VADO, N.M. — Rigoberto Pablo ran out of hope. There was no work, no decent schooling for his children. Nothing in the dried-out streams, wilting coffee plants and wafting sewage of his village in the western highlands of Guatemala gave him reason to think his family’s suffering would end. So late last year, he crossed the nearby Mexican border, U.S.A.-bound.

Three months later, in February, I met him in this small New Mexico town, a timid man with a gentle smile. Pablo, age 37, is in American limbo, like hundreds of thousands of migrants. Seated on a sofa in the home of his hosts, he reached down, turned up the hem of his pants and revealed the electronic ankle monitor that Immigration and Customs Enforcement affixed when it released him. A green light confirmed he was being tracked. “If I take it off,” he said, “they’ll come after me.”

His 14-year-old son, Alex, who crossed the border with his father on Nov. 14 and is now in seventh grade at a nearby school, gazed at the device. His dad, he said, is “not a rapist or murderer. He wants to work and I want to study.”

Desperate people do desperate things! Duh! That’s what one of my colleagues told me my first week on the bench in Arlington. Too bad that Trump and the incompetents who work for him don’t take the time to understand the basics of human migration and conduct themselves lives like human beings and responsible public officials.

America deserves someone better than Donald Trump and his cowardly sycophantic GOP. Both Guatemala and the U.S appear to be “governed” by kakistocracies!

We diminish ourselves as a nation with each day that Trump is in office. But, that won’t stop human migration. It’s going top take folks much smarter, more humane, and more competent that Trump and his toadies to successfully address today’s immigraton issues.

Media outlets and politicians routinely refer to the “flood” of Central American migrants, the “wave” of asylum seekers, the “deluge” of children, despite the fact that unauthorized migration across the US borders is at record lows in recent years. Comparing human beings to natural disasters is both lazy and dehumanizing, but perhaps this tendency to lean on environmental language when describing migration is an unconscious acknowledgement of a deeper truth: much migration from Central America and, for that matter, around the world, is fueled by climate change.

Yes, today’s Central American migrants – most of them asylum seekers fearing for their lives – are fleeing gangs, deep economic instability (if not abject poverty), and either neglect or outright persecution at the hands of their government. But these things are all complicated and further compounded by the fact that the northern triangle of Central America – a region comprising Guatemala, El Salvador and Honduras, and the largest sources of asylum seekers crossing our border in recent years – is deeply affected by environmental degradation and the impacts of a changing global climate.

The average temperature in Central America has increased by 0.5C since 1950; it is projected to rise another 1-2 degrees before 2050. This has a dramatic impact on weather patterns, on rainfall, on soil quality, on crops’ susceptibility to disease, and thus on farmers and local economies. Meanwhile, incidences of storms, floods and droughts on are the rise in the region. In coming years, according to the US Agency for International Development, countries in the northern triangle will see decreased rainfall and prolonged drought, writ large. In Honduras, rainfall will be sparse in areas where it is needed, yet in other areas, floods will increase by 60%. In Guatemala, the arid regions will creep further and further into current agricultural areas, leaving farmers out to dry. And El Salvador is projected to lose 10-28% of its coastline before the end of the century. How will all those people survive, and where will they go?

This September, I travelled to El Salvador to report on the impacts of the US government’s family separation policy. I’d been to El Salvador many times before, but never to the Jiquilisco Bay, a stunning, shimmering and once abundant peninsula populated by mangroves and fishing communities and uncountable species of marine life. It is also one that, like many places in El Salvador, and like many places in the world, is also imperiled by climate change. Rising sea levels are destroying the mangrove forests, the marine life that relies on them, and thus the fishermen who rely on that marine life to feed themselves and eke out a meager economy.

I met a man there named Arnovis Guidos Portillo, a 26-year-old single dad. Many people in his family were fishermen, but they were able to catch fewer and fewer fish. The country’s drought and devastating rainfall meant that the area’s farming economy, too, was suffering. The land was stressed, the ocean was stressed, and so were the people. Arnovis got into a scuffle one day at a soccer game, which placed him on a hitlist with a local gang. He had been working as a day laborer here and there, but the drought meant there was less work, and it was hard to find work that didn’t require crossing into rival gang territory. If he did, he would be killed. So he took his daughter north to the United States, where border patrol agents separated them for two months, locking them up in different states and with zero contact.

Violence and environmental degradation are inextricably linked, and both lead to mass migration. An unstable planet and ecosystem lends itself to an unstable society, to divisions, to economic insecurity, to human brutality. When someone’s home becomes less and less livable, they move elsewhere. Wouldn’t each and every one of us do the same?

This week, the New Yorker’s Jonathan Blitzer published a series of pieces about the impacts of climate change in the Guatemalan highlands, where farmers are struggling to grow crops that they have been farming there for centuries. “In most of the western highlands,” Blitzer wrote, “the question is no longer whether someone will emigrate but when.” A few years ago, I reported from Guatemala’s dry corridor, several hours away from where Blitzer was reporting, where persistent drought had decimated the region’s agriculture, and particularly the coffee crop, on which roughly 90% of local farmers relied. It was a wildly different landscape from the one Blitzer described, but it faced the same problem: if you live in an agricultural zone, come from a long line of farmers and can’t reliably harvest your crops any more, what else is there to do but leave?

It’s abundantly clear that climate change is a driver of migration to the US – we have the data, we have the facts, we have the human stories. Still, the Trump administration has done nothing to intervene in this root cause. In fact, the US government has systematically denied the existence of climate change, rolled back domestic regulations that would mitigate US carbon emissions and thumbed its nose at international attempts – such as the Paris accords – to curb global warming.

Now, in his latest futile, small-minded and cruel attempt to cut migration off at the neck (something we know is not possible – an unhealthy societal dynamic must be addressed at the root, just like with a struggling tree or crop), Donald Trump announced last week that he would cut all foreign aid to the northern triangle. It’s a punitive move, and one that – just like building a wall, separating families, locking people up indefinitely, and refusing asylum seekers entry across the border – is a petty intimidation tactic that will do nothing to actually curb forced migration.

In fact, cutting aid to Central America will do quite the opposite, for as much waste and imperfections as there are in international aid, aid in Central America has been vital for creating community safety programs, job skills development and government accountability standards. It has also helped with drought mitigation and supporting climate-resilient agricultural practices. In other words, foreign aid to Central America – a place unduly hit by climate change – is supporting the kind of climate change resiliency that will keep people from having to leave in the first place.

Because people really don’t want to leave their homes for the vast uncertainty of another land, particularly when that land proves itself again and again to be hostile to migrants’ very existence. People don’t want to be raped along the route north, or die in the desert, or have their child ripped away from them by the border patrol, or be locked up indefinitely without legal counsel, without adequate medical care, with no idea what will happen to them and when. Who would risk this if things were OK back home? People like Arnovis leave because they feel like they have to.

Eventually Immigration and Customs Enforcement (Ice) officials convinced Arnovis to sign deportation papers with the promise that, if he did, he would be reunited with his daughter and returned to El Salvador. But he was shooed on to a plane back home without her. It took a tremendous amount of advocacy, but, after months locked up in the US, she, too was returned home. They are now back together, which is a good thing, but the fundamental problem hasn’t changed: he can’t find work. His society is ill. So is the planet, and the land and sea all around him.

Today, there are 64 million forced migrants around the world, more than ever before. They are fleeing war, persecution, disaster and, yes, climate change. The UN estimates that by 2050, there will be 200 million people forcibly displaced from their homes due to climate change alone.

Migration is a natural human phenomenon and, many argue, should be a fundamental right, but forced migration – being run out of home against one’s will and with threat to one’s life – is not natural at all. Today, whether we choose to see it or not, climate change is one of the largest drivers of migration, and will continue to be for years to come – unless we do something about it. If we want people to be able to stay in their homes, we have to tackle the issue of our changing global climate, and we have to do it fast.

Last week I traveled with colleagues to Central America’s Northern Triangle — Guatemala, Honduras, and El Salvador — where we spent five days meeting with heads of state, law enforcement, business leaders, U.S. ambassadors and diplomatic staff, USAID officials, and working people.

The trip, organized by Sen. Tom Carper of Delaware, was highly informative, particularly given the ongoing debate over immigration policy, temporary protected status (TPS), trade, and other related issues.

I think my fellow travelers – Sens. Carper and Jeff Merkley (Ore.) and Reps. Lisa Blunt Rochester (Del.), Lou Correa (Calif.), and Donald Norcross (N.J.) – would agree that what we saw and heard was both depressing and encouraging.

It is clear that the top mission of our U.S. presence in these countries is changing the conditions which drive irregular migration attempts to the United States. We are attacking the corruption, especially within the governments, which undermines citizen confidence that their countries will progress.  We are training police forces to deal with both gang violence and narcotics trafficking, with significant reductions in the murder rates in all three countries.  And we are investing in the conditions necessary for economic growth, especially the training of young people for jobs that pay much more than the minimum wage.

Our top concern was the decline in presidential support for U.S. initiatives to support economic growth and improved security in the region, and the naive idea that a wall on a border more than a thousand miles north will be any disincentive for jobless people living in fear of violence. The notion that a wall would magically solve the complex problems which cause people to flee to the United States was not borne out by what we saw.

Instead, we saw again and again that when we help create conditions of the most modest prosperity, when we reduce the fear of imminent violence, and when folks believe things will get better, it greatly reduces people’s desire to emigrate to the United States.

The most effective way for us to deal with unwanted immigration is to address the root causes in the developing economies of the Northern Triangle. We have already made a significant difference, but there is so much more we can and must do.

We should begin by shifting the useless waste of taxpayer funds in a silly border wall into greater investment into the Alliance for Prosperity, into our law enforcement efforts, and into diplomacy which will ensure ever less corrupt and more responsive governments.

My colleagues and I will be sharing these lessons with our colleagues this week, as Congress takes up a measure to reject the president’s fake national emergency, and beyond it as we look for humane, practical solutions to improve our immigration system and our relationships with these nations.

There are many other things that we could do, both internationally and domestically, to address the current humanitarian situation in the Northern Triangle. The money that the Trump Administration is happy to waste on a wall, unnecessary and inhumane detention, and the unneeded stationing of troops on the border could actually support much more reasonable and effective approaches that would comply with the law, rather stretching and often breaking it.

We need a better government by better people. Join the New Due Process Army and help end the Trump Kakistocracy.

JUSTICE DENIED: U.S. Immigration Judge @ Stewart Detention “Court” (“Where Asylum Cases Go To Die”) Denies “Slam Dunk” Asylum Bid To Unrepresented Refugee From DRC, Threatening Him & Family With Death! — System That Once Promised To “Guarantee Fairness and Due Process for All” Is Now A Bastion Of Injustice!

Constantin Bakala and his family have survived kidnapping, torture, rape, poison and a shipwreck.

Now, faced with the complexities of the U.S. immigration system, they may be on the verge of defeat.

Bakala, 48, and his family fled their home in the Democratic Republic of Congo in late 2016 after they were targeted for Bakala’s participation in an opposition party that promoted democracy in the country, according to his wife.

After traveling through more than 10 countries, the family arrived at the San Ysidro Port of Entry in November 2017. Bakala was separated from his wife and seven children and sent to an immigration detention center in Georgia while they were released to live in the San Diego area, a common practice at the time. He hasn’t seen them since.

Because they were separated physically, their cases were also handled separately in immigration court. Since the federal government prioritizes detained cases, Bakala’s finished before the family’s even began, according to their attorney.

Unable to find an attorney to represent him at the detention center in rural Georgia and with little money to even pay for phone calls to the outside world to try to get help, Bakala faced by himself an immigration court known for being tough on asylum seekers. Judge Michael Baird, who heard his case, granted 11 of the 152 asylum cases that he decided between fiscal 2013 and 2018, records show.

Bakala lost.

He tried to appeal the case by himself and was denied that as well, according to court records. Now the family, with the help of a San Diego church, has found an attorney to help him, but it may be too late.

He is convinced that if he returns to the Democratic Republic of Congo, he will be murdered by his own government.

Bakala’s party membership card shows he was part of the Rassemblement des Congolais Démocrates et Nationalistes, or RCDN, which opposed former president Joseph Kabila’s maneuvers to stay in power past his term limit. When Bakala wasn’t at his job at the Ministry of Health, he worked with the party’s youth and advised them on how to demonstrate peacefully against the ruling party, his wife Annie Bwetu Kapongo said.

Bwetu Kapongo tells their story slowly, haltingly, sometimes with painful detail and sometimes in circles, a symptom of the trauma she carries from what happened.

She remembers when her husband first told her about getting threatened, and she remembers the day he went missing in 2016.

When she went to the police to ask for help finding him, she was locked in a room that reeked of urine. Later, three policemen came in, beat her and raped her. She tried to stop them and pointed out that she was pregnant.

The men didn’t care, she said. She ended up losing the baby.

When she was eventually able to return home, her husband was still missing. The two stores she owned, one that sold fish and one that sold cakes and juice, were broken into and robbed by people looking for her husband, who had by this point escaped where he had been imprisoned and tortured, according to his attorney.

One night, Bwetu Kapongo woke up to the family dog’s aggressive barking before hearing it abruptly stop. They found the dog dead the next day.

Another night, she and the children got sick. Their heads were spinning, and they were vomiting. Eventually, they found a tool someone had used to release poison into the house, she said.

Finally, one night she heard a knock on her window. It was her husband.

Aided by people he’d brought to help the family, they scooped the children out of their beds while they were sleeping and fled in a boat down a river to the Republic of Congo, where the people helping them paid for their hotel, Bwetu Kapongo said.

They waited a couple of months there until they had travel documents to get to Brazil and left in early 2017 to begin a grueling journey to the U.S. border.

“We came because America respects the law, and they know how to protect people,” Bwetu Kapongo said through a translator.

In each of the countries they passed through, officials told them that they could not stay, she added. They were sent from Panama back to Colombia when they tried to get across the border by boat and ended up having to make the grueling 6- to 7-day walk through the jungle to Costa Rica.

In Costa Rica, they found a boat that would take them to Nicaragua.

After they’d been on it for about 45 minutes, Bwetu Kapongo heard shots fired at them. She told her children to lay down. Then, the boat broke, she said, and it began to sink.All of a sudden, her youngest child Joseph, who is now 5, was no longer in her arms.

She started to drown.

“Is this a nightmare? Is this real? Is this happening?” she recalled asking the darkness that surrounded her.

She felt other bodies in the water, hands pushing her head down as they tried desperately to reach the surface. She felt someone clutch her neck. It was David, her 12-year-old son.

When a rescue boat pulled her to safety, she found her 17-year-old daughter Marie Louise. Bwetu Kapongo began to pray, crying out the names of her five other children and asking God to find them. Her husband was soon rescued from the water and prayed with her.

When rescuers noticed bubbles moving in the water, they found Joseph along with 8-year-old Moses and 10-year-old Augustine clinging to a rope and pulled them to safety.

Emmanuel, her 15-year-old son, had been carried further away into the water with 14-year-old Daniel. They found a life preserver that had been thrown into the water and clung to it, bringing with them two girls from another family who were also nearly drowning.

When Emmanuel used the last of his strength to cry out, rescuers found them, Bwetu Kapongo said. Two people who had been on the boat died, one adult and one child.

Though the family survived, all of the documents and photos that could have been used as evidence were lost in the water.

They would have to journey by boat two more times between Costa Rica and Nicaragua before successfully making it the rest of the way up to the U.S. border.

Bwetu Kapongo said she expected to receive “protection and respect” when they arrived. Instead, her husband was quickly taken away.

It is only when she reaches this point in the story that she begins to cry.

She wouldn’t hear from him for about a month. He told her that he didn’t know how to find her, that it took that long for officials to give him information about where she was.

The family’s attorney Julie Hartlé said the family’s story is “horrific but not unusual.” Other attorneys she knows have had similar cases.

“This family meets every criteria. They were persecuted for being democracy activists, kidnapped and tortured by their own government,” Hartlé said. “It meets the exact definition of asylum for political persecution. It should’ve been straightforward. They were able to use the detention system against them.”

Bakala had to fill out his asylum application in English, a language he does not speak well. Though he told the judge verbally about three times he was taken by police, how he was beaten, interrogated and held without food, he only put information about one of the incidents in his application.

“That sounds like a pretty bad event,” the judge said in his ruling of one of the incidents Bakala described. “Unfortunately, it is never mentioned anywhere in the respondent’s application for asylum.”

The evidence that Bakala was able to gather and present — including a notice from his political party about his disappearance, another notice that the ruling party was looking for him, his voter ID card and party membership card — was not translated into English, so the judge said he couldn’t consider it, according to court records. He found Bakala’s story not credible.

The Executive Office for Immigration Review said it does not comment on judges’ decisions.

Neither Immigration and Customs Enforcement nor Customs and Border Protection were able to respond to request for comment in time for publication.

As immigration officials prepared to deport Bakala, attorneys filed emergency motions to temporarily keep him in the U.S. to try to reopen his case with new evidence. Last week, the 11th Circuit granted him a stay until Friday.

In the meantime, members of the church helping the family here in San Diego are planning a protest outside of the federal building at noon on Thursday in support of Bakala.

Bwetu Kapongo said the most important thing for her is protection for her children.

“He sacrificed his life to protect his kids,” she said in French. “If we hadn’t done what we did, they would already be dead.”

Beyond that, she wishes for her husband’s return. She tries to hide her exhaustion and her tears from her children, but she doesn’t think she can raise them alone.

“After the mountain I went through, I’ve got no more strength,” she said.

So, how might a real judge, one committed to guaranteeing fundamental fairness, due process, and properly applying the generous dictates of U.S. asylum law have approached this case?

First, Bakala comes from a country, the Democratic Republic of Congo (“DRC”) which is one of the most repressive regimes in the world, where persecution is rampant. For example, the DRC received a score of 17 on a scale of 100 in the latest Freedom House freedom rankings.

Here’s a quote from the most recent U.S. State Department Country Report summarizing the daily horrors of life in the DRC:

The most significant human rights issues included: unlawful killings; disappearances and abductions; torture and other cruel, inhuman, and degrading treatment and punishment, including sexual and gender-based violence (SGBV) and rape; life-threatening conditions in prisons and detention facilities; arbitrary arrests and prolonged detention; denial of fair public trial; arbitrary interference with privacy, family, and home; restrictions on freedoms of speech and the press, assembly, and association; abuse of internally displaced persons (IDPs); inability of citizens to change their government through democratic means; harassment of civil society, opposition, and religious leaders; corruption and a lack of transparency at all levels of government; violence and stigmatization against women, children, persons with disabilities, ethnic minorities, indigenous persons, lesbian, gay, bisexual, transgender, and intersex (LGBTI) persons, and persons with albinism, with little government action to investigate, prosecute, or hold perpetrators accountable; trafficking in persons, including forced labor, including by children; and violations of worker rights.

Authorities often took no steps to investigate, prosecute, or punish officials who committed abuses, whether in the security forces or elsewhere in the government, and impunity for human rights abuses was a problem.

Therefore, knowing that Bakala comes from a notorious “refugee producing country,” the Immigration Judge should have insisted as a matter of due process and fundamental fairness that the case be continued until the respondent could get the assistance of a competent lawyer to fully and fairly present a case for saving his life.

Asylum law has been made intentionally and unnecessarily complicated by a politicized system run with a strong enforcement bias; statistics, as well as experience, show that unrepresented individuals have virtually no realistic chance of success, particularly in a system run by an Administration clearly prejudiced against them. Human lives become mere “case completions.”

Second, Bakala’s wife also appears to have a strong asylum claim in her own right.  If granted, he could also have been protected as a derivative asylee under his wife’s application. Therefore, unless ICE were basically willing to stipulate to an asylum grant, proceeding with the cases separately was presumptively unfair. A judge committed to fairness, would have “pushed” the ICE Counsel on why this family’s cases were not being heard together.

Third, to justify an adverse credibility finding under the statute and BIA precedents, the judge’s ruling must demonstrate significant discrepancies or omissions, provide cogent reasoning, and carefully consider and give reasons for not accepting the respondent’s explanations for any problems. This judge’s ruling appears to have “flunked” all of those tests. The idea that a detained unrepresented individual’s omission of an event from the asylum application is a cogent basis for finding him not credible is facially absurd. That’s particularly true where the respondent is not a native English speaker and is held in detention where his ability to prepare, or, indeed, to even understand what is required for a successful asylum application, is intentionally impaired.

Moreover, a simple reference to the most current State Department Country Report (quoted above) would have shown the judge that the respondent’s testimony was highly plausible in light of known country conditions.  Indeed, persecution, torture, and abuse are daily occurrences in the DRC.

Additionally, the judge violated due process by requiring a detained individual to get translations of key corroborating documents. It’s simply not possible in most cases. How is a detained unrepresented individual going to find a qualified foreign language translator in the Stewart prison? A judge doing his job fairly would have asked the respondent to summarize the documents and accepted a “proffer;” or he could have had the documents read into the record by the interpreter.

For the purpose of a detained adjudication, I would have assumed that the documents were what the respondent said they were and acted accordingly. If the DHS wanted to challenge the decision, they could have the documents translated.  Just one of many problems in purporting to conduct “due process hearings:” in place where due process often can’t really be achieved.

Then, the “rubber stamp” BIA (a/k/a the “Falls Church Adjudication Center”) also “tanked” by not applying its own precedents which should have resulted in a finding that the Immigration Judge’s specious reasoning was “clearly erroneous.”

I heard a number of asylum cases from the DRC during my time on the bench in Arlington. I doubt that I denied any except for individuals who were aggravated felons, engaged in persecution of others, or had provided material support to a terrorist organization. Even those who failed to establish asylum eligibility often had valid claims for protection under the Convention Against Torture, given the prevalence of government sponsored or endorsed torture in the DRC. Most DRC asylum cases in Arlington were well-represented, well-documented, and either largely unopposed or not appealed by ICE.

Even without a lawyer, it appears that Bakala’s testimony was credible under the circumstances and that he suffered harm that should have warranted a grant of asylum on account of political opinion based on known country conditions. At one time in Arlington, a case like this with representation probably could have been granted largely by stipulation, with brief testimony, on a “short docket.”

That’s how cases can “move” on the Immigration Court’s crowded dockets without compromising due process or fundamental fairness. Instead, this Administration encourages a biased “haste makes waste” approach, issues statements of strong prejudgment against asylum seekers and their attorneys, motivates judges to cut corners, and enables judges to look for “any reason” to deny asylum and crank out final orders of removal. It’s a “cavalcade of worst practices!”

While some judges courageously resist and insist on “doing the right thing,” others choose or feel compelled to “go along to get along” with the Administration’s unethical (and incompetent) administration of these so-called “courts.” Indeed, today’s Immigration Judges are not even properly trained on how to correctly adjudicate and grant asylum under the generous standards mandated by the law, the Supreme Court, and even the BIA’s (seldom followed) precedent supposedly implementing generous standards following the Supreme Court’s admonishment. It’s an exercise in extreme intellectual dishonesty.

Allowing serious, “life or death” cases to be tried in places like Stewart, notorious for being the home of unsympathetic judges and an inherently coercive atmosphere, intentionally located in and out-of-the-way place where it is hard for attorneys to participate, is a stain on America.

The DOJ has abandoned any semblance of running its “wholly owned courts” in a fair and constitutional manner. Congress, ultimately responsible for creating and countenancing this mess, has long abdicated its duty to establish an independent system that complies with Due Process.

Article III Judges also have been largely complicit in allowing this pathetic imitation of a “court” system to continue operating in a fundamentally unfair and unreasonable manner and spewing forth skewed, unjust, often unlawful, and sometimes deadly results. It’s a national disgrace!

Sadly, the individuals being abused by the Immigration Court system are some of the weakest and most vulnerable among us. That’s what allows such systematic injustice to operate “largely below the radar screen.” However, the individuals who are participating in and enabling such outrageous contempt for the rule of law and human dignity, and thereby violating their oaths of Federal office, will not escape the judgment of history.

Fixing this unfair and intentionally broken system is well within our power as a country. It could be done for much less than $5.7 billion. Put an end to the “New American Gulag” and  the “theater of the absurd” masquerading as a “court” that operates within its bowels!

Looking at deportation from south of the border, I saw our own flawed attitudes about migration more clearly

While reporting on deported Mexicans in that country’s capital, I saw the human cost of our failure to develop a thoughtful immigration policy.

MEXICO CITY — For the thousands of Mexicans who’ve been deported from the United States and who’ve chosen to rebuild their lives in this massive capital city, America represents “el otro lado,” Spanish for “the other side.”

On our side of the U.S./Mexico border, from Florida to Washington state, these repatriated Mexicans left behind jobs, loved ones and community ties.

On our side, they experienced the chaos and coldness of America’s immigration and deportation system, one that has shown little interest in broken families and the loss of economic viability, or the relative unsafety and cultural hostility toward migrants of all kinds that deported people face after returning to their native country.

Earlier this month, two of my Times colleagues and I traveled here, to the other side of America’s border crisis, to learn about life after deportation. The stories we heard, the hardships we came to understand and the grass roots efforts we learned about will all be presented soon in a special package in The Times.

But before I write about that, I wanted to write about the strange context in which we did our reporting.

There we were covering the real-life experience of being kicked out of the United States, during the same week that our president declared a state of emergency to prevent an imaginary army of Mexican and Central American migrants from barging in.

The way President Donald Trump describes it, we are at war with craven invaders who don’t want to play by America’s immigration rules.

From the vantage point of Mexico City, though, it seemed as if America had plunged deeper into a war with itself, in part because it can’t come up with sensible rules for a nation that has been built and sustained by immigrants and migrant workers — both free and captive.

People who live and work in the United States without legal documents do represent a special category of migrant, and they certainly know the risks.

But as I sat and listened to returnees in Mexico City — who had migrated to the United States with their families when they were minors, or who started their own families while on American soil in the years before being deported — the trauma of deportation and the complexity of the rebuilding process seemed more real.

We are good at sending people “back where they came from” for the crime of being here without papers and sometimes for committing other offenses that result in being considered unfit for legal residency. What we are not so good at is considering the possible injustice of forcing people back into countries that may not be equipped to reintegrate them, that may not even want to welcome them home, and that for all intents and purposes may not feel like “home” anymore.

Mexico City — a teetering metropolis that sits at an elevation of 7,300 feet and that’s more than 20 million people strong — is a hard place to navigate even for those who were born here and never left. It’s especially challenging for those who left years ago in search of a better life in America and now find themselves back here and needing to start over, in a city dealing with issues like poverty and corruption.

We met repatriated Mexicans who spoke like homies from around the way, who shook my hand with the soul-brother salute, who talked about the United States as if they had been born wrapped in red, white and blue, who are proudly making it work in the land of their ancestors while also displaying the spirit of their adoptive motherland up north.

In deportation cases, the decision can seem pretty cut-and-dry: Should they stay or should they go?

On the ground in the beautiful cacophony that is Mexico City, the overcrowded and smoggy incubator of dreams big and small, everything was a blur and there were nothing but gray areas.

It’s so easy in our society to portray immigrants who carry proper documentation as “good” and those who don’t have those documents as “bad,” but when our government behaves as if it doesn’t care about the aftereffects of the decision to expel someone from our soil — which seems to be the case right now — it is our character that’s in question.

Trump’s wall is not the only story. And immigration isn’t our only crisis.

We have a responsibility to be careful about who we let into this country, to be sure. But we also have to find a way to more humanely manage the detention, departure and reintegration of those we send away — to see them as human beings even when they have violated the integrity of our borders.

We can act as if the fate of undocumented migrants isn’t our problem, that they shouldn’t have come here under those circumstances in the first place.

But if we deal with the original sin of entering the United States illegally in such a clinical way, we will be committing the equal sin of heartlessness when humanity is due.

Justice is never truly blind.

Because of that, as we think about deportation, we should view this tough journey with our eyes wide open.

Callous treatment of those who might once have thought of our country as “home” is never a good idea. Not fully considering the human and political consequences of our own actions is the height of arrogance. It says to the world “who cares about others and what they think — we can do as we please because we’re the biggest and richest bullies on the block.”

Under Trump, the U.S. is faltering on most foreign policy fronts, unnecessarily alienating our potential friends and allies and “sucking up” to the worst and most dangerous strongmen in the world while getting little of verifiable value in return (notably, one of the worst among them, Putin, helped install Trump in his current position).

No country remains “on the top of the heap” forever. And, as our power and influence begin to wane under Trump’s erratic and incompetent hand, we might someday soon find that we need all the friends we can get, even outside our border, to maintain and regain our position and prestige in the world. Just ask the Brits about the perils of “going it alone” — or letting national policies be driven by irrational and self-defeating nativist sentiment.

Magdalene Menyongar’s day starts with a 5:30 a.m. conference call with women from her church. They pray together as Menyongar makes breakfast and drives to work, reflecting on everything they are thankful for.

But lately, the prayers have turned to matters of politics and immigration. They pray with increasing urgency for Congress or President Trump to act before Menyongar, 48, faces deportation to her native Liberia, where she fled civil war nearly 25 years ago.

In less than six weeks, the order that has allowed her and more than 800 other immigrants from the former American colony in West Africa to live in the United States for decades will end, the result of Trump’s decision last year to terminate a program that every other president since George H.W. Bush supported. Come March 31, Menyongar will face a choice: Return to Liberia and leave behind her 17-year-old daughter, an American citizen, or stay in the United States, losing her work authorization and becoming an undocumented immigrant.

Menyongar is among thousands of Liberian immigrants who were given temporary permission to stay in the United States in 1999, when President Bill Clinton implemented “deferred enforced departure.” DED was routinely extended by previous administrations but is set to end under Trump’s effort to terminate programs for immigrants without permanent status, which also has endangered Deferred Action for Childhood Arrivals and temporary protected status for immigrants from 10 other countries.

Temporary protected status, or TPS, was established by Congress in 1990 for citizens of countries suffering from war, environmental disaster, health epidemics or other unsafe conditions. They are given temporary permission to work in the United States and travel abroad without fear of deportation.

But that court action does not apply to the smaller and lesser-known DED program, which operates purely at the president’s discretion and gives no statutory basis on which to sue.

Without a change of heart from the president — or new legislation from Congress — Liberians living in the United States under DED will lose their work authorization and become subject to deportation. Instead of self-deporting, many are expected to stay in the United States in hopes of getting a hearing in immigration courts, a process that could take years.

But critics say his move to end protection for Liberians, leaving them undocumented after decades in the country legally, reflects an immigration policy that is capricious and, at worst, driven by racial bias.

“There comes a point where even if relief started as temporary, it needs to end with some possibility for permanence,” said Royce Murray, managing director of programs at the American Immigration Council, an advocacy group. “These are people who have built their lives here, have invested in their communities and are raising American citizens.”

Last week, a group of DED holders from Minnesota traveled to Washington to lobby representatives, and Democrats have responded with legislative efforts. Rep. Dean Phillips, a freshman Democrat who represents Menyongar’s Minnesota district, pushed unsuccessfully for a DED provision to be included in the spending bill Trump signed.

Opponents of the programs say they have outlasted their original intent, to provide temporary protection, and represent a misuse of executive authority.

RJ Hauman, government relations director at the Federation for American Immigration Reform, which favors reduced immigration and greater enforcement, calls DED and TPS “flagrant abuses of our immigration system.”

“Both of these ‘temporary’ designations have been on autopilot for years, with one unmerited, open-ended extension after another,” Hauman said. “These individuals should return to their homeland, which has since recovered, and use their skills to enrich Liberian society.”

Liberians don’t have to register with the federal government to qualify for DED, so there’s no reliable count of how many people depend on the program. But as of March 2018, approximately 840 had work authorization under DED, according to U.S. Citizenship and Immigration Services. Liberians must have lived in the United States continuously since 2002 or earlier to qualify.

Most of the original DED beneficiaries have since left the country, died or gained permanent status, Murray said. She estimates as many as “a few thousand” may remain in the country but have not renewed their optional work permits, which cost a total of $495 in annual fees.

Gabby’s primary focus these days is preparing for college, possibly in Atlanta to be close to her father’s family and escape the frigid Midwest winters. She said she didn’t understand that her mother could have to leave until last March, when Trump declared a one-year “wind-down period” for DED. She has told her best friend how worried she is about the situation but avoids talking about it otherwise.

A second family, a second home

Minnesota is home to the nation’s largest Liberian community, concentrated in the northwestern suburbs of Minneapolis. A few times each week, Menyongar makes a 20-minute drive to Bethel Robbinsdale — one of several Liberian churches in the Twin Cities area — where she serves as president of the women’s ministry.

After communion during a recent Sunday service, the band and choir struck up a euphoric tune while Menyongar joined the congregation in dancing through the pews. Dressed in a brightly colored jumpsuit and a turquoise head wrap, she exchanged handshakes and hugs along the way.

“The church is my second family,” Menyongar said. “It’s like a support system that we have for each other.”

Friday knows Menyongar isn’t the only member of his church who could face deportation, but he can’t say for sure how many will. Many keep their immigration status secret.

“These people, if you grant them permanent residence, they are going to be so patriotic,” Friday said. “The burden would be lifted off their shoulders to know that they can finally live a normal life.”

Liberian immigrants have taken prominent positions in Minneapolis and its suburbs, such as Brooklyn Center, which recently elected its first Liberian-born mayor. They moved in part for the job market — a shortage of nurses and other health-care workers drew many, like Menyongar, to work in hospitals and assisted-living facilities.

Mary Tjosvold, who owns group homes for seniors and people with disabilities, employs more than 150 Liberians. Although she does not track how many of her employees are protected by DED, she said losing even a few workers would have wide ripple effects.

“People have had these jobs for a long time. They’re important parts of businesses,” said Tjosvold. “On an economic basis, it doesn’t make any sense, no matter what you think politically.”

An end to the policy also has economic implications abroad. Remittances sent from those working in the United States to their relatives in Liberia act as “a source of de facto foreign aid,” said Paul Wickham Schmidt, a former immigration judge and current adjunct professor at Georgetown Law School.

Menyongar works a combined 60-plus hours each week at two nursing homes, and her paychecks support her 97-year-old mother and other relatives in Liberia.

Schmidt said the idea that Liberians losing DED will self-deport is unrealistic.

“My experience is that most people go home not because they’re threatened, but because they deem it in their overall best socioeconomic interest,” he said. “A lot depends on what faces you at home, which is why this administration’s policy doesn’t work.”

Mark Krikorian, executive director of the Center for Immigration Studies, a Washington think tank that supports sharp immigration restrictions, argues that a president should not be able to prolong temporary programs like DED without congressional approval. Even so, he said, “When we’ve permitted people to lawfully reside here for decades, it’s practically and politically and morally problematic to say, ‘Okay, now time is up.’ ”

Liberia has been emerging from war during the past 15 years and last year saw its first peaceful transfer of power since 1944. In a memorandum announcing the end of the temporary status, Trump wrote, “I find that conditions in Liberia no longer warrant a further extension of DED.”

Menyongar strongly disagrees with that assessment, citing violent crime, poor health care and infrastructure, and a lack of jobs in explaining why she could not return to her country of birth.

“The Liberia that I knew and grew up in is not the Liberia of today,” she said.

ANOTHER PERSPECTIVE: There Is Nothing Inherently Wrong With TPS Or DED — But, There Is Plenty Wrong With The Trump Administration’s Mistreatment Of 800 Long-Term Residents From Liberia

Far from being a “problem,” as Trump and his restrictionist “naysayers” like to falsely claim, the TPS/DED program for Liberians has been a tremendous success! With a little “Congressional tinkering,” it could easily become a model for resolving future humanitarian situations without overburdening the US asylum system and adding to the huge existing U.S. Immigration Court backlog.

The US was able to provide humanitarian assistance to at least 10,000 Liberians during the darkest time for their country. This was accomplished without the time, expense, and often inconsistent and unsatisfactory results of forcing them into the formal US asylum system.

While in TPS/DED, Liberians were able to work legally, pay taxes, raise their families, live in peace, and otherwise contribute to American society.  Over the years, many were over able to fit within our legal immigration system. Some died. Others found that with changes in Liberia, it made socio-economic sense for them to return there. A very few violated the rules of our hospitality and were duly arrested and removed after receiving Immigration Court hearings (most before the Trump Administration “trashed” due process in Immigration Court). The Government might even have turned a slight profit on the routine renewals of work authorization for which a fee was charged that probably exceeded the actual time it took to adjudicate them.

Now, we have approximately 800 long-term residents remaining who would like to stay here with their families, jobs, and communities. Passing the necessary legislative fix to allow them to get green cards should be a “bipartisan no brainer” — indeed if the Administration introduced and supported such a fix, it almost certainly would pass by huge margins and be signed into law. Presto — problem fixed and everyone wins! At a minimum, a rational Administration would exercise “prosecutorial discretion” (“PD”) to maintain the status quo and allow the few remaining Liberians to reside in the US and work legally pending good behavior and a legislative solution.

The law might or might not have been specifically designed for this outcome. But, wiser Administrations in the past used the available legal mechanisms along with Executive authority and common sense to solve human problems in a practical, efficient manner.  Thanks exactly what “good government” is supposed to do.

That the Trump Administration chooses to use laws selectively to create “bogus emergencies” and “engineer problems” where none existed, rather than solving problems in a way that promotes the common good, should be of concern to all of us who favor good government and humane solutions to humanitarian issues.

Trump administration begins effort to strip work permits for immigrant spouses

WASHINGTON — After nearly two years of delays, the Trump administration is moving ahead with its plan to strip work permits for the spouses of many high-skilled visa holders, an effort that could jeopardize tens of thousands of immigrants families in California alone.

Rolling back the permits could have sweeping consequences for the Bay Area, where tech companies heavily rely on high-skilled immigrants. Many of those workers come to the U.S. with spouses and children, and the loss of the spousal work permits could imperil many families’ ability to stay in the country or be convinced to come work here.

The step forward for the regulation comes as a federal appeals court ran out of patience with the administration’s delays in issuing it.

The proposed regulation was officially sent to the White House for review on Wednesday, a government database shows. The procedural step means that the Department of Homeland Security has completed its work on the policy and is ready for its official publication. The White House will now put the regulation through review with other agencies, a process that can take anywhere from days to months, depending on the complexity of the regulation.

At issue are work permits for nearly 100,000 immigrants who are here with spouses working on a high-tech visa and seeking a green card. (Spouses and children of H-1B visa holders have H-4 visas granting residence.) The largest share of those, nearly 30,000 of them, live in California, according to a Congressional Research Service report.

In 2015, the Obama administration created the H-4 employment authorization document, or H-4 EAD as it’s commonly known, to allow those spouses to work until the family can get green cards. Getting those permanent residency permits is a process that can often take many years, especially for immigrants of countries like India and China that send a lot of high-skilled talent to the U.S. In the meantime, their spouses are unable to work legally in the U.S. unless they have an employer who can separately sponsor them for a visa.

Since going into effect, there have been more than 90,000 immigrants approved for work permits under the program.

President Trump pledged early on to rescind the H-4 permit program, but the administration has been delayed in doing so. As it continued to promise the regulation would eventually come, a lawsuit challenging the program has been on hold in the courts.

That changed in December, when the D.C. Circuit Court of Appeals stopped granting the Department of Homeland Security extensions and ordered that the case proceed. A group of technology workers called Save Jobs USA who argue the program jeopardizes American jobs sued the Obama administration and, after losing in D.C. federal court, appealed the case. The Trump administration after taking power had successfully had it postponed until December.

The reasons for the delay, and sudden step forward, are not entirely clear. Government lawyers had assured the court the rule was being written and reviewed, it was just taking time. In September, the lawyers had predicted a rule would be out in three months. The first briefs in the case are due in March.

Experts suspect that with the government finishing a separate rule blocking immigrants who might use public benefits, and with the lawsuit moving forward, the work was expedited. Once the rule is published, the government could argue the court should indefinitely postpone the lawsuit, as the underlying regulation is being rewritten. That would avoid the chance that the appellate court decides the program is legal, setting a precedent contrary to the objectives of the Trump administration.

“The agency doesn’t want to risk having a judicial ruling that would go against it,” said Natalie Tynan, an attorney with Hunton Andrews Kurth who worked in the Department of Homeland Security for over 11 years. “In general from an agency’s perspective, the agency prefers to issue its regulations rather than have the courts opine on what the regulations should say. So any opportunity to moot out litigation is a positive one for the agency.”

Fifteen members of California’s Congressional delegation signed a letterurging the Trump administration to preserve the permit program last year. They included Reps. Anna Eshoo, D-Palo Alto, Zoe Lofgren, D-San Jose and Ro Khanna, D-Fremont. Eshoo and Lofgren introduced legislation late last year to keep the H-4 program in place.

U.S. Citizenship and Immigration Services, the agency within the Department of Homeland Security that manages the program, said the agency is “committed to upholding our nation’s immigration laws, helping ensure they are faithfully carried out, and safeguarding the integrity of our immigration system designed to protect the wages and working conditions of U.S. workers,” according to spokeswoman Jessica Collins.

She would not comment on the substance of the regulation, but noted that nothing would be final until the regulatory process is complete.

Once the White House signs off on the draft regulation, it will be published in the Federal Register. That will start a clock on a comment period, usually 30 to 90 days, after which the administration legally has to review the comments and make any necessary revisions. Only after that can the regulation be finalized, and litigation could potentially hold it up for months or years longer.

Still, the uncertainty of future job status and symbolism of the proposal from the Trump administration could have immediate ripple effects for families that rely on the visas and the companies that are already struggling to attract top talent.

“If you have 100,000 people who are extremely well-educated and on the path to getting green cards, and are either indirectly stimulating economic growth or directly creating jobs for native-born Americans by starting companies in this country, why would you pull out the rug from all these people?” said Doug Rand, co-founder of Boundless, a tech startup designed to help immigrants navigate the legal system. Rand also worked on the original H-4 regulation in the Obama administration.

Rand pointed out that by rule, only families already approved for green cards qualify for the work visa, meaning the government has already determined there are no Americans who could be working the high-skilled job. The spouses are only ineligible for work because of the lengthy backlog that exists for countries including India.

More than 93 percent of those affected are women, which especially concerns advocates. Lofgren has also co-authored legislation that would eliminate per-country green card caps, helping to alleviate the backlog.

“It undermines the agency and dignity of these spouses and it harms their career prospects, it leaves them less empowered to leave abusive situations,” said Amanda Baran, an attorney and advocate with the San Francisco-based Immigrant Legal Resource Center and a veteran of the Department of Homeland Security.

“It limits the success of women,” Baran continued. “I feel like it’s just another part of Trump’s larger agenda, which is to expel immigrants, prevent them from coming in and make life uncomfortable for them here and compel them to leave.”

These marriages are arranged to provide the alien spouses with a basis for obtaining visas they can use to enter the United States as lawful permanent residents, leaving young girls trapped in marriages that have been described as a form of slavery.
When the Committee asked U.S. Citizenship and Immigration Services(USCIS) about this, USCIS Director L. Francis Cissnaconfirmed in a letter dated October 4, 2018, that there are no statutory age requirements associated with a visa petition for a spouse or fiancé.
USCIS, however, will not approve the petition if the beneficiary or the petitioner was not old enough to marry under the laws of the place where the marriage was performed, or a marriage at that age violates the public policy of the American state in which the couple intends to reside.
Most states do not have a minimum age for marriageif the child has parental or judicial consent, but USCIS admittedat a Committee staff briefing that visa petitioners do not have to prove parental or judicial consent.  However, the instructions for a fiancé petition require evidence that the couple met in-person within the last two years, unless doing so violates religious customs or social practices.
Delaware and New Jersey are the only statesthat prohibit marriage for anyone under the age of 18 with no exceptions.
The United Nations Population Fundsays that child marriage is a human rights violation.  It threatens girls’ lives and health, and it limits their future prospects. Girls who marry while they are still children often become pregnant while still adolescents, which increases the risk of complications in pregnancy and childbirth. This is the leading cause of death for older adolescent girls.

President Trump has gone to extraordinary lengths to conceal details of his conversations with Russian President Vladi­mir Putin, including on at least one occasion taking possession of the notes of his own interpreter and instructing the linguist not to discuss what had transpired with other administration officials, current and former U.S. officials said.

Trump did so after a meeting with Putin in 2017 in Hamburg that was also attended by then-Secretary of State Rex Tillerson. U.S. officials learned of Trump’s actions when a White House adviser and a senior State Department official sought information from the interpreter beyond a readout shared by Tillerson.

The constraints that Trump imposed are part of a broader pattern by the president of shielding his communications with Putin from public scrutiny and preventing even high-ranking officials in his own administration from fully knowing what he has told one of the United States’ main adversaries.

As a result, U.S. officials said there is no detailed record, even in classified files, of Trump’s face-to-face interactions with the Russian leader at five locations over the past two years. Such a gap would be unusual in any presidency, let alone one that Russia sought to install through what U.S. intelligence agencies have described as an unprecedented campaign of election interference.

Special counsel Robert S. Mueller III is thought to be in the final stages of an investigation that has focused largely on whether Trump or his associates conspired with Russia during the 2016 presidential campaign. The new details about Trump’s continued secrecy underscore the extent to which little is known about his communications with Putin since becoming president.

After this story was published online, Trump said in an interview late Saturday with Fox News host Jeanine Pirro that he did not take particular steps to conceal his private meetings with Putin and attacked The Washington Post and its owner Jeffery P. Bezos.

Asylum denials jump; immigration judges’ discretion attacked

MEXICO CITY, Dec. 10 (UPI) — New data about the number of asylum applications granted by the United States this year show how the Trump administration has dramatically narrowed asylum granted to people fleeing persecution in their home countries — though significantly more Central Americans have been admitted over the past decade.

“Asylum acceptance rates are at a 20-year low, and the recent TRAC data confirms that,” said Sarah Pierce, policy analyst for the non-partisan and independent Migration Policy Institute, referring to data from the Transactional Records Access Clearinghouse.

For fiscal 2018, TRAC’s statistics show immigration judges denied 65 percent of asylum claims — up from 42 percent in 2017. There were 42,224 asylum cases decided in 2018, an 89 percent increase over the total number of cases decided in 2016.

Due to a backlog in the immigration system, some asylum seekers have been able to live in the United States for three years to five years while their claims are adjudicated, a situation the administration has tried to address by changing some rules and practices.

“This administration is trying to address people who are trying to take advantage of the system. But unfortunately this administration’s approach tends to punish asylum seekers rather than just specifically looking at those individuals who are taking advantage of the system,” Pierce said.

The administration’s broad approach to all asylum seekers has had the effect of narrowing asylum by increasing immigration judges’ workloads by setting quotas, ending discretionary decision making and rewriting immigration rules to deny relief to asylum seekers fleeing domestic and gang violence.

Immigration experts told UPI the administration’s changes to how immigration judges work has spiked a general increase in asylum denials.

Northern Triangle

There has been an increased flow of asylum seekers from Central American countries, particularly those from the Northern Triangle countries of Honduras, El Salvador and Guatemala.

And the fact that more of them are getting approved shows they are “sincere humanitarian migrants,” Pierce said.

A new TRAC tool shows Central Americans now fare better than in previous years. Salvadorans receive asylum in rates higher than Guatemalans or Hondurans. In 2004, Salvadorans’ asylum approval rate was 6 percent. In 2018, it rose to 23 percent. Guatemala’s grant rate in 2018 was 18 percent, the lowest of three countries, with Honduras at 20 percent.

Pierce said that changes in immigration law under the Obama administration help account for significant changes in asylum approval rates for people fleeing the Northern Triangle. Immigration judges over the past decade were more accepting of domestic and gang violence as grounds for asylum, with successes helping to develop case law.

The rise in asylum for Salvadorans has to do with direct violent threats, rather than domestic violence, which is a common claim among Guatemalan asylum seekers, or gang violence, common among Hondurans.

“The circumstantial evidence suggests El Salvador tends to have the most direct violent threats,” said Everard Meade said, director of the Trans-Border Institute at the University of San Diego.

Data comparing the Northern Triangle countries’ asylum seekers’ claims is hard to come by. However, Meade said in 2014 the United Nations High Commissioner for Refugees issued its report, “Children on the Run,” about unaccompanied Central American minors highlighting direct violence in El Salvador as a reason for flight. UNHCR interviewed almost 400 children with 66 percent of El Salvadorans reporting flight for threat of direct violence Guatemalans reported 20 percent, Hondurans at 44 percent.

But Central Americans’ asylum approvals might be a blip. Former Attorney General Jeff Sessions this year removed domestic violence and gang violence as grounds for asylum in immigration court proceedings.

“These private acts of violence claims are typically the ones we are seeing from the Northern Triangle,” Pierce said, “including El Salvador.”

Discretionary decision-making

The general picture, however, is that more people are failing to win asylum than ever before because the Trump administration has changed how judges work.

“The asylum decisions and denial data for fiscal year 2018 is really about discretionary relief that used to be available under [President Barack] Obama but is not available under [President Donald] Trump anymore,” Meade said.

Prior to Trump-Sessions, immigration judges used to employ a form of discretionary relief called administrative closure. This was a form of temporary protection against deportation that did not grant any permanent immigration status, unlike asylum, which is a pathway to citizenship.

“Immigration judges had people coming before them who had really compelling stories but those stories did not necessarily cleave close enough to the asylum standard to grant them asylum. But the judges really felt they did not want to return them to dangerous situations, either. They also felt they were people who were credible, who had told the truth, and so they were administratively closing their cases,” Meade said.

The practice of administrative closure ended this year with a Sessions memorandum.

“Administrative closure was a widespread practice and that is exactly what explains how the denial rate can go up so dramatically without the grant rate going down. Actually, the grant rate has gone up. In defense of the institutions, the modest increase in the grant rates suggest people have some really good asylum claims,” Meade said.

The situation in El Paso

Carlos Spector, a veteran El Paso immigration lawyer, said that although the asylum rate has increased nationwide, there is little evidence of successful asylum claims in El Paso’s immigration court.

“This year, I have lost some asylum cases that had really compelling claims,” Spector said, adding that 98 percent of his clients are Mexican.

Mexicans generally do not fare well in immigration court. In 2018, 14.5 percent of Mexican asylum seekers received asylum. Part of the reason is that immigration judges were administratively closing cases, protecting from deportation but stopping short of permanent relief.

For 2018, the latest TRAC data reveal El Paso’s immigration judges reviewed 297 cases, granting asylum 47 times. In 2017, they reviewed 148 cases and granted asylum 12 times. These low asylum rates, some of the lowest in the nation, mean El Paso’s immigration judges have a reputation for enforcing law and order, Spector said.

“I’ve been tracking asylum cases of Mexican nationals for the past few years and it is more or less the same rate along the border from San Diego to Brownsville,” Spector said.

“Because we are on the border and these judges are political appointees and these judges do understand the government’s mandate of holding or guarding the border and they take that law enforcement approach,” Spector said, “the denials are much, much higher on the U.S.-Mexico border, and they always have been.”

TRAC compiled asylum approval and denial statistics for fiscal year 2018, the first full year of Trump’s presidency, based on Freedom Of Information Act requests to the Justice Department’s Executive Office of Immigration Review, the agency charged with adjudicating defensive asylum claims in immigration court.

Just as I have been saying all along!  The Trump Administration’s claim that low asylum approval rates indicate the system is being “gamed” by applicants is a bogus cover up. Even taken at “face value,” a 20-25% chance of being granted asylum hardly shows a system being “gamed.” At most, it shows that Immigration Judges are applying a much more restrictive standard than Asylum Officers considering “credible fear” claims at the border. Far from being “gaming,” that would be consistent with (although not necessarily required by) an intentionally much more generous standard for getting a fair adjudication in a removal hearing (“passing credible fear”) than for actually achieving relief (“a favorable order from an Immigration Judge after a full merits hearing”).

But, what really appears to be going on here are artificially restrictive, politically inspired “tweaks” to asylum law and procedures specifically intended to disadvantage those in danger from the Northern Triangle. Additionally, inappropriate detention policies are intended to force many more applicants to proceed without lawyers or to abandon appeals — making it like “shooting fish in a barrel” for those Immigration Judges with a predilection to deny relief who are under great pressure to “produce” more final orders of removal. It also appears that a disturbing number of Immigration Judges along the Southern Border view themselves as agents of DHS and Administration enforcement policies, rather than as fair and impartial decision makers committed to giving asylum seekers the “benefit of the doubt” under the law.

This all adds up to what appears to me to be a significant “cover up” of politicized wrong-doing and a mass denial of Due Process orchestrated by the Administration through the Department of Justice.

Why are the Administration, DHS, and DOJ so afraid of giving asylum applicants fair access to lawyers, time to prepare and document their cases, and timely fair hearings before impartial quasi-judicial adjudicators whose  sole focus is getting the right substantive result, rather than achieving some type of assembly line enforcement-related “production quotas?”

Why waste time on “gimmicks” — most of which eventually prove to be illegal, ineffective, or both — rather than  concentrating on getting to the merits of these cases in a timely manner and “letting the chips fall where they may.”

Surely, among a largely artificially created 1.1 million case “backlog” there are hundreds of thousands of cases that could be “administratively closed” as an exercise of prosecutorial discretion to allow more recently arrived cases to be timely heard without increasing backlogs or creating further wasteful “Aimless Docket Reshuffling.”

Eventually, the “mask will be ripped off” what’s really happening in  our U.S. Immigration Court system. When that happens, the results could be ugly and damaging to the reputations of those orchestrating and enabling what certainly appears to be a disgraceful and intentional miscarriage of justice!

The most dangerous place for women is in their own homes, a new report from the United Nations concludes.

The U.N. Office on Drugs and Crime (UNODC) released the “Global Study on Homicide: Gender-related Killing of Women and Girls” on Sunday to coincide with the International Day for the Elimination of Violence Against Women. The report analyzed the violence perpetrated against women worldwide in 2017, looking at intimate partner violence and family-related killings such as dowry- and honor-related murders.

Last year, 87,000 women were murdered around the world, and more than half (50,000 or 58 percent) were killed by partners or family members. Over a third (30,000) of those intentionally killed last year were murdered by a current or former intimate partner. This means that, globally, six women are killed every hour by someone they know.

U.N. Secretary-General António Guterres described violence against women as a “global pandemic” in a Sunday statement marking the international day of recognition.

“It is a moral affront to all women and girls, a mark of shame on all our societies and a major obstacle to inclusive, equitable and sustainable development,” he said. “At its core, violence against women and girls is the manifestation of a profound lack of respect ― a failure by men to recognize the inherent equality and dignity of women. It is an issue of fundamental human rights.”

The U.N. report also highlighted that women are much more likely to die from domestic violence than men are. According to the study, 82 percent of intimate partner homicide victims are women and 18 percent are men.

“While the vast majority of homicide victims are men, women continue to pay the highest price as a result of gender inequality, discrimination and negative stereotypes. They are also the most likely to be killed by intimate partners and family,” UNODC Executive Director Yury Fedotov said.

The study suggested that violence against women has increased in the last five years, drawing on data from 2012 in which 48,000 (47 percent) of female homicides were perpetrated by intimate partners or family members.

Geographically, Asia had the most female homicides (20,000) perpetrated by intimate partners or family members in 2017, followed by Africa (19,000), North and South America (8,000), Europe (3,000) and Oceania (300). The U.N. does point out that because the intimate partner and family-related homicide rate is 3.1 per 10,000 female population, Africa is actually the continent where women are at the greatest risk of being murdered by a partner or family member.

And, there is an ever-growing body of expert information publicly available to establish that, totally contrary to Sessions’s bad-faith distortion of the record in A-B-, many countries of the world are unwilling, unable, or both unwilling and unable to offer a reasonable level of protection to women facing gender-based persecution in the form of DV. 

Sessions has unwittingly set the wheels of positive change in motion! It’s time to force judges at all levels, legislators, and government officials to recognize the reality of gender-based persecution in today’s world and that it is one of the major forms of persecution clearly covered by the U.N. Convention.

Forget about the bogus “floodgates” argument.  The U.N. Convention came directly out of World War II and was intended to insure that the Holocaust and the “Red Terror” did not happen again.  The definition would clearly have covered most of the pre-War European Jewish population and tens of millions (perhaps hundreds of millions) of individuals stuck behind the Iron Curtin. If the numbers are large, then it’s up to the signatory countries to come together, pool resources, and think of constructive ways of addressing the problems that generate refugee flows, not just inventing creative ways of avoiding their legal and moral responsibilities.

NY TIMES: David J. Bier @ CATO Tells How Trump is Skirting Congress & The Law To Destroy Legal Immigration & Darken The Future Of America!

At his postelection news conference, President Trump said of immigrants traveling to the United States, “I want them to come into the country, but they need to come in legally.” Yet newly released government data show that so far in 2018, the Trump administration is denying applications submitted to the United States Citizenship and Immigration Services at a rate 37 percent higher than the Obama administration did in 2016.

This makes no sense: Depriving immigrants of legal immigration options works against the president’s stated goal of increasing economic growth.

A new analysis for the Cato Institute has found that the Department of Homeland Security rejected 11.3 percent of requests to the immigration agency, which include those for work permits, travel documents and status applications, based on family reunification, employment and other grounds, in the first nine months of 2018. This is the highest rate of denial on record and means that by the end of the year, the United States government will have rejected around 620,000 people — about 155,000 more than in 2016.

This increase in denials cannot be credited to an overall rise in applications. In fact, the total number of applications so far this year is 2 percent lower than in 2016. It could be that the higher denial rate is also discouraging some people from applying at all.

In 2018, the D.H.S. turned away 10 percent of applicants for employment authorization documents compared with 6 percent in 2016, and it rejected applications for advanced parole — which gives temporary residents the authorization to travel internationally and return — at a clip of 18 percent, more than doubling the rate in 2016. Even skilled workers are being rejected at higher rates. The denial rate for petitions for temporary foreign workers shot to 23 percent from 17 percent. The application for permanent workers saw denials rise to 9 percent from 6 percent.

The largest increase in the denial rate for family-sponsored applications, for petitions for fiancés, rose to 21 percent from 14 percent.

Greg Siskind, a Memphis-based immigration attorney with three decades of experience, told me that these numbers back up the anecdotes that he has been hearing from colleagues across the country. The increase in denials, he said, is “significant enough to make one think that Congress must have passed legislation changing the requirements. But we know they have not.”

So what is going on?

Last year, the Trump administration increased the length of immigration applications by double, triple or even more, making them more time-consuming and complicated than ever. This made mistakes far more likely. This year, it also made it easier to deny applicants outright without giving them an opportunity to submit clarifying information. The agency has also made moves to police caseworkers who may be, in its view, too lenient.

Mr. Trump’s political appointees to the D.H.S. have also seized on his rhetorical attacks on immigrants, as well as executive orders like the “Buy American and Hire American” order and another mandating extensive vetting of foreigners, as a justification for a crackdown on legal immigration.

As a result of all this, total immigration to the United States has declined under President Trump, and fewer foreign travelers have been entering the country. These trends are surprising, because the economies of the United States and almost all other countries are growing, which usually generates more travel and immigration. The best explanation for this discrepancy is that the president’s policies are having their intended effect: reducing legal immigration to this country.

This is happening at a time when there are more job openings than job seekers in the United States. This month, Federal Reserve Chairman Jay Powell stated that fewer immigrants and foreign workers would slow economic growth by limiting the ability of businesses to expand.

On some level, President Trump appears to understand this reality, but his policies are making the situation worse.

The answer is actually pretty simple, David. Trump lies, particularly when he repeats the racist restrictionist disingenuous claim that he “just wants legal immigrants.” I call BS! His pejorative use of the term “chain migration” and his bogus proposals for a fake “merit based” (read “no”) immigration system clearly belies any such claim.

His policies are driven by a toxic combination of intentional ignorance, hatred, White Nationalism, and political opportunism. You don’t have to be a rocket scientist to know that policies driven by such evil and irrational motives are going to produce irrational and highly counterproductive results.

Welcome to the Age of Trump & His GOP, David! Where’ve you been? What have you and your colleagues at CATO been doing to insure that Trump and the GOP are sent packing and replaced with leaders (e.g., Democrats, at least at present) who both understand and are willing to stand up for the national interest?

CATO is supported to a large extent by the Koch Bros. While I actually agree with some of their ideas, respect that they actually employ folks producing useful goods and apparently treat them reasonably well, and I occasionally attend CATO seminars, the “Bros” generally have been supporters and enablers of Trump, Pence, and the current GOP kakistocracy.

They helped prop up the truly reprehensible Scott Walker who wasted money, divided Wisconsin, demeaned education, tanked the infrastructure, screwed the environment, and diminished the state in almost every way. It turned what had been a fairly progressive, “midwest friendly,” and cooperative state into a leader in the “race to the bottom.” And, their support for the ugly and unprincipled opposition to Senator Tammy Baldwin was beyond despicable!

I think you and your CATO colleagues largely see where history is going. But, until you get out there and actively work for the Constitutional removal of Trump (and his toady Mike Pence), the defeat of the “Trump GOP,” and the return of “government for all the people” you will remain on the “wrong side of history.” Your dream of an economically prosperous and powerful America continuing to lead the world into the future will be just that — a dream that will never be fulfilled as long as racism and White Nationalism overrule reason!

America needs a two party system (or more). And, I believe there’s plenty of room and a need for a fiscally conservative, pro business, labor friendly, non-racist, non-White-Nationalist, non-homophobic party that challenges the idea that we can solve all problems by just throwing money at them. Not saying I’d join it, but I can see the need for it. But, the current GOP is nothing of the sort — talk about disingenuous rhetoric and total fiscal irresponsibility!

That day, the mothers scoured the site outside El Fuerte, a town in Sinaloa state, on Mexico’s northern Pacific Coast, looking for one of two men presumably kidnapped by cartel gunmen in recent weeks. One body had already been found in a field. The women believed the other may be nearby. In the end, they came up empty.

“This is my life,” said Mirna Medina, a forceful woman who holds the group together. “Digging up holes.”

Her son, who sold CDs by a gas station, was kidnapped in 2014. Three years later to the day, she and the other mothers of the search group dug up his remains. “I felt his presence,” she said, remembering the day and breaking out in tears. “I wanted to find him alive, but at least I found him.”

Some 37,000 people in Mexico are categorized as “missing” by the government. The vast majority are believed to be dead, victims of the country’s spiraling violence that has claimed more than 250,000 lives since 2006. The country’s murder rate has more than doubled to 26 per 100,000 residents, five times the U.S. figure.

Because the missing aren’t counted as part of the country’s official murder tally, it is likely Mexico’s rate itself is higher.

The killing and the number of missing grow each year. Last year, 5,500 people disappeared, up from 3,400 in 2015. Mexico’s murders are up another 18% through September this year.

Victims’ families, mostly mothers, organize search parties, climbing down ravines or scouring trash dumps. Their technique is crude. Sometimes they hire laborers to hammer steel rods into the soil and haul them up to see if they smell like decomposition. Other times, they simply look for an exposed body part or shallow grave.

The sheer numbers of the disappeared now rival more famous cases of missing people in Latin American history.

The Disappeared, or Desaparecidos, became a chilling part of Latin America’s vocabulary during the Cold War, when security forces kidnapped, killed and disposed of the bodies of tens of thousands of leftist guerrillas as well as civilian sympathizers. The most infamous case is Argentina’s “Dirty War,” where at least 10,000 people vanished from 1976 to 1983. In Buenos Aires, mothers of the missing organized weekly vigils in front of Argentina’s presidential palace, gaining world-wide prominence.

Mexico fought its own far-smaller war against Marxist guerrillas during the 1970s. According to the government human-rights commission, 532 people went missing, and at least 275 people were summarily executed by security forces.

This time around, the horror in Mexico is bigger and its causes more complex. Many of the disappeared in recent years are believed to be the victims of violence unleashed by criminal gangs fighting to control drug routes and other lucrative businesses such as extortion, kidnapping and the theft of gasoline from pipelines, often with the complicity of police forces, government officials say.

“It’s a crisis of civilization in Mexico,” said Javier Sicilia, a poet and victims’ advocate whose son was murdered in 2011. “It’s diabolical—an unprecedented perversity to disappear human beings and erase any trace of them from the world.”

The trauma of Mexico’s missing is an open wound in the nation’s psyche. Families who can’t grieve for their loved ones spend the day alternating between doubt and despair, praying for, and dreading, the blessing of certainty.

“We don’t sleep nights, we have nightmares wondering what happened, where can he be,” said Maria Lugo, 62, whose son disappeared in 2015.

Obviously, by no stretch of the imagination is Mexico a “Safe Third Country” for purposes of U.S. asylum law. The brazen attempt by the Trump Administration and GOP Senators led by Chuck Grassley and Mike Lee to force such an agreement down the throat of Mexico is as disingenuous as it is immoral.

It also is appalling the number of Trump Administration senior immigration officials who parrot the bogus claim that “refugees from Central America are required to apply for asylum in Mexico.” Neither international law nor U.S. law imposes such a requirement, for good reasons. Actually, the single “Safe Third Country Agreement” that we have negotiated with Canada in compliance with our immigration laws is quite circumscribed and very limited in scope. And, there are ongoing efforts in Canada to force Canada to withdraw from this agreement because of the Trump Administration’s mistreatment of asylum applicants.

Nevertheless, as I have previously pointed out, given conditions in the Northern Triangle, while Mexico isn’t a “Safe Third Country” for purposes of our law, it might well be a “safer third country,” in practical terms, for many Central American refugees and their families. It’s bigger than the Northern Triangle countries, somewhat better governed than the “failed states” of the Northern Triangle, easier and less dangerous to reach, has more economic opportunities and resettlement options, and is generally (although, sadly, not always) not as overtly hostile to refugees as is the U.S. under Trump.

To encourage (rather than attempt to force) more individuals to apply for asylum in Mexico, our Government should:

  •  Publicly acknowledge and treat the migration from Central America as a “humanitarian situation,” rather than a law enforcement issue;
  • Work with the UNHCR and Mexican authorities to improve asylum processing, adjudication, and resettlement in Mexico;
  • Provide financial aid and incentives for Mexico to improve its asylum system (rather than law enforcement money or threats to cut off funding);
  • Emphasize to Central American refugees the possible benefits of applying for asylum in Mexico (or elsewhere), rather than threatening them and trying to intimidate them from coming to the U.S.
  • Finally, and most important, the U.S. should be taking a leadership role with the UNHCR and other countries in our hemisphere to address the endemic problems in the Northern Triangle that are creating these refugee flows.

Refugee situations are complex, on a number of levels. They won’t be solved by the simplistic approaches (a/k/a political stunts) currently being taken by the Trump Administration, including the ridiculous “Wall.” Indeed, they can’t be solved by any single country. It takes the countries of the world working together to resolve them. That’s exactly what the mechanisms set up under the U.N. Convention on Refugees were intended to do. It’s beyond foolish for our Government to ignore them.

APPLETON – Heritier Muhorana talks to his wife and daughter every day.

He can hear their voices on the phone. He can look at their faces on a screen. But for more than three years, he hasn’t seen them in person.

In 2000, Muhorana fled horrific violence in the Democratic Republic of Congo for the relative safety of crowded refugee camps in Burundi, a neighboring country in central Africa.

Muhorana met his wife, Chantal, in one of those refugee camps. That’s where they got married. But in late 2014, Muhorana was approved for resettlement in the U.S. — a process that took nearly two years and began before he was married.

He came alone to the U.S. in 2015, expecting his wife would be able to join him soon after. That didn’t happen. His daughter, Deborah, will be 3 years old in December. He has never met her in person.

His wife and daughter left the refugee camps and now live in Bujumbura, the capital of Burundi. They’re working with World Relief Fox Valley in an effort to get to the U.S., but so far haven’t been successful.

Muhorana tries to stay positive, but it’s difficult not to be frustrated. He doesn’t know when his family will be back together.

“This experience will never happen to me again,” he said. “It’s a very bad experience, not to be with your family.”

The situation isn’t likely to improve anytime soon. The number of refugees being allowed to settle in the U.S. has sharply fallen in the last two years.

In September, the Trump administration announced a plan to limit the number of refugees allowed to resettle in the U.S. this fiscal year to 30,000, down from a limit of 45,000 set last fiscal year — already the lowest since Congress passed the Refugee Act in 1980. The limit during the final year of the Obama administration was 110,000.

Despite the limit of 45,000 last fiscal year, the U.S. only admitted 22,491 refugees, which is the lowest number in decades, according to State Department records.

About 25.4 million refugees exist worldwide, according the U.N. refugee agency.

The number of refugees arriving in northeast Wisconsin has also significantly declined in the last two years. World Relief Fox Valley, which has offices in Appleton and Oshkosh, had 209 arrivals in fiscal year 2016. That fell to 70 in fiscal year 2017 and 57 in fiscal year 2018, which ended Sept. 30.

Phil Stoffel, immigration manager for World Relief Fox Valley, said the situation for refugees trying to bring close relatives to the U.S. has gotten more difficult recently.

“People all across the nation in networks and affiliates that we work with are telling me they’re not getting any answers for any of these cases right now,” he said.

Many refugees have started to lose trust in the system they’re relying on to help them, Stoffel said. World Relief Fox Valley has at least 50 cases of refugees trying to bring close relatives to the U.S., but it doesn’t appear anything is going to change in the near future, he said.

“There’s no other way to explain what’s going on,” he said. “The politics in this are really bad right now.”

Stoffel has one piece of advice to anyone unsure whether the U.S. should welcome refugees at all: meet one.

“Once you meet one, it changes,” he said.

‘A very tough moment’

In 1998, Muhorana fled with his family from their village in Katanga, a former province in the southern part of Congo. The country was descending into war. He was just 12 years old.

He still remembers the night they left. It was about 6 p.m. That’s when they started walking. They didn’t stop until about 2 p.m. the next day. And his family wasn’t alone.

“Thousands of people moving at one time, just walking,” he said. “It was very painful.”

Muhorana didn’t bring much with him, other than what he could carry. He remembers a cousin asking him to hold a bottle for her baby, to help her as they were walking.

They walked for weeks without enough food to eat and in constant danger of being caught up in the violence unfolding around them.

“At that time, what mattered was just to save our lives,” he said.

But they couldn’t always avoid the fighting. The exposure to violence left many people traumatized — or worse, Muhorana said.

“I saw some people who were hurt or shot, some other people were killed on the way,” he said. “It was a very tough moment.”

Muhorana, though, safely found his way to Kalemie, a town on the western shore of Lake Tanganyika, where a relief organization provided food to the crowd of refugees. He stayed there for more than a month, but safety was still a concern.

He eventually continued north to South Kivu, a province near the border with Burundi, and stayed there for almost two years, despite treacherous living conditions. He stayed in churches or schools, often in close quarters with thousands of other people.

“We didn’t have enough food to eat. We didn’t have medical assistance,” he said. “So, everything was just a little bit. It wasn’t enough.”

Disease was a problem, too. Many people got sick. Some died. But safety from the violence remained the primary concern, Muhorana said.

“People were still being killed there,” he said.

He couldn’t think about his plans for the future. The situation didn’t allow it. So, in an effort to find peace and a place he could think about his goals in life, he and his family decided to flee for Burundi.

‘We were limited’

Muhorana was a teenager by the time his family crossed the border into Burundi and arrived at their first refugee camp. They stayed for more than a year, then were forced to move to another camp in the northeast part of country.

The violence unfolding in Congo was behind them. But in the camps, his family encountered other problems. Sickness, mostly.

“I would see people dying every month, every year,” Muhorana said. “You bury a lot of people.”

Their camp was packed with about 10,000 people, he said. And it wasn’t the only camp around. Burundi had multiple refugee camps set up for those fleeing across the border.

The camp was not a good place to live, Muhorana said. He felt trapped, unable to go anywhere without asking permission first.

“When you are young, you have dreams. You have goals. You have ambition. You have something in your heart you desire to achieve,” he said. “In the camp, we were limited.”

Still, despite the limitations, Muhorana found a way to work toward a better life. He left the camp after a few years and made his way to Rwanda, a country to the north of Burundi. There, he was able to finish high school and get a college scholarship, which he used to earn a bachelor’s degree in business.

Then, in 2013, Muhorana returned to the camp, where his family still lived. That’s when he met the woman who later became his wife. She had fled a similar situation in Congo and was already living in the camp when he returned.

He found a lot to like about her, Muhorana said, but her generosity stood out to him. The prospect of getting married in the camp wasn’t ideal, he said. But, in 2015, without other options, that’s exactly what he did.

He hadn’t specifically planned on coming to the U.S. — he simply wanted to find a country where he could live a normal life. But when he was approved for resettlement in the U.S., the prospect excited him.

“We were thinking that maybe life was going to be different than what we have here,” he said.

The process of getting approved for resettlement took nearly two years. And when it was over, Muhorana didn’t get to choose where he was sent. His wife, who hadn’t yet been approved, wouldn’t be able to join him.

“We couldn’t travel together because I was already at the final step,” he said. “I was already ready to come.”

So, with no other choice, he left on his own.

‘Change will come’

Muhorana didn’t speak English — not much, at least — when he arrived in the U.S. in 2015. And that was far from the only challenge he faced.

He was thrilled to arrive, but those first few years weren’t easy at all, he said. The culture was entirely new to him and it took time to adjust.

“I couldn’t imagine that I would have friends and I would get familiar with people here,” he said.

World Relief Fox Valley has services meant to help refugees acclimate to life in the U.S., said Tami McLaughlin, the organization’s executive director.

The organization recruits volunteers who spend time with refugees and serve as companions and valuable sources of information, McLaughlin said.

“Those friendships make the difference in how well somebody transitions into a completely new culture and community,” she said.

To do basic things, such as apply for a job, enroll a child in school, or get health care, can be overwhelming at first for refugees who are often simply relieved to be safe, McLaughlin said.

“You celebrate the little wins and take the little steps,” she said.

As much as Muhorana tries to remain optimistic about his future, it’s difficult not to be upset with his wife and daughter living thousands of miles away, he said.

The conversations he has with them tend to focus, almost inevitably, on when they might see each other again.They’re still working hard to have a life together, despite the distance between them.

“I try to share my life, my experience here, so I can tell them the difference,” he said.

Muhorana has been working with Stoffel, the immigration manager, for about two years to get his wife and daughter to the U.S., but it’s unclear how much progress they’ve made.

“I can’t begin to tell you how much paperwork we’ve had to file and go through,” Stoffel said. “It’s just a constant back-and-forth with no clear answers from the government.”

Any refugee trying to enter the U.S. has to go through exhaustive background checks, according to U.S. Citizen and Immigration Services. Muhorana’s wife and daughter both have passed those checks, but attempts to get updates on the status of their case have gone unanswered, Stoffel said.

But despite the frustration and the length of time the couple has spent apart, his wife is still excited by the idea of coming to the U.S., Muhorana said.

“She can dream of a bright future too,” he said.

For now, Muhorana will wait. It’s all he can do.

“In life, nothing is permanent,” he said. “Everything is subject to change. So, change will come.”

LONDON — President Trump’s promise to stop a caravan of Central American migrants from reaching the United States border, if necessary through military force, might seem like just another effort by the president to unilaterally dismantle international laws and accepted practices.

But there is one important difference between this and Mr. Trump’s go-it-alone defiance of climate change agreements, trade deals or arms control treaties. In attacking the long accepted means of protecting refugees and upholding stability in times of mass displacement, he’s got company. Lots and lots of company.

There is no shortage of countries that also skirt, and therefore undermine, global refugee rules. The European Union and Australia are two of the biggest offenders. Peru and Ecuador are restricting Venezuelan refugees, while Tanzania is working to push out Burundians.

In 2015, as Rohingya refugees fled Myanmar on overcrowded boats, the governments of Indonesia, Malaysia and Thailand — in a move that might make even Mr. Trump blush — pushed the boats out to sea, stranding them, to prevent them from reaching safe shores.

Still, countries tend to hide their violations by presenting themselves as following the letter of the law, or by dressing up anti-refugee measures in humanitarian terms. But Mr. Trump is selling his harsh treatment of asylum-seekers as deliberate. And even if he is not the first to breach the rules, he is contributing to their breakdown in ways that could have global consequences.

“The more brazen you get, like Trump, and the more frequent you get, you can easily imagine a norm being completely torn down,” said Stephanie Schwartz, a migration expert at the University of Pennsylvania, who added that Mr. Trump was “taking an ax” to “one of the strongest norms we’ve got in international law” — the right of a refugee to seek asylum.

To consider how that would happen and what it would mean, it helps to understand the basics of asylum and how Mr. Trump fits into its erosion.

The resurgence of populist and nationalist politics also bodes poorly. Us-vs-them movements, skeptical of international agreements and immigration, have little interest in asylum’s foundational concepts of global burden-sharing or universal rights.

If asylum rights were declining even in the era of sunny 1990s global liberalism, it is hard to imagine their doing much better in the era of Donald J. Trump, Viktor Orban and Vladimir V. Putin.

“It takes a really, really long time to build these norms, especially when they restrict government actions in some way,” Ms. Schwartz said. “It’s so much easier to take them down.”

If that happens, the consequences will be most felt far away from the United States-Mexico border, in places like Honduras, Myanmar, Jordan or Burundi, where millions of people displaced by war or persecution will have to go without the protections once promised by a world that had agreed “never again.”
