Thanks, Craig, for highlighting the work of my friend and former Georgetown Law colleague Heidi Altman, Director of Policy at NIJC. Heidi is the embodiment of what real leadership, innovation, humane, creative thought on immigration and the border looks like. She stands in dramatic contrast to the pathetic fear mongering (Trump) and fear of standing up for values (Biden) “leadership” coming from our candidates and reflected in the failure of politicos of both parties to embrace humane, cooperative, beneficial solutions for those seeking asylum at the border.

Heidi is a particularly great representative and leadership role model for Women’s History Month.

I had additional thoughts on this podcast:

Better judges, not just more judges. To be effective and efficient, EOIR judges at both levels must be recognized experts in asylum, human rights, and due process who are not afraid to set positive precedents, grant protection to those who qualify under a properly generous interpretation of the law, simplify evidentiary requirements and state them in clear, practical terms, establish and enforce best practices, and steadfastly oppose the political abuse of the Immigration Courts as “deterrents” or as extensions of DHS enforcement. The failure of Garland to clean house at EOIR, particularly the BIA, and of Mayorkas to do likewise at the Asylum Office has been a national disaster driving much of the “disorder at the border.”
Incorporate “Judges Without Borders” into the solutions. See https://immigrationcourtside.com/wp-admin/about.php. It’s a great concept waiting to happen!
Invest in VIISTA Villanova and other innovative programs to expand pro bono and low bono representation. See https://www1.villanova.edu/university/professional-studies/academics/professional-education/viista.html. Reach beyond lawyers and NGOs to train students, retirees, social justice advocates, and “ordinary citizens” who want to help by becoming “Accredited Representatives” for “Recognized Organizations” and represent asylum seekers before the AO and EOIR. The programs is top-notch, online, and “scalable.” The Biden Administration’s failure to tap into it and “leverage” it is another dramatic failure of leadership.
Better leadership needed in the Biden Administration. As we have seen over the last three years, all the great ideas (and there is a plethora of them) in the world are meaningless without the dynamic, courageous, effective leadership to make it happen! Garland, Mayorkas, the White House Domestic Policy Office, and the Biden Campaign are dramatic negative examples of folks who lack the hands-on expertise, courage, creativity, and skills to lead on effective administrative immigration reform. I endorse Heidi’s proposal to create a White House Task Force. But, without expert, dynamic, empowered leadership, that Task Force will be ineffective. (Take it from me, over 35-years in the USG, I was on lots of “task forces” and other “action/study groups” whose voluminous reports and well-meaning proposals went directly into a dusty file cabinet or paper shredder.) Think Julian Castro, Dean Kevin Johnson, Judge Dana Marks, Professor Karen Musalo, Beatriz Lopez, Professor Michele Pistone, Anna Gallagher, Camille Mackler, Professor Stephen Yale-Loehr, Heidi Altman, Alex Aleinikoff, Mary Meg McCarthy, Paula Fitzgerald, et al — any of these folks, or a combination, or other “battle tested experts” like them would be head and shoulders over the inept gang advising on and “implementing” (and I use this term loosely) immigration policy for the Administration and the campaign. Leadership counts! And, time’s a wasting to start fixing this asylum system before the election!
Acquiescence gets Dems the same place as activist racism. I “get” that the nativist border agenda now being shoved down our throats by both campaigns is driven by GOP fear-mongering and Dem acquiescence. That’s classic Jim Crow! I doubt that every White person south of the Mason-Dixon Line during my youth was overtly racist. Yet, a whole bunch of them were happy to acquiesce in segregation (and worse) because it served their political, social, or business purposes. For example, ”I’ve personally got nothing against Blacks, but if I hired one at my store all my business would go elsewhere.” In calling for “bipartisan” joining with the Trump-generated racist proposal to “close the border,” Biden and many of his supporters are basically endorsing a lawless, cruel, anti-humanitarian program that couldn’t succeed if enacted. Does that he might be doing it as an act of “political strategy,” “shifting the blame,” or “one-upmanship,” rather than “genuine” racism, xenophobia, and hate, like Trump and MAGA nation, somehow make it more palatable? Not to me!
Stop the candidate’s negative campaigning. If Joe can’t think of anything better to say about human rights and the border than to point fingers at the GOP and try and match Trump’s cruelty, lawlessness, and stupidity on the issue, better he say nothing at all.
Don’t get suckered by “whataboutism.” Undoubtedly, there are those in our community genuinely concerned that helping asylum seekers resettle and succeed will deflect resources and attention from existing problems like homelessness and poverty. Nevertheless, few, if any, of my friends and acquaintances who have actually spent their lives, or substantial portions thereof, helping the less fortunate in our communities express this fear. They believe that that if we treat all of our fellow humans as humans, we can expand opportunities and economic activities across the board so that there will be enough for everyone. It’s a derivation of something we say every Sunday at the community church we attend: “All are welcome at Christ’s table.” Also, asylum seekers and other migrants disproportionately give back to communities, particularly low income communities, rural communities, or others in need. By contrast, many of those raising these fears are the same GOP folks who steadfastly want to cut meals for kids, slash after-school programs, defund proven-to-work programs that reduce poverty, and restrict or limit other existing aid programs. It’s not like these folks would “repurpose” any of the very limited funds spent on assisting migrants to helping the homeless or the less fortunate. No, they would almost certainly spend it on more deadly, yet ineffective walls, “civil” prisons, unnecessary tax cuts for the wealthy, and/or more counterproductive, wasteful, costly border militarization. Don’t get suckered by their “crocodile tears” for the poor and needy!

Contrary to the BS 💩 that is peddled every day by the presidential candidates, spineless politicos of both parties, and the mainstream media, the border is solvable with common sense, humane, innovative legal reforms. More cruel, wasteful, and essentially mindless enforcement and restriction is NOT the answer, nor will it ever be!

Although many reports in the media critique Chicago and other major cities response to southern governors who bus asylum-seekers and newcomers from the southern border to Chicago, we have not heard as much about the outpouring of support and hospitality offered by Chicagoans through faith communities, community-based organizations, and volunteers. The held its 2023 Virtual Meeting on November 9, 2023, to highlight some of that hospitality and welcome. You can view the entire meeting at the link below. Human migration is inevitable and has huge benefits to societies that learn how to deal with it in a robust, legal, humane, realistic manner, rather than exhibiting “fear and loathing.” See, e.g., https://www.forbes.com/sites/andyjsemotiuk/2023/11/15/new-report-details-huge-contribution-immigrants-are-making-to-america/.

Yet, the so-called “mainstream media” exhibits little interest in the realities and benefits of migration. Instead they prefer to uncritically repeat White Nationalist “talking points” about “invasions,” “burdens,” “costs,” and “unprecedented crises.”

They also regularly blur the distinction between “unauthorized entrants” and the many asylum seekers who are screened and allowed into the U.S. to exercise their legal rights to apply for protection under U.S. and international laws (in, I might add, a legal system intentionally stacked against them). Such individuals are here with official permission; they are “NOT” “illegal entrants” as White Nationalists like to incorrectly characterize them. Indeed, the “scofflaws” here are actually those who seek to deny both the humanity and the legal rights of asylum seekers!

The Administration aggravates this situation by failing to speak out forcibly in favor of immigrants’ rights and the realities and benefits of immigration. They also have not developed a coordinated reception and resettlement approach to combat the shenanigans of GOP nativist governors and politicos. The Dems thus have mistakenly turned the initiative on human rights and immigration over to haters, nativists, and fabricators — folks with no interest whatsoever in instituting humanity, efficiency, and the rule of law at the border!

Thus, the truth about immigration and its benefits as well as humane, realistic ways of improving our immigration system (including the process for accepting refugees and asylees) remains largely hidden “beneath the radar screen.”

In a recent post, Attorney Jorge Gonzalez stated his actual experience helping asylum seekers at the southern border:

I interviewed many migrants awaiting their credible fear interview. All of them suffered persecution during their time in Mexico, whether they were robbed by police, cartel members, or ordinary citizens. Many were kidnapped and held for ransom. Some had group members that did not finish the journey.

This speaks loudly about those, from both parties, who seek to impose “gimmicks” and “further restrictions” at our already over-militarized border that would “deter” legal asylum seekers by forcing them to remain in Mexico or denying them fair hearings on their applications. The question of “right or wrong” here is not fairly debatable! Intentionally mistreating asylum seekers is wrong from both a legal and a moral standpoint! Yet, one sure wouldn’t know that from listening to the “mainstream media!”

The GOP prefers demagoguery to truth. Meanwhile, the Dems are scared to embrace the truth about immigration.

🇺🇸🗽⚖️ INSPIRING AMERICA: From Tortured Dissident, To Refugee, To DePaul Law Grad! — The Saga Of Emad Mahou!

How he made it_ Syrian torture survivor becomes DePaul Law grad

Zareen Syed writes in the Chicago Tribune:

He says he can’t really describe torture or the night terrors that still creep up on him years later, but he’ll try. He starts out with a picture: a prison cell the size of a rug and a creaky door that he couldn’t help but stare at. Every time it opened, he knew he’d either be released or tortured once again.

When Emad Mahou tells the story of being imprisoned in Syria during the 2011 revolution, his voice has a heaviness, unlike the joy he exhibits when talking about not knowing how to order a Subway sandwich when he arrived in Chicago as a refugee.

With his hands he demonstrates the ups and downs of the last 12 years — from being released and offered refuge in America to graduating from the DePaul University School of Law. As his wife, 8-year-old daughter and his father stood in the stands, he walked across the stage with hopes of practicing human rights law to help other refugees coming into the country.

Mahou’s father, Shirkou Mahou, flew in from Lebanon to attend the May 20 ceremony on a visit visa.

“I’m seeing a part of my dad I didn’t see before,” Mahou said. “He’s an old man. When I left he was much stronger, much younger.”

On a May afternoon, days before the graduation ceremony, Mahou’s dad was sitting next to him on a couch in one of DePaul’s Loop campus law buildings, wearing a brown suit, white shirt and a prayer hat on his head.

It’s his first time in America. His first time seeing his son’s new life up close — so different from the life he left at age 21.

He cried audibly every now and then, especially when Mahou would translate for him into Arabic parts of what he was sharing about the Syria of his childhood versus the Syria he left behind.

Mahou’s memories of some of his arrests are blurry, except for one in which he was detained and tortured for three months. In June 2011, he said he spent 100 days in an underground cell the size of a rug. He didn’t know it when he was thrown in, but this would also be the last time he’d be imprisoned.

“The torture was really over the limit at that point. I was really struggling with the pain,” Mahou said. “It was daily, continuous, degrading. One day in particular, they took turns urinating on me. It got to a point where mentally I was broken. You smell yourself and I felt really, really bad. I am used to a nice life. I showered daily. I was in college to be an architect.”

Mahou stops and reminds himself that he had a full life in Zabadani, Syria, before the revolution. They all did.

“At that point, I was almost done with college and I had a whole future ahead of me. And I just looked at where I am now. That day was my weakest day mentally. I was shattered. The humiliation went too far — like they’re using you as a toilet … so I banged my head on the wall.”

He started attending community college at Harry Truman toward a degree in computer science in the fall of 2013, before transferring to DeVry. In 2017, he got a job as a web developer for the board of trustees at DePaul University. There he met law professor Craig Mousin, who sat in an office across from Mahou.

Mousin said when Mahou realized that he taught at the law school and that his specific area of teaching was asylum and refugee law, it piqued his interest.

“Emad has intimate knowledge of how governments can use all the power and authority they have to stifle dissent,” Mousin said. “And sometimes in doing asylum and human rights cases, there’s this built-in assumption that governments would not hurt their own citizens. And sometimes it’s very difficult for people in the United States who live with relative freedom to understand that. Emad’s felt the brunt of that failure.”

With Mousin’s guidance, Mahou tapped into his experience of standing up for freedom in Syria and what he calls “a rebel mentality” to figure out that what he actually wants to do isn’t web development, but rather become a lawyer. On May 20, he earned his juris doctorate.

“I really want to learn about other people’s experiences in the system,” said Mahou, who now lives in Oak Park. “People who are fleeing persecution, traveling through dangerous paths to seek refuge, those are the people I want to help.”

Mahou said he’s now studying for the bar exam but was fortunate to get a taste of the kind of cases he would like to work on when he enrolled in DePaul’s Asylum and Immigration Law Clinic, where he helped put together an asylum petition for a family.

As Mahou recounts his tale, he shares that he’s seen his parents for a total of 20 days since 2011, during short visits to Lebanon. And now he was making up for lost time.

🇺🇸 NATIVISTS’ SPITE STUNT CREATES OPPORTUNITY FOR AMERICAN HUMANITARIANS TO SHINE!🗽😎 As Biden Administration Bumbles & Fumbles On Resettlement, NGOs Step Up To Save The Day!

When Abbot announced that he was sending the buses, many people across the country saw it for what it was: a political stunt. In a statement at the time, Abbot criticized the Biden administration as turning “a blind eye to the border crisis” and said, “Texas should not have to bear the burden of the Biden administration’s failure to secure our border.”

We can debate Abbot’s actions, and some of us undoubtedly will see a show of strength where others of us see a show of cruelty, but what is not debatable is what happened after those buses started arriving. People stepped up. From a political stunt grew a network of dedicated community members in D.C., New York and elsewhere who now coordinate across state lines to help migrants.

“What started it was no one else was going to do it,” said Madhvi Bahl, an organizer with the Migrant Solidarity Mutual Aid Network, a group of community members and organizations in the D.C. region dedicated to welcoming migrants. She said that because the city didn’t get involved until months after the buses started arriving, volunteers were on their own to greet arrivals, collect supplies and raise money to provide temporary housing.

Once again, the Biden Administration failed to take leadership and to plan for the obvious. Some have suggested that leaving asylum seekers to be political pawns for GOP nativist governors was part of the Administration’s cruel and inept “border deterrence program” which they have substituted for competently administering asylum laws.

Not for the first time, NGOs and advocates have been left to pick up the pieces from the Administration’s failed immigration policies. Fortunately, these NGOs are more talented, creative, and motivated than Administration politicos and bureaucrats.

Along the same lines as Theresa’s article, my friend and NDPA stalwart Rev. Craig Mousin reports similar successful responses in Chicago:

I forgot to add one more item of good news that your talk suggested. You mention the nativist driven bus rides from Arizona, Florida, and Texas. We have had something remarkable happen in Chicago. A group of five or six faith-based individuals and NGOS had been meeting prior to the bus trips to try and find housing for asylum-seekers. That group, the Chicago Sanctuary Working Group (SWG) meets weekly. It remains an informal group, but it now includes over 30 organizations and individuals. It has found private housing for over 100 families or individuals along with case management for the social service needs while attempting to link them to attorneys from NIJC, CLINIC, other Chicago based groups as well in some cases helping to find funding to pay low bono AILA attorneys. Housing has included individual families welcoming asylum-seekers into their homes for varied amounts of time, some temporary financial support, and some churches opening their doors. In addition, it has received a grant and now rents a building housing about 15 families along with in premise social workers. The national United Church of Christ gave it a small grant and they are hosting a Chicago-area breakfast on May 3 to encourage more congregations to open their doors or recruit individual families to offer asylum-seekers a room in their homes. Almost completely volunteer-driven, it has been an amazing response to this difficult problem. Full disclosure, my wife is on the steering committee, but the stories have been inspirational as a citizen-driven response to bad federal and state policies.

Think what could be accomplished with better Federal leadership and coordination! Why can’t the Biden Administration get its act together on social justice?

As Craig says, the Biden Administration, along with GOP nativist politicos, and pandering righty Federal Judges, ignore the fundamental right guaranteed by the Refugee Act of 1980: Every person at the border or in the U.S., regardless of status, has a right to apply for asylum! Obviously, that includes a right to a fundamentally fair adjudication by a well-qualified, impartial adjudicator.

It’s not “rocket science!” Yet, Biden, Harris, Mayorkas, Garland, & Co. can’t wrap their heads around this fundamental truth! Disgracefully, after two years of screwing around and wasting time, resources, and squandering goodwill on futile and often illegal “deterrence,” they aren’t much closer to re-establishing a fair, functional asylum system at the borders than they were on Jan 20, 2021! Where’s the basic competence and “good government” that Biden/Harris promised when running for office?

The smug nativist-pandering politicos in the Biden Administration think that asylum applicants, the laws that protect them, and the advocates, like YOU, who defend them are “political chopped liver” — unimportant and completely expendable! It’s up to YOU to prove them wrong! Nobody else is going to do it!

Mousin, an Adjunct Faculty member of DePaul University’s College of Law, Refugee and Forced Migration Studies Program, and the Grace School of Applied Diplomacy interviews Heidi Altman, the Policy Director of the National Immigrant Justice Center (www.immigrantjustice.org). Ms. Altman discusses a proposed rule that will effectively preclude most asylum-seekers from safely and effectively applying for asylum in the United States. She advocates for humanitarian asylum welcome. She previously served as the legal director for the Capital Area Immigrants’ Rights Coalition and was a Teaching Fellow in the immigration clinic at Georgetown University Law School.

Here are “my takeaways:”

Asylum seekers have a legal right, established by the Refugee Act of 1980 and international conventions, to seek asylum at our border or in the U.S., regardless of status and/or nationality;
The Trump and Biden Administrations have abrogated this right without legislation;
The Trump Administration’s anti-asylum actions and intentional dehumanization of asylum seekers was rooted in White Nationalist nativism;
Despite recognition during the 2020 campaign of the invidious motivation for Trump’s anti-asylum policies, the Biden Administration has retained, or even enhanced, the dehumanization and denial of rights to asylum seekers at the border;
Over the past two Administrations, acceptance of the basic rights and obligations of the U.S. toward asylum seekers, incorporated in the Refugee Act of 1980, has been eliminated or reduced to a superficial “shell” (“asylum in name only,” as some advocates have termed Biden’s latest proposed anti-asylum border policies);
By abandoning the framework set forth in the Refugee Act of 1980, the Trump and Biden Administrations have re-injected the ad hoc approach, disorder, nationality bias, and ideological preferences at the border that the Refugee Act of 1980 was specifically enacted to eliminate;
There is much under-appreciated support for welcoming, fairly treating, and helping refugees and asylum seekers among Americans in communities throughout our nation;
NGOs and experts have dozens of great ideas for restoring and improving the legal right to seek asylum in fair, humane, non-discriminatory ways which they have shared or are happy to share with the Biden Administration;
The Biden Administration to date has shown little if any interest in adopting and implementing better humanitarian solutions for asylum seekers at the border;
Both parties lack leaders with the integrity and courage to stand up for the legal and human rights of asylum seekers;
We must continue to discuss ways to break the cycle of dehumanization, cruelty, and scofflaw treatment of asylum seekers and replace it with enhanced humanitarian procedures and a welcoming culture, in accordance with the Refugee Act of 1980, the U.N. Convention and Protocol, and the very best traditions of our nation of immigrants.

Thanks for speaking out, Craig! Mayorkas’s interview was a shocking mix of intellectual dishonesty, insincerity, and misdirection worthy of a Trump Administration official. And, as Craig points out several times, the interviewer didn’t ask the right questions either.

Let’s understand what the Biden Administration’s arbitrary, ad hoc “parole program” that has been substituted for the Refugee Act of 1980 (“the law”), as amended, really does: 1) favors those who don’t necessarily meet the “refugee” definition (even if properly interpreted), but who have individual sponsors, over refugees; or 2) forces those who do meet the refugee definition into an inferior “parole status” that denies them the statutory path to a green card and eventual citizenship and other benefits that legal “refugee” or “asylum” status entails, or 3) a combination of 1) and 2).

Sound like a good idea? Of course not! It’s a prescription for a legal, humanitarian, and moral disaster!

Getting the USG to follow the law shouldn’t be this difficult. But, it is, because of the refusal of the Biden Administration to heed the advice of experts who not only know the law, but understand the border and the corrosive effect and real human consequences of unlawfully abandoning the statutory framework established by the Refugee Act of 1980.

Thanks Craig for speaking truth when so many are spreading false information and advocating trading human rights that aren’t ours to give away for “benefits” that should be conferred on their own merits with no “strings attached.”

Unhappily, even the normally reliable and sensible Greg Sargent @ WashPost is spouting some of this absolute nonsense! He speaks of indefinitely extending massive violations of legal and human rights (“Title 42”), prisons for asylum seekers (“processing centers”), and expedited dockets (“deportation railroads without due process”) as if they are “OK trade-offs” for so-called “immigration reform.”

Notably, there is nothing now stopping the Administration from processing more refugees outside the U.S., providing grants to innovative organizations like “VIISTA Villanova” for training more qualified pro bono asylum representatives without having to rely exclusively on law schools, replacing poorly qualified Asylum Officers and Immigration Judges with asylum and human rights experts, appointing a new expert BIA qualified to establish affirmative precedents to guide Asylum Officers, IJs, and lawyers on both sides in how to recognize, document, and grant asylum in accordance with the generous intent of the law and the U.N. Convention on which it is based, providing grants to NGOs for systemic resettlement of asylees and applicants away from the border, targeting and prosecuting human smugglers, and expeditiously removing those arriving at or near the border who can’t establish a “credible fear” of persecution.

That the Administration has failed to bring in the necessary visionary, dynamic, competent leadership to accomplish any of the foregoing, and that a Dem-controlled Congress has failed in its oversight responsibilities and to push the Administration to fulfill its legal obligations to asylum seekers is a question of competence and will, NOT the fault of asylum seekers and their advocates. Nor is it a basis to reduce the already unfairly and illegally compromised rights of asylum seekers

Craig basically echoes some of the themes I set forth this week in my “Dissenting Opinion!”

Many of those tone-deaf (or worse) politicos pushing the far right agenda of hate, lies, and racism reflected in the defeated amendments are elitists masquerading as “bogus populists” who got the benefit of education at some of the top law schools and universities in the nation. Whatever happened to the teaching of basic legal ethics and responsibilities to society? The Jim Crow agendas of today differ little from those of the pre-civil rights era of the 20th Century. These are NOT debates between legitimate “differing viewpoints,” but essentially questions of truth vs. lies, hate v. tolerance, integration v. exploitation;
The White Nationalist Right is taking over school boards and local governance in the false name of “parents’ rights” — actually meaning the rights of far right parents to impose their minority religious doctrines and false social doctrines on others. The fight for social justice begins at the local level where where teaching of truth and legitimate debates are being drowned out by disgruntled, anti-democracy, empowered White Nationalist theocrats who claim they want liberty but actually are trying to impose autocracy and minority rule;
The fight for social justice never ends!

Craig Mousin has been the University Ombudsperson at DePaul since 2001. He received a BS from Johns Hopkins University, a JD from the University of Illinois, Urbana-Champaign, and an M Div from Chicago Theological Seminary. He joined the College of Law faculty in 1990, and served as the Executive Director of the Center for Church/State Studies until 2001, Acting Director until 2003, and co-director from 2004–2007. Mousin co-founded and continues to participate in the Center’s Interfaith Family Mediation Program. He has taught in DePaul’s School of Continuing and Professional Studies, the Religious Studies Department, the Grace School of Applied Diplomacy, and the Peace, Justice and Conflict Studies program. He has also taught as an adjunct faculty member at the University of Illinois College of Law and Chicago Theological Seminary .

Prior to DePaul, he began practicing labor law at Seyfarth, Shaw, Fairweather & Geraldson in 1978. In 1984, Mousin founded and directed the Midwest Immigrant Rights Center, a provider of legal assistance to refugees which has since become the National Immigrant Justice Center. He also directed legal services for Travelers & Immigrants Aid between 1986 and 1990. The United Church of Christ ordained him in 1989. At that time, Wellington Avenue U.C.C. called him as an Associate Pastor. He was a founding co-pastor of the DePaul Ecumenica l Gathering (1996-2001). Mousin serves as a Life Trustee of the Chicago Theological Seminary. In addition, he is a member of the Leadership Council of the National Immigrant Justice Center, a member of the Leadership Council of the Marjorie Kovler Center for Survivors of Torture, a former President and member of the Board of the Eco-Justice Collaborative, and a former President and Board member of the Immigration Project of downstate Illinois. Mousin is a current member of the ABA Dispute Resolution Section Ombuds Committee.

Today’s WashPost Outlook Section contained a highly relevant article by author Dave Eggers about how far-right zealots — many with no real stake in our public schools — have taken over at local levels and apply extreme censorship — even to books and concepts that have been successfully and routinely taught for years. https://www.washingtonpost.com/outlook/2022/06/24/dave-eggers-book-bans-south-dakota/

In this case, it’s driving experienced teachers who believe in truth, freedom, and individual rights to flee in droves. So, what we’re really seeing is a shocking “dumbing down” of American education, libraries, and public discourse driven by far right fear-mongers seeking to impose their lack of values and intolerance on others.

We have seen this week how far-right activist extremists, from the Supremes to local politicians and school boards, have elevated guns that kill while gutting the individual rights to free speech, equal protection, and fundamental fairness guaranteed by the 1st, 5th, and 14th Amendments.

Justice Clarence Thomas is certainly a horrible jurist. But, in this instance he might be the only honest GOP appointee on the Supremes.

When Thomas says that immigrants’ human rights, gay rights, right to conception, marriage rights and most other meaningful individual rights guaranteed by the Constitution are on the chopping block, progressives had better believe him. Remember how “leaving things to the states” worked out for African Americans and other minorities attempting to exercise their fundamental rights, even after the Civil War and the 13th, 14th, and 15th Amendments. And, remember all those paeons to precedent and “not to worry” about Roe statements under oath from GOP Supremes’ candidates before they actually took their seats on the Court and started scheming to undo abortion rights for political, not legal, reasons!

“Social Justice Warriors” like Craig have been fighting the good fight for decades. But, at this point, it’s going to depend on the NDPA and other young progressive groups to take on the extremist right at the ballot box and to take back their individual rights — really all of our individual rights.

Otherwise, they will find themselves as a disempowered counterculture, hiding out and trying to keep ahead of Ray Bradbury’s firemen in Fahrenheit 451!
