More bogus border narratives are unfolding as I’m writing this. Disingenuous CBP officials are manipulating data to tell the Senate that the border is out of control.

What is really happening is that kids and other asylum seekers are basically turning themselves in to be processed and get the hearings to which they are entitled.  Why? Because the Trump Administration has purposely slowed down the process at legal Ports of Entry.

Clearly, instead of wasting money on troops and unneeded detention, the Administration should be sending Asylum Officers to the border to complete the screening. Once screened, those with “credible fear” can be matched with lawyers. Represented asylum applicants show up for hearings nearly 100% of the time, thus making prolonged detention unnecessary.

Also, since it now appears that the bulk of the “artificial backlog” in Immigration Court actually was “illegally commenced” though defective notices, those cases could simply be removed from the docket. That would free up U.S. Immmigration Judges to hear asylum cases within a reasonable (6-18 month) time frame.

Where there is a will, there’s a way. Additionally, as I often point out, doing things the right, legal way would likely cost far less than the “publicity stunts” now being conducted by the Administration at the border. But, doing the right thing and making the laws work just isn’t something that Trump and his minions are interested in, as the “Bottomless Pinocchios” related above show!

Under the proclamation, DHS would not have to screen aliens to determine whether they have a credible fear of persecution for asylum purposes, but it would have to screen them to determine if they have a reasonable fear of persecution.

The United States is a signatory to the Refugee Convention, which prohibits expelling a refugee to a country where it is likely that he will be persecuted. Asylum just requires a well-founded fear of persecution.

This condition is met with the withholding of deportation provision in the INA for aliens who establish that it is more likely than not that they will be persecuted.

America also is a signatory to the Convention Against Torture (CAT), which provides that, “No State Party shall expel … a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.”

Relief under these provisions is limited to sending the alien to a country where he would not be persecuted or tortured.

The proclamation should be withdrawn until these problems can be resolved.

Nolan’s conclusion ties in nicely to my preceding posts that confirm, as Nolan points out, that CBP, the Asylum Office, the Immigration Courts, and probably the Federal Courts are woefully unprepared for the additional chaos and workload that is likely to be created by Trump’s shortsighted actions. Like most of what Trump does in the immigration areas it demonstrates a chronic misunderstanding of the laws, how the system operates, the reality of what happens at the border, and ignores the views of career civil servants and experts in the area. In other words, a totally unprofessional performance. But, that’s what “kakistocracy” is all about.

We’ll see what happens next. I expect a U.S. District court ruling on the ACLU’s suit to stop implementation of the Executive Order and the “Interim Regs” to be issued in the near future.

The proposal is not yet finalized and could ultimately be cast aside, said the sources, who spoke on condition of anonymity because the plan is in the formative stages. If President Trump approved such a plan, it would represent a dramatic escalation in border enforcement as a migrant caravan works its way north through Mexico.

 

The administration is working rapidly to draft the possible executive action, which could effectively use the same legal authority that Trump invoked last year in imposing a ban against people from several mainly Muslim countries from traveling to the U.S., said a government source who has seen a working version of the plan and several sources who had it described to them.

 

“The administration is considering a wide range of administrative, legal and legislative options to address the Democrat-created crisis of mass illegal immigration,” a White House official said on condition of anonymity when asked about the effort. “No decisions have been made at this time. Nor will we forecast to smugglers or caravans what precise strategies will or will not be deployed.”

So, now Trump can just suspend any law that proves inconvenient for his White Nationalist agenda by invoking a transparently bogus “national security” rationale! Wonder whose rights will be next to go? Wonder what the Supremes will do when he comes to get them using their own misguided jurisprudence against them?

The Turnback Policy compounds other longstanding border-wide tactics CBP has implemented to prevent migrants from applying for asylum in the U.S., including lies, intimidation, coercion, verbal abuse, physical force, outright denials of access, unreasonable delay, and threats—including family separation.

The new filing was brought by the Los Angeles and Tijuana-based organization Al Otro Lado, Inc. and individual asylum seekers who are collectively represented by the Center for Constitutional Rights, the Southern Poverty Law Center, and the American Immigration Council. The attorneys allege that the Trump administration policy and practice violate U.S. and international law and subject vulnerable asylum seekers to imminent danger, deportation, or death.

“Every day we work with survivors of horrific physical and sexual violence, doing our best to provide the necessary resources to extremely vulnerable individuals. They come to our border to seek safety for themselves and their children. The United States, in implementing the Turnback Policy, cavalierly rejects thousands of these individuals, retraumatizing them and stranding them alone and destitute. It is hard to overstate the cruelty with which CBP operates,” said Nicole Ramos, Border Rights Project director at Al Otro Lado.

Attorneys say practices under the Turnback Policy are directly attributable to high-level Trump administration officials, including Attorney General Jeff Sessions and Department of Homeland Security Secretary Kirstjen Nielsen. The filing cites Sessions’ characterization of asylum seekers as deliberately attempting to “undermine our laws and overwhelm our system,” and Nielsen’s reference to the legally required process of receiving and processing asylum seekers at the border as a “loophole.” The filing also quotes U.S. Customs and Border Protection officers as stating, “We have orders not to let anybody in.”

“Internal CBP documents released in this case reveal that high-level CBP officials authorized a Turnback Policy as early as 2016 to restrict the flow of asylum seekers to the U.S-Mexico border,” said Melissa Crow, senior supervising attorney with the Southern Poverty Law Center’s Immigrant Justice Project. “The Turnback Policy has escalated under the Trump administration and has been buttressed by a wide range of unlawful tactics that CBP uses to deny asylum seekers access to the protection they deserve.”

Said Baher Azmy, legal director of the Center for Constitutional Rights, “Ever since the horrors of World War II, the world’s nations have committed to giving asylum seekers the opportunity to seek safe haven. The Trump administration has turned its back on this most elementary humanitarian principle, in violation of U.S. and international law, and is subjecting vulnerable men, women and children who are fleeing horrific conditions at home to continued terror, violence and in some cases, death.”

Asylum seekers are fleeing persecution in their home countries, and suffer unspeakable harm en route to the United States at the hands of Mexican government officials, cartels, and gangs. When they are turned away at ports of entry, the lawsuit alleges, they are compelled to either enter the U.S. illegally and be prosecuted, stay trapped in Mexico where they are targeted by criminal groups, or return home to face persecution and death. The filing recounts an extensive array of inaccurate information and abusive treatment those seeking asylum have faced at the hands of U.S. border officials, including that the U.S. is no longer providing asylum or that people from specific countries are not eligible; yelling at, harassing, and assaulting asylum seekers and their children; threatening to take children away from their parents; and setting up “pre-checkpoints” that prevent asylum seekers from reaching the U.S. border. Over four consecutive days in March, CBP officials turned away Guatemalan asylum seekers, saying “Guatemalans make us sick.”

And government data released Wednesday showed that the number of migrant families taken into custody along the southern border remained nearly unchanged from June to July — an indication that the Trump administration’s move to separate thousands of parents and children did little to deter others from attempting the journey.

More than 9,200 family members entered the country illegally in July, a number on par with the past several months, according to the data. In all, more families with children have arrived in the first 10 months of fiscal 2018 than during any year under Obama.

INFANTS, TODDLERS, tweens, teens — Trump administration officials are less interested in the age of an unauthorized child migrant than they are in removing the child from his or her parents as a means of deterring illegal border-crossers. That plan, first floated by White House Chief of Staff John F. Kelly last year when he was homeland security secretary, was widely regarded as so callous and such a radical departure from historical practice that it was unthinkable for any U.S. government.

If only.

In fact, not only has the idea of systematically separating undocumented children and parents gained currency among top officials determined to turn the tide on illegal entry, it’s already happening with increasing frequency. The Department of Homeland Security insists it has not adopted the practice as a matter of official policy — despite White House pressure to do so — but administration officials acknowledge that hundreds of children, including scores younger than 4, have been taken from their parents in the past few months.

By now it’s clear that there are few red lines President Trump is unwilling to cross in his crusade to rid the United States of undocumented immigrants. For Mr. Trump, having washed his hands of the “dreamers” — young migrants, most in their 20s, raised and educated in the United States after being brought here as children — it’s hardly a moral leap to inflict lasting psychological damage on younger children by taking them from their parents if it will further his goal of combating illegal immigration.

As reported by The Post’s Maria Sacchetti, top immigration and border officials have recommended that all parents who enter the country illegally with their children be detained and prosecuted, meaning the automatic separation of minors, who cannot legally be held in jails or detention centers designed for adults. Until recently, that was extremely uncommon; most parents who crossed the border with children would be released pending an immigration court hearing, or, in some cases, detained together in a facility designed for families. Prosecuting parents for illegal entry, a misdemeanor under federal law, has been exceedingly rare — specifically because of the harm it would cause blameless children.

In addition, many of the parents who would be prosecuted are eligible under U.S. law to seek and be granted asylum. That’s hardly a stretch for migrants from El Salvador and Honduras, beset by drug cartels, gang violence, domestic abuse and some of the world’s highest homicide rates. In the last three months of 2017, more than two-thirds of the 30,000 asylum seekers crossed into the country illegally — and it is far-fetched to exempt from prosecution only those who announce themselves as asylum seekers at legal ports of entry, as Homeland Security officials propose. Are desperate, impoverished people fleeing violence to be penalized because they enter the United States in the wrong place?

The United States has a legitimate interest in deterring illegal border-crossing. It is within its rights to detain and deport individuals and families who fail to make a persuasive case for asylum. But to splinter families and traumatize children in the name of frightening away migrants, many of whom may have a legitimate asylum claim, is not just heartless. It is beyond the pale for a civilized country.

ADMINISTRATION TRASHES RULE OF LAW, DENIES DUE PROCESS AT U.S. SOUTHERN BORDER!

“U.S. immigration officials have a long history of overstepping the boundaries of their legal authority and violating the constitutional and other legal rights of migrants at the Southwest border. Allegations of abuse throughout the apprehension, detention, and deportation process are not new; immigrant rights organizations and media outlets have reported on those violations for years.

Deportations in the Dark: Lack of Process and Information in the Removal of Mexican Migrants, a new report released by the American Immigration Council, is the most recent effort to document such violations. The report shows the extent to which U.S. immigration officials prevent migrants in their custody from accessing critical information and processes, which in many cases jeopardizes their chances to access various forms of immigration relief. Specifically, the report examines whether U.S. immigration agents properly inform migrants of their rights, actively obstruct their ability to exercise these rights, coerce or intimidate migrants in their custody, or neglect to provide removal documents to migrants at the time of repatriation.

The study is the result of a collaboration between the Council and the Mexico-based Binational Defense and Advocacy Program (in Spanish, Programa de Defensa e Incidencia Binacional, or PDIB), a Mexican human rights initiative established in 2010 to document abuses perpetrated against repatriated Mexican immigrants during their time in the United States. With staff currently located in three different sites—Nogales, Sonora; Nuevo Laredo, Tamaulipas; and Ciudad Juárez, Chihuahua—PDIB interviews migrants upon deportation to Mexico on an ongoing basis.

Based on new survey data (600 interviews) collected by PDIB between August 2016 and April 2017 and testimonies gathered between August 2016 and May 2017, the study found that migrants are frequently deprived of legally required information, told they cannot contact their consulates, compelled to sign documents they cannot read or understand, threatened with protracted detention, and blocked from applying for asylum and other legal claims.

For example, half of the respondents who signed repatriation documents reported that they were not allowed to read the documents before they signed them; 57.6 percent did not receive their repatriation documents; 43.5 percent were not advised of their right to contact their consulate; more than half (55.7 percent) were not asked if they feared returning home.

This report is perhaps the first attempt to systematically analyze the prevalence of denied access to critical information among migrants in U.S. custody. Some of the issues highlighted here, however, have been raised by advocates and been subject to litigation in the past. One concrete example is the case of immigration agents misleading migrants into waiving their right to a removal hearing by signing for voluntary return.

When immigration authorities deprive migrants of critical information regarding their rights or the opportunity to exercise them, migrants may face unjust deportation and lose the ability to ever seek legal admission or apply for asylum in the future. As the U.S. government promises to institute a new level of immigration enforcement, the behavioral patterns of U.S. immigration authorities highlighted in this report are a source of concern.“

“President Trump’s plan for an aggressive hiring surge of 15,000 Border Patrol and immigration personnel to help keep out undocumented immigrants is unrealistic — and the Department of Homeland Security has not made a case for it, the agency’s watchdog says.

A report released this week by the DHS inspector general concludes that based on its rigorous screening requirement for law enforcement jobs and the relatively high rate of attrition among Border Patrol agents, Homeland Security would have to vet 750,000 applicants to find 5,000 qualified personnel.

In addition, to hire the 10,000 Immigration and Customs Enforcement (ICE) agents the president called for in executive orders he issued in his first days in office, a pool of 500,000 candidates would need to apply, auditors found.

The report calls into question whether DHS officials even need 15,000 new hires to target undocumented immigrants. Agency leaders have done such poor planning for what their workforce should look like, with an understaffed, poorly trained human resources operation, that they cannot justify thousands of new employees, the report says.

“Neither [U.S. Customs and Border Protection] nor [ICE] could provide complete data to support the operational need or deployment strategies for the additional 15,000 agents and officers,” the report by the office of Inspector General John Roth said.

DHS officials told auditors that they are still three to four years from getting a system in place that will be able to tell them how many new personnel they need and where to deploy them.

“Without comprehensive staffing models, operational needs analyses, and deployment strategies, CBP and ICE will not be able to identify clearly the correct number and type of employees required, what positions must be filled, or where to deploy those employees,” the report said.

Trump promised on the campaign trail to vastly beef up enforcement against undocumented immigrants with a new border wall, a surge in agents to help seal off the Southwest border with Mexico and a “deportation force” to arrest people in the country illegally. The 15,000 new front-line employees would come with almost 9,600 more technical and support staff, the report said.”

“Border agents are systematically intimidating and turning away asylum seekers at the US–Mexico border, a lawsuit filed on Wednesday alleges.

The federal class-action lawsuit filed in US District Court in California by immigrant rights groups alleges that US Customs and Border Protection agents have told migrants that “Donald Trump just signed new laws saying there is no asylum for anyone.” They have also allegedly coerced asylum seekers into signing forms abandoning their claims by threatening to take their children away.

“CBP’s illegal conduct is occurring as a humanitarian crisis drives vulnerable people experiencing persecution in their home countries to seek refugee protection in the United States,” the complaint states.

CBP said in a statement that it does not comment on pending litigation.

One of the plaintiffs, identified as Abigail Doe in the complaint, is a Mexican native with two children under the age of 10. She attempted to flee Mexico after the cartels threatened to kill her family.

She arrived in Tijuana with her two kids and approached border agents at the San Ysidro point of entry. The lawsuit states CBP agents coerced her into recanting her fear of staying in Mexico and signing a form withdrawing her application for admission to the US.

Abigail Doe and other women in the lawsuit said they were told by agents that if they continued to pursue their asylum claims they would be separated from their children.

“As a result of this coercion, the form falsely states that [Abigail Doe] and her children were unable to access the asylum process and were forced to return to Tijuana, where they remain in fear for their lives,” the lawsuit states.

Another woman, identified as Dinora Doe from Honduras, presented herself to US border authorities after her and her 18-year-old daughter were threatened and repeatedly raped by MS-13 gang members. The complaint accuses CBP officials of misinforming Dinora Doe of her rights under US law, and denying her the chance to apply for asylum.

The lawsuit also names Al Otro Lado, a legal aid organization that helps migrants on both sides of the border, as a plaintiff because it has allegedly been forced to divert significant resources to counteract CBP’s actions.”

Not So Fast, My Friends! — Border Intrusions Increase In May N/W/S Administration’s (Perhaps Premature) “Victory Dance!”

“Illegal immigration across the southwest border appears to have jumped 27 percent in May, according to numbers released this week by Homeland Security, breaking a three-month streak of declines under President Trump and suggesting that the slump in migrants has bottomed out.

The Border Patrol nabbed 14,535 illegal immigrants in the southwest last month, up from just 11,129 in April. Analysts said that the number of people caught is a rough measure of the overall flow of people trying to sneak in.

The number of illegal immigrants showing up at ports of entry without authorization also ticked up, from 4,649 to 5,432.

U.S. Customs and Border Protection, the agency that oversees the Border Patrol and the ports of entry, acknowledged the increase in crossings, but attributed it to “a seasonal uptick.”

CBP said it “expects the uptick to continue” through the summer months.

The numbers suggest that while Mr. Trump appears to have changed the calculations of many border crossers, there’s still a segment of the population — particularly among Central Americans — determined to make the journey.

Agents usually record an uptick from April to May, but the jump this year is the largest on record.

 

Still, it’s by far the lowest May total on record. For example, May 2016 saw more than 40,000 illegal immigrants caught at the border.

Illegal immigration from Cuba and Haiti had been a problem last year, but had dipped under the final months of President Obama and again under Mr. Trump.

Now, Cubans appear to be surging again, while Haitians remain low.

Two other special categories of migrants — unaccompanied minors and families traveling together — also saw increases last month, rising from a combined 2,117 nabbed by the Border Patrol in April to 3,070 in May.”

We should also keep in mind that according to other recent reports, the largest flow of asylum applicants is now from Venezuela. Most of them are middle class and business-oriented individuals who already have visas enabling them to enter the U.S. legally. Once admitted, they can apply for asylum at any time during the first year following entry. Such individuals would not show up in any of the border or port of entry statistics.

“On May 11, 2017, Attorney General Jeff Sessions made an appearance before Customs and Border Protection officers at the U.S.-Mexico border to announce the issuance of new guidance to federal prosecutors on criminal immigration enforcement.

It is here, along this border, he said, that transnational gangs like MS-13and international cartels flood our country with drugs. They leave death and violence in their wake. “And it is here that criminal aliens and the coyotes and the document forgers seek to overthrow our system of lawful immigration.”

“I am here to tell you, the brave men and women of Customs and Border Protection: we hear you and we have your back.”

The president has made enforcement of our immigration laws a priority, and we are seeing the results already. Illegal crossings dropped by 40 percent from January to February of this year, and last month, we saw a 72 percent drop compared to the month before the president was inaugurated. This is the lowest monthly figure in the last 17 years.

It is “the Trump era.” The days of abdicating our duty to enforce the immigration laws are over.

Sanctuary cities ‘harboring‘ aliens: Trump’s next immigration target?

The harboring provision provides criminal penalties for concealing, harboring, or shielding aliens from detection knowing that they are in the United States illegally.

Harboring that results in the death of any person, may “be punished by death or imprisoned for any term of years or for life.”

The harboring provision does not specify what actions constitute “harboring,” and the courts have not settled on one uniform definition.

According to the Second Circuit, it encompasses “conduct tending substantially to facilitate an alien’s ‘remaining in the United States illegally,’ provided that the person charged has knowledge of the immigrant’s unlawful status.”

Isn’t that what officials in sanctuary cities are doing when they take affirmative steps to help undocumented aliens to remain in the United States unlawfully? “

“Two U.S. immigration judges recently sent to the Mexico border to process asylum requests from migrant women and children are being recalled as they have so few cases to hear, according to two people familiar with the matter.

The dearth of cases at two Texas facilities where the judges are based can be traced to a sharp drop in illegal border crossings by women and children since U.S. President Donald Trump took office in January.

Eight immigration judges were reassigned from their regular courts to detention centers at the border beginning on March 20 as part of Trump’s executive order to curb illegal immigration.

Six of the judges have had full dockets, handling dozens of cases per week. But the two at detention centers housing women and children in Dilley and Karnes County, Texas had so few cases their presence was deemed a waste of resources by the U.S. Department of Justice, according to one of the sources.

The Department of Justice did not immediately respond to a request for comment.

The number of parents and children apprehended at the U.S. Mexico border in March dropped to just over 1,000, a 93 percent fall from December, the Department of Homeland Security reported last week.

The decline follows Trump’s harsh rhetoric on illegal immigration and policies which classify almost all illegal migrants as subject to deportation.

The judges were deployed to the border in an effort to quickly hear the claims of migrants seeking asylum so that those deemed ineligible could be deported.

In more than three weeks at the border, the judge in Dilley had no hearings and the judge in Karnes County had four, according to a spokeswoman for the U.S. Department of Justice’s Executive Office of Immigration Review. [emphasis added].

The judges deployed to the border left behind scheduled hearings in their home courts. As of early March, immigration courts were weighed down by a record backlog of more than 542,000 cases.”

Haste makes waste. Meddling by political officials with no understanding of how the Immigration Court system works and who are not committed to due process and fairness as “mission one” has no place in our U.S. Immigration Court system, or indeed in our American system of justice. America needs an independent Article I Immigration Court now!

To further illustrate how money is being misdirected and due process undermined by the DOJ’s mal-administration of the U.S. Immigration Courts, I have heard “rumors” from several sources that the annual U.S. Immigration Judge Training Conference will be cancelled this year. This is despite some obvious quality control issues, such as gross disparities in asylum grant rates and and a gradual uptick in critical comments about the legal and factual quality of decisions by both trial and appellate judges made by some U.S. Courts of Appeals as they review removal orders. Moreover, with dozens of newly-hired Immigration Judges on board who have never attended a national training conference, there has never been a more critical time for effective, in-person training. While money is being poured down the drain on expensive, unneeded, and inappropriate details of judges, the real needs of the court system are going unmet by the DOJ.

CNN: Border Busts Fall Again — Is Trump’s “Get Tough” Stance On Immigration Working? Many Think So!

“Washington (CNN)–Apprehensions at the southern border continue to fall dramatically, according to new numbers from Customs and Border Protection — a drop that experts attribute to President Donald Trump’s aggressive immigration enforcement policies.

There were roughly 12,000 total apprehensions at the southwest border in March, according to numbers obtained by CNN that are expected to be released this week. That represents a 35% drop from February and a 63% drop from March 2016.
In 17 years of CBP data, apprehensions had never dropped from February to March, typically rising slightly.
Former Acting Customs and Border Patrol Commissioner David Aguilar said Tuesday at a hearing in front of the Senate’s Homeland Security Committee that through the end of March, immigration officials have seen a 67% drop in illegal crossings from Mexico as compared to the same period last year.
Aguilar attributed the drop to Trump’s hardline position on immigration — a focal point of his campaign and the first few weeks of his presidency.

“This has happened before when — as it relates especially to immigration — when the US stands strong and takes certain actions,” Aguilar said. “This administration said we’re going to address illegal immigration. ICE has started working in the interior unlike other times. So that message resonates.”

Federal officials cautioned that many of the changes detailed in a pair of memos from Homeland Security Secretary John F. Kelly will take time to implement because of costs and logistical challenges and that border patrol agents and immigration officers will use their expanded powers with care and discretion.

Yet the official public rollout of Kelly’s directives, first disclosed in media reports over the weekend, was met with outrage from immigrant rights advocates over concerns the new policies will result in widespread abuses as authorities attempt to fulfill President Trump’s goals of tightening border control.

Trump took a hard line against illegal immigration during his campaign, at times suggesting he would seek to create a nationwide “deportation force” to expel as many of the nation’s estimated 11 million unauthorized immigrants as possible.

In a conference call with reporters, a senior Department of Homeland Security official moved to avert what he called a “sense of panic” among immigrant communities.”

Enforcing the law. Under this executive order, with extremely limited exceptions, DHS will not exempt classes or categories of removal aliens from potential enforcement. All of those in violation of the immigration laws may be subject to enforcement proceedings, up to and including removal from the United States. The guidance makes clear, however, that ICE should prioritize several categories of removable aliens who have committed crimes, beginning with those convicted of a criminal offense.

Establishing policies regarding the apprehension and detention of aliens. U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) will release aliens from custody only under limited circumstances, such as when removing them from the country, when an alien obtains an order granting relief by statute, when it is determined that the alien is a U.S. citizen, legal permanent resident, refugee, or asylee, or that the alien holds another protected status, when an arriving alien has been found to have a credible fear of persecution or torture and the alien satisfactorily establishes his identity and that he is not a security or flight risk, or when otherwise required to do so by statute or order by a competent judicial or administrative authority.

Hiring more CBP agents and officers. CBP will immediately begin the process of hiring 5,000 additional Border Patrol agents, as well as 500 Air & Marine agents and officers, while ensuring consistency in training and standards.

Identifying and quantifying sources of aid to Mexico. The President has directed the heads of all executive departments to identify and quantify all sources of direct and indirect federal aid or assistance to the government of Mexico. DHS will identify all sources of aid for each of the last five fiscal years.

Expansion of the 287(g) program in the border region. Section 287(g) of the INA authorizes written agreements with a state or political subdivision to authorize qualified officers or employees to perform the functions of an immigration officer. Empowering state and local law enforcement agencies to assist in the enforcement of federal immigration law is critical to an effective enforcement strategy, and CBP and ICE will work with interested and eligible jurisdictions.

Commissioning a comprehensive study of border security. DHS will conduct a comprehensive study of the security of the southern border (air, land, and maritime) to identify vulnerabilities and provide recommendations to enhance border security. This will include all aspects of the current border security environment, including the availability of federal and state resources to develop and implement an effective border security strategy that will achieve complete operational control of the border.

Constructing and funding a border wall. DHS will immediately identify and allocate all sources of available funding for the planning, design, construction, and maintenance of a wall, including the attendant lighting, technology (including sensors), as well as patrol and access roads, and develop requirements for total ownership cost of this project.

Expanding expedited removal. The DHS Secretary has the authority to apply expedited removal provisions to aliens who have not been admitted or paroled into the United States, who are inadmissible, and who have been continuously physically present in the United States for the two-year period immediately prior to the determination of their inadmissibility, so that such aliens are immediately removed unless the alien is an unaccompanied minor, intends to apply for asylum or has a fear of persecution or torture in their home country, or claims to have lawful immigration status. To date, expedited removal has been exercised only for aliens encountered within 100 air miles of the border and 14 days of entry, and aliens who arrived in the United States by sea other than at a port of entry. The Department will publish in the Federal Register a new Notice Designating Aliens Subject to Expedited Removal Under Section 235(b)(1)(a)(iii) of the Immigration and Nationality Act that expands the category of aliens

subject to expedited removal to the extent the DHS Secretary determines is appropriate, and CBP and ICE are directed to conform the use of expedited removal procedures to the designations made in this notice upon its publication.

Returning aliens to contiguous countries. When aliens apprehended do not pose a risk of a subsequent illegal entry, returning them to the foreign contiguous territory from which they arrived, pending the outcome of removal proceedings, saves DHS detention and adjudication resources for other priority aliens. CBP and ICE personnel shall, to the extent lawful, appropriate and reasonably practicable, return such aliens to such territories pending their hearings.

Enhancing Asylum Referrals and Credible Fear Determinations. U.S. Citizenship and Immigration Services (USCIS) officers will conduct credible fear interviews in a manner that allows the interviewing officer to elicit all relevant information from the alien as is necessary to make a legally sufficient determination. USCIS will also increase the operational capacity of the Fraud Detection and National Security Directorate.

Allocating resources and personnel to the southern border for detention of aliens and adjudication of claims. CBP and ICE will allocate available resources to expand detention capabilities and capacities at or near the border with Mexico to the greatest extent practicable. CBP will focus on short-term detention of 72 hours or less; ICE will focus on all other detention capabilities.

Properly using parole authority. Parole into the United States will be used sparingly and only in cases where, after careful consideration of the circumstances, parole is needed because of demonstrated urgent humanitarian reasons or significant public benefit.

Notwithstanding other more general implementation guidance, and pending further review by the Secretary and further guidance from the Director of ICE, the ICE policy directive with respect to parole for certain arriving aliens found to have a credible fear of persecution or torture shall remain in full force and effect.

Processing and treatment of unaccompanied alien minors encountered at the border. CBP, ICE, and USCIS will establish standardized review procedures to confirm that alien children who are initially determined to be unaccompanied alien children continue to fall within the statutory definition when being considered for the legal protections afforded to such children as they go through the removal process.

Putting into place accountability measures to protect alien children from exploitation and prevent abuses of immigration laws. The smuggling or trafficking of alien children into the United States puts those children at grave risk of violence and sexual exploitation. CBP and ICE will ensure the proper enforcement of our immigration laws against those who facilitate such smuggling or trafficking.

Prioritizing criminal prosecutions for immigration offenses committed at the border. To counter the ongoing threat to the security of the southern border, the directors of the Joint Task Forces- West, -East, and -Investigations, as well as the ICE-led Border Enforcement Security Task Forces (BESTs), are directed to plan and implement enhanced counter- network operations directed at disrupting transnational criminal organizations, focused on those involved in human smuggling.

Public Reporting of Border Apprehensions Data. In order to promote transparency, CBP and ICE will develop a standardized method for public reporting of

statistical data regarding aliens apprehended at or near the border for violating the immigration law.”
