“Washington (CNN)As the ink dried Friday on a major budget compromise deal in Congress, immigration advocates were taking stock of getting left behind — again — without a resolution for hundreds of thousands of young undocumented immigrants on the verge of losing protections.

It’s an open question if there are cards left to play in the push to enshrine the Deferred Action for Childhood Arrivals policy into law. While no advocates say they are giving up, many also openly admit that Democrats and allies gave up their best negotiating position on the issue without another clear avenue coming up.
In the meantime, a pending court decision on DACA, which President Donald Trump is terminating, means the immigrants protected by it and who mostly have never known another country than the US, won’t begin losing their protections as planned on March 5 — but their fate could be reversed at any moment by another court decision.
Rep. Luis Gutierrez, an Illinois Democrat who has long served as one of the most outspoken advocates in Congress for immigration reform, was pessimistic with reporters early Friday morning as Congress passed the deal with virtually every Democratic priority except DACA in it.
“No, I don’t, I don’t,” he said when asked if there was any other way Democrats could exert leverage on the issue. Gutierrez said the plan from the beginning was to either attach a DACA compromise to the must-pass budget deal or raising the debt ceiling, both of which were passed in the early morning hours Friday without DACA. Arizona Democrat Raul Grijalva called the episode “disheartening.”

“We have decoupled the issues. Your leverage is you want them one and the same,” Gutierrez said. “Do we need a new way forward? Yeah, we’re going to figure out a new way forward.”

Step 1: Senate vote next week

There is one glimmer of hope for advocates. Senate Majority Leader Mitch McConnell made good on his promise to tee up an immigration debate on the Senate floor next week. Moments after the Senate passed the deal, McConnell filed to have a vote to open debate on an unrelated bill Monday evening — which will kick off a process where an as-yet-unknown number of amendments will be able to compete for a procedural threshold of 60 votes to then pass the Senate.
It was that promise that put in motion the deal that eventually severed DACA from other negotiations but also offers a rare opportunity for lawmakers to compete on a neutral playing field for bipartisan support.
“We’re pivoting, what can you do?” said longtime advocate Frank Sharry, executive director of the pro-immigration group America’s Voice. “We’ve had our doubts about the viability of a standalone legislative process but that’s what we’re left with, so we’re hoping to make the most of it. … That will put pressure on the President and the House to do the same.”
Already, groups of lawmakers are preparing for the floor debate, even as it remains unclear how many amendments will be offered, how debate will be structured and how long it might last.
A group of roughly 20 bipartisan senators is drafting legislation over the weekend to offer perhaps multiple amendments and potentially keep the debate focused on a narrow DACA-border security bill. Advocates on the left may offer a clean DACA fix like the Dream Act, and some on the right are drafting a version of the White House proposal that would include $25 billion for a border wall and heavy cuts to legal immigration with a pathway to citizenship — though neither is expected to have 60 votes.
“First of all, we have the Senate procedure, which is my hope. We’re working with the (bipartisan group) to see if we can come to a two-pillar solution,” said Sen. Bob Menendez, a New Jersey Democrat who has long worked on the issue, when asked Thursday what comes next for DACA. “Hopefully we could gather 60 votes for that. And then that would be it — we’d resist everything else, any other amendments, and then go back to the House and create all the pressure in the House to make it happen.”

Step 2: Pressure Ryan

If the Senate can pass a bill, lawmakers hope Trump will fully embrace it, freeing House Speaker Paul Ryan to call it up.
Already as the budget deal was on track for passage, House advocates began a pressure campaign to urge Ryan to make a promise like McConnell — though Ryan continually demurred and insisted instead he’s committed to the issue of immigration and passing a bill the President can support.
“I think we have to be realistic,” said Arizona’s Democratic Rep. Ruben Gallego. “We’re going to have to deal with reality and find whatever means possible to put pressure on Speaker Ryan and the Republican Party to bring, again, a fair vote on the Dream Act to the floor.”
“I think for me the strategy has to be pressure Ryan and bring it to the floor,” Grijalva said, adding the process should allow any proposal to vie for a majority — even if it doesn’t have a majority of Republican votes. “The Senate, when they gave up on not voting for it, at the very minimum extracted a time certain and a debate on something. We don’t even have that.”
Democrats also may have some Republican supporters in the House to pressure Ryan. A bipartisan group of lawmakers that includes two dozen Republicans sent a letter to Ryan asking to open a floor debate like McConnell.
Republican Charlie Dent of Pennsylvania said he’s been urging fellow moderates to use their numbers the way that conservatives on the right flank do.
“The Freedom Caucus has been effective because they’ll use their power of 24 (votes to deny a majority), and they take the hostage, they’ll do what they have to do,” Dent said. “I tell our members, we put our votes together, we can really direct an outcome. … I suspect if the Senate sends us a bipartisan DACA bill, that’s when we’re going to have to flex our muscles.”
But others have doubts. Republican Sen. Marco Rubio of Florida, a member of the bipartisan group, says he learned his lesson in 2013, when he co-authored legislation that passed the Senate with wide margins but died in the House.
“There are some who believe that if we get a bunch of votes it’ll force the House to do it. I don’t agree,” Rubio said. “We could vote on it 90-10. … This notion that the House is going to listen to what a senator tells them to do is not real.”

Step 3: Other leverage

If the legislative process can’t produce success, advocates say, they will look for any other leverage points they can.
“If that doesn’t work out, then there’s still an omnibus at the end of the day,” said Menendez, referring to the spending bills due in March to fund the government under the topline two-year budget deal passed Friday.
But Gutierrez doubted that approach — scoffing at the idea that Democrats would be taken seriously if they threatened to withhold their votes yet again without success.
“Really?” Gutierrez said about the omnibus as leverage. “Is it plausible? Is it realistic? Can you continue to threaten with something?”
Other options could include a temporary, one-year or two-year extension of DACA without a permanent solution, though lawmakers have decried that option.
Still, many aren’t ready to give up hope.
“This President clearly wants to get it done, I think the majority of Republicans want to get it done and the majority of Democrats want to get it done. Can we reach that balance? We can get there, I feel very confident we can get there,” said Florida’s Republican Rep. Mario Diaz-Balart.”

Although it should be a “no brainer,” I’m not as confident as Rep. Diaz-Balart that this group can “get to yes.” A fair resolution of the “Dreamers” situation just isn’t very high on the GOP agenda, particularly in the House. And, both the Dreamers and the Dems are coming to grips with the obvious reality: if you want to set or control the agenda, you have to win elections!

“For the better part of a decade, an agency that bilked Chinese immigrant investors out of nearly $50 million operated in plain sight from a storefront in the front lobby of the bustling Hilton San Gabriel hotel.

Their crimes came to light last year after a task force of San Gabriel police and federal immigration officials tracked transactions between Chinese and U.S. banks, conducted cross-border surveillance operations, launched an undercover sting and sought information from the Chinese government.

San Gabriel Valley police departments often use federal partnerships to tackle crimes like these — many of which target vulnerable new immigrants — because they lack the necessary resources, skills and technology to pursue them.

But the largely immigrant communities that they police are starting to protest these partnerships in the wake of aggressive, Trump-era immigration enforcement that has stoked widespread fears over deportations.

On Tuesday, San Gabriel city leaders rescinded a Police Department agreement with immigration officials, citing doubts about the arrangement’s necessity and heightened fears about deportations.

The memorandum of understanding, signed by Police Chief Eugene Harris in December, designates a San Gabriel police detective to act as a customs officer on a task force that investigates various types of immigration-related crimes.

Although the memo states that the designated officer does not have the authority to enforce administrative violations of immigration law, city leaders said the decision should have been brought before the City Council.

The partnership sends the wrong message about the city’s stance toward immigrants, Councilman Jason Pu said. The city’s population is 61% Asian and 25% Latino, and more than half of of all residents are foreign-born. He also asked the City Council to consider a “sanctuary city” resolution at a later meeting.

“The city of San Gabriel embraces our immigrant communities. If the message becomes ‘Come to San Gabriel and get deported,’ it would be devastating to our community and to our businesses,” Pu said.

Harris said the partnership with Homeland Security Investigations was designed to fight crimes, not deport immigrants. Contributing an officer to an HSI task force allowed the department to access federal databases, among other resources.

Councilman John Harrington voted against canceling the agreement and accused other council members of playing politics.

“This sends the message that politics are more important than residents’ safety,” Harrington said.

The news of the agreement was met with alarm in San Gabriel.

Advocacy groups and residents chanted slogans and waved signs before the Tuesday night meeting, which was so crowded that the city was forced to relocate it from City Hall to the nearby San Gabriel Mission Playhouse.

San Gabriel’s agreement was one of dozens that Immigration and Customs Enforcement officials have struck with local agencies across Southern California, including jurisdictions as small as Monterey Park and as large as the Los Angeles County Sheriff’s Department.

The documents lay out terms for information-sharing, compensation for labor costs and, in some cases, the designation of a local police officer to work on a task force with Homeland Security Investigations, ICE’s criminal investigations arm.

But California’s new “sanctuary state” law largely prohibits the use of local funds and personnel on both criminal and civil immigration enforcement.

Jurisdictions around the state are scrutinizing these agreements and other local collaborations with ICE — and in some cases canceling them.

Pasadena city leaders recently voided an agreement signed by Police Chief Phillip L. Sanchez, saying that it required the signature of the city manager.

Santa Monica also canceled its Police Department’s arrangement with ICE in a letter from the city manager last year, citing concerns about “implied or inadvertent involvement in civil immigration enforcement by the SMPD.”

Oakland city leaders canceled their agreement with ICE after activists learned that two Oakland police officers had stopped traffic during a raid that resulted in the arrests of two people. One was placed in deportation proceedings. Federal officials said the operation was targeting a human trafficking ring, but no criminal charges have been filed.

In Santa Cruz, a criminal investigation targeting gang members also brought about the arrests of several non-gang members for immigration violations. The city police chief, Kevin Vogel, said he was never informed about the possibility of collateral arrests.

“They misled my department as to the actual scope of the operation. I feel like I was lied to,” Vogel said.

ICE officials said they told Vogel that collateral arrests of non-gang members could occur during the operations several days before the raids, which Vogel disputes.

Though Santa Cruz had no agreement with ICE, Vogel warned other police departments to clarify the terms of their cooperation with ICE up front.

“I’m not in a position to tell authorities which laws to enforce,” said Vogel, a 30-year veteran of the Santa Cruz Police Department who retired in June. “But you have to be straight with me if you’re going to come into my city for an operation.”

A detective in San Gabriel has been assigned to an HSI task force since June. The group has arrested two people it says were posing as immigration attorneys in order to charge exorbitant fees for fraudulent legal services. It has also investigated a counterfeit driver’s license and passport operation, and is looking for the owners of 30 Chinese passports discovered in a package.

These cases are typically too small to draw the attention of state and federal law enforcement agencies but too complicated for local police departments to handle with their own resources, Harris said.

Police departments and immigration authorities say these partnerships are strictly for criminal investigations.

But advocates say it may be impossible to ensure these partnerships won’t include what the Trump administration has called “collateral arrests,” or arrests of immigrants who are in the country illegally but are not the target of criminal investigations.

“Even if the original intent is to investigate a crime, if they find neighbors, bystanders that they believe are removable, they will also arrest and detain them,” said Angela Chan of Advancing Justice — Asian Law Caucus, a coauthor of Senate Bill 54, the sanctuary state bill.

Of the 111,000 immigration arrests reported by ICE between Jan. 20 and Sept. 30 of last year, about 8% were collateral arrests. And last year, ICE’s acting director, Thomas Homan, warned that more collateral arrests might be one result of California’s passing a sanctuary state bill.

Agreements like San Gabriel’s, immigrant rights advocates say, often are broadly worded and rarely include any mention of collateral arrests or consequences for violating the agreement, said Ana Muñiz, assistant professor of criminology at UC Irvine.

“On one hand, ICE and HSI can technically comply with agreements, but on the other hand, there are rhetorical and technical loopholes,” Muñiz said.

Police officers working with HSI task forces are “not authorized” to arrest people for administrative violations of immigration law, said Jennifer Reyes, assistant special agent in charge for Homeland Security Investigations Los Angeles. But immigration officers working on HSI task forces have no such restrictions.

“HSI special agents, however, have the authority to make administrative arrests during criminal investigations as part of enforcing our nation’s laws,” Reyes said.

Harris said he thinks proper oversight of joint operations with immigration authorities could ensure that no local resources are used to enforce immigration law.

Federal, state and local agencies work together to emphasize that public safety is a shared goal across all law enforcement agencies, Harris said.

But cities are increasingly wary of the perception of endorsing the Trump administration’s immigration policies. And some city leaders, like Pu, don’t see ICE and HSI as trustworthy law enforcement partners.

“The bottom line is, you just can’t trust ICE during the Trump administration,” Pu said.”

Declaring  “open season” on law-abiding undocumented members of the community (treating them basically the same as criminals and gangsters) and picking fights with local officials is one of the dumbest “law enforcement” strategies I could imagine. Even after the “Trumpsters” eventually depart, ICE might never be able to re-establish trust and credibility in many communities.

“House Democrats face choice over budget deal

As lawmakers announced a budget deal that would address many of the issues stymieing Washington — with the key exception of immigration — House Democrats on Wednesday were feeling the heat.

Minority Leader Nancy Pelosi took to the House floor Wednesday to warn she would not support the burgeoning deal without a commitment from House Speaker Paul Ryan that the Republican-controlled House would hold a debate and vote on immigration legislation as his Senate counterpart Mitch McConnell has pledged, setting up a potential standoff.

The two-year deal that leadership announced on the Senate floor would set domestic and defense spending levels, push back the debt limit and resolve some outstanding issues Democrats have pushed for like support for community health centers and disaster relief money.

But left out of the deal would be a resolution for the Deferred Action for Childhood Arrivals policy that Trump is ending — and House Democrats have long been steadfast they would not support government funding without it.

The Senate is close, nevertheless, to sending the deal to the House with a continuing resolution that would fund the government into March, squeezing Democrats to risk rejecting a budget compromise over DACA alone, a position they have actively sought to avoid. Democratic votes in the House haven’t been necessary to pass continuing resolutions this year, but a number of House conservatives are expected to oppose the budget deal because of the domestic spending levels. That will force Democrats’ hand.

“The budget caps agreement includes many Democratic priorities,” Pelosi said in a statement. “This morning, we took a measure of our caucus because the package does nothing to advance bipartisan legislation to protect Dreamers in the House. Without a commitment from Speaker Ryan comparable to the commitment from Leader McConnell, this package does not have my support.”

Some Democrats were already backing up Pelosi as the deal was announced Wednesday afternoon.

California Rep. Eric Swallwell said while he supports a DACA fix, his concern was more about the size of the deal.

“I still have a real problem dramatically increasing the caps, adding to the deficit, when we just added $2 trillion for the tax plan. So if (Republicans) want to roll back their tax cuts so that we don’t have such a deep, deep deficit, I would be more receptive to that,” Swallwell said.

Congressional Hispanic Caucus member and California Democratic Rep. Nanette Diaz Barragán said Democrats should not accept a funding deal without what they’ve asked for.

“No, I think that we aren’t using all the leverage we have and that’s a disappointment and I won’t support it,” she said. “We as a caucus have talked about making this one of our leverage points and using this as a leverage point. I hope that we continue to do that.”

But the objection wasn’t universal, and the mood in a House Democrat caucus meeting this morning that convinced Pelosi to speak on the floor was split, according to a Democrat in the meeting. Some were “understandably upset” about not including DACA recipients and there was “generally a lot of frustration.”

But others raised questions, asking, “What is our plan? What is our message? How are we going to win this?” After the last shutdown members are still unclear on the path forward and expect the Senate to pass this, leaving them little room. The source said there is a lot in the deal that many Democrats support, including the increase in domestic programs.

This source told CNN “a lot of people are going to vote for it. It’s not a situation where we can hold all our members.”

It’s unclear if Democratic leadership will whip against the bill. Asked Wednesday if leadership is instructing its members any particular way, House Democratic Caucus Chairman Joe Crowley demurred.

“People in our caucus will do what they think is in the best interests of their constituents and for the country,” Crowley said.

And Crowley didn’t commit to supporting or rejecting the deal.

“There is more to this deal than the issue of immigration,” he said, referencing the disaster relief money, in particular. “It is very complex. This There? is much more to this than simply one-off issues. And we’ll have to look at that in totality.”

Unlike recent past government funding deadlines, House Democrats have been holding their fire in pressuring their Senate colleagues to reject a deal that doesn’t address DACA. That has largely been because of McConnell’s promise to turn to a “fair” process on immigration after February 8, when the deadline comes.

“It’s hard, because we want them to be clear that this is reckless by the Republicans, but we are also clear that they want to keep the Senate and Congress moving so they have an opportunity, not just at getting a full year (funding) — stop doing (continuing resolutions) — but also to deal with other issues including DACA, by getting a vote on something,” said on Tuesday.

The Congressional Hispanic Caucus has been one of the loudest voices for rejecting funding without an immigration deal, even marching from the House side to Senate Minority Leader Chuck Schumer’s office in December to urge him to hold the line. That pressure isn’t there this time.

“I don’t sense any,” said Arizona Democratic Rep. Raul Grijalva, a member of the caucus. But, he added, there’s “some trepidation” about the Senate process because of what could be added to a neutral bill — both in the Senate and the House.

“This has been the black hole for immigration, the House of Representatives, since I’ve been here, 15 years, and nothing comes out of here, and whatever goes to conference, if the House leadership has any say, it will get uglier,” Grijalva said.

But while Democrats were keeping their powder dry on a continuing resolution, as talk of the caps deal being near circulated, one Democratic House member said on condition of anonymity to discuss dynamics, that began to change. Tuesday night and Wednesday morning brought a flurry of communications between members, the lawmaker said.

“There is more support than yesterday on holding the line,” the member said Wednesday. “We shouldn’t negotiate the caps away without a DACA fix.”

I can’t see any “Bipartisan Dreamer Bill” along the lines being discussed in the Senate that will be able to pass the House as long as the GOP is in charge and Paul Ryan is the Speaker.

I also don’t see a “House Dreamer Bill” passing. The “Goodlatte Bill” — favored by many in the GOP –is so miserly in its Dreamer protections and has so much of the Administration’s White Nationalist restrictionist agenda attached that all or almost all Democrats and probably a “good-sized chunk” of “moderate” Republicans are likely to be able to defeat it.

But, while the Democrats and the GOP moderates in the House might be able to come up with a more reasonable proposal that actually could pass, like the Hurd-Aguilar Bill, under the “Hastert Rule,” Speaker Ryan won’t bring it to the floor for a vote because the bill would rely on a majority of Democrats for passage.

Given the foregoing scenarios, I don’t see where forcing another shutdown gets the Democrats. With the GOP and the White House opposed to including a narrower “Dreamers-Border Security Only” (only two of Trump’s “four pillars”) in a Budget Agreement, there isn’t a feasible “end game” for the House Democrats. They could force a shutdown, but I don’t think they will be able to force the GOP to include Dreamer protection in a Budget deal. So, ultimately, they will have to “fold,” as has happened in the past.

So, what’s the best result I could see for the “Dreamers” right now: 1) eventually getting a “temporary extension” of DACA from Congress, or  2) an “indefinite hold” on DACA recision from the Federal Courts (which wouldn’t preclude the Administration from going through a “Notice and Comment” regulatory process to repeal DACA). Either of those would only help those who qualify for the current DACA program — not the “expanded DACA” group. Either way, permanent relief for the Dreamers is likely to require “regime change” at least at some level.

“The earliest, highest-profile critic of granting an executive reprieve to Dreamers was none other than Justice Antonin Scalia. The plight of young immigrants brought to the United States as children was not something the Supreme Court was concerned with in 2012, but the late justice somehow felt the need to protest, in open court, President Obama’s then weeks-old decision to not deport them for humanitarian reasons. “The president has said that the new program is, quote, the right thing to do, close quote, in light of Congress’ failure to pass the administration’s proposed revision of the immigration laws,” he said as he read from a summary of his partial dissent in Arizona v. United States. That case and decision had nothing to do with Dreamers.

Maybe Scalia’s real qualm was with the sitting president and not the recipients of the Deferred Action for Childhood Arrivals program, better known as DACA. But his broader point, which a Supreme Court majority rejected, was that states should have leeway in enforcing federal immigration laws, since they — and not undocumented immigrants — face the “human realities” of a broken immigration system. The citizens of border states like Arizona “feel themselves under siege by large numbers of illegal immigrants who invade their property, strain their social services, and even place their lives in jeopardy,” Scalia complained. Somewhere, a future President Trump may have been taking notes.

More than five years since that screed, the Supreme Court could soon get a chance to judge the propriety, if not the legality, of Trump’s decision last September to pull the plug on DACA. A federal judge in California in January ordered the reinstatement of the program, reasoning that its rescission rested on a “flawed legal premise” — namely, Jeff Sessions’s paper-thin conclusion that DACA was illegal the moment it was conceived. The judge also rejected as “spin” and “post-hoc rationalization” the Trump administration’s contention that DACA was vulnerable to a legal challenge by Texas and other states, which had threatened Sessions with a lawsuit if he didn’t kill the initiative outright. “The agency action was not in accordance with law because it was based on the flawed legal premise that the agency lacked authority to implement DACA,” wrote the judge, William Alsup, in a ruling that effectively brought DACA back from the dead. Days later, the administration began accepting renewal applications as if the rollback had never happened.

Legal scholars weren’t impressed with the ruling. And Sessions, not one to give up on Trump’s anti-immigrant crusade, then took the “rare step” of appealing Alsup’s decision directly to the Supreme Court — and why not? The Ninth Circuit, Trump’s least favorite appeals court, is unruly, liberal, and anti-Trump, anyway; leapfrogging it seemed the smart thing to do. What’s more, Sessions wanted the justices to act expeditiously — his solicitor general filed an additional request to decide the case before the end of June. Not doing so, he suggested, would be the same as blessing “indefinitely an ongoing violation of federal law being committed by nearly 700,000 aliens.” So much for Trump’s wish to treat Dreamers “with heart.” There was only one problem: The Supreme Court rarely, if ever, lets anyone skip over the regular appeals process. And if Sessions is in such a hurry, why didn’t the administration seek to block Alsup’s ruling rather than comply with it? Last Friday, a coalition that includes the University of California, several states, a local chapter of the SEIU, and a number of Dreamers told the Supreme Court to reject the Trump administration’s request to hear the case. The DACA mess, this alliance broadly contended, is Trump’s and Congress’s to own, and the justices shouldn’t be the ones fixing it, at least not with the urgency Sessions is demanding.

The principle of prosecutorial discretion, which is what holds DACA together, was never once discussed by Sessions when he announced the wind-down of DACA. He didn’t even try. Prosecutorial discretion wasn’t some novelty that Napolitano came up with at the time, let alone a quirk of immigration law. In a path-breaking memorandum written some 40 years ago, Sam Bernsen, the general counsel of the now-defunct Immigration and Naturalization Service, advised the agency’s commissioner that the “ultimate source for the exercise of prosecutorial discretion” lies with the inherent powers of the presidency. “Under Article II, Section 1 of the Constitution, the executive power is vested in the President,” Bernsen wrote in what is believed to be the first in a long string of government memos justifying prosecutorial discretion in the immigration realm. “Article II, Section 3, states that the President ‘shall take care that the laws be faithfully executed.’” Ironically, conservatives would later seize on this “take care” language to argue breathlessly that Obama’s immigration actions were an affront to the constitutional text, but no judge took that argument seriously.

Far and wide, executive officers enjoy similar discretion to enforce the law. From the president down to a lowly street cop, every law enforcer, state or federal, exercises some form of prosecutorial discretion over the laws they’re entrusted to oversee. It’s the reason you don’t always get ticketed for jaywalking or pulled over for doing 65 on a 55, even in instances where you happen to do those things in full view of the police: The government has ample discretion to not go after you if it feels you’re a low-priority lawbreaker. Maybe the 75-miles-per-hour driver is the bigger fish. Whichever the case, the decision is, by and large, unchallengeable. “Federal officials, as an initial matter, must decide whether it makes sense to pursue removal at all,” wrote Justice Anthony Kennedy in the same immigration ruling that Scalia assailed in 2012. “Discretion in the enforcement of immigration law embraces immediate human concerns,” he added.

Kirstjen Nielsen, the new DHS secretary, and Trump himself have all but conceded the point in recent weeks. In an interview with CBS’s John Dickerson, Nielsen said that it’s “not the policy of DHS” to go after Dreamers who are DACA recipients, even if the current legislative talks fail and the program isn’t renewed. “It’s not going to be a priority of the Immigration and Customs Enforcement to prioritize their removal,” Nielsen clarified, directly contradicting the Department of Justice’s position on DACA before the Supreme Court. (Dreamers and immigration advocates know better than to trust Nielsen’s assurances.) Asked last month if he might extend the arbitrary March 5 end date of the DACA rollback process — which is no longer the end date as a result of Judge Alsup’s ruling — Trump spoke as if he never truly believed, like Sessions did, that deferred action was unlawful: “I certainly have the right to do that if I want.”

In this climate, and with Trump still fielding immigration offers as Congress faces yet another deadline to fund the government, the Supreme Court would be crazy to jump into the DACA controversy. “I think for the Supreme Court to reach down to a district court decision and not allow the normal appellate process to proceed would necessarily, under the circumstances, involve or indicate that the Supreme Court is signaling its involvement in a deeply political matter,” Napolitano told me. Scalia may have felt comfortable criticizing policy choices from the bench, but that doesn’t mean Chief Justice John Roberts and his colleagues have to take the bait. For their own peace of mind and that of Dreamers, the Court is better off staying as far away as possible, and letting Trump take care of the laws that give him broad authority to spare young undocumented immigrants if he really wants to.”

“President Trump’s proposal to cut legal immigration rates would delay the date that white Americans become a minority of the population by as few as one or as many as five additional years, according to an analysis by The Washington Post.

The plan, released by the White House last month, would scale back a program that allows people residing in the United States to sponsor family members living abroad for green cards, and would eliminate the “diversity visa program” that benefits immigrants in countries with historically low levels of migration to the United States. “Even as President Donald Trump has led the most prolonged and public attack on the Justice Department in history, Attorney General Jeff Sessions has broken a long tradition of those in his position of protecting the institution from such interference by remaining largely silent, The New York Times reported Monday.

“What is unusual is the FBI and the Justice Department being attacked, the president leading the charge and the attorney general missing in action,” said Harvard Law Prof. Jack Goldsmith, who headed the Justice Department’s Office of Legal Counsel under President Geoerge W. Bush. “Why isn’t he sticking up for the department?”

Many prosecutors say Sessions’ tepid response is deflating morale among department employees and has increased fears prosecutors cannot depend on protection from political interference.

“Attorneys general swear an oath to protect and defend the Constitution, not the president,” said Matthew Axelrod, a former Justice Department official who is a partner at Linklaters. “Institutions like the DOJ rely on their leaders to be a voice that defends them. It’s critically important to this institution that its leadership have its back.”

Although the Business Insider reported Sessions did praise his second-in-command Rod Rosenstein hours before the disputed Devin Nunes memo was released Friday by saying he represents “the kind of quality and leadership we want in the department” and he had “great confidence in the men and women of this department,” many commentators said that backing was quite meager when he added, “But no department is perfect.”

One such previous example often cited of far more courageous and strong backing is when ailing attorney general John Ashcroft from his hospital bed allowed his acting replacement, James Comey, to defy the Bush administration over a surveillance program that Justice Department lawyers had called unconstitutional.

Sessions, who has been heavily and publicly criticized by Trump in the past year, declined to comment to the Times.

“Sessions’ silence is evidence that Trump’s public neutering of anyone close to this investigation is working,” said Paul Pelletier, a Democratic candidate for Congress in Virginia who was a long-time federal prosecutor. “It is deleterious to the whole criminal justice process.”

The law enforcement community might have thought that they were getting a strong defender/advocate in the right-winger Sessions. After all, he’s out to bust those recreational legalized marijuana users and hard-working maids and janitors who have been in the U.S. without documents for decades waiting for the immigration reform that never came because he helped block it in the Senate.

But, what they actually got was a disingenuous “Gonzo Apocalypto” White Nationalist interested primarily in advancing his racially inspired agenda at the expense of the U.S. justice system and anyone who might stand in the way. Oh yeah, and a guy who is also very interested in “covering his own tail.” That’s why he didn’t hesitate to hire DC Lawyer Chuck Cooper to defend him once his continuing “memory lapses” came to light in the Russia investigation and things started “hitting the fan.”

A guy with no time for the rights of African-Americans Latinos, Immigrants, LGBTQ Americans, women, or apparently his subordinates and employees at the DOJ seems to have an excellent sense of his own rights and self-preservation. And, he isn’t so silent when it comes to an opportunity for slandering and diminishing the achievements of DACA recipients, Immigrants, sanctuary cities, asylum seekers, or people of color who are supposed to be entitled to justice and protection from his more or less “Whites only” DOJ.

Despite fight in Congress over immigration, the DACA deadline is up in the air

When President Donald Trump ended the Deferred Action for Childhood Arrivals policy, he created a March 5 deadline for protections to end, designed to give Congress time to act to save the program.

But while lawmakers have continued to use the March 5 date as a target, court action and the realities of the program have made any deadline murky and unclear.

As a result, there currently is no date that the protections will actually run out for the roughly 700,000 DACA recipients, young undocumented immigrants who came to the US as children — but there remains a large amount of uncertainty about whether they could disappear at any time.

Trump himself mentioned the March 5 deadline in a tweet Monday.

“Any deal on DACA that does not include STRONG border security and the desperately needed WALL is a total waste of time. March 5th is rapidly approaching and the Dems seem not to care about DACA. Make a deal!”

The original plan proposed by Trump in September was that the Department of Homeland Security would phase out DACA by letting the two-year protections and work permits issued under the program expire without the option to renew them. But the administration allowed anyone with permits that expired before March 5 a one-month window to apply for a renewal, which would reset their two-year clock.

However, 20,000 of the 150,000 eligible to renew didn’t. They were either rejected, unable to pull together the paperwork and $500 fee, or unwilling to trust the government with their personal data and enroll again. Further complicating things, some of those rejections were later reopened after DHS acknowledged that thousands may have had their applications lost in the mail or delivered on time but rejected as late.

Then, in January, a federal court judge issued an order stopping the President’s plan to phase out DACA, and DHS has since resumed processing applications for renewals for all the recipients who had protections in September.

But the administration has also aggressively sought to have the judge’s ruling overturned by a higher court, including the Supreme Court, only adding uncertainty to the situation. If a court were to overturn the judge’s ruling, it could have several outcomes, including letting renewals processed in the interim stand, invalidating all of those renewals or even ending the whole program immediately.

McConnell holds all the cards on next week’s immigration debate, and he’s not tipping his hand

In a week the Senate is supposed to debate and vote on major immigration legislation for the first time in years — and only one person might know what it will look like: Senate Majority Leader Mitch McConnell.

“That, you’d have to check with the leader on,” said Sen. Cory Gardner, R-Colorado, Monday about the process as he left a GOP Senate leadership meeting.

“You’ll have to ask him,” echoed fellow leadership member Sen. John Thune of South Dakota. “He’ll have to decide what he wants to do.”

“Sen. McConnell hasn’t announced his intention,” Majority Whip John Cornyn told reporters.

Lawmakers of both parties told reporters Monday repeatedly they had no idea what the legislation or the process they’d be voting on likely next week would look like.

McConnell promised to turn to immigration on the Senate floor after February 8, the next date that government funding runs out, if broad agreement couldn’t be reached in that time. The promise, which he made on the Senate floor, was instrumental in ending a brief government shutdown last month, with senators of both parties pointing to the pledge for a “fair” floor debate as a major breakthrough.

The reality is, though, that McConnell has a lot of discretion as to how such a vote could go — and as of now, he has not given many clues.

Even in a meeting with White House chief of staff John Kelly, Homeland Security Secretary Kirstjen Nielsen and White House legislative director Marc Short, a source said McConnell “wouldn’t indicate what he’s going to do.”

“Total poker face,” the administration official said. “He’s not going to tip his hand.”

But the group came for the meeting, the official said, to “make sure he hears from the administration.”

On Monday, lawmakers expressed hope that such a deal could come together before the Thursday funding deadline, but wouldn’t call it likely. That tees up a vote next week with an uncertain end.

“Probably if nothing is agreed on this week, which I would not be optimistic will happen, then Mitch’ll call up some bill next week and let everyone get their votes on their amendments and see where it goes,” Thune said. “My assumption is that in the end, something will pass. But I guess we’ll see.”

McConnell’s choices will be instrumental in deciding how the debate goes, lawmakers and experts say, and he has a number of options on how to proceed, from the base bill, to the amendment process.

“There’s a lot of different conversations that continue, I don’t think anyone has narrowed it down to one, two or even three paths at this point,” Gardner said.

Utah Sen. Orrin Hatch, the longest-serving GOP senator, was the only lawmaker who seemed to know how the debate would look.

“I have a pretty good sense. I’ve been through it a hundred times,” he said, laughing. Asked if that meant a mess, he added, still chuckling: “It’s always a mess.”

Washington (CNN)President Donald Trump on Tuesday said that it was “disgraceful” that an NFL player was killed by a man who police believe is an undocumented immigrant in a suspected drunk driving accident over the weekend.

“So disgraceful that a person illegally in our country killed @Colts linebacker Edwin Jackson. This is just one of many such preventable tragedies. We must get the Dems to get tough on the Border, and with illegal immigration, FAST!” Trump tweeted.
Indianapolis Colts linebacker Edwin Jackson and another man were struck and killed in a suspected drunken driving accident early Sunday morning. Indiana State Police say the man they believe hit them is an undocumented immigrant who has been deported twice.
“My prayers and best wishes are with the family of Edwin Jackson, a wonderful young man whose life was so senselessly taken. @Colts,” Trump said in a second tweet Tuesday morning.
The crash occurred when Jackson and the other man were struck on the shoulder of Interstate 70 in Indianapolis.

“A federal judge in Newark on Friday issued a temporary restraining order halting the deportations of two Indonesian Christians taken into custody last week while they were dropping their daughters off for school.

U.S. District Judge Esther Salas issued the order after the ACLU went to court, arguing that the summary deportation of the men violated their due process and deprived them of the opportunity to argue their case for asylum.

“These community members, our neighbors, are entitled to argue their case with the protections of due process, especially when the stakes are life-and-death,” said ACLU-NJ Executive Director Amol Sinha.

Gunawan Liem of Franklin Park and Roby Sanger of Metuchen, who both had pending removal orders, were arrested a week ago without warning by U.S. Immigration and Customs Enforcement, as part of an increasingly aggressive enforcement effort by the Trump Administration targeting illegal immigration.

A third man, Harry Pangemanan, was not home when ICE agents showed up at his house and he sought sanctuary at the Reformed Church of Highland Park, where Rev. Seth Kaper-Dale has long been championing the cause of the Indonesian Christian community.

A federal judge in Newark on Friday issued a temporary restraining order halting the deportations of two Indonesian Christians taken into custody last week while they were dropping their daughters off for school.

U.S. District Judge Esther Salas issued the order after the ACLU went to court, arguing that the summary deportation of the men violated their due process and deprived them of the opportunity to argue their case for asylum.

“These community members, our neighbors, are entitled to argue their case with the protections of due process, especially when the stakes are life-and-death,” said ACLU-NJ Executive Director Amol Sinha.

Gunawan Liem of Franklin Park and Roby Sanger of Metuchen, who both had pending removal orders, were arrested a week ago without warning by U.S. Immigration and Customs Enforcement, as part of an increasingly aggressive enforcement effort by the Trump Administration targeting illegal immigration.

A third man, Harry Pangemanan, was not home when ICE agents showed up at his house and he sought sanctuary at the Reformed Church of Highland Park, where Rev. Seth Kaper-Dale has long been championing the cause of the Indonesian Christian community.

“State of the Union on Tuesday night, “one that admits people who are skilled, who want to work, who will contribute to our society, and who will love and respect our country.”

The president and his allies claim such an immigration policy would promote cohesion and unity among Americans “and finally bring our immigration system into the 21st century.” Far from forward-facing, however, the president’s policies evoke the beginning of the 20th century, when war abroad and opportunity at home brought waves of immigrants to the United States, from Italians, Polish, and Russians to Chinese and Japanese. Their arrival sparked a backlash from those who feared what these newcomers might mean for white supremacy and the privileged position of white, Anglo-Saxon Americans. Those fears coalesced into a movement for “American homogeneity,” and a drive to achieve it by closing off America’s borders to all but a select group of immigrants. This culminated in 1924 with the Johnson-Reed Act, which sharply restricted immigration from Southern and Eastern Europe and all but banned it from much of Asia.

Members of the Trump administration have praised the Johnson-Reed Act for its severe restrictions on who could enter the country, and the act’s history helps illuminate what exactly Trump means when he says he wants to put “America first.”

The cohesion Trump espouses isn’t national or ideological. It is racial. The fight over immigration isn’t between two camps who value the contributions of immigrants and simply quibble over the mix and composition of entrants to the United States. It is between a camp that values immigrants and seeks to protect the broader American tradition of inclusion, and one that rejects this openness in favor of a darker legacy of exclusion. And in the current moment, it is the restrictionists who are the loudest and most influential voices, and their concerns are driving the terms of the debate.

At the heart of the nativist idea is a fear of foreign influence, that some force originating abroad threatens to undermine the bonds that hold America together. What critics condemned as “Know Nothing-ism” in the 19th century, adherents called Americanism. “The grand work of the American party,” said one nativist journal in 1855, “is the principle of nationality … we must do something to protect and vindicate it. If we do not, it will be destroyed.”

In the first decades of the 20th century, the defense of “the principle of nationality” took several forms. At the level of mass politics, it meant a retooled and reinvigorated Ku Klux Klan with a membership in the millions, whose new incarnation was as committed to anti-immigrant, anti-Catholic, and anti-Semitic politics as it was to its traditional anti-black racism. In Behind the Mask of Chivalry: The Making of the Second Ku Klux Klan, historian Nancy MacLean notes how Georgia Klan leader William Joseph Simmons warned his followers that they were, in his words, “being crowded out by a “mongrel population … organized into Ghettos and Communistic groups … and uplifting a red flag as their insignia of war.” Likewise, Klan leaders and publications blasted Catholic immigrants as “European riff-raff” and “slaves of ignorance and vice” who threatened to degrade the country at the same time that they allegedly undermined native-born white workers. When, in 1923 and 1924, Congress was debating the Johnson-Reed Act, the Klan organized a letter-writing campaign to help secure its passage, turning its rhetoric into political action.

At the elite level, it meant the growth of an intellectual case for nativism, one built on a foundation of eugenics and “race science.” Prominent scholars like Madison Grant (The Passing of the Great Race) and Lothrop Stoddard (The Rising Tide of Color Against White World Supremacy) penned books and delivered lectures across the country, warning of a world in which “Nordic superiority” was supplanted by those of so-called inferior stock. “What is the greatest danger which threatens the American republic today?” asked eugenicist Henry Fairfield Osborn in the preface to Grant’s book. “I would certainly reply: The gradual dying out among our people of those hereditary traits through which the principles of our religious, political and social foundations were laid down and their insidious replacement by traits of less noble character.” The aim of the nativists was to preserve those traits and admit for entry only those immigrants who could fully and easily assimilate into them.

It is true that there are some more moderate restrictionists in the mix, for whom the drive to reduce legal immigration is driven by concern and prudence—concern over immigration’s impact on wage and employment, especially among the country’s working-class citizens, and prudence regarding our ability to assimilate and absorb new arrivals.

The facts do not support these misgivings. Low-skilled immigration does more to bolster prospects for working-class Americans—providing complementary employment to construction and farm labor—than it does to lower wages. Likewise, immigrants to the United States have shown a remarkable capacity for assimilation, quickly integrating themselves into the fabric of American life by building homes, businesses, and families. To the extent that native-born workers need protection, it’s best provided by stronger unions and more generous support from the government.

But those moderate voices aren’t setting the agenda. Instead, it’s the hardliners who have used their initiative to inject nativism into mainstream politics and channel, in attenuated form, the attitudes that produced the 1924 law. President Trump, for example, ties Hispanic immigrants to crime and disorder, blaming their presence for gang violence. He attributes terror attacks committed by Muslim immigrants to the “visa lottery and chain migration” that supposedly allows them unfettered access to American targets. And in a recent meeting with Democratic and Republican lawmakers, Trump disparaged Haiti and various African nations as “shitholes” (or “shithouses”) whose immigrants should be turned away from the country in favor of those from European countries, like Norway. It’s unclear if Trump is aware of Rep. Albert Johnson, who spearheaded the 1924 immigration law. But in his racial ranking of immigrants, the president echoed the congressman’s sentiments. “The day of unalloyed welcome to all peoples, the day of indiscriminate acceptance of all races, has definitely ended,” proclaimed Johnson on the passage of the bill that bore his name.

The president isn’t alone in his views. Before joining the Trump administration, former White House adviser Stephen Bannon openly opposed nonwhite immigration on the grounds that it threatened the integrity of Western nations. And while Bannon has been exiled from Trump’s orbit, that legacy lives on. Stephen Miller, who is now the driving force behind immigration policy in the Trump administration, is a notorious hardliner who has echoed Bannon’s views, bemoaning the number of foreign-born people in the United States.

Miller is the former communications director for and protégé of Jeff Sessions, who as Alabama’s senator praised the Johnson-Reed Act and its restrictions on foreign-born Americans. “When the numbers reached about this high in 1924, the president and Congress changed the policy, and it slowed down immigration significantly,” Sessions said in a 2015 interview with Bannon. “We then assimilated through the 1965 and created really the solid middle class of America, with assimilated immigrants, and it was good for America.”

As attorney general, Sessions has leaned in to these views. “What good does it do to bring in somebody who’s illiterate in their own country, has no skills, and is going to struggle in our country and not be successful?” said Sessions during a recent interview on Fox News. “That is not what a good nation should do, and we need to get away from it.” Rep. Steve King of Iowa, a staunch defender of Trump, is especially blunt in his defense of hardline immigration policies. “Assimilation, not diversity, is our American strength,” he said on Twitter last year.

Assimilation in those middle decades of the 20th century was built, to a considerable extent, on racial exclusion. It was assimilation into whiteness, one which bolstered and preserved the racial status quo. There’s no return to the America of that era, but one could slow the nation’s demographic transition. The White House proposals for immigration reform seem designed to do just that. According to an analysis from the Cato Institute, President Trump’s framework for immigration would slash entries by 44 percent, excluding almost 22 million people from the United States over the next 50 years. And in an analysis tied to the “Securing America’s Future Act”—a House-produced bill which hews closely to what the president wants—the Center for Global Development finds that white immigrants would be twice as likely to attain entry into the United States than black and Hispanic ones, while a majority of Muslim and Catholic immigrants would be barred from the country. Couple these measures with voter suppression, a biased census, apportionment by citizenship, extreme gerrymandering, and the existing dominance of rural counties in national politics, and you can essentially rig the system for the preservation of white racial hegemony.

Immigration policy is inextricably tied to our nation’s self-identity. What we choose to do reflects the traditions we seek to uphold. In the 1920s, most Americans wanted a more homogenous country, and they chose accordingly. Forty years later, in the midst of the civil rights revolution and a powerful ethos of inclusion, Americans reversed course, opening our borders to millions of people from across the globe. In this moment, we have two options. We can once again take the path that wants to keep “America for Americans,” and which inevitably casts American-ness in ways circumscribed by race, origin, and religion. Or we could try to realize our cosmopolitan faith, that tradition of universalism which elevates the egalitarian ideals of the Founding, and which seeks to define our diversity of origins as a powerful strength, not a weakness to overcome.

STUPIDITY & CRUELTY BECOME TRADEMARKS OF TRUMP’S ICE – ONE FEDERAL JUDGE IN NY HAD ENOUGH – BLASTS POLICIES AS UNCONSTITUTIONAL!

“Donald Trump hasn’t created the massive “deportation force” he promised as a candidate for president. But he has done the next best thing—boosting, bolstering, and unleashing the Immigration and Customs Enforcement agency, giving it broad authority to act at its own discretion. The result? An empowered and authoritarian agency that operates with impunity, whose chief attribute is unapologetic cruelty.

Under President Obama, who ramped up immigration enforcement even as he sought to protect large categories of unauthorized immigrants from deportation, ICE was a controversial agency whose practices came under heavy scrutiny from activists and some fellow Democrats. But in the year since Trump’s election, ICE has become something far more sinister: a draconian force for harassing and detaining people who pose no threat to the United States or its citizens.

And in keeping with one of President Trump’s first executive orders, which drastically expanded who the federal government considered a priority for deportation, the most striking aspect of ICE under this administration has been its refusal to distinguish between law-abiding immigrants, whose undocumented status obscures their integration into American life, and those with active criminal records—the “bad hombres” of the president’s rhetoric.

Erasing that distinction is how we get the arrest and detention of Lukasz Niec, a Polish immigrant and green card holder who was brought to the United States as a young child. Last week, ICE agents arrested Niec at his home in Michigan, citing two misdemeanor convictions for offenses that were committed when he was a teenager, according to the Washington Post. Although one of the convictions had been scrubbed from his record, it can still be used to remove him from the country. A practicing physician, Niec now sits in a county jail, awaiting possible deportation.

Niec’s standing as an affluent professional makes him an unusual case. More typical is the plight of Jorge Garcia, a 30-year resident of the United States who was recently deported to Mexico after his arrest by ICE. Married with two American-born children, Garcia was brought to the country as a child. He was working to secure legal status when, following Trump’s election, he was ordered to leave the country. In a statement to CBS News, ICE explained that anyone violating immigration laws “may be subject to immigration arrest, detention and … removal from the United States.” Despite its ability to exercise discretion, ICE has opted for an indiscriminate approach to immigration enforcement, arresting and detaining unauthorized residents regardless of whether they pose a threat to the public.

In its drive to remove as many undocumented residents as possible, ICE has begun deporting immigrants who make routine check-ins to their offices, even if those people are simply awaiting visas or green cards that would allow them to stay. Vice News recounts the story of Andre Browne, a Barbados native married to an American citizen. At a recent check-in with ICE agents, he was “arrested and forced to surrender all personal belongings.” He was jailed and now faces deportation. Similarly, in Virginia, a mother of two, Liliana Cruz Mendez, was detained following her regular check-in with immigration officials. Her offense? A traffic misdemeanor.

ICE’s tactics can have life-changing effects, even when its targets are spared deportation. The New Yorker tells of Alejandra Ruiz, brought to the United States as an infant. Last March, she was arrested by ICE agents citing a deportation order issued when she was a toddler. She was shackled and sent to an immigrant-detention facility operated by a private-prison firm. Ruiz was eventually released—she had filed a motion to reopen her childhood case for asylum—but it came at the cost of her livelihood: She lost her job as a senior care worker.

In addition to these activities, ICE is ramping up its mass raids in an effort to spread paranoia and uncertainty in cities with large undocumented populations. The agency is deliberately targeting these “sanctuary cities,” hoping to compel cooperation with their newly aggressive enforcement operations. This is all part of a larger strategy to create an atmosphere of fear and desperation for unauthorized immigrants. It’s behind President Trump’s decision to rescind Deferred Action for Childhood Arrivals and end deportation protections for immigrants from Haiti and El Salvador. Vox’s Dara Lind describes it as “a combination of policy and messaging to keep the threat of deportation hanging over immigrants’ heads” meant to make sure “they don’t get too comfortable here because they could be taken at any minute.”

Anti-immigration hard-liners describe these incidents in the bloodless language of “immigration enforcement,” but that obscures the violence and trauma of what’s happening on the ground: ICE is whisking people away to jails or private prisons and then exiling them from their homes and communities with little chance of recourse or recompense. And the pace is only increasing. While the overall number of “border removals”—those caught trying to cross the border—dropped last year, as a result of economic trends and Trump’s hard-line policies, the proportion of “interior removals” undertaken by ICE increased. Most deportations still involve immigrants from a handful of Latin American countries, but “[t]he number of deportees from other nations rose 24 percent in Trump’s first year,” reports NPR.

The administration is still hoping to increase those efforts. A proposal released by the White House last week asked Congress to grant additional funds to hire more ICE agents as part of an overall increase in “border security” that would be effectively traded for a path to citizenship for more than 1 million Dreamers.

It will be up to Democrats to block those additional funds and, perhaps, to build a broader case against ICE and its tactics. Some high-profile Democrats, like Sen. Kamala Harris of California, have already publicly condemned the agency. “ICE raids across the country have torn mothers apart from their children. The raids lack transparency, spread fear, and harm public safety,” she said last year in a Facebook post. More recently, following a report that ICE was planning raids in retaliation to a new California law limiting cooperation between local law enforcement and federal immigration authorities, Harris said that such raids would be “an abhorrent abuse of power.”

Given the extent to which Democrats have helped build the architecture for today’s ICE, Harris’ statements—as well as similar ones by House Minority Leader Nancy Pelosi—may mark the beginning of a new and needed skepticism toward the agency. And if so, then the logic of their critique doesn’t just point toward reform—it points toward a fundamental rethinking of immigration enforcement and a move away from the authoritarianism of ICE as it exists.

What the country needs, in other words, is an honest discussion about whether ICE can be effectively reformed or if it must be abolished and replaced by an agency that can carry out its mission in a more effective and humane way.”

She blasted ICE’s actions in ordering Ragbir’s release to say good-bye to his family and wind up his affairs. Judge Forrest characterized ICE’s actions in detaining Ragbir as “unnecessarily cruel.”

Useless, counterproductive removals, waste of Government enforcement resources, irrationality, and unnecessary cruelty are, of course, at the heart of the Trump/Sessions/Miller immigration enforcement program. Certainly, the performance of ICE under Trump — not especially good at removing real criminals and threats or any other type of legitimate law enforcement — much better at busting minor offenders and law-abiding community members  and sowing terror in ethnic communities — provides a compelling argument that DHS does not need any additional enforcement agents.

Indeed, I have hypothesized that what Trump, Sessions, Miller, and the White Nationalists are really doing is building the DHS into an internal security police force that will be used against all of those the Administration fears or views as opponents of their “Totalitarian-Wannabe State.”

In the meantime, arbitrary use of force and calculated unnecessary cruelty are likely to remain staples of the DHS under Trump. That’s why ICE is fast becoming American’s most loathed, mistrusted, and unprofessional police force. Bouie might well be right. Assuming that America recovers from the Trump regime, unfortunately not necessarily a given, ICE might well need to be abolished and “replaced by an agency that can carry out its mission in a more effective and humane way.”

“IMMIGRATION AND CUSTOMS Enforcement, the federal agency whose deportation agents have been unshackled by the Trump administration, has intensified its efforts to such a degree that cruelty now seems no impediment to its enforcement decisions, and common sense appears to play a diminishing role.

Recent months have brought news of one senseless detention and deportation after another. From all appearances, the agency seems to have embraced the idea that it is just to sunder established families and separate immigrant parents from their U.S.-born children — even in cases involving garden-variety technical violations of immigration rules.

Yes, the Obama administration also deported some longtime residents who had committed no serious offenses, but its deportation efforts were focused on criminals. By contrast, detentions of immigrants with no criminal records more than doubled in the first year of President Trump’s administration — to 13,600 in 2017 from 5,498 in 2016. Evidently seized by a vainglorious notion of its mission, ICE too often discounts basic decency as a guiding tenet.

How else to explain the detention and imminent deportation of a 27-year-old Ohio man, arrested for driving without a license, who is the only means of financial support, and one of just two trained medical caregivers, for a 6-year-old paraplegic boy (who also happens to be a U.S. citizen)? How else to explain the deportation of a construction worker in Michigan, the father of 10- and 3-year-old U.S.-born boys, who provided critical help to police in Detroit in their investigation of a shooting?

How else to explain the airport arrest and deportation of a 22-year-old female college student from Spain, visiting the United States for a vacation at the invitation of a librarian at Oregon State University, on grounds that she would give Spanish lessons to the librarian’s young son for a few weeks — work for which she lacked the right visa? How else to explain the deportation of a 39-year-old landscaper living in the Detroit suburbs, a father and husband of U.S. citizens, who had lived in the United States since age 10 and whose record was so unblemished that it didn’t even feature a traffic violation? How else to explain the Israeli undergraduate at the University of California at San Diego, a “dreamer” studying legally in the United States, who was detained upon trying to cross back into the United States minutes after his roommate made a wrong turn on the highway, unintentionally driving into Mexico?

In its boilerplate communiques, the agency defends its actions by insisting that it prioritizes bona fide threats to national security and public safety but exempts no category of “removable alien” from enforcement. Which raises a question: Have discretion and humanity been dropped from the attributes that Americans can expect of their law enforcement agencies?”

In answer to the Post’s question: YES, thanks exactly what has been happening in America since the very beginning of the Trump regime — starting with the “Muslim Ban” and continuing with a consistent White Supremecist agenda! Many of us have been saying that all along!

We already have the “New American Gulag” — expanded “civil” immigration detention in substandard, potentially even deadly conditions, in obscure “out of sight, out of mind” locations. There, individuals, many deserving legal protection from the US under our laws, are denied fair access to counsel and railroaded out of the country in what essentially are “mock court” hearings conducted by “judges” controlled by notorious White Nationalist Jeff “Gono Apocalypto” Sessions.

Sessions and his minions encourage the judges to view individuals in removal proceedings as “production numbers, possible fraudsters, and potential terrorists,” rather than as vulnerable human beings deserving of fairness, respect, and due process.

To complement the “New American Gulag,” we now have the “New American Gestapo,” headed by Acting Chief ICEMAN Tom Homan. It’s an internal police force that operates without rules, rhyme, reason, or humanity — in other words arbitrary “Gonzo” enforcement intended to terrorize ethnic (primarily Latino) communities.

And, in case you haven’t read about it, ICE now has the capacity to electronically track the whereabouts and driving patterns of every license plate in America —- including YOURS! Of course they say that they will only use it for “legitimate” law Enforcement purposes.

But, for the “New American Gestapo” everything is “legitimate” — boundaries on law enforcement conduct and misconduct went out the widow when the Trumpsters crawled in. Remember, Gonzo essentially told local police forces he really didn’t care what they were doing to the civil rights of African-Americans and other minorities as long as they were enforcing the law and bringing crime rates down!

This is why ICE is well on its way to becoming the most hated, distrusted, and least respected police force in America.

“The defining moment of Jeff Sessions’s time as attorney general has been when he recused himself from oversight of the Russia investigation. That quickly led to the appointment of special counsel Robert S. Mueller III, who is now extensively probing President Trump. And by all accounts, it seriously strained Sessions’s relationship with Trump, who thinks Sessions should be protecting him and doing his bidding.

But there are increasing signs that Sessions has indeed done plenty of Trump’s bidding behind closed doors. And he’s done it on some dicey and very politically tinged issues — so much so that he made Trump’s second FBI director deeply uncomfortable with the whole thing.

The Post’s Devlin Barrett and Philip Rucker report that Sessions has pressured FBI Director Christopher A. Wray to get rid of his deputy Andrew McCabe, a holdover from James B. Comey’s FBI and favorite target for Republicans alleging bias in federal law enforcement. Some have reported that Wray even threatened to resign; The Post is reporting that he did not explicitly do so.

Here’s the meat of it all:

Sessions, Republican lawmakers and some members of the Trump administration have argued for weeks that Wray should conduct some kind of housecleaning by demoting or reassigning senior aides to his predecessor, Comey, according to people familiar with the matter. These people added that Sessions himself is under tremendous political pressure from conservative lawmakers and White House officials who have complained that the bureaucracy of federal law enforcement is biased against the president.

Trump has made no secret of his distaste for McCabe, even tweeting about it repeatedly after McCabe announced last month that he would soon retire, when he becomes eligible for full pension benefits. Trump’s tweets date back to the summer and have focused on McCabe’s wife’s run for the Virginia state legislature as a Democrat and ties to Hillary Clinton.

In other words, Trump has publicly stated his preference for Sessions to try to get rid of McCabe, and he has suggested Wray do it as well. Now we find out Sessions did indeed attempt it, and Wray resisted it.

But it’s only the latest evidence that Sessions and his Justice Department are taking specific actions that Trump has publicly urged, even as they, in some cases, risk looking like they are in service to Trump’s political goals.

The New York Times reported recently that a Sessions aide went to Capitol Hill last year seeking derogatory information about Comey at a time when Trump clearly had his eyes on firing Comey. (A Justice Department spokesman has denied this occurred.) There are also reports that the Justice Department is considering a revival of its investigation into Hillary Clinton’s emails, which Trump has repeatedly called for. And back in August, Sessions announced a ramped-up effort to root out leakers in the federal government — just days after Trump tweeted that Sessions had taken “a VERY weak position” on the issue.

(Remarkably, Trump actually hit Sessions for his weak positions on both leakers and Clinton’s emails in the same tweet. The Justice Department now appears to be addressing both.)

The Post’s Josh Dawsey and Matt Zapotosky even reported last month that Sessions has engaged in an all-out campaign to regain Trump’s faith by pointing to things the Justice Department has done in service of Trump’s agenda. That’s a pretty remarkable state of affairs.

Some of these things are issues on which Sessions has clearly sided with Trump, especially the dangers of leakers. So it’s perhaps no surprise Sessions would pursue them. But the fact that Trump called for these actions before Sessions was reported to have taken them sure makes it look like he’s taking direction from Trump — or at least succumbing to pressure that Trump and others have brought to bear.

Sessions has also, notably, resisted that pressure at times. During congressional testimony in November, he very publicly shunned a Republican lawmaker’s conspiracy theory — one to which Trump has also alluded — about how the federal government may have colluded with Democrats to spy on Trump’s campaign. Sessions said the issue didn’t rise to the level of appointing a special counsel.

But the picture of what Sessions is doing behind the scenes is increasingly suggesting that Trump’s very public hints that his attorney general should do this or that have often resulted in those specific actions. And especially when it comes to things such as trying to force out McCabe or reportedly dig up dirt on Comey, it sure makes it look like Sessions is using his authorities to try to address Trump’s political aims.

And for an attorney general who leads the federal law enforcement that is currently investigating the president and his team, that’s a perception problem, at best.”

Meanwhile “chatter” surrounding the DOJ credits Sessions for doing a “bang up” job of implementing his racist, White Nationalist agenda at Justice. Basically, according to some, he’s very effectively shifting the Government’s resources, focus, and litigating capacity to insuring  that no element of White privilege or far-Right religious intolerance goes unprotected.

At the same time, he’s using basically bogus or at least highly misleading “statistics” to “rev up” racist fervor against immigrant, primarily Latino communities and Democratic local officials who won’t go along with his program of attempting to draw false connections between immigrants and crime and terrorism. Meanwhile, he essentially has consigned the rights of African-Americans, Latinos, Immigrants, Migrants, Women who seek abortions, and the LGBTQ community to the “trash-bin of Justice.” Many who care about the future of racial equality and social justice in America are concerned that this type of “deep damage” to our justice system can’t easily be undone or repaired, even after Sessions and his “wrecking crew” finally depart the “Halls of Injustice.”

Reportedly, Sessions has been ably assisted in his campaign “to take the justice out of Justice” by Associate Attorney General Rachel B. Brand, the “number three” person at Justice. Brand, a former Assistant Attorney General for the Office of Legal Policy under Bush II, DOJ “vet,” and apparent “true believer” in the Radical Right, maintains a much “lower profile” than the ever controversial Sessions. But, apparently she and those under her excel at undoing and “deconstructing” all of the “social justice” achievements of the Obama Administration.

Following the “Watergate Disaster” in the 1970, where the Nixon Administration’s blatant politicization of the DOJ became a national scandal, succeeding Administrations, in my view, more or less “backed off” of obvious political partisanship at the DOJ. But, as Watergate becomes a “mere tiny image in the rearview mirror,” that “tradition of restraint” has gradually eroded. Sounds to me like the “Watergate Era” has basically returned to the DOJ. This time, and quite sadly for our Constitutional system of Government and the U.S. Justice System, there is some doubt as to whether it will ever depart again.

The Dreamers have won the hearts of most all Americans — across our political boundaries — whose country they joined when they were just children and who are clearly Americans too.

There is enormous public support for DACA (Deferred Action for Childhood Arrivals) from the American people. According to a poll released by CBS News last week, “nearly 9 in 10 Americans (87%) favor allowing young immigrants who entered the U.S. illegally as children to remain in the U.S.” This number includes 79 percent of Republicans, 92 percent of Democrats, and 87 percent of independents who favor the policy.

The DACA program, which is designed to shield from deportation undocumented Americans who were brought to this country by their parents, was established by President Obama in 2012 and ended by President Trump in September. Congress has tried and failed for the last 17 years to pass legislation that would formally confer legal status on these young men and women.

Because of President Trump’s decision, about 800,000 Dreamers currently protected by DACA will be at risk of deportation in early March unless Congress passes legislation and the president signs it by then. That’s why Democrats and some Republican members of Congress have felt such urgency to finally pass permanent legal protection for the Dreamers. Until the issue is resolved legislatively, it is likely to dominate the political debates in Washington in the weeks to come.

Dreamers are essential members of our communities. As politicians play games with their futures, it’s important that we share their stories. They are Dreamers like Mauricio Lopez-Marquez, who is 28 years old and was able to become a social worker after receiving DACA. In that role and as a dance instructor for an after-school program, he works with 180 young people in New Mexico. They are Dreamers like 22-year-old Teresa Rivera, who is a senior at the University of North Carolina at Chapel Hill and a part-time child facilitator at an organization that supports women and children who have experienced domestic violence. They are Dreamers like Zabdi Samuel Olvera, 18, who was brought from Mexico to Charlotte, N.C., at 6 months old, and is currently majoring in computer science at the University of North Carolina at Chapel Hill. Zabdi’s work with underprivileged children in South Charlotte and his excellence on his varsity wrestling team earned him a Golden Door Scholarship, which provides a full-tuition scholarship that is making it possible for him to earn his degree. If Congress does not pass legislation to protect the Dreamers by early March, these young men and women and so many more will be unable to work legally in the United States and could be vulnerable to deportation.

In 2012 many Dreamers had the opportunity to step out of the shadows and participate fully in the economy in ways that were previously impossible. They have done so, however, at great risk: In exchange for legal protection, they had to provide their personal information to the government. And now, unless Congress acts, the government could use that information to find and deport them. This is not a tenable moral or political position, and the public support for a permanent DACA fix reflects that. Americans understand that the Dreamers are our children’s teachers, they work in our communities, and they serve their country in all kinds of ways, including the military.

It is also undeniable that churches across the theological and political spectrum of American Christianity have been steadfast in support for the Dreamers. Even among white evangelicals, the base of Donald Trump’s support, 57 percent favor protection for Dreamers. This support comes from biblical commands about how we should treat “the stranger” among us, a religiously inspired sense of what is moral and just, and the fact that many Dreamers and their families are members of our church communities —and even our pastors. As I’ve written many times before, the biblical command to protect immigrants is unambiguous, and that certainly informs how many Christians approach this issue. But the human stories are perhaps even more influential in changing minds and hearts. Indeed, many churchgoers have discovered over the last five years that people they know well and care for deeply are undocumented because DACA gave them the incentive to step out of the shadows. Now, congregations all over the country are facing the possibility that many families in their midst will soon be torn apart. That is justifiably causing righteous outrage and determination for Christians all over the country to stand beside Dreamers and demand a solution from Congress.

Yet the problem, as it has been for many years, is to translate the strong public support for protecting Dreamers to actual policy change. The roughly 10-20 percent of Americans who do not support protecting the Dreamers in any way have long had a hugely outsized influence on our politics. Gerrymandered white Republican districts led to a wave of radical anti-immigration restrictionists in the House. That trend, of course, continued through the 2016 election, when hardline immigration opponents got perhaps their greatest champion in recent memory in the White House with President Donald Trump. We don’t know how this fight will ultimately turn out, but we do know two things. First, we know that the right thing for Christians to do is to fight — and fight hard — for Dreamers until they get the permanent protection they need, and continue fighting for their parents and the many other undocumented people living among us. These are the people Jesus literally commands us to treat as we would treat him.

Second, we know that since an overly influential group of hardline anti-immigration White House officials and politicians in Congress are blocking both the will of the overwhelming majority of the American people and what God wants, we must defeat them at the ballot box. There are fundamental Christian issues that cause Christians to vote against political candidates — and being opposed to immigrants should become one of those issues. We need to ensure that the fate of the Dreamers and other undocumented Americans is a voting issue for Christians this November and beyond.

Jim has nailed it! Our public immigration policy has been taken over by a group of White Nationalist GOP restrictionists who represent a minority of Americans, but are now driving the debate and the policies.

Guys like Attorney General Jeff Sessions, whose racially tinged White Nationalist views on immigration as a Senator were so extreme that he was once marginalized within his own party, and his White Nationalist strategist/protégée Steven Miller, are now in charge of the Government’s immigration policies. They and others in the GOP with similar restrictionist views have made overtly racist immigration policies “fashionable” again.

We now “debate” things like “should we reduce African immigration, deport long-term law abiding Hispanic residents, and bar Muslims” as if these immoral minority proposals were a legitimate “other side” of the immigration issue. The real issues often get shoved aside.

The minority might have seized control. But that doesn’t mean that they are entitled to ram their anti-immigrant, basically anti-American policies down the throats of the rest of us.

The resistance is going to take a prolonged and energetic effort — at the ballot box, in  the courts, and in the arena of public opinion. But, eventually, human decency, true American values, and having our “nation of immigrants” treat current and future migrants as human beings whose contributions we recognize and value will be restored!

“The Justice Department on Wednesday escalated its attempt to crack down on so-called “sanctuary” jurisdictions, threatening to subpoena 23 states, cities and other localities that have policies the department suspects might be unlawfully interfering with immigration enforcement.

President Trump and Attorney General Jeff Sessions have long promised to target places with policies friendly to those in the country illegally — warning they might withhold federal money from some and trying to tie grant eligibility to cooperation with federal authorities on immigration matters. The Justice Department had previously contacted the 23 jurisdictions threatened Wednesday, raising worries they might be in violation of a federal law barring places from enacting policies that block communication with Immigration and Customs Enforcement.

In a new letter, Bureau of Justice Assistance Director Jon Adler said officials remained “concerned” that the places had policies that violate the law, even after their previous responses. He asked for a new bevy of documents — including “any orders, directives, instructions, or guidance to your law enforcement employees” — and said the department would subpoena the materials if necessary.

Among those jurisdictions in the crosshairs are Chicago, New York City, Los Angeles and the states of California, Illinois and Oregon. In total, the 23 jurisdictions received more than $39 million in fiscal year 2016 money from the Edward Byrne Memorial Justice Assistance Grant Program — which Sessions is now threatening to put at risk.

Local leaders criticized the move. New Orleans Mayor Mitch Landrieu (D), president of the U.S. Conference of Mayors, said he would skip a planned White House meeting on infrastructure because of it. “An attack on one of our cities mayors who are following the constitution is an attack on all of us,” he said. His city was not among those targeted Wednesday.

New York City Mayor Bill de Blasio similarly wrote on Twitter he would skip the gathering after Trump’s Justice Department “decided to renew their racist assault on our immigrant communities. It doesn’t make us safer and it violates America’s core values.”

Chicago Mayor Rahm Emanuel (D) said officers in his city endeavor to build trust with residents to reduce public safety threats, and “you cannot do that if you drive a wedge between any immigrant community and the law enforcement.” He said Sessions’s threats were “amazing” in that the attorney general seemed to “disregard what the court system has already said uniformly from coast to coast.”

White House Press Secretary Sarah Huckabee Sanders said: “The White House has been very clear that we don’t support sanctuary cities. We support enforcing the law and following the law, and that is the Department of Justice’s job is to do exactly that, and if mayors have a problem with that, they should talk to Congress.”

Much of this crackdown has been stymied by the courts. A federal judge in California last year blocked Trump’s executive order to cut funding to such places, and a federal judge in Chicago ruled that Sessions had exceeded his authority in imposing new conditions, such as requiring recipients to give immigration authorities access to jails and 48 hours notice when suspected illegal immigrants are to be released. A federal judge in Philadelphia also ruled that city was in compliance with the law and blocked the Justice Department from withholding money. The Justice Department has appealed all those cases.

Sessions has long sought to tie crime to immigration — recently releasing data, which experts said was misleading, that said 73 percent of terrorism convictions in the U.S. involved individuals from other countries. Determining a link between illegal immigration and other crime is statistically difficult to do, though some research shows that immigrants are less likely to commit crimes than those who are native born. Civil liberties and immigration advocates, too, note there is irony in Sessions threatening to withhold law enforcement grants in the name of fighting crime.”

On paper, Gonzo isn’t actually in charge of the DHS. That job is nominally in the hands of Lightweight Sycophant Kirstjen Nielsen.

Remarkably, what Sessions is actually supposed to be doing is administering a fair and unbiased U.S. Immigration Court System in a manner that guarantees the legal and Constitutional Due Process rights of each individual brought before those courts by the DHS. Yeah, right! Sessions never met a migrant he didn’t despise and want railroaded out of the country as part of his White Nationalist agenda. And, he’s clearly “in bed” with DHS Enforcement. That’s why the U.S. Immigration Courts under Gonzo Apocalypto are well on their way to becoming mere “Whistle Stops on the Deportation Railway.”

There was a time when what is now ICE worked hard to gain community support and be considered part of the “legitimate law enforcement apparatus.” But, those days are long gone.

Trump, Gonzo, and Tom Homan are well on the way to making ICE the most hated, distrusted, and despised police force in America — the “New American Gestapo” if you will. The aforenamed “nasty clowns” will be gone someday. But, I’m not sure that ICE will ever be able to undo the damage they are doing to its reputation and standing in the law enforcement community.

As one or more Federal Judges has noted in enjoining Gonzo’s illegal overstepping, “once lost, community trust is not easily, if ever, regained by the police.”
