When thousands of migrant children ended up stranded in U.S. Border Patrol stations last spring, President Trump’s administration characterized the crisis as a spontaneous result of the record crush of migrants overwhelming the U.S. immigration system. But the backup also was a result of policy decisions that officials knew would ensnare unaccompanied minors in bureaucratic tangles and leave them in squalid conditions, according to dozens of interviews and internal documents viewed by The Washington Post.The policies, which administration officials began pursuing soon after Trump took office in January 2017, made it harder for adult relatives of unaccompanied minors to secure the children’s release from U.S. custody. Enhanced vetting of sponsors — including fingerprints and other paperwork — and the sharing of that information between child welfare and immigration authorities slowed down the release of children and exposed the sponsors to deportation.

The government knew the moves would strain child shelters, according to documents and current and former officials, but it was aimed at sending a message to Central American migrants: Coming to the United States illegally has consequences.

Administration officials said the policy was designed to protect children from potential abusers or criminals, but they also wanted to create a broad deterrent effect; they reasoned that undocumented migrants might hesitate to claim their children for fear of being deported. Authorities weighed deterrence — a central aspect of U.S. immigration policy under both President Barack Obama and Trump — against the possibility of children crowding into border stations. And they chose to push forward, knowing what would result.

“This will strain bed capacity,” authorities wrote in a discussion paper in February 2018.

The approach caused thousands of unaccompanied minors to be stranded in U.S. custody and exacerbated the appearance of a crisis on the southern border — a major element underlying the administration’s public request for billions of dollars in additional funding from Congress.

Lawyers were allowed to visit children in the border stations, and Democratic lawmakers were invited to tour the facilities when they were at their worst. They witnessed — and shared with the public — scenes of desperate children held in crowded cells without basic necessities.

According to current and former government officials, and emails and memos detailing the Trump administration’s strategy, it is clear they knew that without enough beds in government shelters, children would languish in Border Patrol stations not equipped to care for them, making the government a target of lawsuits and public criticism — both of which occurred.

One of the key figures in that strategizing, Chad Wolf, is set to take the helm at the Department of Homeland Security. Senators on Tuesday are expected to first vote on Wolf’s confirmation to his current job as undersecretary for strategy, policy and plans. Wolf is Trump’s favored pick to then take over as acting head of the agency, just as officials brace for what could be another increase in migrant crossings.

Top DHS officials have warned that the reprieve from the record influx of migrants in recent months is probably temporary. Acting Customs and Border Protection commissioner Mark Morgan said last month that the number of people crossing the border is still higher than at the same time last year and remains a “crisis.” Migration also typically increases in the spring, and the U.S. government is preparing for another surge of families and unaccompanied minors.

Such a potential wave of children is what inspired the early discussions about policy changes within the Trump administration in 2017 — along with debate about the policy’s effects.

‘Safety’ vs. ‘anguish’

Staff at the Department of Health and Human Services’ Office of Refugee Resettlement, which is in charge of caring for unaccompanied migrant children, argued against the policy in weekly memos during the summer of 2017. Jonathan White, then deputy director of the ORR’s children’s program, warned in a July 2017 memo that the administration’s plan to separate children from their families and to alter the process of handing children over to sponsors would “result in significant increases” in how long children would be held.

White wrote that children would spend an average of 95 days in federal custody and that the department would need at least 6,500 additional beds in just three months. White declined to comment for this story.

Documents reviewed by The Post show that officials also estimated that HHS would need an additional $686 million in funding — more than 50 percent above its planned budget — to accommodate the policy and create additional bed space.

But the administration did not formally request extra money for that purpose at the time, according to senior Democratic and Republican congressional aides who spoke on the condition of anonymity to discuss private negotiations.

Mark Weber, an HHS spokesman, did not dispute those details but maintained that the border backups resulted from a historic influx of unaccompanied children. In May alone, 9,000 children were referred to the government’s care, he said.

Administration officials also thought the backlog would be short-lived.

“At some point in FY19, the deterrent effect of the new policy should stop families and unscrupulous adult aliens from using the reunification process, normalizing and reversing the volume trend” of unaccompanied minors arriving at the border, authorities wrote in a discussion paper that the National Security Council shared with senior administration officials. The paper was shared with an interagency group that met regularly in the White House Situation Room to discuss immigration and border security.

Some senior officials acknowledged in interviews that they expected some children to remain in custody for longer periods of time, but they said the policy was developed with child safety in mind; they did not want children to be released to smugglers or criminals.

“My number one concern on this was making sure that kids were safe,” Tom Homan, former acting director of U.S. Immigration and Customs Enforcement, said in an interview. “I know it’s a tough decision. It was never easy. You have to weigh the operational concerns, and the humanitarian concerns, and how long they’re going to stay in detention. . . . Yeah, it was going to increase the bed stay, but it wouldn’t be like twofold, threefold, fourfold. We thought it was worth a try, and it if doesn’t work, we can always pedal back and change gears.”

Acting ICE director Matthew Albence said the policy was part of the “deterrent effect” the government was seeking: “The goal was to prevent these children from coming on this dangerous journey.”

Albence, Homan and other Trump administration officials say the backlog arose because of Washington politics, blaming Democrats in Congress for being too slow to authorize funding for more shelter beds at facilities designed to care for children.

“No one who values child welfare and safety would argue smuggled, exploited and unaccompanied children at the southern border should be handed over to illegal alien ‘sponsors’ without reliable identity confirmation and background checks,” said deputy White House press secretary Hogan Gidley. “The only ones responsible for crowded shelters are Democrats who want to preserve and expand loopholes used by child smugglers for purely political purposes.”

A few months after the policy was implemented, HHS officials determined that it was not improving child safety. They concluded that the added vetting was redundant and needlessly extended the time children remained in custody, according to internal documents that ORR Deputy Director Jallyn Sualog presented to Congress, and to testimony on Capitol Hill.

Advocates saw a darker motive in policies that they say were “intentionally developed to inflict maximum anguish on children,” said Heidi Altman, of the National Immigrant Justice Center. She said officials knew that their plans “would trigger a chain of events that left children hungry, abused and sick in overcrowded CBP facilities.”

Democrats likewise have argued that the White House set up the crisis. Rep. Rosa L. DeLauro (D-Conn.), presiding over a House Oversight subcommittee hearing last month, noted that it had always been possible for the government to ease conditions but that officials chose not to.

“We did not have to have a backlog. We did not,” DeLauro said. “That was created.”

Tightening the rules

The Department of Homeland Security did a test run of the policy in the summer of 2017, instructing border agents to interview young migrants about the relatives they wanted to live with in the United States. They then created “target folders” for those adults that could be used to take action against them, according to internal emails that the American Immigration Council obtained via the Freedom of Information Act and made available online.

 

At the ORR, then-director Scott Lloyd was thinking about the administration’s “moral imperative” to protect children from smugglers and to ensure that gangs were not exploiting the child shelter system to enter the country.

“Our legal responsibilities are child welfare,” Lloyd said in an interview. “But even from a child welfare perspective, it’s desirable to deter people from taking that risk, putting their kids in that type of harm.”

Lloyd said he and his staff agreed that better communication between his agency and DHS was the best way to address those concerns.

“We needed to know if a kid had any gang ties or gang ties in their family — we needed to make sure that DHS had that information and that we had that information,” Lloyd said.

The partnership was formalized in an agreement that mandated significantly stricter fingerprinting and screening requirements for all adults who hoped to sponsor a migrant child or who lived in a house where a migrant child might stay.

“If this could get finalized and implemented soon, it would have a tremendous deterrent effect,” Gene Hamilton, counsel to then-attorney general Jeff Sessions, wrote in notes he sent by email in December 2017 to Wolf, the senior DHS official who is now in line to take over as acting secretary. The existence of the notes — but not the identity of the authors or the recipients — was first reported by NBC News.

Wolf declined to comment.

Alexei Woltornist, a Justice Department spokesman, said the agreement was just one of “numerous steps” to prevent the victimization of children: “Ending the trauma these children can face requires taking action against all parties who entrust criminals and cartels to transport their children across the border.”

HHS Secretary Alex Azar and then-DHS secretary Kirstjen Nielsen — the two department heads tasked with carrying out the policy — voiced serious concerns, according to two officials familiar with the discussions. They worried that the agreement would be impossible to implement, could lead to longer detention times for children and would be viewed publicly as unnecessarily harsh, said the officials, who spoke on the condition of anonymity to discuss internal policy deliberations.

Caitlin Oakley, an HHS spokeswoman, did not dispute that account, but she said in a statement that Azar “supports the Trump administration’s goal of enforcing immigration laws and securing the border.”

“The backup at the border of minors witnessed this summer was the consequence of a broken immigration system,” Oakley added.

Nielsen declined to comment.

One HHS employee who spoke on the condition of anonymity to discuss internal matters recalled Lloyd telling staffers that the White House wanted them “to do everything you can to prevent backups into border stations. But it is better that there be a backup in a border station than that we not enforce immigration laws and that we not deter migration.”

Lloyd denied that account.

“I don’t ever recall holding, even temporarily, the idea that backups at border stations was a remotely acceptable scenario,” Lloyd said.

Internal memos show that for months before implementing the policy, government lawyers worried about lawsuits and discussed ways to claim that the policy would make children safer. In a January 2018 draft memo, viewed by The Post, Justice Department lawyers proposed defending the plan to conduct enhanced background checks and share them with enforcement agents as a means of protecting migrant children from witnessing the eventual deportation of their parents or relatives.

“We can argue that whether a proposed sponsor is subject to removal is a key factor in determining suitability, given the impact that immigration enforcement against, or detention of, a sponsor would have on the circumstances faced by” unaccompanied minors living with the sponsor, Justice Department lawyers wrote in January 2018 correspondence with DHS and HHS officials as part of an “analysis of litigation risk” associated with the agreement.

Federal judge blocks Trump administration from detaining migrant children for indefinite periods

The administration also developed and rolled out its family separation policy in the spring of 2018, part of its “zero tolerance” approach at the border. The months-long initiative, which separated thousands of children from their parents, compounded the need for shelter space. After a public outcry, the administration ended the policy.

By the fall of 2018, most of the families had been reunited, and the number of unaccompanied children crossing the border had fallen, but the population of children in the shelters continued to grow, according to HHS data. By October 2018, migrant children were spending an average of more than 90 days in federal custody — exactly as White had predicted — more than twice the length of stays two years earlier.

While some adult migrants were afraid to come forward to claim their children, the contractors tasked with carrying out the background checks and fingerprinting were overwhelmed, according to current and former HHS officials. The American Civil Liberties Union and other advocates filed lawsuits challenging the policy, arguing that parents waited months for fingerprinting results.

Time in custody grows

Kevin Dinnin, the head of the nonprofit that operated a shelter for migrant children in Tornillo, Tex., said the crush of minors became increasingly severe through late 2018, and he told the agency he could not continue. Images of teenagers behind chain-link fences shuffling single-file from tent to tent had drawn public outrage, and Dinnin could not understand why children continued arriving at the shelter even though migrant crossings had slowed and family separations had ended.

“The problem was, kids were coming and not being discharged,” Dinnin said. “The average length of stay just kept increasing.”

An HHS official who spoke on the condition of anonymity to discuss sensitive policy decisions said the agency would never have opened the Tornillo shelter had it not been for the agreement with DHS.

“It was the increase in average length of care that created a need for thousands of beds,” the official said.

U.S. returns 100 migrant children to overcrowded border facility as HHS says it is out of space

HHS career staff members decided that the agency had no choice but to eliminate some aspects of the background checks to relieve the pressure on the system. To avoid roiling the White House, they slowly rolled back the policy through several “operational directives” over a period of months, according to current and former HHS officials.

The agency announced that it would stop fingerprinting all adult members of a sponsor’s household in December 2018, and the government then quickly released thousands of children from custody. The Tornillo shelter closed a few weeks later.

But with the agency still fingerprinting sponsors, some children continued to languish in custody for months, especially when migrant crossings surged again in the spring. Children apprehended at the border were left in Border Patrol stations as a result.

Democratic lawmakers, lawyers and advocates toured Border Patrol stations in late spring and early summer and delivered scathing descriptions of the suffering they witnessed. DHS and HHS officials pleaded with Congress for more money, saying they had been blindsided by the numbers. HHS canceled English classes, soccer and legal aid for migrant children, citing inadequate funds.

In June, Congress approved a $4.6 billion emergency border spending package, shortly after hearing the government’s pleas about what they described as a humanitarian crisis at the border.

Officials credited the subsequent release of hundreds more children to the aid package. But in court documents and congressional testimony, they acknowledged that moves to scale back the enhanced background checks had made the difference. Those included a final directive in June to stop fingerprinting aunts, uncles and grandparents seeking custody of migrant children, speeding up the release of more than 1,000 children in a matter of weeks and allowing the emergency shelter in Homestead, Fla., to close.

“I do support the four operational directives in order to expedite the release of children to properly vetted sponsors,” ORR Director Jonathan Hayes said at a congressional hearing in July. “I want to see the children back with their families.”

Officials have argued that shortening the time that children are held in federal custody will boost the incentive for migrant families to seek entry into the United States.

“The shorter the stay, the more likely they’re willing to take it on,” Homan said. “If I think I’ll be detained for a year, I might not come. But if I’ll be detained for a week and be released, that may convince me to make that trip.”

It’s a result of conditions in the sending countries and won’t be stopped or prevented by unilateral actions on the part of receiving countries, even extreme cruelty.  The phenomenon might, however, be increased by the overtly anti-refugee policies and statements of the Trump Administration and the actions of the Trump Administration in coddling dictators and tyrants, which actually produces more child refugees.

Also, what about the criminals over at HHS who have abandoned their Congressionally-assigned duty to protect and look out for the best interests of children for a White Nationalist, racist, nativist enforcement policy that targets kids. When folks like Alex Azar & company are sent packing from Government some day, remember for what they really stand!

A federal judge on Monday blocked an experimental Trump administration policy that requires asylum seekers to wait in Mexico while their cases make their way through the immigration court system, a major blow to President Trump as border crossings have surged to their highest point in more than a decade.

U.S. District Court Judge Richard Seeborg in San Francisco enjoined the Migrant Protection Protocols policy days after outgoing Homeland Security Secretary Kirstjen Nielsen pledged to expand the program. The policy began in January.

Trump has justified blocking asylum seekers from entering the United States by claiming that many asylum seekers are trying to carry out a scam — that they are coached to file false asylum claims knowing that they will be released into the country because of a lack of detention bed space. The administration had hoped to keep more asylum seekers in Mexico — and off U.S. soil — while they await court hearings on their claims.

Migrants who reach U.S. soil — including areas that are outside U.S. border barriers but inside U.S. territory — have the legal right to seek asylum. They generally are either held in detention facilities to await rulings in their cases or are released into the United States.

The policy had been one idea to stem the flow of migrants into the country, but Seeborg said his order ending the policy will take effect at 5 p.m. on April 12. Within two days, he said, the 11 migrants named in the lawsuit must be allowed to enter the United States, and the administration may not implement or expand the program.

The American Civil Liberties Union, one of the groups that filed the lawsuit, hailed the ruling as a “very important decision” on an “unpredecented” attempt to block asylum seekers from setting foot on U.S. soil.

“What it will mean is that nobody else can be sent to Mexico,” said Judy Rabinovitz, an ACLU lawyer. “They can’t enforce this policy.”

In February 2019, 66,450 migrants crossed the US/Mexico border between official border crossings and were apprehended by US Border Patrol agents, committing the misdemeanor of illegal entry.

It’s a sharp increase from January and marks an 11-year high. But the number reflects an ongoing trend: record numbers of families coming to the US without papers.

The Trump administration reported that 76,103 people tried to enter the US without valid papers in February. That number combines people who came to official border crossings and migrants who were caught by Border Patrol after crossing illegally.

The total has alarmed conservatives; President Donald Trump has taken it as validation of his decision to declare a national emergency and appropriate more funding to build “a wall” along the border. (Construction of the wall would take months or years.)

But while current apprehension levels are higher than they’ve been in the last decade, they’re still way below pre-recession levels.

What is truly unprecedented is who the migrants are.

Almost two-thirds of Border Patrol apprehensions are of parents and their children. While we don’t have complete historical data, it seems likely that more families are coming to the US without papers than ever before. Additionally, a large share of migrants (both families and single adults) are expressing a desire to seek asylum.

Both groups are overwhelmingly coming from the Central American countries of Guatemala, Honduras, and El Salvador.

The US immigration enforcement system was designed to swiftly detain and deport migrants who attempted to sneak into the US illegally. Asylum-seekers and families don’t fit that mold.

Border Patrol agents aren’t equipped to deal with large groups of families who travel through Mexico by bus and then turn themselves in at the border. This has arguably contributed to the deaths of multiple children in Border Patrol custody in recent months, and spurred Customs and Border Protection to expand medical care.

There are strict limits on how long immigrant children and families can be held in immigration custody; in practice, officials release most families pending an immigration hearing. Asylum seekers can’t be deported without a screening interview, and those who pass (by meeting a deliberately generous standard) are often eligible for release from detention while their cases are resolved.

Some of those migrants, either intentionally or accidentally, do not complete the asylum process or lose their cases, and live in the US as unauthorized immigrants. For many Trump officials, this is the heart of the crisis. Officials have spent the last year working on regulations and pushing Congress to expand family detention and reduce asylum protections.

Trump critics continue to insist that migration isn’t at crisis levels. To them, the more urgent issue is the administration’s treatment of families, children, and asylum seekers. They are urging the administration to allow more asylum seekers to present themselves at ports of entry legally. They are calling attention to the conditions in which migrants are being held in custody.

Asylum seekers cannot be barred from entry. The question is whether they should be treated as vulnerable migrants who the US is obligated to treat with kindness, or as deportable migrants until (if at all) they win legal status.

It’s really a question of whether we honor our legal and international obligations by fairly processing refugees, or choose to dehumanize and further victimize them. The totally disingenuous performance by Administration officials testifying before Congress on Tuesday tells you all you really need to know. This Administration has shown a slavish devotion to failed policies, dumb gimmicks, and just downright cruelty in a vain attempt to stop people from fleeing danger zones. Not surprisingly, their “built to fail” policies, scofflaw behavior,  and malicious incompetence has made things worse rather than better.

What if we had an honest Administration that admitted that this is a refugee flow that we had a significant role in creating? What if we used the existing law and legal mechanisms to take as many refugees as we could and worked with the UNHCR and the international community to help the others find viable resettlement alternatives? Wow, that would be making government work for the common good. something that’s just not in the “White Nationalist playbook.”

WASHINGTON — The Trump administration plans to begin turning asylum-seekers back across the southern border on Friday to wait in Mexico under a new policy designed to crack down on immigration by Central American families, according to three Department of Homeland Security officials familiar with the matter.

Customs and Border Protection officers will begin returning asylum-seekers trying to enter at the San Ysidro port of entry in California from Tijuana, Mexico, where thousands of migrants from Honduras, Guatemala and El Salvador are already waiting in poor conditions.

Under current policy, immigrants who pass an initial “credible fear” interview are allowed to remain in the U.S. while they wait for immigration judges to decide their cases. Single adults are detained while they await their hearing, but a federal court decision in 2015 mandates that families with children be detained no longer than 20 days.

The Trump administration has blamed that court decision, known as the Flores settlement, for being a magnet that is driving record numbers of immigrant families to apply for asylum at the southern border. Last summer under the “zero tolerance” policy, DHS separated asylum-seeking parents from their children at the border, sparking international outcry.

Overall numbers of undocumented immigrants apprehended or stopped from legally entering the United States are lower than the historic highs reached in the early 2000s.

Children who travel without a guardian, immigrants who appear ill as well as other “vulnerable populations” will be exempt from the policy and allowed to wait in the U.S. for an immigration hearing.

Immigrant and civil rights organizations have threatened to sue the Trump administration over the policy, known as Migration Protection Policy, which Homeland Security Secretary Kirstjen Nielsen announced was coming in her congressional testimony in December.

The policy is a unilateral move by the U.S. and not part of an agreement with Mexico, two officials said, though Mexico has agreed to care for immigrants who are waiting to apply. The Lopez Obrador administration in Mexico has been vocal about its opposition to the policy in the past.

Beginning Friday, the asylum-seekers who come to the San Ysidro port of entry will be sent back to Tijuana with a notice to appear in court in San Diego. On their court dates, U.S. Immigration and Customs Enforcement will provide transportation from the port of entry to immigration court. Asylum-seekers will also be given a 24-hour hotline to call for the status of their asylum cases.

SHUTDOWN HAS FURLOUGHED IMMIGRATION COURT JUDGES

Due to a backlog in U.S. immigration courts of more than 800,000 cases, asylum-seekers currently have to wait months or even years to see a judge. DHS has asked the Justice Department to expedite the cases of immigrants waiting in Mexico, and two officials said they expect the asylum-seekers affected by the new policy to wait no more than a year.

A 7-year-old girl from Guatemala died of dehydration and shock after she was taken into Border Patrol custody last week for crossing from Mexico into the United States illegally with her father and a large group of migrants along a remote span of New Mexico desert, U.S. Customs and Border Protection said Thursday. . . .

According to CBP records, the girl and her father were taken into custody about 10 p.m. Dec. 6 south of Lordsburg, N.M., as part of a group of 163 people who approached U.S. agents to turn themselves in.

More than eight hours later, the child began having seizures at 6:25 a.m., CBP records show. Emergency responders, who arrived soon after, measured her body temperature at 105.7 degrees, and according to a statement from CBP, she “reportedly had not eaten or consumed water for several days.”

The Department of Homeland Security’s statement in response to reports of the child’s death was a moral and legal disgrace:

Traveling north through Mexico illegally in an attempt to reach the United States, is extremely dangerous. Drug cartels, human smugglers and the elements pose deadly risks to anyone who seeks to cross our border illegally. Border Patrol always takes care of individuals in their custody and does everything in their power to keep people safe. Every year the Border Patrol saves hundreds of people who are overcome by the elements between our ports of entry. Unfortunately, despite our best efforts and the best efforts of the medical team treating the child, we were unable to stop this tragedy from occurring.

“Once again, we are begging parents to not put themselves or their children at risk attempting to enter illegally. Please present yourselves at a port of entry and seek to enter legally and safely.”

For starters, the federal government is responsible for the health and welfare of anyone it detains — whether it is a criminal in a prison, a child in its foster-care system or families detained at the border. Regardless of what the children’s parents did or did not do, the United States has an obligation to the children the moment it detains them. Not to give food and water, or to check the health of those it has in custody, is inexcusable. Blaming the parents as Homeland Security Secretary Kirstjen Nielsen did (“This is just a very sad example of the dangers of this journey. This family chose to cross illegally”) reflects her legal and moral obtuseness. In our care, the child’s welfare became our responsibility.

“This tragedy represents the worst possible outcome when people, including children, are held in inhumane conditions,” the ACLU’s Border Rights Center said in a statement. “Lack of accountability, and a culture of cruelty within CBP have exacerbated policies that lead to migrant deaths.” The ACLU continued, “In 2017, migrant deaths increased even as the number of border crossings dramatically decreased. When the Trump administration pushes for the militarization of the border, including more border wall construction, they are driving people fleeing violence into the deadliest desert regions.” The statement pointed out that the incident wasn’t reported for a week. “We call for a rigorous investigation into how this tragedy happened and serious reforms to prevent future deaths,” the statement concluded.

Frank Sharry, executive director of America’s Voice, a progressive pro-immigration group, also responded. Sharry pointed out that a “tragic and preventable death of an innocent seven-year old girl should not be seen as a mistake made in an otherwise humane system, but rather a deliberately cruel and dehumanizing system that has produced yet another death.” His statement asserted that CBP’s holding facilities are characterized by “freezing temperatures, no beds, lights left on, no showers, not enough toilets or toilet paper, filthy conditions, horrible smell, inedible food and not enough clean water to drink, and [are] run by insulting and abusive agents.” The system the administration has set up is seemingly designed to inflict the maximum amount of suffering in a failed attempt to deter migrants:

[The] strategy has many components: tell those who want asylum to request it at ports of entry while making it nearly impossible to request asylum at ports of entry; prosecute those who present themselves to Border Patrol agents between ports of entry for “illegal entry;” separate families in numbers large (now halted by a federal judge) and small (under the flimsy pretext of protecting children from “criminal family members”); detain as long as possible those who seek asylum; lock up minors who arrive unaccompanied minors and scare away their U.S.-residing parents and relatives who want to sponsor them by threatening to arrest and detain those who come forward; and gut asylum standards by unilaterally changing the bases for deciding cases, pressuring trained Asylum Officers to reduce their high rates of deeming Central Americans as having a credible fear of return, and bullying Immigration Judges to deny cases when finally adjudicated.

Now if a pregnant migrant asserts her right to seek an abortion, this administration will go to any lengths to protect the life of the unborn child; for the already-born minors (and adults) in its custody, however, the administration cannot be bothered to ensure humane and safe conditions.

Under the Republican-majority House and Senate, rigorous oversight of the Department of Homeland Security and legislation to try to ameliorate these conditions were all but impossible. With a Democratic-majority House, this will no longer be the case. The House Judiciary Committee will be headed by Jerrold Nadler (D-N.Y.) in the new Congress. He left no doubt as to his intention to get to the bottom of the tragedy and the conditions that allowed this to occur:

On Friday, Nadler and Democrats who will head House Judiciary subcommittees sent a letter to the inspector general for the Department of Homeland Security requesting the IG “initiate an investigation into this incident, as well as CBP policies or practices that may have contributed to the child’s death [and] CBP’s failure to timely notify Congress of this incident.” The letter told the IG, “It is hard to overstate our frustration with the fact that we learned of this incident through media reports one week after the incident occurred. It is clear that CBP failed to follow the reporting requirements laid out in last year’s omnibus appropriations bill until after the news of this death was already public.”

With adequate border security and staffing, a sufficient number of immigration judges deployed to handle the caseload, reversal of the administration’s deliberately cruel policies, and effective diplomacy with and provision of assistance to the countries from which these people are fleeing for their lives, the current, intolerable situation should improve.

It’s a cruel irony that Trump has portrayed refugees as a threat to Americans. In fact, the reverse is true.

The attitude of President Trump toward federal law enforcement is, to put it mildly, mixed. The FBI refused to bend to his will. So the special counsel team is composed of “hardened Democrats” engaged in a “WITCH HUNT.” The FBI was, according to Trump, too preoccupied with the Russia investigation to prevent the Parkland, Fla., school shooting. The agency’s reputation “is in Tatters — worst in History!”

But Immigration and Customs Enforcement has passed the loyalty test. ICE’s enforcement surge “is merely the keeping of my campaign promise,” the president tweeted. Referring to ICE acting director Thomas Homan, Trump said, “Somebody said the other day, they saw him on television. . . . ‘He looks very nasty, he looks very mean.’ I said, ‘That’s what I’m looking for!’ ”

This is territory more familiar in political systems of personal rule. The agency that defies the ruler must be discredited. The agency that does his bidding is viewed as a kind of Praetorian Guard.

Most of the professionals working in ICE would surely deny this characterization, pointing to an important legal role independent from any individual president. But they need to understand that their work is now being conflated with Trump’s nativism.

ICE’s 40 percent increase in arrests within the United States after Trump took office is now closely associated with the president’s political priorities. His sweeping executive orders on immigration broadened the focus of enforcement beyond serious threats to public order. Arrests of immigrants without criminal convictions have spiked. Routine “check-ins” with ICE officials can end with handcuffs and deportation. “Sanctuary cities” — a recurring presidential political obsession — are being targeted with additional personnel. Hundreds of children have been removed from parents seeking asylum and detained separately — compounding their terrible ordeal of persecution and flight. ICE recently announced a new policy that makes it easier to detain pregnant women. Asylum seekers have often been denied “humanitarian parole” while their cases are decided, effectively jailing them without due process.

Officials of the agency insist that their nonpolitical mandate hasn’t changed. But Homan has praised the Trump administration for taking “the handcuffs off law enforcement.” Whatever their intention, ICE agents are being used by the president to send a message of callousness. And they are tying themselves to Trump’s political fortunes in the process.

The job performed by ICE is essential to American security, and not easy. Agents must prevent some truly dangerous people from entering and staying in the country — gang members, drug dealers and terrorists. But it is also their job to deal with asylum seekers — men, women and children fleeing from gangs, targeted for death by drug cartels and oppressed by terrorist states. Some of the worst people in the world, and some of the most sympathetic people in the world, are processed by immigration officials. It takes care and discernment to make this distinction.

ICE is not an agency famous for its care and discernment. In releasing an immigration activist detained by ICE early this year, U.S. District Judge Katherine B. Forrest said, “It ought not to be — and it has never before been — that those who have lived without incident in this country for years are subjected to treatment we associate with regimes we revile as unjust. . . . We are not that country.”

Accusations of abuse in ICE custody are numerous and serious, and they preexisted the Trump era. An investigation by ProPublica and the Philadelphia Inquirer reported cases of racial profiling, fabricated evidence and warrantless searches — all given little scrutiny by overwhelmed immigration courts. During the past few years, there have been hundreds of accusations of sexual abuse, racial slurs, abusive strip searches and verbal harassment in ICE jails, prisons and detention centers. For an institution that claims “zero tolerance” for such practices, it seems to get a lot of serious complaints. One asylum seeker, Gretta Soto Moreno, has called the facilities worse than normal prisons because ICE “feels like it can treat immigrants any kind of way.”

This is the bitter fruit of dehumanization — in a facility, in a system, in a country. It is unclear whether Trump would even regard such a reputation as undesirable. He has effectively given permission for bullying.

This is an issue ripe for more rigorous congressional oversight — even an independent commission to investigate charges of physical and sexual abuse in the ICE system. But this would require a critical mass of elected Republicans to give a damn about the rights and dignity of migrants. It is a distant dream.

Dehumanization of migrants, who are among the most human of all among us, is certainly one of the most insidious aspects of the Trump/Sessions/Nielsen,/Homan regime. When we allow individuals like these who have both forgotten their proper roles in a democratic republic and arrogantly checked their humanity at the door, we essentially dehumanize ourselves.

Not surprisingly, migrants grow in moral stature as we shrink, individually and collectively. And the restrictionist (occasionally, as in the case of folks like Rep Steve King (R-IA) “neo-Nazi”) wing of the GOP is certainly a prime enabler of this reprehensible conduct. As even some GOP commentators have noted, there is a disturbing “empathy and humanity gap” evident when GOP politicos speak in dismissive and derogatory terms about migrants.

Only time will tell how soon we will be able to remove these unworthy public officials from the positions they now hold and replace them with responsible public servants who treat others with dignity, respect, humanity, and reasonableness. But, the speed and decisiveness with which we act will say much about America’s future prospects as a nation.

New DHS secretary faces first immigration litmus test

New Homeland Security Secretary Kirstjen Nielsen faces her first major test on immigration policy next week with a decision that could force upwards of 250,000 Central Americans to leave the United States or scramble to find a way to stay.

Monday is the deadline for deciding the future of a protected status for nationals of El Salvador, and the Department of Homeland Security is widely expected to announce an end to the program, which has offered work permits and the right to live in the United States.

More than 260,000 Salvadorans are covered by the program, according to US Citizenship and Immigration Services, but some experts estimate roughly 200,000 of them could be left without the protected status, based on previous department estimates. Salvadorans make up the largest share of immigrants protected by the program, and all of them have lived in the United States since at least 2001.

While the Homeland Security Department has not yet announced its decision, its actions this year have signaled a tougher approach to the program, which allows individuals from countries affected by crises like natural disasters, war and epidemics to stay in the US and work without being deported. The “temporary protected status,” as it is known, lasts for about two years before needing to be renewed. El Salvador’s status has been continually renewed since 2001, when it was granted after a series of earthquakes.

The pending deadline marks the first major immigration decision that will fall to Nielsen, who has thus far pledged to carry on the legacy of her predecessor and former boss, John Kelly, who is now White House chief of staff.

This fall, her department ended temporary protected designations for thousands of immigrants, including more than 50,000 from Haiti and thousands more from Nicaragua and Sudan, which critics say needlessly uproots contributing immigrants to send them back to unstable countries.

Acting Secretary Elaine Duke, however, extended protections for more than 80,000 Hondurans for six months because she said she was unable to reach a decision about whether conditions in that country had improved enough to terminate the protected status. That decision prompted heavy pressure from the White House to end the protections, sources said, though Duke later denied accounts that said she felt distressed and disappointed by the interference from Kelly.

Nielsen has the ultimate decision on whether to extend El Salvador’s status, but advocates on the issue from both sides of the aisle anticipate a similar decision to that on Haiti, a struggling country as well, but one the department says has recovered from its devastating earthquake in 2010. If Nielsen opts to end the Salvadorans’ protections, it likely would give them 12 to 18 months to apply for some other visa to stay in the United States or prepare to leave.

When the protections end, recipients revert to the status they have otherwise, which would likely leave a number of Salvadorans undocumented after nearly two decades of legally working and living in the United States.

Groups on the right that advocate for restricting immigration are pressing the Homeland Security Department to end the status for El Salvador, and were concerned during Nielsen’s confirmation that she would be adequately hard-line in implementing President Donald Trump’s immigration agenda.

“(Monday’s decision) is a test of whether she properly reflects the Trump campaign’s commitment to the people on these issues,” said Dan Stein, president of the Federation for American Immigration Reform. “We’d be very disappointed to see TPS extended yet again — with no credible justification.”

“Allowing them to stay longer only undermines the integrity of the program and essentially makes the ‘temporary’ protected status a front operation for backdoor permanent immigration,” added Roy Beck, president of NumbersUSA.

There is one area of agreement between the groups on the right like FAIR and NumbersUSA and advocates on the left who say ending temporary protected status for El Salvador would be an unnecessary and cruel move — Nielsen’s decision will toss a political hot potato to Congress.

In ending the protections for other groups, the Homeland Security Department has urged outraged lawmakers to enact legislation rather than continue to force the secretary to make the decisions.

“It will be couched in nice terms, but it actually will be a dramatic move,” Frank Sharry, executive director of America’s Voice Education Fund, a pro-immigration reform group, said of his expectation that DHS will urge Congress to act. “These are Salvadorans who have been living in the United States with work permission for almost 20 years. These are people who are American in all but their paperwork. And the idea that we’re going to try to drive them back to a country that is engulfed in weak governance and corruption and violence is unthinkable.”

How dumb is it to terminate TPS for El Salvador. I ran into a respected local immigration attorney over the Holidays. While she decried the stupidity and wastefulness of the anticipated decision to terminate Salvadoran TPS, she said that it would have little practical effect on most of her Salvadoran TPS clients.

By now, she related, they all have strong prima facie claims for what is known as “Non-Lawful Permanent Resident Cancellation of Removal” based on “exceptional and extremely unusual hardship” to U.S. citizen spouses or children. Once TPS runs out and these cases are placed on the already dysfunctional Immigration Court docket, she will file the Form EOIR-43 Application for Cancellation of Removal and seek work authorization while the cases are pending before the Immigration Courts. She anticipates that given the current and anticipated backlogs in the local U.S. Immigration Courts, those cases will receive “Individual (Merits) Hearings” about five or six years from now.

Some, she thinks most, will succeed. Those that fail will exercise their appellate rights, thus further extending the process. By that time, the already feeble rationale for actually removing them for the U.S. will be even weaker. And, by then, we likely will have a different Administration and Congress that hopefully will take a more realistic, humane, and pro-American approach to the plight of the TPSers.

How dumb is terminating TPS? I’d hazard to guess that Salvadorans with “permits’ — work authorizations granted under TPS — form the backbone of the booming Northern Virginia construction and remodeling industry. If they were removed tomorrow, everyone in the region would suffer an immediate, and not easily reversible, economic downturn.

Similar problems will occur throughout the nation, not to mention the likely destabilization of El Salvador from the return of so many individuals who had long resided in the U.S to a country already in serious turmoil. In  other words, the Trump Administration appears to be in the process of engineering a human rights, foreign policy, and economic disaster on multiple levels.

The administration will notify the Salvadorans they have until Sept. 9, 2019 to leave the United States or find a new way to obtain legal residency, according to a copy of the announcement prepared by the Department of Homeland Security that will be published Monday morning.

The Salvadorans were granted what is known as Temporary Protected Status, or TPS, after a series of earthquakes devastated the country in 2001.

DHS is preparing to announce that Secretary Kirstjen Nielsen has decided the conditions in El Salvador have improved significantly since then, ending the original justification for the Salvadorans’ deportation protection, these people said.”

White House chief of staff John Kelly pressured acting Homeland Security Secretary Elaine Duke to terminate protections for tens of thousands of Honduran immigrants currently living in the US, sources tell CNN.

Duke received multiple calls from Kelly pressuring her, in Duke’s perception, to end Temporary Protected Status for Honduran immigrants on Monday’s decision day, leaving Duke “distraught and disappointed” and ready to leave the department, according to a source familiar with Duke’s thinking.

The Trump administration characterized the call as Kelly weighing in through a normal process and said Duke was committed to remaining at her post.

The Washington Post first reported on the call.

TPS is an immigration status allowed by law for certain countries experiencing dire conditions, such as a natural disaster, epidemic or war, and protects individuals from deportation and authorizes them to work in the US.

Monday was the deadline for a decision on the protected status for the roughly 86,000 Hondurans. DHS instead announced that Duke had not found there was enough information to make a formal decision, a move that triggered a six-month extension of the protected status. The administration did terminate protections for Nicaraguans, about 5,300 of which live in the US. Both populations have lived in the US for nearly two decades.

According to the source familiar with Duke’s thinking, Kelly and the administration wanted Homeland Security secretary nominee Kirstjen Nielsen to avoid questions about the issue at her Senate confirmation hearing on Wednesday, and wanted to her confirmed quickly enough that she would be the one to make a decision on temporary protected status for Haitians, which is due at the end of the month and which will likely be ended.

According to the source familiar, Duke had decided over the weekend that she did not have enough information to end the protections for the Hondurans, which is what the department announced late Monday evening.

“I think she’s very distraught and disappointed at Kelly and the whole apparatus,” the source said. “She’s out there alone, you know? It’s like, ‘Why do I keep doing this if you guys are just going to beat me up?'”

The source confirmed that she made reference to resigning during the back-and-forth and is inclined to leave the job.

The source described the back-and-forth as a “forceful, directive conversation.”

“It was a loud conversation, it wasn’t a quiet conversation,” the source said.”

Whether she will live up to their “low expectations,” however, is another matter entirely.

“President Trump announced Wednesday that he intends to nominate Kirstjen Nielsen, a cybersecurity expert and deputy White House chief of staff, to be Homeland Security secretary, a job left vacant when John F. Kelly departed to become White House chief of staff in July.

The White House, in a statement, described Nielsen as having “extensive professional experience in the areas of homeland security policy and strategy, cybersecurity, critical infrastructure, and emergency management.”

Nielsen is a longtime Homeland Security Department official who served as Kelly’s chief of staff when he was DHS secretary and accompanied him to the White House as his deputy. She also worked at the DHS during the George W. Bush administration and founded a consulting firm focused on risk and security management.

Other contenders for the Cabinet post included Tom Bossert, Trump’s homeland security adviser, and Kevin McAleenan, the acting commissioner of U.S. Customs and Border Protection.

Her detractors viewed her no-nonsense style as brusque and complained that she could be unresponsive as she worked with Kelly to streamline operations and instill discipline in a White House often lacking structure. But her allies and supporters said she was simply helping to professionalize the West Wing — the sort of necessary but thankless task that often leaves some staff members griping.

Nielsen will inherit a massive and important portfolio. The Department of Homeland Security is considered a critical agency on matters of counterterrorism and national security. It is the agency, for example, that informed states they had been targeted by Russian hackers during the 2016 election campaign, and it would be responsible for monitoring and preventing such incidents in the future.

But it also bears primary responsibility for immigration enforcement and border protection — top priorities in the Trump administration. The Federal Emergency Management Agency, which has been coordinating the government’s response to several recent hurricanes, the Secret Service, which protects the president and his family, and the Transportation Security Administration, which handles airport and other transportation-related security, are also a part of the DHS.

 

Nielsen is likely to have to navigate no shortage of controversies. Homeland Security officials will play a key role in implementing Trump’s new entry ban, which is scheduled to fully take effect Oct. 18, and agency officials are also at the center of the president’s decision to wind down DACA — the Deferred Action for Childhood Arrivals program — which allowed undocumented immigrants who were brought to the United States as children to avoid deportation.

The DHS, along with the Justice Department, has been energetic in implementing Trump’s promised crackdown on illegal immigration — employing aggressive, controversial tactics such as arresting people suspected of being in the country illegally while they were in court seeking redress on matters including domestic violence complaints. Immigration agents have made 43 percent more arrests since Trump took office than in the same time period last year, but fewer deportations have taken place than in the comparable period last year.

Nielsen is not expected to face a difficult confirmation process in the Senate. She is widely viewed as a competent, experienced and nonpartisan security professional.

Given that polarizing and ideological figures such as former Milwaukee County sheriff David A. Clarke Jr. and Kansas Secretary of State Kris Kobach were previously rumored to be in the running for the DHS job, mostly for their hard-line views on immigration, the Nielsen choice would be more evidence of Kelly’s ability to consolidate control and move the administration in a more conventional, mainstream direction.

 

Some of the president’s senior advisers, including Stephen Miller, were said to favor an immigration hard-liner who would excite Trump’s base.

But the Nielsen pick would preserve the DHS’s reputation as an agency whose core mission is counterterrorism and national security.

Democrats and critics of the president said they were looking for a nominee with counterterrorism experience and a familiarity with DHS operations, and Nielsen would qualify on both counts.

“Nielsen’s nomination is a strong signal of competence and experience being valued by the White House over ideologues and outsiders,” said Stewart Verdery, a Republican lobbyist who worked in the department during the George W. Bush administration. “The homeland mission requires an unusual, diverse set of skills, and she has expertise in almost all of them.”

Former Pennsylvania Gov. Tom Ridge (R), the first secretary of homeland security, said in a statement that Nielsen was a “homeland security veteran” who was “extremely well versed in the all-hazard threats” challenging the nation’s security and resilience.

 

“Kirstjen can hit the ground running and there won’t be a learning curve,” Ridge said. “Most importantly, in this hyper-political environment, Kirstjen is not a self-promoter. She is a patriot and takes a mission-focused approach to her work.”

Seems like a logical, qualified choice. Pretty scary, since Trump almost never acts logically nor are the majority of his most visible picks qualified for their positions.

That being said, it probably doesn’t make much difference for immigration. The de facto DHS Secretary for Immigration is Sessions. And the “Gonzo” Enforcement policies are driven by Sessions’s White Nationalist xenophobia, parrotted by ICE’s Tom Homan, and the largely arbitrary whims of line agents. That’s not likely to change under Nielsen.
