Like the 1980 and 1994 boatlift crises, the present one may be in part tacitly encouraged by the Havana regime, which, like its allies in Managua and Caracas, is closely aligned with Russia.

It is in these governments’ interest to export dissent and stir political trouble for President Biden — as the boatlifts did for his Democratic predecessors Jimmy Carter and Bill Clinton.

Notably, the exodus from Cuba accelerated after its ally Nicaragua ended its visa requirement for Cubans, making it far easier for the latter to reach the Central American isthmus — and continue on to the border.

Cuba, Nicaragua and Venezuela do not take their citizens back if deported from the United States, which renders the Biden administration all but powerless to deter the flow.

All of the above should inform the debate about “root causes” of migration, which, like so many of its predecessors, the Biden administration has promised to address. There is a related argument over the United States’ own culpability in the plight of people living under the three left-wing regimes. Washington has sanctioned each one for gross human rights violations, the most recent being Cuba’s nightmarish crackdown on protests that broke out in July 2021 and a similar round-up of dissidents by President Daniel Ortega’s regime in Nicaragua.

Even when the United States targets them to limit collateral damage, these measures can affect ordinary people and not just the regimes; obviously, too, millions have left non-communist countries in Latin America for a better life in the United States.

What is nevertheless undeniable is the historic debacle represented by the departure of over 6 million from Venezuela, whose population peaked at 30 million in 2015, when the main phase of the exodus began. That is a fifth of the entire country.

For Cuba, 200,000 emigrants in a year represents nearly 2 percent of its 11.3 million population. In Nicaragua, the 200,000 who have left since Ortega’s crackdown began four years ago, mostly for the United States and next-door Costa Rica, amount to 3 percent of a 6.6 million population.

U.S. sanctions, under which — for example — this country was still Cuba’s second-largest supplier of food imports in 2020, cannot possibly account for so many people “voting with their feet” against the systems they live under. The foreseeable failure of subjecting the economy to top-down control and denying people basic freedoms can.

The exodus is thus a tremendous compliment to the United States and other democratic capitalist countries. We should appreciate it. Meanwhile, it imposes duties: to treat migrants humanely and incorporate as many of them as we lawfully and realistically can; and to oppose more effectively the despotism that is the root cause of their desperation.

Growing up in the 50’s and 60’s in Wauwatosa, WI, then a GOP bastion, I remember that the party of Ike and Nixon never saw someone fleeing from Communism or lefty dictatorships that they didn’t swoon over. East Germans, Hungarians, the “Chang Gang” from China, Cubans, Russians, all were welcomed and viewed not only as great assets to America (which they were) but also as strong empirical evidence of the superiority of democracy over left-wing dictatorships!

In elementary and high school, I had good friends whose families had fled East Germany and Hungary. They were all hard-working folks who left much behind but “reinvented themselves” in a new environment.

Now,  the forces of xenophobia, hate, fear, and the hope of exploiting the foregoing for political gain have replaced more realistic and welcoming attitudes in MAGA land. It’s up to the rest of us to show that these “negative values and bad attitudes” don’t represent the real America!

If Republican officials actually wanted to reduce the number of people coming to the border without advance permission, there are plenty of things these politicians could do. They could push for expansion of guest-worker visas, for instance. Or more funding for the refugee admissions program. Or really any other legal, orderly pathway to come to the United States.

After all, the main reason there is such a crush at the border — and why the asylum system in general is so overwhelmed — is that right now this is one of the very few legal ways to get to America.

Yes, I said legal: The families being hoodwinked and shipped around the country like chattel on chartered buses and flights are here lawfully, based on what’s been publicly reported. They turned themselves in upon crossing the border precisely so that they can apply for asylum, as is their legal right. The federal government has screened them, and granted them humanitarian parole while they pursue their asylum cases in court.

It’s not an ideal system. Or an especially fast one. It would be much better to fix the rest of our broken legal immigration system so that those other, more orderly pathways are available. Especially the pathways that offer quicker access to work permits, given America’s current massive labor shortages.

It’s true that Democrats have also put forth relatively little effort to fix these problems. In some cases Democrats seem fearful of appearing too pro-immigrant, having apparently bought into the GOP lore that deep down Americans are xenophobes. But even what little Democrats have tried to do they generally can’t do without 60 Senate votes. Which Democrats don’t have.

Democrats need Republicans to cooperate on immigration reform, and Republicans won’t. Even when those reforms are coupled with investments in border security that Republicans claim to want. The GOP would rather keep around a dragon they can perpetually promise to slay one day — and better yet, to taunt and torture for a while, in public, first.

In the meantime, the Dems have done little to make the current laws relating to refugees and asylum work. The much-hyped “asylum rule changes” at DHS have had little, if any, discernible positive impact. EOIR is a national disgrace — continuing the “death spiral” that accelerated during the Trump kakistocracy. The refugee system remains in shambles. The proposed 15,000 allocation of refugee admissions for FY 2023 to Latin American and the Caribbean is an insult and a “signal” to other receiving nations in the area that we are not serious about addressing the problem. There is no rational resettlement program for asylum seekers crossing the border, thus providing an unnecessary opening for the “performative cruelty” of  clowns like DeSantis and Abbott.

None of these things are “rocket science” or “budget busters.” They just require knowledgeable leadership, values, and the courage to act on them. Apparently, faced with the cruelty and desecration of values by the “MAGA GOP,” the Dems think that “all they have to do is show up, smile, and mumble platitudes” to seem like the only choice for Americans who believe in democracy. Maybe — but I wouldn’t count on it!

I think that Catherine “hit the nail on the head” with this assessment of the spineless policy officials driving refugee and asylum policies in the Biden Administration: “In some cases Democrats seem fearful of appearing too pro-immigrant, having apparently bought into the GOP lore that deep down Americans are xenophobes.” Cowardice on immigrants, immigrants’ rights, and racial justice has become an endemic problem in the Democratic Party.

Due Process Disaster in Immigration Court

It is not easy to convey the magnitude of the ongoing disaster at EOIR, the Executive Office for Immigration Review, the office that oversees our nation’s Immigration Courts. Simply stated, the agency is rescheduling and advancing hundreds–maybe thousands–of cases without notifying attorneys, checking whether we are available to attend the hearings or checking whether we have the capacity to complete the cases.

On its face, this appears to be a mere scheduling problem. But in effect, it is a vicious and unprecedented assault on immigrants, their attorneys, and due process of law.

“Advancing hearings with no notice and no time to prepare? Why didn’t I think of that?!”

For me at least, the problem started small. A few cases were rescheduled and advanced without anyone at the Immigration Court bothering to inquire about my availability: Your case that was scheduled for two years in the future has been advanced and is now set for two months in the future. I was angry and upset, but I did not want to let my clients down. So I set other work obligations aside. I set family time aside. I put off doctors appointments. And I completed the cases, which were approved. I hoped that these cases were anomalies and that EOIR would stop this unfair and abusive practice. But that was not to be.

Instead, EOIR has dramatically expanded its effort to reschedule cases, often without providing sufficient notice–or any notice–to get the work done for our clients. As best as we can tell, the problem is occurring in California, Colorado, Maryland, and Virginia. I myself have had about a dozen cases rescheduled and advanced (so far). These cases had been scheduled for 2023 or 2024, and suddenly, they are now set for the fall of 2022. Other attorneys have had 20, 30 or more cases advanced, including some that were double booked. One lawyer reported having seven cases scheduled for the same week and 47 cases set for one month. Another lawyer purportedly told a judge that if she had one more case scheduled within the next six months, she would commit suicide.

Here, I want to break down what is happening, so noncitizens in Immigration Court can at least have some idea about EOIR’s disruptive practices.

First, when I say that EOIR is not providing notice of the hearings, that is not entirely accurate. They are not sending us a notice or contacting us in advance. Instead, they are posting the new hearing dates on our portal. What does this mean? Each attorney has access to a portal page with a calendar. We can scroll through the calendar one month at a time. Days with hearings are highlighted, and we can click on those days to see what is scheduled. When I review my calendar, I often find new hearings that were not previously on the schedule. The only way to know whether a new hearing has been scheduled is to scroll through our portals month-by-month and compare what’s there with our existing calendar–a burdensome process that leaves plenty of room to overlook a date. Needless to say, every time I sign on to the portal, I feel a nauseous sense of dread about what I might find.

Once we discover the new date, we need to review the file, contact the client, and determine whether we can complete the case. This all takes time. If we cannot complete the case, or we do not have an attorney available on the scheduled date, we need to ask for a continuance. Of course, clients who have been waiting years for a decision usually want to keep the earlier hearing date. They do not understand why we cannot complete the work or why we are not available that day. Their perspective is perfectly reasonable, but they only have one case, where lawyers have many and we are daily being ambushed by EOIR with additional work. All this can result in conflicts between clients (who want their cases heard) and lawyers (who need time to get the work done). It also makes it difficult to serve our other clients, who must be pushed aside to accommodate the new work randomly being dumped on us.

Even if the client agrees to request a continuance, that does not solve the problem. Motions to continue can be denied. Even when they are granted, the judges tend to reset the date for only a few weeks in the future, which is often not enough time to properly complete the work. Other times, judges simply do not rule on the motion, so we are left to prepare the case, not knowing whether it will go forward or not.

Also, while we sometimes discover a new date that is a few months in the future (and so in theory, we might have time to do the work), other times, the new date is only a few weeks in the future. Since the evidence, witness list, and legal brief are due at least 15 days before the hearing, and since even a “simple” asylum case takes 20 or 30 hours to prepare, this is not nearly enough time. Worse, some cases are randomly advanced and placed on the docket after the evidence is due, and so by the time we have “notice” of the case, our evidence is already late.

Adding insult to injury, another common problem is that cases are still being cancelled at the last minute. And so we drop everything to prepare a case, only to have it postponed once all the work is done. Since this is all utterly unpredictable, it is impossible to prioritize our work or advise our clients.

Again, if this were only a few cases, attorneys could set aside other work and get the job done. But lawyers who do immigration law tend to have many cases, and we are seeing dozens and dozens of cases advanced with no notice. This is such a blatant and obvious abuse of due process that it is impossible to believe it is accidental. I might have expected this policy from the Trump Administration, which was hell-bent on restricting immigration by any means necessary. But as it turns out, President Biden’s EOIR is far worse than President Trump’s. Indeed, the current level of callousness would make even Stephen Miller blush.

The solution to these problems is so basic that it should not need to be said, but here it is anyway: EOIR should stop advancing and rescheduling cases without notice and without consideration for whether we have time to complete the work. Unless something changes, we can expect many noncitizens to be unfairly denied protection, immigration attorneys will leave the profession (or worse), and EOIR will become illegitimate. Let us hope that sanity and decency will soon return to the Immigration Courts.

Ever wonder why Dems struggle to govern and often lose elections they should win?  This is a pretty good example of how the Biden Administration, through cowardice, ignorance, arrogance, and failure to prioritize racial justice and immigrant justice are “shooting themselves in the foot, over and over!”

They are going into midterms where every vote counts. They need “all hands on board” in the human rights community to help bail them out of the gross failures of the White House, Garland, and Mayorkas to reestablish a fair, efficient, and properly robust system for legally admitting refugees and processing asylum claims at the borders and the interior. This, in turn, has empowered disingenuous nativists like DeSantis and Abbott to “play games with human lives.” 

But, the Biden Administration “strategy” is to do everything possible to offend and drive a wedge between them and some of their most loyal and important groups of supporters — the immigration, human rights, and racial justice communities. (Make no mistake: The ongoing disaster at Garland’s EOIR disproportionally targets individuals of color.)

Garland seems to be impervious to his self-inflicted disaster at EOIR.  I think that advocates are going to have to sue to bring his “Stephen Miller Lite” travesty of justice at EOIR to a grinding halt. Those are resources that could and should be used to help asylum seekers “orbited” around the country by DeSantis and Abbott. 

I, for one, have been saying for a long time that Garland’s unfathomably horrible performance at EOIR is a threat to our entire justice system and to the future of our nation. Sadly, every day, Garland proves me right!

The real shame: It was all so preventable with just a modicum of competence and backbone from our failing AG!

Immigrations expert outlines next steps for Martha’s Vineyard migrants

Governor Baker has activated 125 members of the Massachusetts National Guard to assist in relief efforts for the nearly 50 migrants who came here last week.

Those migrants are now staying at Joint Base Cape Cod after they were flown into Martha’s Vineyard on Wednesday.

“There’s no doubt about the fact that it was a political move, not a move calculated to make the system work or to help people,” said Paul Wickham Schmidt, a retired U.S. Immigration judge and adjunct professor at Georgetown University.

Schmidt says it was surprising to see dozens of migrants dropped off on Martha’s Vineyard last week without any notice.

“With advanced notice, I think they could have done an even better job and probably with more focus on helping the individuals and less focus on what’s happening here,” said Schmidt.

People living on Martha’s Vineyard jumped into action to provide food and shelter for the immigrants from Venezuela, and now this weekend, they’ve been moved to dorms set up at Joint Base Cape Cod, where MEMA is trying to keep families together while providing not only beds and food, but also services from health care to legal support.

“Getting somebody who can take a personal interest and can make sure people can check in where they’re supposed to,” said Schmidt.

Schmidt says now, the migrants will need lawyers to help them check into an ICE office, Immigration court and an asylum office – all of which didn’t exist on Martha’s Vineyard.

Even though the last few days have been confusing, Schmidt believes the migrants will get the help they need as they get closer to Boston.

“This could have some silver linings because I think the people aren’t in Texas, which is sort of an asylum-free zone, where the judges deny almost every asylum case and there’s obviously a hostile local attitude,” said Schmidt.

Schmidt says immigration courts in Massachusetts are more likely to grant asylum cases than in Texas or Florida.

State leaders say they appreciate all the donations and support coming in for the migrants, but at this point they can’t accept any donations at Joint Base Cape Cod.

As the latter article from Paul Waldman @ WashPost points out, the GOP has no answers whatsoever about how to reform the U.S. immigration system. Dems have some proposals, but lack qualified, expert dynamic leadership on the issue. 

Even without legislation, there are lots of things the Biden Administration could have done by now to fix the broken asylum and refugee systems and make them functional, using current law! The biggest missed opportunity is painfully obvious to all expert observers: Fix the broken Immigration Courts starting with the Trump holdover BIA which is still a serious and unconscionable drag on our entire legal system! 

For example, given the size and importance of the Venezuelan refugee flow, and the mass of available documentation about the truly horrible human rights conditions under the Maduro regime in Venezuela, there should be many BIA precedents guiding practitioners and judges on how to prepare and grant asylum to Venezuelan asylum seekers. This would encourage and facilitate DHS, the private/NGO bar, and Immigration Judges in rapidly moving Venezuelan asylum grants through the system in a timely fashion.

Instead, there are no favorable Venezuelan asylum precedents that I know of. Moreover, almost all the recently BIA precedents on asylum are crabbed, legally deficient, often factually misleading, sometimes anti-historical, “prompts” on how to manipulate the law to improperly deny needed protection. They send grossly improper signals to already under-trained Immigration Judges that “any reason to deny  asylum” is the BIA’s “comfort zone.” 

There is an old saying that “elections have consequences.” But, apparently, when Dems win and Merrick Garland is the Attorney General, not so much.

Immigrants are good for America. Those granted asylum are a critical, often overlooked and and seriously underappreciated, group of legal immigrants. Yes, the asylum system is screwed up. Unfortunately, given the disorder and dysfunction promoted by Garland’s Immigration Courts’ biased and defective handling of asylum cases — essentially “working overtime” to manufacture bogus reasons to deny “slam dunk” asylum grants and providing defective guidance — and the disturbing lack of competent leadership on immigration and human rights by the Biden Administration, that’s going to take litigation in the Article IIIs. Getting individuals out of “Asylum Free Zones” operating in violation of sound legal standards for adjudicating asylum cases, primarily in the 5th and 11th Circuits, will be a huge “plus.”

Keep the focus on the “good guys” who need our help! That’s the best way of taking it to the cowardly grandstanders using humans as pawn and “photo ops.” It’s also the best way of dealing with clueless Dems, like Garland, who empower the “DeSantis’s of the world” by failing to fix our failing legal refugee and asylum systems and to vigorously stand up for the legal and human rights of those needing and deserving  protection!

There is a “great story” to tell about the contributions of those granted asylum and other immigrants to America. If Garland and “tone deaf” Dems are afraid to tell it, it’s up to the rest of us to do the work for them!

There are many “silver linings” surrounding the migrants “orbited” to Martha’s Vineyard as a Jim Crow political stunt. They are in the U.S. exercising their legal rights to apply for asylum. They have not been forced to remain in Mexico in squalid conditions, improperly returned to danger zones without being heard, or imprisoned without trial by DHS in substandard conditions to “punish” them for exercising legal rights.

In Boston, where Immigration Judges grant the majority of asylum cases, they have a much better shot at justice than in disgraceful “Asylum Free Zones” — inexplicably still operated by Garland — like Texas or Georgia. They are also within the jurisdiction of the U.S. Court of Appeals for the 1st Circuit, which often takes seriously its responsibility to enforce the legal and Constitutional rights of asylum seekers against Government overreach. By contrast, the generally extreme right 5th and 11th Circuits often disgracefully “tank” on their responsibilities to enforce the law for those seeking refuge.

As asylum seekers from Venezuela, they have about a 50|50 chance of being granted protection of some type, even in a dysfunctional Immigration Court system tilted against them. With effective legal representation, it’s likely that the majority of them will win relief, and the majority of those will become eligible for green cards and eventual citizenship. In plain terms, most of these individuals are part of our nation’s future hopes and chances for success. They are our future fellow citizens, and not incidentally, taxpayers!

It’s overwhelmingly in our best interests and those of the asylum seekers to be compassionate and welcoming, no matter what the eventual outcome of their cases. Getting them out of the toxic environment created by the GOP in places like Texas and Florida is good for them and for America.

The focus of legitimate state and local governments and NGOs should be on 1) providing food and shelter, and 2) getting individuals representation. The latter is the most important factor in not only increasing court appearance rates to nearly 100% but also increasing chances for a favorable result by four to five times. Fostering representation is actually where government entities seriously interested in rational law enforcement would put resources.

To date, the response of the Martha’s Vineyard community in providing temporary support and by the Massachusetts Government and the Biden Administration in finding the asylum seekers with a place to reside on “the mainland” appears to be working. Everyone interested in a better America in the future should focus on replicating the successful response to this albeit limited situation.

As my friend, humanitarian leader Gary Sampliner, said in his recent WashPost OpEd:

The bottom line is this: If we want to continue to live up to our values, many more of us need to step up to assist the new arrivals. And if we can meet this challenge, we will set an example for the rest of our country to follow. 

Americans must focus on helping our fellow humans, bringing much needed functionality to our broken asylum system, while putting grandstanding political thugs in the rear view mirror. Focus on the individuals seeking refuge, their humanity, and their needs. Tune out everything else. That’s the key to success — as a nation and as individual humans!

“Undesirable Immigrants: Why Racism Persists in International Migration”

In the book, you dispute the assumption that the right to border control and to exclude foreigners is an inherent feature of sovereign states. Instead, you frame it as a “modern consequence of racism.” Why do you see it that way?

The nation-state is a relatively modern invention on the scale of human history. Today, we have this conventional wisdom floating around that it is the natural right and duty of nation-states as sovereign entities to be able to restrict foreigners and have these really hard borders—and that it’s that ability that makes a state what it is. Actually, if you go back in time and look at the international legal thought that emerged from the 15th through the 19th centuries on what it actually means to be a state, the commonly held assumption that people like the late Justice [Antonin] Scalia and others talk about, is actually an invention of the 19th century. In the 16th and 17th centuries, the great thinkers of international legal jurisprudence or of state theory either thought that states had a right or an obligation to be hospitable to foreigners and to allow them free passage into their territory or, at most, it was up for raucous debate. It was only in the 19th century, when immigrant-receiving countries like the United States began receiving a large influx of racially different outsiders like the Chinese, that this presumption that sovereign states have a right and an obligation that can be tied back to their status as sovereign states to restrict outsiders emerged.

People like Texas Governor Greg Abbott seem to invoke that supposed inherent right when they describe migrants at the border as an “invasion.”

Precisely. These types of “declarations of war” are one of the clearest examples of this ideology seeping into public debate, which leads everyday people to create this idea that migrants are undesirable outsiders who are not fit for, or are undeserving of reaping the benefits of living in the United States or participating in our society.

The myth of the “undesirable immigrant” — at the heart of the anti-immigrant rabble rousing of Trump, Miller, Bannon, DeSantis, Abbott, Cotton, Hawley, etc. — has deep roots in American racial history.

I’ve said it many times: There will be neither racial justice nor equal justice for all without justice for immigrants (regardless of status). Laws like the Refugee Act of 1980, that very explicitly make arrival status irrelevant to access to a fair legal process, have been intentionally misinterpreted and misapplied by right-wing judges from the Supremes all the way down to the Immigration Courts. 

Advocates for civil rights, womens’ rights, LGBTQ+ rights, voting rights, disability rights, and other fundamental rights that have been unlawfully restricted or diminished, usually, but certainly not exclusively, by the right, who continue to ignore the primacy of dealing with the intentional unfair, racially biased treatment of migrants do so at their own peril!

THE LEVIN REPORT: GOP VIEWS WOMEN AS “SEA TURTLES!”🐢

As you’ve probably heard by now, within the next few months, the Supreme Court is expected to overturn Roe v. Wade, ending the national right to an abortion. If that happens, the medical procedure will be severely restricted or just outright banned in about half the country. A lot of people are extremely upset about this because, among other things, they think the government should not get to treat 50% of the population like second-class citizens, and that pregnant people should be allowed to decide what to do with their own bodies, just like men can chose to, say, have a vasectomy without a bunch of elected officials weighing in.

 

Yet somehow Montana senator Steve Daines doesn’t seem to understand why anyone would be griping about the catastrophic, dystopian situation that is about to befall women in the U.S. In fact, Daines appears to think he’s figured out a huge “gotcha” when it comes to liberals who want to ensure women have control of their own bodies: that “the left” cares more about the eggs of certain reptiles and birds than it does about human women’s eggs. Seriously.

 

Speaking on the Senate floor Tuesday, Daines opined: “If you were to take or destroy the eggs of a sea turtle—now I said the eggs, not the hatchlings that’s also a penalty but the eggs—the criminal penalties are severe: up to a $100,000 fine and a year in prison. Now why? Why do we have laws in place that protect the eggs of a sea turtle or the eggs of eagles? Because, when you destroy an egg, you’re killing a preborn baby sea turtle or preborn baby eagle. Yet when it comes to a preborn human baby, rather than a sea turtle, that baby will be stripped of all protections in all 50 states, under the Democrats’ bill that we’ll be voting on tomorrow. Is that what the America the left wants?” (Daines was referring to the Women’s Health Protection Act, legislation that would codify the constitutional right to an abortion into federal law, which the Senate failed to pass on Wednesday.)

Curiously, at no point in this speech lamenting that human women have too many rights compared to reptiles and birds, did Daines—who actually loves killing living things—acknowledge that humans do not lay eggs, that human embryos stay inside the mother until they are born, and that people are not endangered species. Must’ve been a mere oversight.

 

Senator Ron Johnson tells pregnant people to suck it up and drive out of state for an abortion if they want one

 

In the likely event that Roe v. Wade is gutted, countless lives will be destroyed, whether it‘s that of the rape victim who will have no choice but to give birth to her attacker’s kid, the woman living in poverty who can’t afford to raise a child, the literal child who has been impregnated by an abusive family member, or the person who simply had a different set of plans for their life that did not involve becoming a parent. Not to mention, the pregnant person who decides they have no choice but to undergo an illegal, risky abortion rather than be forced to give birth. But according to Republican senator Ron Johnson? None of this is a big deal and people are being hysterical over nothing.

 

Speaking to The Wall Street Journal, the Wisconsin lawmaker, who is up for reelection this year, said he doesn’t expect abortion to come up on the campaign trail because it’s basically a nonissue. “It might be a little messy for some people, but abortion is not going away,” Johnson said, an absolutely bizarre choice of words—not to mention, sentiment—given the history of women bleeding out and dying after unsafe abortions. He blithely added that though he doesn’t expect a 19th-century Wisconsin law banning abortions except to save the mother will go into effect if Roe is reversed, pregnant people can always go to neighboring Illinois if they want to obtain the medical procedure.

 

As so many people have noted, the reversal of Roe—and ensuing bans in numerous states—would disproportionately impact poor women and women of color. Those are people that, in fact, can’t necessarily just drive to Illinois (or the neighboring state that applies to them) because they can‘t get the time off of work, or don’t have a car, or have other children at home they can’t be away from for the night—or any of the many other reasons that Johnson apparently can’t think of. As for the idea that the 1849 Wisconsin law banning abortions won’t stand, Johnson is reportedly likely wrong about that too. As the Milwaukee Journal Sentinel wrote last week, “Republican lawmakers for decades have made sure to preserve the 1849 ban in hopes that Roe would someday be overturned,” and the Republicans running for governor in the state “have [all] strongly opposed abortion and would be unlikely to sign legislation loosening the ban.”

 

Johnson, of course, has a long history of extremely shitty takes. As one of the most vocal proponents of Trump’s “big lie,” he repeatedly downplayed January 6, variously claiming that the attempted coup wasn’t “an armed insurrection,” even though that’s exactly what it was; that the rioters were not actually Trump supporters but “provocateurs” impersonating Trump supporters; and that he was never once worried for his life because the mob that stormed the Capitol were there to overturn an election, not protest for equal rights for Black people. He’s also a major purveyor of COVID misinformation, dispenses anti-vaccine rhetoric, and was temporarily kicked off of YouTube for promoting bogus cures. In 2010, he opposed a Wisconsin bill that would have eliminated the statute of limitations for child sexual abuse victims to bring lawsuits. And four years later, he reportedly did not tell the “police, Senate or Wisconsin officials that a former aide was allegedly sexually assaulted by a state lawmaker.”

 

So yeah, it’s not surprising that he has no earthly clue why any of this is a big deal, but that doesn’t make it any less crappy. “I just don’t think this is going to be the big political issue everybody thinks it is, because it’s not going to be that big a change,” he told the Journal, like only the absolutely most ignorant elected official can.

 

Nothing to see here, just Trump’s election coconspirator telling Pennsylvania to trash absentee ballots so it’d look like Trump won

 

Apparently John Eastman saw no potential issues here, hence putting the plot in actual writing. Per Politico:

 

Attorney John Eastman urged Republican legislators in Pennsylvania to retabulate the state’s popular vote—and throw out tens of thousands of absentee ballots—in order to show Donald Trump with a lead, according to newly unearthed emails sent in December 2020, as Trump pressured GOP lawmakers to subvert his defeat. This recalculation, he posited in an exchange with one GOP state lawmaker, “would help provide some cover” for Republicans to replace Joe Biden’s electors from the state with a slate of pro-Trump electors, part of a last-ditch bid to overturn the election results.

 

Per the exchange, Eastman suggested that GOP legislators could simply cite their concerns with Pennsylvania’s absentee ballot procedures and then use historical data to “discount each candidates’ totals by a prorated amount based on the absentee percentage those candidates otherwise received.”

 

“Having done that math, you’d be left with a significant Trump lead that would bolster the argument for the Legislature adopting a slate of Trump electors—perfectly within your authority to do anyway, but now bolstered by the untainted popular vote,” Eastman wrote in a Dec. 4, 2020 email to Pennsylvania Rep. Russ Diamond. “That would help provide some cover.”

 

The suggestion to simply throw out ballots like that was a very cool, very legal thing to do came out of a batch of emails obtained via public records requests by the Colorado Ethics Institute, which reportedly sent them to the January 6 committee. Neither the panel nor Eastman’s attorney responded to Politico’s requests for comment. Back in March, a federal judge said that Trump and Eastman “most likely” committed felonies when they tried to overturn the results of the 2020. “The illegality of the plan was obvious,” Judge David Carter wrote. Even more so now!

 

Guy whose entire shtick is to ban things from the classroom now requiring lessons about the harms of communism in the classroom

 

We’re going to guess that no, Ron DeSantis does not see the irony here. Per The Guardian:

 

Discussions of gender identity and sexual preference are banned in many Florida classrooms because of governor Ron DeSantis’s “don’t say gay” law, alongside dozens of math textbooks blocked for “prohibited topics.” Now the Republican who has loudly condemned what he sees as the “indoctrination” of young people has made another subject compulsory: students must receive at least 45 minutes’ instruction every November about the “victims of communism.”

 

In a ceremony Monday at Miami’s iconic Freedom Tower, where tens of thousands of Cuban immigrants fleeing Fidel Castro’s revolution were admitted into the US between 1962 and 1974, DeSantis signed into law House Bill 395, designating 7 November as Victims of Communism Day…. The instruction will begin in the 2023-2024 school year, DeSantis said, and will require teaching about Joseph Stalin, Mao Zedong and Fidel Castro, as well as “poverty, starvation, migration, systemic lethal violence, and suppression of speech” endured under their leaderships in the Soviet Union, China and Cuba respectively.

 

Mispronouncing the name of Che Guevara as “Che Kay-Farra,” DeSantis used the ceremony to yell at students who wear T-shirts with the revolutionary leader’s image on it. “You can see at a college campus students flying the hammer and sickle from the old Soviet Union flag, you will see students that will have T-shirts with Che Guevara, you will see students that will idolize people like Mao Zedong,” he said, according to The Guardian. “That to me, this speaks of a tremendous ignorance about what those individuals represented and the evils that communism inflicted on people throughout the world…. While it’s fashionable in some circles to whitewash the history of communism, Florida will stand for truth and remain as a beachhead for freedom.”

 

Earlier this year, Florida banned public schools and private businesses from inflicting “discomfort” on white people during lessons or training about discrimination, a ridiculous law that grew out of the conservative hysteria over critical race theory. Florida, of course, now also prohibits teachers from discussing gender identity or sexual orientation in grades k–3 (and, critics say, beyond).

 

Strangely, DeSantis has not said anything about introducing a bill requiring schools to teach students about the history of petty tyrants.

Levin Report: Dumbass Texas Governor Claims No-Exceptions Abortion Law Is Fine Because He’s Going to “Eliminate” Rape

If you’re a person who believes it’s literally no one’s business who gets an abortion other than that of the pregnant individual undergoing the procedure, you’ve likely been incandescent with rage since the Supreme Court’s conservative majority decided to allow Texas to proceed with an insane law that prohibits terminating pregnancies after six weeks, with no exceptions for rape or incest. That anger likely stems from not just the law itself but having to listen to the chorus of dumbass voices who’ve come out backing Texas for effectively banning people from obtaining an abortion, from Tucker Carlson, who opined that the law shows “democracy does still exist,” to California gubernatorial candidate Caitlyn Jenner, who ironically commented that she supports Texas’s right to choose its own laws.

Of course, another one of those voices is the Lone Star state governor Greg Abbott, who signed the bill into law in May, saying at the time, “Our creator endowed us with the right to life and yet millions of children lose their right to life every year because of abortion,” and that the Texas Legislature “worked together on a bipartisan basis to pass a bill that…ensures that the life of every unborn child who has a heartbeat will be saved from the ravages of abortion.” (That both sides of the aisle supported the bill would be news to Texas Democrats, as just a single one of them voted for it.)

Asked on Tuesday why his state felt the need to “force a rape or incest victim to carry a pregnancy to term,” Abbott responded like only a person who really, really hates women can, claiming, “It doesn’t require that at all.” He added: “Because obviously it provides at least six weeks for a person to be able to get an abortion, so for one it doesn’t [require] that. That said, however, let’s make something very clear. Rape is a crime and Texas will work tirelessly to make sure that we eliminate all rapists from the streets of Texas by aggressively going out and arresting them and prosecuting them and getting them off the streets.”

There’s a lot to unpack here, so let’s start with the fact that Abbott is claiming that because the law allows for abortion up to six weeks, it’s not forcing anyone to do anything. As doctors, people who’ve been pregnant before, and people who’ve bothered to read a book on the subject before crafting legislation on it have noted, by the time a person misses her first period, she’s already roughly four weeks pregnant. That means that under Texas law, someone would have no more than two weeks, not six, to determine she’s pregnant and decide whether or not to get an abortion. Even in the case of people who are actively trying to get pregnant, that window can narrow even further for numerous reasons including if they have irregular cycles. Usually, then, one would make an appointment with a doctor to confirm the pregnancy, and as Abbott may or may not know, healthcare in America is not the greatest, so she may not be able to be seen for several weeks. And that hugely generous two weeks is not only a joke for many people actively trying to have a child, but for the majority of people who are not. “It is extremely possible and very common for people to get to the six-week mark and not know they are pregnant,” Jennifer Villavicencio, M.D., lead for equity transformation at the American College of Obstetricians and Gynecologists, told The New York Times. In other words, Abbott should fuck all the way off with his “obviously it provides at least six weeks for a person to be able to get an abortion.”

Then there’s the hilarious remark that he’s going to eliminate rape in Texas, so not allowing individuals to terminate pregnancies that result from heinous crimes is a moot point. Really, Abbott is going to make Texas rape-free? If he had that power, why didn’t he do it prior to enacting this law? The victims of the 14,824 reported rapes in his state in 2019, when he was four years into his first term, would probably love to know! (For those of you keeping up at home, that figure made Texas the No. 1 state for rape that year.)

Of course, Abbott is far from the first politician to say something ridiculously idiotic about abortion and rape. In fact, he joins a long line of assholes who’ve smugly offered their moronic two cents on the matter, an illustrious group that includes:

  • The Ohio state legislature, which introduced a bill in 2019 requiring doctors to “reimplant an ectopic pregnancy” into the uterus, or face charges of “abortion murder,” despite the fact that such a procedure is medically impossible;
  • Former Texas state representative Jodie Laubenberg, who claimed while in office that rape victims don’t need access to legal abortion, because they can get “cleaned out” with rape kits, which obviously is not at all how rape kits work;
  • Representative Michael Burgess, who somehow obtained a medical degree in 1977, and declared that male fetuses masturbate in utero—naturally, there is no evidence of this—, so abortions shouldn’t be allowed;
  • Former North Carolina state representative Henry Aldridge, who once said, “The facts show that people who are raped—who are truly raped—the juices don’t flow, the body functions don’t work, and they don’t get pregnant. Medical authorities agree that this is a rarity, if ever.” (Medical authorities do not agree with this);
  • Former congressman Todd Akin, who boldly declared on the campaign trail: “If it’s a legitimate rape, the female body has ways to try to shut that whole thing down.”

Welcome to the club, Greg! Can’t wait to hear you parse the nuances of putting $10,000 bounties on the heads of individuals trying to help people escape your barbaric law.

 

In other Abbott news…

When he’s not signing and defending disgraceful abortion bills, he’s disenfranchising millions of his constituents. Per Bloomberg:

Greg Abbott on Tuesday signed one of the nation’s most aggressive laws curbing access to the ballot, joining a wave of such restrictions enacted after former President Donald Trump’s false claim that the 2020 election was stolen. The legislature passed the measure last month after an exodus from the state by Democratic lawmakers during the first of two special sessions. After the walkout sputtered, Republican lawmakers passed the bill without delay.

Republicans have spent months raising doubts about the 2020 election, which experts say was one of the nation’s most secure. Now, supporters of new state laws say too many voters have lost faith in voting systems, and must be reassured.

“We must have trust and confidence in our elections,” Abbott said at a signing ceremony in Tyler, Texas. “The bill that I’m about to sign helps to achieve that goal. It ensures that every eligible voter will have the opportunity to vote.” Of course, that’s an interesting way to describe a law that makes it harder to vote, by, among other things, ending drive-thru voting, limiting mail-in voting, and endowing partisan poll watchers with more power. In a tweet, the American Civil Liberties Union wrote “This law is unconstitutional and anti-democratic. Texas—we’ll see you in court. Again.” Beto O’Rourke, the former Democratic U.S. representative from El Paso, wrote in a statement: “Governor Abbott is restricting the freedom to vote for millions of Texans. Instead of working on issues that actually matter, like protecting school kids from Covid or fixing our failing electrical grid, Abbott is focused on rigging our elections and implementing extreme, right-wing policies.”

Republican-led states have been hit the hardest. Last week, Florida and Texas alone made up one out of every three new cases, and now Florida is the center of the pandemic. On Friday, the Centers for Disease Control and Prevention reported 23,903 new cases in Florida that day alone. Hospitals are filling up as unvaccinated Americans need medical care; Austin, Texas, activated an emergency alert this weekend as its hospitals were overwhelmed.

But Republican lawmakers stand against the mask requirements and vaccines that would help stop the spread. Texas governor Greg Abbott has banned mask and vaccine mandates across the state, as has Arkansas governor Asa Hutchinson (who has since said the law was an “error”). South Carolina and Arizona have banned mask mandates in schools.

Today, in just the latest example, Senator Rand Paul (R-KY) said, “It’s time for us to resist. They can’t arrest all of us…. No one should follow the CDC.” He claimed that masking and remote learning was physically and emotionally damaging for children, and there was no reason they should not return to school full time, without masks. He said he would work to defund any school or government agency or school that did not simply resume its pre-pandemic operations.

Instead of trying to stop the spread of the virus, Republicans are blaming Biden for it. They claim that it is sparked by his handling of immigration on our southern border and that infected immigrants are responsible for the spike in the deadly disease.

When Biden asked Republican governors on August 3 to help or get out of the way, Florida governor Ron DeSantis responded: “Joe Biden has the nerve to tell me to get out of the way on COVID while he lets COVID-infected migrants pour over our southern border by the hundreds of thousands. No elected official is doing more to enable the transmission of COVID in America than Joe Biden with his open borders policies,” and claimed: “He’s imported more virus from around the world by having a wide-open southern border.”

DeSantis is not an outlier. Trump has pushed this line, Fox News Channelpersonality Sean Hannity hammers on it, and right-wing publications from the Daily Wire to National Review to the Wall Street Journal’s editorial page all insist that immigrants are to blame for the spread of the virus. Rand Paul has gone so far as to claim that administration officials are deliberately sending infected immigrant children around the country to spread the variant. Yesterday, Trump legal adviser Jenna Ellis called for Biden’s impeachment over the issue.

In fact, the administration continues to reject or expel border crossers under a public health order known as Title 42. It does permit the entry of unaccompanied minors and some vulnerable families. Migrants who cross the border are immediately required to wear masks. They are not tested at Customs and Border Patrol unless they show symptoms, but all are tested if they move into the system, and those who test positive for coronavirus are quarantined. Those slated for deportation are quarantined before they are deported. While infection rates are climbing, because of both the Delta variant and the crowding at Border Patrol, immigrants test positive at a lower rate than the rate of non-immigrants around them.

And yet, Republicans are using the deadly new coronavirus variant to stoke anti-immigrant fires.

It is cynical, it is deadly… and it takes us one more step toward authoritarianism.
