Last week, as the White House digested news of a defeat at the polls, Trump administration officials were greeted with reports of troubling setbacks on two fronts in the country’s long-simmering conflict with Iran.

First came a leaked U.N. document showing yet another sharp rise in Iran’s stockpile of enriched uranium. Then, satellites tracked an Iranian oil tanker — the fourth in recent weeks — sailing toward the Persian Gulf after delivering Iranian petroleum products to Venezuela.

The first item was further proof of Iran’s progress in amassing the fissile fuel used to make nuclear energy and, potentially, nuclear bombs. The second revealed gaping holes in President Trump’s strategy for stopping that advance. Over the summer, the administration made a show of seizing cargo from several other tankers at sea in a bid to deter Iran from trying to sell its oil abroad. Yet Iran’s oil trade, like its nuclear fuel output, is on the rise again.

The Trump administration is entering its final months with a flurry of new sanctions intended to squeeze Iran economically. But by nearly every measure, the efforts appear to be faltering. The tankers that arrived in Venezuela in recent weeks are part of a flotilla of ships that analysts say is now quietly moving a million barrels of discounted Iranian oil and gas a day to eager customers from the Middle East to South America to Asia, including China.

The volume represents a more than tenfold increase since the spring, analysts say, and signals what experts see as a significant weakening of the “maximum pressure” sanctions imposed by the Trump administration since it withdrew from the Iran nuclear deal in 2018.

Other countries, many of them scornful of Trump’s unilateralism on Iran, are showing increasing reluctance to enforce the restrictions, even as Iran embarks on a new expansion of its uranium stockpile, according to industry analysts and intelligence officials, some of whom spoke on the condition of anonymity to discuss sensitive assessments.

As a result, Trump is widely expected to leave President-elect Joe Biden with a crisis that is worse, by nearly every measure, than when he was elected four years ago: an Iranian government that is blowing past limits on its nuclear program, while Washington’s diplomatic and economic leverage steadily declines.

“The Tehran regime has met ‘maximum pressure’ with its own pressure,” said Robert Litwak, senior vice president of the Washington-based Woodrow Wilson International Center for Scholars and the author of “Managing Nuclear Risks,” a book on countering proliferation threats. Far from halting Iran’s nuclear advances, Litwak said, the administration’s policies have “diplomatically isolated the United States, not Iran.”

The weakening of sanctions pressure gives Iran more time to deal with its still formidable economic challenges, without losing a step in its bid to re-create uranium assets it had given up under the terms of the nuclear accord, the intelligence officials and industry experts said. Last week, the International Atomic Energy Agency reported to member states in a confidential document that Iran’s stockpile of low-enriched uranium has swollen to nearly 8,000 pounds, more than 12 times the limit set by the 2015 nuclear deal. Iranian officials justify the breach by noting that it was Washington, not Tehran, that walked away from the agreement.

Even among staunch U.S. allies in Europe and Asia, dismay over the Trump approach has cooled support for the kind of broadly enforced economic boycott that might push Iran to change its behavior, analysts said.

“Many eyes may be averted now” when it comes to Iranian cheating on sanctions, said Eric Lee, an energy strategist with Citigroup in New York. “Many countries are frustrated with U.S. unilateralism, even those with well-placed misgivings about Iran.”

I have no doubt that President Joe Biden will return competence to the State Department. But, repairing the mess left by the unholy Trump/Pompeo clown show won’t happen overnight. Respect and trust are built up over time. Once lost, they are not quickly regained. 

For example, any immigration/human rights expert could tell you how once-respected State Department Country Reports on Human Rights have gone from being the “international gold standard” to being “hackish” far right political screeds not worth the paper they are written on. This, in turn, has forced private organizations and NGOs to spend time, effort, and resources doing the State Department’s job. Meanwhile, the loss of competence and expertise at EOIR and the indifference of many Article III Judges means that even with the heroic efforts of of the private sector, justice for asylum seekers is more of “crap shoot” than a fundamentally fair legal process!

Nov. 7, 2020. Vice President and soon to be President Elect Joe Biden’s 33-year long quest for the U.S. Presidency will come to fruition on January 20, 2021. His running mate and soon to be Vice President Elect Senator Kamala Harris will become the first woman and the first African American to hold the number two job. 

Although the results of the Presidential contest were long in coming, they basically fulfilled pre-election predictions. Harris-Biden are on pace to win a clear majority of the popular vote by over four million votes, in the process compiling the highest vote total in U.S. election history. 

Unlike 2016, this time the popular vote translates into an insurmountable 59 vote margin and a majority in the electoral college. Fittingly, Biden’s apparent victory in Pennsylvania put him over the top. But, with the Biden Harris team in the lead in the “undecided” states of Nevada, Arizona, and Georgia that electoral margin seems likely to widen when the final vote is tabulated. Only the remaining states of Alaska and North Carolina appear to be falling into the Trump column, which would still leave the soon-to-be former President woefully short of an electoral majority. 

Indeed, he is now on pace to lose by the same electoral majority than he compiled in defeating Clinton notwithstanding losing the popular vote to her by millions. At that time, Trump characterized his electoral college victory as a “landslide,” notwithstanding his very clear defeat in the popular vote. While compiling a head-scratchingly large cult-like following of tens of millions that propelled him to victory on 2016 and helped prop up his bizarrely incompetent presidency, Trump was never popular with the majority of Americans, except in his own muddled mind. 

In winning a convincing victory, if not the overwhelming one that Democrats hoped for and that many pundits and pollsters predicted, Biden/Harris appear to have held every state won by Hillary Clinton in 2016 while “flipping” Biden’s birth state of Pennsylvania, Michigan, and Wisconsin by narrow margins. If their narrow current leads in Arizona and Georgia hold, they will add “flips” of these traditional GOP strongholds to their list of election achievements.

Biden becomes only the third candidate since Franklin D. Roosevelt in 1932 to unseat a sitting elected President, the others being President Ronald Reagan and President Bill Clinton. (President Jimmy Carter unseated President Gerald Ford in 1980, but Ford was never elected to either the Vice Presidency or the Presidency.) Biden also becomes the fourth Vice President in the past 70 years  to later win a Presidential election.

Harris is a graduate of Howard University and Cal Hastings Law. Her win is a huge milestone for “historically black colleges” and their many talented graduates throughout our nation.

Biden is a graduate of the University of Delaware and Syracuse Law. The Harris-Biden tandem may be the first time that “non—Ivy” lawyers have held both of our top elected positions. That’s a tribute to the many fine law schools outside the Ivy League that produce the vast majority of the nation’s legal talent and fuel most of the “practical lawyering and usable scholarship” that keeps our legal system afloat.

Hopefully, our new leaders will keep that in mind when filling key positions in their upcoming Administration and particularly in making Federal Judicial appointments at all levels. That’s especially important considering the disturbing failure of many graduates of so-called “elite” law schools serving us as public officials and judges to effectively and courageously stand up to the all out assault on the rule of law, ethics, constitutionally required due process and equal protection, and human decency by the Trump regime.

Any surviving functionality and integrity in our courts and public institutions is largely the result of courageous and under-appreciated attorneys, many working pro bono, who have fought at the “retail level” of our justice system to preserve those human rights and fundamental values upon which our legal system rests. All too often, they suffered bullying and abuse from the cowardly Trump regime for their efforts, while life-tenured Federal Judges failed in their duty to intercede to protect officers of their courts and their clients whose rights were being trampled by a group of out of control White Nationalist bigots.

Thus, the Biden-Harris team will enter what is probably the most consequential Presidency in U.S. history at one of the most most difficult and contentious times. With an out of control pandemic, high unemployment, rapidly deteriorating environment, festering racism, looming healthcare, opioid, and educational crises, cratering international prestige, trade wars, a crippled and demoralized career civil service, a failing judicial system, dysfunctional immigration and refugee systems, lack of trust in Government, disquiet in the intelligence and military communities, lack of competent Executive leadership over the past four years, and about 70.3 million Americans essentially living “in a parallel universe” but still our fellow citizens and essential to our society, saving American democracy would be a daunting task for any leaders. Some would say “mission impossible.” But, I can’t think of anyone better suited than the Biden-Harris team to undertake that mission.

In a democracy, successful outcomes are never guaranteed. But, if our democracy turns out to be beyond reclamation, it almost certainly will be because “We the People” fail to give our new leaders the support they need and deserve.

As for Trump, ever the total boor and purveyor of hate, division, and lies, he sent a missive from his golf course saying that he wouldn’t concede and pledged to continue to pelt our already crumbling court system with yet more frivolous litigation. Thankfully, most news commentators chose to read only a few lines of his incoherent rant before returning to the real news surrounding Biden and Harris. How quickly even the most bombastic ones with the biggest egos become “yesterday’s news.”

So, unsurprisingly, Trump, who undoubtedly will go down as the worst, most corrupt, and least competent President in U.S. history, will exit with the same disturbing lack of class, honesty, and fundamental human decency that has characterized his four-year “nightmare reign.” Meanwhile, as he relaxes, pouts, and sulks on the links, the pandemic that he failed to take reasonable steps to address or control, and consistently and dishonestly tried to downplay, continues to rage unabated and ravish our nation.  

One of the hardest hit areas: The Upper Midwest, particularly my native state of Wisconsin. That might explain why today Trump is playing golf and Joe Biden and Kamala Harris are sharing center stage! For a change, its nice to have folks who represent some of the most admirable human qualities that America has produced getting their time in the spotlight.

The good news: After 12:01 PM on January 20, 2021, the majority of us won’t care about the antisocial antics of the biggest loser of this election!

Lawsuit Seeks to Uncover Secretive Expansion of Judicial Black Sites for Immigration Cases

 

WASHINGTON, DC — Immigration groups filed a lawsuit today in the United States District Court for the District of Columbia against the Executive Office for Immigration Review (EOIR)—which oversees immigration courts—and the General Services Administration (GSA) requesting information on the expansion and creation of immigration adjudication centers, which were established as part of EOIR’s Strategic Caseload Reduction plan designed to accelerate removal proceedings at the expense of due process.

 

The lawsuit—filed by the American Immigration Council, American Immigration Lawyers Association, the Chicago AILA Chapter, and the National Immigrant Justice Center— seeks the disclosure of records on the obscure procedural rules for immigration adjudication centers. The centers are a new initiative created under the Trump administration where immigration judges adjudicate immigration cases from around the country in remote-only settings that are closed to the public.

 

Immigration adjudication centers appear to have been created to address immigration court backlogs, but attorneys and immigrants facing deportation have little instruction on the procedures for appearing before these centers. Immigration lawyers and advocates have expressed concerns after public reports indicate the potential expansion of immigration adjudication centers across the country.

 

The lawsuit challenges EOIR’s failure to disclose information in response to a Freedom of Information Act request submitted in March 2020. EOIR and GSA have failed to disclose critical information about what immigration courts presently exist, immigration court expansion, and contracts governing this expansion.

 

“Immigration lawyers and advocates have an interest in pressing for more transparency in the immigration courts, helping ensure the due process rights of all who appear in court, and providing guidance to the lawyers representing people before these courts,” said Claudia Valenzuela, FOIA senior attorney at the American Immigration Council.

 

“Transparency is essential to a fair day in court. Unfortunately, the secretive creation and expansion of immigration adjudication centers where immigration judges conduct remote-only proceedings in facilities closed to the public demonstrate how opaque an already complex immigration court system has become at the hands of this administration. While the Department of Justice regulations require immigration hearings to generally be open to the public, this administration has imposed significant new barriers to the public’s ability to observe these proceedings and has led to some hearings being conducted in secret, calling into question whether the fundamental elements of due process are being met. We are proud to stand alongside our partners in this effort,” said Laura Lynch, senior policy counsel at the American Immigration Lawyers Association.

 

“Everyone deserves a fair day in court. The lack of transparency in EOIR operations compromises the integrity of our immigration system and undermines public confidence in this system,” said Nell Barker, chair of the American Immigration Lawyers Association’s Chicago Chapter. “The secretive expansion of immigration courts is a blow to due process and adds a layer of unnecessary unpredictability to a system that struggles to inform stakeholders about changing procedures. We are concerned about the increasing inaccessibility of immigration courtrooms to lawyers, clients, and the public.”

 

“The secretive and inaccessible immigration adjudication centers, where judges determine whether noncitizens will be deported to persecution and torture or permanent family separation, are a disturbing example of the manner in which this administration has developed and expanded numerous policies and procedures intended to expedite the deportation of noncitizens without due process,” said Sarah Thompson, senior litigation attorney at the National Immigrant Justice Center. “EOIR must make public its plan for future adjudication centers and the procedures under which these centers operate.”

If we kick out the kakistocracy next week, we could put qualified “practical scholars” like Ingrid and others like her in charge and remake both DHS and the Immigration Courts to actually operate as required by Due Process while also fulfilling legitimate law-enforcement objectives. To state the obvious, neither of these objectives is being realized at present. It’s bad for America and for humanity.

For far too long, the wrong individuals, lacking the necessary expertise in immigration and human rights, and also lacking a firm commitment to equal justice under law, have been “in charge” of the Government’s immigration policy and legal apparatus and appointed to the Federal Courts, at all levels. That’s particularly true at the Supremes where only Justices Sotomayor and (some days) Kagan appear “up to the job.”  

We will never end institutionalized racism, achieve equal justice for all, and realize the true human and economic potential of America until we bring our broken immigration and refugee systems and our failing Federal Judicial System into line with our Constitutional and national values. That process must start, but certainly will not end, with this election!

Susan Church, an immigration attorney in Boston, ended the first week of the Trump administration arm in arm with protesters at Logan Airport, resisting an executive order banning travel from several predominantly Muslim countries. But what happened the next day, away from the public chants of “Let them stay!” was more typical of what the life of the former chair of the New England chapter of the American Immigration Lawyers Association (AILA) was to become under the Trump administration.

Church and an associate filed an emergency lawsuit to secure the release of immigrants from Customs and Border Protection (CBP) custody. “I got a federal judge on the phone, you know, on a Saturday night at eight o’clock.” The judge told Church to go to court immediately. An hour later, the attorneys were in court defending their clients.

“For me, that was the canary in the coal mine about what the rest of my four years under the Trump administration was going to be like,” Church said. “It’s just a nonstop series of emergency litigation filed to try to rescue one or 10 or 100 or 1,000 people, depending on which issue it is.” Eventually, the speed of the work, and the physical and mental exhaustion it triggered, landed Church in the hospital. “I thought I was having a heart attack,” she said.

Church stayed with the fight to reunite parents with their children. She described the process of taking affidavits from clients, which require she learn every harrowing detail of a client’s trauma. In one instance, CBP ripped away one woman’s eight-year-old daughter at the border. “She had to comb her daughter’s hair and change her daughter’s clothes and put her on a bus and say goodbye to her,” Church said through tears. The two were separated for nearly two months, even after the mother was released from detention.

Church was able to reunite her client with her child, but the episode—like many, many other cases—weighs heavy on her shoulders. “I don’t think I’ll ever be quite the same person that I was beforehand,” she said.

Four years into this migration crisis, there’s a parallel migration under way—of immigration lawyers out of the profession. Survey data and interviews the Prospect conducted with more than a dozen lawyers around the country reveal the physical, mental, and financial toll endured by members of the bar. Given the extreme violence, trauma, and inhumanity their clients often endure, immigration attorneys don’t like to talk about how it affects them. But secondary trauma also leaves a mark, making it impossible to continue for some attorneys. Although numerical data is limited, there is evidence that some attorneys are cutting back on some types of cases, such as deportation defense work, or even leaving immigration law altogether. Removal defense casework is one of the most time-intensive, emotional, and exigent parts of lawyers’ loads. It’s also where the administration has aimed much of its cruelest policymaking, severely limiting lawyers’ efficacy.

Under the Trump administration, immigration law has changed not only profoundly, but also so rapidly that it’s hard for immigration attorneys to keep up. Susan Church—and several other attorneys interviewed for this article—described combating Trump’s policies as a game of whack-a-mole.

Remember, all of these cosmic “immigration law changes” have taken place without a single piece of major legislation enacted by Congress! Indeed, the Trump regime’s ham-handed attempt to force it’s nativist agenda down the throats of the Congress as part of the “Dreamer fiasco” fell flat on its face in both Houses!  But, the Supremes have both encouraged and enabled Trump (actually notorious white supremacist Stephen Miller) to rewrite the law through. “Executive fiat.” Totally inappropriate, not to mention glaringly unconstitutional.

The Supremes’ majority has time and again improperly sided with the unethical, immoral, and Constitutionally bankrupt “Dred Scottification” of migrants, particularly asylum seekers. It’s not much different from what has happened to African Americans, Latinos, and other minorities following the Civil War. But, this is supposed to be the 21st Century where we have put “Jim Crow” behind us. Obviously, we haven’t!

Failing to protect “officers of the court” (lawyers) and their clients from a scheme of abuses heaped upon them by a corrupt, biased, out of control, overtly racist Executive and his sycophants is a gross dereliction of duty by the Supremes. It’s basically like allowing, and even encouraging, the badgering of a witness during trial! 

It’s painfully obvious that we have many of the wrong folks on the bench — from the Immigration Courts to the Supremes. Indeed, the nation and the world would be much better served if many more of those courageous lawyers who serve the immigrant community and human rights experts were on the Federal Bench at all levels. 

Trump, Roberts, and the GOP judicial misfits have also shown us first-hand the profiles of individuals who should not be serving in judicial positions. Let them litigate their “originalist,” “unitary Executive,” and other “far out” righty philosophies as lawyers appearing before real judges —“practical scholars” who live in the 21st Century and are committed to problem solving rather than problem creating. As Joe Biden has noted, the entire judicial selection system and particularly the Supremes need a thoughtful re-examination and reform. 

Never again should we have Justices like Amy Coney Barrett and Clarence Thomas performing highly inappropriate and unethical televised “campaign stunts” for an incumbent President during an ongoing election. Geez! What kind of “impartial jurists” are they? 

Most first year law students could tell you that’s a “no-go!” Why have we “normalized” and “accepted” such obvious bias, misbehavior, and lack of sound judgment at the highest levels of our (not Trump’s or Mitch’s personal) Judiciary?

It’s not “Rocket Science!” The fundamental building blocks of our society are immigration, human rights, and equal justice! Any lawyer who who doesn’t embody those virtues and doesn’t publicly embrace them should not in the future be given a lifetime appointment as a Federal Judge — at any level!

We need better judges for a better America! We will never achieve constitutionally-required “equal justice for all” for African Americans, Latinos, or anyone else, nor can we reach our diverse nation’s full potential, if we don’t start “pushing back” against Roberts and the GOP’s right wing judicial oligarchy, their obtuse legal gibberish, and their anti-democratic “jurisprudence.”

It starts with voting to take back our country from the far right. But, that’s just the beginning of the changes needed if equal justice for all is to become a reality, rather than an ever unfulfilled promise, limited to certain privileged (predominantly White) groups within our society!

And, all of society owes a debt of gratitude to Ms. Church and other brave lawyers like her who represent the best our country has to offer and have actually suffered for standing up for the rule of law and the legal and human rights of the most vulnerable among us. In other words, standing up for all of our rights against a tyranny! 

Compare that with the utterly dismal composition of the “Trump kakistocracy” and its “Dred Scottification” of “the other.”

Over the past 3 1/2 years, President Donald Trump has aggressively pushed an “America First” agenda that has significantly weakened more than seven decades of peaceful cooperation between the United States and her treaty partners around the world. In parallel moves, this president has continued a courtship with Russian President Vladimir Putin and a dangerous, nuclear-armed North Korea while allowing China to extend its geopolitical reach and goal of economic dominance.

Despite the widening of perilous fault lines that have emerged from growing diplomatic tensions, the mercurial and ill-equipped president continues to criticize and undermine, with no intellectual rigor, the post-World War II order that has given us 70 years of relative political and economic stability.

Moreover, Trump’s isolationist moves are progressively weakening America. Withdrawing from the Paris climate accord (ratified by nearly 190 nations, including Russia and China), the Iran nuclear deal, the Trans-Pacific Partnership trade agreement, UNESCO, the United Nations Human Rights Council, the World Health Organization and numerous other long-standing international commitments has become part and parcel of his unabashed goal of turning his back — and by extension America’s — on the world.

Donald Trump’s re-election campaign poses the greatest threat to American democracy since World War II.

Mr. Trump’s ruinous tenure already has gravely damaged the United States at home and around the world. He has abused the power of his office and denied the legitimacy of his political opponents, shattering the norms that have bound the nation together for generations. He has subsumed the public interest to the profitability of his business and political interests. He has shown a breathtaking disregard for the lives and liberties of Americans. He is a man unworthy of the office he holds.

The editorial board does not lightly indict a duly elected president. During Mr. Trump’s term, we have called out his racism and his xenophobia. We have critiqued his vandalism of the postwar consensus, a system of alliances and relationships around the globe that cost a great many lives to establish and maintain. We have, again and again, deplored his divisive rhetoric and his malicious attacks on fellow Americans. Yet when the Senate refused to convict the president for obvious abuses of power and obstruction, we counseled his political opponents to focus their outrage on defeating him at the ballot box.

Nov. 3 can be a turning point. This is an election about the country’s future, and what path its citizens wish to choose.

‘We Need to Take Away Children,’ No Matter How Young, Justice Dept. Officials Said

Top department officials were “a driving force” behind President Trump’s child separation policy, a draft investigation report said.

WASHINGTON — The five U.S. attorneys along the border with Mexico, including three appointed by President Trump, recoiled in May 2018 against an order to prosecute all undocumented immigrants even if it meant separating children from their parents. They told top Justice Department officials they were “deeply concerned” about the children’s welfare.

But the attorney general at the time, Jeff Sessions, made it clear what Mr. Trump wanted on a conference call later that afternoon, according to a two-year inquiry by the Justice Department’s inspector general into Mr. Trump’s “zero tolerance” family separation policy.

“We need to take away children,” Mr. Sessions told the prosecutors, according to participants’ notes. One added in shorthand: “If care about kids, don’t bring them in. Won’t give amnesty to people with kids.”

Rod J. Rosenstein, then the deputy attorney general, went even further in a second call about a week later, telling the five prosecutors that it did not matter how young the children were. He said that government lawyers should not have refused to prosecute two cases simply because the children were barely more than infants.

“Those two cases should not have been declined,” John Bash, the departing U.S. attorney in western Texas, wrote to his staff immediately after the call. Mr. Bash had declined the cases, but Mr. Rosenstein “instructed that, per the A.G.’s policy, we should NOT be categorically declining immigration prosecutions of adults in family units because of the age of a child.”

The Justice Department’s top officials were “a driving force” behind the policy that spurred the separation of thousands of families, many of them fleeing violence in Central America and seeking asylum in the United States, before Mr. Trump abandoned it amid global outrage, according to a draft report of the results of the investigation by Michael E. Horowitz, the department’s inspector general.

The separation of migrant children from their parents, sometimes for months, was at the heart of the Trump administration’s assault on immigration. But the fierce backlash when the administration struggled to reunite the children turned it into one of the biggest policy debacles of the president’s term.

Though Mr. Sessions sought to distance himself from the policy, allowing Mr. Trump and Homeland Security Department officials to largely be blamed, he and other top law enforcement officials understood that “zero tolerance” meant that migrant families would be separated and wanted that to happen because they believed it would deter future illegal immigration, Mr. Horowitz wrote.

The draft report, citing more than 45 interviews with key officials, emails and other documents, provides the most complete look at the discussions inside the Justice Department as the family separation policy was developed, pushed and ultimately carried out with little concern for children.

This article is based on a review of the 86-page draft report and interviews with three government officials who read it in recent months and described its conclusions and many of the details in it. The officials, who spoke on the condition of anonymity because they had not been authorized to discuss it publicly, cautioned that the final report could change.

Before publishing the findings of its investigations, the inspector general’s office typically provides draft copies to Justice Department leaders and others mentioned in the reports to ensure that they are accurate.

Mr. Horowitz had been preparing to release his report since late summer, according to a person familiar with the investigation, though the process allowing for responses from current and former department officials whose conduct is under scrutiny is likely to delay its release until after the presidential election.

Mr. Sessions refused to be interviewed, the report noted. Mr. Rosenstein, who is now a lawyer in private practice, defended himself in his interview with investigators in response to questioning about his role, according to two of the officials. Mr. Rosenstein’s former office submitted a 64-page response to the report.

“If any United States attorney ever charged a defendant they did not personally believe warranted prosecution, they violated their oath of office,” Mr. Rosenstein said in a statement. “I never ordered anyone to prosecute a case.”

Intentionally violating Constitutional rights (not to mention lying and attempting to cover it up) is clearly a violation of 18 USC 242.

Sure looks like an”open and shut” case for prosecution.

The irony: Families and their kids have been traumatized for life, perhaps even killed or disabled by the actions of these criminal conspirators; however, the “perps” remain at large.

Hamilton is on the public dole continuing to wreak-havoc on the Constitution, the rule of law, the Immigration Courts, and human decency at the corrupt Barr DOJ; Rosenstein works for a “fat cat” law firm hauling down a six figure salary while he avoids justice and accountability for his misdeeds; “Gonzo” had the absolute audacity to try to reinsert himself onto the public dole by running for the Senate from Alabama (thankfully, unsuccessfully, even though he previously held the seat for years and misused it as a public forum to spread his racist ideas, xenophobic venom, lies, false narratives, and unrelenting cruelty).

Where’s the “justice” in a system that punishes victims while letting “perps” prosper and go free?

Compare the courage and fidelity to due process, fundamental fairness, equal justice for all, and defense of human dignity demonstrated by brilliant lawyers like Michelle Mendez, Aimee Mayer Salins (former BIA JLC), and the terrific CAIR litigators with the warped right wing, anti-constitutional, anti-humanity jurisprudence of Trump’s Supreme Court choice, Judge Amy Coney Barrett:

Faced with two plausible readings of a law, fact, or precedent, Barrett always seems to choose the harsher, stingier interpretation. Can job applicants sue employers whose policies have a disproportionately deleterious impact on older people? Barrett said no. Should courts halt the deportation of an immigrant who faced torture at home? Barrett said no. Should they protect refugees denied asylum on the basis of xenophobic prejudice? Barrett said no. Should they shield prisoners from unjustified violence by correctional officers? Barrett said no. Should minors be allowed to terminate a pregnancy without telling their parents if a judge has found that they’re mature enough to make the decision? Barrett said no. Should women be permitted to obtain an abortion upon discovering a severe fetal abnormality? Barrett said no.

There is no question that, if confirmed, Barrett would cast the fifth vote to either hollow out Roe v. Wade or overturn it altogether. Similarly, there is no doubt that Barrett would dramatically expand the Second Amendment, invalidating gun control measures around the country. It’s quite possible, perhaps even likely, that within a year of her confirmation, Americans will be forbidden from terminating a pregnancy in 21 states—but permitted to purchase assault weapons and carry firearms in public in every state.

In other words, guns yes; human rights and human dignity, no! Some lawyers spend their lives saving lives and advancing humanity; others spend them pursuing and spreading anti-humanitarian, right wing dogmas. Why are commitments to cruelty, inhumanity, and a fundamentally unjust society things to “tout” in a judicial candidate? You need to look inside the deep perversity of the GOP minority who control our nation and are running it into the ground to get the answer.

There are thousands of progressive lawyers, many of them women and minorities, committed to standing up for equal justice for all who are better qualified than Judge Barrett. There is something wrong with a system that elevates the wrong people to the judiciary and other high offices.

It’s time to establish meritocracy and save our democracy. Vote to throw the GOP out of office and end the selection of far-right judges whose reactionary views and lack of empathy for the most vulnerable in society are far outside both the reality of our diverse nation and our future as a vibrant, progressive democracy that will promote equal justice and human rights at home and abroad!

Keep the future Judge Barretts where they belong — on the sidelines and in the margins of our legal system, while those with a better view of the Constitution, the rule of law, and human progress take their rightful places in positions of power and progressive influence in all there branches of our Government.

Judge Barrett parrots great admiration for RBG while aiming to trash her legacy of fairness and equality with a far-right, exclusive, intolerant agenda. In the future, we need Federal Judges who will constantly confront Judge Barrett, her soon-to-be-fellow GOP Supremes, and other righty judges bent on taking us back to the darkest corners of our past.  Make them face the truly courageous and enlightened legacy of RBG and others like her. Force the “Barretts of the world” to reckon with their own smugly disingenuous jurisprudence and their lack of commmitment to humanity and true equality before the law for all persons in the U.S.! Constantly confront complicit courts for change!

Better judges for a better, fairer America!

This Fall, vote like your life and the future of humanity depend on it! Because they do!

And would we have expected anything different from Sen. Lindsey O. Graham (R-S.C.), the shape-shifting chairman of the Judiciary Committee?

Back in the days when he pretended to care about something more than sucking up to power, Graham used to say Republicans would have to live with what they had done to Obama’s 2016 nominee, Merrick Garland. In October 2018, shortly before taking the gavel of the committee that will consider Trump’s nomination, Graham promised: “If an opening comes in the last year of President Trump’s term, and the primary process has started, we’ll wait till the next election.”

Now — surprise! — Graham has promised, via Twitter: “I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.” His rationale, if you can dignify it by calling it that, is that Democrats did things that offended him. So it’s payback time.

Oh, and let’s consider the sanctimonious and pseudointellectual Sen. Ted Cruz (R-Tex.), whom Trump has said he would consider for future openings on the court. When running for president in early 2016, he loftily declared to NBC’s Chuck Todd: “It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year. And what this means, Chuck, is we ought to make the 2016 election a referendum on the Supreme Court.”

What Cruz said wasn’t true, as is so often the case. There had indeed been instances of presidential nominees being confirmed during election years. In February 1988, a Democratic-led Senate voted 97-0 to put Ronald Reagan’s pick, Anthony M. Kennedy, on the court.

But this was only the beginning for Cruz. When it still appeared that Hillary Clinton would win in 2016, he also suggested that the court could get along just fine with only eight members indefinitely. Now — surprise! — Cruz is warning that having an even number of justices constitutes a “grave danger.”

Says it all about Billy the Bigot. His “downward sprint to the finish” has rocketed him past “John the Con” Mitchell and Jeff “Gonzo Apocalypto” Sessions as the most corrupt AG in modern American history. 

That’s, of course, not to minimize or trivialize the crimes committed by either of the other contenders. I suspect we’ll still be unpacking the full extent of Gonzo’s “crimes against humanity” decades from now, as the uglier and uglier truth about this “21st Century Jim Crow” dribbles out a bit at a time

Gee, even the “Afternoon Neighborhood Dog Walking Club” — comprised of neither lawyers nor hard core liberals, can’t understand why Barr, this walking, talking ethics cesspool is 1) still in office; 2) not in jail; and 3) still licensed to practice the law. Here’s hoping that all three of these unfathomable mysteries are resolved favorably to the public interest in the near future! In the meantime, Billy serves as a stark reminder of what’s wrong with legal ethics and our justice system at present.

On the latest episode of Inside the Hive, former Republican strategist Stuart Stevens described the GOP under Donald Trump as a party of cynics, stooges, racists, and obsequious enablers whose profiles in cowardice bear an uncomfortable resemblance to 1930s Germany. “When I talk to Republican politicians, I hear Franz von Papen,” he says, referencing the German chancellor who convinced Germans that so-called radical leftists were a far greater threat than Adolf Hitler. “They all know that Trump is an idiot. They all know that he’s uniquely unqualified to be president. But they convinced themselves that he was a necessity.”

All too disturbingly true. For those who didn‘t notice, the GOP now has no platform. None! They are nakedly running on lies, racism, fear, White Supremacy, hate, misogyny, xenophobia, intentionally false narratives, anti-science, anti-intellectualism, and corruption. Sound familiar? It should to those of us who studied Modern European History and World War II. 

Two years ago, before the International Association of Refugee & Migration Judges meeting at Georgetown Law, fresh from a visit to the Holocaust Museum in DC, I gave a speech warning of a return to “Eve of the Holocaust thinking.” 

It was, of course, “extreme hubris and total self-delusion” to think anyone was paying attention. Nevertheless, it doesn’t lessen my “extreme sadness” of watching the disintegration of our nation, without being able to prevent it.

INTRODUCTION

 

Good afternoon. I am pleased to be here. Some twenty years ago, along with then Chief U.S. Immigration Judge Michael J. Creppy, I helped found this Association, in Warsaw. I believe that I’m the only “survivor” of that illustrious group of “Original Charter Signers” present today. And, whoever now has possession of that sacred Charter can attest that my signature today remains exactly as it was then, boldly scrawling over those of my colleagues and the last paragraph of the document.

 

As the Americas’ Chapter Vice President, welcome and thank you for coming, supporting, and contributing to our organization and this great conference. I also welcome you to the beautiful campus of Georgetown Law where I am on the adjunct faculty.

 

I thank Dean Treanor; my long-time friend and colleague Professor Andy Schoenholtz, and all the other wonderful members of our Georgetown family; the IARMJ; Associate Director Jennifer Higgins, Dimple Dhabalia, and the rest of their team at USCIS; and, of course, our Americas President Justice Russell Zinn and the amazing Ross Patee from the Canadian Immigration and Refugee Board who have been so supportive and worked so hard to make this conference a success.

 

I recognize that this is the coveted “immediately after lunch slot” when folks might rather be taking a nap. But, as the American country singer Toby Keith would say “It’s me, baby, with you wake up call!” In other words, I’m going to give you a glimpse into the “parallel universe” being operted in the United States.

 

In the past, at this point I would give my comprehensive disclaimer. Now that I’m retired, I can skip that part. But, I do want to “hold harmless” both the Association and Georgetown for my remarks. The views I express this afternoon are mine, and mine alone. I’m going to tell you exactly what I think. No “party line,” no “bureaucratic doublespeak,” so “sugar coating.” Just the truth, the whole truth, and nothing but the truth!

 

I have good news and bad news. The good news is that we don’t have an implicit bias problem in the U.S. asylum adjudication system. The bad news: The bias is now, unfortunately, quite explicit.

 

Here’s a quote about refugees: “I guarantee you they are bad. They are not going to be wonderful people who go on to work for the local milk people.”

 

Here’s another one: “We cannot allow all of these people to invade our Country. When somebody comes in, we must immediately, with no Judges or Court Cases, bring them back from where they came. Our system is a mockery to good immigration policy and Law and Order.”

 

Here’s another referencing the presence of an estimated 11 million undocumented residents of the U.S.: “Over the last 30 years, there have been many reasons for this failure. I’d like to talk about just one—the fraud and abuse in our asylum system.”

 

Here’s yet another: “We’ve had situations in which a person comes to the United States and says they are a victim of domestic violence, therefore they are entitled to enter the United States. Well, that’s obviously false but some judges have gone along with that.”

 

You might think that these anti-asylum, and in many cases anti-Latino, anti-female, anti-child, anti-asylum seeker, de-humanizing statements were made by members of some fringe, xenophobic group. But no, the first two are from our President; the second two are from our Attorney General.

 

These are the very officials who should be insuring that the life-saving humanitarian protection purposes of the Refugee Act of 1980 and the Convention Against Torture are fully carried out and that our country fully complies with the letter and spirit of the 1951 Convention Relating to the Status of Refugees which is binding on our country under the 1967 Protocol.

 

Let me read you a quote that I published yesterday on my blog, immigrationcourtside.com, from a young civil servant resigning their position with “EOIR,” otherwise known as our Immigration Court system, or, alternatively, as the sad little donkey from Winnie the Pooh.

 

I was born and raised in a country that bears an indelible and shameful scar—the birth and spreading of fascism. An ideology that, through its different permutations, almost brought the world as we know it to an end. Sadly, history has taught me that good countries do bad things—sometimes indescribably atrocious things. So, I have very little tolerance for authoritarianism, extremism, and unilateral and undemocratic usurpations of Constitutional rights. I believe that DOJ-EOIR’s plan to implement individual annual numerical performance measures—i.e., quotas—on Immigration Judges violates the Due Process clause of the Fifth Amendment of the United States Constitution, and the DOJ’s own mission to “ensure the fair and impartial administration of justice.” This is not the job I signed up for. I strongly believe in the positive value of government, and that the legitimacy of our agency—and any other governmental institution for that matter—is given by “the People’s” belief in its integrity, fairness, and commitment to serve “the People.” But when the government, with its unparalleled might and coercive force, infringes on constitutionally enshrined rights, I only have two choices: (1) to become complicitous in what I believe is a flagrant constitutional violation, or (2) to resign and to hold the government accountable as a private citizen. I choose to resign because I cannot in good conscience continue serving my country within EOIR.

 

Strong words, my friends. But, words that are absolutely indicative of the travesty of justice unfolding daily in the U.S. Immigration Courts, particularly with respect to women, children, and other asylum seekers –- the most vulnerable among us. Indeed, the conspicuous absence from this conference of anyone currently serving as a judge in the U.S. Immigration Courts tells you all you really need to know about what’s happening in today’s U.S. justice system.

 

Today, as we meet to thoughtfully discuss how to save refugees, the reality is that U.S. Government officials are working feverishly at the White House and the U.S. Department of Justice on plans to end the U.S. refugee and asylum programs as we know them and to reduce U.S. legal immigration to about “zero.”

 

Sadly, the U.S. is not alone in these high-level attacks on the very foundations of our Convention and international protection. National leaders in Europe and other so-called “liberal democracies” — who appear to have erased the forces and circumstances that led to World War II and its aftermath from their collective memory banks — have made similar statements deriding the influence of immigrants and the arrival of desperate asylum seekers. In short, here and elsewhere our Convention and our entire international protection system are under attacks unprecedented during my career of more than four decades in the area of immigration and refugee protection.

 

As a result, judges and adjudicators throughout the world, like you, are under extreme pressure to narrow interpretations, expedite hearings, view asylum seekers in a negative manner, and produce more denials of protection.

 

So, how do we as adjudicators remain loyal to the principles of our Convention and retain our own integrity under such pressures? And, more to the point, what can I, as someone no longer involved in the day-to-day fray, contribute to you and this conference?

 

Of course, you could always do what I did — retire and fulfill a longtime dream of becoming an internet “gonzo journalist.” But, I recognize that not everyone is in a position to do that.

 

Moreover, if all the “good guys” who believe in our Convention, human rights, human dignity, and fair process leave the scene, who will be left to vindicate the rights of refugees and asylum seekers to protection? Certainly not the political folks who are nominally in charge of the protection system in the US and elsewhere.

 

So, this afternoon, I’m returning to that which brought this Association together two decades ago in Warsaw: our united commitment to the letter and spirit of the 1951 Convention; additionally, our commitment to fairness, education, international approaches, group problem solving, promoting best practices, and mutual support.

 

In the balance of my presentation, I’m going to tell you four things, taken from our Convention, that I hope will help you survive, prosper, and advance the aims of our Convention in an age of nationalist, anti-refugee, anti-asylum, anti-immigrant rhetoric.

 

 

 

 

BODY

 

Protect, Don’t Reject

 

First, “protect, don’t reject.” Our noble Convention was inspired by the horrors of World War II and its aftermath. Many of you will have a chance to see this first hand at the Holocaust Museum.

 

Our Convention is a solemn commitment not to repeat disgraceful incidents such as the vessel St. Louis, which has also been memorialized in that Museum. For those of you who don’t know, in 1939 just prior to the outbreak of World War II a ship of German Jewish refugees unsuccessfully sought refuge in Cuba, the United States, and Canada, only to be rejected for some of the same spurious and racist reasons we now hear on a regular basis used to describe, deride, and de-humanize refugees. As a result, they were forced to return to Europe on the eve of World War II, where hundreds who should and could have been saved instead perished in the Holocaust that followed.

 

Since the beginning of our Convention, the UNHCR has urged signatory countries to implement and carry out “a generous asylum policy!” Beyond that, paragraphs 26 and 27 of the UN Handbookreiterate “Recommendation E” of the Convention delegates. This is the hope that Convention refugee protections will be extended to those in flight who might not fully satisfy all of the technical requirements of the “refugee” definition.

 

Therefore, I call on each of you to be constantly looking for legitimate ways in which to extend, rather than restrict, the life-saving protections offered by our Convention.

 

Give The “Benefit Of The Doubt”

 

Second, “give the benefit of the doubt.” Throughout our Convention, there is a consistent theme of recognizing the difficult, often desperate, situation of refugees and asylum seekers and attendant difficulties in proof, recollection, and presentation of claims. Therefore, our Convention exhorts us in at least four separate paragraphs, to give the applicant “the benefit of the doubt” in assessing and adjudicating claims.

 

As a sitting judge, I found that this, along with the intentionally generous “well-founded fear” standard, enunciated in the “refugee” definition and reinforced in 1987 by the U.S. Supreme Court and early decisions of our Board of Immigration Appeals implementing the Supreme Court’s directive, often tipped the balance in favor of asylum seekers in “close cases.”

 

 

 

 

Don’t Blame The Victims

 

Third, “don’t blame the victims.” The purpose of our Convention is to protect victims of persecution, not to blame them for all societal ills, real and fabricated, that face a receiving signatory country. Too much of today’s heated rhetoric characterizes legitimate asylum seekers and their families as threats to the security, welfare, heath, and stability of some of the richest and most powerful countries in the world, based on scant to non-existent evidence and xenophobic myths.

 

In my experience, nobody really wants to be a refugee. Almost everyone would prefer living a peaceful, productive stable life in their country of nationality. But, for reasons beyond the refugee’s control, that is not always possible.

 

Yes, there are some instances of asylum fraud. But, my experience has been that our DHS does an excellent job of ferreting out, prosecuting, and taking down the major fraud operations. And, they seldom, if ever, involve the types of claims we’re now seeing at our Southern Border.

 

I’m also aware that receiving significant numbers of refugee claimants over a relatively short period of time can place burdens on receiving countries. But, the answer certainly is not to blame the desperate individuals fleeing for their lives and their often pro bono advocates!

 

The answer set forth in our Convention is for signatory countries to work together and with the UNHCR to address the issues that are causing refugee flows and to cooperate in distributing refugee populations and in achieving generous uniform interpretations of the Convention to discourage “forum shopping.” Clearly, cranking up denials, using inhumane and unnecessary detention, stirring up xenophobic fervor, and limiting or blocking proper access to the refugee and asylum adjudication system are neither appropriate nor effective solutions under our Convention.

 

 

 

 

Give Detailed, Well-Reasoned, Individualized Decisions

 

Fourth, and finally, “give detailed, well-reasoned, individualized decisions.” These are the types of decisions encouraged by our Convention and to promote which our Association was formed. Avoid stereotypes and generalities based on national origin; avoid personal judgments on the decision to flee or seek asylum; avoid political statements; be able to explain your decision in legally sufficient, yet plainly understandable terms to the applicant, and where necessary, to the national government.

 

Most of all, treat refugee and asylum applicants with impartiality and the uniform respect, sensitivity, and fairness to which each is entitled, regardless of whether or not their claim under our Convention succeeds.

 

CONCLUSION

 

In conclusion, I fully recognize that times are tough in the “refugee world.” Indeed, as I tell my Georgetown students, each morning when I wake up, I’m thankful for two things: first, that I woke up, never a given at my age; second, that I’m not a refugee.

 

But, I submit that tough times are exactly when great, independent, and courageous judging and adjudication are necessary to protect both applicants from harm and governments from doing unwise and sometimes illegal and immoral things that they will later regret.

 

I have offered you four fairly straightforward ways in which adhering to the spirit of our Convention can help you, as judges and adjudicators, retain integrity while complying with the law: protect, don’t reject; give the benefit of the doubt; don’t blame the victims; and give detailed, well-reasoned, individualized decisions.

 

Hopefully, these suggestions will also insure that all of you will still be around and employed for our next conference.

In addition to the Moscow Mitches, Grahams, and other corrupt GOP pols who have sold out our nation, the disgraceful performance of Chief Justice John Roberts and his GOP colleagues in the face of the regime’s overtly racist, White Nationalist, deadly abuses of asylum seekers in violation of the Due Process and Equal Protection clauses of the Constitution, the Refugee Act of 1980 (b/t/w, ignored and abrogated, but never repealed), the Geneva Refugee Convention and 1967 Protocol, and the Convention Against Torture will fit well within the “Judicial Aid and Complicity Section” of the future “Museum Honoring Victims of Crimes Against Humanity Committed By The Trump Regime.”  

The Constitution is remarkably clear: All “persons” within the jurisdiction of the U.S. are entitled to due process and equal protection under our laws. Unquestionably, refugees seeking legal protection within our court system, some actually being detained, deported, or forced to relocate by our Government, are within our jurisdiction. An L1 law student knows that! It’s not rocket science!

So, the only way that the Supremes’ majority could abrogate legally required protections is through intentionally disingenuous “legal mumbo jumbo and gobbledygook” and ridiculous “legal fictions” that, at heart, convert refugees and migrants of color into “non-persons” under the law. Similar to their approach to the voting rights of African Americans and Latinos.

That’s how you abandon your duties to your fellow human beings and tank on your Constitutional oaths. Sounds pretty overtly racist to me. And, I must say, it sounds pretty racist to most lawyers who understand immigration and human rights laws.

Too bad and too late for those deserving justice and protection, men, women, children, members of the LGBTQ community, religious and political activists, most highly vulnerable and semi-defenseless in the face of lawless tyranny, whose lives have been sacrificed or ruined forever by lousy, ideological, tone-deaf, anti-human-dignity judging. 

It’s too late for them. But, it’s not too late for America to turn away from 1939 and advance to a better 2021 with a commitment to making “equal justice for all” under the law a reality rather than a cruel, unfulfilled, bogus promise! That would at least honor the memory of the dead, tortured, raped, broken, mutilated, and ruined who have been unnecessarily sacrificed by the GOP and their complicit judges who failed in their duties to our Constitution and to humanity.

We can’t change yesterday. But, we can stop repeating its mistakes!

The following is excerpted from “The Useful Idiot: How Donald Trump Killed the Republican Party with Racism and the Rest of Us with Coronavirus,” by S.V. Dáte.

A pandemic never occurred to them. The idea that Donald Trump would ever be required to sit still, pay attention and make rational decisions that would determine whether hundreds of thousands of Americans would live or die not once crossed the minds of those who put him into the Oval Office.

Oh, they all had their various reasons for wanting him there. For white evangelical Christians, he had explicitly promised to appoint the federal judges they had so longed for to turn back the nation’s cultural clock. For Mitch McConnell, a Trump win — as unlikely as it seemed — was the only real path to making sure Republicans retained control of the Senate and he himself remained majority leader. And for Vladimir Putin, having Trump in the White House — as unlikely as it seemed — would be a dream come true, an opportunity to wreak havoc on his longtime adversary and weaken its historic alliance with Western Europe.

Russia’s dictator, of course, was not remotely interested in what Trump’s ascension might mean for Americans in the event of an actual calamity. If they were dumb enough to vote for him, well, they deserved whatever they got. In any event, it was not his problem.

As for Trump’s American supporters, perhaps so much time had passed since Sept. 11, 2001, that the idea of a genuine national emergency was but a faded memory. Perhaps the quiet competence that President Barack Obama’s team had employed with the 2009 flu pandemic and later with the 2014 West African Ebola outbreak had diminished the perceived threat that a simple virus could present.

For whatever reason, even as they watched the noise and chaos and nonsense generated by candidate Trump for a full year and a half, the consequences of a real crisis requiring real leadership actually happening on the watch of a President Trump had never really dawned on them.

True, there existed then — and continues to exist today — a significant cadre of Republican voters who genuinely believed that the Trump they watched on “The Apprentice” was the real Donald Trump. That he was a real billionaire, based on his own efforts and smarts. That he was capable of making rational, quality decisions based on the facts presented to him.

That excuse, though, does not work for those Republicans from McConnell on down to the congressional candidates who had occasion to speak with Trump in person. As one top Republican National Committee member told me after his first face-to-face encounter with Trump two months before the 2016 election: “OK. Our guy is insane.”

His was not a minority view, by the way. Trump’s incoherence, his temper, his impulsiveness, his breathtaking ignorance — all of it was well-known among the top tiers of the Republican machinery. But for them, it was simply a challenge to overcome, another hurdle that fate had placed between them and their holy grail of judges and tax cuts and regulatory rollbacks. Not once did I ever hear any concern that just maybe they were working to install a useful idiot who truly was an idiot, with absolutely zero leadership qualities one ordinarily looks for in someone aspiring to become the chief executive of the world’s remaining superpower.

It was an abject failure of the Republican Party’s responsibility to the country. In our two-party system, both have a duty to weed out candidates who fail the threshold test of commander-in-chief and, relatedly, emergency-manager-in-chief. Through the summer and fall of 2015 and then the early nominating contests of 2016, it was clear as day that Trump was not credible in those roles, and yet neither the remaining candidates nor the party leadership made a serious effort to ensure his defeat.

True, there were some who voiced warnings. Jeb Bush called Trump a “chaos candidate” who would bring us a “chaos presidency.” But there was also Ted Cruz, who literally praised Trump for the better part of a year, refusing to criticize him in the hopes of one day inheriting his voters. By the time Cruz did unload on him, it was seen as sour grapes. Such was the cynicism and game-playing that put us where we are.
