Law360 (February 5, 2024, 6:23 PM EST) — The U.S. Department of Justice will pay $1.2 million to resolve a suit from a former staff assistant who said a California immigration judge routinely subjected her to explicit, lewd comments and once told her he would “make her straight” if they had sex.

On January 22, 2021, two days after President Joe Biden’s inauguration, then SF Chron reporter Tal Kopan ran an extensive, well-documented expose of the widespread sexual harassment problems at EOIR, the home of the U.S. Immigration Courts at the USDOJ. The story was picked up by other publications. Also, it was highlighted in that day’s edition of “Courtside,” along with a strong suggestion for immediate action addressed to incoming AG Judge Merrick Garland and AAG Vanita Gupta (a former, now very former, “civil rights maven”), both of whom had been nominated but not yet confirmed. Six months later, in apparent response to Tal’s article, Deputy AG Lisa Monaco pledged to root out sexual harassment at DOJ, formed a committee (a bureaucratic device often used for “task avoidance”), and directed it to report within six months. It now appears that Monaco’s efforts at reform have been just as lackadaisical as her implementation of Biden’s Executive order on regulations improving the treatment of gender-based claims at EOIR and elsewhere in Government, and her and her boss’s disturbingly inept approach to EOIR reform generally!

True, many of the actual incidents covered by the complaint in this case happened before Biden took office. But, the plaintiff’s termination by EOIR and her filing of administrative complaints that appear to have been “brushed off” by DOJ took place in 2021 and 2022, after Garland and Monaco assumed office and well after the endemic problems with sexual harassment at EOIR were public knowledge.

Yet, even with clear notice of the festering problems and an opportunity to address them in a way that would “change culture,” it required the institution of a Federal lawsuit by the plaintiff to obtain action and an effective remedy, almost three years after her termination.

Neumann — After years of overt anti-asylum bias and misogyny from Sessions and Barr, long suffering respondents, practitioners, and many EOIR employees expected a “due process/good government renaissance” under former Federal Judge and Supreme Court nominee Merrick Garland. However, despite a few improvements, Garland has “floated above” the chaos and lack of quality control that daily vex and plague those trapped in his dysfunctional, hopelessly backlogged “courts.”

It’s difficult to quantify the actual costs of EOIR mismanagement by Garland and his political lieutenants. After all, how do you put a money value on wrongful deportations, denial of constitutional rights, being subjected to substandard anti-immigrant decision making, bad precedents, “Aimless Docket Reshuffling” (“ADR”) on steroids, poorly trained judges, years stuck in limbo without the relief to which you are entitled, the effect of statistics manipulated to downplay the number of legal refugees stuck in EOIR’s hellish 3 million+ backlog, “courts” intentionally located in obscure inaccessible locations within the “New American Gulag” (“NAG”) run by DHS, and the overall “customer unfriendly” and often intentionally coercive mess to which those who practice before EOIR and those whose fate is in EOIR’s hands are subjected every working day? You can’t!

Nor is the waste of finite USG resources on chronic structural inefficiencies, boneheaded schemes to expedite dockets as “deterrents,” and ill-advised “defenses of the indefensible” in Federal Courts easy to value. But, in this case, we can quantify the cost to taxpayers of Garland’s and Monaco’s poor leadership — $1.2 million!

I wonder how many qualified accredited representatives a real problem solver and due process innovator like Professor Michele Pistone at VIISTA Villanova could train with that kind of money?

The poor leadership of Garland on immigration matters and the lousy performance of EOIR continue to be drags on the Biden Administration and our justice system. It didn’t have to be this way!

No Longer in the Cast: Former Associate AG Vanita Gupta, who left DOJ after three years of “failing to connect the dots” among civil rights, the rule of law, and the glaring violations of human rights and due process taking place at EOIR and the rest of the immigration bureaucracy. Literally, these abuses took place right under her nose, but apparently below her radar screen!

During Gupta’s tenure, the already horrible treatment of asylum seekers and other migrants of color within EOIR and the immigration bureaucracy actually deteriorated in many ways. Gupta is a sad, yet classic, example of what routinely happens to progressives once they are invited into the “halls of power” within the Government: They get co-opted into defending the status quo and the dangerous fiction of “revolution by evolution.” See, e.g., Perry Bacon, Jr., https://www.washingtonpost.com/opinions/2024/02/06/equity-diversity-inclusion-progressivism-limits/.

Just ask neo-Nazi Stephen Miller how “revolution” really works! He spent every day of his tenure in the Trump Administration single-mindedly working to dehumanize and demonize immigrants, particularly those of color and women, and to strip them of their already overly-limited rights. He paid no attention whatsoever to criticism, naysaying, and resistance from within or without. He took every “defeat” in Federal Court as an invitation to do something even worse and more outrageous.

While Gupta, despite her lofty position and civil right creds, was unable to materially improve the situation of migrants, Miller undid decades of progress on due process, racial justice, gender justice, and good government. Much of the damage he inflicted remains imbedded in the system, at DOJ, DHS, and elsewhere, as do many of those who willingly and enthusiastically assisted him.

The contrast between Gupta’s and Miller’s accomplishments and government “legacies” is a stunning illustration of the difference between Democrats and Republicans when it comes to immigrants’ rights, human rights, and racial justice — the fundamentals of governing. Democrat “political strategists” are belatedly “wondering and wandering” what to do about an “enthusiasm gap” with their core progressive voters who put Biden and Harris in office. The answer is staring them right in the face: Results matter!

More than two years have passed since Joe Biden took office on the promise of a more humane approach to immigration and the border. But in many ways, the president has struggled to distinguish himself from his hard-line predecessor: His administration has expanded Title 42, the anti-immigration loophole authorized by Donald Trump; failed to resolve the family separation crisis; and proposed a new spin on Trump’s “transit ban” that would make a large percentage of migrants ineligible for asylum.

What’s more, the Biden administration has also apparently failed to adequately protect thousands of migrant children from labor trafficking inside the US. On Monday, The New York Times reported that the Department of Health and Human Services did not intervene after receiving repeated warnings about underage migrants the agency had sent to sponsors who then forced them to work grueling hours in dangerous conditions. While the department is required by law to vet sponsors to help ensure that children placed in their care will not be trafficked or exploited, those vetting requirements reportedly went by the wayside in 2021 amid a scramble to home those children.

The Times noted that at least five HHS staffers have said they were pushed out of their roles after sounding the alarm about child safety concerns. Jallyn Sualog, a former HHS official tasked with overseeing the agency’s response to unaccompanied migrant children, told the paper that she went to great lengths to warn her superiors that children were being put at risk. “They just didn’t want to hear it,” said Sualog, who said she was moved to a different post in 2021 after filing a complaint with the department’s internal watchdog. (She later accused the department of retaliation before settling with the agency and resigning.)

The paper traced the crisis back to Susan Rice, the president’s domestic-policy adviser. In 2021, as Rice was attempting to move throngs of unaccompanied migrant children from HHS shelters to homes, she and her aides reportedly received a memo detailing accounts of abusive sponsors but did nothing. (White House deputy press secretary Andrew Bates told the Times that Rice “did not see the memo and was not made aware of its contents.”

Since the summer of that year, the number of migrant children being trafficked or exploited has skyrocketed. Monthly calls to the HHS reporting trafficking, neglect, or abuse have more than doubled in the two years since Biden entered office, per the Times.

By contrast, the Biden Administration “disses, and runs away from” key parts of the Dem Coalition whose humane practical expertise and leadership should be at the core of the message. It’s certainly not that Biden’s misguided “Miller Lite” approach to asylum seekers and children at the border has “peeled off” any Trumpist support or is going to be a “winner” among independent voters!

How bad are the Biden Administration’s proposals? They generated an amazing 51,000+ public comments, the vast majority in opposition, despite a ridiculously short 30-day comment period apparently intended to “squelch” dissent.

Practical, humane, sensible immigration policies are much more “politically salable” on the “grass roots level,” even in some surprising places, than the out of touch “policy wonks” at the Biden White House recognize! Biden taking this stance on criminal justice issues comes after the administration recently announced a series of restrictions on asylum seeking so stringent that some former Biden staffers are likening them to Donald Trump’s policies.

I think these decisions are largely about electoral politics. A big part of Biden’s 2024 strategy is to win Michigan, Pennsylvania and Wisconsin again. These states are disproportionately White and have a lot of swing voters who are moderate or conservative on issues such as immigration.

“Electoral politics trump values when it comes to access to asylum,” a Biden administration official recently told the Los Angeles Times.

But I am still not convinced these moves are good politics. Republicans are going to cast Democrats as too lenient on crime and immigration no matter what. I am skeptical these Republican attacks would be significantly more effective because Biden let the D.C. criminal code revisions go into effect or was more lenient to asylum seekers. It’s not as if he has delivered a major speech calling for open borders or defunding the police.

At the same time, voters know the Democratic Party is the one that is more supportive of immigration and making the criminal justice system less punitive. So I am also skeptical that Biden moving to the right on these issues in early 2023 in fairly subtle ways is going to help that much.

And while the electoral effects are fairly unclear, the policy ones are very obvious. Biden is embracing immigration limitations that a future President Trump or DeSantis would build on. The next Republican president will try to silence critics by noting that a Democratic president did similar things.

There will be some people who truly deserve asylum who won’t get it because of Biden’s new policies. It is hard to imagine a Republican president respecting D.C. home rule if a Democratic one won’t. It is extremely disappointing that a heavily White coalition (congressional Republicans, swing-district Democrats and Biden) is reversing the decisions of the government of heavily Black D.C.

Biden appears to be emulating his Democratic predecessors. It’s hard to definitively prove when a politician does something for electoral reasons. But the list of actions taken by Bill Clinton and Barack Obama as candidates and presidents that likely were done in part to appeal to White swing voters is long and troubling: Clinton’s criticism of the rapper Sister Souljah, in part to distance himself from Jesse Jackson, the leading civil rights activist of that time; his decision to leave the campaign trail to preside over an execution in his role as Arkansas governor; his enactment as president of anti-crime and anti-welfare provisions that embraced anti-Black stereotypes of that era; Obama, as a senator from Illinois, criticizing the Rev. Jeremiah Wright, who conducted Obama’s wedding; and Obama often ducking addressing racial issues, particularly in his first term.

I assume Clinton and Obama would argue that their actions were better than letting a Republican be elected. And that they sincerely believed in most or all of them. Biden might argue that his moves to the right will literally save democracy, because the Republican Party of today is so radical.

But if you have to override the elected local representatives of a place (D.C.) that has no representation in Congress to woo swing voters in Wisconsin, you are trying to preserve something less than an ideal democracy.

There must be ways for Biden to appeal to White swing voters that don’t involve backtracking from core principles such as asylum rights, D.C. home rule and a fair criminal justice system. His reelection is a big thing. It’s not the only thing.

Very “spot on” analysis by Perry of why once in office, Dems often betray supporters and abandon values — without getting much in return, but also without consequences for their repeated treachery,

So, according to Biden and the toady Dems (“DINOs?”) who surround him, “access to asylum” — which happens to be a legal right guaranteed by law — is just another “strategic option” — totally expendable, like the many grass roots progressive Dems who support it and helped elect Biden/Harris in 2020.

The progressive social justice movement thus finds itself at a perilous crossroads. It has grown and amassed a remarkable wealth of talent, energy, and a commitment to taking a diverse America into a better democratic future. It also represents values and practical solutions that should appeal to the majority of Americans.

Yet, it finds itself without a political home and lacking meaningful political influence. Thanks to Biden, progressives find themselves spending far too much of their time and energy re-fighting fundamental battles that they won years ago, undone by Trump, and now adopted and “normalized” by Biden.

And despite many impressive successes in defending democratic principles in increasingly conservative courts, progressives lack the political power and strategy to “out-punch” the radical neo-fascist right. The latter group consistently “punches above its weight” politically.

Can “Kids in Cages” — perhaps displayed outside next year’s Democratic Convention to show that this Administration is “tough as nails” when it comes to beating up on the most vulnerable and ignoring laws they are too incompetent and cowardly to implement — be far behind?

I’ve said this before: Until progressives can band together and develop a political strategy (perhaps not unlike the “Freedom Caucus” in the GOP) for making spineless Dems like Biden and Harris pay a political price for abandoning values and disrespecting grass roots supporters, they will continue to be abused, humiliated, and treated as expendable by a Dem Party that time and time again has demonstrated an inability and unwillingness to govern according to principles and fundamental values. Why keep voting, funding, and supporting folks who don’t represent your values any more than the GOP does?

That’s a serious question that progressives need to answer. It’s particularly pertinent for younger progressives whom Dems see as the “future of the party,” while taking your support for granted and without committing to represent or stand up for your deeply held values. Sounds like a bad deal to me!

Dems, as a whole, suffer from a chronic inability to distinguish their friends from their enemies. Progressives, particularly the “younger generation,” would do well to learn the difference and act accordingly!

🇺🇸ELECTION 2022 – PERRY BACON JR @ WASHPOST GETS IT ALMOST RIGHT — Except He Omits One Of Most Overlooked, Under-appreciated, & Over-achieving Groups In The Dem Base: Immigration/Human Rights/Racial Justice Advocates & Supporters!

The heroes of the 2022 midterm elections were Democratic voters and activists, not the party’s leadership. Those leaders should remember that and not try to distance themselves from the party’s base as they have at times in the past two years.

Though they changed course in the final months before the election, the Biden administration and congressional Democrats spent much of 2021 and 2022 on a flawed strategy. Democratic leaders were determined to boost the party with people who didn’t vote for Joe Biden in 2020, particularly the White voters without college degrees who have shifted sharply to the GOP over the last decade. So Democrats focused largely on economic policy, such as the American Rescue Plan, the infrastructure bill and a law making it easier to manufacture microchips in the United States. They intentionally highlighted how these provisions would help people without college degrees and people in rural areas.

They at times sidelined other issues, such as voting rights, that might not be the priorities of White voters without college degrees. In July, a top White House official, communications director Kate Bedingfield, bashed party activists who complained that the administration wasn’t responding aggressively enough to the U.S. Supreme Court’s Dobbs v. Jackson Women’s Health Organization ruling eliminating the right to an abortion. And Democrats moved to the right on some issues, most notably policing. There were constant efforts to court moderate GOP voters and lawmakers and sideline prominent left-wing figures.

The Democrats didn’t do well in this year’s elections by flipping lots of voters in places that voted Republican in 2020, such as Florida and Ohio. What they did was maintain strength in the congressional districts and states that they won two years ago and four years ago. The party’s base prevented the bottom from falling out.

Party officials are rushing to give credit — to one another. And some of the party’s leaders do deserve praise. Candidates such as Gov. Gretchen Whitmer of Michigan, who easily won reelection, and Pennsylvania Gov.-elect Josh Shapiro early in their campaigns highlighted abortion and democracy, in addition to the economy. Biden rightly ignored some in the party who argued he should not talk about democracy issues in the final days of the campaign.

But in elections, the voters are the actors, the deciders. And this year, millions of Democratic-leaning voters turned out and stuck with the party, looking past sky-high inflation and a leadership team that spent much of its time courting people who would never vote for Democrats while ignoring key priorities of people who always vote for the Democrats.

These voters should be commended and celebrated.

Perry my friend, let’s go back just a bit in time and think about the “original targets” of Trump’s MAGA GOP “platform” of hate, lies, false narratives, and virulent anti- democracy insurrection masquerading as “patriotism!”

Who’s been out there fighting for truth, justice, and equality before the law since “Day 1” of the MAGA hate movement? Who led the resistance at airports when the first manifestations of the Trump regime’s neo-Nazism in action began just shortly after his inauguration? Who took the legal fight to preserve American democracy all the way to the Supremes before a right-leaning majority still wedded to Dred Scott and the Chinese Exclusion cases tilted in favor of tyranny? A tilt, I might add that has progressively gotten worse over time and has spawned millions of human rights abuses, enabled torture, and actually helped kill some of the vulnerable humans we were sworn to protect?

Historically, migrants of all types, voluntary or involuntary, have constituted the “other” in America — targeted, disadvantaged at law, and exploited by their fellow Americans even while being the essential ingredient that has built our nation.

It’s rather odd, considering that 98% of us were “the other” at some point in history. I suppose a reckoning with that “inconvenient truth” is one of a number of reasons why the MAGA GOP works so hard to “whitewash” American history.

So, it’s worth thinking about why a talented group, their expertise, and their “learned wisdom” — and the better America for all that they represent and fight for — becomes so expendable and ignored by Dems between election cycles. Also worth reflecting on where American democracy, tenuous as it might be today, would be without them.

If the Biden Administration had honored and “leveraged” the immigration experts who helped elect it in 2016 and preserve it in 2022, we might well have order at the border, many more legal workers, lower inflation, decreasing backlogs, focused immigration enforcement that preserves national security, courts that model equal justice and due process and help develop the Article III Judiciary of the future, creative ideas for helping the economy of rural America, smarter use of taxpayer dollars, the list goes on. Success in these areas might even have enabled Dems to hold onto the House or given them a bigger margin in the Senate.
