resources should be devoted to manage it.

Rep. Veronica Escobar (D-Texas), a freshman lawmaker who represents El Paso, fumed Thursday over the border situation — which she also described as a crisis — during an interview after leaving the House floor.

“They knew that the numbers would increase,” she said. “Why were they not planning?”

Here’s what’s really happening now at the border:

The president’s frequent claims that unprecedented numbers of undocumented migrants are streaming into the country remain untrue. (Twice as many came during the 1990s and early 2000s.) And President Trump’s caricature of border-crossers as violent criminals is still belied by study after study showing that immigrants in general, and undocumented immigrants in particular, commit fewer crimes than the native-born.

“We have a capacity crisis, if you want to think of it that way,” Rep. David Schweikert (R-Ariz.) told POLITICO. “We don’t have capacity to deal with the populations that they’re getting at the border right now.”

Border Patrol anticipates that it will apprehend more than 55,000 family members in March, by far the highest monthly total since such record-keeping began in fiscal year 2012. The warmer spring and summer months ahead will likely bring even higher numbers.

The adult men from Mexico who a decade ago constituted most border migrants were able to be returned more swiftly, often simply by walking them across the border. While they were detained, the men required comparatively little in the way of social or medical services.

Furthermore, a 2008 federal law and related bilateral agreement allowed the U.S. to repatriate Mexican unaccompanied minors rapidly. The law, called the Trafficking Victims Protection Reauthorization Act, does not similarly authorize quick deportation for children from Central America.

By contrast, the greater volume of children among the new Central American migrants imposes on immigration agencies a need for more psychologists, nutritionists, educators and a host of others. Border officials contend that with the rise in families and children, more migrants have health issues than in the past.

Federal court orders in recent years have limited to 20 days the time children can be kept in detention, which means border agents often must release families into the interior. Such releases speed up processing, but demoralize agents and may encourage more migration, McAleenan argued.

The current migratory flow is also different because of the greater proportion of asylum applications at the border in recent years. Central American families arriving at the border frequently seek such refuge, which puts them into an immigration process that can take years to resolve.

The Trump administration argues that the asylum claims largely lack merit, but immigration court statistics don’t back that up. Roughly 25 percent of defensive asylum applications were approved by an immigration judge in fiscal year 2017, with 41 percent denied and 34 percent resolved in another manner, such as a withdrawn application.

Still, immigration hard-liners contend that lax asylum laws have been a magnet for Central Americans.

Mark Krikorian, director of the restrictionist Center for Immigration Studies, compared the current influx at the border to Europe’s migratory surge in 2015.

“We are seeing an Angela Merkel-style disaster on the border caused by loopholes in our laws that the Democrats refuse to even consider changing,” he said.

Democrats and advocates argue that the Trump administration’s response has exacerbated problems at the border.

Administration officials have known for months — arguably years — that more migrant families could trek to the United States, yet they appear to have been caught flat-footed.

During McAleenan’s press conference in El Paso Wednesday, reporters observed hundreds of parents and children held in a parking lot converted into a makeshift detention center.

“That’s their solution? That’s not a solution,” Escobar said. “In my community when these families are released, the community … scrambles and works hard to create hospitality centers, to feed these people, to help get them to their final destination. If we can do it with a fraction of the resources and power of the federal government, surely DHS can find a better solution.”

“They’ve been acting and responding in the same way over the last five years despite the change in the migration pattern,” she said.

The spending package approved by Congress in February included $192 million to construct a large processing center for migrant families in El Paso. The facility will house multiple agencies that deal with families in one building, but will take six months to a year to become functional, according to Escobar.

In the meantime, the Texas Democrat argues that if Trump truly deems immigration a national emergency, he should work harder to house and care for incoming migrants, perhaps with Federal Emergency Management Agency trailers or Red Cross assistance.

Under a January 2017 Trump executive order, federal immigration officials remain tasked with arresting and detaining as many migrants as possible, without a system of prioritization. Advocates contend the enforcement push has sapped resources that could be used to address the care and custody of newly arrived migrant families.

“They just detain any grandpa or mom that they find in the interior and they don’t prioritize who they should be putting in detention,” said Kerri Talbot, a director with the Washington, D.C.-based Immigration Hub. “They don’t need any more money, they need a new strategy.”

Under its “zero tolerance” strategy, the Trump administration sought to prosecute all suspect border crossers for illegal entry. Children couldn’t travel with their parents to criminal detention facilities, so they were reclassified as “unaccompanied” and transferred to the custody of the Health and Human Services Department. Thousands of families were split apart from April until June, only to see Trump reverse the policy and a federal judge order families reunited.

The administration also has sought to keep asylum-seeking migrants in Mexico for longer periods of time.

Using a practice known as “metering,” border officials have forced families to wait in Mexico, only accepting a certain number of asylum applicants at ports of entry each day.

“They’re afraid of waiting in Mexico until they can get in at the port,” said Theresa Cardinal Brown, director of immigration and cross-border policy at the Bipartisan Policy Center. “They’re balancing that against their desire to do it legally. And I definitely think its emboldening the smugglers to go to those who are waiting.”

McAleenan acknowledged during a December Senate committee hearing that metering could lead to an increase in the number of people attempting to cross the border illegally, saying it’s “certainly a concern.”

Still, the Trump administration has moved forward with a separate policy to keep asylum seekers in Mexico for extended periods of time.

The administration’s “remain in Mexico” policy — announced in late December and now implemented in several areas along the border — forces certain non-Mexican asylum seekers to wait in Mexico during the duration of an asylum case.

At the same time, the administration has moved slowly to disperse funding to address root causes of migration in El Salvador, Guatemala and Honduras.

POLITICO reported this week that hundreds of millions in aid dollars remain stalled at the White House budget office as aides wonder how seriously to take Trump’s threats to cut the funding.

“Mexico is doing NOTHING to help stop the flow of illegal immigrants to our Country. They are all talk and no action,“ Trump tweeted Thursday. “Likewise, Honduras, Guatemala and El Salvador have taken our money for years, and do Nothing. The Dems don’t care, such BAD laws. May close the Southern Border!“

Trump’s unwise threat to “close” the Southern Border could turn a humanitarian situation into a self-created international crisis. And, Trump continues to be the “best friend” of smugglers, cartels, and gangs.
There is a clear and present threat to our national security. It’s not desperate refugees (mostly women, children, and families) seeking to exercise their legal rights; unfortunately, it’s our President.
