Donald Trump never did much to hide his dangerous belief that the US justice department and the attorneys general who helmed it should serve as his own personal lawyers and follow his political orders, regardless of norms and the law.

Former senior DoJ officials say the former president aggressively prodded his attorneys general to go after his enemies, protect his friends and his interests, and these moves succeeded with alarming results until Trump’s last few months in office.

But now with Joe Biden sitting in the Oval Office, Merrick Garland as attorney general and Democrats controlling Congress, more and more revelations are emerging about just how far Trump’s justice department went rogue. New inquiries have been set up to investigate the scale of wrongdoing.

Trump’s disdain for legal principles and the constitution revealed itself repeatedly – especially during Bill Barr’s tenure as attorney general, during most of 2019 and 2020. During Barr’s term in office, Trump ignored the tradition of justice as a separate branch of government, and flouted the principle of the rule of law, say former top justice lawyers and congressional Democrats.

In Barr, Trump appeared to find someone almost entirely aligned with the idea of doing his bidding. Barr sought to undermine the conclusions of Robert Mueller’s inquiry into Russian interference in the 2016 elections, independent congressional oversight, and Trump critics in and out of government, while taking decisions that benefited close Trump allies.

But more political abuses have emerged, with revelations that – starting under attorney general Jeff Sessions in 2018 – subpoenas were issued in a classified leak inquiry to obtain communications records of top Democrats on the House intelligence committee. Targets were Adam Schiff and Eric Swalwell, who were investigating Kremlin election meddling, and also several committee staffers and journalists.

Democrats in Congress, as well as Garland, have forcefully denounced these Trumpian tactics. Garland has asked the department’s inspector general to launch his own inquiry, and examine the subpoenas involving members of Congress and the media. Congressional committees are eyeing their own investigations into the department’s extraordinary behavior.

“There was one thing after another where DoJ acted inappropriately and violated the fundamental principle that law enforcement must be even-handed. The DoJ must always make clear that no person is above the law,” said Donald Ayer, deputy attorney general in the George HW Bush administration.

Ayer thinks there could be more revelations to come. “The latest disclosure of subpoenas issued almost three years ago shows we don’t yet know the full extent of the misconduct that was engaged in.”

The record of anti-immigrant, White Nationalist bias at EOIR and the DOJ’s “Dred Scott” approach to justice for asylum applicants and other migrants is crystal clear! Thanks to the NDPA, courageous journalists, some “inside sources,” and the remarkable number of rebuffs from Federal Courts, the record on misfeasance and bias at EOIR, OIL, and the SG’s Office is clear.

Every day, Garland’s lackadaisical approach to restoring “justice @ Justice” and his apparent indifference to individual human rights and fair judging continue to harm vulnerable asylum seekers and other individuals and disintegrate our legal system. It’s “not OK!”

Progressives and members of the NDPA must recognize, if they haven’t already, that they can’t count on Garland! They will have to continue to use litigation, legislation, oversight, FOIA, public opinion, and political pressure to get the immediate common sense progressive reforms and overdue personnel changes that Garland, Monaco, Gupta, and Clarke are avoiding. Garland might view “justice” as too abstract a concept to require his immediate attention. Many of us don’t agree!

You heard me right. The National Republican Congressional Committee (NRCC) issued a statement on Wednesday claiming that Chipotle’s recent decision to raise prices on their burritos and other menu products by about 4% was caused by Democrats.

“Democrats’ socialist stimulus bill caused a labor shortage and now burrito lovers everywhere are footing the bill,” said an NRCC spokesman, Mike Berg.

It seems Republicans have finally found an issue to run on in the 2022 midterm elections. Apparently Dr Seuss and Mr Potato Head weren’t gaining enough traction.

The GOP’s tortured logic is that the unemployment benefits in the American Rescue Plan have caused workers to stay home rather than seek employment, resulting in labor shortages that have forced employers like Chipotle to increase wages, which has required them to raise their prices.

Hence, Chipotle’s more expensive burrito.

This isn’t just loony economics. It’s dangerously loony economics because it might be believed, leading to all sorts of stupid public policies.

Start with the notion that $300 per week in federal unemployment benefits is keeping Americans from working.

Since fewer than 30% of jobless workers qualify for state unemployment benefits, the claim is that legions of workers have chosen to become couch potatoes and collect $15,000 a year rather than get a job.

Republicans have found an issue to run on. Apparently Dr Seuss and Mr Potato Head weren’t gaining enough traction

I challenge one Republican lawmaker to live on $15,000 a year.

In fact, evidence suggests that workers who are holding back from re-entering the job market don’t have childcare or are still concerned about their health during the pandemic.

Besides, if employers want additional workers, they can do what they necessarily do for anything they want more of but can’t obtain at its current price – pay more.

It’s called capitalism. Republicans should bone up on it.

When Chipotle wanted to attract more workers, it raised its average wage to $15 an hour. That comes to around $30,000 a year per worker – still too little to live on but double the federal unemployment benefit.

Oh, and there’s no reason to suppose this wage hike forced Chipotle to raise the prices of its burrito. The company had other options.

Chipotle’s executives are among the best paid in America. Its chief executive, Brian Niccol, raked in $38m last year – which happens to be 2,898 times more than the typical Chipotle employee. All Chipotle’s top executives got whopping pay increases.

So it would have been possible for Chipotle to avoid raising its burrito prices by – dare I say? – paying its executives less. But Chipotle decided otherwise.

I’m not going to second-guess Chipotle’s business decision – nor should the NRCC.

Day after day they flock to the emerald green house on Estévez Street, seeking news of loved ones who have vanished without a trace.

“They say there are lots in there, maybe 40,” said Jessenia Elizabeth Francia, a 38-year-old housewife who had travelled 20 miles to reach the heavily guarded building under a punishing midday sun.

Francia had come to Chalchuapa, a small town in western El Salvador, in search of her son, Luis Fernando, who disappeared seven years ago at the age of 16. “I just want to find at least his bones so I can bury them and find peace,” she said, clutching a cellphone showing a photograph of her missing child and the words: “I have faith.”

Others sought daughters or wives, Central American women feared to have fallen prey to the house’s proprietor, the former police officer and alleged serial killer Hugo Ernesto Osorio Chávez, who is feared to have buried his victims inside.

“She was 24,” said Candelaria Carranza Castro, a silver-haired mother whose daughter went missing in July 2015 and who was among those to visit the house on Monday. “Whatever has happened I want to find her.”

The mass grave at No 11 Estévez Street was discovered on the night of 7 May after neighbours called police having heard the cries of a young woman. By the time police arrived more than an hour later she and her mother were dead – reportedly bludgeoned to death with an iron tube by Osorio, who confessed to the crimes. While taking the 51-year-old into custody, police stumbled across the half-buried bodies of two men in the house’s patio and, when they started digging, found more corpses below in a series of pits.

Authorities have yet to announce the precise number of bodies buried inside but the excavators still probing its foundations believe there could be as many as 40, and no fewer than 15.

Despite his claims that the border situation is a direct result of the Biden administration’s immigration policies, residents in the Rio Grande Valley have said no such crisis exists. In fact, the number of border crossings under the Biden administration largely mirror those under the former Trump administration. Cruz was accompanied by 18 other Republican senators including John Cornyn, Susan Collins and Lindsey Graham.

After claiming he ran into heckling cartel members and saw a dead body floating in the Rio Grande, Cruz was derided by many, including the former congressman Beto O’Rourke who said:  “You’re in a border patrol boat armed with machine guns. The only threat you face is unarmed children and families who are seeking asylum (as well as the occasional heckler).”

Read more at the link about the GOP’s complete farce — while much more courageous individuals, asylum seekers, are forced to risk their lives because the U.S. is incapable of administering our own asylum laws in a fair, responsible, and competent manner. Cruz & co apparently view this as a “photo op.” Actually, it’s a human tragedy for which history will hold Cruz and his racist party largely responsible, even if the voters fail to do so.

The best solution is to hire experts from the private/NGO/academic sectors; build a functioning asylum and refugee system that will process applicants fairly, generously, predictably, and efficiently; reopen legal ports of entry; establish a robust “on site” refugee program for the Northern Triangle; and work with the international community to alleviate the causes of forced migration. Figure out how new arrivals who qualify for legal status can help rebuild our economy moving forward. Develop a humane program for returning those who don’t qualify without endangering their lives, health, and safety.

An absolutely essential part of the solution is a new, “reimagined” EOIR, staffed with real judges who are experts in asylum, human rights, and due process. An EOIR that will “through teamwork and innovation, be the world’s best courts, guaranteeing fairness and due process for all.” Judge Garland, where are you in American justice’s hour of dire need?

The number of people seeking to enter the US has risen in recent months. Joe Biden has kept in place a restrictive Trump-era public health order that barred entry to migrants arriving at the border without prior authorization, essentially ensuring that no new asylum claims have been processed at points of entry for more than a year. But the pandemic, cartels and extreme climate events have created conditions so desperate that many migrants are willing to take grave risks.

“Our border policy is set to create really dangerous situations for people to deter people from migrating,” said Erika Pinheiro, the litigation and policy director at the immigrant legal aid organization Al Otro Lado. “But it doesn’t deter migration, it just leads to more deaths, whether it’s an overheated tractor trailer or an SUV crash.”

What if rather than recycling and mindlessly doubling down on proven to fail “enforcement only” policies (that also happen to be expensive), we ran an honest legal system that fairly, timely, and orderly granted refuge to those who qualify under correct, generous interpretations of protection laws and dealt in a fair and humane manner with those who don’t qualify?

I’m not saying we don’t need more comprehensive immigration reform. In particular, we need the legalization program, a much larger and more rational legal immigration system, and an independent, Article I Immigration Court, staffed by real, expert judges, for starters. 

But, in the meantime, since the GOP has shown no interest whatsoever in reasonable legislative changes, we could do a much, much better job of administering the current laws in an efficient, reasonable, and humane way that would further the national interest, rather than undermining it. 

It won’t happen, however, without bringing in a better team from outside the existing bureaucracy. The longer the Biden Administration waits to replace the dysfunctional bureaucracy with experts who can solve problems and rationalize this system, the more difficult the task becomes.

For example, there are only a handful of folks in the current bureaucracy who understand the problems and the potential solutions as well as Erika Pinheiro. As long as folks like Erika are on the “outside” fighting to block misguided policies and get the attention of those in charge, our border and immigration policies generally will remain a mess as they been for decades before launching into “free fall” under the malicious incompetence of the past four years!

It’s possible to view today’s announcement that Vice President Kamala Harris has been put in charge of the Biden Administration’s “border strategy” as a bright spot. But, unfortunately, not necessarily.

Talk about a “strategic alliance” with sending countries like El Salvador, Guatemala, Honduras, even Mexico, all with exceptionally poor human rights records and huge official corruption problems, sounds like it could be more “Trump Lite,” inhumane and ultimately ineffective enforcement, rather than an innovative, enlightened humanitarian response. 

In other words, Harris and Biden could well repeat, in some manner, the Trump “policy” of trying to insure that asylum seekers die in their home countries, die on the way, or get held in cages somewhere south of the border outside the “normal interest zone” of the American media and grandstanding US politicos. Disturbingly, there was no initial recognition that “wooden cliches” like “enforcing the law” actually means recognizing the legal right of individuals to leave their countries and seek asylum elsewhere, as well as a fair, humane, timely, and competent system for processing asylum claims that respects human dignity. 

We don’t meet any of those criteria right now (nor do any of the “partner countries” listed above). Worse yet, the folks who understand and have ideas on how we might get to where we need to be are consigned to the “outside” — trying to correct errors through litigation and the media — rather than being actively engaged in solving problems. Not a good approach for an Administration that claims to believe, as I do, that good government can and should serve the public interest by relying on experts and the “best and brightest” to solve problems.

So, anyone in the NDFPA who has connections to the Harris camp had better use them in attempting to insert some truth and enlightened thinking into what is typically a grim, tone deaf, and ineffective USG response. Otherwise, we’re likely to see a variation of “same old, same old,” which is why we continue to fail to deal with a pressing, recurring human issue in a legal, humane, informed, and courageous way. I/O/W, “business as usual” in a bankrupt system, just with a different “spin.”

Importantly, they are now free to disregard conservative canards that have hobbled America’s ability to respond to public needs ever since Ronald Reagan convinced the nation big government was the problem.

The first is the supposed omnipresent danger of inflation and the accompanying worry that public spending can easily overheat the economy.

Rubbish. Inflation hasn’t reared its head in years, not even during the roaring job market of 2018 and 2019. “Overheating” may no longer even be a problem for globalized, high-tech economies whose goods and services are so easily replaceable.

Biden’s ambitious plans are worth the small risk, in any event. If you hadn’t noticed, the American economy is becoming more unequal by the day. Bringing it to a boil may be the only way to lift the wages of the bottom half. The hope is that record low interest rates and vast public spending generate enough demand that employers will need to raise wages to find the workers they need.

Prominent Black lawmakers are urging the Biden administration to stop expelling migrants to nations such as Haiti that are engulfed in political turmoil, fearing that they could be harmed or killed.

Hundreds of immigrants have been swept out of the United States in recent days, a blow to groups that had been counting on President Biden and Vice President Harris, the daughter of immigrants and the first Black vice president, to halt deportations and overturn the Trump administration’s hard-line immigration policies.

Biden attempted to pause most deportations on Jan. 20, but a federal judge temporarily blocked the move. Immigration officials say the recent removals match Biden’s new enforcement priorities — such as people who recently crossed the border or who were convicted of serious crimes — but advocates say immigrants are being sent to nations where they could face danger.

“The community should not still be in panic across this nation when we have an administration that is willing to do the work of stopping these deportations,” Rep. Ilhan Omar (D-Minn.) said Friday in a call with reporters. “They have the authority to say no more flights will leave the United States.”

Migrants who cross the border are still being removed under a Trump administration order that allowed the expulsion of recently arrived people under Title 42, Section 265, of the public health law that aims to prevent the spread of the coronavirus. Advocates for immigrants tracking the flights say Immigration and Customs Enforcement has expelled approximately 900 Haitians, including dozens of children, in the past two weeks.

Advocates for immigrants say the situation is urgent, as Haiti and nations in Africa are facing varying threats. Haiti, the Western Hemisphere’s poorest country, has seen its democracy plunge into a constitutional crisis with allegations of a coup attempt and conflicting claims to the presidency.

ICE deported New York resident Paul Pierrilus to Haiti on Feb. 2, even though he has never been to that country and has lived 35 of his 40 years in the United States.

He had fought deportation since 2004 after a drug conviction. His parents are of Haitian descent, but they are U.S. citizens and Pierrilus was born on the Caribbean island of St. Martin.

Haiti had never recognized him as a citizen, he said, but an immigration judge ordered him deported more than 16 years ago and he lost his appeals.

In an interview, Pierrilus described how he had to be dragged off the airplane. He wore the parka he used to wear in New York into the tropical 85-degree air. He said he is stunned and defeated.

“I’m not a Haitian citizen! I’m not a Haitian citizen!” Pierrilus recalled yelling as local officials pushed him onto a bus. “I felt helpless because it’s a situation out of my control. It’s a situation I can’t do anything about. No one is hearing what I’m saying.”

Remember, creating an atmosphere of fear and terror in ethnic communities throughout the United States was a key priority of the Trump White Nationalist kakistocracy — with a some help from the Supremes’ majority. But, of course, there aren’t any Asian American Justices, are there? So, out of sight out of mind for perhaps Ameria’s “least representative” court (with the possible exception of the EOIR “courts”).

I’ve consistently been making several points that others are finally starting to pick up on and that will be essential for Biden Administration policy makers to keep in mind: 

  • The issues of racial justice and immigrant justice are deeply intertwined — one can’t be solved without addressing the other; 
  • Dehumanization of “the other” (Black, Latino, Asian-American, women, immigrants, asylum seekers, etc.) — “Dred Scottification” — has been promoted over the past four years and essentially endorsed and furthered by a tone-deaf Supremes’ majority;
  • Racist attitudes and misogyny are deeply ingrained in the current DHS and EOIR (now operating as an adjunct of DHS Enforcement) enforcement mechanisms and in some of the personnel carrying out enforcement policies, including some EOIR judges; 
  • An aura of impunity and unaccountability infects both DHS and DOJ;
  • Racial justice and equal justice under law will not be achieved without significant personnel and attitude changes at the “retail level” of both DHS and EOIR.

Finally, complaining is a start. But, it won’t result in the necessary systemic changes. 

The only way that African-American, Hispanic-American, Asian-American, and female lawmakers are going to get durable change is by prevailing on their colleagues to recognize the humanity of all persons in the United States and to make the necessary statutory changes in the immigration laws, beginning, but not ending, with an independent Article I Immigration Court.

Keyla Martínez screamed for help from inside the police cell, but no one came to save her.

Martínez, a 26-year-old trainee nurse from La Esperanza, western Honduras, died in police custody last weekend after being detained for breaching a coronavirus curfew.

Police officers initially claimed Martínez had killed herself. But a preliminary autopsy found she had died from “mechanical asphyxiation” and prosecutors announced they were investigating her death as a murder.

Twenty-nine women have been killed so far this year in Honduras, which has a population of about 9 million – only slightly more than New York City.

This week, security forces have teargassed protesters demanding truth and justice for the young nurse. Human rights groups are also demanding accountability amid the alarming escalation of deadly violence against women. At least six women have been killed since Martínez died.

“This killing has all the hallmarks of an extrajudicial execution and must be investigated as such,” said Erika Guevara-Rosas, Americas director at Amnesty International.

“Grave human rights violations such as the killing of Keyla Martínez do not happen in a vacuum. They are the product of rampant impunity and the lack of political will to address the human rights crisis in Honduras. This dire context has produced a relentless and widespread stream of abuses by state security forces.”

Honduras is one of the most dangerous countries in the world to be a woman or girl. It is a deeply machista society where conservative church leaders exert a powerful influence over the personal and political spheres – including women’s access to reproductive healthcare and protection from violence.

Last month, congress voted to amend the constitution to make it virtually impossible to overturn the country’s abortion laws – which are already some of the strictest in Latin America.

In 2009, a coup orchestrated by a network of military, economic, political and religious elites, ushered in an authoritarian government, which remains in power despite multiple allegations of corruption, extrajudicial killings, electoral fraud and ties to international drug trafficking networks.

Since then emigration has risen dramatically, as hundreds of thousands of men, women and children have fled north looking for safety and jobs. A culture of impunity has also meant that violence against women has only worsened.

In the decade before the coup, 222 women were murdered annually, according to analysis by the Centre for Women’s Studies – Honduras (CEM-H). In the past five years, 381 have been killed on average annually. Ninety-six per cent of the murders remain unsolved.

“The militarization of the country since the coup has increased the threat to women’s lives, there are guns everywhere and we know the police have links to criminal gangs,” said Suyapa Martínez (no relation to Keyla Martínez) from CEM-H, a feminist organisation based in Tegucigalpa.

Refugee women continue to flee Honduras, even though the Trump regime misogynist nativists have skewed asylum law to make it more difficult for them to gain legal protection.

The Biden Administration has directed consideration of gender-based asylum regulations. It’s hardly a new idea — former AG the late Janet Reno ordered development of regulations regularizing the granting of “gender-based” asylum claims two decades ago. 

Those efforts were basically sabotaged by DOJ bureaucrats and litigators more interested in narrowing asylum eligibility and making denials easier to defend than they were in protecting women — one of the world’s most persecuted groups by any reasonable accounting.

After years of screwing around, including eight years of inaction during the Obama Administration, super-misogynist and anti-asylum racist Stephen Miller arrived. He perversely came up with absurdly illegal regulations that incredibly purported to bar gender-based asylum claims! Those illegal (not to mention immoral) regulations have been enjoined. Nevertheless, the anti-asylum, anti-woman, anti-Latino attitudes and “judicial” decision-making at EOIR and DHS remain deeply ingrained!

The lesson: Changing policies in the bureaucracy requires something in addition to high level support. It requires bureaucrats who actually believe in the change and are committed to making it happen! That’s why dismantling the Trump immigration kakistocracy and getting better qualified individuals at all levels is so important.

US Immigration and Customs Enforcement (Ice) deported at least 72 people to Haiti on Monday, including a two-month-old baby and 21 other children, in an apparent flagrant breach of the Biden administration’s orders only to remove suspected terrorists and potentially dangerous convicted felons.

The children were deported to Haiti on Monday on two flights chartered by Ice from Laredo, Texas to the Haitian capital Port-au-Prince. The removals sent vulnerable infants back to Haiti as it is being roiled by major political unrest.

Ice is facing a rising chorus of denunciation as a “rogue agency” for its apparent refusal to abide by the new guidelines laid down by Biden and his homeland security secretary, Alejandro Mayorkas. The incoming administration ordered a 100-day moratorium on all deportations, which was temporarily blocked by a judge in Texas.

However, the judge’s restraining order left in place the new guidelines stipulating that only the most serious immigration cases should be subject to deportation.

Last Friday, the administration appeared to gain the upper hand in its attempt to rein in Ice when deportation flights to Haiti were suspended. But on Monday the immigration agency reasserted itself again with the renewed flights to Port-au-Prince, children and infants on board.

Human rights activists are dismayed by the deportations, which bear a close resemblance to the hardline course set by Donald Trump. “It is unconscionable for us as a country to continue with the same draconian, cruel policies that were pursued by the Trump administration,” said Guerline Jozef, executive director of the immigration support group the Haitian Bridge Alliance.

She added: “I don’t know what’s going on between Ice and the Biden administration, but we know what needs to be done: the deportations must stop.”

On her last day at the justice department in 2017, Vanita Gupta considered taking a picture as she left the agency’s headquarters on Pennsylvania Avenue. But she decided against it. Gupta, the outgoing head of the department’s civil rights division, once described as the “crown jewel” of the agency, didn’t really want to remember the moment, she told a reporter who was shadowing her for the day.

Jeff Sessions, then the incoming attorney general, was poised to unwind much of the painstaking progress Gupta, 46, and her colleagues had spent the last four years building. It was no secret that Sessions opposed the kind of court agreements the justice department used to fix unconstitutional policing policies across the country (“dangerous” and an “exercise of raw power” in Sessions’ eyes). Nor were there any illusions that Sessions would try very hard to enforce the Voting Rights Act, already on its last legs after the supreme court gutted a key provision in 2013 (Sessions described the landmark civil rights law as “intrusive”).

Many of those concerns came to pass. Trump’s justice department not only did little to enforce some of the country’s most powerful civil rights protections for minority groups, but in several cases it opposed them. It filed almost no voting rights cases and defended restrictive voting laws, tried to undermine the census, challenged affirmative action policies, sought to roll back protections for LGBTQ+ Americans, and limited the use of consent decrees to curb illegal policing practices. Gupta took a job as the head of the Leadership Conference on Civil and Human Rights, a coalition of civil rights groups across the country, where she became one of the leading figures pushing back on the Trump administration.

Joining Gupta in that effort was Kristen Clarke, a 47-year-old former justice department lawyer who leads the Lawyers’ Committee for Civil Rights Under Law, founded in 1963 to help attorneys in private practice enforce civil rights. As her group filed voting rights and anti-discrimination lawsuits across the country over the last few years, Clarke spent hours nearly every election day briefing journalists on reports of incoming voting problems. Reports of long lines, voting machine malfunctions, translator issues – no problem was too small. The monitoring sent a message that civil rights groups would move swiftly against any whiff of voter suppression.

Now, after years of leading the fight for civil rights from outside the justice department, both women are poised to return to its top levels, where they can deploy the unmatchable resources of the federal government. Last month, Joe Biden tapped Gupta to serve as his associate attorney general, the No 3 official at the department, and Clarke to lead the civil rights division. If confirmed by the Senate, Gupta would be the first woman of color to be the associate attorney general; Clarke would be the first Black woman in her role.

“They are both independently legit civil rights champions with a long deep history,” said Justin Levitt, who worked with Gupta at the justice department and knows both women well. “They’re going to make a really spectacular, really powerful team.”

Picking two career civil rights lawyers for two of the top positions at the justice department sends an unmistakable signal that civil rights enforcement will be a top priority for the agency over the next four years. Civil rights leaders said they could not remember a prior administration in which two of the department’s highest positions were filled by civil rights attorneys, especially two such as Clarke and Gupta.

“It’s going to be really important and energizing and exciting to be able to be in conversation and discussion with people who understand the department’s role in civil rights enforcement,” said Sherrilyn Ifill, president and director-counsel of the NAACP Legal Defense and Educational Fund (LDF), who has worked closely with both women. “But it’s also going to be exciting, and as a matter of resources, to have the department actually do civil rights enforcement.”

Here are the “keys to success:”

  • Immigrants’ rights are human rights;
  • Human rights are civil rights;  
  • There can be neither racial justice nor equal justice in America until migrants are not only fully recognized as “persons” under our Constitution, but actually treated as such (as opposed to the active “dehumanization” and “Dred Scottification” of migrants and persons of color by the Trump regime and the GOP majority on the Roberts’ Court);
  • You can’t possibly “win the game” with the same players who “batted for the White Nationalists” over the past four years.

And, speaking of “Jewel in the Crown.”👑 That’s exactly how many of us in the “Round Table of Former Immigration Judges” 🛡⚔️ once viewed EOIR. The “EOIR Vision” was: “Through teamwork and innovation be the worlds’s best tribunals, guaranteeing fairness and due process for all.” 

So, Vanita, and I hope Kristen also, can imagine the anger and determination to fight with which our Round Table viewed the dismemberment of due process and weaponization of the Immigration Courts under Sessions, Whitaker, and Barr. From aspiring to be the “world’s best tribunals” to “Star Chambers” and a grotesque, dysfunctional national disgrace!

On the plus side: Both Gupta and Clarke are the daughters of immigrants. Both have written and advocated for immigrants’ rights as part of their civil rights leadership.

Caution. Obama Attorneys General Eric Holder and Loretta Lynch were “facially aggressive” on protecting voting rights and police reforms. Yet, at the same time they: helped DHS set deportation records; allowed EOIR to spiral toward dysfunction (to a large extent through failure to procure and properly manage resources and an indolent judicial hiring program that was both “closed and non-diverse in nature” and glacial in operation (2 years to fill an average judicial vacancy!)); supported “baby jails,” the “family gulag,” and toddlers representing themselves on asylum cases in Immigration Court; looked the other way as private prisons treated asylum seekers and migrants worse than convicted criminals; and “went along to get along” with the Administration’s misuse of the Immigration Courts as (a highly ineffective) deterrent to applications for asylum.   

Sessions, Whitaker, and Barr might have been the “Kings of Aimless Docket Reshuffling” at EOIR that helped produce an astounding 1.3 million case plus “backlog.” But, it started in earnest under the Obama Administration.

That’s what I mean by the “two headed policy:” arguing for voting rights for minorities in one courtroom while simultaneously ignoring the human and civil rights of migrants in the next courtroom. Arguing for the right to vote in one case, while arguing (apparently with a straight face) that toddlers who can’t speak English have no right to legal representation in the next case.

Not only that, but with the Biden Administration apparently looking to rapidly fill upcoming Article III vacancies, the Obama DOJ’s mishandling of the Immigration Courts has deprived President Biden of the chance to draw from a diverse group of younger, progressive Immigration Judges whose practical scholarship, commitment to human rights and due process, courage, and proven ability to function in a “high stress” judicial setting would make them strong candidates for the now-reeling Article III Judiciary.

That’s certainly not to say that there aren’t some potential progressive candidates for the Article III Judiciary among today’s present, and particularly recently “retired,” (some essentially “forced out” at relatively young ages as a “matter of conscience”) Immigration Judges. There are! But, only a fraction of the number there would have been if the Obama Administration had taken the Immigration Courts with proper seriousness. 

And, that’s leaving aside the lives that could have been saved and better jurisprudence that could have been “institutionalized” with better, merit-based, judicial selections at EOIR during the Obama Administration!

I sincerely hope that Vanita Gupta and Kristen Clarke can help Judge Garland get the job done at Justice. The “human rights/immigration world” will be cheering for you. Getting some of the folks from the New Due Process Army (“NDPA”) into key positions at EOIR and the rest of the DOJ will be an “early signal” of whether or not “Team Garland gets it.” 

Removing McHenry at EOIR was a good start! But, it’s only a small step in what has to be done to make racial justice and immigrant justice a reality at the DOJ. The “brooms and plungers” 🧹🚽 need to come out, and the sweeping and plunging has to be quick and widespread.    

On the other hand, there is “no patience for another Obama Administration” out here in the real world. Every day, EOIR and DOJ are killing folks, ruining lives, and abusing the brave and dedicated attorneys of the NDPA! If the rhetoric doesn’t produce short term results and drastic improvements, you can expect the same type of aggressive litigation from the NDPA that stopped the defeated regime from completely destroying the U.S. justice system.

A survivor of a Walmart mass shooting that killed 23 people in El Paso, Texas, and targeted Latino people has been deported to Mexico, triggering widespread outrage among activists and local politicians.

Police reportedly stopped the woman – who was not named in full – due to a non-functioning brake light, then took her to a local jail. She was then placed into the custody of Immigration and Customs Enforcement (Ice), where she was soon deported to Mexico.

The legal defense team working on her behalf confirmed to local KVIA that city police arrested the woman, identified as just Rosa. She was booked into the El Paso county jail annex.

Diocesan Migrant & Refugee Services told local KTSM that on Wednesday, the survivor was pulled over and, during the traffic stop, found to have two, five-year-old citations still outstanding.

By Friday morning, Rosa had been deported to Cuidad Juárez where she has remained ever since.

On a Saturday morning in early August 2019, a 21-year-old man walked into the El Paso Walmart Super Center and opened fire, first into the parking lot before taking aim at the store’s entryway. The attack killed 13 Americans, eight Mexicans and one German.

The Biden administration’s acting attorney general, a longtime career official named Monty Wilkinson, took part in a controversial 2017 decision to remove a justice department (DoJ) lawyer in Texas who had raised concerns about migrant children who were being separated from their parents.

Emails seen by the Guardian show that Wilkinson, who is expected to serve as acting attorney general until Judge Merrick Garland is formally confirmed by the Senate, worked with another longtime career official, Iris Lan, in reviewing complaints about Joshua Stern, a prosecutor who had told colleagues he was “disturbed” by the Trump administration’s separation policy.

The policy ultimately led to the separation of about 1,550 children from their parents, hundreds of whom have still not been reunited, although Joe Biden has said he would make that one of his top priorities.

Stern, who is no longer employed by the DoJ, was ultimately removed from his post as a temporary detailee, two weeks after senior officials in Texas raised concerns about him to officials in Washington DC, including Wilkinson.

Wilkinson, who Biden chose to serve as acting attorney general until Garland is confirmed, had been overseeing human resources, security planning and the library at the justice department before he was elevated to serve as acting attorney general.

A recent report in the New York Times suggested that Wilkinson was a trusted longtime official, and that his “low profile” all but guaranteed that he was not involved in any of the myriad scandals that defined the justice department under Donald Trump and the former attorney general Bill Barr.

But a report published by the Guardian in September 2020 revealed that Wilkinson was one of several career officials who reviewed complaints that ultimately led to the removal of Stern from the western district of Texas in 2017.

The report was focused on the role a senior justice department official, Iris Lan, played in reviewing those complaints. Lan had been nominated to serve in a lifetime appointment as a federal judge, but the nomination was never taken up in the Senate after a number of immigrant rights groups raised concerns about Lan following publication of the Guardian’s article.

It is not clear whether Wilkinson or Lan privately supported or criticized the administration’s child separation policy when they heard about Stern’s concerns.

It’s not like Courtside hasn’t been saying it for several years now: Cruelty, lawlessness, inhumanity, racism, and dishonesty end up corrupting everyone. Sessions is essentially a “21st Century Nazi war criminal” — everyone who served him is tarnished by his miserable lack of ethics, humanity, intelligence, honesty, and anything close to the basic qualifications for office. The same can be said for Billy the Bigot and short-timer Matt Whitaker. 

Even a guy like “Monty” — basically considered “safe” because he was a bureaucratic nebbish who kept out of sight and off the radar screen — turns out to have been bathed in the slime 🤮 that Sessions and his cronies unleashed on the Department.

Of course, it’s more fun to come “riding in on a white horse” to rally and save the dispirited troops. But, in this case, the “troops” who willingly carried water for the immoral, racist, lawless, White Nationalist, anti-democracy, and ultimately insurgent kakistocracy at the DOJ are part of the problem. And, that goes for some career lawyers who failed to live up to their oaths of office, not just the vile politicos. 

If “Team Garland” doesn’t knock some heads, re-establish ethical standards, provide some moral leadership, and hold some folks who should have known better accountable, they are not going to be able to get the job done! The EOIR kakistocracy is the obvious starting point. But, it can’t be the end of “operation clean sweep!”🧹

In the meantime, the Biden Administration might have to look in the JMD motor pool or the mail room to find an “Acting” AG not tarnished by the Barr-Whitaker-Sessions kakistocracy @ Justice!

It’s likely that the movement to hold accountable and remove from Congress traitors like Cruz, Hawley, McCarthy, and the other Republicans who shamelessly and seditiously continued to support the anti-American lies, racist false narratives, and conspiracy theories that fueled Trump’s insurrection and domestic terrorism will die out over time. But, it shouldn’t!

As I write this, the GOP treasonists in the House are blocking what should be a unanimous resolution to invoke the 25th Amendment to remove this dangerous, unhinged, traitor/moron from the office he has abused and disgraced from Day One!

One reason why our democracy is on the ropes is that there hasn’t been any accountability whatsoever for Trump and his kakistocracy of thugs on the public payroll or for the GOP White Nationalist traitors and enablers in Congress who have furthered their grotesque abuses of humanity and our democratic institutions.

The lack of accountability is particularly glaring and disgusting for Trump’s lawyers, both in and out of Government, who have lied, misrepresented, and totally jettisoned ethics and “due diligence” in supporting and furthering Trump’s attacks on our democracy. Why is Rudy Giuliani, who led a coast to coast “conspiracy of lies and treason” in Federal and State Courts, before calling for armed rebellion against our Government, still walking free and “practicing” law? Why are Billy Barr, Gonzo Sessions, Don McGhan, Noel Francisco, and a host of others who lied, misrepresented, and abused their ethical obligations as well as their oaths of office happily ensconced in the private sector rather than being held accountable for their “crimes against humanity?” 

Contrary to all the total BS 💩being spread by GOP Trump toadies, the unconstitutional, racist, illegal, violent, anti-democracy agenda of Trump, Miller, and the rest of of the Thugocracy/Kakistocracy was apparent from the “git go.” 

And, Chief Justice Roberts and the other GOP Justices who helped roll out and encourage “Kristallnacht” by rubber-stamping the “Muslim ban,” “Let ‘Em Die In Mexico,” the “Bogus Wall of Misappropriated Funds,” stripping legal migrants of life-saving and health preserving benefits, helping fuel a DHS “reign of terror” directed at ethnic communities, and other neo-Nazi travesties should also tender their resignations to President Biden as of Jan 21, 2021! Intellectual dishonesty by judges and bad, righty biased (non)jurisprudence have real life consequences! 

Trump and Miller told the Supremes precisely what their invidious racist, religiously biased, politically pandering intent was in all of these cases and the GOP Justices ignored it in favor of bogus, fabricated, right wing, authoritarian, racist driven, anti-democracy agendas thinly camouflaged by legal gobbledygook.

People die and lives are ruined forever when judges who are supposed to protect them instead “take a dive” for the forces of tyranny and cruelty! “Dred Scottification” (“dehumanization”) of Blacks, Latinos, Immigrants, and other People of Color by our highest Court is neither acceptable nor should it be “swept under the rug” as has happened all too often when the Supremes fail democracy and align themselves with anti-democracy racists and authoritarians.

For four years, the GOP Justices on the Supremes have treated due process, democratic institutions, and the lives of asylum seekers and other migrants (and to some extent their pro bono lawyers) as “jokes.” That’s because 1) neither they nor their families are rotting in Mexico or facing torture and death in El Salvador or some other failed state; and 2) this time, the right wing thugs they enable were across the street trashing our Capitol rather than storming the Supremes. Better Justices and Better Federal Judges for a Better America!

The Centers for Disease Control and Prevention (CDC) bars asylum seekers and refugees from the US under an order called Title 42. People who attempt to cross the border are returned, or expelled, back to Mexico, without an opportunity to test their asylum claims. More than 250,000 migrants processed at the US-Mexico border between March and October were expelled, according to US Customs and Border Protection data.

The situation is dire. Thousands of asylum-seekers are stuck at the border, uncertain when they will be able to file their claims. The camps they wait in are an even greater public health risk that before.

Outside the border, Al Otro Lado has fought for detained migrants to get PPE and medical releases. Prisons are one of the worst possible places to be when there is a contagious disease and deaths in the custody of US immigration authorities have increased dramatically this year. They have also provided supplies to homeless migrants in southern California who have been shut out of public hygiene facilities.

Pinheiro said there will be improvements with Trump out of office, but some of the Biden campaign promises to address asylum issues at the border will be toothless until the CDC order is revoked. It’s a point she plans to make in conversations with the transition team.

A prime concern for advocates about the Biden administration is that it will include some of the same people from Barack Obama’s administration, which had more deportations than any other president and laid the groundwork for some controversial Trump policies.

While it is a worry for Pinheiro, she has hope that the new administration will build something better. “I would hope a lot of those people, and I know for some of them, have been able to reflect on how the systems they built were weaponized by Trump to do things like family separation or detaining children,” she said.

Family separation, which has left 545 children still waiting to be reunited with their parents, was a crucial issue for many voters and Pinheiro hopes that energy translates to other immigration policies.

“How did you feel when your government committed the atrocity of family separation in your name?” Pinheiro said. “The next step is really understanding that similar and sometimes worse atrocities are still being committed in the name of border security and limiting migration.”

I totally agree with Erika Pinheiro that there is no excuse for the continuing violations of our Constitution, statutes, international obligations, and simple human decency. The regime’s policies are nothing more than “crimes against humanity” thinly disguised as “law enforcement,” “national security,” and  “public health” (from a regime whose “malicious incompetence,” cruelty, and callous intentional undermining of medical advice during the pandemic have contributed to the unnecessary deaths of tens of thousands of Americans).

Even more disgracefully, the Supremes and other Federal Courts have failed in their Constitutional duty to stand up to the abusers and hold the regime’s scofflaw “leaders” (to where, one might ask?) accountable. What’s the purpose of life-tenured judges who lack the training, wisdom, ethics, and most of all courage to enforce the legal and human rights of the most vulnerable against lawless, dishonest, and fundamentally cowardly “Executive bullies” hiding behind their official positions? Not much, in my view! There are deep problems in all three branches of our badly compromised and ailing Government!

I have also spoken out on Courtside against the dangers of putting the same failed Dem politicos who thoroughly screwed up immigration policy, and particularly the Immigration Courts, back in charge again. I agree with Erika’s hope that some of them have gained wisdom and perspective in the last four years. But, why rely on the hope that those who failed in the past have suddenly gotten smarter, when there are “better alternatives” out there ready to step in and solve the problems?

Why not put in place some talented new faces from the NDPA with better, more progressive ideas, tons of dynamic energy, and the demonstrated willingness and courage to stand tall against bureaucratic tyranny? Give them a chance to solve the problems! Erika looks like one of those who should be solving problems and implementing better immigration policies “from the inside” in the Biden-Harris Administration!

The “deterrence only paradigm” that has driven our border enforcement policies over the past half century has been a demonstrable failure, both in terms of law enforcement and the unnecessary and unjustifiable human carnage that it has caused. Why keep doing variations on discredited policies and expecting better results?

We know that ugly, racist rhetoric, jailing families and kids in punitive conditions, weaponizing courts as enforcement tools, suspending the rule of law, denying hearings, and even summarily, illegally, and immorally returning asylum seekers to death won’t stop folks from fleeing unbearable conditions in their native countries! They will continue to seek protection in America, even in the face of predictable abuses, life-threatening dangers, and little chance of success in a system intentionally “gamed” to mistreat and reject them while denying their humanity.

Desperate people do desperate things. They will continue to do them even in the face of inhuman abuses inflicted by those whose better fortunes in life have not been accompanied by any particular compassion, understanding of the predicament of others, or recognition of an obligation to abjure the power to bully and torment those less fortunate in favor of addressing their situations in a fair, reasonable, and humane manner.

Human migration is far older than nation states, zero tolerance, baby jails, family incarceration, biased judging, national selfishness disguised as “patriotism,” and border walls. It has outlasted and outflanked all of the vain attempts to artificially suppress it by force and gimmicks. It’s time for some policies that recognize reality, see its benefits, and work with the flow rather than futilely in opposition to it.

It’s past time to look beyond the failures of yesterday to progressive solutions and new leadership committed to solving problems while enhancing justice, respecting human dignity, and enhancing human rights (which, in the end, are all of our rights)!
