Ninth Circuit ruling could wipe out hundreds of family separations convictions

WASHINGTON — A federal appeals court in California substantially narrowed the government’s ability to charge people for crossing the border illegally — a case that could invalidate hundreds of prosecutions that were at the core of the Trump administration’s separations of migrant families last year.

The ruling comes as the federal law in the case, which makes it a crime to cross the border without authorization, is under scrutiny in the Democratic presidential campaign, with several candidates arguing it should be done away with altogether.

Wednesday’s ruling by a three-judge panel of the Ninth U.S. Circuit Court of Appeals in Pasadena could bolster the Democrats’ argument that the Trump administration is misusing the law to criminalize well-intentioned immigrants seeking asylum. It also adds further questions to the administration’s widely criticized prosecutions that resulted in thousands of family separations last year.

The Justice Department did not respond to a request for comment Thursday.

The 2-1 decision overturning a lower court ruling concerned the provision of U.S. law that makes improper entry to the country a misdemeanor, punishable by up to six months in jail. The law has three parts: entering the U.S. at an improper time or place, eluding immigration officers or entering the U.S. using false pretenses.

In an opinion written by Judge Jay Bybee, a George W. Bush-appointee, the court decided that the second part — eluding officers — could only apply to immigrants who are at a valid border crossing but who try to enter by evading detection, not immigrants picked up on the U.S. side having crossed somewhere else. That was the case with Oracio Corrales-Vazquez, a Mexican national whom officers found hiding in bushes miles from the border, whose conviction the court overturned.

Because part one of the statute already covers immigrants who surreptitiously enter where there is no legal crossing, the court held, the second part must exist to cover some separate activity. Otherwise, the court said, it would be redundant.

Circuit has already held that part one of the illegal-entry crime — entering at an improper time or place — does not apply to people who cross the border where officials can see them, in person or over cameras, and then seek out an officer and claim asylum. Those migrants are clearly not trying to avoid detection, court rulings have held.

It has become standard practice for federal authorities in Southern California to charge border crossers only using part two to avoid the defense to part one, said Kara Hartzler, an attorney with the nonprofit San Diego Federal Defenders who brought the case. Now, federal attorneys will not have part two as a back door to charge asylum seekers with illegal entry.

The court ruling means thousands of similar convictions could be thrown out, including hundreds that were the basis for family separations the Trump administration carried out last summer in the name of prosecuting a crime.

“All of the criminal cases that led to being separated from their families, … at least in San Diego, are at least convictions where the person was actually innocent because of this ruling,” Hartzler said.

David Leopold, a former president and general counsel of the American Immigration Lawyers Association, recalled then-Homeland Security Secretary Kirstjen Nielsen telling Congress the family separations were justified because the adults taken into custody had been charged with illegal-entry crimes.

“Well, here they weren’t even prosecuting those cases correctly,” Leopold said. “It puts a question mark next to every one of those convictions, which led to separation of children and in some cases the permanent separation of child from parent.”

The Trump administration separated thousands of families in the two months the program was in effect, before the president stopped it and a federal judge in San Diego ruled the practice was unconstitutional. In hundreds of those cases, parents were deported without their children, many of whom will not be reunited as the youths pursue a right to stay in the U.S.

The Justice Department does not make prosecution data public that would identify how many separated families could be affected by Wednesday’s ruling, but there could be hundreds of such cases. Nearly 4,000 immigration-related offenses were brought in the Southern District of California in 2018, according to court data, of which the most common charge is illegal entry.

The ruling also comes as some Democrats are attacking the notion that crossing the border should be a criminal rather than civil offense. Former Housing Secretary Julián Castro has made repealing the law a central focus of his presidential campaign, pointing to the Trump administration’s use of the law as a justification for separating the families last year. Twelve Democratic candidates have embraced the idea, according to a Politico tracker.

Castro and other critics of the law say it criminalizes asylum seeking. Other parts of the law make clear that an immigrant can file an asylum claim regardless of whether they entered the country legally.

Bill Hing, professor of law and migration studies at University of San Francisco, supports Castro’s arguments to remove the criminal part of the law, saying deportation is “already a pretty severe penalty” for anyone found not to have a valid asylum claim.

“Especially now, the vast majority of people gathered at the border are coming to seek protection — why criminalize that activity?” Hing said. “The statute should require something much more criminal in intent, and when it’s just simply to cross the border to seek protection, I think there’s a good argument that we should decriminalize that activity.”

The ruling applies only to the nine states covered by the Ninth Circuit, including California and Arizona along the Mexican border. But Hing says lawyers could seek similar rulings in other border states.

“Conceptually it actually makes sense,” Hing said. “It doesn’t make sense to have two parts of a law where the same act could qualify for the violation of both.”

Appointed by President George W. Bush, Judge Jay Bybee has been a controversial figure. His confirmation was strongly opposed by many Human Rights and Civil Rights groups because of his role in justifying torture while serving in the Bush DOJ.

Unfortunately, this much needed decision comes too late for many families who have been irreparably damaged by “Gonzo Apolcalypto’s” vile illegal and immoral abuse of Government prosecutorial authority. It’s too bad that there does not appear to be any way of holding “Gonzo Apocalypto” Sessions personally liable for his abuse of office, unconscionable distortion of our justice system, and the lifetime damage he inflicted on so many innocent children and families.

Judge orders U.S. to hold asylum seeker

Doubtful about his mental state, jurist prevents migrant from being sent to Mexico.

SAN DIEGO — An immigration judge has ordered the Department of Homeland Security to keep a Honduran asylum seeker in the United States while he waits for his court proceedings, instead of returning him to Mexico again under a Trump administration program.

Judge Scott Simpson said that after evaluating the man’s mental competence in a special hearing on Friday, he found that the man would need safeguards in his case to ensure due process. He ordered one put in place immediately: to remove the man from a program known officially as Migrant Protection Protocols and more widely as “Remain in Mexico.”

“I find that he lacks a rational and factual understanding of the nature of the proceedings,” Simpson said in issuing his order.

This is the first time that a judge has made such a ruling since the program was implemented in January, according to advocates who have been monitoring immigration court proceedings.

The program requires certain asylum seekers from Honduras, El Salvador and Guatemala to wait in Mexico while their cases progress in immigration court. The man has been waiting in Tijuana as part of the program for several months.

A Customs and Border Protection guide for officials implementing the program says that migrants with known physical or mental health issues should not be included.

“It’s a big deal that a judge recognized that there was a predatory nature to having put this person in the ‘Migrant Persecution Protocols,’ ” said Ian Philabaum of Innovation Law Lab, calling the program a name used by some immigrant rights advocates. “He wasn’t going to have a chance, and now he gets a chance.”

At the man’s first hearing in March, Simpson quickly became concerned that the man might have a mental competency issue that would make him ineligible for the program or require other protections. He ordered DHS to evaluate the man’s mental state.

Simpson asked government attorneys at each hearing after that whether the man’s mental state had been evaluated and whether the government believed he should continue to be included in the program.

Each time, the government attorney responded that the man should continue in MPP.

Still skeptical, Simpson told Immigration and Customs Enforcement attorney Dan Hua to be prepared to give details Friday about DHS’s evaluation of the man before he was returned to Mexico. When the judge came into court Friday morning, Hua was not able to answer that question.

“The government’s inability to provide that information is simply not excusable,” Simpson said. He gave Hua 30 minutes to find out answers.

Hua said immigration officials at the port of entry had evaluated the man each time he’d come to court, meaning that as of Friday, he’d been evaluated four times.

The attorney could not produce evidence showing what the evaluation observed or what standard it used when the judge pressed for more details.

Philabaum said that fact was significant.

“That assessment of the mental competency was performed on four different occasions, and on four different occasions, according to the U.S. government attorney, their assessment was he was perfectly competent to proceed with his immigration case representing himself,” Philabaum said. But in the man’s “first hearing, it took the immigration judge approximately two minutes to realize there was an issue of competency here.

“Whatever type of standard that CBP has instituted to assess the competency of an individual to be eligible, according to the immigration judge today, it has failed.”

DHS officials, CBP officials and Department of Justice officials did respond to a request for comment.

Simpson decided to do his own evaluation of the man’s mental state under an immigration court precedent known as the Matter of MAM.

He listed the rights that the man has, such as the right to present evidence and the right to question witnesses. He asked if the man understood his rights.

“Um, yes. I need more,” said the man through a Spanish interpreter. “I need more because here I only have some letters, some birth certificates. They’re not translated into English yet.”

“Sir, I’m the immigration judge in your case. It’s my job to decide whether you can stay in the United States,” Simpson said. “In your own words, tell me who am I and what’s my job.”

“I cannot understand you,” the man responded.

In the end, the man was only able to appropriately respond to simple questions such as the date and what city he was in. He told the judge he had not had much schooling and couldn’t read or write.

ICE later confirmed the man is pending transfer to the agency’s custody. He could be taken to an immigration detention facility or released “on parole” into the U.S. to a sponsor while he waits for his next hearing.

Simpson said that depending which option the government chooses, other safeguards may be necessary, including providing an attorney for him if he’s detained.

Every day the human carnage mounts as the 9th Circuit continues to “sponsor” Trump’s illegal, deadly, and unconstitutional “Remain in Mexico Program.” Interesting how a few non-life-tenured Immigration Judges in San Diego and one courageous U.S. District Judge in the Southern District of California seem to be the only Federal officials interested in either the rule of law or the Due Process Clause of our Constitution. Go figure! 

Congrats to Judge Scott Simpson for standing up for the rule of law and the rights of the most vulnerable in the face of massive dereliction of duty by those higher up the line.

Sadly, unlike the 9th Circuit, Judge Simpson lacks authority to enjoin further violations of the law and human rights by the Trump Administration. How many more human beings will suffer, be wronged, and perhaps die as a result of the 9th Circuit’s complicity in scofflaw behavior having little or nothing to do with protecting our borders or any other legitimate policy end and everything to do with punishing and dehumanizing those who seek justice under our laws.?

(Reuters) – Over two hours on June 1, a Honduran teenager named Tania pleaded with a U.S. official not to be returned to Mexico.

Immigration authorities had allowed her mother and younger sisters into the United States two months earlier to pursue claims for asylum in U.S. immigration court. But they sent Tania back to Tijuana on her own, with no money and no place to stay.

The 18-year-old said she told the U.S. official she had seen people on the streets of Tijuana linked to the Honduran gang that had terrorized her family. She explained that she did not feel safe there.

After the interview, meant to assess her fear of return to Mexico, she hoped to be reunited with her family in California, she said. Instead, she was sent back to Mexico under a Trump administration policy called the “Migrant Protection Protocols”(MPP), which has forced more than 11,000 asylum seekers to wait on the Mexican side of the border for their U.S. court cases to be completed. That process can take months.

Tania’s is not an unusual case. Once asylum seekers are ordered to wait in Mexico, their chances of getting that decision reversed on safety grounds – allowing them to wait out their proceedings in the United States – are exceedingly small, a Reuters analysis of U.S. immigration court data from the Executive Office for Immigration Review (EOIR) shows.

A complicit panel of 9th Circuit Judges vacated a proper lower court injunction that was preventing this type of intentional child abuse by the Trump Administration. It’s worth noting that almost every “ameliorating exception” described in the first paragraph of the panel’s opinion is demonstrably untrue — children and those clearly in danger are being returned and the “discretionary parole” is largely a fraud that seldom is granted — according to the Government’s own data (which likely is also falsified or manipulated to some extent to mask or distort abuses). In other words, a “three-reporter panel” of Reuters is more interested and capable of getting to truth than a panel of life-tenured judges.

Oh, that it could be these judges’ kids or grandkids separated from family and sent to live on the mean streets of Tijuana while pursuing their legal rights under US law. Really, how do these child abusers and human rights scofflaws hiding in judicial robes sleep at night?

Guess the can’t hear the screams and moans of those whose rights they are failing to protect and whose human dignity they reject. I’ve heard eyewitness accounts and seen video evidence from the pro bono lawyers courageously (and sometimes at the risk of their own health and safety) trying to protect the lives and rights of asylum seekers at the Southern Border from these abuses of human rights that are enabled by “Remain in Mexico” (a/k/a the disingenuously named “Migrant Protection Protocols”). The truth is no secret for those who actually seek it rather than to ignore it.

Complicit Article III Judges and Government lawyers are keys to Trump’s “dehumanization” program. History must hold them accountable for their abuses of humanity.

ANALYSIS:  Trump Lays Another Egg On Immigration — Everybody Loses, But It Could Have Been Much, Much Worse

Alexandria, VA, June 9, 2019.  After a week of petulance, threats, and self-created drama, Trump produced a resounding trade and immigration dud. Faced with advisors telling him that he was endangering the economy, the only thing propping up his sagging popularity, a potential rebellion among GOP legislators, and an unexpectedly tough and resolute Mexico, Trump backed off of his insane and blatantly illegal plan to ignore U.S. asylum obligations and thereby rocket the U.S. to the upper echelons of international scofflaws and human rights violators. 

The latter scheme, known as “safe third country,” would have mis-designated Mexico and, incredibly, Guatemala, two clearly “unsafe” countries to do the U.S.’s job by processing tens of thousands of asylum applications from those fleeing the Northern Triangle. Neither of the two countries has a viable, fair, and effective asylum adjudication system and both have major safety and human rights issues.

Instead, Trump accepted a vague compact by which Mexico and the U.S. basically agreed to do what they had already been doing without taking any decisive or effective action to address the actual humanitarian crisis in the Northern Triangle that Trump and his flunkies have consistently mischaracterized as a “law enforcement emergency.” Indeed, the New York Times reported that most of Mexico’s “unprecedented steps” had already been worked out in secret with deposed DHS Secretary Kirstjen Nielsen months ago. https://www.nytimes.com/2019/06/08/us/politics/trump-mexico-deal-tariffs.html. To be sure, desperate and vulnerable asylum seekers, particularly women and children, will continue to abused, raped, beaten, extorted, obscenely tortured, and killed with impunity and little if any recourse as a result of this week’s actions. But, at least for now, the U.S. and Mexico are maintaining much of the basic framework of domestic and international protection laws. 

Contrary to the lies and false narratives spread by Trump and his DHS cronies, U.S. law is not filled with “loopholes.” Rather, it is a fairly straightforward implementation of the international protection regime and treaties that have been in effect since World War II to prevent another holocaust from occurring on our watch. 

If anything, since the enactment of the Refugee Act of 1980, the U.S. has watered down its asylum commitment somewhat by adding a legally tenuous “credible fear” process to “pre-screen” arriving asylum applicants in mass migration situations. However, to date, the DHS under Trump has been too incompetent, misdirected, and frankly downright stupid to utilize this streamlined screening process fairly and efficiently. 

By treating a somewhat predictable humanitarian refugee flow as a bogus “law enforcement problem” and mindlessly shoving cases into a “captive” court system that they already had abused, mismanaged, and destroyed, the Administration lost effective control. In panic, they have tried to blame the refugees, Democrats, Mexico, Obama, judges, the media, and even the truly hapless failed states of the Northern Triangle for their largely self-created human and operational disaster.

The first of the “unprecedented steps,” involves Mexico sending approximately 6,000 National Guard troops to the Guatemalan border to control illegal crossings. Never mind that the Mexican National Guard is a recent creation that exists largely on paper. Also, forget that Mexico has a questionable record of controlling corruption and systematic human rights abuses among its existing police and military forces.

The U.S., a much larger, better organized, and more prosperous country than Mexico, has resorted to militarizing the border, mass incarceration, family concentration camps, kids in cages, malicious criminal prosecutions, family separations, walls, fences, overt political interference in the asylum adjudication system, and violating international protection norms. These “gonzo” enforcement efforts not only failed to stem the tide, but have actually aided smugglers and traffickers and increased the flow of migrants. 

Will newly minted, untrained Mexican troops succeed where the might of the U.S. has failed miserably? Don’t count on it. 

Also, the last time I checked, it appeared that most of the Mexican coast and some parts of the U.S. are reasonably accessible by boat from the Northern Triangle. So, assuming that the Mexicans could “shut down” their land border with Guatemala, why wouldn’t smugglers “take to the sea?” How’s that Mexican Navy?

The second “unprecedented step,” is a continuation and expansion of the existing “Remain in Mexico Program.” This toxic gimmick punishes those who have been legally determined to have a “credible fear” of persecution by making them remain in some of the most dangerous locations in the world where they are intentionally and illegally impeded in many ways from pursuing their U.S. asylum claims from Mexico. To date, this program has only been implemented in a few locations, like San Diego where it has been an unmitigated failure according to a report from Kate Morrissey of the San Diego Union-Tribune. https://immigrationcourtside.com/2019/06/06/cruel-yet-really-stupid-trumps-remain-in-mexico-policy-denies-due-process-while-creating-court-chaos-enfeebled-judges-fume-as-aimless-docket-reshufflin/.

The results of this ill-advised effort by Trump to circumvent U.S. asylum laws reads like a “legal toxicology report:” “Aimless Docket Reshuffling,” mass confusion, lack of information, insufficient and deficient hearing notices, massive violations of the statutory right to be represented by counsel, no opportunity to fairly prepare, document, and present asylum claims, interference with the attorney-client relationship by DHS, and few actual case completions to name just a few of the many abuses. And, how will an already dysfunctional EOIR deal with yet another round of “new priorities” and more “Aimless Docket Reshuffling?”

A Federal District Judge actually enjoined this circus before it could get rolling. But, a “tone-deaf panel” of the Ninth Circuit allowed Trump’s assault on the rule of law to go forward, at least for now. 

Nevertheless, the case remains pending with the Ninth Circuit. As EOIR’s rushed and sloppy work product starts to accumulate on their docket and the bodies and horror stories start to pile up in Mexico, more responsible Circuit Judges might actually force the Administration to comply with the law and the Constitution, not to mention simple human decency.

Mexico has pledged to “accept and protect” those sentenced to remain there. But, the Mexican border locations to which individuals are forced to return are dangerous for a reason. Presumably, if Mexican can’t maintain safety and order for its own citizens, it won’t do any better for vulnerable asylum seekers.

Finally, in third “unprecedented step,” Mexico and the U.S. agreed to promote the “Comprehensive Development Plan launched by the government of Mexico in concert with the governments of El Salvador, Guatemala and Honduras” to create “prosperity, good governance and security in Central America.” This part of the agreement makes the most sense. But “promoting” in this case appears limited to using development funds that were “already in the pipeline” in both countries. In other words, nothing really new here.

This was a golden opportunity for the U.S. to show real leadership by dramatically increasing its investment in bringing stability and prosperity to Mexico and Central America. Additionally, we could have created incentives (rather than threats) and benchmarks for Mexico to improve its asylum adjudication system and human rights performance. Partnering with non-governmental-organizations and legal assistance groups on both sides of the border also would bring much needed expertise in resolving asylum issues to the table.

But, that would have taken a President with vision, empathy, compassion, courage, competency, intelligence, and creative problem solving ability. Trump is the exact antithesis of all of these qualities.

Consequently, sooner or later we can expect Trump’s “latest egg” to fail, like all of his other gimmicks and maliciously incompetent schemes on immigration. Our “child president” will undoubtedly then embark on a new barrage of lies, false narratives, idiotic tweets, idle threats, blame shifting, insults, racist dog whistles, and general nonsense aimed at diverting attention from his own failures as a leader and more critically, as a human being.

Innocent people will be harmed and die, America and Mexico will be embarrassed and diminished, and the world will be a worse place. But, until America figures out how to use its democratic institutions to remove the kakistocracy, the disaster will continue. That it could have been worse, is only small consolation.

Why not strive to be  the “best that we can be,” rather than just “not as bad as we might have been?”

SAN DIEGO — The San Diego immigration court has been overwhelmed by the number of cases judges are hearing under a Trump administration program that returns asylum seekers to Mexico while they wait for hearings in the U.S.

Normally, asylum seekers coming to the California border would be distributed to immigration courts across the country, either because they would be held somewhere in the federal government’s national immigration detention system or because they would be released to reunite with family and friends already in the U.S.

Now, the increasing number of people picked for the administration’s Migrant Protection Protocols, known widely as the Remain in Mexico program, across the California border are all being sent to immigration court in downtown San Diego.

“Other than wallow through it, I don’t know what we can do,” said Immigration Judge Lee O’Connor shortly before walking out of his courtroom at 6:21 p.m. one evening last week after hearing a string of MPP cases. Court staff, including security, had left the building long before.

Immigration judges are already working under performance quotas set by the Trump administration to reduce the immigration court backlog, which has grown nationally to nearly 900,000 cases, according to data from the Transactional Record Access Clearinghouse of Syracuse University.

The San Diego court has more than 5,700 cases pending, up from 4,692 cases in fiscal 2018, a 22.4% increase. Nationally, the backlog has grown about 16.2% in fiscal 2019.

“This is a reflection of the constant doublespeak we’ve been highlighting. The agency has internally conflicting priorities,” said Ashley Tabaddor, speaking in her capacity as head of the National Assn. of Immigration Judges. “It creates chaos.”

On a given day, three of San Diego’s seven judges generally have afternoons full of MPP cases. On a recent Tuesday afternoon, 82 people were scheduled to appear before three judges, 28 of those before O’Connor.

“The judges have no control in terms of how many cases are being scheduled,” Tabaddor said.

Border officials who initially receive migrants either requesting protection at a port of entry or after they’re apprehended crossing illegally are responsible for scheduling the first court appearance for returnees.

Customs and Border Protection did not respond to a request for comment. The Department of Homeland Security was unable to respond to questions in time for publication.

Several of the judges assigned to hear cases in San Diego have pushed back on the government for a laundry list of issues that could be violations of the government’s due process responsibilities under immigration law.

Tabaddor said she’s heard a number of concerns from her union members who are trying to make sure “all of the T’s are crossed and all of the i’s are dotted” in implementation of the new program. “That’s what the oath of office is,” Tabaddor said. “You’re supposed to make sure all the rules are followed.”

One that has come up over and over again is the address put down initially on each asylum seeker’s case documents by border officials. Along the California border, Customs and Border Protection and Border Patrol have written some version of “Domicilio conocido,” or “known address.”

Some have “Tijuana, Baja California, Mexico.” Others simply say “Baja California” without the city or the country noted.

Having an accurate address on file is key to showing that immigrants were given proper notice of their court hearings. That proof of notice is a crucial part of a judge’s decision to proceed “in absentia” and order a person deported if he or she doesn’t show up for a hearing.

“This whole program, I don’t understand it,” said Immigration Judge Jesús Clemente on his first day of hearing MPP cases. “How are we ever going to tell this person that he has a hearing?”

Similarly, when an government attorney suggested that it was the asylum seeker’s responsibility to provide an accurate address, Immigration Judge Scott Simpson responded with incredulity. “Are you saying the respondent provided this address?” he asked, referring to the asylum seeker. “Are you saying every respondent in the MPP program provided this address?”

“I can’t speak to that,” the attorney representing ICE responded. “In my experience, the address the respondent provides is what is put down.”

“That’s how it usually works,” Simpson replied. “But I’m not convinced that’s what’s happening now.”

When asked about the address issue recently, San Ysidro Port of Entry Director Sidney Aki said that migrants don’t often know where they will be staying when they’re first returned.

To prevent any miscommunication, Aki said, they’re told to return to the port of entry at a particular date and time.

Normally, if a judge believes that the government violated an asylum seeker’s due process rights, the judge can terminate immigration proceedings against that person, said attorney Lindsay Toczylowski, executive director of Immigrant Defenders Law Center. Then the asylum seeker can apply for protection outside of immigration court in a process that is less adversarial.

For returnees who are ultimately hoping for asylum in the U.S., termination won’t help them because they’ll be returned to Mexico with no access to the U.S. asylum system, she said.

“It essentially removes their ability to vindicate their due process rights,” Toczylowski said.

Among other issues, the dates on instructions given to returnees that explain when to come back to the San Ysidro Port of Entry to be taken to court don’t always match the dates on their hearing notices. Or, the government fails to file the preliminary paperwork in the case and the immigration court doesn’t have a hearing scheduled for the person when he or she shows up.

“I’m sure you’re frustrated,” Simpson said to a man whose paperwork had not properly been filed by the government, resulting in a delay in the start of his case. “I share your frustration.”

Asylum cases typically have several preliminary hearings, known as “master calendar hearings,” before the “merits hearing,” where evidence is presented for the judge to make a decision on the person’s claim. During those master calendar hearings, asylum seekers are given time to look for attorneys, are told their rights in immigration court, and are given applications to fill out and submit.

Juan, a doctor who fled Honduras after facing threats for his participation in political protest, filed his asylum application in mid-May. His merits hearing was scheduled for November.

Where to live and how to sustain themselves in Tijuana is becoming a larger and larger issue as more asylum seekers are returned. Despite its promises at the program’s outset, Mexico has not given many of the returnees permission to work while they wait.

Tijuana’s migrant shelters are already at or near capacity, and most of the people staying in them are not returnees from the program.

One returnee who had become homeless and tried crossing illegally only to be returned again to Tijuana said he was planning on going back to his country in the coming days. It would be better to die there, he said, than to continue living as he’s been living in Tijuana.

Juan is one of the lucky ones. He is staying at a shelter near the border. Still, he’s worried about the long wait ahead.

“The policy’s name is migrant protection, but they send you to the most dangerous city in Mexico,” he said.

The Ninth Circuit had an opportunity to put at least a temporary halt to this blatant denial of the statutory right to counsel and the constitutional right to adequate notice and Due Process. They “swallowed the whistle.” Eventually, these feckless and complicit Article III courts will find their own dockets overwhelmed with the results of their inaction in the face of a Due Process, operational, and human rights disaster of gargantuan proportions in the U.S. Immigration Courts as mal-administered by the DOJ.

Of course, the real culprit is Congress, which has failed to act to require an independent, constitutional U.S. Immigration Court. But, the word “feckless” doesn’t begin to describe a body that under Mitch McConnell has intentionally ceded its constitutional power to govern and oversee in the overall public interest to an unqualified, scofflaw President who respects neither democratic institutions nor the rule of law.

Immigrants got the job done

History finally has its eyes on Chinese laborers who built transcontinental railroad’s western leg

The nation’s first transcontinental railroad, completed 150 years ago today at Promontory Summit in Utah, connected the vast United States and brought America into the modern age. Chinese immigrants contributed mightily to this feat, but the historical accounts that first transcontinental followed often marginalized their role.

Between 1863 and 1869, as many as 20,000 Chinese workers helped build the treacherous western portion of the railroad, a winding ribbon of track known as the Central Pacific that began in Sacramento.

At first, the Central Pacific Railroad’s directors wanted a whites-only workforce. Leland Stanford, the railroad’s president, had advocated for keeping Asians out of the state in his 1862 inaugural address as governor of California. When not enough white men signed up, the railroad began hiring Chinese men for the backbreaking labor. No women worked on the line.

Company leaders were skeptical of the new recruits’ ability to do the work, but the Chinese laborers proved themselves more than capable — and the railroad barons came to consider them superior to the other workers.

My colleagues and I initiated an international research project — based, appropriately, at Stanford University — to investigate the enormous contribution Chinese workers made to the transcontinental project. It proved to be a formidable task, not least because no written record produced by what were called “railroad Chinese” is known to exist. Without letters, diaries and other primary sources that are historians’ stock in trade, we amassed a sizable collection of evidence that included archaeological findings, ship manifests, payroll records, photographs and observers’ accounts.

The material allowed us to recover a sense of the lived experiences of the thousands of Chinese migrants Leland Stanford came to greatly admire. He told President Andrew Johnson that the Chinese were indispensable to building the railroad: They were “quiet, peaceable, patient, industrious and economical.” In a stockholder report, Stanford described construction as a “herculean task” and said it had been accomplished thanks to the Chinese, who made up 90% of the Central Pacific Railroad’s labor force.

These workers showed their mettle, and sealed their legacy, on the peaks of the Sierra Nevada. Many observers at the time had assumed that Stanford and the railroad were daft for thinking they could link California with the East because an immense mountain range separated the state from Nevada and beyond. The Sierra Nevada is a rugged, formidable range, its inhospitableness encapsulated by the gruesome tragedy of the Donner party in 1847 and 1848. Trapped by winter storms in the mountains, they resorted to cannibalism.

To get to the High Sierra, Chinese workers cut through dense forests, filled deep ravines, constructed long trestles and built enormous retaining walls — some of which remain intact today. All work was done by hand using carts, shovels and picks but no machinery.

The greatest challenge was to push the line through the Sierra summit. Solid granite peaks soared to 14,000 feet in elevation. The railroad bed snaked through passes at more than 7,000 feet. The men who came from humid south China labored through two of the worst winters on record, surviving in caverns dug beneath the snow.

They blasted out 15 tunnels, the longest nearly 1,700 feet. To speed up the carving of the tunnels, the Chinese laborers worked from several directions. After opening portals along the rock face on either side of the mountain, they dug an 80-foot shaft down to the estimated midway point. From there, they carved out toward the portals, doubling the rate of progress by tunneling from both sides. It still took two years to accomplish the task.

The Chinese workers were paid 30% to 50% less than their white counterparts and were given the most dangerous work. In June 1867, they protested. Three-thousand workers along the railroad route went on strike, demanding wage parity, better working conditions and shorter hours. At the time it was the largest worker action in American history. The railroad refused to negotiate but eventually raised the Chinese workers’ pay, though not to parity.

After the Sierra, the Chinese workers faced the blistering heat of the Nevada and Utah deserts, yet they drove ahead at an astonishing rate.

As they approached the meeting point with the Union Pacific, thousands of them laid down a phenomenal 10 miles of track in less than 24 hours, a record that has never been equaled. A Civil War officer who witnessed the drama declared that the Chinese were “just like an army marching over the ground and leaving the track behind.”

Progress came at great cost: Many Chinese laborers died along the Central Pacific route. The company kept no records of deaths. But soon after the line was completed, Chinese civic organizations retrieved an estimated 1,200 bodies along the route and sent them home to China for burial.

The transcontinental railroad’s completion allowed travelers to journey across the country in a week — a trip that had previously taken more than a month. Politicians pointed to the achievement as they declared the United States the leading nation of the world.

The transcontinental railroad has been viewed in a similarly nationalistic way ever since. Chinese workers were often left out of the official story because their alienage and suffering did not fit well with celebration. And attitudes toward them soon soured, with anti-Chinese riots sweeping the country. The Chinese Exclusion Act of 1882 barred Chinese laborers from entering the United States and placed restrictions on those already here.

Federal immigration law prohibited Chinese citizens from becoming Americans until 1943.

As a faculty member of the university that bears his name, I am painfully aware that Leland Stanford became one of the world’s richest men by using Chinese labor. But I also try to remember that Stanford University exists because of those Chinese workers. Without them, Leland Stanford would probably be at best a footnote in history — and the West and the United States would not exist as we know it today.

Sometimes, it takes too long. Often, the “real heroes” die unrecognized (like the more than 1,200 Chinese workers mentioned in this article or the many anonymous enslaved African-Americans whose uncompensated labor and ingenuity “propped up” at least five of our first seven Presdients) long before justice comes. And, frequently, the flawed folks who were wrongly acclaimed “popular heroes” of their day escape judgement within their lifetimes.

But, history has a way of eventually “getting it right.” Trump and his misguided followers eventually will be in for a reckoning.

It won’t be pretty. Once the subpoenas can’t be ignored, the testimony perjured, the innumerable lies, intentional misrepresentations, and squalid distortions presented as “business as normal,” and the full historical record becomes available for study and analysis, free from the political hoopla of the present, it will be much, much worse than we can possibly imagine. The true unpalatable nature of Trump and his enablers will be revealed for some future generations. And, those who stood against them and their racism, greed, dishonesty, and cruelty will be vindicated.

TRUMP SCOFFLAWS STUFFED AGAIN BY COURT ON “SANCTUARY” ISSUES: Trump Keeps Trying To “Punish” Jurisdictions For Acting Legally!

Yet again the Trump administration has had one of their cruel immigration policies smacked down byfederal judges. This time, it was the administration’s attempt to prevent California from carrying out sanctuary laws which protect undocumented immigrants in the state, according to Bloomberg.

A three judge panel at the 9th U.S. Circuit Court of Appeals rejected the administration’s attempt to shut down California sanctuary policies. The panel affirmed a previous decision by a federal judge in Sacramento, who ruled that a 2017 immigrant sanctuary regulation, which restricts local police’s cooperation with federal immigration authorities, doesn’t conflict with constitutional law.

The appeals court concluded that while Congress may have expected cooperation between state and federal authorities on immigration enforcement, Washington doesn’t have the constitutional power to require California’s assistance.

The decision regarded the California law SB 54, also known as the California Values Act, which was signed by former Governor Jerry Brown in 2017.

“SB 54 may well frustrate the federal government’s immigration enforcement efforts,” the court panel wrote. “However, whatever the wisdom of the underlying policy adopted by California, that frustration is permissible, because California has the right, pursuant to the anticommandeering rule, to refrain from assisting with federal efforts.”

The panel also upheld a state law that requires employers to inform workers before workplace inspections by federal immigration authorities, and told a lower court judge to take another look at a law that “authorizes the state attorney general to inspect facilities that house immigrants not detained for criminal offenses,” according to Bloomberg.

Many of the Trump administration’s attempts to harden immigration policy have met resistance in the courts. Most recently, the “Remain in Mexico” policy, which requires asylum seekers to wait in Mexico while their claims are processed, was blocked by a federal judge. Since then, the decision has been temporarily reversed.

It’s somewhat ironic that this decision would come down now, the week after it was made public that the Trump administration considered dumping undocumented people in these so-called “sanctuary cities.” After the absurd and cruel suggested policy was publicized, Trump threatened to do something similar, suggesting that immigrants who were caught crossing the border but couldn’t be detained should be sent to liberal cities with sanctuary laws like San Francisco.

In addition to being really stupid (you’re not going to get much useful cooperation from states and cities by suing them) this litigation borders on Constitutionally frivolous. It’s wasting the time of the Federal Courts.

Undoubtedly, a competent Administration with  rational immigration enforcement priorities could have reached accommodations with most jurisdictions on genuine law enforcement issues (not the mindless “deport anyone who is here without documents” program).

There was a time when professionals with some backbone at the DOJ and in the Solicitor General’s Office would have “just said no” to this type of “garbage litigation” being pushed by White House politicos. But, not today’s DOJ and today’s Solicitor General who see themselves as Trump’s sycophantic lawyers rather than upholding their oaths of office and serving the American people (who, after all, pay their salaries, not Trump — who apparently doesn’t even pay taxes). (Sessions’s downfall was that he saw himself more as an instrument of hate, racism, and xenophobia than as a personal protector of the Trumps.)

The Trump Kakistocracy has destroyed the remaining integrity of the DOJ and forced many of its best lawyers to leave, “go underground,” or become “hall walkers” to survive. That’s going to be bad for America long after Trump finally leaves office.

Bizarro world: Pelosi angry over Trump plan to send illegal crossers to sanctuary cities.  By Nolan Rappaport

Apparently, President Donald Trump is about to make life much easier for aliens with children who are apprehended after making an illegal entry.
The Flores Settlement Agreement prevents him from detaining, for more than 20 days, children apprehended after making an illegal crossing into the United States. And because all Hell broke loose when he separated the children from their parents, he is now releasing their parents, too.
But according to his tweets on Friday, that isn’t all he is going to do for them.

I’m sure he was being sarcastic when he said this should make them very happy, but it really should make the Democrats very happy. The government would be providing these families with free transportation to places that are welcoming undocumented aliens, i.e. the sanctuary cities.

In fact, many of them are headed for sanctuary cities anyway. In 2014, California, which is a sanctuary state, was home to between 2.35 million and 2.6 million undocumented immigrants. Nearly a quarter of the nation’s undocumented immigrants lived there. Roughly one in ten California workers was an undocumented immigrant. And the population of undocumented aliens in California has gotten even largersince then.
But it turns out that Trump was right: The Democrats are upset.
I was astonished to see an article entitled, “Pelosi fumes over White House plan to release immigrant detainees in sanctuary cities.”

It’s always difficult to take anything Trump says seriously, particularly about immigration.

I think Pelosi was reacting to 1) the tone of Trump’s threat; 2) his use of human lives as pawns and bargaining chips (something he has done before with the Dreamers); 3) his continuing threats to misuse Presidential power to “punish enemies;” and 4) the lack of any serious coordination that would accompany a good faith plan.  

On the other hand, as shown in this article by Tal Kopan of the SF Chronicle, California and San Francisco officials appear ready to welcome and help any migrants sent their way or who are released and choose to settle in California.

Immigration is a complicated issue.

Rarely a day goes by when we’re not hearing about it, reading about it, talking about it and shaking our heads at our leaders’ constantly shifting laws, policies and reforms. Like the unpredictability of Napa’s weather, the myriad issues surrounding immigration keep us constantly guessing about the outcomes.

Newish-to-Napa resident Polly A. Webber has been in the thick of immigration law for more than three decades.

Her resumé reads like a “Who’s Who” on the subject. She served 21 years as a trial level administrative judge in San Francisco, rendering oral and written decisions for more than 19,000 cases. She also served as national president of the American Bar Association-affiliated American Immigration Lawyers Association and held faculty positions at Santa Clara University School of Law and Lincoln Law School in San Jose. In private practice for 18 years, she has written articles for distinguished legal publications and earned a plethora of awards and accolades earned throughout her legal career.

During her last 10 years on the bench as well as in retirement, Webber has been creating fiber works, through rug hooking and yarn arts, describing her artistry as “a form of meditation” and a way “to get out of my head.”

“There is a pressing need for immigration reform in the United States,” Webber has written. “The Dreamers captured the hearts of a majority of Americans, and the taking of the children captured their outrage. It is time to bring this issue forward whatever way possible. This is my small contribution.”

Webber calls her folk art inspired, refugee-themed triptych of rugs “Refugee Dilemma.” Each wall hanging pays tribute to the thousands of people all over the world who flee and seek refuge from their places of origin.

The first in the series, “Fleeing from Persecution,” was completed in August, 2017. The image portrays Webber’s interpretation of the iconic, but now extinct, set of traffic signs used in San Diego – ostensibly meant to protect fleeing refugees. The plea “help us” appears in Spanish, Mayan, Haitian, Arabic, Pashto, Somali, Sudanese, Russian and English.

“I used marbled red and brown wool for the silhouettes,” Webber said, “to make them more human and universal. The white outline around the figures is a technique found in Russian art.”

“Caught in the Covfefe,” completed in December, 2018, portrays a border patrol officer taking a young girl from her undocumented mother, who pleads in Spanish, “Don’t take my daughter!” Webber describes the image: “An officer’s face is hooked in pure white, an institutional and domineering color, and he is given an almost robotic stance. The mother is frenzied, understandably, and the child is traumatized. The chicken wire fence around them with its barbed wire atop, and the borders around the rug are all done to project the feeling of being trapped. With the more open border at the top, there is hope.”

The most recently-completed rug in September, 2018, “Safe Haven,” illustrates two Central American women and their children in a place of relative safety. “For some,” Webber explains, “this is still aspirational, while others have succeeded. Their smiles are tired smiles, but full of hope. The pattern for this rug was developed from a rug my aunt, Emma Webber, hooked decades ago from a 1950s UNICEF card. Knowing how much my aunt would have appreciated this group of rugs, I wanted to honor her as well.”

Webber has hooked upwards of 25 rugs and often uses patterns made from photographs or draws images freehand. She’s “hooked” her brother’s home and a portrait of her parents with materials consisting of 100 percent wool cloth cut into strips about 1/4 inch thick.

“There are a number of wine country rug hooking groups in Santa Rosa, “ said Webber, “and we sit around and hook with other people. There are also camps that bring in specialized teachers and cutters, and it’s a true art form to go to these places.”

“I poured my heart and soul into these rugs,” Webber said, “and I still think assimilation and advocacy are important parts of the refugee narrative. There may be one or two more rugs coming!”

SAN DIEGO — Three months into the Department of Homeland Security’s program that requires asylum-seeking migrants to wait in Mexico until their U.S. immigration hearings, observers said Friday that the policy may actually be encouraging illegal border crossings.

Last week, migrants rushed the border at least four times at Playas de Tijuana, many of them saying they were motivated by not wanting to wait in Mexico.

A Customs and Border Protection official said migrants who cross the border illegally are not being returned to Mexico while they seek asylum. Instead, they are taken into custody, where they eventually get to wait in the United States, sometimes up to three or four years until their asylum hearings before an American immigration judge.

“Why would I spend three years here in Tijuana when I could be in the United States?” asked Jeydi Fuentes Lopez Montes, a 29-year-old mother from Honduras traveling with a 1-year-old child. “I know there is work here in Tijuana, but isn’t the work better over there?”

Fuentes said she went to Tijuana planning to wait in line to ask for asylum, but she said that when she learned the list to get an initial appointment with U.S. officials could take several months, she decided to try to find another way into the U.S.

Legal experts say a judge is not allowed to deny a person’s asylum request based solely on whether he or she entered the country legally or illegally.

Samuel Rodriguez Guzman, from El Salvador, arrived in Tijuana this month. He said he went to the beach Thursday after hearing about more people successfully entering the U.S. illegally, and seeing on the news people getting through the border infrastructure at Playas.

“I’m trying whatever way I can to immigrate to the United States,” Rodriguez said. “I had problems with the gangs in my country and my father did, too. They want to kill us. When we get there to the United States, they have to respect our human rights to ask for asylum, right?”

Alan Bersin, the former commissioner of U.S. Customs and Border Protection, said there is no coordinated system between the Mexican government and the U.S. to accept large numbers of migrants returned to Tijuana.

So far, fewer than 300 people have been returned to Mexico under the program.

“It’s an incompetent program,” said Bersin, adding that people who cross illegally should be returned to Mexico in the same numbers as those who wait for months in line for their turn to cross legally.

“This policy has a chance of succeeding as a deterrent,” he said. “But [Mexican President Andres Manuel] Lopez Obrador is trying to avoid a fight with Trump so he says yes to everything but does nothing.”

This month, migrants have been climbing through holes in border fencing at Playas or climbing over the 15-foot-high fence.

On March 13, some people slipped through a hole in the border fencing near the beach. One of the men, who was seen in a video running down the beach carrying a small child while a border agent chased him, provided updates via WhatsApp to several people in his group and some witnesses. He said he was not apprehended and made it to Los Angeles.

A group of about 60 people who crossed on March 14 included men, women and children, most of whom said they were from Honduras. Customs and Border Protection spokesman Ralph DeSio said 52 people from that group were arrested.

Border officials also arrested 23 people from Honduras and one from Guatemala on Tuesday after they scaled the fence near the beach.

Then Thursday, activity at the border intensified as border agents and migrants clashed.

Two migrants and several witnesses said agents shot pepper spray across the fence and into their eyes. During the incident, one man climbed the fence and dropped into the U.S. before he was detained by border agents.

DeSio said Customs and Border Protection is averaging 167 arrests a day in the San Diego County area of responsibility, which stretches east to past Jacumba.

“Every arrest in San Diego Sector is investigated. Every breach in San Diego County is a concern whether it’s near Imperial Beach or in Jacumba,” DeSio said in a written statement. “Compromises in our fence are common due to our aging infrastructure. Efforts are made to repair breaches or compromises in a timely manner.”

On Friday, another hole big enough for people to climb through was visible at the base of the border fence at Playas.

“Really, we’re tired of fighting because we just want to cross and ask for asylum…. We’re not rude. We are allowed to come here and ask for asylum,” said Jose Reinera, a Honduran migrant who climbed up on top of the fence at Las Playas on Thursday.

Reinera said he turned back and climbed back down on the Mexican side of the border when he realized his wife and children would not be able to make the climb.

Up until now, the Administration has been fortunate that their cruel, sometimes illegal, and always incompetent policies haven’t made things even worse.

Fact is, most individuals applying for asylum still turn themselves in either at legal ports of entry or shortly after crossing the border to apply for asylum. They can be logged in, fingerprinted, screened for criminal records and credible fear. Those who can’t demonstrate credible fear can be expeditiously returned.

Those who pass, become part of the legal system. If given an opportunity to understand the asylum system, obtain legal a representation (we know that represented asylum applicants succeed at a rate of 4X to 17X those who are forced to proceed without representation) and fairly present their cases, most will show up in Immigration Court. Many of those who are represented and treated fairly will qualify for asylum, withholding of removal, or relief under the Convention Against Torture (“CAT”), even in today’s administrative system which has been intentionally and unfairly skewed against them and their claims.

Those who don’t qualify will be subject to removal, although many will nevertheless face very real and legitimate harm (not fitting within our legalistic and often arcane asylum system) that a more prudent and humane Administration might use to fashion some type of temporary or long-term respite from removal.

But, if the Administration succeeds in it’s mindless plan to destroy the legal asylum and Immigration Court systems, forced migrants, who come of necessity not choice, will simply stop using it.  With the help of smugglers, and paying higher prices and taking more deadly risks, many will simply be smuggled into the interior of our country.  There, they will lose themselves in our huge country with a diverse population and an insatiable need for labor at all levels.

No screening, no registration, no taxes, etc. — some will undoubtedly be caught and removed. But the vast majority will remain “in the underground” until 1) we legalize them; 2) they decide that conditions have changed so it is their best interests to return to their native lands, or 3) they eventually get old and die. Not to mention that by forcing them into the “immigration black market” we deprive them of their human dignity and a chance to contribute their full potential to our country, while we lose the many benefits of having them do so.

Sounds like a bad system. But, it’s the type of mindless, White Nationalist, “lose, lose, lose” restrictionism that this Administration loves to feed to its “political base.” A bigger “immigration underground” means more folks to hate, loathe, blame, and run against.

Two of the three asylum seekers who were supposed to show up for the first immigration court hearings under the “Remain in Mexico” policy did not make it across the border on Thursday to appear.

After the Homeland Security Secretary announced what she called a “historic” program, known officially as Migrant Protection Protocols, in December, many wondered — and worried — about the logistics of shuttling migrants back and forth across the border for court hearings.At least one of the people who had been returned to Tijuana after asking for asylum at the San Ysidro Port of Entry missed the court hearings because of what Assistant Chief Immigration Judge Rico Bartolomei called a “glitch” in the scheduling system.

Court cases for the program were supposed to start next Tuesday, but somehow cases got scheduled for this Thursday, Bartolomei explained. At first, the court tried to reschedule those hearings for Tuesday but realized it wouldn’t have a way to communicate that effectively with the asylum seekers in Mexico.

The issue was that when the court rescheduled to March 19, anyone who called its toll-free number to check for court date updates thought that the hearings would be on March 19. That happened in the case of one Honduran woman who had Los Angeles-based attorney Olga Badilla representing her.

Badilla explained to the judge that she had only learned the day before that the hearing had moved back to March 14 and that her client hadn’t found out in time to be at the port of entry at 9 a.m. She arrived a couple of hours later, but Customs and Border Protection officers wouldn’t let her into the U.S. for her hearing.

“She’s present at the port of entry and ready to come in,” Badilla told the judge, asking for the court’s help. “It’s an unusual situation given the circumstances.”

Aguilar said the judge should order the woman deported in her absence.

Bartolomei denied that motion, saying that the woman had received “insufficient notice” of the hearing. Instead, he scheduled a future date with Badilla to turn in the woman’s asylum application.

Though the woman was given another chance to show up for court, she ran into more problems down at the border. Her permit to stay in Mexico was on the verge of expiring in anticipation of her crossing into the U.S. for court. If she had crossed and returned again, she would likely get a new one. Without entering the U.S., she was about to become deportable from Mexico.

When court ended for the day, Badilla went to try to help her client.

The other person who didn’t show up for court, a 24-year-old man from Honduras, had also had his case rescheduled through the court’s glitch.

ICE attorney Aguilar again moved to have the man ordered deported.

Bartolomei pushed the ICE attorney about whether it made sense to order someone deported from the U.S. while they are still in Mexico. He asked if it made more sense to consider the person’s application for admission withdrawn.

According to immigration attorney Tammy Lin, a withdrawal would limit potential restrictions on the man’s ability to come to the U.S. in the future. A deportation order would make it much more difficult for the man to come to the U.S.

During the conversation, Bartolomei sighed audibly, weighing the options before him.

Then he decided to reschedule his case for the 19th to see if the man showed up then. Since he didn’t have an address to send the new hearing notice to, he gave it to the Department of Homeland Security to pass on to the man.

The one person who did show up did not have an attorney. Also from Honduras, the man arrived at El Chaparral plaza outside the port of entry well before 9 a.m. A volunteer from a legal services organization that supports migrants in the plaza every morning before they ask for asylum saw him and escorted him to the gate inside the port that marks the entry to the U.S.

He waited in line, shuffling down the spiral walkway in a mix of commuters, shoppers and friends returning from trips abroad. When he got to the front of the line, a Customs and Border Protection official held him to the side to wait for the other two who were supposed to come.

He was nervous, he said.

A few minutes after 9 a.m., several CBP officers and two plainclothes officials took him into the U.S. Officers from Immigration and Customs Enforcement transported him from the port of entry to the office building in downtown San Diego that houses the immigration court.

He arrived at the court before noon and sat in a corner of the back row of benches, head bowed.

When it was his turn to face the judge, he spoke softly into the microphone and watched attentively as Bartolomei explained each of the documents he had received.

Bartolomei asked him if he wanted more time to find an attorney.

Yes, the man replied.

The judge granted him another month to try to find someone to help him and told him he would likely be taken back to Mexico again.

“I know it will be difficult to try to get an attorney from there,” Bartolomei told him, urging him to try his best to find a lawyer to take his case.

When his turn was over, ICE officers quickly whisked him away, back to the port of entry.

Notice will continue to be an issue in this ill-designed process. It actually appears that it will be impossible to properly serve anyone at a “last known address” in Mexico. Thus, any in absentia hearings should ultimately be vacated for lack of notice and will have to be re-started. That’s what “ADR” is all about.

The ICE Attorney was both unhelpful and probably unethical when he insisted on frivolously moving for an “in absentia” order given the obvious scheduling and notice issues attributable to his agency’s choice of this “historically” goofed up and perhaps illegal method of proceeding. Unwillingness to assume any responsibility for their own frequent screw ups and predictably bad policy choices is certainly a “hallmark” of the Trump Administration!

Once of the things that made the Arlington Immigration Court run as well as it did during my tenure was the sense of justice, common sense, practicality, and overall cooperation and helpfulness of the ICE Chief Counsel’s Office in working with the Immigration Judges and private bar to “keeping the ball moving down the field.” Apparently deprived of such a professional approach by the mindless “due process and common sense be damned policies” of this Administration, today’s Immigration Judges face additional roadblocks in promoting efficiency and fairness in accordance with the law. No wonder the backlogs are growing exponentially even with more Immigration Judges on the bench!

Here’s how might a “due process and efficiency-oriented system” could have dealt with the same issues:

  • Work with the private sector to obtain local counsel for individuals who have passed the “credible fear” process;
  • Find out how long it will take the lawyer to prepare the application for asylum for filing with the Immigration Court;
  • Choose a compatable date for filing at the “Initial Master” from a computerized list of  “available first Master dates” on Judge Bartolomei’s calendar made available by EOIR;
  • Release the applicant to a local nonprofit who will help insure that he or she understands the system and the importance of keeping attorney meetings and appearing before the Immigration Court as scheduled;
  • At the first Master, the attorney files the completed asylum application with Judge Bartolomei, and he assigns an Individual Hearing date;
  • Presto! A system that works, uses court and judicial time wisely, and promotes fair and efficient results.

Contrast that with the mindless system described above. The key: under the current system everybody has wasted time and effort, particularly Judge Bartholomei, but without getting any closer to assigning an actual Individual Hearing date than on the day the applicant passed “credible fear.”

That’s how Government-created “bogus emergencies” happen. It’s really important that folks like Kate keep reporting on the “nitty gritty” of the Trump Administration’s “malicious incompetence” and how it is destroying and degrading our immigration and justice systems on a daily basis.

Undoubtedly, this Administration will attempt to shift blame for its own predictable failures to the victims — asylum seekers, their lawyers, and Immigration Judges. It’s important that the Trump Administration be held fully accountable, both in the present and for history, for the consequences of their terrible White Nationalist restrictionist agenda.

TThe numbers are sobering. The federal government reported Tuesday that immigration agents apprehended 76,000 people — most of them families or unaccompanied minors — at the U.S.-Mexico border in February, twice the level of the previous year and the highest for February in 11 years. The increase continues a trend that began in the fall, and offers direct evidence that President Trump’s strategy of maximal enforcement at the border is not reducing the flow of migrants.

And no, the answer is not “a big, beautiful wall.” Most of those apprehended weren’t trying to sneak past border agents; instead, they sought out agents once they reached the border and turned themselves in, hoping to receive permission to stay.

Furthermore, the situation isn’t a national security emergency, as he has declared in an effort to spend more on his border wall than Congress provided. It’s a complex humanitarian crisis that appears to be worsening, and it’s going to take creative analytical minds to address.

For instance, the vast majority of the families flowing north in recent months come from poor regions of Guatemala, where food insecurity and local conflicts over land rights and environmental protections are pushing more people off their farms and into even deeper poverty, according to human rights observers and U.S. Customs and Border Protection. Just months earlier, gang violence in urbanized areas were pushing people north to the United States; increasingly now, it’s economics.

But Trump’s rhetoric may be playing a role too. The more he threatens draconian enforcement and cutbacks in legal immigration, the more people contemplating moving north are pushed to go sooner, before it gets even harder to reach the U.S. Similarly, more migrants are arriving at more treacherous and remote stretches of the border to avoid getting stuck in Tijuana or other border cities where the U.S. government has reduced the number of asylum seekers it will allow in, claiming an inability to process the requests.

The system is overwhelmed. But the solution isn’t to build a wall, incarcerate more people, separate children from their parents or deny people their legal right to seek asylum. The solution is to improve the efficiency and capacity of the system to deal with the changed migrant demographics. A decade ago, about 1 in 100 border crossers was an unaccompanied minor or asylum seeker; now about a third are.

More judges and support staffs are necessary for the immigration court system, as the Trump administration has sought from Congress. Yet the case backlog there has continued to grow — in part because the increase in enforcement actions, in part because the Justice Department ordered the courts to reopen cases that had been closed administratively without deportations, often because the migrant was in the process of obtaining a visa. A faster and fair process would give those deserving asylum the answer they need sooner, cutting back on the years they spend in limbo, while no longer incentivizing those unqualified for asylum to try anyway.

The Migration Policy Institute, a think tank, has suggested one partial fix. Currently, migrants claiming asylum have a near-immediate initial “credible fear” hearing with an asylum officer from U.S. Citizenship and Immigration Services, who determines whether the migrant has a significant potential to make a successful asylum claim. Most migrants pass that low threshold and are then directed to the immigration courts to make the formal case, a more involved process that can take years. Keeping those cases within the citizenship and immigration branch for an administrative hearing instead of sending them to immigration court could lead to faster decisions for the deserving at a lower cost — a single asylum agent is cheaper than a court staff — while preserving legal rights by giving those denied asylum a chance to appeal to the immigration courts. That’s a process worth contemplating.

More fundamentally, the current system hasn’t worked for years, and under Trump’s enforcement strategy it has gotten worse. It’s a big ask, but Congress and the president need to work together to develop a more capable system that manages the many different aspects of immigration in the best interests of the nation while accommodating the rights of the persecuted to seek asylum.

The U.S. government is reportedly compiling dossiers on journalists, lawyers and activists at the border.

ASan Diego television station recently obtained some troubling documents that seem to show that the U.S. government, working with Mexican officials under a program called Operation Secure Line, has created and shared dossiers on journalists, immigrant rights lawyers and activists covering or involved with the so-called caravans of migrants moving from Central America to the U.S.-Mexico border.

Worse yet, the government then detained some of these people for questioning (one photojournalist was held for 13 hours), barred some of them from crossing the border and interfered with their legitimate efforts to do their jobs. NBC 7 also received a copy of a purported government dossier on lawyer Nicole Ramos, refugee program director for a migrant rights group, that included a description of her car, her mother’s name, and details on her work and travel history. That’s not border security, that’s an intelligence operation and, as the American Civil Liberties Union pointed out, “an outrageous violation of the First Amendment.”

The ACLU noted correctly that it is impermissible for the government to use “the pretext of the border to target activists critical of its policies, lawyers providing legal representation, or journalists simply doing their jobs.”

It’s unclear when the intelligence gathering began, or how widespread it is, but the Committee to Protect Journalists reported in October that U.S. border agents, using the broad power the law gives them to question people entering the country, seemingly singled out journalists for in-depth examinations, including searching their phones, laptops and cameras — all without warrants, because they’re generally not required at the border. These are troubling developments deserving of close scrutiny by Congress and, if warranted, the courts.

The Department of Homeland Security is responsible for controlling the flow of people across U.S. borders and has broad and court-recognized authority to search for contraband. But the government should not use that authority as a pretext to try to gain information to which it would not otherwise be entitled. And it certainly doesn’t give it a framework for harassing or maintaining secret files on journalists, lawyers and activists who are covering, representing or working with activists.

Homeland Security defended the targeting by linking the intelligence operation to the agency’s investigation of efforts this winter by some Central American migrants to cross the wall near San Ysidro, Calif. It said also that all the people entered into the database had witnessed border violence. That sounds an awful lot like a criminal investigation, not a border security operation.

The name of the report leaked to NBC 7 was “Migrant Caravan FY-2019: Suspected Organizers, Coordinators, Instigators, and Media.” The only thing suspect here is the government’s actions.

Unfortunately, the second editorial on the “enemies list” shows why the first one on solving the Central American forced migration issue in a sensible, legal, and humanitarian manner simply isn’t in the cards without “regime change.”

First, the Trump Administration simply lacks the competence, professionalism, and expertise to solve real problems. The absolutely stunning incompetence of Nielsen and the rest of the politicos who supposedly run immigration and national security policy these days was on full display this week. America’s “real” enemies must have been watching with glee at this public demonstration of lack of competence and concern for any of the actual national security issues facing our nation.

Career civil servants who have the knowledge, expertise, motivation, and ability to solve migration problems have been forced out, buried in make-work “hallwalker jobs” deep in the bowls of the bureaucracy, or simply silenced and ignored. The Administration has also declared war on facts, knowledge, human decency and scorns the humanitarian expertise available in the private and NGO sectors.

Second, there is zip motivation within the Trump Kakistocracy to solve to the problem. As long as neo-Nazi Stephen Miller is in charge of immigration policy, we’ll get nothing but White Nationalist, racist nonsense. Miller and the White Nationalist restrictionists (like Trump & Sessions) have no motivation to solve immigration problems in a practical, humane, legal manner.

No, the White Nationalist agenda is to use lies, intentionally false narratives, racial and ethnic stereotypes, bogus statistics, and outright attacks on our legal system to further an agenda of hate, intolerance, and division in America intended to enfranchise a largely White GOP kakistocracy while disenfranchising everyone else. It plays to a certain unhappy and ill-informed political “base” that has enabled a minority who cares not a whit about the common good to seize control of our country.

While the forces of evil, division, and Constitutional nihilism can be resisted in the courts, the press, and now the House of Representatives, the reign of “malicious incompetence” can only be ended at the ballot box. If it doesn’t happen in 2020, and there is certainly no guarantee that it will, it might well be too late for the future of our republic.

LITHWICK & STERN @ SLATE: Will California’s Appeal To Conservative Jurisprudence Convince Conservative Judges In Litigation Against Trump’s Fake National Emergency?

Last Friday, President Donald Trump declared a national state of emergency at the southern border, adding that it wasn’t one of those emergencies he actually “needed” to declare and then saying a bunch of other things. As he predicted, a coalition of 16 states filed a federal lawsuit on Monday night, seeking a preliminary injunction to prevent the president from acting on his emergency declaration. As he also predicted, that suit was filed in federal district court in California.

What Trump did not predict—and probably could not, given his tenuous grasp on the legal limitations of executive authority—is that Monday’s lawsuit is, at bottom, extremely conservative. The suit does not appeal to the justices’ empathy for vulnerable immigrants or question whether Trump’s racist motives might undermine the declaration’s legality. Instead, it relies upon ancient principles of separation of powers to make a very strong case that Trump has short-circuited the Constitution. It is not a lawsuit about equality, or dignity, but about the nuts and bolts that undergird the constitutional lawmaking process. It is wonky, and formal, terse, and unromantic. And if the Supreme Court’s conservatives have any consistency, Monday’s lawsuit should persuade them to block Trump’s wall.

The 16 plaintiff states center their 57-page complaint around a basic argument: that the president has violated the cardinal principle of separation of powers by trammeling Congress’ will to achieve his policy preferences. Trump, the lawsuit alleges, “has used the pretext of a manufactured ‘crisis’ of unlawful immigration to declare a national emergency and redirect federal dollars appropriated for drug interdiction, military construction, and law enforcement initiatives toward building a wall on the United States-Mexico border.” There is “no objective basis” for this declaration, as Trump himself has essentially admitted. Further, “[t]he federal government’s own data prove there is no national emergency at the southern border that warrants construction of a wall,” and unauthorized entries are “near 45-year lows.”

Much of the complaint details funding that will be diverted from National Guard and drug-interception projects favored by the states in order to build the wall instead. The plaintiffs say that grants them standing to sue in federal court since the president is redirecting money that would benefit their interests to a project that will not. But the states aren’t simply upset because they would have preferred that the money be used for military construction and law enforcement. They are upset because, they allege, the money has been taken from these projects and from their citizens to be used illegally.

Trump, the plaintiff states write, has “violated the United States Constitution’s separation of powers doctrine by taking executive action to fund a border wall for which Congress has refused to appropriate funding.” By “unilaterally diverting funding that Congress already appropriated for other purposes to fund a border wall for which Congress has provided no appropriations,” the president has run afoul of the Presentment Clause.

This lawsuit joins a series of others that have already been filed by watchdog groups. While they all argue that there is no actual emergency at the southern border, that is not the gravamen of their complaint. Instead of asking the courts to second-guess Trump’s intent, these challengers ask them to decide whether Trump had authority to act in the first place.

The answer, they assert, is no. The Presentment Clause is straightforward: For a bill to become law, it must pass both houses of Congress, then be presented to the president for approval. Yet Congress never passed a bill authorizing and funding the border wall Trump now demands. It never presented such legislation to the president for his signature. This is the stuff of Civics 101. Whatever powers the National Emergencies Act may grant to the president, a federal statute cannot override the Constitution. The executive cannot use funds Congress did not appropriate. He cannot amend statutes himself to create money for pet projects. Trump asked Congress for a large sum of money to construct a border wall; Congress resoundingly and provably said no. The National Emergencies Act does not give him leeway to contravene Congress’ commands.

These problems ought to be catnip for SCOTUS’ conservative justices—particularly Justice Neil Gorsuch. In his very first dissent on the Supreme Court, Gorsuch extolled the virtues of this pristine constitutional system. “If a statute needs repair,” he wrote, “there’s a constitutionally prescribed way to do it. It’s called legislation.” Gorsuch continued:

To be sure, the demands of bicameralism and presentment are real and the process can be protracted. But the difficulty of making new laws isn’t some bug in the constitutional design: it’s the point of the design, the better to preserve liberty.

A year later, in his rightly celebrated opinion in Sessions v. Dimaya, Gorsuch hammered this same point home again. “Under the Constitution,” he wrote, “the adoption of new laws restricting liberty is supposed to be a hard business, the product of an open and public debate among a large and diverse number of elected representatives.” The courts abdicate their responsibility when they ignore the Constitution’s “division of duties” between the branches of government. These “structural worries” form the bedrock of American constitutional governance, whose ultimate goal is to safeguard “ordered liberty.” These new challenges demonstrate that Trump is circumventing these “structural worries” and harming “ordered liberty” in the process.

There’s also clear precedent for allowing states to take up this kind of challenge. When President Barack Obama tried to defer deportation for the undocumented parents of American citizens and legal residents, the Supreme Court’s conservatives threw a fit. They accused the president of legislating from the Oval Office and acting without congressional approval. And they succeeded in blocking that program after Texas and 25 other states sued based on an allegation of the flimsiest of hypothetical harms. In that case, Obama was merely executing a statute that allowed him to set “national immigration enforcement policies and priorities,” not building a border wall by fiat in defiance of congressional appropriators. If a president can violate the cardinal principle of separation of powers by stretching congressional guidance, and the states can sue him for it, surely he commits the same constitutional sin against those states by flouting congressional commands.

Litigants have learned well, after two long years of arguing over the travel ban, that the five conservatives have little to no interest in probing what lies in the president’s heart. They simply don’t care about what might or might not be a pretext, or whether tweets should count. They want clinical analysis of formal constitutional authority and presidential power. California v. Trump offers that up on a silver platter: Whatever the president can do—whether his name is Obama or Trump—he cannot take funds Congress refused to appropriate and use them to thwart the will of Congress. No tears, no drama, no probing of the executive’s soul. Just the cornerstone of the Framers’ plan.

The appeal to “conservative jurisprudence” certainly appeared to “score” with Circuit Judge Jay Bybee of the 9th Circuit and Chief Justice John Roberts in the recent East Bay Sanctuary case (asylum regulations). Can it bring over Justice Neil Gorsuch and others in California v. Trump?

On the other hand, Professor Aziz Huq, writing in Politico says the case is already over and Trump has won because of the Supremes’ prior “what me worry” tank job in Hawaii v. Trump, the so-called “Travel Ban 3.0 Case” which also involved a “Trumped up bogus national emergency” to fulfill a political campaign promise. https://www.politico.com/magazine/story/2019/02/19/trump-national-emergency-border-wall-225164

With due respect to Professor Huq, I think this case is different because Congress specifically considered Trump’s request and “reasoning” for wanting more “Wall money” and rejected it. Whether that difference “makes a difference,” in terms of result, remains to be seen.  Stay tuned!

A coalition of 16 states filed a federal lawsuit Monday to block President Trump’s plan to build a border wall without permission from Congress, arguing that the president’s decision to declare a national emergency is unconstitutional.

The lawsuit, brought by states with Democratic governors — except one, Maryland — seeks a preliminary injunction that would prevent the president from acting on his emergency declaration while the case plays out in the courts.

The complaint was filed in the U.S. District Court for the Northern District of California, a San Francisco-based court whose judges have ruled against an array of other Trump administration policies, including on immigration and the environment.

Accusing the president of “an unconstitutional and unlawful scheme,” the suit says the states are trying “to protect their residents, natural resources, and economic interests from President Donald J. Trump’s flagrant disregard of fundamental separation of powers principles engrained in the United States Constitution.”

House Speaker Nancy Pelosi (D-Calif.) and Senate Democratic Leader Chuck Schumer claim that President Donald Trump’s Southern Border National Emergency Proclamation is an unlawful declaration over a crisis that does not exist, and that it steals from urgently needed defense funds — that it is a power grab by a disappointed president who has gone outside the bounds of the law to try to get what he failed to achieve through the constitutional legislative process.
In fact, this isn’t about the Constitution or the bounds of the law, and — in fact — there is a very real crisis at the border, though not necessarily what Trump often describes. It helps to understand a bit of the history of “national emergencies.”
As of 1973, congress had passed more than 470 statutes granting national emergency powers to the president. National emergency declarations under those statutes were rarely challenged in court.
Youngstown Sheet & Tube Co. v. Sawyer, which was decided in 1952, the Supreme Court overturned President Harry S. Truman’s proclamation seizing privately owned steel mills to preempt a national steelworker strike during the Korean War. But Truman didn’t have congressional authority to declare a national emergency. He relied on inherent powers which were not spelled out in the Constitution.
Trump, however, is using specific statutory authority that congress created for the president.
In 1976, Congress passed the National Emergencies Act (NEA), which permits the president to declare a national emergency when he considers it appropriate to do so. The NEA does not provide any specific emergency authorities. It relies on emergency authorities provided in other statutes. The declaration must specifically identify the authorities that it is activating.

The president defended his national emergency by boasting that he’ll win at the Supreme Court because it’s full of his judges.

We’ll see what happens.  While the arguments made by Trump in support of his “Bogus National Emergency” were  totally frivolous (and, perhaps, intentionally so), the points made by Rappaport, Hemel, Shane, and Lithwick aren’t. That could spell big trouble for our country’s future!
Trump doesn’t have a “sure fire legal winner” here; he might or might not have the majority of the Supremes “in his pocket” as he often arrogantly and disrespectfully claims. Nevertheless, there may be a better legal defense for the national emergency than his opponents had counted on.
Certainly, Trump is likely to benefit from having a “real lawyer,” AG Bill Barr, advancing his White Nationalist agenda at the “Justice” Department rather than the transparently biased and incompetent Sessions. While Barr might be “Sessions at heart,” unlike Sessions he certainly had the high-level professional legal skills, respect, and the “human face” necessary to prosper in the Big Law/Corporate world for decades.
Big Law/Corporate America isn’t necessarily the most diverse place, even today. Nevertheless, during my 7-year tenure there decades ago I saw that overt racism and xenophobia generally were frowned upon as being “bad for business.” That’s particularly true if the “business” included representing some of the largest multinational corporations in the world.
Who knows, Barr might even choose to advance the Trump agenda without explicitly ordering the DOJ to use the demeaning, and dehumanizing term “illegals” to refer to fellow human beings, many of them actually here with Government permission, seeking to attain legal status, and often to save their own lives and those of family members, through our legal system.
Many of them perform relatively thankless, yet essential, jobs that are key to our national economic success. Indeed, it’s no exaggeration to say that like the Trump Family and recently exposed former U.N Ambassador nominee Heather Nauert, almost all of us privileged and lucky enough to be U.S. citizens who have prospered from an expanding economy have been doing so on the backs of immigrants, both documented and undocumented. Additionally, migrants are some of the dwindling number of individuals in our country who actually believe in and trust the system to be fair and “do the right thing.”
But, a change in tone, even if welcome, should never be confused with a change in policy or actually respecting the due process rights of others and the rule of law as applied to those seeking legally available benefits in our immigration system. That’s just not part of the White Nationalist agenda that Barr so eagerly signed up to defend and advance
It’s likely to a long time, if ever, before “justice” reasserts itself in the mission of the Department of Justice.

ACLU & SPLC SUE TRUMP ADMINISTRATION ON “MIGRANT REJECTION PROTOCOLS!”

Two weeks ago, immigration authorities began to enforce a new policy that requires some asylum seekers to wait in Mexico while their claims are being processed. NPR and The Washington Post have already reported on migrant families being returned across the border by Department of Homeland Security (DHS) officials. But a new update on Trump’s “Remain in Mexico” policy means it’s about to face a legal challenge.

On Thursday, the American Civil Liberties Union (ACLU) and the Southern Poverty Law Center (SPLC) teamed up, filing a lawsuit to address the matter in Northern California’s District Court. The suit names DHS Secretary Kirstjen Nielsen, as well as numerous Customs and Border Protection (CBP) and Immigrations and Customs Enforcement (ICE) officials. Nielsen has described the policy, officially known as Migrant Protection Protocols as “a huge step forward in bringing order to chaotic migration flows, restoring the rule of law and the integrity of the United States immigration system.” Bustle has reached out to DHS and ICE for comment.

However, some civil rights organizations disagree with that characterization. “Immigration authorities are forcing asylum seekers at the southern border of the United States to return to Mexico — to regions experiencing record levels of violence,” the lawsuit reads. “By placing them in such danger, and under conditions that make if difficult if not impossible for them to prepare their cases, Defendants are depriving them of a meaningful opportunity to seek asylum.”

In its statement, the ACLU rejected the administration’s claims of an immigration crisis at the border.

Before the implementation of the new return policy, asylum-seekers would legally enter the country through a port of entry along the border, and remain in detention while they waited for a “credible fear” assessment. If they were approved, migrants could remain in the country until a future court hearing. However in 2018, CBS News reported, the Trump administration hit a record high in asylum denials, rejecting some 65 percent of applicants.

In a December statement, Nielsen described the “catch and return” policy as a way to prevent migrants trying to “game the system” by obtaining entry and then “disappear[ing] into the United States, where many skip their court dates.” In fact, according to the Department of Justice’s own data from the 2017 fiscal year, some 89 percent of asylum-seekers released into the country return for their court dates.

Under the new plan, CBS reported, migrants crossing at the San Ysidro checkpoint in San Diego, are processed and returned across the border to Tijuana with a toll-free phone number to check on their claim status. Immigration rights activists argue that this system defeats the purpose of an asylum claim for people trying to escape violence and political unrest in Central America.

“They’re just spending their time just trying to survive in Tijuana,” Aaron Reichlin-Melnick, an analyst for the American Immigration Council, told CBS. “We know that there are people who have been turned away from the border who have then been kidnapped, raped. There are likely people who have been murdered.”

One problem that I see right off the bat for the DHS is counsel. The immigration law guarantees individuals in removal proceedings the right to be represented by counsel of their own choice at no expense to the Government.

Not only did the Administration put these “Protocols” into operation without consulting with NGOs and pro bono groups on both sides of the border, but there have been credible reports of DHS actually harassing and impeding American lawyers going back and forth to Mexico in an attempt to provide the representation guaranteed by statute (and probably also by Due Process).

Additionally, contrary to Nielsen’s lies and misrepresentations, there really was no coordination with the Mexican Government of what steps would be taken to guarantee U.S. lawyers reasonable access to clients in Mexico. There have also been credible reports that the Mexican authorities have been uncooperative and have placed roadblocks in the way of attorneys representing asylum seekers. Add that to the fact that like Trump himself, Nielsen and DHS are well-known for lying, evading, and misrepresenting to Congress, the Federal Courts, the press, and the American people, and we have the makings for yet another in the series of “failed restrictionist initiatives” taken by the Trumpsters.
