Along the 2,000-mile (3,219km) boundary between the US and Mexico, the 2022 fiscal year proved the deadliest on record for people trying to make unauthorized crossings of this heavily patrolled international line.

In just 12 months, more than 800 migrants lost their lives in search of a better one as they disappeared beneath the tumultuous waters of the Rio Grande, succumbed to blistering summer heat, crashed in a smuggler’s vehicle, tumbled from a border barrier, or otherwise had their travels violently cut short.

In Eagle Pass’s regional enforcement sector alone, border patrol agents discovered more than 200 dead migrants between October 2021 and the end of July, compared to an already heartbreaking 34 bodies during the entire 2020 fiscal year.

Ahead of this week’s crucial midterm elections, Republicans have manipulated these harrowing statistics as yet another opportunity to make much ado about what various rightwing players call Joe Biden’s “open border policies”, accusing his administration of incompetence that is causing “body bags [to] keep piling up”.

It’s close to sealed by a hostile combination of pandemic-era public health measures cynically retooled as federal immigration control and mass policing by state troops who arrest, jail and criminalize migrants.

Cruelly, these hardline deterrence mechanisms advanced by both Democrats and Republicans have probably only made the US’s south-west border bloodier.

Current US policy is predicated on a false assumption that if only the consequences for crossing the south-west border are severe enough, people will stop trying.

For decades, presidential administrations with disparate political views have unified under the paradigm of prevention through deterrence, erecting physical and legal obstacles to discourage people from crossing.

Deterrence as a strategy has informed some of the US’s most controversial immigration policies, from separating families, to detaining children, to stranding asylum seekers in dangerous Mexican border towns.

But desperate people still find ways to make it on to US soil: last fiscal year, Customs and Border Protection documented nearly 2.38m enforcement encounters at the southern border, a record high causing headaches for Biden as conservatives accuse the president of being “lax” on border crime.

The truth is more complex, and not at all lax. More than a million of last fiscal year’s border enforcement encounters were processed under Title 42, now invoked as a federal immigration enforcement tool but originally disguised as a public health measure amid the Covid-19 pandemic.

The policy allowed the Trump and now the Biden administrations to expel huge numbers of people from the US without even letting them ask for asylum, seemingly in violation of domestic and international law.

Far from ending unauthorized migration, the invocation of Title 42 has in fact dramatically inflated the number of encounters at the US-Mexico border, as people who are expelled feel compelled to cross again – and again, and again. Sometimes, relentless migrants have been so determined to complete their journeys that they have risked life and limb dozens of times, fueling a political and humanitarian disaster.

Yet even though these expulsions have proved ill-advised both optically and ethically, Biden has now expanded the use of Title 42 by adding Venezuelans to the list of nationalities targeted for return to Mexico, an apparent betrayal of his campaign promises to uphold the legal right to seek asylum and a paradox as his administration ostensibly fights to sunset the practice in court.

And both parties continue to police people seeking security and opportunity over violence, persecution and poverty as if they’re national security threats.

In the shadow of it all, the corpses amass.

Back in Eagle Pass, locals like Rosalinda Medrano who have lived for decades along a porous border understand that migrants have and will always come or, increasingly, die trying.

“Even though there’s one fence, and another fence, and so many troopers, and the national guard, and you name it – Border Patrol, here and there and everywhere – it’s not gonna stop these families,” she said, adding simply: “They want a better life.”

Read the complete article at the link, in which Alexandra points to the numerous achievable solutions that both parties eschew — for political reasons — some cynical, dishonest, and racist (GOP) — others cowardly (Dems). None of what Alexandra reports will come as news to faithful readers of Courtside, or, indeed, to anyone who has taken the time to actually study and reflect on America’s decades of expensive, inhumane, “deterrence policies.”

Fact is, existing law, if correctly applied and administered, offers some obvious ways to start solving the problem:

  • Robust realistic “overseas” refugee programs in the Western Hemisphere — 150,000 would be a modest start — rather than the piddling, restricted numbers now slowly doled out by the Biden Administration.
  • Reopen legal ports of entry to legal asylum seekers, as required by law, to incentivize and reward them for not seeking to cross between ports of entry.
  • Staff the Asylum Office and the Immigration Courts with real experts in asylum law (there are plenty of well-qualified lawyers now in the private sector) who are committed to due process and can rapidly recognize and grant the many meritorious cases. Then, individuals are admitted in legal status, on their way to green cards, rather than aimlessly wandering the US with government-issued packets of misinformation (or no information at all) waiting for hearings that will come either too soon or too late, but never in a reasonable manner and often with incorrect preordained results designed to abuse the legal system as an “enforcement deterrent.” (NOTE: To act as an incentive/reward for appearing at ports of entry, the asylum system must be credible, transparent, and timely — something that no Administration has achieved to date, but which is possible with more vision, leadership, and better personnel making decisions.)
  • Work with, bolster, support, and learn from the many NGOs in the U.S. to insure that asylum seekers are informed of their obligations, represented on their applications, and resettled, mostly away from the borders to areas that need them, in an orderly fashion.
  • Additional huge benefit: Despite the lies and myths spread by nativists, increasing legal immigration (including refugees and asylees) is one of the few potentially effective ways that the “political branches” of Government have to address inflation without causing recession. We can, and must, do better than “more body bags” as a matter of national policy! Migrants aren’t going to stop coming. That, we can’t change in the long run — no matter how many lies, myths, and distortions nativists throw out there, and no matter how fast spineless Dem politicos run from or attempt to hide the truth. But, we can deal with reality in a more humane, practical, realistic manner that will serve our nation’s, and humanity’s, interests into the future.

The 6/10/22 order in Texas v. United States vacating the memo went into effect 6/24/22 and has not been stayed at this time. ICE Detains About 23,400 at End of June While Agency’s Electronic Monitoring Program Grows to 280,000

TRAC: After hovering around 20,000 for several months, Immigration and Customs Enforcement’s detained population reached 23,390 on June 19, 2022—down slightly from the start of the month but still higher than in previous months. About three-quarters (74 percent) of people in detention were arrested by Customs and Border Protection (CBP). The number of immigrants arrested by ICE saw a modest but steady increase up to a total of 5,979. Detained Immigrant Women Are Facing A Grueling Abortion Struggle

Bustle: At a base level, the abortion restrictions detained women face are similar to the ones that low-income women face across the country because of the Hyde Amendment. For more than 40 years, the Hyde Amendment has prevented women on Medicaid from using federally funded insurance to pay for abortions, except in cases of rape, incest, or danger to the mother’s life. The same type of language exists in appropriations bills and healthcare regulations for all facets of the federal government, including the Immigration and Customs Enforcement agency.

Border Patrol paroles migrants to avoid massive overcrowding

AP: The Border Patrol paroled more than 207,000 migrants who crossed from Mexico from August through May, including 51,132 in May, a 28% increase from April, according to court records. In the previous seven months, it paroled only 11 migrants.

Law360: A Dominican man got a new chance to fight his deportation on Tuesday when the Third Circuit ruled that his felony conviction under Pennsylvania’s fleeing and eluding law didn’t necessarily amount to a crime of moral turpitude.

 

CA5 on Statutory Birthright Citizenship: Garza-Flores v. Mayorkas

LexisNexis: For years, Petitioner Javier Garza-Flores did not believe he had a valid claim to U.S. citizenship. But now he thinks that he does. And he has presented documentary evidence sufficient to demonstrate, at a minimum, a genuine issue of material fact concerning his claim of U.S. citizenship. That is enough to warrant a factual proceeding before a federal district court to determine his citizenship.

 

CA7 Menghistab v. Garland

CA7: The Board’s main quibble was with the relevance of that evidence to an Ethiopian citizen, which it assumed Menghistab to be. But that assumption was not warranted on the record that was before the Board. Denying the motion to reopen without a full hearing addressing Menghistab’s citizenship and its materiality to his risk of torture was therefore an abuse of discretion.

 

9th Circ. Says BIA Erred In Not Considering All Torture Risks

Law360: The Ninth Circuit on Friday granted a Salvadoran’s request to have the Board of Immigration Appeals review claims that he would be tortured if sent back to the Central American country, saying the board originally failed to consider all possible risk sources.

CBS: While the suspension of ICE’s arrest prioritization scheme is unlikely to place the country’s estimated 11 million unauthorized immigrants in immediate danger of being arrested, the absence of national standards could lead to inconsistent enforcement actions across the U.S., including arrests of immigrants whom agents were previously instructed not to detain, legal experts said.

  • According to a new book from former Trump Education Secretary Betsy DeVos:

“Over the din of patrons slurping lattes and crunching salads, Miller’s men described a plan to put U.S. Immigration and Customs Enforcement (ICE) agents into schools under the pretext of identifying MS-13 gang members. The plan was, when agents checked students’ citizenship status for the alleged purpose of identifying gang ties, they could identify undocumented students and deport them. Not only was the prospect of this chilling, but it was also patently illegal. Nate and Ebony turned them down cold. But that didn’t stop Stephen Miller from subsequently calling me to get my thoughts on the idea. 

  • For years, the BIA has had standard practice of giving short shrift to potentially valid claims for protection under the Convention Against Torture (“CAT”). Without meaningful analysis they simply cite John Ashcroft’s infamous “no CAT precedent” in Matter of J-F-F-,  23 I&N Dec. 912 (A.G. 2006), requiring that “each link in the chain of torture be proved to be probable.” 

Since there is almost always some allegedly “weak link in the chain” that’s an “easy handle” for denial.  Also, The IJ and the BIA can “lengthen the chain” or ignore the evidence as necessary to “get to no.” In the process, compelling evidence of likelihood of torture from qualified expert witnesses is either ignored or minimized — again, without much analysis. That’s how the “denial factory” in Falls Church can keep churning out CAT rejections even to countries where torture is rampant and either furthered or willfully ignored by the repressive governments.

At least in the 9th Circuit, the BIA will now have to go “back to the drawing board” for denying CAT and returning  individuals to countries where torture with government participation or acquiescence is likely. The 9th Circuit case rejecting the BIA’s “formula for denial” is Velasquez-Samayoa v. Garland.   • Louisiana has long been one of a number of EOIR “courts” — these are actually “prison courts” — where “asylum cases go to die.” The deadly combination of bad Immigration Judges, lack of skilled immigration attorneys able to take these cases pro bono, coercive use of detention in out of the way places in substandard conditions, a “denial oriented” BIA stacked by the Trump DOJ and not “unstacked by Garland,” and an indolent, often virulently anti-asylum 5th Circuit add up to potential death sentences for individuals who could gain protection under a system where due process and fundamental fairness were respected and followed.

As the report in The Advocate referenced by Elizabeth shows, Garland has failed to reform and improve this blot on American justice. And, there is little chance that assigning the cases to USCIS Asylum Office in the first instance under new regulations in this intentionally toxic environment is going to promote justice or efficiency. 

One might view the wide discrepancy between “positive credible fear findings” and asylum grants in Immigration Court as a sign of a sick and dying EOIR, not lack of merit for the claims. With less detention, more representation, better Immigration Judges, and a new BIA of true asylum experts willing to grant protection rather than “engineer rejection,” I’ll bet that many, perhaps a majority, of the outcomes would be more favorable to applicants. 

As noted by Mitch Gonzalez of the SPLC in the article, “dehumanization,” “de-personification,” and “Dred Scottification,” along with cruelty are the objects of what’s going on at EOIR in Louisiana. The “fit” with the Trump/Miller White Nationalist anti-immigrant program is obvious. What’s less obvious is why Garland and the Biden Administration haven’t intervened to make the necessary changes to restore EOIR in Louisiana and elsewhere to at least some semblance of a fair and impartial “court system.”

A family in Tijuana who wanted to request asylum and advocacy groups including Innovation Law Lab sought to intervene in the lawsuit. They argued that a court order keeping Title 42 in place should only apply to states involved with the suit. Summerhays denied their request.

Alicia Duran Raymundo, her partner and their 6-year-old daughter fled El Salvador after gang members threatened to torture and kill them. She said in a news release from her lawyers last week that they wanted to live with extended family in California while pursuing asylum, but instead joined the thousands of migrants living in Mexican border towns while they wait for the U.S. to reopen its doors.

“We’ve tried many times to ask for asylum but they just tell us the border is closed,” Duran said.

Seeking asylum is a legal right guaranteed under federal and international law, regardless of how someone arrived on U.S. soil. Some of those turned away are fleeing persecution, while others pushed out by turmoil in their home countries seek jobs and security.

Though migrants can’t seek asylum under Title 42, they can still be screened under the United Nations Convention Against Torture. But those screenings are more difficult to pass.

Lee Gelernt, deputy director of the American Civil Liberties Union’s immigrant rights project, noted that regardless of Friday’s decision, a prior ruling in Washington, D.C., District Court taking effect Monday prevents Title 42 from applying to families who face persecution or torture if they are expelled. Gelernt is lead attorney in that case.

“Hypocritically, the states that brought this lawsuit seemingly care about COVID restrictions only when they involve asylum seekers,” he said. “The lawsuit is a naked attempt to misuse a public health law to end protections for those fleeing danger.”

Migrants have been removed from the U.S. nearly 2 million times since Title 42 was first used in March 2020, in some cases to dangerous situations in which they’ve been tortured or raped.

Aaron Reichlin-Melnick, senior policy counsel at the American Immigration Council, predicted that Title 42 is likely to stay in place until at least next year.

Summerhays’ decision signals that while the Biden administration can establish a policy under emergency conditions, terminating it requires a rulemaking comment period that could take six months to a year.

Louisiana and the other states are not arguing that the policy can never end, Reichlin-Melnick said, but they’re imposing judicial roadblocks to delay it. The CDC is likely to try to end the policy again while satisfying the judge’s demands, he said.

In the meantime, he said, “we’re going to see an ever higher number of repeat crossings. Look at the border and tell me Title 42 works.”

Violence, political upheaval, war, genocide, religious intolerance, racism, food insecurity, poverty, femicide, child abuse, environmental disasters, rampant corruption, and prospects of starvation in several areas around the world are driving unprecedented levels of migration to our Southwest Border. The devastating impact of the COVID-19 pandemic, which involved the temporary suspension of our system for legal immigration, including admission of asylees and other refugees, has only exacerbated these challenges. A number of sources, including human smuggling organizations, peddle misinformation about entering the United States or coming to our borders.

With the restoration of our legal immigration system on the horizon, only two groups of foreign nationals will generally qualify for admission at our borders: first, those in possession of visas or equivalent documents usually issued by U.S. consular officers abroad; and second, those who can establish that they qualify for asylum or other forms of legal protection from return to persecution and/or torture.

Under our laws, asylum can only be granted to those reasonably fearing harm because of their race, religion, nationality, political opinion, or membership in a particular social group. Other foreign nationals facing harm not amounting to “torture” in their home countries will not be eligible for admission under our laws. Those who apply or are apprehended at or near the border and cannot show a “credible fear” of harm because of one of the foregoing grounds will be summarily removed from our country.

In short, if you do not have a valid visa or a bona fide claim for asylum or other legal protection, you should not make the journey to the U.S. border. You will be apprehended and summarily returned to your home country in accordance with our laws.

DHS is implementing a comprehensive strategy to address a potential increase in the number of border encounters. That strategy includes:

  1. Acquiring and deploying many more trained Asylum Officers to legal ports of entry to promptly decide “credible fear” cases for asylum seekers;
  2. Delivering a more efficient, fair, and timely asylum process by allowing Asylum Officers to grant credible, well-documented claims at the border;
  3. Working with NGOs, legal aid groups, and local governments to provide legal counseling and representation to those seeking asylum;
  4. Working with NGOs, religious organizations, and other social services entities in the U.S. to assist in orderly resettlement of those granted asylum or whose cases cannot be timely processed at the border;
  5. Processing and removing those who do not have valid claims; and
  6. Working with the UNHCR, NGOs, and other countries globally to manage migration and address root causes.

With the restoration of a fair and timely asylum and protection processing system at our legal ports of entry, all asylum applicants should apply in an orderly fashion only at those ports. That will be the safest, most efficient way of applying, offer the greatest opportunities for legal representation, and increase the chances of timely, legal admission into the United States for those who are qualified.

Those who attempt to avoid legal processing at ports of entry by unauthorized entry may well find their lives endangered by unscrupulous smugglers. Additionally, those who attempt to avoid the legal process available at ports of entry might subject themselves to detention, additional grounds for removal, bars on future reentry, and criminal prosecution. With the return of full legal immigration and improved asylum processing to ports of entry, DHS will be able to devote more enforcement resources to locating and apprehending those attempting irregular entry into the U.S. DHS will also target human smuggling operations.

The Department of Homeland Security (DHS) works to secure and manage our borders while building a fair and orderly immigration system. The CDC has announced that, on May 23, 2022, its Title 42 public health Order will be terminated. As a result, beginning on May 23, 2022, DHS will no longer process families and single adults for expulsion pursuant to Title 42. Instead, DHS will process them for removal under Title 8. Until May 23, 2022, the CDC’s Title 42 Order remains in place, and DHS will continue to process families and single adults pursuant to the Order.

Under Title 8, those who attempt to enter the United States without authorization, and who are unable to establish a legal basis to remain in the United States (such as a valid asylum claim), are subject to additional long-term consequences beyond removal from the United States, including bars to future immigration benefits.

There is broad agreement that our immigration system is fundamentally broken. The Biden-Harris Administration continues to call on Congress to pass legislation that holistically addresses the root causes of migration, fixes the immigration system, and strengthens legal pathways.
1. Acquiring and deploying resources to address increased volumes.

Developed an integrated and scalable plan to activate and mobilize resources.
DHS initiated a Southwest Border contingency planning effort last fall. Last month, the Secretary designated a Senior Coordinating Official and established the Southwest Border Coordination Center (SBCC) to coordinate planning, operations, engagement, and interagency support.

Ready to surge personnel and resources to the Southwest Border.
DHS has moved officers, agents, and DHS Volunteer Force personnel to rapidly decompress points along the border and more efficiently process migrants.

Increasing CBP temporary holding capacity to process high volumes of individuals in a humane manner.
CBP has mobilized resources to rapidly stand up, expand, and/or reinforce Central Processing Centers in order to provide more efficient end-to-end processing for migrants encountered at the Southwest Border. Additionally, more ICE staff will be deployed to the border to facilitate processing.

Utilized appropriated resources to improve border processing
In its FY22 appropriations bill, Congress provided an additional $1.45 billion for a potential Southwest Border surge, including $1.06 billion for CBP soft-sided facilities, medical care, transportation, and personnel costs; $239.7 million for ICE for processing capacity, transportation, and personnel costs; and $150 million for FEMA’s Emergency Food and Shelter Program at the Southwest Border. Earlier this week, President Biden submitted to Congress its FY23 Budget, which would fund the hiring of 300 new Border Patrol Agents and 300 new Border Patrol Processing Coordinators.

While the 2022 appropriation exceeded the request and represents a historic funding level for DHS, the appropriation would not be sufficient to fund the potential resource requirements associated with the current increase in migrant flows. DHS will fund operational requirements by prudently executing its appropriations; reprioritizing and reallocating existing funding through reprogrammings and transfers; requesting support from other Federal agencies; and finally, by engaging with Congress on any potential need for supplemental appropriations, as necessary.

Implementing COVID mitigation measures
The health and safety of the DHS workforce, communities, and migrants themselves is a top priority. CBP provides PPE to migrants who cannot be expelled under the CDC’s Title 42 order or are awaiting processing from the moment they are taken into custody, and migrants are required to keep masks on at all times. CBP also works with appropriate agencies that facilitate testing, isolation, and quarantine of migrants.

DHS has also been providing the COVID-19 vaccines to noncitizens in ICE custody since summer 2021. Beginning March 28, 2022, DHS expanded those efforts to cover migrants in CBP custody, so as to further safeguard public health and ensure the safety of border communities, the workforce, and migrants. These efforts will be ramped up over the next two months, to cover the majority of noncitizens taken into CBP custody.

In addition, DHS is putting in place decompression plans to protect against the kind of overcrowding that facilitates the spread of COVID-19.

2. Delivering a more efficient and fair immigration process.

Issued rule to expedite asylum claims.
On March 24, 2022, DHS and the Department of Justice issued a rule to improve and expedite processing of asylum claims made by recently arriving noncitizens, which provides for the expeditious granting of relief to those who have valid claims for asylum and prompt removal of those whose claims are denied. Once implemented at scale in the coming months, the rule will transform how cases are processed at the border. In President Biden’s Fiscal Year 2023 Budget to Congress, he makes good on the promise of this rule by investing $375 million to hire the personnel needed to quickly process asylum claims.

A Dedicated Docket process for more efficient immigration hearings.
In partnership with the Department of Justice, DHS established a new, more efficient process called the Dedicated Docket to conduct speedier and fair immigration proceedings for families who arrive between ports of entry at the Southwest Border. As a result, the length of time it takes for many of these cases to reach a final disposition has decreased from years to months.

Increased efforts to dismantle transnational criminal organizations that exploit vulnerable migrants
U.S. Customs and Border Protection, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, U.S. Citizenship and Immigration Services, the U.S. Department of State, and the Federal Bureau of Investigation and Drug Enforcement Administration of the U.S. Department of Justice launched a counter-network targeting operation focused on transnational criminal organizations affiliated with the smuggling of migrants.

This Operation targets criminal networks that profit from a broad range of illicit activities, such as human smuggling, by using targeted enforcement actions against them, including by denying access to travel and freezing bank accounts.

3. Processing and removing those who do not have valid claims.

Continuing to process migrants in accordance with the laws of the United States, including expeditiously removing those who do not have valid claims to remain in the United States.
Individuals who cross the border without legal authorization will be placed into removal proceedings and, if unable to establish a legal basis to remain in the United States, expeditiously removed. Those who attempt to enter the United States without authorization, and without a valid asylum claim, are subject to additional long-term consequences beyond removal from the United States, including bars to future immigration benefits.

Bringing targeted prosecutions of smugglers, repeat offenders, and those who seek to evade law enforcement.
In close coordination with the Department of Justice, DHS will refer border-related criminal activity to DOJ for prosecution where warranted, including that of smugglers, repeat offenders, and migrants who seek to evade U.S. Customs and Border Protection. U.S. Customs and Border Protection also continues to enforce its Repeat Offender initiative to target recidivism. Any single adult apprehended along the Southwest Border a second time, after having previously been apprehended and removed under Title 8, is referred for criminal prosecution. This initiative has improved DHS’s ability to escalate consequences and conserve processing resources.

4. Working with other countries in the Western Hemisphere to manage migration and address root causes.

Working closely with source and transit countries in the region to deter migration.
The Administration is working with source and transit countries in the region to facilitate the quick return of individuals who previously resided in those countries, as well as stem migration at its source. DHS, in coordination with the Department of State, has regular discussions with partner countries in the Hemisphere on migration related matters and continues to engage with foreign governments to improve cooperation with countries that systematically refuse or delay the repatriation of their nationals.

Signed Migration Arrangement with Costa Rica to address irregular migration.
On March 15, 2022, Secretary Mayorkas traveled to Costa Rica where he joined President Alvarado in announcing a bilateral Migration Arrangement, outlining our shared commitment to both manage migrant flows as well as to promote economic growth in the region. DHS and the Department of State are currently engaged with other countries in the region to advance similar objectives.

Continuing close partnership with the Government of Mexico on migration-related issues.
The Biden-Harris Administration continues to maintain a close partnership between with the Government of Mexico to stem irregular migration, creating viable legal pathways, fostering legitimate trade and travel, and combating the shared dangers of transnational crime. In March, Secretary Mayorkas made his fourth official visit to Mexico City where he and President Andrés Manuel López Obrador committed to the promotion of lawful trade and travel and a regional approach to migration management.

 

What if?

As a sometimes law professor, “What if” is a question I can’t avoid!

The DHS “Fact Sheet” reads like an unprepared agency, planning to be overwhelmed by forces allegedly beyond their control, and looking for ways to shift the anticipated political fallout by blaming others: Congress, smugglers, foreign countries, COVID-19, the Trump Administration, and, in a particularly “low blow” the victims themselves — asylum seekers and other desperate migrants.

Let’s keep in mind that legitimate “refugees” have been largely “shut out” of our legal system for the past several years. Thus, many were left with little or no choice but to seek “do it yourself” refugee within our large “extralegal immigration subsystem.” Often they resort to smugglers and put themselves at increased risk after finding our borders closed to those orderly seeking protection under our laws. We have watched it unfold, and largely ignored the unsavory consequences of our own actions.

I’m certainly not the only one to see “planned disaster” for the Biden Administration on the horizon. Check out today’s WashPost lead editorial:

However, what if, with 51 days to go, advocates and NGOs could “flip the script” on “programmed failure” and make the asylum system at our border function fairly and efficiently, in spite of itself? 

What if the “anticipated narrative” of an out of control border never came to pass? What if the U.S. could actually make the rule of law a reality at the border? What if reopening legal ports of entry for asylum seekers, thereby eliminating the pressure for “do it yourself refuge,” actually helped the Border Patrol concentrate on smugglers and those without any legal claim to remain here?

That might involve getting an “army” of volunteers to the border to:

  • Convince asylum seekers to trust the new system and apply in an orderly fashion only at ports of entry;
  • Work with the DHS to insure that any processing lists are established and controlled by legitimate authorities;
  • Leverage the potential for more rapid asylum grants by Asylum Officers by representing applicants and assisting them in documenting and presenting their claims in formats that will facilitate more AO grants;
  • Represent those improperly denied by the AO before the Immigration Courts and use effective, “practical scholarship,” expert advocacy, and compelling documentation to force due process and fundamental fairness into an Immigration Court system and a 5th Circuit Court of Appeals historically biased against asylum seekers at our borders;
  • Counsel those prima facie unqualified for asylum and those rejected after applying on possible alternatives outside the U.S.;
  • Work with authorities, local communities, and NGOs to provide viable resettlement opportunities for those granted asylum and safe, secure, and non-intrusive temporary living conditions on both sides of the border for those awaiting legal processing;
  • Advocate to the DHS for establishment of robust, realistic, generous, credible refugee programs for Latin America, Haiti, and elsewhere to reduce pressure on the border asylum system. A “viable alternative” to appearing at the border for refugees is what’s glaringly missing from both our past and current approaches.

Can change really come from below and outside the struggling DHS and EOIR systems? Frankly, I don’t know. But, we’re going to find out in the next several months! We can’t change history, but, perhaps, we can rewrite the future!

Waves of migration through Mexico and Central America, and people who go missing, will increase in 2022 due to high levels of violence in the region, the International Committee of the Red Cross (ICRC) said.

Battle-scarred ghost town bears mute witness to Mexico’s drug wars

“In many countries, violence is wreaking more and more havoc, and that’s why there are more and more migrants,” ICRC representative Jordi Raich told Reuters in an interview Wednesday. “And it’s not a situation that is going to improve or slow down, not even in the years to come.“

Immigration authorities in Mexico detained 307,679 migrants in 2021, a 68% increase compared with 182,940 detentions in 2019, according to government data.

Shelters in Mexico were completely overwhelmed last year, filled with frustrated migrants unable to continue their journey to the United States, Raich said.

Many migrants get “stuck” along Mexico’s southern or northern borders, Raich said, where they face “enormous economic constraints” and are able to find only basic services.

The administration of Joe Biden has faced record numbers of migrants arriving at the southern border and has implored Mexico and Central American countries to do more to stem the wave.

Disappearances in the region have not slowed either, the Red Cross said in a report released Thursday. Mexico recently surpassed 100,000 people reported missing in the country.

In El Salvador, 488 missing person cases remain unsolved, and in Guatemala, the number of missing women rose to six a day, the Red Cross report said.

Raich said it will be difficult to respond to the root causes of migration immediately. A joint effort among countries like El Salvador, Guatemala and Honduras is necessary, he added.

“Migration is not going to stop,” Raich said. “If you try to prevent it or strictly regulate it, people start to pile up at the borders, which is happening in Mexico and other countries.”

Meanwhile, the Biden administration on Thursday rolled out a sweeping new regulation that aims to speed up asylum processing and deportations at the US-Mexico border, amid a record number of migrants seeking to enter the US.

The announcement of the new rule came as US officials are debating whether to end a separate Covid-era policy that has blocked most asylum claims at the border. The asylum overhaul could provide a faster way to process border crossers if the Covid order is ended.

Cruelty, walls, detention, family separation, border militarization, expedited hearings — they aren’t going to stop human migration. We will be able to increase border deaths, expand the scope of “black market migration,” increase our “underground population,” and enrich human smugglers.  Good policy? 

Meanwhile, it’s obvious that the “disingenuous internal debate” on Title 42 has nothing whatsoever to do with public health and everything to do with whether continued illegal and immoral suspension of asylum protections at the border will prove politically advantageous to the Biden Administration. It won’t! It might, however, cost Dems support among progressives.

How dishonest and unethical is the Biden Administration’s discussion of violating the law? (Do we actually have an Attorney General?) There is, of course, no known medical evidence that “single males” present a greater COVID threat than families! Indeed, there is no known medical evidence to suggest that any potential asylum applicant is a threat to the health and safety of the US.

The whole thing is a deadly farce! Why aren’t Hill Dems calling for oversight of Garland’s sitting by and watching while the law and ethics are pulverized around him? Or worse yet, what about his Department’s defense of abrogation of our laws? Believe it or not, we actually have asylum and protection laws on the books, duly enacted by Congress, although you’d never know it from Garland’s feckless performance!

Meanwhile, WashPost and other so-called “mainstream media” continue to hype stories about increased border pressure. So, continuing to violate asylum law is a viable alternative “strategy?” Give me a break! How is violating the law going to stop folks from fleeing deadly conditions in their home countries? It won’t, as the ICRC points out above!

What it will do, as also pointed out above, is kill more asylum seekers, subject them to rape, torture and other harm, enrich smugglers, and increase the extralegal population in the U.S.!

It also will increase those waiting in vain at the Southern Border for the reopening of a legal asylum system that has abandoned them! In the words of one expert:

“The conditions are squalid,” said Blaine Bookey, the legal director of the Center for Gender and Refugee Studies at University of California, Hastings College of the Law, who led a team interviewing dozens of families waiting in Tijuana for the federal government to lift Title 42. “There is real lack of access to sanitation, medical care, adequate food, all of the real basic fundamental necessities.”

“There have been some exceptions made for Ukrainians, which we’re happy to see, but the policy should be ended for everyone,” Bookey said. “There was never a public health justification, and there certainly isn’t now.” (WashPost, supra).

Meanwhile, back at the ranch, Sen. John Cornyn (R-TX) babbles nativist nonsense:

Sen. John Cornyn (R-Tex.) said at a committee hearing last week that the influx has “completely derailed” efforts to discuss improving legal immigration to the United States, which he said states such as Texas need to staff hospitals and fill jobs. Border states such as Texas and Arizona are bracing for higher numbers of unauthorized immigrants in coming weeks, he said.

“Rather than deter would-be migrants with weak asylum claims from taking the dangerous journey to the southwest border, the administration has rolled out the welcome mat and created new incentives to illegally immigrate to the United States,” he said at the March 15 hearing before the Senate Judiciary subcommittee on immigration, citizenship and border safety.

To my knowledge, neither Cornyn nor any of his other GOP nativist buddies have ever adjudicated an asylum application. Nor have they represented asylum seekers before the Asylum Office or in our broken Immigration Courts. So, how would that have any idea whether certain asylum claims are “weak” or not? They wouldn‘t!

Moreover, we haven’t had a functioning asylum system at our Southern Border for years. So, how would anyone know how many of the claims are  “weak?” They wouldn’t?

Remarkably, apparently unknown to Cornyn and his scofflaw buddies, we actually have laws to deal with his concerns. When the legal system is “open for business” — which it isn’t now — those claiming asylum at the border are subject to “summary exclusion” by DHS officers. Their claims are then expeditiously reviewed by Asylum Officers for a “credible fear” of asylum. Those who don’t establish credible fear, subject only to cursory review by an Immigration Judge, can be immediately removed by DHS.

Historically, when the system was at least nominally functional, those “passing” credible fear have been turned over to the now dysfunctional Immigration Courts. Under Trump, these “parodies of courts”  were “weaponized” into “asylum killing grounds.”

Sessions and Barr packed their non-independent “captive courts” with “judges” perceived to be “enforcement oriented” and “anti-asylum” — willing to skew the law and facts as necessary to deny and deport. This mess is “led” by an appellate body, the BIA, which contains some of the most notorious members of the “Asylum Deniers’ Club”  — folks who got their appellate jobs under Barr specifically because as Immigraton Judges they denied almost every asylum case that came before them! In other words, even when there was some semblance of a legal asylum system, it was redesigned under Trump to be systemically unfair to asylum seekers, particularly women and applicants of color. For sure, racism and misogyny played into this unseemly scenario.

Remarkably, Garland has chosen to maintain this dysfunctional, biased, and broken system largely in the form it existed and with almost all of the same unqualified or questionably qualified “judges” he inherited from Session and Barr!

Our broken asylum system can’t and won’t be fixed without dealing head-on with the overarching problem — systemic anti-asylum bias, poor quality decision-making, grotesque inconsistencies, and beyond incompetent administration of our Immigraton Courts by the DOJ!

Remarkably, Garland’s proposed solution is yet another “designed to fail” gimmick — expedite cases in his broken and biased, anti-asylum system! So the solution to a defective court system, infected with anti-asylum bias and poorly qualified judges turning out defective decisions is to make it “go faster!” The new regulations also fail to deal with the huge due process issue of lack of competent representation in the asylum system, particularly the Immigration Courts. Come on man!

We don’t need over 500 pages of new regulations and sophomoric, alternate universe “time limits” for an agency that can’t even find its files! What we need is for Garland to do the job he was hired to do more than a year ago! That’s  “clean house” at the Immigration Courts, bring in competent, fair judges who have experience in Immigration Court and are legitimate, well-recognized asylum experts — starting with a new BIA (save for their one qualified Appellate Immigration Judge Andrea Saenz, a Garland appointee).

Get expert judges, intellectual leaders, and competent judicial administrators into the broken Immigration Court system to provide coherent, practical asylum legal guidance and work with advocates, the Asylum Office, and DHS to get a functional and fair legal asylum system in place and operating smoothly and efficiently at the border. It should already be in place by now. That it isn’t, is entirely “on Garland!”

Then, with experts who actually are committed to fairly and impartially applying asylum law in place, we’ll see, for the first time, how many of the asylum claims are valid and how many aren’t! And, while we’re at it, we might find that many of the “legal” immigrants Texas and the rest of America needs are right there at our borders — just waiting for our legal system to do justice and admit them. Asylum seekers are seeking legal immigration! It the USG that’s acting “illegally” here!

Under Trump, asylum seekers sent to Mexico were often confused and adrift, unsure how to find legal help or return for their U.S. court appointments. They were visible on the streets of Mexican border cities and were easy targets for criminal gangs.

Marysol Castro, an attorney with El Paso’s Diocesan Migrant and Refugee Services who provides legal aid to asylum seekers in MPP, said the program’s return under Biden was a “relief” to some, “because otherwise if you go to the border you’re getting expelled” under Title 42.

Castro said new enrollees in MPP have court dates with fast-tracked hearings, unlike asylum seekers who were placed into the program under Trump and are still stuck in Mexico “with no hope.”

Mexican authorities say they received assurances from the Biden administration that migrants placed in MPP would have improved access to legal counsel. But despite the vastly lower numbers, there is still far more demand for pro bono legal services than nonprofit groups and charities can provide, Castro said.

More than two-thirds of MPP returns under Biden have been sent to Ciudad Juárez, where they are provided secure transportation through a State Department contract with the U.N. International Organization for Migration. The Mexican government houses them in a shelter set up in a converted warehouse in an industrial area of the city.

“The shelters are more restrictive,” said Victor Hugo Lopez, a Mexican official who helps oversee the program. “The migrants can request permits to go outside, but we try to keep them safe by keeping them inside.”

Dana Graber Ladek, the IOM chief of mission in Mexico, said her organization continues to oppose MPP on principle, even as it’s working with both governments to ameliorate conditions for those sent back.

“It still has a tremendous amount of negative impacts,” she said. “It’s not how asylum is supposed to work.”

Representation remains a problem, but also an opportunity, just as Nolan Rappaport said on The Hill! Fortunately, Professor Michele Pistone has been thinking in advance and has built a “scalable” program (VIISTA-Villanova) that already is turning out qualified grads who can become accredited representatives and could quickly be expanded. By coordinating scheduling of hearings with nationwide NGOs and pro bono groups and “leveraging” resources that might be available to get pro bono resources to the border without overtaxing them elsewhere with “Aimless Docket Reshuffling,” (“ADR”), the representation problem can be solved.

One good sign is that cases of those likely to be granted, Venezuela, Nicaragua, Cuba, have been prioritized which can help move dockets forward while reducing resource-wasting appeals and petitions for review. But, there is much more “low hanging fruit” here to be harvested, in my view:

  • Also prioritize many Haitian cases, domestic violence cases from Latin America, and family-based cases which, if represented and documented, should be relatively straightforward grants;
  • Replace the BIA with judges who are asylum experts and will issue the necessary positive guidance on granting asylum that will move dockets, promote consistency, and reduce appeals;
  • Why ignore the “waiting for Godot” cases left over from Trump’s intentionally “built to fail” program? Get them represented and scheduled for hearings;
  • End the failing and totally misguided “Dedicated Dockets” at EOIR. Instead, treat the MPP as the “Dedicated Docket;”
  • To keep backlog from further building, use ideas from the “Chen-Markowitz” plan to remove two “hopelessly aged” cases from the EOIR backlog docket for every MPP case “prioritized.” This could also free up some representation time. Go from ADR  to “Rational Docket Management” (“RDM”), closely coordinated with the private bar and DHS!    

Finally, keep in mind that directly contrary to the babbling of Paxton and other ignorant GOP White Nationalists, the purpose of asylum law is protection, not rejection! And, the generous standard of proof for asylum, recognized by the Supremes 35years ago, combined with existing regulatory presumptions of future persecution based on past persecution should, if honestly and expertly applied, favor asylum applicants (even if that hasn’t been true in practice). The U.S. legal system is supposed to be about guaranteeing due process fundamental fairness, and achieving justice, not to serve as a “deterrent,” “punishment,” or “enforcement tool.” 

In the case of MPP, everyone in the program has already passed initial credible fear or reasonable fear screening! That means with well-qualified Immigration Judges possessing asylum expertise, new expert BIA judges, competent representation, and a focus on insuring justice by DHS Counsel, many, probably the majority of the MPP cases should be grants of asylum of other protection. 

That will help clean out the camps, while addressing the serious “immigration deficit” that was engineered by Trump and Miller. It also allows refugees to become contributing members of our society, rather than rotting away and squandering their human potential in squalid camps in Mexico!

To date, most MPP cases have  been denied with questionable due process, little obvious expertise, and a complete lack of positive, practical guidance by the BIA. This strongly suggests severe shortcomings and bias in the DHS/DOJ implementation of Remain in Mexico (“MPP”). But, it’s never too late to do better!

The Post article suggests that there have been some modest improvements in MPP under Biden. It’s time to take those to another level! The ideas and tools are out there. All that’s missing is the dynamic leadership, teamwork, and competent, creative., due-process-focused focused management.

DEL RIO, Tex. — Thousands of Haitian migrants who have crossed the Rio Grande in recent days are sleeping outdoors under a border bridge in South Texas, creating a humanitarian emergency and a logistical challenge U.S. agents describe as unprecedented.

Authorities in Del Rio say more than 10,000 migrants have arrived at the impromptu camp, and they are expecting more in the coming days. The sudden influx has presented the Biden administration with a new border emergency at a time when illegal crossings have reached a 20-year high and Department of Homeland Security officials are straining to accommodate and resettle more than 60,000 Afghan evacuees.

The migrants arriving to Del Rio appear to be part of a larger wave of Haitians heading northward, many of whom arrived in Brazil and other South American nations after the 2010 earthquake. They are on the move again, embarking on a grueling, dangerous journey to the United States with smuggling organizations managing the trip, according to border authorities and refugee groups.

The arrival of asylum seekers at the Southern Border is predictable. Contrary to GOP right wing nativist BS, asylum seekers don’t present a significant national security threat to the U.S. 

On the other hand, Texas Governor Gregg Abbott and his GOP right wing crazies are a clear and present existential danger to our heath and security as a nation. Don’t let Abbott and his neo-fascist gang shrift the focus away from their lawless, stupid, and immoral behavior — with glaring racial overtones!

The current disorder is the direct result of Mayorkas and Garland not taking the obvious steps to re-establish credible fear screening at ports of entry and the lack of progressive leaders and judges at EOIR who could cut through the self-created backlog and establish and enforce fair precedents and procedures that would enable timely, yet fair and efficient, processing of asylum cases in Immigration Court for those who pass credible fear.

Instead, Garland has gone with inane, backlog-building, aimless-docket-reshuffling encouraging “gimmicks” like “Dedicated Dockets,” and ill-advised proposals to increase use of “expedited removal” and limit the rights of asylum seekers to de novo hearings, without instituting the major EOIR reforms necessary to make such a system credible.

So far, the results have been predictably chaotic and ineffective. By dragging their feet on elimination of the Title 42 farce initiated by Trump & Miller, Garland and Mayorkas now find themselves “between a rock and a hard place” because of District Judge Sullivan’s recent order finding the misuse of Title 42 to “orbit” asylum seekers to doom without any process was likely illegal.

A restored, fair, legal asylum system inevitably would result in the legal admission of more asylees. Again, contrary to the GOP blather, that is something 1) our law requires, and 2) our country needs. Running a viable refugee program for the Americas outside U.S. borders is also something that should already have been in operation and could reduce the necessity for irregular entries.

Restoration of the rule of law and morality at the border would also take the regulation of immigration out of the hands of smugglers and cartels and restore it to the Government. But, that requires both an understanding of the dynamics of human migration and the courage to do the right thing in making the system work — not as a “false deterrent” but as a fair, generous, efficient, and equitable system, led by and composed of progressive human rights experts.

In the wake of the DOJ’s decision to appeal Judge Sullivan’s order and reports that the Biden Administration will begin illegal deportations of Haitians back to danger zones in Haiti without any due process, 71 human rights organizations wrote a letter blasting the Administration’s actions.

Dear President Biden, Secretary Mayorkas, and Attorney General Garland:
In the wake of multiple federal court decisions holding that your administration’s policies are likely unlawful, we, the 71 undersigned organizations, are appalled that you have chosen to file a notice of appeal in the Huisha-Huisha litigation, resisting an order to process the protection claims of families with children who seek asylum. This decision serves as a particularly disturbing step in what is emerging to be a clear pattern of failure to uphold the refugee laws enacted by Congress. We write to urge you to immediately change course before you further tarnish this administration’s record and inflict even more harm on families, children and adults seeking our country’s protection. We call on the administration to immediately end its embrace, defense, and advancement of illegal and cruel Trump administration policies that harm families and people seeking protection and bolster xenophobic rhetoric by treating people seeking protection as threats. Instead, we urge your administration to restore access to U.S. asylum at ports of entry and also to immediately stop blocking and expelling asylum seekers and migrants to life-threatening dangers.
On September 16, a federal district court held that the government likely does not have authority under U.S. law to implement the Title 42 policy, which subjects people to “real threats of violence and persecution” by returning them to danger in Mexico or the countries they fled, and enjoined the use of the policy against families. Rather than respect human rights and restore asylum in compliance with this ruling, the administration has already filed a notice of appeal in this case. Earlier this month, another federal district court held that the government’s policy of turning back people seeking protection at ports of entry is likely unlawful under the Immigration

and Nationality Act. Your administration must reverse course and accept these court rulings, immediately take steps to restart asylum processing, and permanently end these policies, which were designed to deter and punish people seeking safety in the United States and betray our values and legal obligations towards refugees.
Rather than abiding by campaign promises to uphold the legal right to seek asylum and treat migrants humanely, your administration has embraced and escalated the unlawful Title 42 policy created by the Trump administration to use public health as a pretext to evade U.S. refugee laws. In August 2021, your administration issued a new Centers for Disease Control and Prevention (CDC) order extending the policy and relying on much of the same dangerous and false rhetoric that the Trump administration relied on in its CDC orders.
The human toll of the Title 42 policy during your first eight months in office is enormous. Since January 2021, there have been at least 6,356 public and media reports of violent attacks— including rape, kidnapping, trafficking, and assault—against people blocked from requesting asylum protection at the U.S.-Mexico border and/or expelled to Mexico. The U.N. Refugee Agency (UNHCR) and other international bodies have repeatedly condemned the use of Title 42 to return refugees to danger in violation of international law and urged the United States to restore access to asylum. Leading public health experts have warned the administration time and time again that the policy has no scientific basis as a public health measure and urged the use of rational science-based measures to process asylum seekers and migrants to safety. In its ruling enjoining the use of Title 42, the district court also emphasized that the government’s public health arguments were specious.
This month, the Department of Homeland Security (DHS) expelled dozens of Haitian families and adults to danger in Haiti under Title 42, despite ongoing turmoil following the assassination of the country’s president in July and a major earthquake in August, and flew more than 6,000 Guatemalan migrants and asylum seekers directly to the danger they had fled in Guatemala without an opportunity to apply for U.S. asylum. Since August, DHS has also expelled asylum seekers and migrants directly to southern Mexico, where Mexican immigration authorities forced them to cross the border into remote areas of Guatemala. These expulsions to southern Mexico sparked public condemnation from UNHCR, which warned that this practice “increases the risk of chain refoulement—pushbacks by successive countries— of vulnerable people in danger, in contravention of international law and the humanitarian principles of the 1951 Refugee Convention.”
We further call on your administration to take all necessary legal steps to end the Migrant Protection Protocols (MPP), most importantly by immediately making a public commitment to issue a new policy memo that provides a fuller explanation for the decision to terminate MPP and that resolves any perceived Administrative Procedure Act (APA) issues identified by the district court in its ruling requiring the government to restart this shameful program. The APA

was the singular concern cited by the Supreme Court in its decision upholding the district court’s preliminary injunction, and the administration’s failure to date to commit to issuing a new policy memo raises serious concerns over whether you intend to use the legal challenge as cover to backtrack on your commitment to fulfill your campaign promise to end MPP.
During the two years that MPP was in effect, there were over 1,500 publicly reported cases of violent attacks against people returned to Mexico, including asylum seekers who were brutally murdered. In addition to subjecting individuals to life-threatening dangers under MPP, the program violated the due process rights of asylum seekers and migrants by stranding them in Mexico without access to legal counsel, forcing them to risk their lives to attend their court hearings—there have been numerous reports of asylum seekers in MPP being kidnapped while attempting to reach immigration court—and requiring many to prepare their cases while facing unrelenting fear and insecurity. It is clear that there is no way to make MPP lawful, humane, safe, or rights-respecting. The administration should take all lawful and necessary steps to preserve the MPP wind down and continue processing individuals previously subjected to MPP into the United States while taking immediate steps to address the District Court’s concerns to terminate the policy once and for all.
Policies that turn back, block, expel, and force asylum seekers and migrants to wait in danger are unlawful, as now confirmed by multiple federal courts, and we entreat your administration to immediately stop inflicting violence on people seeking safety in our country by permanently ending these policies and restoring asylum in compliance with U.S. and international refugee laws.

Dear Mr. President:

I write today to appeal to your sense of morality, human dignity and as a fellow Catholic. While the Supreme Court has blocked your efforts to rescind the Migrant Protection Protocols (MPP), better known as the “Remain in Mexico” policy, while litigation against it proceeds through the court system, I urge you to act. These legal complications, and our backlogged immigration courts system, cannot become an excuse to strand thousands of people in dire conditions, especially when other options are available.

I know from firsthand experience just how desperate the situation is. MPP was implemented in my community in early 2019. Its effect was to force thousands of people into a makeshift “tent city” along the Mexican side of the Rio Grande river as they awaited rulings on whether they would be granted asylum.

I would visit the camp almost every single day. It was a blessing that hundreds of compassionate Americans crossed the border between Brownsville, Tex., and Matamoros, Mexico, several times a day to bring tents, food, clothing, and to tend to these families’ medical needs and legal issues. While supported by the good nature and assistance that staff and others provided, I often worried about how the women, men and children at the camp could survive in such conditions. How could they stand the scorching heat of our region’s hot sun or the occasional torrential downpours that turned their encampment into a mud pit?

The lack of care for humanity and the sounds of human misery accompanied me daily as I moved through the camp. I know that reports of these conditions have reached your ears, too: I met your wife, Jill Biden, here in 2019 as she donned rubber boots to wade through the mud and see for herself the misery in which asylum seekers, including many women and children, lived for as long as two years.

So, I rejoiced when you declared an end to this immoral policy on your first days in office, and despaired when the Supreme Court required your administration to implement it once again.

I pray for the Supreme Court justices as I do for all leaders. But in my heart, I know that surely, we can do better than return to the conditions and suffering I witnessed in 2019.

I invite you to come and see for yourself, as your wife did in 2019, what is happening on the border. There are many layers to the immigration realities behind the strident political rhetoric that dominates and obscures the issue today. But we must find ways to counter what Pope Francis calls a “globalization of indifference.”

Mr. President, please demonstrate to the world that the words of Jesus — whatsoever you do to the least of my brothers, you do unto me — are the foundation of not only our faith, but of the moral structure of our country.

REYNOSA, Mexico — When Joe Biden was running for president, he promised to close a squalid border tent camp in Mexico where thousands of migrants had been left to await the outcome of their immigration cases by the Trump administration.

Last spring, Biden emptied the camp, allowing most of the migrants to claim asylum and enter the U.S. even as his administration continued enforcing a Trump pandemic policy that effectively barred most other asylum seekers.

Soon after the Matamoros camp was bulldozed last March, a new camp formed about 55 miles west across from the border bridge to the more dangerous, Gulf crime cartel stronghold of Reynosa. Now that camp and another in Tijuana are home to thousands of asylum seekers, many with spouses and children in the U.S. They’re expected to grow after federal courts reinstated Trump’s so-called Remain in Mexico program last week, making it even harder for asylum seekers to enter the U.S. legally.

“We all thought this would get better when Biden got the presidency,” said Brendon Tucker, who works at the camp clinic run by the U.S.-based nonprofit Global Response Management, which also ran a clinic at the Matamoros camp.

Instead, he said, Biden’s pandemic ban on asylum claims, “is creating worse conditions in Mexico.”

A White House spokesman declined to comment about the migrant camps, referring questions to the Department of Homeland Security.

Homeland Security said in a statement that, “This administration will continue to work closely with its interagency, foreign, and international organization partners to comply in good faith with the district court’s order [on Remain in Mexico] while continuing our work to build a safe, orderly, and humane immigration system that upholds our laws and values.”

In Reynosa, where about 2,000 migrants were living last week, conditions are in many ways worse than they were in Matamoros, Tucker said. There’s less potable water, fewer bathrooms, showers and other sanitation that U.S.-based nonprofits spent months installing in Matamoros. Mexican soldiers circle in trucks with guns mounted on top. Migrants face not only cartel extortion and kidnapping, but also COVID-19 outbreaks and pressure to leave from Mexican authorities. Fewer U.S. volunteers, including immigration lawyers, are willing to cross the border to help due to security concerns. Few at the camp understand their rights and U.S. pandemic restrictions, although they say they asked U.S. Customs and Border Protection agents about them before they were expelled.

“They didn’t tell us anything, they just left us here,” said Salvadoran migrant Emerita Alfaro Palacios, 34, who’s been living at the camp with her 17-year-old daughter Pamela since June, hoping to join her brother in Houston.

Migrants call the camp Plaza Las Americas, the name of the park it occupies. The first to arrive last spring holed up inside the central gazebo. Those who followed pitched tents outside, their warren of droopy tarps and clotheslines expanding daily. Gone were the mariachis who used to congregate in the park, in the shade of a dilapidated casino that still draws throngs on weekends. Last week, only the gazebo’s spindly roof was visible, like the center of an enormous, patched circus tent. Taxis and vendors still circled, selling fruit popsicles, tacos, pupusas and other dishes catering to hungry migrants, mostly Central Americans. Many said they came to the border hoping Biden would allow them to claim asylum. Some had seen reports about how he helped those at the camp in Matamoros.

Many Reynosa residents and officials consider the camp an eyesore.

Standing on the roof of a nearby building overlooking the camp last week, maintenance worker Hector Hernandez Garrido, 33, said it was the responsibility of the U.S. to accept the asylum seekers. He said he feared the camp was contaminated by COVID-19 and other diseases.

Two weeks ago, Reynosa authorities removed cook stoves from the camp kitchen, citing safety risks. They pressured U.S. volunteers to stop cordoning off a section of the camp for migrants who had tested positive for COVID-19, and have threatened to cut the camp’s electricity and water supply.

“They want us out,” said Gina Maricela, a Honduran single mother and nurse at the GRM clinic.

It’s not clear where the migrants would go. Last month, Reynosa officials also launched a legal battle to demolish the city’s primary nonprofit migrant shelter, already home to hundreds, arguing it lies in a floodplain. Felicia Rangel-Samponaro, who has been crossing the border daily to help migrants at the Reynosa camp through her nonprofit Sidewalk School, said they rented a 20-room hotel for those who are COVID-positive to quarantine. They may build a new camp, she said, but that would take weeks and cost tens of thousands of dollars.

“It’s exactly like Matamoros, but with less support,” Rangel-Samponaro said. “Cut what you like, that’s not going to stop the encampment.”

As in Matamoros and other border cities in the surrounding Tamaulipas state, it’s not city officials or even migrants who ultimately control the plaza — it’s the cartel. Migrants who enter or leave the city without paying a smuggler risk getting kidnapped and held for ransom. So do those who leave the camp, even for a few hours to shop or look for work.

Honduran migrant Lesly Pineda, a factory worker, said she and her 11-year-old son Joan were kidnapped with eight other migrants in July and released only after she paid a $2,000 ransom. A single mother, Pineda, 33, then took her son to the border and sent him across the Rio Grande with a smuggler. He remained at a federal shelter in Texas last week, she said. She had left her two oldest children, ages 15 and 14, with her mother in Honduras.

The Trump kakistocracy considered the legal asylum system to be a “loophole” in their White Nationalist agenda. So, they just overtly violated the law. Thanks to an indulgent “Dred Scott” Supremes’ majority, they largely got away with it!

The Biden Administration considers complying with asylum laws, due process, and the rule of law, essentially a “political option” that they are working on (slowly, and incompetently).  

In the meantime, they simply continue the Trump Administration’s illegal policies. Because, hey, it’s not real humans whose rights, lives, and humanity are being stomped upon here. Just “foreign nationals” and mostly “people of color” at that. Let ‘em continue to twist in the wind, while the Administration gets its act together. That’s particularly convenient if it’s happening south of the border where, except for a few courageous folks like Molly and some NGOs and religious workers, the human trauma is largely “out of sight out of mind.” 

If all else fails, we can always blame Trump. Like Trump, Biden has largely ceded control of southern border policies and migration from Latin America to cartels, smugglers, and traffickers. When the legal system fails, the underground and the black market take over. 

I don’t think that there is any doubt that restoring the legal asylum system and actually, for perhaps the first time, administering it fairly, lawfully, generously, and with competent expert Asylum Officers and Immigration Judges (“new blood” required) would result in a substantial number of border arrivals being granted legal asylum or other forms of protection. 

We’d actually be able to screen individuals, know who we have admitted, where they are going, have them in possession of legal work authorization, in a position to pay taxes, and in many cases have them on a path to eventual full integration into our society. And, by all legitimate accounts, after four years of Trump’s legal immigration disaster and a falling birth rate, we certainly can use more legal immigration. 

Instead of looking at asylum seekers as a self-defined “problem,” why not look at saving them and integrating their skills and undoubted courage, energy, and perseverance into our society in a constructive manner as an “opportunity?” Because, that’s exactly what it is!  

Human migration will continue, as it always has been, to be a major force in the 21st Century. “Smart money” is on the countries that best learn how to adapt and take advantage of its realities and embrace its opportunities as the “winners of the future.” 

Given a fair, functional, generous system, many asylum seekers would be motivated to apply in an orderly fashion at ports of entry, or even abroad (if we actually had a robust functioning refugee program for Latin America, which we don’t). With an honest system that treats them fairly, listens carefully, and provides reasoned understandable decisions, even those who don’t qualify would be more likely to accept the result and consider constructive alternatives.

If the U.S. stepped up, fulfilled our legal obligations, and set a good example, other countries in a position to accept refugees and asylum seekers might also be motivated to improve their performance. 

But, what we’re doing right now to those we falsely promised to treat fairly won’t be swept under the carpet forever. Historians are likely to highlight the cowardly abrogation of our legal duties to refugees and asylum seekers, by Administrations of both parties, as a  low point in the American story.

And, here’s my “quick take:”

At first glance, this could potentially be a workable system, with some favorable aspects:

* Restores properly generous credible fear standard;

* Allows AO to grant well-established cases in first instance, even at the credible fear level, without referral to EOIR;

* Retains EOIR review of both credible fear and asylum denials;

* Doesn’t appear to affect pending and affirmative cases;

* Retains access to Circuit review of denials.

But, as with most things, the devil 👹 is in the details. And, personnel, leadership, direction, and accountability are absolute keys to success.

Without:

1) More and better Asylum Officers;

2) Far better training at the AO and EOIR (see, Michele Pistone);

3) Better IJs with proven expertise in asylum law and a demonstrated willingness to grant relief to worthy cases;

4) An entirely new BIA of progressive asylum experts to provide leadership, positive precedents, and accountability for both credible fear reviews and de novo asylum reviews;

5) An agreement with the private bar as to where and on what schedule these cases are to be heard, to achieve universal representation (see, Michele Pistone and VIISTA); and

6) Agreements with NGOs re housing, care, employment assistance to take pressure off particular communities;

this proposal appears to be “headed for failure.”

I can’t glean any of those essential characteristics from this NPR.

In their absence:

1) There are likely to be huge discrepancies in AO decisions;

2) Many current IJs, particularly from border areas, will simply “rubber stamp” both credible fear and asylum merits denials from the AO to keep the EOIR dockets moving and “make quota” (Lucas Guttentag, where are you?);

3) “Rubber stamping” of asylum denials is also endemic at the BIA, as currently comprised;

3) The current BIA will be reluctant to issue positive asylum precedents (not sure they even know how or have the ability to do so) and will likely concentrate on instructing AOs and the IJs on how to deny asylum or credible fear and have it stand up on review;

4) The private bar will be unable to keep up with the pro bono demand, causing many applicants to be unrepresented or underrepresented;

5) Asylum applicants will be concentrated in particular communities, often near the border, who will complain about the burdens being inflicted upon them by the Feds.

In other words, without better, expert, progressive leadership at both DHS and DOJ, and without major changes in personnel and training, this program will rapidly become a disaster, like other “streamlining” efforts that do not deal realistically with the practical aspects of implementation, particularly the qualifications, attitude, “culture,” and training of those making the actual decisions! A continuing lack of progressive leadership and expertise at the “retail level” will likely lead to widespread injustice, inconsistency, and eventually protracted litigation.

I am also concerned that the NPR appears to take the current 1.4 million case EOIR backlog (actually under-stated in the NPR as 1.3 million — Garland has grown it almost as rapidly as Barr-Sessions) as a “given.” But, there are readily available ways to dramatically slash this backlog by perhaps as much as 90% (see, Chen & Moskowitz plan) which would allow both IJs and the BIA to work on these cases “in real time” WITHOUT creating yet more “Aimless Docket Reshuffling” at EOIR (as the NPR, without the changes outlined above, is highly likely to do).

This leads me to reiterate Casey’s cosmic question: “Can’t anybody here play this game?” Ironically, there are many “all-star players” out here in the real world who can and would be “winners.” But, for whatever reason, to date, this Administration has unwisely chosen to leave most of them “on the sidelines” rather than giving them bats and gloves and putting them in the game. ⚾️ That’s painfully obvious at DOJ! What Does “Credible Fear” Really Mean?

A FEW MONTHS BEFORE COVID-19 descended, I spent a week in Dilley, Texas, as a volunteer attorney at the South Texas Family Residential Center, which is essentially a holding center, specifically for women and their children. It’s the last stop before expedited removal and the place where many women and children are sent once they’ve claimed fear of persecution for the purpose of applying for asylum, or for those who have also been apprehended internally.

I was working with asylum seekers at the Mexican border port of entry, where people were held without answers for weeks, even months, while they awaited the next step in their asylum claims: the credible fear interview. If asylum seekers, fleeing persecution in their home countries, declare their fear of returning, they are detained as they await this interview, which will determine whether they can proceed to the next step: appearing before an immigration judge to request asylum. The conversation leads to a proverbial thumbs up or down, a trip to a courtroom or the border they just fled. If an asylum officer determines that their story has objective elements of credible fear, they may proceed to the next legal step. Officers essentially check required elements off a list, including what the specific act of persecution is, if the asylum seeker knows the reason why she’s been persecuted, how many times it happened, if she has sought help to remediate it, and more. In other words, asylum seekers’ lives depend on the hour or so answering questions spent either in a small room or, more likely, over the phone with a government official and interpreter.

Right now, our country again faces a critical point in defining our identity: are we in fact a country founded on freedom and designed to welcome those in need? The Biden administration states that it aims to help asylum seekers, but in order to do so we need to reevaluate how we approach asylum at all levels. That begins with reassessing how we determine credible fear.

During my brief time working in Dilley, I helped women prepare for their credible fear interviews. Many asylum seekers might not understand the process, nor necessarily know which details of their stories determine what the United States has deemed credible fear. Asylum is not a guaranteed right, and attorneys are not permitted to help during the interview; thus, preparation is key.

I spoke with a woman who fled five countries to escape her abusive boyfriend. The man followed her from country to country, raping her and threatening her life in each country. No matter where she fled in South and Central America, he followed her. Her five-year-old son, a product of one of these rapes, held her hand during our conversation in the detention center. I spoke with another woman who was threatened by a well-known drug cartel. Through her tears, she could barely communicate to me that they had already killed her brother, taken her money, patrolled the school where she taught, and routinely policed her town, spitting bullets as easily as words. As I interviewed the women, they cradled their young children, who were also visibly traumatized by what they had experienced in their home countries, by their journeys to the United States, and finally by the process to gain safety on this side of the border.

The credible fear interview places the burden of establishing fear on the applicant and is supposed to be non-adversarial, but given the nature of everything that precedes the interview — the lack of representation during the process, the jail-like location in which it takes place, the asylum officer’s constant questions — it feels adversarial. And this is just the first step. If the officer determines that she does have credible fear, the next step is to present her case to an immigration judge in a proper hearing.

Sadly, and completely unnecessarily and inappropriately, there is nobody in a leadership position at DOJ right now with Elizabeth Silver’s practical insights and understanding of our broken asylum system and how it can be fixed! I’ll bet that neither Garland nor anyone on his senior staff has spent a week at Dilley or any comparable site in the “New American Gulag” trying to represent vulnerable asylum seekers in Garland’s “wholly owned star chamber courts.”

Has Garland even taken the time to observe what’s happening in Dilley, Pearsall, Texas (“home of the Big Peanut”); Jena, Louisiana; Lumpkin, Georgia (“where asylum cases go to die”), or any of the other comparable “courts” (that don’t function like “courts” at all)? Has he ever spoken to asylum applicants and their pro bono lawyers trying to negotiate his fatally flawed and intentionally “user unfriendly” system? Has he gone out and hired progressive “practical scholars” to fill in his “blind spots?”

That says loads about AG Merrick Garland — none of it good! “Ignorance,” “intransigence,” and “good enough for government work” are not acceptable approaches for the Biden Administration! Yet that’s exactly what Garland has “delivered” on immigration, human rights, racial justice, and gender equity during his first three months at “Justice.”

Of course it’s adversarial! Totally, these days! 

The White Nationalist racists in the Trump regime like Miller, “Gonzo” Sessions, “Wolfman,” “Cooch Cooch,” and “Billy the Bigot” hated asylum seekers, people of color, and women and “biased out” the system and selection processes accordingly. Heck, in clear violation of the statute, Trump even replaced USCIS Asylum Officers with totally unqualified Border Patrol Agents to insure denial of even the most compelling claims!

Sessions bogusly bellyached about too many individuals passing “credible fear.” To the contrary, this was totally appropriate, given the “super generous” standards that are supposed to be applied at the “access to the system gateway.” The real systemic problem was in the historically poor performance of the Immigration Courts on asylum grants that got immeasurably worse under Sessions and Barr. (And has remained beyond horrible under Garland’s non-existent “leadership!”)

As almost all legitimate human rights experts would confirm, the “high rejection rate” later in Immigration Court results from far, far, far too many unqualified, non-expert, improperly selected, poorly trained, Immigration “Judges” — at both the trial and appellate levels — operating in a “culture of institutionalized racism, misogyny, and default denial” rather than the generous atmosphere and culture required by the Supremes in INS v. Cardoza-Fonseca but never truly implemented at EOIR.

“Herculean” although the task might appear, there are thousands of well-qualified immigration and human rights experts, most of them in the private sector right now, who could solve this problem and establish due process, fundamental fairness, real asylum expertise, and the rule of law in short order. But, Garland and Mayorkas have failed to remove the deadwood and the Trump/Miller holdovers and have not brought in the expert problem solvers to get this currently deadly, defective, illegal, and blatantly unconstitutional system under control. Additionally, qualified, expert Immigration Judges, REAL independent, courageous Federal Judges, not “go along to get along “bureaucratic retreads,” could also train and effectively supervise the Asylum Officer Corps, rather than woodenly and often ignorantly “rubber stamping” defective denials of “credible fear.” 

Incredibly, Garland aggravated this festering problem “right off the bat” by improperly hiring 17 new, non-expert, not judicial quality Immigration Judges from flawed recruitments, skewed lists, and bogus recommendations developed by “Billy the Bigot” Barr! What an amazing lack of awareness and “open dissing” of humane progressive values and commitment to quality in Government!

Does this group represent the type of diverse, progressive candidates that President Biden would nominate for Article III Judgeships? OF COURSE NOT! Then, what possible excuse is there for “gifting” them some of the most powerful and important Federal Judgeships — those with probably more “life or death” authority and discretion over individuals than even the Supremes?  No excuse whatsoever! 

Our asylum system is totally “fixable.” Immediate improvements can be made and noticeable systemic changes could and should be in place before the end of this year! But, not the way that Garland and Mayorkas are going about it! The deadwood needs to go NOW, and be replaced with expert, progressive leadership, judges, and adjudicators!

I wake every morning to follow news of our sisters and brothers, thinking especially of the children, who have set out from places like El Salvador, Guatemala, Honduras, Venezuela, Cuba, Nicaragua and Haiti–even as far as Cameroon and the Democratic Republic of the Congo–to seek protection at our doorstep. My heart aches for them and I pray for their safety.

Today’s readings remind us of our obligation, as followers of Christ, to speak the truth and follow the light. The truth is that people are suffering, both young and old, and desperately seeking safety and welcome in our country. Yet U.S. authorities and policies are often hostile to receiving them. Their arrival at our doors is deemed a “crisis.” As followers of Christ, we must and we will stand up, act bravely and generously, to speak the truth and welcome them.

The real crisis is not at the border, but within the families forced to make the difficult decision to leave, and in the hearts of those who refuse to follow Jesus’ light.  We, as Christians, must walk in the path of light as Jesus instructs, and do the right thing.  We must make room at our table and remember that we all belong to each other. We must take Jesus’ words to heart and remember to love the mother, the father and the child at the border as if they were our own.

This is not a crisis for us, although it certainly is for the men, women, and children who are fleeing. For us it is an opportunity to act out our faith precisely as Jesus taught.

As these sojourners leave their homes in search of safety, they may repeat a prayer similar to this: “Even though I walk in the dark valley I fear no evil; for you are at my side.” The rhythm of the words and their meaning must comfort them, knowing that God is their companion. What happens when they arrive here is up to us. We could look to God and ask what He would do, but we already know the answer.

Unfortunately, too many folks promote a bogus picture of what’s at stake at our border. The “alternatives” they trumpet are basically increasing family separation and suffering in Mexico or somewhere else as pointed out in this Politico article by Jack Herrera:

The result is a new form of family separation — but instead of happening at the hands of federal agents in American government facilities, it’s taking place, family by family, in camps like the one Janiana lives in. The fact that minors won’t be expelled like everyone else has rapidly spread by word of mouth across the length of the border. And while many families choose to stick together, the pressure to separate weighs heaviest on the most vulnerable — families who fear death, whether from persecutors who have followed them to the border, or from extreme hunger.

For Janiana, the possibility of being sent back to Honduras reads as a death sentence. She shows me the scars from her torture at the hands of a powerful gang back home that her family got on the wrong side of. Fearing further reprisals, Janiana fled with her sister’s children, a teenage nephew and teenage niece as well as the niece’s several-month-old son. The children haven’t been reconnected with their mother yet, who successfully entered the U.S. to begin the process of claiming asylum in 2019, before the pandemic. Staying in Mexico, Janiana says, was never an adequate long-term solution and increasingly feels intolerable. She says the family already tried to make a new life in the southern state of Oaxaca, but danger pursued them there, where her nephew was murdered.

Today, Janiana says her only hope is that the U.S. will begin to accept asylum seekers again, especially as the country gets a better hold over the pandemic. At the moment, she says with resignation, “all we can do is wait.” Though there is one painful exception on her mind: If she were somehow able send the baby across alone, he might be allowed to stay.

“It breaks my heart to even think about it,” she says.

Here’s an idea!

Why not get the trained Refugee Officers, Asylum Officers, Immigration Judges, ORR child services officers, and pro bono lawyers in place to comply with our legal obligations in a robust, timely, fair, and efficient manner?

Why not put experts, like Wendy Young of Kids in Needs of Defense, who understand how our system should work in charge of the welfare of the children? Why not put someone who understands the practical and legal needs at the border, like former Immigration Judge Ilyce Shugall, in charge of the Immigration Court response? Why not put someone like retired Judge Paul Grussendorf, who has also been an Asylum Officer and a UNHCR representative, in charge of the Asylum Office response? Why not put retired Assistant Chief Immigration Judge Robert Weisel, who worked with the UNHCR after retirement, in charge of coordinating the response with NGOs and the private sector?

Yes, the Trump regime definitely left a dismantled and dysfunctional immigration bureaucracy and structure behind. But, just repeating that time after time sounds more like an excuse than a plan or a solution.

Sure, it won’t happen overnight. But, it won’t happen at all without different folks in charge at the “retail level.” I see little evidence of any progress on a real long-term plan and the short-term response is also an unnecessary mess, given that the Biden Team has had more than four months since the election to get a new structure and new personnel in place.

While there are a few “bright spots,” like Michelle Brané and Katie Tobin, I sincerely doubt that the group in charge right now is capable of solving the practical problems in rebuilding and improving our asylum and immigration systems. Nowhere is that more obvious than at EOIR, where the dysfunctional “clown show” 🤡 stumbles on, for no apparent reason.

Many of us keep trying, to no avail, to warn Judge Garland that he literally is sitting on a powder keg with the fuse lit and burning.💣 I guarantee that the next “manufactured crisis” will be when the current group of asylum cases coming from the border hit the broken, dysfunctional, ridiculously and unnecessarily backlogged, grotesquely mismanaged, ill-prepared, and anti-asylum-biased “Immigration Courts.”  Waiting for the inevitable disaster, rather than bringing in a new “A Team” from the NDPA to start solving the problems now, is a monumental mistake by Judge G.

Why not fix the system to run the way it should, rather than spreading myths, throwing spitballs, and ignoring the unfolding human tragedy that can’t be solved with draconian enforcement and lame “don’t come” messages directed at forced migrants fleeing for their lives?

The Department of Homeland Security (DHS) is reportedly drafting plans to transform family migrant detention centers in South Texas into screening hubs as the Biden administration faces a growing number of migrants at the southern border.

The Washington Post, which obtained internal DHS draft documents outlining the plans, reported Thursday that senior ICE official Russell Hott informed staff in an email this week that the number of unaccompanied minors and families arriving in the U.S. in 2021 is “expected to be the highest” recorded “in over 20 years.”

According to the Post, Hott added that with more than 500 family members arriving per day, the shift from detention to Ellis Island-style processing centers “may not be sufficient to keep pace with apprehensions,” with the potential for some migrants to be housed in hotels.

DHS officials, who spoke to the Post on the condition of anonymity because they were not authorized to speak publicly, said the transition to rapid processing and release centers has already begun.

The reported change comes as the latest move in President Biden’s efforts to reform the U.S. immigration system and keep up with the rising number of migrants crossing into the country amid shortages of bed space and personnel at detention centers.

The reported plans also mark a shift from policies under the Obama and Trump administrations, when most migrant families were quickly released or deported upon arriving in the U.S., with some being held in dormitory-style centers for extended periods of time as they awaited immigration proceedings.

The Biden administration has publicly said it is reviewing how family detention facilities are used, though the Post noted that the administration last week told a federal judge that the policies had not yet changed.

SAN DIEGO (AP) — The Biden administration on Friday announced plans for tens of thousands of asylum-seekers waiting in Mexico for their next immigration court hearings to be allowed into the United States while their cases proceed.

The first of an estimated 25,000 asylum-seekers in Mexico with active cases will be allowed in the United States on Feb. 19, authorities said. They plan to start slowly with two border crossings each processing up to 300 people a day and a third crossing taking fewer. Administration officials declined to name them out of fear they may encourage a rush of people to those locations.

The move is a major step toward dismantling one of former President Donald Trump’s most consequential policies to deter asylum-seekers from coming to the U.S. About 70,000 asylum-seekers were enrolled in “Remain in Mexico,” officially called “Migrant Protection Protocols,” since it was introduced in January 2019.

On Biden’s first day in office, the Homeland Security Department suspended the policy for new arrivals. Since then, some asylum-seekers picked up at the border have been released in the U.S. with notices to appear in court.

Earlier this week, Press Secretary Jen Psaki appeared to say it would take weeks if not months for the Administration to develop a plan to dismantle “Remain in Mexico.”

These are all individuals who have been previously screened and found to have a “credible fear” of persecution by a USCIS Asylum Officer. Many have been waiting for hearings for more than one year and have had their hearings postponed by EOIR time after time.

Additionally, many of  the Immigration Judges assigned to the “Remain in Mexico” Program have notoriously high asylum denial rates, some approaching 100% denials.

I sure hope that the Pro Bono Bar is working with USCIS and EOIR to insure that all of these individuals are represented. As we know, that’s the key not only to insuring court appearances, but also to increasing the chances for success on the asylum application.

Vigorous representation of asylum seekers will also be the key to dismantling the aggressive anti-asylum, anti-due-process “jurisprudence” that the defeated regime attempted to implement at a “weaponized” EOIR. Where necessary, these cases must be litigated to the Courts of Appeals and used as examples of the pressing need for reform of the broken, unfair, and dysfunctional U.S. Immigration Courts.

For now, it remains unclear what will happen to newly arriving asylum applicants. Will they receive the “credible fear” screening to which they are legally entitled? (It appears that some families applying for asylum have been screened and released to await hearings in the U.S.) Or, will they be arbitrarily returned to harm’s way with no process at all, pursuant to Stephen Miller’s bogus “CDC border closing order” that has yet to be repealed?

Progress! But still lots of confusion at the border as a result of the defeated regime’s extralegal shenanigans!

Still, dismantling the mess Miller left behind shouldn’t be rocket science. Just common sense and using the existing legal tools to solve human problems, rather than intentionally aggravating them. But, it will take different folks (experts) in charge to make it happen!
